SOCIAL SERVICES CURRENTLY EMPLOYS FIVE LICENSED SOCIAL WORKERS AND FOUR CASEWORKERS AND WE MAY HAVE A FEW OTHER SOCIAL WORKERS OR RETIRED SOCIAL WORKERS FROM OTHER DEPARTMENTS OF THE COMMUNITY AND THAT SOUTH TEXAS SOCIAL WORKER SOCIETY JOINING US AS WELL. IN LINE WITH WHAT THE PROCLAMATION STATED, THE MISSION STATEMENT OF NUECES COUNTY SERVICES IS TO PROVIDE SERVICES FOR VULNERABLE RESIDENTS TO MEET BASIC HUMAN NEEDS AND PROMOTE SELF-SUFFICIENCY. WE HAVE HEARD A LOT OVER THIS COURT FOR THE PAST COUPLE OF MONTHS BY PROVIDING HELP TO THE HOSPITALS AND COUNTY OUTREACH AND WELLNESS PROGRAM AND WE HAVE SEEN THE COURT PROVIDE MUCH NEEDED ASSISTANCE TO FAITH-BASED ORGANIZATIONS AND NONPROFITS THROUGH CONTRACTS THAT ARE, QUOTE, WRITING SUPPORT TO COUNTY RESIDENTS WHO ARE HUNGRY FOR, WORKING FOR, ELDERLY, DISABLED, OR MAY BE AT RISK FOR HOMELESSNESS. AND I WOULD JUST LIKE TO REITERATE THAT THOSE ARE THE SAME CLIENTS THAT WE SERVE EVERY SINGLE DAY. WE ARE GLAD TO SEE THE COURT ADVERTISING AND SUPPORTING THE NEEDS OF OUR VULNERABLE COMMUNITY MEMBERS. THE LATE JUDGE, NEIL, ALWAYS REFER TO SOCIAL SERVICES PROVIDED BY THE COUNTY AS THE SAFETY NIGHT NET OF THE PEOPLE WHERE CITIZENS CAN TURN TO WHEN THEY REALLY NEED HELP. THOSE OF US WORKING IN SOCIAL SERVICES GOTTEN TO THE PROFESSION TO HELP PEOPLE, ESPECIALLY THOSE WHO ARE STRUGGLING AND FINDING IT ETHICAL TO PULL THEMSELVES UP.

THEY MERELY DEALING WITH SUBSTANCE ABUSE, MENTAL HEALTH, MEDICAL ISSUES, DOMESTIC VIOLENCE, FOOD INSECURITY, HOMELESSNESS, OR DEATH. WE WANT TO HELP GIVE PEOPLE A HAND UP FOR SAFETY AND SELF-SUFFICIENCY TO IMPROVE THEIR SITUATION. SO, AGAIN, WE WOULD LIKE TO THANK THE COMMISSIONERS COURT FOR ITS 40 PLUS YEARS OF SUPPORT FOR THE SOCIAL SERVICES DEPARTMENT AND I KNOW WE HAVE SEVERAL OTHER SOCIAL WORKERS HERE THAT HAVE SIGNED UP FOR PUBLIC COMMENT SO, THANK YOU AGAIN FOR YOUR SUPPORT AND THANK YOU TO ALL OF OUR SOCIAL WORKERS AND OUR SOCIETY WHO IS HERE TODAY TOO.

>> HI. MY NAME IS ANGELICA GARCIA AND I AM A SOCIAL WORKER IN THE LOVE SAID OFFICE. I LIVE AT 2057 ACRE DRIVE COURT STREET A 210. I STARTED WITH IT -- TO HELP SERVE THE RESIDENTS OF NUECES COUNTY. I GRADUATED FROM TEXAS A&M UNIVERSITY KINGSVILLE WITH A BACHELORS IN SOCIAL WORK. I GIVE CREDIT TO THIS DEPARTMENT AS IT HELPED ME GAIN EXPERIENCE I NEEDED TO PASS MY LICENSING EXAM. MAY IN THIS YEAR WILL MARK NINE YEARS OF BEING A LICENSED SOCIAL WORKER WITH THE DEPARTMENT. I ENJOY WORKING FOR SOCIAL SERVICES AS IT ALLOWS ME TO WORK WITHIN THE RIDE RANGE OF PEOPLE. WE ASSIST CHILDREN, THE ELDERLY, THE DISABLED, THOSE IN DOMESTIC VIOLENCE SITUATIONS, JUST TO NAME A FEW. WHAT WE DO IN OUR DEPARTMENT HAS A HUGE IMPACT ON THE COMMUNITY. WE ASSIST THE CLIENTS ON KEEPING THE ROOFS OVER THEIR HEADS SO THEIR FAMILIES CAN REST EASY AT NIGHT WHILE THEY ARE STRUGGLING WITH UNFORESEEN MEDICAL ISSUES. WE ASSIST CLIENTS TO PUT FOOD ON THE TABLE SO THEIR CHILDREN DON'T GO HUNGRY AT SCHOOL AND THEY CAN FOCUS ON THEIR STUDIES. WE ASSIST CLIENTS WITH UTILITIES SO FAMILIES CAN HAVE WATER TO SHOWER WITH.

SOCIAL SERVICES IS ABLE TO ASSIST OUR CLIENTS TO MEET THEIR BASIC NEEDS SO THEY CAN WORK THROUGH THEIR CURRENT EMERGENCIES. FOR THAT, I AM THANKFUL THAT NUECES COUNTY HAS A DEPARTMENT THAT THE RESIDENTS CAN DEPEND ON ON THEIR TIME OF NEED. THANK YOU.

>> THANK YOU. >>

[00:10:02]

>> HI. >> HELLO.

>> JULIAN ALDO COPIA IN OCTOBER, 2021, I BEGIN MY WORK WITH THE NUECES COUNTY WORKING IN THE ROB STONE OFFICE ASSISTING CORPUS CHRISTI AND NUECES COUNTY. THIS OPPORTUNITY HAS ALLOWED ME TO CONTINUE WORKING WITH THE COMMUNITY AND USE KNOWLEDGE I'VE GAINED IN MY YEARS OF EXPERIENCE. MY EXPERIENCE WITH THIS ORGANIZATION HAS CONVINCED ME THAT THIS IS MY RIGHTFUL PLACE OF WORK. DURING MY TENURE, I HAVE ENCOUNTERED INDIVIDUALS WHO CAME TO US WITH AND THE MAKE ACCOUNTS AT RISK FOR DISCONNECTION OF THEIR UTILITIES DUE TO UNFORESEEN YOU TO. I INTERACT WITH PEOPLE STRUGGLING TO PAY THEIR BILLS AND FEED THEIR FAMILIES WITH SOME ONLY RECEIVING $22 IN FOOD STAMPS. MOREOVER, I HAVE HAD POSITIONS WITH FAMILIES THAT LOST A LOVED ONES AND EXCITEDLY AND DID NOT KNOW WHAT OTHER STEPS TO TAKE, ALONG WITH MANY OTHER FAMILIES IN NEED OF ASSISTANCE. AS A TEAM, WE LEND A YEAR TO THESE INDIVIDUALS. WHEN THE GUYS WITH THEIR TUITIONS AND OFFER ASSISTANCE OR GUIDANCE WHERE POSSIBLE. WE START BY IDENTIFYING THE SPECIFIC CHALLENGES FACING EACH FAMILY AND THEN WORK TOGETHER TO IDENTIFY THE MOST APPROPRIATE RESOURCES AND ASSISTANCE. OUR GOAL IS DIVIDE PROVIDE HOLISTIC SUPPORT THAT ADDRESSES THE ROOT ALBUMS THAT THEY FACED BY THOSE WE SERVE IN NUECES COUNTY. WHILE MOST OF OUR EIGHT IS ONE TIME PER YEAR, THAT SINGLE INTERVENTION HAS HELPED MANY NUECES COUNTY RESIDENTS REGAIN THEIR FOOTING AND MOVE FORWARD. FOR INSTANCE, THE A PROVIDED HAS ENABLED A ELDERLY COUPLE TO PUT FOOD ON THE TABLE. IT HAS ALSO HELPED A FAMILY GIVE THEIR LOVED ONES A DECENT BURIAL.

ADDITIONALLY, WE COLLABORATE WITH OTHER COMMUNITY AGENCIES TO ENSURE THAT OUR CLIENTS RECEIVE THE NECESSARY RESOURCES AND SUPPORT BEYOND OUR ONE-TIME INTERVENTION. OUR TEAM AT THE NUECES COUNTY DEPARTMENT OF SOCIAL SOURCES IS DEDICATED TO SUPPORTING OUR COMMUNITY, FOSTERING RELATIONSHIPS WITH OTHER COMMUNITIES, AND PROVIDING FAMILIES WITH RESOURCES AND ASSISTANCE THEY NEED TO OVERCOME CHALLENGING TIMES. WE ARE COMMITTED TO WORKING TOGETHER TO IMPROVE THE LIVES WE SERVE AND TO ADDRESS THE ROOT CAUSES OF THE PROBLEMS THEY FACE. I ALSO WANT TO SAY -- TAKE THE TIME TO SAY THANK YOU TO MY VERY FIRST MENTOR FOR MY VERY FIRST JOB IN 2005. HE PROVIDED ME WITH THE GUIDANCE AND TRAINING THAT I HAVE UTILIZED THROUGHOUT MY CAREER. THANK YOU, COMMISSIONER

MAREZ . >> THANK YOU.

>> HI. DID MORNING. >> DID MORNING.

>> MY NAME IS JESSICA ANDERSON. I LIVE IN FOR THREE 30 PORTLAND TEXAS. I AM HONORED TO WORK WITH THE NUECES COUNTY DEPARTMENT OF SOCIAL SERVICES RUNNING EMERGENCY RENTAL UTILITY, FOOD, FOR THE MOST WONDERFUL POPULATION. OUR DEPARTMENT HAS A FUNDING WHERE MOST OTHER AGENCIES HAVE EXCEEDED THE FUNDING. WE ALLOW FAMILIES IN POVERTY TO CONTINUE STRIVING FOR SUSTAINABLE LIVING BY PROVIDING THE MOST BASIC NEEDS SUCH AS LECTURE CITY, WATER, AND OTHER UTILITIES AS LONG AS EMERGENCY FOOD FOR FAMILIES NOT RECEIVING THOSE BENEFITS. WE DELIVER SERVICES TO AREA VETERANS AND THEIR FAMILIES AND HELP GRIEVING FAMILIES IN THEIR TIME OF NEED.

IT IS IN MY HONOR OF SOCIAL WORK MONTH TO PROVIDE CASE MANAGEMENT SERVICES AND ASSISTANCE FOR THE NUECES

COUNTY COMMUNITY. THANK YOU. >> THANK YOU. AND ONE MORE I

THINK I HAVE ON HERE. >> HI. GOOD MORNING. MY NAME IS LEAH RODRIGUEZ. I'M A SOCIAL WORKER IN THE OFFICE.

I'M GOING TO READ A STATEMENT THAT WAS WRITTEN BY ONE OF MY SCORE CHRIS. IT IS EASY TO SAY EVERY DATE YOU MAKE A CHOICE AND YOU RESPONSIBLE FOR THE CHOICES YOU MAKE. I KNOW BECAUSE I SAY THIS OFTEN AND DAILY TO MY OWN CHILDREN. WHILE THE SAME IS TRUE, WE ALL MAKE CHOICES. SOME GOOD AND SOME BAD. MANY PEOPLE IN OUR COMMUNITIES DO NOT HAVE SIMPLE CHOICES LIKE TO I WANT JELLY ON MY TOAST TODAY OR WHAT EARRINGS, GOING TO WEAR WITH MY OUTFIT? SOME DAYS, THEY HAVE THE DIFFICULTY TO MAKE THE CHOICE TO PAY THE ELECTRIC BILL OR NOT BECAUSE DID NOT HAVE ENOUGH MONEY TO PAY FOR FOOD FOR THE REST OF THE MONTH. MANY OF THE ELDERLY IN OUR COMMUNITY ONLY QUALIFY FOR $23 AND MONTHLY BENEFITS. THEY MUST MANAGE THEIR FIXING TO MANAGE THEIR FOOD INSECURITY. WHILE IT IS EASY TO SAY THAT THERE ARE FOOD PANTRIES AND FOOD DISTRIBUTIONS ACROSS THE COUNTY, THE FOOD THEY RECEIVE AT THESE SITES MAY ONLY LAST A COUPLE OF DAYS AND MAY NOT BE ENOUGH TO FEED THEM FOR A WEEK. IN ADDITION, THEY MAY HAVE TRANSPORTATION ISSUES THAT MAY FURTHER PREVENT THEM FROM GOING TO DISTRIBUTION CENTERS. OTHER FACTORS ARE WEATHER.

EXTERNALLY HOT OR CODE CONDITIONS TO BE DIFFICULT TO

[00:15:02]

WAIT OUTSIDE. MANY CLIENTS NOW HAVE A CHOICE WHEN THEY ARE DIAGNOSED WITH A CHRONIC ILLNESS OR LAID OFF. IT IS EASY TO SAY SAVE MONEY ASIDE RECEIVER CHECK. OFTEN, THERE IS NO EXTRA MONEY TO SAVE. CHRONIC ILLNESS, DEATH, OR LOSS OF EMPLOYMENT DO NOT DISSEMINATE AND WE ARE ALL SUSCEPTIBLE.

THESE ARE SOME THE THINGS WE EXPERIENCE AS CASEWORKERS. THIS IS WHERE OUR DEPARTMENT COMES IN. WE ASSIST THE NUECES COUNTY COMMUNITY WITH UTILITY, FOOD DOCTORS, AND BUS PASSES. WE ALSO ASSIST WITH BURIALS AND COMMISSIONS AND HAVE A PROGRAM WHERE WE ASSIST RESIDENTS OF NUECES COUNTY WITH BASIC HOUSEHOLD SUPPLY VOUCHERS WHILE THEY ARE SPENDING THEIR SOCIAL SECURITY BENEFITS. BY PROVIDING THESE SERVICES TO OUR CLIENTS, WE HAVE BEEN ABLE TO PREVENT MANY FROM BECOMING HOMELESS, I WANT TO LIVE IN THE DARK WITH A CODE OR THE HOT LOW WEATHER WITHOUT ELECTRICITY AND WATER OR GAS FOR THE FAMILY. ALTHOUGH OUR JOB MAYBE DIMINUTIVE TO COMPARE TO OTHER DEPARTMENT IN THE COUNTY, WE FEEL LIKE WE PLAY A MAJOR ROLE. WE MAKE THE CHOICE TO COME TO WORK, ASSIST, AND LISTEN TO SOMEONE WITH KINDNESS AND EMPATHY. WOMEN OTHERS SEE THE DELETION OF OUR WORK, FOR EXAMPLE, WHEN A LECTURE CITY IS REINSTATED OR SOMEONE HAS ENOUGH GROCERIES TO GROCERIES FOR THE MONTH, BUT WE KNOW WE MANY DIFFERENT FOR A CLIENT BY ALLOWING THEM TO EXPRESS A CHOICE WHEN THEY ENTER OUR DEPARTMENT. THANK YOU.

>> THANK YOU. THANK YOU ALL FOR BEING HERE TODAY. I THINK THAT WAS THE LAST ONE I HAD FROM YOUR GROUP, REBECCA, TO SPEAK. I DON'T HAVE ANYONE ELSE ON HERE.

>> MORNING, JUDGE. IF I MAY, I AM JENNA SHU . I'M A LICENSED SOCIAL WORKER. I HAVE TWO ROLES HERE TODAY. YOU KNOW ME AS THE DISASTER ORDINATOR FOR THE 211 TEXAS COASTAL REGION. IN THAT ROLE, I LIKE TO SAY THAT NUECES COUNTY COUNTY SOCIAL SERVICES IS, HAS, AND REMAINS OUR NUMBER ONE REFERRAL SOURCE FOR OVER, I WOULD SAY, ABOUT 5000 REFERRALS THAT WE PROVIDE TO CALLERS SEEKING SERVICES IN NUECES COUNTY . THAT DOES GO UP EACH YEAR AS FAR AS WHEN INCOME GOES DOWN OR WHEN WE HAVE DISASTERS LIKE A HURRICANE OR COVID THAT SIGNIFICANTLY IMPACTS OUR RESIDENCE AND THOSE WHO ARE NEEDING HELP. IT IS CRITICAL THAT THE CORE -- AND WE ASK HIM REALLY -- THAT YOU CONTINUE TO FUND NUECES COUNTY SOCIAL SERVICES. AS 211 TEXAS REFERRALS, THERE ARE VERY FEW, I WOULD SAY, TWO OTHER AGENCIES IN OUR COUNTY THAT CAN HELP WITH RENT, UTILITY PAYMENTS, AND ASSESSMENTS. IT WOULD BE CATASTROPHIC IF THE COUNTY SOCIAL SERVICE DEPARTMENT WAS DEFUNDED OR WENT AWAY FOR NUECES COUNTY RESIDENCE. AND SO, I WOULD LIKE TO ASK THAT ON BEHALF OF THE PEOPLE THAT ARE CALLING EVERY DAY , OUR HELP SEEKERS THAT NEED HELP IN OUR COMMUNITY, MANY YEARS WE HEARD MOST PEOPLE ARE ONLY ONE PAYCHECK AWAY FROM BEING HOMELESS. NEVERMORE HAS THAT BEEN SO TRUE THEN TODAY WHAT WE ARE LIVING IN IN LIMITED ECONOMIC INCOME AND, AS YOU HEARD, MANY OLDER ADULTS OF PEOPLE WITH DISABILITIES RECEIVING $23 A MONTH FOR FOOD STAMPS. I KNOW I COULDN'T LIVE ON $23 A MONTH FOOD STAMPS, AND I KNOW PROBABLY NO ONE ELSE IN HERE COULD EITHER, BUT THOSE RESIDENCE, THOSE CLIENTS THAT ARE ASSISTED ARE CREATIVE, RESILIENT, AND SO THEY DO RELY ON SOCIAL SERVICES ASSISTANCE AND THAT IS WHY IT IS CRITICAL WE CONTINUE TO FIND THEM. NOW, I AM GOING TO SPEAK AS THE VICE PRESIDENT OF THE SOUTH TEXAS SOCIAL WORK SOCIETY. A LONGTIME SOCIETY THAT WAS FIRST FOUNDED ABOUT 50 YEARS AGO BETWEEN THREE SOCIAL WORKERS. ONE AT SPOHN, -- BACK THEN IT WAS DOCTORS HOSPITAL -- ONE, JIM LARRY WHO WAS AT THE MEMORIAL PSYCH UNIT. SO, EDDIE HEARD, WHO HAD BEEN MY SUPERVISOR AND OTHERS HERE TODAY, JIM LARRY, AND NANCY WEST , AS YOU KNOW THE EXECUTIVE DIRECTOR OF WCA FOUNDED THE SOCIETY TO STAFF CASES , JUST LIKE WE DO WITH SOCIAL WORK TO FIND RESOURCES.

NUECES COUNTY SOCIAL SERVICES HAS BEEN A KEY MEMBER IN THAT FOR MEDRANO TO MINOR SATELLITE TO REBECCA ROCK AS THE DIRECTOR. WE RELY ON THEIR CONTINUED SUPPORT AND INVOLVEMENT AND WE ARE VERY HAPPY HERE TODAY TO SUPPORT THE PROCLAMATION IN THEIR WORK THAT THEY DO AND ASK THAT YOU CONTINUE TO RECOGNIZE THAT WORK AND SUPPORT THEM. ONE OF MY

[00:20:01]

FAVORITE QUOTES -- I HAVE SEVERAL THAT I TRY TO LIVE BY.

DR. MARTIN LUTHER KING SAID IN 1957, IT IS STILL TRUE TODAY, " ONE OF LIFE'S MOST URGENT AND PERSISTENT QUESTIONS AS, WHAT ARE YOU DOING TO HELP OTHERS?" WE HAVE TO ANSWER THAT EVERY DAY. YOU HAVE TO ANSWER IT AS ELECTED OFFICIALS. WE HAVE TO ANSWER IT AS SOCIAL WORKERS. THAT IS OUR GUIDING PRINCIPLE.

THANK YOU. >> THANK YOU. AND ANOTHER WAS A PROCLAMATION AND THERE IS NO ITEM ON THE AGENDA FOR ANYTHING ABOUT SOCIAL SERVICES TO BE DISCONTINUED OR ANYTHING. THIS WAS A RECOGNITION. SO, THANK YOU.

>> THANK YOU. >> MOVING ON TO PUBLIC COMMENT. I HAVE A LONG LIST HERE. THIS SECTION. OH, REBECCA, YOU WANT TO SPEAK AGAIN? SORRY. A PICTURE. OF COURSE. DID WE GET THAT SIGNED? DID YOU STAMP THAT?

>> YES, MA'AM. >> SPEAKERS ]

>> THANK YOU. THANK YOU. >>

SPEAKERS ] >> LET THEM CLEAR OUT AND WE

[F. PUBLIC COMMENT: This section provides the public the opportunity to address the Commissioners Court on any issues within its jurisdiction. The Commissioners Court may not take formal action on any requests made during the Public Comment period which are not on the Agenda, but can refer such requests to County staff for review if appropriate.]

WILL MOVE ON TO OUR PUBLIC COMMENT AND PLEASE, WHEN I CALL YOUR NAME, GO TO THE PODIUM, SPEAK INTO THE MICROPHONE, AND PLEASE STATE YOUR NAME AND ADDRESS. YOU ARE ONLY ALLOWED THREE MINUTES AND WE ARE NOT ALLOWED TO REALLY COMMENT OTHER THAN TO CORRECT A STATEMENT THAT IS NOT FACTUAL OR SOMETHING OR TO ASK TO PUT IT ON THE AGENDA FOR MORE DISCUSSION LATER. SO, ALMA STUTER, YOU ARE UP FIRST. YOU MAY HAVE TO PULL THE MICROPHONE DOWN A LITTLE BIT.

>> HELLO. MY NAME IS ALMA STUTER . OKAY. YES, MA'AM. MY NAME IS ALMA STUTER. THE ADDRESS IS 5433 79 AND ROB STONE TEXAS.

THANK YOU. I AM HERE IN REGARD TO THE PUBLIC COMMENT PORTION FOR THE AMMONIA PLAN. JUST TO OPEN UP WITH. I PERSONALLY WOULD RATHER IT NOT BE BROUGHT TO OUR COMMUNITY FOR THE SAFETY OF OUR PUBLIC. AND I HAVE BEEN DOING AS MUCH RESEARCH AS I CAN AND ONE OF THE BIGGEST THINGS THAT HAD ME CONCERNED , AND I HAVE LEARNED THIS FROM A ARMY ATTORNEY IN D.C. AND HE SAID, ALWAYS OPEN UP WITH IN MY OPINION. SO, THAT IS WHAT I WILL DO. I FEEL THAT SO MUCH HAS PROGRESSED THAT THE PUBLIC JUST BECAME AWARE OF EVEN THOUGH BASED ON WHAT WE HAVE SEEN ON SOCIAL MEDIA, THIS HAS BEEN AN ONGOING EFFORT, BUT COMMUNITY AS A WHOLE JUST BECAME AWARE OF IT. AND I GUESS THAT KIND OF CONCERN TO ME. AND SO, I EVEN WENT ON INTO THIS TEXAS ASSOCIATION OF COUNTIES AND PULLED UP AND ACCORDING TO THEM, IT IS NEIGHBORS SERVING NEIGHBORS.

IT IS PUBLIC TRANSPARENCY. IT IS ACCOUNTABILITY TO THE VOTERS AND LIKE I SAID, MY CONCERN IS WE HAVE PUSHED SO FAR, WE HAVE ALREADY TALK IN WATER RIGHTS. WE ALREADY TALKED IN CONTRACTS.

WE'VE ALREADY TALKED IN ISSUES OF CONCERNS YET THE PUBLIC IS JUST NOW BEING ABLE TO VOLES THAT ARE CONCERNED.

[00:25:01]

HAD THIS BEEN BROUGHT UP EARLIER, WE MAY HAVE BEEN BETTER INFORMED BUYER TO OUR SITUATION. YOU KNOW, ONE OF THE THINGS THAT KIND OF HURTS ME IS THIS IS AN AMMONIA PLANT AND BEING AN ISSUE, IT CAN BE DEADLY BUT WE HAVE HAD MORE CONVERSATIONS OVER A RESTAURANT ON PADRE ISLAND THEN WE HAD ON A CRITICAL ISSUE THAT WOULD REGARD WATER IN OUR PUBLIC SAFETY. SO I GUESS ONE OF THE BIGGEST THINGS IS THAT -- I GUESS THAT IS MY BIGGEST CONCERN IS THAT IT APPEARS THAT A LOT HAS HAPPENED WITHOUT A LOT OF TRANSPARENCY THAT WE GOT TO THIS POINT AND WE ARE JUST BECOMING AWARE, EVEN THOUGH I BELIEVE THE VOTERS SHOULD HAVE BEEN MORE

AWARE EARLY ON. THANK YOU. >> THANK YOU. SUZANNE

GALLAGHER. >> GOOD MORNING. MY NAME IS SUZANNE GALLAGHER. I LIVE AT 5419 RIVERVIEW DRIVE, TRENTO, TEXAS. I HAVE RECENTLY HAD A CHANCE TO LOOK OVER AVINA'S REVAMPED WEBSITE AND I JUST WANT TO POINT OUT A COUPLE OF THINGS. ONE, IT STATES IT WILL BE A WORLD SCALE PNEUMONIA PRODUCTION FACILITY SET TO BECOME THE LARGEST ZERO MISSION, WHICH LET'S BE HONEST, IS NOT ZERO MISSION.

IT IS ZERO CO2 EMISSIONS. IT WILL ADMIT , MONOXIDE, NITROGEN OXIDE AND OF COURSE, PNEUMONIA. BUT ANYWAY, THE LARGEST ZERO MISSION FACILITY IN NORTH AMERICA. WHEN YOU HEAR THAT, I HEAR REALLY BIG AND REALLY BIG TO ME DOES NOT SOUND LIKE SOMETHING IS TO BE NESTLED BETWEEN TWO COMMUNITIES. THEY ARE ALSO GOING TO BE AHEAD OF COMPETITORS. WHEN I HEAR AHEAD OF COMPETITORS, I HEAR IN A HURRY TO START GETTING THAT PRODUCT OUT THERE AND START MAKING A PROFIT. FROM MY OWN EXPERIENCE, I STARTED MY OWN BUSINESS 14 YEARS AGO AND I DID RESEARCH AND I HAD A MENTOR AND I TALKED TO A LOT OF PEOPLE BUT WHAT I KNOW IS THAT YOU CANNOT BE PREPARED FOR EVERY INEVITABILITY AND YOUR CIRCUMSTANCES ARE ALWAYS GOING TO BE DIFFERENT AND YOU ARE GOING TO HAVE CURVEBALLS THROWN AT YOU AND YOU WERE GOING TO HAVE TO MAKE UP SOME STUFF AS YOU GO. AND I DON'T CARE IF WE ARE TALKING ABOUT WHAT FIELD WE ARE TALKING ABOUT. EVERYONE KNOWS THAT THIS IS TRUE. SO, OUR COMMUNITIES DO NOT WANT THAT LEARNING CURVE DONE ON OUR BACKS OR IN OUR BACKYARDS. AND FINALLY, I WOULD JUST LIKE TO READ A PARAGRAPH FROM THE WEBSITE. "WE ARE PROFOUNDLY DEDICATED TO COMMUNITY ENGAGEMENT AND INVOLVEMENT ABOUT EVERY STAGE OF OUR OPERATIONS. WE UNDERSTAND THE SIGNIFICANCE OF CULTIVATING OPEN, TRANSPARENT COMMUNICATION CHANNELS WITH THE LOCAL COMMUNITY STAKEHOLDERS BEFORE AND DURING THE ESTABLISHMENT OF THE PLANT, WE PROACTIVELY SOLICIT INPUT FROM COMMUNITY MEMBERS THROUGH PUBLIC MEETINGS, CONSULTATIONS, AND INFORMATIONAL SESSIONS. OUR OBJECTIVE IS TO GIVE YOU THOROUGH INFORMATION ABOUT OUR OPERATIONS , ADDRESSING ANY CONCERNS OR QUESTIONS. WE HIGHLY ESTEEMS THE INSIGHTS AND PERSPECTIVES OF RESIDENTS RECOGNIZING THAT THERE AND PUT IS ESSENTIAL IN SHAPING OUR SAFETY PROTOCOLS, EMERGENCY RESPONSE PLANS, AND STRATEGIES FOR MITIGATING ENVIRONMENTAL IMPACT. AND I WON'T SEE ANYTHING ELSE. I THINK THAT SPEAKS FOR ITSELF.

>> CLAPPING OR ANYTHING. THIS IS A COURTROOM SO, THANK YOU.

MALLORY WINCHESTER, PLEASE, YOU ARE UP.

>> GOOD MORNING. MY NAME IS MALLORY WINCHESTER. I LIVE IT 5477 AND ROBSTOWN, TEXAS. AS IT DIRECTLY PERTAIN TO THE CURRENT HEALTH AND ENVIRONMENTAL DISASTER PROPOSE FOR THE CONSTRUCTION IN THE ROBSTOWN AREAS. UPON BEING PRESSED FOR COMMENT, MANY ELECTED OFFICIALS DELAYED THE RESPONSE THING THEY'RE CONCERNED BUT NEED MORE INFORMATION. THIS INFORMATION OF COURSE IS FREE AND READILY AVAILABLE ONLINE SO FOR THE DURATION OF A FEW BRIEF HOURS, I HAVE TAKEN THE LIBERTY OF THAT COLLECTING INFORMATION OF WHAT AMMONIA DOES TO THE HUMAN SYSTEM. ANHYDROUS AMMONIA IS ATTRACTED TO WATER. IT IS HYGROSCOPIC MEANING WHEN IT REACTS WITH MOISTURE OR IN THIS CASE, A BEING. THE HUMAN BODY PROVIDES PLENTY OF MOISTURE. FOR EXAMPLE, MANY STATE AND OUR CULTURAL GUYS STATE THE EFFECT OF AND DRUDGES AMMONIA ON THE EYES. CORRECTED LENS FLARES ARE ARTIST IN THE

[00:30:02]

KOSICE AND ANHYDROUS AMMONIA CAUSES CONSEQUENCES DIFFUSE WITH THE EYES. THE REPERTORY SYSTEM IS NEXT WAS TARGETED BY AND DRUDGES AMMONIA. THE CONSENSUS OF WHAT TO DO IF YOU ACCIDENTALLY INGEST THIS CHEMICAL IS CLEAR. EVACUATE THE AREA IMMEDIATELY IF LUNGS ARE STILL IN WORKING CONDITION.

THE JUDGE SCOTT BURNS THE SYSTEM CAUSING PARALYSIS AND DEATH. THIS IS QUICK BUT NOT WITHOUT ASSOCIATING PAIN AS IT BURNS THE INSIGHTS. SOME SCIENTIFIC ARTICLES SAY THAT THE BURNS SUSTAINED FROM AMMONIA EXPOSURE AND PRODUCE AN OVER PRODUCTION OF MUCUS IN THE LUNGS LEADING TO PNEUMONIA.

WITHIN THESE FACT SHEETS, CHILDREN ARE SPECIFIED AS ONE OF THE MOST VULNERABLE POPULATIONS TO AMMONIA BURNS.

IT IS -- AVINA, THE PARENT COMPANY OF THE PNEUMONIA .

AREN'T WE DO NOT WISH TO ACCEPT THE RISKS. THE ONLY WAY TO PREVENT THE CHANCE OF ANY OF THESE INJURIES TO OCCURRING IS TO CEASE ANY AND ALL DEVELOPMENTS OF ANHYDROUS AMMONIA. AND LIKELY OF IT IS EYSTER AS NUMEROUS NEWS ARTICLES DEMONSTRATE, TO WHOM SHALL BEHOLD RESPONSIBLE FOR THE RECKLESS EXPENSE OF HUMAN LIVES.

>> THANK YOU. CECELIA TOWNSEND?

>> YES. I AM AT 5014 -- I AM AT 514 BROAD PARKWAY AND I'M CALLING ABOUT THE WATER BECAUSE THE AREA AROUND HERE, WE HAVE BEEN ON A FOOD RESTRICTION AND WE HAVE BEEN ABLE TO KEEP THE LAKE AT 30% AND IF YOU ADD THIS COMPANY'S 7 MILLION GALLONS A DAY TO THAT WATER EXTRACTION, IT HAS TO DO WITH TAKING IT DOWN TO 29% AND THEN, NEXT YEAR WE ARE TRYING TO RESTRICT OUR WATER FLUID 28%. AND I SEE IN THE PICTURE THAT ONE OF THESE DAYS THAT LAKE WILL BE EMPTY. BECAUSE IT IS NOT GETTING A LOT OF WATER INTO THE LAKE TO GET IT BACK UP TO 40 AND 50%. WE ARE JUST KEEPING IT 30. SO, I THINK THIS COMPANY IS A DISASTER AND WILL DESTROY OUR AREA BECAUSE, EVENTUALLY, WE WILL BECOME THE DUSTBOWL OF SOUTH TEXAS AND I DON'T WANT ANY OF THAT TO BE EVER HAPPENING, BUT IT IS ONLY LOGICALLY. WHERE WE KEEP IT AT 30 AND ADD $7 MILLION GALLONS EVERY DAY, THEN SOMETHING IS GOING TO HAPPEN TO OUR LAKE AND WHEN THAT HAPPENS, WHAT ARE WE GOING TO DO? SO, I DON'T WANT MY COMPANY HERE. WE SHOULDN'T HAVE HAD -- WHOEVER BROUGHT IT, SHOULD HAVE THOUGHT ABOUT THAT BEFORE THEY BROUGHT IT HERE BECAUSE WATER IS GOLD AND THAT IS ALL I HAVE TO SAY.

THANK YOU. >> THANK YOU, MA'AM. THANK

YOU. BETTY CRANFORD. >> I AM BETTY CRANFORD. I LIVE AT 3802 LAMONT DRIVE HERE IN CORPUS CHRISTI. WE HAVE ALREADY DISCUSSED THE WATER HAZARDS AND WE DO HAVE A COPY OF THEIR CONTRACT WITH THE WATER DISTRICT SHOWING THE TOLL THAT IS GOING TO TAKE. IT IS A DIRE THING AND MUST BE PROTECTED AND IN ADDITION TO THAT, READING FROM THE APPLICATION TV CQ, THEY ADDRESS SOME OF THE HAZARDS ASSOCIATED WITH PLACING THIS PLANT IN THE AREA THAT IT IS, WHICH IS A NEIGHBORHOOD . WITH THERE, THEY ELIMINATED SOME OF THE HOUSES THAT WERE ARE DIRECTLY ADJACENT TO THAT AREA.

SOME OF THE HAZARDS ARE BASED ON THEIR TEC YOU --

>> CAN YOU SPEAK IN THE MICROPHONE A LITTLE BETTER? THEY'RE HAVING TROUBLE HEARING YOU.

>> OKAY. ARSON, NATURAL HAZARDS WITH SEVERE WEATHER, SUCH AS HURRICANES, TORNADOES, AND EXPLOSIONS. IT CAN DISRUPT THE ELECTRICAL SUPPLY FACILITY FOR EXTENDED TIMES, WHICH COULD RESULT BUT THEY WOULD NOT SAY WOULD, WITHOUT ANY RELEASES. BUT IF YOU'VE EVER HAD A RELEASE OR SEE ANYONE THAT HAS BEEN CHEMICALLY BURNED, I STARTED OUT AS A LEVEL ONE TRAUMA NURSE, THAT IS SOMETHING YOU NEVER WANT TO SEE. YOU NEVER, EVER WANT TO EXPERIENCE A CHEMICAL BURN, BUT Y'ALL, THEY'RE PROPOSING TO SET THIS PLANT RIGHT IN THE MIDDLE OF A GROWING EXPANDING NEIGHBORHOOD. YOU LOOK AT THE HOUSES, YOU LOOK AT THE PEOPLE, YOU LOOK AT THE WATER PRICES

[00:35:03]

THAT WE ARE HAVING. YOU HAVE TO TAKE ALL OF THAT INTO CONSIDERATION BEFORE YOU DO ALLOW SOMETHING LIKE THIS TO OCCUR. NOW, I DON'T KNOW WHO DEALT WITH THIS WATER CONTRACT . I HAD THE CONTRACT. I KNOW WHO SIGNED OFF ON IT. FOR AN AGREEMENT, BUT WE ARE STILL SEARCHING AND THEY CAN SAY WHATEVER THEY WANT TO, BUT WE ARE USING THEIR OWN DATA TO PRESENT TO YOU GUYS. SO, THAT DATA IS MISINFORMATION AND YOU NEED TO GO BACK TO AVINA AND TALK TO THEM BECAUSE THEY ARE THE ONES THAT ARE SUPPLYING IT AT THIS TIME. THANK YOU.

>> THANK YOU. COMMISSIONER ROBERT HERNANDEZ , DID YOU SIGN

UP TO SPEAK? >> SURE DID, JUDGE.

>> CAN WE DO THAT? I THOUGHT WE DISCUSSED THAT WE COULD DO

THAT. >> THE ATTORNEY GENERAL HAS TREATED MEMBERS OF THE COURT DIFFERENT FROM PUBLIC BECAUSE

-- >>

SPEAKERS ] >> JUDGE, IF YOU WANT TO MOVE THE AGENDA ITEM UP SO THAT EVERYBODY CAN SPEAK AND

COMMISSIONER CAN SPEAK -- >> AS A CITIZEN, I HAVE A

CONCERN ALSO. >> COULD WE JUST MAYBE MOVE THE AGENDA ITEM UP WHICH THAT WEIGHT COMMISSIONER CAN SPEAK WHEN HE WANTS TO AND WOULD THAT BE OKAY? I JUST WANT TO MAKE

SURE NOBODY THINKS -- >> WE ARE GOING TO HAVE TO DO THE WHOLE PRESENTATION TO GIVE THEM AN OPPORTUNITY.

>> COMMISSIONER, KENNY HOLD OFF AND DO THE PRESENTATION AND THEY ALL SPEAK? COULD HE DO THAT?

>> I WILL HOLD OFF. >> I WILL BRING THEM UP NEXT AND LET THEM SPEAK AND AFTER THEIR PRESENTATION --

>> I WOULD SAY, AS A CITIZEN, I HAVE CONCERNS ALSO.

>> OKAY. MELANIE GRANT? >>

>> I AM MELANIE GRANT. LIVE AT 4201 BOB WRIGHT, ROBSTOWN, TEXAS. I DON'T HAVE ANYTHING PLANNED TO SAY. I DO HAVE CONCERNS. MY HUSBAND AND I LIVE OUT THERE. WE HAVE BUILT A BUSINESS. SPENT 40 YEARS SELF-EMPLOYED. OUR LITTLE DIAMOND IN THE ROUGH HOUSE WAS GOING TO BE OUR RETIREMENT PLAN. WE WERE GOING TO SELL THAT, MAKE A PROFIT, BUILD US A LITTLE RETIREMENT HOUSE BUT WITH THIS AMMONIA PLANT COMING IN, ALL I SEE IS PROPERTY DEVALUATION AND HEALTH HAZARDS. POSSIBLY DEATH SPIRIT . I DON'T WANT TO SEE THAT IN OUR COMMUNITY AND I THINK IT SHOULD BE MOVED SOMEWHERE ELSE.

THANK YOU. >> THANK YOU, MA'AM. MAIRA

ALENESE . >> GOOD MORNING. MY NAME IS MAIRA ALENESE. THAT IS LITERALLY A MILE AWAY FROM THE PROPOSED AVINA PLANT BUT THE END OF MY PROPERTY WILL FACE AVINA CONSTRUCTION. ONE COMMENT I WANT TO MAKE. AVINA CANNOT, 12%, CARRIED TEETH THAT THEY WILL BE NO LINK ASK OR EXPLOSIONS OR HARM TO CITIZENS. I CAN GUARANTEE YOU THAT THERE CHEMICAL RELEASES, DEPLETION OF OUR WATER WILL HURT OUR COMMUNITY AND I HAVE ANOTHER QUESTION ABOUT THE PERMIT THAT THEY SUBMITTED TO THE TECQ , THEY DID NOT TALK ABOUT THEIR WATER USAGE OR THE AMOUNT THAT THEY ARE GOING TO USE. ON THE PERMIT, THEY DO SAY THAT THEY ARE GOING TO PRODUCE 8.7 JILLIONS -- 3.2 BILLION GALLONS OF AMMONIA PER YEAR WHICH IS 8.7 MILLION GALLONS OF AMMONIA PER DAY. 8.7 MILLION GALLONS OF AMMONIA PRODUCED ON THE ESTIMATED SEVEN POINT WHATEVER MILLION GALLONS OF WATER. I DON'T SEE HOW THOSE NUMBERS -- I DON'T SEE HOW 700 GALLONS OF WATER -- 7 MILLION GALLONS PER DAY OF WATER IS GOING TO PRODUCE 8.7 MILLION GALLONS OF AMMONIA PER DAY. I THINK THE PERMIT NEEDS TO HAVE CALCULATIONS. CLEAR CALCULATIONS OF HOW MUCH WATER USAGE IT WILL TAKE TO PRODUCE 3.2 BILLION GALLONS OF AMMONIA THAT IT IS SAYING THAT IT WILL PRODUCE. THEY ARE ALSO ENTICING OUR COMMUNITIES , OUR TAXING AGENCIES , THE ROBSTOWN I.D. AND COUNTY COMMISSIONERS WITH TAX CONTRIBUTIONS , BUT

[00:40:06]

THEY ARE ASKING FOR ABATEMENTS TOO. SO, WITH THESE ABATEMENTS THAT IF WE AGREED TO, WE ARE NOT GOING TO SEE AN ACTUAL POSITIVE REALIZATION ON OUR ABATEMENT FOR YEARS DOWN THE ROAD. AND AT THAT POINT, OUR RESERVOIR MAY BE DEPLETED AND THEY MAY JUST LEAVE AND LEAVE US THIRSTY, HIGH AND DRY. I ALSO DON'T UNDERSTAND HOW SO MANY PEOPLE SAY, THEY NEVER KNEW ABOUT THIS AMMONIA PLANT COMING TO OUR COMMUNITY. WHEN THERE ARE PICTURES, DOCUMENTS , THAT ARE ASSISTING THE ROBSTOWN AREA DEVELOPMENT COMMUNITY RECRUIT THESE COMPANIES. TESLA, AVINA. THERE ARE CONTRIBUTIONS FROM MR. MAREZ FOR THESE EXPENSES. SO HOW CAN I SAY THEY DON'T KNOW WHAT IS GOING ON? IF MY BOSS PAYS ME $20,000, HE EXPECTS A REPORT. HE EXPECTS TO KNOW WHAT THAT $20,000 IS BEING USED AND THAT IS NOT HAPPENING. THANK YOU.

>> THANK YOU. MARY RODRIGUEZ?

>>

>> SHE IS PASSING. >> SHE IS PASSING. MARIE LUCIO

. >> HI. MY NAME IS MARIE LUCIO . I LIVE AT 39 2930 AND ROBSTOWN. WE HAVE HEARD ALL ABOUT AMMONIA. I KNOW AMMONIA IS AMMONIA. DOESN'T MATTER HOW YOU PRODUCE IT. IT STILL CAUSES THE SAME CHEMICAL EFFECTS ON PEOPLE. DOESN'T MATTER WHAT PROCESS YOU DO FOR IT. I AM NOT GOING TO GO INTO HOW BAD EVERYTHING IS. MY CONCERN IS, WHERE DO YOU STAND? I AM NOT ASKING YOU TO ANSWER IT, JUST WHERE DO YOU STAND? ARE YOU STANDING WITH THIS OR STANDING AGAINST THIS? YOU REPRESENT US. SOMEHOW, THIS COMPANY GOT A HOLD OF THIS PARTICULAR LAND IN OUR BACKYARD . HAVE YOU GONE TO GO PAST BY WHERE IT IS AT? DO YOU KNOW EXACTLY WHERE THEY PLAN TO PUT THIS IN OUR COMMUNITIES? BECAUSE, IT LITERALLY IS IN SOMEONE'S BACKYARD. THEY HAVE NEIGHBORS -- HOUSES. PEOPLE WHO HAVE LIVED THERE PROBABLY FOUR YEARS AND THEY ARE SETTING UP THIS INDUSTRIAL COMPANY RIGHT NEXT TO THEM. HOW DID THAT HAPPEN? HOW DID THAT HAPPEN IN OUR COMMUNITIES? WE ELECT OFFICIALS TO PROTECT US. WE DEPEND ON EVERYBODY , NOT JUST COMMISSIONERS COURT, WE DEPEND ON THE WATER DISTRICT. WE DEPEND ON THE ROBSTOWN ISD BOARD. WE DEPEND ON OUR ROBSTOWN CITY COUNCIL.

WE DEPEND ON THE NUECES COUNTY CORPUS CHRISTI CITY COUNCIL TO PROTECT OUR INTEREST, HOWEVER, WE HAVE AN INDUSTRIAL SIZE AMMONIA PLANT BEING BUILT IN OUR BACKYARDS. MIND YOU, MAYBE TWO MILES STRAIGHT SHOT FROM ROB STONE HIGH SCHOOL.

TWO MILES STRAIGHT SHOT TO ROBERT DRISCOLL ELEMENTARY SCHOOL. IF SOMETHING HAPPENS, AND LIKE SHE SAID, THEY CAN'T GUARANTEE THAT NOTHING IS GOING TO HAPPEN. WHAT HAPPENED TO OUR CHILDREN? THAT IS OUR CHILDREN. OUR FUTURE. IS THIS LED THE LEGACY WE WANT TO LEAVE THEM? DO WE WANT TO LEAVE THEM WITH THE MASS OF AN AMMONIA PLANT WAS GOING TO DEPLETE OUR NATURAL WATER RESOURCES? HOURS? NOT MINE, NOT YOURS, THEY ARE EVERYBODY'S. THEY ARE COMING IN TO DEPLETE OUR NATURAL RESOURCES, TO CREATE A THIS HAZARDOUS MATERIAL THAT PROBABLY IS NOT EVEN BENEFICIAL, LIKE I SAID, TO THE STATE OF TEXAS. TO EVEN ANYONE AROUND HERE. THEY ARE PROBABLY GOING TO SELL IT OVERSEAS OR WHOEVER THEY WANT TO MAKE THEIR MONEY. AND WHAT DOES THAT LEAVE US? HOW DOES THAT BENEFIT US? WE NEED TO DO BETTER IN OUR COMMUNITIES. WE NEED TO DO BETTER IN BRINGING MENACES BUSINESSES THAT BENEFIT OUR COMMUNITIES AND WHERE WE LIVE. NINE ELSE'S. THIS PLAN PROBABLY WAS NOT WANTED ANYWHERE ELSE AND THIS IS WHERE IT ENDED UP. THANK YOU FOR YOUR TIME.

>> THANK YOU. MIKE PUBLICLY .

[00:45:06]

>> JUDGE, COURT. GOOD MORNING. MY NAME IS MIKE PUSLEY.

APPROXIMATELY THREE WEEKS AGO, THE CITY OF CORPUS CHRISTI WAS NOTIFIED OF A AMMONIA PLANT BEING PLANTED NEAR THE CITY OF ROBSTOWN. THE PLANT DOES NOT FALL WITHIN THE JURISDICTION OF CORPUS CHRISTI BUT DOES POSE SIGNIFICANT IMPACT TO THE CITY AND SURROUNDING AREAS. I HAVE RECEIVED NUMEROUS QUESTION TO THIS PROPOSAL AND FACILITY SO I CONTACTED THAT PLANT REPETITIVE AND THAT WITH THEM TO DISCUSS THEIR PLANS. AS A RESULT OF THOSE MEETINGS, I WANT TO SHARE MY POSITION AND CONCERNS. AS AN AT-LARGE CITY COUNCILMAN AND PREVIOUS COUNTY COMMISSIONER FOR PRECINCT 1, I HAVE ALWAYS SUPPORTED BUSINESS GROWTH IN OUR COMMUNITY, THIS INCLUDES INDUSTRIAL GROWTH, WHICH MAKES UP A LARGE PART OF OUR REGION AND PROVIDES THOUSANDS OF JOBS FOR FAMILIES IN AND AROUND NUECES COUNTY. NO DOUBT THIS PROJECT WOULD BRING JOBS TO OUR AREA THAT WOULD BE BENEFICIAL TO OUR COMMUNITY, HOWEVER, AS I STATED, THIS PRODUCT IN ITS PROPOSED LOCATION HAS SIGNIFICANT COMPLICATIONS. THE PRIMARY ISSUE WITH MS. AMMONIA PLANT IS ITS LOCATION. WHICH IS NEAR CURRENT AND FUTURE RESIDENTIAL AREAS. FRANKLY, I AGREE WITH THE CONCERNS OF CURRENT RESIDENCE WITH THE AMMONIA PLANT BEING PLACED SO CLOSE TO HOMES AND SCHOOLS.

ULTIMATELY, THIS PRODUCT SHOULD BE PLACED IN AN INDUSTRIAL AREA, NOT A RESIDENTIAL AREA WHERE PEOPLE LIVE, FORM, AND WHERE CHILDREN ATTENDED SCHOOL. A SECONDARY ISSUE IS THE LARGE AMOUNT OF WATER THIS PLANT WILL USE AND HOW THAT WATER USAGE WILL IMPACT THE CITY OF CORPUS CHRISTI AND THE REGION. THE PLANT IS PLANNING TO USE WATER FROM THE NUECES RIVER. THIS MAY CREATE FUTURE PROBLEMS FOR THAT NUECES RIVER, THE CITY OF CORPUS CHRISTI, AND THE CITY'S ABILITY TO SUPPLY WATER TO ITS CUSTOMERS. THROUGHOUT THE REGION. THE AMMONIA PLANTS TEAM HAS NOT MET WITH THE CITY OVER THE WATER ISSUE BUT REGARDLESS OF THE AMMONIA PLANT'S FINAL LOCATION, THIS NEEDS TO HAPPEN VERY SOON. I AM NOT AGAINST INDUSTRIAL GROWTH OR THE PROJECT IN GENERAL, HOWEVER, THE LOCATION AS WELL AS THE WATER USAGE PRESENTS REALISTIC ISSUES FOR OUR COMMUNITY. THE AMMONIA FACILITY NEEDS TO RELOCATE TO AN INDUSTRIAL AREA, POSSIBLY WITHIN THE PORT OF CORPUS CHRISTI AND WORK WITH THE CITY OF CORPUS CHRISTI WITH THEIR WATER NEEDS TO ENSURE THE PROPER DEVELOPMENT OF WATER RESOURCES FOR OUR REGION. I HAVE SHARED MY CONCERNS WITH THE AMMONIA PLANT RUBBER SENSITIVES SO THEY ARE AWARE OF MY POSITION. AS HER CITY COUNCILMAN AND CANDIDATE FOR COMMISSIONER FOR PRECINCT 1, I WILL CONTINUE OPEN CONDITION WITH OUR CITIZENS AND AMMONIA PLANT LEADERSHIP. I WILL SAY IN CLOSING, THE WATER ISSUE IS REAL. THE CITY OF CORPUS CHRISTI IS THE REGIONAL WATER SUPPLIER FOR SEVEN COUNTIES AND

HALF 1 MILLION PEOPLE. >>

>> CITY COUNCIL WAS NOTIFIED THIS MORNING THAT AS OF FRIDAY, OUR WATER CAPACITY IN THE TWO RESERVOIRS WILL DROP BELOW 30%.

AND SO IT IS A REAL ISSUE FOR THIS COMMUNITY. THANK YOU VERY

MUCH. >> JUDGE?

>> YES? >> DOES THAT SOUND TO YOU LIKE CANDIDATE SPEECH? A CAMPAIGN SPEECH?

>> IT WAS THE CITY'S POSITION AND HE STATED WHO HE WAS.

>> HE IS AN INDIVIDUAL. AND I DON'T CARE IF HE IS RUNNING BUT LAST TIME HE TRIED TO CORRECT ANOTHER CANDIDATE.

>> HE FINISHED HIS SPEECH LAST TIME AS WELL.

>> HE DID. HE DID, BUT HE ALSO WANTED TO CONTEST WHAT HE DID.

THIS IS WHAT I AM TALKING ABOUT BEING TRANSPARENT.

>> AND HE PROBABLY SHOULDN'T HAVE ANNOUNCED HIS CANDIDACY THAT MADE IT MORE OF A POLITICAL THING BUT WE ALL KNOW HIM AS THE FORMER COMMISSIONER AS WELL, SO IN THE FUTURE, COMMISSIONER, IF YOU WOULD NOT ANNOUNCE THAT AT ANY SPEECHES OR ANYTHING LIKE THAT. WE HAD THIS COME UP AT ANOTHER TIME BUT THE OTHER INDIVIDUAL WAS ALLOWED TO SPEAK AS WELL.

>>

NAMES OR ATTACK ANYBODY. >>

>> I AM WITH YOU. I AGREE. >> OKAY. MOVING ON. BENNY

PEREZ . >> MY NAME IS BENNY PEREZ. 3782 BARBARA LANE , ROBSTOWN, TEXAS. CORPUS CHRISTI GOES UP TO THE BACK MY PROPERTY THERE. THE COMMENTS ARE FROM MY WIFE. I'M REPRESENTING HER SO THESE ARE HER COMMENTS AND NOT MINE.

FIRST AND FOREMOST, SAFETY OF OUR COMMUNITY IS WHAT IS ALL ABOUT UNDER CATASTROPHIC EMERGENCIES. WE HAVE

[00:50:01]

LONG-LIVED FAMILIES. MANY DID NOT HAVE NEW TECHNOLOGIES IN THEM AND UNDERSTAND LOOK AT THE ALERTS THAT THEY WANT. WANT TO KNOW WHY THEY CHOOSE SUCH A RURAL AREA IN OUR ESTABLISHED COMMUNITY AND THIS PROJECT IS NOT AN INDUSTRIAL AREA AND THE CITY OF CORPUS IS NOT HEAVILY INVOLVED IN IT ALTHOUGH IT IS A COUNTY ISSUE. THE WATER, YOU HEARD MANY PEOPLE TALK ABOUT , HOW MUCH WATER THEY ARE GOING TO USE, HOW MUCH WATER THEY'RE NOT GOING TO TERMINATE BUT HOW MUCH WATER THEY WILL SUPPLY BACK OR IF THIS IS REGENERATING THE WATER THAT THEY CONTINUE TO USE AND HOW THEY GET RID OF IT. THE COMPANY IS REQUIRING A TREMENDOUS AMOUNT OF WATER WHICH WE HAVE TALKED ABOUT AND WE ARE UNDER CONCERTED CONDITIONS AT CERTAIN TIMES WHERE WE HAVE TO RESTRICT OUR WATER USE. WHAT HAPPENED TO UNDERGROUND WATER? IN THE RESERVES, THERE ARE SOME SITES AROUND THAT AREA ALSO THAT ARE SUPERFUND THAT HAVE TO BE OR ARE BEING IN THE PROCESS OF BEING CLEANED UP AND STUFF AND I HAVE CONCERNS ON WHETHER THEY WILL BECOME SUPER FUNDS OR WITH A CONTAMINATING THE UNDERGROUND WATER FACILITIES.

WE HAVE OUR FAMILIES, OUR CHILDREN, SCHOOLS, BUSINESS, COMMUNITIES. THE WHEN THEY MENTIONED THAT I DIDN'T MENTION IS THE CAL ALLEN SCHOOLS WHICH IS TO THE EAST OF THIS FACILITY, WHICH IS STILL IN THE RANGE. WHAT RIVER ELEMENTARY. THE HIGH SCHOOL IS JUST DOWN THE ROAD. THERE IS AN INDIVIDUAL AREA IN OUR CITIES AND COUNTIES THAT ARE MORE SUITED FOR THIS. I WORKED AT A REFINERY FOR 42 YEARS SO I KNOW WHERE IT SHOULD BE PUT AT AND NOT OUT HERE IN A RURAL AREA. IF THE LEADERS HAVE TALKED TO THE INDIVIDUALS OR ANOTHER PERSON THAT TALKED ABOUT WHERE, IT JUST DIDN'T SEEM LIKE WE ARE NOTIFIED AND I'M SURE THERE WERE NOTIFICATIONS OUT THERE BUT WE DIDN'T READ THEM BECAUSE WE DID NOT READ THAT NEWSPAPER OR CERTAIN MEDIUM, THAT FALLS ON US BUT IT IS GOOD BUSINESS FOR THEM TO GET IT OUT TO THE COMMUNITY AND THE NEXT ONE IS, IT IS A FOREIGN COMPANY, WHICH PEOPLE HAVE TALKED ABOUT, AND ARE THE RESOURCES -- I AM A FORMER WERE VENTURE BY TRAIT. NOW I AM RETIRED BUT THE FERTILIZER COULD BE AWFULLY WELL USED HERE INSTEAD OF BEING SHIPPED OUT TO OTHERS. THERE ARE SEVERAL MORE ITEMS BUT OTHER THAN THAT, I THINK YOU FOR YOUR TIME AND GIVING ME THE TIME AND THANK YOU FOR YOUR SERVICE. THANK YOU.

>> THANK YOU. THAT WAS THE LAST OF THE PUBLIC COMMENT. I'M GOING TO GO AHEAD AND BRING UP ITEM 3A.2 .

>> LIKE TO SPEAK? YOU NEED TO COME UP AND STATE YOUR NAME.

>> YOU NEED TO SIGN. >> STATE YOUR NAME AND ADDRESS

AND YOU NEED TO SIGN THIS. >> MORNING. MY NAME IS SANDRA ANDRES MANDY . I LIVE AT THE OPPOSITE CORNER OF THE AVENA PLANT, OKAY? THAT IS LESS THAN 100 FEET. I DON'T HAVE A LARGE PROPERTY BUT I RETIRED FROM THE CITY OF AUSTIN ABOUT 13 YEARS AGO AND I MOVED HERE 10 YEARS AGO TO MY PROPERTY.

IT TOOK ME A LONG TIME TO FIND THIS PROPERTY HERE IN --

>> TO FIND THE PROPERTY IS DURING THAT TIME WE WERE TRYING TO FIND OUR HOME, WE ENDED UP , YOU KNOW, GOING THROUGH SO MANY HOMES. THERE WERE HOMES THAT WEREN'T AVAILABLE AT THE TIME AND IS SOME THAT WERE PRETTY RUN DOWN. OKAY? WE FOUND THIS HOME AND MY HUSBAND AND I BOTH AGREED. THIS IS PERFECT FOR US.

WE ARE GETTING OLDER. WE CAN DO TOO MUCH PROPERTY SO WE LOVED IT, OKAY? I JUST HAD MY GREAT-GRANDDAUGHTER MOVE IN WITH US. SHE IS SIX MONTHS OLD AND WHEN I FOUND OUT IT WAS THREE WEEKS AGO, OKAY? I DON'T UNDERSTAND WHY WE NEVER GOT NO COMMUNICATION, YOU KNOW? THERE IS MALE. THERE IS A SOCIAL MEDIA. THERE IS EMAIL. THERE IS NEWS MEDIA, BUT NOBODY GOT NO INFORMATION THAT THIS WAS COMING OUT. IT IS GOING TO BE DANGEROUS FOR US BECAUSE IF SOMETHING WERE TO HAPPEN, WE ARE THE FIRST ONES TO KNOW RIGHT THERE. AND I AM SURE THAT NONE OF YOU WOULD WANT TO LIVE RIGHT NEXT TO A PLANT THAT YOU DON'T KNOW WHETHER IT IS GOING TO HAPPEN, IT IS NEW TECHNOLOGY, IS IT GOING TO EXPLODE, IS IT GOING TO RELEASE TOO MANY CHEMICALS AND MAYBE 20 YEARS AFTER WE INHALED THEM WILL CAUSE HARM TO US OR TO MY GREAT-GRANDDAUGH TER. YOU KNOW, I DON'T WANT THIS PLANT BECAUSE OF THOSE

[00:55:03]

SITUATIONS. IT IS LIKE HAVING ASBESTOS MATERIAL EXPOSED. YOU DON'T SEE THE EFFECTS UNTIL 25 YEARS LATER. OKAY? THE WATER USAGE IS ANOTHER CONCERN FOR ME. I TRIED TO KEEP RAINWATER SO I CAN WATER MY PLANTS BECAUSE I WANT TO DO MY PART IN SAVING WATER. I WANT TO BE ABLE TO TELL MY GRANDSON AND HIS WIFE, OKAY, DON'T WASH EVERY DAY. I WANT YOU TO WASH ONCE A WEEK. CONSERVE. AND I DO THAT BECAUSE I KNOW THE LAKE LEVELS ARE LOW. WE HAVEN'T HAD ENOUGH FRAME AND IT IS NOT FAIR FOR US TO GO THROUGH ALL OF THIS WITHOUT NO ONE KNOWING.

I AM NOT IN THE CITY OF ROBSTOWN AND I'M NOT IN CAL AL, I AM IN NUECES COUNTY. SOMEBODY SHOULD'VE PUT OUT SOME BEFORE BECAUSE WE VOTE FOR YOU AND PUT OUR TAXES TO YOU.

SO, THAT IS GOING TO BE ON YOUR HEADS BECAUSE THAT IS WHAT WE ARE CONCERNED ABOUT. OUR SAFETY. THANK YOU.

>> THANK YOU. AND CAROLYN BOND.

>> IS ANOTHER ONE? >>

>> NO. >> CAROLYN BOND. 4214 .

FIRST, I WANT TO SAY, AND COMPLETELY FOR INDUSTRY. I SUPPORT INDUSTRY AND ALWAYS HAD BECAUSE WE GET JOBS BUT WHAT I DON'T SUPPORT IS WHERE THIS IS GOING TO BE. THIS IS THE WRONG LOCATION AND I BELIEVE THAT THE REASON THE CITIZENS DID NOT KNOW THAT IT WAS DONE ON PURPOSE. EPIC DO THE SAME THING. THERE WAS NO WAY THEY SHOULD HAVE KNOWN SO THEY SHOULD HAVE SENT OUT FLOWERS, BUT SHOULD'VE HAD SEVERAL PUBLIC MEETINGS. THAT NOT HAPPEN. THEY MAY HAVE HAD ONE THAT I KNOW OF. THE DID NOT HAPPEN. I FOUND OUT THE DAY OF AND HERE IS WHAT I WANT TO DISCUSS THOU. I DON'T LIKE TO MAKE INNUENDOS BUT YOU WERE GOING TO HAVE THE OPPORTUNITY, COMMISSIONER MAREZ, TO ANSWER SOME QUESTIONS AND I HOPE YOU WILL ANSWER THEM. SOUTH TEXAS IS AUTHORITY. YOU ARE LISTED AS THE DIRECTOR. WHAT THEY DO IS WORK WITH THE WATER SUPPLY CORPORATIONS AND GOVERNMENT ENTITIES TO SUPPLY WATER AND OTHER THINGS. SO THAT IS WHAT THE WEBSITE SAYS. SO YOU WOULD HAVE KNOWN AND PROBABLY KNEW WAY BEFORE USE DID AND THAT SHOULD HAVE BEEN REPORTED. THAT TO ME IS A CONFLICT AND WHAT I WANT TO ASK IS HOW CAN IT BE THAT YOU CAN SERVE ON BOTH BOARDS? YOU SERVE YOUR AND YOU SERVE THERE. THAT NEEDS TO BE ANSWERED. THE NEWS NEEDS TO LOOK AT THAT. THEY LISTED AND THE CALL YOU A CONSULTANT. THAT IS A GREAT WAY FOR BUSINESSES TO DO WHEN I DO NOT WANT TO PUT YOU DOWN AS AN EMPLOYEE SO IF THE HAS SOMETHING TO DO OR WHAT YOU ARE CONSERVING AND YOU CAN SERVE, I DON'T KNOW. I DON'T WANT TO ACCUSE YOU OF THAT THAT NEEDS TO BE ANSWERED AND YOU WILL HAVE THE OPPORTUNITY, I HOPE, TO DO THAT TODAY. ANOTHER RUMOR THAT IS GOING ON AROUND THAT NEEDS TO BE ANSWERED BECAUSE I ALWAYS THINK YOU NEED TO FOLLOW THE MONEY. THE WATER CONTROL IMPROVEMENT DISTRICT OUT THERE NUMBER THREE. REMEMBER THE LAND THAT WAS PURCHASED WAS FROM A PREVIOUS BOARD MEMBER. HE HAS A RIGHT TO TO SELL IT BUT WE NEED TO KNOW THAT, I THINK. AND IT WAS AT A VERY HIGH PRICE FOR THE LAND. SO, IF THIS COMPANY HAS THE KIND OF MONEY THAT THEY ARE SAYING THAT THEY PURCHASED, YOU HAVE MONEY TO HAVE A LONGER PIPELINE. WE HAVE THREE SCHOOLS OUT THERE AND WE ARE GOING TO BE THE HILLCREST OF CORPUS CHRISTI. THE NEXT ONE IF THESE INDUSTRIES COME OUT THERE. WE ARE BEGINNING TO LOOK LIKE PORT O'CONNOR WHEN YOU COME IN. WE NEED TO HAVE A PRETTY CITY. WE DON'T NEED TO CONTINUE TO DO THIS. THERE'S OTHER BUSINESS TAKING ON. I DO SUPPORT THEM HAVING THE BUSINESS. I DON'T HAVE A PROBLEM WITH THAT BUT DO NOT PUT IT THERE. THE ONLY THING THAT THIS COURT CAN DO IS Y'ALL DON'T HAVE THE JURISDICTION. YOU DON'T HAVE IT AND A LOT OF PEOPLE DO NOT UNDERSTAND THAT. IT IS GOING TO BE ROBSTOWN THE SCHOOL DISTRICT IF THEY ASK YOU FOR ABATEMENTS, YOU CAN SAY NOW AND TO ME, IF YOU ARE ON THE BOARD, YOU SHOULD RECUSE YOURSELF. AND COMMISSIONER HERNANDEZ, I CHALLENGE YOU. I APPRECIATE THE FACT THAT MY COUSIN IS HERE TODAY SPEAKING OUT FOR THE COMMUNITY AND I CHALLENGE YOU

TO HELP AND THAT IS YOUR AREA. >> FOUND ACCEPTED, MA'AM.

>> THANK YOU. >> IS OR ANYONE ELSE WHO

[2. Receive a presentation from AVINA Clean Hydrogen Inc. ]

WISHES TO SPEAK ON PUBLIC COMMENT? THERE BEING NONE, I AM GOING TO PULL UP ITEM 3A.2 ON RECEIVING THE PRESENTATION BUT BEFORE WE DO THIS WANTED TO RESTATE WHAT COMMISSIONER STATED. THE COUNTY HAS NO AUTHORITY ON THIS. WE DID NOT ALLOW OR NOT ALLOW. THE ONLY THING THAT WE CAN DO AND THEY HAVE NOT ASKED FOR THAT IS ABATEMENTS IN THE FUTURE. THIS PRESENTATION WAS BROUGHT TODAY AT THE REQUEST OF THE CITIZENS

[01:00:03]

BECAUSE OF THIS KIND OF INFORMATION AND, FOR MANY OF YOU THAT AREN'T AWARE, I LIVE ABOUT THREE MILES DOWN PAST THIS LOCATION AS WELL, SO I AM PERSONALLY AFFECTED. MY GRANDKIDS LIVE ABOUT HALF A MILE FROM THIS SO, YES, I TOTALLY UNDERSTAND YOUR CONCERNS AND I WANT WHOEVER COMES THERE AND WHEN THEY COME HERE TO DO IT SAFELY AND WITHIN THE BOUNDS OF THE LAW AND WHAT WE ARE SUPPOSED TO DO. WE DO HAVE A PRESENTATION. KAREN, ARE YOU GOING TO BE GIVEN THIS, DURING WRIGHT OR MICHELLE? I THINK THERE IS A VIDEO AND THEN COMMISSIONER HERNANDEZ WANTS TO SPEAK .

>> WE ARE GOING TO COME BACK TO THIS AFTERWARDS. YES. NO, WHEN A BROWN SO I CAN GET CONFUSED.

>> YOU SIGN UP FOR PUBLIC COMMENT? WE ARE ON THE AGENDA ITEM NOW

SO -- BUT YOU MADE A COMMENT. >> NO, I BROUGHT THE AGENDA ITEM UP AND CLARIFIED FOR THE COUNTY.

>> THANK YOU. >> THANK YOU.

>> US TO PRESENT AND THANKS FOR YOUR COMMENTS AND WE WANT YOU ALSO ALSO COME TONIGHT TOWNHALL THAT WE ARE HOSTING WHERE WE HAVE INVITED SOME ADDITIONAL MEMBERS FROM THE COMMUNITY , FROM THE AMMONIA INDUSTRY TO TALK ABOUT SAFETY IN PARTICULAR SO THAT WE CAN ADDRESS SOME OF THOSE CONCERNS THAT PEOPLE HAVE HAD. I WANT TO INTRODUCE MYSELF AS THE FOUNDER AND CEO OF AVENA HYDROGEN. WE ARE GOING TO GO WITH SOME SLIDES BUT PLEASE FEEL FREE TO STOP ME IF YOU HAVE ANY OTHER QUESTIONS. SO, WITH THAT, LET ME JUST MOVE ON TO THIS PAGE HERE, WHICH TALKS ABOUT GREEN AMMONIA. AND BEFORE I GO INTO GREEN AMMONIA, I CAN JUST TALK A LITTLE BIT ABOUT AVENA.

AVENA IS A COMPANY BASED OUT OF NEW JERSEY THAT WAS ESTABLISHED IN 2019 . IT HAS BEEN IN OPERATION AS A DELAWARE LISTED ENTITIES SINCE 2021 AND WE HAVE BEEN DEVELOPING PLANTS ALL OVER THE COUNTRY. THERE ARE FIVE PLANTS IN DIFFERENT STAGES OF DEVELOPMENT. THE FIRST ONE IS GOING TO COME ONLINE THIS YEAR IN CALIFORNIA AND OUR OBJECTIVE AND OUR MISSION IS TO REALLY HELP THE ENVIRONMENT TO DECOLONIZE SECTORS SUCH AS FERTILIZERS, SUCH AS OTHER INDUSTRIES THAT CANNOT BE DECOLONIZE WITH ELECTRICAL INFRASTRUCTURE AND THAT IS WHY WE ARE DOING THIS. ALL OF THE CONCERNS THAT WE HAVE HEARD ABOUT WATER AND THE ENVIRONMENT, OUR HOPE IS THAT THESE INDUSTRIES ARE GOING TO HELP THE ENVIRONMENT AND MITIGATE SOME OF THOSE CONCERNS ABOUT THAT RESERVOIR THAT WE HAVE SEEN EVERYWHERE INCLUDING HERE IN NUECES COUNTY. SO WHAT GREEN AMMONIA IS IS IT TAKES HYDROGEN THAT IS PRODUCED USING ELECTRICITY OR NO POWER AND COLLIDES IT WITH NITROGEN FROM AIR TO PRODUCE PNEUMONIA, WHICH IS USED IN MANY APPLICATIONS TODAY AND IT WILL HAVE SIGNIFICANTLY LARGER NUMBER OF APPLICATIONS IN THE FUTURE. ALL OF THE INDUSTRY THAT YOU SEE AROUND HERE, INCLUDING THE LARGE OIL AND GLASS COMPANIES THAT ARE SUPPLYING TO INTERNATIONAL MARKETS AS WELL AS DOMESTIC MARKET LIKE INNOVATIONS AND MARITIME FIELDS ET CETERA WILL EVENTUALLY BE MOVING TO FEEL FUELS LIKE AMMONIA AND HYDROGEN. I THINK THIS IS THE INDUSTRY OF THE FUTURE. THIS IS WHERE A LOT OF THE JOBS ARE GOING BE MADE AND WE ARE EXCITED TO ACTUALLY BRING THIS INDUSTRY IN ROBSTOWN AND IN NUECES COUNTY. THE NEXT SLIDE TALKS ABOUT THE DIFFERENT WAYS THAT AMMONIA IS MADE TODAY. IT ADMITS ABOUT TWO AND AFTER THREE TONS OF CO2 PER TON OF AMMONIA PRODUCED. OUR PRODUCTION METHOD BASICALLY PRODUCES NO CARBON DIOXIDE EMISSIONS AND WE WILL TALK ABOUT SOME OF THE OTHER OMISSIONS LATER TODAY. I AM HAPPY TO ANSWER SOME OF THE QUESTIONS, BUT THE ADMISSIONS THAT WE ARE TALKING ABOUT ARE EXTREMELY MINOR OMISSIONS THAT ARE COMING OUT OF THE USE OF NATURAL GASES AS WE START THAT PROCESS. THOSE ARE ALL CALCULATIONS THAT HAVE BEEN MADE BY INDUSTRY CONSULTANTS THAT DO THIS FOR A LIVING AND WE ARE OBVIOUSLY BEING ON THE CONSERVATIVE SIDE WHEN IT COMES TO OMISSIONS AND WATER USAGE, WE WILL TALK ABOUT THAT. THE OTHER PRODUCTION PROCESS IS BLUE AMMONIA, WHICH IS A PLAN THAT WAS PROPOSED IN A DIFFERENT LOCATION AND ROBSTONE CORPUS CHRISTI. THAT PLAN ALSO HAS SOLUTIONS. THAT PLAN IS ZERO CARBON EMISSIONS. THE NEXT POINT I WOULD MAKE IS THAT OUR INTENTION IS TO USE -- THE NEXT SLIDE TALKS ABOUT THE USE OF RENEWABLE POWER TO PRODUCE

[01:05:03]

RENEWABLE ENERGY AND GREEN HYDROGEN. AND THIS IS ALREADY THE POWER THAT WILL BE PRODUCED IN THE STATE OF TEXAS.

IN SOUTH TEXAS THAT WILL PRODUCE ADDITIONAL JOBS AND INVESTMENTS. SO, THIS SLIDE TALKS ABOUT EXISTING AMMONIA PLANTS IN OPERATION ALL OVER THE COUNTRY. THERE ARE MORE THAN 30 PLANTS IN OPERATION. MORE THAN HALF OF THEM ARE IN RESIDENTIAL COMMUNITIES WITHIN HALF A MILE AWAY FROM DENSELY POPULATED RESIDENTIAL COMMUNITIES AS WELL AS SCHOOL DISTRICTS AND WE HAVE AN EXPORT THAT IS COMING TODAY TO TALK ABOUT SOME OF THESE OPERATIONS AND PLANTS THAT HAVE BEEN OPERATING SAFELY WITHOUT ANY INCIDENTS FOR DECADES. OUR PLANT IS GOING TO BE SMALLER ON AVERAGE THAN A LOT OF THE OTHER PLANTS IN OPERATION. SO I JUST WANT TO REASSURE YOU THAT SAFETY IS EXTREMELY IMPORTANT TO US. WE ARE GOING TO TAKE ALL OF THE MEASURES ARE REQUIRED BY LAW, D.C. AND OTHER REGULATORY AGENCIES TO UP RIGHT THIS PLANT SAFETY. TO DESIGN IT SAFELY

AND OPERATE AS WELL. >> I GUESS I CAN ASK QUESTIONS ABOUT THE AGENDA ITEM. IS THAT YOURS IS THE FIRST OF ITS KIND.

IS THAT BECAUSE IT IS RUN BY SOLAR?

>> THAT IS RIGHT. THE AMMONIA PRODUCTION PROCESS IS 100-YEAR-OLD PROCESS. IT IS A TECHNOLOGY USED BY KB ARE. THEY HAVE MORE THAN 50% MARKET SHARE IN INDUSTRIES SO WHAT WE'RE DOING IS INSTEAD OF USING HYDROGEN THAT IS QUITE USUALLY MADE USING NATURAL GAS, WE ARE MAKING HYDROGEN USING

RENEWABLE ENERGY. THAT IS IT. >> OKAY. SORRY. GO AHEAD.

>> IS FINE. THAT TECHNOLOGY FOR PRODUCING HYDROGEN HAS BEEN ALONG FOR A LONG TIME AS WELL. IT HAS BEEN AROUND FOR 25 OR 30 YEARS. THE COSTS HAVE COME DOWN. THE RISK THAT WE ARE TAKING IS THE FINANCIAL RISK OF THAT TECHNOLOGY NOT PERFORMING TO ITS EXPECTATION BUT IT IS EXTREMELY SAFE TECHNOLOGY. I JUST WANT TO BE SURE YOU OF THAT. THE NEXT SLIDE TALKS ABOUT HOW WE ARE GOING TO MOVE THE PRODUCT AND TYPICALLY, WHATEVER RELEASES YOU HAVE SEEN AND INCIDENTS THAT HAVE HAPPENED IN THE PAST OF AMMONIA TRANSPORT BEING MISHANDLED EITHER THROUGH RAIL OR THROUGH TRUCKS. OUR MOTIVE TRANSPORTATION IS ONE WHO THROUGH PIPELINES THAT WILL MINIMIZE ANY LEAKAGE YOU WOULD EXPECT FROM OTHER MODES OF TRANSPORTATION. . SO, THE NEXT SLIDE TALKS ABOUT WATER AND I WILL HAND IT OVER TO KAREN TO TALK ABOUT THIS, BUT BEFORE I HANDED OVER TO KAREN, I WANT TO ITERATE THE FACT THAT YES, WATER CONSUMPTION IS GOING TO BE HIGHER FOR OUR FACILITY BECAUSE OF THE PRODUCT THAT WE ARE PRODUCING BUT IF YOU COMPARE OUR WATER CONSERVATION EFFORTS FOR THIS PARTICULAR DESIGN, THEY WILL ACTUALLY ALLOW YOU TO SAVE A LOT MORE WATER THAN ANY OTHER INDUSTRY IN OPERATION TODAY IF WE LOOK AT ALL OF THE LARGER INDUSTRIES THAT ARE CONSUMING MORE THAN 10 MILLION GALLONS PER DAY OF WATER. OUR WATER USAGE WOULD BE SIGNIFICANTLY LOWER THAN THAT AND WE WILL TAKE ALL THE MESSIEURS TO CONSERVE WATER AND BE STEWARD CITIZENS AND OPERATORS OF THE PLAN. LET ME TURN IT OVER TO KAREN.

>> WHAT WAS YOUR NAME ? >>

>> KAREN WHITE FRAME. DIRECTOR OF THE 24 AVINA CLEAN HYDROGEN. I HAVE WORKED VERY CLOSELY ON THIS WATER ISSUE FROM THE OUTSIDE WITH BOTH LOCAL PARTNERS AND FOLKS ACROSS THE COUNTY TO UNDERSTAND HOW DO WE FIT INTO THE MIX. AND SO, WHAT WE PRESENTLY HAVE IS A 25 YEAR TAKE OR PAY WATER CONTRACT WITH WCA NUMBER THREE AND IN THAT CONTRACT, WHAT WE TALK ABOUT IS THAT WE ARE IN FACT GOING TO PAY FOR ALL THE CAPITAL INVESTMENTS THAT ARE REQUIRED TO BRING THAT WATER RESORTS TO THE PLANT AND THAT WILL HOPEFULLY BE BRINGING MUTUALLY BENEFICIAL RESEARCHES TO THE WATER RESOURCES THAT SERVES THE POPULATION OF CUSTOMERS THAT ARE PRESENTLY IN THAT REGION. WE HAVE BEEN CONSERVATIVE. AS DEVELOPERS, WE START A PROCESS AND WE DON'T KNOW ALL THE FACTS. AND AS WE ENGINEER SOLUTIONS AND ITERATIVELY GO THROUGH THE PROCESS, WE GET TO A PLACE WHERE WE CAN HONE IN ON THE EXACT FACTS. SO RIGHT NOW, THE WATER CONTRACT IS FOR SLIGHTLY OVER 6 MILLION GALLONS PER DAY AND THE INTENTION IS TO LOOK AT A HIERARCHY OF REJECTION, REUSE, RECYCLING, AND RECLAMATION TO REDUCE THAT TO THE MAXIMUM EXTENT POSSIBLE DURING THE ENGINEERING PHASES OF THE PLANT'S DESIGN BECAUSE WE DO UNDERSTAND THE WATER ENERGY NEXUS VERY WELL AND IT IS SOMETHING THAT I HAVE TAKEN SERIOUSLY , PERSONALLY, SINCE THE BEGINNING OF MY CAREER. THE OTHER PIECE OF WATER IN THAT IRRIGATION DISTRICT THAT HAS GOT A RURAL HISTORY THAT IS

[01:10:01]

NOW MORE ANALYZED AS A WATER DISTRICT IS THAT THERE ARE SEASONAL FLOODING PERIOD THAT UTILIZE ALL OF THOSE IRRIGATION CHANNELS THAT ARE CURRENTLY THERE. THE FEEDBACK WE HAVE RECEIVED IS WE SHOULD BE RUNNING FOR A 100 YEAR FLOOD EVENT AND BUILDING STORMWATER MANAGEMENT SYSTEMS FOR THAT DEVOTED INSTEAD FOR A 200 YEAR FLOOD WATER SYSTEM EVENT AND BUILD A SYSTEM THAT HAS A HIGHER STANDARD BECAUSE THE INTENTION IS TO ENSURE THAT WHATEVER WE DO ON OUR PLANT SITE DOES NOT HAVE A INTENDED IMPACTS DOWN THE WAY IN TERMS OF ADDITIONAL STORMWATER RUNOFF AND CONCERN. I THINK THAT IS IT FOR THAT SLIDE. SO THEN, AVINA HAS BEEN IN THE PROCESS OF HONING IN ON ALL OF THE JOBS AND ENGINEERING DETAILS THAT COME WITH BOTH INSTRUCTION AND DAILY OPERATIONS OF THE PLANT , AND SO WHAT WE HAVE DONE IS WE HAVE GONE OUT AND IDENTIFIED WHAT WE THINK ARE THE KEY 75 EMPLOYEES THAT WILL BE DIRECT HIRES, THAT WILL WORK ON THAT PLANT EVERY DAY AND WE ARE WORKING WITH OUR CONSTRUCTION PARTNERS ON WHAT CONSTRUCTION WORKFORCE WILL LOOK LIKE. SO WE HAVE BEEN REASONABLY CONSERVATIVE IN THESE NUMBERS BECAUSE THE INTENTION IS TO UNDER PROMISE AND OVER DELIVER AND NOT THE CONTRARY. THE CONSTRUCTION PERIOD IS GOING TO BE ABOUT TWO YEARS LONG AND YOU WILL SEE $500 PER YEAR ON THE CONSTRUCTION SITE. AND THEN AFTER THAT PERIOD OF TIME, YOU WILL HAVE ALL OF THE OPERATORS, ENGINEERS, THE VARIOUS PEOPLE THAT DO LIFECYCLE CARBON ANALYSIS AND AUDITING AND PROCESS IMPROVEMENT INSTRUMENTATION, LAB WORK, WILL WORK ON THE SITE IN THE ADMINISTRATIVE BUILDING AND OF THOSE FOLKS, WE ARE EXPECTING A VAST MAJORITY OF THEM TO BE FOLKS THAT CAN COME OUT OF HIGH SCHOOL, GET A TWO YEAR DEGREE AND ENTER PLANT OPERATIONS. FROM THE PERSPECTIVE OF THE STRUCTURE UPGRADES, GENERALLY WE HAVE ALREADY TALKED ABOUT WATER BUT ON THE ELECTRIC POWER SIDE, WE ARE ALSO DOING RESOURCE DEVELOPMENT. SO WE ARE WORKING WITH AN EC, THE NUECES ELECTRIC COOPERATIVE TO GRANT THEM LOCATION TO PUT IN PLACE A NEW SUBSTATION THAT WILL SUPPORT BOTH OUR NEEDS AND AND ONLY BE AVAILABLE FOR SUPPORTING ADDITIONAL NEEDS THAT MIGHT COME IN THAT REGION. AND THEN, -- SO ON THE ADDITIONAL PIECES ON TAX, WITH THESE TEXT NUMBERS LOOK LIKE AND THE LOCAL BENEFITS THEY ARE ARTICULATED NOT BY ME BUT BY JIM LEE AT TEXAS A&M KINGSVILLE AND THEY SAY IN ABSENCE OF A TAX ABATEMENT, WHAT WOULD THE TAX CONTRIBUTION OF THE PRODUCT BE IN A GIVEN PERIOD OF TIME? SO, GREATER THAN $20 MILLION IN LOCAL TAX CONTRIBUTION, INCLUDES WHAT WOULD COME INTO THE COUNTY AS WELL AS THE ROBSTOWN ISD. AND AT THIS POINT IN TIME, THE NUMBER WE ARE LOOKING AT IN CAPITAL INVESTMENT IS $2.2 BILLION. I THINK IT IS ACTUALLY ON THE LOW SIDE. WE'RE GOING TO SEE SLIGHTLY MORE CAPITAL INVESTMENT AND AS AGAIN, THE ENGINEERING PROCEEDS AND CONSTRUCTION ESTIMATES GET MORE CONCRETE, THOSE NUMBERS WILL FIRM UP AND WE WILL BE ABLE TO MAKE THAT AVAILABLE. THIS LAST POINT IS ON THE FACT THAT WHAT WE ARE BUILDING HERE OR INTENDING TO BUILD HERE IN NUECES COUNTY IS A 21ST CENTURY FUELS PLAN. IT IS A PLANT THAT 25 TO 30 YEARS FROM NOW, WE WILL QUESTION WHY DID WE BUILD IT. WE WILL SAY, WHY DIDN'T WE BUILD MORE OF THEM FASTER BECAUSE THE ECONOMIES OF THE WORLD ARE PUTTING PRESSURE ON ALL OF US TO COME UP WITH CARBON SOLUTIONS. TO COME UP WITH SOLUTIONS TO HARD TO ABATE SECTORS, RIGHT? RIGHT NOW, THE MARITIME INDUSTRY USE BUNKERING FUEL TO MOVE VESSELS ALL OVER THE WORLD WHICH HAS A HORRENDOUS AIR POLLUTION IMPLICATIONS AS WELL AS CO2 IMPLICATIONS AND WHAT THESE PRODUCTS LIKE AMMONIA WILL DO IS IN THE GROWING MARITIME SPACE REPLACED BUNKER FUEL AS THE UTILIZED FUEL ON LONG-DISTANCE SHIPPING HALLS WHICH IS SOMETHING LIKE 7% OF THE WORLD'S CO2 FOOTPRINT TODAY IS JUST THAT INTERNATIONAL SHIPPING BALANCE.

AND SO THE INTENTION IS FOR THIS PLANT CANNOT JUST COME HERE AND BRING IN EMPLOYEES FROM SOMEWHERE ELSE, IT IS TO COME HERE AND DEVELOP ALONG WITH THE LOCAL COMMUNITY SCHOOLS WHETHER THAT IS IN A COUNTY, ROBSTOWN ISD, DELMAR, AND THE VARIOUS UNIVERSITIES HERE, A PIPELINE SO STUDENTS CAN COME UP FROM THERE IN THE CARTON ALL THE WAY THROUGH TO HIGH SCHOOL AND START TO GET SOME EXPOSURE, EXPERIENCE, TRAINING AND CERTIFICATES ON BE ABLE TO, ON THEIR CHOICE, APPLY FOR APPRENTICESHIP IN THE PLANT AND BE ABLE TO FROM THERE CONTINUE TO WORK FOR THE PLANT, BE PAID TO WORK FOR THE PLANT, AND GRADUATE WITHOUT DEBT SKILLS THAT FIT INTO A GLOBAL WORKFORCE THAT IS ONLY PROCEEDING TO GROW FURTHER.

[01:15:03]

AND SO THE INTENTION HERE IS NOT ONLY TO LOOK AT THE K-12 AND POSTGRADUATE PIPELINE BUT TO ALSO LOOK AT HOW DO WE PROVIDE PRESENT FOLKS IN THE COUNTY WHO WANT TO POTENTIALLY WORK AT A PLANT LIKE THIS WITH THE RESCALING CLASSES THAT THEY MIGHT NEED IN ORDER TO COME IN? AND SO WE ARE ACTIVELY WORKING WITH THE DELMAR AND HOW DO WE MAKE SURE THAT WE HAVE PROGRAMS IN PLACE THAT ARE THERE EARLY ENOUGH THAT ANYBODY WHO MIGHT WANT TO APPLY FOR A JOB COULD HAVE THE CERTIFICATES THEY NEED ON THE DAY ONE? THESE ARE THE KINDS OF ROLES THAT THE PLANT IS INTENDING TO HAVE IN THAT 75 EMPLOYEES GROUP, THAT CONSERVATIVE NUMBER OF PEOPLE WHO DAILY OPERATE ON THE PLANT AND THIS IS GOING TO BE LAND MANAGERS, FOLKS WITH ENGINEERING BACKGROUND AND EXPERIENCE, PLUMBERS, ELECTRICIANS, LAB TECHS, INTO IMPLEMENTATION, SAFETY COORDINATORS , FOLKS THAT WORK WITH THE URQUHART . THERE IS A GROWING NEED ON THIS INDUSTRY TO CERTIFY LIFECYCLE CARBON ANALYSIS ALONG WITH LIFECYCLE SPECIFICATION. SO THERE WILL BE A NUMBER OF THOSE FOLKS MAKING AUDITS ACTIVELY. OF COURSE, ALL THAT IS GOING TO BE IN THE ADMINISTERED A BUILDING ON THE SAME PLANT SITE BUT BEYOND THOSE FOLKS WHO DRIVE THERE EVERY DAY AND WORK AT THE PLANT EVERY DAY, WE DON'T HAVE ANY CONSTRUCTIVE PLAN TO HAVE HUGE TRUCKS COMING IN AND OUT OF THE PLANT DAILY. THAT IS NOT PART OF THE OPERATIONAL PERSPECTIVE. AND TO THE EXTENT THAT WE WILL HAVE THOSE ADMINISTRATIVE BUILDINGS ON THE SITE, WE HAVE NOT PUT THE DRIVEWAYS ON 189 BECAUSE WE DO APPRECIATE THAT THAT IS THE MAIN ROAD IN AND OUT OF TOWN. SO, I RECOGNIZE THAT SOME FOLKS MAY FEEL LIKE THEY HAVE NOT BEEN ENGAGED EARLY OR OFTEN ENOUGH IN THE PROCESS, BUT I'M HERE TO SAY AGAIN AS THE DEVELOPER THAT YOU DON'T KNOW YOUR PROJECT IS MOVING FORWARD UNTIL YOU KNOW CERTAIN THINGS ABOUT IT ARE CLEAR. AND SO, AS THAT CLARITY COMES TO A PROJECT, YOU THEN CAN EXPAND YOUR STAKEHOLDER GROUP BECAUSE THE REALITY OF THE PROJECT BEING REALIZED IS GREATER THAN IT WAS BEFORE. SO WE ARE AT THE PHASE OF THIS PROJECT WILL BE ARE EXPANDING THE STAKEHOLDER GROUP AND WE WANT TO HEAR FROM FOLKS ON THE ITERATIVE BASE IF INCORPORATE THE FEEDBACK THAT AWARE RECEIVING CONSTRUCTIVELY TO IMPROVE THE OUTCOMES OF THE PLAN. I KNOW THAT IS NOT MAY BE ENOUGH FOR SOMEBODY WHO SIMPLY DOES NOT WANT IT IN THEIR BACKYARD BUT THERE ARE FOLKS WHO MAY HAVE MORE MODERATE POSITIONS WHERE WE CAN ACCOMMODATE SOME OF THE THINGS THAT THEY MIGHT WANT TO SEE HAPPEN IN AND AROUND THIS PLANT OR COME UP BECAUSE THIS PLANT IS THERE AND THAT IS MY MAP ON THAT. ALL RIGHT. YEAH. THANK YOU. OH, HERE. THIS IS THE LAST SLIDE. AGAIN, WE DID THE STUDY ON REGIONAL ECONOMIC IMPACTS BEYOND THE HYPER LOCAL.

HERE, YOU ARE GOING TO HAVE AN ADDITIONAL 3000 INDIRECT JOBS DURING THE CONSTRUCTION PERIOD FROM THE DOCK OPERATORS, PEOPLE BRINGING VESSELS AND PARCELS IN AND TRANSPORTING THEM TO THE SITE. FOLKS LAYING FOUNDATION, DOING CONTRACTS AROUND ALL THAT WORK AND THAT IS EXPECTED TO RESULT IN $250 MILLION OF ADDITIONAL PERSONAL INCOME TAX TO THE REGION AS A WHOLE AND DURING OPERATIONAL PHASE, AGAIN, BEING ABOUT 150 INDIRECT OR DIRECT JOBS RESULTING IN ANOTHER $20 MILLION OF PERSONAL INCOME GROWTH IN ANY REGION. AGAIN, ON THE TAX CONTRIBUTION, NUECES GREEN AMMONIA WILL REQUEST FROM THIS BODY A TAX ABATEMENT. IT WILL DO THAT, BUT WE ALSO ACKNOWLEDGE THAT IS A CONVERSATION AND THAT CONVERSATION INVOLVES ALL OF YOUR PERSPECTIVES. IN THIS SLIDE, I HAVE PRESENTED IT AS A THE TAX ABATEMENT WAS NOT GRANTED AND SO THAT IS SHOWING $10 MILLION IN TAX CONTRIBUTIONS DURING CONSTRUCTION AND $20 MILLION DURING CONSTRUCTION.

>> CAN YOU EXPLAIN REALLY FOR THOSE IN THE AUDIENCE WHERE YOU ARE IN THE PROCESS BECAUSE MANY PEOPLE THINK THAT IT IS ALREADY A DONE DEAL AND YOU HAVE PURCHASED THE PROPERTY. CAN YOU EXPLAIN? I KNOW YOU HAVE APPLIED FOR PERMITS BUT THEY HAVEN'T BEEN GRANTED. WHAT IS THE TIMEFRAME FOR THAT? THAT

KIND OF STUFF. >> FAIR ENOUGH. IN TERMS OF THE LAND THAT WE HAVE UNDER CONTROL, WE HAVE AN OPTION PURCHASED. WE HAVE NOT DIRECTLY PURCHASED THAT LAND THAT IS ALL DEPENDENT ON THE PRODUCT COMING TOGETHER IN A CLEAR LINE OF SIGHT TO ACTUAL REALIZATION OF THE PROJECT. SO THERE ARE CONTINGENCIES TO BACK OUT OF THOSE LAND TRANSACTIONS IF WE WANT TO DO SO. THE SAME GOES FOR THE WATER CONTRACT.

[01:20:03]

THERE ARE CONTINGENCIES THAT WOULD ALLOW US TO BACK OUT OF THE WATER CONTRACTS WHERE THE PROJECT NOT TO BE OTHERWISE SUPPORTED. AND SO, I THINK WE HAVE A PRETTY GOOD LINE OF SIGHT ON ALL THE VARIOUS PIECES OF THE PROJECT, BUT IT HAS TO COME TOGETHER AND WE WOULD LOVE TO DO SO WITH THE SUPPORT OF THE COUNTY, WITH THE SUPPORT OF THE ISD IN TERMS OF THE TAX ABATEMENT BECAUSE OVERALL, WE BELIEVE THAT THE ECONOMIC IMPACT OF THE PLANT WILL BE BENEFICIAL AND I THINK IF WE CAN HAVE SOME MORE CONVERSATIONS ABOUT WHAT ARE THE CONSTRUCTIVE THINGS THE PLANT COULD DO BEYOND ITS BOUNDARIES AS A CORPORATE CITIZEN WITHIN THAT COMMUNITY, THAT PERHAPS WE CAN FIND A WAY FORWARD FOR THIS PLANT IN THE

COUNTY. >> ANY OTHER QUESTIONS? COMMISSIONER HERNANDEZ, DO YOU WANT TO SPEAK?

>> OUT IS BIG DURING PUBLIC,. THE NEXT ITEM IS PULLED UP.

>> THE LAST TIME WE HAD MET, YOU SAID YOU ALL HAD PURCHASED THE LAND. LAST TIME I SPOKE TO YOU, IT ALSO CONTRACT FOR WATER , OKAY? AND AT ONE TIME, I DID MEET WITH MR. WALLS AND ANOTHER GENTLEMAN THAT IS WITH CORPUS CHRISTI ECONOMIC DEVELOPMENT .

AT NO TIME DID THEY EVER MENTIONED TO ME ANY OF THE CONS OF THIS REFINERY . YOU KNOW, THEY JUST BROUGHT Y'ALL IN AND Y'ALL GAVE ME YOUR SPEECH ABOUT HOW GOOD IT WAS, OKAY? AND I TOLD YOU I AM NOT A CHEMIST. I HAVE NO KNOWLEDGE OF HOW AMMONIA PLANS WORK, BUT I DON'T OBJECT TO PROGRESS. I DON'T TO JOBS, BUT I DO WANT TO BE TRANSPARENT WITH EVERYBODY. FOR THE PEOPLE AND THE PEOPLE THAT I REPRESENT HAVE A PROBLEM WITH IT AND I LIVE BACK THERE ALSO. I HAVE A PROBLEM, JUST LIKE I DID WITH EPIC. I HAD NO KNOWLEDGE OF EPIC. I WAS EVEN ATE COMMISSIONER BACK THEN. I BELIEVE OUR CITY COUNCILMAN WAS AND HAD NO KNOWLEDGE OF IT EITHER. SO I JUST WANT PEOPLE TO UNDERSTAND WHAT WE ARE GOING TO GET INTO IF WE GO FORWARD WITH THIS. JUST YESTERDAY, I HEARD ON THE USE NEWS, I DON'T REMEMBER THE CITY BUT THERE WAS AN EXPLOSION YESTERDAY IN A CHEMICAL COMPANY AND PEOPLE HAVE TO BE EVACUATED. OKAY? SO, WE NEED TO TAKE ALL THESE THINGS INTO CONSIDERATION AND AGAIN, I AM NOT AGAINST PROGRESS. I'M NOT AGAINST JOBS BUT I AM AGAINST THE PUDDING AND EVERYBODY POST YOU BACKYARD. PEOPLE WHO HAVE WORKED SO HARD TO BUY THESE NICE HOMES AND THEN THEIR HOMES ARE GOING TO BE EVALUATED BECAUSE IT IS GOING TO HAPPEN REGARDLESS. SO, THAT IS WHAT I AM AGAINST AND I'M SORRY FOR SOME OF THE POLITICIANS HERE KNEW ABOUT ALL THIS BEFORE I DID. THERE IS A REASON THEY KEEP IT FROM ME, OKAY, BECAUSE I DO NOT KNOW HOW TO KEEP IT SECRET.

>> PUBLIC. MY CONSTITUENTS. WHILE I WAS DOING BLOCK WALKING, PEOPLE WERE ASKING ME ABOUT ALL OF THIS, YOU KNOW, AND I DID NOT HAVE AN ANSWER. I WAS EMBARRASSED BY TOLD HIM I WOULD FIND OUT. I THINK, IF ANYBODY HERE SHOULD SPEAK, THE TWO GERMAN FROM THE ECONOMIC DEVELOPMENT BOARD SHOULD SPEAK AND TELL HIS WIFE THEY DIDN'T MAKE IT KNOWLEDGEABLE TO THE REST OF THE CITIZENS, YOU KNOW? THEY WERE ALSO ASKING, JUDGE, MY COMMENT, WERE ASKING WHAT HAPPENED TO THE INVENTORY AUDIT ? THE AUDIT YOU PROMISED THE PEOPLE YOU WERE GOING TO DO WHEN YOU CAME IN AS A JUDGE? PEOPLE WERE ASKING ME ABOUT THAT. THEY DON'T TRUST US. THEY DON'T FEEL LIKE WE'RE BEING TRANSPARENT, OKAY? AND I HAD TWO LADIES THAT I WALK ON THEIR BLOCK AND THEY JUST HAPPEN TO BE COUNTY EMPLOYEES AND THEY SAID THEY WERE VERY UNHAPPY WITH THE PROCESS THAT WE ARE DOING. THEY ARE NOT GETTING PAID RIGHT OKAY? THEY ARE LOSING MONEY OR THEY FEEL LIKE THEY WILL AND ALSO, SOME OF THEIR TRANSACTIONS ARE BEING LOST. TO ME, THAT IS A PROBLEM.

IF A TRANSACTION IS BEING LOST, THEN WE ARE NOT BEING TRANSPARENT WITH THE PEOPLE. WE NEED TO HAVE AN AUDIT.

>> WILL STILL ON THE AVINA. >> NO, --

>>

>> WHEN I WAS BLOCK WALKING, JUDGE, YOU HAVE COME AS A FORENSIC AUDIT AND THAT IS NOT HAPPENED.

>> PUT IT ON THE AGENDA. >> OH, MY GOODNESS.

>> IS MY PUBLIC COMMENT TIME AND THIS HAPPENS EVERY TIME,

[01:25:05]

JENNY. EVERY TIME I BRING UP SOMETHING. THIS IS WHY, FOLKS, THINGS AREN'T TOLD TO ME BECAUSE I DO NOT KNOW HOW TO KEEP A SECRET. WE ARE GOING TO GET INTO SESSION ABOUT IF IT

IS ON THE AGENDA. >> COMMISSIONER, THE REASON WHY YOUR COMMENT WAS TAKEN TO THIS TIME WAS BECAUSE THE AGENDA ITEM WAS CALLED AND HE WANTED TO SPEAK ON THE AGENDA

ITEM. >> NO, I JUST HAVE PUBLIC

COMMENT. >>

SPEAKERS ] >> I AM JUST GOING TO GIVE YOU AND YOU DO WHAT YOU WILL BUT THE OPEN RECORDS -- OPEN RECORDS MEETING AT THE STATE WHICH IS AND THE AG HAS HELPED DISTINGUISH FOR COMMISSIONERS COURT MEMBERS THAT THEY ARE NOT ENTITLED TO THE SAME OPEN COMMENT IF THERE IS A COMMENT IN A DISCUSSION THAT THE COMMISSIONERS ARE GOING TO HAVE. THAT IS SOMETHING THAT NEEDS NOTICE.

>> THIS IS THE WAY THAT WE GET BLOCK ALL OF THE TIME. YOU BRING OUT THE ATTORNEY GENERAL'S OFFICE SAID THIS AND SAID THAT AND THIS IS WHERE THE PUBLIC DON'T KNOW WHAT IS REALLY GOING ON IN THIS COMMISSIONERS COURT FOR HOW THEY DO THINGS OR HOW WE DO THINGS. THANK YOU. THANK YOU,

JUDGE. >> THIS HAS NOTHING TO DO WITH

YOU, SORRY. >> JUST ON THE RESPONSE OF BEING REPRESENTED AND WELL REPRESENTED, I THINK FIRST AND FOREMOST, I AM HERE BECAUSE I WANT TO BE HERE BECAUSE I HAVE ENJOYED GETTING TO KNOW THE PEOPLE THAT I HAVE WORKED WITH HERE AND SECOND, I'M HERE BECAUSE I HAVE A RESPONSIBILITY OF THE COMPANY WANTS TO OPERATE IN THE COMPANY TO BE HERE AND THIRD, I'M HERE BECAUSE YOU ARE WELL WERE PRESENTED BECAUSE WE WERE ASKED TO BE HERE AND WE WERE ASKED TO BE HERE IN A TIMELY FASHION TO ADDRESS SOME OF THESE QUESTIONS. AND SO WHAT I'M HOPEFUL FOR IS THAT TONIGHT AT THE TOWN HALL, WE WILL BE ABLE TO GET INTO SOME OF THOSE MORE SPECIFIC QUESTIONS THAT FOLKS HAVE ABOUT THE PROCESS AND AGAIN, THAT IS NOT NECESSARILY GOING TO RELIEVE THE FOLKS THAT SIMPLY DID NOT WANT TO SEE IT IN THEIR BACKYARD OF CONCERNS, BUT IT SHOULD HOPEFULLY HELP REDUCE THE FEAR THAT MAYBE FOLKS FEEL ABOUT NOT UNDERSTANDING WHAT KINDS OF SAFETY PROTOCOLS WILL BE IN PLACE, HOW THEY WILL BE PUT IN PLACE, WHAT DOES THE PROCESS LOOK LIKE? WHAT IN FACT ARE WE PRODUCING? HOW DOES THAT DIFFER FROM SOME THE THINGS THAT I'VE BEEN BROADCAST THAT ARE NOT BEING PRODUCED AT THE PLANT AND I DO ENCOURAGE YOU ALL TO BE THERE AND ANYONE ELSE WANTS TO TALK TO US AND WE ARE INTENDING TO BE AVAILABLE TO ANYONE WHO MIGHT WANT TO PROVIDE US WITH COMMENT AND FEEDBACK.

>>

>> I BELIEVE THAT COMMISSIONER HERNANDEZ WANTS TO SPEAK NEXT.

HERNANDEZ SUMMARIZED THIS PERFECTLY. IT IS NOT A WE OBJECT TO PROGRESS OR JOBS, WE WANT THAT IN OUR COMMUNITY, BUT THE ISSUE IS I THINK THE LOCATION AND THE SAFETY. I THINK THAT IS THE PERFECT SUMMARY RIGHT THERE. WE ALL FEEL THAT WAY. IN FACT, I DON'T TO SAY IT WAS A BATTLE THAT WAS SO IMPORTANT TO US THAT THE THREE OF US RIGHT HERE ALL WANTED TO PUT THIS ITEM ON THE AGENDA SO THAT WE COULD HAVE SOME OF THIS, PUBLIC COMMENT. I MENTIONED IT DURING OUR LAST MEETING, HEY, DIRECTED TO STAFF, WE NEED TO GET THIS ITEM SO WE CAN TALK ABOUT IT PUBLICLY IS IN PUBLIC COMMENT, WE CANNOT HAVE THAT INTERACTION LIKE WHAT COMMISSIONER HERNANDEZ IS SAYING SO THAT IS WHY WE ARE AT THIS POINT. THE INFORMATION WAS SLOWLY COMING OUT AND AS WE HEARD DURING THE PRESENTATION, THEN IT KIND OF OPENS UP. THIS EXPLAINS THE PROCESS. A LOT OF US ARE STARTING TO LEARN PARTS OF THE PROCESS IN THE PROJECT, BUT WE HADN'T HAD A REALLY A FORMAL PRESENTATION LIKE THIS TODAY TO BE ABLE TO HEAR AND SEE ALL OF THIS. THIS IS ALL CONCERNING US. DEFINITELY.

ANYONE THAT WOULD HAVE THIS IN THEIR BACKYARD WOULD BE CONCERNED. AND SO MY COMMISSIONER SAID, HE LIVES NEAR THERE. THE JUDGE LIVES IN THAT GENERAL AREA AS WELL. SO IF YOU DON'T THINK WE ARE PAYING ATTENTION -- AND THERE HAS BEEN SOME BAIT ABOUT WHERE THIS PLAN PHYSICALLY IS. IT IS TECHNICALLY RIGHT ACROSS THE STREET FROM WHERE I REPRESENT.

SO IF YOU DON'T THINK THAT WE ARE INTERESTED OR DON'T CARE ABOUT THE COMMUNITY, PLEASE LOOK AT THAT AGAIN BECAUSE WE DO. IT DOESN'T MATTER IF IT IS IN ONE PRECINCT OR ANOTHER, IT IS A COUNTYWIDE ISSUE. WE ARE HERE BECAUSE OF THAT. WE HEARD YOU LOUD AND CLEAR. MISS GABRIELLA, YOU ARE HERE. AND WE PUT IT ON THIS MEETING. THANKFULLY IT IS HERE.

THANKFULLY, THE AVINA REPRESENTED'S ARE HERE AS WELL TO TRY TO EXPLAIN NOT ONLY HAVE THIS OPPORTUNITY DURING THE WORKDAY WHICH WE KNOW IS TOUGH FOR SOME PEOPLE BUT THE EVEN OPENED UP THAT OPPORTUNITY AND I LOOK FORWARD TO BEING THERE AND LEARNING MORE AS WELL. IT IS STILL A LEARNING PROCESS FOR A LOT OF US BUT FOR ME, AND ACTUALLY IT WAS A CAVEAT THAT I DON'T WANT ANYONE TO THINK THAT I'M NOT LISTENING AND LOOKING DOWN. I AM WRITING NOTES TRYING TO GET THE KEY PHRASES KEY ISSUES THAT MANY OF YOU ARE TALKING ABOUT

[01:30:03]

AND CONCERNED ABOUT. WE HAVE ALREADY MET BEFORE. ONE MEETING BEFORE. WE HAVE HEARD YOUR CONCERNS. YOU ARE RIGHT THERE ON 1889. MY FORMER SECRETARY, I CALL HER OUT. LIVES RIGHT ON 1889 NOT TOO FAR FROM THIS AS WELL. THAT IS IMPORTANT TO ME.

I TRY THAT AREA NOT OFTEN BECAUSE MY AREA I REPRESENT IS IN ROBSTOWN, BUT I DO GO THERE BETWEEN 1889, 624 AND ROBSTOWN A FEW TIMES. MY BIG CONCERN WAS TO TRY TO ADDRESS SOME THE QUESTION THAT CAME UP ABOUT US. AS THE JUDGE MENTIONED, AT THIS MOMENT, THE IS NOT A COMMISSIONER COURT ISSUE, PERIOD. WE OPENED UP THIS PROCESS FOR THE PUBLIC TO BE HERE AND WE OPEN UP THIS PROCESS FOR AVINA TO BE HERE SO THAT WE CAN START MORE OF THAT PUBLIC DISCLOSURE. SOME OF US WERE BUSY LAST NIGHT, BUT UNDERSTAND THAT WAS A MEETING YESTERDAY THAT WAS HELD THAT WAS A PUBLIC MEETING BY A PUBLIC ELECTED BODY THAT HAD FURTHER DISCUSSIONS ABOUT THIS.

AND LET ME ASK THE AVINA REPRESENTATIVES OR WHOEVER WANTS TO ANSWER THIS, YOU MENTIONED THAT GO AHEAD AND GO UP TO THE MIC -- WATER. WATER PROVIDER. WAS THAT AGAIN?

>> AND THEY REPRESENT WHAT GEOGRAPHIC AREA?

>> THE GEOGRAPHIC AREA OF ROBSTOWN.

>> ARE THE ELECTED OR APPOINTED BODY?

>> APPOINTED. NO, ELECTED. >>

>> YOU DID WELL. YOU DID WELL. AS YOU CAN SEE, THIS IS NOT PLANNED. WHAT I'M TRYING TO SHOW IS THAT THERE ARE A LOT OF PARTNERS IN OUR COMMUNITY THAT ARE PART OF THIS WHOLE PROCESS, RIGHT? AND WE ARE HERE TO START THAT HEARING, LISTENING FROM YOU. THAT IS WHY WE ARE HERE TODAY TO HAVE THAT TRANSPARENCY. AS YOU CAN SEE, WE ARE STILL TRYING TO LEARN OURSELVES Y'ALL CAN DEFER AND SAY LET'S JUST WAIT UNTIL AFTER OUR PUBLIC HEARING OR COME BACK ANOTHER DAY WHEN MORE IS KNOWN ABOUT IT BUT YOU AGREE TO OUR REQUEST SO, THANK YOU FOR THAT. SO MANY POINTS THAT WERE BROUGHT UP DURING THE PUBLIC COMMENT DURING THIS AGENDA ITEM, BUT DEFINITELY , THE WATER DISTRICT IN ROBSTOWN . IS THERE A CONTRACT NOW?

>> THERE IS. >> THERE IS A CONTRACT WITH THEM. NUECES COUNTY THANK YOU, DID WE HAVE ANY PART OF THAT?

>> NO. >> SO, I THINK THAT ADDRESSES ANY QUESTIONS THAT WERE BROUGHT UP BY COMMISSIONER VAUGHN OR ANYBODY ELSE EARLIER. WATER RIGHT WHAT WE HEARD COUNCILMAN HUXLEY TALK ABOUT. THAT IS SOMETHING THAT A LOT OF PEOPLE WILL KNOW BETWEEN THE CITY OF CORPUS CHRISTI BECAUSE THEY BOTH HAVE ACCESS TO BASICALLY THE NUECES RIVER AND THAT IS WHERE I THINK THIS WATER IS COMING FROM . IS THAT

THE SOURCE? >> CORRECT. AND AGAIN, THOSE ARE HISTORIC , SUPERIOR ALREADY LITIGATED WATER RIGHTS THAT WCA NUMBER THREE HAS THAT THEY HOLD . AND WHETHER THE WATER IS USE IN NUECES COUNTY, IN THEIR WATER CONTROL DISTRICT OR IN CORPUS CHRISTI IS MY QUESTION, RIGHT? SOMEBODY IS GOING TO USE THE WATER. THE QUESTION IS WHERE IS THE VALUE OF THE PRODUCT GOING TO EXIST AND I THINK THAT THERE IS SOME VALUE TO THE EXISTENCE OF THE PROJECT BEING IN THE REGION IN WHICH IT IS BECAUSE IT BEGINS TO ALLOW THOSE RESOURCES AND URGED THE BENEFIT OF THE PEOPLE WHO DO IN FACT LIVE NEAR THE PLANT, AND AGAIN, WHETHER WC I.D. NUMBER THREE USES IT OR CORPUS USES IT, IS GOING TO BE USED. SO THE QUESTION IS, HOW DO WE THINK ABOUT WATER RIGHTS AND WHAT BENEFITS THEY CAN GIVE TO THE PEOPLE WHO EXIST? AGAIN, IT IS A ROBSTOWN DRIVEN JURISDICTION BUT THE WATER CONTROL IS SLIGHTLY DIFFERENT.

>> IS LITTLE BIT LARGER THAN JUST THE ROBSTOWN AREA. A LITTLE BIT SLIGHTLY LARGER. DEFINITELY HEARD THE ISSUES OF LOCATION AS A CONCERN AND I KNOW YOU ADDRESSED. THAT IS NOT NECESSARILY SOMETHING THAT IS AVAILABLE FOR UP FOR DISCUSSION THAT IS WHAT IT IS. IS WHAT YOU ALL HAVE THAT IS NEEDED DESIGNATED. THAT WAS BETWEEN A PRIVATE PROPERTY OWNER OR LAND

TRUST OR SOMEBODY. >> PRIVATE PROPERTY.

>> YOU WILL HAVE SECURED THAT. ONCE AGAIN, WE HAVE TALKED ABOUT THOSE ISSUES. YOU ADDRESSED SOME OF IT. SOME CREDIBLE SOURCES. BUT YOU KNOW, WHEN PEOPLE THINK OF AMMONIA, THEY THINK OF THE EXPLOSION OF WEST TEXAS. TRY TO COME BY NOW BUT THAT IS WHAT I'VE HEARD, RIGHT? THAT IS WHAT I'VE HEARD FROM PEOPLE FROM PUBLIC COMMENT AND OTHERS AND SO, THE SAFETY

[01:35:02]

ISSUE IS SOMETHING I HOPE YOU CAN TALK ABOUT FURTHER TONIGHT AS WELL AND REALLY ADDRESSED THAT IN DETAIL BECAUSE THAT IS WHAT EVERYBODY IS TALKING ABOUT AND YOU HAVE TWO COMMUNITY STARTUPS. SO THAT IS A BIG I WANT A RED FLAG, THE BIG FLOOD TO NOTICE THAT IS OUT THERE THAT PEOPLE ARE TALKING ABOUT.

AND JUST THE OVERALL WATER USAGE. SOME OF YOU ALL MENTIONED THAT. AND I AGREE. ONCE AGAIN, SOMEBODY MENTIONED TACH. TEXAS ASSOCIATION OF COUNTIES EARLIER. I'M SURE YOU CAN FIND AN EXCEPTION TO THE ROLE IN THE STATE OF TEXAS BUT COUNTIES IN GENERAL DO NOT HAVE WATER SYSTEMS LIKE A DISABILITY DOES . THAT IS WHAT WE HAVE SOMETHING SPECIAL DIFFERENT WATER DISTRICTS AND VARIOUS SIZES DROP ESTATE BUT AT LEAST IN OUR AREA WHEN WE ARE TALKING ABOUT WATER USAGE, THERE ARE THE TWO PROVIDERS THAT COULD POTENTIALLY BE A WATER SOURCE, WHICH IS CCW, ROBSTONE WATER .

>> RIGHT. AND WE WOULDN'T ACTUALLY WHERE WE ARE LOCATED HAVE ACCESS TO CORPUS CHRISTI WATER. THEY CERTAINLY DO NOT

SERVE THE REGION. >> THE WATER ONLY SERVES

CERTAIN AREAS THEN? >> THAT IS RIGHT.

>> IF YOU WANT WATER FROM THE CITY OF DALLAS, YOU CAN TYPE IT

IN. >> IS RIGHT. EVEN IF YOU WANTED TO AND EVEN IF YOU BUILT THAT PIPE, YOU WOULD BE VIOLATING THE MONOPOLY OF THAT WATER UTILITY TO SERVE THAT

AREA. >> CAN JUST CONTRACT WITH SOMEONE ELSE AND BRING AN END.

>> IS RIGHT. >> I THINK IT HELPS WITH THE LOCAL CONTROL. PEOPLE HAVE QUESTIONS AND ISSUES ABOUT THIS LET WE HAVE IDENTIFIED EARLIER. THERE IS ANOTHER ELECTED BODY.

WE ARE STILL LEARNING ABOUT THIS. THERE IS ANOTHER ELECTED BODY THAT TOOK ACTION ON THIS TO SECURE WATER RIGHTS WHO ARE TOTALLY INDEPENDENT OF NUECES COUNTY AND NUECES COUNTY COMMISSIONER'S COURT AND HOPEFULLY PEOPLE EXPRESS THEIR CONCERNS WITH THAT ENTITY AS WELL IF THEY ARE FOR OR AGAINST UTILIZING THOSE WATER RIGHTS AND WATER USAGE THROUGH YOUR PLAN. THOSE ARE SOME OF THE MAIN POINTS I WANTED TO BRING UP OH, RTC, MR. VOLS AND MR. CULBERSON. SO WE HAVE TWO ECONOMIC DEVELOPMENT GROUPS REPRESENTED TODAY. YOU ALL MADE TO STEP UP TO THE MIC BUT I WANT TO MAKE SURE EVERYBODY

HEARS. >> GO UP TO THE MICROPHONE, PLEASE. THERE WAS A QUESTION ABOUT CONTRIBUTION .

>> I DO NOT MAKE INDIVIDUAL CONTRIBUTIONS TO EITHER ONE OF THESE GROUPS AND, COLLECTIVELY, IS A COMMISSIONER COURT VOTE THAT TAKES PLACE TO ALLOCATE FUNDING TO EITHER ONE OF YOUR

ORGANIZATIONS? >>

>> THANK YOU. APPRECIATE THAT. >>

>> THANK YOU, JUDGE, THANK YOU, COURT. IT IS THE COURT.

THE COURT FINDS A LOT OF WHAT Y'ALL CALL OUTSIDE AGENCIES.

WE ARE ONE OF THE AGENCIES. YOU FIND VARIOUS OTHER GROUPS AS WELL AND WE ARE ONE OF THE AGENCIES HERE IN ORDER TO HELP

ATTRACT ECONOMIC DEVELOPMENT. >> AND THEN DOESN'T GET FUNDING FOR YOUR ORGANIZATION BECAUSE YOU REPRESENT THE GENERAL ROBSTOWN AREA FOR LOCAL ECONOMIC DEVELOPMENT AND

GROWTH. >> YES. MOST THE COMMISSIONERS TAKE FUNDING IN THEIR PARTICULAR PRECINCT FOR PROGRAMS ARE IN THEIR PRECINCT. WE ARE IN YOUR RECENT AND WE ARE PARTNERING IN COMMISSIONER HERNANDEZ'S PRECINCT BUT THAT IS TYPICALLY THE WAY IT WORKS. BUT WE'RE NOT THE ONLY WAY IT WORKS. Y'ALL FUND THE DIABETES PROGRAM AND A LOT OF DIFFERENT PROGRAMS. AND MIKE, SAME WITH YOURS. WE ALLOCATE A SIZABLE AMOUNT TO HAVE A OPPORTUNITY TO SUPPORT ECONOMIC DEVELOPMENT FOR YOUR GROUP AND THAT IS AN ACTION TAKEN BY COMMISSIONERS COURT AND NOT BY INDIVIDUAL COMMISSIONERS,

RIGHT? >> THAT IS CORRECT. THE NICE THING ABOUT IT IS THAT WE COVER ALL OF NUECES COUNTY FOR YOU.

WE HAVE DONE THAT SINCE AT LEAST 2009. SO, I APPRECIATE YOU TAKING THE TIME TO COME UP TO THE MIC BECAUSE I THINK THERE'S A LOT OF MISINFORMATION OUT THERE.

HOPEFULLY, THIS ADDRESSED ALL OF YOUR QUESTIONS IN PARTICULAR NOT ONLY FOR INDIVIDUAL MEMBERS OF THE COURT PREFER THE PORT AS A WHOLE ON HOW WE ACT ON THESE ISSUES.

WHAT WE HAVE CONTROL OVER BUT WE DEFINITELY HEAR YOU, RIGHT? AND THAT IS WHY ONCE AGAIN GOING BACK TO WHAT WE -- Y'ALL CAN SIT DOWN. THANK YOU. I WILL FINISH AND LET YOU GO, JOHN. WE HEARD YOU LOUD AND CLEAR TWO WEEKS AGO. OUR NEXT AVAILABLE MEETING WAS TODAY. THAT IS WHY WE PUT THIS ON THE AGENDA FOR THIS DISCUSSION. LIKE I SAID, I PERSONALLY WILL BE THERE TONIGHT TO LISTEN MORE AND LEARN MORE. AS A MEMBER OF THE COMMUNITY AND REPRESENTATIVE OF THE PEOPLE, WE HEAR YOU, ONCE AGAIN, THE STATE AGENCY THAT IS TECHNICALLY GOING TO BE INVOLVED IN THERE IS GOING TO BE THE WATER ISSUE AND OBVIOUSLY, WE SAW ON HERE

[01:40:01]

ELECTRICAL AND WATER UPGRADES AS PART OF THE PRESENTATION THAT WAS GIVEN EARLIER. SO, THOSE ARE ITEMS THAT COMMISSIONERS COURT DOES NOT HAVE ANY CONTROL OVER AT ALL.

BUT WE CAN BE YOUR MOUTHPIECE. THAT IS ONE THING WE CAN DO IS HEAR WHAT YOU ARE SAYING TODAY, THE EMAILS AND PHONE CALLS THAT WE HAVE SEEN AND RECEIVED AND SHARE THEM. WE KNOW THAT AVINA HAS BEEN OPEN TO HEARING THESE CONCERNS FROM US INDIVIDUALLY. I CAN'T SPEAK TO THE ENTIRE COURT BUT AT LEAST FROM WHAT I'VE HEARD FROM YOU ALL. I HAVE TAKEN THAT AND SHARED THAT. SO THIS IS A CONTINUING DIALOGUE. BUT JUST BE AWARE THAT THERE IS NOT MUCH WE CAN DO UNLESS THEY COME TO US FOR AN ABATEMENT SOMETIME IN THE FUTURE. THEN WE CAN TALK THAT OUT AND THAT WILL BE SOMETHING WE CAN VOTE OVER RIGHT NOW, THERE IS NOTHING THE COMMISSIONER COURT DOES OTHER THAN OPENING UP THIS FORUM TODAY AND ALLOWING YOU TO SPEAK AND ALLOWING YOU TO LISTEN AND WE WILL FOLLOW UP TONIGHT AND INTO THE FUTURE AS THIS PROJECT CONTINUES IN THEIR

DEVELOPMENT. >> COMMISSIONER, YOU HIT EVERY POINT ON THE HEAD, BUT JUST WANTED TO JUST LET THE PUBLIC NOW AND MIKE AND I ARE IN THE SAME POSITION AS ALL ECONOMIC DEVELOPMENT AGENCIES. WHEN COMPANIES COME IN TOWN TO LOCATE WHEREVER IN THE COMMUNITY, WE SIGN NONDISCLOSURE AGREEMENTS AND SOMETIMES GOVERNMENTAL BODIES DO THAT AS WELL SO, A LOT OF TIMES WHEN THE INFORMATION DOES NOT COME OUT EARLY ENOUGH IS BECAUSE WE ARE UNDER NONDISCLOSURE AGREEMENTS AND THAT IS JUST THE WAY ECONOMIC DEVELOPMENT PROGRAMS WORK. SO, THANK YOU. APPRECIATE IT.

>> COMMISSIONER GONZALEZ, I THINK YOU WANTED TO SPEAK?

>> KAREN? DID HE BACKUP? >>

>> SORRY, KAREN. >> IT IS ALL GOOD.

>> ANYWAY, I JUST WANT TO LET YOU KNOW THAT I AGREE WITH COMMISSIONER MAREZ AND WHAT COMMISSIONER HERNANDEZ HAS SAID BUT I ALSO WORK FOR ALUMINUM COMPANIES FOR ABOUT 10 YEARS AND I KNOW ABOUT WHERE THE WIND BLOWS A LOT OF STUFF BLOWS, RIGHT? BUT ANYWAY, I THINK I MET YOU GUYS ABOUT A WEEK AGO AT MY SATELLITE OFFICE AT JALISCO, RIGHT?

>> YES. >> THE ONLY MAJOR REQUEST I HAD WAS FOR Y'ALL TO DO A TOWNHALL MEETING AND Y'ALL SET THAT OUT TODAY SO I REALLY APPRECIATE THE FOLLOW UP ON OUR

REQUEST, ALL RIGHT? >> WE ARE HAPPY TO DO IT.

>> I THINK IT IS GOOD FOR THE PEOPLE BECAUSE BEFORE WE DID NOT KNOW ABOUT ANY OTHER TOWN HALL MEETINGS UNTIL A FEW DAYS

AGO, RIGHT? >> IT IS NIGHT AT -- AND SHE GO AHEAD AND STATED IN CASE ANYBODY IS HERE AND DOESN'T

KNOW? >> IT IS TONIGHT AT 6:00 AT THE

FAIRGROUNDS. >> WHERE TO GO AND ASK QUESTIONS? THAT IS WHERE YOU GO TONIGHT? THE BRYCE COUNTY FAIRGROUNDS THERE IN TOWN BY THE BALLPARK?

>> YES. >> MOTHER QUESTION IS, I WILL TELL YOU WHAT, THE JOB IS GREAT. I REALLY SUPPORT JOBS.

I REALLY SUPPORT ECONOMIC DEVELOPMENT , BUT I THINK DID Y'ALL EVER LOOK FOR LAND SOMEWHERE FURTHER OUT IN THE WESTERN AREA MAYBE BETWEEN ROBSTOWN ANNA DRISCOLL OR BISHOP BECAUSE THERE'S A LOT OF LAND OUT THERE TOO, RIGHT? AND A LOT OF WATER OUT THERE ALSO SO I DON'T KNOW IF Y'ALL

LOOKED IN THAT AREA OR NOT? >> YEAH. I DID A COMPREHENSIVE REGIONAL ANALYSIS OF WHERE THERE IS A CONVALESCENCE OF POWER, WATER, AND ACCESS TO DISTRIBUTE THE PRODUCT, RIGHT? SO, PORT DOCUMENT WHAT IS IT? SAFE PLACE. THERE ARE NUMBER OF PROPERTIES THAT ARE CLOSER IN AND INDUSTRIAL THAT WE HAVE HAD ORIGINAL EARLY CONVERSATIONS ON BUT THEY ARE ALL IN A FLOOD ZONE SO OTHER THAN --

>> DEFINITELY NOT IN A FLOOD ZONE.

>> -- THE ONES THAT WERE UNDER CONSIDERATION FOR THE PROJECT INITIALLY ARE IN A FLOOD ZONE, SO OTHER THAN MISHANDLING BY A PERSON THAT IS TRANSPORTING THE FUEL TO THE VESSEL INTO A TRUCK OR THE TRUCK'S MOVEMENT, THE NEXT HIGHEST POSSIBILITY OF INTIMATE FROM A SAFETY PERSPECTIVE IS A BACKUP GENERATOR GOING DOWN AFTER A FLOOD. AND SO THE REASON WHY THIS SITE WAS CHOSEN IS BECAUSE IF YOU OVERLAY POWER AND WATER INFRASTRUCTURE WITH THE LACK OF A FLOOD ZONE BASED ON FEMA'S MAP AND NOT MY OWN IMAGINATION, THEN YOU END UP WITH THE THREE OPTIONS, RIGHT? WHEN IS RIGHT NEXT TO THE AIRPORT WHICH IS A NO GO, ONE IS RIGHT NEXT TO A FAIRGROUND WHICH IS A NO GO AND THIS ONE IS THE OTHER ONE. AND SO WE SPECIFICALLY PROSPECTED THIS PROPERTY BECAUSE IT HAS WATER AND POWER AND NOT IN A FLOOD ZONE AND I UNDERSTAND THAT THAT MAYBE CONTRARY TO

SOMEBODY'S PRESENT INTENTION. >> THE OTHER QUESTION I HAD.

YOU SAID THE PERMITS AND YOU SAID YOU ALREADY HAVE A

PERMIT? >> TC Q PERMIT IS PROCEEDING.

[01:45:05]

WE INITIALLY FILED IN DECEMBER BUT IT WAS PROBABLY NOTICE ON FEBRUARY 1ST. INITIAL COMMENT CUP PERIOD INCLUDED AT THE END OF LAST MONTH. WHAT WILL HAPPEN FROM HERE IS WE WILL WORK IN CONCERT FROM TECQ TO ANSWER ALL OF THE TECHNICAL WASHING THAT CAME UP DURING THAT PROCESS AND THEN, A TECQ WILL ISSUE A DRAFT PERMIT THAT WILL GO OUT FOR ANOTHER SET OF COMMENTS AND PEOPLE HAVE FEEDBACK OPPORTUNITY AT THAT POINT IN TIME AND ISSUES WILL DEPEND ON WHAT KIND OF PROCESS

HAPPENS THEREAFTER. >> WHAT ABOUT QUALITY CONTROL? DO YOU HAVE TO GET A PERMIT FOR THAT?

>> THAT IS THE PERMIT. THERE WILL ALSO BE A STORMWATER DISCHARGE PERMIT THAT WILL BE FILED BEFORE TECQ AS WELL WHICH AGAIN, WE WILL OFFER THE PUBLIC AN OPPORTUNITY TO COME IN AND ASK THEIR QUESTIONS AND HOPEFULLY HAVE THEM ADDRESS.

>> SO REALLY, WE DON'T HAVE ANYTHING TO DO WITH THE PERMIT

BUT TECQ HAS THE PERMIT. >> CORRECT.

>> SO WE DON'T HAVE ANYTHING TO YOU GETTING THE PERMIT.

>> THE NATURE OF THE COUNTY IS THAT THEY ARE LACKS ANY ZONING

COORDINATION. >> ABSOLUTELY. THAT OPINION IS VALUED. I HAVE BEEN INCORPORATING FEEDBACK ACTIVELY WHILE IT IS PROVIDED. IT IS REALLY HELPFUL.

>> I DON'T KNOW BUT I GUESS FROM WHAT I'VE HEARD TODAY, YOU ACTUALLY HAVE A CONTRACT SIGNED WITH THE WATER DISTRICT

NUMBER THREE? >> INDEED.

>> FOR WATER, IN CASE IT DOES GO THROUGH?

>> THERE ARE CONTINGENCIES IN ANY CONTRACT THAT LARGE WE NOT TO CONCLUDE THE PROJECT, BUT IT IS A BINDING CONTRACT WITH THE

WATER DISTRICT. >> I JUST WANT TO MAKE SURE THESE THINGS ARE OUT AND PEOPLE KNOW WHAT WE ARE TALKING ABOUT, RIGHT? BECAUSE I DID NOT KNOW YOU HAD ONE EITHER. A BINDING ONE, BUT ALSO, YOU KNOW, THE CITY OF CORPUS CHRISTI, WHAT ARE YOUR PLANS AND ACTUALLY YOU MIGHT NOT TAKE WATER FROM THE CITY OF CORPUS CHRISTI BUT WILL YOU MEET WITH THE CITY OF

CORPUS CHRISTI? >> SAW EARLY ON WHEN I LOOKED AT THIS SITE, I CALLED OUT TO THE CITY. I CALLED ALL OUT TO THE DEVELOPMENT SERVICES GROUPS AND CAN IDENTIFY EVERY SOURCE IN THE SEA THAT WOULD BE RESPONSIVE. TO THE POINT WHERE I ACTUALLY TOOK UP THE DEVELOPMENT FORM IN AUGUST OF LAST YEAR THAT SPECIFIES HOW YOU WILL PAY THAT VARIOUS CITY PLANNERS TO SHOW UP AT IN EVENTS EVEN TELL THEM ABOUT YOUR EVEN RELEVANT TO HAVE NOTHING TO DO WITH THAT IS THE ARE NOT PROVIDING SERVICES AND I FILED THAT PAPERWORK THAT SAID I WILL PAY YOU TO SHOW UP TO A MEETING SO I CAN TEACH YOU ABOUT THE PROJECT AND GET YOUR FEEDBACK AND MAKE SURE EVERYBODY IS INFORMED AND THE RESPONSE I HAVE RECEIVED TO THAT IS THAT I DID NOT NEED TO HAVE THAT MEETING ANNA DID NOT HAVE INTEREST IN UNDERSTANDING.

>> SO THEY NEVER SHOWED UP. >> NEVER TOOK US UP ON THAT

FILE FORM. >>

>>

THAT. >> I JUST WANT TO MAKE SURE WE GET THAT OUT IN THE OPEN BECAUSE MY QUESTION IS WHY HAVEN'T WE MET SO NOW YOU ARE EXPLAINING WHY. BUT IF THERE

IS SOMETHING ELSE OUT THERE -- >> SO IT IS OUTSIDE OF THE E TJ THAT THEY ARE TO PROVIDING CITY SERVICES AND SO THAT IS WHY THE CONCLUSION CAME FROM THAT WE DID NOT HAVE THAT MEETING BUT AGAIN, I REALLY WANTED TO HAVE THAT MEETING.

>> OKAY. AND PEOPLE NEED TO KNOW THIS TOO BECAUSE THE PERSON THAT PROBABLY SOLD YOU THE LAND NEW WHEN HE WAS SELLING THE LAND SO, TECQ AND THE LANDOWNER SHOULD LET THE PEOPLE KNOW WHO SOLD THE LAND BECAUSE HE SHOULD'VE THOUGHT ABOUT EVERYTHING THE PEOPLE GET INVOLVED TOO, THAT SOMETIMES, LANDOWNERS DO IT BECAUSE THEY WANT THE MONEY, RIGHT? BUT THEY WEREN'T THINKING ABOUT THE COMMUNITY EITHER SO I'M GOING TO PUT THE BLAME WHERE EVERYBODY KNOWS BECAUSE I DON'T WANT THE BLAME TO GO ONLY IN ONE AREA, RIGHT? BUT YOU BOUGHT THE LAND THEY ALREADY.

>> IS UNDER CONTRACT. IT IS UNDER OPTION CONTRACT SO ONE COULD WALK AWAY FROM THE ATLANTA DEAL IF ONE WOULD NEED

TO. >>

SPEAKERS ] >> THEY ARE BOUND TO SELL TO US

IF WE ARE WILLING TO BUY IT. >> OKAY. WHAT ELSE I HAD. I HAD ONE MORE QUESTION SOMEWHERE. WHEN YOU TALK ABOUT -- I WAS LOOKING AT THE VIDEO FOR SAFETY. WHAT IS THE MAIN SAFETY PRECAUTIONS . SAY FOR INSTANCE SOMETHING GOES WRONG.

IN A WORST-CASE SCENARIO, HOW DO YOU DO? DO YOU SHUT THE PLANT DOWN? HOW ARE PEOPLE WARNED THAT THERE IS A PROBLEM? THERE IS AN ISSUE? HOW DO WE WARN THE PEOPLE OUT

THERE? >> THOSE PLANS ARE IN ACTIVE DEVELOPMENT AND AGAIN, IT IS AN ITERATIVE PROCESS. YOU START WITH INITIAL SITE CAPABILITY STUDY. SAYS IS THE SITE SAFE

[01:50:02]

IN THE WAY AREA IN WHICH IT EXISTS? SO HAVE DONE THE INITIAL WORK AND THAT LEADS US TO A PLACE WHERE WE DO ADDITIONAL ENGINEERING TO CHANGE THE PLAN'S DESIGN AND HOW IT IS LAID OUT SO WE CAN REDUCE ANY OF THE SAFETY CONCERNS THAT THEY HAVE IDENTIFIED IN THE INITIAL STUDIES. AND ULTIMATELY, YOU WILL END UP WITH THE QUANTITATIVE RISK ANALYSIS THAT SAYS, HEY, IT'S ON THE WAY THE PLAN IS DESIGNED, WHAT IS THE PROBABILITY OF AN EVENT AND BASED ON ALL THAT FINALIZE ENGINEERING, WHAT YOU WOULD DO IS RENDER A RISK MANAGEMENT PLAN BASED ON THE EPA STANDARD FOR WHAT A RISK MANAGEMENT PLAN SAYS THAT WILL INCLUDE IS UTILIZING EXISTING CHANNELS FOR ANY COMMUNICATIONS. SO IS THERE A EMERGENCY CLINIC A SYSTEM THAT EXIST, WE UTILIZE THAT.

THE PLAN WILL BE FILED AS PART OF THE TC Q AS A PART OF THE FINAL DEVELOPMENT. SO IT WILL BE AVAILABLE AND WE ARE ACTIVELY ENGAGING LOCAL FOLKS WITH THE FIRE AND SAFETY KNOWLEDGE HERE TO ENSURE THAT OUR PLANS MESH WITH THE

EXISTING INFRASTRUCTURE. >> BUT THAT WILL ALSO HAVE TO

BE APPROVED BY TECQ? >> IT IS NOT TO BE APPROVED PER SE. IT WILL BE FILED WITH THEM AND AS LONG AS IT REACHES SUFFICIENCY, IT WILL BE ADOPTED WITH THEM.

>> HAVE A QUESTION. REGARDLESS OF WHO PAYS OR WHO BUYS WHERE THE WATER IS BEING SOLD TO, IT IS ALL COMING FROM THE NUECES

RIVER, RIGHT? >> THAT IS THE SOURCE. YES.

>> IS NOT COMING FROM DALLAS OR ANYWHERE ELSE. THAT IS THE SOURCE. SO WE WILL BE DEPLETING OUR RESOURCES FROM THE NUECES RIVER SO IT DOES NOT MATTER WHO WAS THE ONE THAT IS GOING TO SELL IT OR WHO HAS THE RIGHT TO SELL IT. WE WILL BE DEPLETING. AND THIS IS WHERE I AM CONCERNED. I DO REPRESENT 1889. SORRY FOR THE PLUG IN. AND IT SEEMS LIKE CITY COUNCILMAN DISAGREES WITH YOU THAT YOU WANTED A MEETING AND THEY DECLINED. DEALING IN THE PAST KNOWING WHAT I KNOW, I AGREE WITH YOU. I THINK THEY DO NOT WANT TO LISTEN TO YOU.

>> I DON'T KNOW WHAT THE PROCESS OF WHICH I WAS AND I DON'T WANT TO CONVEY THE IT IS NECESSARILY NEGATIVE OR

INTENTIONAL OR ANY OF THAT. >> NOT TRYING TO BE NEGATIVE.

JUST TRYING TO GIVE YOU THE TRUTH.

>> I REALLY REALLY TRIED -- >> THE WATER POINT, WATER IS A PRIMARY RESOURCE. IT IS A GOLDEN RESOURCE THAT MAKES ECONOMIES RUN OR NOT RUN. THE THING THAT FOLKS NEED TO DRINK EVERY DAY REGULARLY. 80% WATER.

SO WE ACKNOWLEDGE THAT AND UNDERSTAND THAT AND THAT IS PART OF WHY WE ARE TAKING SO MUCH TIME AND DILIGENTLY LOOKING AT THE WATER TREATMENT FACILITY TO REDUCE, REUSE, AND PRODUCE AS LITTLE WATERWAYS AS POSSIBLE AND WHERE POSSIBLE, RETURN THE WATER BACK TO THE DISTRICT SO THEY CAN UTILIZE THAT WATER THEREFORE ADDITIONAL USES.

>> IT WOULD NOT BE AS COSTLY BECAUSE YOU WOULD FIX IT UP TO WHERE IT WOULD NOT AFFECT PEOPLE. JUST TO FINISH UP, I DO WANT TO EXPRESS TO THE PEOPLE THAT LIVE AROUND THAT AREA IN CORPUS CHRISTI, THIS IS NOT JUST -- A NATION, THIS IS A CORPUS CHRISTI NATION BECAUSE THERE'S A LOT OF RESOURCE. SO FAR, THE LORD HAS BEEN GOOD TO US AND GOTTEN WATER IN OUR LAKES. IF THIS KEEPS UP, WE MIGHT BE HURTING. THANK YOU FOR

YOUR HONESTY. >> COMMISSIONER CHESNEY WANTS

TO SPEAK. >> YOU HAVE YOUR TCU PERMIT?

>> THEY ARE PROCEEDING THEIR CAUSE IS -- PROCESS GOING BEFORE THE NEXT STEP IN THE PROCESS QUESTIONS ABOUT THE APPLICATION INCORPORATING COMMENTS WE RECEIVED FROM VARIOUS PEOPLE IN THE COMMUNITY THEN EVENTUALLY ISSUING A DRAFT PERMIT, THOUGH BE ANOTHER COMMENT PERIOD FOR ANY FOLKS TO ENGAGE.

>> THE ONLY WATER AGENCY.WITH , WCAB I'M SORRY.

>> WATER CONTROL DISTRICT NUMBER THREE. AS THE WATER AGENCY THAT'S GIVING WATER TO THE PROJECT IT THE ONLY ONE INVOLVED WOULD NOT BE THE CITY OR ANY OTHER WATER AGENCY? THE ONLY WATER AGENCY INVOLVED IS THE NUECES COUNTY , TELL ME AGAIN WHAT A CONTROL DISTRICT NUMBER THREE. NO OTHER WATER AGENCY WAS INVOLVED, THE CITY, ANYONE ELSE, I DON'T KNOW

[01:55:05]

WHATEVER , THIS ONE ENTITY IS THE ONLY ONE THAT HAS ANYTHING

TO DO WITH IT. >> THEY HAVE THE WATER RIGHT SO THEY ENTERED THE CONTRACT AND ARE ENTITLED TO THAT UNDER

CCM. >> NO ONE ELSE DOES. NO ONE ELSE COULD BE INVOLVED LEGALLY AT THIS POINT BUT THAT WATER AGENCY. THERE'S A LOT OF THINGS THAT HAVE BEEN THROWN OUT TODAY , SOME OF THEM HAVE BEEN INACCURATE. I WANT TO MAKE SURE WE'RE CLEARING PUBLIC NOTES. THANK YOU VERY MUCH.

>> THANK YOU, VIA MESSAGE, THERE SOMEONE IN THE AUDIENCE THAT WISHES TO SPEAK THAT DID NOT GET THE OPPORTUNITY TO SPEAK IN PUBLIC COMMENT . I WILL REOPEN IT FOR A SECOND, DID YOU GET TO SPEAK? I THINK YOU DID, YES MA'AM. YES. YOU HAVE TO COME UP TO THE MICROPHONE, I'M SORRY. I WOULD ASK YOU ALL TOO TO PLEASE TRY TO MAKE IT OUT TO THE TOWN HALL TONIGHT, YOU CAN ASK A LOT OF QUESTIONS TONIGHT. SEE MY

QUICK QUESTION -- >> MY QUESTION FOR THEM, TO YOU ALL, I KNOW I'VE BEEN TO THE , I'VE HEARD THE ROSS TOWN ISD , I WENT TO WATER DISTRICT NUMBER THREE MEETING, NEW ESSES COUNTY WATER DISTRICT. IT WAS EXECUTIVE SESSION, WE WERE ALLOWED TO GIVE COMMENTS, NOTHING WAS GIVEN TO US. A PAYING CUSTOMER TO THEN AS THEY ARE, APPARENTLY. NOBODY SEEMS TO CARE ABOUT THE FACT THAT HE'S RIGHT, IT GOES THROUGH CORPUS CHRISTI WATER TOO. THEY MENTIONED LAST NIGHT THAT VIOLET WILL BE A PART OF THIS WATER SOURCE TOO NO. WITH ALL THIS WATER COMING OUT AND BEING SOLD , I WAS TOLD TO HUGE COMPANIES IN THE MAJORITY. I'M EXPECTING TO DO STAGE TWO OR STAGE ONE, WHATEVER WE GET TO BECAUSE WE WILL GET THERE.

THERE'S NOT ENOUGH WATER COMING THROUGH THE AQUIFER AND BECAUSE OF THE RAIN EVERYONE IN THE CITY USES NUECES RIVER, I HAVE A CANAL THAT RUNS IN FRONT OF THE PLANT THEY ARE PROPOSING WHERE NEXT TO MY HOUSE, IT IS OPEN. THAT'S THE EMERGENCY WATER SOURCE , OPEN WHICH WILL BE CONTAMINATED WHEN THEY RELEASE THE SMALL OMISSIONS THEY ARE SAYING. MY CONCERN IS IF THAT'S GOING TO BE OUR EMERGENCY WATER, AND IT'S VERY LOW RIGHT NOW, AND ALL BEEN NOT CLOSED, NOT PIPED, NOTHING. WE ARE GOING TO BE LEFT IN FIVE YEARS FROM NOW? WE CANNOT GUARANTEE ONLY GOD CAN THAT WE WILL GET RAIN. YOU CAN'T AND WHEN YOU TELL ME HERE THAT IT'S OUT OF YOUR JURISDICTION, THEY TOLD ME THAT LAST NIGHT TOO. IT'S OUT OF OUR JURISDICTION, WHY ARE YOU WASTING MY TIME? BECAUSE I MEAN , SOMEBODY IS MAKING MONEY OFF THIS . I'M NOT MAKING MONEY, I WANT A CLEAN COMMUNITY , SAY FOR MY GRANDKIDS AND GREAT GRANDKIDS. NOBODY IS GUARANTEED SAFE WATER NOW. I DON'T UNDERSTAND WHY I HAVE TO PAY TAXES TO NUECES COUNTY WHEN I CAN'T EVEN DO ANYTHING TO TRASH OVER THERE, I CANNOT DO IT WITH CORPUS CHRISTI, I'M IN THE MIDDLE, STUCK IN THE MIDDLE AND IT'S UNFAIR THAT ALL OF YOU REPRESENT NUECES COUNTY, BELIEVE ME, I WORKED FOR NUECES COUNTY AFTER I RETIRED. I WORKED FOR THE CITY OF CORPUS CHRISTI TOO , MY CONCERN IS THAT YOU CAN ALLOW SOMEBODY BRAND-NEW TO THE COMMUNITY TO MAKE MONEY OR ECONOMIC -- DEVELOPMENT FOR JOBS , 100 JOBS, PLEASE GIVE ME A BREAK.

WE HAVE SO MANY, WE HAVE MORE THAN 10,000 JOBS AVAILABLE HERE IN CORPUS CHRISTI, WHY ARE THEY NOT WORKING, THEY ARE

LOW-PAID . >> I THINK YOU ARE -- THOSE ARE MY CONCERNS TO YOU. YOU ARE ACCOUNTABLE , YOU ARE MY
