[00:14:28]
I WAS SURPRISED THIS HAD A CASH MATCH AND WAS NOT BROUGHT UP
[00:14:31]
FOR DISCUSSION. >> THERE IS CASH MATCH
[00:14:32]
AVAILABLE TO THIS.[00:15:23]
THIS WITH SOMETHING ELSE NORMALLY USED.>> DO WE DO OR WE DON'T? >> WE HAVE ABOUT $10,000 AVAILABLE IN THE SPECIAL PARITY FUND BUT THE MATCHES TWENTYSOMETHING SO THE REST OF THE MATCH WOULD HAVE TO COME
FROM GENERAL FUNDS. >> CONTINGENCY?
>> 20,348. IT WOULD BE ANOTHER 10,000 OUT OF THE GENERAL FUND.
NUMBER. WE DO NORMALLY MATCH GRANTS FROM THE GENERAL FUND.
THERE IS A BUDGET IN THERE. IF THIS WAS THE BUDGETED I BELIEVE
WE PUT IT IN AS BUDGET ITEM. >> THIS IS A PRETTY IMPORTANT THING FOR THE COURT TO MONITOR OFFENDERS AGAINST WOMEN BY ALL MEANS. I CERTAINLY BELIEVE THIS IS WORTHY OF THE DISCUSSION. I DON'T MEAN THIS IN ANY WAY TO SAY, I THINK WE SHOULD DO THIS MY VOTE WOULD BE YES TODAY.
>> I BELIEVE IN THE GENERAL FUND WHEN WE DID THE BUDGET WE DID INCLUDE A CERTAIN AMOUNT FOR THIS GRANT. JUST NOT
ENOUGH. >> NOT ENOUGH FOR FUND 13 BUT
11 WILL COVER THE REST. >> I'M WITH THE JUDGE ON THIS.
BEFORE WE MAKE A MOTION I WOULD LIKE TO HAVE SOME SORT OF MOTION THAT SAYS ANYTHING WITH A CASH MATCH SHOULD GO ON THE REGULAR AGENDA AS A MATTER OF COURSE SO I WOULD LIKE TO MAKE THAT MOTION BEFORE WE FINISH THIS ITEM.
>> WE TRY TO CATCH THAT. I THINK WE TALKED ABOUT IT IN REVIEW BUT I GOT PUT BACK IN HERE. ANY OF THE DEPARTMENT HEADS, WHEN YOU PUT ON THE AGENDA DEPARTMENT HEADS PUT THEIR OWN AGENDA IF IT HAS A CASH MATCH IT NEEDS TO COME UP FOR THE GENERAL, THE REGULAR AGENDA NOT FOR THE CONSENT
AGENDA. >> DO WE RULE GOOD JUSTIFICATION? AS DISCUSSION WITH THE MOTION I WOULD LIKE THIS COURT TO REALLY HAVE AND I HATE TO USE THE WORD WORKSHOP BECAUSE YOU CAN'T TAKE ACTION WORKSHOP BUT SOME ABILITY TO LOOK AT ALL THE GRANTS BECAUSE I THINK WE NEED TO LOOK AND SEE WHERE WE CAN TO EVOLVE AWAY FROM CASH MATCH GRANTS AS MUCH AS POSSIBLE. I KNOW IT'S NOT POSSIBLE TO DO ALL BUT LISTENING TO THESE CONTINUING EDUCATION COURSES THAT I HEAR ALL OVER THE PLACE SEVERAL COUNTIES ARE GOING AWAY FROM THESE GRANTS BECAUSE THERE ARE SO MANY STRINGS ATTACHED AND SO MANY THINGS THAT COME WITH IT AND I GET SOMETIMES YOU HAVE TO DO IT, BUT AS A COURT WE NEED TO HAVE THE DISCUSSION AT SOME POINT SO I WOULD LIKE TO FIGURE OUT HOW TO PUT THAT ON THE NEXT AGENDA AS AN ITEM BUT I WOULD LIKE TO HAVE THAT DISCUSSION. I AGREE THIS IS WORTH DOING AND MOST OF THEM ARE WORTH DOING, PROBABLY ALL OF THEM BUT IT'S JUST IT PUTS THE COUNTY IN A BIT OF A FINANCIAL SITUATION AND WE NEED TO MAKE SURE WE WANT TO BE THERE. I WILL PUT THAT ON FOR
DISCUSSION. >> A MOTION FOR ANY DEPARTMENT HEADS TO PUT ANY CASH MATCH, MOTION AND SECOND FOR CASH MATCH TO BE ON THE REGULAR AGENDA NOT THE CONSENT AGENDA.
COMMISSIONER. IN CERTAIN POINTS , BUT I SECOND BECAUSE I WANT IT TO BE KNOWN WE GO TO THE GENERAL FUND AND SOMETIMES WE ASK FOR THINGS AND YOU CAN'T TAKE IT FROM THE GENERAL FUND SO NOW WE TAKE SOMETHING OUT OF THE GENERAL FUND IT SHOULD BE CONSIDERED SOMETHING ELSE THAT COMES UP.
>> LOOKING AT THE BUDGET BOOK WE DID BUT AT THE ITEM AS A BUDGET ITEM SO IT'S ALREADY APPROPRIATED FOR THIS GRANT.
>> BUDGETED FOR THE TOTAL AMOUNT NOT FOR THE TOTAL.
>> THE TOTAL AMOUNT, YES. IT WAS OUT OF THEIR FUNDS.
>> OKAY WE ARE GOOD. >> THAT'S WHY I ASKED THE QUESTION. HE IS SAYING IT WAS BUDGETED.
>> WE WOULD NOT HAVE HAD THE DISCUSSION IF WE KNEW THAT IT
WAS BUDGETED. >> IT WAS BUDGETED.
>> YOU ARE ALWAYS HIDING ON ME. >> I'M SORRY. IF WE ARE DOING BUDGET SEASON THE AUDITORS WILL ASK GRANTS WHAT IS PENDING, WHAT WE APPLIED FOR, IF THERE IS CASH MATCH SO THEY
CAN PUT IT IN THE BUDGET. >> THIS WAS ALREADY IN THE
BUDGET. >> THIS IS AN APPLICATION FOR
[00:20:02]
NEXT YEAR WHICH WOULD BE 24-25. THIS WILL BE PUT IN THEBUDGET . >> WE APPLY EVERY YEAR.
>> THE SAME AMOUNT. >> IT IS IN THERE THIS YEAR AND IT WILL BE PUT BACK FOR NEXT YEAR IF WE GET IT. OKAY.
MAKING A MOTION ON THE DEPARTMENT HEADS WHEN YOU ENTER ITEM ONTO THE AGENDA FOR US TO BRING TO COURT IF IT HAS CASH MATCH OR ANY FEES OR ANYTHING ATTACHED IT HAS TO GO ON THE REGULAR AGENDA. DO NOT PUT IT ON THE CONSENT AGENDA. ALL THOSE IN FAVOR? ANY OPPOSED? NOW, ACCEPTING A MOTION TO PASS ITEM G AND I WILL MAKE THE MOTION SINCE I PULLED IT TO PASS ITEM 2 WITH THE CASH MATCH BUDGETED FOR THIS DEPARTMENT AND THEN BUDGETED AGAIN NEXT YEAR FOR FUTURE USE.
>> A MOTION AND SECOND ALL THOSE IN FAVOR? ANY OPPOSED?
[J. Approve application procedure for Nueces County Animal Services Advisory Committee.]
THE MOTION PASSES. THANK YOU.>> ITEM J IS JUST, I DON'T KNOW WHY IT HAS , IT'S JUST GOING OUT FOR APPLICATIONS BECAUSE ONE OF THE BOARD MEMBERS ON THE NUECES COUNTY ANIMAL SERVICE ADVISORY BOARD RESIGNED SO WE HAVE ONE OPEN POSITION. ONE, THE OTHER DOES NOT END UNTIL JUNE. HE IS MOVING OUT OF STATE BUT WANTING TO SERVE UNTIL JUNE. SO THERE'S ONE PERSON THAT RESIGNED SO THERE WILL BE ONE OPENING ON THE BOARD, SHE HAS TO POST ASKED FOR APPLICATIONS. THIS IS A SIMPLE PROCEDURE.
>> SO MOVED. >> I WILL SECOND THAT MOTION,
[K. Receive update on the Public Defender's Office]
ALL THOSE IN FAVOR ANY OPPOSED? THE MOTION PASSES. ITEM K RECEIVE UPDATE ON PUBLIC DEFENDER OFFICE. I AM TOLD IN A MEETING IN A WORKDAY WORKSHOP, I WILL ALSO TELL YOU IN THE PAST WITH THESE UPDATES WE WERE INSTRUCTED BY YOU ALL WE DO NOT WANT PEOPLE TALKING FOREVER, IF THEY COULD DO THE PRESENTATION AND PUT IT IN THE CONSENT AGENDA WE COULD READ IT AND EVERY ONE OF THEM FOR QUESTIONS AS YOU MAY HAVE QUESTIONS TODAY WE COULD CALL THEM. IF YOU WOULD LIKE FOR ME TO CATCH HER LATER AND BRING IT BACK WHEN SHE'S OUT OF THE MEETING THEN WE CAN CALL HER IF YOU HAVE QUESTIONS.>> AGAIN WE CANNOT TREAT EVERYTHING TALKING FOREVER I DON'T KNOW WHAT THAT MEANS. WE HAVE TO LIMIT THE TIME I GUESS TO THREE MINUTES LIKE EVERYBODY ELSE. SOMETIMES YOU NEED TO HEAR WHAT'S GOING ON FROM THEM . WHERE WE ARE WITH STAFF.
>> IF YOU READ HER THING IT IS A GREAT REPORT AND I'M SURE SHE WOULD LOVE TO BE HERE TO REPORT SHE HAS FULLY STAFFED AND HAS EVERYBODY AND HAVE RECEIVED , THEY'VE DONE OVER 400 ACTIVE CASES, DISPOSED OF 400, THEY'VE ALL THE LAWYERS AND STAFF, THEY HAD A PROBLEM WITH ONE OF THEIR ADMINISTRATORS OR SOMETHING THAT LEFT TO GO SOMEWHERE ELSE BUT THEY GOT THAT PERSON REPLACED. SO THEY ARE FULLY STAFFED AND FUNCTIONING AT THE DEPARTMENT. IT WAS A GREAT UPDATE, I'M SURE SHE WOULD LOVE TO COME TALK ABOUT IT LATER AND IF SHE GETS OUT OF HER MEETING , WE WILL PULL HER
UP AND LET HER TALK ABOUT IT. >> NO ISSUES OR ANYTHING.
>> NONE AT ALL. >> THAT IS WHAT WE ALL DID ASK TO DO AND THEN ANY OF US NEED TO DO IS PULL IT AND LET THEM KNOW IN ADVANCE WE WANT THEM TO BE HERE.
>> IF YOU HAVE A QUESTION YOU WANT TO ASK.
>> SOMETIMES YOU WANT TO AND SOME OF YOU DON'T.
>> THAT'S WHY WE DECIDED WE WOULD PUT IT HERE AND PULL IT IF WE NEED IT. THIS IS A GOING REPORT, THEY ARE DOING AWESOME AND WILL BE MOVING INTO THEIR NEW OFFICES HOPEFULLY BY FEBRUARY. IT IS FEBRUARY IN HERE, BUT THE REPORT STATES ALL
>> I WILL MAKE A MOTION IF THAT'S OKAY.
>> A MOTION AND SECOND TO PASS. ALL THOSE IN FAVOR SAY AYE AND
[6. Discuss and consider accepting a donation of approximately 7.5 acres of land from CC High Point Investments LLC for a drainage project in the London area and all related matters.]
THE MOTION PASSES. THANK YOU. MOVING ON TO OUR REGULAR AGENDA. I'M GOING TO PULL UP ITEMS SIX, FIRST BECAUSE WE HAVE SOME GUESTS AND WE WOULD LIKE THEM. SIX AND SEVEN ARE TOGETHER. I WAS GOING TO DO SIX FIRST. DISCUSS AND CONSIDER ACCEPTING A DONATION OF 7.5 ACRES OF LAND FROM CORPUS CHRISTI HIGH POINT INVESTMENTS LLC FOR DRAINAGE.[00:25:04]
WE ARE VERY HAPPY AND EXCITED TO HAVE YOU ALL HERE. I WILLTURN IT OVER TO YOU. >> THANK YOU VERY MUCH. LET ME SAY FIRST OF ALL, JUDGE, I LIKE , IF THEY WANT TO SAY
SOMETHING. >> THEY BOTH WANT TO SPEAK.
>> BEFORE THEY COME UP, THIS IS REALLY AN UNBELIEVABLE GIFT THAT HIGH POINT INVESTMENTS IS MAKING . THE DRAINAGE ISSUES WE HAVE ARE SIGNIFICANT . LIKE WE HAVE IN MANY AREAS OF THE COUNTY. WE HAVE ALL BEEN WORKING ON DRAINAGE PROJECTS WITHIN PRECINCTS AND THIS IS ONE HAVE BEEN STRUGGLING WITH FOR QUITE A WHILE IN REGARDS TO THE AREA THAT WE ARE TALKING ABOUT. AS WE ALL DO WE HAVE GOT MONEY WHO KNOWS WHEN THAT IS GOING TO COME ABOUT BASED ON THE APPLICATION PROCESS AND WHEN WE GET BACK FROM THE STATE. I PREVIOUSLY ALLOCATED SOME FUNDS FROM ARPA TO THIS AREA AND WAS TRYING TO COME UP WITH WHICH PROJECT I WOULD GO WITH FIRST. A LOT OF THESE PROJECTS REQUIRE THE LAND TO DO IT. SO FAR WITH THESE PROJECTS THIS ONE HIT FIRST BECAUSE OF THE GENEROSITY OF HIGH POINT INVESTMENTS, WHICH IS FROM THE FAMILIES AND IT IS SO MUCH APPRECIATED THEY ARE DOING THIS TODAY. AGAIN I WANT TO THANK YOU VERY MUCH ON BEHALF OF ALL THE RESIDENTS FROM NUECES COUNTY. THIS IS GOING TO HAVE A HUGE IMPACT IN THE LONDON AREA, RABBIT RUN, SOUTH PRAIRIE, THE AREAS YOU HAVE PROPERTY IN THAT YOU ARE SPENDING A LOT OF TIME WORKING TO DEVELOP. I KNOW YOUR PROPERTY , YOU LIVE OUT THERE IF I'M NOT MISTAKEN. I KNOW , YOU SUFFERED THE FLOODING YOURSELF. SO THIS IS A STEP IN THE RIGHT DIRECTION. AND WE COULDN'T BE DOING THIS PROJECT IF WE DID NOT HAVE THE FUNDING AVAILABLE THROUGH ARPA , BUT ALSO IF WE DID NOT HAVE THE ABILITY OF THE FAMILIES TO MAKE THIS DONATION. SO TRULY I DON'T THINK FOLKS IN LONDON REALIZE HOW IMPACTFUL THIS WILL BE. IN A FEW MINUTES WE WILL REALLOCATE SOME OF THE FUNDS THAT WERE PREVIOUSLY ALLOCATED IN GENERAL TO THAT AREA BUT WE CANNOT DO THIS PROJECT WITHOUT YOUR FAMILIES DOING THIS AND IT IS GREATLY APPRECIATED. IF YOU WANT TO HEAR THE PRESENTATION FIRST OR IF YOU WANT TO SPEAK FIRST I WANT TO MAKE SURE YOU HAVE THE OPPORTUNITY BECAUSE I WANT TO THE FOLKS TO SEE HOW IMPACTFUL THIS WILL BE ON THE AREA. THANK YOU, THANK YOU, THANK YOU MANY TIMES. IF YOU WANT TO GO FIRST THAT'S FINE IF YOU WANT TO GO FIRST THAT DOESN'T MATTER. I DO WANT THE COURT AND THE PUBLIC TO SEE THE IMPACT THAT THIS PROJECT IS GOING TO HAVE ON THAT AREA.
COMMISSIONERS. THIS IS GOING TO BE A HUGE IMPACT TO THE DRAINAGE OUT IN THE LINDEN AREA. THE ESTIMATED SQUARE MILEAGE THAT THE IMPACT IS GOING TO BE ON THE UPSIDE WILL BE A LITTLE OVER SIX SQUARE MILES. COMMISSIONER JUST TO GIVE YOU AN IDEA. THIS IS THE AERIAL VIEW OF THE PROPOSED FACILITY. IF YOU LOOK TO THE LEFT SIDE THAT IS HATCHED IN, THAT AREA IS WHERE THE PROPOSED POND WILL BE CONSTRUCTED. THE LITTLE FINGER TO THE RIGHT WILL BE KIND OF LIKE A SHORT ACCESS FOR THE COUNTY AND FOR THE OWNER TO ACCESS THEIR PROPERTY AND AT THE SAME TIME WE CAN ACCESS THE POND FOR MAINTENANCE OR IF WE NEED TO DO SOME TYPE OF IMPROVEMENT IN THE VICINITY. THE SIZE OF THE POND IS GOING TO BE ABOUT FROM SEVEN ACRES TO A LITTLE BIT OVER SEVEN ACRES OF THE DETENTION FACILITY AND THAT IS GOING TO BE A BIG POTENTIAL FACILITY. WE ESTIMATE ANYWHERE FROM THE DEPTH TO BE ANYWHERE FROM 10 TO 15 FEET IN DEPTH OR DEEPER IF WE CAN DEPENDING ON THE WATER TABLE AND THAT WILL BE
[00:30:04]
PART OF THE DESIGN WHEN THE ENGINEER GETS INVOLVED. THIS IS GOING TO BE AN IMPACTFUL. WE ALSO HAVE THIS TRIBUTARY, THE DRAINAGE WAY THAT GOES IN BETWEEN THOSE PROPERTIES. THAT WILL GET REROUTED INTO THE POND AND THEN HAVE THE OVERFLOW TO EXIT ANY TYPE OF OVERFLOW THAT WE GET FROM THE EXCESS WATERSHED OR FROM THE WATERSHED. GO TO THE NEXT ONE.STAFF HAVE BEEN INSTRUMENTAL IN THIS. WE HAVE BEEN TALKING ABOUT THIS FOR I DON'T KNOW, TWO YEARS IT SEEMS. SEEMS LIKE TWO DECADES , BUT IT HAS BEEN A LONG TIME AND HE REACHED OUT AND MADE THE INITIAL CONTACT AND THEY REALLY WORKED HARD TO COME UP WITH A PLAN THAT COULD HAVE A GREAT IMPACT SO I WANT TO THANK YOU WHILE YOU'RE STANDING THERE. PLEASE PROCEED, BUT YOUR STAFF HAS BEEN INSTRUMENTAL IN GETTING
THIS DONE. >> ON THAT ONE YOU CAN SEE RUNNING ON THE SOUTH END OF THE TRIBUTARY. THE RIVER RUNS ON THE SOUTH SIDE AND THEN YOU HAVE SOUTH PRAIRIE ON THE NORTH SIDE. OF THAT POTENTIAL FACILITY. NEXT ONE.
>> THE NEXT ONE. YES. >> TELL US HOW THAT WILL AFFECT THE FLOW, IF YOU CAN GO BACK. HOW WILL THAT AFFECT THE FLOW AND HELP THOSE FOLKS WITH THEIR SPECIFIC DRAINAGE NEEDS?
>> ON THAT ONE, COMMISSIONER, THE CREEK THAT RUNS IN BETWEEN SOUTH PRAIRIE AND RIVER RUN TRAINS IN BETWEEN AND GOES DOWN TO STATE HIGHWAY 286 AND THEN FLOWS OUT TO THE BAY. SO IT WILL BE IMPACTFUL BECAUSE IT WILL CAPTURE SOME WATER BEING HELD ON THE BACK END SIDE AND IT WILL BE HELD IN THE
DETENTION POND FACILITY. >> HOW MUCH WATER IN LAYMAN TERMS IS THIS GOING TO BE ABLE TO HOLD JUST TO GIVE PEOPLE AN
IDEA, IF YOU HAVE IT? >> I SHOULD AMEND THE CALCULATIONS, AND I HAVE DONE SOME CALCULATIONS AND I WANT TO THROW OUT A NUMBER, BUT IT WILL BE A HUGE FACILITY.
>> I WITHDRAW MY QUESTION THEN.
>> IT'S GOING TO BE HUGE, YES SIR. NEXT ONE, PLEASE. THE NEXT EXHIBIT KIND OF SHOWS HOW LIKE COMMISSIONER SAID HOW MUCH OF A WATERSHED THAT GOES TO THIS , THAT'S GOING TO THIS DETENTION FACILITY. THERE IS A RED LINE THAT MARKS THE NORTHERN SIDE OF THE WATERSHED. THAT WATERSHED SHOWS AND YOU TIE THE RED LINE TO THE BLACKLINE. IT IS ABOUT 6.6 SQUARE MILES OF WATERSHED THAT GOES THROUGH THIS CREEK THAT WILL ALSO GO TO THE DETENTION POND. ALL OF THIS WILL BE CAPTURED IN THE AREA AND THEN SLOWLY RELEASED INTO THE EAST SIDE WHICH WILL BE THE BAY AND THEN SLOWLY , I SAY SLOWLY RELEASED INTO THE BAY SO IT'S NOT ONLY GOING TO IMPACT 6.6 SQUARE MILES ON UPSTREAM BUT IT WILL IMPACT THE WHOLE 12 SQUARE MILES TOTAL OF THE WATERSHED THAT IT WILL BE
IMPACTING. >> THANK YOU, AWESOME.
>> ONE THING THAT CAN BE DONE AND THIS IS PART OF THE REQUEST FROM THE ENGINEERS. SOME OF THE AREAS ARE WITHIN THE FLOODWAY AND THE FLOODPLAIN AND THIS WILL BE IMPACTING THAT BECAUSE THE FLOODWAY MIGHT BE IMPACTED NEAR THE WATER ELEVATION GOING DOWN AND PEOPLE THAT WILL HAVE INSURANCE FOR WATER DAMAGE, SOME OF THOSE CAN GO BACK TO THE INSURANCE COMPANY FOR THE
FUTURE. >> THE MAP YOU HAVE CAPTURED HERE, I WAS 20 SEE , IF PRECINCT 1, BUT AT LEAST THREE ARE CAPTURED IN THE MAP. DOES THAT MEAN THERE WILL BE SOME RELIEF? I KNOW IT IS MAINLY FOR IMPACTING PRECINCT I KNOW IT IS MAINLY FOR IMPACTING PRECINCT 4 AND TWO, BUT MINE IS
LISTED. >> I APOLOGIZE, I KNOW WE SHOW THE DIFFERENT PRECINCTS, BUT THIS WILL BE MORE
IMPACTFUL. >> I GET THAT, THAT'S WHY I WAS ASKING DO YOU ANTICIPATE THIS HELPING OTHER AREAS ARE
MAINLY THIS GENERAL AREA? >> MORE IN THAT GENERAL AREA.
ALL THE WATERSHED IN THE BLACK OUTLINE IS DIRECTED WITH WATER FLOW THROUGH THIS. MOST OF IT WILL BE WITHIN BETWEEN COUNTY
[00:35:01]
ROAD 22 S. AND THEN A LITTLE BIT NORTH, GOING ALL THE WAY TO COUNTY ROAD 51, 53 AND 55. THOSE AREAS WILL BE PART OF THIS DRAINAGE AND THEN FROM THE SOUTH SIDE YOU HAVE COUNTY ROAD 18 TRAINING TOWARD THE BACK INTO THIS FACILITY , THISPROPOSED FACILITY. >> JUDGE, I WOULD JUST, WE DONE? I WOULD MAKE A MOTION AND I WANT TO LET THE FAMILY SPEAK IF THEY WOULD LIKE TO. MOTION TO GET IN ON THE FLOOR TO ACCEPT DONATION OF 7.5 ACRES OF LAND FROM HIGH POINT INVESTMENT LLC FOR DRAINAGE PROJECT IN THE AREA , AS PROPOSED ON THE
>> WE HAVE A MOTION AND MULTIPLE SECONDS, EVERYBODY IS EXCITED. ALL THOSE IN FAVOR SAY AYE. I WAS GOING TO LET THEM SPEAK ANYWAY. ALL THOSE IN FAVOR SAY AYE WE WILL GET IT OVER WITH . NOW WE WOULD LOVE TO HEAR FROM YOU GUYS AND WE ARE SO APPRECIATIVE. THANK YOU.
>> JUDGE SCOTT, COMMISSIONERS. IT IS OUR HONOR TO BE HERE TODAY. THIS IS A GREAT EXAMPLE OF HOW THE PUBLIC SECTOR AND PRIVATE SECTOR COME TOGETHER TO IMPROVE OUR COMMUNITY. SO I THANK ALL OF YOU FOR VOTING POSITIVELY ON THIS ITEM TODAY.
IN PARTICULAR I WOULD LIKE TO THANK COMMISSIONER CHESNEY. WE HAVE WORKED SUBSTANTIALLY WITH COMMISSIONER CHESNEY IN MEETINGS AND I CAN SAY THAT HE IS A TRUE LEADER. HE IS, HE HAS JUST BRILLIANTLY CREATED THIS AND , WE HAD EXCELLENT MEETINGS WITH , AS WELL I THANK HIM AND HIS STAFF. YOU CERTAINLY HAVE A VERY EXPERIENCED AND HIGHLY SKILLED ENGINEERING STAFF. SO WE HAD SOME GREAT MEETINGS, BUT IN PARTICULAR COMMISSIONER CHESNEY I PERSONALLY THANK YOU FOR SPEARHEADING AND LEADING THIS. OBVIOUSLY IT IS NOT EVERYDAY THAT LANDOWNERS COME FORWARD AND DONATE VALUABLE PIECES OF PROPERTY , BUT MY FAMILY AND THE FAMILY HAVE BEEN HERE FOR GENERATIONS. AND WE HAVE SUBSTANTIALLY DONATED TO OUR COMMUNITY IN THE PAST. IN FACT, WE BROUGHT MY DAUGHTER AND HIS SON AND MY GODSON HERE, IN COLLEGE AND WORKING WITH JOHN. TO SHOW THEM , YOU KNOW, WHAT YOU SHOULD DO FOR YOUR COMMUNITY. WHEN IT'S TIME FOR YOU TO STEP UP AND ASSIST , IN THIS CASE, YOUR COUNTY, YOU DO IT WHENEVER POSSIBLE. AND SO, WE WANT THEM MANY YEARS FROM NOW TO PERHAPS DO THE SAME TO HELP OUR COMMUNITY, OUR COMMUNITY HAS GIVEN US SO MUCH AND JOHN AND I WE LOVE THIS PLACE. WE CAME BACK HOME, IN OUR GENERATION WHEN FEUDED , BUT IT HAS BEEN A GREAT HOME AND A BEAUTIFUL HOME FOR US. SO IT IS A WONDERFUL HONOR TO GIVE THIS TO THE COUNTY. AND IN PARTICULAR, DO IT IN A WAY THAT HAS SUCH A SUBSTANTIAL BENEFIT TO THE COMMUNITY. SO AGAIN, I THANK THE ENTIRE COMMISSIONERS COURT IN PARTICULAR COMMISSIONER CHESNEY BECAUSE THIS WAS HARD WORK AND IT WAS, IN MY OPINION BRILLIANT WORK AND , HOPEFULLY IT WILL PROVIDE A GREAT BETTERMENT FOR THE CITIZENS OF NUECES COUNTY. SO, THANK YOU VERY MUCH.
>> THANK YOU, I APPRECIATE THAT, THE KIND WORDS. WE START SOME PAPERWORK. WE MEANT TO MAKE THE MOTION SO NEED TO CORRECT THAT CONTINGENT UPON THE PAPERWORK SO I NEED TO ADD THAT BACK BEFORE I FORGET THAT AND I WILL REFER AGAIN, THANK
YOU FOR THE KIND WORDS. >> I WANTED TO ADD , THE
[00:40:04]
COUNTY JUDGE AND COMMISSIONERS THAT THIS BEGAN WITH THE TRUST, WITH STAKEHOLDERS AND THE COUNTY GOVERNMENT. I WANT TO THANK YOU FOR GIVING THAT ENVIRONMENT FOR US TO WORK WITH YOU. AGAIN COMMISSIONER CHESNEY FOR REACHING OUT TO US AND TAKING THE INITIATIVE OF MAKING THIS HAPPEN AND YOUR STAFF, THEY HAVE DONE AN EXCELLENT JOB AND IT HAS BEEN A PLEASURE WORKING WITH THEM. WE LOOK FORWARD TO CONTINUINGTO WORK WITH YOU. >> THANK YOU, I APPRECIATE IT.
COUNCILMAN GONZALEZ THANK YOU FOR BEING THERE FOR THE COMMUNITY. I REMEMBER 30 YEARS AGO WHEN WE WERE INVOLVED IN SOME ORGANIZATIONS AND WE STILL ARE SO I COMMEND YOU AND YOUR FAMILY FOR THAT. IF YOU HAVE MORE PROPERTY, I AM RIGHT NEXT TO IT. RIGHT NEXT DOOR. ONLY KIDDING, BUT WE ARE
LOOKING FOR LAND. >> HE'S NOT KIDDING EITHER.
>> I THINK MR. MAREZ WOULD ASK FOR THAT.
>> HE BEAT ME TO THE PUNCH. TAKE YOU TO THE FAMILIES. YOU LOOK AT THE DEVELOPMENT, THE WORK YOU PUT IN THROUGHOUT NUECES COUNTY NOT JUST LIMITED TO ONE AREA. SO I CAN'T IMAGINE WHAT THE VALUE IS OF THIS. WHAT IT PAYS FOR IN JUST GIVING TO THE COMMUNITY AND FOR POTENTIAL DEVELOPMENT BECAUSE THAT'S ONE THING WE HEAR , WITH ALL THE DEVELOPMENT THAT YOU DO, THE DRAINAGE IS A GAME CHANGER. IF YOU HAVE GREAT DRAINAGE PEOPLE WANT TO MOVE THERE OR IF THEY DON'T THEY STILL MIGHT MOVE THERE AND THEN REALIZE WHEN WE GET A BIG RAIN EVENT THAT IT WAS NOT WORTH IT. AND THEN THEY USUALLY COME TO US. SO TO BE SO PROACTIVE IN THIS WAY AND THEN ONCE AGAIN WITH THE VALUE I CAN IMAGINE WHAT'S INCLUDED FOR THIS PROPERTY OR WHAT IT WOULD GO FOR ON THE OPEN MARKET. IT IS AN UNBELIEVABLE GIFT YOU HAVE GIVEN TO THIS COMMUNITY SO THANK YOU TO EACH OF YOU FAMILIES FOR ALL YOU HAVE
DONE. >> JUDGE, IF I COULD. SORRY.
AS WELL. THANK YOU VERY MUCH FOR YOUR CONTRIBUTION AND THANK YOU FOR SHOWING THE YOUNG PEOPLE HOW THEY CAN HELP, WHEN THEY CAN HELP AND WE APPRECIATE THAT. IS GOING TO ALLEVIATE A LOT OF PROBLEMS AND A LOT OF CALLS TO MY OFFICE.
PEOPLE CONFUSE MY PRECINCT WITH THE LONDON AREA. ANYWAY IT'S
GOING TO HELP US ALL. >> JUAN AND I'M HOPING JENNY CAN GET THE PAPERWORK EXPEDITED PRETTY QUICKLY ON TRANSFERRING PROPERTY OVER , ASSUMING THAT GETS DONE, THERE ARE SOME FOLKS TUNING IN TO WATCH THIS, THEY HAVE BEEN VERY INTERESTED.
CAN YOU GIVE US A TIMELINE ON HOW FAST , ONCE WE DO NUMBER SEVEN ONCE WE GET THAT GOING WHAT YOU'RE FEELING IS ON HOW
WE CAN DO THIS? >> YES, COMMISSIONER.
TIMELINE, ONCE WE GET THE ENGINEERS ON BOARD, WE ARE PROBABLY LOOKING ANYWHERE FROM ESTIMATING 3 TO 4 MONTHS FOR THE DESIGN PROCESS AND THEN RIGHT AFTER THAT HOPEFULLY YOU GET THE FINAL DESIGN AND THEN GO OUT FOR BIDS AND THE CONSTRUCTION, ESTIMATING ABOUT ONE YEAR BUT PROBABLY LESS
THAN THAT. >> OKAY WE SHOULD HAVE THIS COMPLETED BY THE END OF THIS YEAR. I'M JUST KIDDING.
>> WHICH LEADS TO ITEM NUMBER SEVEN. AMAZING, OUR SINCERE THANKS TO BOTH OF YOU FAMILIES , I KNOW YOU BOTH AND THIS IS TRULY A GREAT GIFT AND A GREAT SENTIMENT TO YOUR VALUE AND FEELINGS ABOUT OUR COUNTY AND WHAT YOU HAVE DONE FOR MANY
[7. Discuss and consider Un-allocating $1,000,000 from Pct. 4 ARPA London Drainage Improvement Project; Reallocate $1,000,000 to the Detention Pond Project in the London area as donated by CC High Point Investments LLC; Assign Freese Nichols as the engineer on said project.]
YEARS. SO THIS IS NOT SURPRISING, BUT WE ARE VERY VERY THANKFUL. MOVING INTO ITEM NUMBER SEVEN TO GET THIS PROJECT ACTUALLY STARTED AND WE JUST GOT THE TIMELINE ON.TO DISCUSS AND CONSIDER ON ALLOCATING 1 MILLION FROM PRECINCT 4 ARE BOTH LONDON DRAINAGE IMPROVEMENT PROJECT TO REALLOCATE 1 MILLION TO THE DETENTION POND PROJECT AND THIS IS YOUR AREA AND YOUR MONEY COMMISSIONER CHESNEY.
>> YES MA'AM I WOULD MAKE THE MOTION TO UN-ALLOCATE $1 MILLION FROM PRECINCT 4 GENERAL ARPA LONDON DRAINAGE IMPROVEMENT TO ALLOCATE THE MONEY $1 MILLION TO THE DETENTION POND PROJECT IN THE LONDON AREA AS DONATED BY THE
[00:45:01]
CC HIGH POINT INVESTMENT AND TO SIGN AS THE ENGINEER ON SAIDPROJECT. >> WE HAVE A MOTION. AND WE HAVE A SECOND. ANY OTHER DISCUSSION ON THIS PROJECT? IF NOT, ALL THOSE IN FAVOR SAY AYE. ANY OPPOSED? THE MOTION PASSES. WE ARE READY TO BEGIN WORK, THANK YOU.
>> THANK YOU VERY MUCH, THANK YOU FOR BEING HERE.
>> HOW FAST YOU THINK WE CAN GET THE PAPERWORK GOING?
>> MY UNDERSTANDING IS THE DEED IS BEING PREPARED BY THE DONORS AND WE WILL RECEIVE THAT OR IT WILL BE FILED AND WE WILL
RECEIVE AFTER THAT. >> GO TO GET REVIEWED AND
APPROVED. >> IF I NEED TO HELP WITH THAT, LET ME KNOW. COUNTING ON YOU TO KEEP AHEAD OF THAT.
[1. Receive updates, if any, regarding the Bob Hall Pier project and all related matters.]
>> OKAY. ITEM NUMBER ONE. DO WE HAVE A PROJECT UPDATE?
>> JUST IN THE PACKET AND AGAIN .
>> NO ONE HERE TO PRESENT? >> JUST TO RECEIVE . I WOULD'VE PUT THIS ON CONSENT BUT I'M TOLD I CAN'T.
>> YOU DID IT THE RIGHT WAY. >> THEY TELL ME I HAVE TO
COMMISSIONER. >> IF YOU HAVE SOMETHING TO ADD TO THE BACK, IF YOU HAVE SOMETHING THAT'S JUST A REPORT YOU CAN PUT IT IN CONSENT. IF YOU HAVE SOMEONE HERE TO PRESENT THEN YES IT HAS TO GO IN REGULAR. IF YOU HAVE NOTHING ON IT AND IT IS BLANK LIKE IT HAS BEEN FOR SEVERAL MEETINGS, THAT HAS TO BE ON THE REGULAR IF YOU WANT TO BRING IT OUT AND
TALK ABOUT IT. >> CAN I PUT THIS ON CONSENT GOING FORWARD? I'VE ALWAYS HAVE A REPORT. YOU'RE THE ONE WHO TOLD ME I CANNOT PUT IT ON CONSENT. JENNY WAS THE ONE WHO ADVISED ME WHY WOULD OF HAD THIS ON CONSENT EVERY TIME. IF I HAVE BACKUP CANNOT PUT IT ON CONSENT?
>> IT CAN BE JUST LIKE THE PUBLIC DEFENDER OFFICE. IF IT'S JUST A REPORT HAVE IT ON, WE CAN READ AND IF WE HAVE QUESTIONS WE WILL CALL AHEAD AND SAY WE WANT SOMEONE HERE.
>> OKAY. >> THERE IS GOING TO BE SOMETHING ON THERE EVERY TIME.
>> YOU SAID DISCUSS AND CONSIDER YOU CANNOT DISCUSS AND CONSIDER ON CONSENT UNLESS YOU PULL IT OUT. IT HAD TO BE
ON THE REGULAR AGENDA. >> THIS IS THE WORDING ON THE CONSENT AGENDA AS GIVEN TO ME BY JENNY. I WAS TOLD TO PULL OFF THE CONSENT AGENDA BY YOU OR SOMEONE ELSE AND PUT IT ON THE REGULAR. I DID NOT PUT IT ON REGULAR I WANTED ON CONSENT I WILL HAVE A REPORT EVERY TIME. I DON'T NEED IT ON REGULAR. TELL ME THE WORDING YOU WANT BECAUSE I WANT IT ON
CONSENT. >> THAT IS DISCRETIONARY WITH
THE COURT. >> BRING THIS BACK ON CONSENT.
IT'S AN UPDATE WHEN IT SAYS DISCUSS AND CONSIDER.
>> IT MIGHT BE LIKE WE ARE PULLING SOMETHING OFF OF CONSENT TO DISCUSS WITH , SO I WILL PUT IT ON LIKE THIS, BUT IT WILL HAVE ACTION IF NEED BE RIGHT?
>> IF YOU INTEND TO TAKE ACTION YOU NEED TO INDICATE
>> CHANGE THE WORDING. >> OKAY EVERY ITEM ON THE CONSENT AGENDA IS AN ACTION ITEM, EVERY ONE OF THEM. WE JUST VOTE ON ALL OF THEM SO THAT'S AN ACTION ITEM.
>> IF IT SAYS RECEIVE UPDATE AND IT DOES NOT SAY AND CONSIDER WHATEVER ACTION YOU ARE CONSIDERING, THEN THAT IS I THINK WHERE THE NOTICE COULD BE MORE CLEAR.
>> OKAY. I ONLY WORDED THIS BECAUSE THIS IS HOW YOU TOLD ME TO WORD IT AND PUT IT ON CONSENT AND THEN IT WAS PULLED INTO WHATEVER. ALL OF THE ITEMS ON CONSENT OR ACTION ITEMS BECAUSE WE VOTE ON ALL OF THEM. EXCEPT ADOPT, ADOPT, ADOPT, APPROVE, RECEIVE, APPROVE WHAT WE VOTE ON EVERY ONE OF THEM.
TELL ME HOW TO WORD IT SO I CAN PUT IT ON CONSENT, BUT IT STILL MIGHT BE AN ACTION ITEM. I DON'T KNOW WHAT SOMEONE WILL
DO WITH IT. >> OKAY AND THEN ALL I WOULD DO IS SAY CONSIDER TAKING ACTION, IF ANY IF YOU DON'T KNOW BUT IF YOU KNOW THE ACTION AHEAD OF TIME THAT IT WOULD BE.
>> RIGHT I WILL PUT IT ON GENERAL IF I NEED TO. I WILL HAVE AN UPDATE EVERY SINGLE TIME BECAUSE I WANT THE COURT TO BE AWARE AND KNOW WHAT'S GOING ON AND I WITH THE PUBLIC
TO BE AWARE. >> I WAS INFORMED THE REASON WE WERE ASKED TO MOVE IT FROM CONSENT WAS BECAUSE IT ALWAYS
[00:50:01]
HAD ALL RELATED MATTERS. WE KEPT PASSING ON THE CONSENT AGENDA AND IT HAD NOTHING BACK UP, WE WERE PASSING A BLANK NAME. WHEN IT HAS A REPORT BEHIND IT, THAT'S FINE TO BE ON CONSENT. WE HAD NOTHING ON IT THAT'S THE REASON WHY WESAID IT WAS MISLEADING. >> I MOVED AND I SAID I WILL PUT IT BACK UP AND I WAS STILL TOLD TO KEEP IT ON. IT HAD BACKUP THE LAST TWO OR THREE MEETINGS SO I HAVE GOT ALL THE BACKUP AND I'M STILL TOLD IT NEEDS TO BE ON THE REGULAR AGENDA. IF I'M TOLD I CAN PUT IT ON THE CONSENT AGENDA WITH BACKUP IT WILL BE ON EVERY ITEM.
>> WITH THE BACKUP. TURNED IN ON TIME IF IT'S NOT.
>> I UNDERSTAND THAT AND I GET MY BACKUP FROM SCOTT HARRIS, HE KNOWS HE NEEDS TO BE ON TIME, I KNOW WE NEEDS TO BE ON TIME BECAUSE I WAS GRIPING ABOUT BEING ON TIME IF STUFF WASN'T AND THERE'S STILL STUFF THAT IS NOT GET TURNED IN ON TIME THAT IS HANDED TO US IN COURT BUT THAT GETS CONSIDERED ANYWAY. I'M HOPING EVERYBODY GETS HELD TO THE STANDARD LAST TWO MEETINGS PEOPLE HAVE HANDED ME STUFF THAT WAS NOT A BACKUP BUT IT STILL GETS ON THE AGENDA. WHATEVER WE'RE GOING
TO DO LET'S DO. >> WE TRIED TO BE VERY CONSISTENT AND THE ONLY REASON YOURS WAS PULLED OUT IS BECAUSE WE WAS PASSING WITH NOTHING ON. IT WAS A LINE ITEM AND IF YOU HAVE SOMETHING ON THERE AND WE HAVE SOMETHING WE HAVE READ AND WANT TO PASS THAT'S WHY IT WAS MOVED. WE CAN BE CONSISTENT FOR EVERYBODY THAT'S LISTENING. THAT'S THE WAY IT IS SUPPOSED TO BE ON THE CONSENT AGENDA. IF IT IS STANDARD OR A REPORT JUST LIKE WE DID EARLIER ON THE EARLIER ITEM IT IS JUST A REPORT THERE IS NOT A BIG DISCUSSION OR ACTION AND IT'S A SIMPLE MATTER, THAT COULD BE PUT ON.
IF YOU HAVE SOMETHING THAT NEEDS TO BE VOTED ON OR AN ACTION TAKEN THAT WOULD TAKE MORE TIME I WOULD SUGGEST YOU PUT IT WHERE YOU WANT TO , WE PUT IT ON THE REGULAR AGENDA.
[2. Discuss and reconsider placing Geoff Atwood back on the Nueces County Emergency Service District No. 4 Board to replace Christopher Wilson and related matters.]
MOVING ON THEN ITEM NUMBER TWO. DISCUSS AND RECONSIDER PLACING MR. ATWOOD BACK ON THE NUECES COUNTY EMERGENCY SERVICES DISTRICT 4. THIS , I RECEIVED A LETTER FROM MR. WILSON YESTERDAY BECAUSE OF THE , IN LIGHT OF THE INFORMATION AND THE COURT RECEIVED AND THE DISCUSSION AT LAST MEETING.MR. WILSON HAS GRACIOUSLY WITHDRAWN HIS APPLICATION SO THIS IS AN OPEN SEAT THAT BECAUSE OF MISINFORMATION WE CAN CORRECT OUR ACTION THAT THE COURT TOOK. I BELIEVE COMMISSIONER HERNANDEZ HAS A MOTION.
>> YES THAT IS CORRECT. I WANT TO MAKE THE MOTION TO NOMINATE
MR. GEOFFREY ATWOOD. >> WE HAVE A MOTION AND A SECOND. IS THERE ANY OTHER DISCUSSION? ALL THOSE IN FAVOR SAY AYE. AND THE MOTION PASSES, BUT I WAS ALSO LIKE TO ONCE AGAIN THANK MR. WILSON. FOR HIS GRACIOUSNESS IN ALLOWING US AND WE DO APPRECIATE HIS APPLICATION TO SERVE AND WE APPRECIATE PEOPLE IN THE COMMUNITY THAT ARE WILLING TO STEP UP. WE HOPE YOU WILL CONTINUE TO DO SO AND MAYBE APPLY AGAIN IN THE FUTURE. THANK YOU FOR ALLOWING
US TO CORRECT A MISTAKE. >> YES, THANK YOU VERY MUCH, THANK YOU MR. WILSON AND THANK YOU FOR REAPPLYING.
>> CONGRATULATIONS ESTHER ATWOOD. YOUR BACK ON THE BOARD.
[3. Discuss and consider the cancelation of Professional Service Agreement with Texas State Roofing Company for consulting services for review, analysis, evaluation, and recommendations regarding the Nueces County Courthouse Complex Roof Repair/Replacement Project, and all related matters.]
MOVING ON , ITEM NUMBER THREE , DISCUSS AND CONSIDER CANCELLATION OF PROFESSIONAL SERVICES AGREEMENT WITH TEXAS DAY ROOFING. I KNOW AT THE LAST MEETING WE TALKED ABOUT, WE HAD A CONTRACT WITH CHUCK GRIFFIN AND I DID FINALLY GET IN TOUCH WITH HIM. I THINK COMMISSIONER CHESNEY GOT IN TOUCH WITH HIM AS WELL. HE HAS BEEN VERY BUSY, HE OFFERED TO LOOK AT OUR ROOF REPAIR PROJECT FOR FREE TO GLANCE AT IT BECAUSE HE HAS NOT HAD TIME BUT IN LIGHT OF THE LAST MEETING, WE WERE PRESENTED WITH RICHTER AND I BELIEVE WE ALREADY HAVE THOSE PLANS AND ESTIMATED AMOUNTS. SO, WE NEED TO CANCEL THE CONTRACT WITH TEXAS DAY ROOFING AND I WILL MAKE THAT MOTION TO CANCEL THE CONTRACT FOR 25,000. WE HAVE AMOTION AND A SECOND. >> QUICK DISCUSSION I WANTED TO MENTION TO THE COURT THAT THEY DID SEND I AND YOU A TEXT SAYING HE DID REVIEW THE PLANS AND EXPECTS FOR THE COURTHOUSE THE PLANNED SYSTEMS AND SPECIFICATIONS WHAT I RECOMMEND THEY ARE SUITABLE FOR THE COURTHOUSE AND SHOULD BE ABLE TO GO OUT. HE DID VERIFY THAT.
[00:55:02]
>> YES WE JUST GOT THOSE TO HIM THIS MORNING. SO HE HAS REALLY BENT OVER BACKWARDS. HE HAD A LOT OF THINGS GOING ON IN HIS COMPANY AND HE APOLOGIZED AT THE MISCOMMUNICATION, HE WAS NOT AWARE OF THE ORIGINAL CONTRACT DATE SO IN NO WAY SHAPE OR FORM IS IT AGAINST HIM AT ALL HE HAS BENT OVER BACKWARDS SINCE HE FOUND OUT TO HELP US AND HE DID THIS FOR FREE. THAT'S THE REASON WE'RE CANCELING THIS CONTRACT. WE HAVE A MOTION AND SECOND. ALL THOSE IN FAVOR SAY AYE. ANY OPPOSED? MOTION PASSES. DISCUSS, NUMBER FOUR. DISCUSS
[4. Discuss and consider the Nueces County Courthouse and Jail roof project including the sewage piping project, and other related matters.]
AND CONSIDER THE NUECES COUNTY COURTHOUSE AND JILL ROOF PROJECT. INCLUDING THE SEWAGE , PLUMBING PIPING PROJECT AND OTHER RELATED MATTERS. I KNOW HERE TO TALK ABOUT THIS AND I KNOW THE FUNDING SOURCE. I THINK TERESA AND COMMISSIONER GONZALEZ AND WE HAVE WORKED EXTENSIVELY TO TRY TO COME UP WITH FUNDING FOR THE ROOF. DO YOU WANT TO TALK FIRST ABOUT THIS OR IS IT SIMPLY ABOUT FUNDING SINCE WE HAD ALREADYGONE FORWARD? >> IT HAS ALREADY BEEN TALKED
ABOUT AND ALL THAT. >> SO THEN DO YOU WANT TO PRESENT THE FUNDING THAT WE HAVE COME UP WITH?
>> THE TOTAL COST, I WILL START AS YOU GETTING READY THE TOTAL COST FOR THE COURTHOUSE ROOF AND THE JILL ROOF, THE ESTIMATE WAS $7,876,561. THE ARPA MONEY WE HAD BUDGETED IS 4,000,297 , THE FORAGE IS 3,000,479 AND WE HAVE WORKED OUT A PLAN THAT I WILL NOW LET TERESA TAKE OVER. EDWARDS HAS BEEN NOTIFIED PEOPLE HAVE BEEN NOTIFIED ABOUT THIS SO IT'S
NOT A SHOCKER TO ANYBODY. >> YOU CAN SIT DOWN IF YOU NEED YOU WE WILL PULL YOU UP FOR A QUESTION .
>> THE SHORTAGE IS 3.5 FOR THE COURTHOUSE JAIL . AND THE RECOMMENDATION IS TO REALLOCATE $2.7 MILLION FROM THE ARPA PARK UPGRADE FUND OF $6 MILLION. FOR THAT TO HELP WITH SOME OF THAT SHORTAGE. IT WON'T BE THE COMPLETE AMOUNT IT WILL BE SHORT 879,000 305. IT WOULD ALLOW US TO REALLOCATE SOME CO FUNDS BACK TO THE PARKS DEPARTMENT IN ORDER TO GIVE THEM SOME OF THE MONEY BACK. SO THE NET REDUCTION
WOULD BE $700,000. >> THE CEOS WOULD BE FROM 1901 GENERAL CAPITAL PROJECT , THE 2015 CO 2016, 2017.
>> THOSE ARE JUST UNUSED? >> THE MAJORITY LIKE 800,000 IS THE COUNTY JUDGE FUND, MAYBE 400,000 IS COMMISSIONER PRECINCT 2 AND THE OTHERS ARE BALANCES AVAILABLE FOR COMPLETED PROJECTS FROM UNALLOCATED BALANCES.
>> THAT IS ON THE CEOS? >> THAT'S CORRECT. YOU HAVE A HANDOUT. THESE PARTICULAR CEOS ALLOW FOR PARK UPGRADES
FOR USE. >> TO VERIFY BEFORE THEY ARE ALL CLEARED FOR PARK UPGRADES TO BE USED. THIS WOULD KEEP ALL THE ROOF PROJECT MONEY, EXCEPT FOR THE 800 WE ARE STILL LOOKING FOR THAT AMOUNT IN ARPA FUNDING FOR THE PROJECT IS USED FOR ONE FUND AND THIS COULD BE REALLOCATED GIVING EDWARD MORE TIME ON HIS PARK PROJECTS.
>> SORRY WAS THIS JUST HANDED TO US TODAY?
>> YES, I TRIED TO TALK ABOUT IT BUT I PUT IT THERE THIS
MORNING. >> I'M SORRY? SO THIS WASN'T
IN THE PACKET? >> WE WERE TRYING TO FIND THE
FUNDS. >> SO CAN HAVE A MINUTE TO LOOK AT ALL OF THIS? AND MAYBE COME BACK SINCE THIS WAS NOT IN THE PACKET IS THAT OKAY? SOUNDS REASONABLE.
[01:00:06]
>> SO, EACH PRECINCT PROVIDING FUNDING FOR THE
JUDGE? >> EXCEPT FOR THE COUNTYWIDE PROJECTS OUT OF THESE CEOS , IT IS MINE AND COMMISSIONER GONZALEZ BECAUSE WE WERE WORKING ON IT, WE WOULD NOT TAKE ANY OF YOUR FUNDS UNLESS IT WAS APPROVED BY YOU. THERE
IS AN AMOUNT. THE AMOUNT . >> THERE ARE THREE OF US.
>> THREE OF US ARE ON HERE. >> WE HAVE ALL SPOKEN WITH YOU. GIVEN YOU THE OKAY. SO YES.
>> WE WANT TO BE THOROUGH AND LOOK AT THE NUMBERS. WE HAVE ALL GIVEN THE OKAY ON OUR PART. TRYING TO HELP MOVE IT ALONG.
SPOKEN DIRECTLY WITH TERESA AND IT SEEMS LIKE WE ARE IN
AGREEMENT. >> THIS IS IMPORTANT AND WE NEED TO COME UP WITH THE FUNDING. ARE THERE AVAILABLE
FUNDS FROM THE OTHER TWO? >> THIS IS KIND OF, I DON'T EVEN, I DON'T KNOW. ANYWAY, IF YOU WANT TO ALLOCATE YOUR OWN THAT'S GREAT BUT I'VE NOT SEEN THIS EXCEPT FOR FIVE MINUTES AGO. I DON'T HAVE A CLUE WHAT YOU'RE ASKING FOR.
>> WE WILL STILL BE SHORT. >> IT IS LIKE A SWAN, THE ARPA FUNDS FOR THE PARKS PROJECTS OF $6 MILLION SO WE WANT TO REALLOCATE ARPA DOLLARS TO THE ROOF PROJECT TO KEEP IT ALL IN ARPA. AND THEN, REPLENISH THE PARKS DEPARTMENT BACK TO
MILLION DOLLARS. >> UNDERSTAND THE CONCEPT BUT I JUST GOT THE INFORMATION. IF YOU'RE ASKING ME TO LOOK AT
MINE I HAVE NO CLUE. >> THAT'S OKAY.
>> YOU WORKED WITH TERESA. >> WHAT IS THAT MEAN? IT IS SUPPOSED TO BE IN THE PACKET.
>> IF YOU NEED TIME TO LOOK AT IT WE CAN BRING IT BACK SINCE EVERYBODY HAS IT AND COME UP WITH FUNDING. THIS IS THE PLAN ON THE SONOS COMES UP WITH A BETTER PLAN. WE ARE SHORT, BASICALLY WHAT IT IS TELLING US WITH NO ACTION TAKEN TODAY, COMMISSIONER GONZALEZ PUT IT ON AS WE NEED 7,000,876 PUT IT ON AS WE NEED 7,876,000 FOR THE ROOF PROJECT FOR THE COURTHOUSE AND THE JAIL. WE HAVE 4,297,000 ALLOCATED . SO SOMEWHERE AND I SAY I WOULD MAKE THE MOTION TO MOVE THIS TO THE NEXT MEETING, FEBRUARY 7TH TO GIVE EACH COMMISSIONER TIME TO LOOK THIS OVER AND APPROVE, DEFINITELY THINK YOU DON'T VOTE ON THIS WITHOUT HAVING TIME TO LOOK AT IT AND GO OVER IT. I WILL MAKE THE MOTION TO BRING IT BACK TO FEBRUARY 7TH MEETING AND IN THE MEANTIME HOPEFULLY EVERYONE ELSE LOVE A CHANCE TO LOOK AT IT AND SEE. I WILL TELL YOU , THANK YOU COMMISSIONER HERNANDEZ. WE HAVE SPOKEN WITH EDWARD, BUT FOR US LOOKING FOR THE FUNDS IT FELT LIKE THE PARKS WAS THE BEST PLACE THAT AFFECTED THE WHOLE COUNTY TO PULL MONEY FROM IF WE WERE TO DO THAT. ALSO TOLD THEM WE WOULD TRY VERY HARD TO PUT THE CEOS AS MUCH AS WE COULD BACK INTO HIS PARKS FUNDS SO HE COULD DO THINGS WITH THE PARKS.
>> THAT THE CO TIE INTO THE RESTRICTIONS THAT ARPA IS TIED
ON? YOU CAN WORK AS AGO. >> QUITE POSSIBLY. IT MIGHT BE THE WILL OF THE COURT TO PULL MORE MONEY TO MAKE UP THE
BALANCE. >> I AM FINE IF YOU GIVE ME SOME TIME TO LOOK AT IT. I JUST NEED SOME TIME TODAY TO LOOK AT IT, THAT'S ALL I'M ASKING.
>> WE CAN BRING IT BACK LATER. I UNDERSTAND, THIS IS NOT SOMETHING TO BE THROWN AND SAY, I THINK SHE TRIED TO DISCUSS
WITH EACH ONE OF US. >> SHE MAY HAVE COME BY THIS
MORNING. >> I DID LAST NIGHT COMMISSIONER. I PUT THE DOCUMENT TOGETHER. I WENT BY
THIS MORNING. >> NOBODY MENTIONED ANYBODY NEEDED TO TALK TO ME AND IT WASN'T IN THE PACKET SO I DO NOT SEE IT. I JUST NEED SOME TIME TO LOOK AT IT.
>> I WILL WAIT TO TABLE IT UNTIL AFTER. WE CAN BRING IT
[5. Discuss and consider award and execution of an Agreement for $1,173,490 with GrantWorks for Grant Management Services for Disaster Recovery including American Rescue Plan Act grants; and approve Task Authorization No. 1; and other related matters.]
>> MOVING ON ITEM NUMBER FIVE DISCUSS AND CONSIDER AWARD
AND EXECUTION OF AGREEMENT . >> SHE WITHDREW THE MOTION.
[01:05:01]
>> I WILL BRING IT BACK, I WITHDREW AND I WILL BRING IT BACK IF WE NEED TO TABLE OR IF WE CAN MOVE FORWARD. SORRY. I WAS NOT CLEAR. ITEM NUMBER FIVE DISCUSS AND CONSIDER AWARD AND EXECUTION OF AGREEMENT FOR 1.173490 WITH GRANT WORKS FOR GRANT MANAGEMENT SERVICES AND DISASTER RECOVERY . THIS AMOUNT WAS HIRING COMMISSIONER GONZALEZ DID NEGOTIATE WITH THEM TO GET IT DOWN. WE ARE APPRECIATIVE OF THAT AND COMMISSIONER GONZALEZ, THIS IS YOUR ITEM. IT IS USING A PERCENTAGE FOR EACH OF THE PROJECTS THAT THEY WILL BE MANAGING. I THINK WE ALL RECEIVED THAT AT THE LAST MEETING. UNDER ARPA BALANCES.
>> I THINK IT WAS 2.9%. >> IT WAS 2.9% AND THEN IT DROPPED DOWN. DO YOU WANT TO COME TALK ABOUT THIS?
>> 1.17. >> GOOD MORNING EVERYBODY.
THANK YOU SO MUCH FOR ALLOWING ME TO BE HERE. GOOD MORNING.
SO I HAVE KENT ON THE CALL SO HE HAS REALLY BEEN A CRITICAL PERSON TO PUTTING THIS TOGETHER AND WORKING WITH US.
YOU ARE ON THE PHONE AS WELL. FEEL FREE TO CHIME IN. WE STARTED WITH THE ORIGINAL OF 2.9, WHAT WAS THE OFFICIAL PERCENTAGE? WE ARE AT 1,000,173, BUT WHAT WAS THE
PERCENTAGE CHANGE? >> THE PERCENTAGE OF THE NEW VALUE IS 2.676 % OF THE TOTAL FUNDING.
>> THANK YOU, KENT. >> DIDN'T WE HAVE THE ARPA MONEY SET ASIDE ? I GUESS THIS HAS A LIST OF WHAT EACH COMMISSIONER PER YOUR PROJECT YOU WOULD BE ALLOCATING TOWARD THE GRANT WORKS AND THAT WAS AFTER OUR DISCUSSION WITH ANY PROJECTS THAT HAD STARTED OR WERE NEAR COMPLETION, THOSE WERE EXCLUDED, ANY PROJECTS THAT HAD NOT STARTED AND THAT WOULD REQUIRE EXTENSIVE WORK, THEY WOULD NOT NEED TO REAPPLY. THEY WERE APPROVED AND GOING FORWARD, BUT THIS WAS THE PERCENTAGE FROM EACH PRECINCT ON THE PROJECTS ,
WHAT THE AMOUNT WOULD BE. >> DID THIS INCORPORATE , YOU AND I DISCUSSED ON THE FUNDING DID THIS INCORPORATE SOME OF THE STUFF WE TALKED ABOUT FOR WHERE TO REDUCE? I MADE
SUGGESTIONS ON THIS ONE. >> IT IS THE SECOND PAGE WHICH SHOWS THE BREAKDOWN FOR FUNDING. ON THE AGENDA ITEM.
ALLOCATION, THIS WAS SOME STUFF WE DISCUSSED. WHEN WE WERE ASKED ABOUT WHAT MIGHT HELP BECAUSE THERE WAS A SHORTAGE ON THIS AS WELL. TO DO IT AND I THINK IT IS AN UP TO AMOUNT ON THE CONTRACT. SO IT IS A MATTER OF, IN OTHER WORDS, IT IS NOT, IT IS UP TO AND WE HAVE TO HAVE FUNDING FOR THE UP TO. I AM STILL HOPING GRANTS IS THE LEAD ON THIS AND GRANT WORKS IS THE AID BECAUSE WE HAVE A GRANTS DEPARTMENT FOR A REASON AND I KNOW THEY NEED HELP, BUT TO ME THE GRANTS DEPARTMENT IS THE LEAD AND GRANT WORKS IS ASSISTING.
>> THE REVISION IS A FIXED COST. THIS IS FIXED FOR ALL THE PROJECTS THAT THEY WILL DO. THAT'S THE TOTAL, 1.173.
490. THEY TOOK THE TOTAL AMOUNT OF ALL THE GRANT FUNDING THAT THEY WOULD MANAGE AND THEY DIVIDED THAT OUT BY EACH COMMISSIONER TO GET A PERCENTAGE THAT WOULD COME FROM EACH COMMISSIONER'S , EACH COURT MEMBER'S FUND. SO, THAT BREAKOUT PRECINCT WITH A COUNTY JUDGE 102 372, PRECINCT 1 IS 99,830, PRECINCT 2 93406 , PRECINCT 3 93421 AND COMMISSIONER CHESNEY 82,463.
>> OKAY. NOW IT HAS GONE TO FIXED.
[01:10:01]
>> THAT'S THE DIFFERENCE. >> COME UP WITH A DIFFERENCE ON THE BOTTOM INSTEAD OF USING OPTION ONE AND THEN OPTION TWO ARE THE AVAILABLE BALANCES PUT TOWARD TO MAKE UP THE
1,100,000. >> OKAY 102 UP HERE AND TELL
ME . >> 700,998 + THE 4072 AT THE TOP WHICH WOULD MAKE UP THE TOTAL.
>> COUNTYWIDE PROJECTS. >> WHEN YOU SEE OPTION ONE AND TWO, OPTION ONE IS NOT IN ANYMORE. WE WERE PLANNING TO USE IT WITH THE ROOF PROJECT. OPTION 2 WE HAD THE GRANT MANAGER POSITION, THE JOHNSON AND WOODS WITH THE BALANCE REMAINING AND THE HAGGERTY BALANCE.
>> THAT ADDS UP TO 700,000. >> SO WE WOULD HAVE TO UN-ALLOCATE THESE MONIES FROM ARPA AND REALLOCATE TO THE
GRANT WORKS. >> WHAT YOU DID WAS HE TOOK MY REDUCED PART AND SWITCHED IT SOMEWHERE ELSE CARE -- OKAY GOTCHA. OTHER PEOPLE WERE WORKING ON THIS BESIDES HIM.
>> YES, YOU DID. OKAY. THIS IS YOUR ITEM, I APPRECIATE YOU WORKING ON IT. OKAY THAT MAKES SENSE, THAT'S WHAT I WAS TRYING TO FIGURE OUT. THIS IS WHAT WE TALKED ABOUT COMING UP
WITH IT. >> HERE IS OPTION ONE.
WHEREVER IT GOES IT WORKS THE BEST.
>> HOPEFULLY WE CAN GIVE IT BACK TO PARKS.
>> OKAY GOTCHA. >> THIS ONE DOES NOT HAVE ANYTHING. PARKS HAS TAKEN A HIT.
>> OKAY SO TELL ME WHAT ROLE GRANTS PLAYS WITH THIS BECAUSE THIS IS A LOT OF MONEY. THIS IS A LOT OF MONEY WE ARE SPENDING AND IT NEEDS TO BE EXPLAINED. THIS IS ARPA MORNING , IT IS ALL TAXPAYER MONEY, BUT GRANT MONEY WE GOT FOR THE AMERICAN RELIEF PROTECTION ACT, COMING OUT OF THE GENERAL FUND, NOT THE TAXPAYER POCKETBOOKS. THIS IS WHAT WE ARE DECIDING TO USE THE FUNDING FOR TO MAKE SURE SOMEDAY IT IS NOT COME BACK TO BITE US AND THEN COME OUT OF TAXPAYER FUNDING SO THIS IS A BIT OF AN INSURANCE POLICY. I WANT TO MAKE SURE , I AM STILL INTERESTED IN MAKING SURE GRANTS IS SUPER INVOLVED AND UNDERSTANDS THIS , NOT THAT WE DON'T WANT TO NOT HIRE GRAND WORKS, BUT WE HAVE A GRANTS DEPARTMENT FOR A REASON.
AND SO IF SOMEONE CAN EXPLAIN THAT I WOULD APPRECIATE IT.
>> THE ROLE AS FAR AS THE GRANT, HOW WE WILL WORK WITH GRANTS DEPARTMENT AS I THINK THE CONVERSATIONS HOW WE HAVE ARRIVED AT THIS POINT IS AGREEING TO REITERATE WHAT THE JUDGE HAS MENTIONED, WE ARE ONLY MANAGING CERTAIN PROJECTS THAT HAVE BEEN ALLOCATED AND THEN SOME OF THE UNALLOCATED AMOUNTS. GRANTS DEPARTMENT WILL CONTINUE TO MANAGE WHAT THEY HAVE STARTED. WE WILL WORK TOGETHER BECAUSE IT ALL HAS TO BE REPORTED TO THE TREASURY SO WE WILL CONTINUE TO CORNER. THE MAIN POINT OF CONTACT WILL BE ON A BECAUSE ON A ULTIMATELY THAT DEPARTMENT WILL BE RESPONSIBLE FOR OVERSIGHT OF HOW THESE FUNDS ARE MANAGED ON THE COUNTY SITE. AND THEN AGAIN, KENT IS ON THE PHONE SO HE CAN GIVE GREATER DETAIL ON WHAT THE ROLE WOULD BE FOR MANAGEMENT.
TO GO TO A SUMMARIZED VERSION OF IT IS WE WILL TALK ABOUT SITTING DOWN AND ASSISTING WITH DEVELOPING PROJECTS, SITTING DOWN WITH ENGINEERS, TALKING ABOUT HOW THIS WILL BE BUILT OUT TO GET PROJECTS THAT HAVE BEEN SELECTED GOING. AND THOSE FUNDS THAT HAVE NOT BEEN ALLOCATED, ASSISTING YOU IN SELECTING PROJECTS WHERE YOU CAN APPLY THOSE FUNDS TO.
DEVELOPING THOSE. AND THEN IT IS OVERSIGHT SO IT'S MANAGING, NOT JUST THE REPORTING ASPECT. IT IS MAKING SURE THAT WE ARE FOLLOWING THE IMPLEMENTATION ON HOW TO ACTUALLY MAKE THAT
PROJECT COME TO LIFE. >> THAT'S A GREAT EXPLANATION.
THE REASON WE HIT ON THIS AND I'M NOT MENTIONING NAMES BUT WE HAVE A SENSITIVITY TO A PRIOR CONSULTANT THAT WAS HIRED. MANY OF US DO NOT FEEL LIKE WE GOT OUR MONEY'S WORTH.
I WANT TO SAY I DON'T FEEL LIKE WE DID WHICH MEANS I DON'T FEEL LIKE TAXPAYERS OF NUECES COUNTY DID. I AM SUPERSENSITIVE MAKING SURE WE DO THIS RIGHT. I HAVE A GREAT DEAL OF CONFIDENCE IN YOU AND YOUR COMPANY AND WE HAVE DONE SO FAR, BUT UNDERSTAND WE ARE PAYING A LOT OF MONEY TO MAKE
[01:15:01]
SURE YOU HAVE US COVERED. I DON'T KNOW HOW ELSE TO SAY THAT. GETTING THIS DONE THESE PROJECTS HAVE GOT TO GET DONE.WE HAVE TO SPEND THIS, ALLOCATED BY 24, SPENT BY 26.
NOTHING YOU WILL WORK ON CAN COME BACK AND HAUNT US. SO THAT'S MY SENSITIVITY ON THIS AND I'M GLAD WE GET THIS WORKED OUT. I SUPPORT THIS, THANK YOU VERY MUCH.
>> UNALLOCATED AND ALLOCATING FUNDS , DIRECTING THEM TO GRAND
WORKS. >> IS . -- YES, WE NEED TO ALLOCATE THE BOTTOM LIST.
OPTION TWO AVAILABLE BALANCE LISTED ON THERE .
>> TO UNALLOCATED THE FOLLOWING.
>> NONPROFIT RETURN FUNDS , ARPA GRANT MANAGER POSITION, SEPTIC SYSTEM ASSESSMENT, CONSULTANT WITH THE REMAINING FUNDS TO BE REALLOCATED TO THE GRANT WORKS.
>> SECOND. >> WE HAVE A MOTION AND SECOND TO UNALLOCATED THE FUNDS ALL OF THOSE IN FAVOR SAY AYE.
>> TO REALLOCATE DO IT IN THE SAME THING AND TO REALLOCATE THEM TO THE GRANT WORKS CARJACKED FOR THE COUNTYWIDE PROJECTS. WE HAVE A MOTION AND SECOND ALL THOSE IN FAVOR SAY AYE ANY OPPOSED? THE MOTION PASSES. THANK YOU VERY MUCH.
ASSUMING EVERYBODY HAS AGREED THAT THE INDIVIDUAL COURT PROJECTS FROM COUNTY JUDGE COMMISSIONERS PRECINCT 1, TWO, THREE AND FOUR WOULD BE REALLOCATED OR ALLOCATED TO
THE GRANT WORKS. >> THESE ARE BALANCES SO THEY
WOULD BE ALLOCATED. >> AS LISTED FOR COUNTY JUDGE PRECINCT 1, TWO, THREE AND FOUR ALLOCATED TO THE GRANT WORKS
CONTRACT. >> YES I WILL SECOND.
>> YES, WE HAVE A MOTION AND A SECOND. ALL THOSE IN FAVOR SAY AYE. ANY OPPOSED? THE MOTION PASSES, THANK YOU VERY MUCH.
ONE MORE THING. I THINK MICHAEL NEEDS TO CLARIFY
SOMETHING. >> OFFICIALLY MAKE MOTION TO WARD AND EXECUTE AGREEMENT WITH GRANT WORKS FOR GRANT MANAGEMENT FOR DISASTER RECOVERY INCLUDING AMERICAN RESCUE PLAN ACT GRANTS UNDER RFP 3525-23.
>> SO MOVED. >> A MOTION AND SECOND. ALL THOSE IN FAVOR? ANY OPPOSED? THE MOTION PASSES.
>> THANK YOU ALL SO MUCH. LOOKING FORWARD TO THIS.
[8. Discuss and restate the policy that every department in Nueces County is open to the public 5-days a week from 8:00 a.m. to 5:00 p.m., Monday through Friday, excluding approved County holidays and related matters. ]
DISCUSS AND RESTATE POLICY EVERY DEPARTMENT IN NUECES COUNTY IS OPEN TO THE PUBLIC FIVE DAYS A WEEK AT:00 UNTIL 5:00. THIS CAME UP BECAUSE OF WORK DAY. WE HAVE A COUPLE OF DEPARTMENTS THAT HAVE BEEN WORKING FOUR THAT HAVE BEEN WORKING 410S AND WE DO NOT HAVE THAT IMPLEMENTATION IN WORKDAY AND IT WILL COST THE COUNTY MONEY TO SET IT BECAUSE WHEN YOU TAKE A DAY OFF IT IS ONLY SET TO GIVE YOU EIGHT HOURS INSTEAD OF 10. I WAS NOT AWARE ANY DEPARTMENTS WERE DOING THAT UNTIL THIS WAS BROUGHT TO MY ATTENTION SO WE THOUGHT WE SHOULD BRING IT TO THE COURT FOR DISCUSSION.>> YES WHEN WE INITIATED THE WORKDAY PROCESS TO STAFF IT REQUIRED US TO PUT OUR PERSONNEL POLICY WITHIN WORKDAY SO IT WOULD BE ABLE TO GENERATE SOME ITEMS OF THE CURRENT POLICY. ONLY ALLOWING EIGHT HOURS , A .6 FOR LAW ENFORCEMENT FOR SICK LEAVE AND VACATION LEAVE SO THAT IS WHY RIGHT NOW THE RESTRICTIONS IN WORKDAY ARE FROM CURRENT PERSONAL POLICY AND THAT'S WHEN WE FOUND OUT SOME WERE ONLY WORKING FOUR DAYS AND 10 HOURS A DAY AND SOME OF THEM ARE UNDERSTANDABLE BUT THEY WOULD NOT BRING THAT TO THE ATTENTION TO CHANGE THAT AND AS YOU WOULD AGREE TO CHANGE THE PERSONAL POLICY WOULD NEED TO BE CHANGED.
>> THIS HAS NOTHING TO DO WITH LAW ENFORCEMENT, THEY ARE 24/7.
I HEARD YOU SAY SOMETHING ABOUT LAW ENFORCEMENT. THIS IS
[01:20:01]
EXCLUDING LAW ENFORCEMENT, THIS IS ANY COUNTY EMPLOYEES THAT WORK FROM THE COUNTY, PERIOD. AND I KNOW JUAN IS HERE WITH HIS EMPLOYEES USING THIS AND I KNOW THE PROBATION DEPARTMENT CAME AND ASKED CAME AND BROUGHT IT FORWARD AND THEY HAVE POSSIBLY USED IT IN THE PAST WHAT IS THE COST TO THE COUNTY IF WE IMPLEMENT THIS?>> RIGHT NOW WE WOULD WORK WITH WORKDAY AND MY STAFF ON IMPLEMENTING THE NEW POLICY THAT WOULD HAVE NOT A SIGNIFICANT INCREASE ON COST. A SMALL AMOUNT TO MAKE SURE YOU HAVE INFORMATION MAKING SURE IT'S CORRECT. I WOULD NOT EXPECT IT TO BE A LARGE AMOUNT AND IT'S IN THE CURRENT PROCESS TO COVER THIS SO I DON'T BELIEVE THERE WOULD BE
ADDITIONAL COST. >> I WAS NOT IMPLYING WE ALL AGREED TO DO THAT I THINK THAT IS A COURT DECISION AND OPENS UP A CAN OF WORMS. I WAS NOT AWARE ANY DEPARTMENTS WERE DOING THIS. WHAT WAS ALARMING TO ME AND THEN IF IT GETS OUT HOW MANY OTHERS WOULD LIKE A THREE-DAY WEEKEND. AND THE NEW TIMEKEEPING SYSTEM GETS POLICY AND PROCEDURES IT DOES NOT ALLOW UNLESS THE COURT DECIDES TO CHANGE.
>> I DON'T KNOW OTHER DEPARTMENT HEADS THAT WILL SHARE THEIR THOUGHTS BECAUSE I GUESS I HAVE BEEN AWARE OF PUBLIC WORKS BUT IT'S A MATTER OF LIFE WHEN I GOT HERE THAT THE SCHEDULE IS HOW IT WORKS AND THEY ARE MORE UNIQUE THAN SOME OTHER DEPARTMENT BUT IN GENERAL I AM OPEN TO THE DEPARTMENT HEAD BEING FLEXIBLE. ONE THING I'VE LEARNED WE CANNOT NECESSARILY GET BONUSES AT THE END OF THE YEAR, ALL WE DO IS GET PAY AND IF YOU CAN GIVE TIME THAN THAT SO PRECIOUS. PEOPLE WILL TAKE TIME BEING ABLE TO BE MORE FLEXIBLE PUTTING HOURS IN YOU DON'T MISS OUT, YOU'RE COVERED
MONDAY THROUGH FRIDAY? >> YES THAT IS CORRECT.
SERVICES COVER MONDAY THROUGH FRIDAY.
>> TELL US HOW THIS WORKS FOR YOU.
>> WE HAVE THREE, WE HAVE THE -- THE TWO YARDS MONDAY THROUGH FRIDAY IS
MONDAY THROUGH THURSDAY. >> WHAT ARE THE HOURS?
>> THEY COME TO WORK AT 7:00 A.M. AND LEAVE AT 5:30. THEY TAKE HALF AN HOUR LUNCH. SO, THEY GET 10 HOURS PER DAY FROM MONDAY TO THURSDAY AND THEN WE WENT TO THE CREW THAT COMES IN I SEE THE CREW BUT OTHER STAFF TUESDAY THROUGH FRIDAY WHICH COVERS THE SERVICES ALL THE WAY FROM MONDAY THROUGH FRIDAY
WITH FURTHER WORK WE DO. >> SO THE MONDAY AND YOUR
OTHER CREW? >> THE CREW THAT COMES IN MONDAY THROUGH FRIDAY , THEIR OUTWORKING. SORRY MONDAY THROUGH THURSDAY. THEY DO MOVE THROUGH MOST OF THE ROADS IN RECONSTRUCTION OF ROADS IN DRAINAGE AND THEY DO ALL THAT TYPE OF WORK. CREWS THAT COME IN ON TUESDAY THROUGH FRIDAY , THE MORNING CREW AND THEY DO DRIVEWAYS AND THEY CAN ALSO DO
THE ROADS. >> THEY CAN DO MONDAY THROUGH FRIDAY OR THIS IS BECAUSE OF THE PAY SCALE LIKE THE COMMISSIONER WAS SAYING THAT WE OFFERED TO EMPLOYEES?
>> I HAVE BEEN HERE GOING ON SIX YEARS. THIS IS A WAY THAT WE HAVE HAD CREWS WORKING, I KNOW IF JERRY WERE HERE HE WOULD SAY IN HIS 42 YEARS OF WORKING WITH THE COUNTY THEY HAVE BEEN DOING IT. IT IS NOTHING THAT HAS BEEN CHANGED OR NOTHING THAT SOMEBODY ISSUES.
>> ALL THE STAFF IN THOSE YARDS MONDAY TO FRIDAY?
>> YES MA'AM. AND WE ALSO HAVE OUR CLERKS WORKING MONDAY TO FRIDAY 8:00 UNTIL 5:00. ANYBODY CALLS THEIR SUMMARY THE ANSWERS THE PHONE IN THE YARD, SO BECAUSE FOUR SOMEBODY ANSWERS THE PHONE AT THAT YARD. AND AT THE CENTRAL YARD, WE CALL THEM MECHANIC'S SHOPS AND SOME COME IN MONDAY
TUESDAY THROUGH FRIDAY. >> I DO YOU DECIDE?
>> WE HAVE NOT HAD ISSUES REGARDING WHO COMES IN. AS A MATTER OF FACT WE HAVE NOT HAD ANY COMPLAINTS FROM ANYBODY REGARDING THE SCHEDULE. I THINK THE LONG HOURS HELPS US BY BEING AT A JOB SITE, YOU DON'T HAVE TO REALLOCATE OR MOVE HEAVY EQUIPMENT. AND THEN COME BACK ON FRIDAY AND MOVE
[01:25:04]
THE SAME EQUIPMENT WITH THE SAME 10 , FIVE OR SIX CARS GOING OUT TO THE JOB SITE. THE EXTRA DAY ON FRIDAY. YOU WILL REUSE FUEL AND HEAVY EQUIPMENT TO DRIVE ALL THE WAY OVER AND THAT TAKES TIME. THIS WAY YOU HAVE CREWS COMING IN EARLY.THEY GET TO THE JOB SITE EARLY AND THEY CAN STAY LATE UNTIL 5:30 OR 5:00 AND THEN DEMOBILIZE AND COME BACK TO THE YARD. WE END UP DOING THIS WE ONLY HAVE EIGHT HOURS WHICH CONDENSES THE WORK. I KNOW THIS IS NOT THE RIGHT WAY TO SAY IT, BUT WE WILL BE PROBABLY, NOT GOING TO BE AS EFFICIENT AS WE WERE WHEN WE HAVE LONG HOUR DAYS.
>> YOUR "THE PUBLIC AND:00 TO 5:00.
>> YES OR. >> MY CONCERN WOULD BE WHEN A DEPARTMENT IS NOT OPEN TO THE PUBLIC 8:00 TO 5:00 MONDAY THROUGH FRIDAY BECAUSE WE SERVE THE TAXPAYERS WE ARE NOT A PRIVATE BUSINESS, WE SHOULDN'T BE MAKING A DECISION TO HAVE LESS ACCESS TO THE PUBLIC, THAT'S NOT SOMETHING THAT I THINK WOULD BE GOOD. I DON'T KNOW YOU WOULD BE IN THE AREA THAT WOULD BE CONCERNING BECAUSE YOU ARE DOING WORK. I WOULD BE MORE CONCERNED ABOUT A DEPARTMENT NOT OPEN TO THE PUBLIC MONDAY TO FRIDAY. AND I DID NOT KNOW I CAN'T SAY THAT I KNEW ALL OF THAT. I THINK YOU HAVE ALWAYS BEEN EFFICIENT SO I HAVE ACKNOWLEDGED THAT AND THAT'S GOOD BECAUSE I HAVE, I CAN CALL YOU ALL THE TIME, THE PUBLIC CAN CALL ALL THE TIME AND THAT'S THE CASE BUT WHAT ABOUT THE DEPARTMENTS , ARE THEY CLOSED? I DID NOT KNOW WE
HAD ONE? >> THEY ALTERNATE. HERE, HIS HAD A POLICY OF FOUR 410S AS WELL.
>> I WOULD LIKE TO ADD WITH COMMUNITY SUPERVISION AND JUVENILE JUSTICE THEY HAVE STAFF WORKING THAT SCHEDULE. I AGREE WITH YOU COMMISSIONER CHESNEY WE ARE TO BE OPEN TO THE PUBLIC MONDAY THROUGH FRIDAY 8:00 UNTIL 5:00 AND THAT IS ON THE WEBSITE BUT I ENCOURAGE ANY SCHEDULE THAT IMPROVES OPERATIONS AND MEETS THE NEEDS OF STAFF AND THEY CAN LET YOU KNOW HOW THAT HAPPENS.
YOU ARE FAMILIAR ON THE PROBATION SIDE WHERE THE INSTITUTION SITE. REAL QUICK ON THE INSTITUTIONS. SIMILAR TO THE JAIL ALTHOUGH WE ARE NOT COLLECTIVE-BARGAINING WOMEN WORKING NONTRADITIONAL HOURS FOR YEARS AND THAT'S OUT OF A BUDGET NECESSITY. WE HAVE 12 HOUR SHIFTS AND A SWING SHIFT.
IF WE WENT TO THE THREE TO THE 38 HOUR SHIFTS THAT WOULD BE A LOT MORE EMPLOYEES TO HAVE TO HIRE. THAT IS ON THE FACILITIES OPERATING FOR YEARS THAT WAY. ON THE PROBATION SIDE WHICH WE HAVE ABOUT 75 PEOPLE , FOR THE LAST YEAR WE OFFERED THEM A NONTRADITIONAL 10 HOUR FOUR DAY WORK WEEK. WE OPENED FROM 7:30 UNTIL 6:30 EVERY DAY. SO FIRST OF ALL IT'S VOLUNTARY. HALF THE DEPARTMENT CHOSE THIS AND A LOT OF THEM HAVE SCHEDULES THAT YOU KNOW WHETHER IT'S KIDS OR MAKING APPOINTMENTS, THEY ARE BEING MORE EFFICIENT MAKING DOCTOR APPOINTMENTS ON EITHER FRIDAY OR MONDAY, NOT JUST ALL FRIDAY THAT THEY TAKE OFF. WE MAKE SURE IT IS BALANCED AND WE HAVE TO HAVE PEOPLE ON FRIDAY . OBVIOUSLY A LOT OF PEOPLE WOULD LIKE TO TAKE FRIDAY OFF BUT EVERY UNIT HAS TO BE COVERED SO THEY SPLIT IT UP BETWEEN FRIDAY AND MONDAY OFF. SO IT HAS BEEN WORKING FOR THE LAST YEAR. WE DID SUSPEND THIS FOR THE LAST MONTH WHEN THEY FOUND OUT IT MAY HAVE BEEN A HICCUP WITH WORKDAY OR WHAT HAVE YOU. ON THE PROBATION SIDE WHAT IS TEMPORARILY SUSPENDED UNTIL FURTHER NOTICE FROM THE
COMMISSIONING COURT. >> OR UNTIL WORKDAY CAN IMPLEMENT SOMETHING SO YOU GUYS CAN GET PAID. THAT'S WHAT BROUGHT THIS TO LIGHT. THEY ARE NOT GETTING PAID. IF THEY TAKE
OFF. >> FOR EXAMPLE FOR STAFF KNOW IF ONE OF THE STAFF WORK 410 HOUR SHIFTS IN A TAKE A DAY OFF FOR SICK LEAVE OR VACATION LEAVE, 10 HOURS WORKDAY ONLY PUTS IN EIGHT HOURS SO IT WOULD BE TWO.
>> THAT WOULD HAVE TO BE IMMEDIATELY ADDRESSED.
>> WE DON'T KNOW THE DEPARTMENTS THAT ALLOW THIS TO
BE DONE. >> WE HAVE WORKDAY , ALWAYS SEEMS TO BE A BETTER PROGRAM TO BE MORE EFFICIENT AND ALL THIS AND NOW WE HAVE PROBLEMS OR KINKS SO WE CAN'T DO THIS AND
[01:30:02]
WE CAN'T DO THAT. IF WORKDAY IS AS GOOD AS THEY SAY I THINKWE NEED TO BE FLEXIBLE. >> IT IS FLEXIBLE AND WE CAN DO THIS BUT THE WORKDAY REQUIRES US TO FOLLOW POLICY AND PROCEDURES WHICH SAYS WE HAVE EIGHT HOURS FOR VACATION AND
SICK LEAVE. >> THAT'S WHAT THE POLICY IS
SAYS AND WHAT YOU ARE PROOF. >> I KNOW HAS BEEN DOING THIS FOR 15 OR 20 YEARS AND I KNOW PUBLIC WORKS, WHEN THEY WERE HERE, THEY WERE DOING THE SAME THING. I THINK SOMETIMES WHEN WE ARE OUT WORKING ON THE ROADS, YOU WANT TO FINISH THE ROADS AND COMING IN BEFORE 5:00 TO COME IN AND PUNCH. IT CREATES ANOTHER PROBLEM NOT FINISHING JOBS ARE HAVING TIME TO FINISH THE JOB. WHAT HAPPENS IN EMERGENCY TIMES? HOW DO WE REPORT OVERTIME? WILL WE HAVE PROBLEMS REPORTING OVERTIME?
>> NO TICKING CLOCK IN WHENEVER HAVE. THE ONLY QUESTION WE HAVE IS WHEN THEY TAKE SICK LEAVE OR VACATION.
>> IT CAN BE FIXED. >> THAT'S THE REASON WHY I REMEMBER WE GOT THIS EXPENSIVE SOFTWARE BECAUSE IT WAS GOING TO BE A LOT BETTER, MORE FRIENDLY TO USE AND WE WOULD BE LED TO A LOT OF THINGS WE WERE NOT DOING NOW. I CAN UNDERSTAND ONE SCREWUP BECAUSE THEY ARE OUT THERE AND I THINK WHEN THEY ARE MOWING THE YARDS AND THE HIGHWAYS AND THE ROADS WERE THE COUNTY ROADS BY THE TIME THEY COME BACK THEY ALMOST HAVE TO LEAVE. THEY BELIEVE TWO HOURS EARLY TO GET BACK TO THE SHOP. SO I THINK RIGHT NOW IT'S WORKING, I KNOW IT IS OPEN MONDAY THROUGH FRIDAY 8:00 UNTIL 5:00 AND I CAN WALK IN AT DIFFERENT TIMES AND I KNOW THEY ARE THERE AND OPEN.
>> THAT SEEMS TO BE MORE THE ISSUE THAT ALL COUNTYWIDE OFFICES SHOULD AT LEAST BE OPEN NO MATTER HOW YOU DO IT.
THEY SHOULD NOT BE ALLOWED TO CLOSE. ANY OTHER OFFICES, I KNOW THAT'S WHAT COMMISSIONER CHESNEY WAS ALLUDING TO. WE HAVE HAD SOME OFFICES THAT CLOSED BECAUSE OF SHORTAGES OR SOMETHING , AT LEAST ONE WINDOW IN THE OFFICE OR SOMETHING SHOULD BE LEFT OPEN. I DO UNDERSTAND THEY HAVE WORK THAT NEEDS TO BE DONE TO BE CAUGHT UP. IT SEEMS THAT THE GENERAL OPINION , THAT WE CANNOT CLOSE AND IN SECTION 1, 57.021 , THE HOURS OF WORK OF COUNTY EMPLOYER, EMPLOYEES, YOU MAY LOOK IT UP SUBCHAPTER E IN A CANDY WITH POPULATION OF 250,000 OR MORE COMMISSIONER COURT MAY ADOPT AND ENFORCE UNIFORM RULES ON THE HOURS OF WORK OF THE DEPARTMENT HEAD ASSISTANCE , DEPUTIES AND ANY OTHER EMPLOYEES WHOSE COMPENSATION IS SET OR APPROVED BY THE COURT. ALL OF THE DEPARTMENTS, EMPLOYEES , COMPENSATION IS SET SO I BELIEVE NO MATTER HOW YOU DO IT, THE WILL OF THIS COURT IS WE ARE OPEN TO THE PUBLIC. THE PEOPLE WE REPRESENT. WHETHER IT IS A SKELETON CREW OR WHAT YOU HAVE. HOWEVER YOU MAKE IT WORK. THE OFFICES WILL BE OPEN.
>> GOING OUT AT 4:00 OR 3:00 AND THEY ARE CLOSED AND THEY SHOULDN'T BE CLOSED. SO I DON'T KNOW HOW DO WE GET THE WORD OUT TO EVERYBODY THAT WE ARE CLOSING AT 4:00? WE WILL
CLOSE WHAT DAYS OF THE WEEK. >> IF WE DO THIS OTHER, IS A NEED TO CLOSE SOME WINDOWS TO GET PAPERWORK DONE IN ORDER FOR THEM TO GET OUT THAT IS UNDERSTANDABLE. AT LEAST ONE WINDOW NEEDS TO BE KEPT OPEN FOR PEOPLE THAT POSSIBLY CANNOT COME IN UNTIL FRIDAY OR CAN'T COME IN UNTIL AFTER 4:00. I GUESS I WOULD ACCEPT A MOTION THAT THIS WOULD BE ADDED TO THE NUECES COUNTY POLICY TO CLARIFY.
>> I ALSO WANT TO GET ON BOARD. PUBLIC WORKS HAS ALWAYS WORKED SINCE I HAVE BEEN HERE AND EVEN BACK IN THE 60S , THAT WOULD ALLOW THEM TO WORK OVERTIME OR THEY WOULD GO IN A FEW HOURS PER HOUR EARLY. THE SUMMER WHEN IT WAS REALLY HOT AND THEY WANT TO LET THE EMPLOYEES START WORK EARLY SO THEY CAN GET OFF A LITTLE EARLIER, THAT HAD BEEN ALLOWED.
AND MY HEARING FROM YOU THAT THIS NEW PROGRAM DOESN'T ALLOW
THIS TO HAPPEN? >> IF THE DEPARTMENT WANTS THEM TO COME IN 5:00 AND THEY CAN, THE ONLY QUESTION WE HAVE
[01:35:01]
IS FOR EXAMPLE LET'S PICK ONE STAFF AND SAID THEY WORK FOUR DAYS A WEEK, FOUR WEEK THEY WANT TO TAKE ONE DAY VACATION THEY CAN ONLY TAKE EIGHT. SO THEY HAVE TO WORK FOR TWOHOURS. >> YOU DID NOT KNOW THIS BEFORE
WE HAD WORKDAY. >> BASED ON POLICY AND PROCEDURE IT SAYS WE ONLY GIVE THEM EIGHT HOURS. THE POLICY.
OUR POLICY, PERSONAL POLICY. >> UNDERSTAND THAT.
>> WE ARE ONLY ALLOWED TO GIVE SOMEONE THE POLICY IF THEY WORK
10 HOUR DAYS. >> ALL IT SAYS IF YOU ON VACATION OR SICK LEAVE FOR REGULAR EMPLOYEE EIGHT HOURS FOR LAW ENFORCEMENT 8.6 HOURS. THAT'S THE POLICY APPROVED BY
THE COURT. >> THAT IS CORRECT. WE CAN IN
THE POLICY. >> THAT IS FOR LAW ENFORCEMENT AS WELL AND THAT'S PART OF THE COLLECTIVE BARGAINING DEAL SO WE ONLY BEEN PAYING THEM EIGHT HOUR DAYS WHEN THEY TOOK VACATION? WE'VE BEEN SHORTING THEM TWO HOURS A DAY FOR YEARS? SO WORKING ON THE OLD SYSTEM IT WAS NOT SET UP, THEY
CAN DO WHATEVER THEY WANT. >> NOW IF WE MOVE FORWARD WILL THIS AFFECT COLLECTIVE BARGAINING? BECAUSE THOSE GUYS
WERE 12 HOUR DAYS. >> COLLECTIVE-BARGAINING ADDRESS THAT AND IT SET UP IN WORKDAY FOR THAT PARTICULAR EVENT BECAUSE IT IS A UNION AND THE UNION CONTROLS THAT SO THAT WAS NOT AN ISSUE. THEY CAN PUT IN TIME-BASED FOR CORRECTIONAL
OFFICERS 12 HOURS. >> WE ONLY PAY THEM FOR THE
LEAVE? >> COLLECTIVE-BARGAINING THEY REQUEST WE PAY THEM 12.8, 12.5 HOURS.
>> HOW DID THEY GET PAID THE TWO HOURS THAT THEY WOULD LOSE? I'M TALKING ABOUT THE REGULAR EMPLOYEES?
>> THEY WOULD BE SHORT TWO HOURS AND AS THEY COME WORK TWO HOURS UNLESS WE AMEND THE POLICY.
>> WE CAN TO DO IT TODAY. >> THE POLICY WOULD BE AMENDED FOR THESE PARTICULAR DEPARTMENTS WHERE WE ALLOW THEM TO USE TWO HOUR SHIFTS OR WHATEVER THE CASE.
>> EXCUSE ME, I HAVE KNOWN YOU FOR A LONG TIME AND HAVE ALWAYS TAKEN CARE OF THE TIME FOR PUBLIC WORKS.
>> CAN YOU COME UP TO THE MICROPHONE? SORRY, WE CAN'T ASK YOU SOMETHING WITHOUT EVERYONE ELSE BEING ABLE TO
>> I WANT TO KNOW, TELL US IN ALL OF YOUR YEARS DOING THE TIMEKEEPING FOR PUBLIC WORKS, THEY HAVE ALWAYS WORKED TWO HOURS EXTRA OR HAD THE SHIFT CHANGE?
>> IS NOT EXTRA BECAUSE THEY ARE GETTING 40 HOURS. IT'S NOT TWO HOURS EXTRA, BUT THE PREVIOUS PROGRAM ALLOWED US TO GET 10 HOURS FOR LEAVE BENEFITS. WORKDAY DOES NOT ALLOW THAT. IT ONLY ALLOWS EIGHT. SO WE HAVE TO FIGURE OUT HOW TO GET THE OTHER TWO. THE FIRST PAY PERIOD WE JUST DID, WE WERE OKAY BECAUSE THEY WORKED EIGHT HOURS BECAUSE OF THE HOLIDAY. THIS WEEK OR LAST WEEK AS WELL THIS WEEK AS WELL BECAUSE OF THE HOLIDAY. ON REGULAR WEEKS WHEN THERE ARE NO HOLIDAYS, THE FOUR TENDS COME INTO PLAY. 'S WE FEEL IT IS EASIER FOR THEM , ESPECIALLY WHEN IT'S HOT OUTSIDE TO START EARLY , THEY LEAVE A LITTLE LATER, BUT THEY GET THE 40 HOURS. WE HAD NO IDEA ABOUT THIS POLICY , NOBODY HAD EVER SEEN AND WRITTEN DOWN IT HAD TO BE A CERTAIN WAY UNTIL I TRIED TO PUT IN LEAVE FOR SOMEONE AND WAS NOT ABLE TO.
>> I DID NOT KNOW THIS IS THE WAY WORKDAY WOULD WORK. WE WERE TOLD IT WOULD BE A LOT EASIER FOR EVERYBODY.
>> WELL WHEN THE KINGS GET WORKED OUT AND WE HAVE TO LEARN HOW TO DO IT IT WILL BE FINE, I THINK. RIGHT NOW THIS IS QUITE A ROADBLOCK. AND ASKING THEM TO CHANGE THEIR SCHEDULE UNTIL THE POLICY GETS SET INTO PLACE IF IT DOES, THEN WE WILL HAVE A LOT OF SLOW DOWN OF WORK HAVING TO GO BACK AND FORTH THE YESTERDAY BECAUSE THEY HAVE TO WORK EIGHT HOURS.
>> SO I THINK THE SOLUTION IS WE CHANGE POLICY WORKDAY COULD BE CHANGED, PRETTY SIMPLE. WE NEED TO PUT IT ON THE AGENDA.
POLICY ON THE AGENDA. >> NOT A HARD FIX. PUT IT AS A
AGENDA ITEM. >> THE POLICY ALREADY STATES WE
WORK 8:00 UNTIL 5:00. >> THAT IS NOT ADDRESS THE
[01:40:03]
HOURS. >> WE CAN ADDRESS THAT AS WELL AND BRING IT BACK TO THE COURT ABOUT WHEN WE ADDRESS THE POLICY ALLOWING THIS. THAT ALSO OFFICES ARE OPEN 8:00 UNTIL 5:00 EVEN IF YOU SHUT DOWN A LARGE PORTION YOU WILL HAVE A WINDOW OR AT LEAST SOME OPEN FOR THE PUBLIC TO BE ABLE TO
ACCESS THOSE SERVICES. >> THAT'S ON FOR TODAY WE CAN DO THAT TODAY. I THOUGHT IT WAS ALREADY A POLICY WE WERE OPEN 8:00 UNTIL 5:00 FOR THE PUBLIC. EITHER WAY WE CAN DO THAT
TODAY. >> JUST CHANGE THE OTHER WORKDAY POLICY FOR 10 HOURS NEXT WEEK.
>> UNLESS IT IS A RELATED MATTER.
>> I WOULD THINK IT IS A RELATED MATTER.
>> THEY ARE ALL RELATED. >> CAN WE DO BOTH TODAY SINCE WE HAVE RELATED MATTERS WITH WORKDAY IMPLEMENTATION OF CHANGING FOR THE 10 HOURS AND TO ADD TO THE POLICY ABOUT ALL DEPARTMENTS IN THE COUNTY BEING OPENED?
>> I AM UNABLE TO OPINE ON ALL COUNTY DEPARTMENTS BEING OPEN AS PER COMMISSIONERS COURT ORDER. THAT WAS NOT REQUESTED OF ME PRIOR, I BELIEVE THERE IS SOME RESEARCH I WOULD NEED TO
DO ON THAT BEFORE THAT. >> WHY WOULD YOU NOT , WHY DIRECTOR DO RESEARCH ON WHETHER WE WANT TO TELL EVERYBODY IT IS IN:00 UNTIL 5:00 OPENING?
>> RESPECTFULLY, I AM NOT AT THIS POINT CONVINCED THE COMMISSIONERS COURT HAS THAT AUTHORITY OVER ALL OF THE ELECTED AND HOW THEY HAVE THEIR OFFICES OPEN. I UNDERSTAND THE STATUTE BUT I HAVE TO BE SURE IT IS NOT THE NUMBER OF HOURS OR THE WHEN THE HOURS CAN BE DICTATED.
>> OKAY I THINK WE SEE IT AND IF YOU FIND IT'S WRONG WE WILL BRING IT BACK. PUBLIC INSTITUTION WE NEED TO BE OPEN
8:00 UNTIL 5:00. >> YES BUT IT'S POSSIBLE THAT DOES NOT GO TO INDIVIDUAL WORKER HOURS UNDER ELECTED AUTHORITY. I KNOW THERE ARE DEPARTMENTS APPOINTED OFFICIALS , PROBATION FOR INSTANCE HAS A WHOLE DIFFERENT AUTHORITY WITH ANSWERS AND THERE ARE DEPARTMENTS THAT ANSWER TO THE COMMISSIONERS COURT, BUT ON THE OTHER COLUMN AND I TOOK THIS FROM PREVIOUS BUDGET BOOKS AND MIGHT BE THERE ARE DIFFERENT AUTHORITIES UNDER ELECTED OFFICIALS IF THEY HAVE
A SEPARATE AUTHORITY. >> THEY ALWAYS CHANGE ELECTED
OFFICIALS. >> AS COUNTY EMPLOYEE AT THE PRECINCT THE ROLE WAS WHEN THERE WAS A SKELETON CREW AS LONG AS THERE WAS A SUPERVISOR THAT RAN A DEPARTMENT THERE ALWAYS HAD TO BE A SUPERVISOR AT THE OFFICE. WHEN WE HAD A
SKELETON CREW. >> PUBLIC WORKS IS NOT APPOINTED BY COMMISSIONER COURT.
>> THE DEPARTMENT HEADS ANSWER TO THE COURT.
>> PUBLIC DOES NOT GO TO THE YARDS TO GO SPEAK TO ANYBODY.
THEY COME HERE TO SPEAK TO ONE AND ONE IS ALWAYS IN THE OFFICE AND AVAILABLE. I DON'T SEE ANY PROBLEM IN THAT. WE SHOULD TRY TO WORK WITH THEM AND FIX THIS TIME CONCERNING
THING. >> I AGREE AND WE WANT TO CHANGE WORKDAY, THAT UNANIMOUS. THE OTHER THING I WANT TO POINT OUT BEFORE WE GET TOO FAR DOWN THE RABBIT HOLE IS WE MENTIONED HOLIDAY PAY WHICH IS ONLY EIGHT HOURS FOR ANY EMPLOYEE THAT TAKES A HOLIDAY. I THINK WE LOOPED ALL OF THAT TOGETHER, SICK DAYS AND VACATION DAYS OR WHATEVER THIS DOES AFFECT WITH HOLIDAYS YOU ONLY GET PAID EIGHT HOURS IF WE
GET PAID ON HOLIDAYS. >> THAT'S WHY THEY HAVE ALWAYS WORKED EIGHT HOURS ON HOLIDAY WEEKS. I WOULD LIKE SOME CLARIFICATION. IF WE HAVE TO WAIT FOR YOU GUYS TO DO WHAT YOU DO FOR THIS, DO THEY HAVE TO START WORKING FIVE EIGHTS? MANUALLY CHANGE THAT WHERE THEY CAN GET PAID OR HOLD OFF ON TAKING TIME OFF. WE CANNOT DO ANYTHING ABOUT WORKDAY IF IT
DOES NOT ALLOW US TO ADJUST. >> WE WILL WORK WITH CONSULTANTS ON WORKDAY AND SEE. IF IT IS AGREEMENT OF THE COURT TO GET THE BALANCE WERE 10 HOUR SHIFTS FOR THOSE WORKING
10 HOURS. >> THOSE PEOPLE ANSWER TO US.
SINCE WE HAVE RELATED MATTERS CAN WE DO BOTH? ALL DEPARTMENTS MUST HAVE SOME STAFF HERE FROM 8:00 UNTIL 5:00 AND TO IMPLEMENT THE WORKDAY TO ALLOW FOR THE DEPARTMENTS THAT WORK FOUR TENDS TO BE PAID?
>> WORKING WITH THE JUVENILE DEPARTMENT DETENTION SIDE IS
12 HOUR SHIFTS. >> I THINK THE POLICY OF THE
[01:45:04]
COMMISSIONERS COURT SHOULD BE EVERY DEPARTMENT IN NUECES COUNTY HERE IT SHOULD BE OPEN TO THE PUBLIC FROM 8:00 TO 5:00 IF AN ELECTED OFFICIAL WANTS TO DO SOMETHING DIFFERENT THEY CAN EXPLAIN TO THE PUBLIC AND THEN WE CAN'T DO ANYTHING ABOUT IT SO BE IT. I THINK THAT'S THE POSITION WE SHOULD TAKE. I DO NOT SUPPORT ANY DEPARTMENT ELECTED OR NOT ELECTED BEING CLOSED DURING A WORK WEEK. I WANT TO BE ON RECORD PUBLICLY SAYING THAT BECAUSE I DO NOT SUPPORT ANY DEPARTMENT SHUTTING DOWN. WE ARE A PUBLIC ENTITY WITH OBLIGATION TO THE PUBLIC AND WE SHOULD BE OPENED MONDAY THROUGHFRIDAY 8:00 TO 5:00. >> OFFICIALS COME AND GO AND
THE HOURS SHOULD STAY. >> IF THERE ARE DEPARTMENTS AND OFFICIALS SHUTTING DOWN SOME THEY CAN HAVE A WINDOW OPENED THAT THE PUBLIC HAS ACCESS TO THOSE SERVICES. I UNDERSTAND IF YOU'RE SWAMPED TRYING TO GET WORK DONE OR WORKING WITH OTHER DEPARTMENTS TO WORK ON THEIR SCHEDULES, BUT THE DEPARTMENT IS OPEN EVERY DAY FROM 8:00 TO 5:00.
>> I WANT TO BRING TO THE COURT'S ATTENTION THAT THERE MAY BE A FINANCIAL FEE INVOLVED WITH THIS CONFIGURATION CHANGE BECAUSE POLICIES ARE BASED ON THE PREVIOUS POLICIES. IF WE CHANGE POLICIES THERE MAY BE COST ASSOCIATED. WE ARE WELL INTO THE LIMITATION OF WORKDAY WHICH STARTED 12/23 AND ANY CHANGE NOW WILL HAVE A FINANCIAL
IMPACT. >> THEY SAID IT WOULD BE
MINIMAL. >> I BELIEVE WE CAN COVER THIS
WITH NO ADDITIONAL CHARGE. >> CAN WE DO ONE AT A TIME? I WOULD LIKE TO MAKE THE MOTION NUECES COUNTY POLICY EVERY DEPARTMENT IN NUECES COUNTY OPEN TO THE PUBLIC FIVE DAYS A WEEK 8:00 UNTIL 5:00 MONDAY THROUGH FRIDAY EXCLUDING
APPROVE COUNTY HOLIDAYS. >> WE HAVE A MOTION AND SECOND.
ANY OTHER DISCUSSION? ALL THOSE IN FAVOR SAY AYE ANY A POST? SAME SIGN, THE MOTION PASSES. NEXT MOTION.
COMMISSIONER. >> I WILL LET SOMEONE ELSE DO
>> FOR THE FLEX TIME? >> HOW DO WE MOTION THAT, MAKE THE MOTION FOR WORKDAY TO IMPLEMENT.
>> WORKDAY AND HR TO BRING UP POLICY CHANGES TO ADDRESS THOSE THAT ARE 10 HOUR WORKDAYS OR 12 HOURS FOR THOSE THAT ARE
>> SECOND. >> MAKE A MOTION TO ALLOW WORKDAY OR THE AUDITING OFFICE TO IMPLEMENT THE POLICY TO WORK WITH THOSE DEPARTMENTS THAT HAVE 10 HOUR WORKDAYS OR 12 HOUR WORKDAYS THAT THEY CAN CONTINUE.
>> I KNOW HR WILL REQUIRE THE POLICY TO BE CHANGED AND THAT HAS TO CHANGE THE , THE POLICIES THAT HAVE CHANGED, ONE
FOR THE . >> AS LONG AS THEY ARE FULLY OPEN AND ACCESSIBLE TO THE PUBLIC.
>> BEFORE WE GET OTHER DEPARTMENTS WANTING TO DO THE SAME THING YOU MUST UNDERSTAND YOUR DEPARTMENT WILL BE OPEN AND STAFFED. ALL OF YOUR SERVICES WILL BE AVAILABLE. TO
THE CONSTITUENTS. >> I WOULD LIKE TO HEREBY COMMUNITY SUPERVISION IS DOING THIS. I DON'T UNDERSTAND WHY
THEY ARE DOING IT. >> THE SAME REASON HOMER IS DOING IT WE HAVE 24 72 FACILITY SUBSTANCE ABUSE TREATMENT FACILITY. WE HAVE PEOPLE THERE 24/7 AND THAT'S ONE REASON, THE OTHER IS INCENTIVE REASONS. IT HAS BEEN MANY YEARS SINCE WE HAD PAY RAISES. COUNTY GETS PAY RAISES WE DON'T WE ARE NOT FUNDED AT THE COUNTY. OUR FUNDING COMES
FROM THE STATE. >> YOU'RE NOT A COUNTY
>> SO I DO HAVE YOU? WHY ARE WE CONCERNED WITH HOW YOU GET
PAID? >> WHILE THE PROBLEM IS WE USE WORKDAY BECAUSE THE COUNTY USES WORKDAY. I REALLY DON'T HAVE TO FOLLOW COUNTY POLICY ON A LOT OF THINGS.
>> ARE YOU A STATE EMPLOYEE? >> WE ARE JUDICIAL EMPLOYEES.
AND THEY'RE BASICALLY EMPLOYEES TO THAT FUNCTION SO THEY ARE NOT COUNTY EMPLOYEES EVEN THOUGH THEY ARE PART OF THE WORKDAY PROCESS BECAUSE WE ACCOUNT FOR THEM AS A SEPARATE
ENTITY. >> WE UTILIZE TC DRS . FOR RETIREMENT, BUT WE HAVE STATE INSURANCE.
>> WHO HIRES YOU? >> THE JUDGE APPOINTS ME AS DIRECTOR AND THEN I HIRE MY EMPLOYEES.
>> SO THEY ARE NOT COUNTY? >> THE PAYROLL JUST RUNS THROUGH OUR SYSTEM. IT COMES FROM THE STATE AND GOES
[01:50:02]
THROUGH OUR SYSTEM. >> OKAY, SO YOU'RE NOT A
COUNTY DEPARTMENT. >> WE WOULD HAVE NO JURISDICTION. YOU JUST NEED THIS IMPLEMENTED.
>> EXACTLY. >> SO THEN FINE, WE'RE DOWN TO JUVENILE PROBATION AND PUBLIC WORKS SO WE ARE REALLY ONLY APPROVING FOR THOSE TWO AT THIS POINT.
>> YES. >> I WOULD ASSUME WE WOULD WANT TO ADD ANYBODY ELSE THAT WISHES TO DO THAT WOULD HAVE TO COME TO COURT AND GET APPROVAL.
>> THIS IS A SLIPPERY SLOPE IF WE'RE NOT CAREFUL.
>> I AGREE, YOU DO IT FOR TWO YOU HAVE A LOT OF PEOPLE IN
HERE. >> FOR PROFESSIONALS WHO HAVE COURT UNTIL ALL HOURS OR HAVE CLIENTS IN THE OFFICE UNTIL ALL HOURS WE WOULD ALSO ASK THE SAME FLEX ABILITY.
>> WE HAVE ANOTHER ADDITION. >> NOT A CHANGE, THIS IS HOW WE
PRACTICE. >> I WANT TO ASSURE THE COURT WE DO TRY TO FOLLOW AS MUCH AS POSSIBLE WHAT THE COUNTY DOES SO THERE IS UNITY. I WANT TO ASSURE WE ARE THERE OPEN TO THE PUBLIC MONDAY THROUGH FRIDAY EVEN THOUGH WE HAVE PEOPLE WORKING FOUR DAYS SOMETIMES. SOMETIMES THEY WORK UNTIL 12:00 MIDNIGHT, WE DO HOME VISITS AT NIGHT SO WE HAD TO ALTER THE
SCHEDULE. >> THAT IS PART OF THE MOTION, THEY ARE REQUIRED WHOEVER IMPLEMENTS THIS IS REQUIRED TO HAVE YOUR OFFICES AND DEPARTMENT OPENED.
>> I WANT TO THANK THE PAYROLL DEPARTMENT BECAUSE I KNOW THEY HAVE BEEN WORKING WITH US THE LAST COUPLE WEEKS TRYING TO DO THE HICCUPS AND THINGS LIKE THAT.
>> YOU'RE MAKING ME MORE AND MORE UNCOMFORTABLE WITH DOING THIS. I'M NOT SURE, THIS, WHERE DO WE STOP HERE? I THINK
THIS IS A BIGGER DISCUSSION. >> THE IMPLEMENTATION THAT YOUR OFFICE HAS TO BE STAFFED , YOU HAVE TO BE ABLE TO HANDLE
WHATEVER CAUSE YOU GET. >> ANYBODY CAN SAY THEY ARE DOING THAT BECAUSE EVERYBODY WANTS FOUR DAY WEEKEND OR THREE
DAY WEEKENDS. >> WITH THE PAY WE ARE DOING LET'S LOOK AT THE PAIN THE PRESENTATIONS WE HAVE HAD AND GIVE STATE RANKINGS WE ARE 15TH IN THE STATE, POPULATION MICE, BUT PAY OVERALL IS AROUND 25TH. THERE IS A BIG GAP WITH SMALLER COUNTIES WE ARE NOT MEETING PAY. IF WE CAN'T DO IT BECAUSE EVERY YEAR WE ARE TYING OUR HANDS TOGETHER BECAUSE OF THE TAX RATE AND I GET IT I SUPPORTED IT AND I VOTED FOR IT IF WE CAN GO THAT WAY BECAUSE WE DON'T WANT TO BURDEN THE TAXPAYER THEN WE'VE GOT TO FIND OTHER WAYS TO INCENTIVIZE. I AM ALL FOR GIVING MANAGERS FLEX ABILITY TO SAY HEY WE ARE STILL GOING TO BE OPERATING BECAUSE EVERYONE WOULD AGREE MONDAY THROUGH FRIDAY 8:00 UNTIL 5:00 BUT IF THEY CAN CREATE A SHIFT WHERE PEOPLE COME IN AND OR MAYBE WORKING FOUR TENS OR SOMETHING THAT FLEXIBILITY WOULD BE MORE APPRECIATED. I WANT TO MAKE SURE WE INCLUDE THAT AND GIVE THAT OPTION AND IF IT HAS TO COME TO US PIECEMEAL I AGREE. I THINK WE HAVE OPEN PANDORA'S BOX BUT I THINK THAT WILL HELP US INCENTIVIZE STAYING HERE BECAUSE WE TALK TO JUAN AND WE WERE TALKING YESTERDAY.
TRAIN YOUR GUYS TO GET THE CDL AND LEGAL WORK FOR THE STATE OR SOMEWHERE ELSE. ALL THESE DIFFERENT DEPARTMENTS, SPEAKING WITH KEVIN YESTERDAY HE GETS HIS PEOPLE TRAINED AND THEY GO WORK FOR THE STATE OR OTHER AGENCIES. SO WE HAVE TO FIND A WAY IF WE CANNOT MONETARILY WHICH WE TRY TO DO EVERY YEAR WE TRY TO GIVE A LITTLE BIT OF INCREASE. BUT THAT'S NOT CATCHING UP WITH INFLATION OR ANYTHING ELSE, COST OF LIVING. THIS GIVES FLEXIBILITY. I KNOW IT CAN BECOME A MESS, BUT I THINK THAT GIVES THE MANAGER TO BE MORE CREATIVE AND HOPEFULLY HELPS WITH RETENTION AND IF IT DOESN'T MAYBE WE DO IT SHORT-TERM AND IF THERE'S NO CHANGE WE GO BACK INTO EVERYBODY MAKING IT EASY 8:00 TO 5:00 MONDAY THROUGH FRIDAY UNLESS YOU ARE --
TO -- AND FULLY STAFFED. >> I THINK COMMISSIONER GONZALEZ -- ABSOLUTELY RIGHT. IF YOU TELL US YOU CAN'T MAKE IT HAPPEN. THEN YOU HAVE TO REALIZE THAT THERE'S CERTAIN STAFF AND CERTAIN NUMBER THAT I DON'T KNOW WHAT IT IS. THAT SOME DEPARTMENTS MAY NOT BE ABLE TO DO IT. BUT PUBLIC WORKS
[01:55:01]
CAN MAKE IT HAPPEN. >> LARGER DEPARTMENTS.
>> EVEN THOUGH THE OFFICE STAFF MORE TRADITIONALLY WORK A SCHEDULE AND THE FIELD STAFF ARE GOING TO WORK THE NONTRADITIONAL. WHOEVER THAT MAY APPLY TO, I'M OKAY WITH
THAT. BUT -- >> I AGREE WHAT SHE WAS SAYING, COMMISSIONER AND I THINK THAT'S THE WAY TO MOVE FORWARD TO IT. IF YOU LIMIT IT TO THE LARGER DEPARTMENTS THAT HAVE THE STAFF TO MAKE THIS SCHEDULE SOMETHING IT CAN WORK, AND STILL MEET THE NEEDS OF THE COUNTY BY BEING OPEN DURING NORMAL BUSINESS HOURS, THAT IS THE WAY TO GO. YOU INCENTIVIZE THE EMPLOYEES BY OFFERING THIS ALTERNATIVE SCHEDULE AND IT DOESN'T AFFECT YOUR BUDGET. AND IT'S NOT COSTING THE COUNTY ANY MORE BECAUSE THERE'S STILL GOING TO GET PAID THE SAME JUST GET PAID DIFFERENTLY. IF WE LOOK AT IT THAT WAY, WE WILL MINIMIZE THE NUMBER OF INQUIRIES. MY DEPARTMENT HAS NO WAY OF MAKING A FOUR TEN HOUR SCHEDULE HAPPEN. I ONLY HAVE A STAFF OF FOUR. SO IT'S IMPOSSIBLE FOR MY DEPARTMENT TO DO IT. BUT LARGER DEPARTMENTS LIKE PUBLIC WORKS, JUVENILE JUSTICE, COMMUNITY SUPERVISION, AND OTHERS THAT ARE LARGE IN SIZE CAN ACCOMMODATE THAT. I WOULD THINK THAT WOULD BE THE PRIMARY CONSIDERATION FOR OUR POLICY.
>> THIS MIGHT EVEN HELP FOR RECRUITMENT AND SOME PEOPLE
MIGHT LOOK AT IT AS A BENEFIT. >> IT'S A HUGE INCENTIVE THAT REALLY MAKES EMPLOYER THE EMPLOYER OF CHOICE IF WE ADD THIS VALUE TO OUR COUNTY OPERATIONS WE WILL INCREASE OUR
RETENTION INDEED. >> I WOULD THINK SO.
>> CERTAINLY. >> SO MOVE FORWARD.
>> SO -- WE HAD THE MOTION AND WE HAVE THE SECOND. DO YOU HAVE THOSE? YOU GOT THOSE. WHO THEY WERE. OKAY. DO YOU WANT TO
WAIT? YEAH. >> I'M READY TO GO. I JUST --
>> SO WE HAVE A MOTION AND A SECOND TO ALLOW WORKDAY TO IMPLEMENT THIS TO -- FOR OUR DEPARTMENTS THAT ARE LARGE ENOUGH TO THE MANAGERS CAN DECIDE IF YOU JUST MAKING SURE RE-UP FORCING ONE LAST TIME, YOUR DEPARTMENT, YOUR OFFICE, WILL BE OPEN AND SERVICES WILL NOT BE SHUT DOWN. IF WE COME TO YOU AND YOU SAY WELL, WE CAN'T DO THAT ONE SERVICE BECAUSE OUR PERSON IS OUT ON THIS DAY. IF YOU IMPLEMENT THIS IN, IT HAS STILL TO HAVE FILL SERVICE AVAILABLE. YES, IT'S GOT TO BE
>> ALL THOSE IN FAVOR -- >> I WOULD LIKE TO ADD THERE SHOULD BE A SUPERVISOR AT ALL TIMES. IN THE OFFICE.
>> YES. >> THAT CAN MAKE A DECISION.
>> YEAH. ALL THOSE IN FAVOR SAY AYE.
>> AYE. >> AYE. ANY OPPOSED SAME SIGN.
MOTION PASSES AND WE WILL SEE HOW THIS GOES. AND PUT IT INTO OUR POLICY, MR. SOLAY. IT'S A GOOD TRIAL RUN AND SEE HOW IT GOES AND WE HAVE TO IMPLEMENT IT ANYWAY FOR THE OTHER DEPARTMENTS AND WORKDAY NEEDS TO GET MOVING ON THAT.
>> GLAD YOU SAID JUDGE, EVEN IF THE DEPARTMENTS GO FOUR DAY TEN HOUR SHIFTS THEY STILL REALIZE THAT A HOLIDAY IS EIGHT HOURS.
[9. Discuss and consider upcoming Commissioners Court meeting date(s), workshop date(s), and related matters.]

COURT DATES? THERE BEING NONE I'LL MOVE ON TO ITEM B1 GRANTS, DOCUMENT A RESOLUTION AUTHORIZING THE SUBMISSION OF A GRANT APPLICATION TO THE OFFICE OF THE GOVERNOR'S CRIMINAL JUSTICE SYSTEM. THE DEPARTMENT THAT IS REQUESTING THOSE ITEMS WILL USE THEIR FORFEITURE FUNDS TO PAY FOR THE MATCH FOR IN.>> IF THEY HAVE A FUND. >> IF THEY DON'T, CAN THEY
REQUEST IT THEN? >> WE DID LOOK THROUGH THESE WHEN THIS WAS BROUGHT TO US DURING THE BUDGET CYCLE AND MOST OUT OF THE DEPARTMENTS DO HAVE THE FUNDS AVAILABLE. THERE WAS ONE THAT DOESN'T AND ALREADY A SMALL BUDGET AMOUNT OF $1,000 SOMETHING FROM THE GENERAL FUND FOR THAT ONE PRESIXTY BUT THE REST OF THE PRECINCTS HAS THE FUNDS
>> FUNDS HAVE BEEN BUDGETED. >> FOR BODY WORN CAMERA THINGS SO AND IT'S ALREADY BEEN BUDGETED TO THAT DEPARTMENT.
>> YES. YES. >> OKAY. I WILL ACCEPT A MOTION
TO ALLOW THIS GRANT. >> MOTION TO ACCEPT THE GRANT.
>> SECOND. >> WE HAVE A MOTION AND A
SECOND TO ACCEPT THIS GRANT. >> THIS IS TO APPLY.
>> APPLY FOR THE GRANT. SORRY, NOT ACCEPT IT. I SAID ACCEPT.
APPLY FOR THIS WITH THE MATCHING FUNDS COMING FROM THE FORFEITURE FOUND IN THOSE DEPARTMENTS AND THE ONE DEPARTMENT WITHOUT MATCHING FUNDS COMING FROM THEIR BUDGETED FUNDS. ALL THOSE IN FAVOR SAY AYE.
[2. Discuss and consider including the Veterans Assistance and Veterans Treatment Court grants in the Vendor Payments Exception List not requiring Commissioners Court pre-approval.]
>> AYE. >> I THINK WE ALREADY SAID
[02:00:04]
THAT. AYE. SORRY. ITEM NUMBER 2. DISCUSSING CONSIDERATION INCLUDING THE VETERANS' ASSISTANCE AND THE VETERANS' TREATMENT COURT GRANTS IN THE VENDOR PAYMENTS EXCEPTION LIST.NOT REQUIRING COMMISSIONERS' COURT PREAPPROVAL. WE TOOK THE VETERANS' OUT FOR A SHORT TIME. I THINK THAT IT WAS FULLY MEANT THAT WE HAD INTENDED FOR VETERANS' GRANTS TO STAY BUT I KNOW WHEN WE VOTED A WHILE BACK TO TAKE THOSE OUT OF THE --
>> EXEC LIST. >> EXCEPTION LIST, THAT -- HOW
DO YOU FEEL ABOUT THIS? >> ORIGINALLY WHILE I WAS THINKING ABOUT IT BECAUSE THERE WAS THAT ISSUE WE HAD WITH SOCIAL SERVICES AND OTHER ISSUES THEY WERE NOT PROVIDING INFORMATION FOR US FOR. HOWEVER SOCIAL SERVICES DOES VERY LIMITED AMOUNT FOR THE TWO GRANT ITEMS. AS LONG AS WE HAVE THE PERMITTED APPROVAL OF THIS AND WE HAVE THE -- INVOICES IN QUESTION, AND THEY COME TO YOU AND MYSELF FOR APPROVAL I
BELIEVE IT'D BE QUALIFIED. >> STILL DOING THE REPORTING THEY REPORT TO YOU AND MYSELF. THIS JUST TAKES THEM OFF -- I
AGREE THAT. >> I'D LIKE THE CLARIFY THE SOCIAL SERVICES DOES GNAT HANDLE ANY OF -- NOT HANDLE ANY OF THE VETERANS' TREATMENT COURT.
>> JUST THE ASSISTANCE, YES. UNDERSTAND. YES.
>> AND THE VETERANS' COMMISSION FROWNS UPON -- WE HAVE TO JUSTIFY IF PAYMENT IS NOT DONE IN 60 DAYS.
>> SO NUMBER ONE. MOVING FORWARD. I WILL MAKE THE MOTION TO PUT THE VETERANS' TREATMENT COURT ON THE EXCEPTION -- BACK ON THEEXCEPTIONS LIST. THIS IS A TOTAL CIGARETTE THING THAT
DOES -- YES. >> THAT'S CORRECT.
>> I'LL MAKE THE MOTION FOR THAT.
>> SECOND. >> I HAVE A MOTION AND A SECOND. ALL THOSE IN FAVOR SAY AYE.
>> AYE. >> AYE AND ANY OPPOSED SAME SANE. THE MOTION PASSES. ON THE VETERANS ASSISTANCE I WILL MAKE THE MOTION TO TAKE THEM OFF THE EXCEPTIONS AS LONG AS THEY CONTINUE WITH THE -- DOCUMENTS THAT THEY ARE TURNING IN TO THE AUDITOR'S OFFICE AND THE COUNTY JUDGE'S OFFICE. THAT THEY WOULD GO BACK ON THE EXCEPTIONS LIST AS WELL.
>> WHICH ONE? >> ON THE VETERANS' ASSISTANCE. THAT'S SOCIAL SERVICES THAT THEY'VE BEEN TURNING IN BOTH PAPERWORK TO BOTH OF US. SO.
>> SO CAN YOU RESTATE THAT MOTION, JUDGE.
>> I'M MAKING THE MOTION TO PUT THE VETERANS' ASSISTANCE BACK ON TO THE EXCEPTIONS LIST AS LONG AS THEY CONTINUE TO PROVIDE THE DOCUMENTATION THAT THEY HAVE BEEN PROVIDING TO BOTH THE AUDITOR'S OFFICE AND TO THE COUNTY JUDGE'S OFFICE FOR THEM TO BE ABLE TO GO ON TO THE EXCEPTIONS LIST PROJECTS.

>> AYE. >> ANY OPPOSED SAME SIGN. THE
MOTION PASSES. THANK YOU. >> THANK YOU SO MUCH.
[1. Discuss and consider conditional selection of Victory Building Team for the American Rescue Plan Act (ARPA) funded Medical Examiner New Facility & Renovation Project (CSP No. 3252-23); and related matters.]
>> THANK YOU. >>> MOVING ON TO PURCHASING, THANK YOU MICHAEL. ITEM D1. VICTORY BUILDING TEAM FOR THE
MEDICAL EXAMINER'S OFFICE. >> YES, JUDGE, WE HAVE A PROPOSAL OPENING FOR CSP FOR THE MEDICAL EXAMINER NEW FACILITY AND RENOVATION PROJECT. WE RECEIVED SIX BIDS.
THE RECOMMENDATION FROM THE COMMITTEE IS TO -- AND THE RECOMMENDATION FROM THE ARCHITECT, IS TO CONDITIONALLY SELECT VICTORY BUILDING TEAM FOR THE RESCUE PLAN ACT AND RENOVATION PROJECT CSP JURY ROOM 32-52/23. THEY HAD A BASE BID OF $7,300,000. I UNDERSTAND THAT -- ONCE WE DO CONDITIONAL SELECTION, THAT WILLSTART THE NEGOTIATING PROCESS. AND JUAN CAN WORK WITH THIS VENDOR TO DO VALUE ENGINEERING IS WHAT I UNDERSTAND. HE PLANS TO DO. AND JUAN CAN SPEAK TO THE DETAILS OF IT BUT I THINK THERE WERE SOME OPPORTUNITIES I THINK WITH THE FOUNDATION WHERE THEY FELT THEY CAN SAVE SOME MONEY ON
THAT. >> MICHAEL, CAN YOU JUST -- TELL US WHO VICTORY TEAM BUILDING IS EXACTLY?
>> SO -- >> I BELIEVE IT'S LOCAL IS MY

>> THAT'D BE GOOD. >> HE GIVES LETTER RECOMMENDATION BUT IT DIDN'T DESCRIBE IT IN THERE. YOU
TALKING ABOUT SOMETHING ELSE? >> THAT WAS JUST SEEING IF HE HAD ANY INDICATION ON HERE ABOUT THAT.
>> AND I THINK WHILE HE'S COMING UP, THIS -- THE REASON WE HAVE NEGOTIATED IS THAT'S OVER THE BUDGETED AMOUNT.
>> CORRECT. >> $7 MILLION FOR THIS PROJECT.
>> AND $7 MILLION WAS TURNKEY -- NO, NO, WE PAID FOR HIS SEPARATE. RIGHT? WE PAID FOR ACTFECT AND DESIGNERS SEPARATE.
>> HE WAS FUNDED PRIOR TO -- >> GO AHEAD. JAVIER, YOU CAN DO IT. WHOEVER WANTS TO DO IT. I'M GLAD WE'RE -- LOOKING AT
[02:05:04]
>> YES. YEAH, WE HAD A VERY GOOD PARTICIPATION ON THE BIDS.
AND THE TOP FOUR THE PERCENTAGE OF THE BIDS WERE REALLY CLOSE TO EACH OTHER. SO THAT ALWAYS TELLS US, YOU KNOW, THAT THERE WASN'T REALLY A BUST OR YOU KNOW, SOMETHING THAT WAS MISSED AND ONE OF THE BIDS. THE OTHER THING THAT WE DID IS WE ANALYZED THE SCHEDULE OF VALUES FOR THOSE TOP FLOOR. AND COMPARATIVELY LOOKED AT THEM AND TO SEE IF THERE WAS ANYTHING YOU KNOW, GLARING THAT WAS MAYBE MISSED OR SOMETHING THAT TO BE A CONCERN. THERE'S NOTHING LIKE THAT. THERE IS, YOU KNOW, THE OVERAGE RIGHT NOW WE'RE ABOUT $300,000 FROM THE $7 MILLION THAT WE WANTED TO BE AT. THERE'S OPPORTUNITIES THAT WE WANT TO LOOK AT. WE WANT TO HAVE THE OPPORTUNITY TO GO BACK AND WORK WITH VICTORY AND TRY TIFFINED, YOU KNOW, BRING DOWN THE COST SO WE CAN GET IT IN THE BUDGET. ALSO THERE'S SOME ALTERNATES THAT WE DIDN'T HAVE OR THAT WOULD BE -- WOULD BE HIGHLY RECOMMENDED IF IT, YOU KNOW, IF WE CAN FIND THE FUNDS.
YOU KNOW,, TO DO THEM. >> YES.
>> $7.3 MILLION. >> YES. ESPECIALLY THE HVAC AND THE ROOFING OF THE EXISTING BUILDING. THOSE TWO ITEMS ESSENTIALLY IF WE CAN DO THOSE TWO ITEMS, THEN BUILDING PER SE IS GOING TO BE BRAND NEW. YOU KNOW. EVEN WITH THE RENOVATION AND THE NEW ADDITION. WE'RE GOING TO END UP WITH A NEW BUILDING AND NEW HVAC AND NEW ROOFING. THE AC UNITS FOR THE EXISTING PART OF THE BUILDING, THEY'RE -- VERY OLD. SO THE GOOD THING IS THAT THE CONSTRUCTION OF THE PROJECT IS ABOUT 18 MONTHS. SO WE'RE GOING TO BE DOING THE ADDITION THE NEXT 12 MONTHS. AFTER THAT, WE MOVE INTO THE OLD PART AND SO WE HAVE A LITTLE BIT OF TIME MAYBE PHYSICAL YEAR THAT WE CAN LOOK FOR SOME EXTRA MONIES AND THEN MAYBE LATER, YOU KNOW, NEXT YEAR, COME BACK AND SEE WHERE WE'RE AT AND SEE IF THERE'S AN OPPORTUNITY TO PICK UP SOME OF IN ALTERNATES. SO WE DON'T HAVE TO MAKE A DECISION NOW. BUT THAT'S -- YOU KNOW, IT WOULD BE A GOOD -- I THINK IT WOULD BE A GOOD TIME TO DO IT BECAUSE RIGHT NOW IT WON'T DISTURB THE FACILITY. IT CAN BE DONE CLEANLY. AND I'M SAYING THIS ON THE FACE TOO. IT CAN BE
DONE CLEANLY. >> PRICES WON'T GO UP.
>> YEAH. YES. >> YOU ARE NOT ANTICIPATING THAT YOU COULD GET DOWN A HALF A MILLION DOLLARS SO THAT WE CAN DO THE ROOF AND THE HVAC? KEEP THAT AT -- BECAUSE WE'RE # HUNDRED THOUSAND DOLLARS OVER AND YOU ADD ANOTHER $200,000 IF WE CAN KNOCK $500,000 OFF WE CAN DO THE REQUIRED THINGS.
>> YEAH, WE'RE GOING TO LOOK AT --
>> I WOULD WORK TOWARDS THAT. YES.
>> SO WE'RE GOING TO LOOK -- >> NEXT YEAR, I'M NOT SURE IF FUNDING IS GOING TO BE ANY BETTER.
>> YEAH. WE'RE GOING TO LOOK AT EVERYTHING. WE'RE GOING TO LOOK AT IT. WE'RE GOING TO LOOK AT EVERYTHING THAT WE CAN -- WE CAN GET OUT OF IT. AND I ALREADY INSTRUCTED OUR -- ONE OF THE ITEMS THAT WAS I'M GOING TO SAY REALLY SKEWED FROM WHAT WE WERE EXPECTING IN MARKET WAS THE FOUNDATION. AND SO WE'RE REALLY GOING TO LOOK HARD AT THAT ONE. AND SO I INSTRUCTED OUR ENGINEERS WHO ALREADY DESIGNED A DIFFERENT SYSTEM SO HE'S ALREADY WORKING ON THAT. SO HOPEFULLY I'LL HAVE THAT, YOU KNOW, QUICKLY. AND I'M GOING TO GIVE IT TO VICTORY SO THEY CAN PRICE THAT DIFFERENT DESIGN FOUNDATION. YOU KNOW, THAT ONE LINE ITEM, IT'S -- IT'S VERY HIGH. AND THAT'S THE ONLY ONE THAT WAS, YOU KNOW, FROM OUR COMPARISON OF OTHER PROJECTS, THAT WAS THE ONLY ONE THAT WAS GLARINGLY OFF FROM
WHAT IT SHOULD BE. >> ANTICIPATED. YES. YOU ARE ASKING FOR US TO DO A CONDITIONAL SELECTION TO ALLOW THE NEGOTIATIONS WITH THIS INDIVIDUAL -- THIS COMPANY AND WE NEVER FOUND OUT WHO THIS LOCAL COMPANY IS.

ABOUT THIS. >> IS CHRIS THIS LOCAL COMPANY.

>> MOVING ON TO ITEM NUMBER TWO. DISCUSS CONSIDER THE CONDITIONAL SELECTION OF MCAGGRESSIVE INSURANCE SERVICES
[02:10:01]
FOR EMPLOYEE BENEFITS AND CONSULTING SERVICES AND I THINK COMMISSIONER -- YOU WERE THE LEAD ON THAT?>> THE -- THERE WAS THE COMMITTEE SELECTION COMMITTEE THAT WENT THROUGH THIS. AND WE HAVE SCORE SHEETS I THINK.
>> THE SCORE SHEETS ARE ON THERE.
>> UH-HUH. THANK YOU. >> AND JUST A REMINDER THE COURT HAS BEEN WITHOUT A CONSULTANT SINCE THE START OF THE FISCAL YEAR OR JUST PRIOR TO THAT. SO IT WILL BE GOOD TO HAVE A FIRM ON BOARD HELPING MONITOR OUR DAY-TO-DAY AND IT -- WE COLLECTIVELY SUPPORT THE RECOMMENDATION OR ANY OF THESE GROUPS THAT I WOULD JUST RECOMMEND THAT WE BEGIN LOOKING AT EXPLORING OR PUTTING OUT ON THE STREET A BID FOR HEALTH -- FOR THE HEALTH INSURANCE. THIS WOULD BE OUR CONSULTANT BUT FOR
THE ACTUAL HEALTH INSURANCE. >> FOR THEM TO BEGIN WORKING ON
THAT. >> FOR THEM TO BEGIN WORKING ON THAT EXPLORING THAT AND THAT DOES TAKE A WHILE AND IT'S A PROCESS TO LEARN OUR SYSTEM AND ALL THE NUANCES WE HAVE HERE IN NUECES COUNTY. IT WON'T TAKE TOO MUCH. IT COULD HAVE A POSITIVE IMPACT ON OUR BUDGET AND TYPICALLY WHEN YOU GO OUT FOR NEW -- ESPECIALLY SERVICES LIKE HEALTH CARE, YOU CAN CAPTURE SOME COST SAVINGS IN THE EARLY YEARS. TYPICALLY THEY'RE BUNDLED THREE TO FIVE YEARS AND THEN RENEWALS AFTER THAT. SO THAT MAY BE SOMETHING TO CONSIDER AND CAN'T GUARANTEE IT. WE DON'T KNOW IF WE DO SUPPORT MCGRIFF IF THEY CAN FIND ANY FIRMS THAT WOULD BE ABLE TO PROVIDE US ANY SAVINGS BUT I WOULD SAY MY PAST EXPERIENCES, WE HAVE A BETTER CHANCE OF FINDING SOME SAVINGS GOING OUT AND -- WE CAN KEEP THE SAME COMPANY. JUST A NEW PROCESS AND NEW BID AND THEN MAYBE THEY CAN FIND SOME COST SAVINGS AND OUR CURRENT PROVIDERS DONE SOME GREAT WORK WITH US OVER THE LAST FEW MONTHS ESPECIALLY. SO SINCE WE'VE BEEN WITHOUT A CONSULTANT. I WOULD ALWAYS THINK THAT IT'S GOOD TO PUT OUT FOR A BID JUST TO KEEP EVERYONE ON THEIR TOES AND KEEP US WITH THE BEST NUMBERS POSSIBLE FOR US, FOR OUR EMPLOYEES. SO -- THAT WOULD JUST BE MY CAVEAT TO RECOMMENDING MCGRIFF INSURANCE TO BE THE CONSULTANT.
>> IS THERE A REASON THIS IS CONDITIONAL SELECTION TOO?
>> I MEAN --S. >> THIS IS IS THE NORMAL PROCESS FOR RFP. CONDITIONAL SELECTION WILL ALLOW THE DEPARTMENT HEAD FOR WHOEVER THE PROJECT IS FOR TO BEGIN NEGOTIATIONS AND THEN COME BACK TO COURT WITH A CONTRACT. AND THEN AT THAT POINT, THE COURT THEN VOTES TO AWARD AND EXECUTE
THE CONTRACT. >> WE HAVE TO DO IT WITHIN THE BUDGETED AMOUNT THAT WE HAVE BUDGETED AND HOPE THEY HAVE --

THE TWO LOCAL HAD VERY SMALL AMOUNT OF RELATIVE EXPERIENCE OR RELATIVE TIME. THE CLOSEST ONES WERE SAN ANTONIO AND THREE OR FOUR OF THEM WERE FROM DALLAS AND SOME OF THEM WERE FROM A DIFFERENT STATE. SO WE WENT THROUGH AND EVALUATED ALL THESE COMPANIES AND WE FOUND THAT MCGRIFF ARE NOT THAT FAR AWAY EVEN THOUGH THEY'RE FROM SAN ANTONIO. WE CAN DO TEAM AND OTHER ZOOM MEETINGS AT THE TIME TO GET THEM HERE AND ONLY A SMALL INCREASE WHAT WE'RE DOING AT THE MOMENT. RIGHT NOW WE'RE PAYING -- WE WERE PAYING $7,000 A MONTH. THIS IS $7,500 A MONTH. THEY'RE PROPOSING. BUT WHAT THEY'RE ALSO PROPOSING IS -- NOW WE'RE HAVING EIGHT PEOPLE WORKING ON IT INSTEAD OF JUST ONE. SO WE BELIEVE THE -- RETURN OF THE INVESTMENT IS VERY PROFITABLE TO THE COUNTY.
>> JUDGE, I WOULD -- MAKE THE MOTION TO APPROVE THE CONDITIONAL SELECTION OF MCGRIFF INSURANCE LLC FROM EMPLOYEE BENEFITS A CONSULTING SERVICE.
>> WE HAVE A MOTION AND A SECOND. ANY OTHER DISCUSSION?
>> THANKS TO DALE AND TIMOTHY FOR GOING THROUGH THIS BECAUSE MAN, I KNOW HOW MUCH OF A -- THAT WAS A LOT OF STINKING STUFF TO GO THROUGH. AND THANKS FOR FACILITATING IT. MICHAEL.
>> A LOT OF STUFF. >> JUST A LOT OF STUFF.
>> I KNOW TIM AND I -- READ THROUGH EACH ONE OF THE PROPOSALS THREE OR FOUR TIMES AND THEN TIM AND I MET WITH MICHAEL ON THIS WHEN WE TALKED ABOUT THIS AND WHEN I GAVE MY TOP TWO OR THREE AND TIM GAVE HIS, THAT'S ONE OF THE TOP
[02:15:04]
THREE. >> ONE OF BIGGEST BENEFITS WE HAVE BY GOING WITH THEM IS THAT THEY HAVE GIVEN US A GUARANTEED RATE AT THREE YEARS AT $7,500 A MONTH. THAT WAS PHENOMENAL GIVEN 100 YEARS OF EXPERIENCE AND 120 LOCATIONS AND BEING CLOSE. WE HAVE A PROFESSIONAL NETWORK TO CHOOSE FROM AND REALLY ADD VALUE TO NUECES COUNTY.
>> I THINK ONLY QUESTION I HAVE, CAN THEY CHOOSE TO GO TO DIFFERENT HOSPITALS? OR DO THEY HAVE TO BE STUCK AT ONE
HOSPITAL. >> THOSE ARE OUR BROKERS AND DEALERS THAT WILL BE WORKING WITH US AND WORKING WITH MICHAEL ON WHEN WE GO OUT FOR BIDS FOR THIRD PARTY ADMINISTRATORS OR NETWORKS OR WHATEVER IT MIGHT BE COMING UP FOR BIDDING REQUIREMENTS INCLUDING THE PRESCRIPTIONS AND
WELLNESS CENTERS. >> MORE THAN ONE.
>> YES. ALL RIGHT, SO WE HAVE A MOTION AND A SECOND FOR THE CONDITIONAL SELECTION. ALL THOSE IN FAVOR SAY AYE.
>> AYE. >> AYE. ANY OPPOSED SAME SIGN.
MOTION PASSES. >> THANK YOU VERY MUCH. AND I JUST REMIND YOU ON BOTH THE ITEMS WE'LL BE COMING BACK TO THE COURT WITH A CONTRACT FOR YOU TO CONSIDER.
>> ONE QUICK QUESTION. ALSO COVER LIKE OUT OF TOWN SOMETIMES PEOPLE GO OUT OF TOWN?
>> OKAY; SO -- SO THIS IS THE CONSULTANT RIGHT? HE'S GOING TO REPRESENT -- ALL OF OUR NEEDS. YEAH, THIS IS NOT THE
ACTUAL -- SELECTION. >> WE'LL COME BACK FOR THAT. I BELIEVE ONCE WE GET THIS PERSON UNDER CONTRACT FIRST THING WE'RE GOING TO DO IS BRING HIM INTO THE INSURANCE COMMITTEE AND GET HIM INTRODUCED TO EVERYBODY. SO WE BELIEVE -- HE
[1. Discuss and Consider creating one Administrative Assistant II position (pay grade 23) in the District Attorney's Office to be funded through salary savings from the reduction in force deletion of one Criminal Investigator position (pay grade 24). ]
CAN GET SOME DIRECTION FROM IT. >> I'M WITH YOU NOW.
>> OKAY. ITEM NUMBER DHR DISCUSS AND CONSIDER CREATING ONE ADMIN ASSISTANT NUMBER TWO POSITION A PAY GRADE 23 IN THE DISTRICT ATTORNEY'S OFFICE TO BE FUNDED THROUGH SALARY SAVINGS FROM THE REDUCTION ENFORCED DELETION OF ONE CRIMINAL INVESTIGATOR POSITION PAY GRADE 4.
>> THIS IS -- JUDGE, I WANT TO MAKE A MOTION TO PASS THIS BECAUSE -- BUT THIS IS PERMANENT SALARY SAVINGS THEY'RE DOING WITH THIS. THIS COMPORTS WITH THE POLICY WE'VE BEEN DOING GOING FORWARD. I WOULD MOVE TO PASS THIS.
>> WE HAVE A MOTION AND A SECOND. IS THERE ANY OTHER DISCUSSION? ALL THOSE IN FAVOR SAY AYE. I'M GOING TO VOTE NO.
I LET MR. GRANBURY I MADE THE PROMISE IN THE BUDGET LAST YEAR THAT I WOULD NOT VOTE FOR THESE AGAIN IN THE FUTURE. THIS IS ONLY BECAUSE OF MY PROMISE AND IT IS PASSING AND I -- I WOULD HAVE HAD TO EAT THE WORDS AND I APOLOGIZE FOR THAT. BUT I DO UNDERSTAND THE NEED FOR THIS POSITION.
>> ONLY -- IF IT HAD -- >> HAD SALARY SAVINGS BUT I SAID THESE -- THOSE ARE SUPPOSED TO BE DONE DURING BUDGET TIME AND I MADE A PROMISE PUBLICLY IN COURT THAT I WOULD NOT SUPPORT THESE. SO THAT IS THE ONLY REASON AND MR. GRANBURY, ITEM ALREADY PASSED. YOU DIDN'T NEED MY VOTE LIKE I TOLD YOU. THANK YOU VERY MUCH. I APOLOGIZE AND I THINK WE NEED, YOU KNOW, MORE THINGS AND APPRECIATE THAT YOU FOUND SALARY SAVINGS TO GET YOURS ACCOMPLISHED. BUT -- MINE WAS ONLY BECAUSE OF THE PROMISE I MADE EARLIER IN THE YEAR. SO.
>> SOMETIMES YOU HAVE TO DO BETTER WHEN I DON'T APPEAR AT ALL.
[1. Discuss and consider authorizing and approving execution of a contract for $54,967.25 with Insight Public Sector (under Omnia Contract No. 23-6692-03) for Commvault Cloud Licensing for the Information Technology Department.]

>> YES. THANK YOU. >>> MOVING ON TO ITEM E.
INFORMATION TECHNOLOGY DISCUSS AND CONSIDER AUTHORIZING AND APPROVING THE EXECUTION OF A CONTRACT FOR $54,967 WITH INSIGHT PUBLIC SECTOR UNDER OMNIA CONTRACT.
>> PREVIOUSLY BE BUDGETED. >> FUND FROM HIS BUDGET. IT.
>> IT'S NOT ANYTHING NEW. RENEWAL IS COMING UP IN JANUARY ANYWAY. THAT IS JUST A $12,000 INCREASE AND IT TOOK IT OVER
$50,000. >> BUT IT'S BEEN BUDGETED.
>> YES, YES. IT'S ALREADY BUDGETED AND IT'S THE BACK UP SYSTEM AND BACKS UP THE SOFTWARE AND DATA. AND WE'VE
INCREASED THE USERS BY 430 -- >> MOTION TO APPROVE.
>> MOTION TO APPROVE. WE HAVE A MOTION TO APPROVE. AND A SECOND. ALL THOSE IN FAVOR SAY AYE.
>> AYE. >> AYE. ANY OPPOSED SAME SIGN.
THE MOTION PASSES. >>> WE ARE GETTING READY TO GO INTO EXECUTIVE COMMISSION EARACHES KNEE, DO YOU WANT MORE
TIME ON 3A4 -- >> I'M SORRY. I'VE BEEN
PAYING ATTENTION TO THE AGENDA. >> WE'LL BRING IT BACK AFTER EXECUTIVE THEN AND SEE IF YOU GET A CHANCE TO LOOK AT IT
SO SHE'S SAYING JUDGE I GUESS TO CLEAN UP THE MOTION TO ACCEPT THE LAND FROM CC HIGH POINT INVESTMENTS, FOR THE
DRAINAGE PROJECT. >> CONTINGENT ON THE COUNTY ATTORNEY'S APPROVAL? YES. OKAY.
>> I'M GOING TO SAY AS SOON AS THE COUNTY -- NOT CONTINGENT, AS SOON AS TH PAPERWORK IS COMPLETED.
[02:20:04]
>> MY SECOND TOO. >> THANK YOU FOR DOING THAT.
>> AND -- OKAY. WE HAVE -- AN AMENDED MOTION AND A SECOND.
ALL THOSE IN FAVOR SAY AYE? >> AYE.
>> AYE. ANY OPPOSED SAME SIGN. THE MOTION PASSES. THANK YOU.
MOVING ON -- IS THERE ANYTHING ELSE THAT I MISSED OTHER THAN THE ONE ITEM WE'RE BRINGING BACK LATER? AT THIS POINT -- THEN WE ARE GOING INTO EXECUTIVE SESSION.
>> JUST FOR CLARIFICATION -- DOES THIS WORK? JUST FOR CLARIFICATION, JUST FOR -- DOT THE IS AND CROSS THE TS.
>> YES, SIR. >> ON ITEM 3A6 -- YOU DID?
OKAY. THANK YOU. SORRY. >> THAT'S OKAY. WERE YOU OUT OF THE ROOM? SORRY.
>> SHE'S ON THE BALL NOW. SHE'S GOT IT.

Upon completion of the Executive Session, the Commissioners Court may in an open session take such action as appropriate on items discussed in an Executive Session.]
>> GOOD JOB. THIS AT THIS TIME WE'RE GOING INTO EXECUTIVE SESSION. PUBLIC NOTICE IS GIVEN THAT COMMISSIONERS' COURT MAY ELECT TO GO INTO EXECUTIVE SESSION ANY TIME DURING THE MEETS TO DISCUSS MATTERS LISTED ANYWHERE ON THE AGENDA WHEN AUTHORIZED BY THE PROVISIONS OF THE OPEN MEETINGS ACT OF THE TEXAS GOVERNMENT CODE TO THE EXTENT THERE'S BEEN A PAST PRACTICE OF DISTINGUISHING ITEMS FOR PUBLIC DELIBERATION AND THOSE FOR EXECUTIVE SESSION. THE PUBLIC IS ADVISED THE COURT IS DEPARTING FROM THE PRACTICE AND RESERVES THE RIGHT TO DISCUSS ANY LISTED JADA ITEM AND EXECUTIVE SESSION WHEN AUTHORIZED BY LAW TO DO SO. IN THE EVENT THE COMMISSIONERS' COURT ELECTS TO GO INTO EXECUTIVE SESSION, THE SECTION OR SECTIONS OF THE OPEN MEETINGS ACT AUTHORIZING EXECUTIVE SESSION WILL BE PUBLICLY ANNOUNCED BY THE PRESIDING OFFICER. IN ACCORDANCE WITH THE AUTHORITY OF THE GOVERNMENT CODE TEXAS CODE SECTION 551/071 AND 072 AND 073, 074, 5745 AND 576 AND 086, 551:087, THE COMMISSIONER'S COURT WILL HOLD AN EXECUTIVE SESSION TO CONSULT WITH THE ATTORNEYS AND INCLUDING MATTERS RELATED TO LITIGATION, DELIBERATE REGARDING -- REGARDING REAL PROPERTY, PERSPECTIVE GIVES AND PERSONNEL MATTERS AND INCLUDING TERMINATION AND COUNTY ADVISORY BODIES, SECURITY DEVICES, AND/OR ECONOMIC DEVELOPMENT NEGOTIATIONS. AND OTHER MATTERS THAT MAY BE DISCUSSED IN AN EXECUTIVE SESSION. UPON COMPLETION OF THE EXECUTIVE SESSION, THE COMMISSIONERS' COURT MAY IN AN OPEN SESSION TAKE SUCH ACTION AS APPROPRIATED ON -- APPROPRIATE ON ITEMS DISCUSSED IN THE EXECUTIVE SESSION. ITEM A. DISCUSS AND CONSIDER THE APPOINTMENT -- THE EMPLOYMENTEVALUATION REASSIGNMENT DUTIES, DISCIPLINE, OR DISMISSAL OF THE NUECES COUNTY DEPARTMENT HEADS AS SCHEDULED. TEXAS GOVERNMENT CODE 551.074. THIS IS THE WORDING THE COUNTY ATTORNEY HAS SAID THAT WE'REYEARED TO USE FOR THIS. NO DEPARTMENTS ARE BEING -- THIS IS JUST A DEPARTMENT HEAD EVALUATION AND
THIS IS NOT -- >> OKAY. BUT FROM THE COUNTY ATTORNEY'S OFFICE, WE WOULD ASK THAT THE DEPARTMENTS BE IDENTIFIED SO AS IT STANDS, THIS IS NOT AS WE WOULD PREFER
THE LANGUAGE. >> IT IS REQUIRED?
>> YOU HAVE TO -- WELL. >> BECAUSE IT'S JUST OUR EVALUATION. IT'S NOT LIKE WE'RE BRINGING THEM IN FOR DISCIPLINARY, THIS IS STARTING OF THE EVALUATION THAT'S NEVER
BEEN PERFORMED. >> WHAT WOULD BE REQUIRED WOULD BE FOR THE INDIVIDUALS TO HAVE NOTICE PRIOR.
>> THAT'S GOOD. THEY WERE NOTIFIED.
>> BUT THE LEVEL -- AS THE LEVEL OF SCRUTINY GOES UP, IF IT IS A NEGATIVE ACTION AND IF IT IS AN EMPLOYEE THAT -- THAT HAS A LOT OF PUBLIC INTEREST, THEN YES, THAT WOULD NEED TO BE
SPECIFIED IN THE NOTICE. >> WE TOOK THIS OFF AS OF LAST MEETING BECAUSE WE HAD A -- PERSON LISTED AND WE ARE -- ONLY HAVE A SHORT TIME WE'RE TRYING TO WORK THESE ALL IN BECAUSE IN THE PAST WE HAVE NEVER -- DONE THESE BEFORE. AND THE COMMISSIONERS' COURT BECAUSE THEY ANSWERED ALL FIVE OF US, WE'RE HAVING TO ADD THEM ON TO OUR AGENDAS AND WE WANTED TO LEAVE IT OPEN. JUST LIST ALL THE DEPARTMENT HEADS BEHIND THIS, WOULD THAT COVER IT? THEN WE CAN E IN? LAST TIME COULD HAVE PULLED SOMEBODY ELSE IN.
>> JUST WORK ON THE WORDING A LITTLE BIT TO WHERE IT'S NOT
-- >> IT'S VERY INFLAMMATORY LIKE --
[02:25:02]
STATUTE THAT'S THE SAFEST THING TO DO, PERHAPS IF YOU'REDOING TWO STAGE. >> TO ME WE WOULD ONLY DO THE NEXT DATE WOULD BE IF EVALUATION COMES OUT POORLY THEN WE HAVE TO REPOST AS A DIFFERENT ITEM.
>> THAT IS POTENTIALLY YES. WE ARE HAPPY TO WORK WITH YOU .
WHATEVER MAKES YOU COMFORTABLE.
>> WE PUT IT ON THAT'S THE REASON I WANT TO STATE OPENLY FOR THE PUBLIC BECAUSE IT IS VERY INFLAMMATORY AND THAT IS NOT WHAT OUR INTENTIONS ARE. AND THEN MOVING ON ITEM B CONSULT THE COUNTY ATTORNEY REGARDING LEGAL MATTERS RELATED TO STATUS OF THE TRIAL COURT NUMBER 4704 NUECES COUNTY , TEXAS AND APPRAISAL DISTRICT IN THE 135TH JUDICIAL COURT, AND RELATED MATTERS, TEXAS GOVERNMENT CODE 551071 AND TAKE ACTION AND POSSIBLY OPEN SESSION. I BELIEVE THAT IS ALL. WE HAVE NOT PULLED ANYTHING ELSE IN. IF YOU WOULD LIKE ME TO STATE OPENLY FOR YOUR BENEFIT ON THE PREVIOUS ITEM WE DO HAVE PUBLIC WORKS AND GRANTS AND THE REPORT DIRECTOR COMING IN FOR EVALUATION TODAY. SO, IT IS 11:31 AND WE ARE GOING INTO EXECUTIVE SESSION. WE HAVE AN ITEM FOR ITEM B FROM EXECUTIVE SESSION. I THINK I WROTE IT DOWN. I WOULD MAKE THE MOTION TO ALLOW OUTSIDE LEGAL COUNCIL TO CONTINUE THE CASE BY COURT AND ACCEPTING COST EME ASSOCIATED WITH SUCH UPHILL
WITH AMOUNT UP TO $15,000. >> SECOND.
>> MOTION AND SECOND ALL THOSE IN FAVOR? ANY OPPOSED? SAME SIGN. THE MOTION PASSES. GOING BACK TO ITEM 3 A 4 DISCUSS AND CONSIDER THE NUECES COUNTY COURTHOUSE AND JAIL ROOF PROJECT. AND, THE FUNDING SOURCES FOR SUCH THAT WAS PASSED OUT AND COMMISSIONER CHESNEY YOU ARE READY TO MOVE
FORWARD WITH THAT? >> YES MA'AM I APPRECIATE TIME IN ALLOWING ME TO LOOK AT THIS, MY UNDERSTANDING IS WE WILL REDUCE ARPA FUNDING BY $2.7 MILLION FROM PARKSVILLE TO GO TO THE ROOF AND 2 MILLION OF THOSE IN CEOS OUTLINED ON THE LIST PROVIDED WILL BE RETURNED TO THE PARKS DEPARTMENT STILL LEAVING A SHORTAGE IN THE ROOF AND I GUESS A SHORTAGE IN THE PARKS DEPARTMENT , BUT WE WILL WORK ON THAT AT A LATER DATE.
THAT'S MY UNDERSTANDING THAT CORRECT THOSE ARE ALL FROM DIFFERENT PROJECTS THAT I THINK WERE OVERAGES THAT WERE SAVINGS WITH UNALLOCATED AND SO FORTH AND I APPRECIATE THE COUNTY JUDGE AND COMMISSIONERS FOR COMING UP WITH SOME FUNDING BASED ON THAT. I UNDERSTAND IT COMPLETELY NOW AND I APPRECIATE
THE TIME. >> I WILL MAKE THE MOTION TO PASS, IF I CAN. TO PASS WITH THE FUNDING SOURCES, THE UNALLOCATED AND ALLOCATING AND WE CAN GIVE YOU THIS LIST IF THAT IS BETTER FOR YOU FOR THE NOTES BECAUSE IT IS PRETTY EXTENSIVE. TERESA HAS IT, AS WELL AND MOVING FORWARD FOR THE PROJECT. I WILL ACCEPT THE SECOND. WE HAVE A MOTION AND SECOND ALL THOSE IN FAVOR SAY AYE . ANY OPPOSED SAME SIGN.
THE MOTION PASSES. IS THERE ANYTHING THAT WE MISSED ON HERE ? OR NEED TO COME BACK TO? ANY COMMISSIONERS OR ANY ADJOURNMENT IN MEMORY OF? THEN I WILL ACCEPT A MOTION TO
>> MOTION AND SECOND, ALL THOSE IN FAVOR SAY AYE TO ADJOURN.
WE , ANY OPPOSING SIGN ? THE MOTION PASSES AT 1:32 AND WE ARE ADJOURNED.
