YES. >> I DO HAVE FOR THE CLERK.

I AM TALLER THAN THE MICROPHONE RIGHT NOW.

>> YOU WANT SOMEONE TO PASS THAT OUT?

>> IF YOU COULD. I DO HAVE PACKETS.

AND I HAVE FIVE EXTRA IF YOU ALL NEED THEM.

>> THANK YOU. >> GOOD MORNING, JUDGE AND COMMISSIONERS. SOME OF YOU KNOW ME THROUGH PROFESSIONAL MEANS AND I LOOK FORWARD TO SEEING YOU IN THAT CAPACITY IN THE FUTURE. UNFORTUNATELY TODAY I'M HERE WITH MY WIFE AS A PRIVATE CITIZEN MAKING A FORMAL ASK TO THE COMMISSIONERS COURT. 57678 COUNTY ROAD 73, ROBSTOWN, TEXAS. I AM TY PAYNE AND MY WIFE IS REBECCA PAYNE. IT WAS PAID VIA LOAN AND CAUGHT FIRE DUE TO SHODDY ELECTRICAL WORK BY THE PREVIOUS OWNER.

EMERGENCY SERVICES RESPONDED AND THE HOME WAS A TOTAL LOSS.

MY FAMILY HAS DEALT WITH ISSUES YOU WILL FIND ON PAGE 3.

WE HOLD THE DEED TO THE PROPERTY AND AFTER FINDING AN ARCHITECT, WE CAN'T FINALIZE THE BILL BECAUSE STOPPED BY THE COUNTY.

A MONTH AGO, THE COUNTY ENGINEERING OFFICE, SAID THE PROPERTY WAS IN A FEMA FLOODWAY AND UNBUILDABLE WITHOUT A NO RISE CERTIFICATE. THAT E-MAIL ON PAGE 4.

PAGES 5 AND 6 ARE THE COUNTY USES TO MAP ITS ARGUMENT.

YOU VIEW IT, ZERO CHANGES FOR THE PROPERTY AND ZONING FOR THE AREA. I REQUESTED A LIST OF FIRMS FOR THE ACCOUNT TO DO THE WORK AND RECEIVED NO RESPONSE.

THE INFORMATION ON THIS NO RISE CERTIFICATE I RECEIVED FROM MY BUILDER IS THAT IT COULD TAKE OVER A YEAR AND 50,000 IN ORDER TO GET RECEIVED. HE ALSO NEVER HEARD OF THE CERTIFICATE NOR ANYONE LIVING DOWN THERE IN THIS A YEAR .THIS DELAY IN COST CREATES A UNDUE HARDSHIP.

DOESN'T MATTERS $500, $5,000 OR $50,000.

YOU REVIEW ITEMS 9 TO 12. NEW CONSTRUCTION AND IMPROVEMENTS IN THE AREA FOR THE LAST SIX MONTHS ALL FALL WITHIN THE SAME NO ENCROACHMENT CLAUSE IN THE ACTUAL ORDINANCE.

DOING THE RESEARCH I REVIEWED 5R8 4, SECTION D OF THE SAME FLOOD ORDINANCE. MONDAY, I REVIEWED IT AGAIN AND SECTION C 10C. IT MUST BE PROVIDED SAYING THAT BUILDING BELOW THE FLOOD ELEVATION IS AUTHORIZED.

WE ARE NOT TRYING TO BUILD BELOW THE FLOOD ELEVATION.

THE LAW IS POINTING FIRST FLOOR OF THE HOME THAT IS IN THE PACKET IS SIX FEET ABOVE THAT ELEVATION.

NO ATTEMPT WAS MADE BY THE COUNTY ENGINEER'S OFFICE TO LOOK AT HIS PLANS OR HIS STAFF. THERE SHOULD BE NO NEED FOR THIS NO RISE CERTIFICATE BECAUSE WE ARE NOT BUILDING BELOW THAT ELEVATION. OUR BUILDER SHOULD BE ABLE TO PROCEED WITH THE PERMIT. ARTICLE 4, D 2.

I AM ALLEGING ERROR BY THE COUNTY ENGINEER JUAN PIMENTHAL DUE TO HIS OFFICE AND FORMALLY REQUEST TO GET A DECISION FROM THE COUNTY'S COMMISSIONERS COURT.

I WAS GOING TO REQUEST A VARIANCE, BUT BASED ON MONDAY UNDER DELTA 10R, WE ARE REQUESTING TO ALLOW THE PERMITTING PROCESS TO PROCURE THE FLOOD ELEVATION CERTIFICATE.

I APPRECIATE THE TIME AND I KNOW RULES GOVERNING THE COURT DOES NOT ALLOW FOR AN IMMEDIATE ANSWER.

ALL FORMS ARE ON THE LAST PAGE AND ABLE TO TALK TO ANY OF YOU.

IF YOU NEED ME, I AM HEADED DOWN TO THE COUNTY ENGINEER'S OFFICE.

YOU MAY WANT TO CALL HIM. THANK YOU.

>> THANK YOU. >> SUSIE SALDANIA.

>> GOOD MORNING. I COME TO YOU BECAUSE YOU ARE GOING TO BE MAKING APPOINTMENTS VERY SOON.

>> STATE YOUR ADDRESS. >> SUSIE SALDANA, 4010 HACKLE, CORPUS CHRISTI, 74815. THANK YOU.

I AM COMING BEFORE YOU BECAUSE YOU WILL MAKE PORT APPOINTMENTS AND OTHER APPOINTMENTS AND I AM BEFORE THE CITY ALSO BECAUSE I AM CONCERNED WITH THE WAY APPOINTMENTS ARE DONE.

APPOINTMENTS ARE DONE NOT ON QUALIFICATIONS OF THE PEOPLE THAT I FEEL BUT MADE BY POLITICAL AFFILIATIONS AND POLITICAL APPOINTMENTS. I HAVE A BIG CONCERN ABOUT SOME OF THEM. MY BIGGEST CONCERN OF YOUR LATEST APPOINTMENTS THAT WAS DONE ON DECEMBER OF 2022.

[00:15:01]

YOUR APPLICATION LEAVES SOMETHING TO BE DESIRED.

ON YOUR APPLICATION, YOU LIST WHO IS YOUR IMMEDIATE FAMILY.

AND ACCORDING STATE LAW, WHICH YOUR COUNTY ATTORNEY SHOULD BE ABLE TO TELL YOU, A SISTER, A BROTHER IS CONSIDERED AN IMMEDIATE FAMILY. YOU MAY STRENGTHEN A DEFENSE NEGLECTS FROM THE STATE BUT YOU MAY NOT WEAKEN IT.

THAT IS WRONG. SO YOUR APPOINTMENT THERE IN ITSELF WAS WRONG APPOINTING THIS PARTICULAR COMMISSIONER AT THE TIME BECAUSE THERE WAS A RELATIONSHIP THERE OF A SISTER.

I WANT YOU TO TAKE A LOOK AT ONE OTHER THING THAT I WOULD LIKE FOR TO YOU TAKE A LOOK AT. I HAVE CONCERNS ABOUT A PARTICULAR COMMISSIONER ACTUALLY NOT BEING A RESIDENT OF NUECES COUNTY. AND ALL YOUR THINGS DEAL WITH NUECES COUNTY. IT IS OKAY FOR YOU TO DO THINGS WRONG OUTSIDE THE COUNTY AND YOU CAN BECOME A PORT COMMISSIONER.

THINK ABOUT THIS. I AM REQUESTING AND I KNOW YOU CAN'T ANSWER THAT YOU ASK FOR INFORMATION ON RESIDENCY OF ALL THE COMMISSIONERS THAT PROVIDE YOU WITH A RESIDENTIAL PLACE.

LET THEM GIVE YOU THEIR PASSPORT TO SHOW WHERE THEY ARE ACTUALLY HAVE A HOMESTEAD HOME. NOT IN NUECES, BUT IN A COUNTY NOT HERE. YOU HAVE SOME THINGS TO LOOK AT.

AND YOUR COUNTY ATTORNEY SHOULD BE ADVISING YOU ON THIS SHOULD ADVISE YOU OF THIS AND THE APPLICATION THAT DEALS WITH NUECES COUNTY. YOU APPOINT A PORT COMMISSIONER AND ANY TO ANY BOARD, IT SHOULD BE BASED ON THE WHOLE AREA.

NOT JUST NUECES COUNTY, BECAUSE OTHERWISE YOU CAN COMMIT MURDER IN NUECES COUNTY AND THEN COME TO CORPUS CHRISTI.

JUST TO MAKE A POINT. PLEASE TAKE THAT INTO CONSIDERATION, ESPECIALLY WHEN YOU HAVE ANOTHER BOARD MEMBER POSITION COMING UP. THANK YOU.

>> THANK YOU. KRISTEN COOK.

>> GOOD MORNING, CRESTON COOK, MORRIS HILL DRIVE.

EXECUTIVE DIRECTOR OF THE SOUTH MILITARY TASK FORCE.

THANK YOU, COMMISSIONERS AND THE COMMISSIONERS COURT FOR YOUR SERVICE TO THE COUNTY AND YOUR SUPPORT TO THE AREA MILITARY INSTALLATIONS. THE MISSION OF OUR TASK FORCE IS TO PROMOTE, PRESERVE AND PROTECT AREA MILITARY INSTALLATIONS.

WE WANT TO INCREASE THE AWEARNESS OF THE MILITARY AND ECONOMIC VALUE THESE FACILITIES HAVE IN OUR COMMUNITY.

THE MEMBERSHIP OF OUR TASK FORCE INCLUDE LEADERS IN BUSINESS, EDUCATION, INDUSTRY, MILITARY, GOVERNMENT, AND ELECTED OFFICIALS. WE PRIDE OURSELVES IN BEING NONPARTISAN. A DIVERSE GROUP FOCUSED ON PROMOTING AND SUPPORTING AREA MILITARY INSTALLATIONS.

WE REPRESENT IN TEXAS, WE HAVE 15 MAJOR MILITARY INSTALLATIONS.

THREE OF THESE 15 INSTALLATIONS ARE IN OUR COMMUNITY.

NAVAL AIR STATION CORPUS CHRISTI EMPLOYS 5,000 LOCAL CIVILIANS AND PROVIDE INITIAL TRAINING TO NEW PILOTS IN THE NAVY, U.S.

MARINE CROPS, U.S. NAVY. AND 50 TENANTS.

CORPUS CHRISTI WAS THE LARGEST HELICOPTER REPAIR FACILITY IN THE BOARD. PUBLIC OR PRIVATE.

AND IT IS THE LARGEST SINGLE EMPLOYER IN SOUTH TEXAS EMPLOYING OVER ,000 CIVIL YANLS. NAVAL AIR STATION KINGSVILLE.

AND WHEN OUR NAVY AIR CRAFT CAREER ARE DEPLOYED AROUND THE WORLD. THEY ARE CONSIDERED FOUR AND A HALF ACRES OF SOVEREIGN U.S. TERRITORIES AND HALF THE PILOTS TRAINED ARE HERE IN SOUTH TEXAS. WE ALSO REPRESENT AND SUPPORT U.S. COAST GUARD SECTOR CORPUS CHRISTI WHICH HAVE MANY MISSIONS INCLUDING PROTECTING THE PORT OF CORPUS CHRISTI AND HALF OF OUR TEXAS COASTLINE. LASTLY, WE SUPPORT THE PORT OF CORPUS CHRISTI THAT IS A STRATEGIC SUPPORT.

MANY MILITARY SHIPMENTS HAVE BEEN GOING IN AND OUT OF OUR PORT OF CORPUS CHRISTI AND THAT HELPS OUR LOCAL ECONOMY.

ALL OF THESE FACILITIES ARE CRITICAL TO OUR NATIONAL DEFENSE AND ECONOMIC VALUE OF OUR AREA. WE, AGAIN, APPRECIATE YOUR CONTINUED SUPPORT TO THE MILITARY TASK FORCE AND MISSION TO SUPPORT INSTALLATIONS. THANK YOU SO MUCH FOR YOUR TIME.

>> THANK YOU. KIMBERLY LISON.

>> I AM DR. KIMBERLY LEASON AND ACADEMIC FACULTY MEMBER OF THE CHRISTUS SPOHN RESIDENCY PROGRAM.

[00:20:02]

I RESIDE AT GREEN FWRIER DRIVE. DEAR NUECES COUNTY COMMISSIONERS, JUDGE SCOTT AND FRIENDS AND COMMUNITY, I STAND BEFORE YOU WITH IMMENSE GRATITUDE PACED ON THE EMERGENCY MEDICINE PROGRAM IN THE CORPUS CHRISTI COASTAL BEND.

OUR JOURNEY FOR THE RESIDENCY PROGRAM HAS BEEN ARDUOUS BUT YOUR UNWAVERING SUPPORT HAS BEEN A MATTER OF OUR SUCCESS.

THANK YOU SO MUCH. ENSURING QUALITY MEDICAL CARE FOR OUR COMMUNITY HAS NOT GONE UNNOTICED.

HARDSHIPS AND CHALLENGES, YOUR STEADFAST SUPPORT IS THE CORNERSTONE OF OUR SUCCESS OF THE EMERGENCY MEDICINE RESIDENCY PROGRAM. WE EXTEND OUR HEARTFELT THANKS OF THE WELLING OF THE PEOPLE WE LOVE AND SERVE.

I WOULD ALSO LIKE TO EXPRESS OUR SINCERE APPRECIATION TO THE NUECES COUNTY HOSPITAL DISTRICT. YOUR DILIGENCE IS NOT ONLY LISTENING TO OUR STORY BUT RESPONDING PROMPTLY IS INSTRUMENTAL. YOUR PARTNERSHIP OF THE EXPERT IN THE CORPUS CHRISTI LANDSCAPE. AS WE MOVE FORWARD, WE ARE EXCITED OF THE PROCESS OF CONTINUING EMERGENCY MEDICINE IN YOUR COMMUNITY. YOUR SUPPORT ENSURES THAT WE CAN PROVIDE HIGH QUALITY CARE TO THE RESIDENTS OF THE COASTAL BEND FOR MANY YEARS TO COME. TOGETHER, WE ARE BUILDING A FOUNDATION FOR A HEALTHIER, STRONGER COMMUNITY.

AND WE ARE GRATEFUL FOR THE OPPORTUNITY TO CONTRIBUTE TO THAT VISION. ON BEHALF OF MYSELF, MY COLLEAGUES, OUR FAMILIES, LOVED ONES, AND ALL THE RESIDENTS OF THE CORPUS CHRISTI COASTAL BEND. THANK YOU FOR YOUR CONTINUED SUPPORT AND YOUR COMMITMENT TO THE WELL BEING OF OUR COMMUNITY.

>> THANK YOU SHANY ITALIA. >> HELLO, JUDGE SCOTT AND COUNTY COMMISSIONERS. THANK YOU FOR ALLOWING ME TO SPEAK. SONNY ITALIA.

YOU HEARD A LOT FROM US THE LAST FEW WEEKS AND WE ARE GRATEFUL THAT YOU LISTENED. WHO KNEW WE WOULD ALL BE EXPERTS IN ADVOCACY. ONE THING SINCE THE DAY THIS ALL BEGAN THAT I KEPT THINKING ABOUT.

IT WAS TOLD THAT THE CLOSURE OF OUR PROGRAM HAD BEEN IN THE WORKS FOR MONTHS BUT BY DESIGN, WE HAVEN'T BEEN TOLD OF THAT SPECIFIC DAY AND COULDN'T FIGHT IT.

THAT STUCK WITH ME EVER SINCE. FIRST BECAUSE A VERY CLEAR MESSAGE. MESSAGE THAT SAVING US WAS IMPOSSIBLE. NO MATTER WHAT ANYONE DID OR SAID OUR DECISION WAS FINAL. OUR PRIDE AND HOPE SHATTERED WITH JUST ONE SENTENCE. MY MIND QUICKLY GOTO THE REAL ISSUE OF AN IMPOSSIBLE BATTLE.

WHAT WAS FORGOTTEN IN THAT MOMENT IS WE DO THE IMPOSSIBLE EVERY SINGLE DAY. OUR E.R. IS A PLACE WHERE IMPOSSIBLE BECOME THE POSSIBLE. WE BRING PEOPLE BACK FROM THE DEAD. YOU TAKE 50 FROM US TO DO THAT.

WE HAVE LITTLE EXPERIENCE DOING THAT OUTSIDE OF OUR DAY JOB.

WHERE YOU STEPPED IN, CITY COUNCIL, ALL OF THE YOU IN THE COMMISSIONERS COURT. WITH YOUR UNBLISTERING GUIDANCE, YOU LEARNED HOW TO MANGE THE IMPOSSIBLE, POSSIBLE.

AND JUDGE SCOTT, WITH YOUR PERSEVERANCE, SO MUCH SO THAT SPOHN IS NOW WILLING TO HELP US MAKE THIS POP.

THE LAST TIME WE MET, I SAID THE FIRST BATTLE SAVING QUALITY EMERGENCY CARE IN THE COASTAL BEND.

THE NEXT IS TO ENSURE IT. FIRST AGREEMENT PUT A DEADLINE AND THE WELL BEING OF OUR COMMUNITY ANDS THAT SAY HOW HE WE STOOD AGAINST IT. YOU DID TOO.

THIS NEW AGREEMENT THAT QUALITY EMERGENCY CARE WILL NOT BE LOST IN THE FUTURE AND THE REAL BATTLE, FINAL BATTLE AND THIS CLOSE TO WINNING IT TOGETHER. SO THANK YOU.

IF IF THANK YOU, THANK YOU. WE APPRECIATE IT.

CRAIG PETERSON. >> I WILL TAKE THIS OUT.

CRAIG PETERSON. CORE FACULTY WITH THE RESIDENCY PROGRAM. I LIVE ON GYPSY STREET OUT ON THE ISLAND. I WANT TO THANK JUDGE SCOTT AND COMMISSIONERS COURT FOR ALLOWING ME TO SPEAK.

SIX WEEKS AGO WHEN THE ANNOUNCEMENT TO CLOSE THE PROGRAM. I WAS DEVASTATED.

CONCERN OF THE FUTURE OF THE PROING, RESIDENTS AND THEIR TRAINING AND FAMILIES AND CAREERS HAVE BEEN ALL CONSUMING.

MOST OF OUR FREE TIME NOT ON SHIFT IN THE E.R. BUT OUR EFFORTS TO WERE HE SERVE THE PROING.

ATTENDING CITY COUNCIL MEETINGS, KOMGZ COMMISSIONER, NCH MEETINGS, WHILE THE CLOSURE WAS THE LARGEST MOST IMMEDIATE THREAT, BUT FAR THAN THE ONLY ISSUE OF CONCERN FOR OUR COMMUNION. ONE OF MANY ISSUES YOU MUST

[00:25:01]

CONSIDER BEST TO SERVE THE PEOPLE OF NUECES COUNTY.

WITH THAT NEW PERSPECTIVE COMBINED, I CANNOT EMPHASIZE HOW GRATEFUL I AM AND HOW WE ARE FOR THE CAREFUL TIME AND ATTENTION OF OUR CAUSE OF PRESERVING THE PROGRAM.

YOU HAVE TRULY GONE ABOVE AND BEYOND CONVENING SPECIAL COMMITTEES AND SESSIONS TO WORK WITH US AND ON OUR BEHALF.

I WANT TO EXPRESS SINCERE THANKS TO JUDGE SCOTT, THE COMMISSIONERS COURT, COMMITTEE MEMBERS, THE HDC BOARD AND SPOHN THAT WENT INTO THIS SET OF TERMS. WILL HAVE FULL RECRUITING CLASSES FOR THE NEXT SECRETARIES YEARS, LOGISTICAL AND ADMINISTRATIVE REQUIREMENTS.

AND MOST IMPORTANTLY WILL SECURE FAITH IN THE PEACE OF MIND FOR FACULTY AND RESIDENT PHYSICIANS. THIS WILL ALLOW FOR EXCELLENT EMERGENCY CARE TO THOSE IN OUR COMMUNITY SPECIFICALLY THE MOST VULNERABLE IN OUR COMMUNITY. THOSE SUPPORTED BY NUECES COUNTY HOSPITAL DISTRICT. THOSE THAT HAVE FALLEN INTO THE INDIGENT CATEGORY. FURTHER, THE NUECES COUNTY HOSPITAL DISTRICT AND COUNTY COMMISSIONERS WILL HAVE THE ABILITY TO PRESERVE AND PROTECT THE RESIDENCY OF THE FUTURE.

IT WILL REMAIN WITHIN THE CORPUS CHRISTI COMMUNITY WITHOUT SOLE ALLIANCE OF ANY ONE INSTITUTION. I BELIEVE WITH THESE SPECULATIONS IN PLACE, THE PROGRAM FOR THE RESIDENTS AND THE COMMUNITY WILL BE A SUCCESS FOR YEARS TO COME.

THANK YOU. >> THANK YOU.

AL ARIOLA. >> JUDGE SCOTT, MEMBERS OF THE COMMISSION. AL ARIOLA.

I'M HERE REPRESENTING THE CORPUS CHRISTI CHAMBER OF COMMERCE ON BEHALF OF OUR BOARD OF DIRECTORS AND 1,000-PLUS MEMBERS.

WE ARE HERE TO THANK YOU FOR YOUR INVESTMENT AND SUPPORT INTO OUR WINDSTORM INSURANCE REFORM EFFORTS.

LET'S SEE HERE. YOUR COMETMENT TO THIS CRUCIAL CAUSE DEMONSTRATES OUR DEDICATION TO THE COMMUNITY'S WELL BEING AND RESILIENCE. SUPPORT IN THE EFFORTS FOR ADVOCATING FOR WINDSTORM PREFORM OF THE CHALLENGES OUR REGION FACES AND SECURE AN APPROACH FOR A BETTER FUTURE.

YOUR INVESTMENT DOES NOT GO UNNOTICED.

WE ARISM MENIALLY GRATEFUL FOR THIS CRITICAL INITIATIVE.

WE ARE STRIVING FOR A CAREER FOR THE REGION.

AND IF YOU GUYS RECALL, MIDYEAR, TWIA WAS CONSIDERING A RATE HIKE. WE DID MOBILIZE OUR MEMBERSHIP.

DID MOBILIZE GRASS-ROOTS EFFORT TO LOBBY THE BOARD -- THE TWIA BOARD -- TO NOT MAKE THAT DECISION.

I WOULD SAY AS PART OF THAT EFFORT TO MAKE SURE THAT THE WINDSTORM INSURANCE RATE DOES NO GO UP IN THE 2022.

THANK YOU FOR YOUR INVESTMENT AND THANK YOU FOR YOUR LEAD LEADERSHIP.

>> THANK YOU. ANYONE HERE WHO DIDN'T HAVE AN OPPORTUNITY TO SIGN UP IN PUBLIC COMMENT WHO WISHES TO SPEAK? IF YOU STATE YOUR NAME AND ADDRESS AND COME UP.

[1. Receive update from Nueces County Hospital District relating to the Emergency Medicine Residency Program operated by CHRISTUS Spohn Health System Corporation; and related matters.]

I WANT TO MOVE INTO THE REGULAR AGENDA ON 3-A-1 BECAUSE THE DOCTORS ARE HERE TO GET THEM OUT SO THEY CAN GO BACK TO WORK.

[00:30:03]

WE APPRECIATE YOU BEING HERE BUT WE UNDERSTAND YOU HAVE INVEST BUSY, IMPORTANT JOBS YOU NEED TO GET BACK TO.

PEOPLE MIGHT BE WAITING FOR YOU. 3-A-1, RECEIVE AN UPDATE FROM THE HOSPITAL DISTRICT RELATING TO THE EMERGENCY MEDICAL RESIDENCY PROGRAM BY CHRISTUS SPOHN HEALTH SYSTEM AND JOHNNY HIPP IS HERE TO GIVE US THAT PRESEN

PRESENTATION. >> GOOD MORNING, JUDGE AND COMMISSIONERS. TERESA IS PASSING OUT A VERSION OF THE TERM SHEET WE DISCUSSED WITH THE JUDGE HE IS COMM-- THE JUDGE'S COMMITTEE. THE ORIGINAL IS THE ONE FROM A

COUPLE OF WEEKS AGO. >> NO THE CURRENT ONE, YES.

>> THIS ONE HAS A CATEGORY IN THE TOP LEFT CORNER 11/27 AND DIFFERS FROM THE ORIGINAL ONE DIRECTED ON 11/13.

COMMISSIONERS, JUST TO SUMMARIZE THIS TERM SHEET REFLECTS THE TERMS THAT THE HOSPITAL DISTRICT HAS REACHED WITH SPOHN AS OF YESTERDAY EXCUSE ME, I'M LOSING MY VOICE.

TWEAKS OF FEDERAL REGULATIONS TO GOVERN PHYSICIAN PAY AND OTHER THINGS THAT NEEDED TO BE INCLUDED IN THERE.

ALSO I WILL MAKE A CHANGE OF HOW OFTEN THE HOSPITAL DISTRICT PAYS AT 1/12 AND WE WILL BE PLAYING QUARTERLY AND STUFF AND HOW THAT WORKS. JUST TO SUM OF RISE, THE AGREEMENT IS THE FRAMEWORK FOR THESE BULLET POINTS AND THE FRAMEWORK OF AN AGREEMENT THAT WILL FOLLOW.

A FORMAL AGREEMENT THAT WILL HAVE THE LAWYER AND THINGS INCLUDED IN IT AND THOSE KIND OF THINGS.

THE TERMS OF THIS TERM SHEET IS PRETTY BASIC.

THE HOSPITAL DISTRICT WILL STEP UP WITH FUNDING.

THE SIXTH YEAR WAS ADDED AFTER WE HAD WORKED ON IT A LITTLE BIT LONGER AND THE HOSPITAL DISTRICT IN THE FIRST TWO TO ARE THREE YEARS PROVIDE STEPPED-UP FUNDING OF HOW THE PROGRAM WILL UNWIND AND STEP IN AND FUND THAT. IT ALSO INCLUDES SOME SAFEGUARDS FOR THE FACULTY AND PHYSICIANS THAT THEY WILL BE GETTING MARKET PAY WHILE THEY ARE THERE HOSPITAL SPOHN WILL MAINTAIN SUPPORT THAT THEY NEED. SUPPORT THEY NEED TO RUN THE PROGRAM AND SUPPLIES AND THINGS THEY NEED TO KEEP IT GOING.

SO WITHOUT GOING INTO A LOT OF OTHER DETAILS, WHAT I WILL TELL YOU THAT THE SIX-YEAR AGREEMENT BUYS TIME.

IT IS NOT A PERMANENT SOLUTION. SO THESE SIX YEARS WILL ALLOW US TO WORK THROUGH -- HOPEFULLY FASTER THAN THAT -- A MORE PERMANENT SOLUTION FOR THE PROGRAM.

REALLY A QUESTION OF TWO THINGS. ONE HAVING LONG-TERM FUNDING SET ASIDE FOR IT. AND TWO, MAKING SURE WE HAVE A FACILITY IN CORPORATE. A TEACHING FACILITY, A HOSPITAL THAT WILL DETERMINE THE PROGRAM. THIS AGREEMENT BUYS US SIX YEARS. I CHARACTERIZE IT AS TIME -- IT DOES BUY US TIME THAT WE WILL HAVE AN OPPORTUNITY TO WORK ON THINGS THAT ARE MUCH MOTHER IMPROVED AS WE GO THROUGH TIME.

TO WORK THROUGH THOSE AS EX-PETITION DISHTIOUSLY AS WE CAN. THE HOSPITAL DISTRICT BOARD WILL MEET ON FRIDAY DECEMBER 13 TO LOOK AT THIS VERSION.

IF YOU WANT TO ATTEND, MAKE COMMENTS TO THE WORD.

THEY HAVE BEEN APPRISED OF THE AGREEMENT.

WE NEED TO GO THROUGH IT IN A LITTLE MORE DETAIL TO ANSWER A COUPLE OF QUESTIONS THAT CAME UP I LONG THE WAY SINCE YESTERDAY THAT I NEED TO MAKE SURE TO GET THEM ADDRESSED IN SUMMARY THAT

IS WHERE WE ARE. >> TO WE ANY THESE CHANGES WILL IMPACT AT ALL THE DOCTORS IMPACTED BY THIS?

>> NO, I DON'T. THERE WAS A PROVISION IN THE LAST AGREEMENT THAT THE DOCTORS WILL GET PAY.

AND REGULATIONS NEED TO BE STATED IN THERE WHERE IT SAYS MARKET-BASED PAY. IT WILL BE SOMETHING TO THE AFFECT AS DETERMINED BY STARK LAW.

A FEDERAL LAW THAT GOVERNS, LIKE I SAID, PAYMENTS BACK AND FORTH

[00:35:03]

BETWEEN PHYSICIANS AND HOSPITALS.

THE OTHER ONES WERE ONE WHERE THE HOSPITAL DISTRICT MAKES PAYMENTS QUARTERLY INSTEAD OF EVERY MONTH.

AND THEN THERE WAS ANOTHER PROVISION HOW THE AGREEMENT WOULD TERMINATE AND WE PUT A SAFEGUARD IN THERE THAT SAYS THAT SPOHN CAN'T TERMINATE THE AGREEMENT WITHOUT THE HOSPITAL DISTRICT. WE DON'T GET IN A SITUATION WHERE WE HAVE NOW WHERE THE THINKING TO AN END.

IT WAS ONE OF THE EARLIER PHYSICIANS MENTIONED.

NO TIME TO REACT AND STUFF. AND SO I THINK IF WE DO COME TO A SITUATION WHERE SPOHN DESIRES TO TERMINATE THE AGREEMENT, THEN WHAT OUR DUTY IS TO MAKE SURE THERE IS ANOTHER PLACE IN THE COMMUNITY WHERE THE PROGRAM IS ACCOMMODATED AND WE COULD CONSIDER AGREEING TO IT AT THE END.

WE PUT A SAFEGUARD COULDN'T UNILATERALLY SAFEGUARD IT WITHOUT OUR CONSENT AND TO MAKE IT HAPPEN AND PLANS THAT THE PROGRAM WAS ACCOMMODATED IN THE COMMUNITY.

>> THIS PROVIDES FOR STABILITY THAT THE DOCTORS AND ALL OF US IN THE COMMUNITY HAVE BEEN ASKING FOR?

>> IT WILL, YES. >> TO ENSURE AT LEAST -- LIKE YOU SAID, AT LEAST UP TO THE SIX YEARS OR SOONER IF THERE WAS A SYSTEMIC CHANGE THAT NEEDED TO BE MADE.

EVERYONE WILL BE BASICALLY INVOLVED INCLUDED AND SAFEGUARDS

TO BE INCLUDED IN THAT. >> YES, COMMISSIONER.

SOME OF THE COMMENTS YOU ALL MADE YESTERDAY.

IT STEMS TO THE POSSIBILITY THAT WE WILL HAVE AN EXODUS OF 52 OR 60 SOMETHING JOBS IN THE COMMUNITY THAT WILL LEAVE THE EMERGENCY MEDICINE PROGRAM. IT IS A CRITICAL PIECE TO THE HOSPITAL DISTRICT'S INDIGENT CARE PROGRAM BECAUSE A LOT OF OUR INDIG GENTS STILL SEEK CARE IN OUR EMERGENCY ROOM AND TYPICALLY THOSE PATIENTS ARE -- LIKE ALL PATIENTS THAT COME TO A HOSPITAL, THEY MAY OR MAY NOT BE SUBJECT TO TEACHING PHYSICIANS, BUT THE TEACHING PROGRAM IN TERMS OF FAMILY PRACTICE IS SORT OF THE BACKBONE WITH OUR INDIGENT CARE PROGRAM.

AND WITH THE EMERGENCY ROOM, IT BECOMES THE EMERGENCY RESIDENCE.

I HAVE A COUPLE OF QUICK QUESTIONS.

MY FIRST QUESTION IS, DID SPOHN NOT ALREADY PLAY MARKET-BASED PAY TO THEIR PHYSICIANS? DO WE KNOW THAT?

>> JUDGE, I DON'T KNOW THAT. I NEVER INQUIRED TO INVESTIGATE THAT, BUT A REASONABLE REQUEST, YES.

>> NUMBER TWO, TO CLARIFY SOMEBODY LISTENING IN.

WILL THIS FINANCIAL FROM FROM THE HOSPITAL DISTRICT HINDER YOU FOR EVERYTHING THAT YOU ARE DO FOR THE INDIGENT CARE ON A

DAY-TO-DAY BASIS. >> JUDGE, YOU KNOW THE HOSPITAL DISTRICT HAVE LARGE RESERVES AND WE KEEP THEM THERE TO MAKE SURE THAT THE INDIGENT IS TAKEN CARE OF IN YOUR COMMUNITY.

I WILL TELL YOU WHEN I COME TO YOU NEXT YEAR AND TALK ABOUT THE BUDGET, I DON'T WANT YOU TO GET AMNESIA ABOUT WHAT HAPPENED.

NOT THAT Y'ALL DO, BUT REMIND THAT YOU MY BOARD WILL EXPECT TO HAVE THAT TFRGS WITH YOU WITH ALL WHEN WE HAVE THE BUDGET.

THE HOSPITAL DISTRICT'S PAYMENTS UNDER IN AGREEMENT WILL START FLOWING IN JULY. IT REFERS TO ACADEMIC JEERS IN THERE JULY 1 THROUGH JUNE 30. THAT DATE IN THERE IN THE AGREEMENT TOO ANYWAY, THEY WILL TALK TO ME OF THE TERMS OF THE AGREEMENT. THE NEXT QUESTION, JOHNNY, HOW ARE WE GOING TO PAY FOR IT? WE WILL PAY FOR IT OUT OF THE RESERVES BUT THEY WANT US TO HAVE A CONVERSATION GOING

FORWARD. >> I FELT THAT THE PUBLIC NEEDED TO HEAR THAT. THE COMMITMENT YOU ARE MAKING TO OUR COMMUNITY AND I FWREESH BRIGHT VERY MUCH.

>> 2,250,000 FOR TWO YEARS. >> I HAVE SOMETHING TO SAY,

JUDGE. >> YES, GO AHEAD.

>> I REALLY WOULD LIKE TO SUPPORT THE RESIDENCY PROGRAM.

MEDICAL EMERGENCY AND ALL THAT. I AM CONCERNED OF THE $21 MILLION. I AM VERY CONCERNED THE FACT THAT WE HAVE DAIKON AWAY FROM INI DID INDEPENDENT CARE NOW IF WE NEED IT. AND SOME OF THIS INDIGENT CARE DON'T HAVE MONEY TO PAY SPECIALISTS.

I ALWAYS WANTED TO SEE WHAT WAS THE SECOND -- SECOND RESIDENCY THAT SPOHN WILL COME TO THE TABLE WITH.

[00:40:02]

AND WE NEVER KNEW WHAT IT WAS, RIGHT? BECAUSE WE TOOK A DIFFERENT COLLECTION.

I DON'T THINK THAT THE HOSPITAL DISTRICT SHOULD BE SPENDING IS $21 FROM THE RESERVE TO PAY FOR SALARIES THAT ARE ALREADY THERE.

TO PAY FOR SALARIES WHERE ALL ALONG SOMEBODY HAS BEEN SAYING AND THE COUNTY ATTORNEY CAN BACK THIS UP.

WE ARE NOT IN THE BUSINESS OF MEDICAL.

WE ARE NOT IN THE BUSINESS OF PAYING PEOPLE TO PROVIDE MEDICAL. WE ARE NOT IN THE BUSINESS.

YOU KNOW I HEARD THIS FOR ABOUT SIX MONTHS ALREADY, YOU NKNOW YT WE ARE PAYING $21 MILLION SO SOMEBODY ELSE CAN PROVIDE MEDICAL. I DON'T KNOW WHAT THE DIFFERENCE WILL BE BETWEEN A NONPROFIT AGENCY DOING MEDICAL AND US PAYING THEM TO DO MEDICAL AND US PAYING THE DOCTORS TO DO MEDICAL. WHAT -- WHAT ARE THE RIGHTS THAT WE ARE DOING HERE WHAT IS THE LEGAL ISSUES THAT WE HAVE.

PRESIDENTRESS DEN SEE PROGRAM IS GOOD.

DO WE KNOW SPOHN. >> CAN I BACK UP AND GET TO OUR OTHER QUESTIONS BEFORE I GET TO THAT ONE.

IN THE AGREEMENT, IF SPOHN GETS FUNDING OTHERWISE -- FUNDING OTHER THAN US THAT THEY GET TO OFFSET WHAT WE PAY.

THERE ARE PROGRAMS AND THE EASIEST ONE I COULD CITE WAS THE HIGHER EDUCATION COORDINATING BOARD OF NEW RESIDENCY PROGRAMS AND EXISTING RESIDENCY PROGRAMS. THERE IS CERTAINLY A PART OF OUR CONVERSATION WITH SPOHN THAT THEY WILL WORK TO SEEK OTHER FUNDING OF THE OFFSET OF WHAT THE HOSPITAL DISTRICT PAYS.

THE FULL POINT. THE FULL AMOUNT AND VALUES IN YEARS THREE AND THE YEARS THAT FOLLOW THAT ARE ESSENTIALLY FUNCTION OF SPOHN'S DIRECT COST FOR -- FOR FUNDING THE EMERGENCY MEDICINE PROGRAM. AND I SAY "DIRECT" BECAUSE THE HOSPITAL INCURS DIRECT AND INDIRECT COST.

SO OUR BASIS FOR CONVERSATION WITH SPOHN DEALT SOLELY WITH REIMBURSING THEM FOR DIRECT COST.

I WILL BE CANDID WITH YOU, THE 4 $4.5 MILLION, WHEN WE TALKED TO THEM IS BELOW WHAT I EXPECTED. OUR RESEARCH INDICATED THAT FOR THIS KIND OF PROGRAM THIS SEIZE, ETC.

THAT DIRECT COST FOR THOSE INSTITUTIONS IS AROUND $5.2 MILLION EACH YEAR. WHAT IS LEFT FOR SFONZ PAY ARE THE INDIRECT COSTS BECAUSE THEY INCUR KIND OF COSTS PROVIDING CLASSROOMS AND MAKING SURE THAT FACULTY GETS PAID.

OTHER KIND OF OTHER COST AND STUFF THEY INCUR OUTSIDE OF WHAT WE AGREE TO. SO WHAT I AM SEEING, COMMISSIONERS, IN THIS DEAL, THERE IS AN OFFSET FOR SPOHN TO GET ANY ADDITIONAL PAYMENTS, THEY OFFSET WHAT WE PAY TO THEM.

THERE IS ALSO THE COST OF DIRECT COST IS LESS THAN WHAT OUR EXPERIENCE IS AND EVALUATE. IN BOTH CASES.

AND THAT ISSUE IS ONE THAT WAS AN IMPORTANT ONE TO THE COMMISSIONERS COURT. I THINK ADOPTED A COUPLE OF RESOLUTIONS ALONG THE WAY IN SUPPORT OF THE PROGRAM.

AND I BELIEVE THE HOSPITAL DISTRICT BOARD'S COMMISSIONERS REACTED TO THOSE AND DIRECTED ME IN TRYING TO FIND A SOLUTION.

I THINK THE FIRST ONE GOT CLOSE, BUT DIDN'T GET CLOSE ENOUGH AND ADDED A SIX YEAR TO THE AGREEMENT AND SPOHN AGREED.

COMMISSIONERS, I GUESS A LOT OF DIFFERENT WAYS YOU CAN LOOK AT THIS WE RESPONDED THAT THIS WAS AN IMPORTANT MATTER TO THE COMMUNITY. AND AT THE SAME TIME, BUILD SAFEGUARDS IF THERE IS ANY OTHER FUNDING THAT CAME ALONG THAT WE DIDN'T HAVE TO PAY IT. AND THE AMOUNT WE NEGOTIATED WITH THEM IS FAR LESS THAN WHAT OTHER PEOPLE HAVE PAY FOR DIRECT

COSTS. >> YOU KNOW, I JUST -- YOU MAKE TWO POINTS RIGHT NOW OF COMING BACK TO THE COMMISSIONERS COURT.

YOU KNOW -- YOU ALWAYS SAY NO TO RAISING TAXES.

I DON'T CARE WHAT IT IS, THEY WILL SAY NO TO NO TAX.

WILL COME BACK NEXT YEAR AND SAY WE HAVE TO RAISE TAX TO REPLACE SOME OF THE MONIES YOU ARE USING RIGHT NOW.

WHEN WE -- WHEN WE DO THE RESOLUTION, WE DIDN'T KNOW ABOUT THE $21 MILLION. AT LEAST I DIDN'T KNOW ABOUT IT.

THIS CAME -- CAME AFTER THE RESOLUTION, YOU KNOW.

[00:45:04]

AT LEAST I DIDN'T KNOW THAT THERE WAS $21 MILLION.

>> I THINK THAT WAS WAY FOR THE DISCUSSIONS.

NO ONE KNEW ABOUT THE $21 MILLION AT THAT TIME.

>> THAT'S WHAT I AM SAYING. THE RESOLUTION -- I WAS IN FAVOR OF THE WHOLE RESOLUTION BECAUSE WE WERE -- WE WANT TO KEEP THE RESIDENCY. KEEP THE E. FRCHLDS.

BUT SOMETIMES, I WONDER, IS IT CHEAPER TO HIRE DOCTORS DOING THE E.R. EMERGENCY REGULARS DEN SEE? I DON'T KNOW. I DON'T THINK THOSE ARE THE THINGS. THEY WEREN'T BEEN ANSWERED YESTERDAY. VERSUS ONE AFTER THE OTHER.

I AM CONCERNED COUNTY THE $21 MILLION THAT WE -- THAT WE DELETE FROM THE INDIGENT CARE RESERVE FUNDS IN CASE SOMETHING DOES HAPPEN. AND IF WE HAVE THAT KIND OF MONEY, THEN WHY DON'T WE HAVE -- WHY DON'T WE SUBSIDIZE SOME OF THOSE INDIGENT CARE PEOPLE WHO EXPECT AFFORD SPECIALIST.

WHAT ARE WE PAYING FOR THOSE? HOW COME WE ARE NOT HELPING THEM TO GO TO THE HOSPITAL AND GET SURGERY THAT THEY DON'T HAVE -- I AM NOT SAYING THEY ARE GOING TO DO IT FOR FREE EITHER.

WHY DON'T WE DO THAT NOW THAT WE ARE GIVING SO MUCH MONEY AWAY, WHY DON'T WE LOOK AT SOMETHING ELSE OF HELPING THE INDIGENT.

>> COMMISSIONER, THERE WAS SOME SENSE OF IMMEDIACY WHEN THIS WAS BROUGHT UP. THERE WERE, I THINK, A TIMELINE OF THE RESIDENTS NEED TO GET A CLASS FILLED.

THEY MAY BE A LITTLE BEHIND ALREADY MAKING SURE THEIR CLASSES WERE FILLED. WE DIDN'T HAVE ANY NOTICE EITHER. THIS GOT DROPPED ON US THE SAME TIME IT GOT DROPPED ON EVERY EVERYBODY. WE BELIEVE THIS AGREEMENT IS ONE THAT BUYS OUR TIME AND GIVE US A LOOK BACK TO SEE IF THERE IS SOME OTHER WAY TO DO THIS. GIVEN THE CIRCUMSTANCES WE HAVE IN FRONT OF US THE THING THAT NEEDS TO HAPPEN QUICKLY THAT WE NEEDED TO RESPOND, THE FACULTY NEEDED SOME RESPONSES TO RESIDENTS THAT APPLIED FOR THE PROGRAM NEEDED SOME RESPONSES.

COMMISSIONER, WHEN YOU HAVE KIND OF CIRCUMSTANCES 234 FRONT OF YOU AND ISSUES I CONFRONTED TRYING TO CAUSE SPOHN TO BACK

AWAY FROM THIS TOOK DOLLARS. >> ALWAYS TAKES DOLLARS

UNFORTUNATELY. >> YES, SIR.

>> AND THE OTHER THING AND JUDGE MENTIONED IT TOO.

MAKE SURE WE ARE NOT PAYING PEOPLE TWICE OR SUPPLEMENTED FROM SPOHN AND THE HOSPITAL DISTRICT.

HOW DO WE FIND OUT AND HOW DO WE KNOW THAT?

>> THAT IS PROBABLY ONE OF THE WEAKNESSES OF THIS ARRANGEMENT, COMMISSIONER IS THAT -- WE HAVE AN ARRANGEMENT WITH SPOHN TO PROVIDE THEIR INDIGENT CARE. COULD BE SAID THAT WE ARE PAYING FOR IT TWICE. IN THIS CASE, THE EMERGENCY MEDICINE PROGRAM IN ADDITION TO CARE THE INDIGENT REPRESENTED A SITUATION IN THE COMMUNITY. PEOPLE IN THE COMMUNITY BROUGHT UP NOT HAVING THE RESIDENTS AVAILABLE.

IT AFFECTS INDUSTRY. EVEN THOUGH I CHARACTERIZE THIS AS BEING ONE THAT MAKES SURE OUR INDIGENTS WERE TAKEN CARE OF.

HAVING THE EMERGENCY MEDICINE PROGRAM ALSO HAVE OTHER BENEFITS. THEY ARE NOT ALL HOURS.

SO WE TRIED TO FACTOR, COMMISSIONERS, ALL THOSE THINGS IN -- TO OUR -- TO OUR DECISION, BUT I WOULD GO BACK AND JUST HIGHLIGHT AGAIN THAT WE WERE WORKING UNDER A VERY SHORT TIMELINE. WE HAD A SITUATION THAT NONE OF US HAD ADVANCED WARNING ABOUT EVEN IN MY REGULAR MEETINGS WITH SPOHN. NEVER MENTIONED THAT THEY WERE CONTEMPLATING DOING THIS. SO I THINK, COMMISSIONER, IT -- IT TOOK SOME MONEY TO GET IT DONE.

AND WE MAY NOT REALIZE THE FULL SIX YEARS OF IT.

THERE MAY BE SOMETHING THAT COMES ALONG.

BUT WHAT WE HAVE DONE IS BOUGHT A PERIOD OF TIME WHERE WE CAN THE CITY BACK AND LOOK AT ALL THE ISSUES.

YOU JUST MENTIONED THAT YOU ENUMERATED THAT NEED TO BE LOOKED AT. I CAN ALMOST GUARANTEE YOU THAT IF YOU LOOK BACK -- BACKWARDS, OUR HINDSIGHT WILL BE 2020 BUT WE DIDN'T HAVE IS THE BENEFIT OF HINDSIGHT.

HERE. WE NEEDED TO MOVE QUICKLY AND RESPOND. THAT'S WHAT WE DID.

>> HOW SOON CAN WE DO THAT NOW? >> COMMISSIONER, $20 MILLION, SOMEWHERE BETWEEN 17% TO 20% OF OUR CASH RESERVES.

WON'T ALL GO OUT IN ONE YEAR. BUT IT WILL HAVE -- IT WILL HAVE

AN IMPACT. >> THE NEXT QUESTION I HAVE.

THIS IS REALLY -- I HAVE BEEN THINKING A LOT ABOUT THIS.

[00:50:01]

BOTHERS ME A LOT THAT WE ALWAYS FIND REASON NOT TO DO THINGS WHEN IT COMES TO INDIGENT, HELPING THE POOR SOMETIMES, AND -- WE JOIN THE -- JOIN THE FRONT LINES AND PAY SALARIES AND EVERYTHING ELSE -- I DON'T THINK YOU SHOULD HAVE GOT INVOLVED IN THAT. YOUR AGREEMENT WITH SPOHN WAS TWO RESIDENCIES. YOU DIDN'T SAY WHICH ONE.

THE FAMILY MANAGEMENT WAS -- IT IS -- IT HAS -- FAMILY MEDICINE.

THAT WAS -- THAT WAS A HAVE TO DO THING.

BUT THE OTHER ONE WAS CHOSEN BY SPOHN TO DO THE MEDICAL EMERGENCY E.R. NOT THE HOSPITAL DISTRICT.

IT CAME FROM THEM IN ORDER TO GET RID OF IT.

THEY HAD TO COME UP WITH ANOTHER ONE, YOU KNOW.

AND I ALWAYS WONDERED WHAT THE OTHER ONE WILL BE.

IT WILL BE SPECIALTY DOCTORS. WILL IT BE PRIMARY DOCTORS? SOMETHING THAT -- SOMETHING THAT PEOPLE WHO STAY HERE WILL GET THEIR OWN PATIENT HERE, STAY HERE.

BECAUSE THAT -- THAT IS ANOTHER CONCERN THAT I HAVE IS DO Y'ALL HAVE -- DO YOU HAVE SOME KIND OF A CLAUSE IF YOU FINISH THE RESIDENCY YOU HAVE TO STAY HERE TWO YEARS IN THIS COUNTY?

>> WELL, COMMISSIONER, I WILL PUT THAT ON THE LIST.

I EXPECT ANSWER THAT QUESTION RIGHT NOW.

BUT I THINK IF THERE IS AN OPPORTUNITY, WE WILL MAKE SURE WE WORK ON SOMETHING LIKE THAT. IN THE LIST THAT I PASSED OUT TO YOU, IF YOU LOOK AT PARAGRAPH 7, TALKED ABOUT US AND SPOHN CONDUCTING THE COMMUNITY'S NEEDS ASSESSMENT IN TERMS OF WHAT IS NEEDED IN THE COMMUNITY. SO IF IT BECOMES THAT THE EMERGENCY MEDICINE PROGRAM DOESN'T STAY WITH SPOHN.

IT GOES SOMEWHERE ELSE SO THERE WILL BE A SITUATION WHERE THERE WON'T BE A SECOND RESIDENCY THERE.

IT IS OUR INTENT THAT THAT PARAGRAPH 7 WOULD BE USED TO DETERMINE -- HELP DETERMINE WHAT A SECOND RESIDENCY PROGRAM OR EVEN A THIRD RESIDENCY PROGRAM WOULD NEED TO BE AT SPOHN.

I AGREE WITH YOU, COMMISSIONERS, AND I THINK EVERYONE IN THE ROOM IS BEGINNING TO EXPERIENCE ISSUES RIGHT NOW WHERE IT IS HARD TO ACCESS PHYSICIANS. EITHER THEY ARE RETIRING OR THEY ARE LEAVING TOWN OR NOT ENOUGH OF THEM.

THERE IS A SERIES OF ISSUES THAT ARE OUT THERE CONFRONTING ALL OF US. CITIZENS OF THE COMMUNITY AND PAR GRAPH 7 IS IN THERE SO THAT WE ESSENTIALLY GET A LIST OF PRIORITY MEDICAL SPECIALTIES THAT NEED TO BE ADDED BACK TO THE COMMUNITY. AND SO WE HAVE THIS SIX-YEAR PERIOD, WE CAN BEGIN TO FORMULATE HOW THAT MIGHT WORK.

NOW COMMISSIONER, I WILL SAY THAT THERE IS ALSO SOME -- SOME MOVEMENT. THERE IS SORT OF A VERY EARLY MEETING I HAVE WITH I AND SOME MEMBERS OF MY BOARD HAVE WITH CITY MANAGERS SANONI TOMORROW TO TALK HOW WE CAN USE AVAILABLE FUNDS THAT THE CITY HAS FOR HELP RETAIN PHYSICIANS OR DRAW PHYSICIANS TO THE COMMUNITY. THE OFFICIAL CONVERSATION PIECE TOMORROW IS JUST -- IT IS A VERY EARLY, VERY PRELIMINARY WITHOUT A FRAMEWORK IN PLACE YET, BUT THAT CONVERSATION WILL INVOLVE POSSIBLY FINDING A WAY TO HELP RECRUIT PHYSICIANS BY HELPING THEM RELIEVE SOME OF THEIR LOAN BURDEN.

EITHER REPAY IF FOR THEM OR DO WHATEVER.

I ENVISION THAT PURSUIT WILL BE MUCH BROADER THAN THAT.

AND I THINK IT WILL GO EXACTLY THE WAY YOU SAID A WHILE AGO TO TRY TO WORK OUT SOMETHING THAT WE HAVE PHYSICIANS THAT STAY IN THE COMMUNITY. WE WORK WITH THEM TO SOMEHOW RELIEVE THEIR LOANS AND STUFF THAT THEY HAVE AN OBLIGATION TO STAY HERE. COMMISSIONER, JUST TO CLOSE WITH. I WORKED IN HEALTH CARE A LONG TIME. I HAVE RUN SEVERAL HOSPITALS ALONG THE WAY. AND TWO THINGS THAT STEAM TO WORK IN KEEPING PHYSICIANS IN THE COMMUNITY.

EITHER RECRUIT PEOPLE WHO ARE ALREADY FROM HERE OR SOMEWHERE IN THIS AREA. AND THE OTHER ONE I WOULD VENTURE TO SAY IS THAT WHEN A PHYSICIAN COMES TO IT THE COMMUNITY, THEY MARRY LOCALLY. IT IS -- THEY MARRY SOMEONE HERE AND THEY WHOEVER THEY MARRY WANTS TO KEEP THEM HERE AND KEEP THEM CLOSE TO THEIR FAMILY. SO TWO WAYS TWO OTHER EASY WAYS TO WORKS AND OTHER MECHANISMS. PARAGRAPH 7 WAS PUT IN THERE TO HELP ADDRESS AND IDENTIFY WHAT NEEDS IN THE COMMUNITIES ARE.

IT WILL ALSO BENEFIT SPOHN BECAUSE HELP THEM IDENTIFY WHAT THAT SECONDARY RESIDENCE TEE PROGRAM IF EMERGENCY MEDICINE

GOES TO ANOTHER FACILITY. >> THANK YOU, APPRECIATE IT.

>> JUDGE, IF I CAN JUMP IN. I AM SORRY, MAYBE I COULD HAVE

[00:55:03]

GONE BEFORE COMMISSIONER GONZALEZ, IT MIGHT HAVE CLEARED UP SOME OF THE THINGS THAT HE HAD QUESTIONS ABOUT.

FIRST OF ALL, LET ME GO BACK. I AM GOING TO LET JENNY -- I WANT JENNY TO BE ABLE TO ANSWER WHAT COMMISSIONER GONZALEZ ADDRESSED IN REGARDS TO WHY WE ARE DOING THIS BECAUSE RESPECTFULLY HE IS CONFUSING THE COUNTY'S ROLE AND THE COUNTY'S HOSPITAL DISTRICT'S ROLE. HE MADE COMMENTS WE SHOULDN'T BE DOING MEDICAL. WE AS A COUNTY, WHY ARE WE DOING THIS? THIS IS NOT US DOING IT AND THE HOSPITAL DISTRICT, THEIR ROLE IN LIFE IS TO PROVIDE MEDICAL CARE

FOR THE INDIGENT, CORRECT? >> YES, THEY WERE CREATED FOR THAT PURPOSE. AND ONCE THEIR -- ONCE THEY WERE CREATED, THAT IS WHEN THE COUNTY GOT OUT OF THE BUSINESS AND NO LONGER ABLE TO SPEND TAX DOLLARS ON MEDICAL.

BECAUSE THAT IS TAKEN OVER BY THE HOSPITAL DISTRICT.

>> LET ME RESPOND TO HIM SINCE HE MENTIONED MY NAME.

LET ME RESPOND. JENNY, THERE IS NO DIFFERENCE THAN THE HOSPITAL DISTRICT GIVING US THE MONEY TO RUN THE CLINIC FOR MEDICAL, RI. THEN GIVING MONEY TO RUN THE

HOSPITAL. >> COMPLETELY DIFFERENT,

COMMISSIONER GONZALEZ. >> NOT COMING FROM US, BUT FROM THE HOSPITAL DISTRICT. COMPLETELY DIFFERENT.

THEIR ROLE -- YOU MADE COMMENTS EARLIER -- I AM ADDRESSING YOUR COMMENTS BECAUSE YOU SPECIFICALLY MADE THEM AND YOU ALSO ALLUDED TO ME -- I DIDN'T JUMP IN ON YOU --

>> I DIDN'T MENTION YOUR NAME. >> COME ON, COMMISSIONER, YOU SAID THE TAX ISSUE. YOU KNEW IT WAS ME.

AND I LET YOU FINISH YOUR ENTIRE THING.

AND I AM RESPONDING TO YOUR COMMENTS WHICH WERE RESPECTFULLY INCORRECT. THERE IS A HUGE DIFFERENCE IN GETTING FUNDS FOR PROGRAMS THAT ARE WITHIN THE SCOPE OF WHAT THE COUNTY CAN DO AND NOT. THESE FUNDS ARE BEING ALLOCATED FOR INDIGENT CARE. YOU ALSO MADE COMMENTS ABOUT.

WE DON'T DO ENOUGH FOR THE POOR OH, MY GOD, HOW MANY MILLIONS OF DOLLARS DOES THE HOSPITAL USE ON INDIGENT CARE.

YOU ARE SPENDING MILLIONS OF DOLLARS SUBSIDIZING INDIGENT CARE AT SPOHN. THIS COUNTY THROUGH THE HOSPITAL DISTRICT. THAT IS THEIR CHARGE DOING WHAT THEY ARE DOING. IF YOU SAY YOU ARE NOT DOING THAT WILL BE INCORRECT BECAUSE THAT IS YOUR MISSION.

>> LET ME DRAW YOU TO THE EASIEST NUMBER.

THE TAX LEVY THAT YOU APPROVED THE LEVY FOR WAS $30 MILLION A YEAR. THE HOSPITAL DISTRICT USES THAT MONEY TO MAKE SURE THAT THE INDIGENT ARE TAKEN CARE OF.

WE ALSO USE THE MONEY TO HELP ALL THREE HOSPITAL SYSTEMS IN THE COMMUNITY DRAW ADDITIONAL FEDERAL PAYMENT FUNDS AND STUFF.

SO IF YOU WANT A NUMBER, $30 MILLION IS THE NUMBER AND THAT

IS WHAT OUR TAX RATE IS. >> THE MONEY GOES TO THE

SURGERIES AND THE THINGS. >> GOES TO ALL OF THAT.

>> WHY AREN'T WE DOING MORE OF THAT.

AND THE ANSWER IS, WE ARE DOING A TON OF THAT.

WE ARE DOING MILLIONS AND MILLIONS OF THAT NOW.

BUT WE ARE DOING MILLIONS AND MILLIONS OF THAT NOW.

WE CAN ALWAYS DO MORE FOR ANYTHING.

I AGREE WITH YOU ON THAT. AND I THINK IT IS IMPORTANT TO KNOW TOO THAT THE LONG PLAY ON THIS IS, ONE, THERE WAS NO SECOND RESIDENCY EVER OFFERED BY SPOHN WHEN THEY WANTED TO ELIMINATE THIS. IN FACT, IF EVERYONE WILL REMEMBER, THEIR LAWYER STOOD UP AND SAID THEY DIDN'T BELIEVE THEY HAVE TO HAVE A SECOND RESIDENCY.

THUS THE HOSPITAL DISTRICT PASSED A RESOLUTION THAT SAID, OH, YES YOU DO. WE ARE NOT GIVING UP ON THAT PROVISION AND WILL FIGHT THAT PROVISION BECAUSE A PROVISION IN THE AGREEMENT THAT CLEARLY SAYS THAT SPOHN HAS TO PROVIDE TWO RESIDENCY. I WILL LOOK FORWARD TO HEARING A PRESENTATION ON THAT AS WELL, BUT THEY DID NOT HAVE A PLAN FOR A SECOND RESIDENCY BECAUSE THEY DID NOT BELIEVE THEY NEEDED TO HAVE A SECOND RESIDENCY. SO THAT IS PART OF IT IS, WHAT THE HOPE WILL BE ON THE LONG PLAY ON THIS BEING JUST COMPLETELY CANDID WITH EVERYBODY ON THIS.

NOBODY IN THE ROOM THINKS THIS IS THE GREATEST DEAL IN THE WORLD. IT BUYS TIME AS JOHNNY SAID.

WE HAVE ALL HAD TO MAKE ACCOMMODATIONS TO GET TO A POINT WHERE WE CAN LIVE WITH WHAT WE HAVE KNOWING THAT AT THE END OF THE DAY, THERE MIGHT BE -- THERE MIGHT BE A TRANSITION OF THIS PROGRAM ELSEWHERE. JOHNNY DID YEOMAN'S WORK GOING BACK AND REALLY LISTENING TO WHAT THE DOCTORS' INPUT WAS.

WHAT THE HOSPITAL DISTRICT BOARD MEMBERS WERE.

WHAT COMMISSIONERS COURT'S INPUT TO GO BACK AND SPOHN CAME TO THE TABLE WITH JOHNNY. DIDN'T COULD AM TO OUR MEETINGS AND THAT'S OKAY. THAT IS THEIR CHOICE.

CAME TO THE TABLE AND IN GOOD FAITH CAME UP WITH SOMETHING THAT THEY CAN USE WITH, INCLUDING PUTTING A CLAUSE IN

[01:00:02]

HERE THAT INDICATES THAT IF THERE IS A TRANSITION, THE HOSPITAL DISTRICT WILL BE INVOLVED, WHICH MEANS THEY WON'T COME IN AND MAKE AN ABRUPT DECISION WITHOUT SOME CONSULTATION AND LET THE COMMUNITY REACT TO IT .

HOPE IS THIS DOESN'T LAST SIX YEARS.

HOPE IS -- BEING STRAIGHT UP. THIS GETS TRANSITIONED ELSEWHERE AFTER A COUPLE OF YEARS WHERE SPOHN COMES BACK AND SAYS WE MADE A DIFFERENT DECISION WE WANT TO KEEP IT AND THE MONEY FOR THE LONG HAUL. IT IS A CONTRACT AND THE CONTRACT WILL HAVE AN OUTCLAUSE THAT EITHER PARTY WILL GET OUT OF AT SOME POINT. AND IF JOHNNY AND THE HOSPITAL DISTRICT BOARD FEELS THAT THIS DOESN'T PROPERLY SERVES, IT GIVES US THE OPPORTUNITY TO RELE KATE THOSE FUNDS ELSEWHERE.

ONE OF THE THINGS WE TALKED ABOUT IS A COMMITTEE, CONTINUING TO WORK AS A COMMITTEE. LET ME TELL YOU THIS COMMITTEE SPENT HOURS AND HOURS AND HOURS AND HOURS ON THIS TO TRY TO SAVE THE PROGRAM TO PUT ASIDE POLITICAL DIFFERENCES AND FEELINGS OF THIS AND THAT. AND SOMEBODY DIDN'T LIKE -- WE ROLLED UP OUR SLEEVES AND GONE TO WORK AND NOT A GREAT PERFECT SOLUTION BUT ONE THAT SAVES THE COMMUNITY.

SAVES 50 DOCTOR FOR THIS COMMUNITY.

HELPS THE INDIGENT. BECAUSE LOSING THESE DOCTORS HURT THE INDIGENT MOST BECAUSE IT STAFF IT CANNILY GOES TO EMERGENCY ROOMS MORE THAN ANYTHING ELSE PERCENTAGEWISE.

NOT HAVE THESE DOCTORS AND LOSE 52 DOCTORS IN THE COMMUNITY.

THE COST IS WAY MORE THAN $20 MILLION IN THIS COMMUNITY.

IT WILL BE IMMEASURABLE TO IT. THE HOPE IS AFTER TWO YEARS, WE WILL BE ABLE TO TRANSITION THIS SOMEWHERE ELSE MAYBE AND NOT -- THE HOSPITAL DISTRICT HAVEN'T BEEN ABLE TO SPEND ALL THE FUNDSAL CATEGORIED TO THIS BECAUSE NO ONE WANTS TO DO IT.

DOCTORS DON'T WANT TO DO IT. THEY DON'T WANT THE HOSPITAL IT IS STRICT TO SPEND THIS MONEY. AT THIS POINT -- SORRY, MR. GONZALEZ HAD TO LEAVE BECAUSE I WANTED HIM TO HEAR SOME OF THIS IS THAT THEY REALLY FEEL THAT THIS IS THE ONLY WAY AT THIS POINT THAT WE CAN SAVE THIS FOR A PERIOD OF TIME THAT SAVES US TIME AND JOHNNY SAID IT WELL. THIS BUYS TIME.

THIS IS NOT PER EFFECT. THIS IS DEFINITELY NOT DOING THAT IS EVER PERFECT. IF WE HAD MORE TIME AND MAYBE NOT HAVE IT DROPPED ON US, MAYBE SO.

AT THE END OF THE DAY, DEFINITELY SOMETHING WE WILL BE LOOKING FOR OTHER FUNDING OPPORTUNITIES TOO.

AND IMPORTANT TO NOTE. ONE OF THE THING THE COMMITTEE TALKED ABOUT WAS, LOOK, WE CAN DO THIS FOR NOW, BUT WE NEED TO GO TO THIS TYPE A BOARD AND TYPE B BOARD.

WE HAVEN'T HIT THIS FROM A DEVELOPMENT STANDPOINT.

IF SOMEBODY SAYS WE WILL BRING 50 DOCTORS.

THE TYPE A AND TYPE B WILL SPEND MONEY TO BRING 50 DOLLARS AND SPEND 50 TO KEEP DOCTORS. WE TALK ABOUT BRING GREAT THINGS IN THE COMMUNITY. SOMETIMES YOU HAVE TO INVEST IN WHAT IS HERE. THIS IS A INVESTMENT.

THESE PEOPLE WANT TO BE HERE. THEY HAVE FOUGHT TO BE HERE.

THEY HAVE UNIFIED LIKE NO GROUP I HAVE EVER SEEN.

THEY HAVE COME TOGETHER AND SAID, WE LOVE CORPUS CHRISTI.

WE LOVE THE COASTAL BEND. THESE RESIDENTS LOVE BEING HERE.

WE WANT TO STAY HERE, LIVE HERE AND WORK HERE I DON'T THINK ANY OF THEM GOT MARRIED OR ARE FROM HERE.

THAT WHAT WAS GOOD EXAMPLE. NO, IT IS A GOOD EXAMPLE, BUT THE POINT IS A LOT OF THESE PEOPLE DIDN'T FALL INTO YOUR TWO CATEGORIES AND THEY ARE FIGHTING TO STAY HERE.

AND THE ONLY WAY WE CAN THINK OF TO FIX THIS IN 45 DAYS WHICH IS WHAT WE HAVE BEEN DOING IS THIS. AND I KNOW IT IS NOT PERFECT, BUT I AM CONFLICTED. COMMISSIONER MAREZ IS COMMITTED AND THE JUDGE IS COMMITTED BY FORMING THIS COMMITTEE.

I KNOW THIS COURT HAS COMMITTED TO THIS.

COMMISSIONER NASHVILLE ANDA HAVE COMMITTED TO KEEP THE GOING SO THE HOSPITAL DISTRICT DOESN'T HAVE TO PAY FOR THIS.

WE DON'T WANT THEM TO PAY FOR THE WHOLE DEAL.

OUR GOAL IS TO FIGURE IT OUT IN A COUPLE OF YEARS SO THEY ARE NOT HAVING TO HOPEFULLY KICK INTO THAT $4 MILLION LEVEL.

HOPEFULLY JUST THE $1 MILLION AND $2 MILLION AND SOMEWHERE DOWN THE ROAD AND A SCREAMING DEAL IF ALL WE HAVE TO DO IS PAY THAT AMOUNT. I GET IT.

IF I HAVEN'T SPENT THE GAZILLION HOURS ON THIS, I WOULD HAVE RESERVATIONS TOO. THAT IS WHY I AM TRYING TO PUT OUT EVERYTHING I CAN PUTS OUT SO EVERYBODY KNOWS.

AND HARD TO DO IT IN TEN MINUTES WHEN WE HAVE BEEN WORKING ON IT FOR 30, 40 OR 50 HOURS AND EXPLAINING IT.

BUT THE LONG PLAY HERE IS SPOHN HAS COME TO THE TABLE, REALIZE THEY PROBABLY NEED TIME TO FIGURE THIS OUT.

WE KNOW WE NEED THE SECOND RESIDENCY.

THE HOPE IS -- -- THE HOPE IS WE WILL GET SPOHN TO DO THE SECOND

[01:05:04]

RESIDENCY. THIS RESIDENCY WILL SHIFT ANOTHER ONE AND END UP WITH FOUR RESIDENCY PROGRAMS. ANOTHER 50 DOCTORS AND COMMISSIONER GONZALEZ IS RIGHT.

WE NEED OTHER KINDS OF DOCTORS IN OUR COMMUNITY.

WE NEED OTHER KIND OF RESIDENCIES.

I WOULD LOVE TO HEAR SPOHN'S PLAN FOR THE SECOND RESIDENCY IF THIS IS NOT THE ONE THEY WANT TO KEEP LONG DETERMINE AND SWITCH IT TO ACA OR DRISCOLL OR KEEP IT TO THE HOSPITAL DISTRICT AND DO IT. THIS AN EXCITING DEAL.

THIS IS SOMETHING -- AGAIN, I WISH IT WAS BETTER AND I THINK IT IS A GOOD SITUATION AND MEETS THE NEEDS.

TO LOSE THESE DOCTORS IN THIS COMMUNITY WILL BE TRAGIC, MONUMENTAL -- NOT ONLY THE DOCTORS, BUT ALL THEIR FAMILIES.

WE HAVEN'T EVEN STARTED ARTICULATING -- ONE DOCTOR HERE WHO HAS FOUR KIDS. MULTIPLY THE DOCTORS AND FAMILIES AND ALL THEIR KIDS. TALKING HUNDREDS OF PEOPLE, NOT 35. YOU KNOW W-- 52.

YOU KNOW, JOHNNY, A FAIR POINT. GOVERNOR GONZALEZ ALLUDED TO THE FACT I DON'T LIKE TO RAISE TAXES.

AND HE IS RIGHT. I DON'T.

I WILL KEEP THIS IN MIND WITH YOUR BUDGET WITH THE HOSPITAL DISTRICT IF WE CAN LOOK AT ADDITIONAL PROGRAMS AND MAYBE WE NEED TO LOOK AT THOSE IT TOO. BUT A FAIR AS CAN.

IF YOU HAVE TO GO UP -- EVEN THOUGH YOU HAVE SOME OF THE BEST RESERVING IN TOWN, QUITE HONESTLY HAVING $90 MILLION IN RESERVES, WE NEED TO SPEND IT. WE NEED TO SPEND IT ON THE INDIGENT. COMMISSIONER GONZALEZ IS RIGHT.

IF WE NEED TO COME UP WITH OTHER PROGRAMS TO TAP INTO THE RESERVES ALSO. WE NEED TO KEEP A RESERVE BALANCE. $90 MILLION.

WE HAVE $25 MILLION AND $135 MILLION REVENUE BUDGET.

YOU ARE A $30 MILLION. YOU GOT 90 MILLION.

FINANCIAL RESPONSIBILITY AND CONGRATULATIONS.

I DON'T DISAGREE HE WITH COMMISSIONER GONZALEZ.

IF WE HAVE MONEY THAT WE CAN SPEND IN OTHER PLACES AS WELL AS THIS, I WILL LOOK AT THOSE TWO AND BE HAPPY TO DO THAT.

SO I THINK THIS IS REALLY AN INCREDIBLE ARRANGEMENT WE HAD TO DO QUICKLY AND FAST AND COMPLETELY WITHIN WITH THE MISSION OF WHAT YOU DO AND I WILL GIVE GREAT DEFERENCE WHEN YOUR BUDGET COMES UP NEXT TIME. A FAIR ASK FOR TO YOU DO THAT AND I WILL LOOK STRONGLY AT THAT AND ALL THE PROGRAMS AND WHAT YOU DO WITH THE ENTIRETY. THE FIRST YEAR AND SECOND YEAR, IF IT GOES TO FOUR, FIVE AND SIX AND MY HOPE THAT IT DOESN'T GET TO FOUR, FIVE AND SIX AND TRANSITIONED OVER SOMEWHERE ELSE THAT WE DON'T HAVE TO SPEND THAT MONEY THAT IS WHY IT IS IMPORTANT, COMMISSIONER. THAT WE HAVE OUTCLAUSES THAT WE CAN MOVE AWAY FROM IT IF IT DOES TRANSITION.

LIKE JOHNNY SAID, IF THEY DON'T AND GET ADDITIONAL FUNDING THEY WILL HAVE TO REPAY AND GO TO OTHER PLACES TO LOOK FOR FUNDING SOURCES. I KNOW THAT'S A LOT, AND I WANTED TO MAKE SURE TO ADDRESS. BECAUSE WE HAVE SPENT -- I DON'T KNOW HOW MANY HOURS ON THIS THING.

AND I KNOW I RAMBLED A LOT BUT WE SPENT SO MUCH TIME ON IT AND HAD SO MANY CONVERSATIONS AND GETTING IT ALL OUT FOR THE PUBLIC AND COMMISSIONERS COURT TO HEAR I THOUGHT IT WAS IMPORTANT AND I APPRECIATE THE TIME ON THAT, JUDGE.

>>COMMISSIONER MAREZ: JUDGE, ONE OF THE THINGS THAT WE HEARD FROM OUR DOCTORS. WHEN MANY COMMUNITIES ARE TAKEN THIS COURSE IN GOING TO SEE THAT THE HOSPITAL SYSTEMS ARE ELIMINATING E.R.S OR RESIDENCY PROGRAM FOR EMERGENCY ROOMS -- EMERGENCY DEPARTMENT, WE ARE PROBABLY THE ONLY ONE THAT HAVE REVERSED COURSE AND ACTUALLY GOING IN THE WRONG DIRECTION AND REVERSED COURSE AND SAVED IT. THAT IS SOMETHING HUGE THAT TODAY THAT MESSAGE GETS OUT AND GOES OUT THROUGHOUT THE WORLD THAT NUECES COUNTY HAS MADE THIS A PRIORITY.

IT IS NOT PERFECT. I THINK THE KNEE-JERK REACTION FOR ALL OF US PART OF THIS HAS BEEN THAT THIS IS NOT PERFECT.

THIS DOESN'T SOUND RIGHT. AND I AGREE.

I THINK WE ALL WOULD AGREE. BUT IF IT IS ABOUT SAVING THE PROGRAM AND THE AMOUNT OF TIME TO GIVE DOCTOR AS CHANCE TO INTERVIEW AND RECRUIT AND RETAIN SOME WELL QUALIFIED RESIDENTS, WE NEED TO DO IT NOW. THIS DISCUSSION WILL CONTINUE, BUT I CANNOT SAY ENOUGH. I HAVE SAID THIS TO SEVERAL ALREADY -- JUDGE, WITHOUT YOU CREATING THIS COMMITTEE, I DON'T THINK THIS WOULD HAVE HAPPENED. THE WAY THAT YOU -- YOU COMPILED DIFFERENT PERSPECTIVES FROM THE COUNTY, FROM THE COMMISSIONERS COURT ITSELF, FROM THE HOSPITAL DISTRICT, FROM THE DOCTORS, AND FROM THE COMMUNITY. KAREN URBAN HAS DONE WONDERFUL WORK. SHE IS A TRUE ADVOCATE THAT GAVE PERFECTLY FROM THE COMMUNITY'S POINT OF VIEW ALL THOSE THAT

[01:10:02]

WERE INCLUDED TO HELP GIVE PERSPECTIVE TO THIS.

AND IT IS NOT OVER. IT STILL NEEDS TO BE DISCUSSIONS IN THE FUTURE, BUT WITHOUT YOU COMING UP WITH THIS, I DON'T THINK WE WOULD HAVE HAD THAT OPPORTUNITY.

AND IT BROUGHT EVERYBODY TOGETHER AND GAVE STILL OPPORTUNITY FOR SPOHN AND JOHNNY TO WORK KIND OF SIDE BAR CONVERSATIONS AND WORK THIS OUT. THIS IS WHAT THIS IS ALL ABOUT.

I FEEL THAT WHILE YOU CREATE IT WAS TO BE ABLE TO HAVE KIND OF OUTSIDE THE FORMALITIES OF A FORMAL MEETING AND HAVE JUST A COMMITTEE, AN AD HOC COMMITTEE THAT YOU CREATED THAT WE ARE ABLE TO KIND OF HAVE THOSE CONVERSATIONS TO WORK THIS OUT TO HAVE PUSH BACK AND FRANK CONVERSATIONS AND FEEDBACK ON THIS AND SAY WE MAY NOT THINK IT IS PERFECT BUT AT LEAST IT WORKS AND SAVES IT FOR NOW SO I WANT TO THANK YOU FOR STEPPING UP

AROUND CREATING THAT. >> THANK YOU, COMMISSIONER

HERNANDEZ, YOU WANTED TO SPEAK. >> LIKE MY OTHER TWO COMMISSIONERS CADE AND SOME OTHER FOLKS.

I AM STILL CONFUSED. AT THE END OF THE DAY, SPOHN WILL HAVE THE LAST WORD, IS THAT RIGHT?

JOHNNY? >> COMMISSIONER, IN THE CONTEXT OF THE FACT THAT THEY ARE PROGRAMMING THAT FACILITY, THEY DO HAVE A SWAY OVER THAT. THEY HAVE TO WORK WITH THE HOSPITAL DISTRICT AND WE HAVE A WAY TO BENEFIT THEM.

IT IS THEIR PROGRAM AND IT IS THEIR FACILITY AND THEY HAVE THE LAST DAY, BUT THE HOSPITAL DISTRICT HAS A BIG ROLE IN THEIR ECONOMIC SITUATION SO WHEN WE HAVE THAT, WE ALSO HAVE INPUT.

>> OKAY. I WAS JUST WONDERING BECAUSE I AM HEARING THINGS THAT COMMISSIONER CHESNEY BROUGHT UP.

I AM FINDING OUT THINGS THAT WE DIDN'T KNOW.

WE WEREN'T PRIVY TOO. WE HAVEN'T ATTENDED ANY OF THOSE MEETINGS AND GET THOSE THINGS AT THE LAST MINUTE AND READ THROUGH THEM AND MAKE SENSE. YOU ANSWERED SOME QUESTIONS THAT I WASN'T AWARE OF AND A GOOD PROGRAM AND I KNOW DIRECTLY THAT WE DO NEED THE DOCTORS HERE. I TALKED WITH PEOPLE AND THEY SAY CAN'T FIND DOCTORS. DOCTORS ARE RETIRING.

THEY JUST DON'T -- WE DON'T HAVE ENOUGH HERE IN CORPUS CHRISTI.

WE DECENT HAVE ENOUGH SPECIALISTS.

I HAVE BEEN WAITING FOR A SPECIALIST FOR EIGHT WEEKS.

SO I KNOW -- I HOPE IT WORKS, BUT I AM JUST SAYING I AM STILL CONFUSED HOW -- HOW IT IS GOING TO REALLY IMPACT EVERYTHING AS -- AS YOU PROPOSE IT. SO I APPRECIATE THAT ALL THE WORK THAT IS BEING DONE BY THE COMMISSIONERS AND COUNTY JUDGE AND DOCTORS ARE FOLLOWING BRING UP THINGS.

HOW TO MAKE IT BETTER. THAT IS WHAT I AM SAYING, AT THE END OF THE DAY, I THINK SPOHN WILL HAVE THE LAST WORD.

AND I HOPE IT IS IN OUR FAVOR. >> I THINK THIS WAS JUST AN UPDATE. SO WE APPRECIATE YOU ALL BEING HERE. I KNOW WE CAN ONLY HAVE TWO COMMISSIONERS ON THAT COMMITTEE, SO I APOLOGIZE FOR THE INFORMATION NOT BEING SHARED MORE BUT I WASN'T IN THERE AS WELL, BUT I TALKED TO THE DOCTORS INDIVIDUALLY WHEN THEY WERE WAITING FOR THE IN EX-TO SHOW UP.

I HAD THE PRIVILEGE. I TOTALLY UNDERSTAND COMMISSIONER HERNANDEZ WHAT YOU ARE TALKING ABOUT BUT WE ARE THANKFUL FOR ALL THE TIME YOU HAVE GIVEN ALL THE MEETINGS.

SO THANK YOU AGAIN AND WE WILL SEE HOW THIS MOVES FORWARD IN THE NEXT YEAR OR TWO. I AM SURE WE WILL BE GETTING UPDATES FROM THE HOSPITAL DEBTS STRICT AS WELL.

AND HOPEFULLY YOU CAN DO YOUR JOB AND DO WHAT YOU DO BEST

THANK YOU. >> WHILE THEY ARE MOVING OUT, IF

>> MOTION. >> SECOND.

>> WE HAVE A MOTION AND A SECOND.

I DO HAVE A COUPLE ON THIS ONE.

GRANTWORKS -- I KNOW NATALIE IS HERE -- CAN YOU COME UP TO THE PODIUM, NATALIE, PLEASE. I HAVE QUESTIONS FOR YOU.

I HAD THIS BROUGHT TO MY ATTENTION ON OTHER GRANTS AND I WANT TO CLARIFY HERE IN COURT. I KNOW IF WE HIRE YOU TO DO THESE JOBS, ULTIMATELY IN THE END, THEY HAVE TO GO TO OUR GRANT WORKS HAS TO FILE THE PAPERWORK -- HAS TO GO.

YOU WILL PROVIDE ALL THE DOCUMENTS AND THEN ANA WILL HAVE TO SEND IT UP FOR REPAYMENT. THAT CLEAR ON THESE GRANTS TOO?

>> THE PORTAL, THE GRANT PORTAL, IS THAT WHAT WE ARE TALKING

ABOUT? >> I HAVE JESSICA HISSIM ON 9 CALL. THE PROJECT MANAGER FOR THE ARPA PROGRAM WITHIN GRANTWORKS. SHE CAN ACTUALLY TELL YOU EXACTLY FROM THE HORSE'S MOUTH WHEN THEY ARE DEALING WITH THE

[01:20:05]

GRANT PORTALS FOR CLIENTS. EVERY CLIENT IS DIFFERENT.

WE TAILOR IT WITH WHAT WORKS BEST WITH YOUR INTERNAL PRACTICES. GRANTWORKS ACCESS, YOU CAN DO YOUR OWN AND WE CAN TELL YOU WHAT TOO DO OR WE CAN HAVE ACCESS AND DO IT FOR YOU. REALLY ULTIMATELY DEPENDS WHAT YOU GUYS ARE COMFORTABLE WITH DOING.

>> HAVE WE EVER GIVEN ACCESS TO ANYBODY ELSE ON THIS -- ANA,

THIS IS US UP HERE. >> THAT'S OKAY.

>> A CLARIFICATION BECAUSE I HAD ANOTHER ISSUE WITH A DIFFERENT GRANT THIS WEEK AND I WANT TO MAKE SURE MOVING FORWARD WITH W

WE WERE CLEAR. >> IN THE PREVIOUS ONE I SAID --

>> WITH HAGGERTY. >> THEY WOULD GIVE US THAT INFOR INFORMATION.

>> THEY DON'T HAVE ACCESS TO OUR PORTAL?

>> NO, IT WILL STILL HAVE TO COME THROUGH US WHERE YOU WILL SIGN IT AND WE WILL EITHER UPLOAD IT OR.

>> I THINK THAT IS A PROBLEM. IT IS GOING THROUGH TOO DIFFERENT HANDS. WE GET ALL CONFUSED AND SOME OF IT WASN'T BEING LOOKED AT AS PASSED ON.

IF WE PAY THEM TO DO IT. THEY JUST.

THEY DO WHAT THEY HAVE TO DO DOD HAVE TO MONITOR IT, IF WE ARE GOING TO PAY THEM FOR IT GO THE WHOLE NINE YARDS.

>> WHAT IS THE MONITORING ROLE FOR ANA THEN? I MEAN -- THAT IS WHERE WE HAVE GOTTEN INTO PROBLEMS BECAUSE SHE IS SAYING SHE CAN'T GET THE INFORMATION.

>> I DON'T SEE WHY NOT. >> THAT IS WHAT SHE IS REPORTING

IT. >> HAPPENING WITH HAGERTY THAT

WE DIDN'T HAVE THE INFORMATION. >> AND FROM THE DIFFERENT DEPARTMENTS ON INDIVIDUAL PROJECTS, WHEN DEPARTMENT DOESN'T TURN IT IN OR SEND THE REPORTS.

I WANT TO MAKE SURE MOVING FORWARD, WHOEVER TAKES ON THIS ROLE EARNED STANDS IT IS THEIR RESPONSIBILITY.

THEIR ULTIMATE RESPONSIBILITY TO GO AFTER THESE PEOPLE.

SO YOU DON'T WAIT UNTIL THE DAY BEFORE IT IS OR TO TURN IF INTO OUR DEPARTMENT IF WE HAVE TO HAVE IT.

WE HAVE TO BE TURNED IN TIMELY AND I WOULD LIKE A HISTORY OF ALL -- OF THE MONEY IT HAS COST US BECAUSE OF NOT JUST COMMUNICATION, PUBLIC WORKS, AUDITING, GRANTS, EVERYONE.

AND -- I JUST THINK WE HAVE TO CLEAN THAT UP.

WE HAVE GOT TO DO BETTER. SO IF YOU -- IF WE ARE VOTIN ON THIS AND I AM FINE VOTING ON THIS AND GIVING IT ALL TO YOU, BUT I WANT YOU TO KNOW THAT IT IS ALL YOUR RESPONSIBILITY.

I AM NOT GOING TO HAVE MEETINGS WITH EVERYBODY SAYING THEY DIDN'T GIVE IT TO ME AND THEY DIDN'T GIVE IT TO ME AND THEY DIDN'T CALL ME AND THIS PERSON DIDN'T CONTACT ME AND I DIDN'T GET A RIGHT. IT WILL BE YOUR RESPONSIBILITY TO GO AFTER ALL OF THOSE PEOPLE. I WANTED TO MAKE THAT VERY CLEAR

BEFORE MOVING FORWARD. >> YES.

SO GRANTWORKS DOES FULLY HELP. WHEN WE TAKE ON THIS ROLE, WE DO EVERYTHING FOR YOU. ALREADY ULTIMATE SIGN-OFFS THAT WE CAN'T DO BECAUSE WE ARE NOT AUTHORIZED TO DO THAT.

THAT THE OBLIGAEKS OF THE CLIENT, IN THAT CASE THE COUNTY.

WE WILL SEND ANY DOCUMENTS TO BE REQUIRED AND REVIEWED AND SIGNED OFF ON TO YOU AND PROVIDE AN UPDATE.

>> I DO THEM ALL THE TIME. NOT A PROBLEM.

>> YES, MA'AM. WE HAVE A SYSTEM IN PLACE THAT WE PROVIDE ROUTINE REPORTS SO THE COUNTY IS AWARE OF HOW THINGS STAND. AND THEY CAN COME TO COURT AND PRESIDE ON THESE ITEMS. YES, WE CAN BE AS FULLY RESPONSIBLE FOR IT AS YOU WOULD LIKE US TO BE OR AS -- AS REMOVED AS YOU WOULD LIKE US TO BE.

IN THIS CASE, IT SEEMS LIKE YOU ARE ASKING US TO TAKE ON 100% RESPONSIBILITY EVERY IT WHICH WE WOULD.

>> WE WON'T HAVE THE POSITION IN THE GRANTS DEPARTMENT TO TAKE THIS ON. SO THAT WOULD MEAN YOU WOULD BE

TAKING ON THE FULL POSITION. >> YES, MA'AM.

>> OTHER THAN WE DO HAVE THE FUNDING -- THE ATTORNEY IS STILL FUNDED THROUGH 2026. THAT WOULD BE AVAILABLE TO HELP AND GO OVER CONTRACTS AND BIDS OR PRICES, WHATEVER THEY HAVE TO

GO THROUGH. >> THAT'S CORRECT.

AND WE WOULD NEED, THEN, ACCESS TO THE GRANT PORTAL TO BE ABLE TO DO THAT. BUT THERE IS SOME -- IF I AM NOT MISTAKEN, THIS GRANT PORTAL HAS AN EWE THEN IF I OCCASION.

THE MIT MOD. >> CAN WE DO THAT, ANA?

>> THEY HAVE ACCESS TO TREASURY AND THEY CAN REQUEST IT, YES.

>> SO I AM GOING -- I HAVE JESSICA HISSUM AND I WANT TO

[01:25:02]

GIVE HER A SECOND TO KIND OF ADDRESS IT BECAUSE SHE IS ON THE CALL AND THIS IS WHAT WE HAVE GOT.

GO AHEAD, JESSICA. >> HI, EVERYBODY.

THANK YOU FOR HAVING ME. I AM JESSICA HISSUM, ONE OF THE LEAD DIRECTOR ON THE ARPA. YOU ARE A LOT OF QUESTIONS AND I HAVE A WHOLE PRESENTATION IF WE WANT TO RUN THROUGH IT, A HIGH LEVEL OF WHAT ARPA CAN PROVIDE THROUGH GRANTWORKS OR JUST IMMEDIATELY ADDRESS YOUR QUESTIONS.

>> I DON'T THINK WE ARE AT THAT POINT YET, JESSICA, BUT IF YOU ADDRESS THE QUESTIONS. THAT WOULD BE APPROPRIATE.

THANKS. >> NO PROBLEM.

BIG THING IS INTERGOVERNMENTAL BOARD NATION.

ONE OF OUR SPECIALTIES. ULTIMATELY WE NEED THE COLLABORATION OF THE COUNTY TO SEND THE EXPENDITURES AND KEEP US UPDATED ON EXPENDITURES. HOW ACTIVE YOU WOULD LIKE US TO BE. WE WILL BE DOING THAT ONGOING THROUGHOUT THE CONTRACT. SO IT WOULDN'T BE -- HOPEFULLY -- I AM NOT TOTALLY FAMILIAR WITH WHAT HAPPENED BEFORE, BUT IT WOULDN'T BE A STRUCTURE THAT WOULD BE A RUSH.

WE WILL BE ENGAGED KNEW EVERY SINGLE STEP OF THE PROCESS.

AND IF WE ARE, WE ARE ULTIMATELY VERY, VERY HELPFUL DURING THE REPORT. IT IS A SEPARATE -- A SEPARATE PORTAL THAN TETUM. THE INDIVIDUAL PORTAL AND WORKS INDIVIDUALLY DIFFERENTLY. AND ONCE WE GET INTO IT, THE REPORT CAN BE FAIRLY EASY AND HAPPY TO HELP AS MUCH AS WE NEED

TO. >> THANK YOU VERY MUCH.

I APPRECIATE THAT. >> SO WE HAVE THE MOTION -- GO

AHEAD, SORRY. >> SO WILL THE GRANTS DEPARTMENT OR THE AUDITORS PROVIDE THEM WITH THE EXPENDITURES, THE INFORMATION THAT THEY ARE GOING TO NEED TO UPLOAD INTO THE

PORTALS? >> THE AUDITOR'S OFFICE IS WHAT IT SAYS IN THE AGREEMENT. THE AUDITOR'S OFFICE, YES.

>> JUST A QUESTION. AS WITH ANY THIRD PARTY CONSULTING AGENT, IT IS BY HOURLY RATE.

EVERYTHING THEY DO WILL BE BY HOURLY RATE.

>> AS FAR AS THE -- WHAT PART -- >> ANY COMMUNICATION THAT THEY

DO. >> COMMUNICATION, ANYTHING,

HOURLY RATE. >> WHEN THEY DISCUSS THINGS WITH THE COMMISSIONER, WITH US. IT WILL -- CORRECT ME IF I'M

WRONG. >> SO THAT IS ACTUALLY BASED ON THE CONTRACT. IF IT IS A LUMP SUM CONTRACT, THEN BASED ON LUMP SUM. TREASURY DOES NOT REQUIRE HOURLY BE THE STIPULATION OR BE THE REPORTING STYLE SO IT IS ACTUALLY DEPENDENT ON THE CONTRACT ITSELF.

IF THE AGREEMENT ABOUT BY LUMP SUM, THAT IS THE BILLING STRUCTURE. BASED ON MILESTONES THAT ARE MET THROUGHOUT THE CONTRACTS -- THE CONSTRUCTION THEMSELVES.

NOW IF THE COUNTY WOULD LIKE TO IMPOSE SOME KIND OF ADDITIONAL RESTRICTION THAT IS MORE IN LINE WITH THEIR PRACTICES, THEN THAT IS UP TO THE COUNTY. AND THAT IS NOT A REQUIREMENT BY THIS GRANT AND, AGAIN, THAT GOES BACK TO THE CONTRACT, WHAT WAS ORIGINALLY AGREED TO, IF IT IS A LUMP SUM, IT IS VERY DIFFERENT.

IT IS NOT HOURLY. >> THAT WILL BE PER THE

INDIVIDUAL PROJECTS YOU WOULD -- >> THAT'S CORRECT.

>> WE WILL HAVE TO DO ALL OF THEM IF WE TO AWAY FROM THE ARPA

MANAGER, ALL THE ARPA -- >> I THINK WE NEED AN ESTIMATE WHAT THAT WILL BE. BECAUSE THE ARPA MANAGER.

WE KNOW WHAT THE COST -- I THINK WE NEED DETAIL ON THAT BECAUSE THIS IS -- I AM ALL FOR GRANTWORKS.

Y'ALL HAVE DONE A GREAT JOB, BUT THIS WILL COST US A LOT MORE THAN THE ARPA MANAGER. NOT A BAD THING, BUT I WOULD LIKE TO KNOW SPECIFICALLY HOW MUCH WE ARE TALKING ABOUT.

HOW MUCH MORE COST THIS WILL BE BECAUSE COME OUT OF THE ARPA FUNDS WHICH IS LESS MONEY TO DO WHAT WE NEED TO DO WITH THE ARPA FUNDS. DO WE HAVE THAT NUMBER?

>> JUDGE, I THINK THAT IS IN ITEM NUMBER 6.

>> I WAS GOING TO SAY. A SUBSEQUENT ITEM.

>> I THINK WE NEED TO DO ITEM NUMBER 6 BEFORE WE VOTE ON THIS TH THEN.

WE SHOULD HAVE DONE THIS IN OPPOSITE ORDER.

>> WE CAN DO THEM TOGETHER AND 5 AND 6.

>> JUDGE, IF I MAY INTERJECT, THE CONTRACT ITSELF I THINK IS A PERCENTAGE CONTRACT BASED ON THE AMOUNT.

NOT TO EXCEED. RIGHT NOW THE CURRENT SETTING IS $1 MILLION. NOT TO EXCEED $1 MILLION.

THE FIRST TASK ORDER IS BASED ON A HOURLY RATE.

>> NOT TO EXCEED A MILLION ON ALL THE PROBLEMS OR

INDIVIDUALLY. >> ALL THE PROJECTS.

>> I WAS LIKE, WHOA. >> INCLUDING THESE THAT WE ARE

ADD SOMETHING IN. >> THE FIRST TASK ORDER IS BASED ONLY -- WHAT IT WILL COST THEM TO GO IN ON AN HOURLY A BASIS TO CHECK OUT WHAT WE ALREADY HAVE. AND PROCEDURES AND EVERYTHING WE

[01:30:06]

HAVE DONE SO FAR AND LOOK AT WHERE WE ALLOCATED -- TO MAKE THE DIFFERENT ALLOCATIONS AND THEN THEY ARE GOING TO COME BACK AND THAT. THAT TASK ORDER IT THREE TO FOUR MONTHS BUT ACCORDING NATALIE, THE COMMISSIONER WANTS IT HIT HARD AND AT LEAST THREE PEOPLE WORKING ON THIS PROJECT AT THAT POINT TO GET A DETERMINATION OF WHAT THE -- WHERE WE ARE AT.

WHERE WE STAFFED. AT THAT POINT, WE WILL DO A TASK ORDER THAT IS BASED ON THE PERCENTAGE BASIS NOT TO EXCEED $1 MILLION. TO -- OR WHATEVER WE DETERMINE TO FINISH UP THE REST OF THE PROJECTS.

>> WE STILL NEED AN ESTIMATE HERE.

I CAN'T VOTE ON -- OPEN-ENDED BECAUSE -- THE ARPA MANAGER COST US -- I DON'T KNOW WHAT WE ARE PAYING, $90,000 A YEAR FOR A

ARPA MANAGER. >> YOU HAVE $350 --

>> THREE YEARS WITH BENEFITS AND EVER

EVERYTHING. >> THAT'S WHERE I WAS GOING.

THE TOTAL COST OF A THE ARPA AND GO INTO THE FACT ARE THERE, AND I WOULD LIKE TO KNOW SOME ESTIMATE.

I CAN'T JUST VOTE ON -- AND HOPE AND PRAY.

THIS A BIG DIFFERENCE. WE ARE TALKING ABOUT ADDING ALL -- ALL THESE OTHER PROJECTS, RIGHT? WE ARE TALKING HOW MANY MILLIONS OF DOLLARS OF PROJECTS WE ARE ADDING TO WHATEVER WE HAVE GIVEN THEM.

ANYBODY HAVE AN IDEA OF THAT. >> THE TOTAL AMOUNT IS $ 1

MILLION. >> ON THE CDBG STUFF OR WE HAVE

ALREADY GIVEN THEM. >> ARPA.

>> 71 MILLION. >> WILL BE 2.5 OR 49% OF THE $30

MILLION AS A PERCENTAGE. >> THEY WILL BE INVOLVED IN ALL

$70 MILLION OF OUR PROBLEMS? >> WHATEVER -- WHATEVER PROJECTS THAT ARE AVAILABLE THAT HAVE YET TO BE DONE.

>> WHERE IS THAT IN DETAIL? I NEED NO KNOW WHAT THAT COSTS.

WE COULD BE ADDING $1 MILLION OR ADDING $5.

I DON'T KNOW. I HAVEN'T GOTTEN THAT ON THE BREAKDOWN. I CAN'T VOTE ON SOMETHING WITHOUT KNOWING WHAT IT WILL COST AND IT COULD EXCEED THE MILLION DOLLARS THAT WE HAVE GIVEN THEM AN UP TO, RIGHT?

>> THE CONTRACT SAYS NOT TO EXCEED.

>> NOT TO EXCEED. >> BUT WE STILL HAVE TO NO KNOW.

ARE THEY -- WE HAVE ALREADY ASSIGNED THEM THE CDBG PLANT PROJECTS. THAT HAS ALREADY BEEN DONE UP TO $1 MILLION FOR CDBG. NOW WE ARE COMING BACK -- THE ORIGINAL CONTRACT. WE ARE COMING BACK AND SAYING WE WILL ADD I DON'T KNOW WHAT. A WAY TO GIVE US SOME ESTIMATE WHAT THIS WILL COST EXTRA BEFORE WE VOTE ON IT.

MEANING NOT JUST SITTING RIGHT THERE.

YOU WILL HAVE TO COME BACK AND SO HE MOO THIS.

WE CAN DO IT LATER TODAY. >> VOTE WITHOUT A AMOUNT.

>> OR DO IT PER JOB. IF YOU WANT TO USE THEM ON YOUR JOBS AND TAKE IT OUT OF THE FUNDS.

>> OF YOUR INDIVIDUAL FUNDS. >> I MEAN, THAT IS FAIR.

IF COMMISSIONER COMMISSION WANTS TO USE IT ON A PROJECT AND HE BUDGETS THAT IN. I JUST HAVE GOT TO HAVE 1078

NUMBER OTHER THAN. >> RIGHT.

TO BE -- TO BE CLEAR AND MAKE SURE WE ARE ALL KIND OF ON THE SAME PAGE. THE CDBG IS TOTALLY DIFFERENT THING COVERED BY CDBG. THE ARPA FUNDING, THE CONTRACT AMOUNT IS NOT TO EXCEED $1 MILLION.

A TASK ORDER THAT FALLS BENEATH THE ORIGINAL UMBRELLA CONTRACT OF NOT TO EXCEED $1 MILLION THAT HAS A BREAKOUT -- IF I BELIEVE -- WRONG, $10 AN HOUR FLEW THE END OF THIS YEAR WHICH IS UTILIZED TO DISCOVER, BASICALLY, WHERE YOU GUYS STAND.

AS OF RIGHT NOW GRANTWORKS, WE DON'T KNOW -- WE HAVEN'T BEEN BROUGHT TO THE TABLE WHERE YOU ARE ON ALL OF THE PROJECTS ARPA WISE AND WHAT THE PROGRAM DRESS HAS BEEN ON THOSE.

AND WE ARE GOING TO NEED MULTIPLE PEOPLE TO COMB HOW THAT ALL OF THE DOCUMENTATION THAT EXISTS TO IDENTIFY WHERE YOU STAND WHERE YOUR ARPA PROJECTS, WHAT STATUS THEY ARE IN.

AND GET A HANDLE ON WHAT IS CURRENTLY ALLOCATED TO CERTAIN PROJECTS. SO THE WORK -- THE TASK ORDER WILL BE USED FOR THAT PURPOSE FOR US TO SIT TOWN AND START LOOKING AT WHERE YOU GUYS ARE. ONCE THAT HAS BEEN IDENTIFIED AND WE CAN CLEARLY SAY THIS IS THE NEXT PATH FORWARD THEN WE --

[01:35:06]

THAT TASK ORDER WILL END. A NEW TASK ORDER THAT YOU WILL AGREE TO THAT IS BASED ON OUR NEW FOUNDED LEVEL OF UNDERSTANDING WHERE YOU STAND IN YOUR CURRENT PROJECTS AND WHAT NEEDS TO BE DONE TO GET YOU GUYS ACROSS THE FINISH LINE.

>> GOOD CLARIFICATION. SO TWO PHASE SZ WHAT YOU ARE TELLING ME. I STILL NEED A NUMBER ON PHASE 1. YOU ARE COMING IN ASKING FOR ADDITIONAL MONIES WE HAVE NOT ALREADY CONTRACTED YOU FOR, THEN I NEED TO KNOW -- BECAUSE NORMALLY IF SOMEONE IS GOING TO BID ON SOMETHING OR MAKE A PROPOSAL, WE DON'T PAY FOR THE PREPARATION TO MAKE THE PROPOSAL.

THAT IS A LITTLE BIT OF A DIFFERENT ASK --

>> WE ARE DOUBLE PAYING BECAUSE ALREADY STARTED IT AS GRANTS.

>> A ASK FOR ME. I WILL LISTEN TO IT, BUT A TOUGH ASK IF YOU SAY I HAVE TO SPEND A BUNCH OF MONEY TO TELL YOU HOW MUCH MORE YOU ARE GOING TO SPEND AND HOW MUCH WE ARE GOING TO SPEND OF YOUR MONEY. BUT I AM GETTING A LITTLE DICEY ON THAT ONE. BECAUSE MOST OF THE TIME PEOPLE COME IN AND MAKE A PROPOSAL AND SAY WE WILL DO THIS FOR YOU FOR X. AND YOU ARE SAYING WE WILL CHARGE YOU TO TELL YOU WE ARE GOING TO MORE.

>> PART OF THE MILLION DOLLAR NOT TO EXCEED.

>> BUT YOU ARE ASKING FOR MONEY NOT TALKED ABOUT OR ALLOCATED

FOR. >> WE WERE REQUESTED TO PUT A TASK ORDER TOGETHER THAT WOULD ENCOMPASS WHAT WE NEEDED TO DO COME AND SAY, OKAY, WE NEED -- WE NEED TO COME TO THE TABLE AND HAVE A CONVERSATION AND LOOK AT WHERE YOU STAND.

WE ARE HAPPY TO TAKE ON THE FULL WORKLOAD.

PART OF BEING ABLE TO DO THAT SITTING DOWN TO LOOK AT WHERE YOU ARE AND HOW TO GET YOU ACROSS THE FINISH LINE.

>> WHY WOULD THAT COST. WHY NOT AN EVALUATION.

IF YOU WERE MAKING A BLIND PROPOSAL FOR US AND NOT UNDER CONTRACT. WE WOULDN'T PAY YOU TO PUT TOGETHER A PROPOSAL TO TELL US WHAT YOU ARE GOING TO DO THE NEXT ROUND. YOU WILL COME IN WITH THE

PROPOSAL. >> TYPICALLY WE DON'T DO IT THIS WAY. WE HAVE DONE IT THIS WAY BECAUSE WE WERE UNDER THE IMPRESSION A TASKS ORDER AND YOU WANTED TO SEE A BREAKDOWN OF WHAT IT WOULD COST TO DO IT.

>> DID THE COURT MAKE THAT REQUEST? AN INDIVIDUAL COMMISSIONER CAN ASK FOR STUFF TOO.

>> IT WAS A REQUEST FOR A COMMISSIONER.

SO BE PUT TOGETHER THE TASK ORDER.

THE WORK ORDER TO HAVE A LUMP SUM CONTRACT AND INCLUDED IN THAT THAT WE WILL SPEND TIME IN THE TABLE SORT OF DISCOVERING AND GOING THROUGH DEVELOPMENTAL. JUST THE GIVEN.

IN THIS CASE IT WAS BROKEN OUT SO AN HOURLY RATE WILL BE PLACED THROUGH AND WE COULD SEE WHERE WE ARE HEADED.

THE OVERALL CONTRACT IS NOT GOING TO EXCEED $1D MILLION TO INCLUDE ALL ACTIVITIES THAT GRANTWORKS IS GOING TO PROVIDE WHICH IS FULL MANAGEMENT AND ADMINISTRATION TO CLOSE OUT.

SO EVEN IF -- WHEN WE SIT DOWN UNDER THIS FIRST WORK@IZATION THAT IS NOT TO EXCEED THE $87,000.

REDUCED FROM IF THE MILLION DOLLAR CAP.

SO WE ARE NOT TALKING OF EXCEEDING THE MILLION DOLLARS

BUT WORKING UP TO. >> I APPRECIATE THAT, BUT I DON'T WANT TO SPEND $1 MILLION. I SAID THAT AT THE PETITION

BEGINNING TOO. >> YOU DID.

>> I GET IT. I AM GLAD YOU SAY IT WILL NOT EXCEED MILLION. I AM NOT GOING --

>> IT WILL NOT GO OVER THAT. >> SO AT THE END OF THE DAY -- DO YOU HAVE ANY IDEA WHAT IT WILL COST FOR THE FIRST TASK ORDER. NOT THE SECOND ONE --

>> THE FIRST ONE -- YEAH, THE FIRST ONE IS TO REALLY ENGAGE US SO WE CAN ACTUALLY START WORKING AT THINGS AND WHERE YOU ALL ARE AND MOVE THINGS ALONG. WE HONESTLY FIGURED -- WE PUT TOGETHER A PROPOSAL OF $145 AN HOUR NOT TO EXCEED $87,000.

PERIOD OF PERFORMANCE -- >> $87,000.

>> NOT TO EXCEED. >> YOU WANT $87,000 TO TELL US HOW MUCH IT WILL COST TO SPEND IN THE NEXT ROUND.

>> PART OF THE $1 MILLION NOT TO EXCEED.

I KNOW. >> COMMISSIONER, YOU GO THE TO REVIEW EVERYTHING THAT IS ALREADY ON THE TABLE.

>> WHY WOULD WE PAY THEM TO DO THAT.

>> OKAY, YOU SAY HERE IS WHAT WE HAVE DONE.

NOW GO TO THE NEXT STEP. HOW WOULD WE KNOW WHAT WAS DONE WAS DONE RIGHT WHAT ELSE DO WE NEED TO DO.

>> WE NEED TO GO TO THE TABLE AND WHERE YOU GUYS ARE AND WHAT IS DONE AND NOT DONE AND BE ABLE TO GIVE ADEQUATE ADVICE BASED ON

WHAT WAS DISCOVERED. >> YOU CAN'T GET THAT FROM THE ARPA MANAGER EMPLOYED BY NUECES COUNTY? TECHNICALLY, THE ARPA MANAGER IS STILL IN CHARGE WITH THIS UNTIL WE RELEASE HER. WHAT CAN'T YOU GET THAT WILL COST ME -- NOT ME, BUT COST THE COUNTY AN ADDITIONAL $87,000.

[01:40:04]

UP TO -- NOT TO EXCEED. YOU ARE COMING IN NOT TO EXCEED.

SPEND 86,500. WHATEVER.

YOU ARE BEING TRANSPARENT ABOUT IT, BUT WHY WOULD I WANT TO SPEND $87,000 OF ARPA FUNDS WHEN I HAVE A ARPA MANAGER THAT OUGHT TO BE ABLE TO RELAY TO YOU WHAT YOU NEED SO YOU CAN THEN MAKE A PROPOSAL TO GET AFTER IT. AND I DON'T KNOW WHAT THE

PROPOSAL TO GET AFTER THIS. >> I DON'T KNOW --

>> WE ARE IN THAT SAME BOAT. WE NEED TO SIT DOWN AND GO THROUGH THINGS AND WILL TAKE MULTIPLE STAFF MEMBERS OF OUR

OWN IN TIME TO DO IT. >> EVEN THE $87 MILLION -- $87,000 -- SORRY, NOT MILLION. IS -- ARPA MANAGER'S ANNUAL SALARY AND YOU CAN YOU ARE TALKING A COUPLE OF WEEKS.

>> A MONTH AND A HALF -- >> THE NUMBER IS A LITTLE BIT

ALARMING. >> IT IS, AND I SEE -- PERFORMANCE ON THIS TASK ORDER SAYS FIB -- YOU MENTIONED

DECEMBER. >> YES, OUR ACTUAL WORK AUTHORIZATION WE SUBMITTED ENDED DECEMBER 31, 2023.

>> I THINK IT IS UPDATED, $87,000 FOR FOUR MONTHS.

>> NOT TO EXCEED. WE ARE NOT SAYING IT WILL TAKE THAT MUCH. WHAT WE ARE SAYING THE HOURLY RATE IS $145. WE CAN VERY WELL GET THIS DONE WITHIN THREE WEEKS. WHEN ORIGINALLY SUBMITTED THIS A MONTH AGO AND A TABLE DISCUSSION.

SO WE HAVEN'T BEEN ABLE TO SIT AND REALLY LOOK AND DIGEST.

BY THE TIME WE SUBMITTED THIS, THE $87,000 WAS MORE APPROPRIATE. POTENTIALLY BASED ON THE AMOUNT OF TIME LEFT IN THE YEAR. AS OF TODAY'S DATE, THERE IS ONLY A COUPLE OF WEEKS LEFT IN THE REST OF THIS YEAR.

SO I DON'T THINK WE WILL GET ANYWHERE CLOSE TO THAT.

WE WERE TRYING TO LEAVE SOME ROOM IN CASE WE NEEDED TO KEEP WORKING UNDER THIS CURRENT WORK AUTHORIZATION.

>> BASED ON -- YOU SAY $140 AN HOUR.

>> $145. >> LET ME MAKE SURE I DO THIS RIGHT. $87,000 DIVIDED BY 145 AN HOUR.

YOU WILL NEED 600 HOURS TO GET US TO KNOW WHERE WE WERE ON ALL THE PROJECTS. THAT IS STAGGERING.

>> IT WAS A -- IT WAS A BALLPARK FIGURE IN CASE WE NEEDED TO GO THAT ROUTE TO GET US THROUGH THE END OF THE YEAR.

NOT SOMETHING THAT WE ARE -- NOT TO EXCEED.

WE DON'T THINK WE WILL BILL ANYWHERE NEAR THAT AMOUNT BECAUSE IT IS HOURLY. IF WE HAVE FIVE STAFF MEMBERS ON THIS SO WE CAN GET IT DONE IN TWO WEEKS TO SEE WHERE WE ARE

AT, THEN. >> WHAT ARE YOU GOING TO DO.

TELL ME -- AGAIN. >> EXPLAIN WHAT THE PROCESS WILL

BE. >> I AM SURE A LOT OF THESE DISCUSSIONS WERE HAD OTHER PLACES AND YOU CAN'T HAVE IT WITH THE WHOLE COURT, I GET IT. THE COMMITTEE, WE CAN ONLY HAVE TWO MEMBERS THERE AND WITH THAT TEAL.

SAME THING WITH THIS. THIS IS A CHALLENGE -- OTHER PEOPLE HAVE SEEN IT AND ACTUALLY SHOULD BECAUSE THEIR THING.

I HAVE NO ISSUE. >> I DON'T MIND AT ALL.

>> I AM TRYING TO FIGURE OUT WHAT YOU ARE GOING TO DO FOR 600

HOURS. >> WELL, SO THE FIRST PART OF IS, WE NEED TO SIT DOWN AND NEED TO HAVE CONVERSATIONS WITH THE COUNTY. HAVE IT BE -- OUR CURRENT ARPA MANAGER THAT YOU HAVE OR ANY OTHER OFFICIALS OR PERSONS YOU DEEM THE APPROPRIATE PARTIES TO TALK TO.

WE HAVE TO SIT DOWN AND FIGURE OUT, OKAY, HOW DID YOU ORIGINALLY INTEND TO SPEND YOUR MONEY AND ALLOCATE YOUR FUNDS.

AND BASED ON THAT REVIEW 9 REPORTING THAT HAS TAKEN PLACE AND VET THAT ALL THOSE PROCESSES HAVE BEEN FOLLOWED THOROUGHLY AND ACCURATELY AND NONE OF IT HAS BEEN DONE INCORRECTLY.

THAT TAKES TIME. >> BUT WE HAVE LAWYERS AND THE GRANT WORKS AND OTHER PEOPLE -- I MEAN OUR PROJECTS ARE ALLOCATED. THERE ARE VERY FEW THAT ARE ON OUR HIGH RISK LIST LEFT. WE HAVE DPN THROUGH THE APPROVAL PROCESS. I THINK MOVING FORWARD THE PROJECTS ARE DETERMINED. AND THEY HAVE BEEN VETTED BY THE ATTORNEYS OR GRAND CANYON OR WHOEVER.

SO NOW WHAT WOULD YOU DO. >> WELL, WE TRUST THAT, BUT PLEASE UNDERSTAND FROM OUR LEVEL OF UNDERSTANDING OF WHAT YOU GUYS HAVE DONE THUS FAR BECAUSE WE DON'T KNOW.

WE JUST HAVE TO DO OUR DUE DILIGENCE AND WE HAVE TO LOOK AT

IT TOO. >> WE TELL THEM TO TAKE RESPONSIBILITY FOR THE WHOLE THING, YOU KNOW, IF SOMETHING HAPPENS BEFORE THEY TOOK RESPONSIBILITY, IT IS GOING TO

FALL BACK ON THEM. >> NO IT IS NOT.

>> YES, IT IS. THEY HAVE TAKEN OVER THE WHOLE THEY THINK. THEY WERE TELLING US THEY WOULD BE RESPONSIBLE FOR THE WHOLE THING -- WITH THE WHOLE THINGS

[01:45:05]

STARTS FROM THE BEGINNING TO MAKE SURE IT IS DONE RIGHT AND EVERYTHING IN THE PROCESS WAS DONE RIGHT.

I HAVE QUESTIONS FROM THE LAST MEETING THAT --

>> WE ARE GOING TO GO BACK IN TIME.

>> A LOT OF STUFF IS -- >> PREAPPROVED PROJECT?

>> YOU SAY YOU WANT TO GO BACK IN TIME AND CHECK EVERYTHING?

>> WANTS TO CLARIFY SOMETHING. IF YOU LOOK AT THE TASK ORDER, IT EXPLAINS EVERYTHING THAT THEY ARE GOING TO DO.

THE REVIEW THE ANALYSIS THEY WANT TO DO RIGHT NOW WHERE TO GO WITH ARPA. AND IT IS VERIFICATION OF WHAT WE HAVE ALREADY DONE AS FAR AS WHAT LULU HAS DONE AND THE PROCESS OF WHAT WE HAVE ALREADY DONE AND THAT IS THE SCOPE OF WHAT THEY ARE SAYING THEY NEED TO VET AND VERIFY.

>> I DON'T WANT TO DO THAT. I WANT TO TAKE IT FROM HERE FORWARD. IF WE ARE GOING TO HIRE YOU NOW AND IF WE HAVE GOT SOME CONCERNS THAT THE ARPA MANAGER HAVEN'T DONE SOMETHING WRITE, THEN SOMETHING NEEDS TO TELL ME THAT BECAUSE I DON'T KNOW OF THOSE. SO IF THOSE CONVERSATIONS ARE GOING ON AND I AM NOT AWARE OF THOSE EITHER, THAT WE NEED TO SAY THAT AND SAY IT OUT HOW. OTHERWISE, THEY WILL TAKE ON IT AT THE POINT OF WHICH THEY TAKE IT.

I HAVE NO INTENTION TO TRIPLE CHECK IT WITHIN THE LAST TWO

YEARS. >> THEN YOU NEED TO MAKE A MOTION AND NOT HOLD ACCOUNTABLE FOR ANYTHING BEFORE THAT.

>> YEAH. I DON'T -- IF THAT IS PART OF

WHAT YOU ARE HAVING THEM DO. >> FOR TAKING OVER THE WORK ON THE DOCUMENTATION AND FINISHING AND PROCEEDING WITH JOBS THAT HAVE ALREADY BEEN PREAPPROVED BY SOMEONE ELSE.

>> YEAH, THAT -- MAYBE THAT IS. >> I THINK THAT IS WHERE I WOULD WANT TO MOVE FORWARD. TALKED TO THE TEXAS ASSOCIATION OF COUNTIES AND TALKED TO EVERYONE.

AND I REALLY FEEL LIKE IT IS DOUBLE PAYMENT AND WASTE OF FUNDS TO GO BACK AND DO THAT SAME PROCESS AGAIN.

I DON'T WANT TO HALT MY PROBLEM. SUPPOSED TO GO OUT FOR A WORK AUTHORIZATION COME JANUARY. AND WE ARE READY TO MOVE.

COMMISSIONER HERNANDEZ. >> I AM JUST WONDERING.

I WANT TO CLARIFY SOMETHING. WE WON'T FIND ANY OF THIS UNTIL

TREASURY QUESTIONS SOMETHING. >> THAT'S CORRECT.

>> HAS IT BEEN DONE FROM THE PREVIOUS ARPA MANAGER? HAS TREASURY LOOKED OVER OR ASKED TO APPROVE SOMETHING AND

HAVE THEY? >> THE ARPA IS REPORT AND TO TREASURY ON A QUARTERLY BASIS. EVERYTHING HAS BEEN VETTED WITH THE COUNTY. THE AUDITOR'S OFFICE AND WE ARE AWARE PROVIDE EVERYTHING IN THEIR FINANCIALS AND EVERYTHING THAT HAS COME TO COURT AND EVERYTHING THAT HAS BEEN

REPORTED IN A QUARTERLY BASIS. >> ATTORNEYS THAT WE HAD --

>> EVERYTHING HAS GONE THROUGH THE COUNTY ATTORNEY'S,

COLLABORATION, CONTRACTS . >> I HAVE NO DESIRE TO GO BACKWARDS. ZERO.

IF THAT IS WHAT THIS IS ABOUT, THAT IS THE DISCONNECT.

WHY WE HAVE TO SPEND ALL THIS MONEY NOW -- MY UNDERSTANDING IF THE THOUGHT IS YOU WILL HAVE TO GO BACKWARD IN TIME.

THAT NOW I GET. AND I AM NOT INTERESTED IN THAT.

>> ALL MONEYS HAVE BEEN ALLOCATED ALREADY.

THERE IS NO UNALLOCATED BESIDES WHAT EACH COMMISSIONER, JUDGE,

HAS ON THEIR OWN ALLOCATION. >> SING WE GOT -- NOW I

UNDERSTAND. >> WE HAVEN'T HAD ANY FEEDBACK

FROM TREASURY. >> COMMISSIONER HERNANDEZ IS

STILL TALKING. >> I AM GOOD.

>> SORRY. >> SO AS FAR AS -- I WAS JUST READING A NOTE FROM JESSICA. TREASURY ISN'T INDIVIDUALLY REACHING OUT TO ANYTHING REPORTED YET AS FAR AS WE ARE AFFAIRS. THAT IS JUST NOT NECESSARILY A NUECES COUNTY THING. BUT ACROSS THE BOARD TYPE OF THING. BUT, YES, TO A CERTAIN EXTENT, WE STILL HAVE TO COME TO THE TABLE BE IT AS IT MAY THINGS ARE COMMITTED AND DONE BY NUECES COUNTY, PART OF THE DUE DILIGENCE TO TAKE ON RESPONSIBILITY AND TO ENSURE THAT EVERYTHING IS ACCURATE, WE HAVE TO LOOK AT WHAT HAS BEEN DONE, EVEN IF IT TAKES US A WEEK TO DO IT.

I MEAN, WE STILL HAVE TO BE ABLE TO LOOK -- IN ORDER FOR US TO KNOW WHERE WE ARE HEADED. WE HAVE TO KNOW WHAT THE VISION WAS GETTING TO WHERE WE ARE AT TO BE ABLE TO CARRY IT FORWARD.

RIGHT NOW GRANTWORKS, WE DON'T KNOW.

WE HAVEN'T HAD THOSE CONVERSATIONS.

WE HAVEN'T LOOKED AT ANY OF THOSE DOCUMENTS BECAUSE WE HAVEN'T BEEN ENGAGED. SO THAT IS WHAT THAT HOURLY RATE WAS SUPPOSED TO INCLUDE WAS TO GIVE US THE OPPORTUNITY TO LOOK

[01:50:03]

DOWN TO WHERE YOU ARE AND THAT WAY WE CAN MOVE FORWARD AND WE ARE NOT TRYING TO OVERCHARGE ANYTHING HERE, BUT WE WERE ASKED TO PROVIDE WHAT WE FELT WAS A RESPONSIBLE HOURLY RATE TO GET IT DONE. AND WE REALLY -- BASED ON -- WE WENT WITH THE HOURLY RATE AND WE HAD TO PUT A CAP CONTINUE TO IT AND THE COMFORT LEVEL AT THE TIME AND WE REPLACED ONE.

WE DIDN'T EXPECT IT TO GET TO THAT AMOUNT.

AND WE ARE REALLY -- WE ARE REALLY JUST TRYING TO MOVE THIS FORWARD SO WE CAN SIT DOWN AND HAVE THE ABILITY TO LOOK AT WHERE YOU GUYS ARE AND KNOW HOW TO GET YOU GUYS TO THE END OF

IT. >> JUDGE, THIS IS AS CLEAR AS MUD TO ME NOW. EVERYTHING THAT WE HAVE DONE SO FAR HAS BEEN VETTED. AND WE HAVE NO INDICATION THERE IS ANYTHING WRONG WITH ANYTHING WE HAVE DONE THUS FAR.

IN FACT, TO THE CONTRARY YOU CAME IN AND MADE DARN SURE THAT SOME OF THE STUFF THAT WAS DONE INCORRECTLY BEFORE YOU WERE HERE GOT CLEANED UP. SO YOU HAVE BEEN SUPER DILIGENT IN WORKING WITH THE COUNTY ATTORNEY AND THE AUDITOR AND GRANTS AND LULU IN MAKING DARN SURE WE WERE IN COMPLIANCE.

SO TO GO BACKWARDS AND DO WHAT SHE IS PROJECTING NOW IS UNNECESSARY AND NOT YOUR FAULT, BUT IT IS A WASTE IN MY OPINION TO DO BECAUSE YOU -- YOU HAVE DONE IT.

NOW, JUDGE, IF YOU BELIEVE WE GOT -- YOU ARE THE ONE MOST INVOLVED IN CLEANING UP THE ARPA MESSES THAT YOU NEED TO CLEAN UP. YOU NEED TO SAY SO BECAUSE DISH JUST THOUGHT WE WERE LOOKING AT HIRING THEM --

>> TO MANAGE THE PROJECTS MOVING FORWARD.

>> RIGHT. >> NOT TO GO BACK AND REVET.

>> THE MANAGER TOOK ANOTHER JOB. WE HAVE A ARPA MANAGER WHO DECIDED TO TAKE ANOTHER JOB WITHIN THE COUNTY.

THAT IS GREAT. SORRY SHE LEFT.

A PERMANENT JOB. THE ARPA JOB WAS ONLY FUNDED THROUGH A PERIOD OF TIME. THIS CONCEPT MAKES SENSE TO ME BECAUSE IT IS HARD TO FIND SOMEONE TO DO A JOB.

AND WE HAVE TO TRAIN AND GET UP TO SPEED AND I GET THAT.

I KNOW IT WILL COST A LITTLE BIT MORE, BUT I THINK THERE HAS TO BE. I THINK THERE NEEDS TO BE A PROPOSAL THAT SAYS HERE IS WHAT IT IS GOING TO BE GOING FORWARD AND LET US DIGEST THAT. NOT GOING BACK IN TIME.

>> AND WE CAN -- YOU CAN PUT IN YOUR DOCUMENT THAT THESE WERE PREAPPROVED. YOU DIDN'T APPROVE THEM GOING FORWARD. WHATEVER.

I HAVE NO FORWARD WITH MOVING FORWARD WITH THAT.

WHAT I WOULD LIKE TO SAY TO EVERYONE UP HERE IS THIS IS REALLY IMPORTANT. WE ARE GETTING TO IT THE STAGE WHERE ALL THESE PROJECTS ARE GOING TO BE TAKING PLACE.

AND WE DO NOT HAVE THE MANPOWER OR THE PERSONNEL TO TAKE CARE OF IT AND THIS IS AN EXCELLENT IDEA MOVING FORWARD WITH THEM DOING THAT. SO AS LONG AS IT IS NOT BACKTRACKING AND WHATEVER WE HAVE TO PUT TO CLEAR YOU AND YOUR COMPANY NAME OR ANYTHING LIKE THAT, I AM FULLY ON BOARD WITH. BUT I THINK WE ABSOLUTELY NEED YOU AND NEED YOUR HELP HAND THIS IS THE POINT IN THE NEXT YEAR OR TWO TO GET THESE PROJECTS TO COMPLETION THAT WE HAVE TO DO

SOMETHING LIKE THIS. >> WE HAVE GOT TWO THINGS.

A CONTRACT ON THE AGENDA TODAY WHICH IS THE GENERAL CONTRACT, RIGHT. AND THEN WE HAVE -- THE WORK ORDER THAT WAS PLACED. DO WE NEED TO JUST OMIT THE WORK ORDER AND JUST ENFORCE THE CONTRACT GIVING US THE ABILITY TO ENGAGE OR DO YOU WANT A WORK ORDER --

>> I WANT A PROPOSAL -- A FINANCIAL PROPOSAL.

THAT IS WHAT I WOULD LIKE. I CAN'T VOTE TO SUPPORT ANYTHING WITHOUT A FINANCIAL PROPOSAL. I AGREE WITH WHAT JUDGE SAID AND COMMISSIONER GONZALEZ BROUGHT THIS FORWARD.

WHOEVER DID THIS. GREAT IDEA.

SUPER GREAT IDEA, BUT I HAVE GOT TO HAVE MORE SPECIFICS.

I NEED TO KNOW WHAT IT WILL COST BASED ON GOING FORWARD NOT GOING

BACKWARDS. >> YOU WOULD LIKE TO SEE MILESTONES AND THAT SORT OF THING.

>> JUST SOMETHING. >> OUTSIDE OF THE ORIGINAL

PROPOSAL WE SUBMITTED? >> MAYBE DO IT -- IF YOUR PROJECT IS A $1 MILLION, THIS IS WHAT YOU CAN EXPECT TO PAY FOR OUR WORK OR SOMETHING ON THE VARIANCE OR SOMETHING.

>> SURE. >> FOR THE INDIVIDUAL PEOPLE SO HE KNOWS ON HIS PROJECT WHAT IT WILL COST.

>> SURE. WE CAN WORK ON SOMETHING.

I WAS JUST TRYING -- >> JUST A LEVEL --

>> I WAS TRYING TO THINK OF OUTSIDE OF THE RFP SUBMITTAL WHEN THIS WAS OPENED AND IT INCLUDED OTHER SERVICES THAT WAS REQUESTED OUT OF THAT. SO WE CAN DO SOMETHING VERY

SIMILAR. >> GET TO A LIST OF ALL THE PROJECTS IF YOU CAN DO -- AND DO AN INDIVIDUAL ONE AND COST ESTIMATE FOR YOUR PROJECT IS THIS.

AND THAT WOULD BE EVEN BETTER. I THINK WE ABSOLUTELY HAVE TO ARE HAVE THIS. WE NEED THIS, PLEASE.

>> SURE. WE CAN DO IT HOWEVER YOU GUYS

WANT US TO DO IT. >> FOR ME THAT WILL BE A BETTER

PLAN. >> THE ARPA MAN INJURY IS IN

[01:55:01]

PLACE UNTIL WE KNOW SHE ISN'T. SHE HAVEN'T BEEN RELIEVED OF HER TUTTI. MAY HAVE TAKEN ANOTHER JOB AND I AM STILL CALLING HER ASK HER STUFF WHEN I NEED TO.

NOT THAT SHE LEFT AND -- I THINK THIS IS A GREAT CONCEPT AND WE NEED TO HAMMER IT DOWN A LITTLE TIGHTER AND SHE IS STILL HERE.

WE ARE NOT LEFT OUT IN THE COLD UNTIL WE GET THIS IN PLACE.

SO IT IS IMPORTANT, BUT NOT OF AN EMERGENCY STATUS THAT WE HAVE TO DO IT TODAY BECAUSE LULLU IS STILL HERE.

I AGREE -- >> WE CAN BRING IT BACK ON THE 13TH, IF YOU COULD -- CAN YOU DO SOMETHING THAT QUICKLY?

>> I THINK SO. THAT IS DOABLE.

>> THAT IS WHAT I WANTED TO ASK, NOT EMERGENCY.

BUT EVERY WEEK COUNTS. AND IT IS LIKE -- I GET WHAT YOU ALL ARE SAYING TO VET EVERYTHING AND HAVE A BETTER PROPOSAL AND I WORRY TOO THAT THESE WEEKS, THESE DAYS ARE ADDING UP AND WE ARE GETTING CLOSER TO THIS FINISH LINE.

AS SOON AS WE CAN GET GRANTWORKS ON THE BETTER.

>> LULU IS STILL -- VERY MUCH DEDICATED TO THE ARPA PROJECTS AND STILL WORKING WITH THEM. WORK WITH MY STAFF.

>> WORKING WITH MY OFFICE. SHE WAS JUST HERE THE OTHER DAY.

>> SHE IS STILL REPORTING RESPONDING TO ANYBODY THAT ASKS.

SHE IS STILL LOOKING -- >> I DO AGREE.

WE NEED SOMEONE TO HELP US MOVE FORWARD.

I STRONGLY FEEL AND BELIEVE THAT GRANTWORKS CAN AND SHOULD DO THAT WORK FOR US. I WOULD WANT TO MAKE SURE THAT WE HAVE NOT JUST A CONSENSUS BUT FULL SUPPORT FROM THE COURT ON THIS. IT IS SUCH AN PORCH DECISION.

AND DO YOU THINK THAT YOU CAN HAVE ALL THE DATA AND THE PROPOSAL FOR US TO TAKE ACTION BY DECEMBER 13, BY OUR NEXT

MEETING? >> OH, I KNOW SHE CAN.

>> OKAY. SO COMMISSIONER SPOKE FOR YOU.

>> BUT HEARD HIM. >> WE CAN -- WE CAN HAVE IT DONE BY THE 13TH. WE NEED TO MAKE SURE THAT IT IS

COMPREHENSIVE OF THE PROJECT. >> I WANT TO MAKE SURE THAT YOU ENGAGE WITH LULU AND SHE ENGAGE WITH YOU.

WHATEVER YOU NEED AND IT SHOULD BE ON THE ABLE.

>> IF WITH COULD HAVE A MEETING WITH LULU, JUST A CALL WANTING TO PUT THE PRICE POINTS BY PROJECTS.

IF WE CAN HAVE A CALL AS EARLY AS THIS WEEK.

>> IF YOU FOLLOW WITH ANA, WE CAN GET THAT SET UP.

>> WE CAN GO THROUGH THE PROJECTS.

>> OUR DATES DON'T COME UP, AND EVERYTHING IS STILL ON THE COURT AND WE PRESENTED ALL THE PROJECTS.

EVERYTHING IS OUTLINED. THE DOLLAR AMOUNT.

>> WE WILL MAKE IT AVAILABLE. ADD ME IN ON THAT MEETING AND WE WILL HAVE IT IN THE CONFERENCE ROOM.

>> JUDGE, CAN I MAKE ONE POINT. WE NEED TO LOOK AT THIS AS A HYBRID. WE HAVE THE GRANTS DEPARTMENT FOR A REASON. THIS IS A GRANT.

SO I -- I GET THAT Y'ALL HAVE PLENTY TO DO, BUT I THINK Y'ALL NEED TO BE INVOLVED AND HAVE A ROLE IN THIS.

>> OF COURSE. >> MEANING -- I WOULD LIKE TO SEE SOME SORT OF HYBRID PRESENTATION AND IMPORTANT TO HAVE GRANTWORKS ON IN SOME CAPACITY AND I THINK IT FALLS TO GRANT. THIS IS A GRANT.

IT HAS TO FOLLOW UNDER GRANTS. THIS HAS TO RUN THROUGH GRANTS.

SO I THINK YOU INTIMATELY NEED TO BE INVOLVED PUTTING THIS TOGETHER WITH NATALIE BECAUSE WE ARE STILL -- I AM STILL LOOKING TO GRANTS. THE CONSULTANT TO THE GRANTS DEPARTMENT IF WE DO THIS. I DON'T THINK THEY ARE A CONSULTANT TO THE COURT. I THINK IT ALL HAS TO RUN THROUGH YOU EVERY GRANT NEEDS TO RUN THROUGH YOU IN SOME CAPACITY. YOU WILL NEED SUBJECT MATTER EXPERTISE. BUT YOU HAVE LULU WITH A LOT OF SUBJECT MATTER EXPERTISE ON ARPA AND A I AM AGO PROVIDE CAN ADDITIONAL HELP AND I DON'T WANT TO SPEND A TON OF MONEY WE DON'T HAVE TO SPEND THAT WE CAN SPEND ON PROJECTS IF WE HAVE PEOPLE IN GRANTS WHO CAN DO SOME OF THE WORK.

THAT IS JUST MY PERSPECTIVE. MAY NOT BE WHAT THE COURT'S

PERSPECTIVE IS. >> JUST LIKE EVERYTHING ELSE, BOTTOM LINE, IT FALLS ON NUECES COUNTY.

TO IT IS GOING THEM WORKING. ANY OTHER THIRD PARTY CONSULTANT BUT BOTTOM LINE STILL NUECES COUNTY.

>> WE WILL PUT IT IN AND WORK IT OUT THE THREE OFS.

>> I AM LOOKING AT THEM DOING THE WORK THAT LULU IS GOING TO DO. THEY ARE DOING THE WORK.

>> WE HAVE A LOT OF JOBS COMING UP WITH A LOT OF DOCUMENTATION THAT WILL BE NECESSARY. A LOT OF PAPERWORK TRAILS.

WITH HE CAN NOT AFFORD TO NOT GET IT CORRECT IN THE COUNTY.

[02:00:03]

>> AS DIRECTED BY GRANTS AND THE COUNTY AUDITOR'S OFFICE.

IF HE HAD WARD HERE'S A OUTSIDE VENDOR, HE IS STILL RESPONSIBLE FOR THIS PROJECT. YOU WILL STILL BE RESPONSIBLE AND I KNOW YOU WILL BE IN THERE --

>> YES, SIR, WE JUST NEED TO STAY IN COMMUNICATION AND STAY

INVOLVED. >> WE CAN PROBABLY SET UP QUARTERLY MEETINGS TOGETHER. EITHER TEAMS OR SOMETHING ONLINE. WE ARE GOING TO MOVE THIS TO THE DECEMBER 13 MEETING TO BRING IT BACK MAKE A MOTION FOR THAT.

>> NEED TO WITHDRAWAL THE MOTION.

THIS. >> THERE IS A MOTION ALREADY.

WE NEED FOR YOU TO WITHDRAW -- >> I HAVE A QUESTION FORTUNATELY. WE GOT CAUGHT UP ON QUESTIONS.

>> SURE. >> THIS IS A PARTICULAR AMOUNT.

FINITE AMOUNT, BUT I GUESS A LOT OF ENTITIES CAN DO BY PERCENTAGE. AND THAT -- IS THAT WHAT YOU ARE

PROPOSING OR WILL BE PROPOSING? >> SOUNDS LIKE BASED ON THE CONVERSATION TODAY, YES, THEY WANTING TO SEE SOME TYPE OF A FINANCIAL SCALE BASED ON PROJECT AND THAT WILL BE PERCENTAGE BASED ON EACH INDIVIDUAL PROJECT.

SOME THAT PROBABLY -- FROM EARLIER COMMENTS IF A COMMISSIONER WOULD LIKE TO COVER EXPENDITURES OUT OF THEIR ALL OCCASION OF THINKING MAYBE IS THE REASON FOR THAT.

BUT, YES. >> BECAUSE THERE ARE NO LEFTOVER FUNDS TO PUT INTO THIS. SO IT WILL HAVE TO BE THE INDIVIDUAL PROJECTS COVERING THE COST.

>> WE WILL BUILD THAT. BUILD THE STRUCTURE BASED ON THAT AND WE WILL SET UP A MEETING FOR THIS WEEK.

AND IN ORDER FOR US TO HAVE THE RIGHT AMOUNT OF TIME TO BUILD THAT OUT FOR THE 13TH, WE NEED TO MAKE SURE WE HAVE ALL THE NECESSARY DOCUMENTATION TO CONSIDER IN BUILDING THAT PLAN

SO WILL HAVE TO BE THIS WEEK. >> DEADLINE FOR WHAT?

>> WE WILL SET UP THE MEETING THIS WEEK AND IF YOU WANT TO GO NEXT DOOR AND GET WITH PEYTON. I AM AVAILABLE THURSDAY MORNING OR FRIDAY. LET'S SEE WHAT WE CAN DO.

>> SOUNDS GOOD. THANK YOU, ALL.

>> YOU ARE GOING TO WITHDRAW YOUR MOTION.

THE MOTION WE HAD. NOW WE NEED A MOTION TO BRING THIS BACK TO DECEMBER 13. SOMEBODY WANT TO SECOND IT.

>> SECOND. >> ALL IN FAVOR, SAY AYE.

ANY OPPOSED, SAME SIGN. >> YOU HAVE FIVE.

>> WE CALLED THEM TOGETHER. >> WE CALLED THEM TOGETHER.

>> DID YOU ADD IT IN AFTERWARDS. >> WE BROUGHT THE ITEMS AND SAID WE WOULD DO THEM AT THE SAME TIME.

WE TABLED THEM STATEMENT. >> WE WILL BRING THEM BACK HOWEVER -- THEY WILL PUT A NEW MOTION ON FOR THE 13TH BECAUSE

YOU EITHER DO. YOU HAVE MILESTONE FOR PERCENTAGE OF COMPLETION. I WANT TO MAKE SURE THAT WE ARE CLEAR IN THE COURT THAT WE DO OFFER BOTH OPTIONS.

AND THAT IN THE FUTURE THIS WON'T BE SUCH A DIFFICULT MOVING FORWARD FOR YOU AND YOUR PRO PROJECTS. WE HAVE A MOTION AND A SECOND.

[1. Discuss and consider taking action regarding CR 18 bridge repairs located at the intersection of CR 18 and CR 65, and other related matters.]

THAT. OKAY ITEM B, PUBLIC WORKS DISCUSS AND CONSIDER TAKING ACTION REGARDING COUNTY ROAD 18 BRIDGE REPAIRS LOCATE LOCATED AT INTERSECTION OF COUNTY ROAD 18 AND 56. I KNOW THESE REPAIRS HAVE ALREADY BEEN DONE. IS JUAN HERE?

>> THIS IS MY ITEM. I WOULD LIKE TO ASK JJ TO COME UP AND EXPLAIN WHAT WE DID, WHAT HAS BEEN DONE IN ORDER TO MAKE THIS BRIDGE A SAFE BRIDGE. SO.

>> THIS IS A TEMPORARY FIX? >> GOOD MORNING, COMMISSIONERS.

GOOD TO BE HERE TODAY. I HAVEN'T BEEN HERE IN A WHILE.

FEW PHOTOS. TXDOT HAD A LETTER CLOSING THIS BRIDGE AND THE COMMISSIONERS WERE GOING BACK AND FORTH WITH THE DRAINAGE DISTRICT WHO IS RESPONSIBLE FOR FIXING IT BUT THE EXTENT OF THE DAMAGE WAS PRETTY BAD.

THE BRIDGE WAS CLOSED. WHAT HAPPENED ON THE BRIDGE IS THE UNDERMINING ON THAT -- I WILL GO QUICK THROUGH THE SLIDES THAT YOU ARE SEEING. SO AT FIRST RIGHT FLORIDA YOU WILL SEE ONE PHOTO THERE WHERE THE BRIDGE IS SHOWN IT IS CLOSED AND ON THE RIGHT HAND SIDE. AND WHAT HAPPENED ALL THAT MATERIAL THAT WAS -- THAT WAS HOLD THE ROAD BACK DOWN INTO THE -- DOWN INTO THE BRIDGE ABUTMENT AND WENT DOWN STREAM WITH -- WITH THE WATER AND THE STORMS. SO IF YOU GO TO THE NEXT SLIDE, YOU WILL SHOW. AND THAT IS THE CONTINUE THAT IT WAS IN. AND YOU SEE THAT ON THE PICTURE ON LEFT. AND YOU SEE THE SUPPORT COLUMN AND THE BOTTOM EXCEPTION OF THE ABUTMENT IS GONE AND THE SOIL BEHIND THE RETAINING WALL AND ABUTMENT WAS -- WAS UNDERMY.

AND THE PHOTO ON THE RIGHT ARE YOU WILL SEE ONE OF OUR GUYS LOOKING INTO BASICALLY BEHIND THE TIMBER WALL.

I KNOW IT TOOK A LITTLE BIT OF TIME BETWEEN GETTING THE PROJECT APPROVED AND EVERYTHING, WE HAD MORE UNDERMINING HAPPENING AT THE TIME. GO TO THE NEXT PHOTO.

THE NEXT SLIDE. WE DID AN ABUTMENT OF THE BRIDGE TO RETAIN THOSE -- THAT BACKFILL PACK DID ACCESS POINTS TO IT THE TOP, TO FILL EVERY VOID THAT IS UNDER THAT ROAD AND BEHIND THAT ABUTMENT WALL AND KEEP THAT MATERIAL FROM COMING OUT THAT WALL CREATED HERE. ANOTHER THING THAT WE SAW THAT WE RECOMMENDED AND WHEN YOU HAVE TRUCKS AND FARM EQUIPMENT APPROACHING THE BRIDGE, THE PART THAT STARTS TO FAIL RIGHT AWAY IS THE ENTRANCE TO THE BRIDGE. THAT ASPHALT WEARS DOWN AND YOU HAVE RAIN ALL THAT WATER GOES INTO THE SUBSOIL AND DEGRADES THE -- THE -- THE BACKFILL BEHIND IT.

SO WHAT WE DID WAS CREATED A CONCRETE APPROACH ON BOTH SIDES AND LESSENED THAT IMPACT OF THE FARM EQUIPMENT AND TRUCKS AND WHATEVER TRAFFIC GOES THROUGH THERE AND THE CONCRETE PAVEMENT AND THE BRIDGE TO BE ABLE TO PROVIDE A BETTER PRODUCT THAT WILL LAST LONGER THAN USUAL. AND THEN WE GO TO THE NEXT SLIDE TH THERE YOU SEE WITH THE BOTTOM OF

[02:10:06]

THE BRIDGE. WE PUT AS FAULT COATING ON THE NEW ABUTMENT WALL AND CONCRETE ON THE APPROACH ON BOTH SIDES.

LET ME TO THE NEXT -- THE NEXT PHOTO THERE.

YOU SEE A PHOTO ON THE LEFT IS ME AND MY SON EXPECTING THE REBAR -- I THINK IT WAS A SUNDAY HE GAVE IT THE THUMBS UP AND POURED IT FOR THE APPROACH. ON THE PHOTO THERE ON THE RIGHT, YOU WILL SEE THE -- THE ABUTMENT ALREADY FIXED AND ALSO SOME RIPRAP UNDERNEATH, THE WHITE ROCK THAT YOU SEE THE LINING.

THAT IS ROCK THAT WE FURTHER IN THERE TO PREVENT EMOTION.

THE BRIDGE IS READY AND CONCRETE CURED.

WE ALREADY OPENED IT. RIGHT, COMMISSIONER?

>> WE OPENED IT. >> IS TXDOT NOT GOING TO FIX IT?

IT LOOKS TOO GOOD. >> FROM WHAT I UNDERSTAND THAT THE COUNTY, YOU APPLIED FOR A TXDOT GRANT.

THEY COME AND THEY REBUILD THE WHOLE BRIDGE, BUT THEY USUALLY TAKE TWO OR THREE YEARS SOMETIMES, SOMETIMES EVEN

LONGER. >> I THOUGHT THIS ONE WAS ALREADY ON THE LIST TXDOT -- IT LOOKS LIKE YOU HAVE DONE GOOD

REPAIRS. >> YOU WILL HAVE A BRIDGE FOR A

WHILE. >> A SAFE BRIDGE.

>> A SAFE BRIDGE. >> THANK YOU.

APPRECIATE IT. >> JUAN, ANYTHING WITH TXDOT TO LET THEM KNOW THAT WE HAVE REPAIRED IT?

>> YES, COMMISSIONER. WE NOTIFY ONCE THE BRIDGE WAS REPAIRED. WE CONTACTED TXDOT.

THEY WERE NOTIFIED AND TOOK OFF THE BARRICADES TO ALLOW TRAFFIC TO GO THROUGH THE BRIDGE. IT IS OPEN AT THIS TIME.

>> THERE IS NOTHING WE NEED TO VOTE ON ON THIS OR ANYTHING.

>> I WOULD LIKE TO MENTION TO JENNY -- HAVE JENNY, IF WE FIND OUT THAT IS BELONGS TO DISTRICT NUMBER TWO, SEND THEM AN INVOICE

WE ARE TRYING TO SAY CAN WE MAKE THIS ONE MONTH AND PROBABLY ONE OR TWO WEEKS IN JANUARY TO ALLOW US TO MAKE SURE THAT WE GET OUR BILLS PAID TO DO THIS AS WE WOULD NORMALLY DO IT AS EXPENSES AND HAVE TO BRING IT BACK TO COURT FOR VERIFICATION.

NOT MAINTAINING IT FOR THE FULL YEAR.

BUT WE FORWARDED THIS TO THE COUNTY ATTORNEY'S OFFICE AND HAVE REVIEWED THE INFORMATION IN QUESTION.

THIS WOULD BE THE AMOUNT OF TIME TO GET WORKDAY COMPLETELY WORKING AND USSUSPENDING THE CONTRACT WITHIN SIX MONTHS.

>> THIS IS COMING OUT, YOUR BUDGET?

>> THAT'S CORRECT. >> I WILL MAKE THE MOTION TO PASS.

>>. >> WE HAVE A MOTION AND A SECOND. ALL THOSE IN FAVOR, SAY AYE.

WE WILL NOT HAVE PHONE SERVICE. >> YES.

>> THIS COMES OUT OF YOUR BUDGET.

>> YES, IT IS ALREADY BUDGET ED >> WE HAVE A MOTION AND A SECOND. ALL IN FAVOR, SAY AYE.

ANY OPPOSED, SAME SIGN. THE MOTION PASSES.

>> BEFORE YOU GO INTO EXECUTIVE SESSION, I HAVE A QUESTION.

IF THAT IS OKAY JENNY, DISCUSS AND CONSIDER EMPLOYMENT DUTIES DISCIPLINE OF THE I.T. DEPARTMENT IS BACK ON THE AGENDA. OBVIOUSLY THE PERSONNEL MATTER.

HE HAS EVERY RIGHT TO HAVE THAT DONE IN THE BACK ROOM, BUT IF WE DO, WHAT -- WHAT RIGHT DO WE HAVE TO BE ABLE TO DISCUSS ALL THE STUFF THAT WENT ON BECAUSE A VERY PUBLIC ISSUE.

WHERE IS THE LINE THERE AND THE DISTINCTION AND WHAT IS POSTED -- I AM JUST TRYING TO FIGURE OUT -- I THOUGHT THIS WAS RESOLVED, IT IS NOT. IF WE ARE GOING TO HASH IT BACK OUT LET THE PUBLIC KNOW WHAT WENT ON.

BECAUSE IT SAYS IN OPEN SESSION. SO I AM A LITTLE CONFUSED WHAT WE CAN AND CANNOT TALK ABOUT TODAY AND HOW --

>> THIS IS WRITTEN TO PROVIDE YOU THE FLEXIBILITY.

AND I HAVE NOT CONFERRED WITH YET TO FIND OUT IF HE IS GOING TO EXERCISE A DESIRE TO HAVE THE DISCUSSION IN OPEN OR IN PRIVATE AND WE CAN DO THAT FOR JUST A MOMENT AND IT IS WRITTEN SO THAT YOU CAN HAVE YOUR DISCUSSION IN PRIVATE IN EXECUTIVE, BUT YOU DECIDE DISCUSS AND CONSIDER AND TAKE ACTION AND YOU DON'T NEED A DUPLICATE APPLICATION. PROVIDING YOU FLEXIBILITY.

>> WE DON'T HAVE TO SAY IN OPEN SESSION IF WE HAVE AN ACTION ITEM ON THERE. WE DON'T HAVE ANYTHING ELSE.

>> I AM ALL FOR DOING THIS IN OPEN SESSION BECAUSE I THINK THE PUBLIC NEEDS TO KNOW WHAT BENT ON.

IF HE WANTS TO DO IT IN THE BACK, THAT IS FINE.

[02:35:02]

I AM ALL FOR DOING IT IN THE OPEN.

WHATEVER I JUST DID WANT TO RECITE OFF ALL THE SECTIONS BEFORE ALL THAT WAS DETERMINED. WHATEVER.

>> WOULD THE COURT ALLOW ME TO CONFER WITH DARYL REAL QUICK?

>> YEAH. >> I CAN RESPOND HIS CONCERN.

COMMISSIONER, FOR THE FULL DISCUSSION WITH THE COMMISSIONERS COURT, THERE WILL BE A LOT OF DISCUSSION ON CYBERSECURITY. AND THAT IS NOT SOMETHING THAT I WOULD DISCUSS IN OPEN SESSION. THAT IS KIND OF A VULNERABILITY, BUT IT ALSO -- WE CAN SEPARATE IN EXECUTIVE SESSION WHAT HAPPENED AND COME BACK OUT AND I CAN MAKE -- I HAVE NO PROBLEM COMMENTING ON THE FACTS WHAT IS HAPPENING WITH THE LOSS OF THE DOMAIN. AND A LOT MORE INFORMATION TO BE

BE PROVIDED FOR COMMISSIONERS -- >> NOTHING POSTED OF ANY KIND OF CYBERSECURITY DISCUSSION. THIS IS ALL ABOUT -- THIS IS ALL JUST POSTED AS DISCUSS THE APPOINT.

EMPLOYMENT EVALUATION AND REASSIGNMENT OR DISMISSAL OF THE I.T. DIRECTOR YOU ARE OPPORTUNITY TO 551.

THERE IS NO -- I DIDN'T KNOW WE WERE HAVING A DISCUSSION ON CYBERSECURITY THAT THE WHOLE INCIDENT THAT WAS RELATED TO WHAT WE DISCUSSED LAST TIME WAS PURELY RECORDING THE DOMAIN AND HOW THAT WAS IN MY OPINION PRETTY CATASTROPHIC.

SO WHY ARE WE -- WE DIDN'T POST ANYTHING ABOUT CYBERSECURITY.

>> I BELIEVE THAT IT IS POSSIBLE THAT DURING THE DISCUSSION OF WHAT HAPPENED IN THE PERFORMANCE, I THINK HE IS DESCRIBING THAT HIS EXPLANATION TO THE COURT WILL INVOLVE ISSUES WITH CYBERSECURITY. IS THAT --

>> OKAY. IF YOU THINK -- IF YOU VETTED IT AND YOU THINK IT MEETS THE POSTING REQUIREMENT, I WILL LEAVE THAT TO YOU -- TO YOUR -- YOU ARE THE ATTORNEY.

>> YOU ARE IT. >> OKAY.

ARE WE READY THEN? >> YES, MA'AM, THANK YOU.

>> JUDGE, AFTER A DISCUSSION WE WERE PARTICIPATED THE PARTNERSHIP WITH THE CITY OF CORPUS CHRISTI I MOVE -- I MAKE A MOTION THAT THE COUNTY CHANGE DIRECTIONS AND WITHDRAW FROM THE CITY-COUNTY HEALTH DISTRICT IN ORDER TO FOCUS ON OUR RURAL PUBLIC HEALTH SERVICES OUTSIDE THE CITY LIMITS WHICH WE ARE

COMMITTED TO SERVE. >> SECOND.

>> WE HAVE A MOTION AND A SECOND --

>> QUICK DISCUSSION. >> CLARIFICATION?

>> I JUST WANT TO SAY -- WE HAVE REALLY ENJOYED THE PARTNERSHIP WITH THE CITY. THIS HAS NOTHING TO DO WITH ANYTHING OTHER THAN THE COUNTY JUST WANTS TO FOCUS MORE ON THE AREAS THAT WE ARE LEGALLY OBLIGATED TO DO WHICH ARE THOSE AREAS IN THE -- OUTSIDE THE CITY LIMITS AND INSIDE THE NUECES COUNTY. WE DID PROVIDE -- I THINK THE COUNTY ATTORNEY SENT TO THE CITY ATTORNEY AND JUDGE CONTACTED VIA TEXT THE MAYOR TO LET HER KNOW WHAT WE WERE DOING.

I THINK THERE IS A 120-DAY PROVISION THIS WILL TRIGGER SO NOT GOING TO BE ANY LAPSE IN SERVICES.

ANYTHING OF THAT NATURE BECAUSE WE GOT THAT.

I KNOW COMMISSIONER GONZALEZ AND OTHERS HAVE BEEN WORK ON DIFFERENT IDEAS TO FOCUS ATTENTION ON THE RURAL AREAS TO MEET THE NEEDS THERE. SO THERE IS NO NEGATIVE TO THIS.

WE THINK WE CAN ALSO SAVE SOME -- SOME -- YOU KNOW, MONEY ON OUR END WHICH WILL MAYBE OFFSET SOME OF THE MONEY WE SPENT TODAY, JOHNNY, SO IS YOU CAN'T ASK ME FOR ANY MORE NEXT YEAR.

I WAS JOKING WITH COMMISSIONER GONZALEZ ABOUT THAT.

AGAIN, NO NEGATIVE HERE. PARTNERSHIP HAS BEEN GREAT.

I THINK IT WORKED SUPER WELL. NOBODY HAS ANY REAL OBJECTION OR ANYTHING. WE JUST WANT TO FOCUS ON THE RURAL AREAS THAT WE REPRESENT. AND THAT IS REALLY WHAT WE ARE GIVEN -- OUR ADVICE FROM COUNCIL.

THAT IS WHAT WE ARE LEGALLY OBLIGATEDED TO DO.

AND WE APPRECIATE EVERYTHING THAT THE CITY HAS DONE AND A GREAT PARTNERSHIP, AND WE LOOK FORWARD TO WORKING WITH THEM ON

THIS AND OTHER ISSUES. >> YOUR HONOR, BEFORE YOU VOTE, WE NEED TO MAKE SURE WHEN THIS WITHDRAWAL IS FINALIZED.

WHEN WE KNOW THE PAYMENTS NEED TO BE STOPPED.

>> WE WILL MAKE SURE. >> IT COO BE -- 120 DAYSES.

>> 120 DAYS. WE WILL WORK IT OUT.

THIS IS A PEACEFUL EASY THING. AND WE LOOK FORWARD TO WORKING

WITH THE CITY ON THIS. >> SMOOTH TRANSITION.

AND THIS IS TO INCLUDE THAT IT IS NOT TO EXCLUDE WHOEVER TAKES THIS ON MONTH TO MONTH WILL STILL BE PERMITTED TO BID ON THESE SERVICES.

>> I THINK ALSO WE NEED TO MAKE SURE WE INCLUDE IN THE MOTION THAT THE CURRENT EMPLOYEES ALSO STAY WHERE WE ARE WITH WHOEVER COMES IN AND TAKES THIS OVER TEMPO

TEMPORARILY. >> YES, OUR DESIRE TO CONTINUE.

>> THEY ARE DOING A GREAT JOB. >> I WILL SECOND THAT AND COMMISSIONER GONZALEZ IS RIGHT. THE EMPLOYEES HAVE DONE A WONDERFUL JOB AND THEY HAVE BEEN WITH SEVERAL DIFFERENT COMPANIES IN THE JAIL. THEY HAVE BEEN THE CONSISTENCY IN ALL THIS. THEY HAVE BEEN THE ONES TO KEEP US GOING THROUGH ALL THE CHANGES THAT WE HAVE THROUGHOUT THE YEARS WITH DIFFERENT COMPANIES. SO WE DEFINITELY APPRECIATE THEM. AND I THINK WHAT WE HAVE TALKED ABOUT DOING, I THINK, JUDGE, THAT IS WHY I WAS ASKING TO YOU

REREAD IT. >> IT DIDN'T HAVE IT IN THERE TO AUTHORIZE ME TO SIGN THE CONTRACT AND BRING IT BACK TO

COURT FOR RATIFICATION. >> I DON'T KNOW IF THAT NEEDS TO

BE -- >> YOU HAVE THE EXCEPTION.

IF YOU DO IT, YOU BRING IT BACK FOR RATIFICATION.

>> SAID BASED ON THE FACT THAT THE CONTRACT IS EXPIRING TO ALSO INCLUDE IN THE MOTION THAT THE JUDGE, COUNTY ATTORNEY AND SHERIFF WILL WORK TOGETHER TO FIND SOMEBODY IMMEDIATELY TO

TAKE OVER -- >> THEY ARE ALREADY ON THEIR WAY

OVER THERE RIGHT NOW. >> JUST TO PUT IT AS PART OF THE

PUBLIC RECORD. >> IS THAT COMING US TO?

TAKEN. >> ON B, C, D.

THERE WAS NO ACTION TAKEN. >> JENNY, I THINK WE DID TALK ABOUT NOT HAVING THIS A AND B LIKE THIS.

WE TOOK ACTION ON A AND NO ACTION ON B BECAUSE WE DON'T NEED TO HAVE THEM ON THERE TWICE.

AND WHERE THERE IS ONE ITEM. >> YES.

>> PLEASE. THANK YOU.

>> AND. THERE ANY ADJOURNMENTS IN MEMORY? IF THERE ARE NONE, THEN I WILL

ACCEPT A MOTION TO ADJOURN. >> SO MOVED.
