OUR ITEM NUMBER 2 IN RECOGNITION OF THE MONTH OF 2023 AS SUICIDE [2. In recognition of the month of September 2023 as "Suicide Prevention Awareness Month".] PREVENTION AWARENESS MONTH. AND CAN I GET A MOTION AND SECOND? WE HAVE A MOTION AND SECOND. IN RECOGNITION OF SEPTEMBER 2023 AS SUICIDE PREVENTION MONTH. WHEREAS, SEPTEMBER IS SUICIDE PREVENTION AWARENESS MONTH, A TIME TO, IN ADDITION TO SHIFTING [00:05:07] PUBLIC PERCEPTION, WE USE THIS MONTH TO SPREAD HOPE AND VITAL INFORMATION TO PEOPLE AFFECTED BY SUICIDE. THE GOAL IS TO START THE CONVERSATION ABOUT MENTAL HEALTH AND IMPACT OF SUICIDE. TO HELP CONNECT PEOPLE WITH THE MENTAL HEALTH RESOURCES AND SUICIDE PREVENTION SERVICES AVAILABLE IN OUR COMMUNITY. AND WHEREAS SUICIDE IS THE NUMBER 2 CAUSE FOR 15 TO 24, AND THE 12TH LEADING CAUSE OF DEATH OVERALL IN THE U.S., AND WHEREAS, THE HIGHEST RATES OF SUICIDE IN THE U.S. ARE AMONG AMERICAN YAIRND, ALASKAN NATIVES, FOLLOWED BY NONHISPANIC WHITES, LESBIAN, GAY AND BISEXUAL YOUTH ARE FOUR TIMES MORE LIKELY TO ATTEMPT SUICIDE THAN STRAIGHT YOUTH, TRANSGENDER YOUTH ARE NINE TIMES MORE LIKELY TO ATTEMPT SUICIDE IN THEIR LIFE COMPARED TO THE GENERAL POPULATION AND SUICIDE IS THE MOST COMMON, FOUR TIMES MORE LIKELY TO DIE BY SUICIDE. 46% OF PEOPLE WHO DIE BY SUICIDE HAD A DIAGNOSED MENTAL HEALTH CONDITION. BUT RESEARCH SUGGESTS THAT 90% MAY HAVE EXPERIENCED SYMPTOMS OF AN UNDIAGNOSED MENTAL HEALTH CONDITION. AND WHEREAS, ON AVERAGE, THERE ARE 130 SUICIDES PER DAY IN THE U.S., WITH THE RATE OF SUICIDE BEING HIGHEST IN MIDDLE AGED WHITE MEN. AND WHEREAS, EACH AND EVERY SUICIDE DIRECTLY IMPACTS A MINIMUM OF 100 ADDITIONAL PEOPLE INCLUDING FAMILY, FRIENDS, CO-WORKERS, NEIGHBORS, AND COMMUNITY MEMBERS, AND WHEREAS, THE NATIONAL ALLIANCE ON MENTAL ILLNESS GREATER CORPUS CHRISTI ENCOURAGES ALL COMMUNITY MEMBERS TO IDENTIFY THE WARNING SIGNS TO TAKE THE TIME TO UNDERSTAND THE IMPORTANCE OF MENTAL HEALTH EDUCATION AND RECOGNIZE THAT TAKING CARE OF OURSELVES AND OTHERS EQUATES TO TAKING CARE OF MENTAL HEALTH AND MENTAL HEALTH SERVICES. NOW THEREFORE BE IT RESOLVED THAT THE COMMISSIONERS COURT OF NUECES COUNTY DOES HEREBY COMPLAIM OCTOBER SEVENTH 2023, ADVOCATE FOR BETTER MENTAL HEALTH CHARACTER INCLUDING EFFECTIVE AND ACCESSIBLE CRISIS RESPONSE SYSTEM. BECAUSE OF SUICIDE PREVENTION IS EVERYONE'S BUSINESS. >> THANK YOU ABOUT MUCH MAY HAVE A MOTION AND SECOND. ALL THOSE IN FAVOR SAY AYE. AYE. ANY OPPOSED, SAME SIGN AND I KNOW WE HAVE SOME PEOPLE HERE THAT WANT TO SPEAK ON THIS. FOR ME SUICIDE IS PERSONAL. ON DECEMBER THINT, 2011 MY NEPHEW TOOK HIS LIFE. AND MY LIFE HAS NEVER BEEN THE SAME SINCE THEN. YOU KNOW, WE GRIEVED THE LIFE THAT HE COULD HAVE HAD AND NOW WE'LL NEVER KNOW. HIS MOTHER IS STILL NOT EVEN ABLE TO TALK ABOUT IT IN PUBLIC. SO I DO IT FOR HER. I'M HER VOICE, I'M THE VOICE OF CHRIS. AND I -- MY BIGGEST MESSAGE IS THAT SUICIDE IS PREVENTIBLE. THERE ARE WARNING SIGNS, MOST OF THE TIME. IF WE KNOW THE WHAT THEY ARE. WE DIDN'T KNOW THE WARNING SIGNS IN 2011. IT WAS BEFORE I EVEN KNEW ABOUT NAMI BUT THANKFULLY I'VE LEARNED, I'VE EDUCATED INSIGHTFUL. AND WE JUST WANT EVERYONE IN THE COMMUNITY TO KNOW THAT SUICIDE IS PREVENTIBLE. LEARN THE WARNING SIPHONS. DON'T BE AFRAID TO ASK A LOVED ONE IF THEY'RE THINKING OF KILLING THEMSELVES. IT'S NOT EASY TO SAY. IT'S SOMETHING I'VE HAD TO PRACTICE. BUT I KNOW THAT THAT QUESTION AND JUST BEING THERE TO LISTEN CAN REALLY SAVE A LIFE. I'M HERE ON BEHALF OF MULTIPLE PEOPLE IN THE COMMUNITY WHO HAVE LOST A LOVED ONE TO SUICIDE. RANDY IS WITH US TODAY AND HE DIDN'T WANT TO SPEAK SO I'M HERE ON BEHALF OF RANDY TO HONOR COLTON. AND THE COUNTLESS OTHERS. >> THANK YOU VERY MUCH. >> THANK YOU. >> HEATHER'S GOING TO SAY A LITTLE BIT REAL QUICK. >> SURE. >> HI, MY NAME IS HEATHER LOW, I'M THE INCOMING AFFILIATE LEADER FOR NAMI. I'VE BEEN SUICIDAL MORE TIMES THAN I CAN COUNT. I HAVE BEEN HOSPITALIZED VOLUNTARILY AND INVOLUNTARILY FOR SIX WEEKS. IT'S NOT FUN. BUT THE BEST THING THAT YOU CAN [00:10:02] DO, ABSOLUTELY WHAT YOU HAVE TO DO IS SHED LIGHT ON THE TOPIC. DO NOT KEEP IT IN THE DARK. TALK TO YOUR FAMILY MEMBERS, YOUR LOVED ONES AND LET IT BE OKAY THAT THEY'RE SHARING THEIR FEELINGS WITH YOU. LET IT BE OKAY THAT THEY'RE SAYING I HAVE SUICIDAL THOUGHTS. BECAUSE OTHERWISE IT'S GOING TO STAY IN THE DARK. IT'S GOING TO STAY STIGMATIZE ED AND TABOO AND WE CAN'T HAVE THAT BECAUSE THAT'S WHERE TRAGEDY HAPPENS. THAT'S WHERE PEOPLE DIE. ONE OF THE ONLY REASONS WHY I'M HERE IS BECAUSE I HAD SUCH A GOOD SUPPORT SYSTEM. AND I WAS ALLOWED TO SHARE MY FEELINGS. SO PLEASE. GOOGLE THE WARNING SIGNS. GOOGLE THE RISK FACTORS. FIND OUT IF YOUR LOVED ONES ARE DOING OKAY AND REALLY LISTEN TO THE ANSWER. BECAUSE YOU DON'T WANT TO BE ON THE OTHER SIDE OF THAT. THANK YOU. >> THANK YOU HEATHER. WE HAVE THIS IF Y'ALL WOULD LIKE TO COME FORWARD, IF YOU WANT A PHOTO WE'RE HAPPY TO SPREAD THE WORD AND THE MORE PEOPLE THAT HEAR ABOUT THIS, WE BELIEVE IT'S IMPORTANT AND -- IN THE NEXT ITEM BEFORE WE BEGIN WITH PUBLIC COMMENT I'D LIKE TO ASK IF ANY MEMBERS, ANY COMMISSIONERS HAVE ANY ITEMS THE THEY WISH TO TABLE? AHEAD OF TIME IF YOU KNOW OF ANYTHING? I DON'T HAVE ANYTHING. [2. Nueces County Animal Services Advisory Committee] >> I WANTED TO -- I'M SORRY. I WANTED TO POTENTIALLY TABLE G-2 NUECES COUNTY ANIMAL SERVICES ADVISORY COMMITTEE, ONLY BECAUSE I HAVE AN IDEA I WANT TO PURSUE IF THAT'S OKAY, I NEED TO GET WITH JENNY ABOUT IT. I WOULD LIKE TO TABLE IT UNTIL THE NEXT MEETING. I'D ASK FOR THE INDULGENCE OF THE COURT ON THAT. >> G-2? >> THE ANIMALS SERVICES ADVISORY COMMITTEE. >> YES ON THE BEGINNING. I WAS LOOKING AT 3G. I WAS LIKE -- >> THAT'S OKAY. I MAKE A MOTION TO TABLE TO THE NEXT MEETING, I'LL SEND JENNY AN E-MAIL REGARDING WHAT CAN BE DONE BEFORE I PROPOSE IT, JENNY TELLS ME SHE'S NOT SURE. I DON'T MEAN TO PUT HER ON THE SPOT. >> YES, I WILL TALK TO YOU ABOUT SOMETHING ABOUT THAT TOO AFTER TODAY. IF YOU COULD SECTOR ME BECAUSE THERE IS SOME STUFF THAT WAS BROUGHT TO MY ATTENTION TOO. >> IF YOU WANT TO DO THAT BEFORE I TABLE. I JUST WOULD LIKE TO HOLD OFF ON THE APPOINTMENTS BUT IF YOU NEED TO DISCUSS I CAN HOLD OFF ON MY TABLE. >> ON THE APPOINTMENTS THE ONLY THING I WAS GOING TO SAY THERE IS NOT MUCH LEEWAY, THERE IS STATUTORY APPOINTMENTS AND WE ONLY HAD ONE PERSON APPLY FOR SECRET RINNARY POSITION. >> THAT'S WHAT I WANTED TO TALK TO HER ABOUT, IT'S A POTENTIAL EXPANSION, I'VE JUST GOT AN IDEA ON IT AND I WANT TO MAKE SURE IT IS OKAY TO DO IT. THERE IS A REALLY QUALIFIED APPLICANT, WE'VE HAD GREAT INTEREST IN THE BOARD LATELY AND I WANT TO KEEP THAT GOING IF WE CAN. I AGREE WITH WHAT YOU'RE SAYING, PART OF THE REASON I'M TABLING. >> IS IT A VETERINARIAN? >> NO, A NONSPECIFIC SPOT. I HAVE SOME IDEAS. IF I COULD HAVE -- >> WE WOULD HAVE TO VOTE TO [00:15:04] EXPAND THE BOARD IS WHAT YOU POTENTIALLY ARE -- >> THAT'S RIGHT. >> BECAUSE THERE IS SEVEN TO 11 MAX. >> I'VE GOT AN IDEA, I NEED TO ASK HER ABOUT. >> WE HAVE A MOTION TO TABLE THIS TO THE NEXT MEETING. CAN I GET A SECOND? >> SECOND. >> WE HAVE A MOTION AND SECOND. ALL THOSE IN FAVOR SAY AYE, AYE, ANY OPPOSED SAME SIGN THAT MOTION PASSES THANK YOU. >> AND I JUST WANT TO SAY BECAUSE I DON'T WANT TO GET A BUNCH OF E-MAILS FROM ANIMAL SERVICES. NOTHING SINISTER GOING ON. I JUST WANT TO ASK JENNY IF I CAN PROPOSE WHAT I PROPOSE, THOSE BOARD MEMBERS ALL HOLD OVER AND WE'LL DID IT IN THE NEXT MEETING. THANK YOU. >> ANY OTHER TABLED ITEMS FROM ANY OTHER COMMISSIONER? ANYONE SIGNED UP FOR PUBLIC COMMENT? IS THERE ANYONE THAT DIDN'T SIGN UP WHO WISHES TO SPEAK ON PUBLIC COMMENT? >> EXCUSE ME JUDGE. I DO HAVE A QUESTION ON 8. >> FOR TABLING? >> WELL, I JUST WANT TO -- R, YES. >> WE'LL BE THERE, IF YOU WANT TO TABLE SOMETHING MANY WE'LL PULL THOSE IN CONSENT. IS THAT CONSENT AGENDA H? >> YES. >> FOR MORE DISCUSSION, IS THAT WHAT YOU'RE WARRANTING TO DO THAT? I'LL DO THAT NEXT, IN FACT WE'RE ALMOST THERE. [1. Nueces County Airport Advisory Board] SO THERE'S NO ONE THAT SIGNED UP FOR PUBLIC COMMENT. SO MOVING ON WE'RE AT G-1. THE NUECES COUNTY AIRPORT ADVISORY BOARD. AND I AM ASKING FOR A MOTION TO REOPEN FOR APPLICATIONS BECAUSE WE DID NOT HAVE ANY LETTERS OF INTENT. AND ISLY CLARIFIED AND WITH TARA THE 74 POSITIONS THAT ARE OPEN ON THIS AIRPORT ADVISORY BOARD ARE ONE FROM EACH YOUR PRECINCTS. SO YOU MIGHT WANT TO REACH OUT TO -- THERE'S THREE THAT ARE AT LARGE AND ONE THERE EACH OF YOUR PRECINCTS AND ONE OPEN FROM EACH OF YOUR FREE SINGTS. GO AHEAD. >> JUDGE ACTUALLY MY APPLICANT DID SIGN A THOAT IN ASKING TO BE RECONSIDERED AND I DIDN'T EVEN ASK BECAUSE SHE'S ON ANOTHER BOARD IF IT'S OKAY. BUT I KNOW SHE'S SENT IN SOMETHING TO BE RECONSIDERED. I DON'T KNOW WHERE IT WENT. >> IT DIDN'T GO TO TARA AND IT DIDN'T GO TO ME. >> THERE W CORRESPONDENCE FROM HER. >> DID SHE SEND IT JUST TO YOU? >> WE NEED TO SEARCH. REQUEST WE HOLD AND I'LL SEE IF I CAN FIND THAT CORRESPONDENCE. >> I'D LIKE TO DO THE SAME FOR PRECINCT 1. >> YES, WE'LL BRING THAT BACK AND WE WILL HAVE TO REOPEN IF WE DO THAT. HE THINKS HE HAS ONE BUT THAT IS ANOTHER SIMILAR ISSUE ON SOMETHING ELSEWHERE THEY DIDN'T RESPOND TO THE E-MAIL OR THE LETTER THAT WHEREAS SENT OUT. AND SO WE COULDN'T ACCEPT ANYTHING THAT WAS SENT TO THE CHAIR OF THAT BUT THE CHAIR DOES NOT APPOINT ANYONE ON THE OTHER BOARD. SO 80. ITEM NUMBER 3, THE NUECES COUNTY HOSPITAL DISTRICT BOARD OF MANAGERS. WE HAVE TWO LETTERS OF INTENT AND NO NEW APPLICATIONS. THE TWO WERE THE INCUMBENTS. >> DISTRICT NUMBER 4. >> NUMBER 3. >> OH, I THOUGHT HE -- I'M SORRY, I SKIPPED THAT ONE. NUECES COUNTY EMERGENCY SERVICES [3. Nueces County Emergency Service District No. 4] DISTRICT NUMBER 4. THIS IS FILLING A VACANCY AND WE HAVE ONE APPLICATION. AND I WOULD NEED A MOTION TO ACCEPT HIS APPLICATION. >> SO MOVED. >> JESUS GUERRA. WE HAVE A MOTION TO ACCEPT THE APPLICATION FROM MR. GUERRA. DO I HAVE A SECOND? >> SECOND. >> WE HAVE A MOTION AND SECOND. ALL THOSE IN FAVOR SAY AYE, ANY OPPOSED, SAME SIGN. MOTION PASSES. [4. Nueces County Hospital District Board of Managers] NOW MOVING ON TO ITEM NUMBER 4, NUECES COUNTY HOSPITAL DISTRICT BOARD OF MANAGERS. TWO LETTERS OF INTENT FROM INCUMBENTS AND NO NEW APPLICATIONS. >> MOTION TO REAPPOINT. >> SECOND. >> WE HAVE A MOTION TO REAPPOINT AND A SECOND. ANY OTHER DISCUSSION? ALL THOSE IN FAVOR SAY AYE, AYE ANY OPPOSED, SAME SIGN. AND THEN ON ITEM NUMBER 5, THE CORPUS CHRISTI REGIONAL [5. Corpus Christi Regional Transportation Authority Board of Directors] [00:20:04] TRANSPORTATION BOARD OF DIRECTORS. WE HAVE THREE LETTERS OF INTENT. AND ONE ADDITIONAL LETTER. AND I THINK -- IS THIS ONE THAT COMMISSIONER CHESNEY YOU WERE WANTING TO CHANGE THE PROCESS? OR DO WE HAVE A MOTION OR -- >> I DO LIKE TO NOMINATE INDIVIDUALLY, WE CAN. >> WE CAN DO THAT. >> THAT IS THE INTENT OF MY PROCESS TO BE DISCUSSED LATER SO IF YOU WANT TO VOTE HIM UP OUR DOWN HOWEVER YOU WANT TO DO IT. BUT THAT IS WHAT I WANT TO ADDRESS LATER IN THE POLICY BUT AS OF RIGHT NOW WE DON'T HAVE THE POLICY IN PLACE. SO I'M CERTAINLY FINE WITH JUST PUTTING PEOPLE UP INDIVIDUALLY AND HAVING PEOPLE VOTE ON THEM. >> ARE WE GOING TO NOMINATE? >> INDIVIDUALLY SO IF Y'ALL WANT TO MAKE -- >> IF IT'S NOT OUR POLICY JENNY, CAN WE NOMINATE LIKE THAT, OR NOMINATE BY VOTE UP OR DOWN -- >> DOES YOUR POLICY -- >> I WAS ASSUMING MOTION AND SECOND AND A VOTE. >> BY MOTION INDIVIDUALLY, SOMEBODY SAID INDIVIDUALLY, THAT'S THE QUESTION I HAVE DO WE DO IT INDIVIDUALLY. BECAUSE WE'VE NEVER DONE IT THAT WAY. >> WE DON'T REALLY HAVE A POLICY, FOUR APPLICANTS, THREE INCUMBENTS, ONE ADDITIONAL, SO WE'RE KIND OF -- >> I THINK IT'S WITHIN YOUR DISCRETION AS A COURT. >> HOWEVER MANY NAMES OR IS THERE A PROCESS OR HOW DO WE DO THAT? >> I MEAN IS THAT WHAT YOU WERE GOING TO ASK LATER ON? >> FOR ME TO SAY, I CAN MAKE A MOTION THAT WE ELECT ANNA JIMENEZ FOR THE BOARD OF -- >> ARE YOU SAYING YOU WANT TO DO THEM ONE AT A TIME? >> YES ONE INDIVIDUALLY. >> SECOND. >> I WAS GOING TO GET CLARIFICATION OR THE WHAT COMMISSIONER CHESNEY WAS SAYING FOR LATER. >> AND BASICALLY THE PROCESS THAT I'M PROPOSING AND HOPE TO GET SOME INPUT FROM ON THE COURT, IT'S A LITTLE LATE TO DO IT FOR THIS ONE BECAUSE IT HAS AN INTERVIEW PROCESS IN IT FOR OUR MAJOR BOARDS GOING FORWARD AND THAT WAS CIRCULATED, EVERYONE SHOULD HAVE GOTTEN THAT E-MAIL IN HARD COPY. >> AND THAT WAS INCLUDED? >> WE'RE SO FAR DOWN THE PATH ON THIS ONE IT'S HARD TO PICK IT UP ON THIS ONE. BUT PART OF THAT INDICATES EVERY COMMISSIONER PUTTING FORWARD PEOPLE AND WE LOOK AT THE APPLICATIONS, WE PICK OUR TOP 2, IF SOMEONE GETS TWO VOTES, THAT'S FOR A DISCUSSION FOR LATER, WE DON'T HAVE THAT POLICY IN PLACE BUT I'M OPEN. >> WE HAVE A MOTION AND SECOND FOR ANNA JIMENEZ, IS THERE ANY OTHER DISCUSSION ON THIS ONE, OR ALL THOSE IN FAVOR SAY AYE. AYE, ANY OPPOSED, SAME SIGN. >> JUDGE I'D LIKE TO NOMINATE LYNN ALLISON FOR REAPPOINTMENT OR MOVE FOR REAPPOINTMENT. >> WE HAVE A MOTION FOR LYNN ALLISON FOR REAPPOINTMENT. I'LL SECOND THAT MOTION. >> JUDGE -- DO WE HAVE A MOTION -- >> ALL THOSE IN FAVOR SAY AYE. AYE. THOSE OPPOSED, SAME SIGN. >> NAY, NAY. THERE DID YOU VOTE JOHN, 3-2 THE MOTION PASSES. I'LL ACCEPT ANOTHER MOTION. >> I'D LIKE TO NOMINATE AARON MUNOS. >> SECOND. >> WE HAVE A MOTION AND SECOND TO NOMINATE AARON MUNOS. ANY OTHER DISCUSSION? ALL THOSE IN FAVOR SAY AYE. AND WE HAD THREE POSITIONS OPEN AND THOSE ARE OUR THREE. SO WE APPRECIATE THE NUTRITION FROM MS. DOMINGUEZ AND WE HOPE THAT YOU'LL CONTINUE AND DO THIS AGAIN. THANK YOU. YOU'RE NOT READY TO GO BACK? ARE YOU GOING TO TELL ME YOU'RE READY TO GO BACK TO THE OTHER -- >> WELL, THIS IS WHERE I MATE BE QUOOUSK TO MS. PAXTON. THERE WAS SOME CORRESPONDENCE WHERE I RESPONDED AND ASKED SOMETHING ABOUT AN APPOINTMENT AND THEN THE RESPONSE FROM TARA THAT'S CORRECT, AND MS. PAXTON WHICH IS TO ONLY SERVE ON THE BOARD, SHE CAN ADDITION REGARD, SHE SENT ME AN E-MAIL THAT SHE STILL WANTED TO SERVE. I GUESS SHE THOUGHT THAT WAS GOOD ENOUGH, SHE SENT THE RESPONDS TO ME SAYING SHE WANTED TO STAY ON. THEY ALL HOLD OVER, SO IF YOU WANT TO -- >> WE'RE GOING TO BRING THEM ALL BACK SO WE DON'T HAVE FOR THE OTHERS, WE'LL JUST BRING THAT BACK TO I GUESS REOPEN. SO HOW LONG WOULD WE OPEN IT FOR? [00:25:11] >> THROUGH OCTOBER 18. ARE WE TALKING ABOUT THE AIRPORT, RIGHT? >> YES, OPEN IT UP -- >> SEPTEMBER 27 THROUGH OCTOBER 18TH. >> IS THE NEXT MEETING WE WOULD BRING IT BACK TO? >> OCTOBER 18TH. SO WE HAVE A MOTION AND SECOND TO BRING THAT BACK TO THE 18TH. I'LL MAKE THE MOTION. YES. >> AFTER WE REOPEN FOR APPLICATIONS AGAIN. DO I HAVE A SECOND? >> SECOND. >> WE HAVE A MOTION AND SECOND. ALL THOSE IN FAVOR SAY AYE. [2. CONSENT AGENDA: The following Agenda Items are of a routine nature, and the Commissioners Court has received supporting materials for consideration. All of these Agenda Items will be passed with one vote without being discussed separately, unless a member of the Commissioners Court or the public requests that a particular Agenda Item be discussed. One vote will approve the remaining items on the Consent Agenda.] >> ANY OWNED, SAME SIGN, MOTION PASSES. MOVING ON TO OUR CONSENT AGENDA. ARE THERE ANY ITEMS ON THE CONSENT AGENDA? COMMISSIONER WISHES TO PULL FOR MORE DISCUSSION. >> I DO. >> YES, SIR. D. F AND O. >> DF AND O. >> D F AND O. JUDGE I'VE GOT ONE. A. JUST SOME SMALL WORDING ADDITIONS TO THE MINUTESSEN. >> OKAY. ANY OTHERS? COMMISSIONERS AND ANY OTHERS? >> DID SOMEBODY SAY THEY'RE PULLING G? >> NO. WE HAVE A D F AND O. DO YOU WANT G PULLED? >> YES I DO. >> UH-HUH. ALL RIGHT. ARE WE GOOD TO GO? ANYBODY ELSE? >> JUDGE I AM GOING TO, I'M SORRY. JUST HOLD ON, LET ME FIND IT, I APOLOGIZE. I WANTED TO PULL THE ONE FOR BOB HALL BUT -- THERE YOU GO, R. >> DID YOU WANT TO PULL? >> JUST FOR BRIEF STATEMENT, YES, MA'AM. THANK YOU. >> YOU'RE WELCOME. OKAY I WILL ACCEPT A MOTION TO PASS WITH THE EXCEPTIONS OF A, D, F, O, G AND R. FOR DISCUSSION. >> SO MOVED, SORRY. >> THANK YOU. I HAVE A MOTION. >> LITTLE SLOW THIS MORNING JUDGE. >> DO I HAVE A SECOND? >> SECOND. >> WE HAVE A MOTION AND SECOND. ALL THOSE IN FAVOR SAY AYE. [A. Accept Commissioners Court Minutes for September 13, 2023 and September 19, 2023.] AYE, ANY OPPOSED, SAME SIGN. AND COMMISSIONER CHESNEY I BELIEVE YOU HAD A FIRST. >> YES, MA'AM THANK YOU. AND I SENT TARA AN E-MAIL LAST NIGHT BUT I WANTED TO ON PAGE 8 OF THE SEPTEMBER 13 MINUTES, LORENZO, WHERE IT SAYS MOTION BY COMMISSIONER GONZALEZ, SECONDED BY COMMISSIONER HERNANDEZ, I JUST WANTED TO ENTER WORDING THAT SAID MOTION FOR THE NEW TAX RATE. SO IF I CAN MAKE A MOTION TO AMEND THAT SO THAT IT'S SUPER-CLEAR THAT THAT WAS A MOTION TO NOT RAISE TAXES I WOULD APPRECIATE THAT. IF I CAN GET A SECOND FOR THAT AMENDMENT. >> I'LL SECOND THAT. WE HAVE A MOTION AND SECOND. ALL THOSE IN FAVOR SAY AYE. AYE. ANY OPPOSED, SAME SIGN. THE MOTION PASSES. >> THEN JUDGE ONE MORE ON THAT ONE. I'M SORRY. >> GO AHEAD. >> I SHOULD HAVE DONE IT THE SAME TIME. THAT NEEDS TO BE FROM THE 1115 WAIVER FUNDS SO THAT'S CLEAR. SO AGAIN I WOULD MOVE THAT WE AMEND THEM TO THE LANGUAGE, FROM THE 1115 WAIVER FUNDS. >> YES, GOOD CATCH. I WILL MAKE THE SECOND ON THAT MOTION. ALL THOSE IN FAVOR SAY AYE, AYE. ANY OPPOSED, SAME SIGN. >> AND THEN NOW JUDGE I WOULD MAKE A MOTION TO PASS, ACCEPT THE COMMISSIONERS COURTS MINUTES AS AMENDED. >> WE HAVE A MOTION AND SECOND. ALL THOSE IN FAVOR SAY AYE, ANY [D. COMMISSIONER GONZALEZ, SPECIAL MOTIONS LIST. >> I JUST WANT TO PULL THAT ONE OUT BECAUSE I WANTED TO DO SOME DECLARATION BECAUSE I WAS GOING TO ADVISE THAT THE JOB HADN'T BEEN COMPLETED 100%. [00:30:04] AND IT WAS BEING PAID. >> WHICH INVOICES ARE WE TALKING ABOUT THERE? >> NUMBER 12 AND 13. >> THE STODDARD INVOICES THESE WERE, I CALLED ABOUT THESE AS WELL. AND THESE WERE PUT ON THE DESK AND MISPLACED I THINK THEY WERE PULLED BECAUSE THEY HAD BEEN LEFT THERE. >> THE THING IS JUDGE IT WAS 100% DONE. THERE ARE CHANGE ORDERS THAT WERE ADDED TO THAT. >> GOOD ON THESE ADA COURTHOUSE IMPROVEMENTS, YES. >> BUT THERE IS RETAINAGE AND THE CHANGE ORDERS OF THE REQUEST OF THE COUNTY. BUT THE MONEYS WERE THERE TO PAY OR THE THAT. BUT ORIGINALLY, THE -- WHAT WAS SUPPOSED TO BE DONE WAS DONE OTHER THAN THE CHANGE ORDERS THAT BROUGHT IT UP TO A LITTLE HIGHER. SO THERE'S REALLY NOT -- AND I MEANT THIS MORNING JUST TO MAKE SURE THAT THAT WAS CORRECT. SO OTHER THAN THAT, EVERYTHING IS OKAY WITH THOSE -- >> I CHECKED WITH PUBLIC WORKS AS WELL. THOSE WERE TWO THAT I HAD CALLED ABOUT BEFORE THE MEETING. I PULLED THOSE OUT. THEY SAID THEY WERE BOTH GOOD TO GO. >> SO I THINK WE'RE OKAY. I THINK THERE WAS A QUESTION I HAD ABOUT. >> I APPRECIATE YOU BRINGING THAT OUT, BECAUSE I DID TOO. >> I JUST WANTED TO JUST -- BEFORE IT GOES FURTHER AND WE KNOW WE VOTED ON SOMETHING. >> JUST TO EXPLAIN A LITTLE MORE INFORMATION ON THAT ITEM, YES. >> THERE'S STILL MORE PENDING. THERE ARE A COUPLE MORE CHANGE ORDERS THAT ARE PENDING THE REQUEST OF THE COUNTY SO WE NEED TO FINISH THOSE AND WE SHOULD BE THROUGH, RIGHT? >> RIGHT. >> NOTHING TO DO WITH THE ORIGINAL CONTRACT. >> OKAY. >> SO OTHER THAN THAT I MOVE TO TAKE NO ACTION. >> SO ARE YOU MAKING A MOTION TO PASS D THEN AS-IS? >> YES. MOVE TO PASS. >> I'LL SECOND THAT MOTION. ALL THOSE IN FAVOR SAY AYE. AYE, ANY OPPOSED, SAME SIGN. THE MOTION PASSES. [F. Authorize payment of bills - Special Motions List - Hagerty dated September 27, 2023.] MOVING ON TO ITEM F. >> F, I ALSO PULLED F. BECAUSE I MET WITH ANNA A COUPLE OF TIMES AND I STILL HAVE A LOT OF QUESTIONS ON THE ERAP ON THE INVOICES, YOU KNOW, WOULD BE SO SIMPLE, I GUESS IT WOULD BE, I DON'T KNOW. TO PUT EVERYTHING THAT'S INVOLVED WITH INVOICE 7912 TOGETHER, INVOICE 8059 TOGETHER AND INVOICE 8052 TOGETHER, BECAUSE RIGHT NOW WE HAVE A STACK OF I DON'T KNOW WHICH BELONGS TO WHAT INVOICE. BUT IT'S BEEN APPROVED BY HAGERTY. I DON'T SEE A SIGNATURE WHERE WE APPROVED IT. SO I ASKED ANNA TO PULL WHATEVER SHE CAN PULL. I JUST WANT TO MAKE SURE WE'RE PAYING BUT PAYING FOR SOMETHING THAT WE GOT. I WANT -- ANNA DO YOU HAVE AN ANSWER OR THE US NOW? BECAUSE IF NOT I'M GOING TO TABLE IT. >> YESTERDAY YOU TALKED AND SAID YOU WEREN'T ABLE TO OPEN THOSE THAT I.T. SENT YOU. WERE YOU ABLE TO OPEN UP? >> WE SHOWED THE SCREEN SHOTS. >> NEITHER ONE OF US COULD SEE THE INSIDE. WE COULDN'T OPEN IT UP TO -- >> THEY HAVE APPLICANT, THEIR SOCIAL, THAT'S WHY I GAVE SNIPPET OF IT, NOT SHOWING ACCOUNT NUMBERS OR SHOWING ADDRESSES OR THEIR NAMES. >> IS THERE ANY WAY WE CAN GROUP THOSE INVOICES, WHATEVER GOES WITH THIS INVOICE TO GROUP IT TOGETHER? >> IN THE BACKUP, KIND OF STABLE IT OR -- >> SECTION IT -- STAPLE IT? >> I DON'T KNOW WHEN ALL THIS HERE, I REALLY DON'T KNOW WHAT THE BOYS ARE TALKING ABOUT. >> I SUBMITTED THEM TO THE AUDITORS AS AN INVOICE WITH ALL THE BACKUP. >> AUDITS SEEM TO BE ACCEPTING A LOT OF STUFF THAT'S GOING THROUGH BUT, YOU KNOW -- >> AS INDIVIDUAL INVOICES I MEAN THE COVER SHEET AND THEN THE INVOICE ITSELF WITH ALL THE BACKUP AND THEN THE OTHER INVOICE, THERE WAS THREE INVOICES LISTED ON THAT LETTER. >> HOW DO WE DO -- HOW DO WE IDENTIFY WHAT'S IN THE INVOICE 7912? OR 8059? >> IN THE ENGINEER PACKETS YOU RECEIVED YOU SHOULD EACH HAVE THE INDIVIDUAL INVOICE THAT I WAS REFERRING TO, HER LETTER INCLUDING THE INVOICE WE HAVE, TO SUMMARIZE INVOICE 4 WHAT THE HOURS WERE WORKED AND WHAT THE BALANCES WERE THERE. [00:35:02] SO THERE ARE IN YOUR PACKET INVOICES FOR EACH OF THE BILLS SHOWING. >> THESE ARE THE INVOICES YOU ARE TALKING ABOUT? >> YES. >> I'M LOOKING AT THEM TOO BUT IT DOESN'T TELL ME WHAT INVOICE IT IS. IT DOESN'T TELL ME -- >> INVOICE MEMBER 7912 IS THE VERY FIRST ONE YOU HAVE. IT HAS A NUMBER ON IT. >> IT ONLY TELLS ME IT'S 3.5 HOURS. BUT DOESN'T GIVE ME THE TOTAL. >> IT LOOKS LIKE THIS 7912 HAS ALL OF THESE INVOICES WITH IT UNTIL YOU GET TO THE NEXT COVER SHEET, HAGERTY. >> THIS IS TO ME VERY CONFUSING, AND I KNOW THAT I.T. WAS DOWNLOADING SOME OF THIS ANDIVITY IS NOT PART OF GRANTS. >> I.T. HAS NOTHING TO DO WITH THESE INVOICES. >> THAT'S WHAT YOU WERE DOWNLOADING YOU SAID. >> NO, THE DATA, ALL THE DATA, THAT HAGERTY HAS ONE -- WE HAVE OUR OWN SOLUTION, THEY HAVE THEIR OWN QUICK BASE SOFTWARE, THEY WERE ENTERING THEIR MANAGEMENT THROUGH THAT. THE ONLY THING WE HAVE IN OUR SYSTEM WOULD BE THE DOCUMENTATION THAT WE DOWN LOADED OURSELVES TO SUBMIT FOR PAYMENT. OF CLIENTS. THIS IS THE INVOICES FOR HAGERTY CONSULTING THAT DID THE CASE MANAGEMENT AT THAT TIME, JANUARY THROUGH MARCH OF 2022. >> NOW IF I LOOK AT THE INVOICE HERE, TRYING TO FIND THE NUMBER OF THE INVOICE, PO, THIS ONE HERE I GUESS IT'S INVOICE, I DON'T KNOW WHAT NUMBER THAT IS. BUT IT ALSO HAS ABOUT FIVE PEOPLE'S NAMES ON THERE. ALL THESE PEOPLE ARE GETTING PAID FROM THIS INVOICE FOR WORK? >> YES, SIR. >> WHAT DO THEY DO, FIVE PEOPLE WORKING ON ONE INVOICE? >> IT'S STAGES. YOU'RE TRYING TO GET INFORMATION WITH CLIENTS. THE CLIENTS WOULD HAVE TO SUBMIT DOCUMENTATION BACK AND FORTH. SO SOME PEOPLE DO THE CASE MANAGEMENT. AND THEN SOME PEOPLE DID THE AUTHORIZATION. SO I MEAN IT'S A -- >> AN THEN THEIR OWN PEOPLE APPROVE ALL THAT. SO BUT YOU KNOW, SOME PEOPLE ARE CHARGING US 220 AN HOUR, 170 AN HOUR, 180 AN HOUR. >> THAT'S PART OF THE CONTRACT THAT WAS WITH THE AUTHORIZATION OF THE RATES. >> AND THESE ARE THOSE INVOICES WE'VE HAD TROUBLE WITH FOR A LONG TIME THAT ARE 2022 INVOICES? >> THEY WERE NOT SUBMITTED ON A TIMELY BASIS AND DISCOVERED AFTERWARDS. AND THAT'S WHY WE WERE TRYING TO SUBMIT THEM. >> BY HAGERTY? >> NO HAGERTY SUBMITTED THEM BUT THE PREVIOUS DEPARTMENT DID NOT SUBMIT THEM FOR PAYMENT TO THE AUDITOR'S OFFICE. >> WE HAD THEM, THEY RETURNED THEM TO US. SO THAT'S ON US. >> DID THEY SAY WHAT WAS THE DELAY, DELAYED THE PAPERWORK, PAYMENT? >> IT WAS NOT SUBMITTED FOR PAYMENT BY THE DEPARTMENT. NUECES COUNTY. >> NOBODY'S OVERSEEING THAT OR -- >> IT WAS PREVIOUS MANAGEMENT SIR. >> ALL RIGHT THANK YOU. I DON'T KNOW JUDGE Y'ALL WANT TO PAY IT? >> WITH YOUR MOTION, IT'S YOUR -- YOU STILL HAVE THE FLOOR ON IT. >> I WROTE RATHER DALE IS THERE ANY WAY WE CAN GROUP THIS BY INVOICE? >> WHAT'S THE QUESTION? >> CAN WE GROUP THIS ONE BY INVOICE? >> THEY SUBMIT EACH ONE INDIVIDUAL BY INVOICE. WE CAN PAY THEM WITH ONE CHECK BUT THEORETICALLY THEY PROVIDED THE THREE INVOICES. WE ARE PAYING THE THREE INVOICES BECAUSE EACH SHOWING A SEPARATE DATE THAT THE INVOICE WAS SUBMITTED. >> DO YOU HAVE ANY INPUT? >> I BELIEVE SEVERAL DEPARTMENTS ARE LOOKING AAT THESE INVOICES TO MAKE SURE THERE IS NO OVERLAP. I BELIEVE -- I DON'T SEE LULU HERE. SHE HAD NOTHING TO DO WITH THE ERA PRESIDENTIAL. >> I KNOW AT SOME POINT SHE HAD BEEN CONCERNED ABOUT SOME OVERLAP IN BILLING. YOU KNOW. BUT I BELIEVE THIS IS NOT INVOLVED IN THAT INQUIRY FOR SURE. >> SO I'M SORRY YOU'RE SAYING THEY ARE READY TO GO ANNA? >> YES, THEY ARE READY. FIRST INVOICE IS THERE JANUARY 1ST, 2022 THROUGH JANUARY 28, 2022. AND THEN THE SEX ONE IS JANUARY 29 THROUGH FEBRUARY 25TH OF 2022. AND THE THIRD ONE IS 20262022, THROUGH MARCH 25TH, 2022. SO THERE IS NO OVERLAP IN DAYS. [00:40:02] IS SERVICES WERE DONE. WE DID PAY A LOT OF -- >> YOU SAID THE SERVICES WERE DONE. SO HOW DO YOU KNOW? >> BECAUSE WE RECEIVED THE INFORMATION, AUTHORIZATION OF CLIENTS THE PUBLIC TO GET PAYMENTS AND WE SUBMITTED A LOT OF PAYMENTS THROUGH OUR SOFTWARE. SO SOAK HAD TO DO THE CASE MANAGEMENT. WE DID THE PAYMENTS. >> THAT CAME THROUGH SOCIAL SERVICES? >> NO. >> NO. >> HAGERTY HAD -- >> THEIR OWN PEOPLE. >> SOCIAL SERVICES DIDN'T COME INTO PLAY UNTIL NOVEMBER, DECEMBER OF 2022. >> WHEN WE CANCELLED HAGERTY. >> AND WE STOPPED THE SERVICES. AND AT THAT TIME, THEY DID BASICALLY WHAT ALREADY WAS IN THEIR SOFTWARE. AND THERE WAS I THINK 1100 SOME PEOPLE AND WE PAID 7. THEY AUTHORIZED FOR SEVEN NEW CLIENTS AND WE HAVEN'T PAID ANYTHING SINCE, THAT WAS JANUARY OF 2023. >> JUDGE I JUST DON'T LIKE TO PAY SOMETHING I DON'T KNOW WHAT I'M PAYING FOR. >> THESE ARE STILL SERVICES, THIS IS WHY I'M TRYING TO PUSH THEM TO SUBMIT THEM TO TREASURY AND FINISH IT OFF. THAT'S THE ONLY ONE LACKING THERE THIS -- >> ARE THESE THE LAST ONES? >> THE VERY LAST ONE. FOR ERAP. >> WE STILL HAVE ONE FOR THE ARPA. >> THAT'S TRUE YES. >> WE HAVE SEVERAL FOR ARPA BUT ERAP NIECE ARE THE FINAL THREE INVOICES. >> AFTER APRIL WE PAID OTHER INVOICES AND UNTIL WE KIND OF STOPPED AND THAT'S WHEN THEY SAID Y'ALL STILL HAVEN'T PAID OR THE THESE. THAT'S WHEN WE DID THE RESEARCH AND WE HAVE NOT PAID THESE. >> WE'RE REALLY JUST LOCKED IN. >> SHE DOESN'T HAVE ANYTHING TO DO WITH ERAP SO -- >> YOU DID WANT TO SAY, DID YOU HAVE SOME INFORMATION LULU, YOU LOOKED LIKE YOU WERE COMING FORWARD IF YOU HAVE SOMETHING YOU NEED TO SAY, YES. >> EXCUSE MY VOICE AGAIN, THERE IS HOPE AS FAR AS ERAP IS CONCERNED AND ARPA AND WE'VE TRIED WILLIAM FROM THE COUNTY ATTORNEY, WE HAVE BEEN TRYING TO MAKE SURE THAT WORK NOT OVERLAPPING. >> NOT OVERLAPPING THEY HAD LOOKED AT IT AS WELL. >> SO WE'RE TRYING TO AVOID -- >> YOU'RE SAYING THESE ARE GOOD TO GO AS WELL? NO OVERLAP WITH YOU? THAT'S ALL YOU KNOW. >> YES. >> WELL THERE IS SOME CHARGES ON HERE FOR THE ERAP. >> THERE IS SOME OVERLAP WITH ARPA. >> THERE IS SOME OVERLAP. >> ON THESE THREE INVOICES? I'M TALKING ABOUT THESE THREE INVOICES ONLY, ONLY THESE THREE INVOICES. THE REST WE'LL DEL WITH WHEN THEY COME UP. NO OVERLAP FOR ARPA BOTH OF YOU ARE SAYING YES GOING FORWARD JENNY IS SAYING YES, YES. >> OKAY WE'LL DISCUSS THIS WITH HAGHAGERTY IF THERE IS ANY OVERP ON THE ARPA END. >> IF ONE OF YOU WANT TO MAKE A MOTION GO AHEAD. I'M NOT GOING TO MAKE ONE. >> WE OWE IT, IT'S 2022. >> THIS IS THE FIRST TIME THAT THE ERAP IS BUILD, IS THAT WHAT YOU'RE SAYING LULU? >> NO. THESE ARE THE LAST THREE INVOICES. >> THEY'RE THE LAST THAT WE'VE RECEIVED BUT THEY'RE THE FIRST IN TIME BILLING FOR HAGERTY'S ERAP SERVICES. >> THERE ARE SOME CHARGES FOR ERAP AND WE'RE TALKING ABOUT JANUARY OF 2022 UP TO FEBRUARY OF 23. >> OKAY AND YOUR CONCERN IS THAT THE SAME SERVICES ARE BUILD IN SUBSEQUENT BILLS? >> THAT IS CORRECT. >> SO IF YOU PAY THIS ONE, THEN WE'LL JUST ADDRESS IT IN SUBSEQUENT BILLS. IS -- >> WE WON'T PAY THE FUTURE ONES THAT -- >> IF IT'S DUPLICATE BILLING FOR THE SAME WORK. >> THAT'S MY CONCERN, DUPLICATE BILLING. >> SO WHICH OF THE ONES THAT ARE ONE THAT WE COULD PASS THAT WE ARE NOT WORRIED ABOUT DUPLICATE BILLING? >> SHE DOESN'T KNOW BECAUSE THEY HAVEN'T BUILD YET. >> ARE YOU SUGGESTING -- >> HOW DO WE IDENTIFY WHAT'S WHAT? >> SHE'S WORRYING ABOUT DUPLICATE. >> IF SHE'S GOOD TO GO THEN WOULD I HAVE TO DISPUTE THE CHARGES WITH HAGERTY AS FAR AS ANY ERAP BILLING IN HERE. >> I'M NOT FOLLOWING THAT ONE. >> THERE'S THREE OTHER INVOICES, OR FOR ARPA, THAT HAS ERAP CHARGES THAT HAS SCOPE HAS BEEN CHANGED THAT HAS ANOTHER IFB -- WHAT IS IT, IBF, WHATEVER IT IS, CHARGES THAT WERE NEVER APPROVED [00:45:08] THAT WE'VE BEEN CARNLGD WITH. SO THOSE ARE THE ONES FOR THE ARPA. RIGHT? BUT THERE'S ERAP ALSO INVOLVED FOR WHATEVER REASON IN ARPA. >> THEY'VE BEEN WORKING ON PARCELING THOSE OUT. BUT IF -- WE JUST NEED TO PAY OR THE THE BILLING ONE TIME FOR THE WORK ONE TIME. AND SO THAT'S -- IF YOU PAY THESE BILLS, THEN SHE'LL DISPUTE IS WHAT SHE'S SAYING ON THE OTHER BILLS. >> YOU'RE FINE WITH US PAYING THESE BECAUSE THEY WILL STOP THE DUPLICATION IN THE NEXT. >> RIGHT. >> GOOD LUCK. >> THAT'S UP TO YOU TWO AND WORKING TOGETHER. I DIDN'T REALIZE THEY WERE THAT MUCH COMBINED BUT I GUESS THAT WILL WORK A WHOLE LOT BETTER AFTER TODAY WHEN YOU'RE UPSTAIRS TOGETHER TOO. SO DEFINITELY IN THE FUTURE WE WOULD LIKE YOU BOTH TO BE CLEARING THESE BEFORE WE VOTE TO PAY OR THE THESE. YOU'RE SAYING YES SO I WILL MAKE A MOTION TO PAY THESE. BECAUSE YOU'RE SAYING LULU WILL WATCH AND WE WOULDN'T BE DUPLICATE BUILD. SO I WILL MAKE A MOTION TO I PA THESE AND Y'ALL WATCH FOR THIS AND STOP THE DUPLICATION IN THE FUTURE BILLING. >> YES. >> WOULD BE MY MOTION AND THE NEXT TIME THEY COME FORWARD. WE BOTH ARE IN AGREEMENT. >> I JUST WANT TO ASK: WILL YOU BE ABLE TO IDENTIFY WHICH ONES WE'RE PAYING NOW AND WHICH ONES WE MIGHT BE BUILD LATER? >> YES. BASICALLY, THESE ARE ERAP SERVICES PAID BY ERAP FUNDING. IF THEY ARE CHARGING ERAP SERVICES IN THE ARPA THEN YES I WOULD CANNOT PAY THAT. BUT THESE WERE DONE FOR ERAP, RENTAL ASSISTANCE. >> HAVE Y'ALL BEEN KEEPING AN EYE OUT FOR THIS IN THE PAST? >> WE PAID AFTER APRIL. I MEAN WE PAID INVOICES FOR THEIR SERVICES AFTERWARDS BUT THEN IT STOPPED. SO THESE WERE PRIOR. THESE WERE JANUARY THROUGH MARCH OF 2022. >> OKAY, THANK YOU. >> SO I HAVE A MOTION. IF I COULD GET A SECOND OR NOT? THAT'S FINE TOO. >> SECOND. >> WE HAVE A MOTION AND SECOND TO PAY THESE AND TO STOP THE FUTURE ONES THAT ARE DUPLICATES. SO YES. QUAWMPLES SAY AYE. -- ALL THOSE IN FAVOR SAY AYE. ANY OPPOSED, SAME SIGN, YES HEARD THAT. >> I GOT TO BE A NAY ON THAT ONE JUDGE. >> OKAY UNDERSTAND. >> SO IT PASSES 3 TO 2 TO PAY THESE AND PLEASE LADIES, LET'S WATCH FOR THE DUPLICATES IN THE FUTURE AND BOTH OF YOU BE ON THE SAME PAGE IN THE NEXT. ITEM G, I THINK THAT WAS YOURS [G. Authorize payment of bills - Special Motions List - Lockwood Andrews & Newnam (LAN) dated September 27, 2023.] COMMISSIONER HERNANDEZ. >> I JUST ALSO WANT TO NOTE, THIS IS FOR LOCKWOOD ANDREWS AND NEWNAM. IS THIS THE LAST PAYMENT? >> NO, SIR, THIS IS NOT THE LAST PAYMENT. THIS IS THE CURRENT PAYMENT THAT IS DUE. THE H MAP HAS BEEN FINALIZED AND SUBMITTED TO TETAM FOR REVIEW. AND THEN IT WILL BE TOWARDED ON TO FEMA FOR APPROVAL. AND THEN ONCE THAT COMES BACK WITH APPROVAL THEN A FINAL BILL WILL BE DUE. BECAUSE THEY WILL PRODUCE BOOKS FOR ALL OF THE REGIONS WHO ARE PARTICIPATING IN THIS HAZARD MITIGATION ACTION PLAN. >> DO YOU HAVE ANY IDEA OF THE TIME LINE? >> WE WERE TOLD THE END OF OCTOBER. OR END OF -- TAKE THAT BACK. END OF NOVEMBER. WE EXPECT TO BE ADVISED BY THE END OF OCTOBER OF APPROVAL. AND THEN THE MANUALS WERE PRODUCED FOR EACH INSTITUTION BY THE END OF NOVEMBER. >> VERY GOOD, THANK YOU. >> YOU MAKE A MOTION TO PASS. >> SECOND. >> WE HAVE A MOTION AND SECOND. ALL THOSE IN FAVOR SAY AYE, AYE. [O. Approve Interlocal Agreement with the Coastal Bend Council of Governments, related to the planning, development, operation and provision of 9-1-1 Public Safety Answering Points.] ANY OPPOSED, SAME SIGN. THE MOTION PASSES, MOVING ON TO ITEM O. >> I PULLED THAT ONE JUDGE. I HAVE ONE QUESTION ONLY. IS THERE A FUNDING SOURCE OR WHAT'S THE COST? WHERE IS IT COMING FROM? >> YES, SIR, THE GLO GAVE US $100,000. AND THEN ALL OF THE NUECES COUNTY WATER DISTRICTS WHICH THERE WERE THREE, 2, 3 AND 4, PAID $22,700 APIECE, EACH, TO PARTICIPATE. AND WE HAVE RECEIVED ALL THOSE CHECKS IN THE FINANCE DEPARTMENT. AND ALL OF THESE FUNDS ARE GOING THROUGH IS THE JUDGE'S ACCOUNT BECAUSE SHE FUNDED THE MONEY [00:50:08] UNTIL WE GOT THE GRANTS. >> THAT WAS $100,000. THE PEOPLE WHO ARE PAYING IT COMES BACK TO MY ACCOUNT, I HAVE SEEN THESE CHECKS, SOME OF THEM HAVE COME TO MY OFFICE TOO. I'LL MAKE A MOTION TO PASS. >> SECOND. >> WE HAVE A MOTION AND SECOND. ALL THOSE IN FAVOR SAY AYE. AYE. ANY OPPOSED? [R. Receive update, if any, regarding the Bob Hall Pier project and all related matters.] SAME SIGN. THE MOTION PASSES. ITEM R. COMMISSIONER CHESNEY. >> THANK YOU JUDGE. JUST A BRIEF COMMENT THAT I JUST WANTED TO THROW OUT TO THE COURT. AS YOU KNOW, THIS IS A VERY IMPORTANT PROJECT TO ME. THAT I'VE BEEN WORKING ON WITH YOUR HELP FOR THE LAST THREE YEARS. I AM JUST THROWING THIS OUT BECAUSE I'M LOOKING FOR -- I'M LOOKING FOR HELP AND THE HELP BEING IF ANY OF THE THREE OF YOU HAVE ANY IDEAS OR SUGGESTIONS OR ANYTHING THAT YOU WOULD LIKE TO TWEAK OR DO, THAT COULD POSSIBLY PUT THIS RESTAURANT -- THIS THIRD PARTY CONCESSIONAIRE BUILDING BACK ON THE TABLE I'M OPEN TO SUGGESTION. I'M LOOKING FOR HELP ANYWHERE I CAN GET IT. AND SO I'M JUST ASKING THAT THOSE IN THE MAJORITY CONSIDER, THIS WILL BE AN ITEM THAT WE CAN CONTINUE TO DISCUSS AND WE'LL CONTINUE TO AFFORD IN SOME CAPACITY AND I APPRECIATE THAT. BUT CERTAINLY, IT'S A VERY IMPORTANT PROJECT THAT NOT ONLY IS MY PRECINCT BUT IT'S A VERY IMPORTANT PROJECT FOR THE COUNTY, IT DROVE THOUSANDS AND THOUSANDS TO THAT PIER AND IT WAS A GREAT SENSE OF PLACE. I'M AGAIN HUMBLY JUST ASKING, IF Y'ALL CAN COME UP WITH SOMETHING THAT YOU CAN SUPPORT THAT TWEAKS WHAT WE DID THAT CAN OFFICIALLY MOVE THAT THIRD PARTY CONCESSIONAIRE BUILDING FORWARD, I'D HAVE NO OBJECTION TO ANYBODY BRINGING THINGS UP AND HAVING DISCUSSIONS, I KNOW THERE ARE TWO VERY STRONG SIDES OF THIS ISSUE AND I'M JUST ASKING FOR THE COURT'S CONSIDERATION, IF ANYBODY COMES UP WITH ANYTHING, I'M OPEN TO SUGGESTIONS. IT IS MORE THAN A GENERAL COMMENT. I WANTED TO SAY IT IN A GENERAL MEETING BECAUSE I CAN'T TALK TO MORE THAN ONE PERSON OFFLINE. I'M NOT TALKING ABOUT IT TO PUT ANYBODY ON A SPOT, IT IS THE ONLY WAY I CAN DO IT TO HAVE THE ENTIRE COURT HAVE INPUT. OTHER THAN THAT I DON'T HAVE ANY ACTION ON IT, JUST WANT TO MAKE THAT STATEMENT AND APPRECIATE YOUR CONSIDERATION FOR THAT PROJECT. THANK YOU. >> ARE YOU ASKING FOR NOW IF ANYONE HAS ANYTHING, DO THEY WANT TO BRING IT UP? DOES ANY OTHER COMMISSIONER WANT TO BRING IT UP? >> NOW, NEXT MEETING, IF ANYBODY DOES, GREAT, IF NOBODY DOES, I'LL TRY THE FIGURE OUT IF I CAN GET SOMETHING ON SO IF SOMEBODY CAN CHANGE THEIR MIND ON, IF SOMEBODY ELSE DOES I WANT TO HAVE SOME SUGGESTION OR SOME HOPE TO MAYBE KEEP THAT DREAM ALIVE. BUT SO THAT'S IT. YES, MA'AM. >> DOES ANYONE WISH TO ADD ANYTHING RIGHT NOW? THERE BEING NONE WE'LL MOVE ON. I GUESS WE NEED A MOTION -- >> IT'S JUST -- RIGHT NOW IT'S -- >> IT DOESN'T MATTER. WE DON'T HAVE ANYTHING. >> AND I WILL CHANGE THE LANGUAGE TO THAT TO MAKE SURE IT'S AN ACTION ITEM IN THE FUTURE IN CASE THAT WAS THE INTENT, MONTH MATTER WHAT. WE'VE GOT THE REPAIR AND WE'VE E SOMETHING ELSE, THAT'S NEEDED. THANK YOU. >> MOVING ON TO OUR REGULAR AGENDA ITEMS. ITEM 3A. DISCUSS AND CONSIDER AUTHORIZATION AND APPROVING THE RETIREMENT -- OH, I MADE NEED TO PUSH -- IS THE DOCK HERE, ARE THEY HERE WITH THE RETIREMENT -- [2. Consideration and appropriate action, if any, to ratify a collective bargaining agreement negotiated between Nueces County, Texas and the Nueces County Sheriffs Officers Association (NCSOA).] SORRY, 1:30, I NEED TO BRING THAT ONE BACK. A 2, CONSIDERATION AND APPROPRIATE ACTION IF ANY TO RATIFY THE CLEFNG DISAGREEMENT NEGOTIATED BETWEEN NUECES COUNTY AND THE NUECES COUNTY SHERIFFS OFFICERS ASSOCIATION. >> SO MOVED. >> WE HAVE A MOTION TO APPROVE. I SECOND THAT MOTION. ANY OTHER DISCUSSION? ALL THOSE IN FAVOR SAY AYE. AYE. ANY OPPOSED? SAME SIGN. THE MOTION PASSES. THANK YOU ALL FOR BEING HERE AND I DO UNDERSTAND, YES IF YOU WANT TO SPEAK THAT WOULD BE GREAT. >> JUDGE COMMISSIONERS, WE WANT [00:55:06] TO THANK YOU ON BEHALF OF THE NUECES COUNTY SHERIFFS OFFICERS ASSOCIATION. WE APPRECIATE ALL THE EFFORT THAT EVERYBODY PUT THROUGH ALL THEIR OFFICES, THE COUNTY AUDITORS, ALL OF Y'ALL. WE ARE VERY APPRECIATIVE OF THE MARKET BASED COMPENSATION STUDY THAT'S GOING TON DONE AND I THINK THAT'S GOING TO PUT US IN A COMPENSATION WITH A LOT OF THESE OTHER COUNTIES. COMPETITION WITH A LOT OF THESE OTHER COUNTIES. JUST APPRECIATE Y'ALL. >> THANK YOU FOR BEING HERE. >> THANK YOU SIR. >> CAN I COMMENT ON THAT? >> YES. >> I JUST WANTED TO SAY I APPRECIATE YOUR PATIENCE AND EVERYTHING. THIS WAS A DIFFICULT PROCESS. THIS COURT IS -- HAS ALWAYS BEEN SUPERPROLAW ENFORCEMENT, WE TRIED TO SHOW THAT IN EVERY WAY WE CAN. WE HAD A DIFFICULT TIME THIS YEAR AND I KNOW THERE'S PROBABLY SKEPTICISM THAT MAYBE THIS WAS STALL TACTIC OR WHATEVER. I THINK YOU SAW IT TRULY WASN'T AND I THINK YOU SAW THE SINCERE EFFORT THAT THIS COURT AS A WHOLE AND EVERYBODY ON THIS COURT MADE BECAUSE WE DEFINITELY HAVE -- AND I DON'T MEAN TO SPEAK COLLECTIVELY BUT I BELIEVE IT IS TRUE. I BELIEVE THIS COURT HAS ALWAYS PLACED AND I KNOW I HAVE A HUGE EMPHASIS ON LAW ENFORCEMENT. AND I THINK LAW ENFORCEMENT AND FIRST RESPONDERS ARE ALWAYS IN THE CLASS BY THEMSELVES, AS WHAT THEY SHOULD GET IN LIFE BECAUSE OF THE FACT THAT YOU'RE CONSTANTLY PUTTING YOURSELVES ON THE LINE FOR OTHERS. I APPRECIATE THAT AND I APPRECIATE YOUR PATIENCE. I KNOW IT WASN'T EASY BUT I THINK HOPEFULLY YOU DID SEE AND IT SOUNDS LIKE DID YOU BY THE VOTE THAT THIS COURT MADE A SINCERE EFFORT IN ONE OF THE LOWER BUDGETS I'VE SEEN IN ALL OF THIS TO STILL GET YOU A VERY GOOD CONTRACT. AND I HOPE THAT -- AND I KNOW THAT YOU REALIZE IT BECAUSE IT WAS AN OVERWHELMING VOTE THE MAJORITY OF THIS AND WE REALLY WE APPRECIATE THAT TOO BECAUSE WE REALLY, REALLY WORKED HARD AS A COLLECTIVE BODY TO GET THIS DONE AND GET AS MUCH AS WE COULD ON THE TABLE WITH WHERE WE WERE AND I APPRECIATE THE MEMBERSHIP BEING SUPPORTIVE, THANK YOU ALL VERY MUCH WE DO. WE DO VALUE YOU GREATLY AND VALUE WHAT YOUR MEMBERS DO SO THANK YOU VERY MUCH. >> THANK YOU COMMISSIONER. MOVING ON TO ITEM NUMBER 3. >> DO WE NEED TO VOTE ON THAT? >> WE ALREADY VOTED. >> THAT WAS QUICK. MY BAD. >> I THOUGHT IT WAS VERY QUICK BUT WE DID VOTE. YES. [3. Discuss and consider approval of the Fees for Sheriff and Constable for 2024, pursuant to Section 118.131 of the Texas Local Government Code.] >> I WAS TESTING YOU JUDGE, YOU PASSED. >> ITEM NUMBER 3, DISCUSS AND CONSIDER APPROVAL OF THE FEES FOR SHERIFF AND CONSTABLE FOR 2024. AND YOU DO HAVE THOSE FEES IN YOUR PACKET. >> MOTION TO APPROVE. >> SECOND. >> WE HAVE A MOTION AND SECOND TO APPROVE. ANY OTHER DISCUSSION? >> JUDGE, JUST QUICKLY ON THIS ONE IF I CAN. YOU KNOW I BELIEVE WHAT WE'VE DONE HERE IS, WE'RE STILL -- THEY'LL DO AN ANALYSIS I THINK ON THIS QUITE SOME TIME AGO AND I THINK THE ANALYSIS STILL HOLDS. WHAT WE ARE TRYING TO DO HERE IS EVENTUALLY GET THIS TO EVEN WHERE IT COMPENSATES THE COST OF DOING BUSINESS AND WE'RE STILL WELL OFF OF THAT NUMBER BUT WE UNDERSTAND TOO THAT YOU HAVE TO DO THINGS TOWARDS NOT KILLING PEOPLE EITHER. BUT I APPRECIATE IF EFFORT THAT HAS GONE INTO THIS TO SHOW THAT WE ARE STILL WELL UNDERCHARGING WHAT IT COST US TO DO BUSINESS. BUT I THINK THIS IS FAIR, AND I APPRECIATE THE EFFORT THAT WENT INTO MAKING THIS HAPPEN AS WELL. >> THERE WAS AN UPDATED LIST THAT WAS CIRCULATED IDEA BY THE SHERIFFS OFFICE. IS THAT THE ONE THAT'S BEING VOTED ON NOW? >> WITHIN YOUR PACKETS YOU HAVE ONE THAT IS THE CURRENT RATE AND ONE THAT IS 5%. WE ARE ASKING WHAT THE COMMISSIONERS ARE ASKING TO APPROVE. >> SO -- OKAY. >> I DIDN'T -- DID WE GET THOSE UPDATED ONE? >> WE WERE ASKED TO PROVIDE 5%. THE CURRENT RATE IS WHAT THE SHERIFF'S OFFICE IS ASKING FOR AT THE CURRENT RATE. >> AND THAT'S BASED -- I MEAN THAT'S BASED ON THE FACT THAT WHAT WE'RE CHARGING DOES NOT COVER WHAT IT IS TO DO THIS WORK. >> THAT'S CORRECT. >> BY LOTS AND LOTS AND LOTS. >> YES. >> AND WE AGREE WITH THAT. >> AND IN ADDITION TO THAT, COMMISSIONERS AND JUDGE, THERE IS -- THERE ARE SOME PARENTHETICALS THAT WERE ADDED YESTERDAY ABOUT FEES FOR PROTECTIVE ORDERS STATUTORILY, THOSE ARE NOT TO BE CHARGED TO THE APPLICANT. THAT WAS CORRECTED, AND WE GOT THAT BUT I'M NOT SURE IF THAT'S WHAT'S -- YOU'RE VOTING ON RIGHT NOW. >> THAT'S A GOOD QUESTION, DALE DO YOU KNOW THAT ONE? >> WE'LL MAKE SURE WE WORK WITH THE COUNTY ATTORNEY ON THIS AND THOSE ARE ADDRESSED WHEN THIS IS APPROVED. >> CAN WE MAKE A MOTION TO PASS AS IS -- >> THERE ARE FEES FOR PROTECTIVE [01:00:03] ORDERS IN HERE. >> SO THE ONE THAT WE RECEIVED YESTERDAY AS AN UPDATED VERSION SIMPLY HAS AND THERE'S ONE EXAMPLE ON THERE THAT'S A PARENTHETICAL, IT SAYS IT CAN'T BE CHARGED TO THE APPLICANT ONLY POSSIBLY TO THE RESPONDENT IF ORDERED BY THE COURT. YOU KNOW, AT THE CONCLUSION OF EVERYTHING. I CAN FORWARD THAT, MY E-MAIL JUST CRASHED. BUT -- >> IN OTHER WORDS THE FEES ARE OKAY BUT IT HAS TO BE DISTINGUISHED THAT IT CAN'T BE CHANCHED TO THE VICTIM. >> STATUTORILY REQUIRED. >> WITH THAT CLARIFICATION JUDGE WITH YOUR MOTIONING I'LL SECOND. IF YOU ARE DOING -- >> I THINK WE HAD A MOTION, YOU AND HERNANDEZ WERE -- WOULD YOU ACCEPT THAT AS AN AMENDMENT TO YOUR MOTION TO CHANGE YOUR MOTION? >> I WOULD. >> YES. >> OKAY AND YOUR SECOND. >> YES, MA'AM. >> WE HAVE A MOTION AND SECOND. ALL THOSE IN FAVOR SAY AYE. AYE. ANY OPPOSED, SAME SIGN. THE MOTION PASSES. [4. Discuss and consider renewal and amendment of agreement between Texas General Land Office/Veterans Land Board and Nueces County related to the operation of the Coastal Bend Veteran’s Cemetery, and related matters.] ITEM NUMBER 4, DISCUSS AND CONSIDER THE RENEWAL AND AMENDMENT OF AGREEMENT BETWEEN THE TEXAS GLO VETERANS LAND BOARD AND NUECES COUNTY RELATED TO THE OPERATION. AND THIS IS ACCEPTING ADDITIONAL FUNDS. THIS IS A CONTRACT THAT IS WAITING FOR ME TO DOCUSIGN ON HERE AND WE ARE VERY APPRECIATIVE, APPRECIATIVE FOR YOU JJ AND YOUR WORK OUT THERE, WE HAD THE CEREMONY THIS PAST WEEK AND IT WAS AN HONOR TO HAVE EVERYONE THERE AND WE THANK THEM PERSONALLY FOR THIS AND HOPE TO LIVE UP TO THEIR EXPECTATIONS AND KEEP THIS PLACE LOOKING AMAZING AND BEAUTIFUL. SO I WILL MAKE THE MOTION TO PASS. >> SO MOVE. >> PASSED. >> WE HAVE A MOTION AND SECOND. ALL THOSE IN FAVOR SAY AYE. AYE, ANY OPPOSED SAME SIGN. [5. Discuss and consider Amendment No. 1 to the Interlocal Agreement Between Nueces County and City of Robstown for Fire and Emergency Rescue Services (MOU), and related matters.] THANK YOU. ITEM NUMBER 5 DISCUSS AND CONSIDER AMENDMENT NUMBER 1 TO THE INTERLOCAL AGREEMENT BETWEEN NUECES COUNTY AND THE CITY OF ROBSTOWN FOR FIRE AND EMERGENCY RESCUE SERVICES MOU. I BELIEVE THIS IS JUST TO EXTEND FOR ONE MONTH BECAUSE THEY ARE THE ONLY GROUP THAT IS AT A DIFFERENT RATE AND NOT UPSTAIRS. AND COMMERCE MAWRZ HAS TALKED WITH EMERGENCY MANAGEMENT AND HE IS FINE WITH THE INVOICING AND THE MOU TO BE HANDLED JUST LIKE THE OTHER ONES UPSTAIRS. SO I WOULD MAKE A MOTION TO PASS FROM COMMISSIONER HERNANDEZ, I WILL SECOND THAT MOTION. ANY OTHER DISCUSSION? I'M SORRY. COMMISSIONER MAWRZ. >> JUST CONTEXT, MY OFFICE WAS DESIGNATED TO DO THIS EVEN PRIOR TO ME COMING IN UNDER COMMISSIONER ORTIZ. WE APPRECIATE IT, SANDRA NOW PRISCILLA HAD BEEN HANDLING THAT, WE APPRECIATE THE RIGHTFUL GROUP SHOULD BE THE WUFNEDZ HANDLING INDIRECT CONTACTING OR THE INVOICING. THANK YOU FOR TAKING IT ON. >> YOU'RE SURE WELCOME SIR. >> ABSOLUTELY. WE HAVE A MOTION AND SECOND. ALL THOSE IN FAVOR SAY AYE. ANY OPPOSED SAME SIGN. THE MOTION PASSES. [6. Discuss and consider taking action regarding CR 18 bridge repairs located at the intersection of CR 18 and CR 65, and other related matters.] THANK YOU. ITEM NUMBER 6, DISCUSS AND CONSIDER TAKING ACTION REGARDING COUNTY ROAD 18 BRIDGE REPAIRS LOCATED AT THE INTERSECTION OF COUNTY ROAD 18 AND 65, OTHER RELATED MATTERS. I THINK COMMISSIONER GONZALEZ THIS IS YOUR MOTION. >> I MAKE A MOTION TO PROCEED WITH THE REPAIRS. >> SECOND. >> WE HAVE A MOTION TO PROCEED WITH THE REPAIRS. AND A SECOND FROM COMMISSIONER HERNANDEZ. THIS IS, IT IS TO BE PAID BY COMMISSIONER PRECINCT 2 FUNDS TO BE DETERMINED. ANY OTHER DISCUSSION? WE HAVE A MOTION AND SECOND, ALL THOSE IN FAVOR SAY AYE. AYE. DESTINY OPPOSED, SAME SIREN. THE MOTION PASSES. ITEM NUMBER 7, DISCUSS AND CONSIDER POLICIES REGARDING THE [7. Discuss and consider policies regarding Nueces County ETJ Platting Interlocal and collecting plat application fees within the County's jurisdiction and related matters.] NUECES COUNTY ETJ PLATTING INTERLOCAL AND COLLECTING PLAT APPLICATION FEES WITHIN THE COUNTY'S JURISDICTION. AND I KNOW COMMISSIONER MEDITEHERNANDEZ, YOU HAVE CHALLD THIS, AND I THINK MR. PIMENTEL IS HERE TO TALK ABOUT IT I BELIEVE FOR YOU. YES. >> COMMISSIONERS -- >> YES, GO AHEAD. >> I THINK JUDGE AND COMMISSIONERS, I THINK THERE'S AN INTERLOCAL GRANT BETWEEN US AND THE CITY WHERE I THINK WE SHOULD, IT'S STATED THAT WE SHOULD BE ABLE TO GET REFUNDED SOME OF THE MONEYS THAT ARE BEING CHARGED WITHIN THE ATJ AND I THINK COMMISSIONER HAD REQUESTED FOR US TO LOOK INTO IT AND ALSO WITH THE COUNTY ATTORNEY. [01:05:05] YOU WANT TO GO COMMISSIONER? >> YES THAT'S TRUE JUDGE. I SEE THIS AS AN OPPORTUNITY FOR US TO GENERATE REVENUE. IT HASN'T BEEN TAKEN ADVANTAGE OF BY US. THE CITY COLLECTS ALL THE MONEYS AND THEY HAVEN'T -- I READ THE CONTRACT AND THEY WERE SUPPOSED TO GIVE ALL THE PLATTING FEES TO PLIRKTS. PUBLIC WORKS AND THAT HASN'T BEEN HAPPENING. SO BEEN WORKING WITH THE COUNTY ATTORNEY TO FIND OUT WHAT'S THE NEXT STEP WE CAN TAKE TO GET SOME OF THESE FUNDS REFUNDED TO US. AND I ALSO WANT TO, IF I MAY, I ALSO WANT TO EMPHASIZE WE SHOULD START OUR OWN, OUR OWN PLANNING DEPARTMENT. PLANNING DEPARTMENT. >> COMMISSIONER, I WARRANT TO TELL YOU, THIS IS A GREAT CATCH ON YOUR PART, YOU'RE DEAD ON, ON THIS. I DON'T KNOW ABOUT THE PLATTING DEPARTMENT YET, NOT SURE ON THAT ONE YET BUT I'M REALLY APPRECIATIVE OF THIS BECAUSE I THINK THERE'S SOMETHING THAT THE COUNTY NEEDS TO REALLY PURSUE TO GET THOSE FUNDS BACK AND TO START GETTING THOSE FUNDS GOING FORWARD. BECAUSE WE DO PLAY A ROLE IN IT. THERE'S A REASON WHY THAT AGREEMENT'S IN PLACE AND IF IT'S POSSIBLE THEN LET'S PURSUE IT. SO I DON'T KNOW WHAT THE END RESULT WILL BE BUT IT IS A GOOD ATTEMPT AND A GOOD CATCH SO THANK YOU COMMISSIONER FOR POINTING ALL THAT STUFF OUT. >> THANK YOU SIR. >> I DO NOT HAVE ANY EVIDENCE THAT THE CITY COLLECTED ANY FEES ON THOSE ETJ PLATS. AND I'M UNAWARE OF ANY FEE THAT THE COUNTY CHARGES FOR PLATTING. SO I DON'T THINK COMMISSIONER. AT THIS POINT, I DON'T HAVE EVIDENCE OF REFUNDS OWED TO THE COUNTY. I JUST WANTED TO BE CLEAR. >> WELL, JEAN, ALL I CAN SAY IS THE CITY GIVES OUT PERMITS. THE CITY CHARGES FOR PERMITS. OKAY. AND THE REASON I'M AGAINST THIS IS BECAUSE THE CITY IS NOT HOLDING UP TO THEIR AGREEMENT. THEY'RE NOT GOING OUT THERE MAKING SURE THE DEVELOPERS ARE DOING WHAT THEY'RE SUPPOSED TO BE DOING, OKAY? THIS IS WHY WE HAVE FLOODING PROBLEMS OUT THERE. BECAUSE THE CITY IS NOT INSISTING ON THE DEVELOPERS TO DO WHAT'S RIGHT, AS FAR AS FLOODINGS CONTROL, THE ROADS AND THIS. AND THIS IS WHY I THINK WE SHOULD CONSIDER TAKING -- DOING OUR PART FOR THE COUNTY -- >> ABSOLUTELY COMMISSIONER. I JUST -- YOU WERE TALKING ABOUT AND ASSERTED THAT THERE WERE REFUNDS OWED TO THE COUNTY AND I DIDN'T WANT TO GIVE THE INFORMATION THAT I HAD GIVEN INFORMATION TO THAT EFFECT. >> THAT IS WHY I ASKED MR. PIMENTEL, HE'S MORE FAMILIAR HOW THESE WORK AND HOW WE COULD BENEFIT FROM THIS. >> THEY ARE CHARGED SOMETHING FOR SOME. THEY'RE NOT DOING NOTHING FOR NOTHING. IF THEY ARE APPROVING PLATS THEY HAVE GOT SOMETHING DESIGNATED SOMEWHERE, IT IS GOING TO TAKE A LITTLE DIGGING. THEY CHARGE OUT THE WAZOO OUT THERE THEY ARE TALKING ABOUT CHARGING MORE THOSE IMPACT FEES. JUST BECAUSE THEY DON'T CALL IT JENNY A PLATTING FEE IT'S IN THERE SOMEWHERE. IT'S BUNDLED IN THERE, I DON'T KNOW, JUST BECAUSE IT'S -- YOU KNOW, THAT'S WHAT THE TRICK MAY BE IT MAY BE BUNDLED AND NOT CALLED A PLATTING FEE BUT THEY ARE CHARGING FOR IT. THEY DON'T DO ANYTHING FOR FREE THERE. >> YOU ARE CORRECT COMMISSIONER. THERE IS A PLATTING FEE THAT THEY CHARGE A DEVELOPER THAT, ONE ACRE TRACT OR A 100 ACRE TRACT. THERE IS A COST PER ACRE THAT THEY DO CHARGE FOR DOING THE PLAT AT THE CITY. DO WE HAVE THOSE TYPE OF FEES HERE AT THE COUNTY? NO SIR, WE DON'T CHARGE HERE AT THE COUNTY FOR THOSE FEES. BUT ANYTHING WITHIN THE ETJ IS BEING REVIEWED BY THE CITY FOR PLATTING PURPOSES AND DEVELOPMENT PURPOSES. >> BUT THEN THEY SEND IT OVER TO YOU FOR REVIEW. >> YES, WE DO GET THE PLATS THAT ARE BEING SUBMITTED WITHIN THE ETJ THAT WE REVIEW INTERNALLY BUT WE DON'T CHARGE A FEE FOR THAT. >> IF THEY SEND IT TO YOU FOR REVIEW, YOU SHOULD BE ABLE TO PULL UP A LIST OF ALL THEY'VE SENT YOU. I DON'T KNOW IF THEY SEND IT TO YOU DOCUMENTED OR WHAT. >> YES, MA'AM. WE GET -- >> THAT MAY HELP JENNY WITH HER REQUEST. >> WE OUGHT TO GET A PIECE OF THAT PIE. >> IF YOU'RE HAVING TO WORK ON IT THEN YES. >> I'M NOT SAYING WE WANT TO CHARGE EXTRAS BECAUSE WE'RE GOING TO QUASH IT BUT WE NEED TO GET A PIECE OF WHAT THEY'RE CHARGING. I DON'T KNOW IF I WANT TO START A NEW FEE AND HAVE EVERYBODY SHOW UP AND SAY WE'RE ADDING TO THE COST OF THE REDEVELOPMENT. BUT WE SHOULD GET A PIECE OF THE PIE. I THINK COMMISSIONER HERNANDEZ IS ON THAT. ARE FOR THE MONEY YOU SPEND ON IT JUST LIKE THEY SPEND IT. [01:10:02] IF IT'S 90% THEM AND 10% US, THAT'S FINE. BUT THERE'S GOT TO BE AN EQUITABLE WAY TO COME TO AN AGREEMENT WITH THEM. >> DOES THE MOU, IS IT CURRENT HAS IT EXPIRED? >> NO, IT IS CURRENT, IT SAYS -- >> YES? >> IT SAYS THAT THE FEES THEY COLLECT WILL COME TO THE COUNTY. >> AND DOESN'T SAY AN AMOUNT, PERCENTAGE OR ANYTHING? >> IT'S NOT SPLIT. BUT I HAVE -- >> BUT IT SAYS THE FEES THEY COLLECT WOULD BE -- >> IF THEY COLLECT A FEE, IT WILL -- BUT THE CONTRACT IS SPECIFIC. IT SAYS IF THEY COLLECT A FEE IT WILL BE SENT OVER AND WHAT THEY HAVE ASSERTED TO US AT LEAST WHEN I ASKED THAT SPECIFIC NARROW QUESTION, IS DO THEY COLLECT A PLATTING FEE. NO, THEY DO NOT. ON THOSE IN THE ETJ. I'M TOLD THAT THERE ARE BETWEEN EIGHT AND TEN OF THESE ANNUALLY, THAT THE CITY SENDS OVER FOR REVIEW. AND SO IT JUST MAY TAKE A DIFFERENT DISCUSSION OR AS YOU SAID COMMISSIONER CHESNEY TO FIND OUT WHAT KIND OF FEE THEY ARE COLLECTING AND WHETHER IT QUALIFIES TO COME OVER TO THE COUNTY. >> EXACTLY. SO THERE DOESN'T SEEM TO BE ANY ACTION, THIS IS JUST AN UPDATE IN KEEPING EVERYONE INFORMED OF WHAT YOU ARE DOING. THANK YOU COMMISSIONER HERNANDEZ AS WELL. >> JUDGE IF I COULD SAY SOMETHING, I THINK IT WOULD BE GREAT TO CHARGE ANYTHING THAT'S OUTSIDE OF THE ETJ THAT WE CAN CHARGE THE COUNTY ITSELF, RIGHT NOW WE DON'T CHARGE ANYTHING FOR THESE TYPE OF PLATS ALSO. >> DEVELOPER? >> CORRECT FOR DEVELOPERS. SO I THINK THAT WOULD BE SOMETHING THAT -- >> TO WORK ON -- >> I WOULD JUST LIKE TO SEE, I'D LIKE TO PURSUE GETTING WHAT THEY'RE CHARGING FIRST. >> YES, SIR. >> SEE IF IT'S EVEN BENEFICIAL OR HOW MUCH IT IS. >> SORRY JUDGE. IF THEY'RE CHARGING FOR THIS, THEN I DON'T KNOW WHAT THEY'RE CALLING IT. THERE'S NO WAY THEY ARE CHARGING FOR THIS. THEY CHARGE FOR EVERYTHING AT THE CITY SO I DON'T BELIEVE THEY ARE NOT CHARGING FOR THIS, I'M SORRY, THEY MAY NOT BE CALLING IT THAT, BUT I DON'T KNOW WHAT COMMISSIONER HERNANDEZ IS GOING TO, PLEASE DON'T LET THEM TELL YOU THEY ARE NOT CHARGING FOR THIS. BECAUSE I DON'T BELIEVE IT. >> JUDGE ALL I'M SAYING, COMMISSIONERS, IS WE'RE TAKING UP THE BURDEN OF FIXING OUR ROADS, BY THESE DEVELOPERS AND THE CITY'S NOT HELPING. I'VE ASKED THEM. I SPOKE TO AN ASSISTANT CITY MANAGER AND HE PROMISED ME THAT WE'RE GOING TO START ASSISTING US WITH RECONSTRUCTING OUR ROADS BECAUSE THEY'RE BEING BROKEN UP BY THOSE HEAVY TRUCKS, CEMENT TRUCKS AND EVERYTHING ELSE THAT GOES BY THERE AND THE CITIZENS ARE COMPLAINING THAT THEY'RE SPEEDING BY THERE. SO I THINK WE DESERVE SOME KIND OF FEE. SO WE CAN TRY AND FIX OUR ROADS IF THEY'RE NOT GOING TO HELP US. SO I THINK WE DESERVE FEES. >> THANK YOU. I THINK WE'RE GOOD. YES, I APPRECIATE IT. >> THANK YOU JUAN. >> MOVING ON TO ITEM 8. DISCUSS AND CONSIDER APPROVAL OF THE TRANSFER OF DUTIES OF RECORDING THE EXECUTIVE SESSION FROM THE COUNTY CLERK BACK TO THE COMMISSIONERS COURT. AND I THINK COMMISSIONER CHESNEY YOU PUT -- DID YOU PUT THAT ON? >> NO, THE COUNTY CLERK DID. >> COUNTY CLERK DID. YES. I THINK WE DO HAVE TO RECORD, SOME MEETINGS HAVE TO BE RECORDED. I HAVE TALKED TO STAFF. WE'LL JUST ORDER A TAPE RECORDER. I THINK THERE IS A SAFE UP IN THE FIRE MARSHAL'S OFFICE THAT WE COULD STORE THE RECORDINGS IN THAT WE CAN MOVE IT DOWN HERE INTO THE OTHER OFFICE TO STORE. SO I DON'T HAVE A PROBLEM WITH US TAKING THIS OVER AND DOING IT. DID THE COUNTY CLERK GIVE YOU ANY INFORMATION TO SAY -- CAN YOU PUT YOUR MICROPHONE, SORRY. >> CAN WE CIRCLE BACK TO THIS? >> YOU WANT US TO COME BACK TO IT LATER? >> SURE. I'LL CIRCLE IT TO COME BACK. [9. Discuss and consider revising or adopting a policy formalizing the appointment process for appointments to boards and commissions by the commissioners court, and related matters.] MOVING ON TO ITEM 9, DISCUSS AND CONSIDER REVISING AND ADOPTING A POLICY FOARMSING THE APPOINTMENT PROCESS FOR APPOINTMENTS TO BOARD AND COMMISSIONS BY THE COMMISSIONERS COURT, THIS ONE IS YOURS COMMISSIONER CHESNEY. >> IT IS, I WANTED TO MAKE SURE THAT EVERYBODY GOT THE BUCH, AND HARD COPY, I WANTED TO MAKE SURE EVERYBODY GOT THAT BEFORE I START, EVERYBODY GOOD ON THAT, YES, PAIN? OKAY SO IF NOT I CAN GET SOME MORE COPIES MADE. I GOT TO FIND MINE. THE PURPOSE, WE'VE TALKED ABOUT THIS EVERY TIME ONE OF THESE HIGHER PROFILE BOARDS COMES UP AND HOW WE'RE GOING TO DO IT. AND I THINK SEVERAL -- I KNOW SEVERAL EVER US HAVE MADE MENTION ABOUT WANTING TO COME UP WITH A PROCESS THAT IS OPEN TRCH AND A LITTLE MORE NOT -- TRANSPARENT AND NOT MORE WHO NOM NECESSITATES THE FIRST PERSON [01:15:07] OUT OF THE CHUTE, BROAD BASIS THAT GIVES EVERYONE AN OPPORTUNITY, ON THESE HIGHER PRO TIME BOARDS TO SEE WHAT WE SEE AND HEAR WHAT WE HEAR. SO THIS WAS JUST TO START. NO PRIDE IN AUTHORSHIP. IF NISH'S GOT ANY IDEAS OR TWEAKS OR WHATEVER I'M CERTAINLY OPEN TO IT. BUT BASICALLY AND I'LL JUST KIND OF READ IT FOR PUBLIC. IT WOULD BE THE PROPOSAL IS A TWO STEP PROCESS. AND WHAT I INCLUDED WAS THE HOSPITAL DISTRICT, PORT OF CORPUS CHRISTI AND THE RTA. WE COULD ADD SPON, I UNDERSTAND THERE WOULD BE A CHANGE ON THAT BUT SPON WOULD BE AN ADDITION ON THAT IF THERE ISN'T ANY CHANGE. THE FIRST POINT IS THAT EACH COMMISSIONER AND THE JUDGE WOULD PICK THEIR TOP TWO APPLICANTS AFTER APPLICATIONS CLOSE AND SUBMIT THOSE TO HR. AND THAT MAY NOT BE HR. I WAS THINKING WHAT WE NORMALLY DO WITH HIRES THAT REALLY SHOULD BE PROBABLY COURT, WE DON'T HAVE COURT ADMIN. >> APPOINTMENTS GO TO THE COMMISSIONERS COURT, THEY GO TO TARA OR ME. IF YOU TURN IN YOUR LETTER THAT'S WHERE THOSE GO. >> TO WHOEVER HANDLES THIS. I JUST PUT HR BECAUSE I WAS THINKING HIRE. NUMBER 2 FOR ANY APPLICANT WHO DOES TWO VOTES WE DO A PUBLIC INTERVIEW. THEN EACH COMMISSIONER OR JUDGE HAS THE ABILITY TO NOMINATED ONE CANDIDATE ON THE BOARD. EACH WOULD VOTE FOR THEIR OWN PERSON AND VOTE FOR ANOTHER ONE AS WELL. THE TOP 2 OR 1 DEPENDING ON SPOTS OPEN OR THREE WHATEVER WOULD GET IT. IF THERE IS A TIE BETWEEN THE TWO, BETWEEN TWO AND THERE IS ONLY ONE SPOT THEN THOSE TWO GO INTO THE NEXT ROUND AND EACH COMMISSIONER AND JUDGE WOULD VOTE ONE TIME. AGAIN THE PURPOSE IS JUSTTO SO THAT -- I REALLY THINK IT WOULD BE COOL ESPECIALLY ON THESE THREE, AND WOULD I PROBABLY PUT SPON IN THERE TOO TO, YOU KNOW, REALLY HAVE SOME OPEN DIALOGUE SO THAT WE COULD ASK QUESTIONS IN FRONT OF THE PUBLIC FOR THESE PEOPLE WHO WANT TO SERVE ON THESE VERY HIGH PROFILE BOARDS AND IT WOULD GIVE EVERYBODY AN OPEN AND TRANSPARENT WAY TO DO THINGS. IT'S JUST A SUGGESTION AND IT WAS SO EXCITING THAT TWO MEMBERS LEFT. NO, I'M KIDDING. >> COMMISSIONER MARE DID ISDID . MARE IS ONLINE. >> IT WOULD BE NICE AN EXAMPLE TO DO FOR THE RTA WE DIDN'T HAVE A POLICY IN PLACE. YES I WOULD LIKE TO MOVE IT FORWARD IF NO ONE HAS ANY CHANGES OR ADDITIONS OR WHATEVER. SO, YOU KNOW. WE HAVE GOT A BIG ONE COMING UP AND, YOU KNOW, I WOULD ADD SPO IN TO THIS LIST. SPON TO THIS LIST. YOU CAN ALWAYS SUSPEND THINGS BUT IF YOU DON'T HAVE A POLICY IN PLACE YOU DON'T HAVE A WAY TO TELL THE PUBLIC YOU'RE GOING TO DO IT SO -- >> COMMISSIONER, JUDGE. >> YES. >> I MYSELF I WOULD LIKE TO KIND OF TABLE THIS, HAVE MORE TIME TO PROCESS IT AND SEE HOW IT -- YOU KNOW, HAVE MORE TIME TO PROCESS IT. AND SEE HOW IT'S REALLY SUPPOSED TO WORK. THANK YOU FOR THE EXPLANATION, COMMISSIONER, BUT IT JUST SEEMS TO ME THAT -- DID YOU SAY HR WAS GOING TO HAVE PART OF IT? >> IT WAS A MISTAKE. I JUST THINK THIS IS -- COMMISSIONER I MODELED THIS AFTER HOW WE DO DIRECT HIRES, THIS IS KIND OF HOW WE DO DIRECT HIRES OTHER THAN THE PUBLIC INTERVIEW PROCESS. SO I PUT HR IN, IT SHOULD HAVE GONE NOT TO HR BUT WHOEVER DOES OUR APPLICATIONS. >> TARA IS ONLINE TOO SHE TAKES OUR APPLICATIONS SHE MAY CLARIFY FOR US. IF YOU WANT TO UNMUTE TARA. >> SO COMMISSIONER I THINK YOU MIGHT BE RIGHT, BUT THE HR MIGHT BE BEST -- I DON'T HAVE ACCESS TO LIKE A LEGITIMATE LIKE BACKGROUND CHECK SERVICE. AND THAT IS A REQUIREMENT FOR SOME OF THE GIGGER BOARDS. >> MAYBE HR IS THE RIGHT THING TO DO, HA, I GOT LUCKY. >> AND I JUST WANTED TO DOUBLE CHECK WHICH BOARDS YOU WERE WANTING TO -- I KNOW YOU SAID HOSPITAL DISTRICT RTA. >> PORT OF CORPUS CHRISTI AND SPON, THE FOUR. >> OKAY. >> THE ONLY THING I WOULD THINK ABOUT IS MAYBE DEFINING, MAYBE [01:20:02] WHAT A BIG BOARD CONSTITUTES. >> SPEAK UP. YOU'RE KIND OF -- >> REALLY MUFFLED. >> BUT IF YOU GUYS ARE KIND OF IRONING OUT THE DETAILS ON THIS I THINK THAT SOUNDS GOOD. >> THE ONLY QUESTION I WOULD HAVE IS, JUST LIKE THE OTHER SITUATION WITH THE OTHER APPOINTMENTS, BECAUSE THE APPOINTMENTS SAY THEY GO TO THE -- YOU TURN THEM INTO THE COUNTY JUDGE'S OFFICE. SO THEY WOULD ALMOST NEED TO ADD ALMOST BOTH OR WE'RE GOING TO GET INTO THE SAME POSITION THAT WE JUST HAD WITH ANOTHER INDIVIDUAL THAT TURNED IT INTO A BOARD MEMBER THAT THEY'RE ASKING TO BE ON. INSTEAD OF THE COURT. >> NO I AGREE. IT COULD BE HR/COUNTY JUDGE'S OFFICE. >> JUST SOMEONE IN OUR OFFICE. >> WHO IT GOES TO IS NOT -- IT'S JUST SOMEONE THAT'S GOING TO TALLY IT RIGHT? IT'S NOT GOING TO BE -- DOESN'T MATTER TO ME WHERE IT GOES, IT'S >> BUT THE TWO I THINK IS A GOOD PLACE BECAUSE THEY HAVE TO REVIEW AS WELL JUST LIKE ANYTHING ELSE. OR WE NEED TO CHANGE THE REST OF THE POLICY BECAUSE ALL THE OTHERS GO TO THE COUNTY JUDGE'S OFFICE TOO. >> COMMISSIONER DO YOU HAVE ANY -- >> ME? >> YES, IF YOU -- >> ANY OTHER -- >> YOU KNOW, I -- THE PROCESS WE HAVE RIGHT NOW IS NOT A BAD PROCESS, YOU KNOW? AND THIS IS WHAT WE WERE TALKING EARLIER, FOR VOTING, INDIVIDUALLY. BECAUSE IF I'M GOING TO -- >> AND YOUR MICROPHONE PLEASE. >> WANT TO HAVE LIKE HIRING SOMEBODY, YOU KNOW, SENDS YOU THE LIST AND YOU -- THE ONE WHO'S GOT TWO VOTES, GOING TO WANT TO COME BEFORE THE COMMISSIONERS OR THREE VOTES. I THINK IF I HAVE TO NOMINATE SOMEBODY OR YOU DO, AND HERNANDEZ, I THINK THAT THE ALL SHOULD BE HERE, AND INTRODUCE THEMSELVES AND SEE WHAT WE CAN DO ABOUT THE QUALIFICATION ET CETERA. I LIKE TO INTERVIEW EVERYBODY INDIVIDUALLY, I THINK WE'VE TALKED ABOUT THAT BEFORE. BUT I PREFER TO INTERVIEW, IF THERE'S FOUR APPLICANTS, I LIKE TO REVIEW. IF IT WERE JUST MY APPLICANT, BECAUSE YOU MIGHT -- I MIGHT NOW AND AGAIN ONLY GET TWO VOTES, ONE VOTE FROM SOMEBODY ELSE. BUT I THINK THAT BY THE TIME WE COME TO COURT THINGS COULD CHANGE, YOU NEVER KNOW. SO, AND I DON'T KNOW IF I WANT TO MAKE THIS REALLY A POLICY YET, OR I THOUGHT IT WAS ONLY -- THIS IS FOR DISCUSSION ONLY RIGHT? >> YES, I MEAN WE ARE JUST DISCUSSING IT. WE CAN TABLE IT TO THE NEXT MEETING AS COMMISSIONER HERNANDEZ SAID. I WANT TO START FOR DISCUSSION, I LIKE THE INTERVIEW PROCESS. LET'S SAY THERE IS A BOARD THAT 20 APPLICANTS APPLY. I DON'T KNOW THAT WE WANT TO INTERVIEW ALL 20 RIGHT? SO I WAS JUST TRYING TO COME UP WITH SOME WAY TO, YOU KNOW, LIMIT THAT, ESPECIALLY, YOU KNOW, SO WE DON'T DO IT THAT WAY. BUT I MEAN I DON'T HAVE LIKE -- THIS WAS JUST A STARTING POINT. I'D LIKE TO TAKE SOME ACTION -- >> THAT IS A GOOD IDEA COMMISSIONER HERNANDEZ TO TABLE TO THE NEXT MEETING TO THE FIRST MEETING IN OCTOBER WHERE WE CAN ALL THINK ABOUT IT A LITTLE BIT MORE. >> TWO OR THREE OF THEM TODAY, WE'VE ONLY GOT ONE MORE COMING. I THINK IT WOULD BE ADVANTAGEOUS BECAUSE I THINK IT WOULD BE NICE FOR THE PUBLIC TO SEE AND HEAR FROM THESE PEOPLE WHO ARE APPLYING FOR THESE BOARDS. >> I DON'T MIND HAVING TO HEAR FROM THEM BUT I DON'T THINK I WANT TO LIMIT IT. THAT'S MY DEAL. AROUND I DON'T THINK WE CAN DO IT THIS YEAR, SOMETHING WE'RE LOOKING AT FOR A POLICY FOR NEXT YEAR. >> WELL NO, I'D LIKE TO -- I'LL BE HONEST. I'D LIKE TO INTERVIEW THOSE PORT PEOPLE THAT IS FIXING TO BE -- THAT IS A BIG BOARD COMING UP. I'D LIKE TO INTERVIEW THEM AND HAVE SOME TYPE OF PROCESS -- >> IF THEY APPLY WE SHOULD INTERVIEW THEM BUT I'M NOT GOING TO SAY WE SHOULD ONLY INTERVIEW TWO. >> NO, EVERYBODY COULD GET TO PICK. IF YOU HAVE SOME SUGGESTION HOW TO DO THE INTERVIEWS -- >> I'LL MAKE A SECOND TO COMMISSIONER HERNANDEZ MOTION -- >> I'M TRYING TO GET INPUT FROM EVERYBODY, SO I CAN FIGURE OUT WHAT TO PUT DOWN NEXT TIME SO WE DON'T COME BACK IN AND IN THE SAME SPOT. I CAN TABLE BUT IF YOU WANT TO MAKE A MOTION TO TABLE -- >> WE KIND OF ALREADY MADE THE MOTION. >> BUT THERE WAS NO SECOND. I'M JUST TRYING TO -- IF THERE IS ANYTHING ANYBODY HAS INPUT ON, I'M TROOG TO PUT TOGETHER SOMETHING WE HAVE CONSENSUS ON. IF THERE'S NOT CONSENSUS, THAT'S FINE TOO. IF EVERYBODY HAS ALREADY SAID THEIR PIECE I'D BE HAPPY TO -- >> HR AND JUDGE'S OFFICE. [01:25:05] >> ALL I'M TRYING TO SAY IS I THINK THE PUBLIC WANTED US TO DECIDE. IT SHOULD BE OUR OWN THOUGHTS AND NOT HUMAN RESOURCE TO -- >> TO TALLY THE VOTES. >> I RECOMMEND THIS, YOU KNOW. >> NO NO, THEY WOULDN'T HAVE ANY SAY IN, NO, HE WOULDN'T HAVE A VOTE OFTEN WHO WE DO. >> THAT WOULD BE THE PERSON TO TALLY THE VOTES. THEY WOULDN'T HAVE A SAY. I APOLOGIZE IF IT CAME OUT THAT WAY. >> JUST WE HAVE A PLACE TO TURN IT INTO AND HE HAS THE TALLY AND HE DOES ON SOME OF THEM HAVE TO DO BACKGROUND CHECKS. THAT IS THE ONLY THING HR WOULD BE INVOLVED IN, NOT ELECTION OR ANYTHING LIKE THAT. >> MISUNDERSTOOD, MY BAD, SORRY. >> I DON'T KNOW IF COMMISSIONER MARE Z WANTED TO -- NO. >> HE DOESN'T HAVE, SO I GUESS WE'RE GOOD. SO WE HAVE A MOTION -- DID YOU WANT TO CHIME IN? >> JUDGE, I WANT TO MENTION A LITTLE BIT ABOUT IT. I MEAN I THINK THERE NEEDS TO BE A BETTER PROCESS. I THINK THAT WHAT'S BEEN SUGGESTED IS A GOOD START. I DON'T KNOW IF IT'S PERFECT. I DON'T KNOW IF I AGREE WITH IT TOTALLY ON EVERY PART. BUT I THINK TODAY WAS A GOOD EXERCISE IN IF WE DO IT INDIVIDUALLY, I MEAN IT'S OKAY. BUT WE'VE NEVER REALLY PRACTICED IT THAT WAY. I JUST WANT SOME UNIFORMITY ON ALL OF THIS, I THINK THAT'S MY BIGGEST CONCERN WE HAVE A STANDARD AND WE FOLLOW IT CONSTANTLY. AT LEAST THROUGH THE BIGGER APPOINTMENTS. I MEAN IT JUST SO HAPPENED THE DAY WE WERE TALKING ABOUT IT WE HAD APPOINTMENTS TO TWO OF THE THREE BIGGEST POSITIONS WE APPOINT TO WHICH IS THE HOSPITAL DISTRICT AND TO THE RTA AND OF COURSE THE THIRD, ARGUABLY THE PORT. SO THAT'S MY ONLY CONCERN IS THAT WE JUST HAVE SOME STABILITY ON WHERE WE AND HOW WE VOTE ON THE PROCESS SO THAT THERE'S NO CONFUSION ON THE DAY OF THE VOTE AND THAT WE JUST HAVE THAT PROCESS AND WE WORK THROUGH IT AND, YOU KNOW, WE START THE DISCUSSION TODAY AND WE COME BACK HOPEFULLY BY THE NEXT MEETING AND THEN WE ARE ABLE TO KNOW WHAT THE RULES ARE, HOW WE'RE GOING TO ABIDE BY IT. AND SO THE PUBLIC UNDERSTANDS THE PROCESS AS WELL. BUT I REALLY THINK THAT WE NEED THAT. AND TODAY WAS A REALLY GOOD EXAMPLE OF WHY WE DO. >> THANK YOU COMMISSIONER. AND ALSO THIS COULD BE EXTENDED ALSO TO EVERY ONCE THAT WHILE WE HAVE AN OFFICE HOLDER LEAVE OFFICE AND, YOU KNOW, WE COULD EXTEND IT TO THAT TOO. TO WHERE, YOU KNOW, IF SOME OFFICE HOLDER -- THERE ARE SOME WE HAVE TO APPOINT. WELL IT WOULD BE GREAT TO HAVE THOSE PEOPLE INTERVIEWED IN PUBLIC TOO ESPECIALLY IF THEY ARE GOING TO BE APPOINTED TO AN ELECTED POSITION, RIGHT? SO I'LL SECOND HIS TABLE FOR THE NEXT MEETING AND I'LL CONTINUE TO WORK ON THIS AND IF ANYBODY HAS ANY INPUT PLEASE GIVE IT TO ME. I'M LOOK AS COMMISSIONER MAREZ SAID, FOR SOME CONSISTENCY. >> WE HAVE A MOTION AND SECOND TO TABLE. AWFERALL THOSE IN FAVOR SAY AYE. WHEN THE THE NEXT MEETING, OCTOBER 11TH. >> THANK YOU. >> ALL THOSE IN FAVOR SAY AYE. SORRY. AYE. ANY OPPOSED SAME SIGN. [8. Discuss and consider approval of the transfer of the duties of recording the Executive Session from the County Clerk back to the Commissioners Court, and all related matters.] THE MOTION PASSES. WE'LL MOVE BACK TO ITEM NUMBER 8 SINCE THE COUNTY CLERK IS HERE DISCUSS AND CONSIDER THE TRANSFER OF THE DUTIES, THAT WAS YOUR ITEM GOING BACK AND THE COMMISSIONERS COURT TAKING IT FROM EXECUTIVE SESSION RECORDIN- >> RIGHT THAT WAS DONE I WAS REQUESTED TO RECORD AND TO BE PART OF EXECUTIVE SESSION FOR THE TIME BEING AND I BELIEVE THAT HAS RUN ITS COURSE. I'M NO LONGER -- FOR THE REASON I WAS REQUESTED TO BE IN THERE, THAT'S NO LONGER -- >> NECESSARY. >> NECESSARY FOR ME. IN MY VIEW. SO I JUST WANT TO CHANGE THAT IF YOU ALL CAN. I'M STEPPING BACK SO Y'ALL DO WHATEVER YOU WANT. >> THE LAW SAYS WE COULD DO IT OR WE COULD DESIGNATE YOU. THE LAWS SAYS WE CAN DO IT OR DESIGNATE IT TO YOU. ISN'T THAT RIGHT? SO WE CAN TAKE IT BACK BY LAW. >> OH ABSOLUTELY, YES YES YES. >> I WAS JUST -- >> YES, CLEAN BREAK Y'ALL. >> WE WOULD STILL BE -- WE WOULD BE CHARGED WITH RECORDING OBVIOUSLY AFTER TODAY'S MEETING, SINCE WE'RE ONLY DOING THIS TODAY MAYBE. >> THAT'S UP TO Y'ALL AS WELL. >> THAT WOULD BE ANOTHER POLICY. >> AFTER TODAY I WOULD ASSUME. >> I MEAN YEAH. >> I'M NOT SURE WE ARE GOING TO NEED ANY RECORDING. >> I WILL GIVE YOU THE TAPE RECORDER. >> SEEMS LIKE THERE MIGHT BE ONE THING. >> THERE ARE OCCASIONS WHEN IT'S REQUIRED. >> IF YOU WANT TO GIVE US THE TAPE RECORDER WE CAN DO THAT TOO WHATEVER. >> WE COULD JUST TRANSFER IT TO THE COUNTY ATTORNEY WHO IS ALWAYS IN THERE. LIKE -- SHE DOESN'T WANT TO DO THAT. [01:30:02] >> I CAN PUSH A BUTTON. I AM HAPPY TO DO THAT AND MAN THAT. I DO NOT WANT TO BE THE CUSTODIAN OF THOSE RECORDINGS AFTERWARDS. THAT IS I BELIEVE THAT IS THE JOB OF THE COUNTY JUDGE TO MAINTAIN THOSE DOCUMENTS. >> AND WE FOUND A SOLUTION FOR THAT AS WELL, AS I SAID THERE IS A SAFE UP IN THE OLD FIRE MARSHAL'S OFFICE THAT WE CAN GET MOVED DOWNSTAIRS AND WE CAN KEEP THOSE. AND QUITE POSSIBLY -- I DON'T KNOW WHO ALL NEEDS THE COMBINATION TO THE SAFE OR WHATEVER. MY OFFICE -- >> WE JUST NEED TO KIND OF TALK THROUGH THAT AS TO -- YOU KNOW, MAYBE WE COULD DO IT PENDING YOU BEING ABLE TO DEVELOP AN ALTERNATE PLAN OR PUT ON AN ALTERNATE MOTION. BUT DO IT SOMEWHAT CONTINGENT ON, SO SHE CAN FIGURE OUT WHAT SHE WANTS TO DO. >> OH, THE RECORDS THAT WE HAVE IN OUR SAFE DO YOU WANT US TO CONTINUE TO HOLD THOSE UNTIL -- >> I THINK THAT'S WHAT WE NEED A LITTLE TIME TO FIGURE OUT. WE KNOW WHERE YOU'RE GOING. >> DESTRUCTION, TWO YEARS -- >> IS THAT HOW LONG -- >> I DON'T KNOW THE RETENTION SCHEDULE BUT TARA GENERALLY KNOWS. >> SINCE WE TOOK CUSTODY WE CAN HOLD CUSTODY. >> MOVING FORWARD WE'LL SEE. YES. ANYTHING MOVING FORWARD WOULD BE OUR RESPONSIBILITY. PREVIOUS IS STILL YOURS. YOU TOOK THEM, YOU HAVE CUSTODY. >> SIGN AN AFFIDAVIT. >> OH NO NO NO. >> I WILL, WE WILL. >> CAN WE MAKE THAT MOTION PENDING THE OPPORTUNITY FOR THE COUNTY JUDGE TO FORMULATE AN ALTERNATE PLAN AND BRING TO THE COURT HOW SHE WANTS TO HANDLE IT? AND THEN -- OR IF YOU HAVE GOT -- IF YOU KNOW WHAT YOU WANT TO DO NOW? >> I JUST THINK WE TRANSFER IT BACK. I THINK WE HAVE A GOOD PLAN. I THINK I HAVE THE FACILITY TO STORE IT LATER. BUT -- >> THEN WE'RE GOING TO TRANSFER IT BACK TO THE COURT AND DESIGNATE THE COUNTY JUDGE AS THE CUSTODIAN OF THE RECORD? BECAUSE THAT HAS TO BE -- >> I'M DESIGNATED ALREADY. >> I DON'T HAVE THAT IN FRONT OF ME. I DON'T KNOW THE LAW. I DON'T KNOW. >> I ASSIGN THE ENVELOPE ALL OF THAT EVERY TIME. YES, YES. SO I'LL JUST KEEP IT INSTEAD OF HANDING IT OFF TO HER. YES YES. >> OKEY-DOKE, LONG AS YOU GOT IT COVERED JUDGE. I KNOW THAT YOU DO. >> SO I'LL MAKE THE MOTION TO ACCEPT THIS AND TRANSFER IT BACK. >> SECOND. >> WE HAVE A MOTION AND SECOND. ALL THOSE IN FAVOR, SAY AYE, AYE. THANK YOU. EXCEPT FOR NOT FOR TODAY. IF WE HAVE TO RECORD, I DON'T HAVE A RECORDER YET. >> THEY'RE $30. >> I LOOKED ON AMAZON ALREADY. ITEM NUMBER 10 DISCUSS AND [10. Discuss and consider revising or adopting a policy for regular written reviews by the Commissioners Court of department heads that report to the Commissioners Court, and related matters.] CONSIDER REVISING OR ADOPTING A POLICY FOR REGULAR WRITTEN REVIEWS BY THE COMMISSIONERS COURT OF DEPARTMENT HEADS THAT REPORT TO THE COMMISSIONERS COURT AND RELATED MATTERS. >> AGAIN JUDGE THIS WAS A DISCUSSION ITEM TO GET THE INPUT FROM THE COURT. WE, TO MY KNOWLEDGE SINCE I'VE BEEN HERE, I DON'T KNOW THAT WE'VE EVER HAD A POLICY WHERE A REGULARLY SCHEDULED DEPARTMENT HEAD REVIEW SITUATION AND I JUST THINK AS -- I MEAN WE NEED TO DO THAT. SO I DON'T KNOW WHAT THAT IS. AND WE SHOULD DO THEM AT LEAST ONCE A YEAR I WOULD THINK OR MAYBE WE COULD DIRECT THE HR DIRECTOR TO COME BACK WITH A SUGGESTED PLAN IF THE COURT THINKS THAT'S A GOOD IDEA TO REGULARLY REVIEW. >> WE HAD DISCUSSED THIS BEFORE, WHEN IT WAS BROUGHT TO OUR ATTENTION THAT THESE WEREN'T DONE, AND WE HAD TALKED ABOUT BRINGING THEM TO COURT TO TWO DIFFERENT DEPARTMENT HEADS MAYBE PER MEETING TO GET THEM IN ANNUALLY BUT BECAUSE OF THE BUDGETING AND COLLECTIVE BARGAINING AND MAJOR ISSUES THAT HAVE GONE ON THIS HAS FAILED TO GET ADDED TO LENGTHY MEETINGS THAT WE HAVE ALREADY HAD. BUT I THINK SINCE THAT TIME HAS PASSED THIS TIME OF YEAR IS PROBABLY A GREAT TIME OF YEAR TO MOVE TOWARD WITH THAT, WITH THE HELP OF THE HR DIRECTOR. SO. IF YOU WANT TO ADD ANYTHING MR. KOLEY. >> YES JUDGE AND COMMISSIONERS. WITH THE INTEGRATION OF WORKDAY, WE WILL THAT WILL BE THE PERFORMANCE EVALUATION SYSTEM WILL BE BUILT INTO OUR PROGRAM WHERE THAT WILL BE CONDUCTED ANNUALLY. BY ALL DEPARTMENTS AND ALL EMPLOYEES. >> BUT THE DEPARTMENT HEADS ARE THE ONES WE'RE TALKING ABOUT THAT REPORT TO THE COURT. YES. >> ABSOLUTELY. SO THAT WILL BE BUILT INTO OUR SYSTEM ANNUALLY. AND WE CAN DETERMINE WHATEVER DATE THE COURT WOULD LIKE FOR THAT TO OCCUR. BUT THAT WILL BE BUILT IN. >> IT WILL BE BUILT INTO -- WHAT WILL BE BUILT IN, TELL ME THAT AGAIN? >> THE PERFORMANCE EVALUATION PROCESS. WE'LL BE DOING IT CONSISTENTLY EFFECTIVE JANUARY 1ST ACROSS [01:35:04] THE COUNTY. >> FOR ALL EMPLOYEES? >> ALL EMPLOYEES INCLUDING DEPARTMENT HEADS. >> IS THAT A NEW POLICY? I DON'T KNOW -- >> PARK OF WORKDAY. >> PART OF WORKDAY THE INTEGRATION. BUT IF YOU WOULD LIKE ME TO DEVELOP A POLICY ON THAT I CAN. RIGHT NOW POLICY STATES THAT IT IS RECOMMENDED BUT I WOULD LIKE TO ENSURE THAT IT IS DONE CONSISTENTLY. >> I THINK ALL DEPARTMENT HEAD OUGHT TO BE EVALUATING THEIR EMPLOYEES AND EVERY WEEK WE SHOULD BE EVALUATING EVERYONE THAT WORKS FOR US. ALL I'M ADDRESSING TODAY IS THE DEPARTMENT HEADS THAT REPORT TO US. BECAUSE, YOU KNOW, IT IS A PRETTY COMMON STANDARD THING IN HR IN THIS WORLD IS HAVE WRITTEN EVALUATIONS AND I DON'T THINK WE'VE DONE IT. WE GOT TO LEAD BEFORE WE CAN EXPECT OTHERS TO DO THE SAME THING SO I'M JUST TRYING TO GET SOMETHING TODAY THAT SAYS WE'RE GOING TO DO IT ONCE A YEAR OR WHATEVER. BUT I'D LIKE TO PASS SOMETHING THAT SAYS WE'RE GOING TO EVALUATE, I MEAN IF WE CAN, I'D LIKE TO GIVE YOU SOMETHING, SOME DIRECTION TO SAY WE WANT A SPECIFIC THING FOR COMMISSIONERS COURT, LET'S DO THAT ONE FIRST. I STRONGLY AGREE THAT ALL EMPLOYEES OUGHT TO BE EVALUATED ON A REGULAR BASIS. WHATEVER REGULAR MEANS IN A WRITTEN FORM. I MEAN -- >> YES. IN PRACTICE. NORMALLY WE WOULD DO IT IN A PROBATIONARY PERIOD OF SIX MONTHS AND THEN THERE WOULD BE AN ANNUAL EVALUATION POSITIVE ALL EMPLOYEES. IF YOU WANT TO DO ANNUAL FOR THE APPOINTED OFFICIALS WE CAN DO THAT AS WELL BUT WE CAN DO A SIX MONTH AND A ONE YEAR. >> I THINK ANNUAL IS THE PREFERRED START. >> SIX MONTHS AS WELL THAT'S TOUGH. >> BY THE TIME WE DO ALL THE DEPARTMENT HEADS WE'LL BE STARTING OVER, YES, ESPECIALLY SINCE IT'S GOING TO REQUIRE US COORDINATING OR BEING HERE OR DOING IT AT A COURT DATE. >> I THINK WE WOULD -- WE'RE ALMOST THROUGH THIS YEAR, THE CLIRND YEAR. I DON'T KNOW IF WE WANT TO DO IT ON A -- YOU'RE TALKING ABOUT A CALENDAR YEAR NOT OUR FISCAL YEAR. >> YES. >> I THINK WE SHOULD START THIS JANUARY 1. >> CALENDAR YEAR NOT FISCAL YEAR, SORRY. >> RIGHT BECAUSE YOU'RE GOING TO DO IT ON A CALENDAR YEAR RIGHT? >> THAT'S CORRECT YES. >> IF THAT'S WHAT WE'RE GOING TO TRY THE GET SOME UNIFORMITY, WE COULD START THIS IN JANUARY AND WE WOULD CHARGE THE HR DIRECTOR TO MAKE SURE THAT WE DO IT. LIKE SO THAT WE DON'T FORGET. I MEAN WE HAVE A LOT OF STUFF ON OUR PLATE AND IT'S AN HR MATTER. COMMISSIONER GONZALEZ ANY THOUGHTS? WHAT DO YOU THINK? >> I AGREE WITH THAT. >> CONSIDER IT DONE. >> I MEAN YOU GOT TO BE ANNUALLY, NOT SIX MONTHS. >> WE AGREED, ONLY ANNUAL. LOOKS LIKE A GOOD START. AND I WOULD MAKE THAT MOTION OR SECOND YOUR MOTION IF YOU'RE CHARGE WITH THAT. >> RIGHT. >> AND -- CHARGING HR WITH THAT. >> MAYBE IT'S AS SIMPLE AS WE JUST SAY WE WANT TO DO IT ONCE A YEAR FOR DEPARTMENT HEADS AND WE DIRECT THE HR DIRECTOR TO REMIND US AND GET US GET THESE FOLKS SCHEDULED. I'M JUST THROWING IT OUT. ANYBODY GOT ANY IDEAS? I MEAN I'M -- >> THIS WOULD BE CONSIDERED -- >> THEN YOU WOULD PUT IT ON THE AGENDA FOR WHOEVER IS -- WE ARE GOING TO INTERVIEW THEN, YOU WOULD HAVE THEM ON THE AGENDA, WE WOULD DO IT IN EXECUTIVE FOR -- YES. >> I'M SORRY, STEPPED OUT FOR A LITTLE BIT. JUST WANTED TO GET IT STRAIGHT. THIS WOULD BE AN ANNUAL EVALUATION? >> YES. >> BECAUSE WE HAVE LIKE 21 DEPARTMENT HEADS AND MORE WE'D HAVE TO SCHEDULE IT TO MAKE SURE IT'S DONE BY THE MONTH OF JANUARY. SO IT COULD ALL BE DONE -- >> 21 DEPARTMENT HEADS REPORT TO US? >> AT LEAST THE ONES THAT COME TO COURT. >> 21 DEPARTMENT HEADS? >> THAT'S WHAT I COUNT. >> MAN WE HAVE TOO MANY -- ANYWAY, OKAY. >> JUDGE I HAVE ONE QUESTION. DOES IT INCLUDE THE DEPARTMENT HEADS THAT ARE UNDER THE JUDGES? >> THIS WOULD BE ALL DEPARTMENT HEADS, WE NEED TO EVALUATE EVERYONE, YES. >> I WOULDN'T ARE ABLE TO EVALUATE EMERGENCY MANAGEMENT. >> THAT WOULD JUST BE MINE. >> I DON'T DEAL WITH -- I MEAN THAT'S -- SO IT WOULD BE -- MY THOUGHT WOULD BE ALL DEPARTMENT HEADS THAT REPORT NOT ELECTED OFFICIALS. I'M NOT SAYING OBVIOUSLY BUT DEPARTMENT HEADS, ALL DEPARTMENT HEADS THAT REPORT TO US, WE WOULD DO AN ANNUAL EVALUATION ON THEIR JOB PERFORMANCE. >> WELT I THINK WE COULD EVALUATE EVERYONE AND JUST LET THEM -- LET THE PEOPLE THEY'RE UNDER, WHAT WE THINK, THAT'S ONE WAY OF LETTING THEM KNOW HOW WE THINK ABOUT THEIR DEPARTMENT HEADS THAT ARE UNDER THEM. THAT WROTE GET AN IDEA HOW WE FEEL. >> ALL THE REST OF THE DEPARTMENT HEADS ARE UNDER THE WHOLE COURT. THERE IS ONLY ONE DEPARTMENT HEAD SURFACE UNDER THE JUDGE AND THAT'S EMERGENCY MANAGEMENT. >> THEN THE OTHER TWO. THE ONES THAT ARE UNDER THE JUDGES? >> THAT IS ONLY EMERGENCY MANAGEMENT, ONLY ONE. >> I'M TALKING ABOUT DISTRICT JUDGES. >> DISTRICT JUDGES, OH NO WE HAVE NO SAY IN THE ELECTED OFFICIALS. >> JURISDICTION OVER THEM? [01:40:01] >> NO. >> BUT THEY HAVE AN IDEA WHAT WE THINK ABOUT. >> I DON'T THINK ANY ELECTED OFFICIAL IS GOING TO ALLOW US TO EVALUATE THEIR EMPLOYEES. >> THAT'S WHAT I WAS ASKING. >> BECAUSE THEY HAVE SUPERVISORY ROLES OVER THEM AND THAT IS THEIR DEPARTMENT NOT OURS. >> THAT'S WHY I WAS ASKING, I WAS GOING TO INCLUDE THOSE. >> SO IF WE HAVE 21 THEN EVERY YEAR MIGHT BE TOO AGGRESSIVE MANY TO TRY TO DO THAT. BUT I STILL WANT -- >> WE NEED TO TRY EVERY YEAR. >> WE HAVE TO PLAN IT IN ADVANCE SO IT'S DONE BY THE SCHEDULED DATE. >> GOOD STAGGER THEM, THREE AT A MEETING, MAKE THEM QUICK. >> HOW THEY WANT TO EVALUATE THEIR OWN PEOPLE, THAT WOULD NOT BE US. TODAY'S DISCUSSION IS PURELY THE DEPARTMENT HEADS THAT REPORT TO US. >> THAT IS THE DOCUMENT HE IS WORKING ON THE PROCESS FOR WORKDAY WHERE IT'S UNIFORM ACROSS ALL THE DEPARTMENTS THEIR ASSESSMENT AND EVALUATION. >> THAT'S NOT ON THE AGENDA TODAY, THAT IS NOT MY DISCUSSION. I DON'T KNOW, THAT'S A -- WE'LL BRING THAT FOR ANOTHER DAY BUT FOR ME LET'S, I WOULD MAKE A MOTION THAT WE COME UP WITH A EVALUATION SYSTEM WHERE WE TRY TO EVALUATE OUR DEPARTMENT HEADS WHO ROWRT TO THE COMMISSIONERS COURT ONCE A YEAR AND HAVE THE HR DIRECTOR FACILITATE THAT AND PUT THOSE ON AS NEEDED STARTING JANUARY 1ST OF 2024. >> I'LL SECOND THAT MOTION. DESTINY OTHER DISCUSSION? ALL THOSE IN FAVOR SAY AYE, ANY OPPOSED, SAME SIGN. >> WHO UPDATES OUR COURT POLICIES, BECAUSE WE HAVE THOSE COURT POLICIES. THAT WOULD NEED TO BE ON THERE. IS THAT JERCHLY? >> THAT WOULD BE THE ATTORNEYS. >> PROBABLY JENNY Y'ALL HAVE THAT DOCUMENT? >> YES WE CAN UPDATE IT. OUR OFFICE WILL AS WELL. >> THANK YOU. ITEM NUMBER 11 DISCUSS AND [11. Discuss and consider a narrowing and selection process for all qualified employees that report directly to the commissioners court, and related matters.] CONSIDER NARROWING SELECTION PROCESS FOR ALL QUALIFIED EMPLOYEES THAT REPORT DIRECTLY TO THE COMMISSIONERS COURT. I DON'T UNDERSTAND THAT ONE, GRANT, THAT'S YOURS. >> SIMILAR TO WHAT WE DISCUSSED EARLIER, AS REGARDS TO THE PROCESS OF HOW WE PICK PEOPLE WHO REPORT TO US. AND WHAT WE'VE DONE INFORMALLY HAS BEEN KIND OF WHAT I DESCRIBED EARLIER FOR THE BOARDS WHICH WAS WE GET ALL THE APPLICANTS, THE HR QUALIFIES THEM, SENDS THEM TO US, WE PICK OUR TOP TWO, WHOEVER GETS TWO OR MORE VOTES GETS AN INTERVIEW AND THEN WE HAVE AN INTERVIEW. THAT'S HOW WE'VE BEEN DOING IT BUT IT'S BEEN INFORMAL. >> IS THIS FOR OPEN POSITIONS FOR EMPLOYEES LIKE WHEN WE HIRE AT HR? >> NO DEPARTMENT HEADS. >> DEPARTMENT HEADS? >> ONLY PEOPLE THAT REPORT TO US. BECAUSE THERE'S ALREADY A PROCESS IF PLACE FOR -- >> IF THE DEPARTMENT HEAD POSITION BECOMES OPEN AND HAS TO BE REPLACED THIS WOULD BE THE PROCESS FOR THAT, THAT MAKES SENSE. >> CORRECT. SORRY IF I DIDN'T MAKE THAT CLEAR. BUT YEAH THAT WOULD BE, IT'S JUST FORMALIZING WHAT WE'VE BEEN I DOING INFORMALLY. >> WHEN WE ADOPT THE PROCESS FOR THE OTHER. >> FORMALIZING WHAT WE DO INFORMALLY. WHAT WE HAVE BEEN DOING FOR SEVERAL YEARS BUT WE DON'T HAVE IT FORMALIZED. >> WE HAVE THIS TABLED TO THE 11TH SO I ASSUME THIS WOULD NEED TO BE TABLED UNTIL WE HAVE THE FOLLOW READY? >> THIS IS DIFFERENT THAN THE OTHER ONE JUDGE, THIS IS FOR EMPLOYEES, THE OTHER IS FOR BOARDS. >> I THOUGHT YOU WANTED TO FOLLOW THE SAME PROCEDURE. >> THIS IS DOING EXACTLY WHAT WE ARE ALREADY DOING, JUST FORMALIZING IT. THEY WANTED MORE INPUT ON THE BOARDS. THIS IS HOW WE HAVE BEEN DOING. I DON'T KNOW I'M THROWING IT OUT THERE IF NOBODY WANTS TO -- SO DOES ANYBODY HAVE NIS OBJECTION HOW WE HAVE BEEN DOING IT? >> FOR DEPARTMENT HEADS? >> CORRECT. >> I GUESS WE HAVEN'T -- OTHER THAN HR I DON'T KNOW THAT WE'VE HIRED ANYBODY ELSE SINCE I'VE BEEN HERE, HAVE WE? CORRECT ME ANYBODY. OH YES YES, THAT'S THREE, GOOD POINT. I HAVE NO PROBLEM WITH THE WAY WE'VE BEEN DOING IT AN FORMALIZING THAT PROCESS. I THINK MR. GONZALEZ WERE YOU WANTING TO SAY SOME? >> I'M JUST A LITTLE CONFUSED HERE ON THIS -- >> I THINK THE PROCESS THAT YOU'RE TALKING ABOUT BRENT WAS WHERE WE ALL GOT THE APPLICATIONS AND WE REVIEWED THEM, WE PICKED TWO, WE SEND IT BACK TO HR AND THEY SET UP THE INTERVIEWS FOR US, JUST LIKE WE DID -- >> FOR NEW HIRES. >> I KNOW ON THE NEW HIRE OTHER THAN SOMEONE MOVING THIS. >> RIGHT AND YOU COULD EVEN SAY, THERE COULD BE SOME JOB APPLICATION WHERE YOU HAVE 20 APPLICATIONED AN THE NUMBER COULD BE TOP THREE, THERE COSH A SCALE THERE TOO. BUT AGAIN JUST TRYING TO PUT IN [01:45:08] PLACE SOMETHING SO THE WORLD KNOWS HOW WE'RE DOING IT, THE APPLICANTS KNOW HOW WE'RE DOING IT, I THINK THE WORLD IS OKAY WITH HOW WE'VE BEEN DOING IT BECAUSE WE'VE BEEN DOING IT FOR A WHILE. >> I DON'T HAVE A PROBLEM WITH THAT. >> DOES THAT MAKE SENSE? COMMISSIONER MAREZ DO YOU HAVE ANYTHING YOU WARRANT TO ADD ON THAT? >> NO. -- WANT TO ADD ON THAT? >> NO. >> WE DON'T HAVE TO, WE CAN TABLE IT. >> I DON'T KNOW, I'M NOT TOO CLEAR ON THIS. >> OKAY THEN LET ME JUST MAKE A MOTION TO TABLE THIS UNTIL OCTOBER 8TH AND I'LL PUT IT -- >> OCTOBER 11TH. >> SORRY OCTOBER 11TH. AND I'LL PUT THAT IN SPECIFIC, YOU KNOW, WRITTEN FORM THAT SHOWS EXACTLY WHAT WE'VE BEEN DOING, AND JUST LIKE I SAID, JUST FORMALIZING WHAT WE'VE BEEN DOING. >> SECOND. >> WE HAVE A MOTION AND SECOND TO TABLE TO THE OCTOBER 11TH MEETING.
