IF I CAN HAVE A MOTION AND A SECOND, DEE WILL READ THAT.

>>COMMISSIONER HERNANDEZ: SO MOVED.

>>COMMISSIONER CHESNEY: SECOND. >>JUDGE SCOTT: A MOTION AND A

SECOND. >> IN RECOGNITION OF MINORITY MENTAL HEALTH AWARENESS MONTH JULY 2023.

WHEREAS IN 2008, U.S. HOUSE OF REPRESENTATIVE BEBE MOORE CAMPBELL MENTAL AWARENESS MONTH OF AWARENESS OF MENTAL HEALTH AND MENTAL HEALTH AMONG MINORITIES.

AND THE ANNUAL PREVALENCE OF MENTAL HEALTH AMONG U.S. ADULTS BY DEMOGRAPHIC GROUPS IS 39% ASIAN, 17.9 BLACK AFRICAN-AMERICAN, 18.7 AMERICAN INDIA BE OR ALACE CAR HAD, 478 MULTINATIONAL. AND 18.4% HISPANIC OR LATIN -- LATINO. 47.4% LGBTQ+.

AND WHEREAS ACCORDING THE OFFICE OF MINORITY AND NATIONAL AFFAIRS FOR THE AMERICAN PSYCHIATRIC ASSOCIATION, APPROXIMATELY

[00:15:04]

TWO-THIRDS OF ALL PEOPLE WITH A DIAGNOSABLE MENTAL HEALTH DO NOT SEEK TREATMENT THROUGH TO STIGMA, LACK OF COMMUNITY-BASED RESOURCES, INADEQUATE DIAGNOSIS OR NO DIAGNOSIS.

WHEREAS, MENTAL HEALTH CONDITIONS DO NOT DISCRIMINATE BASED ON RACE, COLOR, GENDER AND IDENTITY.

PENTAGON EFFECT OF RACE ICHLT AND MENTAL TRAUMA IS REAL AND CANNOT BE IGNORED. UNDERSERVED COMMUNITIES AND COMMUNITIES OF COLOR NEED CULTURALLY COMPETENT MENTAL HEALTH RESOURCES AND APPROPRIATE TRAINING OF ALL HEALTH CARE PROFESSIONALS AND PROVIDERS TO SERVE MULTIETHNIC CONSUMERS.

WHEREAS ACCESS TO MENTAL HEALTH TREATMENT, SERVICES, ADVOCACY AND QUALITY OF CARE TO LIVE HEALTHY AND FULFILLING LIVES ARE OF PARAMOUNT IMPORTANCE. WHEREAS THE MONTH OF JULY IS THE TIME TO AMPLIFY THE MESSAGE OF TOGETHER FOR MENTAL HEALTH AND TO FOCUS ON THE HEALING VALUES AND PRIORITIZING MENTAL HEALTH AS MENTAL WELL BEING. WHEREAS THE NATIONAL ALLIANCE OF MENTAL HEALTH OF GREATER CORPUS CHRISTI IS PROUD TO HONOR BB MOORE CAMPBELL'S EDUCATION AND ADVOCACY OF PEOPLE AND THEIR LOVED ONES WHO LIVE WITH MENTAL HEALTH AND ESPECIALLY THOSE IN MINORITY COMMUNITIES. NOW, THEREFORE, BE IT RESOLVED THAT THE COMMISSIONERS COURT OF NUECES COUNTY HAVE 2023 AS BB CAMPBELL MINORITY MENTAL HEALTH AWARENESS MONTH.

DULY ADOPTED BY THE COMMISSIONERS COURT OF NUECES, TEXAS, JULY 12, GEE.

>>JUDGE SCOTT: A MOTION AND A SECOND.

ALL IN FAVOR, SAY AYE. AYE.

ANY OPPOSED, SAME SIGN. THE MOTION PASSES.

I KNOW I SEE SEVERAL OF YOU OUT HERE.

DO YOU HAVE A SPOKESPERSON THAT IS GOING TO SPEAK ON YOUR BEHALF? I GUESS HE GOT VOLUN-TOLD.

>> AT LEAST THEY GAVE ME OVERNIGHT THIS TIME.

THANK YOU SO MUCH, JUDGE, COMMISSIONERS.

THE SECOND TIME THIS YEAR I HAVE BEEN BLESSED TO TESTIFY IN FRONT OF YOU ON OF WHAT OF MENTAL HEALTH AWARENESS.

LAST MONTH ON DISKENISIA AWARENESS.

WOULD LIKE TO READ A STATEMENT AND THEN STATISTICS FROM THE FEDERAL DEPARTMENT OF HEALTH. MENTAL HEALTH EFFECTS US ALL AND EVERYONE SHOULD HAVE THE RIGHT TO BE HEARD AND HEALED WITHOUT SHAME OR JUSTICE. BB MOORE CAMPBELL WAS COMMITTED FOR SAFE SPACES FOR PEOPLE IN COMMUNITIES OF COLOR TO CONNECT WITH OTHERS WHO SHARE SIMILAR EXPERIENCES AND CULTURAL BACKGROUNDS. THESE SAFE SPACES SERVED AS A GATEWAY FOR VY STALL MENTAL HEALTH RESOURCES AND SUPPORT NETWORKS. THIS JULY AND BEYOND, WE ARE NOT ONLY HONORING BB MOORE CAMPBELL'S LEGACY BUT CONTINUING IT WITH EMPOWERING AND UPLIFTING HISTORICALLY UNDERREPRESENTED COMMUNITIES IN THEIR MENTAL HEALTH JOURNEYS AND ERADICATING SIGMA AND ELEVATING COMMUNITIES. IN 2021, ONLY 5 52% OF NONHIS SPANNIC WHITE ADULTS RECEIVED MENTAL HEALTH TREATMENT OF NOSE DIAGNOSED. IT WAS ONLY 39% FOR BLACK AND AFRICAN-AMERICAN. 25% FOR ASIAN-AMERICAN ADULTS.

AND 35% FOR HISPANICS. ACCORDING THE VETERANS HEALTH ADMINISTRATION DEPARTMENT, AMERICAN INDIAN AND ALASKAN NATIVE VETERANS EXPERIENCED POST TRAUMATIC STRESS DISORDER AT DOUBLE THE RATE OF NONHISPANIC. 25% COMPARED TO 11.6%.

WE CAN DEBATE AND ARGUE AND DISAGREE ON SOME OF THE CAUSES AND SOLUTIONS TO DISPARITIES IN HEALTH AND MENTAL HEALTH CARE AND MENTAL HEALTH TREATMENT, BUT DISPARITIES EXIST AND CULTURALLY COMPETENT CARE IS HELPFUL, IS BENEFICIAL.

AND WE ARE REALLY GRATEFUL FOR THIS PROCLAMATION SUPPORTING MINORITY MENTAL HEALTH AWARENESS MONTH.

THANK YOU VERY MUCH. >>JUDGE SCOTT: THANK YOU.

AND THANK YOU ALL FOR WHAT YOU DO.

I DIDN'T PLAN ON SPEAKING, BUT I FELT I WOULD LIKE TO REITERATE THE IMPORTANCE OF BRINGING AWARENESS TO MENTAL HEALTH.

I HAD SYMPTOMS VERY YOUNG AS A CHILD.

DUE TO MY CULTURE AND FAMILY, IT WAS NOT SOMETHING SPOKEN ABOUT.

I ALWAYS SUFFERED IN SILENCE. IT WASN'T UNTIL I MARRIED MY WIFE WHO HAD SCZO EFFECTIVE DISORDER THAT I FOUND HELP.

I FOUND NAMI. I GOT EDUCATED AND HELP MYSELF AND MY WIFE AT THE TIME. MENTAL HEALTH CONDITION CONTINUES TO SPIRAL OUT OF CONTROL AND SHE USED SUBSTANCES

[00:20:02]

TO ASSIST WITH THOSE SYMPTOMS AND SHE LOST -- WELL, SHE LOST THAT BATTLE THIS LAST DECEMBER. I DID HAVE THE WONDERFUL OPPORTUNITY OF GOING TO A MENTAL HEALTH CONFERENCE IN WASHINGTON D.C. RECENTLY. TO SEE THE YOUNGER GENERATION AND SO MANY PEOPLE OF DIFFERENT BACKGROUNDS AND DIVERSITY TO GATHER TOGETHER TO HELP BRING AWARENESS IS A BEAUTIFUL THING AND I HOPE THAT CONTINUES. I GOT TO SEE THE PROGRESS OVER THE YEARS. AND IT IS BUILDING.

AND I HOPE THAT IT CONTINUES. AND I JUST HOPE THAT EVERYBODY TAKES THE OPPORTUNITY TO BE ACCEPTING OF THOSE AROUND THEM AND ALSO IN THEIR OWN FAMILY AND TRY TO HAVE THOSE OPEN CONVERSATIONS WITH THEIR CHILDREN AND THEIR LOVED ONES SO THEY CAN HAVE SOMEONE TO GO TO. THANK YOU.

>>JUDGE SCOTT: THANK YOU. THANK YOU VERY MUCH.

I HAVE A PROCLAMATION FOR YOU, A RESOLUTION, BUT I JUST NOTICED THAT IT IS MISSING KARA'S SIGNATURE.

I HATE TO PASS IT OUT. WE WILL GET IT BACK TO YOU WITH ALL THE SIGNATURES IN THERE BUT WE ARE VERY APPRECIATIVE OF EVERYTHING THAT YOU DO. THANK YOU VERY MUCH, AGAIN.

WE ARE HAPPY TO TAKE A PICTURE IF YOU ALL WANT TO TAKE A PHOTO TOO. I DON'T MEAN TO PASS IT UP.

IT IS YOUR CHOICE. YOU ARE THE GUEST.

WE WILL GO AHEAD AND BRING THIS I

IN. >>COMMISSIONER CHESNEY: THANK

YOU VERY MUCH. >>COMMISSIONER HERNANDEZ: APPRECIATE YOUR WORK. THANK YOU, MA'AM.

APPRECIATE WHAT YOU DO. >>COMMISSIONER CHESNEY: HAVE A GREAT DAY. THANK YOU.

[G. PUBLIC COMMENT: This section provides the public the opportunity to address the Commissioners Court on any issues within its jurisdiction. The Commissioners Court may not take formal action on any requests made during the Public Comment period which are not on the Agenda, but can refer such requests to County staff for review if appropriate.]

>>JUDGE SCOTT: NOW WE WILL MOVE ON TO PUBLIC COMMENT.

WE HAVE A FEW PEOPLE WHO HAVE SIGNED UP.

HOWARD SHOWER WITH THE VFW. STATE YOUR NAME AND ADDRESS.

YOU DIDN'T PUT YOUR ADDRESS ON HERE.

GOOD MORNING, JUDGE, HOWARD SHOWER, VFW 1832 AT 702 JESTER STREET. THE PURPOSE FOR ME BEING HERE TODAY IS TO PUBLICLY THANK YOU FOR THE DISTRIBUTION OF THE AMERICAN RESCUE PLAN ACT FUNDS THAT WE RECEIVED.

THOSE FUNDS AS WE KNOW TOURING THE PANDEMIC WITH THE FORCED CLOSURE BY THE GOVERNOR THAT WE WERE UNABLE TO HAVE ANY REVENUE COMING IN. WHICH STOPPED SOME OF OUR INFRASTRUCTURE THAT WE WERE WORKING ON TO SUPPORT VETERANS AND THEIR FAMILIES AND THE LOCAL YOUTH OF THE COMMUNITY.

ONCE AGAIN, I WOULD JUST LIKE TO TELL WITH YOU THE UPMOST SINCERITY, GRATITUDE FROM OUR POST MEMBERS THAT WE THANK YOU FOR YOUR SUPPORT. 1832 IS A PLACE THAT EVERY VETERANS' FAMILY AND GUESTS ARE WELCOMED WITH A HANDSHAKE, HUG OR HELLO. AN EAR TO LISTEN AND SHOULDER TO CRY ON WHEN THEY NEED IT. THANK YOU.

>>JUDGE SCOTT: THANK YOU, SIR [APPLAUSE]

>>JUDGE SCOTT: AMBER HASSAN WITH HABITAT FOR HUMANITY.

>> AMBER HASEN 1901 POND HERE IN CORPUS CHRISTI.

GOOD MORNING, JUDGE AND COMMISSIONERS.

FIRST OF ALL, I WANT TO THANK YOU SO MUCH FOR YOUR SERVICE AND

[00:25:03]

YOUR LEADERSHIP INDIVIDUALLY AND AS A GOVERNING BODY FOR OUR GREAT NUECES COUNTY. AND ON BEHALF OF HABITAT FOR HURANITY, I AM VERY GRATEFUL FOR THE GRANT FUNDING.

HABITAT HAS TAKEN A HUGE HIT THROUGH THE PANDEMIC.

AND WE HAVE SO MANY FAMILIES IN NEED THAT WE SERVE.

AND IT IS A HUGE BLESSING. SO WE ARE VERY -- VERY GRATEFUL.

WE HAVE A -- A LONG LIST OF -- OF FAMILIES WHO NEED CRITICAL REPAIRS FROM HARVEY. MANY OF OUR AGING POPULATION.

A LOT ON DISABILITY. MANY OF OUR VETERANS THAT WE GO INTO THOSE CRITICAL REPAIRS AND TRY TO KEEP THEM IN THEIR HOMES.

WE TO REMODEL PROJECTS AND WE ALSO DO THE NEW CONSTRUCTION AND ALL OF THAT GRANT AND IF, FUNDING BENEFITS A WIDE RANGE OF DEMOGRAPHICS, DIVERSITY HERE IN OUR COUNTY.

AND WE WANT TO LET YOU KNOW HOW GRATEFUL WE ARE.

I DID BRING A -- THE BLUE FOLDER FOR EACH OF YOU TODAY AND DESCRIBES MORE INFORMATION, JUST ABOUT ALL OF OUR PROGRAMS AND THE WORK THAT WE ARE DOING. I HOPE THAT YOU WILL TAKE SOME TIME TO LOOK AT THAT. I THINK MY -- MY FEELING IS THERE IS -- THERE IS SO MUCH THAT WE DO THAT IS JUST NOT COMMON KNOWLEDGE. SO WE ARE TRYING TO GET THAT MESSAGE OUT. SO, AGAIN, WE APPRECIATE YOU SO MUCH. IF THERE IS EVER A TIME WE CAN PARTNER TOGETHER TO DO MORE GREAT WORK IN THIS COUNTY, WE ARE HERE. WE ARE WILLING.

WE ARE READY TO BUILD. WHATEVER THAT LOOKS LIKE, I WANTED TO OPEN THOSE LINES OF COMMUNICATION AND LET YOU KNOW THAT WE WANT TO BEAUTIFY THE CITY AND PUTTING DESERVING FAMILIES IN HOMES. THANK YOU SO MUCH.

>>JUDGE SCOTT: THANK YOU SO MUCH.

AND THANK YOU FOR OUR GIFTS. CYNTHIA WINKLEY IS ONLINE.

IF YOU CAN UNMUTE HER. HAD.

SHE HAS ASKED TO SPEAK. WE NEED HER ADDRESS.

STATE HER NAME AND ADDRESS. >> HELLO? HELLO. MY NAME IS CYNDIE WINKLEY.

I LIVE AT 514 PASADENA PLACE. AND I AM ON THE ANIMAL SERVICES ADVISORY BOARD. I JUST WANTED TO GO ON RECORD TO SAY A COUPLE MUCH THINGS IN RESPONSE TO THE COMMENTS AT THE LAST MEETING. THE ONLY REASON I CAME BEFORE YOU GUYS TO SPEAK THEN WAS IN AN EFFORT TO END ALL THE DRAMA.

AND GET SOME ANSWERS. AND MOVE ON.

AND I JUST WANT TO MOVE ON WITH THIS.

BASICALLY I GOT -- BELIEVE ME WHEN I TELL YOU I UNDERSTAND THE FRUSTRATION AROUND THIS ISSUE, BECAUSE I HAVE BEEN DEALING WITH DRAMA AND HARASSMENT NOW FOR OVER A YEAR, GETTING YELLED AT, BECAUSE THE COURT IS BOTHERED AND DISTURBED THAT THE BOARD IS NOT MEETING AND DOING WHAT WE SHOULD BE DOING.

BUT FOR THE RECORD, THE LAST THING I KNEW IN SEPTEMBER, FOUR BOARD MEMBERS WHICH ARE HALF OF US WERE UP FOR REAPPOINTMENT.

WE ALL APPLIED. WE WERE PUT ON HOLD IN ORDER TO BE INVESTIGATED. MAYBE I WAS INACCURATE WHEN I MISUNDERSTOOD TO MEAN THAT WE SHOULD NOT MEET, BUT GENERALLY IN MY EXPERIENCE AS A PERSON NOT APPOINTED TO A POSITION, PLACED UNDER INVESTIGATION, THEY ARE ALREADY CONSIDERED ON A LEAVE OF ABSENCE UNTIL THERE IS A RESOLUTION.

SO WE STILL DON'T KNOW WHY WE ARE BEING INVESTIGATED OR WHAT THE RESULTS WERE. WE STILL DON'T HAVE ANY ANSWERS.

BUT AS A VOLUNTEER, PERHAPS YOU CAN UNDERSTAND MY CONFUSION.

WE FREELY FIVE OUR TIME WITHOUT BEING PAID TO SERVE THE COUNTY.

IT IS ALL VOLUNTEER. IT IS, YES, FOR THE ANIMALS BUT TO WORK AT SHELTERS, AND FOR THE ENTIRE COMMUNITY AS A WHOLE.

I AM WORKING FOR ALL OF YOU AND EVERYBODY IN THIS COUNTY.

AND, YOU KNOW, I AM TRYING TO MAKE THIS A BETTER PLACE FOR EVERYONE TO LIVE. I FEEL LIKE, YOU KNOW, IF I CAN JUST DO SOME SMALL THING TO CONTRIBUTE TO IMPROVE THE QUALITY OF LIFE HERE IN NUECES, THAT IS SOMETHING I AM TRYING TO DO. SO I COMPLETELY UNDERSTAND THAT OUR ADVISORY BOARD IS NOT IN CHARGE OF THE DEPARTMENT.

WE HAVE NO AUTHORITY OVER ANYTHING.

WE HAVE HAD A FEW SUCCESSES AS A BOARD.

WE WERE ACCOMPLISHING A LOT BEFORE WE GOT INTO ALL THIS DRAMA WITH MILLER AND MCBRIDE. SO I AM HOPEFUL THAT WE CAN PUT ALL OF THAT BEHIND US TODAY. GET BACK TO THE WORK TO SERVE THE ANIMAL SERVICES DEPARTMENT, THE ANIMALS THEY HARBOR AND THE ENTIRE COMMUNITY WHICH WE ALL SERVE.

I WANT TO THANK THE COURT FOR THEIR TIME AND SERVICE.

[00:30:01]

I LOOKED UP YOUR JOB DESCRIPTION, AND IT IS TOTALLY IMMENSE. I WANT TO THANK YOU FOR YOUR CONTINUED HARD WORK. AND THE SUCCESS OF OUR COMMUNITY DEPENDS ON YOU, ON ALL OF US. SO I PRAY THAT ALL THE VOTERS ARE PAYING ATTENTION. THAT GOD BLESSES YOU ALL AND ALL OF US AND THAT OUR COMMUNITY CAN BE STRENGTHENED THROUGH ALL OF

OUR WORK TOGETHER. >>JUDGE SCOTT: THANK YOU.

THAT WAS THE LAST PERSON WE HAD SIGNED UP.

ANYONE ELSE WHO IS IT NOT HAVE A CHANCE TO SIGN UP FOR PUBLIC COMMENT WHO WISHES TO DO SO NOW? DUSTIN, DO YOU WANT TO SPEAK? STATE YOUR NAME AND ADDRESS, PLEASE.

I WILL WRITE YOU DOWN. >> DUSTIN CRONYN, YORK TOWN BOULEVARD. GOOD AFTERNOON -- I MEAN GOOD MORNING JUDGE AND COUNTY COURT COMMISSIONERS.

I WANT TO ANNOUNCE TODAY THAT THIS PAST WEEK -- OR LAST WEEK, I JUST GOT MY -- MY PAPERWORK FILED TO BECOME A NONPROFIT OWNER FOR PEOPLE WITH AUTISM AND TO HELP AROUND ALL THE COMMUNITY BE TO DO SOME GREAT WORK AND TO EDUCATE ALL OF OUR FIRST RESPONDERS AND ALL OF OUR SCHOOL DISTRICTS AROUND THE COUNTY AND AROUND THE CITY AND EVERYONE. AND WE ALSO WANT TO LOOK AT THEM PROVIDING FOR OUR LAW ENFORCEMENT, FOR OUR FIRST RESPONDERS, FOR THE ONES THAT ARE NONVERBAL, THAT HAVE -- THAT STILL HAVE THE MENTAL CAPACITY OF A FOUR AND FIVE-YEAR-OLD.

THESE BRACELETS THAT HAVE -- IT IS LIKE A HOUSE ARREST MATERIAL BRACELET BUT NOT AS BIG. IT WILL HAVE A GPS SYSTEM AND ALL THAT TO LOCATE WHERE THEY ARE AT IF THE CAREGIVER IS BEING NEGLIGENT OR IF SOMETHING SERIOUS HAPPENS LIKE THE CAREGIVER HAS, LIKE, A HEART ATTACK, TO WHERE IF THEY GET, LIKE, TOO FAR AWAY WITHIN THEIR CAREGIVER, IT WILL PEEP AND LET THE FIRST RESPONDERS KNOW TO GO OUT THERE AND ALL THAT GOOD STUFF. AND WE ALSO LOOK TO PROVIDE A LOT OF GREAT SERVICE, EVEN MAYBE EVEN SOME HOUSING TOO FOR THE ONES THAT ARE, LIKE, HIGH FUNCTION AND ALL THAT.

GOOD STUFF. AND WE ALSO -- WE ALSO ARE GOING TO WORK WITH COMMUNITY CHOICE LIVING, ALSO, TOO, TO MAKE IT BETTER AND MAKE IT GOOD IN THE COUNTY.

AND I WANT TO THANK YOU ON ALL OF OUR COUNTY COURT COMMISSIONERS, EACH AND EVERY ONE OF YOU.

AND I LOOK FORWARD TO DOING THIS.

AND IT'S -- IT IS MY GREAT HONOR AND MY GREAT PLEASURE AND THAT'S

ALL I HAVE TODAY. >>JUDGE SCOTT: THANK YOU.

>>COMMISSIONER HERNANDEZ: THANK YOU.

>>JUDGE SCOTT: ANYONE ELSE? THAT IS PUBLIC COMMENT.

[2. CONSENT AGENDA: The following Agenda Items are of a routine nature, and the Commissioners Court has received supporting materials for consideration. All of these Agenda Items will be passed with one vote without being discussed separately, unless a member of the Commissioners Court or the public requests that a particular Agenda Item be discussed. If so, that Agenda Item will be pulled from the Consent Agenda and discussed as part of the regular Agenda at the appropriate time. One vote will approve the remaining items on the Consent Agenda.]

MOVING ON TO ITEM NUMBER 2, CONSENT AGENDA.

ARE THERE ANY ITEMS IN THE CONSENT AGENDA, ANYONE WISHES TO PULL? I HAVE ONE.

I NEED TO PULL ITEM EKING JUST FOR A DIRECTION.

AND ANMENT IN APPEAR ITEM E. J FOR A DIRECTION.

AND ANMENT IN JUST FOR A DIRECTION.

AND ANMENT IN APPEAR ITEM E. J A DIRECTION.

AND ANMENT IN JUST FOR A DIRECTION.

AND ANMENT IN APPEAR ITEM E. BUT.

>>COMMISSIONER CHESNEY: I WOULD LIKE TO PULL M, M AS IN MARY.

>>COMMISSIONER GONZALEZ: I WOULD LIKE TO PULL F.

AND I WOULD LIKE TO PULL Q. >>JUDGE SCOTT: F AND Q.

>>COMMISSIONER MAREZ: AND S, JUDGE.

>>COMMISSIONER CHESNEY: WHICH IS THE ONE YOU PULLED?

>> Q. >>JUDGE SCOTT: ANY OTHERS? THEN I WILL ACCEPT A MOTION TO PASS THE CONSENT AGENDA EXCLUDING ITEM E, F, M, Q, AND S.

>>COMMISSIONER CHESNEY: SO MOVED JUDGE.

>>COMMISSIONER MAREZ: SECOND. >>JUDGE SCOTT: MOTION AND

[E. Authorize payment of bills - Special Motions List for Lockwood Andrews & Newnam dated July 12, 2023.]

SECOND. ALL IN FAVOR, SAY AYE.

ANY OPPOSED, SAME SIGN. MOTION PASSES.

MOVING ON IT TO E WAS JUST A CLARIFICATION.

I UNDERSTAND THAT THE TOTAL IN HERE WAS INCORRECT.

IT IS -- THE TOTAL SHOULD BE $22,537.31 TO -- ON THE SPECIAL MOTIONS LIST FOR LAN, FOR I.B. MAGEE PARK HAZARD MITIGATION AND THE HAZARD MITIGATION ACTION PLAN.

I BELIEVE YOU RECEIVED BACK-UP ON THAT --

>>COMMISSIONER GONZALEZ: WERE THERE TWO TOGETHER THERE? YOU SAID MITIGATION AND HAZARD OR THE -- THE I.B. MAGEE PARK.

>>JUDGE SCOTT: ONE IS I.B. MAGEE.

[00:35:02]

TWO INVOICES ROAR ONE IS I.B. MAGEE PARK AND THE OTHER IS HAZARD MITIGATION. THE TOTAL IS CORRECT, TOTAL $22,527.31. SINCE THAT IS PART OF EMERGENCY MANAGEMENT, I WILL MAKE A MOTION TO PASS THAT.

>>COMMISSIONER GONZALEZ: I WOULD LIKE TO ASK A COUPLE OF

QUESTIONS. >>JUDGE SCOTT: PLEASE IF I CAN

GET A SECOND. >>COMMISSIONER CHESNEY: SECOND

FOR DISCUSSION. >>COMMISSIONER GONZALEZ: WAS THERE -- WAS THERE A TIMELINE ON THIS THING THAT -- DID WE MISS

OR EXTENDED OR ANYTHING? >>JUDGE SCOTT: THE PART ON THE HAZARD MITIGATION. WE RECEIVED A GRANT OF $100,000.

WE HIRED THEM TO DO THIS PLAN FOR US.

THEY ARE WORKING ON THIS AS WE SPEAK.

WE GET REIMBURSED -- WELL, ACTUALLY WE.

IT COMES OUT OF THE COUNTY JUDGE'S FUNDS.

I GET REIMBURSED AFTER WE PAY THIS.

THIS IS AN INVOICE THAT WE PAY, WE CAN'T ASK FOR REIMBURSEMENT UNTIL THE COUNTY PAYS IT UP FRONT.

D IS TALKING AND GETTING BACK UP.

WE ARE STATING THAT IT IS TRUE AND CORRECT AND ASK TO PROCEED.

>>COMMISSIONER GONZALEZ: I HAVEN'T SEEN THE BACK-UP.

WAS THERE BACK-UP? >>JUDGE SCOTT: I TOOK IT TO YOUR OFFICE -- YOU PROBABLY DIDN'T SEE IT.

YOU WERE GONE. >> ALL THE THINGS THEY DID IN

AUGUST -- >>COMMISSIONER CHESNEY: YOU NEED

TO BE ON THE MIC. >>JUDGE SCOTT: YOU HAVE TO BE ON

-- >>COMMISSIONER CHESNEY: WHICH ONE IS WRONG, JUDGE, WHILE SHE IS WALKING OUT.

AN AMOUNT ON ONE OF THESE. >>JUDGE SCOTT: ADDITION, THE TWO TOTAL WAS INCORRECT WITH THE TWO INVOICES.

THEY ADDED IT UP WRONG. THEY NOTIFIED ME.

I WASN'T AWARE. >> SAYS 12,000.

>>JUDGE SCOTT: JUST A CLERICAL ERROR.

NOT THAT THE INVOICES ARE INCORRECT.

>> I TALKED TO TAD MAQUINO. THEY ARE 90% DONE WITH IT.

WHAT THEY ARE WAITING ON NOW, THE WATER DISTRICT GOT IN LATE IN THE GAME THAT THEY ARE CATCHING THEM UP AND THEY ARE LOOKING TO HAVE A -- A FINAL REPORT BY OCTOBER, BUT THAT REPORT HAS TO FIRST GO TO TEDUM, THE TEXAS DIVISION OF EMERGENCY MANAGEMENT. THEY HAVE TO GIVE THEIR BLESSING. ONCE THAT HAPPENS, IT WILL BE FORWARDED TO FEMA AND FEMA HAS TO APPROVE THE PLAN AS WELL.

ONCE THAT IS DONE, WE WILL HAVE IT IN PLACE.

AND THIS IS KIND OF LIKE THE TRI-COUNTY WATER DISTRICT PLAN YOU GUYS WERE DOING. IN ORDER FOR US TO APPLY FOR GRANTS AND THINGS IN THIS AREA. WE HAVE TO HAVE A JURISDICTIONAL HAZARD MITIGATION PLAN AND THAT IS WHY THIS IS SO IMPORTANT.

>>COMMISSIONER GONZALEZ: THANKS FOR THE EX-EMPLOYEE NATION.

>> YOU ARE WELCOME. >>JUDGE SCOTT: ANY OTHER QUESTIONS. A MOTION AND A SECOND.

ALL IN FAVOR, SAY AYE. AYE.

[F. Authorize escrow disbursement request #14 in the amount of $387,878.99 from Banc of America Public Capital Corp., Payable to "ABM Building Services LLC" for Nueces County Bundled Energy Solutions Project for Pay Application #20, Services Ending April 30, 2023.]

ANY OPPOSE, SAME SIGN. THE MOTION PASSES.

MOVING ON TO ITEM F. ESCROW DISBURSEMENT IN THE AMOUNT OF 387 FROM BANK OF AMERICA.

I BELIEVE IT IS PAYMENT NUMBER 20 TO ABM AND JUAN IS NOT HERE

-- >>COMMISSIONER GONZALEZ: ONE

QUESTION. >>JUDGE SCOTT: YOU HAVE A

QUESTION, YES. >>COMMISSIONER GONZALEZ: I WAS AGAIN -- I THOUGHT WE HAD ALREADY -- A FEW MINUTES AGO -- A COUPLE OF MONTHS AGO, AN ISSUE ON THE PAYMENT.

AND I THOUGHT WE HAD CLEARED THAT.

THIS IS ANOTHER PAYMENT BE IDENTIFY WHAT WE WERE DISPUTING?

>>JUDGE SCOTT: THE OTHER PAYMENTS FROM PREVIOUS MONTHS BEFORE THAT WAS WITHHELD THAT DID MOVE FORWARD.

THIS IS ACTUALLY -- DOES IT SAY ON FLORIDA WHICH MONTH IT IS?

>>COMMISSIONER GONZALEZ: APRIL 30, 2023.

>>JUDGE SCOTT: THIS IS BACK FROM APRIL.

THEY ARE CONTINUING TO WORK AND WE GOT FAR BEHIND IN PAYMENTS WITH THEM. THERE WAS ANOTHER PAYMENT THAT IS GOING TO BE COMING OUT. GO AHEAD, TERESA --

>> COMMISSIONER GO MINNESOTA, THIS BILL IS FOR THE SERVICES FOR THE MONTH OF APRIL. IT DOES NOT INCLUDE THE CHANGE ORDER THAT HAPPENED IN MAY, BUT IT IS A GOOD INVOICE.

IT HAS BEEN AUDITED AND JUAN HAS SIGNED OFF ON IT.

>>COMMISSIONER GONZALEZ: ALL RIGHT.

DON'T WANT TO PAY FOR SOMETHING THEY ARE NOT DOING.

>>JUDGE SCOTT: ABSOLUTELY. I APPRECIATE THAT.

>>COMMISSIONER GONZALEZ: SO MOVED.

>>JUDGE SCOTT: WE HAVE A MOTION TO PASS.

DO WE HAVE A SECOND? >>COMMISSIONER HERNANDEZ:

SECOND. >>JUDGE SCOTT: A MOTION AND A SECOND. ALL THOSE IN FAVOR SAY AYE.

[M. Approve FY 2022-2023 Outside Agency Contract for $3,300 with Nueces County Junior Livestock Show (NCJLS). 1. County Judge - $1,000 2. Commissioner Pct. 1 - $1,300 3. Commissioner Pct. 3 - $1,000]

ANY OPPOSED, SAME SIGN. THE MOTION PASSES.

[00:40:01]

ITEM M. COMMISSIONER CHESNEY, YOU ASKED TO PULL APPROVING THE OUTSIDE AGENCY CONTRACTS FOR NUECES

COUNTY. >>COMMISSIONER CHESNEY: JUDGE, I WAS JUST WANTING TO ADD -- MAKE A MOTION TO AMEND AND ADD $1,000 FROM PRECINCT 4. I KNOW I GAVE TO THE -- I CAN'T REMEMBER THE HORSE, ONE RELATED TO THE LIVESTOCK SHOW AND I WANTED TO ADD $1,000 FROM PRECINCT 4 FUNDS.

THAT IS ALL I WAS PULLING IT TO MAKE THAT MOTION TO AMEND --

>>COMMISSIONER GONZALEZ: SECOND. >>JUDGE SCOTT: WE HAVE A MOTION AND A SECOND TO AMEND AND ADD AN ADDITIONAL $1,000 FROM PRECINCT 4. ANY OTHER DISCUSSION? ALL THOSE IN FAVOR, SAY AYE. AYE.

ANY OPPOSED, SAME SIGN. THE MOTION PASSES.

MOVING ON TO ITEM Q, AND COMMISSIONER GONZALEZ.

>>JUDGE SCOTT: NOW WE HAVE TO PASS THE WHOLE THING.

THANK YOU FOR CATCHING ME. >>COMMISSIONER CHESNEY: I WILL MAKE A MOTION TO PASS ITEM M AS AMENDED.

>>COMMISSIONER GONZALEZ: SECOND. >>JUDGE SCOTT: A MOTION AND A SECOND TO PASS ITEM M HAS AMENDED.

ALL IN FAVOR, SAY AYE, SAY AYE. AYE.

OPPOSED, SAME SIGN. MOTION PASSES.

[Q. Authorize execution of Notification of $79,495.00 FY 2023 Funding (Street Improvement Fund), as presented by the Regional Transportation Authority.]

THANK YOU VERY MUCH FOR CATCHING THAT.

>>COMMISSIONER CHESNEY: YES, MA'AM.

>>JUDGE SCOTT: ITEM Q, COMMISSIONER GONZALEZ, THE FUNDING OF THE IMSTREET IMPROVEMENT FUND.

>>COMMISSIONER GONZALEZ: THIS IS AN AREA COMMISSIONER OR JUDGE? REFERENCE TO 20,000, WHATEVER IT IS, 18,000.

IT IS NOT BROKEN DOWN IN HERE. >> SO THE TOTAL 79,495 AND EACH COMMISSIONER AND THE JUDGE WILL RECEIVE $15,889 FOR THIS FISCAL YEAR, 2023. SO IT IS --

>>JUDGE SCOTT: THE BALANCE IN THAT ACCOUNT.

THE BALANCE WE HAVE -- >> I CAN PROVIDE THE BALANCE.

>>JUDGE SCOTT: THE OTHER DAY 854.

>>COMMISSIONER CHESNEY: HOW MUCH?

>>JUDGE SCOTT: $854. >>COMMISSIONER MAREZ:

$854.62.50. >>COMMISSIONER CHESNEY: WHAT IS

IT IN THERE NOW. >> THE TOTAL BALANCE FOR THE

QUARTER. >>JUDGE SCOTT: I WAS TOLD WE --

WHAT CAN WE SPEND THAT ON? >> RELATED TO -- SIDEWALKS,

EVERYTHING RELATED -- >>COMMISSIONER CHESNEY: SUPPOSED

TO BE KIND OF WHERE BUSES RUN. >> THAT'S CORRECT, COMMISSIONER.

>>COMMISSIONER CHESNEY: THAT DIDN'T SOUND RIDE.

>>COMMISSIONER MAREZ: PRETTY HE MUCH AN EVEN SPLIT THEN?

>> YES. ON -- I -- I AM GOING TO ASK TO PROVIDE THE BALANCES FOR EACH ONE, BECAUSE SOME OF THE COMMISSIONERS -- IT HAS BEEN MORE THAN TWO YEARS AGO, I BELIEVE THAT ONE OF COMMISSIONER SPENT A LITTLE MORE.

>>JUDGE SCOTT: SOMEBODY HAVEN'T SPENT A LOT OF MONEY IF WE HAVE THIS KIND OF BALANCE. FUND BALANCE OVER EACH FIVE OF THEM AND EACH ONE HAS BEEN ALLOCATED A CERTAIN AMOUNT OF

THAT TOTAL. >>COMMISSIONER MAREZ: WE WILL

GET A BETTER BREAKDOWN. >> NEXT TIME.

>>COMMISSIONER MAREZ: OF PRECINCT FOR A JUDGE.

>>COMMISSIONER CHESNEY: MAYBE PUT THAT ON AS ACTION WITH

BACK-UP. >>JUDGE SCOTT: ON THE 26TH.

I AM SURE TERESA IS LISTENING AND WILL WRITE THAT DOWN.

MAKE SURE SHE GETS IT. >> YES, EVERYBODY --

>>COMMISSIONER GONZALEZ: APPROVE THIS ON HERE.

>>JUDGE SCOTT: A MOTION TO APPROVE FROM COMMISSIONER GONZALEZ. SECONDED FROM COMMISSIONER HERNANDEZ. ALL IN FAVOR, SAY AYE.

AYE. ANY OPPOSED, SAME SIGN.

[S. Authorize the selection of International Consulting Engineers (RFQ No. 3232-23) for Environmental Services of colonias included in the Colonia Self-Help Center Program awarded through Texas Department of Housing and Community Affairs.]

THE MOTION PASSES. COMMISSIONER MAREZ, YOU ASKED

FOR ITEM S. >>COMMISSIONER MAREZ: YES,

JUDGE. >>JUDGE SCOTT: ICE ENGINEERING

QUESTION. >>COMMISSIONER MAREZ: EDWARD, I KNOW WE HAD SOME OF THE BACKGROUND INFORMATION ON THE SHEET AND THE ATTACHMENT WAS SORT OF A PLANK ASSESSMENT FORM THAT WILL BE USED SHOULD WE AWARD THIS TO ICE, IS THAT

RIGHT? >> YES, SIR.

ESSENTIALLY THREE PHASES. THE COUNTY AS A WHOLE, EACH INDIVIDUAL COLONIA WE HAVE ON THE LIST.

AND THEN AS WE CHOOSE WHATEVER HOMES OR WHATEVER WE ARE GOING TO DO, REPAIRS OR SOMETHING, THAT SPECIFIC PROPERTY.

SO IT WILL BE A THREE-PHRASE DEAL WITHOUT.

>>COMMISSIONER MAREZ: IS THIS THE FUNDING -- I KNOW WE ANNOUNCED A YEAR AGO OR MAYBE MORE, WE WERE ALLOCATED MONEY FROM THE STATE. WAS THIS TIED INTO THAT.

IS THAT SAME FUNDING? >> YES, SIR.

>>COMMISSIONER MAREZ: WE ARE JUST NOW IT GET TO THE ASSESSMENT ITSELF AND DON'T STAND TO LOSE.

>> FOUR YEARS TO DO THE PROJECT. HOPING TO DO IT QUICKER.

>>COMMISSIONER MAREZ: BUT WE ARE ALLOCATED, WHAT WAS IT, $500,000

-- PER YEAR OR TOTALITY. >> IN TOTALITY FOR THE FOUR-YEAR

RUN. >>COMMISSIONER MAREZ: SORRY, FOR

THE FOUR-YEAR RUN. >> BUT IF WE SPEND THE MONEY AS QUICKLY AS WE CAN, WE CAN ASK FOR MORAL OCCASION.

[00:45:03]

IF WE SPEND ALL OF IT IN TWO YEARS, WE CAN ASK FOR AN ADDITIONAL $1 MILLION IS WHAT THE NEXT LEVEL WILL BE.

>>JUDGE SCOTT: THIS IS A REQUIREMENT OF THE GRANT TO HAVE

THIS STUDY DONE? >> YES.

>>COMMISSIONER MAREZ: LET'S GET SPENDING.

I WOULD LOVE TO SPEND MORE. I AM NAHFUL THAT WE GOT THIS FUNDING OPPORTUNITY F FOR COLONIAS.

IF PEOPLE IN THE COMMUNITY SAY WE DON'T PUT EMPHASIS ON THE CONLONIAS. WE HAVE.

WE FOUGHT TO GET THIS DESIGNATION TWO YEARS AGO.

AND WELCOME THANK YOU FOR PUSHING THIS.

WE HAVE FUNDING A~ AVAILABLE. AND YOU MENTIONED BEFORE IN

COURT OVER A TOOL -- >> LENDING LIBRARY.

>>COMMISSIONER MAREZ: LENDING LIBRARY WITH TOOLS.

IS THAT PART OF THAT? >> THIS IS PART OF THAT.

I HOOKED UP WITH HABITAT FOR HUR HURANITY. PERFECT BLEND WITH THIS PROJECT AND WE WILL BE GETTING TOGETHER AND DISCUSSING MORE OF THE ISSUES. LENDING LIBRARY.

TEACHING LIBRARY. AGREED TO USE THEIR CLASSROOMS AND EQUIPMENT TO ALLOW US TO -- TO USE -- USE THOSE CLASSROOMS TO TEACH PEOPLE HOW TO FIX THEIR HOMES.

>>COMMISSIONER MAREZ: GREAT TO HEAR.

>>COMMISSIONER HERNANDEZ: ANYBODY IN MIND THAT ARE RUN THE TOOL SHED. WHEREVER THE TOOLS WILL BE KEPT.

>> WE PUT IT OUT. WE HAVEN'T RECEIVED ANY PEOPLE WHO WOULD WANT TO BE OUR MANAGER AND MAY END UP BEING A HYBRID AS WE DISCUSSED COMMISSIONER WHERE THE COUNTY DOES A PORTION OF IT AND THE HABITAT FOR HURANITY OR THIS OTHER GROUP OR WHATEVER GROUP THAT WE GET A PORTION OF IT, THE TRAINS AND THE

MANAGEMENT OF THE GRANT. >>COMMISSIONER HERNANDEZ: HOW IS IT GOING TO BE DONE TO GET THE WORD OUT TO THE PUBLIC AND T THE COLONIAS THAT WILL BE COMING FOR THEM?

>> THAT WILL BE PART OF THE NEXT PHASE WITH THE ENVIRONMENTAL STUDY ON. THE MANAGEMENT GROUP.

THE MANAGEMENT GROUP WILL HELP US PUT THE WORD OUT, BUT THE

WORD IS GETTING OUT. >>COMMISSIONER HERNANDEZ: OKAY,

THANK YOU. >>COMMISSIONER MAREZ: SO WITH THIS -- WITH THIS STEP, THEN THE STATE -- I GUESS THIS IS FEDERAL FUNDING THAT IS SENT TO THE STATE, AND THEN THE STATE TO US IT. THAT IS THE PATTERN.

>> YES, SIR. >>COMMISSIONER MAREZ: SO THIS IS -- THIS IS SIMILAR TO WHAT IS BEING DONE IN THE OTHER SEVEN COLONIAS SELF-HELP CENTERS IN THE STATE, OR ARE THEY MORE

ADVANCED? >> THEY ARE MORE ADVANCED BECAUSE THEY HAVE BEEN AROUND LONGER AND HYBRID SYSTEMS. DISCUSSED -- CERTAIN COUNTIES THAT FUND THE WHOLE THING THROUGH A PRIVATE CONTRACTOR OR PRIVATE GROUPS.

THERE ARE SOME THAT COMPLETELY DO IT INTRINSICALLY THROUGH THEIR OWN OPERATIONS AND SOME THAT DO A HYBRID.

PORTION OF IT GOES TO A GROUP AND PORTION TO COUNTY MANAGERS.

SO TO HE WAS ARE THE DIFFERENT MODELS THAT ARE BEING USED RIGHT

NOW. >>COMMISSIONER MAREZ: I HAVE A FEW OTHER QUESTIONS. TIED IN BUT NOT EXACTLY RELATED

[1. Discuss and consider the following related to the County depository and the County and District Clerk Court Registry Funds: a. Qualification of Frost National Bank as depository for the County and the County and District Clerk Court Registry Funds b. Resolutions/Orders designating Frost National Bank as depository for the County and the County and District Clerk Registry Funds c. Resolutions designating signatories pursuant to proposed security agreement(s) with Frost National Bank]

TO THIS. WE CAN TIE IN AFTER THE MEETING.

MOTION TO APPROVE, JUDGE. >>COMMISSIONER GONZALEZ: SECOND.

>>JUDGE SCOTT: WE HAVE A MOTION AND A SECOND TO APPROVE S.

THE SELECTION OF ICE

[2. Discuss and consider approval for Nueces County to extend the deadline for outstanding invoices for Brooks County until July 31st, 2023.]

[00:50:12]

DIFFICULTIES] >> THEY HAVE RUN OUT OF MONEY ACCORDING THEIR AUDITOR'S OFFICE.

THEY HAVE RUN OUT OF MONEY TO PAY FOR --

>>JUDGE SCOTT: RATES CHANGED IN THE MIDDLE OF THE YEAR AFTER

BUDGET PROCESS? >> WE DID.

>>JUDGE SCOTT: I WANT THE PEOPLE TO UNDERSTAND.

>>COMMISSIONER CHESNEY: DID THEY RUN OUT OF MONEY BECAUSE OF OUR RATES ARE CHANGING OR THEY RUN OUT OF MONEY --

>> THEY HAVEN'T ADVISED US THAT THEY RUN OUT OF MONEY BECAUSE OUR RATES HAVE CHANGED. THEY ADVISED US THEY ARE RUN OUT OF MONEY AND TRYING MOVE MONEY AROUND.

WE ARE DOING FULL AUTOPSIES AND THEY COST SIGNIFICANTLY MORE THAN THE REGULAR AUTOPSIES FORMED IN THE PAST WHICH WERE

EXTERNAL EXAMS IN MANY CASES. >>JUDGE SCOTT: SORRY FOR

INTERRUPTING. >> THAT'S OKAY, JUDGE.

THEY HAVE ASKED THAT WE EXTEND AUTOPSY SERVICES TO THEM.

WE HAVE DONE SIX AUTOPSIES. AND A TOTAL OF $25,000 WORTH OF INVOICES THAT ARE OUTSTANDING. SO THEY ASKED TO CONTINUE TO TAKE THEIR CASES SHOULD THEY HAVE THEM AND WE ALLOW THEM TO HAVE A LITTLE BIT MORE OPPORTUNITY TO PAY THAT UNTIL

THE END OF THE MONTH. >>JUDGE SCOTT: AND --

>>COMMISSIONER CHESNEY: WHAT DOES THAT MEAN? THEY WILL PAY US $500 AT THE END OF THE MONTH? PAY OFF THE BILL AT THE END OF THE MONTH?

>> THEY HAVE TOLD US THAT THEY WILL PAY THE OUTSTANDING INVOICES BY MID-MONTH OR THE END OF THE MONTH.

>>COMMISSIONER CHESNEY: THE $25,000 WILL BE PAID BY

MID-MONTH WHICH IS NOW -- >> SORRY, COMMISSIONER, LET ME CORRECT MYSELF. WE HAVE TWO OUTSTANDING INVOICES THAT EXCEEDED THE TIME PERIOD. WE HAVE ADDITIONAL INVOICES THAT HAVE BEEN SENT TO THEM THAT HAVE NOT EXCI EXCEEDED THAT 30-DAY W AND OTHER AUTOPSY SERVICES THAT WE PROVIDE.

ALL TOGETHER, ALL COMBINE AND TOTAL $25,000 WORTH OF SERVICES, BUT WE HAVEN'T -- THEY ARE ONLY TALKING ABOUT --

>>JUDGE SCOTT: WHAT IS THE OUTSTANDING AMOUNT THAT IS OVER

30 DAYS? >> I BELIEVE IT IS -- LET ME SEE REAL QUICK. STAND BY.

I KNOW IT IS IN EXCESS OF $7,000 RIGHT NOW.

YEAH, $7290. THAT HAVE EXCEEDED THE 30-DAY

WINDOW. >>COMMISSIONER CHESNEY: I GOT TO SAY, I AM A LITTLE CONCERNED THAT A COUNTY PAY $7,000.

I KNOW IT IS NOT A BIG COUNTY, BUT MAKES ME A LITTLE NERVOUS NOW WE HAVE $25,000 OUT TO THEM SO, I MEAN, I DON'T KNOW -- SO THEY WANT -- THEY WANT TO KEEP SENDING US STUFF.

HOW ARE THEY GOING TO CATCH UP IF PETITION? CAN'T PAY $7,000 AND THEY OWE US $25,000 AND WANT TO GET MORE? I WOULD THINK WE WOULD NEED TO GET ALL $25,000 ON A PAYMENT PLAN BEFORE WE ACCEPT ANYTHING ELSE MORE FROM THEM.

BECAUSE IF YOU CAN'T WAY $7,000, HOW ARE THEY GOING TO PAY

$25,000. >> CORRECT, COMMISSIONERS.

THAT IS ONE OF THE THINGS. WE CERTAINLY WANT YOUR INPUT ON AND DISCRETION ON WHETHER OR NOT WE WOULD INVOKE THE CLAUSE IN OUR INTERLOCAL AGREEMENT THAT WILL SUSPEND FUTURE CASES UNTIL THEY PAY THEIR OUTSTANDING INVOICES.

>>COMMISSIONER CHESNEY: SO -- AND THEN -- THE TWO ARE OVER 30 DAYS AND THE OTHER ONES ARE WHAT?

>> HE ANOTHER TWO WHICH HAVE NOT REACHED THAT TIME FRAME.

AND WE HAVE TWO MORE YET TO BILL.

>>COMMISSIONER CHESNEY: THEY WILL PROBABLY COME BACK AND ASK

FOR AN EXTENSION ON THAT TOO? >> I DON'T HAVE ANY INFORMATION

ON THAT. >>COMMISSIONER CHESNEY: WE NEED TO COME UP WITH SOME PLAN THAT DOESN'T JUST DEAL WITH THESE TWO BUT ON SOME THINGS GOING FORWARD SO YOU DON'T HAVE TO WASTE YOUR TIME COMING OVER. THAT IS THE LAST THING TO PULL DR. FAGAN AWAY FROM AUTOPSIES TO TALK TO US ABOUT $7,000.

THAT IS NOT A GOOD WAY TO SPEND OUR TIME -- OR THEIR TIME.

>>COMMISSIONER GONZALEZ: DO IT ACROSS THE BOARD ALL THE TIME,

SOMETHING -- >>JUDGE SCOTT: ANY POLICY WE HAVE IN PLACE, JENNY, ANYTHING WE DO?

>>COMMISSIONER CHESNEY: HE TOLD US WHAT THEY HAVE IN PLACE.

HE IS ASKING US TO SUSPEND IT. I DON'T WANT TO START THE PRECEDENT OF SUSPENDING WHAT WE HAVE IN PLACE IF PEOPLE CAN'T PAY THEIR BILLS. I -- NO OFFENSE, I AM NOT CONCERNED OF BROOKS COUNTY. THAT IS NOT WHO I REPRESENT.

I DON'T KNOW WHY WE WOULD BE MAKING EXCEPTIONS FOR A COUNTY THAT IS NOT IN NUECES THAT WE ARE JUST DOING OUT OF COURTESY.

>>JUDGE SCOTT: MUCH LESS DOUBLE THE WHAMMY LIKE I SAID WHEN IT

[00:55:02]

WAS BROUGHT TO MY ATTENTION BECAUSE THEN WE ARE PAYING OUR MEDICAL EXAMINERS TO DO THESE, AND THEY GET THEIR PERCENTAGE.

AND -- >> THEY DON'T GET THEIR

PERCENTAGE UNTIL WE COLLECT. >>JUDGE SCOTT: BUT THEY ARE GOING TO ASK US FOR IT AND THAT IS WHAT I ASKED FOR IF YOU ARE COMING FORWARD TO THIS, I NEEDED IN WRITING WHAT YOUR REQUEST SO YOU ARE WILLING TO GAMBLE ON YOUR 40% AS WELL BECAUSE THE COUNTY IS NOT GOING TO PAY FOR THAT IF THEY DEFAULT.

>> THAT'S CORRECT. >> YES, I DO UNDERSTAND THAT IF NUECES COUNTY IS NOT PAID, THEN THE DOCTORS' COMMISSIONS WOULD

NOT BE PAID AS WELL. >>JUDGE SCOTT: I THINK IT IS

STILL -- >>COMMISSIONER CHESNEY: I AM NOT

-- I JUST -- >>COMMISSIONER GONZALEZ:

PERCENTAGE THING. >>COMMISSIONER CHESNEY: I AM SORRY. I JUST -- WE GOT TO THINK OF NUECES COUNTY FIRST. AND THIS IS TAKING MAN AND WOMAN POWER AWAY FROM NUECES COUNTY TO DO THESE THINGS THAT WE ARE NOT GETTING PAID FOR TIMELY. SO, YOU KNOW, THAT MIGHT BE TIME YOU AND YOUR DOCTORS WILL SPEND ON OTHER AUTOPSIES.

I KNOW YOU PRIORITIZE NUECES COUNTY, BUT, STILL, IT IS TAKING TIME AWAY FROM COUNTIES THAT PAY.

TAKING TIME AWAY FROM OTHERS. I GET WE ARE ALL IN A TIGHT SPOT, BUT NO ONE IS IN A TIGHTER SPOT THAN NUECES COUNTY IS.

OUR BUDGET IS GOING TO BE THE WORSE EVER UNLESS SOME MIRACLE HAPPENS. I AM NOT REALLY IN A WAIVING MOOD KNOWING WHAT WE COULD BE FACING HERE IN NUECES COUNTY.

I DON'T KNOW HOW WE CAN DO THAT. >> I AM TOLD BY THE END OF THIS MONTH, BROOKS COUNTY WILL BE ABLE TO AT LEAST SAY WHAT KIND OF PAYMENT PLAN THEY CAN PUT IN PLACE.

IF YOU WANT TO MOVE THAT TO THE 26TH OR --

>>COMMISSIONER CHESNEY: YEAH, I DON'T THINK WE SHOULD WAIVE ANYTHING UNTIL WE KNOW WHEN THEY ARE GOING TO PAY US.

I DON'T THINK WE OUGHT TO BE ACCEPTING ANY MORE CASES FROM BROOKS COUNTY UNTIL WE ARE PAID OR HAVE A PAYMENT PLAN THAT WE KNOW WILL HAPPEN AGAIN ALL FOR HELPING OUR FELLOW COUNTY, BUT IT IS NUECES -- WE GOT TO CONSIDER WHAT WE ARE FIXING TO COME INTO AS WELL. WE CAN'T -- WE CAN'T BE WAIVING STUFF WITH THE BUDGET WE ARE LOOKING AT.

PEOPLE HAVE TO UNDERSTAND THAT. WE ARE JUST IN A VERY TOUGH SPOT

HERE. >>JUDGE SCOTT: DO YOU WANT TO MAKE A MOTION IF THEY COME TO YOU WITH A PAYMENT PLAN TO BRING IT BACK ON THE 26TH MEETING? OR NOT EVEN --

>>COMMISSIONER CHESNEY: I AM JUST SAYING ME PERSONALLY.

THE REST OF THE VOTE CAN OUTVOTE ME.

I AM NOT INTERESTED IN WAIVING GUYS RIGHT NOW OR EVER.

BECAUSE THEN HOW MANY OTHER COUNTIES ARE GOING TO ASK WHEN THEY GET BEHIND AND THEY CAN'T MOVE THEIR MONEY AROUND AND START WITH THIS PATH -- WAIVE FOR BROOKS COUNTY -- HOW MANY

COUNTIES DO WE SERVE? >> CURRENTLY SIX OR SEVEN.

>>COMMISSIONER CHESNEY: CAN'T SAY WE WILL DO IT FOR BROOKS AND NOT THE OTHER SIX OR SEVEN WHO MIGHT BE IN THE SAME SPOT.

I AM NOD INTERESTED IN DOING IT NOW OR THE NEXT MEETING.

SO IF THE REST OF THE COURT DOES, I AM JUST OKAY WITH BEING OUTVOTED. IT IS FINE.

I DON'T THINK IT IS GOOD PRECEDENT.

>>COMMISSIONER MAREZ: I GUESS MY CONCERN IS THE BREAKDOWN OF HOW MUCH MONEY AS FAR AS THE FUNDING THAT COMES IN GOES TO THE COUNTY AND GOES TO THE DOCTOR. I DON'T WANT US TO MISS OUT ON THIS OPPORTUNITY TO ASSIST OUR GENERAL FUND.

NEW PLAYERS IN THE GAME THAT HAVE NOT BEEN -- I DON'T WANT TO CALL IT A GAME, BUT IN THE INDUSTRY AND THE WORK THAT YOU DO, DOCTOR, THAT WEREN'T THERE BEFORE.

THERE WERE STEPS THAT WERE HIGHER THAT CERTAIN COUNTIES TOOK TO HIRE OUR FORMER ME. LET'S BE AWARE OF THAT.

MANY OF US ARE NOT AWARE THAT I JUST CAME ACROSS THAT INFORMATION IN CONVERSATION WITH SOMEONE OUT OF CLAYBURG COUNTY A MONTH AGO. I WAS NOT AWARE.

SO IT -- THE COURT MAY HAVE TO DECIDE AT ONE POINT MORE HASSLE THAN IT IS WORTH. BUT LET US REALIZE AS WELL, IF WE SAY NO AND REJECT THIS, THEN WHERE WE ARE ABLE TO KIND OF MAKE UP FOR SOME OF THOSE LOSSES THAT WE CAN'T RECOUP BASED ON OUR INABILITY TO FUND. AND WHERE WE ARE USING THESE OTHER COUNTIES TO KINDS OF SUPPLEMENT THAT, WE WILL LOSE OUT. POTENTIALLY LOSE OUT TO OTHER COUNTIES IN OUR AREA. IT USED TO BE JUST THE VALLEY OR MAYBE SAN ANTONIO POINTS NORTH. AND THEN IT WAS ONLY US.

NOW WE HAVE ANOTHER -- YOU KNOW, ANOTHER GROUP IN PLAY.

AND THAT IS MY CONCERN WHEN WE LOOK AT THIS.

I AGREE BY PRINCIPLE, YES, AT SOME POINT WE CAN'T JUST SAY, LET'S WAIT OR LET'S TAKE WHAT WE CAN GET, BUT KNOW THAT THESE COMMITMENTS THAT WE HAVE WITH THESE -- WITH THESE OTHER COUNTIES, WE COULD LOSE THEM EVENTUALLY AND COULD HAVE AN IMPACT ON YOUR BOTTOM LINE. ON YOUR BUDGETING.

ON ALL THE SERVICES YOU PROVIDE. >> YES, SIR.

THAT IS ONE OF THE GREAT DANGERS IF YOU CUT THE COUNTY OFF, YOU WILL FIND ANOTHER HOME AND THEY MAY NOT COME BACK.

SO THAT IS MY CONCERN WITH JUST -- IF THAT IS THE DECISION OF

[01:00:02]

THE COURT TO SUSPEND TAKING IN NEW CASES, WE WILL DO THAT.

I MEAN, BUT -- I WOULD JUST LIKE TO EMPHASIZE THAT MOST LIKELY BROOKS COUNTY WOULD SET UP A NEW ARRANGEMENT WITH SOMEONE ELSE

WHO IS LOCAL. >>COMMISSIONER CHESNEY: OKAY.

>> WILL LOSE THAT MONEY TOWARD OUR GENERAL FUND WHICH I AM TRYING TO KEEP THAT REVENUE COMING TO THE COUNTY BECAUSE --

>>COMMISSIONER GONZALEZ: THE PROBLEM FOR SOMEBODY ELSE BECAUSE -- AT ONE POINT, WE GOT TO -- WE GOT TO -- A YES OR NO.

AND I AM NOT -- WE ARE NOT -- EITHER YOU DO IT OR YOU DON'T DO IT, YOU KNOW. WE HAVE BEEN HERE LOTS OF TIME.

THEY NEED TO DO THE THING. >>JUDGE SCOTT: I THINK GIVEN THE COUNTY'S SITUATION RIGHT NOW IS A VERY DIFFICULT TIME TO BE EXTENDING ANYTHING. AS MUCH AS WE LOVE OUR NEIGHBORS AND WE WORK WELL TOGETHER AND WE APPRECIATE THE RELATIONSHIPS WE HAVE LOOKING AT WHAT WE ARE LOOKING AT WITH THE COUNTY, IT IS ALE REALLY A HARD THING TO DISCUSS RIGHT NOW.

>>COMMISSIONER CHESNEY: YEAH, I THINK -- IF MAYBE WANTS TO BRING SOMETHING THAT IS ACROSS THE BOARD FOR ALL COUNTIES OF WE CAN ALL LIVER WITH, I DON'T THINK WE SHOULD BE PIECE MEAL IT.

EITHER HAVE SOME SORT OF ACROSS THE BOARD PROCEDURE.

>>JUDGE SCOTT: CONSISTENT THAT THIS IS A POLICY WE WILL ADHERE TO AND UNDERSTANDING THAT WE ALL GET INTO SITUATIONS, BUT THIS WILL BE THE PLAN AND THIS WILL BE THE DATE IT WILL NO LONGER GO FORWARD. YES.

RIGHT NOW WE JUST -- IS ANYBODY WILLING TO MAKE A MOTION ON THIS? RIGHT NOW GO WITH THE POLICY.

>>COMMISSIONER CHESNEY: PLUS, JUDGE, WE NEED TO LOOK AT THE -- THE -- AN ANALYSIS. WE HAVE TO -- SOMEONE WILL HAVE TO PUT DOWN AN ANALYSIS OF HOW MUCH THIS EXTRA REVENUE THAT WE GET FROM THESE OUTSIDE COUNTIES -- I HATE TO SAY THE WORD "MATTERS ""BUT MATTERS BECAUSE WE GIVE 40% OF IT AWAY TO THE DOCTOR. WE ONLY GET 60% OF IT.

HOW MUCH IS THE REVENUE -- IS IT REALLY WORTH KEEPING.

I KNOW IT IS A LOT BUT ALSO -- >>JUDGE SCOTT: COST, TIME, SERVICES, FACILITIES, EVERYTHING.

>>COMMISSIONER CHESNEY: IS IT PROFITABLE FOR ADDITIONAL REVENUE THAT WE WILL HAVE TO, SURE, CUT BACK, YOU KNOW, AT THE MEDICAL FACILITY TOO, BUT I -- WE NEVER DONE THAT.

WE NEVER REALLY DONE AN ANALYSIS OF -- IF THAT IS REVENUE WE GET FROM THESE EXTRA COUNTIES WORTH GETTING.

I DON'T KNOW. >>JUDGE SCOTT: MIGHT BE SOMETHING THEY COULD BRING BACK TO THE NEXT MEETING.

>>COMMISSIONER CHESNEY: NOT TRYING TO PUT YOU ON THE SPOT.

IS THAT REVENUE WORTH US KEEPING.

IT MAY BE. IT MAY NOT BE.

NOW DOES THAT MEAN WE MAY HAVE LESS PEOPLE AT THE M.E.'S OFFICE. ARE WE ONLY HAVING THOSE EXTRA PEOPLE BECAUSE OF THE REVENUE. I DON'T KNOW.

WE -- WE HAVE BEEN IN SUCH A STATE OF CHAOS UNTIL DR. FAGAN GOT HERE AT THE M.E.'S OFFICE FOR SO LONG, WE DIDN'T SIT DOWN AND HAVE THIS ANALYSIS. THAT IS WHAT WE DO.

I AM OKAY WITH AT ACROSS-THE-BOARD POLICY AND HAS TO BE FOR EVERYBODY. EQUAL AND FAIR SO WE CAN PASS.

SO YOU DON'T HAVE TO COME BACK. IF SOMEONE GOING TO BE LATE, THE COURT'S PAST POLICY, FOR EVERYBODY, IS ONE TIME.

DO THAT ANALYSIS ON HOW MUCH THAT EXTRA MONEY REALLY HELPS THE OFFICE VERSUS THE EXPENSE WE HAVE TO CARRY TO SERVICE THAT

EXTRA MONEY. >> COMMISSIONER, I DO THAT ANALYSIS EVERY MONTH AND I HAVE PREPARED AN ANALYSIS OF HOW MUCH WE MAKE OF THE OUT-OF-COUNTY REVENUES IN COMPARISON TO COMMISSIONS AND OTHER SERVICES WE PROVIDE IN NUECES COUNTY.

>>COMMISSIONER CHESNEY: DOES IT HAVE A PART OF IT THAT SHOWS THE COST TO SERVICE THAT REVENUE OR JUST THE EXTRA REVENUE.

WITHOUT THE COST TO SERVICE THE REVENUE, WE ARE NOT GETTING A

CLEAR LOOK. >> IT DOES NOT INCLUDE THE COST OF THE OPERATING OF THE OFFICE AND THE STAFFING AND THE EQUIPMENT THAT WE USE FOR THAT PURPOSE.

I DO KNOW THAT BROOKS COUNTY LAST YEAR DID 11 AUTOPSIES TO OUR OFFICE. SENT 11 AUTOPSIES FOR US TO DO.

NOT A TREMENDOUS PART OF OUR OUT-OF-COUNTY REVENUE.

JUST A SMALLER PORTION IN COMPARISON TO OTHER COUNTY LIKE ARANSAS SENDS US A LOT MORE. JUST ONE OF THE SMALLER COUNTIES. I HAVE NOT DONE THE ANALYSIS OF THE COST. I CAN WORK ON THAT FOR YOU.

>>COMMISSIONER CHESNEY: ALL I AM ASKING FOR.

>>JUDGE SCOTT: ON THE NEXT AGAIN WITH THE COST ANALYSIS.

>>COMMISSIONER GONZALEZ: REVENUE VERSUS EXPENSE.

>>COMMISSIONER CHESNEY: WE NEED TO REVENUE.

HOW MUCH DOES IT COST TO SERVICE THAT REVENUE.

>> ONE OF THE OTHER QUESTIONS TO SUSPEND TAKING ANY CASES FROM

[01:05:04]

THEM AS WELL WHILE WE ARE WAITING PAYMENT?

>>COMMISSIONER CHESNEY: I THINK WE NEED TO HAVE A --

>>JUDGE SCOTT: YOU SAID THEY WERE SUPPOSED TO BY THE MIDDLE OF THE MONTH TAKE CARE OF THE OUTSTANDING SO THEY WOULDN'T BE OUT. SO I -- I THINK RIGHT NOW WE GO WITH WHAT OUR POLICY SAYS UNLESS WE COME BACK AND CHANGE THE POLICY FOR EVERYONE ACROSS THE BOARD.

YEAH. BUT HOPEFULLY THEY WILL CATCH UP ON THE TWO, AND THEY WON'T BE SUSPENDED IF THEY CATCH UP ON

THE TWO THIS WEEK. >> OKAY, THANK YOU, JUDGE.

>>JUDGE SCOTT: THANK YOU. MOVING ON TO ITEM 3, DISCUSS AND

[3. Discuss and consider taking action in approving the grant-funded contract between the Nueces County Family Drug Treatment Court at County Court at Law #5 and Distinctive Counseling for mental health services related to child welfare cases; and related matters.]

CONSIDER TAKING ACTION IN IMPROVING THE GRANT FUNDED CONTRACT BETWEEN THE NUECES COUNTY DRUG TREATMENT COURT AND COUNTY COURT OF LAW 5. JENNY, YOU PUT THIS ON HERE WITH THE CONTRACT. SAYS THE TOTAL NOT TO EXCEED $4300. RATE FOR HOURS ABOUT $150 AN HO HOUR.

>> YES, THIS IS SOMETHING OUR CPS ATTORNEYS -- NICOLE IS NOT HERE, BUT CAN SPEAK TO MORE DETAIL IF THE COURT IS INTERESTED. THINKABLE IS A GRANT THAT

ALREADY HAS BEEN APPROVED. >> I'M HERE.

>> OKAY, THERE WE GO. >> SORRY.

YES, GOOD MORNING, COMMISSIONERS.

I AM THE COUNTY'S LIAISON TO COUNTY COURT 5.

CPS REMOVALS IN THE COUNTY. DRUG COURT IS A VERY IMPORTANT PART OF THAT PRACTICE AND PROING.

WE ARE ASKING TO FOR AN APPROVAL OF $4300 CONTRACT.

THIS IS ALREADY BEEN PAID FOR THROUGH A GRANT THAT WE RECEIVED FROM THE OFFICE OF THE GOVERNOR CRIMINAL JUSTICE DIVISION FOR SPECIALTY COURTS AROUND THE STATE.

WE WERE HAPPY TO RECEIVE THIS GRANT EARLIER IN THE FISCAL YEAR. SOMETHING THAT THE COMMISSIONERS COURT ALREADY VOTED ON AND UNANIMOUSLY APPROVED.

WHAT NEEDED TO HAPPEN IS, WE NEEDED TO COME BACK, BECAUSE THIS IS A PAYMENT FOR SERVICES. WITH THIS CONTRACT FOR YOUR APPROVAL; HOWEVER, IF THE -- THIS MONEY ISN'T SPENT OUT OF THE GRANT, WE DO LOSE THIS MONEY.

IT DOESN'T COST THE COUNTY ANY ADDITIONAL FUNDS.

WE PROVIDED A COUPLE OF THE CONTRACT.

AND IN IT THE TERMS SECTION. AND WE HAVE THE EXECUTED AMENDED DOCUMENT FOR YOUR APPROVAL. AND WE WILL ASK THAT IT BE

APPROVED SUBJECT TO THAT. >> SO MOVED.

>> SECOND. >> A MOTION AND A SECOND TO APPROVE AS AMENDED. ALL IN FAVOR, SAY AYE, SAY AYE.

ANY OPPOSED, SAME SIGN. >>COMMISSIONER GONZALEZ: WE

TABLE IT. >>JUDGE SCOTT: THAT IS WHAT WE WERE TALKING ABOUT. I THOUGHT THEY WERE COMING BACK ON THE 26TH. DIDN'T DO ANY ACTION.

ASKED THEM TO COME BACK AND STAY WITH THE SAME POLICY.

SORRY. THE MOTION PASSES, THANK YOU.

[4. Discuss and consider authorizing County Judge to execute agreement, if necessary, with legislative consultants, Joel Romo and Patricia Shipton, for temporary services for any Special Session(s) called by the Governor that relate to Nueces County business.]

MOVING ON TO ITEM NUMBER 4. MY ITEM.

GIVEN THE SITUATION WE ARE IN AND THE SPECIAL SESSIONS THAT THE GOVERNOR HAS CALLED AND IN ANTICIPATION OF MORE SPECIAL SESSIONS BEING CALLED, I AM ASKING FOR YOU TO ALLOW ME TO EXECUTE AN AGREEMENT IF NECESSARY WITH OUR LEGISLATIVE CONSULTANT JOE ROMO AND PATRICIA SHIPTON.

THIS AS YOUR PREVIOUSLY AGREED-UPON TERMS OR LESS CONTRACTUALLY BUT NO MORE THAN 2400 EACH HAVE BEEN DONE IN THE PAST. BUT WITH THE SESSIONS BEING CALLED AND GIVEN THE SITUATION WHERE MR. KUSNICK WAS TRYING TO GET A BRACKET OUT AND HELP WITH OUR CURRENT SITUATION WITH THE APPRAISALS AND THE PROBLEMS IT WAS CAUSING FOR THE COUNTY.

I WAS IN CONSTANT COMMUNICATION WITH THEM.

THEY HAVE WALKED TO EVERY PAPERS AND LETTERS AND HAVE DONE THINGS. I WOULD ASK THE COURT TO GIVE ME THAT DISCRETIONARY POWER IF ANOTHER ITEM COMES UP THAT IS IMPACTING THE COUNTY WHERE WE HAVE AUTHORITY TO USE THEM.

>>COMMISSIONER MAREZ: JUDGE, WAS THIS DONE -- WERE THEY IN CONTRACT WHEN THEY WERE ASKED TO DO THIS?

>>JUDGE SCOTT: NO, THEY ARE NOT. THEY DID IT ON THEIR OWN AS A HELP TO THE COUNTY AND THAT IS WHY I PUT THIS ON THE CALENDAR.

THEY WERE A TREMENDOUS HELP TO THE COUNTY EVEN THOUGH IT HAVEN'T GOTTEN IN YET. THERE IS STILL A POSSIBILITY, I HEAR, YESTERDAY THAT IT MIGHT GET IN, BUT THEY WALKED ALL OVER THE COURTHOUSE. THEY TALKED TO PEOPLE.

DELIVERED LETTERS. HELPED ME WRITE THE LETTER AT

[01:10:03]

HOME ON THE WEEKEND. SEND IT.

I CAN'T SEE ENOUGH GREAT THINGS ABOUT THE BOTH OF THEM.

ONLY IF NECESSARY. ONLY IF IT IMPACTS THE COUNTY,

BUT I WOULD ASK FOR APPROVAL. >>COMMISSIONER MAREZ: I AGREE WITH BEING CAREFUL WITH MONEY. BUT A STRANGE SESSION.

THE SPECIAL MINI SESSIONS OR WHATEVER YOU WANT TO CALL THEM HAVE BEEN CALLED QUICKLY WITH LITTLE TO NO IN ITS AND POP UP AND AND IN SOME CASES, YOU KNOW, THE HOUSE HAS GONE AND DONE THEIR WORK WITHIN HOURS AND GONE HOME WHERE THE SENATE MAYBE HAVE BEEN FORCE TO STAY LONGER. AND OVERALL, THE GRAND SCHEME OF THINGS DO WE HAVE EVERYTHING. NUECES COUNTY SPECIFIC IN SOME OF THOSE SESSIONS, PROBABLY NOT. THIS WAS A PRIME EXAMPLE OF WHAT IT MEANS TO HAVE OUR LEGISLATIVE TEAM THERE WORKING FOR US.

I AM THANKFUL THAT MR. ROMO AND MISS SHIPTON ARE TEAM PLAYERS AND DONE IT IN SPITE OF NOT BEING PAID.

THE AMOUNT OF WORK AND QUALITY OF WORK THEY PROVIDE FOR NUECES COUNTY HAS PROVEN ITSELF TIME AND TIME AGAIN.

I GET THAT WE SAY LET'S HOLD OFF, BUT A GREAT EXAMPLE OF WHY WE SHOULDN'T HAVE. AND ONLY BECAUSE THEY ARE TEAM PLAYERS DID THEY DO THAT FOR US. BECAUSE THEY COULD HAVE EASILY SAID, JUDGE, I AM TOO BUSY. JUDGE, WE CAN'T DO IT BECAUSE WE ARE NOT UNDER CONTRACT, BUT THEY DID IT ANYWAY.

MAYBE A WAY TO SAVE EVERY BIT THAT WE CAN.

BUT, LIKE YOU MENTIONED AS WELL, MR. KUSHNICK GOING TO AUSTIN.

THAT WAS A TREMENDOUS TASK. I -- YOU KNOW THAT WAS A HAIL MARY THAT COMMISSIONER CHESNEY MENTIONED.

ONCE AGAIN, WE DIDN'T HAVE A LEGISLATIVE TEAM THAT WAS UNDER CONTRACT FOR US. SO I MEAN, I SUPPORT THIS, BUT GOING BACK TO THAT DISCUSSION THAT WE HAD A MONTH OR TWO AGO GOING INTO THE SUMMER THAT SOMETIMES IT IS WORTH KEEPING THEM ON BOARD ESPECIALLY AS WE HAVE SEEN ARE THESE SESSIONS COME AND GO. AND I AM SURE WE MAY HAVE ANOTHER ONE. THIS IS A REMINDER FOR US.

>>JUDGE SCOTT: LIKE YOU SAID WHILE THE GOVERNOR MAY PUT AN ITEM ON A SPECIAL AGENDA, DURING THAT THINGS GET ATTACHED, AMENDED AND THINGS THAT CAN IMPACT THE COUNTY THAT WE HAVE

TO BE AWARE OF. >>COMMISSIONER CHESNEY: I APPRECIATE YOUR APPROACH BE DIFFERENT.

BECAUSE THE LAST TIME IT WAS PUT ON ASKED TO DO IT FOR SIX MONTHS AND LENGTHY PERIOD OF TIME. THAT WAS THE OBJECTION I HAD.

I DON'T THINK KEEPING THEM ON FOR SIX EXTRA MONTHS DURING THE INTERIM WAS IN HE IS, AND I STILL DON'T.

THIS IS AN APPROPRIATE APPROACH BECAUSE GIVES YOU THE DISCRETION ON A MONTH BY MONTH BASIS. YOU CAN SAY I NEED THEM FOR A MONTH, A WEEK, OR TWO WEEKS OR WHATEVER.

AND THING THAT IS A LOT DIFFERENT APPROACH.

I AM SUPPORTIVE OF THAT. I TOTALLY AGREE WITH WHAT JOHN SAID WITH THE COMMENTS THAT WE MADE.

I SUGGEST THAT THEY PAY HIM A SUPPLEMENT.

FOR WHATEVER -- UP TO THAT AMOUNT THAT YOU JUST SAID FOR THE WORK THAT THEY HAVE DONE, BECAUSE I CERTAINLY DON'T WANT THEM TO DO ANYTHING FOR FREE. SO WHATEVER YOU THINK IS APPROPRIATE FOR THE TIME THAT THEY SPENT DOING THOSE THINGS.

YOU KNOW, WITHIN THAT $2500. I WOULD -- NOT ONLY WILL I SUPPORT YOUR PROPOSAL, BUT OFFER AN AMENDMENT TO SAY THAT THEY BE PAID FOR THE WORK DONE AT -- IN THE SCOPE OF THIS UP TO $2500 THAT YOU FEEL IS APPROPRIATE BECAUSE I DON'T -- I DIDN'T -- I DIDN'T THINK THERE WOULD BE ANYTHING FOR THEM TO DO IN A SPECIAL SESSION ON COMPRESSED TAX RATE OF THE SCHOOL DISTRICT.

KEVIN TRIED TO PULL A HAIL MARY AND DO SOMETHING AND NEEDED FOR STUFF SPECIFIC TO NUECES COUNTY THAT WE DIDN'T KNOW ABOUT.

I WOULD OFFER AN AMENDMENT AND THE AMOUNT IN JULY PAYING FOR

THAT AS WELL UP TO THE $2500. >>JUDGE SCOTT: ARE YOU MAKING

THAT A MOTION. >> SECOND.

>>JUDGE SCOTT: WE HAVE A MOTION AND A SECOND.

>>COMMISSIONER CHESNEY: LET ME MAKE THAT AGAIN.

THAT WAS NOT VERY WELL STATED AND DOESN'T ASK ME VERY OFTEN AND I KNOW IT IS A BAD MOTION. MAKE THE MOTION, FIRST OF ALL, TO AMEND -- WELL, I WILL MAKE THE MOTION TO ALLOW THE COUNTY JUDGE TO EXECUTE AGREEMENT, IF IN NECESSARY, WITH LEGISLATIVE CONSULTNESS JOEL ROMO AND PATRICIA SHIPTON UP TO $2500 A MONTH PER PERSON IN ADDITION TO. THAT MOTION WILL INCLUDE PAYMENT WITHIN THOSE CONFINES AT THE JUDGE'S DISCRETION AT THE WORK DONE IN PRESIDENT MONTH OF JULY OF JUNE.

[01:15:04]

>>JUDGE SCOTT: MONTH OF JULY. TERESA IS WANTING TO SAY SOMETHING TO THE COURT ONCE YOU ARE FINISHED.

WE HAVE A MOTION -- ARE YOU STILL SECONDING IT.

COMMISSIONER HERNANDEZ. TER TREE IS A WOULD LIKE TO

TALK. >> I WOULDNESS TO CLARIFY, COMMISSIONER. THE CONTRACT EXPIRED JUNE 15.

ARE WE ACTUALLY GOING TO MAKE IT -- WE ARE GOING TO MAKE IT EFFECTIVE THE END OF THAT -- THE END OF THAT CONTRACT? WHERE WE ARE ALLOWING THE RATE TO $2500 OR STAYING AT THE $5,000 NUMBER AND EXTEND IT FOR THREE MONTHS?

>>COMMISSIONER CHESNEY: NONE OF THAT.

>> NONE OF THAT? OKAY.

[LAUGHTER] >>JUDGE SCOTT: I WILL TALK TO

YOU, TERESA. >>COMMISSIONER CHESNEY: NONE OF THAT. JUNE 15 ON, UNDER THIS MOTION, THE JUDGE WILL HAVE THE DISCRETION TO PAY FOR THE WORK PERFORMED AT A RATE OF $2500 PER PERSON AND HAS A RIGHT TO, AS NEEDED, WEEK BY WEEK, MONTH BY MONTH, WHATEVER THE CASE MAY BE

BE. >> OKAY, ALL RIGHT.

>>COMMISSIONER CHESNEY: NOT EXTENDING THE CONTRACT AT THIS

POINT. >> ALL RIGHT, THANK YOU.

>>COMMISSIONER CHESNEY: YES, MA'AM.

>> FOR CLARIFICATION FROM OUR OFFICE.

WITHOUT THE CONTRACT, WHAT IS GOING TO BE -- IS IT -- ARE THEY

GOING TO SUBMIT INVOICES? >>JUDGE SCOTT: I WOULD ASSUME.

>>COMMISSIONER CHESNEY: I THINK THEY MAY HAVE TO SUBMIT AN AS-NEED CONTRACT. WE HAVE APPROVED WHAT -- THERE IS A MOTION ON THE FLOOR TO APPROVE WHAT WE WANT TO DO.

IF YOU NEED TO DO SOMETHING AND GET A CONTRACT FOR THEM AS-NEEDED CONTRACT. THAT IS UP FOR YOU, JENNY, TO TELL US WHAT YOU NEED FOR THAT. YOU ARE PUTTING US ON THE SPOT.

>> I KNOW WE WERE WORKING TO GET A NEW CONTRACT SET UP BECAUSE ONE DID EXPIRE. AND WE CAN LOOK AT THAT WITH THAT IN MIND. SO ONLY -- MAYBE A WORK ORDER.

>>COMMISSIONER CHESNEY: PREPOSITIONED.

I LOOK AT IT AS A PREPOSITIONED CONTRACT, IF WE NEED THEM.

>>JUDGE SCOTT: IF NECESSARY. >>COMMISSIONER CHESNEY:

PREPOSITION CONTRACT. >>JUDGE SCOTT: WE HAVE A MOTION AND A SECOND. ANY OTHER DISCUSSION? ALL IN FAVOR, SAY AYE. AYE.

ANY OPPOSED, SAME SIGN. THE MOTION PASSES.

ITEM NUMBER 5. DISCUSS AND CONSIDER APPROVAL OF JOINT APPLICATION REQUEST FOR EX-EARNINGS AND REQUEST FOR APPROVAL OF DUNE PERMIT. MR. CROSS, YOU ARE UP.

>> CREME. THIS WITH A WAS KIND OF A HYBRID PERMIT APPLICATION. IT WAS DETERMINED THAT THEY DIDN'T NEED A PERMIT TO FILL WETLAND BETWEEN 1,000 FOOT AND 350. THE APPLICANT AND THE APPLICANT'S REPRESENTATIVE ARE HERE.

AND CHRISTINE IS ONLINE. Y'ALL JUMP IN AND CORRECT ME IF I MESS ANYTHING UP. THEY GOT A FEDERAL DETERMINATION THAT HAD THE WETLANDS WEREN'T JURISDICTIONAL THAT GAVE THEM THE AUTHORITY TO FILL THEM. ANYHOW, THEY ARE REQUESTING AN HE EXEMPTION TO FILL THE ONE WETLAND APPROVED BY THE COURT.

COMMENTS FROM THE GAO. DON'T DISTURB ANY DUNES WHICH THE APPLICANT IS NOT DOING. DON'T CAUSE ANY AAINTELLIGENT FLOODING TO PROPERTIES WHICH THEY ARE CLEARLY NOT DOING.

I THINK THIS IS GOOD TO GO. I RECOMMEND Y'ALL APPROVE IT.

>> SECOND. >>JUDGE SCOTT: MOTION AND A SECOND TO APPROVE THIS DUNE PERMIT.

ALL IN FAVOR, SAY AYE. AYE.

THANK YOU VERY MUCH, SIR. MOVING ON TO ITEM NUMBER 6,

[6. Discuss and consider execution of a real estate application with the United States Army Corps of Engineers (USACE) to lease 35.5 acres of property on the north boundary of I.B. Magee Park for a 25-year period at no cost.]

DISCUSS AND CONSIDERING EXECUTION OF A REAL ESTATE APPLICATION WITH THE ARMY CORP OF ENGINEERS.

THAT IS YOU AGAIN. >> YES, MA'AM, WE HAD THIS LEASE WHERE WE LEASE THIS PROPERTY. I DON'T KNOW IF I HAVE A DIAGRAM IN THERE OR NOT, BUT A SMALL SECTION RIGHT NEXT TO THE JETTY IN PORT ARANSAS THAT I.B. MAGEE PARK OVERLOOKS.

ONE EXECUTED 45 YEARS AGO AND ONE 15 YEARS EXECUTED BEFORE THAT. WE HAVE BEEN LEASING THIS ME OF PROPERTY FROM ARMY CORP OF ENGINEERS FOR 40-PLUS YEARS.

WE DON'T HAVE ANY PLANNED CONSTRUCTION DEVELOPMENT ON IT, BUT WE MAINTAIN IT BECAUSE THE ACCESS TO THE JETTY FROM THE BEACH, ESPECIALLY IN THE FALL FOR THE FISHER HEMEN IS A REALLY HOT ITEM. SO, ANYHOW, WITH THE FUTURE EXPANSION ON I.B. MAGEE PARK. DON'T HAVE PLANS TO BUILD ON THIS PROPERTY. IF I WAS TO DO SO SPECIAL APPROVALS TO THE ARMY CORP OF ENGINEERS.

A BOILERPLATE NO-COST LEASE FROM THEM.

I RECOMMEND APPROVAL. >>COMMISSIONER CHESNEY: THIS ISN'T THE PROPERTY YOU AND I DISCUSSED PRIOR TO THAT WE OWN

-- >> OH, NO, THAT IS NOT THAT PROPERTY. THAT IS SOUTH.

>>COMMISSIONER CHESNEY: JUDGE, MOTION TO APPROVE.

[01:20:01]

>>COMMISSIONER HERNANDEZ: SECOND.

>>JUDGE SCOTT: A MOTION TO APPROVE BY COMMISSIONER CHESNEY.

A SECOND BY COMMISSIONER HERNANDEZ.

ANY OTHER DISCUSSION? ALL IN FAVOR, SAY AYE.

AYE. THE MOTION PASSES.

THANK YOU VERY MUCH. ITEM NUMBER 7 DISCUSS AND CONSIDER THE RAM IF I FACES OF THE UPCOMING 2023-2024 BUDGET AND COMMISSIONER CHESNEY, I KNOW YOU PUT THIS ON HERE.

I ALSO HAVE BEEN ASKED IF WE CAN PULL THIS TO REQUEST SOME QUESTION FROM OUR ATTORNEY IN THE BACK AND OUR FINANCIAL ADVISOR FOR EXECUTIVE. CAN WE PULL THIS AND HOLD ON TO THE END -- MOVE THIS UNTIL AFTER EXECUTIVE TO ADDRESS THIS?

>>COMMISSIONER CHESNEY: YOU ARE THE JUDGE.

>>JUDGE SCOTT: WE HAVE THE RIGHT TO DO THAT, JENNY?

>> YES. I THINK PULLING IT LATER WILL GET A MEETING OUT OF PLACE -- OUT -- OUT OF THE WAY.

>>JUDGE SCOTT: BRING IT BACK OUT AND I KNOW WE WANT TO TALK ABOUT IT, BUT WE HAVE A COUPLE OF QUESTIONS THAT ARE NEEDED TO BE ADDRESSED BEFORE THE DISCUSSION ON THIS, IF POSSIBLE.

>> OKAY. >>JUDGE SCOTT: THANK YOU.

REMIND ME NOT TO FORGET THAT, BUT I PUT A NOTE.

MOVING ON TO ITEM NUMBER 8, DISCUSS AND CONSIDER ALLOWING COUNTY STAFF WITH THE PROCESS OF RENAMING COUNTY ROAD 22 AND 43

TO COUNTY ROAD 51. >>COMMISSIONER CHESNEY: JUDGE, I

WOULD LIKE TO PULL 8 AND -- >>JUDGE SCOTT: NUMBER 14.

>>COMMISSIONER CHESNEY: YES, PLEASE.

THANK YOU. >>JUDGE SCOTT: YOU ARE WELCOME.

LET ME GET MY NOTES. I DON'T WANT TO LEAVE IT OFF.

>>COMMISSIONER MAREZ: THAT WAS 14 ALSO?

[9. Discuss and consider authorizing selection of Ardurra Group, Inc for Engineering Services for Council of Governments-Method of Distribution (COG-MOD RFQ No. 3222-22) for the following projects, Golden Acres drainage and Colonias Septic Tank Study and Rehabilitation; and other related matters. ]

>>COMMISSIONER CHESNEY: YES. >>JUDGE SCOTT: 8 AND 14 MOVING TO EXECUTIVE AS WELL. ITEM NUMBER 9, DISCUSS AND CONSIDER SELECTION OF ARDURRA, INC. FOR ENGINEERING SERVICES FOR COUNCIL OF GOVERNMENTS METHOD OF DISTRIBUTION.

FOR THE COLONIAS. >> THIS IS FOR FOR THE CDBG.

>>JUDGE SCOTT: CDBG AND COMMISSIONER GONZALEZ ITEM

NUMBER 9 ON THE COLONIAS. >>COMMISSIONER GONZALEZ: I DON'T

HAVE ANY QUESTIONS OR ANYTHING. >>JUDGE SCOTT: WE APPROVED ALL OF THE PEOPLE. SO YOU ARE ASSIGNING --

>>COMMISSIONER GONZALEZ: JENNY, CAN YOU MAYBE ASSIST IN

PREPARING A SCOPE OF WORK? >> IF YOU DON'T MIND, MAY I

SPEAK UP A LITTLE BIT. >> YOU ARE THE SECOND JENNY.

>> WE WORK TOGETHER. SO ON THE -- THESE CDBG COGNITIVE COGNITIVE /* - -- COG-MOD WE HAVE IN PLACE.

THE ACTION IS TO SELECT THE I THINK YEAR FOR THIS WORK.

AT THAT POINT THE ENGINEER WILL WORK WITH THE DEPARTMENT TO NEGOTIATE THAT WORK AUTHORIZATION.

AND THAT WORK WILL BE BROUGHT BACK TO THE COURT FOR APPROVAL.

>>COMMISSIONER GONZALEZ: THAT IS GREAT.

>>JUDGE SCOTT: WE HAVE A MOTION. I WILL SECOND THAT MOTION.

ANY OTHER DISCUSSION? ALL THOSE IN FAVOR 13.

>> I KNOW WE MENTIONED WE APPROVED THE ENGINEERING FIRMS. PREAPPROVED THEM. BUT THE BACKGROUND -- I MEAN, WE DON'T HAVE ANY BACKGROUND HERE AND THAT HAS BEEN ASKED FOR.

SO THAT IN THE PREVIOUS DOCUMENT THAT WE APPROVED FOR THIS

SPECIFICS PROJECT. >> THE MASTER SERVICES AGREEMENT WE WENT THROUGH ALL OF THAT AND EXECUTED CONTRACTS WITH EACH OF THOSE ENGINEERS. THE NEXT STEP IN THAT PROCESS IS FOR THE COURT TO COLLECT ENGINEERS AND ARCHITECTS F FOR CDBG, MINT MOD AND ARPA CASES.

IN EACH OF THOSE CASES ONCE THE COURT SELECTS.

THIS ACTION DOESN'T HAVE BACKGROUND OTHER THAN WHAT THE COURT WANTS TO PROVIDE IN SUPPORT OF YOUR RECOMMENDATION.

>> SO IT IS JUST SELECTING THEM TO MOVE FORWARD, BUT THE SCOPE OF WORK, WE DON'T KNOW WHAT THAT IS NECESSARILY.

>> NOT AT IN POINT. AT THE POINT OF THE WORK

AUTHORIZATION COMING BACK. >> COMMISSIONER, IF YOU REMEMBER, THESE ARE THE PROJECTS THAT WE SUBMITTED THAT THE COURT APPROVED. DO HAVE SCOPE OF WORK IN HERE.

JUST DEFINE IT AND DETAIL IT SO IF WE GET THE REQUEST FOR INFORMATION BACK RIGHT NOW, THAT IS WHY WE ARE TRYING TO GET ALL

[01:25:02]

THESE ENGINEERS ON BOARD BECAUSE THEY NEED TO ANSWER THOSE SPECIFIC QUESTIONS THAT YOU ARE ASKING.

WE JUST GOT -- WE MEET UPON HERE.

THE ENGINEERS WILL ANSWER OUT BI HOW DEEP, HOW DOES THIS AFFECT THE AREA. SO THAT'S WHERE --

>> I THINK THAT WILL BE HELPFUL. I MEAN, IT -- IT IS HARD TO KEEP FOR US MUCH LESS THE PUBLIC AS WE TALKED BEFORE, MAINTAIN OUR POLICY AND HAVE SOME SORT OF BACKUP.

>> WE WILL INCLUDE THAT NEXT TIME.

APOLOGIZE FOR THAT, SIR. >>COMMISSIONER CHESNEY: THAT

WOULD BE MY COMMENT. >> THIS IS MAYBE JUST A -- KIND OF ONE PART OF MOVING THIS FORWARD TO GET TO THAT DETAILED INFORMATION, BUT EVEN THIS -- THIS IS FOR -- I MEAN, I KNOW IT KIND OF TALKS ABOUT DRAINAGE. BUT WHAT DOES MA MEAN.

WHAT DOES THAT INCLUDE. THE SEPTIC TANK STUDY.

WHAT DOES THAT INCLUDE. WHAT COLONIAS ARE WE TALKING ABOUT. GOLDEN ACRES OR IN THE PRECINCT, OR THE COUNTY. THAT'S WHAT I NEED.

>> I THINK IT WOULD BE HELPFUL IF THE GRANTS DEPARTMENT CAN PROVIDE A LIST OF ALL OF THE PROJECTS TO THE COURT, THE MASTER LIST. WHEN WE ARE HAVING THE SELECTION TOPICS REFER TO ITEM WHATEVER IS ON THE LIST.

>> IF IT IS LISTED ON MY CDBG, WILL BE LISTED ON THE PRECINCT.

>>JUDGE SCOTT: I THINK IN THE PAST WHAT HE IS SAYING, IF ALREADY PREAPPROVED THESE PEOPLE HE JUST HAD.

IF THERE IS A WORK AUTHORIZATION, THEN THEY HAVE BACK-UP BECAUSE IT DETAILS WHAT THEY ARE GOING TO DO WITHIN

THERE. >>COMMISSIONER MAREZ: I KNOW I HAD SOME ITEMS I WAS ASKED TO HOLD OFF ON BECAUSE I DIDN'T

PROVIDE ANY BACK-UP ON IT. >>COMMISSIONER CHESNEY: JOHN RIGHT. HAS TO BE SOME BACK-UP.

THAT IS WHY I HAVE TO PULL ONE OF MINE BECAUSE I DIDN'T GET

BACK-UP THE RIGHT WAY. >>COMMISSIONER MAREZ: THAT HAPPENS TO ALL OF US. THAT IS MY CONCERN.

SOMEWHERE THAT WE CAN REFERENCE, I AM GOOD WITH THAT.

SOMEWHERE ELSE IN THE PACKET, I AM GOOD WITH THAT.

BUT, IT IS LIKE, WE HAVE ALL BEEN BURNED BY IT.

WE WILL HAVE TO MAKE SURE THAT. >>JUDGE SCOTT: I UNDERSTAND.

>> SOMETHING I RECOMMENDED BEFORE FOR THE ARPA PROJECTS.

NICE TO HAVE A LIST OF ALL THE PROJECTS.

EVEN I DON'T HAVE ACCESS TO THAT.

I DON'T HAVE A YOU WILL THE PROJECTS THAT WILL BE

PREAPPROVED. >>JUDGE SCOTT: WE WILL HAVE THAT

NEXT MEETING. >>COMMISSIONER CHESNEY: THIS IS THE SAME. I AGREE.

JOHN IS RIGHT. THIS IS THE SAME THING THAT WE ARE COUNTING ON THE COURT MANAGER TO LOOK TO MAKE SURE.

IF THERE IS NO BACKUP, SHE IS ABLE TO CALL TO GET BACK-UP AND NOT PUT IT IN THE AGENDA. THAT IS THE COURT'S POLICY.

>>JUDGE SCOTT: WE DON'T POLL OUR COMMISSIONERS BUT WE WILL VOTE TO TABLE AND WORK HARDER TO GET THE BACK-UP.

I GUESS WE ARE SAYING WE WILL PUSH TO THE 26TH.

>>COMMISSIONER CHESNEY: SUPPOSED TO HAVE PHONED US AND SAY DON'T HAVE BACKUP. WHAT ARE WE GOING TO DO.

>>JUDGE SCOTT: SHE REPRESENTS THE COURT.

>>COMMISSIONER CHESNEY: I NEED TO DO -- MINE DOESN'T HAVE BACKUP AND NOBODY POINTED THAT OUT TO ME.

COURT HAVE APPROVED INDIVIDUALLY.

>>COMMISSIONER CHESNEY: DOESN'T MATTER.

NO BACK-UP. >> I AM NOT DEBATING THAT TOP,

INC. >>JUDGE SCOTT: THE 26TH.

>>COMMISSIONER GONZALEZ: MAKE EVERYBODY HAPPY.

>>COMMISSIONER CHESNEY: I AM HAPPY TOP DO IT --

>>JUDGE SCOTT: WE WILL DO IT UNTIL THE 26TH.

TABLE THIS FOR THE 26TH MEETING. A MOTION FROM COMMISSIONER GONZALEZ IS OKAY WITH THAT. I WILL SECOND THAT.

WELL, YOU WILL AMEND YOUR MOTION IF YOU WOULD LIKE TO STATE IT.

I AM NOT SPEAKING FOR YOU. GO AHEAD.

OF SECOND THAT MOTION. WE WILL PUT IT ON THE ONLY FOR THE 26TH AND BRING IT BACK WITH BACK-UP.

YES. ALL TO HE WAS IN FAVOR, SAY AYE.

ANY OPPOSED, SAME SIGN. THE MOTION PASSES.

MOVE TO THE 26TH. THEN I ASSUME ITEM 10 IS THE

[10. Discuss and consider authorizing selection of International Consulting Engineers (ICE) for Engineering Services Drainage Projects for Council of Governments of Distribution (COG-MOD RFQ No. 3222-22) for the following projects listed below; and other related matters. 1) Tierra Grande 2) Petronila Estates 3) Belk Lane]

EXACT SAME THING. SO DO YOU WANT TO MAKE -- TABLE THAT -- SAME THING. TABLE TO THE 26TH.

>>COMMISSIONER GONZALEZ: TABLE UNTIL THE 26TH.

>>JUDGE SCOTT: I SECOND THAT MOTION.

ALL THOSE IN FAVOR -- >>COMMISSIONER CHESNEY: WHICH ONE, I AM SORRY GO MINNESOTA GONZALEZ HAVE ADDITIONAL BACK-UP. JUST A LITTLE BIT OF BACK-UP.

BUT ANYWAY, WE WILL WAIT UNTIL THE 26TH.

>>JUDGE SCOTT: ALL IN FAVOR, SAY AYE.

ITEM 11 IS THE SAME THING MOVE TO THE 26.

COMMISSIONER. >>COMMISSIONER GONZALEZ: SO MOVED. WAITING FOR -- RESETTING FOR THE

26TH. >>JUDGE SCOTT: 26TH.

I WILL SECOND THAT MOTION. ALL IN FAVOR, SAY AYE, SAY AYE.

ANY OPPOSED, SAME SIGN, THE MOTION PASSES.

[12. Receive presentation of the 2021-2022 Annual Comprehensive Financial Report to the court by Dale Atchley, Nueces County Auditor.]

MOVING ON TO ITEM 12. HAND THIS IS FOR YOU, LISA, THE COMPREHENSIVE ANNUAL FINANCIAL REPORT TO THE COURT.

I GUESS DALE IS NOT AVAILABLE AND YOU ARE IT TODAY.

>> YES, MA'AM. HAVE THE PRESENTATION UP.

BE SURE TO SPEAK IN THE MICROPHONE, PLEASE.

>> YES, MA'AM. I RESPECTFULLY SUBMIT THE ANNUAL COMPREFINANCIAL REPORT FOR YOUR CONSIDERATION THIS IS -- IT IS A LITTLE BIT LATE THIS YEAR. WE WERE TRYING TO WORK OUT SCHEDULES. WE HAD IMPLEMENTATION ISSUES WITH GASBY 57 AND CAUSED VARIOUS DELAYS.

WE ARE SUBMITTING IT FOR THE FISCAL YEAR 9/30 OF '22.

>>JUDGE SCOTT: THAT CAUGHT ME OFF -- THAT WAS A LITTLE SURPRISING TO ME HOW LATE THIS WAS.

>> YES, MA'AM. NEXT SLIDE.

THESE FINANCIAL RECORDS HAVE BEEN PREPARED IN ACCORDANCE WITH THE ACCOUNTING PRINCIPLES GENERALLY ACCEPTED IN THE UNITED STATES, WHICH IS G.A.P. THE GOVERNORING ACCOUNTING STANDARDS BOARD. THEY HAVE BEEN IN ACCORDANCE WITH THE AUDITING STANDARDS IN THE UNITED STATES AND STANDARDS APPLICABLE TO THE FINANCIAL AUDITS CONTAINED IN GOVERNMENTAL AUDITING STANDARDS BY A LICENSED C.P.A. FIRM BROWN AND HILL WILL HAVE A PRESENTATION -- OR DISCUSSION AT THE END.

OUR GOVERNMENT-WIDE FINANCIAL STATEMENTS PROVIDE A BROAD OVERVIEW OF THE COUNTY'S FINANCES IN A MANNER SIMILAR TO THAT OF THE PRIVATE SECTOR BUSINESS.

THE -- THE STATEMENT OF NET POSITION PRESENTS ALL OF THE INFORMATION ON THE COUNTY'S ASSETS WITH THE DIFFERENCES REPORTED BETWEEN THE ASSETS AND THE LIABILITIES AS THE NET POSITION. OVER TIME, INCREASES AND DECREASES IN NET POSITION MAY SERVE AS A USEFUL INDICATOR OF FINANCIAL OF THE COUNTY AND IMPROVING AND DETERIORATING FINANCIAL. AND DISCUSS LIABILITY TO PENSIONS. GOVERNMENT-WIDE FINANCIAL REVENUES AND EXPENSES, THE FINANCIAL ANALYSIS OF THE GOVERNMENTAL FUNDS, CHANGE IN FUNDS BALANCE BY FUND, THE GENERAL FUND FUND BALANCE, AND IMPACT FOR FUTURE YEARS.

NEXT SLIDE. THE OBJECTIVE OF THE FINANCIAL REPORT IS TO PROVIDE THE INFORMATION TO DETERMINE WHETHER THE PRIOR YEAR REVENUES WERE SUFFICIENT TO PAY THE PRIOR YEAR SERVICES. WE ARE DEMONSTRATING WHETHER RESOURCES WERE OBTAINED AND USED IN ACCORDANCE WITH THE COUNTY'S LEGALLY ADOPTED BUDGET, PROVIDE INFORMATION TO DETERMINE WHETHER THE COUNTY'S FINANCIAL POSITION IMPROVED OR DETERIORATED AS A RESULT OF THE YEARS OPERATIONS AND THEN PROVIDE ADDITIONAL INFORMATION ABOUT THE COUNTY. AND THE GOVERNMENT WIDE TOTAL ASSETS AND DEFERRED OUTFLOWS OF THE FISCAL YEAR EXCEEDED LIABILITIES AND INFLOW OF RESOURCE BUSINESS $106,375, 083.

NET INCREASED BY 11,083,475 OR 11.63% COMPARED TO THE PRIOR YEAR. THE GOVERNMENTAL FUNDS IN CONTRACT TO THE GOVERNMENT WIDE FUNDS REPORTED A COMBINED ENDING FUND BALANCE OF $129,501,00 DECREASE OF.

OF $175,523 FROM THE PRIEF PRIOR YEAR.

THE GENERAL FUND FUND WALL OF $25,765.044 REFLECTS A DECREASE OF $175,523 FROM THE PREVIOUS YEAR.

THE TOTAL REMAINING UNASSIGNED IS ZERO DOLLARS AFTER ADJUST FOR THE PREPAID ITEMS, THE INVENTORIES THAT ARE NONSPENDABLE AND THE MINIMUM GENERAL FUND BALANCE THAT WE

[01:35:01]

APPROVE EACH YEAR WE HAVEVER WE ADOPT THE BUDGET.

THE BUDGETED -- OR THE BALANCE OF THE GENERAL OBLIGATED DEBT AT THE END OF THE YEAR IS $191 NOW, 839,402.

AND THE DEBT SERVICE FUND BASS IS $3,860,425, WHICH IS 24.74% OF NEXT YEAR'S SET DEFER REQUIREMENT.

AND ALL THAT INFORMATION WILL BE HELPFUL AS WE ARE FRYING TO PREPARE THE UPCOMING YEAR'S BUDGET.

YES, THERE WE GO. SO AS I STATED, THE GOVERNMENT-WIDE FINANCIAL ANALYSIS, THE NET POSITION TELLS YOU WHAT VARIANCE BETWEEN YOUR ASSETS AND LIABILITIES BY THE END OF THE YEAR. THE GOVERNMENT WIDE STATEMENTS ARE PREPARED TO BE SIMILAR TO BUSINESS FINANCIAL REPORTS AND PREPARED IN THE SAME MANNER SO IT IS MORE OF A -- YOU ARE ABLE TO COMPARE THE GOVERNMENTAL STATEMENTS OF THE COUNTY LIKE YOU WOULD REVIEW THE GOVERNMENT STATEMENTS OF BUSINESS.

OVER TIME, NET POSITION WILL BE A USEFUL INDICATOR OF THE GOVERNMENT'S FINANCIAL OPINION. AS YOU CAN SEE AT THE END OF THE FISCAL YEAR. THERE WAS A VARIANCE OF -- NET POSITION BECAME $106,375,083. WE COMPARED THAT TO THE PREVIOUS FISCAL YEAR WHICH WAS A VARIANCE OR INCREASE OF $11,038,475.

SO THE NET PENSION LIABILITY. IT IS CALLED A "NET PENSION LIABILITY," HOWEVER, THIS YEAR OUR NET PENSION LIABILITY BECAME A NET PENSION ASSET. SO MUCH INTEREST AND THE PAYMENTS WE MADE INTO THE RETIREMENT ACCOUNT TURNED THAT LIABILITY INTO AN ASSET. WE ACTUALLY HAVE A SURPLUS BECAUSE OF THE FUNDS -- THE AVAILABLE FUNDING CHANGES.

THAT SURPLUS IS A -- IT IS AN INCREASE OF A -- HOLD ON.

I AM LOOKING AT THE WRONG ONE. >>JUDGE SCOTT: THAT LOOKS LIKE

IT IS A NEGATIVE. >> IT IS A NEGATIVE BECAUSE IT

IS AN ASSET. >>JUDGE SCOTT: OKAY.

>> SO THE SURPLUS BECAME -- AS YOU CAN SEE, IT IS THE -- IT IS -- LIABILITY IS A POSITIVE AND AN ASSET IS A NEGATIVE.

BECAUSE NORMALLY YOU OWE MONEY FOR YOUR PENSIONS.

YOU DON'T HAVE SURPLUS PENSION FUNDS.

SO WE HAD SURPLUS PENSION FUNDS OF $27,70 3,866 AS OF DECEMBER 31, 2021. WE ARE TDRS.

AND THEY REPORT ON THE CALENDAR YEAR, NOT THE COUNTY'S FISCAL

YEAR. >>JUDGE SCOTT: GOOD.

>> NEXT SLIDE. SO THE CHANGE IN -- IN NET POSITION. AS YOU CAN SEE, OUR NET POSITION, WHICH, AGAIN, IS -- IS THE BUSINESS -- IS THE CONVERSION OF OUR GOVERNMENTAL FINANCIAL STATEMENTS TO THE GOVERNMENT WIDE FINANCIAL STATEMENTS HAD A -- HAD AN ENDING POSITION THAT INCREASED BY $11,083,475.

THAT NET POSITION RESTATED WAS $106,3 5,083.

THAT IS ACROSS ALL FUNDS EXCLUDING THE COMPONENT UNITS.

THAT IS ACROSS ALL FUNDS EXCLUDING THE COMPONENT UNITS.

THAT IS ACROSS ALL FUNDS EXCLUDING THE COMPONENT UNITS.

NEXT SLIDE, I AM SORRY. I APOLOGIZE, I HAVE TWO -- HOLD ON. OKAY, I AM ON SLIDE 8.

OKAY, SO -- SO THE TOTAL REVENUES INCREASED BY $ 1,177,855. THE PROPERTY TAX REVENUE DECREASED BY $775,037 DUE TO THE IF EXOF INFLATION THROUGHOUT THE AREA. THE INVESTMENT EARNINGS INCREASED BY $1,420,218. THIS INCREASE WAS MAINLY ATTRIBUTED TO THE EFFECT OF THE FEDERAL RESERVE RAISING THE FED FUND RATE TO HELP REDUCE INFLATION THROUGHOUT THE COUNTRY. AND THE OPERATING AND CAPITAL

[01:40:03]

GRANTS AND CONTRIBUTIONS INCREASE CANNED BY $4,710,656 DUE TO AN INCREASE IN GRANT FUNDING.

ALL OF THIS INFORMATION IS FUND IN YOUR MDNA SESSION OF YOUR ANNUAL FINANCIAL REPORT. NEXT SLIDE.

WE ARE ON 9. YOUR TOTAL EXPENSES ALSO INCREASED. YOUR TOTAL EXPENSES INCREASED BY $ .96% WHICH IS $8,389,493. THE LARGEST PORTION OF THAT INCREASE IS DUE TO THE INIMPLEMENTATION OF GASB YY 87.

DALE TALKED ABOUT IT FOR A NUMBER OF YEARS, THE IMPLEMENT STATION OF GASBB 87 HELPED US RECOGNIZE OUR LEASES AS EXPENSES IN HAD -- OR LEASE EXPENSES AS CAPITAL ACCESS AND, THEREFORE, IT INCREASES OUR EXPENSES AND INCREASES OUR FIXED ASSET.

AND THE TWO NET OUT, BUT IN THE FIRST YEAR FOR IMPLEMENTATION, THERE WAS A BIG INCREASE. HERE IS A VISUAL REPRESENTATION OF THE GOVERNMENT-WIDE FINANCIAL STATEMENTS, NET PROGRAM REVENUE VERSUS THE NET EXPENDITURES. AS YOU CAN SEE, THE LAW ENFORCEMENT AND CORRECTIONS HAVE BOTH THE HIGHEST EXPENSES AND THE HIGHEST PROGRAM REVENUE AS WE DO GET REIMBURSED FOR SOME OF THOSE EXPENSES THAT WE HAVE. NEXT SLIDE.

THE BALANCE -- THE FUND BALANCES.

THIS IS WHAT ALL OF YOU ARE QUESTIONING REGARDING WHERE YOU ARE AT THE END OF THE YEAR. YOU BEGIN -- SO THAT IS YOUR BEGINNING FUND BALANCE, PLUS YOUR REVENUES, PLUS YOUR TRANSFERS IN. MINUS YOUR EXPENSES AND GETS YOU TO YOUR ENDING FUND BALANCE. GENERAL FUND ENDING FUND BALANCE DECREASED 17,523. THEREFORE, ONLY 24.15% OF THE BUDGETED REVENUE AND TRANSFERS IN.

WE RIGHT THERE AT THE CUSP OF OUR 25% THAT WE TRY TO DO -- THAT WE TRY TO HAVE IN RESERVES SO WE ARE RIGHT THERE.

ABOUT -- ON THE BORDERLINE OF MEETING IT AT THE END OF 9/30 OF ' 2. A VERY SMALL INCREASE IN THE FUND BALANCE FOR DEBT SERVICE. LARGER INCREASE IN THE FUND BALANCE FOR ROAD FUND. AND IN THE OTHER SMALL FUNDS, HAD -- HAD VARYING AMOUNTS OF DECREASES.

LAW LIBRARY DID END WITH THE NEGATIVE FUND BALANCE OF 64,852.

WHICH WAS -- WHICH IS 31.77% DECREASE.

WE WILL NEED TO TRANSFER ADDITIONAL FUNDS IN THE CURRENT FISCAL YEAR TO COVER THAT SHORTAGE.

THEY HAVE BEGUN RECEIVING FUNDING FROM DISTRICT COURT.

THEIR MAIN SOURCE OF FUNDING IS THE DISTRICT COURT COLLECTS A LAW LIBRARY FEE WHEN CASES ARE FILED.

NOW THAT CASES ARE FILED AND THEY STARTED MOVING.

COLLECT THOSE GUYS. THAT SHORTAGE HAVE DECREASED AS OF TODAY IN THE FUND BALANCE, BUT IT WILL -- IF ADDITIONAL FUNDING IS NOT PROVIDED THEY WILL END THE YEAR ON A NEGATIVE

BALANCE AT 9/30/23 MOST LIKELY. >>COMMISSIONER GONZALEZ: I HAVE A QUESTION. SORRY TO INTERRUPT.

>> YES. >>COMMISSIONER GONZALEZ: EVERYTHING WE SEE IN HERE SEPTEMBER OF ' 22.

>> THAESHLGHAT'S CORRECT. >>COMMISSIONER GONZALEZ: SO WE DON'T KNOW EXACTLY WHERE WE ARE TODAY.

BECAUSE -- BECAUSE THAT IS PROBABLY MY CONCERN.

I KNOW WHERE WE WERE IN SEPTEMBER '22.

BUT WHERE ARE WE AT NOW AS WE GO FORWARD.

BECAUSE WE -- WE ARE GETTING CHOICE TO SEPTEMBER '23 AGAIN.

AND ARE WE GOING TO HAVE A REPORT THAT IS GOING TO TELL US WHERE WE ARE AT AT THE END OF AUGUST OR SEPTEMBER 1? OR SEPTEMBER -- BECAUSE WE -- WE NEED TO KNOW THOSE NUMBERS ALSO AND THE GENERAL FUND WAS $25,945,567.

>> THAT WAS FOR THE FISCAL YEAR THAT ENDED 9/30/21.

[01:45:01]

>>COMMISSIONER GONZALEZ: EVERYTHING HERE IS '22.

'21-'22. >> THAT'S CORRECT.

>>COMMISSIONER GONZALEZ: WHERE I AM CONCERNED IS THE GAP, RIGHT.

>> YES, SIR. WHENEVER WE DO OUR BUDGET WORK SHOPS. DALE DOES ESTIMATED ACTUALS FOR THE BUDGET WORKSHOPS THAT GIVE YOU ESTIMATE WHERE WE INTEND TO END THE FISCAL YEAR 9/30/23. AND DISCUSS DEPARTMENTAL REQUESTS, MAKE ANY ADJUSTMENTS THAT COMMISSIONERS COURT WOULD LIKE TO SEE. ADDITIONS FROM THE BUDGET.

DELETIONS ON THE BUDGET ON AN AS NECESSARY BASIS AND IN ORDER TO PREPARE THE 2023-'24 I AM TRYING TO KEEP MY FISCAL YEARS STATE.

'23-'24 PROJECT. >>COMMISSIONER GONZALEZ: WHAT I WOULD LIKE TO SEE IS SIX MONTHS, TELL US WHERE IS WE ARE AT.

>> IT WILL BE IN THAT BUDGET WORKSHOP WE ARE GOING TO HAVE AND I THINK IT IS IN JUST A COUPLE OF BEAKS, I BELIEVE.

I BELIEVE THAT ON THE 29TH WE MEET WITH THE JUDGE.

AND ON THE FIRST WEEK OF AUGUST, THAT WE --

>>JUDGE SCOTT: SECOND WEEK. >> SECOND WEEK OF AUGUST THAT WE START THOSE BUDGET WORKSHOPS. I BELIEVE -- I KNOW I AM WORKING ON ESTIMATES AND DALE IS WORKING ON ESTIMATES.

WE ARE TRYING TO GET SOMETHING DONE.

AT LEAST A VERY ROUGH DRAFT DONE BY THE END OF THE WEEK.

>>JUDGE SCOTT: I UNDERSTAND GOING INTO MORE WITH THE PROBLEMSNESS WE ARE LOOKING AT. BUT IMPORTANT AND IMPORTANT THIS YEAR TO HAVE FACTS PLANNING BEFORE -- WE WEREN'T HOOKING AT THE SITUATION WE WERE. EVERY BIT THAT YOU CAN TO DO HELP FACILITATE THAT SOONER. WE CAN'T HAVE THIS IN SEPTEMBER OF NEXT YEAR AND DEAL WITH THE PROBLEM WE ARE GOING TO DEAL WITH. SO, YES.

>>JUDGE SCOTT: I UNDERSTAND. I HAVE BEEN THERE AND TALKED TO DALE AND THEIR OFFICE AND DO AGREE 100% WITH YOU, COMMISSIONER .AND WE WILL WORK ON THAT WITH MY MEETING AS WELL AND BRING IT TO THE BUDGET. WE WILL REITERATE THAT REQUEST,

TO SURE. >> AGAIN, I BELIEVE WE WILL FINALIZE A VERY ROUGH DRAFT OF ESTIMATED ACTUALS, BECAUSE ADDITIONAL COSTS ARE COMING IN EVERY DAY.

AND SO IT'S THE -- THE MORE INFORMATION WE HAVE, THE BETTER THE ESTIMATES BECOME. SO WE ARE GOING TO GIVE A VERY ROUGH DRAFT OF THE ESTIMATED ACTUAL ENDING FUND BALANCE FOR 9/30-23. BE SURE TO HAVE DALE FORWARD IT TO ALL MEMBERS OF COMMISSIONERS COURT SO WE CAN ALL HAVE AN UNDERSTAND WHERE WE LOOK LIKE WE ARE GOING.

AND AS WE MAKE REVISIONS AND UPDATES TO THOSE, I WILL BE SURE TO GIVE COMMISSIONERS COURT A COPY OF ALL OF THOSE AS WELL.

NEXT SLIDE. THE GENERAL FUND REVENUES -- YOU CAN SEE THE MAJORITY OF OUR GENERAL FUND REVENUES ARE PROPERTY TAX. THE OTHER PORTIONS OF THE REVENUE ARE MINIMAL COMPARED TO THE AMOUNT THAT THE COUNTY RELIES ON THE PROPERTY TAX REVENUE TO FUND THE GENERAL FUND OPERATIONS. AND, GIVE, THIS IS ALL INFORMATION THAT IS EXTREMELY HELPFUL IN THE OVERVIEW WHEN LOOKING AT THE SITUATIONS THAT WE HAVE WITH OUR UPCOMING BUDGET. NEXT SLIDE.

AS YOU CAN SEE, THE GENERAL FUND FUND BALANCE, I COMPARED THE FIVE-YEAR FORECAST OF THE ACTUAL FUND BALANCE -- SORRY, NEXT SLIDE. NO, YOU ARE THERE, YOU ARE THERE. MY BAD.

I HAVE TWO JOINS. I AM SORRY.

AS YOU CAN SEE THE FIVE-YEAR FORECAST OF THE FUND BALANCE.

WE HAVE INCREASED OUR FUND BALANCE FROM 2018 AT $18 MILLION ALL THE WAY UP TO $25,$765,044 IN THE FISCAL YEAR THAT ENDED 9/30/22. WE ARE RIGHT THERE AT THE CUSP OF REACHING THAT 25% TARGETED BUDGETED REVENUE AT THE END OF 9/30/22. NEXT SLIDE.

WE ALREADY KNOW THAT COMMISSIONERS COURT APPROVED ON DECEMBER 14, 022, THEREFORE YOUR DEBT SERVICE OBLIGATION WILL INCREASE IN THE FISCAL YEAR THAT WE ARE CURRENTLY IN, WHICH IS THE FISCAL YEAR ENDING 9/30/23. AND JOHN MANNING, WHO WAS OUR PARTNER -- PARTNER AT PATILLO, BROWN AND HILL WILL COME UP TO

[01:50:02]

THE MIC AND DISCUSS HIS AUD IT FINDING THAT HE HAD OF OUR

FINANCIAL REPORT. >> JUDGE, COMMISSION REMEMBERS, THANK YOU FOR LETTING ME BE THERE.

THE AUDIT HAS GONE VERY WELL. GIVEN ME HIGHLIGHTS HERE.

IN YOUR ACTUAL ACFR, THE REASON THAT WE ARE HERE OFFER AN OPINION FOR THE FINANCIAL STATEMENT FOR NUECES COUNTY AND ABLE TO OFFER AN UNMODIFIED OPINION MEANING AS SHE MENTIONED EARLIER THAT THE COUNTY ADHERED TO GAP AND A GAP SET OF FINANCIAL STATEMENT OF THE FOUR TYPES OF OPINIONS THAT WE CAN OFFER. BLESSED ASSURANCES.

AND DIDN'T HAVE TO MODIFY OUR OPINION FOR INTERNAL CONTROL WEAKNESSES OR GAP DEPARTURES THAT THE COUNTY IS NOT INCLUDING IN THEIR FINANCIAL STATEMENTS. WE WORK WITH THE COUNTY AUDITOR'S OFFICE, THIS WHOLE DOCUMENT IS A COUNTYWIDE ENDEAVOR AND WE TALK TO A LOT OF DIFFERENT DEPARTMENTS.

A LOT OF DIFFERENT PERSONNEL. THE FACT THAT THIS REPORT IS SO GOOD IS A REFLECTION OF THE COUNTY AS A WHOLE IN ADDITION TO THE AUDITOR'S OFFICE. WE APPRECIATE ALL THE HELP WE GOT WHILE DOING THAT. AS SHE MENTIONED EARLIER ONE OF THE REASONS THAT WE ARE -- IF YOU LOOK AT THIS, A MIX-UP ON THE AGENDA. WE WERE SUPPOSED TO PRESENT THIS IN JUNE. SO NORMALLY THIS IS DUE BY MARCH 31. GAUZE OF GASBY 87 ASKING FOR A ONE MONTH EXTENSION. WE ARE ONE MONTH LATER THAN WE NORMALLY, AND IF YOU ARE WORKING ON THAT PARTICULAR IMPLEMENTATION OF THE NEW STANDARD.

A LOT OF DATA TO GET TOGETHER. WORKED WITH DEBT BOOK AND ACCUMULATED THAT TO PRESENT IT INSTEAD OF FINANCIAL STATEMENTS THAT ARE READY GAP READY. THAT IS THE REASON FOR THE DELAY. WE ALSO HAD TO LOOK AT YOUR FEDERAL AND STATE GRANT FUNDS AND LOOKED AT FIVE PROGRAMS FOR FEDERAL. AND WE LOOKED AT WITH UP FOR STATE AND WE IS IT NOT HAVE ANY MATERIAL WEAKNESS OR SUFFICIENT AT THE FISH EN CEASE TO REPORT. SO, IN OTHER WORDS, THE GRANT MONIES YOU GUYS ARE GETTING, THE ONES THAT YOU ARE TESTING ARE IN THE REQUIREMENTS ADHERED TO. AND REPORTS ARE BEING FILED.

AND EVERYTHING WILL BE IN GOOD WORKING ORDER WHEN WE GOT THERE.

WE APPRECIATE ALL THE ASSISTANCE THAT WE HAVE OFFERED.

AND THAT WERE OFFERED. THE COUNTY SUBMITS THIS TO GFOA FOR EXCEL EXCELLENCE IN REPORTING AN COMMENTS WERE MINIMAL. THOSE ITEMS WERE CORRECT AND WE DON'T SEE ANY REASON WHY THIS SET OF FINANCIALS WILL NOT AGAIN RECEIVE THAT AWARD AND ONE THING COMING UP IS SIMILAR TO THE LEASES, THERE IS ALSO A NEW STANDARD ISSUED IN '23 THAT IS MAKING US CAPTURE ALL OF YOUR SUBSCRIPTION-BASED TECHNOLOGY ARRANGEMENTS MEANING ALL OF YOUR LONG-TERM SOFTWARE AGREEMENTS HAVE TO BE EVALUATED AND MAY POSSIBLY BE INCLUDED IN THE FINANCIALS IF THEY MEET THE CRITERIA.

SO THIS 23 UNIVERSITY YEAR SHALL THE LAST ONE WITH SIGNIFICANT CHANGES TO THE REPORT AND TIME FRAMES THAT WE ARE HOPING FOR.

WE CAN'T NEVER PROMISE ANYTHING, BUT ENJOY OUR TIME HERE AT NUECES COUNTY AND APPRECIATE ALL THE EFFORT GIVEN TO US BY A LOT OF PEOPLE HERE. IF YOU GUYS HAVE QUESTION.

I KNOW IT IS A HUGE DOCUMENT. I WILL BE GLAD TO ANSWER THOSE NOW. AND, AGAIN, THANK YOU.

>>JUDGE SCOTT: THANK YOU. DO YOU HAVE ANY QUESTIONS BEFORE

HE GOES DOWN -- EVERYBODY? >> THE ANNUAL FINANCIAL REPORT IS AVAILABLE ON THE COUNTY'S WEB SITE POSTED SINCE APRIL THIS.

>>COMMISSIONER CHESNEY: JUDGE ARE I WANT TO MAKE BRIEF COMMENTS ON THIS AND I WANT TO, FIRST OF ALL, APPLAUD THE LOCAL MEDIA WHO HAS DONE A GREAT JOB OF GETTING THE WORD OUT ON THIS.

AND I ALSO WANT TO APPLAUD YOU FOR MEETING WITH A LOT OF DEPARTMENT HEADS, ELECTED OFFICIALS.

I KNOW YOU INVITED ALL OF THEM PRETTY MUCH WHICH KIND OF MAKES THIS ITEM MOOT, BECAUSE IT IS PRETTY WELL KNOWN THE RAMIFICATIONS OF THE UPCOMING 2023 MACHINE '24 OF OFFICES AND WITH THE POTENTIAL DEVASTATING CUTS WE MAY HAVE TO MAKE AS A COUNTY. I THINK THE WORD HAS GOTTEN OUT PRETTY CLEARLY AND I REALLY HAD PUT THIS ON HERE TO MAKE SURE THAT WE HAD THE OPPORTUNITY TO VISIT WITH DEPARTMENT MEADS AND ELECTION OFFICIALS AND YOU TOOK THAT ON YOUR OWN AND I REALLY APPRECIATE THAT. THAT IS TRUE LEADERSHIP.

I APPRECIATE THAT. THIS IS GOING TO BE DIFFICULT TO SAY THE LEAST TO GO THROUGH WHAT WE ARE FIXING TO GO THROUGH.

THE HAIL MARY THAT MR. KESNICK PUT FORWARD DOESN'T LOOK THAT PROMISING AND I APPRECIATE HIS EFFORTS BECAUSE HE HAS BEEN

[02:50:03]

BUSTING HIS TAIL TO DO THIS. THEY HAD A MEETING YESTERDAY.

I DON'T KNOW WHAT THE OUTCOME OR IF ANYTHING CHANGED THERE OR WHAT WILL HAPPEN WITH REGARDS TO THAT.

AT THE END OF THE DAY, THIS COUNTY IS LOOKING AT PRETTY CATASTROPHIC BUDGET NUMBERS THAT I SAID TO THE MEDIA AND PUBLICLY IN THE 15 OR 16 BUDGETS I HAVE DONE AS A CITY COUNCILMAN AND COUNTY COMMISSIONER, I SEEN ANYTHING LIKE THAT.

NOT SOMETHING THAT WE WILL TAKE LIGHTLY AND LOOK FORWARD TO.

I AM THE FIRST TO TELL YOU ALWAYS WAYS TO MAKE CUTS, BUT NOT THE WAY WHICH WOULD ANTICIPATE OR WANT TO MAKE CUTS, BECAUSE THIS IS GOING TO CUT INTO -- NOT ONLY FAT BUT THE BONE AND THAT WILL HURT A LOT FOR COUNTY SERVICES IF I CAN DEED IT HAS TO HAPPEN NOT ONLY COUNTY SERVICES BUT SCHOOLCHILDREN WILL BE AFFECTED. ROUGH ON SCHOOL DISTRICTS.

HOSPITAL DISTRICT, DEL MAR. SO HAVING SAID THAT, JUST TO MAKE THOSE COMMENTS, I WOULD MOVE TO TABLE THIS ITEM INDEFINITELY SIMPLY BECAUSE WE HANDLED IT IN OTHER MANNERS.

THANK YOU. >>JUDGE SCOTT: A MOTION TO TABLE INDEFINITELY. DO I HAVE A SECOND? WE HAVE A SECOND. ALL IN FAVOR, SAY AYE.

THAT IS YOUR ITEM, ALSO, COMMISSIONER CHESNEY.

>>COMMISSIONER CHESNEY: JUDGE, BASED ON THE MORATORIUM PASSED, I AM GOING TO MAKE A MOTION TO TABLE THAT UNTIL THE 26TH TO KIND OF SEE HOW THIS ALL PLAYS OUT.

SO I WOULD MAKE A MOTION TO TABLE UNTIL JULY 26.

THE JULY 26 MEETING, SORRY. >> A MOTION TO TABLE.

DO I HAVE A SECOND? >> SECOND.

>> A MOTION TO SECOND AND A TABLE.

ALL IN FAVOR SAY AYE. OPPOSED, SAME SIGN.

>>JUDGE SCOTT: I AM MAKING SURE -- PLEASE CORRECT ME IF I'M WRONG, BUT I THINK WE COVERED EVERYTHING ON THE AGENDA.

[14. Discuss and consider annexation of CR 22 area; and all related matters.]

14? >>COMMISSIONER CHESNEY:S THAT -- I WILL MAKE A MOTION TO TABLE -- PART OF G.

>>JUDGE SCOTT: IT WAS ON THE LIST -- THE OTHERS WEREN'T ON THE LIST. THAT WAS ITEM G FROM THE EXECUTIVE SESSION, YES. THEN THEY HAVE -- ARE THERE ANY

ADJOURNMENTS IN MEMORY? >>COMMISSIONER CHESNEY: I HAVE

ONE, JUDGE -- >>JUDGE SCOTT: I HAVE ONE ALSO.

>>COMMISSIONER CHESNEY: JUDGE, I DON'T HAVE THE OBITUARY YET, AND I WILL READ THAT AT THE NEXT MEETING.
