[1. CALL TO ORDER]

[00:00:15]

>>JUDGE SCOTT: TO LEAD US IN THE INVOCATION AND DO THE PLEDGES AFTER THAT. IF YOU WILL PLEASE RISE.

>> THANK YOU, JUDGE. LET US PRAY.

FATHER, IN THE NAME OF JESUS, WE COME BEFORE YOU, LORD, WE THANK YOU FOR THIS DAY. WE THANK YOU FOR YOUR MANY BLESSINGS THAT YOU HAVE GIVEN US, THAT YOU HAVE POURED OUT UPON US AND UPON THIS COUNTY, UPON THIS NATION.

AND I PRAY, LORD, THAT YOU WILL CONTINUE TO POUR YOURSELF OUT.

I ASK, LORD, THAT YOU WILL BLESS THIS COUNTY, YOU BLESS THE LEADERSHIP OF IT. THESE NEWLY ELECTED OFFICIALS, LORD, I PRAY THAT YOU BLESS JUDGE CONNIE SCOTT.

AND I ASK, LORD, THAT YOU ORDER HER STEPS.

THE WORD SAYS UNLESS YOU BUILD A HOUSE THEY LABOR IN VAIN WHO BUILDS IT. I PRAY YOUR WISDOM AND GUIDANCE TO ALWAYS LEAD THIS COURT. I ASK, LORD GOD, THAT YOU WILL GIVE US DISCERNMENT IN A TIME, LORD, WHERE IT IS DIFFICULT TO DISCERN RIGHT FROM WRONG AND GOOD FROM EVIL.

WE PRAY FOR YOUR SUPERNATURAL DISCERNMENT, LORD, THAT WE WILL BE ABLE TO SEE THROUGH THE MIDST.

WE ASK, LORD GOD, THAT YOU JUST BLESS OUR COUNTY AND BLESS ALL THOSE WHO HAVE ANY PART OF DECISION MAKING, LORD.

THAT WISDOM WILL PREVAIL THROUGH IT ALL, LORD.

I PRAY THAT IT BE LED WITH BOLDEN AND NOT FEAR.

GIVEN US THE SPIRIT OF FEAR, LOVE AND OF A SOUND MIND.

WE PUT ALL THOSE THINGS, LORD, THE FIRST MEETING OF 2023.

I PRAY, LORD, THAT YOU ORDER OUR STEPS THROUGHOUT IT ALL.

PRAY IN JESUS'S PRECIOUS, POWERFUL AND MIGHTY NAME.

AMEN. >> AMEN.

I PLEDGE ALLEGIANCE TO THE FLAG OF UNITED STATES OF AMERICA.

AND TO THE REPUBLIC FOR WHICH IT STANDS.

ONE NATION, UNDER GOD, INDIVISIBLE, WITH LIBERT AND JUSTICE FOR ALL. HONOR THE TEXAS FLAG.

I PLEDGE ALLEGIANCE TO THEE, TEXAS, ONE STATE UNDER GOD, ONE

AND INVISIBLE. >>JUDGE SCOTT: I BELIEVE WE HAVE A QUORUM HERE. THIS IS JANUARY 4.

IT IS 8:36. WE ARE AT THE 901 LEOPARD,

[D. Adopt the following Resolution(s), Proclamation(s), and/or Order(s):]

NUECES COUNTY COURTHOUSE AND WE ARE READY FOR A MEETING.

THANK YOU. WE HAVE A RESOLUTION FIRST ON THE AGENDA IN SUPPORT OF EFFORTS FOR SECOND CAUSEWAY FOR PEDRO ISLAND. I BELIEVE CHESNEY IS GOING TO

TAKE THIS. >>COMMISSIONER CHESNEY: THANK YOU, JUDGE. I APOLOGIZE.

I FORGET WE MOVED THIS UP. THIS IS A -- LET ME GET TO IT.

THIS IS A RESOLUTION IN SUPPORT OF A SECOND VEHICULAR CAUSEWAY TO PEDRO ISLAND IN ADDITION TO THE EXISTING JFK CAUSEWAY.

REPRESENTATIVE TODD HUNTER HAS BEEN LEADING THE EFFORTS WITH REGARDS TO TXDOT WITH ANOTHER CONTINGENCY ON THE ISLAND THAT I HAVE BEEN A PART OF AND KIND OF THE FIRST ROUND.

YOU WILL BE SEEING THESE RESOLUTIONS IN OTHER BODIES.

HOPEFULLY THE CITY OF CORPUS CHRISTI, PORT ARANSAS TO SHOW SUPPORT. IT IS SIMPLY AN ATTEMPT TO START THE PROCESS AT A DIFFERENT LEVEL OR TAKE IT TO A DIFFERENT LEVEL.

THE PROCESS HAS BEEN ONGOING FOR MANY YEARS AND WE HAVE TO GO TO TXDOT TO GET ON THEIR LIST AND GET TO THE VERY IMPORTANT SECOND VEHICULAR CAUSEWAY STARTED.

THE ISLAND, PORT ARANSAS, THE GROWTH OUT THERE HAS BEEN INCREDIBLE. IT WILL CONTINUE TO BE INCREDIBLE. I THINK IT IS EVEN MORE SO WITH ALL THE DEVELOPMENT GOING ON OUT THERE.

SO I THINK IT IS INCUMBENT UPON THIS BODY TO SUPPORT THIS RESOLUTION, ESSENTIAL IT TO THE LEGISLATIVE DELEGATION, AND ESPECIALLY REPRESENTATIVE HUNTER AND SENATOR HINHOSA AND REPRESENTATIVE -- I HAVE GOT TO TRY TO REMEMBER EVERYBODY THERE.

NOT TRYING TO LEAD OUT. AND TODD HUNTER'S -- AND MOVE

PASSAGE. >>JUDGE SCOTT: WE HAVE A MOTION AND A SECOND. ANY OTHER DISCUSSION? ALL IN FAVOR. AYE.

ANY OPPOSED? THE MOTION PASSES.

KARA, I HAVE THIS SIGNED HERE. DO I HAND IT TO YOU NOW OR WAIT?

>> JUDGE, CAN YOU MAKE YOU SPEAK IN THE MIC SO THE PEOPLE CAN

HEAR YOU. >>JUDGE SCOTT: I GUESS I NEED TO GET CLOSER. HAVING NO MONITOR.

[00:05:01]

WE ARE HAVING A LITTLE BIT OF DIFFICULTIES THIS MORNING BUT IT WILL GET BETTER. NOT THAT I AM AWARE -- OH, I DIDN'T SIGN THE REST OF THIS UNDERNEATH HERE.

SORRY. OKAY.

YOU WILL BRING IT LATER. THANK YOU.

[E. ANNOUNCEMENT ON DISCLOSURE OF CONFLICTS OF INTEREST: Any Conflicts of Interest or Appearance of a Conflict of Interest with items on this agenda shall be declared at this time. Members with conflicts will refrain from voting and are asked to refrain from discussion on such items. Conflicts discovered later in the meeting shall be disclosed at that time.]

ITEM E, ANNOUNCEMENT OF DISCLOSURE OF CONFLICT OF INTEREST. ANY CONFLICT OF INTEREST WITH ITEMS ON THE AGENDA SHOULD BE DECLARED AT THIS TIME.

I AM DECLARING MY CONFLICT. I AM ABSTAINING FROM REGULAR AGENDA ITEM A-12 TODAY. IS THERE ANY OTHER CONFLICTS?

[F. PUBLIC COMMENT: This section provides the public the opportunity to address the Commissioners Court on any issues within its jurisdiction. The Commissioners Court may not take formal action on any requests made during the Public Comment period which are not on the Agenda, but can refer such requests to County staff for review if appropriate.]

>>COMMISSIONER CHESNEY: NO, MA'AM.

>>JUDGE SCOTT: SO BEING, WE WILL MOVE ON TO PUBLIC COMMENT.

TWO PEOPLE SIGNED UP FOR PUBLIC COMMENT TODAY.

MARGARET DURAN. YOU ARE SIGNED UP.

YOU ARE ON ITEM NUMBER 2. DO YOU WANT TO SPEAK WHEN IT COMES UP OR ARE YOU READY TO SPEAK NOW?

THANK YOU. >> GOOD MORNING.

MY NAME IS MARGARET DURAN OF 4022 CONGRESSIONAL DRIVE HERE IN CORPUS CHRISTI. THE NUECES COUNTY APPOINTMENT TO THE PORT OF CORPUS CHRISTI IS A DECISION WITH NOT ONLY REGIONAL BUT INTERNATIONAL IMPACT. THE FORMER JUDGE CAUSED THE NOTICE TO SEEK APPLICATIONS TO BE POSTED ON DECEMBER 16 WITH A DEADLINE FOR APPLICATIONS TO BE SUBMITTED BY DECEMBER 28.

OBVIOUSLY, A VERY BUSY TIME OF THE YEAR.

AS THE NEWLY ELECTED JUDGE, PLEASE SHOW YOUR PREFERENCE FOR AN OPEN AND TRANSPARENT APPLICATION PROCESS.

I ASK THAT YOU TABLE THE AGENDA ITEM AND REOPEN APPLICATIONS FOR THIS VERY IMPORTANT POSITION. THANK YOU VERY MUCH.

>>JUDGE SCOTT: RON GRABIN. >> RON GRABIN, PRESIDENT OF THE NOTION REGIONAL ASSOCIATION AN IMHERE REPRESENTING THE COMMUNITY. I WOULD LIKE TO SPEAK TO THE ISSUE OF THE -- OF THE BREAKWATER OYSTER PROJECT.

THIS IS THE FIRST TIME, TO OUR KNOWLEDGE, THAT WE HAVE A MECHANISM IN PLACE TO HELP MITIGATE SOME OF THE DAMAGE THAT IS CREATED BY STORM AND TIDAL WAVES COMING INTO OUR BEACH AREAS. THE -- THE POINT I WANT TO BRING OUT IS THESE GRANTS ARE WRITTEN IN A SPECIFIC WAY.

AND IF THEY ARE MODIFIED TOO MUCH, WE MAY NOT BE ELIGIBLE FOR MATCHING FUNDS. SO I HAVE NOT READ THE PROPOSAL.

BUT I AM ASKING THAT YOU LOOK AT IT.

AND WITH -- WITH CLOSE EYES. AND WE DON'T -- I UNDERSTAND THAT THERE MAY BE $90 MILLION IN ADDITION OF MATCHING FUNDS, SO, PLEASE, WHEN WE LOOK AT THIS PROPOSAL, KEEP THAT IN MIND.

AND WE ARE VERY MUCH IN FAVOR OF SOME TYPE OF MITIGATION.

AND THERE HAVE BEEN ALL KIND OF SCIENCE AND I THINK YOU ARE AWARE OF ALL THAT. THE DEADLINE IS APPROACHING.

I THINK YOU ARE AWARE OF THAT AS WELL.

WE WANT TO GO ON RECORD BY SAYING THAT VERY MUCH READY TO

MOVE FORWARD ON THIS. >>JUDGE SCOTT: THANK YOU, RON.

ANYONE ELSE HERE TODAY THAT WANTS TO DO PUBLIC COMMENT?

[G. Accept the following Minutes:]

OKAY. WE WILL MOVE ON TO ITEM G, ACCEPTING THE MINUTES FROM DECEMBER 14, 2022.

YOU HAVE ALL HAD THEM IN YOUR PACKETS.

DO I HAVE A MOTION? >>COMMISSIONER CHESNEY: SO

MOVED. >> SECOND.

>>JUDGE SCOTT: A MOTION AND SECOND.

ANY DISCUSSION ON THIS? ALL IN FAVOR.

AYE. ANY OPPOSED.

THE MOTION PASSES TO ADOPT THE MINUTES FROM THE DECEMBER 14,

[H. BOARD APPOINTMENTS:]

2022 MEETING. MOVING ON TO ITEM H, BOARD APPOINTMENTS. ITEM NUMBER ONE IS NUECES COUNTY COASTAL PARKS BOARD. I WOULD LIKE TO SAY THIS.

IF YOU ARE ALL OKAY WITH THIS, I WOULD LIKE TO TABLE THIS TO -- I HAVE NOT HAD A CHANCE TO MEET WITH THESE APPLICANTS.

I TRIED TO SET UP SOME MEETINGS. THERE WAS A COUPLE AT THE LAST MINUTE I DIDN'T HAVE A CHANCE TO SEE.

I ALSO THINK BECAUSE TWO PEOPLE STEPPED DOWN -- DIDN'T FILL OUT THEIR APPLICATION THAT WERE ON THE BOARD, I THINK I WOULD BE ASKING YOU ALL IF WE COULD REOPEN THIS APPLICATION PROCESS UNTIL JANUARY 12 AND PUT IT ON OUR JANUARY 18 MEETING.

[00:10:04]

>>COMMISSIONER CHESNEY: THAT A MOTION.

>>JUDGE SCOTT: A MOTION, YES. >>COMMISSIONER CHESNEY: I SECOND

THAT. >>JUDGE SCOTT: ANY OTHER DISCUSSION ABOUT IT? ANYBODY? IF THERE IS NONE, ALL IN FAVOR, SAY AYE.

>>KARA SANDS: JUDGE SCOTT, YOU WANT TO OPEN IT UP UNTIL THE

12TH, JANUARY 12? >>JUDGE SCOTT: YES, AND PUT IT

ON THE 18TH MEETING. >>KARA SANDS: OKAY.

THANKS. >>COMMISSIONER GONZALEZ: EXTEND

IT TO THE 12TH. >>JUDGE SCOTT: YES, EXTEND IT TO THE 12TH. ITEM NUMBER 2, THE PORT OF CORPUS CHRISTI AUTHORITY. WE ARE NOW OPEN FOR A MOTION ON THE APPOINTMENT PROCESS THERE. I WOULD ALSO LIKE TO MAKE A MOTION THERE. I HAVE KNOWN THIS INDIVIDUAL FOR A LONG TIME. SHE WAS BORN AND RAISED HERE IN NUECES COUNTY. HER FAMILY HAS A LARGE LEGACY --

>>COMMISSIONER GONZALEZ: EXCUSE ME, JUDGE.

BEFORE YOU MAKE A MOTION, I WOULD LIKE TO HAVE NOMINATIONS.

>>JUDGE SCOTT: NOMINATIONS, YES. >>COMMISSIONER GONZALEZ: OF WHO

WOULD WANT TO VOTE IT. >>JUDGE SCOTT: I DIDN'T HAVE THE

PROCESS. >>COMMISSIONER GONZALEZ: I HAVE SOMEBODY I WANT TO NOMINATE TOO. IF WE HAVE NOMINATIONS AND THEN

DISCUSS OF THE NOMINATION. >>JUDGE SCOTT: I WASN'T SURE.

>>COMMISSIONER GONZALEZ: MY NOMINATION WOULD BE

BE GABI CANALES. >>COMMISSIONER CHESNEY: IF YOU WANT TO DO YOUR NOMINATION FIRST.

>>COMMISSIONER GONZALEZ: I MOVE WE NOMINATE GABI CANALES.

>>JUDGE SCOTT: A MOTION TO NOMINATE --

>>COMMISSIONER HERNANDEZ: I ALSO WOULD LIKE TO NOMINATE SOMEONE.

>>JUDGE SCOTT: MOTION ON THE FLOOR AND A SECOND TO HIS MOTION FIRST. DO WE HAVE A SECOND TO

COMMISSIONER GONZALEZ'S MOTION. >>COMMISSIONER MAREZ: POINT OF CLARIFICATION, JUDGE. I WOULD LIKE TO SEE US MAKE SURE -- OF ALL TIMES WE SHOULD HAVE HAD THAT IN PLACE FOR THIS POSITION. WE -- I MENTIONED IT BEFORE, BUT WE NEED STAFF TO BRING US A POLICY THAT WILL HELP CLARIFY OUR APPOINTMENTS. I -- I CUT MY TEETH -- I KNOW THAT COMMISSIONER CHESNEY DID WHEN WE WERE ON CITY COUNCIL.

NOMINATIONS WERE MADE ACROSS THAT ENTIRE NINE-MEMBER BODY.

SO YOU CAN POTENTIALLY HAVE NINE NAMES MENTIONED AND YOU WORK

YOUR WAY DOWN BY ROUNDS. >>JUDGE SCOTT: OH, OKAY.

>>COMMISSIONER MAREZ: I THINK THERE ARE SOME GREAT NAMES HERE AND GREAT APPLICANTS. IF WE CAN AT LEAST ALLOW FOR THEIR NAMES TO BE PUT UP AND IF THERE IS NOT A MAJORITY IN THE FIRST ROUND COULD AM TO THE SECOND ROUND, THEN LET'S REGROUP

AND DO THAT. >>COMMISSIONER GONZALEZ: I WILL RESAY MY MOTION TO GO BACK AND JUST NOMINATE PEOPLE AND THEN

SELECT FROM THOSE NOMINATIONS. >>COMMISSIONER CHESNEY: I HAVE BEEN DOING IT THE LAST THREE YEARS WITH NOMINATIONS.

IF SOMEONE WANTS TO MAKE A NOMINATION, THEY SHOULD HAVE THE OPPORTUNITY TO MAKE A NOMINATION AND BRING A POLICY -- WE HAVE DONE THIS FOR THE LAST FOUR YEARS.

>>COMMISSIONER MAREZ: I DON'T WANT TO COMPLICATE IT NOW.

>>COMMISSIONER CHESNEY: I AM JUST SAYING, THE LAST FOUR YEARS WE HAVE DONE IT AS NOMINATIONS. IF WE WANT TO CHANGE THAT, WE ALWAYS HAVE THE RIGHT TO CHANGE THAT.

BUT IF SOMEONE WANTS TO MAKE A NOMINATION, YOU NOMINATED PEOPLE THAT HAVE GOT APPOINTED SO FORTH.

I GET THIS IS A DIFFICULT DAY, BUT IF SOMEONE WANTS TO MAKE A NOMINATION, THEY OUGHT TO BE ABLE TO MAKE A NOMINATION.

SO -- >>JUDGE SCOTT: I AGREE WITH YOUR POINT. WE HAD SOME EXCELLENT CANDIDATES. EXCELLENT CANDIDATES.

>>COMMISSIONER MAREZ: NOT THE TIME.

WE SHOULD HAVE SOMETHING IN PLACE FOR FUTURE APPOINTMENTS.

>>COMMISSIONER GONZALEZ: MY NOMINATION STAYS.

>>JUDGE SCOTT: WE HAVE A MOTION AND A NOMINATION FOR FOR GABI CANALES. DO WE HAVE A SECOND.

THERE BEING NONE. >>COMMISSIONER MAREZ: MOTION TO NOM NOMINATE CATHERINE HILLIARD.

>>JUDGE SCOTT: MOTION TO NOMINATE HILLIARD.

>>COMMISSIONER GONZALEZ: MAKE A MOTION FOR DIANA GONZALEZ.

>>JUDGE SCOTT: I SECOND THAT MOTION.

ANY DISCUSSION, ALL IN FAVOR. SAY AYE.

ANY OPPOSED? >>COMMISSIONER GONZALEZ: STAY

WITH MY NOMINATION. >>JUDGE SCOTT: I UNDERSTAND.

THREE IN FAVOR. TWO OPPOSED.

TO DIANE GONZALEZ, YOU ARE THE NOMINEE FOR THE PORT COMMISSION.

THANK YOU FOR SIGNING UP. WE APPRECIATE YOUR SERVICE AND YOUR FAMILY'S LEGACY HERE IN THE COMMUNITY.

WE KNOW YOU ARE GOING TO SERVE WELL FOR THE PORT, DO WELL AND SERVE NUECES COUNTY AS WELL. SO, THANK YOU.

[00:15:03]

>>KARA SANDS: JUDGE SCOTT, SHE IS APPOINTED?

NOT NOMINATED BUT APPOINTED. >>JUDGE SCOTT: SHE IS APPOINTED, YES, SORRY. PROBABLY A LOT OF THAT TODAY.

[2. CONSENT AGENDA: The following Agenda Items are of a routine nature, and the Commissioners Court has received supporting materials for consideration. All of these Agenda Items will be passed with one vote without being discussed separately, unless a member of the Commissioners Court or the public requests that a particular Agenda Item be discussed. If so, that Agenda Item will be pulled from the Consent Agenda and discussed as part of the regular Agenda at the appropriate time. One vote will approve the remaining items on the Consent Agenda.]

>>KARA SANDS: THAT'S OKAY. I GOT YOU.

>>JUDGE SCOTT: MOVING ON TO THE CONSENT AGENDA DO WE HAVE ANY ITEMS ON THE CONSENT AGENDA THAT NEED TO BE PULLED FOR DISCU DISCUSSION?

>>COMMISSIONER CHESNEY: G. >>JUDGE SCOTT: G.

>>COMMISSIONER GONZALEZ: YOU SAID G?

>>COMMISSIONER CHESNEY: JUDGE, I BELIEVE THAT L NEEDS TO BE

TABLE. >>COMMISSIONER GONZALEZ: TABLE

IT. >>JUDGE SCOTT: TABLE L.

ANY OTHERS? >>COMMISSIONER GONZALEZ: G, COMMISSIONER. YOU SAID G?

>>JUDGE SCOTT: G. SO DO I HAVE A MOTION TO APPROVE CONSENT AGENDA ITEMS ALL -- EXCLUDING ITEMS G AND ITEM L.

DO I HAVE A MOTION. >>COMMISSIONER MAREZ: SO MOVED.

>>JUDGE SCOTT: THANK YOU. DO I HAVE A SECOND.

>>COMMISSIONER CHESNEY: SECOND. >>JUDGE SCOTT: ON THE CONSENT AGENDA EXCLUDING ITEM G AND ITEM L.

>>COMMISSIONER GONZALEZ: TO PULL -- PULL ALL THE REST OF THEM.

>>JUDGE SCOTT: YES. ALL IN FAVOR.

AYE. ANY OPPOSED?

[G. Approve application procedure for the following board(s): 1. Nueces County representative on the Corpus Christi Regional Economic Development Corporation 2. Nueces County Library Advisory Board]

WE ARE ALL UNANIMOUS. THAT PASSES.

BRENT, YOU WANT TO BRING UP ITEM G?

>>COMMISSIONER CHESNEY: JUDGE, THE NUMBER ONE, I DON'T BELIEVE -- I BELIEVE IT NEEDS TO BE TABLED INDEFINITELY UNTIL WE REVISIT THAT PROCESS SO I WILL MAKE A MOTION TO TABLE G-1 INDEFINITELY UNTIL YOU ARE READY TO BRING THAT BACK UP OR SOMEONE

ELSE WANTS TO BRING IT BACK UP. >>JUDGE SCOTT: FOR NOW SHE WILL BE SERVING AND MOVING LATER. WE HAVE A MOTION AND A SECOND TO TABLE INDEFINITELY ITEM NUMBER 1.

ALL IN FAVOR. >>COMMISSIONER CHESNEY: AYE.

>>JUDGE SCOTT: ANY OPPOSED? THE MOTION PASSES TO TABLE INDEFINITELY NUECES COUNTY REPRESENTATIVE ON REGIONAL ECONOMIC DEVELOPMENT CORPORATION.

MOVING TO ITEM NUMBER 2. NUECES COUNTY LIBRARY ADVISORY

BOARD. >>COMMISSIONER CHESNEY: JUDGE, THAT IS ANOTHER ONE WHERE -- ONE OF -- WHAT I WOULD LIKE TO DO IS BRING BACK ALL OF OUR ADVISORY BOARDS FOR THE COURT'S REVIEW AND DISCUSSION OF WHETHER OR NOT WE NEED CERTAIN ADVISORY BOARDS IN NUECES COUNTY. ONES THAT -- NOT ONES THAT ARE STATUTORY OBVIOUSLY, NOT TIRS BOARDS, NOT EDC BOARDS, BUT ONES THAT ARE ADVISORY IN NATURE AND REVIEW AND DISCUSS IF WE NEED THESE BOARDS. SO I THINK BEFORE WE OPEN THIS ONE UP AND THESE PEOPLE WILL HOLD OVER.

AND I AM NOT SAYING THEY WILL BE ON THE LIST TO NOT DO.

I AM JUST SAYING WHEN I IS A YOU IT, I THOUGHT LET'S REVIEW THE WHOLE PROCESS BEFORE WE START GOING BACK DOWN THE ROAD OF APPOINTING AND REAPPOINTING THINGS.

I WOULD LIKE TO TABLE THIS UNTIL THE FIRST MEETING IN FEBRUARY.

AND ASK THAT THE COUNTY MANAGER BRING BACK ALL THE BOARDS AS AN AGENDA ITEM FOR REVIEW TO DETERMINE -- AS AN ACTION ITEM TO DETERMINE IF THOSE ADVISORIES BOARDS ARE, IN FACT, NECESSARY FOR THE LONG HAUL. THAT IS MY MOTION TO TABLE.

>>COMMISSIONER GONZALEZ: SECOND. >>JUDGE SCOTT: A MOTION AND A SECOND. ANY OTHER DISCUSSION ON THIS.

>>COMMISSIONER MAREZ: YES, JUDGE.

I FULLY SUPPORT THIS ITEM. I JUST WANTED TO ASK FOR SOME CLARITY ON -- I AGREE. I THINK THIS IS LONG OVERDUE.

WE TRIED THIS, I THINK, FOUR YEARS AGO AND I THINK HAD A MEETING OR TWO DISCUSSION. AND WE KIND OF HAD OTHER BIGGER ISSUES COME UP BEYOND THAT, BUT I DO SUPPORT REVAMPING OR JUST REVIEWING ALL OF THESE BOARDS AND COMMISSIONS AND COMMITTEES THAT WE APPOINT TOO. IS THERE ANY WORK OR DOES THE COURT HAVE ANY DISCUSSION, JUDGE, OF HOW TO APPROACH THIS.

WHAT I RECALL THERE WAS A PRETTY HAIRY AGENDA ITEM AND TOO CAN A WHWHILE ANY WORK WE CAN DO INDIVIDUALLY WITH THE COUNTY ATTORNEY'S OFFICE OR COURT ADMINISTRATOR TO GET SOME OF THAT PREWORK DONE AT LEAST NOT COMING UP WITH GREAT IDEAS AND QUESTIONS AND THEN HAVE IT THEN. I KNOW YOUR PLATES ARE ALREADY

[00:20:03]

FULL ENOUGH, BUT IF WE ARE GOING TO DO THIS JUSTICE, MY ONLY CONCERN. IF WE HAVE A PARTICULAR GROUP THAT WE REALLY WANT TO FOCUS ON AND ANALYZE AND STUDY MORE DIRECT STAFF AND KEEP THE COURT ADMINISTRATOR WHO CAN KEEP THE FULL COURT AWARE OF IT. I REALLY DON'T.

I THINK WE COULD BE HERE A WHILE.

IF HE -- I AM IN FAVOR. NOT LIKE SOMETHING I AM STUCK ON -- JUST LIKE I WORRY THAT THAT WILL TAKE US A LONG TIME.

>>COMMISSIONER CHESNEY: JOHN, IF YOU REMEMBER WE DID THIS FOUR YEARS AGO AND ELIMINATED SOME AND MERGED SOME.

I FELT LIKE IT IS TIME TO DO THEM ALL NOW AGAIN.

SO I DON'T HAVE ANY FOCUS IF THERE IS A WAY -- DIDN'T TAKE US THAT LONG THE LAST TIME BECAUSE I THINK A LOT OF THEM WILL BE GOT TO KEEP, GOT TO KEEP, GOT TO KEEP -- SO I DON'T HAVE A FOCUS.

JUST MORE OF A GENERAL CATEGORY. I DON'T KNOW HOW -- HOW TO MAKE

IT ANY TIGHTER. >>COMMISSIONER MAREZ: I AM FINE WITH THAT. THERE MAY NOT BE ANYTHING THAT WE REALLY NEED TO FOCUS ON. I JUST WANT TO MAKE SURE THAT WE -- IF WE DO HAVE ANY HEARTBURN, ANY CONCERN ON ALL THIS, WE CAN KIND OF GET AT LEAST SOME OF THE BACKGROUND DONE.

DISCUSSIONS. NOTHING OFFICIAL OBVIOUSLY.

IF WE HAVE CONCERNS AND TELL EACH OTHER AS A COURT, LET'S DO THAT HOMEWORK AND LET'S BE PREPARED TO COME IN FOR WE AT LEAST HAVE THOSE QUESTIONS READY AND STAFF AND RESPONSES READY INSTEAD OF JUST -- I HAVE SEEN IT ON SOME ISSUES, WE COME UP WITH GREAT IDEAS, AND IT PUSHES IT BACK AGAIN.

I AGREE. SOMETHING THAT SHOULD BE DONE AT LEAST EVERY FOUR YEARS AND LET'S DEAL WITH IT.

AND BE DONE WITH IT. THAT IS MY ONLY CONCERN TO BE AS EFFICIENT AS WE CAN AND TO IT BE TIMELY WITH OUR MEETINGS AND THAT IS ONE OF OUR CONCERNS THAT WE KIND OF ENSURE THAT THAT IS WHAT HAPPENS. NO HEARTBURN.

I SUPPORT YOU FULLY ON THIS. IF WE MAYBE CAN TELL OURSELVES WE NEED TO GO TO THE COUNTY ATTORNEY OR COURT ADMINISTRATOR OR COUNTY MANAGER SO WE CAN WORK ON THAT BEFOREHAND.

>>JUDGE SCOTT: ANY OTHER COMM

COMMENTS? >>COMMISSIONER GONZALEZ: EXCUSE ME, JUDGE. I HAVE AN ITEM I WANT TO PULL.

>>JUDGE SCOTT: WE ARE ON THIS ITEM STILL.

THE ONLY THING I WANTED TO ADD COMMENTS-WISE.

GOING THROUGH THIS AND MEETING WITH THE ATTORNEY.

IT IS MY FIRST MEETING AND I ASKED KIND OF -- WHAT DO SOME OF THESE ADVISORY BOARDS REALLY DO. DO -- THEY HAVE NO AUTHORITY REALLY AND JUST KIND OF -- I WOULD LIKE A CHANCE TO MAYBE GO OVER SOME OF THIS. AND SEE WHAT --

>>COMMISSIONER GONZALEZ: SOME MORE STATUTES.

>>JUDGE SCOTT: SOME ARE STATUTORY, YES, WE NEED TO MAKE SURE HOW WE FOLLOW THE LAW AND STUFF THOSE ARE MY THOUGHTS ON IT. THERE IS A MOTION AND A SECOND TO TABLE THIS UNTIL THE FIRST MEETING IN FEBRUARY.

AND ALSO SET SOMETHING UP. DO WE HAVE TO ADD THAT TO OUR MOTION? OR DO WE JUST TABLE IT UNTIL.

>>KARA SANDS: YOU AUTHORIZED IT. >>COMMISSIONER CHESNEY: WITH

DIRECTION. >>JUDGE SCOTT: WITH DIRECTION.

TO SET UP A -- A POLICY OR INFORMATION, YES.

WE HAVE A MOTION AND A SECOND. ALL IN FAVOR, SAY AYE.

ANY OPPOSED? I THINK WE ARE UNANIMOUS.

[L. Ratify Memorandum of Understanding between Banquete ISD and Nueces County to supply temporary school resource officer from American Rescue Plan Act (ARPA) funding.]

THAT PASSED. THE MOTION PASSES.

>>COMMISSIONER GONZALEZ: TABLE NUMBER L.

WE HAD A DISCUSSION YESTERDAY. WE MET WITH COUNTY ATTORNEY.

AND THE CONSTABLE'S OFFICE. AND I THINK ITEM TO BE TABLE UNTIL THE 18TH, JEANNIE, WOULD THAT BE ENOUGH TIME.

FOR THE 18TH? >>JUDGE SCOTT: FOR TO YOU FINISH

THE CONTRACT? >> I BELIEVE SO.

>>COMMISSIONER GONZALEZ: I MOVE WE TABLE IT UNTIL THE 18TH.

>>JUDGE SCOTT: I SECOND. WE HAVE A MOTION AND A SECOND.

IS THERE ANY DISCUSSION ON THA. ALL IN FAVOR, SAY AYE.

ANY OPPOSED -- SORRY, JOHN, DIDN'T MEAN TO RUSH YOU.

THE MOTION PASSES TO TABLE UNTIL THE 18TH.

MOVING ON TO OUR REGULAR AGENDA --

[C. Authorize payment of bills - special motions list dated January 4, 2023.]

>>COMMISSIONER GONZALEZ: JUDGE, I WANTED TO TABLE 2-C.

ITEM 24. I WANTED TO ASK -- OR JU

JUAN PIMENTAL TO EXPLAIN TO US. >>JUDGE SCOTT: 2-C.

WE ALREADY VOTED ON TO PASS THE CONSENT AGENDA.

>>COMMISSIONER CHESNEY: YOU WANT TO REOPEN? MOTION TO REOPEN? WHICH ONE --

>>JUDGE SCOTT: 2-C ON THE CONSENT AGENDA.

>>COMMISSIONER CHESNEY: MOTION TO REOPEN ITEM C ON THE CONSENT AGENDA. I NEED A SECOND ON THAT MOTION.

>>COMMISSIONER HERNANDEZ: SECOND, PLEASE.

>>JUDGE SCOTT: WE HAVE A MOTION AND A SECOND.

[00:25:04]

DISCUSSION? >>COMMISSIONER HERNANDEZ: JUAN,

WILL YOU PLEASE EXPLAIN TO US. >>COMMISSIONER CHESNEY: WE NEED

TO VOTE TO REOPEN. >>JUDGE SCOTT: ALL IN FAVOR.

NO OPPOSED. EVERYBODY SAID AYE.

SO, YES, THANK YOU, JUAN. >> YES, MA'AM.

>>JUDGE SCOTT: MOTION PASSED. >> GOOD MORNING -- GOOD MORNING, JUDGE,E COMMISSIONERS. IN REGARDS TO -- BILLS SUBMITTED. AT THIS TIME, WE WENT AND REVIEWED ONE OF THE BILLS ON -- ON INVOICE NUMBER 1711007-#00-48 UNDER SECOND PAGE. WE ARE RECOMMENDING -- PUBLIC WORKS IS RECOMMENDING NOT TO PAY FOR HOURS TWO -- THREE HOURS THAT WERE SUBMITTED ON THIS INVOICE.

REMEMBER RECOMMENDING NOT TO PAY.

>>COMMISSIONER GONZALEZ: WHAT NUMBER IS THAT?

>> THE SECOND PAGE OF THE INVOICE.

AND IT IS FOR SHANE PETERSON. IT'S TWO HOURS WITH ABM AND CONTRACTORS ON MOVING. PRESIDENT'S VISIT, TWO HOURS ON THAT. AND SHANE PETERSON WALKED AND TALKED WITH JASON GREEN TO PREPARE FOR CONSTRUCTION FOR PRESIDENT. THAT WAS AN HOUR -- A TOTAL OF â–  THREE HOURS TOTAL. WE ARE RECOMMENDING NOT TO PAY

THOSE HOURS. >>COMMISSIONER MAREZ: DO WE HAVE THE COUNTY ATTORNEY'S BACKING ON THAT OR DISCRETIONARY?

>> AT THIS POINT, IF YOU PASS THAT, THEN WE WILL HEAR FROM LAN ON THEIR STANCE ON IT. AND WE WILL COME BACK TO THE

COURT. >>COMMISSIONER MAREZ: OKAY.

THERE IS AN OPPORTUNITY TO STILL COME BACK IF THERE IS ANY --

>> IF THEY PROVIDE CONTRACTUAL OBLIGATION.

>>JUDGE SCOTT: THEN WE CAN BRING IT BACK.

NO ONE SIGNED OFF ON THIS INVOICE FOR THIS AMOUNT?

OR IS THIS -- >> GO AHEAD, I AM SORRY.

NO. AT THIS TIME, WE DID SUBMIT A LETTER, BUT AFTER REVIEWING IT, JUDGE, RECOMMENDING THAT THOSE

HOURS NOT TO BE APPROVED. >>JUDGE SCOTT: AND THEY ARE

AWARE TOO. >> HE IS AWARE THAT THEY SUBMITTED -- THE DISPUTE OF THIS PAYMENT.

IT IS A PROCESS. SO I BELIEVE THAT JUAN -- CAN YOU CONFIRM YOU SUBMITTED IT WITHIN THE 20 DAYS THAT YOU

RECEIVED THE INVOICE? >> THAT'S CORRECT.

THAT'S CORRECT. >>JUDGE SCOTT: ANY OTHER DISCUSSION ON THIS? WE HAVE A MOTION AND A SECOND TO PULL THE ONE INVOICE FOR THE THREE HOURS TO NOT PAY.

>>KARA SANDS: YOU OPENED IT AND NOW YOU WILL NEED A MOTION TO

NOT -- TO TABLE -- >>JUDGE SCOTT: WE JUST OPENED IT. NOW WE NEED A MOTION TO NOT PAY

-- TO TAKE THE RECOMMENDATION. >> SO MOVED.

>> YOUR HONOR, BEFORE YOU BEGIN ON THIS, IT WOULD BE BEST TO COMPLETELY REMOVE THE ITEM 24, BECAUSE THAT IS THE ONE IN QUESTION. THEN HAVE PUBLIC WORKS RESUBMIT THE APPLICATION FOR US WITH THE CORRECT AMOUNT TO BE PAID.

AND WE WILL BRING IT BACK TO YOU ON THE 18TH.

>>JUDGE SCOTT: IS THAT YOUR WISH, COMMISSIONER HERNANDEZ TO REMOVE ITEM NUMBER 24 AND HAVE THEM RESUBMIT THE INVOICE

TOTALLY? >>COMMISSIONER HERNANDEZ: YES,

JUDGE, THAT IS MY VIEW. >>JUDGE SCOTT: I WILL SECOND THAT. ANY OTHER DISCUSSION? ALL IN FAVOR, SAY AYE. ANY OPPOSED? NONE BEING, SO THE MOTION PASSES TO REMOVE ITEM 24 AND TALK TO L.A.N. AND RESUBMIT THAT INVOICE.

>> YES, MA'AM. THANK YOU, JUDGE COMMISSIONERS.

>> YOUR HONOR, WE NEED TO MAKE A MOTION TO --

>>JUDGE SCOTT: WE ACCEPTED THEM AND OPENED IT UP JUST FOR THAT ONE. YES.

[1. Discuss and consider public application to close/discontinue/abandon a portion of West River View Drive, a designated road, pursuant to Texas Transportation Code Section 251.052.]

NOW ON OUR REGULAR AGENDA ITEMS. NUMBERA, NUMBER 1, DISCUSS AND CONSIDER PUBLIC APPLICATION TO CLOSE AND DISCONTINUE, ABANDON A PORTION OF WEST RIVER VIEW DRIVE.

I -- WE RECEIVED A PHONE CALL YESTERDAY FROM MR. HIGGINBOTHAM.

AND HE IS -- HE HAS BEEN VERY INVOLVED IN THIS.

HE IS ILL AND COULD NOT ATTEND THE MEETING AND HE ASKED IF WE COULD MOVE THIS TO THE FEBRUARY, I THINK, 18TH MEETING.

>>KARA SANDS: JANUARY OR FEBRUARY?

>>JUDGE SCOTT: OH, JANUARY 18, SORRY.

[00:30:01]

JANUARY 18. ANY -- I WILL MAKE THE MOTION.

>> SECOND. >>JUDGE SCOTT: ALL IN FAVOR.

>>COMMISSIONER CHESNEY: WHICH MEETING, JUDGE?

>>JUDGE SCOTT: JANUARY 18. >>COMMISSIONER CHESNEY: FOR A?

>>JUDGE SCOTT:A-1. >>COMMISSIONER CHESNEY: COULD WE

DO THAT IN FEBRUARY. >>JUDGE SCOTT: HE JUST CALLED -- I KNOW IT HAS BEEN UP SEVERAL TIMES AND HE ASKED FOR THAT.

BUT -- >>COMMISSIONER CHESNEY: CAN WE DO IT THE FIRST MEETING IN FEBRUARY.

WOULD THAT BE POSSIBLE? I WOULD RATHER DO THAT ONE.

BECAUSE I NEED SOME TIME TO MEET WITH STAFF ON THAT.

BECAUSE I STILL DON'T UNDERSTAND.

THIS HAS BEEN PRETTY CONTROVERSIAL AND VOTED DOWN REPEATEDLY. I NEED TO UNDERSTAND AND I AM TRYING TO GO TO AUSTIN BETWEEN NOW AND THE 18TH AND I DON'T THINK I CAN GET WITH THEM BETWEEN.

>>JUDGE SCOTT: AND I AM GONE FOR A WEEK.

I WILL CHANGE MY MOTION TO PUSH IT -- TABLE IT UNTIL THE FIRST MEETING IN FEBRUARY. I DON'T KNOW WHAT DATE THAT IS OFF THE TOP OF MY HEAD RIGHT NOW.

SO -- AND WE HAVE A SECOND STILL.

>>COMMISSIONER MAREZ: SECOND. >>JUDGE SCOTT: ALL IN FAVOR.

-- OH, I AM SORRY, DID YOU HAVE SOMETHING? OKAY. COMMISSIONER HERNANDEZ SECONDED IT. AND IT WAS UNANIMOUS VOTE.

[2. Discuss and consider approval of the Nueces County Commissioners Court Legislative Agenda for the 88th Session of the Texas Legislature.]

SO WE ARE TABLING THAT. THE NEXT ITEM ON THE AGENDA IS DISCUSS AND CONSIDER APPROVAL OF THE NUECES COUNTY COMMISSIONERS COURT LEGISLATIVE AGENDA FOR THE 88TH SESSION OF THE TEXAS LEGISLATURE. WE HAVE MR. ROMO.

HELLO. OR PATRICIA SHIPTON.

ARE Y'ALL GOING TO PRESENT SOMETHING? I KNOW WE ALL RECEIVED A COPY OF THE LEGISLATIVE AGENDA.

IF THEY ARE HERE TO DISCUSS IT, IF YOU HAVE ANY QUESTIONS OR ANYTHING YOU WOULD LIKE THEM TO GO INTO MORE DETAIL ABOUT.

SO I WILL OPEN IT UP IF YOU WANT TO --

>> WE SUBMITTED -- GOOD MORNING. >>JUDGE SCOTT: GOOD MORNING, HOW

ARE YOU. >> JUDGE AND COMMISSIONERS, WHAT YOU HAVE IN FRONT OF YOU IS A REVISED AGENDA THAT IS A LITTLE MORE STREAMLINED. WE DID PUT A LOT OF ITEMS UNDER THE CATEGORY FOR US FOR THE COURT AND US, THAT PATRICIA AND I MONITORED ON YOUR BEHALF. AS BILLS GO THROUGH THE PROCESS DIFFERENT CHANGES AND WORDING THAT HAPPENS IN DIFFERENT COMMITTEES. AFTER DISCUSSIONS, WE THOUGHT IT WOULD BE BEST TO LEAVE THOSE TO MONITOR SO WE ARE NOT LEAVING THE COURT TO SUPPORT SOMETHING OR OPPOSING SOMETHING THAT WE MAY HAVE DIFFERENCES WITH. BUT OVERALL, YOU KNOW, WE HAVE BEEN TRACKING -- I KNOW MISS SHIPTON HAS BEEN TRACKING ON BEHALF OF THE COURT OVER 100 BILLS.

YOU WANT TO SPEAK TO THAT? >> WE HAVE SEVERAL BILLS -- WE WILL START GIVING YOU REGULAR WEEKLY REPORTS OF THE BILLS WE ARE TRACKING. WITH THE HUNDRED OF BILLS THAT WE MONITOR. A LOT OF THEM WILL MOVE AND A LOT WON'T. AND HIGHLIGHT AND SNIPPETS WATCH THIS AND DON'T WATCH THIS. I THINK WE ARE IN THE CORRECT POSITION TO MONITOR THINGS UNTIL WE REALIZE WHAT HAVE ARE THE ACTUAL VEHICLES THAT WILL BE MOVING.

THIS IS A LOT OF REPORTING AND SENDING Y'ALL CONSTANT UPDATES AND WORKING WITH YOUR TEAMS TO GIVE THAT YOU INFORMATION

TIMELY. >>COMMISSIONER GONZALEZ: I --

>>COMMISSIONER CHESNEY: GO AHEAD.

>>COMMISSIONER GONZALEZ: I DIDN'T -- I NEED A NEW LIGHT.

BUT THE THING IS, THIS WHOLE THING IS SO BROAD.

YOU KNOW, WE DON'T EVEN KNOW WHAT YOU GUYS ARE DOING.

I LIKE THE FACT THAT YOU ARE GOING TO BE MONITORING BILLS AND GET TO US TO LET US KNOW WHEN THE BILLS ARE, AND WHAT WILL AFFECT US FROM THOSE BILLS, BUT AS A LOBBYIST, I THINK -- AUTOMATICALLY YOU WOULD BE DOING JUST ABOUT EVERYTHING THAT IS HERE ANYWAY. I THINK FOR US TO DIGEST WILL BE A LOT. ARE YOU GOING TO DO ALL OF THIS? I DON'T KNOW. BUT YOU PROBABLY WILL BE DOING THIS BECAUSE YOU ARE A LOBBYIST AND THERE AND WALKING AROUND.

I THINK IT IS VERY IMPORTANT, MISS SHIPTON WHAT YOU SAID TO MONITOR THE BILLS. THE BILLS ARE SOMETHING THAT WE CARE ABOUT. NOTHING THAT WE SUBMITTED THAT WE WANT TO CHANGE, THAT I KNOW OF.

UNLESS SOMEBODY -- I KNOW WE WANT TO MAKE SURE WE GET FUNDED FOR SOME COUNTY ITEMS IN HERE, RIGHT.

BUT SOME WILL GO THROUGH AND SOME WON'T GO THROUGH.

SO, YOU KNOW, WHERE SOME OF THESE ITEMS ARE, IS VERY IMPORTANT TO US -- OR TO ME, YOU KNOW, TO THE CITY.

WHO IS PUSHING IT AND WHERE IS IT GOING.

IF IT AFFECTS ONE WILDFIRE US HERE UNDER ONE CATEGORY, THEN WE KNOW WE GOT TO PUSH IT BECAUSE IT IS ON THE ROAD, RIGHT.

ON THE ROAD WHERE WE ARE SUPPOSED TO GO.

SO I THINK -- THIS IS KIND OF A LOT OF ROAD BLOCKS FOR ME TO

[00:35:05]

SAY, OKAY, WE WILL DO ALL THIS RIGHT HERE.

BECAUSE THIS IS JUST -- WHEN YOU DO ONE, YOU ARE PROBABLY DOING THREE OR FOUR OTHER ONES, RIGHT. SO I THINK THAT, FOR ME, AND I DON'T KNOW HOW WE DIVIDED THIS. DO WE SAY WE ARE GOING TO VOTE ON IN WHOLE PACKAGE HERE? OR DO WE SEPARATE? I PICKED LIKE 126 THEM THAT I WANTED.

BUT, WORK THE WHOLE THING. YOU WORK THE WHOLE THING.

UP TO THE COMMISSIONERS COURT. MY CONCERN IS MONITORING THE BILLS AND WHAT IS GOING FORWARD AND WHAT'S NOT.

SOMETHING THAT WILL AFFECT US OR NOT, MAYBE WE NEED TO WORK ON IT EARLY ENOUGH THAT WE KNOW. ANYWAY, THAT IS MY RECOMMENDATION THAT THE NEXT TIME I THINK WE NEED TO BE MORE SPECIFIC, MAYBE 15 OR 20 OF THEM WE ARE GOING TO WORK FORWARD.

ALL THE WORK WE DONE. APPRECIATE IT.

TALKED ABOUT THIS FOR MONTHS AND EASIER FOR TO YOU CALL UPON US.

I DON'T WANT TO TALK OVER ANYONE AND ANY OF THAT BECAUSE I KNOW THE COUNTY CLERK AND MISS HERNANDEZ ALSO HAS SOME INPUT, BUT I WANTED TO ASK OUR LOBBIES T TEAM. THIS SEEMS ABOUT THE SAME LENGTH, MAYBE A LITTLE BIT MORE, MAYBE A LITTLE BIT MORE DETAIL THAN TWO YEARS AGO. THIS IS THE STORM, ISN'T IT.

WE KIND OF PICK GENERAL AREAS WHERE YOU HAVE LISTED OUR TOP PRIORITIES AND BASED ON CONVERSATIONS, I AM ASSUMING YOU HAD WITH THE COURT AND I HOPE YOU HAD WITH JUDGE SCOTT, HAVE

YOU? >> YES, SIR.

>>COMMISSIONER MAREZ: ONE OF THE REASONS WE WANTED TO HOLD BACK UNTIL TODAY AND I DID SUPPORT THAT.

I FELT THAT WAS VERY IMPORTANT TO HAVE THE JUDGE'S INPUT.

I LIKE HOW THIS IS BROKEN DOWN. IT IS A LITTLE VOLUME LULL USE.

KIND OF BROAD. WE GOT TO BE BROAD BECAUSE I KNOW THE MULTIPLE BILLS, THOUSANDS.

THE THOUSANDS OF BILLS THAT ARE FILED, THERE ARE CERTAIN AREAS, CATCH WORDS TO YOU THAT WILL GET YOUR ATTENTION WHEN YOU ARE MONITORING THEM. SO I THINK THAT IS WHY YOU HAVE IT SET FOR US, THE LOCAL CONTROL, THE TAXES ISSUE, STATE FUNDING, DISASTER PREPAREDNESS, GOVERNANCE, ON AND ON AND ON.

I LIKE THE WAY THAT IS SAID. I KNOW WHAT THE COMMISSIONER GONZALEZ IS SAYING AS FAR AS HE WANTED TO PICK A FEW.

AND WE STILL HAVE A CHANCE FROM WHAT I REMEMBER.

IT BEING TWO YEARS AND YOU GOT TO REMEMBER FOUR YEARS -- FROM NOW ALSO, OR PREVIOUSLY, HOW THE SYSTEM WORKS.

BUT WE ALWAYS HAVE A CHANCE TO COME BACK AND YOU WILL HAVE A CHANCE TO COME BACK IF THERE IS SOMETHING SPECIFIC THAT WE GOT TO GET TO YOU TO GET TO OUR DELEGATION, THAT IS CORRECT?

>> THAT'S CORRECT. I WILL WARN Y'ALL THAT THE FIRST 60 DAY IS FOR FILING BILLS. WE HAVE A CUTOFF FOR ANYTHING WE WANT TO FILE PROACTIVELY, BUT WE HAVE NOT RECEIVED ANY RECOMMENDATIONS FROM THE COURT TO PROACTIVELY PURSUE LEGISLATION. THE TIRE BUYBACK PROGRAM, COMMISSIONER, YOU ARE RIGHT. THE TIRE BUY BACK AND THE SMALL BUSINESS GRANTS. BUT TO -- TO RESPOND TO YOUR EARLIER POINTS, YES, WE VISITED WITH SEVERAL DEPARTMENTS IN THE COUNTY AND WITH EACH OF Y'ALL. AND THAT IS WITH -- THIS IS A CULMINATION OF. IN ADDITION TO -- YOU ARE RIGHT, ISSUES THAT YOU HAVE SEEN EVERY SESSION THAT COME UP AND I KNOW THEY HAVE BEEN OF INTEREST TO THE COURT IN THE PAST SESSIONS.

THINGS THAT CAME, SAY, EVEN DURING SPECIAL SESSIONS LAST SUMMER IS LIKE THE BAIL BOND ISSUE THAT ALL OF A SUDDEN GOT A LOT OF ATTENTION AND IMPACTING THE COURT DIRECTLY.

WE ADDED THAT BACK IN AND KIND OF GOT OURSELVES UP TO SPEED ON THAT ISSUE. SO THAT IS WHAT IT REFLECTS.

>>COMMISSIONER MAREZ: AND JUST ONE OTHER ITEM ON -- I KNOW YOU HAD MULTIPLE CONVERSATIONS, NOT ONLY WITH US -- AND I APPRECIATE THAT. I THINK THAT IS IMPORTANT.

WHEN I THINK OF -- I LOOK AT OUR COUNTY CLERK.

SHE IS VERY PROACTIVE AND MR. KISNICK IS PROACTIVE IN AUSTIN. UP THERE MONITORING ACTIVELY ON BILLS IN FAVOR OR AGAINST THAT COULD HURT THE INTEREST OF NOT ONLY THEM BUT OF THEIR FELLOW MEMBERS THROUGHOUT THE STATE AND THE COUNTIES THAT THOSE MEMBERS SERVE.

I AM ASSUMING THAT YOU WILL WORK WITH THEM AND SUPPORT THEM WHEN

NEEDED. >> ABSOLUTELY.

>>COMMISSIONER MAREZ: OVERALL, THIS IS KIND OF A COUNTY EFFORT AND HOPE EVERYONE HAS BEEN INCLUDED TO SHARE THAT PART OF IT. BECAUSE I DO WANT TO SAY THIS IS NUECES COUNTY. AND WE AS A COURT BACK THAT,

[00:40:01]

WHATEVER IT MAY TO BE SUPPORT OR TO OPPOSE SOME OF THE VARIOUS OFFICES. ON THE TOP PRIORITY, AND I SUPPORT ALL THE REST -- OR I THINK I DO UNLESS SOMEBODY BRINGS UP GOOD CURBS. THE MONITORING LEGISLATION OF EXPANSION OF THE ELECTION OF PORT.

IS ELECTION USED IN ANOTHER DEFINITION -- DEFINITIONS HAVE MULTIPLE MEANINGS. IS THIS MEANING OF "ELECTION." DOES THIS MEANTIME FRAME OR MEANING ACTUAL ELECTED BODY?

>> THAT WAS A -- THAT WAS A RESULT OF A DISCUSSION WITH COMMISSIONER CHESNEY. AND ELECTION MEANS ELECTION,

YEAH, VOTER. >>COMMISSIONER CHESNEY: WHICH

ONE ARE YOU TALKING ABOUT. >>COMMISSIONER MAREZ: TOP

PRIORITY, SIXTH DOWN. >>COMMISSIONER CHESNEY: YEAH, I

WAS GOING TO TALK ABOUT THAT -- >>JUDGE SCOTT: HE WAS GOING TO

TALK ABOUT IT. >> I THINK IT WAS MEANT FOR

Y'ALL'S DISCUSSION. >> AND, COMMISSIONER MAREZ, ON THAT NOTE, WE VISITED WITH JOHNNY HIPP WHO IS HERE TODAY.

WE HAVE BEEN WORKING CLOSELY WITH HIM.

AS USUAL WE WILL WORK WITH THE NEIGHBORING COMMUNITIES, WITH THEIR LEGISLATIVE AGENDAS, THE CHAMBERS.

SO, YES -- AND OUR GOAL IS TO REPRESENT THE COURT, THE COUNTY AND ADVOCATE ON THAT BEHALF. ONCE YOU ACCEPT THAT WE DELETED ITEMS AND PARRED DOWN FROM PREVIOUS SESSIONS OR PREVIOUS AGENDAS THAT YOU HAVE ADOPTED AND TO YOUR POINT AND TO EVERYBODY'S POINT, COMMISSIONER GONZALEZ, ETC., THIS IS A LIVING DOCUMENT. AS THINGS CHANGE IN AUSTIN, WE MAY MOVE FROM SUPPORT, MONITOR TO OPPOSE OR SUPPORT AND COME TO YOU FOR RESOLUTION AND GUIDANCE BEFORE WE TAKE ACTION BASED ON THOSE BILLS AS THEY MOVE THROUGH THE PROCESS.

HOW THEY MAY IMPACT AND BENEFIT THE COUNTY, ETC.

AND, OF COURSE, WE WOULD LOVE TO HAVE YOU WALK THE HALLS WHEN YOU ARE IN TOWN. COMMISSIONER MAREZ, YOU INDICATED YOU WILL BE THERE FOR THE TUESDAY BREAKFAST DAYS.

AND IT IS A GOOD TIME EARLY IN THE SESSION IF ANY OF YOU ARE IN AUSTIN, NOT ONLY TO MEET WITH OUR DELEGATION WHO KNOWS YOU WELL, BUT OTHER KEY MEMBERS OF THE LEGISLATURES THAT MAY BE CHAIRING COMMITTEES, BILLS THAT MAY IMPACT NUECES COUNTY.

>>COMMISSIONER MAREZ: I ENJOYED GOING TO AUSTIN.

I SPENT MANY DAYS THERE, EVERY SESSION AND DOING THAT FOR SEVERAL SESSIONS CONSECUTIVELY. I HAVE A SPECIAL REASON TO DO THAT, BECAUSE MY DAUGHTER IS GOING TO BE INTERNING FOR ONE OF

OUR DELEGATION. >>JUDGE SCOTT: WE HAVE HEARD.

>>COMMISSIONER MAREZ: I WANT TO GO TO AUSTIN TO SEE MY FAVORITE

PERSON IN THE CAPITOL. >>JUDGE SCOTT: LOOKING FORWARD

TO WORKING WITH HER. >> I GUESS WE ARE NOT YOUR

FAVORITE PERSON. >>COMMISSIONER MAREZ: CHAIRMAN

HUNTER, SENATORS, BUT, YEAH. >>COMMISSIONER CHESNEY: ARE YOU DONE, JOHN? OKAY.

A COUPLE ON THE GOVERNANCE. SAYS MONITOR.

THAT IS ONE I PUT ON BASED ON THE CONFUSION THAT WAS HAD DURING THE EMERGENCY POWERS -- AND HOPEFULLY WE DON'T HAVE TO GO THROUGH THAT AGAIN. BUT ATTORNEY GENERAL OPINIONS THAT SPECIFICALLY DEALT WITH THINGS THAT WERE NOT ADHERED TOO. SO MY HOPE WOULD BE THIS IS MORE THAN A MONITOR AND THE COURT WILL SUPPORT MAKING IT A CODIFICATION OF THE -- WHICH IS A LAW AND EVERYBODY KNOWS THAT.

THE ATTORNEY GENERAL'S OPINION THAT SPECIFICALLY THEY CAN NOT DECLARE DISASTER ON THE SAME UNDERLYING CIRCUMSTANCES AND LACK OF ABILITY TO PAY BILLS OVER CONTINGENT FUND.

AND I DON'T THINK -- I AM NOT TRYING TO GET TOO DEEP INTO IT BECAUSE A LOT OF DIFFERENT THINGS ABOUT THE EMERGENCY POWERS THAT THE -- THAT THE -- AND I DON'T WANT TO IN ANY WAY, SHAPE OR FORM GET INTO THE GOVERNOR'S, YOU KNOW, EMERGENCY POWERS BECAUSE A DIFFERENT T THING.

NO DESIRE TO GET INTO THAT 250 COUNTY JUDGES, AND I PROMISE YOU 254 COUNTY JUDGES DID IT 254 DIFFERENT WAYS AT DIFFERENT TIMES AND MAKES IT HARD FOR -- WHEN I CONTACT THE COUNTY ATTORNEY AND SAY -- HEY, WHAT ABOUT THIS, WHAT ABOUT THAT.

THIS COUNTY DOES IT THIS WAY AND THIS COUNTY DOES IT THIS WAY.

WE GOT TO HAVE SOME CLARITY. THIS WAS AN ATTEMPT TO BABY-STEP THIS INTO FILING A BILL AND WE WOULD HAVE TO HAVE ONE OF OUR

[00:45:03]

DELEGATION BE WILLING TO TAKE THE BILL, BUT I THOUGHT THE EASIEST WAY WOULD BE TO CODIFY AN ATTORNEY GENERAL'S OPINION OF THE SITTING ATTORNEY GENERAL THAT MAYBE WOULDN'T BE TOO OFFENSIVE TO RUN. MIGHT BE, BUT AT LEAST I THOUGHT IT WAS WORTH THE TRY, BECAUSE IT WAS A MESS.

AND HOPEFULLY WE DON'T HAVE ANOTHER PANDEMIC, BUT THERE WAS -- WE JUST NEED SOME CLARITY. SO I WOULD LIKE TO CHANGE THIS TO FILING A BILL, ASSUMING WE CAN GET ONE OF OUR LEGISLATIVE DELEGATION TO DO IT AND NOT JUST MONITOR IT.

BUT TO MAKE AT THAT CLEAR THIS HAS NOTHING TO DO WITH THE GOVERNOR'S POWERS BECAUSE I AM NOT TRYING TO GET INTO THAT FIGHT BECAUSE A STINKY MESS WITH THE LEGISLATURE.

I KNOW IT. WE WILL HAVE TO WORD THIS THE RIGHT WAY AND EXPLAIN TO OUR DELEGATION ALL WE ARE TRYING TO DO IS CODIFY WHAT THE ATTORNEY GENERAL HAS ALREADY OPINED.

SO I WOULD LIKE FOR THAT TO BE NOT JUST MONITORED BUT FILING A BILL. SO -- BUT I WANTED TO -- AND I WILL TALK ABOUT THE PORT ONE IN JUST A SECOND, BUT I WANTED TO HIT ON THIS ONE FIRST. IF ANYONE HAS OBJECTION TO THAT, PLEASE LET ME KNOW, OR OTHERWISE, I WAS GOING TO MAKE A MOTION TO FILE A BILL TO DO THAT ASSUMING WE COULD GET A SPONSOR.

>>COMMISSIONER MAREZ: I WOULD SUPPORT THAT.

I THOUGHT -- WELL, IN '21, WE WERE NECK DEEP IN COVID STILL AND COVID RESPONSE. I THOUGHT THERE WERE SEVERAL BILLS THAT WERE FILED -- NOT BY NUECES COUNTY, BUT IN THE STATE OR CHOSEN NOT TO FILE ANYTHING? BECAUSE NUECES COUNTY WAS NOT THE ONLY COUNTY, FROM WHAT I REMEMBER READ IN THE MEDIA, THERE WERE CONFLICTS BETWEEN THE COURTS AND THE EMERGENCY MANAGEMENT POWERS OF THE COUNTY JUDGES THAT HAPPENED IN SEVERAL COUNTIES THROUGHOUT THE STATE. ANY BILLS AND LOOK WHAT IS DONE AND I DON'T BELIEVE ANY OF THEM PA

PASSED. >> NONE OF THEM PASSED IN PANDEMIC AND COVID RESPONSE. AND HIGHLY POLITICIZED AND DREW IN THE GOVERNOR'S POWERS. THIS IS LITTLE DIFFERENT BECAUSE WE HAVE AN AG'S OPINION. IF YOU APPROVE LEGISLATION, OUR FIRST STEP WOULD BE TO CARD NATE THROUGH THE ATTORNEY GENERAL'S OFFICE TO SEE IF WE CAN GET THEIR HELP.

IT IS HIS AG'S POSITION. SEE WHAT THEIR OPINION IS ON THE CODIFICATION WITH THAT. I WOULD THINK THEY WOULD BE HELPFUL WITH THAT, BUT WE WOULD LIKE TO START THERE.

>>COMMISSIONER MAREZ: I AM IN FAVOR OF THAT.

I WANT TO MAKE SURE WE ARE FOLLOWING BEST PRACTICES AND IF IT WORKED BEFORE AND WHAT HAVEN'T, WE DO THAT TO BE MORE

EFFICIENT. >> NONE OF THEM PASS TODAY MY KNOWLEDGE, BUT I WILL DOUBLE CHECK.

>>COMMISSIONER MAREZ: SOUNDS GO

GOOD. >>COMMISSIONER CHESNEY: MOTION THAT BE CHANGED OF THE LEGISLATIVE DELEGATION WILLING TO ACCEPT ON COUNTY JUDGES ONLY AND CODIFY THE ATTORNEY GENERAL'S OPINION IN RESPONSE TO OR IN REGARDS TO THOSE OPINIONS THAT ARE LISTED ON THIS SHEET, SORRY.

>>COMMISSIONER GONZALEZ: I SECOND THAT MOTION.

>>KARA SANDS: WHICH SHEET. ? THE UPDATED ONE? SO YOU ARE GOING TO CHANGE ONE

LINE? >>COMMISSIONER CHESNEY: CHANGE ONE WORD INSTEAD OF "MONITOR" IT IS "FILING A BILL."

>>COMMISSIONER GONZALEZ: UNDER THE GOLFER ADVANCE.

>>COMMISSIONER CHESNEY: FILE A BILL.

INSTEAD OF MONITOR TO FILE A BILL IN CLARIFICATION OF, AND THE REST IS CORRECT. JUST CHANGING ONE WORD.

>>KARA SANDS: BUT YOU ARE NOT GOING TO APPROVE THE ENTIRE ITEM YET, YOU ARE JUST GOING LINE BY LINE.

>>COMMISSIONER CHESNEY: ON THIS ONE, I AM.

THIS ONE BECAUSE I WANT TO CHANGE THE WORDING.

AT SOME POINT WE MAY DO THE WHOLE THING AND THEN I WANT TO

TALK OF THE PORT. >>KARA SANDS: OKAY.

>>COMMISSIONER CHESNEY: THE MOTION WILL BE TO FILE THE BILL FOR THE CLARIFICATION OF EMERGENCY POWERS AND THE REST WHAT IS ON THAT SENTENCE. IS THAT BETTER?

CLEARER? >>JUDGE SCOTT: WE HAVE A MOTION AND A SECOND. ANY OTHER DISCUSSION.

>>COMMISSIONER MAREZ: DISCUSSION, JUDGE.

YOU MENTIONED THE SMALL BILLS, GRANT PROGRAM AND THE TIRE BUYBACK PROGRAM. ITEMS THAT YOU KNOW TO HELP IN IMPROVING THIS THAT WE MOVE FORWARD WITH BILLS.

I WANT TO KEEP A SEPARATE LIST AND IMPORTANT TO HAVE A DOCUMENT THAT KIND OF GIVES US THESE BROAD PARAMETERS THAT WE SUPPORT. BUT I WANT TO GET SPECIFIC BECAUSE I AGREE THE 60 DAYS HAPPENS QUICK.

SOMETHING SPECIFIC THAT WE ALL AGREE TO.

AND -- >>JUDGE SCOTT: HIS MOTION IS

REALLY JUST ON THE ONE ITEM. >>COMMISSIONER MAREZ: THAT'S WHAT I AM SAYING, JUDGE. AT THAT TRISHA AND JOEL MENTIONED THE TWO OTHER ITEMS OR BILLS THAT THEY KNOW I PUSHED IN THE LAST SESSION THAT WERE UNSUCCESSFUL.

I WANT TO MAKE SURE IF WE ARE MAKING A MOTION IT INCLUDES ANY AND ALL BILLS UP TO THIS POINT. IF WE NEED TO DO THEM SEPARATE,

[00:50:05]

WE CAN DO THEM SEPARATE. BUT EFFICIENCY WHAT YOU RECOMMEND OR CLERK OR COUNTY ATTORNEY RECOMMEND.

>>JUDGE SCOTT: I THINK WE ARE GOING TO DISCUSS THESE TWO ITEMS THAT BRENT PUT ON AND SEE IF WE AGREE ON THEM AND THEN PASS THE

WHOLE AGENDA TOGETHER. >>COMMISSIONER MAREZ: THE WHOLE AGENDA INCLUDING THOSE. BUT THOSE WILL BE BILLS.

>>COMMISSIONER CHESNEY: I HAVE TO AMEND THIS.

ON HERE, I CAN'T VOTE TO PASS THE WHOLE THING UNLESS I AMEND THIS FIRST. I HAVE TO AMEND THIS FIRST

BEFORE WE PASS THE ENTIRE THING. >> COMMISSIONER MAREZ, ITEM HAVE SUPPORT. AND WE WILL WORK ON THAT AND ONCE APPROVED, WE WILL MOVE FORWARD.

>>JUDGE SCOTT: COMMISSIONER GONZALEZ, YOU HAVE SOME

COMMENTS. >>COMMISSIONER GONZALEZ: WE APPROVED THE WHOLE ITEMS. GO AHEAD AND DO YOURS FIRST.

>>JUDGE SCOTT: WE HAVE A MOTION AND A SECOND TO JUST CHANGE THE WORDING ON THE "MONITOR" OF CLARIFICATION OF EMERGENCY POWERS TO A BILL. ALL IN FAVOR, PLEASE SAY AYE.

OPPOSED? THEN IT IS UNANIMOUS.

THE MOTION PASSES. WE CAN MOVE ON TO YOUR OTHERS, BRENT, FIRST, BEFORE COMMISSIONER GONZALEZ WANTS TO WAIT UNTIL YOUR TWO ARE FINISHED.

>>COMMISSIONER CHESNEY: SO I -- THIS WAS ONE WHERE -- I GET IT IS CONTROVERSIAL. AND I GET IT MAY OR MAY NOT PASS THIS COURT. MAY OR MAY NOT GET A SPONSOR.

IT MAY OR MAY NOT, WHATEVER. THE PORT OF CORPUS CHRISTI IN MY OPINION -- THAT DOES NOT MEAN THAT I AM STILL NOT GOING TO TRY. THE NUECES PORT OF CORPUS CHRISTI, IN MY REASON, SHOULD BE -- THE PUBLIC SHOULD BE MORE INVOLVED. HAVING A MULTI, MULTI, MULTIMILLION DOLLAR QUASI GOVERNMENTAL ENTITY AND UNDERSTAND THAT THE PORT COULD BE A TAXING ENTITY.

THEY HAVE THAT ABILITY. THEY DON'T CHOOSE TO DO SO AT THIS TIME BUT THEY DO. I THINK THAT SHOULD HAVE MORE INPUT FROM THE PEOPLE. I THINK THE PEOPLE SHOULD HAVE MORE OF THE SAY. I DON'T BELIEVE THAT THAT PARTICULAR BOARD SHOULD BE APPOINTED.

IT IS EXTREMELY DIFFICULT. NOT THAT DIFFICULT IS BAD, BUT IT IS DIFFICULT FOR -- FOR 14 PEOPLE, MEANING THE IN ST. PAT.

NINE PEOPLE HERE AND NINE PEOPLE IN CITY COUNCIL AND HOW MANY IN SAINT PAT, WHO ARE APPOINTING THE PEOPLE WHO ARE RUNNING A MULTI, MULTI, MULTI, MULTIMILLION DOLLAR QUASI PUBLIC ENTITY. DIFFERENT PORTS TO DO IT DIFFERENT WAYS. SOME ELECT.

SOME APPOINT. ONE IN TEXAS -- I CAN'T REMEMBER WHICH IS WHICH, ONE APPOINTS AND ONE ELECTS.

BROWNSVILLE ELECTS OR HOUSTON APPOINTS.

OR THE OTHER WAY AROUND. IS THAT RIGHT? IT COULD GO EITHER WAY. WITH APPOINTMENTS, THERE ARE TIMES WHERE THE BEST PEOPLE GET APPOINTED.

AND THERE ARE TIMES WHERE THE MOST INFLUENTIAL PEOPLE GET APPOINTED. AND THAT IS NOT WHAT I THINK IS BEST FOR THIS COMMUNITY OR OUR PORT COMMISSION.

THAT -- WHAT WE JUST DID THIS MORNING WAS DISCUSSING TO HAVE TO DO. ALL THREE OF THOSE WERE GREAT CANDIDATES. THE FOURTH -- THE FOURTH DIDN'T EVEN GET BROUGHT UP. HE IS A GREAT CANDIDATE.

FOR FIVE PEOPLE TO DECIDE THREE PEOPLE WHO RUN A MULTI-- I DON'T THINK THAT IS THE WAY IT OUGHT TO BE.

I THINK THE PEOPLE SHOULD DECIDE.

THEY SHOULD BE ELECTED AND HELD ACCOUNTABLE TO THE PUBLIC.

IT'S HARD -- IT IS HARD TO DO WHAT WE JUST DID PICKING BETWEEN THREE OUTSTANDING CANDIDATES. WE ARE PAID TO DO THAT.

I GET IT. WE ARE ELECTED TO DO THAT.

I GET IT. I AM NOT TRYING TO SHIRK RESPONSIBILITIES, BUT I BELIEVE THIS SHOULD BE DECIDED BY THE PEOPLE OF THE ENTITY IT SERVES. THIS SHOULD BE DECIDED BY THE PEOPLE OF SAN PATRICIA COUNTY AND THE PEOPLE OF CORPUS CHRISTI. AND NOT ELECTED BODIES.

AGAIN, I GET IT IS A LITTLE CONTROVERSY.

I GET IT IS DIFFICULT, BUT I ALSO BELIEVE STRONGLY THIS IS WHAT WE OUGHT TO DO. IF IT IS NOT VOTED.

I WILL START THE YEAR NOT. CIVIL DISCOURSE -- I AM THRILLED TO HAVE CIVIL DISCOURSE AGAIN AND EMPHASIZING THE WORD "CIVIL" I GET TO FINISH MY WHOLE STATEMENT WITHOUT BEING INTERRUPTED IS A NEW DAY. I THINK THIS IS IMPORTANT.

AND I WOULD LIKE TO HEAR OTHER'S INPUT ON IT.

AND I RESPECT EVERYBODY'S INPUT. IF IT DOESN'T GO ANYWHERE AND DOESN'T GET A SECOND, I CAN LIVE WITH THAT.

I HOPE EVERYONE WILL REALLY THINK ABOUT THIS.

THIS SHOULDN'T BE ABOUT US NOT BEING WILLING TO GIVE UP POWER.

BECAUSE IT IS POWERFUL. NO QUESTION.

[00:55:03]

TO BE ABLE TO APPOINT PORT COMMISSIONS IS POWERFUL.

SHOULDN'T BEEN THAT. I DON'T THINK IT WILL BE THAT WAY AT ALL BUT SHOULDN'T BE. IT SHOULD BE WHAT IS BEST FOR OUR COMMUNITY. HOW CAN WE BE MORE ACCOUNTABLE TO OUR PUBLIC. ACCOUNTABLE TO THE PEOPLE WE SERVE AND THIS IS A BIG STEP IN THIS AND I THINK WE OUGHT TO PUT A BILL FORWARD AND WE WILL MAKE A MOTION FOR DISCUSSION TO SUPPORT ELECTING PORT COMMISSIONERS.

>>JUDGE SCOTT: MOTION FOR DISCUSSION.

>>COMMISSIONER CHESNEY: THE MOTION IS TO PUT ON THE AGENDA, AGAIN, THE WORDS HERE WERE -- I GOT TO FIND IT.

HOLD ON. SHOOT.

WHERE WAS -- >>COMMISSIONER GONZALEZ:

ELECTION OF PORT -- >>COMMISSIONER CHESNEY: SHOULD TO BE FILE LEGISLATION INSTEAD OF MONITOR LEGISLATION.

THE MOTION WILL BE TO FILE LEGISLATION WITH EXPANSION OF THE ELECTION OF THE PORT OF CORPUS CHRISTI COMMISSIONERS.

>>JUDGE SCOTT: WE HAVE A MOTION AND A SECOND.

DO WE HAVE ANY DISCUSSION? ANYONE ELSE.

>>COMMISSIONER MAREZ: I -- >>JUDGE SCOTT: I WOULD LIKE TO DISCUSS WHEN YOU GET THROUGH TOO.

>>COMMISSIONER MAREZ: I THINK THIS IS AN EXCELLENT ISSUE TO HAVE DISCUSSION ON. AND I WOULD LOVE FOR US TO INCLUDE THE PUBLIC, I AGREE. FOR AN ITEM THAT WE ARE GOING TO ADVOCATE THAT THIS GIVES THE PUBLIC MORE INPUT THAT THE PUBLIC IS ALLOWED TO HAVE A SAY. SO IF WE CAN SEPARATE THAT, KEEP THE LANGUAGE AS IS. APPROVE THAT TODAY AND MAYBE AT THE NEXT MEETING IMMEDIATELY BRING UP FOR DISCUSSION SO THE PUBLIC KNOWS EXACTLY ON THAT ONE.

BECAUSE THAT ONE -- THAT ONE IS CONTROVERSIAL.

I THINK AT THE END, THE PUBLIC WILL SAY THEY WANT TO VOTE AND HAVE A SAY IN IT. I HAVE NO PROBLEM WITH THAT.

I WILL SUPPORT THAT. JUST AS LONG AS WE ARE NOT MAKING THE MOTION TODAY TO MAKE IT PART OF OUR AGENDA TODAY BECAUSE THAT IS SHORT NOTICE, UNLESS THAT WAS PUT OUT IN THE MEDIA OR IN ANY ANNOUNCEMENT. THAT IS NOT SOMETHING THE PUBLIC IS EVEN AWARE OF THAT WE ARE WANTING TO TACKLE SHORT OF IT BEING A MOTION TODAY. THAT WOULD BE MY ONLY CONCERN THAT WE CAN BRING IT BACK IN THE NEXT MEETING.

I WANT IT DONE EFFICIENTLY. IF WE CAN DO THAT, THEN GREAT.

>>JUDGE SCOTT: I HAVE COMMENTS ON THAT TOO, REAL QUICK.

WHILE I AGREE AND I SUPPORT THIS, I ALSO, BEING A FORMER LEGISLATOR AS WELL, UNLESS THE CITY AND THE PORT IS ALL AGREEMENT OF THIS. IT WILL NOT PASS.

THIS IS BASICALLY A FORMALITY TO GET THE DISCUSSION GOING.

I DON'T SEE ANYTHING WHAT'S HAPPENING THIS IN THE NEAR FUTURE OR ANYTHING, BUT I AGREE WITH THE PROCESS.

I AGREE THAT IT IS TOO IMPORTANT TO -- TO JUST LEAVE UP TO US.

I THINK THE VOTERS SHOULD HAVE A SAY IN IT.

SO I AM NOT OPPOSED TO PUTTING IT ON HERE.

BUT I THINK IT IS HIGHLY UNLIKELY THAT IT WILL PASS THIS TIME. I THINK IT JUST GETS THE DISCUSSION STARTED. I ALSO WANT TO LET YOU KNOW AS A FORMER LEGISLATOR AS WELL. I STILL HAVE FRIENDS THERE.

I DO INTEND TO BE IN AUSTIN JUST AS MUCH AS KARA AND KE KEVIN KESNICK. I WANT TO DO WHATEVER I CAN TO HELP NUECES COUNTY AND GET OUR BILLS PASS OR STOP LEGISLATION THAT WE NEED TO STOP, BUT STUFF THAT WE AGREE ON AS A COURT AND A COMMISSION MOVING FORWARD. I THINK WE DISCUSSED THAT.

I HAD A LENGTHY MEETING WITH THEM YESTERDAY ON THIS LEGISLATIVE AGENDA. RIGHT NOW WITH ANYTHING ON A LEGISLATIVE AGENDA THIS EARLY IN A PROCESS IS BASICALLY WATCHING AND MONITORING. THINGS CHANGE RIGHT NOW.

THERE IS NOT A LOT GOING ON. I KNOW YOU HAVE TO FILE.

WE DO NEED SOME OF THOSE THINGS TO GET STARTED, BUT WE ALL KNOW IN THE END AS WE ARE -- IF THESE BILLS DON'T PASS, THINGS GET TACKED ON TO OTHER BILLS SO YOU ARE WATCHING AND MONITORING.

THAT IS WHY IT IS SO VAGUE AND SO LONG RIGHT NOW.

I THINK IT WILL BE CLARIFIED AS WE GO DOWN THE ROAD.

AND ADDED TO -- IF THERE IS SOMETHING THAT COPS UP THAT WE REALLY NEED TO KNOW, THAT IS WHAT THEY ARE GETTING PAID FOR TO WATCH FOR US AND LET US KNOW AND DRAG US UP THERE WHEN WE NEED TO HIGHLIGHT SOMETHING. SO I WOULD SUPPORT THIS NOW BECAUSE I THINK THE PUBLIC WILL HAVE PLENTY OF TIME TO WEIGH IN.

THE CITY WILL HAVE TIME TO WEIGH IN.

THE PORT WILL HAVE TIME TO WEIGH IN.

I WILL TURN IT BACK OVER, BRENT. >>COMMISSIONER CHESNEY: I APPRECIATE THAT, JUJ. THERE IS A LONG PROCESS AND WE HAVE A SHORT WINDOW. IF THE CITY AND ST. PAT DON'T SIGN OFF, IT IS DEAD. I TALKED TO REPRESENTATIVE HUNTER. IF THE CITY AND ST. PAT SIGN UP ON IT. I DON'T WANT TO SPEAK FOR TODD HUNTER. BUT HE TOLD ME THE ONLY WAY THIS WILL GO IS ALL THREE ENTITIES -- WILL TAKE SOME TIME.

MY THOUGHT IS IF WE PASS THIS TODAY, WE WILL DIRECT STAFF TO

[01:00:03]

SEND THIS OVER TO THE REPRESENTATIVES AS WELL AS THE CITY OF CORPUS CHRIS CHRISTISAN PATRICIO.

A LOT OF PEOPLE -- THIS HAS TO GO THROUGH A LOT OF RINGERS REAL FAST. IF WE DELAY THIS ANOTHER TWO WEEKS, THAT WILL EAT UP ALL THE BILL FILING TIME BY THE TIME IT GETS TO ALL THOSE OTHER ENTITIES.

IF THE COURT IS INCLINED TO PASS IT TODAY KNOWING THAT -- I AGREE WITH YOU. IT HAS BEEN ON HERE FOR A LONG TIME. BUT I GET IT DIDN'T GET OUT AND HOPEFULLY MAYBE THE MEDIA IS HERE AND THEY WILL COVER IT, BUT HOPEFULLY WHAT WE CAN DO IS PASS THIS TODAY, SEND IT TO THE CITY,SAN PAT, LEGISLATIVE DELEGATION AND WHAT DO YOU THINK ABOUT THIS. IF THE BODIES VOTE IT DOWN OR BRING IT UP, IT IS NOT GOING ANYWHERE.

WE NEED TO TAKE THE FIRST STEP AND GET THE BALL ROLLING BECAUSE NOT HAVING THE PUBLIC WEIGH IN ON THE PORT, AND THE PUBLIC IS REAL INTERESTED IN THE PORT. WE ALL GET E-MAILS AND TEXTS AND HOLY COW WHY AND HOW AND -- THEY DON'T EVEN KNOW WHO THE PORT COMMISSIONERS ARE. NOT THE PORT COMMISSIONERS'

FAULT, BUT ANYWAY -- >>COMMISSIONER GONZALEZ: YOU KNOW. I SECONDED THE MOTION BECAUSE I THINK IT IS SOMETHING THAT WE NEED TO REALLY CONSIDER.

IT DOESN'T HURT. MAYBE IT WON'T GO THROUGH, BUT AT LEAST IT IS OUT THERE THAT IT HAD BEEN PUSHED AGAIN.

NEXT TIME AROUND PEOPLE NOTICE THAT IT IS MORE SERIOUS.

AND PEOPLE WHO WANT TO BE PORT COMMISSIONER HAVE TO HAVE SOME KIND OF INVESTMENT THEMSELVES EASY TO GET APPOINTED BUT WHAT DO YOU BRING TO THE TABLE WHEN GET APPOINTED.

IF YOU HAVE TO RUN FOR THAT POSITION, YOU HAVE AN.INVESTMENT. YOU HAVE AN INVESTMENT TO THE CITIZENS OF THIS COMMUNITY TO SAY I WANT TO DO A GOOD JOB AND DO WHAT IS BEST FOR THE COMMUNITY.

NOBODY APPOINTED ME HERE, SO I DON'T OWE THEM ANYTHING.

BUT ANYWAY, I THINK IT IS A GOOD IDEA TO PLANT THE SEED.

AND IF IT DON'T GO, IT DON'T GO. BUT, I FEEL THE SAME WAY ABOUT THE HOSPITAL DISTRICT. I DON'T KNOW IF IT IS PART OF THIS AGENDA HERE, BUT SHOULD BE PART OF THE AGENDA HERE.

IS THIS A PART OF THIS AGENDA HERE?

>>JUDGE SCOTT: THEIR STUFF IS IN THERE, YES.

>>COMMISSIONER GONZALEZ: THEY WILL SUPPORT IT.

I SECOND THE MOTION. TIME TO REALLY LOOK AT IT.

WHETHER IT GOES OR NOT, I THINK WE NEED TO PUT IT OUT THERE AND LET PEOPLE KNOW WHAT WE ARE THINKING THAT COULD BE POSSIBLY

HAPPENING DOWN THE ROAD. >>JUDGE SCOTT: COMMISSIONER

HERNANDEZ, YOU WANTED TO TALK? >>COMMISSIONER HERNANDEZ: YES, JUDGE. I WANTED TO TELL THE PUBLIC THAT I AGREE WITH THIS. THE PUBLIC SHOULD HAVE INPUT IN THE PORT COMMISSION, HOW IT IS RUN AND WHERE THEY WANT TO GO WITH IT. SO I AM IN FAVOR OF THIS.

LET'S GIVE THE OPPORTUNITY TO THE OTHER FOLKS, THE PUBLIC.

THANK YOU. >>JUDGE SCOTT: SO WE HAVE A MOTION AND SECOND. I THINK WE HAD DISCUSSION.

ALL IN FAVOR, SAY AYE. SO THIS MOTION ON THIS ONE ITEM ON HERE -- NOT THE WHOLE PAGE YET.

>>COMMISSIONER CHESNEY: JUST CHANGING THE WORD.

>>JUDGE SCOTT: CHANGING THE WORD TO "FILE A BILL."

>>COMMISSIONER GONZALEZ: MOVE TO PASS THE WHOLE ITEM.

>>COMMISSIONER CHESNEY: JUDGE, CAN I ALSO ADD -- CAN I ADD DIRECTION. MAKE SURE THAT STAFF IMMEDIATELY SENDS INFORMATION OVER TO TO THE ENTITIES THAT I DISCUSSED ABOUT LETTING THEM KNOW THAT WE WANT TO FILE A BILL, BUT WE WANT THEIR CONCURRENCE AND HELP AND HOPE THEY SUPPORT IT TO GET IT IN FRONT OF THE BODIES FOR A VOTE.

I WANT THAT COMMUNICATED WELL TO THEM.

I DON'T WANT THEM TO BE BLINDSIDED TO ARE THINK WE DIDN'T PULL ANYTHING. I WANT TO MAKE SURE SAN PATRICIO COUNTY THAT SUPPORTS -- THE PORT OF CORPUS CHRISTI AND LET OUR LEGISLATIVE DELEGATION KNOW THIS IS CIRCULATING AROUND, PLEASE.

WE DO HAVE A NEW SENATOR THAT REPRESENTS OUR AREA.

SO MAKE SURE SHE IS ON THE LIST. >> ONE KIND OF TECHNICAL ISSUE AS WE GO THROUGH THIS. SO EVERYBODY IS AWARE OF THE PROCESS. SHOULD EVERYBODY SIGN OFF AND THE BILL BE PURSUED TO FILE R FILE THE BILL, IT IS A LOCAL BILL AND POSTING NOTICES. SO NOT SUBJECT TO THE FILING

DEADLINE OF MID MARCH. >>COMMISSIONER CHESNEY: I

APPRECIATE THAT, THANK YOU. >> POST IT FOR 30 DAYS IN THE

NEWSWAYER. >>JUDGE SCOTT: SO THE PUBLIC

WILL GET THE NOTICE. >>COMMISSIONER CHESNEY: IF WE -- I KNOW NOBODY MAY FILE IT UNLESS SOMEBODY SIGNS OFF.

IF WE FILE IT AND SIGN OFF, HOW DOES THAT WORK.

I DON'T REMEMBER THE LOCAL POSTING RULES.

>> YOU POST NOTICE OF THE BILL'S INTEND TO FILE FOR 30 DAYS

[01:05:02]

FIRST. >>JUDGE SCOTT: IT NEEDS TO BE

DONE QUICKLY. >> I WILL ALSO ADD, COMMISSIONER, IN THE PAST -- IN THE PAST, WE HAVE SEEN OTHER MEMBERS OF THE SURROUNDING AREA DELEGATION.

SPECIFICALLY REPRESENTATIVELOZANO.

FILED BILLS ALTERING THE MAKE-UP OF THE PORT AND HOW THEY ARE ELECTED. HE MAY BE INVOLVED IN THIS WITHOUT DIRECTION FROM YOU ALL. WE HAVEN'T INVESTIGATED THAT.

PART OF OUR HOMEWORK MAY BE DONE IF THERE IS A BILL THAT WE CAN

WORK WITH -- >>COMMISSIONER CHESNEY: PUT AN

AMENDMENT ON, GOT IT. >>COMMISSIONER CHESNEY: THAT IS WHAT WE PAY TO YOU DO. Y'ALL FIGURE IT OUT.

BUT I WANT TO MAKE SURE ALL OF THEM KNOW WE ARE DOING IT.

NO SURPRISES OR CATCH THEM OFFGUARD.

LET THEM KNOW THIS IS WHAT THE COURT VOTED ON AND SEE WHERE IT G GOES.

>>JUDGE SCOTT: WE VOTED. IT PASSED.

THE MOTION PASSED. NOW DO WE HAVE A MOTION TO PASS -- SORRY, COMMISSIONER, DID YOU WANT TO SAY SOMETHING?

>>KARA SANDS: I ACTUALLY NEED TO SAY SOMETHING, IF I CAN, ABOUT THIS. SO I SPOKE TO AT LENGTH SEVERAL TIMES BOTH OF OUR LOBBYISTS. SO RIGHT NOW WE WILL HAVE TO GET NEW EQUIPMENT, AN UPDATE. THAT IS LAW.

IF WE DO NOT UPDATE OUR VOTING EQUIPMENT.

IF WE DO NOT UPDATE IT THIS PAST YEAR TO.

IF WE HAVE, WE WILL GET 100% REIMBURSEMENT THROUGH THE STATE.

SINCE WE DID NOT BECAUSE A TERRIBLE IDEA THAT YOU HEARD ALL THE PROBLEMS AROUND THE STATE WITH THE PAPER AUDIT TRAIL AND THE DIFFERENT COUNTIES. ALSO OUR VENDOR JUST COULDN'T MAKE IT EVEN IF WE PUSH IT WE WOULDN'T BE ABLE TO UPDATE THE NEW EQUIPMENT. BECAUSE OF THAT WE ARE NOW ON THE HOOK TO PAY 50%. ONLY GOING TO GET REIMBURSED 50%. I TALKED TO PATRICIA AND JOEL ABOUT IT AND THOUGHT -- I MAY HAVE MISSED IT.

BUT I THOUGHT IT WOULD BE PURSUING LEGISLATION TO PERHAPS CHANGE RIGHT NOW TO LET US GET 100% REIMBURSEMENT FOR THE COUN COUNTIES.

>> WE SHOULD HAVE HAD THAT ON THERE.

>>KARA SANDS: THAT IS A BIG DEAL.

THAT WE CAN GET THE 100% REBURRSMENT FOR THE ELECTION

EQUIPMENT. >>COMMISSIONER CHESNEY: COIN A MOTION FOR US TO GET IT. I AM HAPPY TO MAKE IT, JUST TELL

ME -- >>KARA SANDS: JUST REIMBURSEMENT. IF YOU WANT -- WHATEVER THE

COUNTY CLERK WANTS. >>COMMISSIONER GONZALEZ: 100%

REIMBURSEMENT. >>KARA SANDS: I AM KIDDING -- 100% REIMBURSEMENT FOR THE NEW EQUIPMENT.

I JUST THOUGHT -- IT WASN'T ON THERE.

>> YES, MA'AM, WE WILL PUT IT ON THERE.

>>JUDGE SCOTT: YOU ARE MAKING THE MOTION.

CAN WE HAVE A SECOND TO ADD IT ON TO THE LIST.

ANY OTHER DISCUSSION? ANY QUESTIONS? ALL IN FAVOR, SAY AYE. ANY OPPOSED? THE MOTION PASSES TO ADD THIS TO OUR LEGISLATIVE LIST.

NOW IT LOOKS LIKE THE NEXT THING WE ARE POSSIBLY GOING TO DO, IF -- IS TO MAKE A MOTION TO PASS THIS LEGISLATIVE PACKET FOR THEM

TO MONITOR. >>COMMISSIONER GONZALEZ: SO

MOVED. >>JUDGE SCOTT: WE HAVE A MOTION

FROM COMMISSIONER GONZALEZ. >>COMMISSIONER CHESNEY: SECOND.

>>JUDGE SCOTT: WE HAVE A SECOND. ANY OTHER DISCUSSION ON THE LEGISLATIVE DIRECTION, I GUESS YOU CALL IT FOR OUR LOBBYISTS? THERE IS NO OTHER DISCUSSION. ALL IN FAVOR, SAY AYE.

ANY OPPOSED? NONE, THE MOTION PASSES FOR OUR

LEGISLATIVE DIRECTION. >> THANK YOU, Y'ALL.

>>JUDGE SCOTT: THANK YOU FOR BEING HERE.

>>COMMISSIONER GONZALEZ: IS NUMBER 3 INCLUDED IN THAT MOTION, THE HOSPITAL DISTRICT? IT IS?

>>COMMISSIONER CHESNEY: YES, ON THE BACK.

>>JUDGE SCOTT: YEAH. SO WE DON'T NEED TO INCLUDE

THAT. >>COMMISSIONER CHESNEY: WILL YOU GET ALL THE RED OUT AND -- SEND US AN UPDATED COPY THAT DOESN'T HAVE ALL THE RED IN IT. I KNOW YOU DID LAST-MINUTE CHANGES, I GET IT. BUT IF YOU CAN -- LIKE TODAY OR SOON. THANK YOU.

[3. Discuss and consider adopting a Commissioners Court Resolution supporting legislation relating to the use of a broker for the sale of real property by the Nueces County Hospital District.]

>>JUDGE SCOTT: SO DO WE NOT NEED TO DO NUMBER THREE?

>>COMMISSIONER CHESNEY: THAT IS DIFFERENT.

THAT STILL NEEDS TO BE DONE, DOESN'T IT?

>>JUDGE SCOTT: MR.HIPP, GOOD TO SEE YOU.

YOU WILL LET US KNOW WHAT TO DO. >> YES, JUDGE, CONGRATULATIONS ON YOUR FIRST MEETING. YOU ARE DOING WELL.

THIS IS WHAT THIS DOES. WE ARE ASKING FOR YOU TO APPROVE A RESOLUTION SUPPORTING THE HOSPITAL DISTRICT PURSUING LEGISLATION TO CREATE A SECOND MECHANISM TO SELL HOSPITAL

DISTRICT PROPERTY. >>COMMISSIONER CHESNEY: SO

MOVED. >>COMMISSIONER GONZALEZ: SECOND.

>>JUDGE SCOTT: ANY OTHER DISCUSSION? NONE. ALL IN FAVOR, SAY AYE.

ANY OPPOSED? THE MOTION PASSES.

THANK YOU VERY MUCH FOR BEING HERE.

I GUESS WE WILL HAVE THAT RESOLUTION READY FOR YOU ALL

NEXT MEETING. >> THANK YOU.

[4. Receive FEMA update on COVID-19 recovery from Emergency Management.]

APPRECIATE IT. >>JUDGE SCOTT: ON ITEM NUMBER A -- AGENDA ITEM NUMBER 4. RECEIVE THE FEMA UPDATE.

WE ARE TABLING THAT UNTIL THE SECOND MEETING IN FEBRUARY.

I MET WITH LOUIE YESTERDAY, AND HE WAS NOT READY TO PRESENT AT THIS TIME. HE SAID THERE WAS NOTHING CRITICAL OR PRESSING THAT BE NEEDED TO HEAR, BUT HE WOULD

LIKE FOR IT TO BE TABLED. >>COMMISSIONER CHESNEY: UNTIL

FEBRUARY? >>JUDGE SCOTT: THE SECOND MEETING IN FEBRUARY. 22ND.

>>COMMISSIONER CHESNEY: IS THAT YOUR MOTION, JUDGE?

>>JUDGE SCOTT: YES. >>COMMISSIONER CHESNEY: I WILL

SECOND. >>JUDGE SCOTT: ALL IN FAVOR, SAY

[5. Discuss and consider reduction of the CDBG-MIT grant submission of the living breakwater island project, “Rincon Breakwater Oyster Reef,” from $98,857,651.40 to $14,000,000.]

AYE. UNANIMOUS.

THE MOTION PASSES. NUMBER 5 DISCUSSION AND CONSIDER THE REDUCTION IN THE CDBG-MIT GRANT SUBMISSION OF THE BREAKWATER ISLAND PROJECT "RINCON BREAK WATER OYSTER REEF" FROM 98 MILLION TO $14 MILLION. WE HAD MEETINGS OF THIS AND HAS BEEN TABLED TWICE. I DON'T LIKE TO SAY THAT WE WANT TO DO THAT. BUT I WANT TO TABLE IT.

AND WE ARE GOING TO DO A ONE-ITEM MEETING ON JANUARY 17 WHERE WE CAN LOOK AT ALL OF THE PROJECTS THAT ARE AVAILABLE FOR US TO USE. WE CAN HAVE A WORKSHOP PLUS -- AND COME OUT AND POSSIBLY VOTE ON IT IN THE 17TH.

IF WE CAN'T GET TO THE VOTING AND DO IT ON THE 18TH.

I THINK WE WILL ADD IT TO BOTH AGENDAS.

>>COMMISSIONER CHESNEY: JUDGE, THE ONLY CONFLICT -- I WILL BE HAPPY TO DO IT BY ZOOM. I AM PLANNING TO BE IN AUSTIN THAT DAY. THAT IS THE --

>>JUDGE SCOTT: I WAS PLANNING TO BE THERE AS WELL.

BUT WE CAN'T PUT IT OFF ANY LONGER.

>>COMMISSIONER CHESNEY: I AGREE. >>COMMISSIONER MAREZ: HAS TO BE

DONE BY THE 17TH, JUDGE. >>COMMISSIONER CHESNEY: SAY

AGAIN. >>COMMISSIONER MAREZ: HAS TO BE

DONE BY THE 17TH. >>COMMISSIONER CHESNEY:

APPLICATION ON THE 21ST. >>JUDGE SCOTT: FEBRUARY 21.

>>COMMISSIONER CHESNEY: I THINK TECHNICALLY -- WHAT WE COULD DO -- I DON'T KNOW HOW HEAVY THE AGENDA IS ON THE 18TH, WE COULD MAKE IT IN THE AFTERNOON, ONE AGENDA ITEM OR SOMETHING LIKE THAT. I JUST DON'T KNOW -- WE COULD HAVE OUR REGULAR MEETING AND DEDICATE THE 18TH.

>>JUDGE SCOTT: JUST DO IT THAT WAY.

>>COMMISSIONER CHESNEY: BECAUSE I NEED THE PRESENTATION ON HOW ALL THIS MONEY WORKS. I NEED TO UNDERSTAND WHAT IS RESTRICTED. WHAT IS NOT RESTRICTED.

WHAT IS ALLOWED. IN THE MMI COME INTO PLAY.

WHO CAN GIVE IN PRESENTATION. WE NEED TO GET THIS APPLICATION IN. DUE FEBRUARY 21.

WE ARE PRETTY GOOD TIME FRAME AS LONG AS WE MAKE A DECISION ON THE 18TH AND MAYBE HAVE A LITTLE MEETING ON THE 19 POSTED JUST TO HAVE THAT AS A BACKUP IF WE DON'T DECIDE ON THE 18TH.

I AM OKAY WITH THAT. THIS IS SUPER IMPORTANT AND I DON'T UNDERSTAND HOW ALL THIS WILL WORK AND ALL THIS MONEY IS GOING TO WORK. WHO WILL MAKE THAT PRESENTATION TO US. L LIKE. WE NEED TO KNOW.

IS JUAN GOING TO BE INVOLVED. WE CAN'T SAY FROM A PRESENTATION AND NOT KNOW WHO WILL BRING AND EXPLAIN HOW ALL THIS STUFF WORKS AND ALL THE PROJECTS. I NEED SOMEBODY -- NOT JUST THIS PROJECT, BUT I AM TALK ABOUT THE WHOLE PROCESS, HOW THE MONEY

WORKS. >>JUDGE SCOTT: WHAT IS AVAILABLE TO SPEND OR WHAT IS NOT. WE HAD A MEETING WITH ICE, AND HE HAS A GREAT PROGRAM THAT HE HAS.

>>COMMISSIONER GONZALEZ: CDBG. >>JUDGE SCOTT: YES.

>>COMMISSIONER GONZALEZ: I DON'T KNOW WHY WE KEEP PUTTING THE $8

MILLION THERE. >>COMMISSIONER CHESNEY: THE TABLED ITEM. HOW IT WAS TABLED AT THE LAST

MEETING AND HOW IT WAS LISTED. >>COMMISSIONER GONZALEZ: I MEAN THAT SHOULDN'T BE ON THERE. I DON'T KNOW HOW --

>>COMMISSIONER CHESNEY: WE ARE TAKING DOWN $14 MILLION OF THIS $98 MILLION IS WHAT I UNDERSTAND.

WE DIDN'T GET $98 MILLION. >>COMMISSIONER GONZALEZ: 14 COMING OUT OF THE RESTR RESTRICTED CDBG.

>>JUDGE SCOTT: MY MOTION WOULD THEN BE FOR US TO TABLE THIS FOR

[01:15:01]

A SPECIAL MEETING IN THE AFTERNOON AFTER OUR MEETING THIS ONE ITEM WITH A PRESENTATION ON ALL THE AVAILABLE PROJECTS THAT WE CAN USE THE MONEY ON FOR THIS WHOLE ITEM, NOT JUST THE RINCON.

THE $14 MILLION, BUT THE $31 MILLION AVAILABLE TO BE USED.

>>COMMISSIONER CHESNEY: KNOWING WHO WILL TAKE -- ARE YOU GOING TO TAKE THE LEAD IN MAKING SURE THE PRESENTATION -- WE CAN'T TABLE THIS ANYMORE BUT WE NEED TO HAVE THE WHOLE PRESENTATION.

WE GOT TO SEE THE BIG PICTURE. >> CORRECT.

>>JUDGE SCOTT: JUAN AND ICE. >> THEY HAVE BEEN INVOLVED WITH THE COG PEOPLE. I CAN CONTACT THEM TO BE HERE JUST TO EXPLAIN HOW IT WORKS WITH $# 1 MILLION.

AND WHAT WE CAN DO AND WHAT IS -- BECAUSE SO MUCH RESTRICTED.

AND HALF OF THE MONEY CAN BE USED IN DIFFERENT WAYS.

WE CAN HAVE THAT. >>COMMISSIONER CHESNEY: JUAN, THAT IS WHERE I WILL NEED FOR YOU TO BE ABLE TO COME AT THAT MEETING AND SAY HERE ARE PROJECTS THAT WOULD QUALIFY.

>>JUDGE SCOTT: THAT ARE READY AS WELL.

>>COMMISSIONER CHESNEY: SHOVEL READY.

WE HAVE GOT TO DO THIS AND FINISH ON THE 18TH OR 19TH.

AND WE GOT TO DO THIS AND FINISH THIS.

GOT TO HAVE TIME TO HAVE THE APPLICATION AND GET THE MONEY, THE # 31 MILLION AND FIGURE OUT WHERE IT IS ALL GOING TO GO.

>> YES, SIR. I WILL GO AHEAD AND SET UP A MEETING WITH GRANT AND ALSO WITH NILLICE AND SIT DOWN AND PREPARE A PRESENTATION FOR THE 18TH. THE 18TH, COMMISSION PER.

>>JUDGE SCOTT: THE 18TH, A SPECIAL MEETING.

>>COMMISSIONER CHESNEY: JUST POST IT AT 1:00 AND SAY WE WILL DO THAT AT 1 P.M. AND I HOPE WE FINISH THE REST OF THE AGENDA BY THEN AND GO INTO THAT. IS THAT OKAY WITH EVERYBODY?

>>JUDGE SCOTT: FINE. YEAH.

>>COMMISSIONER CHESNEY: I AM JUST TRYING TO FIGURE OUT HOW TO

-- >>JUDGE SCOTT: SO WE HAVE A MOTION TO DO THIS. DO WE HAVE A SECOND?

>>COMMISSIONER HERNANDEZ: SECOND.

>>JUDGE SCOTT: ANY OTHER DISCUSSION? ALL IN FAVOR, SAY AYE. ANY OPPOSED, SAME SIGN.

THE MOTION PASSES TO PUT THIS ON THE 18TH AND WE WILL GET THIS SET UP WITH EVERYBODY IN THE PRESENTATION SO WE WILL BE ABLE

TO VOTE ON THIS NEXT TIME. >>COMMISSIONER CHESNEY: I THINK WE MAKE IT AS A TIME SPECIFIC AT 1:00.

>>JUDGE SCOTT: 1 P.M. >>COMMISSIONER CHESNEY:

[6. Discuss and consider allocating American Rescue Plan Act (ARPA) funds ($135,000) for a pavilion at Kiwanas Park; Discuss and consider allocating ARPA funds ($220,000) for a walking trail at Diaz Park.]

EVERYBODY WILL KNOW WHEN TO SHOW UP FOR IT AND NOT TO WASTE

ANYBODY'S TIME. >>JUDGE SCOTT: ITEM NUMBER 6, DISCUSS AND CONSIDER ALLOCATING AMERICAN RESCUE PLAN ACT, ARPA FUNDS $135 FOR A PAVILION IN KIWANIS PARK, DISCUSS AND CONSIDER ALLOCATING FUNDS $225,000 FOR A WALKING TRAIL IN DIAZ PARK. IS THIS YOURS, JOHN.

>>COMMISSIONER MAREZ: JUDGE, THIS -- I MENTIONED THIS A MONTH OR TWO AGO WHEN IT CAME UP ON THE AGENDA ONE ITEM THE KIWANAS PARK IN MY PRECINCT AND THE OTHER IN COMMISSIONER HERNANDEZ'S DISTRICT. I DON'T MIND SEPARATE THEM AND THEY CAN BE VOTED ON WITH THEIR OWN MERITS BUT AIDAI, I DON'T

KNOW IF YOU WERE READY -- >>COMMISSIONER GONZALEZ: CAN I SAY SOMETHING? I THINK THE MOST IMPORTANT THING THAT BOTH OF THOSE PARKS ARE CITY PARKS.

ONE IS ROBSTOWN AND ONE IS CORPUS CHRISTI.

AND WE CAN'T DO ANYTHING UNLESS WE HAVE A MOU WITH THEM.

>>COMMISSIONER HERNANDEZ: KIWANIS BELONGS TO THE CITY.

>>COMMISSIONER GONZALEZ: THE CITY OF CORPUS CHRISTI.

>>COMMISSIONER CHESNEY: THESE FUNDS -- THE REASON WE TABLE THESE BECAUSE THEY ARE COUNTY JUDGE FUNDS.

YOU WERE GOING TO DECIDE AND YOU WILL DECIDE WHAT YOU WANTED TO DO WITH THIS AND GET WITH THE COUNTY JUDGE.

THAT IS THE OTHER THING. I WILL SAY LET'S TABLE IT UNTIL YOU WANT TO BRING IT BACK BECAUSE --

>>COMMISSIONER GONZALEZ: UNLESS THEY AGREE WITH IT.

>>COMMISSIONER MAREZ: I WAS SAYING IF WE CAN SEPARATE IT.

>>JUDGE SCOTT: TABLE IT INDEFINITELY AND YOU CAN SEPARATE IT AND BRING IT BACK ON YOUR OWN.

>>COMMISSIONER MAREZ: I SPOKE TO MAYOR GOMEZ FROM THE CITY OF ROBSTOWN. THEY ARE IN FAVOR OF THIS PROJECT. WE HAVE A MOU WITH THEM BUT I DON'T KNOW IF IT IS SPECIFIC ENOUGH FOR US TO TAKE ANY ACTION OR HAVE TO HAVE ONE THAT JENNY CREATED SEPARATELY TO WORK WITH THEM ON THIS PARTICULAR PROJECT. THAT IS MY QUESTION.

IF WE CAN CLARIFY THAT. WE HAVE DONE THAT ON OTHER PROJECTS. SOMETHING DIFFERENT AND NEW, PERHAPS. THE SCOPE IS NOT A DOLLAR AMOUNT I CAME UP WITH, SO THAT WAS PREVIOUSLY SUGGESTED.

NOT BY ME. I ALSO WANT TO WORK DOWN THE PLACE OF THAT TO SUPPORT THEM, BUT MAYBE NOT TO THAT LEVEL.

>>COMMISSIONER HERNANDEZ: I ALSO WOULD LIKE TO GET TOGETHER WITH THE CITY OF CORPUS CHRISTI AND PROBABLY SPEAK TO THE MAYOR TO SEE HOW THEY FEEL ABOUT IT. BUT $135,000 I THINK I CAN STILL

USE IN MY PRECINCT. >>JUDGE SCOTT: I WOULD LIKE COLLAR IF I IF THIS IS COMING FROM THE NUECES COUNTY JUDGE

[01:20:02]

FUNDS. OR COMING FROM Y'ALL'S FUNDS.

>>COMMISSIONER CHESNEY: I THINK YOU WERE SURPRISED IT WAS PUT UNDER YOUR NAME BECAUSE IT WAS NUECES COUNTY JUDGE FUNDS.

>>COMMISSIONER MAREZ: SIMILAR PROJECT.

DIAZ PARK. OH, YEAH, MOVING FORWARD AND SOMETHING I WAS NOT WORKING ON. BECAUSE I WANTED TO WORK ON THE SPLASH PARK -- A SMALL ONE. NOT THE SIZE THAT COMMISSIONER GONZALEZ HAD CREATED BUT A SMALL ONE TO HELP SUPPORT THE CITY THERE. BUT THEN THERE WAS TALK OF THE DOG -- OR THE WALKING TRAIL, WHICH I SUPPORT.

BUT WE ARE DOING SIMILAR EFFORTS AT THE COUNTY PARK LESS THAN A MILE AWAY, JUDGE. SO THERE IS A LOT OF WAYS THAT WE CAN TRY TO BE MORE EFFICIENT BUT I DID WANT TO STILL SUPPORT

THE CITY OF ROBSTOWN. >>JUDGE SCOTT: WE HAD A MOTION TO TABLE -- WE WILL TABLE IT BECAUSE THEY ARE GOING TO

SEPARATE IT AND BRING IT BACK. >>COMMISSIONER GONZALEZ: FOR THE

FIRST MEETING IN FEBRUARY. >>COMMISSIONER MAREZ: SET A TIME FRAME, PLEASE. FOR MINE AT LEAST.

>>JUDGE SCOTT: WE WILL DO IT BOTH FOR DISCUSSION.

TABLE TO SEPARATE AND BRING IT BACK FOR THE FIRST MEETING IN

FEBRUARY. >>KARA SANDS: ON THE 8TH, OKAY.

>>JUDGE SCOTT: IS THAT YOUR MOTION.

I WILL SECOND IT, COMMISSIONER GONZALEZ.

ALL IN FAVOR, SAY AYE. ANY OPPOSED, SAME SIGN.

THE MOTION PASSES TO TABLE IT TO THE SECOND WEEK IN -- SECOND --

>>COMMISSIONER CHESNEY: I THOUGHT WE WERE GOING TO DO IT

INDEFINITELY. >>JUDGE SCOTT: HE WANTS TO BRING IT BACK IN FEBRUARY. HE IS GOING TO SEPARATE IT.

>>COMMISSIONER CHESNEY: IT MEANS WHENEVER YOU ARE READY.

>>COMMISSIONER MAREZ: SETTING A DATE IS GOOD TO GIVE THE JUDGE ENOUGH TIME AND MYSELF. IF WE PUSH IT --

>>COMMISSIONER CHESNEY: YOUR PROJECT, SO THAT'S FINE

HERNANDEZ THE DATE IN FEBRUARY. >>JUDGE SCOTT: 8TH.

[7. Discuss and consider allocating $600,000 to the Santa Maria Subdivision drainage issue to be funded from Pct. 4 $1.5 million ARPA allocation, and related matters.]

I DIDN'T HAVE THAT EITHER. THE MOTION PASSED.

ITEM NUMBER 7, DISCUSS AND CONSIDER ALLOCATING $600,000 TO THE SANTA MARIA SUBDIVISION. YOUR ITEM, BRENT.

>>COMMISSIONER CHESNEY: YES, MA'AM, THANK YOU.

THIS IS ONE WE TABLED ALSO BECAUSE IT WAS ARPA FUNDS.

WHAT I WOULD LIKE TO DO IS AMEND THIS BECAUSE IT SAYS DISCUSS AND CONSIDER 600,000 TO THE SANTA MARIA SUBDIVISION DRAINAGE TO BE FUNDED BY PRECINCT 4 ALLOCATIONS AND OR CDBG-MIT FUNDS.

BECAUSE WHEN WE HAVE THAT MEETING, THIS QUALIFIES FOR THAT AND I AM GOING TO USE IT FOR THAT.

BUT I DON'T KNOW. SO I WOULD JUST LIKE TO PUT IT EITHER-OR AND HAVE IT ALLOCATED SO THE PEOPLE OF SANTA MARIA KNOW THE MONEY HAS BEEN ALLOCATED AND JUAN CAN KNOW THAT IT IS ALLOCATED AND A FUNDING SOURCE AND WE CAN BRING A SHOVEL-READY PROJECT BACK. THAT IS MY MOTION.

>>JUDGE SCOTT: I WILL SECOND IT. ANY DISCUSSION ON THAT? THERE BEING NONE, ALL IN FAVOR, SAY AYE.

ANY OPPOSED, SAME SIGN NONE, THE MOTION PASSES 4-1.

COMMISSIONER GONZALEZ IS OUT OF THE ROOK --

>>COMMISSIONER CHESNEY: 4-0. JUAN, LET THEM THAT THE MONEY HAS BEEN ALLOCATED AND GET READY FOR A SHOVEL-READY PROJECT.

[8. Discuss and consider an additional $30,000 allocation to the Corpus Christi Regional Economic Development Corporation (CCREDC).]

PEYTON, IF YOU WERE LISTENING TO REACH OUT TO THEM.

>>JUDGE SCOTT: MOVING ON TO ITEM NUMBER 8, DISCUSS AND CONSIDER AN ADDITIONAL $30,000 ALLOCATION TO THE CORPUS CHRISTI REGIONAL ECONOMIC DEVELOPMENT CORPORATION.

MY UNDERSTANDING THAT WE HAVE DONE # $50,000 AND THIS IS THE REMAINDER OF THE $80,000 THAT ISLE KATED.

I AM NEW HERE, BUT CORRECT ME IF IT IS AMONG.

>>COMMISSIONER CHESNEY: COMMISSIONER MAREZ WAS FASTER THAN ME. WE MADE AN INFORMAL AGREEMENT AND HAD LEFTOVER SAVINGS FROM OUR LOBBY SAVINGS LAST YEAR.

COMMISSIONER MAREZ. COURT ALLOCATED TO THE ROBSTOWN ECONOMIC DEVELOPMENT CORPORATION AND HE GOT HIS ON BEFORE I DID.

AND THIS IS ONE-TIME $30,000 ALLOCATION TO THE CORPUS CHRISTI REGIONAL ECONOMIC DEVELOPMENT CORPORATION AS WELL.

THAT WILL BE MY MOTION. >>COMMISSIONER MAREZ: I WILL

SECOND IT, JUDGE. >>JUDGE SCOTT: A MOTION AND A SECOND. ANY OTHER DISCUSSION.

>>COMMISSIONER MAREZ: YEAH, JUDGE, I -- I THINK WE ALSO NEED TO HAVE DISCUSSION -- SINCE PATRICIA AND JOEL LEFT, THIS KIND OF PROMPTED ME. YOU KNOW, WE HAD DISCUSSIONS ON THE NCDC AND ARE WE GOING WITH THAT.

I THINK THAT IS SOMETHING THAT IS PART OF OUR LEGISLATIVE AGENDA AND MAYBE WE CAN DO IT IN A FUTURE MEETING PRETTY SOON JUST TO DECIDE WHAT IT WILL LOOK LIKE AND HOW IT WILL BE

[01:25:01]

COMPOSED. ALL OF THOSE THINGS THAT COME WITH IT. I WOULD SUGGEST THAT WE -- SINCE WE ARE TALKING ECONOMIC DEVELOPMENT RIGHT NOW AND WE KNOW THE -- THE CCRDC HAS DONE WORK SPECIFICALLY ON PROJECTS IN THE WESTERN PART OF THE COUNTY OUTSIDE THEIR PURVIEW SAND THEY DO A LOT OF WORK AND I SUPPORT THAT.

BUT IT WARRANTS THAT WE HAVE ONE BIG DISCUSSION ITEM PERHAPS ON ALL OF THE ENTITIES THAT SERVE OUR INTEREST.

ECONOMIC DEVELOPMENT AND WHO YOU THAT LOOKS AT LEAST FOR THE NEXT

YEAR OR TWO. >>COMMISSIONER CHESNEY: I PUT

THAT ON FOR JANUARY 18. >>COMMISSIONER MAREZ: PERFECT.

SOUNDS GOOD TO ME. >>JUDGE SCOTT: SO WE HAVE A MOTION AND A SECOND. ALL IN FAVOR, SAY AYE.

ANY OPPOSED, SAME SIGN. THE MOTION PASSES 4-0.

[9. Discuss and consider allocating $200,126.40 from the 2022 PPFCO (Public Property Financing Contractual Obligation) funds to purchase capital equipment for the Medical Examiner's Office. ]

COMMISSIONER GONZALEZ IS STILL OUT OF THE ROOM.

MOVING ON TO ITEM NUMBER 9, DISCUSS AND CONSIDER ALLOCATING $200,126.40 FROM THE 2022 PPFCO, PUBLIC PROPERTY FINANCING CONTRACTUAL OBLIGATION FUNDS TO PURCHASE CAPITAL EQUIPMENT FOR MEDICAL EXAMINER'S OFFICE. BRENT, I BELIEVE YOU TALKED TO THEM ABOUT THAT OR SOMETHING WE HAVE BEEN WANTING TO DO.

>>COMMISSIONER CHESNEY: YES, MA'AM.

THIS IS A CLEANUP. DALE AND I AND COMMISSIONER GONZALEZ MET WITH THE MEDICAL EXAMINER AND MR. MITCHELL, AND THIS WAS THE CLEANUP ITEM THAT WE HAD -- WHERE IS FOREST IN I KNOW HE IS HERE. WHERE WE HAD MET, AND WE JUST HADN'T GOTTEN IT ON THE AGENDA. SPEAK TO THAT, DALE, REAL QUICK?

>> BROUGHT UP MANY TIMES WHEN WE FIRST HIRED MEDICAL EXAMINER OF GETTING A EQUIPMENT AND NEVER AN OFFICIAL VOTE FOR THE COURT AND THE POSSIBILITY OF FINING FUNDS AS WE KNOW.

THE COUNTY JUST ISSUED THE 22 PFCO TO FUND THE NEW SYSTEM FOR THE COUNTY AND PART OF IT HAD TO BE RE-EVALUATED PAUSE DID NOT BE FUNDED OF IT. AND TO COVER IT AND IT HAS TO BE CAPITAL ASSISTANCE AND SOMETHING THAT WE KNOW THE MEDICAL EXAMINER HAS BEEN BROUGHT FORWARD AND DISCUSSED AND DESPERATELY NEEDED. AND THE FUNDS WERE -- THE FUNDS WERE AVAILABLE FOR THIS PARTICULAR FUNCTION IF THE COURT

SO AGREES. >>COMMISSIONER GONZALEZ: SO MOVED. FOR THE EQUIPMENT?

>> YES. >>COMMISSIONER MAREZ: SECOND.

>>JUDGE SCOTT: ANY OTHER DISCUSSION? I DON'T THINK WE NEED ANYTHING. LOOKS LIKE IT IS UNANIMOUS.

ALL IN FAVOR. SAY AYE.

ANY OPPOSED, SAME SIGN. THERE IS NONE.

THE MOTION PASSES TO USE THESE FUNDS TO PURCHASE CAPITAL

[10. Discuss and consider authorizing the County Attorney to use salary savings as a funding source for the employment benefits associated with the one-time Hospital District supplement to the CA Office.]

EQUIPMENT FOR THE MEDICAL EXAMINER'S OFFICE.

ITEM NUMBER 10, DISCUSS AND CONSIDER AUTHORIZING THE ATTORNEY GENERAL USE SALARY SAVINGS AS A FUNDING SOURCE FOR THE EMPLOYEE BENEFITS ASSOCIATED WITH THE ONE-TIME HOSPITAL DISTRICT SUPPLEMENT TO THE COUNTY ATTORNEY'S OFFICE.

>>COMMISSIONER GONZALEZ: SO MOVED.

>>COMMISSIONER CHESNEY: SECOND -- SORRY.

>>JUDGE SCOTT: ANY DISCUSSION. NONE.

ALL IN FAVOR SAY AYE. ANY OPPOSED.

SAME SIGN. NONE.

UNANIMOUS. DID YOU NEED SOMETHING?

DID WE MISS SOMETHING FOR YOU? >>COMMISSIONER GONZALEZ: NO, GOOD. GOT IT.

>>JUDGE SCOTT: YOU ARE MOVING US RIGHT ALONG.

THESE NEXT TWO ITEMS 11 AND 12 ARE AT THE END OF THE AGENDA AS WELL, SO WE WILL SKIP THEM TO GO.

I THINK WE HAVE ASKED TO PUT THEM AT THE END OF THE AGENDA IN THE FUTURE FOR EXECUTIVE SESSION.

[13. Discuss and consider next Commissioners Court meeting date, and related matters.]

MOVING ON TO NUMBER 13, DISCUSS AND CONSIDER THE NEXT COMMISSIONERS COURT MEETING AND RELATED MATTERS.

>>COMMISSIONER GONZALEZ: I WOULD LIKE TO MOVE THAT THE NEXT MEETING 8TH OF FEBRUARY 18TH OF JANUARY BUT I WANT TO MOVE THE

TIME FROM 8:30 UNTIL 9:00. >>COMMISSIONER CHESNEY: JUST

THAT MEETING. >>JUDGE SCOTT: I AGREE WITH THAT. WE NEED TO ADD ON FOR FUTURE MEETINGS A SHORT RECESS, EVEN 30 MINUTES, FOR A LUNCH BREAK WHEN OUR MEETINGS ARE GOING TO BE LONG, IF THEY ARE GOING TO BE OVER WITH BY NOON OR EVEN 1:00, THEN MAYBE WE WILL BYPASS THAT, BUT WE NEED TO HAVE A BREAK FOR LUNCH.

>>COMMISSIONER MAREZ: JUDGE, I -- I SUPPORT BEING TIME SPECIFIC. I THINK THAT HELPS THE -- THE COURT, BUT ESPECIALLY THE AUDIENCE AND OUR STAFF.

I WOULD ASK THAT -- OF COURSE, YOU ARE RUNNING THE MEETINGS, THAT PERHAPS WE CAN BE MORE EFFICIENT AND INCLUDE T THE E-SESSION DURING LUNCH. IF WE CAN HAVE THE EXECUTIVE SESSION AND HAVE THAT DURING LUNCHTIME TO HAVE THAT PRESENTED. DO A WORKING LUNCH HERE.

>>JUDGE SCOTT: NOT A BAD IDEA. >>COMMISSIONER MAREZ: WE DID THAT BEING PRECOVID AND THAT WOULD HELP US ALSO TO MOVE

ALONG. >>COMMISSIONER CHESNEY: GREAT POINT. AND ALSO IN ADDING TO THAT.

NOW THAT WE ARE GOING TO HAVE USE OF A LARGER CONFERENCE ROOM, I WOULD SUGGEST THAT WE MOVE EXECUTIVE SESSION BACK INTO

[01:30:04]

THAT, BECAUSE I CAN TELL YOU PEOPLE CAN HEAR WHAT WE DO IN HERE. AND IT HAS BEEN RELAYED TO ME REPEATEDLY. AND I THINK WE NEED TO QUIT.

>> COMMISSION, THE ONLY PROBLEM YOU HAVE IF YOU ANTICIPATE VIA ZOOM. WE DON'T HAVE A SET-UP OF ZOOM

IN THE CONFERENCE ROOM. >>COMMISSIONER CHESNEY: I GUESS WE WILL HAVE TO GET ONE. PRETTY EASY.

I CAN DO ZOOM IN MY MOUSE. >>JUDGE SCOTT: WAS IT IN THE OLDER CORE OFFICER RESIDENCE -- THEY ARE MOVING ALL THAT EQUIPMENT BACK TO THE FRONT, THE BIGGER CONFERENCE ROOM.

IT WON'T BE IN THERE. >> THEY NEVER IT SET UP FOR

ZOOM. >>COMMISSIONER CHESNEY: YOU CAN DO ZOOM ON A LAPTOP. NOT A BIG DEAL.

EASY TO FIX. THAT IS WHY WE HAVE A GREAT I.T.

DEPARTMENT. >>COMMISSIONER GONZALEZ: THE MOTION HAS TO BE ALL THAT? SO THE MOTION WOULD BE THAT WE -- THAT WE -- OF COURSE, THE NEXT MEETING WILL BE THE 18TH OF JANUARY. ALL THE MEET ALSO START AT 9:00 IN THE MORNING. AND THAT WE BREAK 30 MINUTES FOR LUNCH, BUT WE CAN HAVE OUR EXECUTIVE SESSIONS DURING THAT 30-MINUTE BREAK, BECAUSE -- OR LONGER -- NOT ENOUGH TIME -- ENOUGH TIME TO COME OUT AND GET BACK.

UNLESS TIME ALLOWS, WE WILL TAKE THE 30 MINUTES.

THAT IS MY MOTION. >>COMMISSIONER MAREZ: SECOND.

>>COMMISSIONER CHESNEY: IN THE BACK CONFERENCE ROOM.

>>JUDGE SCOTT: AND ALSO RECORDING THE EXECUTIVE.

>>COMMISSIONER CHESNEY: KARA. >>JUDGE SCOTT: WE TALKED ABOUT

THAT YESTERDAY. >>COMMISSIONER CHESNEY: I WANT

TO KEEP THE RECORDING. >>JUDGE SCOTT: KEEP THE MOTION.

>>COMMISSIONER CHESNEY: IF YOU WANT TO VOTE ON THAT -- I LIKE HAVING THAT ALL RECORDED. WE FORGET THINGS WE SAY NEXT EX-A LOT. A LOT.

>>COMMISSIONER MAREZ: JUDGE, MY -- I SUPPORT STARTING A LITTLE BIT LATER, BUT IF WE COULD KEEP THIS FLUID.

I THINK WE WILL RUN AN EFFICIENT COURT AND GET OUT IN A TIMELY MANNER ANYWAY, BUT 8:30 IS NICE IF WE STILL TO DO BE EARLY BECAUSE WHEN RAN PLAN FOR A LONGER DAY HERE IN THE OFFICE OR OUT IN THE FIELD SOMEWHERE. I DON'T MIND TESTING IT OUT.

I WILL SUPPORT THIS VOTE, BUT I ALWAYS LIKE TO DEFER BACK TO 8:30 IF WE FEEL WE HAVE SO MUCH IN THE PLATE AT THE END BEGINNING OF THE YEAR AND BEGINNING OF YOUR TERM.

IF WE CAN PROOF WE CAN GET THIS DONE QUICKLY.

>>COMMISSIONER CHESNEY: I FEEL CONFIDENT AT 9.

WE WILL BE HERE WAY EARLIER THAN USED TO BE.

>>JUDGE SCOTT: WE CAN TRY IT AND IF THERE IS A HEAVY AGENDA.

>>KARA SANDS: AS LONG AS IT IS POSTED.

>>JUDGE SCOTT: AS LONG AS IT IS POSTED.

>>COMMISSIONER MAREZ: I AM OKAY WITH IT NOW OR CONSIDER IT IN

SIX MONTHS TO ARE SO. >>COMMISSIONER GONZALEZ: CALL

FOR THE QUESTION. >>JUDGE SCOTT: A SECOND ON THAT.

A MOTION AND A SECOND. COMMISSIONER HERNANDEZ SECONDED.

ALL IN FAVOR, SAY AYE. ANY OPPOSED, SAME SIGN.

EVERYBODY IS AGREEING. UNANIMOUS DECISION.

MOTION PASSES. I HAVE A QUESTION ABOUT A FUTURE MEETING. FEBRUARY 22.

AND I DON'T KNOW IF THAT IS SOMETHING WE NEED TO BRING UP RIGHT NOW OR ANYTHING IS THE COASTAL BEND DAY AT THE CAPITOL, AND I AM NOT SURE IF WE WANT TO CONSIDER MOVING THAT OR WE DO THAT IN FEBRUARY BEFORE THAT OR WAIT THEN.

>>COMMISSIONER GONZALEZ: FEBRUARY 18 IS THE MEETING.

>>JUDGE SCOTT: JANUARY 18 IS THE NEXT MEETING AND FEBRUARY IS

COASTAL BEND. >>COMMISSIONER GONZALEZ:

FEBRUARY WAS THE 8 AND -- >> 22ND.

>>JUDGE SCOTT: THAT IS COASTAL BEND DAY.

AT THE CAPITOL. SO DO YOU WANT TO BRING IT UP IN FEBRUARY OR TALK ABOUT ANY OTHER POSSIBLE DATES? DO YOU ALL MOVE DATES AROUND? ARE WE STUCK WITH WEDNESDAY?

>>COMMISSIONER GONZALEZ: MAYBE A DAY AND GO AROUND -- WHAT IS A

GOOD DAY FOR EVERYBODY. >>.

NEXT MEETING ALSO WE CAN DISCUSS AND EVERYBODY LOOKS AT THEIR CALENDAR AND WE CAN MAKE A DECISION.

>>JUDGE SCOTT: OKAY. I WANTED PEOPLE TO BE AWARE THAT WAS AN IMPORTANT DAY IN AUSTIN FOR ANYONE WHO CAN ATTEND.

[1. Discuss and consider making a finding for the method of procurement (request for proposals) for case management software for Medical Examiner; authorize the Purchasing Agent to publish a notice; and adopt an order delegating evaluation authority to a selection committee.]

MOVING CONTINUE TO ITEM B, PURCHASING, I BELIEVE.

>> JUDGE AND COMMISSIONERS. >>JUDGE SCOTT: GOOD MORNING.

>> DISCUSSION A METHOD OF PROCUREMENT REQUEST FOR PROPOSAL FOR CASE MANAGEMENT SOFTWARE FOR THE MEDICAL EXAMINER.

PUBLISH A NOTICE AND DELEGATE AUTHORITY TO THE SELECTION COMMITTEE. THIS IS A PROJECT THAT FOREST HERE CAN SPEAK TO. AND I AM JUST GOING TO SPEAK TO THE PURCHASING ASPECT. IN ITEM IS ARPA FUNDED, SO WE ARE RECOMMENDING THAT WE BID THIS PROJECT OUT USING A RFP METHOD AND PROCEDURES. THE SELECTION COMMITTEE MEMBERSHIP ON THIS ONE IS COMMISSIONERS COURT MANAGER,

[01:35:02]

INFORMATION TECHNOLOGY, MEDICAL EXAMINER AND DIRECTOR OF OPERATIONS FOR MEDICAL EXAMINER AND I WILL TURN IT OVER TO FOREST IF YOU HAVE ANY SPECIFIC QUES

QUESTIONS. >> GOOD MORNING, JUDGE, COMMISSIONERS, FOREST MITCHELL. I AM HAPPY TO ANSWER ANY

QUESTIONS THAT YOU HAVE. >>COMMISSIONER CHESNEY: THIS IS PRETTY QUICK ONE TOO, I THINK. THE CASE MANAGEMENT SOFTWARE -- AGAIN AN AREA THAT COMMISSIONER GONZALEZ AND I MET WITH THE MEDICAL EXAMINER, MR. MITCHELL, THE CASE MANAGEMENT SOFTWARE -- WE DON'T HAVE ANY. OR IT IS NOT ANY GOOD.

I DON'T LIKE SOLE SOURCE. I EXPRESSED THIS TO THE MEDICAL EXAMINER, BUT ON THIS ONE I WENT, OKAY, LET THIS ONE GO BUT I DON'T LIKE SOLE SOURCE IN GENERAL BUT THEY DID THEIR RESEARCH. THEY WENT THROUGH AND TALKED TO MORE THAN ONE. THEY GOT PRICES FROM MORE THAN ONE. I DECENT FEEL THIS IS A TRUE SOLE SOURCE. THEY DID THEIR RESEARCH AND FOUND THE BEST ONE. THE CONTINUING AMOUNT AND WHAT THEY CAME TO THE TABLE WITH AND I APPRECIATE THEM IN DOING WE WOULD BE COMMITTING AFTER PAYING OUT OF ARPA THE INITIAL MONEY AND WE BUY SOFTWARE AND THE UPDATE, $25,000 A YEAR IF I AM NOT MISTAKEN. ARE YOU WANTING TO CORRECT ME?

>> WELL, SIR, WE ARE NOT GOING TO BE SEEKING A SOLE SOURCE RECOMMENDATION FOR THIS PROJECT. AFTER DISCUSSIONS WITH MICHAEL ROBINSON AND THE DIRECTOR OF I.T., WE SAID THAT THE BEST IS TO GO FOR REQUEST FOR PROPOSAL.

>>COMMISSIONER CHESNEY: LET ME STAY ON THE FUNDING MECHANISM PART OF IT. THAT IS NEW TO ME AS OF RIGHT THIS MINUTE. WITH WHAT WE MET BEFORE THAT YOU ALL CAME UP WITH, GOOD FOR YOU. I DON'T HAVE A PROBLEM WITH THAT. THAT MAKES ME FEEL BETTER.

WE WILL PAY IF THE COURT APPROVES THE INITIAL FUNDING AND THEY HAVE AGREED TO FREEZE A POSITION TO PAY FOR THE ONGOING MAINTENANCE COST BECAUSE THAT WAS THE ISSUE HOW TO PAY FOR THIS GOING FORWARD BECAUSE ONCE -- THE ARPA MONEY RUNS OUT.

THIS IS A VERY OUTSTANDING, I THINK, APPROACH BY THE MEDICAL EXAMINER. REALLY APPRECIATE THEM BEING A PARTNER WITH US ON THIS. AND COMING AND OFFERING SOME HELP ON OUR FINANCIAL QUANDRY. THEY WILL PUSH IF WE APPROVE IT WOULD ALLOCATE THE -- OR WHATEVER IT IS FROM ARPA.

WHATEVER IT IS FROM ARPA AND THEY WILL PAY FOR FREEZING THE POSITION FOR THE ONGOING MAINTENANCE OF THAT.

IS THAT A CORRECT WAY TO SAY IT? >> YES, COMMISSIONER.

THE COURT PREVIOUSLY AUTHORIZED $100,000 FOR CASE MANAGEMENT SOFTWARE. WHOEVER IS SELECTED FOR REQUEST FOR PROPOSAL. MANY OF THESE SOFTWARE COMPANIES A-ING COST FOR LICENSING, MAINTENANCING AND SUPPORT.

WHOEVER THAT IS, THE OFFICE IS IT READY TO UTILIZE SAVINGS FROM POSITION TO HELP POTENTIALLY FUND THAT THROUGH RECURRING

COSTS. >>COMMISSIONER GONZALEZ: SO

MOVED. >>JUDGE SCOTT: A MOTION AND A SECOND. ANY OTHER DISCUSSION? NO? ALL IN FAVOR, SAY AYE.

ANY OPPOSED. SAME SIGN.

MOTION PASSES 4-0. COMMISSIONER HERNANDEZ IS OUT OF

THE ROOM. >> JUDGE, JUST LET YOU KNOW THIS IS THE FIRST STEP IN A TRADITIONAL BIDDING PROCESS FOR THE COUNTY. THE NEXT TIME YOU SEE ME WILL BE WHEN WE COME BACK TO BRING THE SELECTIONS FROM THE RESULTS OF

THE RFP. >>JUDGE SCOTT: THANK YOU VERY MUCH. I APPRECIATE YOU BOTH BEING

[1. Approve the monthly financial report for Fiscal Year 2021-2022 Ending August 31, 2022.]

HERE. THANK YOU.

WE WILL MOVE TO ITEM C WITH THE AUDITOR.

YOU ARE ON, DALE. APPROVE THE MONTHLY FINANCIAL ROMP FOR FISCAL YEAR 2021-2022 ENDING AUGUST 31, 2022.

>> YES, YOUR HONOR. THANK YOU FOR THIS.

SORRY FOR THE DELAY OF GETTING THIS INFORMATION TO YOU BUT WE TRIED TO KEEP THIS OUT OF THE AGENDA FOR A WHILE TO SAVE SOME TIME IN NOVEMBER, DECEMBER. AND SOME OF OUR TIME WITH GETTING OUR APPROVALS FROM THE -- SOME OF DELAYS THAT ARE CAUSED. AND GO THROUGH AUGUST BALANCES AS WE SPEAK. IF WE GO TO PAGE 4 AND 5, YOU SEE OUR BALANCES FOR ALL OF OUR FUNDS.

THE ONES WE ALWAYS CHOOSE IS THE GENERAL FUND AS OF AUGUST 32,368,000. AND NORMALLY IS OUR -- OUR MONTHLY EXPENSES FROM $8 MILLION TO $10 MILLION.

IF WE CONSUME THAT, THAT WILL GET US DOWN TO $24 MILLION -- LITTLE OVER $24 MILLION FUND BALANCE AND WE BELIEVE WHEN WE GET TO SEPTEMBER, THAT MEANS WE WILL HAVE A SMALL REDUCTION IN RESOURCES WHEN THAT DOES HAPPEN. BUT WE ARE WORK ON THOSE NUMBERS AS WE TALK -- AS WE SPEAK NOW. OUR ANNUAL FINANCIAL REPORT IS DUE MARCH 31 AND TRYING TO GET THE EVALUATIONS OVER THAT.

>>COMMISSIONER GONZALEZ: ARE YOU LOOKING AT THE BOOK?

>> YES. >> IF WE GO TO PAGE 10 AND 11, THESE ARE OUR SELF-INSURANCE FUNDS.

THE ONE WE WANTED TO REALLY, REALLY SPEAK ABOUT IS ONE IN THE

[01:40:02]

-- GROUP HEALTH. NORMALLY GROUP HEALTH ARE SOME ISSUE WHERE IS WE HAVE SOME DECLINES AND STUFF, BUT $2.2 MILLION IN FUND BALANCE AND WHY THIS WAS.

WE ARE RECOVERING SOME OF OUR COSTS FROM COVID IN THE AMOUNT OF $1.7 MILLION THAT CAUSED OUR FUND BALANCE TO GO UP.

WORKING WITH THE COUNTY ATTORNEY AND THE COURT TO ESTABLISH A TRUST FUND FOR THE GROUP HEALTH. I NEED TO WORK WITH THE COUNTY ATTORNEY TO MAKE SURE WE GET THIS DONE.

IF WE DON'T DO THIS CORRECTLY AND THE TREASURY SEES WE ARE GIVING MONEY BACK TO OURSELVES. THEY TEND TO GO AGAINST THAT.

AND TRUST FUND FOR OUR GROUP HEALTH FUND AND KIND OF SEPARATE THIS FUND FROM THE REST OF THE COUNTY AND THAT SHOULD PROTECT US FROM ANY ISSUES ON THAT PARTICULAR --

>>COMMISSIONER GONZALEZ: ARE WE IN THE RED ON THAT.

>> PARDON? >>COMMISSIONER GONZALEZ: ARE WE

ON THE RED. >> POSITIVE.

$2 MILLION POSITIVE. THE OTHER ARE BECAUSE OF TIMING.

WE DO THOSE IN SEPTEMBER WITH THE TIMING ISSUES OF THE WORK MAN'S COMP. AND THOSE WILL BE POSITIVE.

GROUP HEALTH, 2.2 MILLION POSITIVE.

NORMALLY CLOSE TO BEING ZERO AND SOMETIMES IN THE DEFICIT FOR THAT FUND, BUT AT THIS TIME WE ARE NOT.

WE ARE TWO MILLION. IF ALL THE -- IF ALL THE PLAN GOES AS WE SEE FIT. GOING THROUGH THE NORMAL PROCESS, GROUP HEALTH WILL CONTINUE TO GROW AND BE SOUND IN THE FUTURE. ON PAGE 16, YOU WILL SEE OUR RENEW FOR THE GENERAL FUND. AS YOU SEE OUR REVENUE COLLECTIONS AS OF AUGUST 94.2%. WE PROBABLY WILL BRING IN AROUND 97% TO 98%. WE STILL ARE LOSING SOME MONEY BECAUSE OF LOSS OF REVENUE BECAUSE OF COVID ACTIVITIES AND SOME OF OUR -- OUR BALANCES COMING IN ARE A LITTLE BIT LOW.

GOOD NEWS IS, SOME OF OUR INTEREST HAS GONE UP.

WE WILL TALK TO. WHEN WE HAVE OUR INVESTMENT REPORTS, BUT RIGHT NOW THE INTEREST WE ARE EARNING IN TEXAS CLASS IS 4.5%. SO BUT LAST YEAR AT.1%.

IF THATS YOU A BIG DIFFERENCE. GOOD TO BEGIN WITH.

WE KIND OF GO THROUGH AND GIVE YOU A HINT OF SOME OF THE DEPARTMENTS THAT ARE -- THAT ARE A LITTLE BIT BEHIND ON SOME BALANCES, SO WE WILL GO TO PAGE 31.

FIRST ONE BUILDING REPAIRS AND BECAUSE OF SOME OF THE BENEFITS WHEN WE HAVE A CHANGE OF STAFF. SOMETIMES THE PERSON WHO LEFT HAS A SINGLE EMPLOYEE MEDICAL INSURANCE.

AND THE PERSON COMING IN HAS A FAMILY WHEN YOU DO THAT THAT I IS A SIGNIFICANT INCREASE IN COST.

SO NOT REALLY ALARMING THAT IT IS SMALL AMOUNTS FOR THAT PARTICULAR DEPARTMENT. WE ARE WORKING WITH THE DEPARTMENT ON THAT ISSUE. THE NEXT DEPARTMENT IS GOING TO BE -- ON PAGE 37. AGAIN, THIS IS PROBABLY THE SAME ISSUE ON ON IS UP SUPPLIES AND COUNTY COURT LOG TWO.

ON PAGE 39, WE HAVE -- THIS IS LITTLE BIT DIFFERENT.

YOU LOOK AT THE TOP, THE 32-50 AND 3200.

MOVE FROM 3200 TO 3250. THAT IS WHY 3250 SP DEFICIT, BUT 3500 IS SIGNIFICANT INCREASE. THEY WORK THEMSELVES OUT BUT I NEED TO REPORT THAT THAT IS WHAT IS THERE.

NEXT DEPARTMENT IS GOING TO BE ON PAGE 47.

JUST THE PRECINCT 1-2. THIS IS ISSUE ON EMPLOYEE BENEFITS. IF YOU LOOK AT EMPLOYEE BENEFITS. THIS IS WHAT IS DRIVING THAT COST. AS WELL PAGE 50, JP 4.

AGAIN, BENEFITS IS ANOTHER ISSUE.

BECAUSE THESE ARE SMALL DEPARTMENTS.

AND YOU ONLY HAVE FOUR EMPLOYEES.

THE COST RELATION FOR SALARY SAVINGS AND BENEFIT SAVINGS IS VERY SMALL WHEN YOU HAVE THOSE ISSUES.

NEXT ONE IS ON PAGE 54. CONSTABLE PRECINCT 2.

AGAIN, THESE ARE SALARIES, AS WELL AS SUPPLEMENTAL PAY.

WHEN YOU INCREASE THE -- GOING FROM DEPUTY 1, 2 AND 3, SUPPLEMENTS INCREASE, BENEFITS INCREASE.

THAT IS TO BE EXPECTED. 55 FOR CONSTABLE PRECINCT 4 IT SHALL -- I MEAN PRECINCT 3. LAST ISSUE I WANT TO TALK ABOUT ON PAGE 61. 61 IS WHERE IT GETS VERY -- WHERE -- WHAT IS REMAINING TO BE SPENT FROM THE GENERAL FUND IS 18.9 FERRARI. ONE MONTH REMAINING IN THE FISCAL YEAR WHAT THIS WILL BE 8.33% WHICH MEANS RIGHT AROUND

[01:45:04]

10% DIFFERENCE BETWEEN THAT. RIGHT NOW WE EXPECT TO BE ABOUT 89 TO 90% OF TOWER TOTAL EXPENSE IN FUNDS WHICH IS GREAT.

THAT IS WHERE WE ARE WANTING TO BE.

IF THIS GOES UP, WE WILL HAVE SOME SMALL DECREASES IN OUR FUND BALANCES IN THE GENERAL FUND AND KIND OF EXPECTED THAT LAST YEAR WHEN WE DID OUR RATE A LITTLE BIT LOWER THAN WAS NECESSARY TO RUN. THE LATEST BALANCE OF SCHEDULES AND BALANCES THAT EACH OF YOU HAVE IN YOUR PRECINCT FUNDS AND YOUR RTA FUNDS AND PROJECTS. I WILL BE GLAD TO ANSWER ANY QUESTIONS ON THE MONTHLY FINANCIAL REPORT FOR AUGUST 31.

>>JUDGE SCOTT: ANY QUESTIONS FOR DALE, ANYBODY?

>>COMMISSIONER CHESNEY: YOU NEED TO PASS IT, DALE?

>> IF YOU ARE READY WITH NO QUESTIONS, I ASK FOR IT TO BE

SUBMITTED AND APPROVED. >>COMMISSIONER CHESNEY: SO

MOVED. >>JUDGE SCOTT: WE HAVE A MOTION AND A SECOND. ALL IN FAVOR, SAY AYE.

ANY OPPOSED, SAME SIGN. MOTION PASSES FOR THE MONTHLY

[2. Approve Budget Change Order No. 05 for Fiscal Year 2022-2023.]

FINANCIAL REPORT. AND WE WANT TO MOVE ON TO NUMBER

2, DALE, THE CHANGE ORDER. >> YES, YOUR HONOR, BUDGET CHANGE OVER NUMBER 5, THERE ARE LARGE NUMBERS ON HERE.

AS WE MENTIONED REQUESTING FUNDS FOR OUR NEW SOFTWARE COMPANY, WE WENT OUT FOR THE PPSCO. AND PART OF THAT WAS INCLUDING OPERATIONS AND IMPLEMENTATION. WHEN WE GOT THE FUNDS, WE LEARNED THAT THE OPERATION IS NOT ALLOWED TO BE EXPENSED THROUGH THE PPSCO. AND WE WILL TO EXPENSE THROUGH THE OPERATION. WE MOVED SOME OF THE CAPITAL EXPENSES FROM PUBLIC WORKS INTO THE PPCSO IN THE AMOUNT OF $#00,000 AND WE ARE GOING TO PAY FOR THE OPERATIONS OF THE SOFTWARE FROM THE GENERAL FUND AND REDUCE THE TRANSFER OUT OF THE GENERAL FUND. FISCAL IMPACT FOR THE GENERAL FUND WILL BE ZERO. BUT WE NEEDED TO DO THAT FORAGE ISSUING POINT. WHEN YOU SEE A 300,000 INCREASE FOR MINE BUT PAGE 2, DECREASE OF TRANSFER FOR THE SAME $300,000.

THE OTHER LARGE ISSUE IS FOR THE GALE --

>>COMMISSIONER GONZALEZ: DALE, ALL WE ARE DOING IS SWITCHING

FROM ONE TO THE OTHER? >> YES.

>>. OTHER ISSUE THAT THE JAIL HAS A SIGNIFICANT NUMBER OF VACANCIES AND THEY HAVE TO HIRE AN OUTSIDE COMPANY TO HELP MANAGE THE -- THE PEOPLE COMING IN AND OUT OF THE JAIL AND THE SHERIFF'S OFFICE.

I THINK -- THIS IS THE IF I AM NOT MISTAKEN, THE FUNDS ARE THERE. THEY HAVE -- THEY DEFINITELY HAVE SAVINGS IN THEIR SALARY REGULAR TO COVER THE ADDITIONAL OUTSIDE COSTS. THESE ARE LARGE AMOUNTS, BUT THE FUNDS ARE THERE, AND THEY NEED IT BECAUSE OF THE NUMBER OF VACANCIES. THE OTHER TRANSFERS AND BUDGET REQUESTS ARE VERY SMALL IN OFFICE SUPPLIES AND MAINTENANCE REPAIR. MY STAFF AND I LOOKED THROUGH EACH OF THE REQUESTS. WE BELIEVE THEY ARE VALID AND JUSTIFIED. AND WE SUBMIT BUDGET CHANGE ORDER NUMBER 5 FOR YOUR ACCEPTANCE AND APPROVAL.

>>COMMISSIONER MAREZ: SO MOVED. >>JUDGE SCOTT: WE HAVE A MOTION.

DO WE HAVE A SECOND. >>COMMISSIONER HERNANDEZ:

SECOND. >>JUDGE SCOTT: A MOTION AND A SECOND. ALL IN FAVOR SAY AYE.

I SEE NO MORE QUESTIONS. ALL IN FAVOR SAY AYE.

>>COMMISSIONER CHESNEY: AYE. >>JUDGE SCOTT: OPPOSED, SAME SIGN. THE MOTION PASSES TO APPROVE THE

[3. Approve Capital Project Budget Change Order No. 115.]

CHANGE ORDER NUMBER 5. NOW IT IS YOU AGAIN.

CAPITAL PROJECT BUDGET CHANGE ORDER.

>> WORK WITH TERESA AND -- TRYING TO REALLOCATE SOME OF COSTS FOR OUR CALDERON BUILDING AND SOME OF THE OTHER BUILDINGS THAT HAVE CLOSED AND MOVED TO IMPROVEMENTS.

FOR 1901 CALDERON BUILDING. 2016 COS AND GETTING -- MOVING MONEY BACK AND FORTH BETWEEN THE ROBTOWN COMMUNITY CENTER AND ADA IMPROVEMENTS. SMALL ABOUTER BALANCES.

SAME THING FOR THE 2019. MOVING UNALLOCATED FUNDS TO THE CALDERON IMPROVEMENTS. AND LASTLY FOR OUR 2021 COS.

LITTLE BIT UNALLOCATED AND MOVING FOR THE NEW PROJECTS IS THE NUECES COUNTY STEEL WALL REPAIR AND THE COMMUNITY FACILITY BALANCES. THE REST ARE ALLOCATIONS THAT WE ARE MOVING -- THAT YOU ALL AGREED TO COVER SOME OF THESE COSTS. THE FUNDS ARE THERE.

AND WE WORK WITH TERESA ON THIS. AND THE FUNDS ARE AVAILABLE FOR THIS ABROFL. WE SUBMIT PROJECT CHANGE ORDER NUMBER 115 FOR A YOUR ACCEPTANCE.

I WILL BE GLAD TO ANSWER ANY QUESTIONS YOU MIGHT HAVE.

>>JUDGE SCOTT: I APPRECIATE THE NEW ON THE SIDE TWO HIGHLIGHTED.

DO I HAVE A MOTION TO APPROVE THE PROJECT CHANGE ORDER?

>>COMMISSIONER CHESNEY: SO MOVED.

>>COMMISSIONER GONZALEZ: I HAVE ONE QUESTION.

>> YES. >>COMMISSIONER GONZALEZ: I DID.

>>JUDGE SCOTT: WHO SECONDED? >>COMMISSIONER CHESNEY: JOHN

[01:50:01]

SECONDED IT. >>JUDGE SCOTT: JOHN SECONDED IT.

GO AHEAD. >>COMMISSIONER GONZALEZ: YOU TALK OF A PROJECT. A SPECIFIC PROJECT ON NUMBER

115? >> WHICH ONE?

>>COMMISSIONER GONZALEZ: NUMBER 3.

115. WAS THERE A PARTICULAR PROJECT

ON THAT OR WHAT? >> THESE ARE THE ONES WORKED WITH THE COMMISSIONERS AND TERESA AND AIDAI ON THIS.

WE HAVE THE BALANCES HERE. WE CAN -- I CAN REVIEW THESE AND MAKE SURE AND GET BACK TO YOU LATER ON IN THE ISSUE BUT SUBMITTED TO HER OFFICE AND OUR OFFICE TO WORK THROUGH THE BALANCES. AND THESE ARE PROJECTS THAT ARE

CURRENTLY IN EXISTENCE. >>COMMISSIONER GONZALEZ: ALL RIGHT. CAN YOU GIVE THAT TO ME LATER?

>> YES. >>COMMISSIONER GONZALEZ: THANKS.

>>JUDGE SCOTT: YOU ARE OKAY WITH THAT AND MOVE FORWARD.

WE HAVE A MOTION AND A SECOND. ALL IN FAVOR, SAY AYE.

OPPOSED, SAME SIGN. THE MOTION PASSES.

MOVING ON TO -- THE MOTION PASSES TO APPROVE CAPITAL

[4. Discuss and consider including 'Grants' on the Vendor Payments Exception List not requiring Commissioners Court pre-approval.]

PROJECT CHANGE ORDER NUMBER 115. NUMBER 4, DISCUSS AND CONSIDER INCLUDING GRANTS ON THE VENDOR PAYMENTS EXCEPTIONS LIST NOT REQUIRING COMMISSIONERS COURT PREAPPROVAL.

>> THIS DID NOT COME FROM MY OFFICE EVEN THOUGH PUT HERE.

CAME FROM GRANTS ADMINISTRATION. NONIF ANA IS HERE.

AT ONE TIME, GRANTS WAS ON OUR EXCEPTION AND SHE WANTS TO PUT IT BACK ON THERE BECAUSE OUR GRANTS HAVE TIME WINDOWS THAT DON'T COMPLY WITH GETTING IT TO COURT TO BE APPROVED.

BUT THAT IS KIND OF WHAT I HEARD FROM HER.

THAT SOMETIMES THE GRANT WILL BE COMING TO AN END VERY QUICKLY AND WE NEED TO GET THE CHECKS ISSUED AND PAID AND THE COURT MIGHT NOT BE TWO OR THREE WEEKS LATER.

THE COURT DISCUSSED THAT WE -- WE PULL THIS AND UP TO THE COURT TO ADD THIS BACK AS AN EXCEPTION.

>>COMMISSIONER GONZALEZ: I LIKE -- I AM SORRY.

I READ WHAT YOU SAID, BUT -- I CAN'T APPROVE THIS ON HERE.

I AM NOT -- I KNOW WE TOOK IT OFF LAST TIME.

I DON'T LIKE TO GIVE AN OPEN WINDOW TO -- ESPECIALLY GRANTS, YOU KNOW, BECAUSE CONTRACTS AND EVERYTHING ELSE.

I THINK SOMETHING REALLY IMPORTANT IN THE TIMELINE, I THINK IT CAN COME BACK TO AIDAI, AND GET BACK TO THE JUDGE, AND WE CAN ALWAYS -- IF SHE THINKS IT IS THAT IMPORTANT.

WE CAN RATIFY IF WE HAVE TO. SO -- WISH I DON'T THINK WILL HAPPEN THAT MANY TIMES. I DON'T LIKE RADIFICATIONS.

SO ANYWAY, I AM NOT GOING -- I WILL MAKE A MOTION THAT WE DON'T

DO THIS. >>COMMISSIONER HERNANDEZ:

SECOND. >>JUDGE SCOTT: A MOTION AND A SECOND TO NOT APPROVE THIS ITEM NUMBER 4.

DO WE HAVE ANY OTHER DISCUSSION? >>JUDGE SCOTT: DO YOU WANT TO SPEAK ABOUT IT? PLEASE.

>> I STRONGLY REQUEST THAT WE DO PUT IT IN THE EXCEPTION LIST.

WE HAD -- WE HAVE ERAP. WE HAVE UTILITIES.

WE HAVE VETERANS ASSISTANCE GRANTS THAT PROVIDE ASSISTANCE TO UTILITIES, RENTAL ASSISTANCE, FOOD.

AND SOME OF THESE CANNOT BE -- YOU KNOW, WE HAD ONE INVOICE THAT WAS -- COULD HAVE BEEN PAID IN THE CHRISTMAS HOLIDAY.

AND IT CAN NOT BE PAID UNTIL THIS FRIDAY.

AND THEY HAVE ALREADY BEEN CALLING, YOU KNOW.

THEY ARE UP TO YOU EVICTION. SO IT IS NOT ONLY ONE GRANT, IT IS SEVERAL GRANTS. AND THE DEADLINES IS THE TIMELY -- SOME GRANTS NEED PROOF OF PAYMENT.

SO TO PROCESS A PAYMENT AND THEN TO PAY IT AND THEN WAIT FOR IT, BANK INFORMATION IN ORDER TO REQUEST REIMBURSEMENT, IT IS A TIMELY MANNER. SO I REALLY DO ASK --

>> THE ONLY CONCERN I HAVE THAT. I DON'T MIND THE ERAP AND ALL THAT. BECAUSE DEALING WITH OUR COMMUNITY, OUR CITIZENS, BUT WHEN WE DEAL WITH CONTRACTS AND WE DEAL WITH OTHER AGENCIES. I JUST DON'T LIKE TO GIVE AN OPEN BLANKET -- SOMETHING LIKE THAT -- AND TO PAY THE RENT OF SOMEBODY, IT SHOULD COME TO THE JUDGE AND SAY, JUDGE, WE NEED TO PAY THIS RENT. THE PEOPLE NEED TO PAY THE RENT.

>> THAT WILL BE ON A DAILY BASIS, SIR.

>>COMMISSIONER CHESNEY: COME UP WITH A LIST OF ONES BECAUSE NOT ALL OF THEM -- I AGREE WHAT THEY ARE SAYING.

I DON'T LIKE THE BLANKET THAT YOU ARE ON ALL OF THEM.

IF THERE ARE SPECIFIC ONES LIKE -- I THINK ERAP IS ABOUT OVER,

ISN'T IT? >> IT IS, BUT VETERANS

ASSISTANCE. >>COMMISSIONER CHESNEY: MAKE US A LIST OF ONES THAT ARE URGENT AND NOT -- BECAUSE GRANTS IS TOO ENCOMPASSING. TO PUT GRANTS ON THERE WITH ALL THE GRANTS THAT YOU DO THAT DON'T REQUIRE EMERGENCY RELIEF, THOSE ARE THE ONES WE ARE CONCERNED ABOUT.

I AM WITH JOE. IF YOU WANT TO DO -- GIVE US A LIST. WE CAN PUT IT ON THE AGENDA FOR THE NEXT TIME. OR GIVE US A LIST RIGHT NOW OF THE ONES THAT ARE URGENT AND LET US LOOK AT THAT BUT I DON'T THINK GRANTS NEED TO BE ON THE LIST OTHER THAN SOME SPECIFIC CATEGORIES OF THAT, THAT'S FINE. I WOULD LOOK AT THAT.

[01:55:02]

IF YOU WANT TO GIVE US A LIST OF THOSE.

WELL, YOU KNOW, SOMETHING ELSE TO CONSIDER CONTRACTS THROUGH SPECIAL MOTIONS HAVE TO COME TO COURT BEFORE PAYMENT IS DONE.

REGULAR INVOICES ON A PROCESS. >> LET US LOOK AT THOSE.

>> THE VETERANS COME TO SOCIAL SERVICES.

>> STILL A GRANT. AND THE GRANT IS --

>> SOCIAL SERVICES IS THE ONE THAT IS ACTUALLY HANDLING THE

FUNDS FOR THE GRANT. >> THE VETERANS TREATMENT COURT IS HANDLED BY -- THE VETERANS ASSISTANCE IS VETERAN SERVICES

AND SOCIAL SERVICES. >> SOMETHING YOU CAN PUT ON THE LIST, LET'S DO IT, BUT I AM JUST NOT GOING TO GIVE AN OPEN

BLANKET. >>COMMISSIONER CHESNEY: YOU WANT TO GO BACK AND MAKE A LIST. WE WILL BE BACK NEXT EX-AND YOU CAN COME BACK AND HOLD THE ITEM UNTIL AFTER EXECUTIVE SESSION AND COME BACK WITH THE LIST. SO WE CAN LOOK AT THE LIST SO WE CAN GET YOU ONES OF URGENT STUFF.

SO, I MEAN. I AM OKAY WITH ERAP.

OKAY WITH VETERANS STUFF. I AM NOT OKAY WITH ALL OF IT.

SO IF YOU WANT TO GIVE US SOME SUGGESTIONS, WE WILL TAKE THEM.

>> YES, SIR. >> SO CAN WE HOLD ON THIS ITEM AND HOLD ON THIS MOTION UNTIL WE GET A CHANCE TO DO THAT.

AND WE WILL COME RIGHT BACK AFTER EXECUTIVE SESSION.

>>JUDGE SCOTT: COME BACK TO THIS ONE.

>>COMMISSIONER CHESNEY: IS THAT OK

OKAY? >>COMMISSIONER GONZALEZ: WE WILL HOLD ON THE MOTION UNTIL SHE COMES BACK.

IF SHE DOESN'T COME BACK. JUST VOTE OPINION.

>>COMMISSIONER CHESNEY: I WILL SAY WITHDRAW IT AND COME BACK TO IT AFTER EXECUTIVE SESSION AND YOU CAN MAKE THE SAME MOTION.

MORE SPECIFIC TO WHAT. >>COMMISSIONER GONZALEZ: AGREE FOR A MOTION AND COME BACK WITH EXECUTIVE SESSION.

DO THE SECOND. >>COMMISSIONER MAREZ: I SECOND

THAT. >>COMMISSIONER GONZALEZ: I WILL

[1. Discuss and consider temporary supplemental pay for the interim Senior Autopsy Technician currently performing Autopsy Technician and Senior Autopsy Technician duties.]

HOLD OFF ON THAT. >>JUDGE SCOTT: HUMAN RESOURCES, DISCUSS TEMPORARY SUPPLEMENTAL PAY.

>>COMMISSIONER CHESNEY: SO MOVED.

>>JUDGE SCOTT: WE HAVE A MOTION AND A SECOND.

>>COMMISSIONER CHESNEY: SORRY TO INTERRUPT YOU.

>>JUDGE SCOTT: ANY OTHER DISCUSSION? ALL IN FAVOR, SAY -- GOVERNOR GONZALEZ, THEY.

ALL IN FAVOR, SAY AYE. IT ANY OPPOSED, SAME SIGN.

THE MOTION PASSES UNANIMOUSLY. NOW WE ARE GOING INTO EXECUTIVE

>> ITEM 8 WILL BE TO CONSULT WITH THE COUNTY ATTORNEY REGARDING TO LEGAL MATTERS RELATED TO THE CLAIM OF ROBERT NOVOTNY AND RELATED MATTERS TEXAS GOVERNMENT CODE 551.07137 AND ITEMB, CONVERT WITH THE COUNTY ATTORNEY ON

[02:00:02]

LEGAL MATTERS RELATED TO CAUSE NUMBER 2022-DCV-4839-H.

THE ESTATE OF WILLIAM R. DURRILL SR. DECEASED VERSUS NUECES COUNTY TEXAS AND RELATED MATHERS TEXAS GOVERNMENT CODE 551.071.

AND THAT IS ALSO THE ITEM THAT I HAVE ANNOUNCED I HAVE A CONFLICT WITH AND WILL NOT BE PARTICIPATING IN.

SO NOW DOES EVERYBODY LEAVE? WHAT DO WE DO.

>> YES. WE STILL --

>> CALL THE TIME. >>JUDGE SCOTT: THE TIME IS 10:34 AND GOING INTO EXECUTIVE SESSION.

. >>JUDGE SCOTT: 11:20.

COMING BACK TO THE REGULAR MEETING.

11:20. AND WE NEED TO -- IS ANAA BACK

WITH ITEM NUMBER 4, NO? >>COMMISSIONER GONZALEZ: IF SHE IS NOT HERE, WE WILL GO AHEAD WITH THE MOTION.

IF GRANTS AREN'T HERE -- >>COMMISSIONER CHESNEY: SHE CAN BRING IT BACK. DO YOU WANT TO DO THESE AND TELL

HER TO HURRY UP. >>JUDGE SCOTT: SHE IS COMING.

>> I CAN E-MAIL HER. >>JUDGE SCOTT: EXECUTIVE ITEMS ITEM A, CONSULT WITH COUNTY ATTORNEY REGARDING LEGAL MATTERS OF ROBERT NAVOTNY AND RELATED MATTERS 55 #.071.

>>KARA SANDS: JUDGE SCOTT, IT SHOULD -- BUT IT ACTUALLY -- YOU CAN'T TAKE AN ACTION ITEM ON LISTED EXECUTIVE.

[11. Discuss and consider action on claim by Robert Novotny dated December 7, 2022; and related matters.]

SO IT IS GOING TO BE ITEM 3-A-11.

>>COMMISSIONER CHESNEY: DID WE DO A TIME COMING BACK IN.

>>JUDGE SCOTT: 11:20. SO WHAT WOULD THE NEXT ONE BE --

>>COMMISSIONER GONZALEZ: 11 AND 12.

>>JUDGE SCOTT: I DO NEED TO REPEAT THAT WHOLE THING? THEN -- I THINK YOU HAD A MOTION THAT YOU ARE WILLING TO MAKE.

>>COMMISSIONER GONZALEZ: I DON'T KNOW IF WE NEED A MOTION OR NOT.

BUT JUST TO ALLOW YOU TO GO BACK AND NEGOTIATE OR REMEDIATE WITH THE -- WITH THE ROBERT NOVOTNY TO COME UP WITH SOME KIND OF AN AGREE AGREEMENT.

>>COMMISSIONER CHESNEY: TALKING TO YOU NOW.

>>COMMISSIONER GONZALEZ: DO WE NEED TO MAKE A MOTION OR HAVE THE COUNTY ATTORNEY GO BACK AND DO --

>> GO BACK AND CONTINUE NEGOTIATIONS.

>>COMMISSIONER GONZALEZ: CONTINUE NEGOTIATIONS.

>>COMMISSIONER CHESNEY: SECOND. >>JUDGE SCOTT: MAY I HAVE A MOTION AND A SECOND. ALL IN FAVOR SINCE WE CAN'T DISCUSS OUT HERE, I GUESS. WE DON'T HAVE DISCUSSION OUT HERE ON THIS ONE. ALL IN FAVOR, SAY AYE.

ANY OPPOSED, SAME SIGN. EVERYONE IS IN FAVOR.

UNANIMOUS DECISION FOR YOU TO GO AHE

[12. Discuss, consider and take action on the settlement negotiation in Cause No. 2021-DCV-4839-H; The Estate of William R. Durrill, Sr., Deceased vs. Nueces County, Texas; and related matters.]

AHEAD. >> ITEM 3-B-12.

>>COMMISSIONER CHESNEY: NUMBER 12, B ON EXECUTIVE SESSION.

THE MOTION IS TO REQUEST A MEDIATION WITH THE OTHER SIDE WITH COMMISSIONER MAREZ AND MYSELF ATTENDING ON BEHALF OF THE COUNTY AND FOR THE COUNTY ATTORNEY TO PROVIDE A LIST OF THREE MEDIATORS TO CHOOSE FROM. AND ALSO TO ASK THEM TO CONTINUE THE HEARING THAT IS CURRENTLY SET SO WE CAN GET THIS -- UNTIL WE GET THE MEDIATION DONE. THAT WOULD BE MY MOTION.

ANYBODY? ANYBODY?

>> SECOND. >>COMMISSIONER CHESNEY: THANK

YOU. >>JUDGE SCOTT: I DO STILL GET TO

CALL SINCE I AM ABSTAINING. >>COMMISSIONER CHESNEY: YOU CAN CALL IT BUT YOU CAN'T VOTE ON ANYTHING.

>>JUDGE SCOTT: STILL THE PRESIDING.

ALL IN FAVOR, SAY AYE. I AM ABSTAINING.

THE MOTION PASSES. ANA IS STILL NOT HERE FOR ITEM

NUMBER 4. >>COMMISSIONER GONZALEZ: SHE CAN

ALWAYS COME BACK LATER. >>COMMISSIONER CHESNEY: WANT TO

TABLE IT INSTEAD. >>COMMISSIONER GONZALEZ: GO AHEAD AND MAKE A MOTION WE DON'T INCLUDE THE GRANTS DEPARTMENT --

>>COMMISSIONER CHESNEY: THEY ALREADY ARE.

[02:05:01]

TO INCLUDE -- THEY ARE ALREADY -- THEY ARE ON THE EXCLUSION LIST ALREADY. SO WE DON'T NEED TO DO ANYTHING.

>>COMMISSIONER GONZALEZ: I MADE A MOTION NOT TO PUT IT BACK ON.

>>KARA SANDS: MAKE A MOTION NOT TO APPROVE.

>>JUDGE SCOTT: SHE IS HERE. ANA, YOU ARE UP, GRANTS

DEPARTMENT. >>COMMISSIONER GONZALEZ: DO YOU

HAVE A LIST FOR US IN? >> I WILL DIVIDE IT.

HOLD ON, PLEASE.

>> WHAT I HAVE PASSED OUT WITH SOME OF THE PAYMENTS PROCESSED FOR GRANTS. NOW YOU HAVE TO UNDERSTAND ALSO THAT I ONLY DID FUND 28 WHICH IS THE MAJORITY OF THE GRANTS, BUT FUND 28 THAT IS JUVENILE GRANTS. THAT IS ALSO CONSIDERED A GRANT.

THE GRANTS DEPARTMENT, MY DEPARTMENT IS NOT THE ONLY DEPARTMENT THAT SUBMITS INVOICES FOR PAYMENTS.

THEY ARE ASSIGNED TO WHOEVER IS RUNNING THE PROGRAM AND THEY SUBMIT THE -- THE INVOICES FOR PAYMENTS.

SO THIS IS WHY -- FOR THE SHORT LIST IS THE ONE THAT HAVE BEEN PAID FROM OCTOBER 22 TO PRESENT -- TO DECEMBER 31.

AND THOSE ARE THE ACTIVE GRANTS THAT HAVE BEEN PROCESSED.

THE SECOND ONE IS FOR THE YEAR OF # 20/1-22.

THESE ARE ALL THE GRANTS. >>COMMISSIONER CHESNEY: BUT WHY -- WHY WOULD WE WANT TO TAKE THE AMERICAN RESCUE PLAN ACT ONES OFF. THAT IS NOT SUR URGENT.

>> THESE ARE INVOICES THAT GET PROCESSED.

ALL INVOICES THAT GET PROCESSED. >>COMMISSIONER CHESNEY: DO YOU HAVE A LITTLE LIST OF THE ONES IN GENERAL CATEGORIES THAT ARE URGENT. THAT IS WHAT WE ASKED FOR.

I MEAN 30 OR 40 OF THESE HERE. YOU ARE NOT ASKING FOR ALL OF THESE, RIGHT? I KNOW YOU ARE ASKING FOR ALL OF THEM. WE ARE SAYING WHAT ARE THE

URGENT CATEGORIES. >> TO ME, ALL GRANTS ARE URGENT BECAUSE THE TIMELY MANNERS THAT WE HAVE TO HAVE PROGRAMS TO BE PROCESSED. REPORTS HAVE TO BE PROGRAMMED.

>>COMMISSIONER CHESNEY: I AM REALLY TOO IG TO HELP YOU YOU ARE NOT HELPING ME A WHOLE LOT. WHICH ONES HAVE TO BE DONE URGENTLY OR I AM GOING TO SUPPORT HIS MOTION.

I AM TRYING TO HELP, BUT YOU ARE NOT GIVING ME -- YOU CAN'T JUST SAY -- I GET THAT YOU THINK THAT, AND WE ASKED YOU SOMETHING DIFFERENT AND GO GIVE US A SHORT LIST.

>> I GUESS SHORT LIST IS THE SHORT LIST THAT I PROVIDED FOR YOU. THAT IS ONLY PROCESS --

>> HELPING HEROES. WHY IS THAT URGENT?

I MEAN -- >> OKAY.

WE WILL DO -- >>COMMISSIONER CHESNEY: I WILL MAKE A MOTION TO TABLE THIS UNTIL THE NEXT TIME AND LET HER FINE TUNE THIS A LITTLE BIT AND HAVE HER WORK WITH SOMETHING --

BECAUSE THIS DOES NOT HELP ME. >>COMMISSIONER MAREZ: LIKE -- AND I AGREE. I WANT TO GIVE YOU AS MUCH -- AS MUCH FLEXIBILITY AS YOU NEED, BECAUSE, YES, SIR, I KNOW THERE ARE TIME FRAMES THAT COME OUT. LIKE THE JAVA ELECTIONS SECURITY. IT WILL BE NEEDED TO RESPOND TO BUT NOT SOMETHING THAT COMES UP TODAY AND WE GOT TO APPROVE IT BY TOMORROW. WE ARE GIVEN SOME TIME, RIGHT.

I AGREE. I WANT TO GIVE YOU ALL THAT YOU NEED AND IF YOU CAN GIVE US SOMETHING THAT KIND OF SHRINKS DOWN THIS LIST, I THINK THAT WILL BE HELPFUL BECAUSE I DO FEEL THAT THERE ARE TIMES WHEN BETWEEN YOU AND THE JUDGE, YOU SHOULD BE ABLE TO GET THE AUGHTIZATION STRAIGHT FROM THE JUDGE AND NOT HAVE TO BRING IT TO COURT BECAUSE I KNOW THERE ARE SOME THINGS THAT ARE TIMELY. BUT I AGREE, NOT EVERYTHING SHOULD BE CART BLANCHE ON THERE TO --

>>JUDGE SCOTT: JUST AS WHAT YOU DISCUSSED EARLIER, SOMEONE WITH THEIR POWER DURING THE -- YOU KNOW, DURING DECEMBER IN THE COLD. THE VETERAN ASSISTANCE AND STUFF IS WHAT WE WERE ALL THING ALONG THOSE LINES.

>> WOULD SOMETHING LIKE THE RELEASE -- I KNOW THERE WERE SOME INVOICES THAT HAVE EARLY RELEASE THAT GET SIGNED BY THE

[02:10:01]

JUDGE. THE AUDITOR SUBMITS FROM ACCOUNTS PAYABLE. CERTAIN INVOICES THAT NEED TO GET PAID GET PROCESS IN THAT MANNER.

>>COMMISSIONER GONZALEZ: AND THAT'S FINE, BUT YOU KNOW, THAT IS URGENT. WHEN IT COMES TO PEOPLE'S LIVES AND SAFETY AND RENTAL, I HAVE NO PROBLEM WHATSOEVER.

I CAN'T OPEN IT UP TO SAY GRANTS WILL DO EVERYTHING THEY WANT TO DO WITHOUT HAVING TO COME TO COURT.

BECAUSE YOU HAVE THE CDBG HERE ALSO AND I DON'T THINK IT SHOULD BE HERE. BUT I THINK -- -- BECAUSE I AM GOING TO GO AHEAD AND TABLE MY MOTION UNTIL -- UNTIL NEXT

MEETING TO JANUARY 18. >>COMMISSIONER CHESNEY: TABLE THIS UNTIL THE 18TH AND SEE IF SHE CAN TIGHTEN UP THE LIST.

THAT WOULD BE MY MOTION, JUDGE. >>JUDGE SCOTT: THE 18TH.

>>COMMISSIONER CHESNEY: I WILL BE SECONDED HIS MOTION.

HE MADE IT. >>JUDGE SCOTT: ANY OTHER DISCUSSION? COMMISSIONER HERNANDEZ, I DID

OVERLOOK YOU? >>COMMISSIONER HERNANDEZ: I FEEL THE SAME WAY AS COMMISSIONER CHESNEY AND GONZALEZ.

>>JUDGE SCOTT: ALL THOSE IN FAVOR, SAY AYE.

ANY OPPOSED, SAME SIGN. THE MOTION PASSES TO TABLE TO THE 18TH. AND HOPEFULLY, YOU KNOW -- AND I CAN MAYBE EVEN GET TO YOU ON THAT.

AND LET'S TRY TO FIND OUT WHAT IS ACTUALLY EMERGENCY QUICK, WE NEED RESPONSE TO AND EVERYTHING. LET'S TRY TO SET SOMETHING UP AND DO THAT TOGETHER. THANK YOU VERY MUCH.

THAT IS THE ENDS OF OUR AGENDA. SO OFFICIALLY WE ARE DONE.

>>COMMISSIONER CHESNEY: AJOSHMENTS IN MEMORY.

>>JUDGE SCOTT: ADJOURNMENTS ON MEMORY.

IF THERE ARE ANY UPON REQUEST. >>COMMISSIONER GONZALEZ: I DON'T

HAVE ANY. >>JUDGE SCOTT: NOBODY HAS

ADJOURNMENTS IT MEMORY. >> GOOD RIDDANCE TO 2022.

>>JUDGE SCOTT: THANK YOU VERY MUCH, GENTLEMEN.

MY PLEASURE FOR MY FIRST MEETING.

THANK YOU VERY MUCH. AND WE ARE OFFICIALLY ADJOURNED AT 11:31. GOT TO REMEMBER THAT TIME.
