GO AHEAD AND TAKE THE MICROPHONE. YOU DID SIGN UP FIRST. JUST REMEMBER TO ANNOUNCE YOUR ADDRESS. YOU KNOW YOUR NAME, ADDRESS FOR THE CLERK AND FOR THOSE ONLINE. >> GOOD MORNING, EVERYONE. RON TRIBEN, 202 SURFSIDE IN NORTH BEACH. AND 50I78 THE PRESIDENT OF THE NORTH BEACH COMMUNITY ASSOCIATION. A PRESSURE TO BE HERE WITH ALL OF YOU. I WANT TO ADDRESS THE BREAKWATER ISSUE. I KNOW THERE IS FUNDING THAT IS AVAILABLE. AND HOPEFULLY WE ARE GOING TO VOTE ON THAT AND SECURE THE $15 MILLION THAT HAS BEEN TALKED ABOUT FOR THE PROJECT IN NORTH BEACH. NOT ONLY AM I A PRESIDENT, BUT A RESIDENT THERE, HOMEOWNER AND I AM BUILDING A BRAND-NEW HOME ON THE BEACH. THE OLD-TIMERS TELL ME THE BEACH WAS A LOT FURTHER OUT BEFORE AND NOW IT IS ERODING AWAY. I THINK COMMON SENSE TELLS US WE HAVE TO DO SOMETHING. WE CAN'T KEEP DOING THE NOURISHMENT PROGRAM. THE FIRST TIME TO MY KNOWLEDGE THAT MONEY HAS BEEN ALLOCATED TO THIS REGARD THAT WE CAN TAKE ADVANTAGE OF IT. WE ASK -- I ASK THAT YOU TAKE ADVANTAGE OF THIS UNIQUE OPPORTUNITY AND PROTECT OUR BEACHES. THERE IS A BRAND-NEW PARK THAT THE CITY IS PUTTING IN NEXT TO ME CALLED SURFSIDE PARK. THEY ARE GOING TO REDO IT. IT WILL BE BEAUTIFUL FOR THE CHILDREN, BUT IF WITH HE A BREAKWATER OUT THERE, IT WILL BE WELL PROTECTED AGAINST ANY TYPE OF STORM SURGES OR ANYTHING LIKE THAT. SO THANK YOU VERY MUCH FOR YOUR TIME AND WE DO HOPE THAT YOU WILL NOT ONLY APPROVE THIS, BUT APPROVE THE AMOUNTS AND NOT REDUCE ANY AMOUNTS THAT WILL BE ALLOCATED FOR THAT PROJECT ON NORTH BEACH. THANK YOU SO MUCH. >>JUDGE CANALES: THANK YOU, SIR. THE NEXT PERSON WILL BE MISS CARRIE MEYER. >> GOOD MORNING, COUNTY COMMISSIONERS AND COUNTY JUDGE. MY NAME IS CARRIE MEYER. I LIVE AT 4401 GULF BREEZE BOULEVARD ON NORTH BEACH AND I'M HERE IN SUPPORT OF THE BREAKWATER PROJECT -- THE LIVING BREAKWATER PROJECT. I HAVE GIVEN TO THE WOMAN IN BLACK A PIECE OF PAPER TO HAND OUT -- SORRY -- TO HAND OUT TO ALL OF YOU GUYS WHEREVER -- DURING THE DAY, A LETTER OF SUPPORT FROM NORTH BEACH COMMUNITY ORGANIZATION. I AM THE SECRETARY. RON IS THE PRESIDENT, LIKE HE SAID, AND LYNN HERE AND ANN ARE MEMBERS. THAT LETTER OF SUPPORT IS ACTUALLY NOT DATED TODAY. IT IS DATED, I BELIEVE, 2019 OR 2018 AND JUST SHOWS HOW LONG OUR GROUP HAS BEEN SUPPORTIVE OF THIS PROJECT. IT IS NOT A NEW IDEA. IN FACT I THINK WE -- OUR GROUP KIND OF CAME UP WITH IT IN ABOUT 2010 BY THINKING -- BY LOOKING OVER AT DOWNTOWN. I MEAN WE ARE ON NORTH BEACH LOOKING OVER AT DOWNTOWN SAYING LOOK AT THAT BREAKWATER OVER THERE. SUSPECT THAT NICE WHEN THE STORMS COME IN AND THE SHIP WAKES HIT, THEY ARE NOT AFFECTED LIKE WE ARE. AND YOU KNOW LEADERS A LONG TIME AGO DECIDED TO BUILD THAT BREAKWATER AROUND THE DOWNTOWN SEAWALL AND PROTECT THEIR INVESTMENT. AND I ALSO JUST WANTED TO SAY I GO TO CITY COUNCIL MEETINGS A LOT BECAUSE SO MANY ISSUES ON NORTH BEACH ARE CITY RELATED AND THE CITY HAS BEEN DOING A LOT OF STUFF FOR NORTH BEACH LATELY AND POSITIVE ABOUT THAT. I DON'T COME TO COUNTY COMMISSIONERS MEETINGS BECAUSE NOT OFTEN NORTH BEACH COMES UP ON YOUR AGENDA. THIS IS THE FIRST TIME YOU HAVE AN OPPORTUNITY TO DO SOMETHING DIRECTLY FOR THE CITY -- THE PEOPLE OF NORTH BEACH, YOUR CONSTITUENTS AND ALL THE TOURIST WHO COME TO OUR CITY AS WELL AS ALL THE PEOPLE WHO WORK THERE, ALL THE PEOPLE WHO OWN BUSINESSES THERE. AND SO IT'S -- IT IS REALLY SOMETHING THAT YOU CAN DO FOR US AND SO I AM REALLY APPRECIATIVE OF THIS EXCITING OPPORTUNITY THAT YOU HAVE. AND I ENCOURAGE YOU TO FOLLOW THROUGH AND GO AHEAD AND USE [00:10:03] THAT FUNDING THAT HAS BEEN DISCUSSED ALL ALONG. $14 MILLION AND $15 MILLION TO DO THIS PROJECT. IF YOU REDUCE THAT NUMBER, WE DON'T KNOW IF IT IS GOING TO BE POSSIBLE TO EVEN DO THE PROJECT. WELL, WE WILL DO HALF OF IT, YOU NKNOW THE CITY FUNDED THE $250,000 STUDY BY MOTT MCDONALD AND THE CITY'S INVESTMENT IN THIS. IT IS NOT A CITY ISSUE AND NOT IN CITY LAND. IT IS OUT IN THE WATER. ANYWAY, I WANT TO THANK ALL OF Y'ALL FOR BRING IT THIS FAR AND GO AHEAD AND SEND IT ACROSS THAT TOUCHDOWN LINE. THANK YOU. >>JUDGE CANALES: THANK YOU. MR. PETER DAVIDSON. >> HONORABLE JUDGE AND COMMISSIONERS. PETER DAVIDSON, REPRESENTING THE ED ROCHELLE FOUNDATION AND MARINE CONSULTANT. I WISH TO THANK THE COMMISSIONERS, COMMISSIONER HERNANDEZ FOR DOING AN EXCELLENT JOB, COMMISSIONER GONZALEZ, COMMISSIONER CHESNEY AND ESPECIALLY JUDGE CANALES, WHO HAS BEEN HARD AT WORK ASSISTING US IN DOING PROJECTS WITH MANY OT OTHERS. IN 1901, 1900, THERE WAS A LARGE HURRICANE THAT DEVASTATED GALVESTON AND THEY BUILT A 17-FOOT SEAWALL. IN 1919, THERE WAS A HURRICANE THAT DEVASTATED THE CITY OF CORPUS CHRISTI. AND. 1925, THEY BUILT THAT ROUGH BREAKWATER. FOUND AN ARCHITECT THAT BUILT AND DESIGNED MOUNT RUSHMORE CAME IN 1928 AND DESIGNED A SEAWALL AND THAT SAT ON A SHELF. IN 1937, PRESIDENT ROOSEVELT AND THE WORK PROGRAMS DECIDED TO HELP BUILD THAT. AND THIS PROJECT, BREAKWATER TO PROTECT NORTH BEACH IS SO IMPORTANT AND IT IS AKIN TO THOSE PROJECTS. IT STRETCHES ABOUT 1.6 MILES AND STARTS BY THE USS LEXINGTON TO PROTECT OUR HISTORIC AREA AND MOVES NORTHWARD. NORTH BEACH ON THE HANDOUT IS ONE OF THE FIRST PLACES WHERE GENERAL -- ZACHARY TAYLOR CAME AND CAMPED ON THE BEACH. IT WAS THE FIRST PLACE THE UNITED STATES FLAG WAS FLOWN HERE ON NORTH BEACH. AND IT IS VERY HISTORIC. NORTH BEACH WITH THE LEXINGTON AND THE AQUARIUM HAS 550,000 VISITOR AS YEAR AND NEEDS TO BE PROTECTED INCLUDING THE BUSINESSES AND ALL THE RES RESIDENTS. THE FOUNDATION HAS PARTNERED WITH THE PORT OF CORPUS CHRISTI AND THE PERMITTING IS UNDER WAY. THE OTHER PARTNERS IN IT HAVE BEEN THE CITY OF CORPUS CHRISTI, WHO HAVE HELPED WITH THE ENGINEERING DESIGN AND I HAVE TO THANK COMMISSIONER GULLEY FOR BEING HERE TODAY IN SUPPORT AS THE PORT COMMISSIONER. WE WORK WITH THE HEART RESEARCH INSTITUTE, THE NORTH BEACH COMMUNITY, ALL THE STAKEHOLDERS LIKE THE USS LEXINGTON. WE HAVE A SHOVEL-READY PROJECT THAT IS READY TO GO. AND AS SOON AS FUNDING IS APPROVED AND THE PER FIT IS COMPLETE WHICH IS NOW UNDER WAY WE ARE BEGIN THIS PROJECT AND PROTECT THE HISTORY AND THE INFRASTRUCTURE OF NORTH BEACH. THANK YOU SO MUCH. >>JUDGE CANALES: THANK YOU, SIR. MR. LYNN FRAZIER. >> THANK YOU, JUDGE CANALES. >>JUDGE CANALES: YES, THANK YOU. >> GREAT TO BE HERE THIS MORNING. I JUST WANTED TO LET EVERYBODY KNOW THAT -- MY NAME IS LYNN FRAZIER. LIVE AT 713 SNUG HARBOR ON NORTH BEACH. I MOVED HERE TO CORPUS CHRISTI, TEXAS, IN THE YEAR 2000 SOME I LIVED IN CORPUS FOR 22 YEARS. BEFORE I MOVED HERE, I TRAVELED THE WORLD, I DID FOR 18 YEARS. I HAVE BEEN TO AUSTRALIA, NEW ZEALAND, INDONESIA, CHINA, JAPAN, MIDDLE EAST, WEST AFRICA, VENEZUELA, BRAZIL, MEXICO. I HAVE BEEN ALL OVER THE PLACE, SIX OF THE SEVEN CONTINENTS ANYWAY, SO I HAVE SEEN FIRST HAND HOW THE WORLD WORKS AROUND THE GLOBE. [00:15:02] AND IT'S --.WE WANT INFRASTRUCTURE. WE WANT THINGS TO BUILD UP SO WE CAN SEE THINGS, MAKE THINGS BETTER FOR ALL OF US AND I WOULD LIKE TO TALK A LITTLE BIT OF THE NORTH BEACH COMMUNITY HERE IN CORPUS. LIKE I SAID I AM FINANCIALLY AND EMOTIONALLY INVESTED IN CORPUS CHRISTI. I OWN 6,000-SQUARE-FOOT OFFICE BASES FOUR ACRES, 150,000-SQUARE-FEET OF OFFICES ON FOUR ACRES ON BEXAR LANE. REBUILT THE CHAMBERLAIN DOWNTOWN AT UPPER BROADWAY AND THE WHOLE HEB BUILDING AND FAJITAVILLE AND HOTEL D[L]EVIL SITTING OUT ON THREE ACRES AND FURTHER UP THE BEACH, FIVE ACRES OF RAW LAND AND BEACHFRONT AND MARINAVILLE THAT I LEASE FROM TXDOT ON NUECES BAY AND FINISHING UP LIGHTHOUSE POINT ON NUECES BAY. BESIDE THE HARBOR AND I OWN A COUPLE OF OTHER RENTAL PROPERTIES THERE. HOW INVESTED I AM IN CORPUS AND HOW MUCH I LOVE THIS TOWN. I AM WANTING AND WISHING THIS AREA TO IMPROVE. THIS IS THE VERY REASON WHY I'M HERE TALKING TO YOU GUYS I WANT SO BADLY TO IMPROVE OUR NORTH BEACH AREA. BUILDING OUR PROPOSED BREAKWATER ISLANDS FOR NORTH BEACH WILL HELP IT SO MUCH. IN FAJITAVILLE, THE ONE TO TWO-FOOT WAVESS CHURNING AND WASHING OUR SAND AWAY. WHAT IS WORSE IS WHEN THE SHIPS COME IN AND OUT OF OUR PORT THROWS OUT THIS ONE TO TWO-FOOT WAVE. WHEN THEY ARE COMING INTO TO OUR WORLD-RENOWNED CORPUS CHRISTI PORT. BUILDING A HUGE BRIDGE -- TXDOT IS, TO ALLOW MUCH BIGGER SHIPS TO ENTER AND LEAVE OUR PORT WHICH IS AWESOME. GREAT FOR THE COMMUNITY AND EVERYTHING. NORTH BEACH, THE AQUARIUM, LEXINGTON, CONDOS AND HOUSING NEED PROTECTION FROM THE MUCH LARGER WAVES AND BEACH EROSION THAT ARE ABOUT TO HAPPEN. THIS NEW TRAFFIC WILL PREVENT THAT AND YOU CAN IMAGINE A SHIP OF A SIZE WILL PUSH THAT WAKE OUT. WE REALLY GOT TO WATCH THAT. AS WE ALL KNOW, A HUGE AMOUNT OF BEACH EROSION -- WE WILL HAVE A HUGE AMOUNT WITH THESE BIGGER SHIPS AND INCREASED TRAFFIC AND IT WILL GET MUCH, MUCH WORSE AND THIS THE EASY PROBLEM TO FIX WITH THE PROPOSED BREAKWATER AND BREAKWATER ISLANDS THAT WE HAVE BEEN TALKING ABOUT. WHEN OUR PROPOSAL -- AND WITH OUR PROPOSAL, THIS WILL PROTECT ALL OF NORTH BEACH POPULATION AS WELL AS GIVE US A VERY ATTRACTIVE COASTLINE FOR EVERYONE LIVING ON AND COMING TO NORTH BEACH TO ADMIRE AND APPRECIATE. I WOULD LIKE TO THANK EVERYONE FOR YOUR TIME. I REALLY HOPE WE GET THIS ALL PASSED AND GET ENOUGH MONEY IN HERE TO GET -- MAKE THIS HAPPEN AND MAKE OUR CITY NICE. THANK YOU VERY MUCH. >>JUDGE CANALES: THANK YOU. DR. XAVIER GONZALEZ. GOOD MORNING. >> GOOD MORNING, JUDGE AND COMMISSIONERS. TODAY I AM COMING MORE OF AN ADVOCATE FOR BEHAVIORAL HEALTH. AND JUST REALLY HIGHLIGHTING SOME GOOD THINGS THAT ARE BEING DONE AND WILL BE DONE BEFORE THE -- BEFORE THE UPCOMING HOLIDAYS. AS WE ALTHOUGH, HOLIDAYS CAN BE A LITTLE BIT STRESSFUL, ESPECIALLY WHEN IT COMES TO MENTAL HEALTH. SO WHAT I REALLY WANTED TO HIGHLIGHT AND WHAT I HAVE HERE IS BASICALLY SOME CARDBOARD SIGNS THAT THE SHERRIFF'S OFFICE HAS -- HAS PRINTED OUT AND MADE AVAILABLE AND THAT THE -- THAT THE DEPARTMENT OF BEHAVIORAL HEALTH PROGRAMS IS WORKING WITH HIM TO MAKE SURE THESE SIGNS GET SPREAD OUT THROUGHOUT THE COMMUNITY. THAT WAY THERE IS AWARENESS TO WHAT AVAILABLE RESOURCES THERE ARE TO BEHAVIORAL HEALTH. THROUGHOUT OUR COMMUNITY. SO I REALLY WANTED TO HIGHLIGHT THAT TO Y'ALL AND TO THOSE IN THE ROOM AND TO THOSE WHO ARE ONLINE THAT, YOU KNOW, WE REALLY WANT TO MAKE SURE THAT THERE ARE PROGRAMS OUT THERE IF SOMEONE NEEDS HELP. AND TO HAVE THOSE HERE. NOT EVERYBODY IS ON THERE OTHERWISE WE WOULD HAVE A LOT OF SIGNS. BUT A QR CODE THAT GIVES ACCESS TO THE DIFFERENT NUMBERS OF THE SERVICES TO THAT ARE OUT THERE. TODAY MORE OF A HIGHLIGHT THAT OUR SHERIFF'S OFFICE IS DOING GOOD THINGS AND TRYING TO HELP OUR COMMUNITY AS WELL. SO, THANK YOU. >>JUDGE CANALES: THANK YOU SO [00:20:04] MUCH. IS THERE ANYBODY ELSE? HOW ABOUT ONLINE, CONNIE? ANYBODY ONLINE? ALL YOU HAVE TO DO IS PUT YOUR VIRTUAL HAND -- THE EYE -- ICON OF THE HAND. I HAVE SIGNED UP. JJ -- >> YOUR HONOR. AND YOU AND THEN I WILL SPEAK Y FOR JJ IN JUST A MOMENT. >> I AM BRIAN GULLY, I AM -- ACTUALLY I AM THE PRESIDENT OF THE COASTAL BEND ESTUARIES AND PORT COMMISSIONER FOR THE PORT OF CORPUS CHRISTI. I KIND OF AGREE WITH EVERYTHING I HEARD SO FAR. I THINK THIS IS A VERY IMPORTANT PROJECT. I ACTUALLY WAS INVOLVED WITH RENURSING THAT BEACH ONE TIME MANY YEARS AGO. IT WAS A VERY EXPENSIVE PROJECT. WHAT THIS WILL DO -- WE HAVEN'T REALLY STRESSED THAT VERY MUCH, BUT IT WILL HELP PROTECT THE EROSION ON THAT BEACH AND SAVE THE CITY OF CORPUS CHRISTI MILLIONS OF DOLLARS IN THE FUTURE OF NOT HAVING TO RENURSE THE BEACHES OFTEN. IT WILL ALSO PROTECT THE LEXINGTON HAVING SCOURING ISSUES. THE PORT VERY MUCH IS IN SUPPORT OF THIS PROJECT. AND I THINK WE JUST NEED TO KEEP IN MIND THAT WE NEED TO GET TOGETHER AS SOON AS POSSIBLE ON THIS AND GET THE SCIENTISTS INVOLVED AND TO MAKE SURE WE HAVE GOT EVERYTHING PREPARED TO LOCK IN THIS MONEY SO WE HAVE THIS MONEY TO USE. SO WE ARE PREPARED TO WORK AS SOON AS POSSIBLE WITH BAYS AND ESTUARIES, WITH THE SCIENTISTS AND ALL THE OTHER STAKEHOLDERS TO TRY TO BRING THE CITY IN BECAUSE I THINK THEY SHOULD PARTICIPATE IN THIS AS WELL AND ALL WORK TOGETHER TO MAKE THIS DEADLINE OF FEBRUARY 21. THAT IS OUR ONLY CONCERN. WE ARE VERY EXCITED ABOUT THIS PROGRAM. A GREAT PROJECT. THANK YOU. >>JUDGE CANALES: THANK YOU SO MUCH. ANYBODY ELSE? YES, SIR. PLEASE. CAPTAIN, WELCOME. >> DANIEL PETIS. CHIEF DEPUTY OF ADMINISTRATION FOR THE SHERIFF'S OFFICE AND JUST TO KIND OF RESOUND WHAT DR. GONZALEZ WAS SAYING. THESE BOARDS THAT WE PUT UP, THOSE WERE AN IDEA THAT WAS BROUGHT BACK FROM THE COUNTY MANAGEMENT AND RISK CONFERENCE THAT I ATTENDED EARL YEAR THIS YEAR. BECAUSE OF LAW ENFORCEMENT AND CORRECTION IS NOT NECESSARILY CONSIDERED I GUESS A FACTOR WITH EN WE DEAL WITH HEALTH SERVICES OR MENTAL HEALTH SERVICES. WE THOUGHT IT WOULD BE A GOOD IDEA BECAUSE WE ARE NOT EXEMPT FROM MEETING THESE TYPE OF SERVICES SO I GOT WITH A COUPLE OF PEOPLE THERE AT THE SHERIFF'S OFFICE THAT COMPILED THIS LIST AND PUT IT ON OUR SHERRIFF'S APP. ON THE SHERRIFF'S WEB SITE. SO IF YOU ARE INTERESTED LIKE DR. GONZALEZ WAS SAYING, THIS IS A LIVING DOCUMENT. IF YOU GO TO OUR GOOGLE PLAY STORE OR THE APPLE STORE AND DOWN LOAD THE SHERRIFF'S APP, THE SAME RESOURCES ARE AVAILABLE ONLINE. A LIVING DOCUMENT THAT WILL BE CHANGED FREQUENTLY. AS SOON AS WE POSTED THEM WE WERE RECEIVING FEEDBACK THAT WE LEFT SOMEONE OUT. WE WILL HAVE THESE AS A LIVING DOCUMENT SO THEY ARE AVAILABLE TO THE COMMUNITY ALL THE STAFF THAT MAY LIVE HERE OR VISITING HERE. THANK YOU. >>JUDGE CANALES: THANK YOU. ANYBODY ELSE? I WILL PROCEED. I -- MY ITEM IS REFLECTED OF A REALLY PROUD MOMENT FOR BOTH NUECES COUNTY, OUR JURISDICTIONS INSIDE NUECES COUNTY INCLUDING OUR BIG CITIES LIKE CORPUS CHRISTI AND OUR SMALL ONES AND INCLUDES CLAYBURG COUNTY. WE HAD A PRESS CONFERENCE TO ANNOUNCE THAT THE NATIONAL PARK SERVICE THROUGH THE DEPARTMENT OF INTERIOR AWARDED 18 AMERICAN COMMUNITIES WITH THE DISTINCTION OF BEING A WORLD WAR II HERITAGE CITY. AND WE HAVE THAT LOCATION. ONLY ONE LOCATION IN EVERY STATE CAN RECEIVE THIS DESIGNATION, THIS TITLE. WE APPLIED FOR THIS THROUGH A TREMENDOUS EFFORT THAT WAS COLLABORATIVE. I WANT TO ACKNOWLEDGE, AS WE DID YESTERDAY, THE INCREDIBLE HISTORIANS WE HAVE IN NUECES COUNTY, BOTH FROM THE CITY OF CORPUS CHRISTI WHO ALREADY HAD COMPILED -- NINA HAD COMPILED [00:25:06] THIS AMAZING -- LOOKED LIKE A BOOK WHEN YOU PRINT IT OUT -- OF OUR WORLD WAR II HISTORY. WE HAD, OF COURSE, THE LIVING MUSEUM OF THE WORLD WAR II HISTORY, THE USS LEXINGTON AND THE LIVING AND ACTIVE NAVAL, CORPUS CHRISTI NAVAL STATION AT KINGSFIELD AT ONE TIME THE AIRFIELD IN BEEVILLE. THIS DESIGNATION HAS A TREMENDOUS IMPACT NOT JUST FOR HISTORY BUFFS, BUT WILL HAVE A RIPPLE EFFECT FOR ECONOMICS HERE IN OUR COMMUNITY PEOPLE WILL COME LIKE THEY DO UNESCO SITES ALL OVER THE WORLD AND THEY WANT TO COME AND SEE WHY THIS LOCATION HELD SUCH IMPORTANCE IN WORLD WAR II. IF YOU LOVE THE HISTORY OF PORT ARANSUS, WE HAD INCREDIBLE MUNITIONS IN PORT A. AND WE HAD GERMAN U-2 BOATS NOT THAT FAR OFF IN THE GULF OF MEXICO. OUR WAR EFFORTS FROM BONDS TO GARDENS -- VICTORY GARDENS, THE GIRLS WHO SOLD THE WAR BONDS. IT'S JUST -- JUST AN AMAZING STORY. WE BOMBED AS A COMMUNITY BECAUSE OF OUR WORLD WAR II HERITAGE. WANT TO SAY THERE WILL BE A LOGO AROUND THE COMMUNITY AND I SPOKE WITH MANAGER ZANONE AND HE WILL ASK VISIT CORPUS CHRISTI TO BE A PART OF THAT CELEBRATION AS WELL AS OUR OWN -- IT'S ON OUR VETERANS PAGE, I BELIEVE, UNDER NUECESCO.COM AND LOOK UNDER VETERANS AND LOOK AT THE ACTION. AN IMPORTANT HONOR FOR US TO RECEIVE. AND I HOPE THAT WHEN THE DECALS GET PRINTED YOU WILL GET ONE FOR YOUR CAR AND PROUDLY DISPLAY WHAT IT TRULY MEANS TO HONOR THE SACRIFICES OF THE GREATEST GENERATION. TODAY IS PEARL HARBOR DAY. I THINK IT COULDN'T BE MORE FITTING TO CELEBRATE THIS DESIGNATION TODAY OF ALL DAYS. SO THE DAY DOESN'T JUST LIVE IN INFAMY, BUT LIVES AS A TESTAMENT WHAT OUR FREEDOM HAVE DOS US. PLEASE JOIN ME IF WE CAN IF WE FINISH ON TIME AT 2:00 ON THE LEXINGTON AT 10 A.M. THIS MORNING IF YOU DON'T HAVE TO BE IN THIS COURT ROOM, GO TO CHERYL PARK FOR THE PEARL HARBOR CELEBRATION AND REMEMBRANCE. I JUST WANTED TO SAY THANK YOU TO OUR VETERAN SERVICE OFFICER JJ DECERA. SCOTT CROSS, WHO ACTUALLY BROUGHT FORTH -- BECAUSE IT CAME OUT OF NATIONAL PARKS. COASTAL PARKS PEGGED IT FIRST. ANYWAY, AN AMAZING COLLABORATION AND CLAYBURG COUNTY IS OVERJOYED AS I AM TO MAKE THIS A PART OF OUR NEW -- OUR NEW LIVING HISTORY. WITH SO THAT, THOSE ARE MY COMMENTS ON WORLD WAR II AND I WILL ASK IF THERE IS ANYBODY ELSE? OKAY, GREAT. THEN WE WILL PROCEED. [1. AND YOUR PROCLAMATION WAS PERFECT WHERE YOU SAID THEY HAVE SPECIAL ABILITIES, NOT DISABILITIES. AND THAT IS WHAT WE ALWAYS POINT OUT. I THINK EVERY PERSON IN THE WORLD HAS A DISABILITY, SO I POINT OUT THE DISABILITIES. WE ALL HAVE SPECIAL ABILITIES ALSO. WE SO APPRECIATE IT. WE HAVE ONE OF OUR BOARD MEMBERS HERE. I KNOW HE DIDN'T WANT TO SPEAK, BUT THANK YOU FOR COMING. OR DO YOU WANT TO SAY SOMETHING? OKAY. BUT I APPRECIATE THE BOARD MEMBERS AND ALL THAT. WE MOVED RIGHT DOWN THE STREET FROM YOU. AND I AM JOINING US VIRTUALLY AND I APPRECIATE THE OPPORTUNITY TO WORK WITH THE COUNTY AGAIN TO TRY TO, YOU KNOW, REALIZE THAT STATE FUNDING INCREASE FOR OUR PROGRAM. YOU KNOW, WE WORKED ON THIS FOUR YEARS AGO WITH YOU ALL AND GOT PRETTY CLOSE BUT DIDN'T QUITE MAKE IT OVER THE FINISH LINE. SO, YOU KNOW, THAT IDEA HERE IS AS MUCH AS POSSIBLE GETTING SUPPORT FROM -- NOT JUST NUECES COUNTY, BUT OTHER -- OTHER, YOU KNOW, LOCAL GOVERNMENT PARTNERS WE HAVE IN THE AREA TO PUSH FORWARD THE STATE FUNDING INCREASE. BUT THIS IS REALLY -- NUECES COUNTY HAS BEEN AN INTEGRAL PART IN LEADING THIS EFFORT AND I APPRECIATE THAT AND THANK THE COMMISSION FOR ALL THEIR CONTINUED SUPPORT AND, YOU KNOW, WE WILL HOPEFULLY SEE THIS THROUGH THIS TIME. >>JUDGE CANALES: WITH US HERE, DR. STANCIL. BOB HARDSON AND BRIAN GULLY. >> ONCE AGAIN, DR. BRIAN GULLY, AND I AM HONORED TO SERVE AS THE PRESIDENT FOF THE COASTAL BEND BAYS AND ESTUARIES. AS PORT COMMISSIONER AND PORT OF CORPUS CHRISTI. WE ARE THE BIGGEST CONTRIBUTOR TO THE OPERATION OF THIS -- VERY GREAT ORGANIZATION. LAST YEAR WE CONTRIBUTED $168,000 THAT TO ORGANIZATION FROM THE PORT OF CORPUS CHRISTI AND FURNISHED THEM THEIR OFFICE SPACE IN THE OLD PORT BUILDING. SO WITH THAT, I AM GOING TO TURN IT OVER TO BOB, WHO IS EXECUTIVE DIRECTOR OF THE COASTAL BEND INDUSTRY ASSOCIATION AND PROBABLY OUR LONGEST-SERVING BOARD MEMBER IN EXISTENCE. HE HAS BEEN THERE FOREVER. I WILL LET HIM EXPLAIN WHAT THE ORGANIZATION IS AND HOW IT EFFECTS THE COASTAL BEND. >> THANK YOU, BRIAN. GOOD MORNING, JUDGE, COMMISSIONERS. THANK YOU FOR THE OPPORTUNITY TO BE HERE WITH YOU THIS MORNING. I AM BOB HOLLISSON, BANDERA DRIVE IN CORPUS CHRISTI, TEXAS. AS DR. GULLY MENTIONED, I AM DIRECTOR OF THE COASTAL BEND INDUSTRY ASSOCIATION. THAT IS THE NEW VERSION OF THE ORGANIZATION THAT YOU PROBABLY KNOW -- ASSOCIATE ME WITH PORT INDUSTRIES OF CORPUS CHRISTI. WE WENT THROUGH A RENAMING AND REBRANDING BUT THE SAME GROUP -- SAME GROUP OF ORGANIZATIONS. PORT INDUSTRIES OF CORPUS CHRISTI AND COASTAL BEND HAS BEEN PARTICIPANTS IN IT THE BAYS AND ESTAURIES PROGRAM SINCE ITS INCEPTION. AND REALLY IT GOES WITHOUT SAYING JUST A TREMENDOUS WORK THAT THE PROGRAM HAS DONE OVER THE LAST 20-PLUS YEARS. HERE NOT ONLY IN THE CORPUS CHRISTI BAY AREA BUT THROUGHOUT THE ENTIRE COASTAL BEND. AND DURING THAT TIME, YOU KNOW, IT RECEIVES FUNDING FROM A VARIETY OF SOURCES. [00:40:04] TCEQ, EPA, INDUSTRY OF THE PORT, THE MUNICIPAL -- OR THE GOVERNMENTAL JURISDICTIONS IN THE AREA, BUT AS IT HAS BEEN MENTIONED, THE CORRECTION FROM THE STATE IS IMPORTANT. AND I THINK MORE IMPORTANTLY, IT HAS BEEN AT THE SAME AMOUNT FOR VIRTUALLY THE 20 YEARS THE PROGRAM HAS BEEN IN EXISTENCE. AND THE -- THE PROGRAM DOES A -- A FANTASTIC JOB OF MAKING BEST USE OF THE FUNDS IT DOES HAVE. BUT IT WOULD SIGNIFICANTLY BENEFIT FROM INCREASED FUNDING SO I REALLY APPRECIATE YOUR SUPPORT AND ENCOURAGE ENCOURAGE ADOPTION OF THE RESOLUTION. THANK YOU VERY MUCH. >>COMMISSIONER HERNANDEZ: EXCUSE ME, JUDGE, AT THIS TIME I WOULD LIKE TO TABLE ITEM 7. >>JUDGE CANALES: NUMBER ONE, WE ARE ON ITEM NUMBER 5. >>COMMISSIONER HERNANDEZ: JUST THOUGHT I WOULD LET YOU KNOW JUDGE I AM NOT GOING TO TAKE OR HEAR ANY MOTIONS UNTIL I CALL ON IT. ITEM NUMBER 5, ALL THOSE IN FAVOR, SIGNIFY BY SAYING AYE. OKAY. [2. CONSENT AGENDA: The following Agenda Items are of a routine nature, and the Commissioners Court has received supporting materials for consideration. All of these Agenda Items will be passed with one vote without being discussed separately, unless a member of the Commissioners Court or the public requests that a particular Agenda Item be discussed. If so, that Agenda Item will be pulled from the Consent Agenda and discussed as part of the regular Agenda at the appropriate time. One vote will approve the remaining items on the Consent Agenda.] WHAT I AM GOING TO DO IS I WILL CALL ON THE CONSENT AGENDA AND ASK YOU A-Q. GIVE ME A CHANCE -- I ASKED DARYL -- DARYL, YOU ARE ONLINE. I THOUGHT THAT DECEMBER 7 WE WOULD HAVE OUR BUTTONS, BUT I GUESS WE ARE NOT. YOU DON'T HAVE TO COMMENT BUT PLEASE E-MAIL ME TO GET THOSE BUTTONS HERE BECAUSE IT MAKES FOR SUCH A -- A MUCH EASIER OPPORTUNITY SINCE I CAN'T SEE RIGHT AND LEFT AT THE SAME TIME. GO AGAIN, CONSENT AGENDA IS NEXT. ITEMS A-Q. AND I WILL ASK IF ANY -- COMMISSIONER GONZALEZ, YOU SAID YOU HAD ONE. >>COMMISSIONER GONZALEZ: I HAVE SEVERAL. I AM GOING TO MOVE TABLE NUMBER I. >>COMMISSIONER GONZALE GONZALEZ: I, O, P, AND J. >>JUDGE CANALES: LET'S TAKE THIS MOTION FIRST IF THERE IS ANY OTHER, FROM ANY OTHER COMMISSIONERS THAT NEED TO BE REMOVED FROM CLARITY -- >>COMMISSIONER CHESNEY: JUDGE, ALSO, THEY NEEDED TO TABLE Q IS ONE OF THE ONES I WAS TOLD. >>JUDGE CANALES: BUT YOU SAID Q. I DON'T KNOW WHO SAID THAT. >>COMMISSIONER CHESNEY: COUNTY ATTORNEY. >>JUDGE CANALES: LET ME HEAR FROM HER. JENNY, DO YOU HAVE ANY TO TABLE BECAUSE APPARENTLY ONLY ONE-WAY COMMUNICATION. I DIDN'T RECEIVE AN E-MAIL REGARD IT. DO YOU NEED ANY TO BE TABLE? >> THOSE WERE CONTRACTS THAT WERE NOT -- THEY JUST HAVEN'T BEEN REVIEWED YET. SO THAT'S NOT COMPLETE. >>JUDGE CANALES: HANG ON FOR A SECOND. LET'S DO THE EASY PART. ANY OTHERS THAT NEED TO BE PULLED FOR CLARIFICATION. LET'S DO THIS CORRECTLY. LET'S DO THE ONES THAT ARE NOT PULLED ARE A,B,C,D,E,F,G,H,K ANDM. IS THERE A MOTION TO APPROVE -- >>COMMISSIONER CHESNEY: JUDGE. >>JUDGE CANALES: GIVE ME A SECOND, PLEASE. >> YOU MIGHT WANT TO PULL F TO HAVE DISCUSSION ON TWO OF THE BONDS THAT ARE NOT COMPLETELY SIGNED. >>JUDGE CANALES: THAT'S CORRECT. I AM SORRY. THAT CAME -- THAT CAME TO ME TOO. THAT CAME TO ME AS WELL. I HAVE THAT NOTE WITH THE EXCEPTION OF F ON ITEM COUNTY COURT OF LAW 5, THAT IS NUMBER 10. AND ALSO ITEM -- WHICH OTHER ONE HAVEN'T BEEN SIGNED. >> 4. >>JUDGE CANALES: 4, THE COUNTY CLERK. LET'S DO THIS ONE MORE TIME FOR LORENZO. ASKING FOR A MOTION AT THIS TIME ON A-H WITH THE EXCEPTION THAT F HAVE THE EXCLUSIONS OF ITEMS 4 AND 10 AND K,L ANDM AT THIS TIME. IS THERE A MOTION TO APPROVE THE CONSENT AGENDA ITEMS? >>COMMISSIONER CHESNEY: SO MOVED. >>JUDGE CANALES: SO MOVED. >> SECOND. >>JUDGE CANALES: THEN THERE IS A SECOND. OKAY. THEN ALL THOSE IN FAVOR, SIGNIFY BY SAYING AYE. >>COMMISSIONER CHESNEY: AYE. >>JUDGE CANALES: THEN ON ITEM I. I WILL HEAR THAT NOW. A SOLE SOURCE -- EXCUSE ME, A SOLE SOURCE PURCHASE REGARDING ONE SOLUTION. AND IT IS THE ANNUAL MAINTENANCE RENEWALS. IS THERE A QUESTION, CLARITY SITUATION, JENNY, WITH THAT CONTRACT? >>COMMISSIONER GONZALEZ: JUDGE, I MOVED TO TABLE I,J,O,M ANDP. [00:45:02] THAT IS MY MOTION. I DON'T HEAR A -- >>COMMISSIONER HERNANDEZ: SECOND. >>COMMISSIONER GONZALEZ: I MET WITH IT. I MET WITH NUECES COUNTY ATTORNEY. >>JUDGE CANALES: COUNTY ATTORNEY, I AM ASKING FOR CLARIFICATION. ARE ANY OF THOSE IN JEOPARDY OF, FOR EXAMPLE, EXPIRATION WHERE THE COUNTY COULD BE IN PERIL RILL. IF NOT I DON'T HAVE A PROBLEM WITH IT, BUT TO HAVE NO DISCUSSION ON IT WHEN IT IS ON THE CONSENT AGENDA, THERE MUST BE A REASON THAT YOU CAN OFFER HERE TO HELP FOR CLARITY FOR THE PEOPLE'S SAKE WHO ARE LISTENING. >> MY UNDERSTANDING THAT THERE IS NO DANGER OF THAT. THEY CAN BE REVIEWED; HOWEVER, JUDGE, THEY WERE NOT SUBMITTED TO OUR OFFICE IN A TIMELY -- TO GIVE US TIME TO DO THAT. >>JUDGE CANALES: HAVE YOU ADDRESSED THAT ISSUE WITH THE DEPARTMENT HEAD. >> YES, WE HAVE. >>JUDGE CANALES: WILL HE BE READY TO SUBMIT ON DECEMBER 14 AGAIN? >> I BELIEVE MOST OF THESE SHOULD BE; HOWEVER, AS YOU ARE AWARE, MANY OF THESE COME WITH VOLUMINOUS ADDITIONS AND ATTACHMENTS THAT SIMPLY TAKE TIME TO REVIEW AND WE ARE DOING OUR BEST TO DO IT. >>COMMISSIONER GONZALEZ: FOR CLARIFICATION ALSO, JUDGE, TWO HAVE TO DO WITH FINANCIAL RESOURCES THAT WEREN'T CLEAR AND I.T. WASN'T VERY CLEAR AND I INCLUDED N ANDP ON THERE. >>COMMISSIONER CHESNEY: THE QUESTION IS BECAUSE HE HAVEN'T MADE HIS MOTION SPECIFIC, DO YOU WANT IT ON THE 14TH OR IN JANUARY. BECAUSE I -- I DON'T WANT TO HAVE TO REVIEW VOLUMINOUS THINGS EITHER WITHOUT YOU DOING IT. AND I AM ASKING THAT AS CLARIFICATION BECAUSE HE HAS NOT YET STATED WHEN HE WANTS TO TABLE IT TOO. >> I DON'T KNOW WHICH ONES BECAUSE WE DON'T HAVE ALL THE DOCUMENTS GATHERED ARE THE LARGEST TO SAY WHICH ONES COULD BE ABSOLUTELY ACCOMPLISHED ON THE 14TH. >>COMMISSIONER CHESNEY: COMMISSIONER GONZALEZ. >>COMMISSIONER GONZALEZ: MY MOTION WILL INCLUDE P AND N FOR JANUARY BUT ACCORDING TO I.T., THEY ARE GOING TO HAVE TO GO BACK AND INVESTIGATE THE FINANCIAL RESOURCES. >>JUDGE CANALES: DARYL, IS THAT -- THOSE -- ALL OF THESE COME FROM -- I WOULD LIKE TO AT LEAST ANNOUNCE THEM SO THAT -- I MEAN, WE ARE TABLING THEM. BUT ON I, IT HAS TO DO WITH ONE SOLUTION. J HAS TO DUE WITH ASPHALT. ON J, WHAT IS THE ISSUE THERE, JENNY, BECAUSE LOOKS LIKE IT HAS TO DO WITH ROAD MATERIAL. WILL THAT DELAY A ROAD? IT LOOKS LIKE IT IS AN EXECUTION OF AGREEMENT. WE ALREADY APPROVED IT AS THE COURT. CAN YOU EXPLAIN WHAT THE ISSUE IS THERE? >> THE ISSUE IS THE SAME. WITHOUT ACTUALLY HAVING THE DOCUMENTS IN OUR POSSESSION TO REVIEW IN THEIR ENTIRETY, WE CAN NOT ADVISE THE COURT WHETHER THE CHOICE OF LAW IS APPROPRIATE AS WE FOUND IN DOCUMENTS GIVEN TO US. WE CANNOT TALK OF EN DEMOCRAT TEE BECAUSE WE SIMPLY HAVE TO SEE THE WORDS ON THE PAPER. >>JUDGE CANALES: I UNDERSTAND AND COMMISSIONER CHESNEY HAS A QUESTION. ON BUY BOARD CONTRACTS, WE HAVE GONE OVER THIS MULTIPLE TIMES. YOU WILL NOT CHANGE THE BUY BOARD CONTRACTS BECAUSE THEY ARE EXECUTED IN PRIVITY WITH THE STATE OF TEXAS. >> OUR JOB TO ADVISE THE COURT WHEN THERE IS A PART OF THE -- PART OF THE CONTRACT THAT IS NOT FAVORABLE OR IS NOT ACCEPTABLE. AND SO WE HAVE HAD EXPERIENCE IN THE PAST WHERE PURCHASING HAS BEEN ABLE TO STRIKE THOSE THINGS THAT ARE UNFAVORABLE OR UNACCEPTABLE TO THE COUNTY, SO IT IS SOMETHING THAT HAPPENS. >>JUDGE CANALES: IT MIGHT BE PRUDENT TO LOOK AT THE BUY BOARDS WE ARE UTILIZING AND GO AHEAD AND LOOK AT THEIR MASTER AGREEMENTS IN ADVANCE AND IF SOMETHING YOU DON'T WANT TO USE, MAYBE THEY SHOULD NOT BE UTILIZED. THE PURPOSE OF USING THE BUY BOARD IS TO ADOPT THE CONTRACTUAL LANGUAGE FOR THE FAVOR OF THE COUNTY, RIGHT, FOR EXPEDIENCY AND EFFICIENCY AND IT SEEMS TO BE THE OPPOSITE. SO LET'S GO OVER THEM AG AGAIN I,J,M,N TO,O,P ANDQ. AND YOU DON'T BELIEVE ANY OF THEM WILL RESULT IN WHAT I WOULD CALL -- I WAS CONCERNED ABOUT THE ODYSSEYS AND THE, YOU KNOW, ALL THE ONES THAT DEAL WITH I.T. DARYL, YOU CAN BRING IT BACK. YOU CAN GET HER EVERYTHING SHE NEEDS? >> YES. WE DO HAVE THOSE. THOSE WERE PREVIOUS AGREEMENTS. THEY ARE NOT NEW. THEY ARE JUST RENEWALS. AND THE TYLER GOES ALL THE WAY BACK WHEN LANCE MURPHY WAS HERE. THIS IS YEAR THREE OF THAT WHICH IS DUE. I DID DISCUSS A LITTLE BIT WITH THE COUNTY ATTORNEY YESTERDAY AND THEY WERE CONCERNED SEEMED TO BE THE DELAWARE CORPORATION THAT THEY -- THAT THEY HAVE AN AGREEMENT, BUT NOTHING THAT WILL CHANGE THE COST IS IN THERE. AND THEN THE MICROSOFT ONE. THAT IS VERY STRAIGHTFORWARD ON [00:50:05] -- THAT AGREEMENT WANT DONE LAST YEAR AS WELL. IT WAS ON A THREE-YEAR AGREEMENT. CAME UP FOR RENEWAL LAST YEAR. AND ACTUALLY WORKED WELL WITH IT. IT IS A PRODUCT ONLY. ALL OF OUR OFFICE PRODUCTS AND THE -- AND THE EXCHANGE E-MAIL SYSTEM AS WELL AS OTHER PRODUCTS THAT WERE CURRENTLY USING IN -- THEY ARE UP FOR RENEWAL NOW. SO. >>JUDGE CANALES: WHEN DO THEY EXPIRE? >> THEY ARE AT EXPIRATION RIGHT NOW. >>JUDGE CANALES: SO IF THEY EXPIRE, I MEAN, I WOULD LIKE TO SEE IF YOU CAN GET THESE FOR NEXT WEEK. IF THEY ARE EXPIRING AND YOU DON'T HAVE COVERAGE, AND THEY HAVE BEEN IN PLACE THIS ENTIRE TIME WE HAVE BEEN USING THEM -- >> YES. MICROSOFT IS PRODUCT ONLY. NO SERVICES IN IT. SO IT IS A VERY STRAIGHTFORWARD AND -- THE TYLER, WHICH IS OUR CASE MANAGEMENT SYSTEM, LIKE I SAID, THAT WAS DONE A FEW YEARS BACK. SO, YOU KNOW, I EXPECTED IT WOULD HAVE BEEN REVIEWED BACK THEN. I KNOW WE ARE MUCH MORE STRICT NOW AND HAVE BEEN WORKING DILIGENTLY BUT THE RENEWAL ITEMS WERE THE ONES WE WERE WORKING ON NEW -- NEW AGREEMENTS AND THE RENEWALS ARE UNDER CURRENT AGREEMENTS AND THAT'S WHERE THE -- WHERE WE HAVE BEEN DOING A LOT. AND WORKING VERY HARD WITH HER OFFICE, WENT THROUGH ALL THE NEW ONE THAT ARE COMING UP. I APOLOGIZE FOR THESE PARTICULAR ITEMS. THE RICO ONE WHICH IS VERY ROUTINE. COPIER REPLACEMENT. BUT THAT ONE IS NOT AS SIGNIFICANT AS THE OTHER TWO. >>JUDGE CANALES: GO AHEAD COMMISSIONER GONZALEZ AND COMMISSIONER CHESNEY WANTS TO GO AFTER YOU. >>COMMISSIONER GONZALEZ: ON THE P, YOU AND I TALKED ABOUT IT. MY CONCERN IS -- THE INCREASES CAN BE FOR THE NEXT TWO YEARS AND YOU INDICATED THERE WOULD PROBABLY BE SOME INCREASES. SO MY QUESTION WAS -- AND WHY I WANT TO TABLE IT. I WANT TO MAKE SURE WHAT WE ARE LOOKING AT FOR THE NEXT TWO YEARS IS NOT GOING TO BE SOMETHING THAT WILL SURPRISE US AND SAY YOU WILL OWE ANOTHER $200,000 OR $300,000. >> YES, IN FACT CONNIE, IF YOU WILL BRING UP A DOCUMENT, IF THE COURT WILL ALLOW IT, GOING TO WANT TO LOOK AT -- THAT IS THE MICROSOFT ONE. AS I SAID IT HAS A DEFENDER ANTIVIRUS SOFTWARE THAT COMES WITH THAT. AND OUR EXCHANGE E-MAIL SYSTEM AND THE OFFICE PRODUCTS. THAT AGREEMENT HERE THAT IS DONE IS PRODUCT ONLY. VERY SHORT. NO VERBIAGE IN IT. NOTHING REALLY LEGAL IN IT. IT IS WITH MICROSOFT AND BUY THE PRODUCTS OR DON'T BUY THE PRODUCTS. THAT THAT IS THE PRIMARY ONE I AM CONCERNED WITH, BECAUSE HOW WE MANAGE OUR NETWORK AND EVERYTHING. LIKE I SAID VERY LIMITED INFORMATION IN THAT CONTRACT, SO -- IT IS NOT EVEN A CONTRACT. IT'S A THREE-YEAR AGREEMENT. AND WITH IT, IT HAS NO COST INCREASE I WORK DILIGENTLY WITH THE CONSULTANT AND GOT BACK WITH MICROSOFT AFTER THAT AND HAS BEEN AROUND A $545,000 INVOICE ON IT AND WE BEAT IT DOWN TO 425 AT THE BOTTOM OF THIS DOCUMENT. AND THAT AMOUNT RIGHT THERE WENT DOWN BY $120,000. SO IT CAME OUT VERY GOOD, BECAUSE WE RESTRUCTURED HOW THE LICENSES WERE FROM THE PREVIOUS THREE YEARS. SO IT CAME OUT VERY WELL. AND THERE IS NOT REALLY MUCH MORE TO THIS. SO THERE WAS NOTHING REALLY TO REVIEW FROM IT FROM A LEGAL PERSPECTIVE REALLY. AND -- >>COMMISSIONER GONZALEZ: BUT THAT IS YOUR OPINION. >>COMMISSIONER CHESNEY: AN MAY I OPINION. >>COMMISSIONER GONZALEZ: TALKING OF CONTRACT AND AGREEMENT. ONE THING THE COUNTY ATTORNEY NEEDS TO LET US KNOW. >> BUT NO COST INCREASE ON THIS ONE OVER THE THREE YEARS. IT DOESN'T HAVE -- >>COMMISSIONER CHESNEY: WE MADE A MOTION TO TABLE AND SECONDED AND DISCUSSING AND DISCUSSING AND I AM TRYING. I DON'T EVEN KNOW WHY WE ARE AT THIS POINT, DARYL. I THINK WE WILL KEEP DISCUSSING IT AND NOT SUPPOSED TO AND I WILL KEEP DOING THIS TOO. WHY ARE WE AT THIS POINT. WHY DIDN'T YOU TAKE IT UP TO THE COUNTY ATTORNEY FOR RENEWAL AS THE DEPARTMENT HEAD RESPONSIBLE FOR THIS. YOU ARE SITTING HERE REPRESENTING NO BIG DEAL BUT WE END UP WITH CONTRACTS ALL THE TIME UP HERE IF WE HAD GIVEN THE COUNTY ATTORNEY MORE TIME TO REVIEW AND THESE ARE BAD CONDITIONS AND NOT FAVORABLE. THE COUNTY ATTORNEY IS TRYING TO GET HER JOB. AND WHY WOULDN'T WASN'T THIS GIVEN BACK TO HER. DID YOU LET IT EXPIRE WITHOUT BRING IT TO THE COUNTY ATTORNEY TIMELY? >> I DIDN'T KNOW THAT THE RENEWALS WERE THESE TYPES OF RENEWALS AND HAD TO BE DONE WITH THE NEWER AGREEMENTS THAT WE ARE [00:55:03] WORKING ON. >>COMMISSIONER CHESNEY: YOU ARE THE DEPARTMENT HEAD OF I.T. THAT IS RESPONSIBLE FOR THE I DON'T EVERY SIGHT OF KNOWING WHEN THESE CONTRACTS ARE UP, CORRECT? THAT IS YOUR RESPONSIBILITY. >> YES, YES. >>COMMISSIONER CHESNEY: THIS QUITE FRANKLY IS ON YOU. YOU ARE PUTTING THIS COURT IN A POSITION BECAUSE YOU APPARENTLY DIDN'T KNOW THEY WERE COMING UP AND YOU ARE THE DEPARTMENT HEAD AND SHOULD KNOW THAT THESE THINGS COMING UP AND YOU ARE TRYING TO RUSH THE COUNTY ATTORNEY AND MY QUESTION EARLIER WHICH WAS PERTINENT TO THE MOTION TO TABLE. AND AGAIN I WILL TAKE THIS UP DARYL. I HAVE A PROBLEM WITH THE WAY IS ALL COMING DOWN AGAIN WITH I.T. THE MOTION TO TABLE WHICH IS WHAT WE ARE DISCUSSING. JEN HEY, WHEN DO YOU -- WHEN WILL THIS PROVIDE -- HOW MUCH TIME DO YOU NEED TO REVIEW THE THINGS BECAUSE I DON'T WANT TO APPROVE ANYTHING UNTIL YOU SIGN OFF ON IT BECAUSE THIS IS THE PROBLEM WE GET IN ALL THE TIME. I DON'T WANT YOU COMING BACK AND SAYING THIS IS ANOTHER BAD CONTRACT AND WE SHOULDN'T HAVE SIGNED IT AFTER THE FACT. I NEED TO KNOW WHICH DATE WE ARE TABLING THESE THINGS TOO. I NEED DEPARTMENT HEADS EYE DAY TO WORK FOR YOU. TO HAVE MEETINGS ON A REGULAR BASIS AND I AM NOT STARTING JANUARY LIKE THIS. I AM NOT GOING INTO JANUARY WITH THIS STUFF WHERE WE ARE RUSHING OF THE COURT INTO SOMETHING BECAUSE SOMEBODY DIDN'T DO WHAT THEY ARE SUPPOSED TO DO. HE REPORTS TO YOU. YOU ARE RESPONSIBLE. THE BUCK STOPS WITH YOU. THIS IS AN I.T. DEAL. THIS NEEDS TO BE DOCUMENTED HERE WE ARE IN A BAD SITUATION TRYING TO FIGURE OUT HOW TO RUSH ALL THIS. I AM NOT RUSHING THE COUNTY ATTORNEY TO TELL ME TO GET AN OPINION. IF SOMETHING GOES WRONG THAT IS ON I.T. AND YOU AID AAE FOR NOT DOING IT RIGHT. ON THESE ITEMS HOW MUCH TIME DO WE NEED, WHEN DO THEY NEED TO BE TABLED TOO. ALL I WAS TRYING TO GET TO A LONG TIME AGO AND A 30-MINUTE DISCUSSION. >>JUDGE CANALES: GO ONE BY ONE AND ASK THAT QUESTION, JENNY. FIRST ONE IS -- WOULD YOU LIKE THAT ONE DECEMBER 14 OR JANUARY 4. AND THEY WILL START MAKING NOTES. BECAUSE SOME ARE DIFFERENT THAN OTHERS. FOR EXAMPLE N IS NOT -- YOU DON'T NEED TO DO ANYTHING. IT HAS TO DO WITH A FUNDING QUESTION. >>COMMISSIONER GONZALEZ: I MAKE THE MOTION, JUDGE. AND N WILL BE IN JANUARY. I WILL MOVE -- I WILL MAKE A MOTION. N WILL BE IN JANUARY. >>COMMISSIONER CHESNEY: I AM OKAY WITH THAT AS LONG AS IT -- I THINK WE CAN DO THEM ALL THAT WAY BUT FOR ANY OF THEM ARE DEEMED BY THE COUNTY ATTORNEY OR THE DEPARTMENT HEAD THAT IS RESPONSIBLE FOR IT THAT IT NEEDS TO BE SOONER AND IT CAN BE DONE REALISTICALLY, THEN THAT CAN BE BROUGHT BACK ON THE 14TH IF THAT IS OKAY, COMMISSIONER. AND JENNY MAY NOT KNOW THE ANSWER OF THAT. >>COMMISSIONER GONZALEZ: I DON'T WANT TO PUT PRESSURE ON HER. >> WE DO KNOW THAT I BELIEVE -- I BELIEVE I CAN BE DONE VERY SAFELY BY THE 14TH. NOT A PROBLEM. AND THEN J. JZ SHOULD BE READY SAFELY BY THE 14TH ALSO. THAT ONE IS NOT. >>JUDGE CANALES: WHAT ABOUT THE MICROSOFT AND THE ODYSSEY AND THE RICO. >> MICROSOFT I WOULD LIKE TO GET BACK TO YOU LATER IN THE DAY PERHAPS. THAT HAS ALREADY EXPIRED. THAT EXPIRED 11-30-22. >>JUDGE CANALES: THAT IS MY CONCERN. >> I CAN'T TELL YOU SITTING HERE TODAY WHAT THE RAMIFICATIONS OF THAT WILL BE AS FAR AS THE RENEWAL. >>COMMISSIONER CHESNEY: SO COULD -- THE ONES THAT WE KNOW CAN BE TABLED TO THE 14 WILL BE I AND J. ANY OTHERS THAT YOU KNOW WILL BE READY ON THE 14TH? AND IF YOU DON'T, I AM NOT PRESSURING YOU. I WANT IT TO BE DONE RIGHT. >> YES, O IS THE MICROSOFT. >>COMMISSIONER CHESNEY: O WHAT? >> O IS THE MICROSOFT AND I CAN GET INFORMATION THROUGHOUT THE DAY. >>JUDGE CANALES: WE WILL HOLD BACK ON O THEN. SHE SAID SHE WILL GIVE US AN ANSWER AT THE END OF THE DAY COMMITTEES COMMITTEES WHICH ONES FOR SURE ARE OKAY FOR THE 14TH. >> THAT IS PROBABLY IT. I AND J. >>COMMISSIONER GONZALEZ: I, J AND O. >>COMMISSIONER CHESNEY: THE ONES WE KNOW ON THE 14TH. TABLES THE OTHER UNTIL JANUARY UNLESS THEY ARE READY AND THEN WILL BE BACK ON THE 14TH. >> JENNY, THE MICROSOFT CAN WAIT UNTIL THE 14TH AND THE OTHERS CAN WAIT UNTIL THE 4TH. I CAN WORK THAT OUT WITH THE VENDOR BECAUSE -- BECAUSE I AM NOT GOING TO PUT THE COUNTY ATTORNEY IN ANY SITUATION HERE. I APOLOGIZE FOR THIS BECAUSE I DIDN'T KNOW THAT -- I DIDN'T KNOW THAT RENEWALS THAT WERE UNDER ALREADY AGREEMENT WILL BE SUBJECT TO IT THE STRINGENT STUFF WE HAVE BEEN DOING WITH THE NEW ONES. BUT I AM NOT GOING TO -- I AM NOT GOING TO PRESSURE THE COUNTY ATTORNEY OR THE COMMISSIONERS COURT. I WILL GO BACK TO THE VENDOR SHI FOR MICROSOFT AND THAT CAN BE [01:00:01] PUT OFF TOWARD THE 14TH AND THE OTHERS CAN BE PUT OFF TOWARD THE -- UNTIL JANUARY 4. >>COMMISSIONER CHESNEY: P AND Q. I AM JUST MAKING SURE. >>JUDGE CANALES: THAT'S CORRECT. P AND Q. >> Q IS THE RICO ONE, THE COPIER REPLACEMENT AND CAN WAIT TO THE 4TH. >>COMMISSIONER GONZALEZ: N TO THE 4TH. >>JUDGE CANALES: N IS NOT DARYL. IT IS MICHAEL. WE ARE TRYING TO FIGURE OUT HOW TO DO THIS WITH THE DAYS. >>COMMISSIONER CHESNEY: IF IT IS NOT READY ON THE 14 ST WE WILL DEAL WITH THAT THEN. P AND Q GO TO JANUARY 4 AND LEAVE US WITH N. >>JUDGE CANALES: N WAS A -- HE WANTS TO TABLE IT UNTIL JANUARY BECAUSE OF THE FUNDING. BUT I WANT TO REMIND COMMISSIONER GONZALEZ THAT THE FUNDING WAS ESTABLISHED BY THE COURT AND IT WAS ARPA AND DONE CUMULATIVELY AND AIDAE CAN CONFIRM. IF WERE YOU -- >>COMMISSIONER GONZALEZ: MY MOTION FOR THE 4TH, JUDGE. >>JUDGE CANALES: YOU ARE ASKING A QUESTION OF THE FUNDING. THE FUNDING EXISTS ALREADY. >>COMMISSIONER GONZALEZ: TALKED WITH THE FUNDING WITH DARYL. >>COMMISSIONER HERNANDEZ: WHAT WAS YOUR MOTION, COMMISSIONER? >>COMMISSIONER CHESNEY: TALKING OF N, COMMISSIONER? >>COMMISSIONER GONZALEZ: N. >>JUDGE CANALES: THE FUNDING FOR THE CASE MANAGEMENT SOFTWARE WAS APPROPRIATED ABOUT THE COURT. >> THE FUNDING FOR THE -- OH, FOR THE QUINCY, WITH THE MEDICAL EXAMINER? YES, I -- AS A MATTER OF FACT, I HAVE THIS IN FRONT OF ME BECAUSE IT DID -- I.T. ONLY -- KENT AND I MET WITH THEM TO GO OVER THE AGREEMENT. BUT THEN PURCHASING ACTUALLY MANDELED THE AGENDA ITEM. I HAVE -- I HAVE REVIEWED IT. AND IT LOOKS OKAY, BUT I THINK COMMISSIONERS WILL LIKE TO MAKE SURE THAT IS THE ONLY THIS I THINK THAT WILL WORK FOR THEM. >>COMMISSIONER CHESNEY: JENNY, HAVE YOU REVIEWED IT? HAVE YOU REVIEWED N? >>JUDGE CANALES: N IS AN AUTHORIZATION FOR A SOLE SOURCE. >> THIS IS THE ONE WHERE THERE IS ONLY A LITTLE BIT OF INFORMATION FOR THE COURT WHENEVER THEY DO DISCUSS IT WILL FILL IN SOME DATES. BUT AS FAR AS OUR REVIEW OF THAT, THAT -- THAT WE ARE -- WE ARE -- WE ARE COOL WITH THAT ONE. >> MY ONLY CONCERN FROM I.T. THAT THEY SUSTAINED FUND FOR THE RENEWALS, IF THEY WERE STILL GOING TO USE ARPA FOR THAT. NOT MY CALL IF THEY CAN OR NOT SO MY CONCERN WAS LOOKING AT THIS AND MAKING SURE THAT THEY CAN SUSTAIN IS IT AFTER IT WAS FUNDED THE FIRST YEAR AND IF COMMISSIONERS ARE COMFORTABLE WITH THE DOLLAR AMOUNT FOR THE FIRST YEAR. THAT ONE, I HAVE NO -- IF IT NEEDS TO WAIT, IT NEEDS TO WAIT AND WE CAN REVIEW IT IS IT SOME MORE AND MAKE SURE THAT THE SOLE SOURCE IS APPROPRIATE AND NOT ANOTHER APPLICATION. >>COMMISSIONER CHESNEY: I DON'T LOVE SOLE SOURCE EITHER MYSELF. I AM NOT A FAN OF SOLE SOURCE. I AM OKAY. SOUNDS LIKE L, I, J AND O FOR THE 14TH. >>JUDGE CANALES: DR. FAGAN IS ON THE LINE AS WELL AS FOREST MITCHELL. I DON'T KNOW IF YOU HAVE ANYTHING ELSE -- I CAN'T RECALL AT THE MOMENT IF YOU HAVE ANYTHING ELSE ON THE AGENDA. I WILL SUGGEST THAT YOU GO OUTSIDE AND VISIT WITH DARYL AND GET HIM UP TO SPEED ON MEDICAL TECHNOLOGY SOFTWARE AS WELL AS OUR PROCUREMENT AGENT BECAUSE -- >>COMMISSIONER GONZALEZ: CALL FOR THE QUESTION. >>JUDGE CANALES: YOU HAVE THE WRONG PERSON ADVISING. YOU DON'T KNOW ANYTHING ABOUT MEDICAL, TECHNICAL, M.E. SOFTWARE. WE WILL WORK TOGETHER TO GET THAT ACCOMPLISHED. OKAY. SO WILL YOU ALL PLEASE DO THAT. SO WHY DON'T YOU RESTATE YOUR MOTION NOW THAT YOU HAVE ALL THE RIGHT DATES AND ALL THE RIGHT. >>COMMISSIONER GONZALEZ: MOTION TO CABLE I, J AND O TO THE 14TH. >>COMMISSIONER HERNANDEZ: S SECOND. >>COMMISSIONER GONZALEZ: OF DECEMBER 2022. AND ALSO TO TABLE N, P, AND Q TO THE 4TH OF JANUARY. 2023. >>JUDGE CANALES: SO THE MOTION -- THAT IS A MOTION. IS THERE A SECOND. >>COMMISSIONER HERNANDEZ: SECOND. >>JUDGE CANALES: OKAY. ALL TO HE WAS IN FAVOR, SIGNIFY BY SAYING AYE. I AM A NO FOR THE N, FOR THE REASON THAT MEDICAL SOFTWARE THAT HAS BEEN DELAYED AND ALREADY APPROPRIATED SHOULD BE IN THE HANDS OF MEDICAL PROFESSIONALS AS SOON AS POSSIBLE. OTHERWISE THE ADMINISTRATION OF JUSTICE CANNOT BE HAD, AND THIS IS APPARENTLY LOST HERE. [1. Discuss and consider the renewal of Nueces County's Workers Compensation Insurance Coverages for Calendar Year 2023.] SO, WE WILL MOVE ON. WE HAVE GOT -- I HAVE GOT [01:05:02] DISCUSS AND CONSIDER THE RENEWAL OF THE WORKERS COMPENSATION. I BELIEVE JENNY, YOU HAVE REVIEWED THIS. >> YES. WE ARE STILL GATHERING DOCUMENTS. I DON'T HAVE AN OBJECTION TO THIS ONE, BUT WE ARE STILL GATHERING THE UNDERLYING DOCUMENTS. SO THAT IN THE FUTURE WHEN THESE DO COME UP, WE WILL BE ABLE TO ASSIST AND PROACTIVELY HAVE ALL THE REVIEW DONE. >>JUDGE CANALES: ALL RIGHT TAMPA TO TIM, PRESENT THE WORKMAN'S COMP AND THE COVERAGE ALL FOR THE YEAR '23. ALL HAVE CHASE CARLISLE HERE WITH US TO ANSWER ANY UNDERWRITING QUESTIONS AND CONCERNS. >> GOOD MORNING ONCE AGAIN, JUDGE, COMMISSIONERS BEFORE THE COURT THIS MORNING IS 2023 WORKERS COMPENSATION COVERAGES AND THE INFORMATION THAT I PROVIDED TO THE COURT, WE ARE WELL BELOW OUR 2021 NUMBERS AS FAR AS OUR LOSSES IN WORK-RELATED INJURIES. FOR THE -- FOR THE 504,000, WE ARE ALSO WELL WITHIN THE BUDGETED AMOUNT THAT WAS IN THE 2023 BUDGET AS WELL. SO WE ARE WITHIN THAT AS WELL. AS YOU CAN SEE, THE MAJORITY OF OUR LOSSES -- OF OUR LOSSES ARE 68%. THAT IS HISTORICAL. HISTORICALLY CORRECT ACROSS THE BOARD AND THE RUNNING NUMBERS. CHASE IS HERE AS WELL. HE WILL GIVE YOU THE PERCENTAGES. I KNOW IT WENT UP FROM LAST YEAR OF 39,000. HE AND I DISCUSSED WHY IT WENT UP AND I WILL ALLOW HIM TO TALK ABOUT IT BECAUSE I DON'T WANT TO STAND HERE AND TAKE UP ALL THE CHIME. CHASE. >> GOOD MORNING. THANK YOU FOR HAVING ME MERE. AS TIM SAID, WE SAW A PREMIUM INCREASE, BUT THAT IS PRIMARILY DRIVEN BY AN EXPOSURE INCREASE. LAST YEAR WHEN THE POLICY STARTED, THEY WILL A ROUGHLY $52 MILLION OF PAYROLL, THIS YEAR THE RENEWAL WAS 59 MILLION AND INCREASE OF $7 MILLION IN PAYROLL THAT REPRESENTS 18%. THE PREMIUM INCREASE -- SORRY 13%. THE PREMIUM INCREASE IS 8%. THE DIFFERENCE BETWEEN THE TWO IS 5% WHICH ULTIMATELY REFLECTS THAT YOU GUYS RECEIVED A 5% REDUCTION IN YOUR OVERALL RATES. OVERALL, I THINK THAT WAS A WIN. YES IT IS COSTING US A LITTLE BIT MORE MONEY, BUT HIGHER EXPOSURE ON THE PAYROLL. >>JUDGE CANALES: COME MESH RAT. >> THE IMPORTANT PART YOU HAVE A RATE DECREASE. >>JUDGE CANALES: ALL RIGHT. ARE THERE ANY REQUEST HE IS? A MOTION TO APPROVE THE NEW WORKERS COMPENSATION. >>COMMISSIONER CHESNEY: SO MOVED. >>COMMISSIONER HERNANDEZ: SECOND. >>JUDGE CANALES: MOTION AND A SECOND. ALL TO HE WAS IN FAVOR OF THIS RENEWAL, SIGNIFY BY SAYING AYE. ALL RIGHT, THANK YOU. THE NEXT TWO ITEMS ON THE AGENDA ARE WHAT IS CHARACTERIZED AS CLEANUP BY THE COUNTY ATTORNEY'S OFFICE AND OUR COUNSEL, BOND COUNSEL, AND I WILL READ THEM BUT I UNDERSTAND JENNY, IN ADVANCE, THESE ARE -- THIS IS LANGUAGE THAT HAS COME STRAIGHT FROM OUR COUNSEL THAT IS NEEDED IN FURTHERANCE AND PURSUANT OF THE FINANCES. WHAT IT BASICALLY DOES IS HELP FIRM UP THE LANGUAGE WITH REGARDS TO WHAT IS NEEDED WHEN YOU ARE BORROWING AND YOU NEED TO STATE WHERE THOSE DOLLARS ARE COMING FROM, OUR INS, BUT YOU HAVE TO ACTUALLY REFER BACK TO [2. Discuss and consider order authorizing and levying an annual ad valorem tax in connection with the issuance of $5,060,000 in principal amount of public property finance contractual obligations to be issued by the county to for the purchase and installation of materials, supplies, furnishings, equipment, machinery, and computers information technology systems, applications, hardware, and software.] THE AD VALOREM THAT PRODUCES THE INS. HERE IT IS TO DISCUSS AND CONSIDER -- THIS IS THE PART, AUGHT TRYING AND LEVYING AN ANNUAL AD VALOREM TAX IN ISSUANCE OF 5.60,000 -- 5,006,000. AND FINANCE AND CONTRACTUAL OBLIGATIONS TO BE ISSUED BY THE COUNTY FOR THE PURCHASES AND MATERIALS FOR MACHINES, EQUIPMENT, MACHINE REESE AND COMPUTERS AND INFORMATION, APPLICATIONS, HARDWARE AND SOFTWARE. I WILL REFER TO AIDAI BECAUSE SHE BROUGHT THIS TO ME AND SAID WE NEEDED TO ACCOMPLISH THIS. AGAIN, ALL OF PREVIOUS WORK THAT WE HAVE DONE ALREADY REFLECTS WHAT THIS IS ABOUT, WHICH IS THE BORROWING FOR THE ONE SOLUTION SOFTWARE. >> COUNSEL IS HERE. >>JUDGE CANALES: COUNSEL IS WITH US. I SAID ONE SOLUTION. WORK DAY. I HAD IT IN MY HEAD FROM THE PREVIOUS. >>COMMISSIONER CHESNEY: I HAVE QUESTIONS ON THESE TWO. I DIDN'T UNDERSTAND WHY THERE WERE TWO ITEMS. ONE FOR 5.06. ONE FOR. >>JUDGE CANALES: I WILL LET THE COUNSEL ANSWER THAT. >>COMMISSIONER CHESNEY: PLEASE, THANK YOU. >>JUDGE CANALES: COULD YOU JUST [01:10:01] PLEASE UNMUTE. AIDAI. ISAIAH -- MR. WETA. WILL YOU BE ABLE TO HELP US. ITEMS TWO AND THREE ARE THE ITEMS REQUESTED BY BOND COUNSEL. THE QUESTION THAT MR. CHESNEY HAS IS -- MR. CHESNEY. >>COMMISSIONER CHESNEY: EXCUSE ME. I AM CHOKING. WHY IT IS SET UP WITH LANGUAGE TO WHERE IT IS 5.060 AND 5.585. I READ THE RESOLUTION BUT NO EXPLANATION WHY WE ARE DOING THIS. AND I NEED TO UNDERSTAND WHY THESE ITEMS ARE ON HERE. AND I WANT TO MAKE SURE. >>JUDGE CANALES: THE REFUNDING. I THINK HE IS ASKING YOU ABOUT THE REFUNDING. >>COMMISSIONER CHESNEY: TWO AND THREE IS WHAT I AM ASKING ABOUT. >> YES, GOOD MORNING, EVERYONE, LADIES AND GENTLEMEN OF THE COURT. I AM ISAIAH. TO ADDRESS THE COMMISSIONER'S QUESTION. THE ITEM 2 AS IT RELATED TO THE PPCFO'S RETURN TO FUND THE SOFTWARE WHILE ITEM 3 WITH A REFUNDING AND SOMEWHAT A RESTRUCTURES TO HELP MAINTAIN THE LEVEL OF TAX RATE GOING FORWARD. THE INITIAL OBJECTIVE GIVEN BY THE COURT WAS TO FIND FUNDING FOR THE SOFTWARE PROJECT WHILE ALSO, AGAIN, MAINTAINING A DEBT SERVICE AND TAX RATE GOING FORWARD. AND SO THAT'S WHY THERE ARE TWO ITEMS UNRELATED TO THE PROJECT FUND AND ITEM 3 IS THE REFUNDING CREATING SAVINGS TO MAINTAIN THE TAX RATE. >>COMMISSIONER CHESNEY: THREE IS SIMPLY REFUNDING -- WHEN YOU SAY REFUNDING -- THAT IS TO RESTRUCTURE THAT DEBT AND ISSUE NEW DEBT FROM NUMBER 2? >> THREE IS RELATED TO 2015 SERIES THAT WAS ALREADY OUTSTANDING. AND WE ARE REFUNDING PORTIONS OF THAT 2015 IN CREATING SAVINGS FROM THE FRONT EEND THAT HELPED CAPACITY NOR NUMBER TWO WHICH IS THE SOFTWARE PROJECT. >>COMMISSIONER CHESNEY: WITHOUT INCREASING OUT DEBT -- WITHOUT INCREASING OUR DEBT AND HAVING TO INCREASE OUR INS TAX RATE? >> WITHOUT INCREASING THE TAX RATE, CORRECT. OVERALL, INCREASE IN DEBT BECAUSE WE ARE ISSUING BONDS TO FUND THE SOFTWARE PROJECT, BUT RESTRUCTURED IN A WAY TO MAINTAIN THE LEVEL OF TAX RATE TO $.42. >>COMMISSIONER CHESNEY: REFUNDING IS A MISNOMER. IT SOUNDS LIKE WE ARE GETTING MONEY BACK. HOW WOULD YOU DESCRIBE IT OTHER THAN A REFUNDING TO BE TRANSPARENT. NOT REALLY A REFUNDING BECAUSE YOU ARE GETTING IT BACK. >> A RESTRUCTURING ON THE PRESENT VALUE PACE IS. A DEPOSIT -- A SAVINGS OF JUST OVER $60,000. >>JUDGE CANALES: REFUND SOMETHING THE CORRECT TERM. MR. HUERTA, REFUND SOMETHING THE CORRECT FINANCIAL TERM IN THIS SITUATION. >>COMMISSIONER CHESNEY: I UNDERSTAND THAT AND -- IF THE PUBLIC READS THIS AND THAT MAY BE THE CORRECT FINANCIAL TERM BUT THE REAL WORLD THAT WE ALL OPERATE, REFUNDING INDICATES THAT WE ARE GETTING MONEY BACK. >>JUDGE CANALES: WE ARE, SIR, THERE ARE SAVINGS. THAT MEANS COMING BACK. >>COMMISSIONER CHESNEY: BUT CONNECTS WITH THE ISSUANCE OF REFUNDING BONDS TO BE ISSUED BY THE COUNTY AND HE WE ARE NOT DECREASING OUR DEBT. WE ARE GETTING A LITTLE BIT OF MONEY BACK BUT STILL INCREASING OUR DEBT. >> TWO ISSUE -- TWO ISSUENESSANCES HERE. NUMBER THREE, ISOLATED AWAY FROM NUMBER TWO IS A REFUNDING WITH NET PRESENT VALUE SAVINGS OF JUST OVER $60,000. >>COMMISSIONER CHESNEY: SAVINGS, GOT IT. THANK YOU. >>JUDGE CANALES: THERE A MOTION TO APPROVE AND AUTHORIZE THE LEVYING AS READ FOR THE ISSUANCE OF $5,068,000 FOR ITEM NUMBER TWO FOR THE PURCHASE OF THE ITEMS I PREVIOUSLY MENTIONED THAT AREN'T LISTED. I WILL MAKE THE MOTION. IS THERE A SECOND. >>COMMISSIONER HERNANDEZ: SECOND. >>JUDGE CANALES: ANY FURTHER [3. Discuss and consider order authorizing and levying an annual ad valorem tax in connection with the issuance of $5,585,000 in principal amount of limited tax refunding bonds to be issued by the county for the purpose of providing for the (i) discharge and final payment of the refunded obligations and (ii) payment of the costs of issuance of the bonds.] DISCUSSION? ALL THOSE IN FAVOR, SIGNIFY BY SAYING AYE. ITEM NUMBER 3 IS THE SAME, ONLY THIS DEALS WITH THE REFUNDING, THE RESTRUCTURING AS WAS SAID AND DEALS WITH THE SAVINGS THAT WILL BE ACQUIRED OF 5.585 MILLION AND THERE IS A MOTION TO LEVY THIS AS WELL IN CONNECTION [01:15:02] WITH THE ISSUANCE? I WILL MAKE THE MOTION. IS THERE A SECOND? >> SECOND. >>JUDGE CANALES: THANK YOU. ALL THOSE IN FAVOR, SIGNIFY BY SAYING AYE. HOW SHOULD WE RECORD YOUR VOTE ON THE LAST TWO, COMMISSIONER CHESNEY. >>COMMISSIONER CHESNEY: I AM TRYING TO REMEMBER -- I WAS SITTING HERE TRYING TO REMEMBER, JUDGE, IF I ABSTAIN. I DON'T HAVE ANY CONFLICT AND I THINK I VOTED NO ON THESE BUT I CAN'T REMEMBER. >> IT WAS A NO. >>COMMISSIONER CHESNEY: I THINK I AM GOING TO REGISTER NO. >>JUDGE CANALES: YOU WILL BE CONSISTENT. >>COMMISSIONER CHESNEY: NO ON TWO, YES ON THREE TO BE CONSISTENT. >>JUDGE CANALES: THAT WAY WE GOT YOU. >>COMMISSIONER CHESNEY: I APPRECIATE IT. TRYING TO SIT HERE TO REMEMBER. [4. Discuss and consider requesting an extension of the beginning date for the Texas Indigent Defense Commission Public Defender Office grant from July 1, 2022 to November 7, 2022 and update designation of Program Director.] >>JUDGE CANALES: DISCUSSION -- OKAY, THANK YOU. ITEM NUMBER 4 IS IMPORTANT BECAUSE IT DEALS WITH OUR NEWLY TREATED INDIGENT DEFENSE COMMISSION. AND WE MEET OUR NEW PUBLIC DEFENDER AND SHE IS GETTING STARTED. THERE ARE MOVEMENTS AFOOT WITH REGARDS TO THE CREATION OF B BOTHED AN OFFICE STAFF AND SPACE; HOWEVER, SHE DID NOT GET HIRED -- AND AIDAI, THERE MIGHT HAVE BEEN AN ERROR HERE. I THINK IT IS NOVEMBER 7. THAT IS THE OFFICIAL DATE. >> THAT'S CORRECT. >>JUDGE CANALES: IT WAS BEFORE BUT SEEMS LIKE IT WAS SO RECENT. HER OFFICIAL DATE OF EMPLOYMENT WAS NOVEMBER 7. THE PURPOSE OF TODAY'S AGENDA, UNDER THE RULES, I CAN SEND A LETTER BUT BROUGHT IT TO THE COURT FOR NOT ONLY AWARENESS BUT CONFIRMATION THAT WE PREFER THAT THE GRANT START THE DATE SHE STARTED. AND THAT IS REALLY WHY THIS LETTER IS HERE. AND I AM SEEKING THAT EXTENSION FROM THE TIDC'S OFFICE AND INSTEAD OF JULY 1, THE WAY THE GRANT HAD IT AND INSTEAD NOVEMBER 7 TO CORRESPOND WITH HER ACTUAL EMPLOYMENT. >>COMMISSIONER CHESNEY: JUDGE YOU HAVE YOU A BLANK FOR THE PROGRAM DIRECTOR. PUT THE CURRENT GRANTS? >> THAT'S CORRECT. >>JUDGE CANALES: ANA VELASQUEZ IN THE BLANK AND I DIDN'T KNOW THAT WHEN WE DID THE LETTER. THE FILL IN THE BLANK. >>COMMISSIONER CHESNEY: SO MOVED. >> SECOND. >>JUDGE CANALES: MOTION AND MULTIPLE SECONDS. I HEARD MR. GONZALEZ. SHE IS ON THE LINE AND HERE TO ANSWER ANY QUESTIONS. I DON'T THINK THERE IS ANYTHING HERE. THIS IS MERELY A FORMALITY, BUT AN IMPORTANT ONE TAMPA RIGHT DENNIS, WE WANT TO MAKE SURE WE DON'T GET DOCKED FOR THE TIME. WE WANT TO START THE CLOCK AT THE RIGHT DATE. IS THAT ACCURATE? THERE SHE IS. >> HI. YES, THAT'S CORRECT. IT IS REALLY JUST A HOUSEKEEPING THIS I THINK TO MAKE SURE THAT OUR REPORTING DEADLINES CORRESPOND TO THE BEGINNING OF THE PROGRAM. AND TO MAKE SURE WE HAVE THE FULL BENEFIT -- I BELIEVE A 24-MONTH PERIOD TO SPEND THE GRANT MONEY. >>JUDGE CANALES: THAT'S CORRECT. GREAT. NOT QUESTIONS BUT CLARIFICATIONS. ALL THOSE IN FAVOR, SIGNIFY BY SAYING AYE. I WILL BE SIGNING THIS SHORTLY AS SOON AS I GET A LITTLE BIT OF A CLEANER COPY, AND WE WILL GET IT UP TO ANA WHO WILL GET IT TO YOU. BUT WE KNOW YOU NEED TO GET THIS OUT TODAY AND THAT IS MY ATTENTION. >> THANK YOU. >>JUDGE CANALES: THANK YOU. WE HAVE ALREADY DONE ITEM NUMBER [6. Discuss and consider concurring with Coastal Bend Council of Governments proposed Method of Distribution for declined/de-obligated Hurricane Harvey CDBG-Disaster Recovery funds resulting in a $61,000 award to Nueces County.] 5. AND I AM SET SOMETHING THE TABLE FOR ITEM NUMBER 6 NOW. AND BASICALLY THIS IS AN OPPORTUNITY TO GET MORE MONEY. AND I WILL EXPLAIN IN JUST A MOMENT. DISCUSS AND CONSIDER CONCURRING WITH THE COASTAL BEND COUNCIL OF GOVERNMENT METHOD OF DISTRIBUTION FOR HURRICANE HARVEY CDBG DISASTER RECOVERY FUNDS RESULTING IN A $61,000 AWARD TO NUECES COUNTY. SO WHAT THIS IS THERE WERE FUNDS THAT WERE NOT UTILIZED INSIDE OUR REGION AND WHAT THE COG IS SEEKING IS PUBLIC COMMENT FROM THE JURISDICTIONS ON WHETHER OR NOT THEIR METHOD OF DISTRIBUTION IS ONE THAT WE CAN, AS THEY SAID, ACCEPT AND LIVE WITH. WHEN YOU USE THE METHOD OF DISTRIBUTION, WE WILL GET AN EXTRA $61,000. ALL THE JURISDICTIONS IN THE COG, IF YOU WANT TO SEE WHAT THEY ARE, I BELIEVE THEY ARE ATTACHED. IN YOUR PACKET, BUT THE PURPOSE OF THIS IS THAT WE NEED TO MAKE PUBLIC COMMENT NEXT -- BELINDA [01:20:04] IS NOT HERE. I CAN'T REMEMBER THE DATE BUT THE PUBLIC COMMENT NEEDS TO BE ISSUED AND WE THOUGHT IT BEST TO SPEAK WITH ONE VOICE AND SAID, YES, WE WOULD LOVE TO ACCEPT THESE EXTRA DOLLARS. AND SO THAT IS WHAT THIS IS ABOUT. AND I WILL ASK FOR A JUST TO INSTRUCT OUR GOVERNMENTAL AFFAIRS OFFICERS TO GO MAKE PUBLIC COMMENT IF WE SO CHOOSE TO DO THIS TO CONCUR WITH THEIR PROPOSED MONEY THEY WANT TO GIVE U US. >>COMMISSIONER GONZALEZ: ANY OF THE MONIES WE GET FROM THAT, JUDGE, EAR MARK THAT FOR THE ROOF FOR THE COUNTY COURTHOUSE? >>JUDGE CANALES: YOU CAN -- I DON'T THINK THAT WOULD BE A PROBLEM, BUT I I DON'T HAVE THE -- DR, DISASTER RECOVERY. KATH KATHY, WILL YOU ABLE TO HELP US AND VISIT WITH ANA. THIS IS A HURRICANE HARVEY OLD PROGRAM, WHERE DISASTER RECOVERY FUNDS CAN BE USED. TYPICALLY ANYTHING THAT WAS DAMAGED DO BE USED. I WOULD THINK THAT IS ANOTHER AGENDA ITEM FOR ANOTHER DAY AND I WOULD SAY, YES, WHY DON'T YOU AIDAI WORK WITH THIS TEAM AND GET BACK. THE PURPOSE IS TO GET THE MONEY. >>COMMISSIONER GONZALEZ: SO MOVED. >>COMMISSIONER HERNANDEZ: SECOND. >>JUDGE CANALES: A MOTION AND A SECOND. ALL THOSE IN FAVOR, SIGNIFY BY SAYING AYE. [7. Discuss and consider reduction of the CDBG-MIT grant submission of the living breakwater island project, “Rincon Breakwater Oyster Reef,” from $98,857,651.40 to $14,000,000.] AND ON THE NEXT ITEM, FULLY AWARE OF THE INTENT COMMISSIONER HERNANDEZ AND COMMISSIONER CHESNEY. IT HAS BEEN CLEARED. I HAVE SOME COMMENTS BEFORE I CALL ON YOU, BECAUSE WE ARE SO IN LOVE WITH ROBERTS RULES OF ORDER. UNTIL I CALL ON YOU, NO MOTIONS CAN BE MADE. HERE ARE MY COMMENTS. IF YOU PERMIT ME, I WILL MAKE SURE THAT I CALL UPON YOU TIMELY. FIRST, AS YOU JUST HEARD ME SAY, THE COG IS REALLOCATING T THE CDBGR, THAT IS DIFFERENT THAN THE CDBG MITIGATION DOLLARS. RECENTLY THE COG -- AND WE ALL PARTICIPATED IN IT -- WAS ABLE TO AWARD NUECES COUNTY A LITTLE OVER $# 1 MILLION FOR HURRICANE HARVEY MITIGATION FUNDS. IN APRIL -- SO SORRY, IN OCTOBER OF -- OCTOBER 28, TO BE EXACT, OF 2020, THE COUNTY, NUECES COUNTY, SUBMITTED A PROPOSAL OF THE JOINT APPLICATION AS WELL AS THE INDIVIDUAL APPLICATION FOR CDBG. THOSE WERE THE LIVING A BREAKWATER ISLANDS PROJECT AND A LICHT STATION FOR COASTAL PARKS. >>COMMISSIONER HERNANDEZ: EXCUSE ME JUDGE. I JUST WANT TO ASK. >>JUDGE CANALES: YOU WILL HAVE TO WAIT BECAUSE I AM IN THE MIDDLE OF SOMETHING. >>COMMISSIONER HERNANDEZ: I JUST WANTED TO MAKE MY MOTION CLEAR. >>JUDGE CANALES: I JUST EXPLAINED IT. BUT I WILL EXPLAIN IT AGAIN IN JUST A MOMENT. >>COMMISSIONER HERNANDEZ: THANK YOU VERY MUCH. >>JUDGE CANALES: I APPRECIATE YOU. SO, AGAIN, THE CDBG FUNDS TOTAL $31 MILLION. AND THERE ARE RULES ASSOCIATED WITH IT. THE RULES HAVE A PERCENTAGE REQUIREMENT. I DON'T HAVE THAT IN FRONT OF ME AROUND THE 46% TO 48% FOR OUR COUNTY, FOR LMI PROJECTS. THAT MEANS THAT AMOUNT OF MONEY WILL GO TOWARD AREAS THAT HAVE A LOW TO MODERATE INCOME THAT SATISFIES THE ELIGIBILITY. PLAIN ENGLISH, MEANS THAT THERE IS GOING TO BE A LOT OF DOLLARS AVAILABLE, ALMOST HALF OF THEM OF THE $31 MILLION OF AREAS NEEDED THE MOST FOR FLOOD MITIGATION PROJECTS. THAT IS A GREAT THING; HOWEVER, IN OCTOBER 28 -- OCTOBER 2020, THE THIS COURT ADMITTED A HUGE GRANT BECAUSE YOU COULD DO SO. UP TO 100 MILLION DOLLARS AND IN THE TUNE OF $98 MILLION FOR THE BREAKWATER ISLAND THAT YOU HEARD THIS MORNING VERY STRONG PUBLIC SUPPORT FROM THE RESIDENTS AND THE ASSOCIATIONS THEY REPRESENT INCLUDING THE BUSINESSMEN THAT HAVE MADE LARGE INVESTMENTS THERE TO SUPPORT THE PROJECT OBVIOUSLY IT PROTECTS CRITICAL INFRASTRUCTURE, AND SOMETIMES IT IS NOT SO OBVIOUS. NOT JUST THE HOMES AS WAS POINTED OUT BUT THE BEACH AND THE SERIOUS EROSION AND THE TENS OF THOUSANDS OF DOLLARS TIME AFTER TIME AFTER TIME COSTING TAXPAYERS A TREMENDOUS AMOUNT OF MONEY. WHAT IS SPECIAL ABOUT THIS PARTICULAR GRANT IS THAT WITH HE A $30 MILLION MATCH ASSOCIATED WITH IT. COMES FROM BOTH PRODUCT AND IN KIND SERVICES. THAT MATCH WILL NOT BE AVAILABLE UNLESS THE DOLLARS FOR THE LIVING BREAKWATER ISLANDS ARE [01:25:04] APPROPRIATED. WORLD-CLASS SCIENTIST HAVE PRODUCED OUR FIRST APPLICATION, AND OUR FIRST APPLICATION WAS FOR AN EXTENSIVE SYSTEM OF ISLANDS, AGAIN, TOE $98 MILLION. WE KNOW WE HAVE APPROXIMATELY $14 MILLION LEFT. WHY $14 MILLION? BACK IN 2019, WE PROCURED A GRANT MANAGEMENT TEAM TO ASSIST US WITH CDBG MINT. WHY? BECAUSE THE APPLICATION PROCESS IS VERY HAVE VERY COMPLEX. AND SO THEY HAVE A 6% BY CONTRACT FEE. SO YOU GOT TO TAKE THE $31 MILLION, BACK OUT THE 6%. BACK OUT THE 50%. AND THAT'S HOW YOU COME UP WITH $14 MILLION. THE HART RESEARCH INSTITUTE ARE THE BRILLIANT SCIENTISTS BEHIND IT. THERE HAS ALREADY BEEN A TREMENDOUS AMOUNT OF WORK AND THE COURT MADE IT ITS PRIORITY IN 2020. IT HAS TAKEN A LONG TIME AND THAT IS WHAT HAPPENS SOMETIMES AFTER HURRICANES AND HUD A AND GLO. WE DIDN'T DO ANYTHING WRONG AND TOOK A LONG TIME FOR THE FEDS AND THE STATE TO BASICALLY GET US THESE DOLLARS. IT HAS TAKEN OVER FIVE YEARS. AND THE PROJECTS REMAIN SOLID AS A ROCK. IT IS ALSO MENTIONED AS TO WHY THE COUNTY WOULD THINK THIS TO BE SUCH AN IMPORTANT COUNTY PROJECT. AND THE TWO MAIN REASONS FOR THAT. FIRST THE LIVING BREAKWATER ISLANDS CAN BE DESIGNATED AND THEY WERE THIS SPRING AS A TIER ONE PROJECT FROM THE GENERAL LAND OFFICE. WHY IS THAT SO IMPORTANT? WELL, ONLY PROJECTS THAT ARE IN THAT STATUS CAN RECEIVE GOMESA MONEY. WHO CAN RECEIVE GOMESA MONIES? ONLY COUNTIES. THIS PROJECT HAS A TREMENDOUS UPWARD MOBILITY TO BASICALLY QUADRUPLE ITSELF, MAYBE EVEN GREATER THAN THAT IF WE HAVE SKIN IN THE GAME AND WHY IN COURT WISELY CHOSE IN 2020 TO SUBMIT THIS PROJECT AS ITS NUMBER ONE. AGAIN ON A MORE TECHNICAL MATTER, THESE PARTICULAR ISLANDS WILL SEE APPROXIMATELY A BILLION OYSTERS AND I HEARD SOMETHING YESTERDAY THAT I HEARD NOT HEARD IN A VERY, VERY LONG TIME AND I WOULD LIKE TO REPEAT IT. ALWAYS WHEN WESTERN KIDS SAID WE ARE COMING OVER THE HARBOR BRIDGE. A SPARKLING CITY BY THE SEA. THAT IS BECAUSE IN THE 1800S WHEN OYSTERS WERE BEING PROLIFIC OYSTERS ACT LIKE LITTLE FILTERS AND WHERE THE BEAUTIFUL NAME, THE SPARKLING CITY KIND OF CAME FROM THAT THE WATER CLARITY WAS SO GOOD. SO IT IS A TREMENDOUS PROJECT ON TEN DIFFERENT LEVELS AND I KNOW THAT THE INTENT IS TO BRING IT BACK IN JANUARY, BUT I WILL SAY THAT THIS PROJECT -- WE DID NOT KNOW THIS UNTIL LITERALLY A MONTH -- LESS THAN A MONTH AGO WHAT THE RULES WERE GOING TO BE AND NOW WE KNOW THAT THE RULES ARE GOING TO BE FOR SUBMISSION ON FEBRUARY 21. AND -- OR 28TH, YOU ARE RIGHT. I THINK IT IS THE 28TH. IS THAT RIGHT -- THE 21ST OR 28TH. THE 28TH. AND THIS GIVES VERY LITTLE TIME IF YOU SAW THE APPLICATION IN -- IN THE TECHNICAL BACKGROUND, IT GIVES VERY LITTLE TIME TO REDUCE -- >>COMMISSIONER GONZALEZ: WE ARE HAVING DISCUSSION. YOU HAVE BEEN TALKING FOR 10, 15 MINUTES. >>JUDGE CANALES: THAT IS WHY IFL THE GAVEL. >>COMMISSIONER GONZALEZ: THE GAVEL DOESN'T DO ANYTHING. >>JUDGE CANALES: EXCUSE ME SIR. I AM GETTING TO YOU. ACTUALLY GET TO COMMISSIONER HERNANDEZ FIRST, BUT YOUR INTERRUPTIONS ARE NOT ONLY RUDE BUT UNWELCOMED. THE DREDGE MATERIAL -- >>COMMISSIONER GONZALEZ: TALK, TALK, TALK. >>JUDGE CANALES: THE DREDGE MATERIAL THAT WILL BE USED FOR THE ISLANDS WOULD BE AVAILABLE TO US NOW, NOT IN THE FUTURE. SO THERE IS GOING TO BE A TREMENDOUS OPPORTUNITY FOR THIS COURT TO CONTINUE THEIR QUEST FOR THEIR LIVING BREAKWATER ISLAND PROJECT FIRST SUBMITTED IN 2020 AND THEN I MIGHT ADD THIS -- AND I KNOW YOU WEREN'T HERE IN -- COMMISSIONER HERNANDEZ, BUT URN HERE IN APRIL OF 2022. IN APRIL OF 2022, THIS COURT R REAFFIRMED THE PROJECT WHEN WE [01:30:01] APPLIED FOR THE FISH AND WILDLIFE FOR A $9 MILLION GRANT. SAME EXACT CONCEPT AND PROJECT. AND SO I JUST WANT THIS COURT TO KNOW THAT THERE IS A -- A LOT OF WONDERFUL BACK-UP DATA THAT WAS PROVIDED TO YOU. AND COMMISSIONER CHESNEY, YOU ASKED FOR THAT AND I AM GLAD YOU DID. AND THERE IS A TREMENDOUS AMOUNT OF VOLUME OF DATA THAT HAS BEEN IN YOUR POCKET. AND THERE HAS BEEN A -- A TON OF WORLD-CLASS, AS I SAID, BOTH SCIENCE AND ENGINEERING DONE. AND, AGAIN, WHY? BECAUSE THIS COURT SETS FORTH THESE PRIORITIES. BACK IN 2020, AND WE REAFFIRMED IT BACK IN 2022. AND WE HAVE BEEN WORKING WITH ALL OF OUR STAKEHOLDER AND ALL OF OUR PARTNERS IN ORDER TO SEE THIS DONE. AND AS THE EMERGENCY MANAGER, THERE ARE SO MANY REASONS FROM A COASTAL PERSPECTIVE WHY THIS PROJECT IS IMPORTANT, BUT THE NUMBER ONE REASON IS IF WE ARE TO GET A DIRECT HIT, THAT CRITICAL INFRASTRUCTURE, THE ONE THAT BRINGS US A MILLION TOURISTS A YEAR, THE LEXINGTON, THE AQUARIUM AND THE NEW RESEARCH CENTER WILL BE COMPROMISED. IT IS ABOUT FOLLOWING THROUGH AND KEEPING THIS OPPORTUNITY TO GET THE $30 MILLION MATCH. I DON'T KNOW OF ANY BUSINESSMAN THAT WOULDN'T RECOGNIZE THAT IF YOU CAN TURN $14 MILLION INTO $44 MILLION, THERE IS NO OTHER PROJECT THAT I AM AWARE OF THAT THAT HAS THAT ABILITY. SO WITH THAT, I WANTED TO EXPRESS MY APPRECIATION FOR THE PEOPLE THAT HAVE STAYED. I KNOW SOME OF THEM HAD TO LEAVE, BUT WHO CAME AND GAVE PUBLIC COMMENT BECAUSE I DO BELIEVE THAT AFTER THREE YEARS WORTH OF WAITING FROM THE FEDS AND THE STATE, WE FINALLY HAVE IS THE DOLLARS TO, AS THEY SAID, FINISH THE JOB. AND GET THIS PROJECT STARTED. SO JUST SO YOU KNOW WHAT YOU ARE TABLING IS SIMPLY THE AGENDA ITEM WAS TO REDUCE $98 MILLION WHICH THE COURT HAD ALREADY APPROVED TO $14 MILLION. AND WHY? WELL, BECAUSE $98 MILLION HAS WAY MORE WORK THAN THE $14 MILLION CAN ABSORB. SO IT IS NOT THE PROJECT IN ITS FULL SUBMISSION TODAY THAT YOU ARE TABLING. YOU ARE SIMPLY TABLING THIS CONCEPT OF TAKE IT FROM WHAT IT CAN NOT BE, OUR FIRST SUBMISSION OF $98 MILLION WHAT IT NEEDS TO BE THE $14 MILLION. THE $14 MILLION WILL BASICALLY COVER ISLANDS ONE AND TWO ONLY. THE REASON IT IS SO CRITICAL TO PUT -- TO START, GAUZE THE GLO NOW HAS THE ABILITY -- AND ONLY THE COUNTY HAS THIS, NOBODY ELSE. GOMESA FUNS FROM THE STATE -- NOT THE COUNTY BUT THE STATE'S GOMESA BECAUSE IT IS A TIER ONE PROJECT. WE DID THAT THIS STRING. WE GOT THAT CONFIRMATION. IT NOW CAN GET THE BIG DOLLARS THAT IT NEEDS BUT THE PROJECT HAS TO START. SO I THINK THAT IS REALLY AN IMPORTANT -- LIKE, AS THEY SAY, CONNECTING OF THE DOTS AS TO WHY THE COUNTY. BUT MAKE NO MISTAKE, EVERY MAJOR STAKEHOLDER HAS PARTICIPATED IN A SIX-FIGURE OR SEVEN-FIGURE, YOU KNOW, DOLLAR AMOUNT. IT IS JUST THAT THIS OPPORTUNITY WAS AVAILABLE TO COUNTIES. COMMISSIONER HERNANDEZ, YOU WANT TO HAVE A -- I WILL RECOGNIZE YOU AND YOU HAVE A MOTION. >>COMMISSIONER HERNANDEZ: YES, MA'AM, I DO. AND I WANT TO STATE THAT I HAD A LOT OF CONSTITUENT WHO COULDN'T BE HERE BECAUSE THEY HAD TO BE AT WORK. A LOT OF ESCONDIDO WITCH WENT THAT ARE ELDERLY, CAN'T DRIVE AND DON'T HAVE A VEHICLE. A LOT OF THEM ARE COMING FROM THE BANQUETE AT THAT AREA, DRISCOLL, ING A GA DOLCE. I HAVE AN OBLIGATION TO THEM TOO. THIS IS WHY I AM TABLING THE ITEM. >>COMMISSIONER GONZALEZ: MAKING THE MOTION AT THAT TABLE. >>JUDGE CANALES: A SECOND. >>COMMISSIONER GONZALEZ: SECOND. >>JUDGE CANALES: ALL THOSE IN FAVOR SIGNIFY. >>COMMISSIONER GONZALEZ: TABLE IT UNTIL JANUARY. [8. Receive update regarding incentive fee for 2022 for Global Spectrum Management agreement.] >>COMMISSIONER HERNANDEZ: UNTIL JANUARY. >>JUDGE CANALES: JANUARY 4. OKAY. WE WILL MOVE ON TO ITEM NUMBER 8 8. THIS IS AN INCENTIVE FEE FROM 2022 GLOBAL SPECTRUM MANAGEMENT. JUST THE OPPORTUNITY TO LOOK OVER THE DOLLARS AND CENTS. THERE -- ANY QUESTIONS? I MEAN, WE CAN HEAR FROM THE PRESENTATION OR YOU CAN JUST ACKNOWLEDGE -- I THINK IT IS IN THE $40,000 RANGE. >> THAT'S CORRECT. >>JUDGE CANALES: THAT CALCULATION, AIDAI, DO YOU WANT TO TALK ABOUT IT? [01:35:03] >> THIS IS BASED ON THE CONTRACT. EVERYTHING, $8376. >>JUDGE CANALES: ANY QUESTIONS FOR AIDAI. >>COMMISSIONER GONZALEZ: I ASKED THE COUNTY ATTORNEY TO GO BACK TO REVIEW THIS CONTRACT TO SEE -- I DON'T REMEMBER -- PROBABLY I DON'T REMEMBER FOR VARIOUS REASONS, RIGHT. BUT ANYWAY, I THINK THAT WE GAVE THEM SO MUCH MONEY AT THE BEGINNING AND NOW GIVING THEM $40,000 PER THE CONTRACT. AND THE ONLY TIME WE ARE GIVING THEM $40,000. NOT ANOTHER TIME? SO I NEED TO REVIEW THAT TO SEE WHY THEY WOULD GIVE THEM SO MUCH MONEY. >>JUDGE CANALES: AIDAI, COULD YOU ADDRESS IT WITH YOUR MIC. SORRY. WE HAVE TO HEAR IT. >> THIS IS JUST INCENTIVE FEE OR CONTRACT IS GIVEN TO THEM. >>COMMISSIONER GONZALEZ: PRESENTED FOR WHAT? >>COMMISSIONER CHESNEY: THEY DO -- THE QUESTION IS, DOES THIS COMPLY WITH THE CONTRACTUAL TERMS? I REMEMBER HAVING THE INCENTIVE FEE IN IT. I DON'T REMEMBER THE SPECIFICS AS WE SIT HERE TODAY, BUT WHEN I LOOKED AT THIS AND READ THIS, I THOUGHT THIS WAS IN COMPLIANCE. I READ THIS ONE QUICKLY LAST WEEK. BUT I MEAN, I THOUGHT THIS WAS IN COMPLIANCE WITH THE CONTRACT. JENNY, HAVE YOU -- >> THAT'S CORRECT. >>COMMISSIONER CHESNEY: HAVE YOU LOOKED AT THIS? >> WE TALKED OF THIS AND THAT QUESTION WAS ASKED OF ME YESTERDAY. I AM HAPPY TO DO THAT BUT I HAVEN'T LOOKED AT THAT CONTRACT YET CHOLESTEROL CHEST COULD WE P -- >>COMMISSIONER CHESNEY: COULD THE PASS IT WITH THE UNDERSTANDING. I UNDERSTAND HIS CONCERNS BUT PASS IT WITH THE COUNTY ATTORNEY OR AUTHORIZING OR ACKNOWLEDGING THAT WILL BE THE RIGHT AMOUNT IF. >> IT WILL BE VERY SIMPLE TO COMPLETE WHEN I HAVE THE OPPORTUNITY TO DO THAT AND I CAN POINT THAT PART OUT TO YOU IN THE DOCUMENTS THAT WENT THROUGH. >>COMMISSIONER CHESNEY: SO I WOULD. >>JUDGE CANALES: WE DON'T VOTE ON IT. JUST THE RIGHT -- >> ONLY AN UPDATE. >>JUDGE CANALES: YOU WON'T VOTE ON EVERYTHING, COMMISSIONER CHESNEY. EITHER YOU COMPLY AND THE AUDITORS PICK UP THE FINANCIAL DOCUMENTS THAT REPORT IT. IF YOU WANT TO QUESTION THAT, THEN YOU WOULD HAVE THAT UP ON AN AGENDA ITEM. TODAY TO ACKNOWLEDGE THAT IS THE RIGHT AMOUNT AND THE RIGHT AMOUNT PER THE CONTRACT TO PAY. IF YOU DON'T PAY IT ON TIME, THEN THERE WILL BE CONSEQUENCES FOR THE BREACH. >>COMMISSIONER CHESNEY: I THINK SO IT IS. JENNY, FULL JUST LOOK AT IT. WHEN I LOOKED AT IT, I THOUGHT IT WAS CORRECT BUT IF YOU CAN VERIFY. >> ABSOLUTELY. >>COMMISSIONER CHESNEY: THAT'S ALL. >>JUDGE CANALES: BY THE WAY EXACTLY HOW IT HAS BEEN DONE [9. Discuss and consider supplemental pay for interim Human Resources Director.] EVERY SINGLE YEAR. >>COMMISSIONER GONZALEZ: OKAY, THANK YOU. >>JUDGE CANALES: THE NEXT ONE IS TO CONSIDER THE SUPPLEMENTAL PAY FOR THE INTERIM HUMAN RESOURCES DIRECTOR. I WILL LET AIDAI HANDLE THAT ONE. >> TO APPOINT MELINDA IN HR AS INTERIM DIRECTOR FOR HR. WE ARE ASKING TO REQUEST FROM THE COURT HOW MUCH WE ARE GOING TO BE FOR SUPPLEMENTAL PAY. ALSO SHE IS REQUESTING TO -- TO CONTINUE TO BANK HER COMP TIME TO DON'T GET A PAY. AND WE WILL SEE -- IF THE COURT DECIDES TO GET THAT PAY. RIGHT NOW SHE IS UNDER A NONEXEMPT EMPLOYEE. RIGHT NOW SHE IS GOING TO BE DOING THE FUNCTIONS OF AN EXEMPT EMPLOYEE AND SHOULD BE PAYING OUT THIS COMP TIME, BUT IT IS UP FOR THE COURT TO DECIDE THAT. >>JUDGE CANALES: WELL -- >>COMMISSIONER GONZALEZ: HOW MUCH COMP TIME. >>JUDGE CANALES: YOU ARE GOING TO GIVE US THIS. FORGIVE ME, SHE CAN NOT UNDER THE LABOR LAWS NOT BE COMPENSATED. IS THAT CORRECT? SO IT IS NOT UP TO THE COURT. >>COMMISSIONER GONZALEZ: SHE HAS TO BE EXPENSE SAY THEED. WE ARE NOT SAYING SHE IS NOT. HOW MUCH SHE HAS AND HOW LONG. SHOULD HAVE TAKEN HER COMP TIME A LONG TIME AGO. >>JUDGE CANALES: NOBODY CAN UNDERSTAND YOU. YOU NEED TO USE YOUR MIC. >>COMMISSIONER GONZALEZ: SHE SHOULD HAVE DONE HER COMP TIME A LONG TIME AGO. >>JUDGE CANALES: SHE SAYS -- HE SAYS SHE COULD DO THE COMP TIME A LONG TIME AGO. >>COMMISSIONER GONZALEZ: TO CARRY ON THE COMP TIME OVER AND OVER. THE ISSUE WE HAVE EVERY YEAR DURING BUDGET TIME AND PEOPLE COME UP AND HAVE HOURS AND HOURS OF COMP TIME. I DON'T THINK IT SHOULD BE CARRIED FOR THE WHOLE YEAR. COMP TIME -- GOT TO BE A LIMIT WHEN YOU CAN TAKE THE COMP TIME. MAYBE DEPARTMENT HEADS ARE NOT DOING THEIR JOB GIVE YOU COMP PLAN AND 30 DAYS TO USE IT OR 60 DAYS TO USE IT. IT HAS GOT TO BE USED. IT IS NOT LIKE A BANK, YOU KNOW. THAT YOU ARE GOING TO SAVE ALL THIS MONEY AND SAVE YOUR COMP TIME. SOMETHING WE NEED TO RELOOK AT TO SEE -- WHEN PEOPLE NEED TO START USING THEIR COMP TIME. AND SOME PEOPLE LEAVE AND THEY LOSE. AND IT IS ON THEM, RIGHT. >>JUDGE CANALES: DO YOU HAVE A POLICY THAT WE CAN REFER TO RATHER THAN THIS -- >>COMMISSIONER CHESNEY: I THOUGHT WE WERE DISCUSSING [01:40:02] SUPPLEMENTAL PAY. >> SHE IS REQUESTING -- SHE DOESN'T WANT TO GET A PAYOUT. >>JUDGE CANALES: WE HAVE TO TALK TO AIDAI ON THE MICROPHONE. >>COMMISSIONER CHESNEY: AGAIN NO BACK-UP. HERE WE ARE TRYING TO FIGURE THIS OUT IN THE LAST MINUTE. WHAT'S NEW. >> THE REQUEST FROM MELINDA SHE DOES NOT WANT TO GET THE COMP TIME PAY OUT. THAT IS THE REQUEST. RIGHT NOW SHE WILL DO THE FUNCTIONS UNDER EXEMPT EMPLOYEE. AND THE POSITION IS EXEMPT. WE TRANSFER A PERSON FROM NONEXEMPT TO EXEMPT. COUNTY PAYS -- >>COMMISSIONER CHESNEY: WHY DO WE HAVE TO TRANSFER FROM THE EXEMPT TO NONEXEMPT. THIS IS AN INTERIM POSITION. WE DON'T HAVE HAVE TO HAVE AN INTERIM POSITION IF THIS IS GOING TO CREW SOMETHING OUT. THIS IS INTERIM, NOT A PERMANENT HIRE. WHY DOES IT TAKE SOMEONE -- WHEN IT IS AN ACTING OR INTERIM POSITION. WE CAN'T GO AGAINST THE POLICY, LET'S NOT MAKE HER ACTING DIRECTOR AGAIN AND NOT WORRY ABOUT IT. >>COMMISSIONER HERNANDEZ: WHERE IT SAYS COMP PAY. HOW MUCH DO WE OWE HER? >>COMMISSIONER GONZALEZ: $5,000. >>COMMISSIONER CHESNEY: IF WE PAY IT OUT. WHAT THEY ARE SAYING SOMETHING THAT SAYS -- I CAN'T BELIEVE THERE IS NOT AN EXCEPTION FOR AN INTERIM TYPE SITUATION. AND IF THERE IS, WE NEED -- WE SHOULD HAVE KNOWN THAT BEFORE WE VOTED ON IT. I WOULD HAVE SAID LEAVE HER ALONE. LET HER DO HER THING. WE DON'T HAVE TO HAVE AN ACTING HR DIRECTOR. >>JUDGE CANALES: I THINK YOU DO NEED TO HAVE AN ACTINGHR DIRECTOR. >>COMMISSIONER CHESNEY: MELINDA, ASSISTANT DIRECTOR THAT SHE NEEDS TO BE IN CHARGE. >>JUDGE CANALES: WHAT ADAI IS SAYING, IF THAT IS WHAT YOU WANT TO DO, SHE WILL HAVE TO PERFORM DUNKSES THAT REQUIRE HER TO BE SUPPLEMENTED. THAT IS THE NATURE OF THE AGENDA ITEM. IT ISN'T THAT YOUR SUGGESTION ACTUALLY WASN'T FOLLOWED. IT WAS FOLLOWED TO A T, BUT THE MINUTE THAT SHE PERFORMS THE DUTY THAT HAVE TO BE DONE DAILY OF AN ACTING HR, THEN THAT TRIGGERS THE SUPPLEMENTAL. AND -- >>COMMISSIONER GONZALEZ: BUT IF SHE IS ACTING, SHE DOESN'T GET COMP TIME. >>COMMISSIONER CHESNEY: NEED HER COMP TIME PAID OUT. THAT IS WHAT I DON'T UNDERSTAND. AN ACTING AND INTERIM POSITION THAT HAS TO HAPPEN? >> I DID THAT -- I CONSULTED WITH THE HR CONSULTANT AND THAT IS THE ANSWER -- I WILL SHARE THE E-MAIL WITH EVERYBODY. >>COMMISSIONER CHESNEY: HOW DO WE NOT DO WHAT WE ARE SUPPOSED TO DO. IF WE MADE THIS DECISION WITHOUT ALL THE FACTS, OKAY. BUT WE ARE HERE. WE MADE THE DECISION. WE DIDN'T KNOW THIS WAS GOING TO HAPPEN. WE ARE HERE. WE HAVE IT HANDED TO US FIVE MINUTES AGO. DON'T KNOW WHY THIS CAN'T BE HANDED TO US BEFORE. THAT'S OKAY. ONCE AGAIN WE WILL DEAL EVERYTHING WITH WHAT IS IN FRONT OF US WITH NO PREP TIME. WHY WOULD WE -- HOW WOULD WE -- WHY WOULD WE -- I GET SHE DOESN'T WANT IT TO BE PAID OUT. >> CORRECT. >>COMMISSIONER CHESNEY: BUT IF THE LAW IS THE LAW, WE DON'T HAVE A CHOICE IS WHAT YOU ARE TELLING ME. >> THAT'S CORRECT. >>COMMISSIONER CHESNEY: THEY CAN REFUSE TO BE THE ACTING DIRECTOR IF SHE WANTS TO. IF ALL THE THINGS TRIGGER BECAUSE OF THE POLICY. >>COMMISSIONER HERNANDEZ: I THOUGHT HE WAS DONE. >>COMMISSIONER CHESNEY: I AM KIND OF WAITING FOR AIDAI TO ANSWER THIS. THESE ARE NOT RHETORICAL QUESTIONS. >> UP TO THE COMMISSIONERS COURT. BECAUSE THE LAST TIME WE SELECTED TO HAVE HER AS AN:INTERIM DIRECTOR AND PERFORMING THE FUNCTIONS NOT AN EXEMPT. THE POSITION. >>COMMISSIONER CHESNEY: SO WE HAVE TO PAY HER. >> EXACTLY. >>COMMISSIONER CHESNEY: WHAT IS THE ISSUE. >> SHE JUST MADE THE REQUEST AND I AM JUST ADDRESS IT WITH THE COURT. I DON'T KNOW IF IT IS UP TO THE COURT. A QUESTION I ASKED -- IF IT IS -- IF IT IS UP TO THE COURT TO DECIDE IF WE PAY IT OUT OR NOT. THAT WILL BE A QUESTION I ASK. >>COMMISSIONER CHESNEY: YOU HAVEN'T GIVEN TIME AND WE NEED TO TABLE THIS UNTIL DECEMBER 14 TO HAVE THE TIME TO DO THIS. IF YOU NO AT THE THE ANSWER, PLEASE ANSWER. >> I DON'T KNOW IT SILTING HERE RIGHT NOW BUT A VERY QUICK LOOK THROUGH THE PERSONNEL MANUAL. >>JUDGE CANALES: AGREED. >>COMMISSIONER CHESNEY: SOMEBODY GO LOOK. >>JUDGE CANALES: WE HAVE INFORMATION. DO YOU WANT TO OFFER INFORMATION. >>COMMISSIONER HERNANDEZ: ADAI, WHAT IS REMEMBER JOB. >> HUMAN RESOURCES JOURNALIST AS RECOMMENDED. >>COMMISSIONER HERNANDEZ: BEFORE WE GIVE THE INTERIM. WASN'T IT AN ASSISTANT. >> NO DOESN'T HAVE AN ASSISTANT UNDER THE POSITION CURRENTLY. >>COMMISSIONER CHESNEY: HE IS ASKING WHAT WAS HER TITLE BEFORE THIS NEW TITLE IN. >>COMMISSIONER CHESNEY: HUMAN RESOURCES GENERALIST. [01:45:02] WE MADE HER INTERIM HUMAN RESOURCES DIRECTOR. OKAY. I GUESS IF SOMEONE WANTS TO LOOK AT IT WHEN WE COME BACK, JUDGE. >>JUDGE CANALES: GO AHEAD. >> I SPOKE TO MARY ESTHER IN THE COUNTY ATTORNEY'S OFFICE. AND WHEN I WAS -- BEFORE I BROUGHT IT TO AIDAI, AND SHE SAID I SHOULD BECOME EXEMPT AT THE TIME I BECOME THE INTERIM BECAUSE THE INTERIM POSITION IS JUST THE CORRECT POSITION FOR THE PERIOD. I WAS REQUESTING NOT TO PAY OUT ANY COMP TIME BECAUSE I DON'T WANT IT TO AFFECT THE BUDGET, AND I CAN USE THIS TIME FOR VACATION AND USE IT THROUGHOUT THE YEAR TO GET IT BACK DOWN. >>COMMISSIONER CHESNEY: AND I APPRECIATE THAT. THE QUESTION IS, CAN WE DO THAT? WE DON'T KNOW BECAUSE I DIDN'T EVEN THOUGH THIS WAS COMING UP UNTIL FIVE MINUTES AGO. >>JUDGE CANALES: I WOULD IMAGINE YOU KNOW THE POLICY. >> RIGHT. TYPICALLY SO WHENEVER A NONEXEMPT EMPLOYEE BECOMES AN EXEMPT EMPLOYEE, THE POLICY IS TO PAY OUT KNIT COMP TIME AT THAT POINT AS AN EXEMPT, YOU ARE NOT GOING TO EARN COMP TIME. >>COMMISSIONER CHESNEY: WE DON'T HAVE A CHOICE IS WHAT YOU ARE TELLING US. >> I DON'T KNOW. BUT I THINK IT WOULD BE UP TO THE COURT. TO ALLOW IT TO BE. >>JUDGE CANALES: SOUNDS LIKE A REASONABLE AND, FAIR PRACTICE. >> SHOULD ONLY BE FOR A SHORT PERIOD OF TIME. >>JUDGE CANALES: ONLY FOR A SHORT PERIOD OF TIME. OKAY. THANK YOU FOR THE BACK GROUND AND THE INFORMATION. I WILL MAKE THE MOTION TO -- TOO CONSIDER PAYING THE SUPPLEMENTAL PAY AS PROVIDED ON THIS PERSONAL ACTION REQUEST. >>COMMISSIONER GONZALEZ: BUT DURING THE SUPPLEMENTAL PAY, THE EXEMPT EMPLOYEE, YOU ARE NOT ALLOWED TO ACCUMULATE COMP TIME, RIGHT? >> RIGHT. I WILL WORK HOW MANY HOURS I NEED TO WORK AND NOT ACCRUE ANY TIME. >> I APOLOGIZE, HOW MUCH IS THE SUPPLEMENT BECAUSE DOESN'T SAY IT ON THE AGENDA ITEM. JUST SAYS DISCUSS AND CONSIDER SUPPLEMENTAL PAY FOR HUMAN RESOURCES DIRECTOR INTERIM. BUT DOESN'T HAVE AN AMOUNT. >>JUDGE CANALES: UNDER THE PERSONAL ACTION REQUEST THAT I HAVE -- IT, IT IS AN HOURLY RATE, CORRECT, AIDAI OF 2971. >> THIS IS UP FOR THE COURT TO DECIDE HOW MUCH WILL BE SUPPLEMENTED FOR THE PERIOD SHE IS GOING TO BE TAKING OVER THESE FUNCTIONS APPEAR. >> NO SUPPLEMENT PROPOSED. >>JUDGE CANALES: IN OTHER WORDS, THE CURRENT -- WHAT LISA IS SAYING, IF YOU LOOK AT THE ACTUAL DOCUMENT, THE HOURLY RATE IS $29.71 CURRENTLY AND THE PROPOSED IS THE SAME AMOUNT. I THINK WHAT I AM ASKING IS -- >> SO THE DIFFERENCE IS BECAUSE AS SHE IS TAKING ON WHAT IS SUPPLEMENTAL AND AROUND $44. CAN YOU CONFIRM HOW MUCH FOR THE HR DIRECTOR. SO LET ME ARE AMEND MY MOTION, LISA, TO SAY THE FOLLOWING. I PROPOSE THAT THE SUPPLEMENTAL PAY BE AWARDED TO THE INTERIM HR DIRECTOR AS THE DIFFERENCE BETWEEN THE CURRENT HOURLY RATE AND THE CURRENT POSTED HR DIRECTOR RATE AND IN THE WORDS MAKES ONE MORE SENSE. >>COMMISSIONER CHESNEY: SAY IT ONE MORE TIME. >>JUDGE CANALES: THE DELTA BETWEEN THE HR DIRECTOR AND THE $29.71 SHE CURRENTLY HAS. >>COMMISSIONER CHESNEY: THE STARTING. >>JUDGE CANALES: CORRECT, WHAT IT IS. >>COMMISSIONER CHESNEY: $44. >>THE AFFECTED DATE WILL BE NOVEMBER 26. >>COMMISSIONER CHESNEY: OKAY. AND TELL ME -- I AM LOOKING AT THAT -- BUT -- SO JULIE -- SO -- SO WHAT I NEED TO KNOW. >> GET THE CORRECT HOURLY RATE. AND THAT'S WHY WE NEED TO BRING IT TO BE THE DIFFERENCE. >>COMMISSIONER CHESNEY: WHAT THE STARTING IS. >> THAT'S CORRECT. >>COMMISSIONER CHESNEY: WHAT YOU [01:50:01] ARE SAYING, JUDGE, WHAVS WHATEVER IT IS FOR THE STARTING HOURLY RATE WITH THE HR DIRECTOR WITHOUT ANY STEPS IS WHAT THIS SHOULD BE. >> NO STEPS INCLUDED. THANK YOU. >>JUDGE CANALES: MOTION HAS BEEN ARTICULATED, CLARIFIED. IS THERE A SECOND? >>COMMISSIONER HERNANDEZ: SECOND. >>JUDGE CANALES: ALL THOSE IN FAVOR, SIGNIFY BY SAYING AYE. COMP TIME BALANCE IS A SEPARATE MATTER, AND THE COMP TIME BALANCE SP 1616, 166 HOURS. IS THAT RIGHT? >> THAT'S CORRECT. >>COMMISSIONER CHESNEY: AND SOMEONE. >>JUDGE CANALES: JENNY -- WE WILL HOLD ON THAT JUST TO GO BACK AND LOOK AT THE POLICY BUT I WOULD SAY THAT IS IN KEEPING OF WHAT IT WORKS. THERE IS A COST TO DO BUSINESS AND YOU LOSE SOMEBODY AND YOU TRY TO REPLACE THEM, YOU DON'T HAVE ANY IDEA IN THE MIDDLE, THIS IS WHAT RESULTS. >>COMMISSIONER CHESNEY: I WOULD SAY, JUDGE, SUBJECT TO THE VERIFICATION OF THE COUNTY ATTORNEY, WHATEVER THE POLICY SAYS, WE DO. I DON'T THINK WE NEED TO COME BACK. IF THE COUNTY ATTORNEY VERIFIES ALL THESE THINGS, WE JUST HAVE -- THE MOTION CAN BE CAN BE TO JUST DO IT. I AM FINE WITH WHATEVER THE POLICY SAY IS WHAT IT IS. >> PAGE 27. NUMBER 5 DESCRIBES DISPOSITION OF COMPENSATORY TIME FOR PROMOTED FROM EXEMPT TO NONEXEMPT POSITION AND SAYS AN EMPLOYEE AN EXEMPT TO THE NONEXEMPT BE PAID ALL ACCRUED TIME. >>COMMISSIONER CHESNEY: A SHALL PROVISION SOUNDS VERY CLEAR TO ME. IF YOU MAKE THAT MOTION. >>COMMISSIONER HERNANDEZ: I HAVE A QUESTION. BUT IS COMP TIME MEANT TO BE STORED AND BUILT UP UNTIL YOU GET READY TO RETIRE OR YOU ARE READY TO GO. >> SUPPOSED TO BE USED WITHIN A REASONABLE TIME ACCORDING TO THE MANUAL, BUT THAT IS NOT DEFINED. >>COMMISSIONER CHESNEY: WE NEED TO DEFINE THAT LATER TOO. I THINK JOE -- COMMISSIONER GONZALEZ IS RIGHT ON THAT. WE NEED TO BRING IT BACK. >>JUDGE CANALES: YOU CAN'T PUNISH PEOPLE ON RULES THAT DECENT EXIST. >>COMMISSIONER HERNANDEZ: WE DON'T WANT TO PUNISH EVERYONE. >>JUDGE CANALES: THEN CREATE YOUR POLICY. >> NONEXEMPT, THERE IS A LIMIT ON THE ACCUMULATION OF COMP TIME AND ONCE THEY REACH FOR EMPLOYEES MAY ACCUMULATE UP TO 240 HOURS OF COMP TIME, REPRESENTING 160 HOURS OF OVERTIME WORK TIMES THE 1.5 PREMIUM. SO CAN ACCRUE UP TO AFTER THE 240 HOURS OF COMP TIME ACCRUED, THEY HAVE TO BE PAID OUT IMMEDIATELY. >>COMMISSIONER CHESNEY: ALL OF IT. >> AS THEY EARN IT, IF HAS TO BE PAID OUT. YOU CAN'T HAVE MORE THAN 240 OF COMP TIME. >>COMMISSIONER CHESNEY: 241, YOU HAVE TO PAY THAT ONE HOUR. >> WHENEVER THEY EARN THAT ONE EXTRA HOUR WILL BE PAID OUT. THAT IS REFLECTED IN YOUR OVERTIME AMOUNT ON YOUR BUDGET. ONLY CONSIDERED OVERTIME WHEN THE COMP TIME IS PAID OFF. WHENEVER THE COMP TIME IS USED IN REPLACE TO SICK LEAVE AND VACATION TIME, WHENEVER THEY ARE US USING IT, IT GETS PAID AS STRAIGHT TIME AND DOESN'T REPLACE THE OTHER CATEGORY. >>COMMISSIONER CHESNEY: WHAT WE DON'T HAVE IN THERE IS REASONABLE -- HAS TO BE USED IN A REASONABLE TIME. >> THERE IS NO TIME LIMIT. JUST SAY REASONABLE AMOUNT OF TIME. >>COMMISSIONER CHESNEY: WE NEED TO GO BACK AND TIGHTEN THAT UP AND FIGURE OUT WHAT WE ARE GOING TO DO ON THAT. >> NOW THERE IS SOME. IF THE COURT DETERMINES THAT THE INTERIM TIME IS NOT A HIRE ING, THE MOTION AT THIS TIME I THINK THE COURT WILL HAVE SOME DISCRETION, BUT IF THAT WERE TO BE A PROMOTION THAT WAS PERMANENT, THEN THIS BOO COVER IT. DOES THAT MAKE SENSE? >>COMMISSIONER GONZALEZ: I DON'T THINK IT IS A PROMOTION. A PERMANENT PROMOTION, IS IT? >>COMMISSIONER CHESNEY: IT IS INTERIM BUT AGAIN, WE DON'T HAVE THAT DEFINED EITHER. SO WITH THE AMBIGUITY. THAT IS ANOTHER THING WE NEED TO TIGHTEN UP AND PUT ON. THESE THINGS HAPPEN. WE REPLACE PEOPLE THAT ARE IN THERE AND MAKE THEM INTERIM. >> I SUGGEST WITH THE AM BIG DPUT WILL GIVE YOU ARGUABLE DISCRETION IN THIS AREA. >>JUDGE CANALES: MY MOTION STANDS. AND IT IS SECONDED BY COMMISSIONER CHESNEY. ALL THOSE IN FAVOR, SIGNIFY BY SAYING AYE. ALL RIGHT, WE ARE GOING TO MOVE ON. [10. YOU HAVE ITEM NUMBER 11, JENNY, YOU ALSO HAVE SOME SALARY SAVINGS. IT IS UNDER $10,000. I THINK THIS PARTICULAR ITEM. AND IT IS BASICALLY TO PAY FOR OVERTIME AND TEMPORARY POSITIONS AS NENEEDED. ARE YOU ASKING THE COURT TO APPROVE THIS UP TO THE AMOUNT OF MONEY YOU HAVE FOR SALARIES SAVINGS? >> YES, WE ARE ALSO DOCTOR THE WAY WE WORDED IT, WE ARE ASKING FOR A LITTLE BIT OF DISCRETION SO THAT THE COURT -- THE COURT COULD VOTE AT THE SAME TIME OR IN TWO DIFFERENT VOTES THAT IT BE USED EITHER TO THE OVERTIME THAT SOMETIMES HAPPENS AND OR TO THE TEMPORARY POSITIONS SO THAT WE CAN GO AHEAD AND MOVE ON THOSE QUICKLY. >>COMMISSIONER CHESNEY: AND I DON'T HAVE BACK-UP. >> THERE SHOULD HAVE BEEN . >>JUDGE CANALES: BOTTOM LINE IS, YOU ARE GOING TO GET TEMPS IN TO HELP YOU AND YOU WILL USE SALARY SAVINGS TO DO IT AND MY HOPE IS THAT I DON'T SEE ANY ISSUE WHEN YOU -- THE MOTION SHOULD BE WHEN SALARY SAVINGS END, TEMPS END, SO YOU CAN BRING IT BACK TO COURT FOR A NEW AUTHORIZATION OR NEW FUNDING, RIGHT? >> ONCE THAT SALARY SAVINGS ENDS, YES. AND THERE IS BACK-UP ATTACHED TO THE -- >>COMMISSIONER CHESNEY: I KNOW WHAT IT IS BECAUSE I TALKED YOU ABOUT IT AND I DON'T HAVE ANY BACKUP. >> CURRENT SALARY SAVINGS IS APPROXIMATELY 71 AND CHANGE THOUSAND DOLLARS. >> THIS FALLS UNDER THE CATEGORY OF NO CHANGE TO THE BUDGET. YOU ARE JUST USING MONEY IN A DIFFERENT WAY. SO THOSE RECLASSIFICATIONS, I WILL STILL LIKE THE BACK-UP. AND STILL LIKE TO -- I MEAN, I THINK THAT IS A CONCEPT THAT IS FINE. IF SOMEONE WANTS TO COME IN AND. NO BUDGET INCREASE DURING BUDGET YEAR. >>COMMISSIONER GONZALEZ: SO MOVED. >>COMMISSIONER CHESNEY: SECOND. >>JUDGE CANALES: A LITTLE BIT OF DISCUSSION. HOW LONG DO YOU THINK IT IS GOING TO LAST, THE TEMPORARY -- LIKE, HOW MUCH -- HOW WILL THAT TAKE YOU? HOW MUCH FURTHER? >> WELL, JUDGE, WE HAVE AN OPEN POSITION FOR AN ATTORNEY NOW. THAT IS PROVIDING A LOT OF THAT AS WE SPEAK. AND THEN THERE -- SO -- IT IS INDETERMINANT UNTIL WE HIRE AN ATTORNEY. >>JUDGE CANALES: I GUESS THE POSITIVE IS, IF YOU TOOK THE WHOLE $71,000, YOU COULD BASICALLY HAVE SOMEBODY FOR THE WHOLE YEAR. >> THERE IS A LIMIT ON THE TIME PERIOD THEIR A TEMPORARY EMPLOYEE CAN BE. AND WE CERTAINLY WOULD PREFER TO HAVE FULL-TIME EMPLOYEES OVER ANY TIME OF TEMPORARY SITUATION. WE ARE TRYING TO DO THE BEST WE CAN AND THE ATTORNEY DEFICIT. THE HIRING POOL IS VERY SMALL. >>JUDGE CANALES: YOU WILL TRY TO [12. IT IS UP TO YOU. >> THERE IS AN OFFER WE ARE GOING TO, I BELIEVE, SUGGEST ACCEPTING FROM STATE FARM, BUT IF YOU WOULD RATHER TALK ABOUT THAT IN EXECUTIVE. >>COMMISSIONER CHESNEY: A TOTAL LOSS. NOT MUCH -- >> WE DO BELIEVE IT IS FAIR MARKET VALUE. >>JUDGE CANALES: I AM GOOD WITH THAT. SO THIS IS A MUCH MORE ROBUST SYSTEM. IT GIVES US MORE SELF-SUFFICIENCY IN CONFIGURING IT. WE CAN COLLECT DATA BETTER AND THE PROJECT MANAGEMENT PIECE OF IT WILL BE GOOD BECAUSE THE HELP DESK STUFF GOES IN THERE, SOME OF THOSE TURN INTO PROJECTS AND WE HAVE A LOT OF I.T. THE QUESTION WAS, IF THESE MONIES WERE TO BE ALLOCATED BY VOTE COG, WOULD BE AVAILABLE FOR A ROOF USAGE? USAGE TO WORK INFRASTRUCTURE PROJECTS ON OUR ROOF? >> THE FUNDS THAT ARE GOING TO BE REALLOCATED, THERE IS PUBLIC COMMENT ON THE WAY THEY ARE DISTRIBUTING THESE MONIES ON DECEMBER 14. THIS MONEY IS STILL DUE TO HURRICANE HARVEY DISASTER. SO ANY USE OF IT WOULD BE HAVING TO BE RELATED TO HURRICANE DISASTER. HURRICANE HARVEY DISASTER. WE DID RECEIVE THE DR MONIES FOR THE ROADS FOR THIS 4.6 MILLION AND WE DID USE THEM. SO THAT IS WHAT THEY ARE TELLING US. GOOD AFTERNOON JUDGE AND COMMISSIONERS. THE WAY THAT THE -- WE HAVE [02:20:02] ALLOCATED THE FUNDING IS THAT WE HAD THREE CHOICES. YOU ARE GOING TO GO WITH THE CONCEPT OF THE ONE LUMP SUM. THAT IS YOUR RECOMMENDATION AND, THEREFORE, THE RANKINGS SH SHOW RARANSAS PASSED. >> THAT'S CORRECT. THE DATA -- WE USED ARANSAS PASS CAME IN FIRST. THE CITY OF ROFERIO. NUECES COUNTY CAME IN 12 ST BASED ON THE DAY THAT THAT WE USED. >>COMMISSIONER CHESNEY: THAT MEANS WE WON'T GET ANYTHING. >>JUDGE CANALES: IF IT ALL HOLDS. TO BE WHY USUALLY THEY HAVE TO PRESENT PUBLIC COMMENT. JUST SO YOU KNOW, THE WAY IT WAS PRESENTED, WE THOUGHT THAT THERE WAS AN OPPORTUNITY TO HAVE THE MONEY DISTRIBUTED AS PER THE CHART, AND THAT'S WHY WE HAD THE 61,000. BUT WHAT YOU ARE SAYING IT IS ONLY THREE CHOICES, LUMP SUM, 500, 5500, 100, AND I FORGET WHAT THE THIRD ONE WAS. IS THE THIRD ONE THE DISTRIBUTION THAT THE CHART SHOWS. >> RIGHT. I SEE THAT -- I REALLY APOLOGIZE FOR THE MISUNDERSTANDING AND I AM SORRY FOR TAKING UP THE COURT'S TIME ON THAT. THANK YOU FOR MAKING US AWARE.
