>> COULD YOU REPEAT WHAT IS BEING PULLED?
ITEM F, ITEM J. ITEM Q AND IN QUEEN.
R AS IN RABBIT. M ALREADY PULLED PRIOR TO YOU JUMPING ON BECAUSE OF THE FACT THAT CONTRACT IS NOT READY FOR
THE COUNTY ATTORNEY'S OFFICE. >> I HEARD THAT WHEN I WAS WATCHING, COULDN'T GET ON THE LINK.
>> MOTION ON THE FLOOR. ALL IN FAVOR SIGNIFY BY SAYING
[00:10:01]
>> OPPOSED SAME SIGN. MOTION CARRIES.
LET'S TAKE IT IN THE ALPHABETICAL ORDER.
[F. Approve personnel actions of budgeted nature: 1. Temporary List 2. Personnel Actions Summary]
FIRST ONE IS LETTER F. QUESTION FROM COMMISSIONER GON GONZALES, I AM GOING TO DEFER THIS TO EITHER DALE TO HELP ME OUT ON THIS ONE.THIS ONE, I THINK GENERATED OR, CAN YOU ANSWER HIS QUESTION.
>> I JUST DON'T UNDERSTAND THE LIST, TEMPORARY LIST.
IS THAT THE PAPER I GAVE YOU BACK?
I COULDN'T READ? >> IS IT THIS ONE?
>> NO, THIS IS DIFFERENT. WHAT ARE WE APPROVING?
WHAT TEMPORARY LIST. >> YOU DON'T HAVE ATTACHMENTS?
>> I CAN PULL THEM HERE FOR HIM. >> I AM ASKING.
COMMISSIONER FOLLOW UP QUESTION. ON THE COUNTY LIBRARY, LISTED HOURLY SALARY $9.79. IT IS BELOW $15.
LAST BUDGET CYCLE WE SAID WE WERE GOING TO RAISE EVERY
POSITION TO $15 AN HOUR. >> THE WAY WE NORMALLY DO TEMPORARY POSITION. 10% BELOW SALARY OF THE PERSON WE ARE FILLING IN FOR. TEMPORARY SALARY RECORD CLERK AS $15 AN HOUR. 90% OF THAT IS CLOSER TO WHAT WE ARE TALKING ABOUT. BELOW $15 AN HOUR, YES.
>> AT LEAST $12 AN HOUR FOR TEMPS.
>> POLICY SAYS HIRE AT 90%. >> $9.79, I DON'T SEE HOW
ANYBODY CAN MAKE ANY MONEY. >> CAN WE BRING THAT UP AS ANOTHER ITEM FOR NEXT TIME? TO ADDRESS THAT?
>> WE'LL HAVE TO BRING THE POLICY IN.
>> WHY DON'T WE DIRECT EVERYBODY TO BRING THAT UP, GO BACK TO COMMISSIONER GONZALEZ' QUESTION, MY UNDERSTANDING FROM READING BACK UP MATERIAL, WHAT YOU ARE APPROVING IS THAT FOR THIS PARTICULAR TIME PERIOD SHOWS HOW MANY NEW PEOPLE HAVE COME ON BOARD. IT IS SHOW CASING HOW MANY PEOPLE HAVE COME IN. HOW MANY HAVE COME OUT.
IT IS MY UNDERSTANDING HOW MANY TEMPORARIES REQUESTED AND THEN OF COURSE I AM MAKING THE ASSUMPTION THEY ARE THERE ALREADY. I COULD GET THAT INFORMATION
MAYBE ASKED AND ANSWERED. >> YOU ARE CORRECT YOUR HONOR.
IT IS PROVIDING YOU AN IDEA OF WHAT HAPPENED.
>> OKAY. WHAT YOU ARE APPROVING IS JUST A SUMMARY OF EXACTLY WHO HAS COME IN AND OUT ON BOTH TEMPORARY SIDE AND WHAT I WOULD CALL FTE SIDE.
IT DIVIDES IT UP BY PAY GROUP AND WEEKLY SALARY.
THAT IS WHAT YOU ARE APPROVING TODAY.
>> I HAVE A QUESTION ON THE BACK.
COMMUNITY SERVICE, EMERGENCY MANAGEMENT, RESIGNATION.
AND FIRE MARSHAL AND RETIREMENT. WHY RETIREMENT AND [INAUDIBLE]?
>> I DID NOT DO THIS, YOUR HONOR.
I COULDN'T TELL YOU WHY IT SHOWS RETIREMENT.
IT WOULDN'T BE RETIREMENT. THAT SHOULD BE CHANGED TO
RESIGNATION. >> SO WE CAN MARK THAT AS AN EDIT. AND DIRECT THAT CHANGE TO OCCUR.
[00:15:03]
YOU COULD DO SUBJECT TO. >> [INAUDIBLE] ALL RIGHT.
CAUGHT MY EYE. I WAS GOING TO BRING UP, COMMISSIONER MAREZ DID ALREADY. WE NEED TO REVISIT THAT ONE,
>> OKAY. SO WHAT -- A MOTION AND SECOND.
AND ALL IN FAVOR SIGNIFY BY SAYING AYE.
[J. Approve outstanding invoices for Professional Services for the Texas Water Development Grant drainage project.]
OKAY NOW LET'S MOVE TO ITEM LETTER J.
J AS IN JAM. >> I HAVE QUESTIONS.
CALLING THE AGENCIES WHY SO MANY REPORTS SO LATE, SIX MONTHS LATER. SOMEBODY TOLD ME, LIKE THEY WERE SUPPOSED TO ON TIME. I DON'T KNOW WHY MISS ROSS IS HOLDING ON TO THE INVOICES. THEY HAVE EMPLOYEES TO PAY.
WHY ARE WE WAITING SIX MONTHS TO SUBMIT INVOICES FOR PAYMENT? THAT IS ONE, TWO ALSO IN REIMBURSEMENTS.
AS WE LOOK AT THE WORK SHEET, HOURS, 133.
I DON'T KNOW WHAT HOURS GO WITH WHAT.
ANOTHER REALLY SURPRISED TO SEE THAT WE HAVE BEEN, WE ARE PAYING FOR COFFEE STARBUCKS AND COFFEE MCDONALDS WHEN WE ARE PAYING SOMEBODY $185 PER HOUR. WHY ARE WE PAYING FOR COFFEE.
THAT PERSON, I DIDN'T KNOW OUR ENGINEERS WERE ALLOWED TO DO THAT. MAYBE OLD ENGINEERS CAN DO THAT.
TO ME, YOU PAY SOMEBODY 185 AN HOUR, THAT SHOULD COVER EVERYTHING. THEY NEED TO DO AS FAR AS TRAVEL. I DIDN'T KNOW WE WERE SUPPOSED TO PAY FOR MEALS WHEN THEY HAVE A CONTRACT.
>> IF THE CONTRACT ALLOWS FOR TRAVEL EXPENSES IT ALLOWS FOR THOSE EXPENSES. WE COULD CONFIRM THAT WITH THE COUNTY ATTORNEY. MOST IMPORTANT THING IS TO ANSWER YOUR QUESTION ON THE INVOICES.
IT HAS BEEN BROUGHT TO OUR ATTENTION LAST COURT IT WAS THE FACT THAT THE WATER DEVELOPMENT BOARD NEEDED AN AMENDMENT IN ORDER FOR THE INVOICES TO BE PRESENTED.
THEY ARE NOT LATE. WE DID THE AMENDMENT LAST COURT.
THIS WAS EXPLAINED. I THINK YOU WERE ACTUALLY OUT OF THE ROOM AT THE TIME. I REMEMBER YOU CAME BACK IN AND ASKED IF WE HAD DONE ITEM NO. 8. YOU MIGHT HAVE MISSED THE EXPLANATION. THE INVOICES COULD NOT HAVE BEEN SUBMITTED UNTIL THE WATER DEVELOPMENT BOARD SIGNED THE DOCUMENTS OF WHICH THEY WERE ABLE TO DO WHEN THIS COURT
PASSED THIS AMENDMENT. >> YOU ARE SAYING THE WATER DEVELOPMENT BOARD HAD THE INVOICES AND SOMETHING WASN'T
I AM SAYING INVOICES ARE SUBMITTED TO PUBLIC WORKS.
THEY WERE SUBMITTED TIMELY BECAUSE WE HAD TO WAIT FOR THE WATER DEVELOPMENT BOARD TO RECEIVE AND SIGN A DOCUMENT THAT CAME TO THIS COURT. THIS IS A MINISTERIAL ACT THAT WAS BEING BROUGHT TO US AT THIS POINT.
NOW ALL THE DOCUMENTS HAVE BEEN SIGNED BY THIS COURT AND BY THE AGENCY. NOW EVERYBODY IS READY TO GET PAID. NOBODY HAS DONE ANYTHING EXCEPT FOR FOLLOW WATER DEVELOPMENT BOARD'S TIMELINE.
YOU ARE RIGHT. THEY WERE NOT TIMELY.
BUT WE HAVE BEEN TIMELY. SO HAS OUR ENGINEERS.
>> EVERYTHING FALLS ON WATER DEVELOPMENT BOARD?
>> IT DOES. WE HAVE CORRECTED THAT LAST TIME. IF YOU'LL REMEMBER WE DID THE AMENDMENT LAST COURT. WHEN I SAY LAST TIME I MEAN LAST
COURT. >> A LOT OF THE INFORMATION IN THE REIMBURSEMENT FOR THE INVOICES IS SUBMITTED REFLECT THERE IS CORRESPONDENCE VARIOUS PEOPLE, REPORTS TO THE JUDGE.
HOW COME WE DON'T GET COPIES. >> I GOT COPIED ON A REPORT ALL
[00:20:02]
THE COMMISSIONERS JUST GOT RECENTLY.>> I AM NOT TALKING ABOUT RECENTLY, JUDGE.
THIS IS GOING BACK SIX MONTHS. I AM TALKING ABOUT, DOESN'T SAY THIS MONTH LAST MONTH. GOES BACK TO SEPTEMBER.
>> I KNOW SUSAN HAS GIVEN, WE HAVE LITERALLY HAD LOTS OF
REPORTS. >> I CAN DECLARE, WE ARE SEE WITH ANNA IF SHE HAS THE REPORTS.
OCTOBER-APRIL. >> ALSO CHECK CONTRACT TO SEE ABOUT THIS. MISCELLANEOUS EXPENSES, COFFEE.
>> I WILL WITH THE COUNTY ATTORNEY.
>> YOU HAVE TO DRINK COFFEE ANY WAY.
I CAN'T BELIEVE SOMEBODY WOULD CHARGE US FOR STARBUCKS AND MCDONALDS, 300, 400 DOLLARS. WHAT ARE WE APPROVING PAYING THE
INVOICES. >> WHEN YOU PAY THESE INVOICES THEY WILL BE ABLE TO PAY ALL OUR ENGINEERS.
>> LET ME ASK A QUESTION, WHEN ENGINEERS OR SUBCONTRACTORS SUBMIT AN INVOICE TO SUSAN ROSS OR PUBLIC WORKS OR SUSAN ROSS AND ON TIME, WE DON'T SUBMIT THOSE FOR PAYMENT? DO WE HOLD THEM? MY QUESTION IS, IF THEY SUBMIT AN INVOICE SAY FOR JUNE, RIGHT? DO WE PAY THOSE IN JULY?
>> I DO NOT PAY THEM UNTIL I RECEIVE THEM FROM THE DEPARTMENT. I CAN'T PAY IT UNTIL I RECEIVE
IT. >> THEN SUSAN ROSS NEEDS TO
SUBMIT IT TO YOU. >> THIS WOULD HAVE TO GO TO PUBLIC WORKS. IF THEY DIDN'T AUTHORIZE IT --
>> COULD THEY AUTHORIZE IT -- >> THAT IS CORRECT.
PUBLIC WORKS HAS BEEN HOLDING THESE INVOICES UP.
>> REASON WAS HE SAID THEY WERE LATE.
AND WHEN WE EXPLAINED THEY WERE NOT LATE WHEN COUNTY ADMINISTRATOR EXPLAINED THEY WERE NOT LATE, WE DECIDED TO BRING IT TO COURT. SO I THINK THE FAULT LIES WITH THE SYSTEM WE HAVE THAT BLOCKED INVOICES FROM BEING PAID.
NOW WE HAVE THE ABILITY TO RECTIFY IT.
>> OKAY BACK ONLINE? >> I THINK WE SHOULD BE BACK ONLINE NOW. THE AMENDMENTS ARE DONE.
EVERYBODY IS ON TRACK. >> HOPE SO, SO MOVED.
>> OKAY. AND IS THERE A SECOND?
[Q. Approve Memorandum of Understanding between Nueces County and ERF Tower II for FEMA requirement contract provisions.]
ALL IN FAVOR SIGNIFY BY SAYING AYE.NEXT ONE ALSO BELONGS TO YOU. IT IS ITEM Q.
>> I JUST HAVE CLARIFICATION APPROVE MEMORANDUM OF UNDERSTANDING BETWEEN NUECES COUNTY AND EFR TOWER 2.
$100,000. IS THIS SOMETHING NEW?
>> NO. >> ALREADY HAD IT BEFORE IN '21,
RIGHT? >> LET ME EXPLAIN, ALSO I THINK IVA CAN HELP, Q AND R RELATED. WE ARE WORKING TO GET THE RIGHT LANGUAGE ON ITEMS ALREADY HAPPENED IN THE PAST SO THAT WHEN WE SUBMIT TO FEMA, FEMA RECOGNIZES THE LANGUAGE THEY ARE USED TO. THESE ARE REQUIREMENTS TO USE THE RIGHT LANGUAGE. IDA COULD YOU ASSIST?
>> THAT IS CORRECT. WE HAVE PROCESSED PAYMENT.
ONLY THING IS INCLUDE THIS LANGUAGE FOR REIMBURSEMENT.
>> IT SAYS PAID FOR COUNTY INCIDENT MANAGEMENT SERVICE RESPONSE TO COVID-19 I GUESS. AND CITY HEALTH DISTRICT.
IS THAT? >> ALL OF THIS HAPPENED IN THE
PAST. >> I DON'T UNDERSTAND WHAT WE
HAVE BEEN DOING HERE. >> WE ARE NOT DOING THAT COMMISSIONER. WE ALREADY DID IT.
THIS IS JUST TO AMEND TO REFLECT THE RIGHT LANGUAGE.
>> RIGHT NOW WE DON'T HAVE ANYTHING? WE ARE NOT USING TOWER ANYMORE FOR ANYTHING TO DO WITH COVID?
[00:25:01]
>> THAT IS CORRECT. >> SHUT DOWN?
>> THAT IS CORRECT. >> SO NOW $100,000 SOMETHING WE
NEED TO PAY TO WHO? >> WE ARE NOT PROCESSING ANY PAYMENT. THIS IS NOT ANY PAYMENT.
IT IS NOT COST. >> WE ARE SUBMITTING THIS COST.
>> WE ALREADY PROCESSED THOSE PAYMENTS.
>> I THINK IT SHOULD BE REQUESTED PAYMENT I GUESS
PROBABLY MORE CLEAR. >> THIS IS GOING TO HELP FOR REIMBURSEMENT, COMMISSIONER. SOMETHING FEMA REQUESTING US TO
I WANTED TO MAKE SURE ABOUT THE TOWER.
>> THAT A MOTION THEN? >> I'LL SECOND.
ALL IN FAVOR SIGNIFY BY SAYING AYE.
[R. Approve no cost Amendment No. 4 between Nueces County and HireQuest LLC dba Snelling providing for FEMA requirement contract provisions.]
AYE. OPPOSED SAME SIGN.THANK YOU. LETTER R EXACT SAME THING.
IT IS GETTING THE RIGHT LANGUAGE SO THAT WHEN FEMA ASKS FOR INFORMATION WE ARE ABLE TO SHOW CASE THESE PROVISIONS INCLUDED.
THIS IS JUST CLEAN UP TO GET THE RIGHT INFORMATION TO FEMA.
>> LET ME ASK YOU, WE ARE NOT MAKING ANYMORE PAYMENTS?
>> WHEN WAS THE LAST PAYMENT? >> I HAVE NO IDEA.
>> CAN YOU FIND OUT? >> I'LL FIND AND SHOULD HAVE
SOMETHING NEXT COURT. >> COULD I ASK A QUESTION.
AGREEMENT UP TO 500,000. THIS IS ANOTHER ONE ALREADY BEEN
DONE? >> COMMISSIONER, WE ARE IN THE PROCESS OF RECOVERY MODE. FEMA ISSUES REQUEST FOR INFORMATION. IN THAT VAIN THEY WANT TO SEE THESE WERE CONTRACTS THAT TOOK PLACE DURING COVID-19.
THIS IS MAKING SURE THE LANGUAGE IS CORRECT.
TAKE TOWER TWO LEASE, THEY AREN'T NORMALLY THINKING OF FEMA LANGUAGE. SOME HAVE THE RIGHT LANGUAGE.
SOME DON'T. IT IS THE COMPANY THEY HAVE ALWAYS USED. THESE ARE PROVISIONS WE ARE PLACING INSIDE THE CONTRACT SO FEMA KNOWS THE PARTY AGREED.
>> THEY ARE THE ONES THAT DRAFT IT.
>> THIS IS ALL OKAY NOT ONLY LEGALLY, FEMA KNOWS? NOBODY THINKS WE ARE GOING BACK. YOU HAVE DONE ALL THAT AND
CHECKED ALL THAT, CORRECT? >> YES.
I DON'T KNOW IF FEMA KNOWS, WE HAVE DRAFTED THIS AGREEMENT AND
BELIEVE IT IS SUFFICIENT. >> WE HAVE A COVID LAWYER, REMEMBER. JUST WORKS ON OUR COVID CONTRACTS FOR THE PURPOSES OF RETRIEVING OUR DOLLARS.
ALL THIS IS MINISTERIAL TO MAKE SURE.
>> I JUST WENT ON THE RECORD LEGAL CHECKED BOTH OUT.
>> THAT IS WHY I AM ASKING. THIS IS LEGAL AND NOT DOING ANYTHING ODD OR STRANGE. I WANT THEM TO PUT IT ON THE
RECORD THEY HAVE DONE ALL THIS. >> IT CAME FROM YOUR OFFICE, I THINK FRANCISCO JUST SAID THAT. ALL RIGHT.
SO IS THERE A MOTION THEN? >> SO MOVED.
ALL IN FAVOR SIGNIFY BY SAYING AYE.
OPPOSED SAME SIGN. THAT DOES CONCLUDE THE CONSENT AGENDA. THAT IS VERY HELPFUL BECAUSE WE ARE DOING PRETTY GOOD ON TIME. I DO WANT TO HAVE A FEW MORE ITEMS TO TABLE. I AM GOING TO WORK ON THAT.
ITEM 3A. BRIEFING WE WERE GOING TO GET.
[1. Receive briefing from Nueces County Hospital District on matters relating to CHRISTUS Spohn Health System Corporation’s notice of plans to initiate demolition of Memorial Medical Center and other structures and infrastructure located at 2606 Hospital Boulevard, Corpus Christi, Texas; CHRISTUS Spohn’s demolition action pursuant to Master Agreement between the parties.]
TABLE TO JULY 27TH. AS WAS MUTUALLY CONVENIENT.[00:30:01]
>> SECOND. >> I'LL TAKE YOURS AS A MOTION
AND I'LL DO A SECOND. >> I WOULD LIKE TO MAKE A MOTION
TO TABLE NO. 2. >> HOLD ON ONE SECOND.
ALL IN FAVOR OF TABLING ITEM NO. 3A 1, SIGNIFY BY SAYING AYE.
OPPOSED SAME SIGN. >> I WOULD LIKE TO MAKE A MOTION
TO TABLE NO. 2. >> COMMISSIONER GONZALEZ IS HERE
TO MAKE THE PRESENTATION. >> THIS IS THE EXCEPTION WE GAVE LAST TIME. I WOULD LIKE TO MAKE A MOTION TO
>> IT IS NOT WHAT WE GAVE LAST TIME.
WHEN WE VOTED ON IT, YOU SAID YOURSELF ONLY FOR CONCEPT, NOTHING ELSE. GIVE US 30 DAYS TO COME BACK,
HERE WE ARE TWO WEEKS LATER. >> I TOLD XAVIER GONZALEZ TO DO IT WITHIN 30 DAYS AND DID IT QUICKER.
GIVEN THE URGENCY OF THE CONCERN IN OUR COMMUNITY I THOUGHT IT
WOULD BE A GOOD THING. >> WE ARE GOING TO HAVE OUR HANDS FULL UNTIL WE FIND OUT WHAT WE ARE GOING TO DO WITH
THAT ONE. >> ANY RATE, MOTION AND SECOND TO TABLE. I'LL CALL FOR DISCUSSION WHICH IS THAT I THINK IT IS IMPORTANT OPPORTUNITY TO HEAR HIS PRESENTATION. THEREFORE I DON'T THINK WE SHOULD TABLE IT. IF YOU WANT TO TABLE DISCUSSION ON OTHER MATTERS. HE IS HERE TO MAKE THE PRESENTATION AND THE QUICKER WE KNOW.
>> MY MOTION TO TABLE. >> MOTION AND SECOND.
I JUST CALLED FOR DISCUSSION. ALL IN FAVOR SIGNIFY BY SAYING
SO DR. GONZALEZ WILL YOU BRING US --
>> IS COMMISSIONER NOT ONLINE? >> JUDGE, WE HAD AN AGREEMENT.
>> CAN YOU TURN UP YOUR VOLUME JUST A LITTLE BIT.
>> WE HAD AN AGREEMENT. SO UPSET THIS POSTED.
AGREEMENT WE WERE GOING TO ONLY HEAR ITEMS ABSOLUTELY NECESSARY TODAY. COMMISSIONERS COURT GONZALEZ ONLY HERE OUT OF COURTESY. HE ONLY HAS A MEDICAL PROCEDURE.
COMMISSIONER ISN'T HERE BECAUSE OF THIS.
THIS IS WHY I AM SO FRUSTRATED WITH THE COURT MANAGER AND HER STAFF. ONLY SUPPOSED TO BE A BRAND NEW AGENDA THINGS ABSOLUTELY ESSENTIAL TO BE HEARD.
THIS IS NOT ESSENTIAL. MANY ITEMS NOT ESSENTIAL.
I THINK THE COUNTY MANAGER AND HER STAFF COMPLETELY FAILED THIS COURT AND PUTTING MORE AGENDA ITEMS TO CONSIDERING POLICIES APPARENTLY DOESN'T MATTER ONE OR TWO OR THREE COMMISSIONERS WEIGH IN. SHE DOES WHATEVER IT IS SHE IS GOING TO DO. THIS IS NOT AN ITEM IN THE SPIRIT WE ARE HAVING THIS MEETING SHOULD BE HEARD.
THERE ARE OTHER ITEMS WE HAVE TO HEAR.
COMM COMMISSIONER GONZALEZ ISN'T EVEN SUPPOSED TO BE HERE TODAY AND PUSHING AGENDA ITEM PRESENTATION NOT ESSENTIAL ITEM TO HAVE TODAY.
LET'S GET DONE WHAT HAS TO BE DONE ONLY.
AND ALLOW HIM TO GO TO THE MEDICAL PROCEDURE.
I'LL TAKE IT UP WITH THE COURT MANAGER LATER.
SHE IS INAPPROPRIATE POSTING THIS AGENDA.
THIS IS NOT WHAT WAS SUPPOSED TO HAPPEN.
COULD HAVE EASILY CREATED A NEW AGENDA TODAY.
MAJORITY OF THE COURT OVERWRITTEN HOW THIS AGENDA HAS BEEN POSTED. I DON'T UNDERSTAND WHY WE ARE SITTING IN THIS POSITION WHEN COMMISSIONER GONZALEZ ISN'T EVEN SUPPOSED TO BE HERE TODAY. THAT WAS THE INTENT.
I CAN ONLY BE HERE UNTIL 11:00. I HAVE TO LEAVE AT 11:00.
COMMISSIONER MAREZ HAD CONFLICTS.
WE ARE GOING TO SPEND A BUNCH OF TIME BECAUSE THERE IS NO ACTION AND COMMISSIONER HERNANDEZ ISN'T EVEN HERE TO HEAR IT.
I AM EXTREMELY DISAPPOINTED IN THE COUNTY MANAGER AND ESPECIALLY PART OF THE STAFF PROPOSED THEY COULDN'T SET AGENDA SEPARATE FROM ALREADY DONE ABSOLUTELY INACCURATE.
SO I DON'T UNDERSTAND WHY WE ARE HAVING THIS PRESENTATION TODAY.
COMMISSIONER HERNANDEZ ISN'T HERE.
HE HAS AN INJURY. COMMISSIONER GONZALEZ NEEDS TO LEAVE. THIS IS COMPLETELY
INAPPROPRIATE. >> THANK YOU, COMMISSIONER.
[00:35:01]
>> I HAVE TO LEAVE AT 11:00, NO LATER.
>> THANK YOU, COMMISSIONER. >> THIS IS NOT RIGHT.
I CAN'T BELIEVE Y'ALL DENY TO TABLE THIS ESPECIALLY THIS WAS THE AGREEMENT. THIS WAS EXACTLY WHY AGENDA INAPPROPRIATE. HERE WE ARE SUPPOSEDLY ONLY
HANDLE ITEM ESSENTIAL. >> THANK YOU, COMMISSIONER.
THANK YOU. SO WHAT I AM GOING TO DO IS LET'S SEE WHAT TIME ALLOWS XAVIER.
WE'LL HOLD FOR A MOMENT. VOTE IS TO YOU WILL BE ABLE TO MAKE THE PRESENTATION IF TIME ALLOWS.
WE DON'T KNOW THAT IT WILL. I HAVE OTHER TABLED ITEMS.
>> IT IS A PUSH, IT MEANS TO ACTION.
>> IT IS ONLY 2-2. >> 2-2 IS NO ACTION.
>> NO ACTION. >> I AM GOING TO MOVE ON TO ANOTHER ITEM IN THE INTEREST OF TIME.
ANOTHER COUPLE OF TABLED ITEMS, I AM GOING TO TACKLE THOSE.
[3. SPECIALLY SET ITEM AT 10:00 AM Discuss and consider the appointment, employment, evaluation, reassignment, duties, discipline, or dismissal of the Human Resources Director, pursuant to Sec. 551.074 of the Texas Government Code.]

PREVIOUSLY ALLOCATED I WOULD MAKE THE MOTION.
>> THANK YOU. I THINK WE ARE TIME IS OF THE ESSENCE. THAT IS GREAT.
NO OTHER QUESTIONS ANYONE HAS, RIGHT?
>> I BELIEVE? >> YOU ARE ALL GOOD TO GO,
MICHAEL? >> I UNDERSTAND THE DRAWINGS AND SPECIFICATIONS ARE ALREADY PREPARED.
WE SHOULD BE COMING ON THE STREET.
>> THAT IS FANTASTIC. >> THAT IS GOOD NEWS,
THANK YOU. >> I KNOW YOU HAVE A MOTION, IS
THAT RIGHT I'LL SECOND. >> SECOND.
>> ALL RIGHT MOTION AND SECOND. ALL IN FAVOR SIGNIFY BY SAYING
AYE. >> JUDGE, IF I COULD INDULGE THE
[1. Discuss and consider approving a method of procurement (request for competitive bids) for an Oil and Gas Lease of 3,600.54 acres of School Land Lease property in Jim Wells and Live Oak County; approve hiring a land surveyor and an appraiser.]
COURT. I WAS GOING TO GO TO YOU.I THINK WE CAN DO THIS QUICKLY. THIS MIGHT REQUIRE LITTLE BIT OF EXPLANATION. WE ARE NOT THE BENEFICIARY.
ITEM D 1. DISCUSS METHOD OF PROCUREMENT TWO PHASES COMMISSIONERS. APPROVE METHOD .
MICHAEL? >> SO COUNTY RECEIVED UNSOLICITED INTEREST IN PERFORMING NATURAL GAS EXPLORATION OUT AT THE SITE OF THE SCHOOL LAND LEASE AS THE COURT MAY RECALL, EASEMENT, PIPELINE ALREADY RUNS THROUGH THAT PROPERTY. AND SO WHAT WE HAVE DONE IS WE TRIED TO WORK WITH TEXAS OIL AND GAS ASSOCIATION TO EXPLAIN HOW THESE LEASES HAVE DONE. WE ARE GOING TO FOLLOW THE SAME COMPETITIVE BUSINESS ONCE WE HAVE THE PARTITIONS OF LAND DRAWN OUT. ALREADY A LEASEHOLDER WHO RUNS
[00:50:04]
THE LAND THAT IS FOR THE SURFACE LAND.COUNTY HAS THE RIGHTS TO THE NATURAL ROW RESOURCES THAT ARE THERE. THIS IS TO PLACE THIS BEFORE THE COURT FOR THEIR CONSIDERATION. LIKE I SAID UNSOLICITED INQUIRY.
ANY PROCEEDS WOULD BE THE BENEFIT TO THE SCHOOL DISTRICTS.
>> LET ME SAY SOMETHING, MIKE, THIS THING HAPPENED BACK IN 2004. MORE THAN ONE LINE.
THERE ARE ABOUT THREE LINES UNDERNEATH THE PROPERTY.
WE SURVEYED THIS PROPERTY ALREADY TWICE.
I DON'T KNOW WHY WE ARE SURVEYING IT AGAIN.
PROPERTY IS A PROPERTY. THING IS MAYBE APPRAISAL AND VALUE. BUT YOU KNOW, WE ARE ACTUALLY EXECUTORS OF THOSE MONEYS AND HOLD THEM FOR SEVEN SCHOOL DISTRICTS, RIGHT LIVE OAK WE ARE JUST MONITORING THE MONEYS.
WE DON'T GET ANY REVENUES. >> I HAVE DRIVEN PROPERTY MICE.
>> IT IS NOT LIKE SOMETHING NEW. SEVERAL LINES THERE ALREADY THAT WE HAVE TO APPROVE OIL COMPANIES TO COME IN AND DO THE LINES.
THIS IS FOR EXPLORATION. THE WAY IT WAS DESCRIBED TO ME LAND MASS WE DO HAVE APPRAISAL FOR IS FOR THE ENTIRE LAND MASS.
FOLKS IN THE OIL AND GAS INDUSTRY WON'T BID ON PROPERTY OF THAT SIZE. I DON'T KNOW ABOUT OIL AND GAS.
>> PART OF THE AGREEMENT. AGREEMENT WITH THE LANDOWNERS.
>> NUECES COUNTY IS THE LANDOWNER.
>> WE ARE NOT THE LANDOWNERS. WE JUST ARE THE EXECUTORS.
WE WERE APPOINTED EXECUTORS TO MAKE SURE MONEY GOES WHERE IT IS
SUPPOSED TO GO. >> I GOT HERE IN 2008.
>> THAT IS WHAT IT IS ALL ABOUT. WE HAVE SEVERAL LINES UNDER THAT
DISCONNECT, COMMISSIONER. >> THERE IS NOT A DISCONNECT.
I AM MIKE, MAYBE HE WASN'T HERE.
WHAT WE HAVE DONE, ALREADY FOUR LINES OUT THERE.
NATURAL GAS AND OIL. WHATEVER IT IS.
ANY TIME ANYBODY WANTS TO RUN A LINE THEY ARE SUPPOSED TO CHECK
WITH NUECES COUNTY. >> THAT IS EXACTLY WHAT IS HAPPENING HERE. THERE IS A GROUP INTERESTED IN PERHAPS LEASING PROPERTY OUT THERE FOR EXPLORATION.
WE INFORMED THEM THAT WE WOULD NEED TO PUT THAT OUT FOR BIDS.
WE CAN'T AWARD TO ONE INTERESTED PARTY AND SO THE MECHANISM I HAVE AVAILABLE TO ME IS THE LEASING RULES IN THE TEXAS LOCAL GOVERNMENT CODE. I AM PRESENTING THIS TO THE COURT. SOMEONE IS INTERESTED IN PURSUING THIS. IT IS THE COURT'S DECISION IF THEY WISH FOR US TO MOVE FORWARD ON IT.
I TRIED TO PREPARE HOW YOU WOULD DO IT.
>> ALSO A LEASE FOR HUNTING. ALSO A LEASE FOR HUNTING.
>> SET UP FOR GRAZING AND HUNTING.
THAT IS GOING ON RIGHT NOW. >> I REALLY HAVEN'T SEEN PROVIDING THAT CONTRACT JUST SO Y'ALL WOULD KNOW THERE WAS A PARAGRAPH THAT SPECIFICALLY INDICATED RIGHTS OF THE LEASEHOLDER ON THE SURFACE FOR THE GRAZING AND HUNTING.
THOSE BELOW THE SURFACE, COUNTY HAS ABILITY TO LEASE OUT OIL
[00:55:05]
RIGHTS, NATURAL GAS RIGHTS. THAT IS WHAT THIS IS ABOUT.UM, THAT IS ABOUT ALL I KNOW AT THIS POINT.
WHAT I UNDERSTAND IF WE WERE TO PURSUE IT WE WOULD NEED A NEW LAND SURVEY TO PARCEL OUT INTO SMALLER SEGMENTS.
>> CAN WE ACTUALLY PARCEL IT OUT.
? I KNOW THE ONE TIME WE WERE TRYING TO DO SOMETHING WITH LAND WE ARE GOING TO BE IN VIOLATION OF IT. WE DIDN'T DO IT.
>> I WOULD SAY IF THE COURT IS INTERESTED IN THE SPIRIT OF MOVING FORWARD IN THIS AND AUTHORIZED ME TO WALK DOWN THAT PATH. I WOULD WORK WITH THE COUNTY ATTORNEY'S OFFICE AND MAKING SURE WE ARE DOING EVERYTHING
CORRECT. >> I AGREE WITH THAT ONE.
>> LET'S BE CLEAR, THIS IS NOT FOR PIPELINES THIS IS FOR EXPLORATION PRODUCTION -- EXCUSE ME, YOU ARE INTERRUPTING ME AGAIN. EVERYTHING THAT YOU SAID --
>> IS TRUE. >> IS NOT ADDRESSING THIS PARTICULAR ACTION ITEM. THIS ACTION ITEM IS SO WE CAN HELP MAKE MONEY FOR OUR SCHOOL DISTRICTS.
PARCELLING THE LAND IT WOULD NEED SURVEYING AND DOING SO WE WOULD HAVE THE OPPORTUNITY TO HOPEFULLY ATTRACT AN OIL AND GAS EXP EXPLORATION DEVELOPER THAT WOULD LEASE THE ESTATE WHICH IS DIFFERENT THAN THE SURFACE ESTATE. THIS IS THE METHOD WE NEED.
YES, WE NEED AN APPRAISER. YES WE NEED SURVEYOR.
THIS IS THE BEST WAY TO ATTRACT A DEVELOPER AND MAKE GOOD MONEY FOR OUR CHILDREN IN THE SCHOOL DISTRICTS.
IT HAS NOTHING TO DO WITH THE PIPELINES.
THERE IS NO CURRENT -- NOT THIS LEASE.
THIS LEASE IS TO DRILL WELLS. IT WOULD BE OIL AND GAS LEASE FOR PURPOSES OF DRILLING FOR NATURAL GAS AND ROYALTIES ACHIEVED BY THIS LEASE WOULD BENEFIT THE SCHOOL LAND.
EASEMENT FROM THAT PIPELINE. IT IS COMPLETELY DIFFERENT.
THIS IS INCREDIBLY IMPORTANT SO WE CAN MAKE MONEY FOR OUR REGION AND SCHOOL CHILDREN IT IS A GOOD THING.
>> I AGREE. >> THAT IS WHAT THIS IS ALL ABOUT. AND WITH THAT, I WOULD LIKE TO ASK FOR A MOTION TO AGAIN APPROVE THE METHOD OF PROCUREMENT, QUEST FOR COMPETITIVE BIDS AT THIS TIME FOR THIS OIL AND GAS LEASE THAT COMPRISE 3600 ACRES.
THAT IS THE ITEM ONE. SECOND WOULD BE TO APPROVE A LAND SURVIVOR AND APPRAISER. MICHAEL WILL BE WORKING WITH THE COUNTY ATTORNEY'S OFFICE ON THIS MATTERS.
IS THERE A SECOND? I DON'T KNOW IF YOU WANT TO HEAR THEM SEPARATELY, MICHAEL. FIRST IS MOTION TO APPROVE
REQUEST FOR COMPETITIVE BIDS. >> MOTION TO APPROVE.
>> SECOND BOTH TOGETHER, JUDGE. >> IF THE COUNTY ATTORNEY IS OKAY WITH THAT, I AM OKAY WITH THAT.
SURVIVOR, APPRAISER, APPROVAL FOR ALL THREE.
I'LL TAKE THAT AS AMENDED MOTION, COMMISSIONER MAREZ.
IS THAT ALL RIGHT? TAKE THAT AS A SECOND COMMISSIONER CHESNEY? ALL IN FAVOR SIGNIFY BY SAYING AYE. AYE.
>> IT IS EXACTLY 10:05. I COULD HER I WOULD TRY MY BEST
[1. Discuss and consider the Texas Indigent Defense Commission (TIDC), Public Defender Office Mental Division Grant; Discuss and consider submission of the Board of Judges recommendation of oversight committee.]
TO BE TIMELY, STILL PLEASED WITH OURSELVES I AM GOING TO TAKE THE COURT BACK TO THE ITEM THAT DEALS WITH THE TEXAS INDEPENDENT GENT DEFENSE COMMISSION AND VERY IMPORTANT GRANT THAT WE HAVE, WE ARE GOING TO HEAR MORE ABOUT. ITEM B 1.WE HAVE SEVERAL GUESTS. I'LL LET JUDGE MISSY BEGIN.
>> THANK YOU VERY MUCH. >> WE ASK YOU TO HAVE THE MIC.
>> ALWAYS DIFFICULT. I WANT TO START KARAOKE WHEN I HAVE A MICROPHONE. JUDGE THANK YOU FOR HAVING US, COMMISSIONERS, THANK YOU FOR HAVING US AND OUR TEAM HERE.
MY NAME IS MISSY. 347TH DISTRICT COURT JUDGE.
TODAY WE HAVE GREAT NEWS. IT HAS BEEN IN THE PAPER.
[01:00:03]
THEY HAVE IT BEFORE YOU ALL DID. SURE YOU ALL READ IT AND REACHED OUT TO A FEW OF Y'ALL. TODAY TURNING OVER WHAT WE ARE VERY EXCITED FOR. 7.2 MILLION DOLLAR GRANT FROM TEXAS INDEPENDENT GENT DEFENSE COMMISSION.LARGEST GRANT GIVEN THIS YEAR. WE ARE GOING TO, WE ASKED FOR 14 MILLION. THAT WAS PIE IN THE SKY.
WHAT THEY HAVE DONE IS COME BACK.
THEY HAVE OFFERED US 7.2 MILLION DOLLARS.
IN ORDER TO DO THAT WE WON'T BE HANDLING 45% OF ALL THE MENTAL HEALTH CASES AND 13% OF THE REGULAR CASES.
THERE WAS TWO BUCKETS OF MONEY. ONE FOR BACKLOG.
OTHER FOR MENTAL HEALTH. ONLY GRANT THAT WAS A HYBRID GRANT GIVEN BY TIDC. YEAR TWO 1,798,12 DOLLARS.
APRIL 19TH A STEP DOWN. NEXT YEAR TIDC 80%.
NUECES COUNTY PAYS FOR TO. NEXT YEAR 60, 40% FOR NUECES COUNTY, 40, AND 20, ALL THE WAY DOWN FOR STEP DOWN.
7.2 MILLION DOLLARS THIS COUNTY WOULD RECEIVE FROM THE TEXAS DEFENSE COMMISSION. WE TURN IT OVER TO YOU ALL.
WE START WITH AN OVERSIGHT BOARD.
OVERSIGHT BOARD WE REACHED OUT, MY TEAM AND I AMANDA OVER HERE AND LISA AND DANNAH FROM THE APRIL 19TH WE GAVE THIS PRESENTATION. NEXT THING WE DO IS GIVE OVERSIGHT BOARD TO YOU. TEAM MET, OKAY.
WHAT ARE OUR RULES? OUR RULES WE HAVE TO PICK FROM PEOPLE THAT HAVE MENTAL HEALTH BACKGROUNDS, FAMILIARITY WITH PEOPLE THAT HAVE MENTAL HEALTH. ACADEMIA.
INDIVIDUALS THAT REALLY TRULY CARE ABOUT THIS COMMUNITY.
BIPARTISAN COMMITTEE. WE DON'T NEED REPUBLICANS AND DEMOCRATS, WE NEED HUMANS. WE HAVE PRESENTED YOU WITH AN OVERSIGHT COMMITTEE. IT IS YOUR JOB TO APPROVE THE COMMITTEE OR NOT. I BROUGHT TO IT THE BOARD OF JUDGES. I KNOW WE HAD A ZOOM ISSUE.
I KNOW A LOT OF THE JUDGES CAN'T BE HERE.
I WANT TO THANK JUDGE WATTS AND JUDGE WARNER FOR BEING HERE.
WITH THE OVERSIGHT COMMITTEE, PRESENTED IT TO THE BOARD OF JUDGES. BOARD OF JUDGES AGREED 100%.
THEY HAVE ASKED US TO RECOMMEND THESE INDIVIDUALS TO YOU.
WE WANT TO MAKE IT AN ODD NUMBER IN CASE THERE IS DISAGREEMENT.
WE HAVE LEFT TWO POSITIONS OPEN TO APPOINT A PERSON.
YOU KNOW JOHN MARTINEZ. FORMER JUDGE, CITY COUNCILMEMBER, HE IS HERE SEATED TO MY RIGHT.
STANDING TO MY RIGHT. MISS MARSHAL.
SHE IS NOT HERE TODAY. MISS MARSHAL IS THE INDIVIDUAL MISS GREENBURG, SHE REPRESENTED HER SON NOT ABLE TO RECEIVE MENTAL HEALTH TREATMENT AND THEREFORE IT WAS A DISASTROUS OUTCOME. THAT IS WHAT WE ARE TRYING TO PREVENT. BRICK ROGERS RETIRED AT THIS TIME. EXPERIENCE AND DOESN'T TAKE COURT APPOINTMENTS. I THINK IT IS PART OF THE BYLAWS. LISA GREENBURG ON THE TEAM FROM THE VERY BEGINNING, CRIMINAL DEFENSE ATTORNEY.
PUBLIC DEFENSE AND JUSTICE SYSTEM.
ALSO DOESN'T TAKE COURT APPOINTMENT.
LIBBY COMMUNITY LEADER, KNOWLEDGE OF COMMUNITY AND MENTAL HEALTH ISSUES. SHE IS OUT OF THE COUNTRY.
CHRIS ADD LER, NEEDS NO INTRODUCTION.
[01:05:03]
YOU ALL KNOW CHRISSY. SHE IS A COMMUNITY LEADER.EVERY PERSON I CALLED THEY SAID ABSOLUTELY.
THIS IS GREAT FOR OUR COMMUNITY. NEXT BENJAMIN WOLF.
ALSO DIRECTOR OF THE OFFICE OF CAPITAL AND FORENSIC RITZ IN AUSTIN. I MET HIM 25 YEARS OLD.
INDIVIDUAL INCOMPETENT, GIVEN THE DEATH PENALTY.
WE HAD MANY, MANY HEARINGS HE DROVE DOWN FROM AUSTIN.
I GOT TO KNOW HIM REALLY WELL. OUTSTANDING INDIVIDUAL.
DR. OWENS TO MY RIGHT. MEMBER OF THIS COMMUNITY.
JANICE COMMUNITY LEADER, PERSONAL EXPERIENCE WITH MENTAL HEALTH. GRANT JONES, FORMER NUECES COUNTY DISTRICT ATTORNEY. DIRECT KNOWLEDGE OF MENTAL HEALTH CASES. DR. SHANE GLEESON THIS ALSO FULFILLS OUR ACADEMIA PORTION. WORKS AT POLITICAL SCIENCE, IMPACTS ON MARGINALIZED COMMUNITIES.
I MET DR. GLEESON YEARS AGO. I LOVED HIS RESEARCH SO MUCH.
I HAD HIM COME DOWN AND SPEAK TO THE FIFTH REGION.
HE MADE ME COME AND SPEAK TO HIS CLASS AS WELL.
I HAVE KNOWN MANY OF THESE INDIVIDUALS IF MANY, MANY YEARS.
I PRESENT TO YOU THIS BOARD, I BELIEVE THEY CARE ABOUT THIS COMMUNITY. I BELIEVE THEY CARE ABOUT THIS MENTAL HEALTH. AT THIS TIME, I AM GOING TO GIVE YOU A COPY AND TURN IT OVER TO MISS GREENBURG.
>> BOARD MADE UP OF 11. IS THAT A CONSISTENT NUMBER
REQUIRED? >> WHAT THE BOARD YOU HAVE TO HAVE EVEN OR UNEVEN NO.. WHEN WE STARTED, MABL LE-- MAYB LET'S DO SEVEN OR NINE. WE WANTED TO MAKE SURE TO OPEN IT UP SO WE DIDN'T HAVE FIVE PEOPLE ON THERE OR SEVEN.
WE HAVE 11. WE HAVE GIVEN YOU ALL TWO OTHER SPOTS. YOU HAVE ALL 13 SPOTS IF YOU WANT THEM. LEFT TWO OPEN IN CASE YOU ALL WANTED TO JOIN THE COMMITTEE AS WELL.
>> THANK YOU. >> GOOD MORNING.
>> GOOD MORNING. >> SO TODAY IS A REALLY, REALLY GOOD DAY. HAPPY TO BE HERE TO PRESENT THIS TO YOU. JUST SO YOU KNOW TIDC.
TEXAS INDEPENDENT GENT DEFENSE COMMISSION HAS GUIDELINES.
WE DID THE WORK TO FULFILL THOSE GUIDELINES.
THESE 11 PEOPLE WE HAND YOU, THEY HAVE TO BE KNOWLEDGEABLE ABOUT PUBLIC DEFENSE OR MENTAL HEALTH OR COMMUNITY.
THEY HAVE TO FOCUS ON PUBLIC DEFENSE.
CAN'T BE THE LEGAL SYSTEM IN GENERAL.
WANTED YOU TO UNDERSTAND THAT. THEY HAVE TO HAVE SOME SORT OF STAKE IN THE COMMUNITY AND PUBLIC DEFENSE.
WHAT WE WANT TO DO, WE ARE STARTING A PUBLIC DEFENDER'S OFFICE. WE ARE MAKING THE SYSTEM WORK.
WE NEED TO FOCUS ON PUBLIC DEFENSE.
WHEN THE LIST SAYS THEY HAVE TO BE COUNTY COMMISSIONERS, JUDGE TOLD YOU TWO SPOTS FROM THE JUDICIARY.
CAN'T BE ACTIVELY HEARING THE CASES.
COMMUNITY GROUPS, DEFENSE BAR. FORMERLY INCARCERATED PERSONS OR FAMILY, DEFENSE COMMUNITY. WE HEAR SO MUCH ABOUT THIS.
I KNOW YOU KNOW THAT. WE TRY TO DO THE WORK AND MAKE SURE BIPARTISAN. PEOPLE WHO WOULD CARE ABOUT THE SUCCESS OF THIS OFFICE. HERE WE HAVE AN OPPORTUNITY FOR CHANGE. THAT IS WHY TODAY IS SUCH A GOOD DAY FOR ME. SOMEONE THAT HAS SEEN THE PROBLEMS IN THE SYSTEM. WE CAN COMPLAIN.
TODAY IS THE DAY WE CAN MAKE CHANGE.
THESE PEOPLE ARE INVESTED AND CARE.
I FEEL LIKE JUDGE SAID THIS IS OUR BABY.
I AM SO INVESTED IN THIS TO MAKE SURE IT IS A SUCCESS AND PEOPLE'S VOICES ARE HEARD. THAT IS WHY WE DID THIS WORK.
THIS IS UP TO YOU TO DECIDE IF YOU APPROVE OF THE BOARD AND TWO
[01:10:03]
EMPTY SPOTS OR THE ENTIRE BOARD. OTHER THING I WANTED TO REITERATE. ALL HAVE TO BE FREE FROM INTEREST DIRECTLY RELATED. WE MADE SURE DEFENSE LAWYERS DIDN'T TAKE COURT APPOINTMENTS. I HOPE TODAY THAT YOU UM, LOOK AT THIS LIST. I HOPE YOU KNOW, THE ONLY REASON WE ARE HERE IS TO TRY TO MAKE POSITIVE CHANGE.WE HAVE THIS OPPORTUNITY TODAY. I KNOW IT IS NOT EVERYTHING WE ASK FOR IT IS A START. IT IS A GOOD DAY.
WE'LL TAKE THE BALL AND SHOW THIS COMMUNITY WE CAN DO BETTER.
THAT IS WHAT WE ARE ASKING TODAY.
OTHER THAN THE FACT WE SHOULD ACCEPT THIS PROPOSED OVERSIGHT BOARD MEMBERS, NAME TWO MEMBERS OF OUR COURT TO COMPLETE THE 13.
WHAT I HAVE SEEN WORK WELL IN OTHER OVERSIGHT BOARDS TO HAVE RESOURCES. FOR EXAMPLE, WE HAPPEN TO HAVE BEHAVIORAL HEALTH DIRECTOR, DR. XAVIER GONZALEZ.
I WOULD INCLUDE HIM AS EXFISH YOU OR A GREAT RESOURCE.
HE IS THE NEXUS BETWEEN BEHAVIOR AND MENTAL HEALTH IN OUR COUNTY.
THAT WOULD BE GREAT FOR FUTURE WAYS TO FORCE MULTIPLE GRANTS.
ONE THOUGHT. SECOND THOUGHT AGAIN IN THE ROOM, GREAT OPPORTUNITY TO HAVE EXPERTISE IS SOMEBODY FROM MHID.
THOSE ARE MY TWO SUGGESTIONS. NOT AS BOARD MEMBERS, A WAY WE COULD DEFINE THEM. SOMETIMES THEY ARE JUST RESOURCES IN THE ROOM THERE ADVISERS IS A GOOD WORD,
THOUGHTS. >> SHE PASSED ME THE MIC.
REASON I THINK SHE PASSED ME THE MIC.
WE DIDN'T WANT TO PUT THEM ON THE BOARD BECAUSE OF CONTRACTS.
>> ABSOLUTELY INVALUABLE. WE WANT THEM AS RESOURCES.
WE REACHED OUT TO THE OTHER COUNTIES THAT HAVE STARTED PUBLIC DEFENDER'S OFFICE SUCCESSFUL ONES.
>> THAT IS WHAT I THOUGHT, TOO. THEY WANT TO BE THERE BEING YOUR GUIDING LIGHT AND GOOD NEXUS BUT NOT ON THE BOARD.
>> I AGREE WITH THAT. I DID PASS THAT OVER TO LISA.
SHE DID STUDY THOSE RULES. WE REACHED OUT TO ONE AND THEY COULD NOT BECAUSE OF THE CONFLICT.
WE WOULD LOVE THE RESOURCE. HE INTRODUCED HIMSELF TO ME OUTSIDE. AS SOON AS I WALK OUT OF HERE, I AM GOING TO BE OBVIOUSLY INVESTED AND WANT TO HEAR ABOUT IT. AS SOON AS I WALK OUT OF HERE, MY JOB IS DONE. COMMITTEE'S JOB IS DONE.
I WANT TO ECHO WHAT MISS GREENBURG SAID.
THIS IS A GREAT DAY FOR NUECES COUNTY.
I SAID APRIL 19TH, THE MOST MARGINALIZED INDIVIDUALS OF OUR COMMUNITY. INDIVIDUALS WITH MENTAL HEALTH ISSUES. IT IS LIKE BEING BLOWN A LEG OR ARM. IT IS NOT THEIR FAULT.
WE HAVE TO TREAT THEM ACCORDINGLY.
I WILL TELL YOU SOMETHING ELSE. DO YOU REMEMBER WHEN WE GAVE THE PRESENTATION AND TALKED ABOUT TO THE WOMAN NAMED KATE? WE TALKED ABOUT TO YOU ABOUT HOW MANY LAWYERS WE HAD TO GIVE HER.
HOW MANY TIMES SHE HAD BEEN IN AND OUT OF JAIL.
THAT WAS APRIL 19TH. SHE IS STILL IN JAIL.
IT IS A GREAT THING. I AM SUPER PROUD OF THE TEAM.
I COULDN'T BE MORE EXCITED ABOUT THE INDIVIDUALS FROM OUR COMMUNITY THAT JUMPED ON BOARD TO TRY TO DO THIS.
THANK YOU VERY MUCH. >> THANK YOU.
>> MAKE A MOTION TO ACCEPT THE --
>> YES. PROPOSED OVERSIGHT BOARD
MEMBERS. >> I WAS GOING TO DO IT IN TWO MOTIONS. I AM HAPPY TO TAKE RECOMMENDATIONS OF THE JUDGES. I DON'T KNOW WE NEED TOED TWO MORE SLOTS. I THINK 11 IS A LARGE BOARD.
[01:15:04]
GIVE THEM TWO-YEAR TERMS. WE WOULD PUT THAT IN THE ROTATION, MAYBE STAGGER, SOME ARE TWO, THREE.NOT EVERYBODY IS UP. I THINK 11 IS LARGE AS IT IS.
THEY HAVE TAKEN A GREAT AMOUNT OF TIME TO PUT THESE PEOPLE ON.
I WOULD MOVE WE PASS THE BOARD AS SUBMITTED AND PUT THEM ON TWO AND THREE-YEAR TERMS. AFTERWARDS IT WOULD COME BACK TO
COMMISSIONERS COURT COURT. >> COMMISSIONER.
I THINK THE LADIES HERE ARE GOING TO MAKE A COMMENT.
I THINK IN OTHER BOARDS, THERE WAS, WAS IT YOUR REQUEST THAT THE COMMISSIONERS COURT SERVE ON THIS BOARD?
>> YOU KNOW, HERE IS THE THING, THERE ARE OTHER JURISDICTIONS THAT HAVE COMMISSIONERS OR COUNTY JUDGE.
THERE ARE OTHER JURISDICTIONS THAT DO NOT.
WE WANTED TO GIVE YOU ALL THE OPPORTUNITY BECAUSE IT IS FUNNY, EVERY PERSON I CALLED, HEY, I WANT TO TALK TO YOU ABOUT BEING ON THE OVERSIGHT BOARD. I ENDED THE CONVERSATION, I AM OFFERING YOU THIS POSITION AND I DON'T HAVE THE AUTHORITY.
THEN BOARD MEMBERS SHALL SERVE MAXIMUM OF TWO-YEAR BOARD.
I LIKE THE IDEA WE HAVE TO STAGGER IT.
ONCE WE ESTABLISH THE OVERSIGHT COMMITTEE, THEY SHOULD GET TOGETHER AND APPOINT A CHAIR. CHAIR CAN DETERMINE WHETHER OR NOT WHO HAS ONE-YEAR TERMS AN WHO HAS TWO-YEAR TERMS. MIGHT BE PULLING OUT OF A HAT. RANDOMLY ASSIGN ONE AND TWO-YEAR
TERMS. >> I DO THINK IT IS A GOOD IDEA.
I WOULD LIKE TO SERVE AND ONE OF MY COLLEAGUES TO SERVE WITH ME.
WE HAVE SO MUCH WORK TO DO ESTABLISHING PHYSICALITY, HR PIECE IT IS GOING TO WORK BETTER WITH A LIAISON THERE JUST LIKE WITH THE BOARD OF JUDGES. THAT IS TO BRING BACK TO THE RIGHT DEPARTMENTS SO THERE IS A CONTINUING FLOW.
>> I DON'T THINK NONE OF US SHOULD BE ON THE BOARD.
MY OPINION. DR. GONZALEZ IS ADVISORY, GREAT.
WE DON'T HAVE A PROBLEM WORKING WITH EACH OTHER.
I DON'T THINK WE SHOULD BE, THIS IS MY OPINION PART OF ANY OF THE WORD UNTIL YOU SEE WHAT IS GOING TO HAPPEN.
I GUESS AT THAT TIME WE CAN REVISIT.
TODAY ONLY ACCEPTING BOARD RECOMMENDATIONS NOT THE GRANT,
RIGHT? >> THERE SHOULD BE A LETTER -- LGA, LETTER OF AGREEMENT SHOULD HAVE BEEN SENT ALREADY.
IF IT HASN'T BEEN TO THE COUNTY JUDGE.
>> IT ALREADY HAS. >> IT HAS BEEN.
OKAY. >> IF WE HAVE ALREADY ACCEPTED THE GRANT, I AGREE WITH COMMISSIONER GONZALEZ.
COMFORTABLE WITH THE 11 APPOINTED.
ANYTHING PASSED 11 THAT IS A HUGE BOARD.
THAT IS GOING TO BECOME HARD. THIRTEEN IS A BIG NUMBER.
I THINK WE SHOULD ACCEPT SUBMISSION OF THE NAMES, MOVE
FORWARD AND BE HAPPY. >> STAGGER TWO AND THREE.
WEI'LL DO ONE NATURAL. PICKING THE CHIEF PUBLIC DEFENDER. THAT WOULD BE THE MOST IMPORTANT THING THIS BOARD DOES. ESTABLISHING IT.
CHIEF PUBLIC DEFENDER IS GOING TO SET THE TONE.
ALSO GOING TO HAVE TO WRITE BYLAWS.
BY SEPTEMBER. WE ARE ON A FAST TRACK.
WE ARE NOT ON THE KID ROLLER COASTER.
WE ARE ON THE BIG ONE. I DON'T HAVE AN OPINION ON THIS.
I DON'T WANT TO HAVE AN OPINION. WE HAVE GIVEN YOU 11 INDIVIDUALS WE THINK ARE OUTSTANDING. I UNDERSTAND JUDGE CANALES CONCERNS. IT IS NICE TO HAVE SOMEBODY AS A LIAISON TO THE COMMISSIONER COURT.
[01:20:03]
>> WE SIT ON EVERY SINGLE OTHER BOARD FOR A REASON AND PURPOSE.
I WOULD LIKE TO SERVE AS A WAY TO HELP MAKE CERTAIN THINGS GET DONE, NOT BECAUSE I AM LOOKING TO HINDER BUT ENHANCE.
I COME AS ADVISORY RESOURCE JUST LIKE DR. XAVIER.
HOPEFULLY I CAN ATTEND MEETINGS AND MAKE THINGS A REALITY.
THAT IS WHAT HAPPENED WHEN THIS GRANT CAME TO US AND NEEDED ON A DIME'S NOTICE AN INITIAL GRANT WRITER.
IT WILL BE HELPFUL. YOU WANT TO AVAIL YOURSELF OF ALL THE RESOURCES. OUT OF SIGHT OUT OF MIND IS NOT GOOD. YOU NEED SOMEBODY TO HELP FROM WITHIN. THAT IS WHY IT IS DONE IN OTHER LARGE ORE CENTERS AND WHY IT IS CRITICAL HERE.
IT HAS BEEN A LONG, LONG TIME SINCE I WORKED LEGAL AID.
I THINK I WAS PREGNANT AT THE TIME.
I THINK THERE IS AN A REAL VALUE AND I HOPE EXCITEMENT IN HAVING THIS COURT HAVE A MEMBER OR TWO ON THE ADVISORY CAPACITY.
I WANT TO MAKE SURE OUR MARGINALIZED COMMUNITY REFLECTED INSIDE THIS PROPOSED OVERSIGHT BOARD AND MAYBE THAT IS HOW WE CAN USE THOSE OTHER TWO SPACES IF YOU THINK THAT BE PROPER.
I THINK WE OUGHT TO REACH OUT. WE COULD SEEK THESE 11.
LEAVE THOSE TWO OPEN, FOR INSTANCE TO HELP ASCERTAIN LET'S GOAT IT MORE DIVERSE. IT IS NOT AS DIVERSE AS YOUR CLIENTELE. I AM GOING TO TELL YOU THAT RIGHT NOW. THAT IS SOMETHING -- AS SOON AS I AM FINISHED I WILL CALL ON YOU.
I THINK THAT IS IMPORTANT TO THINK ABOUT.
BUT AS THEY SAY, WHETHER IT IS A SECURITY COMMITTEE, WHETHER IT IS THE OPIOID COMMITTEE, DOESN'T MATTER WHAT COMMITTEE.
THERE IS A REASON THAT INTERFACE EXISTS.
JUST AS YOU SAID SHOULD NOT BE POLITICAL.
IT SHOULD BE BECAUSE WE HAVE A GENERAL INTEREST AND WILLINGNESS TO SERVE AND CREATE THAT NEXUS BETWEEN WHAT THE COURT CAN PROVIDE. THIS COURT IS GOING TO PROVIDE RESOURCES. WHEN A COURT PROVIDES RESOURCES IT SENDS SOMEBODY TO MAKE SURE THE RESOURCES ARE PROPERLY BEING ADVISED. THAT IS SMART GOVERNMENT.
I THINK THAT IS IMPORTANT. >> MAKE A MOTION TO ACCEPT A
LIST THAT THE JUDGES GAVE US. >> MOTION IS TO ACCEPT THE 11
AND IS THERE A SECOND? >> I'LL SECOND THAT.
I'LL MAKE A SEPARATE MOTION AFTER THAT.
IF YOU FEEL WE NEED TO HAVE SOME REPRESENTATION EVEN IF IT IS ADVISORY. JUST BY TITLE, COUNTY JUDGE, COURT ADMINISTRATOR. TO REPRESENT OUR INTERESTS.
I THINK IF IT IS REMOVED BUT STILL PART OF IT.
I DON'T WANT TO -- THIS IS A GREAT LIST.
LET'S FOCUS ON THAT FIRST, LET'S GET THE 11.
IF WE CAN ADD ON A SEPARATE MOTION AND ADD ON COUNTY JUDGE
AND COURT MANAGER. >> LET'S VOTE ON THAT FIRST ONE.
IT IS THE 11 PROPOSED OVERSIGHT BOARD MEMBERS AS PRESENTED.
SANCHEZ, RICK, CHRIS, DR. OWENS. GRANT JONES, DR. SHANE GLEESON.
MOTION AND SECOND. NO FURTHER DISCUSSION.
SIGNIFY BY SAYING AYE. >> AYE.
>> MOTION TO ADD TWO MEMBERS ON TO THIS BOARD COUNTY JUDGE AND COUNTY MANAGER AND COUNTY ADMINISTRATOR.
>> YOU HAD HOW MANY, COMMISSIONER?
>> THEY WOULD BE THE RESOURCES. >> I THINK THEY ARE STILL PART
OF IT. >> WE'LL ADD DOCTOR JAVIER
[01:25:03]
GONZALEZ. EX OFFICIO DR. GONZALEZ.REPRESENTATIVE FROM MHID. >> ALL RIGHT.
I HAVE A MOTION AND SECOND. ALL IN FAVOR SIGNIFY BY SAYING
>> OKAY. IS THERE UM, ANOTHER MOTION? OKAY WELL -- MAYBE THE MOTION THAT I HAVE IS TO PERHAPS SINCE THERE ARE TWO SPACES OPEN. I DO THINK WE COULD USE A MORE REFLECTIVE, YOU KNOW, CONTINUE THAT DIVERSITY.
MAYBE YOU WOULD BRING BACK TWO MORE BOARD MEMBERS AND HOPE THE BOARD SEES FIT TO AGAIN, I WOULD LIKE TO SERVE BY THE WAY, JUST TO MAKE THE EXPLANATION WHEN IT IS 2-2 IT IS A PUSH.
NO ACTION TAKEN. HOPEFULLY YOU WILL INVITE YOUR COUNTY JUDGE WHO IS NOT ONLY ENGAGED BUT INTERESTED.
I THINK THAT WOULD SERVE THE WHOLE COMMITTEE VERY WELL.
ADVISORY CAPACITY. IT IS A SAD DAY, I THINK WHEN A COMMISSIONERS COURT DOESN'T ALLOW RESOURCES LIKE HHID, AND COUNTY JUDGE AND COUNTY ADMINISTRATOR.
THAT IS HOW YOU GET THE RESOURCES YOU NEED TO ESTABLISH THIS OFFICE. AGAIN WE WILL LOOK TO YOU TO HOPEFULLY CHANGE THAT IN THE VERY NEAR FUTURE.
>> JUDGE -- >> WITH THAT, EXCUSE ME.
AND WITH THAT, YOU HAVE YOUR 11 SEATED.
AND WE'LL LOOK FORWARD TO MAKING SURE THAT THE NEXT CONVERSATION IS ABOUT THE DOLLARS THAT NEEDS TO COME BACK, JUDGE, AND LISA ON ANOTHER AGENDA ITEM NOT POSTED. WE DO NEED TO ESTABLISH THE FUNDING WHICH DALE HAS ALREADY STARTED WORKING ON.
GOOD NEWS IN THE PROCESS. NEXT IS PHYSICALITY OF THE LOCATION OF THE OFFICE AND HEADED UP WITH THE PROCESS HR PROCESS. SCOPE THE WORK.
YOU HAVE TO CREATE A DESCRIPTION.
YOU ALSO HAVE TO FIGURE OUT HOW TO POST.
YOUR GOALS ARE GOING TO BE IMPORTANT.
>> I WOULD LIKE TO MAKE A MOTION.
>> OURS WAS TO EXCLUDE ANYBODY FROM COMMISSIONER'S COURT.
WE DIDN'T SAY ANYTHING ABOUT DR. GONZALEZ.
AND BEHAVIORAL CENTER. THOSE SHOULD BE ADVISORY.
>> ARE YOU MAKING A MOTION? >> MAKE A MOTION DR. GONZALEZ AND BEHAVIORAL CENTER BE OUR ADVISERS.
>> OKAY. MOTION IS DR. GONZALEZ IS ACCEPTABLE MHID JUST NOT THE COUNTY JUDGE.
GOT IT. IS THERE A SECOND TO THAT COMMI COMMISSIONER CHESNEY?
>> I HAVE A SECOND. >> COULD WE GET THE SECOND AND
CALL FOR DISCUSSION? >> MY QUESTION IS ABOUT THE SECOND. MY UNDERSTANDING THEY FELT LIKE THERE WAS CONFLICT WITH DR. GONZALEZ AND MHID BECAUSE OF THE CONTRACTS. I DON'T KNOW IT IS WISE TO INCLUDE THEM IN THAT EITHER BECAUSE OF THE POTENTIAL
CONFLICT. >> I THOUGHT IT WAS JUST THE
BOARD. >> MHID IS GOING TO BE INVOLVED IN EVERY SINGLE ONE OF THESE CASES.
I DON'T SEE THE CONFLICT. IF YOU WANT TO WE COULD BRING THAT BACK. I DON'T KNOW WHAT THE CONFLICT IS. THESE ARE PEOPLE IN THE JUSTICE SYSTEM -- THIS IS TWO DIFFERENT THINGS.
THIS IS A DISCONNECT. LISA, YOU WANTED TO SAY
SOMETHING? >> TODAY WE HAD TO SET UP THE COMMITTEE WHO WILL SET UP THE BYLAWS.
[01:30:02]
THERE WAS A CHECKLIST FOR THE GRANT.FIRST THING THAT WE UNDERSTOOD TO DO IS GET THE COMMITTEE, OVERSIGHT COMMITTEE. OVERSIGHT COMMITTEE SAID COULD
NOT HAVE ANY KIND OF CONFLICT. >> I RESEND MY MOTION.
>> I WANT TO TELL YOU IF IT HELPS, ONCE THAT COMMITTEE HAS BEEN APPROVED, WE WORK ON HIRING CHIEF PUBLIC DEFENDER BY SEPTEMBER. IN THIS PLAN OCTOBER HIRE CHIEF PUBLIC DEFENDER AND OFFICE PLAN, OCTOBER-NOVEMBER, OFFICE SPALS SHOULD BE DISCUSSED OCTOBER-DECEMBER OR COMPLETED.
STRICT DATES FOR THESE FUNDS. I DON'T WANT TO SOUND LIKE WE DON'T NEED THOSE RESOURCES. JUST LIKE JUDGE CANALES SAID, EVERY PERSON THAT COMES TO THIS HAS HISTORY.
WE NEED THEM. WE WANTED TO FOLLOW THE RULES.
THE BLACK LETTER LAW. >> WE ARE TALKING ABOUT YOUR FUTURE. WE ARE NOT TALKING ABOUT WHAT WE NEED TO SIGN -- THAT IS MINISTERIAL PIECE.
WE ARE TALKING ABOUT WHAT THE FUTURE LOOKS LIKE.
I AM HAPPY WHAT WE HAVE DONE HERE TODAY.
WE CAN MOVE ON SO IT BECOMES A HAPPY NOTE.
NOT ANYTHING ELSE. AGAIN SO MUCH WORK TO DO.
THIS IS THE BEGINNING OF A VERY LONG AND GREAT PROCESS.
>> LAST THING, ALSO, SORRY, COMMISSIONER CHESNEY, ONE LAST STATEMENT. WE ARE GOING TO BEGIN ACCEPTING MENTAL HEALTH PUBLIC DEFENDER'S OFFICE STARTING JANUARY 1ST.
DEADLINE FOR BUILT OUT, STAFF, ATTORNEYS EVERYONE ON THERE.
IT IS A RACE. THANK YOU, GUYS.
OBVIOUSLY COMMISSIONER CHESNEY WANTS TO SAY SOMETHING.
>> I WAS GOING TO END THIS ON A POSITIVE NOTE.
VERY APPRECIATIVE OF ALL THE GREAT WORK YOU HAVE DONE.
THIS IS A HUGE, HUGE DAY TODAY. HAPPY WITH THE BOARD YOU PUT TOGETHER. AGAIN 11 IS PLENTY AND COME UP WITH 11 GREAT PEOPLE. THANK YOU, THANK YOU.
I KNOW THIS WAS A BIG HUGE DEAL. BIG HUGE UNDERTAKING.
THAT IS WHAT WE SHOULD TAKE AWAY FROM TODAY THIS IS A GREAT, GREAT STEP FORWARD FOR NUECES COUNTY.
WE WOULDN'T BE IN THIS POSITION. NOTHING TO DO WITH THIS COURT OTHER THAN SAYING YES. IT WAS ALL THE WORK JUDGE AND MISS GREENBURG. THANK YOU, WE LOOK FORWARD TO HEARING MORE FROM YOU IN THE FUTURE.
>> GOOD LUCK. >> THANK YOU VERY MUCH.
[APPLAUSE] >> CONGRATULATIONS TO THE OVERSIGHT BOARD. THANK YOU ALL VERY MUCH.
JUDGE CANALES. >> I WAS GOING TO REOPEN PUBLIC
[F. PUBLIC COMMENT: This section provides the public the opportunity to address the Commissioners Court on any issues within its jurisdiction. The Commissioners Court may not take formal action on any requests made during the Public Comment period which are not on the Agenda, but can refer such requests to County staff for review if appropriate.]
COMMENT. IT IS NOT POSTED.WHAT I'LL DO I'LL INVITE ANY OF THE JUDGES TO STAY LIKE JUDGE WATTS. I AM GOING TO REOPEN FOR LIMITED PURPOSE OF ONE ITEM JUDGE MA DEERY IS GOING TO SPEAK.
>> OFFICE OF COURT ADMINISTRATION HAD SAME TYPE OF ARPA FUNDS THE TEXAS INDEPENDENT GENT DEFENSE COMMISSION.
AGAIN WITH MY TEAM OF AMANDA, ABSOLUTELY OUTSTANDING.
WE WROTE WITHOUT A GRANT WRITER. WE WROTE A GRANT TO BE ABLE TO GET GRANT FOR AUXILIARY COURT. WE WHAT DID, THEY HAVE BASICALLY GIVEN US APPROXIMATELY $900,000 THAT WOULD BE TO START AUXILIARY COURT. IT IS GOING TO BE HELPING US WITH THE BACKLOG AS YOU ALL KNOW.
WE TALK ABOUT BACKLOG ALL THE TIME.
BACKLOG IN 254 COUNTIES. MANY DID GET THESE TYPE OF GRANTS. GRANT WOULD BE FOR A VISITING JUDGE. FOR A TIME PERIOD.
I WOULD LIKE TO DO IT FOR SIX MONTHS AT A TIME IN ORDER TO
[01:35:02]
HAVE CONTINUITY. THAT WOULD BE FOR 72 WEEKS WHICH WOULD BE TWO YEARS. IT WOULD BE EVERY THREE WEEKS OUT OF EVERY FOUR. SO THAT IS WHAT WE WOULD LIKE TO DO. ALSO GIVEN MONEY FOR PROSECUTOR FELONY FIVE POSITION. WE ALSO HAVE A CLERK, CERTIFIED BAILIFF AND WE WOULD BE ABLE TO WORK WITH THIS.PLACE WE ARE THINKING SO IT DOESN'T COST YOU ALL A FORTUNE.
JUDGE PULCHUER WORKS FOR CLAYBURG COUNTY AS WELL.
WE WANT TO MOVE AUXILIARY COURT TO THE EIGHTH FLOOR ON EVERY OTHER WEEK. ON THE THIRD WEEK, WE ARE STILL PUTTING THIS TOGETHER. I AM GOING TO MEET WITH THE BOARD OF JUDGES. INSTEAD OF TAKING FIFTH FLOOR COURTROOM, OUR COUNTY JUDGES USE A LOT.
THAT IS ALL I HAVE ON THE AUXILIARY COURT.
WE ARE VERY EXCITED. IT IS ANOTHER RESOURCE THAT CAN HELP THIS COUNTY TRYING TO GET RID OF THE BACKLOG.
JURY TRIAL STOPPED. WE COULDN'T DO JURY TRIALS.
AS WE TALK ABOUT IT, OUR JAIL IS STUFFED RIGHT NOW.
GIVE US ONE MORE RESOURCE TO BE ABLE TO HELP US GET RID OF THE BACKLOG. THANK YOU.
>> OKAY. ALL RIGHT THANK YOU SO MUCH.
SO WE ARE GOING TO CONCLUDE PUBLIC COMMENT AT THIS POINTED.
IN AN EFFORT TO FINISH A FEW MORE ITEMS HERE.
I AM GOING TO DIRECT YOUR ATTENTION TO FINISHED
[12. Receive update on Commissioner Court Courtroom audio/visual capabilities, including microphone system.]
[13. Discuss and consider recording executive session meetings, identifying a funding source for the needed equipment, and related matters.]
PURCHASING. >> JUDGE, I CAN TABLE --
>> I'LL RECOGNIZE COMMISSIONER CHESNEY?
>> I CAN TABLE ITEM 12 AND 13. >> I'LL TAKE THAT.
TILL JULY 6TH. OR THE NEXT ONE AFTER.
>> SOME TIME IN JULY, I GUESS. >> LEAVE IT OPEN, YES, MA'AM.
>> I AM GOING TO TAKE THOSE AS A MOTION AND SECOND ITEM NO. 12 FOR TABLE JULY DATE. TO BE DETERMINED.
AND IS THERE A SECOND? I SECONDED IT.
MOTION AND SECOND. ALL IN FAVOR SIGNIFY BY SAYING
[1. Discuss ongoing issues with intercom replacements at the County Jail and possible remedies; Discuss and consider authorizing temporary employees, purchase of equipment, or pursuing other possible remedies; Discuss and consider funding sources.]
ALL RIGHT. AND UM, I AM GOING TO TACKLE VERY IMPORTANT ITEM DARRYL IS HERE FOR F 1.DISCUSS ONGOING ISSUES AT THE COUNTY JAIL AND TEMPORARY EMPLOYEES PURCHASE OF EQUIPMENT AND PURSUING OTHER REMEDIES.
THIS IS A GENERAL HOW TO FIX INTERCOM PROBLEM IN THE JAIL,
PRETTY STRAIGHTFORWARD. THIS FELL IN MY LAP BACK IN DECEMBER, NOVEMBER MET WITH THE SHERIFF'S OFFICE.
THIS WAS SOMETHING APPARENTLY FALLEN APART OVER THE YEARS.
I BELIEVE IT HELPED IN THE PAST. ALSO BROUGHT IN A CONTRACTOR THAT DIDN'T WORK OUT. RELIEVED OF THEIR DUTIES.
CAUSING QUITE A STRAIN ON THE IT DEPARTMENT.
INTERCOMS VANDALIZED AT A HIGH RATE.
PUBLIC WORKS, ACTUALLY WAS ABLE TO BRING ON TWO EMPLOYEES, THEY HAVE A LOT OF EMPTY POSITIONS. PUBLIC WORKS GOT A COUPLE POSITIONS TO HIRE SPECIFICALLY TOILETS AND LIGHTS GET BROKEN.
SEEMS TO BE THE LIGHTS MAIN CULPRIT.
INMATES CAN REACH THE LIGHTS AND REMOVE THE COVER, DESTROY THE LIGHT AND THEY CAN ALSO GET PARTS FOR THE LIGHT AND USE THEM AS LITTLE TOOLS AND WHITTLE AWAY AT INTERCOMS AND TOILETS.
[01:40:10]
INTERCOMS AND WIRING, EVEN THE HOUSING.THEY HAVE EVEN STRIEED PUTTING THESE WITHIN HEFTY IRON ENCLOSURES, EVEN THOSE GET DESTROYED.
I HAVE GONE AND SEEN WHERE THESE ARE MOUNTED.
NOTHING BUT A RUGGED HOLE LEFT IN A CINDER BLOCK.
WE TRIED OUT SOURCING. I DON'T HAVE SOURCES FOR HANDLING THIS. IT IS A PERPETUAL PROBLEM TAKING AWAY IT PERSONNEL. [INAUDIBLE] IT IS INVOLVING PEOPLE HIRED FOR SOMETHING ELSE BY FAR.
IT IS TAKING AWAY FROM THE OTHER DUTIES THEY SHOULD BE PERFORMING. WE LIKE TO DO BRING OVER TWO POSITIONS. I DON'T NEED THEM PERMANENTLY.
>> RIGHT. I THINK WHAT HE IS TRYING TO SAY, LET'S GO AHEAD AND YOUR RECOMMENDATION IS TO TAKE, I
WILL HAVE IDAY READ IT OUT. >> WHAT WE RECOMMEND TWO TEMPS
FOR HIS DEPARTMENTS FOR 90 DAYS. >> IS THAT THE HOEGS?
>> OKAY. TWO POSITIONS 90 DAYS.
THERE IS A MOTION? IS THERE A SECONDS? SECOND. ALL OF THIS AND MORE TONIGHT ON "NEWSWATCH". ALL IN FAVOR SIGNIFY BY SAYING AYE AND THEN THERE WAS THE OTHER PIECE OF IT WHICH IS JUST DISCUSS AND PURSUE
THE REMEDIES, RIGHT, DARRYL? >> PROBABLY BEYOND MY SCOPE.
IT IS MORE OF A JAIL ISSUE SHERIFF MAY WANT TO GET INTO.
IMPORTANT THING KEEP THE PROJECT ROLLING.
KEEP UP WITH THE BACKLOG. REAL FIX IS A JAIL.
PERSON IS NOT GOING TO TALK ABOUT NEW JAILS.
>> I WAS WONDERING IF THERE WAS ANY NEW TECHNOLOGY.
SEEMS THEY ARE YANKING IT, DO YOU MIND, SHERIFF GIVING US A LITTLE BIT. CERTAINLY, WE ARE NOT THE ONLY JAIL IN AMERICA THIS HAS HAPPENED TO.
MAYBE THERE ARE BEST PRACTICES WE COULD INVEST IN.
>> SO ONGOING PROBLEM AND IT HAS BEEN GOING ON A LOT LONGER THAN TWO OR THREE YEARS, HARDWARE THAT IS BEING USED INSIDE IF JAIL IS OLD SCHOOL TECHNOLOGY. ALL WE HAVE BEEN DOING WITH THE INTERCOM AND LIGHT FIXTURES AND PLUMBING REPLACING THOSE PIECES
WITH MORE OF THE SAME. >> RIGHT.
>> AND SO IN THE PAST TWO WEEKS WE HAVE HAD THREE DIFFERENT CONTRACTORS COME THROUGH THE JAIL LOOKING AT WHAT EXISTS NOW.
THEY ARE, THEY WILL BE SUBMITTING PROPOSALS OR IDEAS ONNING RETROFITTING WITH SOMETHING STRONGER, HARDER, UNITS BEING USED NOW AS FAR AS THE INTERCOM, THEY CAN BE DESTROYED AND MADE INOPERABLE WITH LIQUID.
WHETHER IT IS URINE OR WATER. THEY ARE WATER RESISTANT BUT NOT
[01:45:04]
WATERPROOF. WE HAD THREE DIFFERENT VENDORS WALK THROUGH THE JAIL LAST TWO WEEKS.ONE IS DOING A MAJOR OVERHAUL OF THE INTERCOM SYSTEM AT THE COASTAL BEND DETENTION CENTER IN ROBSTOWN.
WIRELESS TECHNOLOGY FOR 150 INMATES SEGREGATED.
ISOLATION WHERE THE INMATE IS IN HIS CELL FOR 23 HOURS OUT OF A 24 HOUR DAY. THOSE INMATES ARE THE ONES TEARING UP THE INTERCOMS BECAUSE THEY HAVE NOTHING MORE THAN TIME ON THEIR HANDS. SO THEY ARE LOCKED IN A CELL.
WE DON'T HAVE A CAMERA FOR PRIVACY PURPOSES BUT WE DO HOURLY CHECKS. SOMETIME WITHIN THOSE HOURLY CHECKS, THE INTERCOMS GET DESTROYED.
THE DEMOGRAPHICS OF THE PRISONERS CHANGED.
ALMOST EVERYBODY IN OUR JAIL ARE VIOLENT OFFENDERS.
WHEN IT COMES TO ALTERING THEIR BEHAVIOR, OR PUNISHING THEM FOR TEARING UP AN INTERCOM. THERE IS NOT A LOT WE CAN DO, JUDGE. IF THEY HAVE COMMISSARY MONEY, WE CAN SEIZE COMMISSARY MONEY FOR REPLACEMENT OF THE HARDWARE.
MOST OF THEM DON'T EVEN HAVE COMMISSARY MONEY.
WE PUT A TAB ON THEIR BILL AND IF THE NEXT TIME THEY ARE BOOKED INTO THE COUNTY JAIL AND COME IN WITH MONEY IN THEIR POCKET WE CAN SEIZE THE MONEY AT THE TIME. THAT IS NOT FIXING THE PROBLEM IN THE SHORT TERM. THAT IS WHERE WE ARE AT.
>> SOUNDS LIKE FROM DARRYL'S PERSPECTIVE, WE DID WHAT WE COULD DO. SOUNDS LIKE YOU ARE GOING TO BRING BACK NEW IDEAS, PERHAPS. I LIKE THE IDEA OF THE WIRELESS TECHNOLOGY. IS THAT FAIR? THAT IS ONE THING I WANT TO CORRECT.
QUITE FRANKLY A LOT OF BANG FOR THE BUCK.
IT IS NOT AS HUGE MAYBE WE SHOULD HAVE TOLD THEM THAT.
VERY, VERY GOOD USE. THANK YOU, DARRYL, THANK YOU, SHERIFF. WE LOOK FORWARD TO HEARING YOUR FUTURE REMEDIES THERE. I HEAR YOU.
I HAVE TWO MORE THAT ARE SMALL I WOULD LIKE TO GET TO AND I'LL CALL ON C 1 AND C 2. THE FIRST IS HRES I WANT TO
[1. Discuss and consider order approving and accepting donation as the designated beneficiary of Cindy Martinez's life insurance policy proceeds.]
FINISH. DISCUSS AND CONSIDER APPROVING ACCEPTING DONATIONS OF THE LIFE INSURANCE THIS WAS AN EMPLOYEE OF OURS THAT LIFE NUECES COUNTY LIFE PROCEEDS.ALL WE ARE DOING IS ACCEPTING IT.
CONSIDERING ORDERED TORE APPROVE IT.
IS THAT CORRECT? EVERYBODY ON THE LEGAL TEAM?
>> YES. IS THERE A MOTION TO APPROVE?
>> SECOND? ALL IN FAVOR SIGNIFY BY SAYING
THEN WE HAVE SOME SALARY SAVINGS.
[2. Discuss and consider reclassifying the Juvenile Probation Officer Victim Service position in the Texas Juvenile Justice Department (TJJD-A State Aid) Grant for Juvenile Department from Pay Group 23/03 to Pay Group 24/03. ]
REPRESENTED BY TWO AND THREE. SECOND ONE IS ITEM NO. 2, RECLASSIFY JUVENILE PROBATION OFFICER VICTIM IN A GRANT PAY GROUP 23-24. AGAIN FROM A GRANT NO COST TO>> NO COST. VERY MUCH NEEDED NOW.
MOTION TO ACCEPT RECLASSIFICATION? AGAIN FROM A STATE GRANT. THANK YOU.
I'LL SECOND ALL IN FAVOR SIGNIFY BY SAYING AYE?
>> AYE. >> JUDGE, I AM RUNNING OUT OF TIME. I AM NOT TRYING TO LEAVE OUR GET
[01:50:02]
OUT OF HERE. I MENTIONED I HAVE TO LEAVE BY 11:00. I CAN PUSH ANOTHER 15-20MINUTES. >> CAN I HURRY THROUGH HR.
>> I AM LEAVING, TOO. >> THERE IS NO WAY WE CAN HAVE THAT PRESENTATION IN FIVE MINUTES.
COMMISSIONER YOU SAID YOU CAN BE HEAR UNTIL NOON.
>> YOU ARE WILLING TO WALK? >> IT IS FOR THE JAIL, SIR.
[4. Discuss and consider creating and unfreezing an Employment Liaison (Pay Group 15/01) in the County Jail (#3720) and deleting a Cadet Corrections Officer position.]
SHERIFF NEEDS THIS ON ITEM NO. 4.PLEASE WAIT. >> I'LL MOVE FOR THAT.
>> FOR HEAVENS SAKES DISCUSS AND CONSIDER -- [INAUDIBLE] NO.
3720, CADET OFFICER IT IS AN IMPORTANT MOVE, SHERIFF YOU DO RECOMMEND IT. THERE IS A MOTION.
>> CONSIDER UNFREEZING, IT IS ALREADY CREATED?
I AM CONFUSED BY THE WORDING. >> I UNDERSTAND.
SHERIFF WOULD YOU MIND? ALL IN FAVOR SIGNIFY BY SAYING
[3. Discuss and consider reclassifying the First Assistant-County Auditor position in the department of County Auditor (#1250) from Pay Group 34 to Pay Group 32.]
>> ALSO COST SAVINGS. IT WILL HELP US GET A POSITION WE NEED POSTED. THAT IS THE RECLASSIFICATION OF FIRST ASSISTANT COUNTY AUDITOR POSITION, ITEM NO. 3.
THIS IS SALARY SAVINGS AGAIN HERE.
I HAVE A MOTION AND SECOND. ALL IN FAVOR SIGNIFY BY SAYING
OKAY. AND THEN, WE ARE ABOUT TO LOSE HOPKINS TO HARVARD LAW. TWO ITEMS REGARDING THAT
[6. Discuss and consider the applications review and interview process for the Nueces County Development Commission Director.]
POSITION. IT IS TO DISCUSS APPLICATIONS TO REVEAL INTERVIEW PROCESS. IDEA IS THAT WHEN THIS POSITION IS POSTED, COMMISSIONERS COURT WOULD INTERVIEW LIKE WE DO FOR DEPARTMENT HEADS. I THINK THAT'S THE PROCESS MAYBEWE ADD CHAIRMAN OOR >> I WOULD LIKE TO WAIT ON THIS
ITEM? >> WOULD YOU LIKE TO TABLE THIS?
>> WE ARE GOING TO BE VOID SOMEBODY THERE.
I WON'T BE HERE FOR ANOTHER COMMISSIONERS COURT MEETING.
>> RIGHT. >> ALL THIS IS TO SAY WE ARE
GOING TO INTERVIEW THIS PERSON. >> I BELIEVE THE INTENT WAS THE MAKE SURE THE NCDC COMMISSION HAD INSIGHT INTO THE INTERVIEW PROCESS. THEY ARE PREPARED TO PUT TOGETHER A COMMITTEE WHATEVER THE PROTOCOLS IS HIRE AGO DEPARTMENT HEAD. WE WOULD LIKE TO MAKE SURE THE COMMISSION HAS A PRETTY GOOD INSIGHT AND INPUT INTO THE
PROCESS OF HIRING THE DIRECTOR. >> OKAY.
>> $30,000 INCREASE? LET CINDY KNOW AND SHE CAN RELAY
THE INFORMATION. >> MAIN ONE, I DIDN'T HEAR IF
THERE WAS ACTION ON FIVE? >> I AM GOING BACK THERE.
COMMISSIONER CHEST CHESNEY IS A TABLE TO JULY 6TH, KARA.
[5. Discuss and consider reclassifying the Deputy Director (Pay Group 24) in the department of Nueces County Development Commission (#1389) to Economic Development Director (Pay Group 32) and add a car allowance.]
SIGNIFY BY SAYING AYE. >> JUDGE?
>> YES, MA'AM. JUST TO NOTE ON RECLASS FOR THE POSITION. IT IS A 0 COST INCREASE.
EVERYTHING COMING WITHIN THE BUDGET.
ALSO FROM CONTINGENCY APPROPRIATIONS TO OFFSET.
[01:55:04]
>> I WOULD LIKE TO TABLE MOTION 5.
I WOULD LIKE TO HAVE LARGER DISCUSSIONS.
THIS IS NOT A FIVE MINUTE DISCUSSION, EITHER.
>> ALL RIGHT. I WANT THE COURT TO RECOGNIZE WE ARE NOT GOING TO BE ABLE TO POST AND AN OPEN POSITION THERE.
>> SECOND. >> MOTION AND SECOND.
>> ALL IN FAVOR SIGNIFY BY SAYING AYE.
>> AYE. >> I AM GOING TO HAVE TO VOTE NO. IT IS IRRESPONSIBLE NOT TO ALLOW
[7. Discuss and consider creating and unfreezing an Audio/Visual/Interactive Integration Specialist (Pay Group 32/01) in Information Technology Department (#1240) and deleting a Systems Analyst (Pay Group 32/06) due to employee retirement at the end of June 2022.]
FOR THE POSTING TO OCCUR. ITEM NO. 7 IS ALSO A, CAN YOU HELP ME OUT ON ITEM 7 IT IS NO COST, BUT A SALARY SAVINGS.A SAVINGS BEFORE WE LOSE EVERYBODY.
>> PERSON RETIRING THEIR SALARY IS HIGHER THAN WHAT THIS POSITION WILL COME IN AT. IT IS A SYSTEMS ANALYST THAT IS RETIRING. FEW SYSTEMS ANALYST AND CHANGING TIMES. THIS IS A MODERNIZATION APPROACH FOR THE DEPARTMENT. WE TABLED A COUPLE OF ITEMS RELATED TO AV STUFF. THIS IS A HUGE PLUS FOR THE DEPARTMENT. WE ARE LACKING IN THIS AREA.
WE ARE WEAK AND READY TO STRENGTHEN IT UP.
WHAT WE HAVE NOW WE ARE GROWING IN THIS AREA.
YES, VERY VITAL. >> BIG THING IS, FROM SALARY
SO THERE IS A MOTION I'LL MAKE THE MOTION TO CREATE THE INTEGRATION SPECIALIST PAY GROUP 32.
DELETE SYSTEMS ANALYST IN GROUP 32.
ALL HAS TO DO WITH THE RETIREMENT.
IT IS A GOOD TIME TO DO IT. >> ALL RIGHT.
IS THERE A SECOND? >> ALL IN FAVOR SIGNIFY BY
THAT TOOK CARE OF QUITE A BIT OF THE INFORMATION TECHNOLOGY AS
[8. Discuss and consider Fire Marshal Job Description.]
WELL AS ALL THE HUMAN RESOURCES THAT HAD TO BE DONE.TABLING ON ITEM NO. 8? >> SO MOVED.
>> JULY 6TH IS THAT ALL RIGHT? >> YES.
>> ALL IN FAVOR SIGNIFY BY SAYING AYE?
OKAY. THAT TAKES CARE OF ALL OF THAT.
CLEARLY WE ARE NOT GOING TO GET TO EXECUTIVE SESSION TODAY.
DO YOU HAVE TO LEAVE AT 11:00 WHAT IS THE SITUATION?
>> I AM DOING THE BEST I CAN. THERE ARE ACTION ITEMS I WOULD
APPRECIATE WE CAN GET TO. >> I FEEL LIKE I HAVE RACED THROUGH THE COUNTY'S BUSINESS. I AM GOING AS FAST AS POSSIBLE HERE. THERE ARE OTHER ONES THAT COULD BE TABLED. ITEM NO. 15, FOR INSTANCE.
>> IF WE COULD GO TO C 1 AND 2. I KNOW COMMISSIONER GONZALEZ HAS
[1. Receive presentation from Turner Ramirez Architects for renovations at the Calderon Building; Discuss and consider Goodbuy EZIQC Contract No. 20-21 7GCJOC2 with Barcom Construction, Inc. for Nueces County Calderon Building Interior Renovations.]
PHILLIP VENNITEZ. >> EXCUSE ME, JUDGE PUBLIC WORKS IS IN NEED OF APPROVING THE CONTRACT WITH BAR COME TO GET
CONSTRUCTION GOING. >> I HAVE AN ISSUE WITH THAT.
I JUST CALLED PHILIP. YOU'LL HAVE TO WAIT.
THANK YOU. YOU SHOULD BE READY TO EXPLAIN WHY WE DIDN'T COMPETITIVELY PROCURE THAT.
IF YOU ARE NOT IN A POSITION TO DO THAT, PLEASE GO GET YOUR DEPARTMENT HEAD. HI PHILIP, YOU ARE GOING TO VISIT WITH US, ITEM C 1 FOR THE CLERK.
>> I KNOW YOU ARE TRYING TO MOVE FORWARD QUICKLY.
I WILL DO MY BEST. WE COMPLETED THE PLANS FOR THE RENOV RENOVATIONS.
FOR THE MEDICAL CLINIC. THOSE PLANS WERE SUBMITTED TO PUBLIC WORKS. AND DUE TO THE SIZE OF THE PROJECT AND SCALE OF IT THE BEST PROCUREMENT METHOD TO PUT IT OUT
[02:00:04]
TO THE BOARD ESSENTIALLY. I BELIEVE WE RECEIVED, COUNTY RECEIVED PROPOSAL FOR SAID RENOVATIONS TOTAL WE WERE ASKING FOR OUR INITIAL BUDGET FOR THE PROJECT EARLIER IN ONE OF THE PREVIOUS PRESENTATIONS, I BELIEVE WE THOUGHT THE BUDGETED SHOULD BE IN THE $650,000 RANGE OR NORTH OF THAT AS WE ALL KNOW, CONSTRUCTION MARKET HARD TO PREDICT AT THE MOMENT.HOWEVER WE DID RECEIVE A BID FROM BAR COME GOOD-BYE PROGRAM IN THE AMOUNT OF $586,411. IT IS QUITE FRANKLY ONE OF THE FEW INSTANCES OVER THE PAST SIX OR SEVEN MONTHS WE HAVE SEEN A PROJECT FALL WITHIN THE PREDICTED BUDGET RANGE.
THE BID AS PROPOSED SEEMS REASONABLE.
WE WORKED WITH BAR COME ON MULTIPLE PROJECTS AND A CONTRACTOR TO PERFORM THE WORK. THEY HAVE DONE A LOT OF WORK IN THE COMMUNITY. I STAND BY FOR QUESTIONS Y'ALL MIGHT HAVE WITH REGARDS TO THE BIDS YOU MIGHT HAVE RECEIVED.
>> I AGREE WITH YOU ON THE ANALYSIS BAR COME ONLY DOES SUPERIOR WORK IN THE COMMUNITY. MY CONCERN, WHY DID YOU CHOOSE, DID WE AUTHORIZE PROCUREMENT ON A BIBOARD.
I HAVEN'T SEEN THE PLANS, I HAVEN'T SEEN THE PRESENTATION OF THE PLANS IN COURT. WE HAVEN'T SEEN WHAT YOU DESIGNED. YOU HAVEN'T MADE THAT FULL.
YOU THOUGHT WE SAW PRELIMINARY. WE ACTUALLY TABLED IT OR WE WERE GOING TO BRING IT BACK. WHEN DID WE SEE AUTHORITY FOR
PROCUREMENT TO GO BY BOARD. >> THAT IS AT THE PUBLIC WORKS LEVEL. HOWEVER MY UNDERSTANDING, DUE TO THE NATURE OF THE SIZE OF THE PROJECT, WE WORK WITH LOTS OF CLIENTS THAT HAVE THE ABILITY TO PROCURE THAT WAY.
DID NOT SEE ANYTHING OUT OF THE ORDINARY WITH THAT.
AS FAR AS OVERALL DESIGN, JUDGE WE DID GIVE A PRESENTATION TO THE COMMISSIONERS COURT. MORE OF A TECHNICAL DRAWINGS RELATED TO THAT DESIGN PRESENTED THAT WERE COMPLETED.
THERE WAS ABATEMENT REPORTS COMPLETED AND INCORPORATED INTO THE OVERALL DESIGN AS WELL AS TECHNICAL ENGINEERING DRAWING.
OVERALL CONCEPT DID NOT CHANGE PER WHAT WE PRESENTED TO YOU ALL, WITH REGARDS TO THE SEQUENCE OF APPROVAL, CAN'T SPEAK TO THAT. WE COMPLETED DRAWINGS AND SUBMITTED TO THE COUNTY AND AWARD PROCESS Y'ALL CHOOSE TO USE. I DON'T SEE ANYTHING THAT APPEARED TO ME ON THE SURFACE. WE SEE IT QUITE A BIT WITH PUBLIC CLIENTS. THAT IS BECAUSE AREN'T UNDER THE MICROPHONE. IT IS AN EXCELLENT TOOL.
TYPICALLY WE USE IT WHEN WE DON'T GET COMPETITIVE BIDS ON AN RFP. YOU COULD HAVE ALWAYS USED THIS AS ANOTHER TOOL. WHY DIDN'T WE DO THAT? WE NEED TO GET DONE BY END OF JULY, LATEST AUGUST.
WE ARE IN A TIGHT TIME RIGHT NOW AS IT IS.
I THINK IF WE DO THIS ALL THE TIME.
MICHAEL DOES IT ALL THE TIME. NOBODY QUESTIONS IT WHEN WE GO TO BIBOARD. I THINK EVERYTHING IS DONE AND BROUGHT TO COURT. NOTHING DONE MORE THAN JUST TWEAK WHATEVER NEEDS TO BE DONE. YOU KNOW.
[02:05:05]
>> I HAVE A QUESTION. CAN YOU CHECK IF THE COURT AUTHORIZED METHOD OF PROCUREMENT? WE FOUND A WAY TO PUT A SIGNIFICANT AMOUNT OF DOLLARS.
NEVER BROUGHT TO COURT A METHOD OF PROCUREMENT.
THIS IS HOW WE ARE GOING TO DO IT.
DID WE DO THAT THIS TIME? >> I AM NOT AWARE OF IT.
>> I AM NOT AWARE OF IT, EITHER. THE CONVERSATION I HAVE TO GO BACK AND FIND THE TAPE. CONVERSATION WE HAD, BEFORE WE WENT DOWN THIS ROAD, WE WERE GOING TO HAVE SOLUTIONS THAT WE WOULD HAVE A ROOF THAT WAS STABLE.
I DON'T KNOW, LITERALLY WENT FROM ONE CONVERSATION WHEN PHILLIP CAME AND PRESENTED YOU ARE READY TO AWARD A CONTRACT.
WHAT IS THE DEADLINE OF JULY OR AUGUST OR SEPTEMBER.
>> END OF AUGUST. >> THEY START PROVIDING
SERVICES. >> THERE IS A WAY TO PROVIDE SERVICES WITHOUT DOING THIS PARTICULAR, THAT SHOULD NOT BE WHAT HINGES ON AUTHORIZATION FOR PROCUREMENT.
I THINK IT WAS DONE, MAY LOOK NORMAL TO YOU, PHILLIP.
DOES NOT LOOK LIKE THIS COURT MADE A DECISION.
IF THIS COURT MADE A DECISION TO GO DO THAT FOR A BIBOARD IT WOULD LOOK VERY NORMAL. TO SEE IT ON AN AGENDA.
I AM GLAD YOU CAN LOOK AT IT AND EYE BALL IT.
THE LAST TIME WE DID THIS, WHEN YOU ARE IN THE HALF A MILLION DOLLAR RANGE. WE USE OTHER TOOLS AND WE DON'T GET BIDS. I AM WONDERING WHY WE DIDN'T DO
THAT? >> THE BIBOARD COMES BACK AND
SAYS WE WENT TO THE BIBOARD. >> FOR CONSTRUCTION?
>> I AM NOT SURE. >> COMMISSIONER CHESNEY WANTS TO SAY SOMETHING. MAYBE HE IS TALKING TO SOMEBODY
>> THAT GRANT WAS WE APPROVED FAIRLY EXPENSIVE PROCESS.
MY CONCERN IS GOING, I AGREE WE SHOULD ADVANCE I THINK WE CAN STILL FIX IT TODAY. THAT IS A GOOD PRICE.
I DON'T REMEMBER. >> ARE YOU IN THE CONSTRUCTION BUSINESS NOW? HOW DO YOU KNOW IT IS A GOOD PRICE? I'LL BE HONEST.
I DON'T KNOW IF IT IS A GOOD PRICE.
I DON'T KNOW ANYTHING ABOUT THAT, NOR WOULD YOU, I DON'T THINK. HOW WOULD WE KNOW THAT?
>> I JUST HEARD FROM MR. RAMEIRZ WHO IS AN EXPERT.
>> ARE YOU GOING TO CERTIFY -- THAT WOULD HAVE COME AT A LOWER PRICE? I DOUBT THAT.
>> WE JUST DID THE RAMP THE SAME WAY.
WE DID THAT ON BIBOARD. >> I DON'T THINK WE DID THAT BY
BIBOARD, SIR. >> YOU JUST MENTIONED THE RAMP.
>> YOU MISUNDERSTOOD ME OR -- >> IT IS GOING OUT FOR COMPETITIVE BIDS ON THE RAMP. DID Y'ALL HAVE A QUESTION.
>> YOU JUST SAID THE RAMP WAS -- >> IT WASN'T BIBOARD.
[02:10:02]
>> BY DOING -- >> LET ME ADDRESS TWO THINGS, ONE, COURT CAN UTILIZE BIBOARDS TO MEET COMPETITIVE BITTING REQUIREMENTS. YOU CAN CELEBRITY A VENDOR USING THAT METHOD. PASSES PURCHASING ACT.
WHAT IT DOES NOT DO NECESSARILY IS GIVE COMPANIES IN THE AREA THAT MIGHT BE INTERESTED AN OPPORTUNITY TO BID ON IT.
THAT IS A DECISION FOR THE COURT TO MAKE.
THAT IS WHY YOU'LL SEE ME COME. SOMETIMES I'LL BRING AN ITEM LISTED AS A BIBOARD PURCHASE. CROSSES 50,000 THRESHOLD.
USUALLY ITEM, 75, 120 SOMETHING. I HAVEN'T SEEN MANY THIS SIZE.
WHEN PUBLIC WORKS BRINGS THIS ITEM TO ME AND I VERIFY BIBOARD IS A VALID METHOD, I AM OBLIGATED TO BRING IT TO THE COURT'S ATTENTION IN THIS WAY. DISPLAY FOR THE COURT TO CONSIDER. I HAVEN'T BEEN GIVEN DIRECTION BY THE COURT WHAT DOLLAR THRESHOLD Y'ALL WOULD LIKE ME TO UTILIZE BIBOARD. BIBOARD DOES NOT HAVE A DOLLAR THRESHOLD. COURT NEEDS TO LET ME KNOW THAT IS WHAT THEY WOULD LIKE ME TO DO.
GENERALLY IF WE HAVE LARGE DOLLAR PROJECTS Y'ALL ALWAYS WANT ME TO BID IT OUT. SOMETIMES TIME IS OF THE ESSENCE. IN THOSE CASES COURT HAS USING IT TO MAKE BIBOARDS. I DON'T BELIEVE THE COURT HAS MADE AN OPPORTUNITY THAT METHOD OF PROCUREMENT.
THAT IS WHY IT BROUGHT YOU THE WAY IT IS TODAY.
>> LOOK, COMMISSIONER MAREZ, I WANT TO MAKE SURE YOU KNOW I AM IN SUPPORT OF THIS PROJECT. WE WORK ALLOCATIONS.
I WAS NOT AWARE WE WERE AT THIS POINT.
I DON'T KNOW IF YOU HAVE GOTTEN ALL THE INFORMATION YOU NEED.
HAPPY TO WEIGH IN. NOW I AM HEARING WHY THIS
HAPPENED. >> THIS DEFINITELY IS IMPORTANT.
I KNOW WE HAVE ALL SPEND TIME TALKING ABOUT THIS BUILDING AND WE HAVE ALL COME INTO AGREEMENT IT IS A COUNTY FACILITY.
HAPPENS TO REST IN PRECINCT THREE.
I HAVE NOT HAD UPDATES ON THIS PROBABLY SINCE THE COURT DID LAST WHICH WOULD HAVE BEEN TWO MONTHS AGO.
I THINK I SAW HIM HERE BACK IN MAY.
100% CONSTRUCTION DOCUMENTS. THAT IS THE LAST I HEARD.
AS FAR AS PRESENTATION. I REMEMBER WHAT WAS GIVEN BY PHILIP. I HAVEN'T HAD UPDATES.
I DO APPRECIATE COMMISSIONER GONZALEZ REALLY ENTHUSIASTIC ABOUT THIS. HE SEES THE BIG PICTURE.
AS FAR AS THE UPDATES, I HAVE NOT GOTTEN THEM UNLESS PHILLIP SEND ME SOMETHING. DEFINITELY WOULD WANT TO MAKE SURE WE FOLLOW THIS PROCESS THE RIGHT WAY, MICHAEL.
IF YOU ARE TELLING US, IF WE MISS SOMETHING.
>> MY RESPONSE TO THAT WOULD BE BIBOARD METHOD PROPOSED TO YOU IS A VALID PROCUREMENT METHOD. NOTHING INVALID ABOUT THAT ASPECT OF IT OTHER THAN WHETHER IT IS THE COURT'S DECISION EACH TIME. I MAKE A SUGGESTION FOR PROCUREMENT METHOD. Y'ALL LET ME KNOW IF IT IS OKAY METHOD OR NOT. A CERTAIN TIMES YOU HAVE TIMED
-- >> WE CAN BRING IT BACK ON THE 6TH. CAN YOU BRING IT TO THE COURT ON
THE 6TH? >> IF YOU ARE CHOOSING BIBOARD YOU CAN APPROVE THAT TODAY? IF YOU WANT ME TO BID, I WOULD NEED TO COME BACK ON THE 6TH AND ASK PERMISSION TO BID IT OUT.
>> I WOULD RATHER CHOOSE THE BIBOARD.
>> ON THE BIBOARD, WE CAN GO AT ANY TIME.
[02:15:01]
WE COULD BE MORE IF WE PUT OUT A BID THEN, TOO.>> RIGHT, SO, DIFFERENT COMPANIES BID FOR THE OPPORTUNITY TO WIN THE BIBOARD CONTRACT.
THEY HAVE WILL HAVE BEEN BIT TO WIN THE CONTRACT.
NOT FOR THE SPECIFIC PROJECT. SPECIFIC PROJECT BEING BROUGHT NOW FOR CONSIDERATION. YES, THEY HAVE MED PURCHASING ACT REQUIREMENTS FOR BEING AWARDED A CONTRACT ON THE BIBOARD. FOR THE COURT DEPENDS ON YOUR POSITION BASED ON TIMING YOU WOULD UTILIZE PROCUREMENT VEHICLE TO GET SOMETHING QUICKLY DONE.
IF YOU HAVE PLENTY OF TIME, OBVIOUSLY WE WOULD LIKE TO BIDS OUT. MY POSITION FROM PURCHASING I WOULD LIKE TO BID OUT AND GIVE ALL THE LOCAL CONTRACTORS OPPORTUNITY TO WIN THAT JOB. SOMETIMES TIME DOESN'T ALLOW.
WE PROVIDE THESE OPTIONS AS A WAY TO MEET THE PURCHASING ACT AND GIVE THE COURT TO RESPOND TO CHANGING NEEDS.
>> HAVE YOU SENT US THESE FINAL DESIGNS.
IS THIS SOMETHING IN OUR PACKET WE HAD AT SOME POINT AND MAYBE DON'T RECALL? IS THAT SOMETHING YOU CAN GET TO US? I UNDERSTAND THE TIME FRAME AND I AGREE MOVING ALONG IS IMPORTANT.
MATCHES THE BUDGET CALENDAR. I GET THAT AND SUPPORT THAT.
DO WE HAVE FINAL PLANS IN PLACE? DID YOU GET THOSE TO US?
>> YES, SIR. SEND TO PUBLIC WORKS.
THAT IS THE DOCUMENTS THIS BIBOARD SUBMITTED ON, SUBJECT TO
THOSE CONSTRUCTION DOCUMENTS. >> RIGHT.
AND PHILLIP, DISCONNECT, WHEN WE GET OUR PACKETS NOTHING IN THE PACKET TELLS US BASIC, HOW MANY ROOMS. YOU HAVE COME TWICE, ONE WAS INCREDIBLY BRIEF.
SECOND TIME WAS A LITTLE MORE THOROUGH.
MY RECOLLECTION IS THAT WE HADN'T GOTTEN DOLLARS YET.
WE HAD FOUND A WAY TO CREATE FUNDING ABILITY.
THAT HASN'T EVEN, I DON'T THINK THAT HAS BEEN BROUGHT TO COURT, EITHER. WHEN I LOOK AT MY PACKET, I KNOW YOU HAVE DONE YOUR JOB. IN THE SENSE YOU GOT THOSE DRAWINGS TO PW. NOBODY BROUGHT THEM UP STAIRS.
THERE HAS NOT BEEN A LAYPERSON'S PRESENTATION OF HERE IS WHAT YOU ARE GOING TO GET FOR YOUR 586,000.
THIS COURT HAS BEEN TENACIOUS WITH ALL CAPS ABOUT BEING BEING COMPETITIVE. GOT PUT ON SUPER LAST MINUTE AS A RESULT I AM UNHAPPY ABOUT IT. IT DOESN'T REPRESENT THE BEST OF US. BY THE WAY WE ARE THE FIRST ONES TO BE THRILLED IF A BIBOARD CAN DO BETTER FOR US.
IT IS VERY EFFICIENT. IT IS NOT, WHAT ARE WE MISSING WHEN, I FEEL LIKE THIS IS TRYING TO BE SHUT DOWN.
[INAUDIBLE]. >> THAT IS CORRECT, COMMISSIONER
[02:20:01]
OUR OFFICE RECOMMEND IF BIBOARD IS A METHOD COURT IS INTERESTED IT WOULD BE BROUGHT BACK TO REVIEW IT MORE CAREFULLY.>> WAIT UNTIL THE 6TH. >> IF THAT IS THE DIRECTION.
>> I AM OKAY IF YOU WANT TO BRING IT BACK TO THE NEXT TIME TO MAKE SURE WE DO IT RIGHT WHATEVER THE CONSENSUS.
>> MOTION TO BRING BACK ON THE 6TH.
>> YES, I CAN CERTAINLY DO THAT. >> MOTION IS TABLED TO THE 6TH.
ARE YOU WILLING TO SECOND IT? >> TABLE IT TO?
>> JULY 6TH. >> COUNTY ATTORNEY I'LL HAVE HIM
REPEAT IT. >> OFFICE WOULD LIKE MORE TIME TO REVIEW THE QUOTATION ATTACHED AND OTHER DOCUMENTS WE WOULD LIKE TO REVIEW NOT ATTACHED. WE WOULD BRING IT BACK ON THE
6TH TO APPROVE OR NOT APPROVE. >> IF THAT IS THE DIRECTION THE
COURT IS INTERESTED IN. >> IS THAT THE DIRECTION OF THE
COURT, JUDGE? >> LOOK THERE IS NOT EVEN A CONTRACT ATTACHED. WHAT ARE YOU SIGNING ON TO? THIS MORNING WE ARE WORRIED ABOUT MCDONALDS.
THIS AFTERNOON WE ARE ABOUT TO PUT 600 GRAND IN SOMEBODY'S
POCKET WITHOUT ASKING. >> WHAT IS IT WE ARE GOING TO DO
I AM GOING TO LET FRANCISCO SAY IT THEN JOHN WANTS TO CHIME IN.
>> AT THIS TIME OFFICE NEEDS ADDITIONAL DOCUMENTS TO REVIEW THAT HAVE NOT BEEN ATTACHED TO THIS AGENDA.
OUR OFFICE WOULD LIKE OPPORTUNITY TO OBTAIN OTHER DOCUMENTATION RELATED TO THIS ITEM TO REVIEW THAT CAREFULLY THAT WAY ON JULY 6TH THEY CAN DECIDE WHAT IT IS THEY WOULD
LIKE TO DO. >> I'LL SECOND THE TABLE.
>> COMMISSIONER, I AM GOING TO CALL FOR DISCUSSION, COMMISSIONER MAREZ HAD SOMETHING.
>> MY STATEMENT WOULD BE TABLE ALLOW LEGAL TO REVIEW AND NOT CHANGE ANYTHING OTHER THAN PUSHING IT BACK TO OUR NEXT MEETING. I AM IN FAVOR OF THAT.
>> OKAY. >> ALL IN FAVOR ZIG ZIG --

THANK YOU, KARA. ADD THAT TO ME LIST.
ADD TO OUR COMMITTEE AMANDA AT THE COURTHOUSE WHO HAS DONE THE FOOTWORK HERE. REASON WE STEPPED OUT THE OVERSIGHT COMMITTEE. WE NEED TO GET THIS DONE BY SEPTEMBER. WE NEED PUBLIC DEFENDER'S OFFICE RUNNING BY JANUARY. SHE HAS YEARS OF EXPERIENCE AND WE WOULD LIKE TO ADD HER TO THE COMMITTEE.
IT MAKES IT 12. LISTENING TO YOU ALL WHAT WE WOULD LIKE TO DO IS OPEN IT UP TO WHETHER YOU WOULD LIKE TO ADD ANOTHER SEAT TO ADDRESS THE CONCERNS YOU HAD EARLIER.
I WOULD LIKE TO ADD AMANDA TO THE OVERSIGHT COMMITTEE.
TO MAKE SURE WE MEET THE DEADLINES.
AND LEAVE ONE OTHER SEAT -- >> DOES SHE HAVE TO BE ON THE BOARD CAN SHE JUST NOT HOPE OUT? I THINK GETTING OVER 11.
I THINK THAT IS A LARGE UNRULY NUMBER.
DOES SHE HAVE TO BE ON THE BOARD TO HELP? WHATEVER WE NEEDED IN ADDRESSING SORT OF THE THINGS LIKE UM, PURCHASING, THINGS IN THE COURTHOUSE SHE COULD GET DONE LITTLE BETTER THAN US WHO ARE NOT IN THE COURTHOUSE.
WE DIDN'T WANT TO CHANGE THAT ODD NUMBER.
SHE REALLY, ONLY THING I CAN SAY I KNOW JUDGE AND I WORKED HARD.
SHE WORKED THE HARDEST. SHE KNOWS IT IN AND OUT.
THAT IS WHY WE WANTED HER. SHE HAS VALUABLE EXPERIENCE SEE
IT IN THE COURTROOM EVERYDAY. >> I THINK WE RECOGNIZE WHAT YOU ARE SAYING. I AGREE WITH WHAT COMMISSIONER CHESNEY IS MOTIONING TO. WE HAD THE DISCUSSION WHICH WILL PROLONG AND DEMONSTRATED WE ARE SPLIT ON HOW TO APPROACH THIS.
BEFORE WE CAN GET BACK TO OUR FIVE HERE, WE ARE GOING TO STILL BE STUCK. I AGREE.
DO WE NEED HER TO BE AN OFFICIAL VOTING MEMBER OF THIS BODY TO STILL CARRY OUT THE WORK. CAN'T SHE BE THERE IN ATTENDANCE AND CONTRIBUTE AND DO THE INNER WORKINGS OF THIS COURTHOUSE AS SHE KNOWS WITHOUT BEING AN ACTUAL MEMBER.
>> LIKE A BOARD LIAISON OR EX OFFICIO.
>> I THINK, I UNDERSTAND WHAT YOU ARE ALL SAYING.
I HATED TO COME BACK BUT THE REASON I DID IT IS BECAUSE I FEEL LIKE AS A STAKEHOLDER SOMEBODY THAT HELPED BRING IT HERE, WE WANTED HER ON JUST TO MAKE SURE.
IF SHE WAS AN ACTUAL MEMBER WE TALKED ABOUT THE 13 NUMBER.
WE DIDN'T KNOW IF WE ADDRESSED THE OTHER CONCERNS LEAVING OTHER SEAT OPEN OR HOWEVER YOU FELT WAS APPROPRIATE AND BE ABLE TO TALK TO PEOPLE SOME OF US DON'T KNOW.
AND GET SOME OF THE RESOURCES. >> YOU ALL CHOSE 13.
THAT WAS A NUMBER OTHER BODIES. HOW DID 13 COME UP?
[02:30:05]
