THANK YOU. >> . >> WE'RE HERE IN THE COUNTY COURTHOUSE IN THE COURTROOM. IT'S MAY 11TH, 2022. AS THE PRESIDING OFFICER, I HAVE CERTIFIED THAT ALL COMMISSIONERS ARE PRESENT AND THEREFORE QUORUM HAS BEEN ESTABLISHED. AT THIS TIME, I'LL LOOK FOR ANNOUNCEMENT ON DISCLOSURE OF CONFLICTS OF INTEREST. THESE ARE ANY CONFLICTS OF INTEREST OR APPEARANCE OF CONFLICT OF INTEREST FOR ITEMS ON THIS AGENDA SHALL BE DECLARED AT THIS TIME. ARE THERE ANY MEMBERS OF THE COURT THAT NEED TO DECLARE? OKAY. SEEING THAT I HAVE NO DISCLOSURE -- I HAVE NO CONFLICTS OF INTEREST AT THIS TIME, YOU ARE ALWAYS WELCOME IF YOU DISCOVER LATER IN THE MEETING THAT THERE IS A CONFLICT OF INTEREST THAT YOU CAN DISCLOSE THEM AT THAT TIME. [E. SAFETY BRIEFING] THE SAFETY BRIEFING -- REBECCA. >> WAIT TO HEAR THAT TABLE. [1. Discuss and consider Game Room Regulations and Application, and other related matters.] I WILL CONSIDER THAT AT THIS TIME. THE ITEM IS COMMISSIONER GONZALES. >> IT'S A GAME ROOM EYE >>WELL, THAT'S 3A1. AND IF YOU WOULD STATE YOUR REASON SO THAT THEY WOULD UNDERSTAND. >>. >> AM NOT READY FOR IT. I THINK THERE'S A COUPLE OF ITEMS THAT I KNOW ARE PROBABLY NOT IN THERE. SO I'LL JUST MAKE A MOTION TO TABLE IT UNTIL THE NEXT MEETING. >> UNTIL NEXT MEETING? >> SECOND. >> SO THE MOTION AND THE SECOND AND THE CALL FOR DISCUSSION. SO IN CASE FOR THOSE OF YOU THAT ARE ONLINE, THE RATIONALE WAS THAT WE RECEIVED THESE DOCUMENTS AT 3:00 P.M., COMMISSIONER GONZALES HAS NOT HAD THE TIME TO LOOK THEM OVER. I DO WANT TO JUST ASK THE COUNTY ATTORNEY IF THEY ACCURATELY -- IF SHE BELIEVES THEY ACCURATELY REPRESENT ALL THAT WE DISCUSSED AND ALL THE DIRECTIVES THAT WERE PUT TOGETHER, IF THERE ARE ANY NEW ONES MAYBE THAT WOULD BE GOOD TO BRING TO ANYBODY'S ATTENTION AT THIS TIME. >> THERE ARE NO NEW ONES IN THERE AND WITH EACH WE PROVIDED A CHANGE LOG SO THAT THE CHANGES THAT WERE VOTED ON ARE HIGHLIGHTED FOR YOU TO SEE IN THE DOCUMENT. IT DOES LOOK DIFFERENT FORMATTING WISE SO I KNOW THAT CAN BE A CHALLENGE BUT THERE ARE SOME COMMENTS THAT I HAVE RECEIVED FROM THE PEOPLE HERE FOR PUBLIC COMMENT THAT MIGHT NEED TO GO INTO IT BUT THOSE ARE NOT INTO IT AT THIS POINT. >> OKAY. ALL RIGHT. THERE'S A MOTION AND A SECOND AND ALL THOSE IN FAVOR OF DELAYING FOR THE LAST -- THE NEXT TWO WEEKS SIGNIFY BY SAYING [00:10:04] AYE. >> AYE. [F. PUBLIC COMMENT: This section provides the public the opportunity to address the Commissioners Court on any issues within its jurisdiction. The Commissioners Court may not take formal action on any requests made during the Public Comment period which are not on the Agenda, but can refer such requests to County staff for review if appropriate.] >> I'M READY. ITEM -- THE NEXT ITEM THAT WE NEED TO RECOGNIZE IS THE PUBLIC COMMENT AND I HAVE IT IN FRONT OF ME. I NEED TO TELL YOU GUYS FOR HOUSE KEEPING THAT WILL IS A VERY IMPORTANT CEREMONY HAPPENING ON THE LAPON SIDE OF THE -- SORRY. THE LEOPARD SIDE OF OUR COURTHOUSE AT OUR FALLEN HEROS MEMORIAL IN HONOR OF OUR LAW ENFORCEMENT MEMORIAL WEEK AND SO OUR INTENTION IS TO ATTEND THAT CEREMONY AND TO TAKE A RECESS AT 9:00 A.M. WE WILL RETURN HERE AT 10:00 A.M. FOR THE CLERK. AND I MAY IF WE CAN TRY TO BREAK FIVE MINUTES BEFORE 9:00 SO THAT THERE IS AMPLE TIME FOR THOSE OF US THAT NEED A LITTLE EXTRA TIME TO MAKE IT FROM THE THIRD FLOOR OUT TO THE LEOPARD SIDE AND FIND A SEAT TO DO SO. I'LL START THIS MORNING WITH J.J. DE LA SARDA. >> COMMISSIONER, DO YOU HAVE PUBLIC SDMENT. >> I'LL WAIT. >> I'LL TELL YOU WHAT, BEFORE WE GO TO 9:00, I'LL BRING IT BACK. >> THAT'S FINE. JUST LET ME KNOW. >> J.J., THE COURT RECOGNIZES YOU AND YOU ARE OUR VETERAN SERVICE OFFICER. WELCOME. >> GOOD MORNING, JUDGE AND COMMISSIONERS. THANK YOU FOR THE OPPORTUNITY TO SPEAK. I'M HERE WITH MR. PAT SIMON AND WE'D LIKE TO PRESENT TO YOU A PROGRAM WHICH ORIGINATED FROM THE VETERANS ROUND TABLE RADIO SHOW TWO WEEKS AGO. CORRECT. AND SO THIS IS -- THE PROGRAM IS CALLED THE FLAG FOR FLAG PROGRAM. ESSENTIALLY WHAT WE WOULD LIKE TO DO IS GO OUT INTO THE COMMUNITY AND FOR THOSE THAT HAVE A FRAYED OR TATTERED FLAG, WE'D LIKE TO REPLACE THAT FLAG FOR FREE. AND THIS IS -- IT WILL BE FROM JUNE -- WE ACTUALLY JUST CHANGED THAT. IT'S JUNE 10TH THROUGH THE 13TH AND WE'LL HAVE THOSE DAYS -- WE'LL HAVE 12 DIFFERENT LOCATIONS THROUGHOUT THE COASTAL BEND NOT JUST NUECES COUNTY. SOME OF THOSE INCLUDE JIM WELLS COUNTY VSO, SAN PAT VSO. SO WE'LL PUT A LIST TOGETHER AS FAR AS THE LOCATIONS TO DROP OFF AND PICK UP A FLAG. AND SO WE'D LIKE TO DO THAT IN PREPARATION FOR FLAG DAY THIS YEAR. I'LL KICK THIS OVER TO PAT FOR MORE COMMENTS BUT JUST WANTED TO INTRODUCE. >> THANK YOU. THANK YOU THANK YOU THE . >> THANK YOU, J.J. GOOD MORNING, EVERYONE. I AM PAT SIMON AND I AM A PROUD VETERAN OF THE UNITED STATES ARMY AT THIS TIME SERVED 30 YEARS. -- I SERVED 30 YEARS IN COMBAT OVER IN IRAQ IN 2009. WRAPPED THINGS UP IN 2018. SO I STAND BEFORE YOU AND I APPRECIATE THIS TIME. OUR FLAG FOR A FLAG PROGRAM IS KIND OF A FUN HOW IT ALL CAME TOGETHER. WHEN WE WERE ON THE RADIO SHOW AND, JUDGE, YOU WERE THERE, JJ. WAS THERE, OUR KOREAN WAR VETERAN AND HOST OF THE SHOW, MR. LEWIS AND WE STARTED TALKING ABOUT THE FLAG RETIREMENT AREA AT THE COASTAL BEND STATE VETERANS CEMETERY AND J.J. MENTIONED HOW PROUD HE WAS THAT THAT'S BEEN RESTORED OUT THERE AND SO I ASKED HIM, I SAID, HEY, J.J., DO WE HAVE A FLAG EXCHANGE PROGRAM HERE TO WHERE YOU CAN DROP OFF YOUR OLD TATTERED AMERICAN FLAG AND GET A BRAND NEW FLAG IN ITS PLACE? AND HE SAYS NO. AND I SAID WELL LET'S TALK ABOUT THIS SO WE TALKED IT THROUGH AS YOU RECALL AND SO I SAID WHY DON'T WE CALL IT FLAG FOR A FLAG AND EVERYBODY IS LIKE LET'S DO THIS SO WE KEPT TALKING ABOUT IT AND TO J.J.'S POINT EARLIER, THAT BECAME A MOVEMENT. WE THOUGHT THIS WOULD BE A GREAT OPPORTUNITY FOR US TO STEP FORWARD, PUBLIC, PRIVATE PARTNERSHIP 6 NEWS ALONG WITH SPONSORS, BELL FURNITURE AND MIKE SHAW TOYOTA, A VETERAN HIMSELF FROM VIETNAM. WE THOUGHT LET'S GET TOGETHER AND COME UP WITH SOMETHING POSITIVE FOR OUR COMMUNITY. RIGHT. TO CONTINUE TO HAVE THIS LEGACY OF WAVING THAT AMERICAN FLAG, THAT LEGACY BEING PRESERVED IN THIS SPECIAL WAY WHERE WE EXCHANGE A BRAND NEW FLAG FOR AN OLD TATTERED FLAG. SO WE ARE ON BOARD WITH THIS PROGRAM. OUR SPONSORS WILL PROVIDE FLAGS AND WE'RE HOPING THAT NUECES COUNTY WILL JOIN IN WITH OUR PARENT COMPANY SCRIBS AND PROVIDE MORE FLAGS. [00:15:03] WE'RE TRYING TO GO FOR 1,000 FLAGS. WE DON'T KNOW WHAT THE 23450ED IS HERE. BUT WE'RE GOING TO TRY TO GO FOR 1,000 FLAGS THIS FIRST GO ROUND. HAVE ALL THOSE FLAGS AND PEOPLE CAN SHOW UP BETWEEN THE 10TH OF JUNE AND 13G9 BECAUSE FLAG DAY IS JUNE 14TH AND BEFORE NOW, MOST PEOPLE THOUGHT FLAG DAY WAS JUST ANOTHER DAY. WE'RE GOING TO PUT FLAG DAY BACK ON THE MAP. OKAY. AND SO THAT'S WHAT WE'RE TRYING TO DO HERE. WE'RE GOING TO MAKE IT HAPPEN AND ATTEND ON JUNE 14TH, A GREAT BIG RETIREMENT CEREMONY OVER AT THE STATE VETERAN'S CEMETERY AND FROM THERE WE'RE GOING TO LOOK TO THE NEXT BIG OPPORTUNITY AND THAT WOULD BE THE 4TH OF JULY TO DO THIS AGAIN AND DO IT AGAIN DOWN ROAD. THANK YOU FOR YOUR TIME THIS MORNING. THIS IS A GREAT EVENT. WE'RE SO PROUD TO BE PART OF IT. THANK YOU. >> THANK YOU SO MUCH. I'LL MOVE STRAIGHT TO LOU PARETTA. GOOD MORNING, MR. PARETTA. >> GOOD MORNING. GOOD MORNING. THANK YOU FOR THE OPPORTUNITY TO ADDRESS THE COURT. >> I'M JUST GOING TO ASK YOU TO GET A LITTLE CLOSER TO THAT MIC SO THAT WE CAN RECORD BETTER. >> IS THAT SPHERE. >> YES, SIR, IT IS. >> OKAY. MY NAME IS LUKE PARETTA. I'M THE PRESIDENT OF -- WE'VE FEN BUSINESS SINCE 1984 AND IS OFFICED IN CAL ISLAND SINCE 19 # A5. WE EMPLOY 50 OFFICE PERSONNEL AND 250 FIELD ELECTRICIANS. THE BID WAS SUBMITTED AT 2:08 P.M. THE PORTAL IS SET UP TO NOT ACCEPT LATE BIDS. SINCE OUR BID WAS PRIOR TO 2:25 IT WAS ACCEPTED AND LOGGED IN. DURING THE READING OF THE BIDS, HOWEVER, IT WAS DETERMINED THAT OUR SUBMISSION WAS LATE AND INVALID. THE TWO LISTED BIDDERS SUBMITTED BASE BIDS OF 3.2 MILLION AND 2.69 MILLION RESPECTIVELY -- OUR BID WAS -- >> I THINK I'M GOING TO HAVE TO STOP. COUNTY ATTORNEY, DO YOU THINK YOU COULD HELP OUT AT THIS MOMENT? EXCUSE ME, MR. PARETTA, I SO MUCH WANT TO HEAR YOU BUT THERE ARE OTHER RULES AT ISSUE THAT I NEED TO ADVISE YOU OF. LET ME DO THIS SC. THIS IS VERY IMPORTANT. I'M VERY SORRY FOR THE INTERRUPTION. >> GIVING OUT NUMBERS AT THIS POINT IS A VIOLATION OF THE PROCESS. I HAVE SPOKEN WITH MICHAEL ROBINSON ABOUT THIS. HE COULD NOT BE HERE TODAY BUT IT WOULD NOT BE APPROPRIATE TO HAVE THAT NUMBER PUT OUT OR ANY INFORMATION ABOUT THE BID AT THIS POINT. >> WHICH NUMBER PUT OUT? >> I'LL TELL YOU WHAT I'M GOING TO DO IS PLEASE CONTINUE -- DO YOU THINK YOU COULD HELP ME? MR. PARETTA, WOULD IT BE ALL RIGHT, SIR, IF I ASK YOU TO YIELD AT THIS POINT AND I PROMISE I'LL GIVE YOU A CLEAN SLATE? >> I'M GOOD WITH THAT, MA'AM. >> AND I DON'T NEED TO ADDRESS THE COURT AT THIS TIME. >> THANK YOU. THANK YOU SO MUCH. >> THANK YOU. >> RONNIE BAKER. >> GOOD MORNING, JUDGE. COMMISSIONERS. I KNOW THAT WE'VE TABLED THE ITEM THAT I'M HERE TO SPEAK ON BUT I WANT TO THANK ALL OF YOU FOR THE EFFORTS THAT YOU'VE MADE [00:20:02] OVER THE LAST SEVERAL YEARS TO HEAR THE CONCERNS OF THE CHARITIES AND NONPROFITS. THIS WILL ACTUALLY GIVE US AN OPPORTUNITY TO SEND A COUPLE OF ADDITIONAL ITEMS FROM THE TEXAS LOTTERY COMMISSION THAT SPELL OUT A COUPLE OF THINGS REGARDING AMUSEMENT REDEMPTION MACHINES. WE WILL BE FORWARDING THAT TO YOU THIS WEEK. IT'S BEEN AN EXCEPTIONALLY LONG JOURNEY. WE HAVE A -- WE STILL HAVE A WAYS TO GO. BUT THE CHARITIES, THE NONPROFITS, ALL THE PEOPLE INVOLVED THAT WORK SO TIRELESSLY TO MAKE THIS COMMUNITY BETTER SINCERELY APPRECIATE YOUR EFFORT. WE LOOK FORWARD TO GETTING OUR COMMENTS FOR DUE CONSIDERATION. COMMISSIONER GONZALES, WE APPRECIATE YOU RAISING YOUR CONCERN. THIS WILL GIVE US AN ADDITIONAL TIME BECAUSE THERE WERE A COUPLE OF THINGS THAT DID COME IN AND WE WILL SUBMIT THOSE FOR DUE CONSIDERATION. THANK YOU GUYS. >> OKAY. SUZANNE TAYLOR. >> QUICKLY, I WANT TO EXPRESS MY THANKS. I WILL BE THREE YEARS THIS OCTOBER SINCE THE FIRST TIME I CAME AND TALKED TO YOU ABOUT REGULATIONS FOR GAME ROOMS. BEEN A LONG TIME. IT'S BEEN A LONG DIRECTION. AND I THINK YOU GUYS HAVE DONE A GOOD JOB AND LADY. I HATE WHEN PEOPLE SAY GUYS AND I'M IN THE GROUP. >> IT'S OKAY. >> APPRECIATE ALL OF YOU AND THANK YOU AGAIN FOR TAKING THE TIME TO REALLY LOOK AT THIS PARTICULAR ITEM AND GIVE IT YOUR ALL IN MAKING SURE THAT EVERYTHING IS CONTINUES TO BE LEGAL IN NUECES COUNTY. >> THANK YOU, MS. TAYLOR. >> I'M GOING TO TRY TO GET THROUGH THE NEXT TWO AND THEN WE'LL TAKE OUR BREAK. >> OKAY. MARGARET BALDWIN. THANK YOU, MARGARET. >> GOOD MORNING. >> MORNING. >> AGAIN, WE WANT TO SAY THANK YOU SO MUCH. THANK YOU FOR TABLING THE ITEM, COMMISSIONER GONZALES. AND I WANT TO REITERATE WHAT RONNIE SAID. WE WILL GET THAT TO YOU AS QUICKLY AS POSSIBLE THIS WEEK. WITH THE LANGUAGE FOR THE LOTTERY COMMISSION SO THAT CAN BE CONSIDERED ALSO. AGAIN, THANK YOU SO MUCH FOR ALL YOUR TIME AND THE TIME PERIOD. >> THANK YOU. AT THIS TIME I WOULD LIKE TO MAKE A MOTION THAT WE DO RECESS FROM -- >> CAN I DO MINE? >> YES. GO AHEAD. >> SORRY. >> JUDGE, I WOULD LIKE TO -- REGULAR AGENDA 3A10 DISCUSS AND CONSIDER THE APPOINTMENT OF EMPLOYMENT EVALUATION OF HUMAN ROW SOURCES DIRECTOR. MOTION TO TABLE. >> MOTION TO TABLE. IS THERE A SECOND? >> SECOND. >> THERE IS A SECOND. >> 3A10 MOTION AND A SECOND. ALL IN FAVOR. >> AYE. >> NO. >> NO. >> OKAY. TWO NOS AND THREE AYES. AND ARE THERE ANY OTHERS FROM ANY OF THE FLOOR TO TABLE? >> YES. BE RIGHT WITH YOU. >> I'M SORRY. THE NEXT ONE. >> IT'S GOING TO BE 3A15. >> YES, MA'AM. THE COUNTY CLERK ASKED FOR THAT AS WELL. THAT IS THE CANVASS ELECTION RETURNS. >> TABLE FOR TABLE? >> JUST SO YOU KNOW ON THIS ONE, I THINK SHE'S GOING TO GET US A DATE THIS MORNING. I THINK SHE MIGHT POST FOR MONDAY IS WHAT I UNDERSTAND. >> OKAY. >> I'LL DOUBLE CHECK. >> I'LL GO WITH HER. >> MOTION AND A SECOND. >> ALL IN FAVOR SAY AYE. >> AYE. >> AND I SAW DEPUTY, THE SECOND WAS -- >> MOTION AND A SECOND WAS DID YOU SECOND OR DID I? >> CANVASS OF THE ELECTION. THAT MEETING IS FORTHCOMING SO PLEASE LOOK FOR THAT TO BE DONE SWIFTLY. AND THEN DEPUTY VASQUEZ. >> COMMENT. >> YES, MA'AM. IF YOU CAN -- I DON'T HAVE YOUR NAME IF YOU WOULD ANNOUNCE YOUR NAME. I WOULD SIGN UP HERE FOR YOU. THEN I'LL LET YOU FINISH THE FILLING OUT QUICKLY AND THEN AGAIN IT IS MY INTENTION TO ASK FOR A VERY QUICK MOTION TO RECESS FROM 9:00 A.M. TO 10:00 A.M. SO THAT WE MAY RUN DOWN STAIRS TO BE PART OF THE REGIONAL FALLEN HEROS MEMORIAL CEREMONY. YES, MA'AM. >> I'LL BE AS QUICK AS POSSIBLE. I'M SORRY I DIDN'T WRITE MY NAME [00:25:04] ON THE LIST. I'M ANGELA SCARUPA. I'M HERE TODAY BECAUSE I WANTED TO MAKE YOU ARE AWARE IF YOU DON'T ALREADY KNOW THE BURGLARIES THAT HAVE BEEN OCCURRING OUT IN NUECES RURAL AND THE LACK OF ASSISTANCE FROM THE NUECES COUNTY SHERIFF OFFICE. SPECIFIC INCIDENTS ARE AREAS CONCERN -- THE AREA THAT IS CONCERNING ME IS SOUTH OF 44 BETWEEN MCKENZIE ROAD AND CALICOT ROAD BUT I'M SURE IT'S AN ISSUE THROUGHOUT RURAL NUECES. MY HUSBAND AND I OWN PROPERTY IN THE AREA AND ONE OF WHICH WE'VE BEEN USING AS A BUSINESS. I BROUGHT MY NOTES. IF YOU'LL BEAR WITH ME. THIS SPECIFIC PROPERTY HAS BEEN BURGLARED FOUR TIMES IN THE LAST SEVEN MONTHS, APPROXIMATELY $15,000 WORTH OF EQUIPMENT AND ITEMS HAVE BEEN STOLEN. AND THE FIRST THREE PRAYERERIES THREE DOORS WERE PRIED OPEN. THE FOURTH BURGLARY THEY ACTUALLY JUST THREW A BRICK THROUGH THE WINDOW. THROUGH THE FRONT WINDOW. EACH TIME I CALLED THE SHERIFF'S OFFICE TO REPORT THE BURGLARIES AN EACH TIME A NUECES COUNTY OFFICER RESPONDED COMPLETELY UNPREPARED TO DO THEIR JOB. THE OFFICERS ARRIVED WITH THE POINT AND SHOOT CAMERA AND NO EQUIPMENT TO PROCESS THE SCENE. WHEN I ASKED IF THEY HAD PROCESSING KITS, THE OFFICERS WERE -- EACH ADVISED ME THEY DON'T CARRY EQUIPMENT TO PROCESS BURGLARIES THAT THE CRIMINAL INVESTIGATIONS DIVISION CARRIES THE EQUIPMENT BUT THEY DO NOT RESPOND TO BURGLARIES. SO FOR EACH BURGLARY I HAD TO PHOTOGRAPH AND PROCESS AND IDENTIFY EVIDENCE MYSELF. AND THE REASON FOR THAT -- THAT GIVES ME THE EXPERIENCE AND KNOWLEDGE IS I WORK AS A CRIME SCENE INVESTIGATOR FOR A LOCAL LAW ENFORCEMENT AGENCY. I WAS ALSO A CRIME SCENE INVESTIGATOR FOR OTHER SERGEANCIES AND ALSO A FORENSIC SCIENTIST FOR THE DEPARTMENT OF PUBLIC SAFETY. I WORKED IN THE CRIME LAB. WHEN THE FIRST BURGLARY OCCURRED I PROVIDED THE OFFICER AND THE CID OFFICERS AND THE CID OFFICERS WITH A POSSIBLE SUSPECT AND WHO HAD APPROACHED ME AND A PHOTOGRAPH ACTUALLY WHO HAD APPROACHED ME THE DAY BEFORE THE BURGLARY. HE WAS IN A VEHICLE WEARING A NUECES COUNTY ESD NUMBER THREE SHIRT AND CARRYING A RADIO. AS HE BEGAN TO ASK ME QUESTIONS ABOUT MY HOME AND NEIGHBOR'S HOMES AND WHEN I RAN HIM OFF HE ADVISED ME THAT HE HAS A RADIO AND KNOWS WHAT GOES NONCOUNTY AND HE COULD HEAR EVERYTHING AND HE WOULD BE BACK. SO THAT BRINGS US TO BURGLARY TWO, THREE, AND FOUR. AT THE SECOND BURGLARY I LOCATED EVIDENCE. A CIGARETTE BUTT AND A POCKET KNIFE. THE NEXT DAY I APPEARED AT THE SHERIFF'S OFFICE TO SPEAK WITH CID ABOUT THE STATUS OFY BECAUS PROVIDED INFORMATION. SHE SAID SHE DID NOT BELIEVE THE KNIFE BELONGED TO THE SUSPECT AND THAT SHE WAS GOING TO PROCESS THE EVIDENCE HERSELF. WHEN I INFORMED HER THAT DEPENDING ON THE PROCESS THAT SHE USED TO PROCESS THE EVIDENCE FOR PRINTS SHE COULD DAMAGE DNA AND THAT'S WHEN SHE ROLLED HER EYES AT ME AND SAID I KNOW WHAT YOU DO. I'LL DO IT MYSELF. THAT'S WHEN I TOLD HER THAT -- THAT'S WHEN I STOPPED TALKING. I KNEW THAT SHE WAS NOT GOING TO LISTEN TO ANYTHING I SAID. SHE WAS ALREADY I GUESS ANNOYED BY ME GIVING HER SUGGESTIONS BUT HAVING WORKED WITH THE DPS CRIME LAB, I KNEW THE BEST ROUTE TO GO. SO AT THAT POINT, WE JUST BOTH STOPPED TALKING. AND WE KNEW THEN AFTER WE FINISHED OUR INTERVIEW WITH HER, WE KNEW THEN THAT MY HUSBAND AND I WERE BOTH -- WE FELT I SHOULD SAY MY HUSBAND AND I FELT THAT WE WERE BOTH CONSIDERED SUSPECTS AS OPPOSED TO ACTUAL VICTIMS. AND THEN AFTER THE MEET, THE DETECTIVE, I ACTUALLY WROTE A LETTER OF GRIEVANCE TO THE SHERIFF'S OFFICE. I HAND DELIVERED IT TO HIS OFFICE. THAT WAS ATTEND OF DECEMBER AND I HAVE YET TO RECEIVE A RESPONSE. [00:30:01] AND BECAUSE OF MY PREVIOUS ENCOUNTERS WITH THEM I HAVE NOT EVEN BEGUN TO INQUIRE ANYTHING ABOUT BURGLARIES THREE OR FOUR. I'VE ALSO SPOKEN TO MANY OF MY NEIGHBORS RECENTLY. THE LAST BURGLARY, THE FOURTH, OCCURRED ABOUT TWO WEEKS AGO APPROXIMATELY. MAYBE LESS THAN THAT. MY NEIGHBORS HAVE ALSO CALLED TO TELL ME THAT THEY'VE BEEN BURGLARIZED. THEY HAVE BEEN DRIVE BYES PEOPLE ARE DRIVING BY THEIR HOMES AND TAKING PHOTOS. MOST RECENTLY, A NEIGHBOR SENT ME A DOOR RING DOOR CAM VIDEO AND IT'S ACTUALLY A VIDEO OF A YOUNG MALE WHO APPROACHED THE HOME, RANG THE DOORBELL AT ABOUT MIDNIGHT AND HE HAD A PISTOL IN HIS FRONT WASTE BAND. I SHOWED A COUPLE -- WAISTBAND. MY LAW ENFORCEMENT SAID HAD THEY OPENED THE DOOR IT WAS BASICALLY A HOME INVASION READY TO HAPPEN. AND ACTUALLY THE PEOPLE WHO LIVE THERE WAS AN ELDERLY -- THERE WERE TWO ELDERLY TWIN SISTERS SO THEY'VE SINCED PASSED BUT THAT'S WHY THE HOUSE IS VACANT. IT DOESN'T LOOK VACANT. THEY KEEP IT UP. I DON'T BY ANY MEANS EXPECT THE NUECES SHERIFF'S OFFICE TO ABOUT THE OUTSIDE OUR HOME WAIT FORKING A CRIME TO HAPPEN BUT I EXPECT THEM TO DO THEIR JOB BY BEING PREPARED WHEN CALLED UPON TO BE TREATED WITH RESPECT AND IN A PROFESSIONAL MANNER AND TO BE TAKEN SERIOUSLY WHEN IT DOES HAPPEN. I HAVE WORKED IN THE FRAPPÉSIC FIELD FOR ALMOST 20 YEARS NOW AND IF THEY WERE TRAINING THIS WAY SOMEONE WHO KNOWS SOMETHING ABOUT THIS TYPE OF CRIME INCIDENT I CAN'T EVEN IMAGINE WHAT THEY'RE DOING TO ORDINARY EVERYDAY CITIZEN OUT THERE IN THE COUNTY. THANK YOU. >> THANK YOU VERY MUCH. YOU'RE WELCOME TO LEAVE ANY OF YOUR NOTES WITH THE COURT MANAGER. AT THIS TIME, THAT CONCLUDES OUR PUB LICK -- DOES NOT CONCLUDE OUR PUBLIC COMMENT BUT FOR THOSE CITIZENS, COMMISSIONER, I ACKNOWLEDGE THAT YOU'RE ON THE LIST BUT I'M GOING TO ASK YOU TO HOLD UNTIL WE COME BACK. MAKE THE MOTION PLEASE FOR THE RECESS AND ASK FOR THE SECOND. >> 9:00 A.M. TO 10:00 A.M. ALL IN FAVOR. >> AYE. >> THE TIME IS 9:04 A.M. >> THANK YOU AGAIN FOR YOUR PATIENCE. SO WHEN WE LEFT OFF, ACTUALLY NOT QUITE CONCLUDED WITH WHAT'S CALLED PUBLIC COMMENT. SO WE'D GONE THROUGH THE SAFETY BRIEFING AND WE HAD AT LEAST EIGHT SPEAKERS. BUT THERE ARE TWO MORE LEFT BEFORE WE GET TO THE RESOLUTIONS AND PROCLAMATIONS SO I'LL CALL UPON MS. SUSIE SALDANA AND THEN ROBERT HERNANDEZ. I'M GAVELLING US IN OFFICIALLY. IT'S 10:29 A.M. WITH THE GAVEL. GOOD MORNING. >> GOOD MORNING. JUDGE, COMMISSIONERS, FIRST OF ALL, LET ME TELL YOU THANK YOU FOR TAKING UP THE ISSUES OF THE GAME ROOM. IT'S CERTAINLY APPRECIATED ESPECIALLY FROM A CONSUMER'S POINT OF VIEW. AND THANK YOU FOR TABLING IT BECAUSE IT FELT THAT IT WAS TOO SHORT A TIME AND ONE ISSUE THAT I THINK WE NEED TO CLARIFY IS EVERY TIME I COME HERE I HEAR FROM THE BINGO PEOPLE ABOUT HOW THEY'VE BEEN WORKING ON THIS ISSUE FOR THREE YEARS. WELL, THEY MAY HAVE BEEN WORKING ON THE ISSUE FOR THREE YEARS BUT WE WERE NOT AWARE OF IT. THE TIME IS ONE OF THE BIGGEST ISSUES. THE TIME PUT DOWN. YOU CANNOT RESTRICT THE BUSINESS FROM THE TIME IT MEETS AND I'M LOOKING AT PEOPLE ARE SAYING THERE'S CRIME GOING ON IN THE GAME ROOMS. THERE'S CRIMES GOING ON EVERYWHERE YOU HAVE. IF THAT WAS THE CASE YOU'D BE CLOSING EVERY BAR IN CORPUS CHRISTIE BECAUSE THEY STAY OPEN UNTIL 2:00 O'CLOCK IN THE MORNING AND YOU DON'T RESTRICT THEM. AND WHEN WE HAVE DRUNK DRIVERS AND PEOPLE GETTING RUN OVER BY DRUNK DRIVERS, THEN THE PERSONS THAT RENT THAT PLACE RESPONSIBLE FOR THAT DRUNK DRIVER? OR IS THE PERSON THAT SERVED THEM THE BEER RESPONSIBLE? YOU CANNOT HOLD SOME PEOPLE ACCOUNTABLE FOR SOME THINGS AND SKIP OTHERS. THOSE ARE THE ISSUES I WANT YOU TO LOOK AT BECAUSE IF YOU DON'T [00:35:03] RESTRICT OTHER PEOPLE AND YOU RESTRICT THE GAME ROOMS THEN YOU ARE ACTUALLY DISCRIMINATING AGAINST THEM. AGAIN, THANK YOU FOR YOUR TIME. THANK YOU FOR THIS ISSUE. WE WILL BE BACK AT THE NEXT BOARD MEETING AND PLEASE LET US KNOW APPROXIMATELY WHAT TIME YOU'RE GOING TO TAKE UP THE ISSUE SO WE CAN BE HERE ON TIME. THANK YOU. >> THANK YOU. ROBERT HERNANDEZ, COMMISSIONER. >> THANK YOU, JUDGE. IT'S JUST I GOT SOME CALLS LAST NIGHT AFTER THE NEWS AIRED ON THE ARTICLE THAT CONCERNED US THEY WERE UPSET AND DISSATISFIED WITH COMMISSIONER'S COURT. THEY JUST SAID THAT WE SHOULD KNOW BETTER AND HAVE BETTER CONTROL OF WHAT GOES ON WITH THE EMPLOYEES HERE. TALKING ABOUT DIRECTORS. THEY DON'T HAVE CONFIDENCE IN THIS COMMISSIONERS COURT AND DON'T BELIEVE ANYTHING WE SAY BECAUSE MOST LIKELY THERE'S SOMETHING IN THE BACK ROOM THAT'S NOT SUPPOSED TO BE. I KNOW WE'VE GOT A LOT OF PEOPLE HERE SO I'M GOING TO CUT IT SHORT AND THEY DID SAY -- ONE DID SAY THAT THE BIDDING PROCESS, THE WAY THEY'VE SEEN IT DONE HERE IS WRONG. WE MAKE TOO MANY MISTAKES. THEY TAKE A LOOK AT THEM AND MAKE SURE THAEFRG IS DONE CORRECTLY. I WON'T GO INTO SPECIFICS ABOUT THAT BIDDING PROGRAM OR WHAT THEY WERE MRAVENING ABOUT BUT THAT'S WHAT IT AMOUNTED TO. PEOPLE JUST DON'T TRUST US ANYMORE. THANK YOU. [1. In recognition of the Veterans Memorial Girls Basketball Team on their achievements. ] >> OKAY. AND THE COURT'S AGENDA, THERE ARE THE NEXT ITEM WE WOULD TAKE UP WOULD BE THE RESOLUTIONS PROCLAMATIONS AND ORDERS AND WE SHOULD START WITH VETERANS MEMORIAL'S GIRLS BASKETBALL TEAM AND WE'RE ALSO GOING TO INVITE THE VETERAN'S MEMORIAL BOYS BASKETBALL PROGRAM AND AND WE'RE GOING TO BRING THEM IN. THIS IS ITEM FOR THE CLERK G1 AND 2 BUT WE THOUGHT SINCE THEY REPRESENT TWO GREAT SPORTS PROGRAMS FROM ONE GREAT HIGH SCHOOL WE'D HAVE THEM ALL IN AT THE SAME TIME. AND THERE ARE A LOT OF THEM. YOU DON'T HAVE TO GUESS WHAT SPORT IS ON THE RIGHT SIDE OF THE ROOM HERE. ON MY RIGHT. >> AND THE LEFT TOO. >> THANK YOU. WE CERTAINLY WELCOME YOU AND ARE HONORED TO HAVE YOU HERE. FUR YOUR PATIENCE THIS MORNING. WE HAVE A VERY SPECIAL RESOLUTION AND I WOULD LIKE TO DIRECT YOUR ATTENTION AT THIS TIME -- WE'LL HAVE SOME CONVERSATION ABOUT IT. >> WHEREAS THE VETERANS MEMORIAL GIRLS BASKETBALL PROGRAM LED BY COACH -- FINISHED A SUCCESSFUL 2022 SEASON WITH THE DISTRICT RECORD OF 16-0 AN AN OVERALL RECORD OF 37-3. AND WE'LL CALL FOR DISCUSSION. WE'LL ASK COACH TO COME UP. A VERY SPECIAL COACH NOT ONLY IN HIS PERSON AND THE WAY HE CONDUCTS HIMSELF THROUGHOUT THE COMMUNITY AND OF COURSE ON THE COURT WHEN I READ THAT YOU HAD SURPASSED 700 CAREER WINS, I KNEW THAT I WANTED TO HAVE THIS OPPORTUNITY BUT I KNOW YOU AND YOU WOULD NOT HAVE WANTED TO SHINE THE LIGHT ON YOURSELF BUT RATHER ON YOUR GREAT TEAM. AND SO WE WELCOME YOU HERE TODAY. WE'RE GOING TO INVITE YOU TO MAKE SOME COMMENTS. MAYBE HAVE SOME OF YOUR CAPTAINS IF THEY SO CHOOSE MAKE COMMENTS AND THEN I BET THERE ARE MANY OF US THAT WANT TO WISH ALL OF THEM CONGRATULATIONS. >> THANK YOU SO MUCH. THIS IS AWESOME. THANK YOU FOR INVITING US. OUR GIRLS PLAY THEIR HEARTS OUT. YOU KNOW, WE HAVE A WANDSERFUL GROUP OF GIRLS. THE BIGGEST AWARD WE GOT WAS ACADEMIC ALL DISTRICT. ALL OUR PLAYERS RECEIVED THAT. THAT'S WHAT I'M SO PROUD OF. OF COURSE THE WINS ARE NICE BUT THEY'RE DOING THINGS AT SCHOOL AND ON THE COURT. SENIORS, GABBY -- IF IT WAS NOT FOR THEM, THEY RAN THE PROGRAM. THEY'RE VERY EDUCATED AND SMART. VERY NICE KIND THOUGHTFUL KIDS AND THEY FELL INTO THE PROGRAM, LOVED IT, AND MADE SURE THE YOUNGER KIDS DID WHAT THEY'RE SUPPOSED TO. THAT'S HOW YOU WIN. COME UP HERE, PLEASE. >> I PLAYED FOR THIS TEAM FOR MY FOUR YEARS OF HIGH SCHOOL AND GROWING PHYSICALLY MENTALLY, YOU KNOW, WITH THIS GROUP OF GIRLS WAS SOMETHING SPECIAL. AND THIS YEAR WAS ONE THAT I MEAN THERE WAS A CHEMISTRY LIKE NO OTHER TEAM I'VE EVER PLAYED WITH BEFORE. IT WAS VERY SPECIAL AND I'M GLAD THAT WE GOT AS FAR AS WE DID. I. >>. >> I'M ALYSSA. WE JUST HAD A GOOD YEAR THIS YEAR. >> HYPER-CAITLIN BROOKS. THESE FOUR YEARS WENT BY FAST BUT THIS IS DEFINITELY THE TEAM I'M GOING REMEMBER THE MOST. THE BONDS AND CHEMISTRY THAT WE HAD. IT ALL STARTED IN THE SUMMER WHEN WE PLAYED TOGETHER IN SELECT TEAMS AND WE DIDN'T THINK THEY WERE GOING TO WIN BUT WE DID IT AS A SCHOOL TEAM AND I THINK THAT'S WHAT TOOK US AS FAR AS IT DID THIS YEAR. >> AMAZING COACH. COMMISSIONERS. >> THANK YOU, JUDGE. I WOULD BE REMISS AND I'LL SPEND TIME HONORING THE GIRLS BUT IF I DON'T GIVE MY FRIEND ROY A LITTLE BIT I DON'T KNOW HOW MANY TIMES -- 700 -- HOW MANY WINS [00:45:02] NOW? >> 7 SOMETHING. >> SEVEN SOMETHING. I DON'T THINK I HAVE THAT MANY. THAT'S AN AMAZING RECORD. >> DO WE FORGIVE HIM FOR LEAVING? DO WE? >> WELL, YOU KNOW. I DON'T KNOW ABOUT THAT. P HE WANTED TO BE INCLUDED IN THIS TOO SO COACH DID A GREAT JOB AS USUAL. WE'RE USED TO SEEING THE PHENOMENAL PROGRAM NOW AND I KNOW VETERAN'S HASN'T BEEN A HIGH SCHOOL A LONG TIME BUT Y'ALL HAVE SET THE MARK AND DONE AN INCREDIBLE JOB. FOR THOSE OF YOU THERE FOUR YEARS YOU'RE USED TO WINNING. NOT EVERYBODY GETS TO BE ON A TEAM LIKE YOU'RE ON AND THE AMAZING SUCCESS THAT YOU'VE HAD ON THE COURT AND OFF THE COURT IS PRETTY STAGGERING. YOU SET THE BAR SO HIGH THAT THE BOYS FINALLY GOT HERE WITH Y'ALL. PRETTY GOOD. RIGHT. [LAUGHTER]. >> COME ON. LET'S CALL IT LIKE IT IS. >> LOOK AT THEM. >> WE GOT COACH WHITE BACK AND HERE WE ARE. ALL RIGHT. SO COACH WHITE IS BACK AND WE'RE EXPECTING JUST LIKE WITH ROY TO SEE Y'ALL BOTH HERE EVERY YEAR. >> COMPETITION. >> BECAUSE IT'S DEFINITELY AN AMAZING ACHIEVEMENT THAT Y'ALL HAVE ACCOMPLISHED AND WE SO APPRECIATE YOU BEING HERE. AS THE JUDGE EXPLAINED WE HAD A VERY IMPORTANT CEREMONY OUT THERE AND FIGURE AS JOHN SAID THE LAST MONTH OF SCHOOL WE DELAYED YOU A LITTLE BIT I'M SURE YOU'RE NOT TOO HEART BROKEN BUT ALSO TO THE PARENTS. I WANT TO SAY I KNOW WHAT A SOUTHBOUNDINGERY IDENTIFIES IT IS AND I'M SIGHING THIS TO BOTH PARENTS NOW BECAUSE I DON'T WANT TO REPEAT 3450IS BUT I KNOW WHAT A SACRIFICE IT IS TO HAVE A STUDENT ATHLETE. IT'S TOUGH. IT'S TOUGH ON THE FAMILIES ON EVERYBODY BUT WE SHARE IN THE SUCCESS. WE DO FOR THOSE OF YOU HERE. FOR THOSE NOT HERE BECAUSE I KNOW WHAT A SACRIFICE IT IS TO GET THEM HERE AND GET THEM THROUGH SCHOOL AND VETERANS IS NO EASY SCHOOL TO GET THROUGH ACADEMICALLY. CONGRATULATIONS LADIES. YOU HAVE MADE SOUTH TEXAS AND NUECES COUNTY PROUD. THE PARENTS ARE THE MAIN SUPPORTERS, TRANSPORTERS, THE FEEDERS THAT FEED YOU TWICE PROBABLY BEFORE AND AFTER THE GAME. SO TO MAKE A GOOD TEAM THAT'S WHAT IT TAKES. LET'S NOT FORGET TO CONTINUE TO WORK TOGETHER IN A UNITED MANNER. GOOD LUCK. GUYS, CONGRATULATING SENIORS, WISH YOU THE BEST. EDUCATION IS THE BEST THING YOU CAN HAVE. NOBODY CAN TAKE THAT AWAY FROM YOU SO CONTINUE TO DO YOUR EDUCATION. ALL RIGHT. NUMBER ONE. ALL RIGHT. GOD BLESS YOU. >> COMMISSIONER. >> THANK YOU, JUDGE. HAVING BEEN ON THE SCHOOL BOARD IS LIKE HAVING KIDS. YOU LOVE THEM ALL EQUALLY AND ALL THE SAME SO IT DOESN'T MATTER WHAT PRECINCT Y'ALL FALL IN, Y'ALL ARE STILL OUR TEAM REPRESENTING NUECES COUNTY. I DON'T GET HOW COMMISSIONER HE HAS KNEE HAS ALL THESE STRONG BASKETBALL PROGRAMS NO, MA'AM HIS PRECINCT. I'M GOING TO MAKE THESE COMMENTS FWOTH TEAMS. NO COMMISSIONER CHESNEE DOES NOT HAVE -- I KNOW THE BOYS TOOK A SLIGHT TO WHAT YOU SAID EARLIER ABOUT THEM FINALLY JOINING THE GIRLS. I'VE BEEN WATCHING Y'ALL FOR YEARS NOW AND I'VE SEEN AND I'VE HEARD THE STORIES ABOUT THE TEAM WORKING THROUGH AND GOING [00:50:03] THROUGH THE SUMMER WORKOUTS AND GETTING READY LONG WHEN Y'ALL WERE IN MIDDLE SCHOOL RIGHT. I MEAN, I REMEMBER FOLLOWING THEM AND MY WIFE KEEPING ME UPDATED AND SO WE'RE EXCITED TO SEE THIS TEAM DEVELOP AND TURN INTO WHAT THEY WERE AND KNEW THIS WAS THE YEAR AND I WAS MENTIONING TO COACH WHEN THEY WERE WALKING IN IT'S EVERY YEAR ONE OF OUR SPORTS TEAMS NO MATTER WHAT SPORT IT IS KIND OF GETS THE SHORT END OF THE STICK. JUST BY THE WAY THE DRAW IS IN THE PLAYOFF ROUNDS. BECAUSE WE KNOW HAD IT BEEN DRAWN PROPERLY THESE GIRLS WOULD HAVE BEEN IN THE STATE FINALS PLAY FORKING THE STATE FINALS. THEY FOUGHT UP TO THE END. IT JUST HAPPENS WHERE YOU LIVE SOMETIMES YOU GET A STRONG TEAM EARLIER THAN WHAT YOU WANTED AND WHO KNOWS WHAT WOULD HAVE HAPPENED HAD YOU MET THEM HEAD ON JUST ONE-ON-ONE. BUT I'M SO PROUD OF Y'ALL. Y'ALL REPRESENT OUR COMMUNITY WELL. AND WE KNOW THAT NOT ONLY ACT ATHLETICS BUT ALSO ACT DELL EASTBOUNDING ACE AND SO THIS WILL BE MY COMMENT TOOLS THE YOUNG MEN. GUYS, KEEP IT UP. WE'RE PROUD OF YOU. Y'ALL DID GREAT. IT'S EXCITING ALWAYS TO WATCH SOME GREAT BASKETBALL AND CONGRATULATIONS ON ALL YOUR FUTURE ENDEAVORS. GOOD LUCK ON THE BASEBALL SIDE AS WELL. THANK YOU FOR BEING HERE. WE'RE PROUD OF YOU. >> COMMISSIONER HERNANDEZ. >> YES. I WANT TO JUST CONGRATULATE MEMORIAL VETERANS SCHOOL. I THINK THEY REPRESENT CORPUS CHRISTI VERY WELL. -- CRISTI VERY WELL. I HOPE THEY CONTINUE THEIR EDGE EDUCATION IN COLLEGE AND PLAY FOR THE DLEJ OF THEIR CHOICE. THANK YOU FOR THE WAY YOU REPRESENT CORPUS. GIRLS, IF YOU WOULD INDULGE US, WHAT WE'LL DO IS EVEN STILL WHAT WE COULD DO IS ALL THE PHOTOS AT ONCE. WE'LL TRY THE CLEARLYS FIRST AND THEN THE BOYS AND IF WE COULD [2. In recognition of the Veterans Memorial Boys Basketball Program on their accomplishments.] SOMEHOW GET EVERYBODY TOGETHER THAT WOULD BE FUN. WE'LL HAVE BBELINDA TO MOVE ON O THE RESOLUTION DEAL, THE BOY'S BASKETBALL PROGRAM. AND ALL OF THEIR ACCOMPLISHMENTS. >> WHEREAS THE VETERANS MEMORIAL BOYS BASKETBALL PROGRAM LED BY [00:55:02] COACH BILLY WHITE, JR., FINISHED A SUCCESSFUL 2022 SEASON WITH A RECORD 15-1 AND AN OVERALL RECORD OF 31-8. THE TEAM ALSO FINISHED AS DISTRICT 29, 5 A. CHAMPIONS AND REGIONAL SEMIFINALISTS. WHEREAS THE MEMBERS WERE HONORED AS FOLLOWSES: -- [01:00:24] >> I LIKE THAT. THAT'S A GREAT SENTIMENT. COMMISSIONER, I KNOW WE'VE TALKED ACT THE GIRLS BUT HOW ABOUT A FEW NICE WORDS FOR THESE GENTLEMEN. >> I WILL. IT WAS NOT A SLIGHT. IT WAS MORE OF A CHALLENGE. THE WINNING TRADITION HAS BEEN ESTABLISHED NOW ON THE BOY'S SIDE AND I'M A HUGE MAN OF COACH WHITE. I HAVE WATCHED SEVERAL OF THESE GAMES BECAUSE I'VE WATCHED ESPECIALLY THE SENIORS PLAY FOR A LONG TIME. AND WATCHING COACH WHITE WITH THESE YOUNG MEN IS PRETTY IMPRESSIVE. JUST DIDN'T HEAR ANYTHING BUT GOOD THINGS ABOUT HOW HE COACHED AND INTERACTED AND CARED FOR THE KIDS AND THAT'S A REAL TRIBUTE. I THINK HE'S BROUGHT A STABILITY TO VETERANS THAT IS HOPEFULLY GOING TO BE THERE A LONG TIME. I THINK HE -- I HOPE HE LIKES BEING HERE IN CORPUS CRISTI. IT'S BEEN FUN. I SAW SEVERAL OF YOUR GAMES THIS YEAR. A LOT OF FUN TO WATCH. YOU GUYS ARE AN EXCITING TEAM AND I DON'T KNOW HOW EVERYBODY PICKED EVERYBODY BUT I DON'T KNOW THAT EVERYBODY EXPECTED Y'ALL TO GO TO THE FOURTH GROUND AND THAT'S NOT A SLIGHT. THAT JUST MEANS YOU OVERACHIEVED AND DID THINGS AS A TEAM THAT MAYBE A LOT OF PEOPLE DIDN'T THINK YOU COULD AND THAT'S ONE OF THOSE LESSONS IN LIFE THAT IF YOU WORK TOGETHER AS A TEAM AND YOU REALLY BUST YOUR TAILS AND YOU DID. Y'ALL BEAT SOME TEAMS THAT MAYBE YOU SHOULD NOT HAVE BEAT BUT ON PAPER BUT BECAUSE YOU PLAYED SO WELL AS A TEAM AND CAME TOGETHER AND HAD GREAT SENIOR LEADERSHIP AND COACHING YOU JUST DID WELL. >>> THAT CERTAINLY WAS NICE AND [01:14:19] FOR ALL OF YOU THAT ARE WAITING ON YOUR A TEMPERATURES, IF YOU [01:14:22] HAVE KIDS, YOU'LL APPRECIATE IT. IF YOU DON'T WHEN YOU HAVE IT YOU WILL APPRECIATE IT. THERE'S JUST SO LITTLE TIME. LIFE GOES BY SO FAST. AND ALL OF A SUDDEN YOU WAKE UP AND THEY'RE SENIORS AND YOU CRAVE EVERY MOMENT, EVERY PHOTO, EVERY -- IT'S JUST AMAZING SO I'M GLAD THAT WE DO THAT. I KNOW IT TAKES A LOT OF TIME BUT SO DID THEIR EFFORTS. SO IT SEEMS LIKE IT'S APPROPRIATE ON THE BALANCING [3. In recognition of the month of May 2022 as Foster Care Awareness Month.] ACT. BUT WE WILL MOVE ON BECAUSE WE DO HAVE TWO IMPORTANT RECOGNITIONS. THE MONTH OF MAY TURNS OUT TO BE AN IMPORTANT ONE FOR NOT ONLY MENTAL HEALTH AS MANY OF YOU KNOW MENTAL HEALTH IS THE MONTH [01:15:03] OF MAY BUT ONE THAT'S NEAR AND DEAR TO OUR HEARTS AND THAT'S FOSTER CARE AWARENESS MONTH AND WE HAVE MANY REPRESENTATIVES HERE TODAY TO CREATE THAT AWARENESS BUT FIRST WE'LL TURN OUR ATTENTION TO BELINDA. >> WHEREAS WE HAVE A RESPONSIBILITY AS INDIVIDUALS, NEIGHBORS, COMMUNITY MEMBER MOUNTAIN BROOK AND CITIZENS OF NUECES COUNT TOY RECOGNIZE THAT CHILDREN AND YOUTH NEED UNCONDITIONAL LOVE, SUPPORT, SECURITY, AND A PLACE TO CALL HOME AND WHEREAS FOSTER PARENTS PROVIDE THE LOVE, SAFETY, AND STABILITY THAT CHILDREN AND YOUTH NEED IN ORDER TO OVERCOME PAST TRAUMATIC EXPERIENCES SO THAT THEY CAN REACH THEIR FULL POTENTIAL AND WHEREAS WE MUST COME TOGETHER AS A COMMUNITY TO RECOGNIZE THE IMPORTANCE ROLE FOSTER PARENTS PLAY IN CARING FOR CHILDREN AND YOUTH WHO HAVE EXPERIENCED ABUSE AND NEGLECT SUPPORTING FAMILY REUNIFICATION AND BUILDING STRONG COMMUNITIES AND WHEREAS THE 125IB89 AND PERMANENCY FOR CHILDREN AND FOIST CHILDREN IS OF THE UPMOST IMPORTANCE. AND WHEREAS THROUGH PARTNERSHIPS WITH FAMILIES, CHILD WELFARE STAFF, AND PUBLIC AND PRIVATE AGENCY, THERE IS A COLLABORATIVE EFFORT TO ENSURE THAT CHILDREN AND YOUTH IN NUECES COUNTY ARE SUPPORTED AND SUCCESSFUL. >>> I'VE GOT A SECOND TO APPROVE THIS MOTION. I'LL TAKE THAT AS A SECOND. AND WE DO RECOGNIZE THAT WE HAVE MEMBERS OF -- I'M IMAGINING BOARD MEMBERS OF AND MAYBE SOME VOLUNTEERS OF AGAPE RAN EVER RANCH AND WE'D -- RANCH AND WE'D LOVE FOR YOU TO INTRO-TUESDAY YOURSELF AND YOUR TEAM AND FOR ME THE WORD AGAPE IS SO BEAUTIFUL. IT'S A DIFFERENT KIND OF LOVE. IT'S AN UNCONDITIONAL LOVE AND I CANNOT THINK OF A BETTER ORGANIZATION TO REPRESENT FOSTER CARE AWARENESS THAN THE WORK THAT THE AGAPE RANCH BOARD DOES. >> THANK YOU SO MUCH. I'M SHAN NOR MURPHY, COMMUNITY RELATIONS COORDINATOR FOR AGAPE RANCH. THANK YOU SO MUCH. JUST FOR ALLOWING US THE OPPORTUNITY TO HAVE A PROCLAMATION TO RECOGNIZE MAY AS FOSTER CARE AWARENESS MONTH. IT'S A MONTH AND AN OPPORTUNITY TO EDUCATE AND BRING AWARENESS TO THE NEEDS OF FOSTER CHILDREN AND YOUTH IN THE COASTAL BENT AND I WAS JUST THINKING OF I WAS LOOK R LISTENING TO EVERYTHING THEY WERE SAYING TO OUR PLAYERS THIS WEEKEND HOW TIMELY IT IS WE'RE FOLLOWING THEM IS BECAUSE A FEW OF YOU MENTIONED THE IMPORTANCE OF FAMILY AND GOOD ROLE MODELS AND MENTORS AND HOW IT STARTS AT HOME AND IF WE THINK ABOUT OUR FOSTER CHILDREN AND YOUTH THEY DON'T ALWAYS HAVE THAT. SO IT TAKES MANY PEOPLE IN OUR COMMUNITY TO RAISE A SUCCESSFUL CHILD TO BECOME A PRODUCTIVE ADULT. CORRECT. SO IT'S TIME TO RECOGNIZE THIS MONTH IS A TIME TO RECOGNIZE THE FOSTER PARENT FAMILY MEMBERS, VOLUNTEERS, MENTORS, POLICY MAKERS, CHILD WELFARE PROFESSIONALS. WE HAVE REPRESENTATIVES FROM THE NUECES CHILD WELFARE COUNTY BOARD AND TEXAS DEPARTMENT OF FAMILY PROTECTIVE SERVICES. WE HAVE A COUPLE OF OUR AGAPE RANCH BOARD MEMBERS HERE. WE HAVE REPRESENTATIVES FROM OUR TEAM AT AGAPE RANCH AND AGAPE HARBOR. WE'RE ALL WORKING TOGETHER TO HELP CHILDREN AND YOUTH AND FOSTER CARE FIND PERMANENT HOMES AND CONNECTIONS. SO I WANT TO JUST MENTION THAT THERE'S AN OPPORTUNITY FOR ANYONE IN OUR COMMUNITY TO SUPPORT. YOU DON'T ALWAYS HAVE TO BE A FOSTER PARENT. THAT IS THE HIGHEST CALLING. BUT YOU MAY NOT READY FOR THAT. WE ALWAYS NEED VOLUNTEERS AND RESPITE CARE PROVIDERS. WE NEED DONATIONS. WE'RE CURRENTLY HAVING A MATCH THIS MONTH. EVERY DONATION WILL BE DOUBLED TO $47,000. SO IT TAKES TIME. IT TAKES LOVE. IT TAKES MONEY TO CONTINUE THE PROGRAMS THAT WE PROVIDE BUT IT'S SO IMPORTANT HERE IN NUECES COUNTY SO THANK YOU SO 34U67. [01:20:03] >> THANK YOU. >> DOES ANYBODY ELSE -- >> WOULD ANYONE ELSE LIKE TO OFFER? >> IF YOU WOULD JUST INTRODUCE YOURSELF. >> GOOD MORNING. I AM THE FAITH BASED PROGRAM SPECIALIST FOR CPS AND WORK VERY CLOSELY BE AGAPE RANCH AND VERY THANKFUL TO THEM FOR THE WORK THEY DO WITHIN THE COMMUNITY. WITHOUT THEM AND ALSO ALL THE OTHER CHILD PLACEMENT AGENCIES THAT ARE CONTRACTED BY THE DEPARTMENT WE WOULD DEFINITELY HAVE A BIGGER GAP IN THE NUMBER OF FOSTER FAMILIES IN OUR COMMUNITY. >> COMMISSIONERS, ANY FURTHER COMMENTS? I KNOW THIS IS AN IMPORTANT MONTH FOR YOU. >> ABSOLUTELY FOR ME AND I KNOW FOR FORMER JUDGE CHESNEY WHEN HE WAS THERE AT COURT FIVE, ANYTHING THAT DOES WITH CPS, CHILD ABUSE AWARENESS MONTH IN APRIL AND OF COURSE RECOGNIZING FOSTER FAMILIES AND ALL THE AGENCIES AND EFTS THAT TAKE PLACE. REMINDS ME OF THE WORK WE DID. I STILL CALL MYSELF AND CONSIDER MYSELF PART OF CPS WHEN YOU SPEND EVEN ONE DAY THERE YOU'RE PART OF THAT FAMILY FOR LIFE AND THE WORK THAT WE DID. IT'S NOT A PERFECT AGENCY BUT WE TRY TO GIVE PERFECT RESULTS FOR THESE CHILDREN AND FAMILIES THAT DESERVE IT. SO I THANK YOU FOR BRINGING ADVOCACY, A REMINDER TO US AS THIS COURT WHEN WE'RE LOOKING AT AGENCIES TO HELP SUPPORT THROUGH OUR BUDGET EFFORTS AND A SENSE OF COMMUNITY AS A WHOLE. I'M GLAD YOU'RE HERE TODAY FOR ALLOWING US TO RECOGNIZE THIS AND CELEBRATE THESE SPECIAL SERVICES. TO LEARN MORE GO ON AGAPERANCH.ORG. I LOVE WHAT YOU SAID ABOUT THE WORD FOSTERING. IT'S AMAZING BUT CPS AND ACC RANCH REALLY ARE FOSTERING THIS CONNECTION AND WE NEED BOTH. BOTH AGENCIES. BOTH SERVICES REALLY WORK IN TANDEM. WE'RE GRATEFUL THAT YOU WERE HERE TODAY. WE HAVE A RESOLUTION THAT WE'D LIKE TO PRESENT IF BOTH OR ALL OF YOU WOULD LIKE TO COME UP. >> I WANT TO SAY ONE THING TO THE GROUP. I WANT TO THANK Y'ALL FOR EVERYTHING YOU DO. EVERY SINGLE DAY 265 DAYS A YEAR. >> I WANT TO THANK -- BECAUSE IT TAKES A SPECIAL KIND OF PERSON TO GET INVOLVED WITH THESE YOUNGSTERS. THANK YOU. >> THANK YOU. >> I'LL COME DOWN AND INVITE YOU CALL TO COME UP. -- INVITE YOU ALL TO COME UP. [01:26:05] >>> ONE THING WE'VE BEEN TALKING ABOUT IS BETTER PUBLIC MESSAGING BOARD ON FLOOR ONE BECAUSE ALL OF THESE GREAT RESOLUTIONS REALLY SHOULD BE HIGHLIGHTED IN THE MONTHS SO THAT EVERYBODY WALKS IN AND KNOWS WHAT MONTH IT IS AND HOW THEY CAN GET INVOLVED. I THINK THAT'S SOMETHING TO FOLLOW UP ON. AND SPEAKING OF GOOD WORKS, WE [4. In recognition of May 19, 2022, as National Stop the Bleed Day.] HAVE A RECOGNITION OF MAY 19TH WHICH IS COMING UP AS NATIONAL STOP THE BLEED DAY BUT THIS IS OUR OPPORTUNITY TO TALK ABOUT THIS IMPORTANT EFFORT, BELINDA. >> WHEREAS UNCONTROLLED BLEEDING IS A MAJOR CAUSE OF PREVENTIBLE DEATH, 40 AH% OF TRAUMA-RELATED DEATHS WORLDWIDE ARE DUE TO BLEEDING OR ITS CONSEQUENCES. ESTABLISHING HEMORRHAGE AS ONE OF THE MOST COMMON CAUSES OF PREVENTIBLE DEATH -- PREVENT ABLE DEATH AND TRAUMA. BYSTANDERS CAN FILL THE GAP. ANYONE CAN BE TRAINED TO SAVE A LIFE. WHEREAS STOP THE BLEED WAS INITIATED BY A FEDERAL AGENCY WORK GROUP QUEENED BY THE NATIONAL SECURITY COUNCIL STAFF AND THE WHITE HOUSE THE PURPOSE IS TO BUILD NATIONAL RESILIENCE TO BETTER PREPARING THE PUBLIC TO SAVE LIVES BY RAISING AWARENESS OF OUR BASIC ACTIONS TO STOP LIFE THREATENING BLEEDING FOLLOWING EVERYDAY EMERGENCIES IN MAN-MADE AND NATURAL DISASTERS. THE WARS IN IRAQ AND AFGHANISTAN HAVE INFORMED THE WORK BACK TO THE HOMELAND AND TO THE BENEFIT OF THE GENERAL PUBLIC. NOW, THEREFORE, BIT RESOLVED BY THE COMMISSIONERS COURT OF NUECES COUNTY THAT THE 19TH DAY OF MAY 2022 IS NATIONAL STOP THE BLEED DAY AND ENCOURAGES ALL CITIZEN TO GET TRAINED, BE READY, AND BE EMPOWERED TO STOP THE BLISS. >> THANK YOU. >> THANK YOU. I'M ON THE BOARD WITH THE COASTAL REGIONAL ADVISORY COUNCIL WHICH YOU'RE FAMILIAR WITH AND IF YOU RECALL AROUND 2019 OR 18 WE TAUGHT A BUNCH OF YOUR STAFF WHICH WE'RE HAPPY TO COME BACK AND DO AGAIN STOP THE BLEED. IT'S IMPORTANT TO KNOW ESPECIALLY IN TEXAS. IT'S NOT JUST THE ACTIVE SHOOTER SITUATION. WE HAVE HUNTERS AND FISHERMEN, ALL KINDS OF STUFF THAT CAN HAVE A PENETRATING WOUND THAT CAN COST SOMEONE THEIR LIFE IF THE SO WE'RE HAPPY TO BRING THIS COURSE TO THIS REGION. I'LL ALSO -- SHE'LL SHARE MORE INFORMATION. >> THANK YOU. WELCOME. >> HELLO. I'M THE VICE PRESIDENT OF TRAUMA SERVICES. I HAVE WITH ME OUR TRAUMA MEDICAL DIRECTOR AND SURGEON AND A TRAUMA COORDINATOR WITH SHORELINE'S TRAUMA PROGRAM. ECHO EVERYTHING BODY KAREN SAID ABOUT STOP THE BLEED. SOME THINGS WE'RE DOING I'M INVOLVED AT A COALITION AT THE STATE LEVEL ON STOP THE BLEED TRAINING. IT'S OBVIOUSLY A DAY WE'RE DOING MULTIPLE CLASSES THROUGHOUT THE SYSTEM AND COMMUNITY. ARE REALLY TRYING TO SEE HOW BIG WE CAN GET OUR NUMBERS AND SO WE CAN SET OUR GOAL EVEN HIGHER FOR NEXT YEAR. TRYING TO ENCOURAGE EVERYONE TO GET OUT THERE AND GET TRAINED. I'M WORKING WITH LOCAL CHURCHES, ORGANIZATIONS TO TEACH TRAINING. THIS IS SOMETHING THAT CAN BE TAUGHT TOEFSH. WE'RE WORKING WITH VET ROBS HIGH SCHOOL AND MY SON WILL BE A [01:30:02] FRESHMAN THERE NEXT YEAR AND I'VE TRAINED MY SON SO DEFINITELY WE HOPE TO HEAR FROM EVERYBODY THAT WANTS TO BE TRAINED WE CAN COME TO YOU AND TRAIN. YOU CAN COME TO US. REAL EXCITED TO BE ABLE TO PROMOTE THIS LIFE SAVING TECHNIQUE. >> THANK YOU. THANK YOU. I HOPE YOU'RE PROUD OF US TOO. WE HAVE AN ALL OUR FLOORS STOP THE BLEED KITS AND OUR RISK MANAGER HELPED US OBTAIN THOSE PROPERLY PLACE THEM MAKE SURE WE HAVE FOLKS ON EVERY FLOOR THAT KNOW HOW TO UTILIZE THEM. BUT I WANT YOU TO KNOW THAT ALL CAME BECAUSE OF CBRAC AND REALLY JUST UNDERSTANDING THAT WAS SOMETHING THAT IT WAS NOT VERY HARD TO OBTAIN. IT'S SOMETHING THAT COULD HAVE HUGE IMPACT IN SAVING LIVES. YOU OPENED MY EYES AND I THINK COURT'S EYES ON THIS IMPORTANT -- JUST LIKE CPR. WE NOW HAVE MUSCLE MEMORY OF HOW IMPORTANT STOP THE BLEED IS. WE THANK YOU FOR THAT AND THANK YOU FOR THE CONTINUED AWARENESS. IS THERE A MOTION TO APPROVE? >> SO MOVED. >> SECOND. >> I'VE GOT A MOTION AND A SECOND. >> AND I DO HAVE THE RESOLUTION HERE. ARE THERE ANY OTHER COMMENTS HERE? >> ANYONE IN THE COURTROOM TRAINED FOR STOP THE BLEED? >> OKAY. THAT'S UNUSUAL. USUALLY WE HAVE -- CHASE WAS GOING TO VOLUME DEAVER YES. SO THERE'S ALWAYS TYPICALLY IN EVERY ROOM SOMEBODY. ALL THOSE IN FAVOR SAY AYE. >> AYE. >> WOULD YOU HONOR US? I HAVE A COPY OF THIS BEAUTIFUL COMMISSIONER'S COURT RESOLUTION AND WE'D LOVE TO GET A PICTURE BECAUSE I THINK IT'S SOMETHING YOU SHOULD PROMOTE ON YOUR WEBSITES AT CBRAC, FACEBOOK. [5. AND ALSO TO CECILIA VENABLE. >> I THINK WE GOT -- UP AND DOWN THE COAST. >> I DON'T KNOW OF AN ELECTED OFFICIAL WHETHER IT BE FEDERAL OR STATE THAT WE DID NOT GET A LETTER OF SUPPORT FROM. IT WAS PHENOMENAL. >> I AGREE. THIS ALSO COMES OUT OF A CONGRESSIONAL ACT SO WHILE OTHER -- WE MIGHT BE THE ONLY ONE THAT WOULD BE WONDERFUL BECAUSE THAT WOULD MEAN WE WOULD BE DECLARED ONE COMMUNITY IN EACH STATE WE'LL RECEIVE THIS DESIGNATION AND WHILE WE'LL ANXIOUSLY WAIT THE TRUTH IS THAT [02:00:02] WE SEE TREMENDOUS UPWARD POTENTIAL FOR ECONOMIC DEVELOPMENT TOURISM POTENTIAL MILITARY TRAIL. THIS IS JUST ENORMOUS. PLEASE TAKE A LOOK AT THIS. IT CAN ALSO BE GIVEN TO YOU DIGITALLY AND PHOTOGRAPHS, THE MEMORABILIA, PEOPLE AROUND OUR COMMUNITY WE WANT TO THANK YOU AT THIS TIME AND I JUST WANT TO SEE IF NINA WANTS TO SAY ANYTHING. WE NEEDED A CURATOR SO BASICALLY WE HAD TEN DIFFERENT AUTHORS AND YOU HAD TO HAVE SOMEBODY WHO UNDERSTOOD THE STYLE OF HOW WE WANTED TO MAKE THIS PRESENTATION. AND THE HISTORY. SHE IS IN CHARGE OF OUR HISTORIC PRESERVATION PLAN FOR CITY AND THAT UPCOMING UPDATE AND I HOPE THAT THIS HELPS TELL OUR STORY NINA. >> THANK YOU. GOOD MORNING. IT'S A PLEASURE TO BE HERE. THIS WAS TREMENDOUS PROJECT TO BE INVOLVED IN AND I DO THANK BOTH NUECES AND -- FOR ENGINEERING THIS NOMINATION FOR OUR TEXAS COASTAL BIN CITIES. THE CRITERIA FOR THIS SUBMISSION WAS TO DESCRIBE OUR CITY'S HOME FRONT CONTRIBUTIONS TO WORLD WAR II EFFORTS AND THEN SECONDLY, HOW WE PRESERVE OUR WORLD WAR II LEGACY AND WE'D HAD A TREMENDOUS AMOUNT OF CONTRIBUTORS TO THE PROJECT AS THE JUDGE HAS SAID. WE STARTED OFF WITH ABOUT A 0-PAGE DOCUMENT AND AFTER THE WORLD WAR II TOWN HALL AND AN OUTPOURING OF INFORMATION FROM MANY, MANY GROUPS AND ORGANIZATIONS IT BECAME A 38-PAGE DOCUMENT. AND SO, AGAIN, I THANK YOU FOR THE OPPORTUNITY TO WORK ON THE PROJECT AS THE JUDGE SAID THIS REALLY HAS SOME WONDERFUL IMPLICATIONS WITH RESPECT TO HERITAGE TOURISM EFFORTS AND WE COULD USE THIS DOCUMENT AS A FRAMEWORK FOR FUTURE SELF-GUIDED TOURS, EXHIBITED, AND OTHER -- EXHIBITS, AND OTHER WAYS TO COMMUNICATE HOW WE PRESERVE AND HONOR OUR WORLD WAR II HR TAJ. >> THANK YOU. >> JUDGE, RECENTLY, I HAD A CHANCE TO VISIT WITH THE CITY MANAGER. A LOT OF YOU KNOW HE'S A FORMER COMMANDER AT NAS KINGSVILLE. NOW THE CITY MANAGER THERE. HE'S AN AVIATOR OF COURSE AND WE WERE JUST TALKING ABOUT DIFFERENT THINGS IN THE HE MENTIONED AS AN AVIATOR FLYING UP AND DOWN THE COAST THAT YOU WILL SEE AIRSTRIPS FROM WORLD WAR II HAVE THAT PATTERN OF THE AIR STRIPS UP AND DOWN THE GULF COAST OF TEXAS. I THOUGHT THAT WAS NEAT AND I DON'T KNOW IF THAT CAN BE PART OF THIS, I KNOW HE'S A GREAT SOURCE OF INFORMATION. LIKE YOU SAID, IT'S REGIONAL AND IT'S ALL OF US TOGETHER AND HOPEFULLY THAT TIDBIT WITH THE OTHER PLUS THAT IS WE HAVE BEING A MILITARY TOWN AND COMMUNITY GOES AND HELPS US TO GET THIS DESTINATION. THANK YOU FOR YOUR WORK. >> AND WHILE IT DID TAKE THIS HUGE VILLAGE, IT TOOK ONE SPECIAL PERSON TO SAY, WOW, LOOK AT THIS, JUDGE, LET'S APPLY. AND SO, KUDOS TO SCOTT CROSS, AND HIS FRIENDS AT U.S. FISH AND WILDLIFE SERVICE, THE FACT IS YOUR A FRIENDLY GUY AND THOSE FRIENDSHIPS PAY HUGE DIVVIEDENTS. YOUR FRIENDSHIP LED THEM TO SAY, MAY BE YOU SHOULD CONSIDER THIS AND THAT STEAM ROLLED INTO AN INCREDIBLE PROJECT. AND I THINK THAT YEARS FROM NOW WE'RE GOING TO BE SO PROUD OF WHAT WE'RE ABLE TO DO. JJ CAME IN AND, AGAIN, I KNOW THAT YOU LOOK AT YOUR PACKETS, BUT TAKE THIS ONE HOME ON THE WEEKEND, FROM THE U.S.S. LEXINGTON, THE ONLY NAVAL CARRIER FROM THE STATE OF TEXAS. YOU'LL BE SHOCKED FROM THE WAR BOND EFFORT. EVERYTHING THAT YOU SEE IN HERE, IS DOCUMENTED FROM CORPUS CHRISTIANS, FROM ALL OF THE COMMUNITIES THAT PARTICIPATED FROM PORT A, BISHOP HAD A HUGE ROLE, AS WELL, JUST WONDERFUL. CONGRESSIONAL ACT IN 2019. AND UM, LET'S BRING YOU BACK WHEN WE GET THE FINAL WORD. APPRECIATE IT. JENNY FROM THE CHAMBER. >> THANKS, JUDGE. I JUST WANTED TO SAY WHAT A PLEASURE IT WAS TO WORK ON THIS PROJECT. AND SO RARE WITH SOMETHING THAT WAS SO UNITING, SUCH GREAT ENTHUSIASM FOR IT. I THINK IT'S GOING TO WORK OUT FOR US, I KNOW THAT CORNING'S OFFICE AND CLOUD'S OFFICE ARE WORKING FOR US BEHIND THE SCENES. >> AS SOON AS YOU KNOW SOMETHING. AND ALSO, JUST [02:05:03] SOMETHING SMALL, YOU KNOW, EVERYBODY DID SUCH GREAT WORK HERE, IT WOULD BE NICE TO DO A FOLLOWUP FOR THE COMMUNITIES THAT DID HELP US OUT. AND LET THEM KNOW WHAT WE KNOW RIGHT NOW. FOR EXAMPLE, I DON'T KNOW IF PORT A, IF WE COULD GET ON THEIR SCHEDULE, BUT TO DO THE SAME THING THAT YOU ARE DOING HERE IN KINGSVILLE AND PORT A, ESPECIALLY IF ANYTHING CAN BE DONE IN THE CITY. I WANT TO BE SURE THAT THE PACKET'S IN EVERYONE'S ELECTED HANDS. >> I RAN INTO HIM THURSDAY AND TOLD THEM THAT I NEEDED TO COME AND REPORT TO THEIR COMMISSIONERS' COURT. I UP DATED HIM BEFORE WE PUT IN THE APPLICATION TO BE SURE THAT THEY WERE OKAY WITH IT. I GUESS IT WAS WHOEVER YOU HAD REACHED OUT FOR THE LETTER OF SUPPORT, BUT, YEAH, WE NEED TO GET OUT THERE AND UPDATE THEM. AND HE SHOULD GET ON THE CITY COUNCIL IN PORT A GIVE THEM AN UPDATE. TO BRING IN EVERYBODY UP THERE. ME AND JJ WILL SCHEDULE GETTING DOWN TO COMMISSIONERS' COURT. >> WONDERFUL COLLECTIVE WORK. SUCH A WONDERFUL PROJECT. THANK YOU AGAIN. THANKS TO ALL. OF COURSE, THAT WAS PRESENTATION ONLY AT THIS TIME. HOW DO YOU FEEL ABOUT THE MINUTES? >> I'M GOOD NOW. >> I'M READY IF EVERYBODY ELSE IS. >> SO WE DON'T HAVE TO GO BACK, IT'S NICE TO FINISH IT. >> EXCUSE ME, JUDGE? >> YES. >> ARE YOU TALKING ABOUT THE MINUTES? >> I-1. >> I WOULD LIKE TO TABLE THAT. >> YOU WOULD LIKE TO TABLE? >> I JUST GOT THIS TODAY? >> NO, NO, NO, THAT'S NOT. IT'S THE MINUTES. >> IT'S THE MINUTES. >> I-1 IS APRIL 27TH, 2022, AND MAY 5TH, 2022, AND THIS IS THE ACCEPTING OF THE MINUTES? >> YOU'RE SAYING, YOU HAVEN'T HAD A CHANCE TO READ THE MINUTES? >> THAT'S NOT WHAT HE WAS HOLDING UP. >> JUST MAKING SURE. SO, YOU'RE GOOD ON I 1. AND MOVE TO MOTION. >> I'LL SECOND. >> ALL THOSE IN FAVOR? >> ACCEPT THE MINUTES. >> ALL THOSE IN FAVOR OF ACCEPTING MINUTES, SIGNIFY BY SAYING AYE. (CHORUS OF AYES) >> AGAIN, WE'RE IN REGULAR [3. Discuss and consider approval of Memorandum of Understanding with the Coastal Bend Food Bank of Corpus Christi for the benefit of the Keach Family Library, Bishop Branch Library, Law Library relating to making the Food Bank's Backpack program available to all participating in the 2022 Summer Library Programs.] AGENDA. AND WE'VE GONE THROUGH ONE AND TWO. WE HAVE AN IMPORTANT APPROVAL OF THE MEMORANDUM OF UNDERSTANDING WITH THE BENEFIT OF THE LIBRARY, IT HELPS THE BISHOP BRANCH LIBRARY AND IT'S RELATING TO MAKING THE FOOD BANKS'S BACKPACK PROGRAM AVAILABLE TO ALL THE SUMMER LIBRARY PROGRAMS. WELCOME. >> WE HIT THE AFTERNOON NOW. >> HOW ARE YOU, JUDGE, AND COMMISSIONERS, WE WERE ABLE TO GET THIS MEMORANDUM OF UNDERSTANDING AND I WOULD LIKE TO SAY, THANK YOU VERY MUCH TO JENNY AND HER CREW THERE, THEY'RE ALWAYS WORKING ON OUR MEMORANDUMS AND LEGAL MATTERS. BUT IT WENT THROUGH AND WE WOULD LIKE FOR YOUR APPROVAL FOR US TO BE ABLE TO PROVIDE THESE BACKPACKS THROUGH THE FOOD BANKS AND LAST YEAR WE ONLY HAD IT AT THE CACHE AND THE LAW LIBRARIES WILL BE HELPING TO DISTRIBUTE THE BACKPACKS FOR FAMILIES IN NEED AND ALL YOU HAVE TO DO IS CONTACT US AS SOON AS THE PROGRAM BEGINS AND WE WILL START THAT PROGRAM SOMETIME IN MID-JUNE. >> THIS IS FOR THE LIBRARY, BISHOP BRANCH SO WE'RE HELPING EVERYBODY IN THE COMMUNITY FOR BACKPACKS. >> OKAY. THANK YOU, I'LL MAKE THE MOTION TO APPROVE THIS MOU WITH THE FOOD BANK AND OUR L LIBRARIES. ANY MOTIONS OR DISCUSSIONS? HEARING NONE, ALL THAT APPROVE SAY [4. Discuss and consider approval of a grant award from the Texas General Land Office, Project of Special Merit (PSM) grant related to a living shoreline project and public access elements at Packery Channel Nature Park.] (CHORUS OF AYES) >> SCOTT WINS THE I HAVE NOTHING ABOUT GREAT NEWS AWARD TODAY. DISCUSS AND CONSIDER THE APPROVAL OF A GRANT AWARD FROM THE TEXAS GENERAL LAND OFFICE PROJECT OF SPECIAL MERIT. IT'S A GRANT RELATING THE LIVING SHORE PROJECT AND PUBLIC ACCESS AT THE NATURE PARK. IN CASE ANYBODY HAS DRIFTED, THIS IS THE TIME TO REALLY FOCUS HERE, THIS IS AN AMAZING ANNOUNCEMENT. >> SO, WE GOT $3,678,000 AWARDED TO US. THERE'S NO MATCH INVOLVED IN THIS. ATTACHED IS A CONC CONCEPTUAL DRAWING. AND THIS IS [02:10:03] IN OUR PACKER CHANNEL NATURE PARK, WHICH I KNOW THAT SOME OF YOU HAVE BEEN OUT THERE. WHAT WE'RE DOING IS WE'VE HAD PROBLEMS WITH THE SHORELINE AND EROADING FOR QUITE SOME TIME. YEARS AGO WHEN I LOOKED AT DOING THIS, YOU COULD NOT GET A CORE PERMIT. AND THEN THEY'VE MADE LIVING SHORE LINES NATIONWIDE. THERE'S SOME QUESTIONS STILL ON THE PERMIT ABOUT THE LINEAR FEET THAT WE MAY BE JUST EXCEEDING NATIONWIDE LINEAR FEET NATIONWIDE. WE HAVE A MEETING JUNE THE 7TH WITH THE REGULATORY AGENCIES, BY EXECUTION OF THIS CONTRACT, THE COURT ACCEPTING THE AWARD AND EXECUTION OF THIS CONTRACT, THE COUNTY ATTORNEY'S OFFICE LOOKED AT IT. AND SO, WE SUSPECT THAT PROBABLY THIS PROJECT, ONCE WE GET THE PERMIT, IF HE NEED AN INDIVIDUAL PERMIT, WE SUSPECT TWO YEAR TOSS COMPLETE THE PROJECT. IT'S IMPORTANT TO NOTE AT SOME POINT, THIS SHORELINE IS HEAVILY USED BY FISHERMEN, THEY FISH FROM THE BANKS. AND SO, WE CAME UP WITH THIS CONCEPT TO WHERE YOU HAVE THE TIMBER PIER SO YOU COULD STILL FISH WITHOUT THE BREAK WATERS BEING IN THE WAY. WE'RE GOING TO STABILIZE THEBACK AND TAKE DRUDGE MATERIAL BEHIND THAT AND REFURBISH THE WETLAND AREA. I MAY HAVE TO LEAVE A LITTLE SPACE THERE, BUT, ANYHOW, THE EROSION THAT WE SUSTAINED ON THE SHORELINE HAS BEEN GROWING HERE AFTER YEAR. AT FIRST WHEN THEY OPENED UP THE CHANNEL, THAT'S WHERE WE SAW A LOT OF IT. THERE'S A NO WAKE ZONE, IF YOU LOOK AT THE DRAWING OVER TO THE VERY FAR LEFT-HAND SIDE, YOU'LL SEE SOMETHING IN THE WATER, THAT'S A NO WAKE SIGN. THAT MEANS THESE BOATS ARE GETTING ON AND OFF PLANE AND SO ALL OF THAT WAKE, YOU KNOW HOW A BOAT WHEN TO SLOWS OR SPEEDS UP, PUSHES THAT WAKE IT'S STILL CAUSING EROSION PROBLEMS AND NORTHEAST WINDS. THIS IS GOING TO FIX ALL OF THAT. THE ONLY THING THIS IS NOT GOING TO ADDRESS IS PACKER CHANNEL NATURE PARK ROAD. THAT ROAD IS IN HORRIBLE CONDITION. ANYHOW, AND SO, BUT, ONCE WE FINISH THIS, THERE ARE A COME OF OTHER ELEMENTS, IN THE THE TIER 1 PROJECT. THIS WAS PART OF THAT PLAN AND SO, ACTUALLY, WE WERE ESTIMATING 2.3, AND WE ENDED UP GETTING JUST UNDER $4 MILLION AND THERE'S NO MATCH. AND THERE ARE OTHER ELEMENTS BACK IN THE PARK STILL PART OF THE NEXT PRODUCING OF THE UPDATING OF THE RESILIENCY PLAN. THAT'S REALLY ABOUT IT. COASTAL PARKS, ACTUALLY IT WAS MEGHAN THAT DID THE HEAVY LIFTING ON THIS AND HELPED ME WRITE THIS, CONSIDERING THAT THAT'S BEEN HERE A LITTLE OVER A YEAR. WE'RE GOOD TO GO AND WE'LL HANDLE THE GRANT REPORTING AND EVERYTHING. >> THAT'S FANTASTIC. ARE THERE ANY QUESTIONS HERE ABOUT THE SCHEMATIC OR THE WORK THAT'S GOING TO BE DONE, OBVIOUSLY, THE EROSION IS SO DIFFICULT TO CONTROL, BUT THIS IS EXACTLY THE MEDICINE THAT WE NEED. I KNOW THIS IS JUST HOW MANY LINEAR FEET, DID YOU SAY? 5? >> IT'S MORE LIKE A LITTLE OVER A THOUSAND. >> OKAY. AND SO, DO YOU SEE FURTHER WORK HERE, MAY BE IN THE FUTURE? >> WELL, YOU KNOW, THERE'S TWO LANDOWNERS TO THE WEST OF US. AND I THINK THAT ONE OF THE PIECES OF PROPERTY WAS UP FOR SALE. WHEN WE HAD P ONLY HAD 20 ACRES OUT THERE. I DON'T KNOW IF THIS HAPPENED WHEN YOU WERE COMMISSIONER OR NOT. WE ONLY HAD CENT ACRES, SO, WE GOT ANOTHER 18. IT WAS THE CHAIR OF OUR BOARD WHO SPEAR HEADED THAT. WE WERE ABLE TO ADD 18. BUT THE PROPERTIES TO THE WEST OF US, I UNDERSTAND THAT THEY HAVE ISSUES WITH CONSIDERING DEVELOPING [02:15:02] THESE THINGS BECAUSE THEY HAVE TOME TITLE FLATS AND WETLANDS, THEY WOULD NEVER BE ABLE TO AFFORD TO MITIGATE FOR IMPACTS. WE'RE LOOKING FOR ANOTHER GRANT IN THE FUTURE TO PURCHASE THAT AND 10 IT INTO A NATURE PARK. BECAUSE, I CAN'T GET IT USING THIS MONEY TO STABILIZE THEIR SHORELINE WHITE HOUSE IT'S PRIVATE PROPERTY. THE OTHER SHORELINES, IT'S HARDENED. AND THEY'RE STABLE. >> OKAY. THAT'S GREAT. VERY GOOD. WELL, I'LL MAKE THE POSITION AT THIS TIME. >> DIDN'T WE PUT A PIT UP THERE ON THOSE ACRES? DIDN'T WE PUT UP A BID TO PURCHASE THAT? >> YOU KNOW, COMMISSIONER, WE HAD TO GET AN APPRAISAL OF THE PROPERTY OF THE 18 ACRES THAT WE DID GET. BUT, SOMEHOW THERE WERE TWO OTHER OWNERS, A FRANCIS GANDY, AND ANOTHER PERSON CO-OWNING WITH US. WE TOOK OUR 18 ACRES AND SEPARATED THEM OUT. BUT THEN WE HAD TO GRANT THEM AN EASEMENT BECAUSE IT CAN'T BE LAND LOCKED. >> YOU CAME TO COURT? >> YEAH, A LONG TIME AGO. AND I REALLY WASN'T INVOLVED ON TOO MANY OF THE DETAILS, CHARLEY WAS WORKING ON ALL OF THAT AT THE TIME. AND I CAN'T REMEMBER WHAT COMMISSIONER IN PRECINCT FOUR AT THE TIME AND JUDGE NEAL. >> IT WAS MCCONE. >> WE CHANGED, THE PACKERRY CHANNEL NATURE PARK, USED TO BE CALLED PACKERRY CHANNEL PARK. AND THE COMMISSIONER IN 2010 WANTED TO GIVE IT THE NATURE PARK DESIGNATION, WHICH WAS FORWARD THINKING BECAUSE FROM THERE, WE CAN WRITE OUR MASTER PLAN FOR THAT PARTICULAR PARK TO MANAGE IT AS A NATURE PARK. AND THAT'S WHAT WE'VE DONE AND WHILE WE'VE DONE THE HABITAT. >> IT'S ONE OF THE MOST BEAUTIFUL, IT WOULD BE LOVELY TO HAVE ONE OF THOSE 360 VIRTUAL VIDEO TOURS. THAT'S SOMETHING THAT MAY BE YOU GUYS CAN PUT IN THE BACK POCKET. >> IT'S ON OUR WEB PAGE AS WELL. IF Y'ALL DON'T KNOW, WE HAVE A NEW WEB PAGE. >> MY MOTION IS TO APPROVE THIS GRANT AWARD OF THE TEXAS GENERAL LAND OFFICE PROJECT OF SPECIAL MERIT RELATING TO THE LIVING SHORELINE PROJECT AND PUBLIC ACCESS. IS THERE A SECOND? >> SECOND. >> ALL THOSE IN FAVOR, SIGNIFY [5. Discuss and consider Coastal Parks request for additional funding for fuel for underground storage tanks at Packery Maintenance Yard.] BY SAYING (CHORUS OF AYES) >> (CHORUS OF AYES) >> ITEM 5 SPELL DISCUSS AND CONSIDER COASTAL PARK'S REQUEST FOR ADDITIONAL FUNDING FOR FUEL FOR UNDERGROUND STORAGE TANKS AT PACKERRY MAINTENANCE YARD. AND WE HAVE ALREADY ESTABLISHED THE FUNDING SOURCE FOR THIS. BUT YOU CAN LET US KNOW. >> YEAH, THIS IS NOT A FUN ONE. I JUST WANTED TO OFFICIALLY GET ON THE RECORD THAT IN MY 14 YEARS AS DEPARTMENT HEAD, THIS IS THE FIRST TIME I'VE EVER HAD TO COME TO THE COURT FOR HELP, WITHOUT MAKING LINE ITEM TRANSFERS, I JUST DON'T HAVE IT, I HAVE ONE OF THE SKINNIEST BUDGETS THAT I HAVE SINCE I'VE BEEN HERE. AND I WAS WILLING TO DO THAT BECAUSE Y'ALL NEEDED HELP. OUR FUEL, MY GOD Z I MEAN, I STOPPED AND PUT FUEL IN MY COUNTY VEHICLE AND 15 GALLAGHERS OF GAS COSTED ME $60. AND YOU KNOW, WE'VE HAD, THE GUY, I'VE BEEN ENCOURAGING OUR GUYS IN OUR FLEET VEHICLES TO USE THE FUEL TANKS MORE THAN THE FUEL CARDS. BUT, MY FUEL COSTS RIGHT NOW HAS GONE UP SINCE THIS TIME LAST YEAR, MY DIESEL IS UP 50%. AND ANYHOW, I WANT Y'ALL TO KNOW, I DON'T COME ASKING THIS LIGHTLY BECAUSE I USUALLY FIND A WAY TO WORK WITHIN MY OWN BUDGET AND I'M SURE DALE CAN TESTIFY TO THAT. I'VE NEVER DONE THIS. SO, THIS IS A RARE THING AND I PROMISE YOU IT WILL ALWAYS BE A VERY RARE THING. >> I CAN RECALL A COUPLE OF TIMES THAT YOU DID, BUT IT'S OKAY. >> YES, COMMISSIONER, WE'RE GOING TO DO IT FROM THE GENERAL FUND. >> THE GENERAL FUND? >> THAT'S CORRECT. >> WHY GENERAL FUND, I MEAN, IS THERE ANY OTHER SOURCE? >> THE GENERAL FUND IS THE MAIN FUND IT TO SERVICE ALL THE DEPARTMENTS. >> IT'S PART OF THE BUDGET FOR EVERYBODY, I'M SAYING, THIS IS NOT PART OF THE BUDGET, THEY WANT SOMETHING ELSE. IS THERE ANY OTHER SOURCE THAT WE COULD GET BESIDE THE GENERAL FUND? >> WELL, COMMISSIONER CHESNEY CAN PAY FOR IT. >> I'M JUST ASKING. [02:20:03] >> I WOULD BE HAPPY TO. I'M THE ONE THAT FUNDED FOR THE ENTIRE WE FOUND THE ALLOCATION FOR THE $80,000 FOR THE FUEL TANKS. >> THAT'S CORRECT. >> WHENEVER WE TALK ABOUT THE GENERAL FUND, EVERYBODY JUMPS THROUGH HOOPS NOT TO SPEND FROM THE GENERAL FUND. >> WE'RE OBVIOUSLIY NECESSARY. >> ANYWAY, I JUST WANT TO MAKE SURE THAT WHEN WITH HE COME BACK TO THE WELL, I DON'T WANT TO HEAR PEOPLE SAYING, WELL, WE WANT TO TAKE OUT OF THE GENERAL FUND, IT SHOULDN'T BE A PROBLEM, RIGHT? >> CORRECT. >> AND THEN THE 60,000 IS WHAT YOU'LL HAVE TO USE FOR THE REST OF THE YEAR? >> IT DIDN'T COST AS MUCH AS LAST YEAR, YOU ALL KNOW THAT. >> MOTION TO APPROVE, AND THERE'S A SECRETARY. AND ALL THOSE IN FAVOR SIGNIFY BY SAYING AYE. >> (CHORUS OF AYES) >> THANK YOU, BECAUSE THOSE TANKS ARE STRATEGIC WHEN WE GET TO THE HURRICANE SEASON. >> HOW MANY GALLONS DO THEY HOLD? >> 9,000 EACH. >> AND I'M DOWN TO LESS THAN 310 IN UNLEADED AND LESS THAN 910. >> THEY EACH HOLD 9,000 A PIECE AND I'M DOWN TO LESS THAN 310 IN UNLEADED AND I'M BELOW 920 IN DIESEL. >> OUT OF THE 9,000 THOSE TANKS HOLD? >> YES. >> SO THEY'RE PRETTY DRY. >> ALL RIGHT, SIR. >> AND BY 2030, YOU'LL BE TALKING, YOU KNOW, ELECTRIC VEHICLESES AND SO, MAY BE THESE ARE NOT THE, YOU KNOW, WOES OF THE FUTURE. >> YOU SEEN SOME OF THOSE 18-WHEELERS THEY'RE WORKING ON, ELECTRIC, IT'S INCREDIBLE. >> OKAY. >> AND BOATS FOR THAT MATTER. WE'RE GOING TO MOVE ON, SCOTT, BUT STICK AROUND, THERE ARE [6. Discuss and consider the allocation of the sales proceeds from the Alister Street property in Port Aransas to county projects.] OTHERS THAT COULD POTENTIALLY EFFECT YOUR COASTAL PARKS. THE NEXT ONE, DISCUSS AND CONSIDER THE ALLOCATION THE SALES AND PROCEEDS FROM PORT ARANSAS THIS IS THE SALE OF PROPERTY THAT THE COURT APPROVED MAY BE 2 WEEKS AGO FOR FINAL EXECUTION AND I MADE A SUGGESTION THAT SOME OF THOSE BE USED FOR THE BOARD WALK. THE GLO DOESN'T LIKE THE BAND AID, THEY WANT TO BE CERTAIN THAT THE BOARD WEEK BE COMPLETE. THAT'S SOME OF THE PROCEEDS. >> THE AMOUNT IS 925. THERE'S PROBABLY CLOSING COSTS. >> WE HAVE NOT CLOSED ON IT, BUT I'VE SIGNED ALL THE DOCUMENTS, YES. >> SO, JUDGE, MY STRONG FEELING ON THIS, AND THIS IS SIMILAR TO ONE PART OF THIS IS SIMILAR TO WHAT WE DID BEFORE WHEN WE BOUGHT OR WHEN WE SOLD THE PORT PROPERTY, WE WERE ABLE TO PUT A GOOD CHUNK OF THAT, IN OTHER WORDS, THAT WAS OVER $6 MILLION AND SO, WHAT I HAD BROUGHT FORWARD WAS TO PUT A PORTION OF THAT IN THE RESERVES TO BENEFIT THE COUNTY AS A WHOLE. ABOUT $3 MILLION OF THAT 6.WHATEVER ENDED UP GOING INTO THE COUNTY RESERVES, BASED ON MY REQUEST AND THE COURT'S ACKNOWLEDGING THAT. AND THAT'S WHERE THIS STEMMED FROM TOO. I THINK, ANYTIME THAT WE SELL LAND WE AUTO PUT SOME IN RESERVE AND THAT'S WHY I CAME UP WITH THE 35%. I THINK I PUT THAT 35% AND I WENT BACK AND FORTH ON THIS A COUPLE OF TIMES AND I'M LOOKING FOR MY BACKUP IN THE RESERVES AND ALSO HAD A STRONG FEELING THAT SOME OF THE MONEY SHOULD BE USED THAT WE GOT OUT OF PORT ARANSAS, IN PORT ARANSAS, JUST LIKE IF WE SOLD OTHER PARTS OF THE PROPERTY TO THE COUNTY THAT PART OF THE COUNTY SHOULD [02:25:01] BENEFIT AS WELL. SO, MY SUGGESTION ON THIS WAS TO ALLOCATE 35%. >> 35/65. THAT 35% GO TO RESERVES AND 65% BE ALLOCATED TO AN UNFUNDED PROJECT IN THE COASTAL PARKS AREA IN THE CITY OF PORT ARANSAS. >> CAN YOU GET THE GAS FROM THAT? >> FROM THAT MONEY THERE? >> WELL, I GUESS. >> WELL, TECHNICALLY, ARE YOU SAYING ON YOUR POSITION THAT 35% WOULD GO TO GF? >> SOT GENERAL FUND RESERVES. >> SO, 35%. TWO GENERAL FUND RESERVES. THAT'S WHAT I DID WITH THE PORT SALE I'M JUST TRYING TO BE CONSISTENT AND DO THE SAME THING AND PUT SOME OF IT TOWARDS THE GENERAL FUND RESERVES IN A MANNER THAT WE DID BEFORE. DALE FOUND A WAY TO DO IT WERE IT WAS... >> I DIDN'T REALIZE YOU COULD ALLOCATE TWO RESERVES. >> WE HAVE A BUDGET POLICY THAT REQUIRES US TO PUT SOME INTO A RESERVE ACCOUNT. >> WE WOULD HAVE TO CHANGE THAT COMMISSIONER. >> AND, I DON'T KNOW THE LEGALITIES OF DOING IT, BUT WE ENDED UP GETTING SEVERAL MILLION DOLLAR INTO THE RESERVES THAT WAY. AND THEN, UM, AGAIN, A LOT JUST TO THE COASTAL PARKS DEPARTMENT WITH APPROVAL BY THE COMMISSIONERS' COURT TO DO AN UNFUNDED PROJECT IN PORT ARANSAS. >> AND WHAT UNFUNDED PROJECT DO YOU THINK YOU MIGHT HAVE? CAN I ASK SCOTT CROSS OF WHAT UNFUNDED PROJECTS THAT WE HAVE? FOR THE COASTAL PARK? >> WELL, THE BOARD WALK NEEDS TO BE FIXED AT SOME POINT. >> IN PORT A? >> NO, IN PADRE. >> I DON'T HAVE ANYTHING RIGHT NOW, OTHER THAN THAT ELEVATED REST ROOM SHOWER FACILITY THAT WAS ON THE BEACH THAT WE DEMOED DOWN. >> WOULD YOU ACCEPT THAT AS THE PROJECT. I'M UNCOMFORTABLE WITH NOT DESIGNATING IT TO SOMETHING. BECAUSE, WE HAVE SO MANY CONCERNS AND ISSUES THAT ARE COUNTY WIDE AND WE NEED THE TIME VALUE OF MONEY IS NOW. IT'S NOW. >> I WAS JUST GOING TO GIVE THE COASTAL PARK'S BOARD TO WEIGH IN. BUT IF THAT'S WHAT SCOTT WANTS TO REPRESENT. >> WELL, SOMETHING LIKE THAT. >> SOMETHING WITH THE COASTAL PARKS. >> WE DON'T KNOW. WEE FEEL STRONGLY, ME AND BOARD FEEL STRONGLY THERE'S A WAY TO REPURPOSE THAT ELEVATED STRUCTURE, YOU DON'T WANT TO LOSE IT BECAUSE THE GLO WILL NEVER LET YOU PUT IT BACK THERE. >> HOW ABOUT, YOU MAKE YOUR MOTION AND I'M NOT CERTAIN THAT YOU COULD PUT INTO RESERVES, I THINK THAT YOU NEED TO SAY IT'S TO A SPECIAL REVENUE, BUT, THEN, I DON'T UNDERSTAND HOW YOU'RE GOING TO TAKE SPECIAL REVENUE AND GET INSIDE YOUR 25%. >> WE SUBSTITUTES SOME PROJECTS SUBJECT TO THE AUDITOR REVIEWING IT AND COMING UP WITH A WAY THAT'S LEGITIMATE. >> AND IF WE WANTED TO DESIGNATE IT TOWARDS THAT PROJECT, SUPERINTENDENT TO THE COASTAL PARKS. >> THAT'S AN IMPORTANT ONE. >> IS THAT THE BUILDING THAT YOU ARE TRYING TO FIX? >> NO. >> WE ALLOCATE THIS FOR A SPECIAL FUND. ACCORDING TO THE RESOLUTION THAT YOU Y'ALL PASSED DURING BUDGET CYCLE SAYS THAT I'M REQUIRED TO ACCOUNT FOR EVERY SALE OF ASSETS IN THAT FUND. >> I GUESS WHAT I'M SAYING IS THAT YOUR GOAL IS NOT ACHIEVABLE THE WAY THAT WE HAVE IT. THAT'S NOT POSSIBLE BY OUR OWN RULES. BUT, AGAIN, I DON'T KNOW HOW THAT WOULD WORK. >> ALL I'M TRYING TO DO IS PUT AN AMOUNT OF MONEY TO HELP THE COUNTY AS A WHOLE. WE'VE DONE IT BEFORE WHERE WE WERE ABLE TO FIGURE OUT HOW TO MOVE PROJECTS TO PUT MONEY INTO THE RESERVES, THE INTENT IS SIMPLY TO SPREAD THE WEALTH. THAT'S REALLY ALL THAT I'M TRYING TO DO IS TO TRY TO PUT SOME IN FOR THE REST OF THE COUNTY AND PUT THIS TOWARDS [02:30:05] A PROJECT IN PORT ARANSAS, BECAUSE IT'S MON COMING OUT OF PORT ARANSAS, JUST LIKE IF ROBERT GOT SOMETHING SOLD IN HIS PART OR JOHN DID, I WANT WANT THAT PART BENEFIT FROM THE SALE OF THAT SALE. >> WHY DON'T WE FOLLOW THE RULE WHICH IS YOU'RE GOING TO PLACE THE SALE OF ASSETS INTO THE SPECIAL REVENUE AS PER OUR OWN COURT POLICY AND IT'S SUBJECT TO AT LEAST THE COURT'S DIRECTIVE THAT 65% BE TRANSFERRED FOR A PROJECT THAT COASTAL PARK'S DETERMINES ONE THEY WOULD LIKE TO REPRESENT IN PORT ARANSAS. AND AT THAT 35%, I GUESS THERE MIGHT BE ON OPPORTUNITY FOR THE COURT TO USE THAT 35% REVENUE FOR ANOTHER PROJECT IN THE COUNTY. AND THAT'S THE ONLY WAY TO REALLY DO IT. >> YOU USED THE WORD TRANSFERRED. >> HE'S GOING TO ALLOCATE. WE GOT TO DO IT SOMEHOW. >> LET US BRING ANOTHER BUDGET CHANGE ORDER TO WORK ON THAT AFTER YOU CREATE THAT AWARENESS WITH YOUR PARK'S BOARD. TYPICALLY, TROY ADLER DOES LISTEN IN. TODAY, I THINK THE BEST MOTION IS INTENTION. GETS DOCUMENTED FOR THE CLERK. >> SO, THAT'S WHAT WE'RE DOING. >> FOR THE CLERK, I WOULD MAKE A MOTION, AND YOU'RE SAYING DADALE ALL OF THIS HAS TO BE INTO SPECIAL REVENUE. >> IF WE HAVE THE WAYS TO TRANSFER 35% OF THE GENERAL FUND WE CAN, WE NEED TO FOLLOW THE ORDER. >> I WOULD MAKE A MOTION TO ALLOCATE ALL THE SALES PROCEEDS TO THE SPECIAL REVENUE FUND WITH THE INTENT OF 65% OF THOSE WOULD BE THEN REALLOCATES SUBJECT TO THE AUDITORS APPROVAL AND THE OTHER 35% BEING ALLOCATED TO THE GENERAL FUND OR OTHER DEPARTMENTS IN OTHER COUNTIES THAT NEEDS FUNDS. >> I'LL SECOND THAT. >> OKAY. >> SEE, YOU DIDN'T EVEN KNOW WHY YOU WERE SAYING. ALL THOSE IN FAVOR, SIGNIFY BY SAYING AYE. [7. Discuss and consider status regarding Policy and Procedures for Wetlands Mitigation pursuant to engagement letter with Baker Wotring LLP executed January 22, 2020, and related matters.] >> (CHORUS OF AYES) >> THE NEXT ITEM IS POSTED AS DISCUSS AND CONSIDER STATUS REGARDING THE POLICY AND PROCEDURES FOR WETLANDS MITIGATION PURSUANT TO ENGAGEMENT LETTER WITH BAKER [8. Discuss and consider ratification of Premium Pay under the American Rescue Plan Act (ARPA) for law enforcement to include Constables and Sheriff in the Nueces County Collective Bargaining Agreement.] WOTRINGLLP. BYE THAT'S AN EXECUTIVE SESSION ITEM. THE NEXT IS THE ARPA PLAN FOR LAW ENFORCEMENT. >> >> JENNY, WOULD YOU HE WANTS TO KNOW WHY THERE'S CLARIFICATION ON THAT. >> I WANT CLARIFICATION ON WHAT WE DID. >> WELL, I THINK COMMISSIONER GONZALEZ PUT THIS ONE ON AND AS FAR AS ADVISING THE COUNTY ON ANYTHING, I THINK THAT YOU WOULD PROBABLY WANT TO HAVE THAT IN EXECUTIVE FIRST, BUT.... >> THIS IS JUST ON THE WETLAND'S MITIGATION? >> THE WETLAND'S MITIGATION AND THE MITIGATION BANK. THOSE ARE THE TWO THINGS WE HIRED HIM TO DO IN 2020 IN JANUARY. >> AND WE'RE GOING TO GET TO HEAR FROM HIM DURING EXECUTIVE SESSION SINCE IT'S A LEGAL DOCUMENT THAT HAS LEGAL IMPLICATIONS, IT WOULD BE A GOOD IDEA. >> I DON'T UNDERSTAND, WHY WOULD IT BE LEGAL, IF WE HIRED HIM TO DO TWO THINGS, ALL WE NEED FOR HIM IS TO PRESENT THOSE TWO THINGS DONE BACK IN 2020. BECAUSE WE PAID HIM IN OCTOBER OF 2020 THE FULL AMOUNT FOR CREATING THOSE TWO. AND I NEVER SEEN THOSE TWO. AND I'VE ASKED FOR A COPY OF THOSE TWO AND I HAVEN'T GOTTEN IT. SO, MY QUESTION IS STILL, WERE THOSE TWO ITEMS DONE? WERE THEY DONE, PRODUCED, CREATED? IF WE GOT A COPY OF IT, IT SHOULD HAVE A DATE OF 2020. >> SO, WE DISCUSSED THIS AT THE LAST TIME IT WAS BROUGHT UP, AND AN EXPLANATION WAS GIVEN THAT IT WAS BE IMPORTANT TO DISCUSS THESE ITEMS IN EXECUTIVE SESSION AS THEY CAN HAVE FUTURE IMPACT, ON IN THIS CASE, THE CEASE AND DESIST LETTER AND WE PROVIDED THAT EXPLANATION. >> (INDISCERNIBLE) >> THERE IS. >> THERE IS NOT. >> AND IT WAS PROVIDED TO US BY [02:35:04] OUR COUNSEL. >> I HAVE NO CONNECTION WITH A CEASE AND DESIST LETTER. >> IT HAS A LOT OF CONNECTION. >> IT WAS BACK IN 2020, WE HIRED HIM TO DO TWO THINGS AND I WANT THOSE TWO THINGS TO BE PRESENTED. >> I THINK WHEN YOU LET HIM HAVE A MOMENT TO EXPLAIN IN EXECUTIVE SESSION, YOU COULD GET THE ANSWERS TO YOUR QUESTIONS AND THE SPECIFICS. BUT, I HAVE LEGAL QUESTIONS THAT ARE OBVIOUSLY WOULD IMPACT NUECES COUNTY. SO, AT THIS TIME, WE'LL TAKE THAT INTO EXECUTIVE SESSION AND IF THERE'S AN OPPORTUNITY TO ADDRESS ITEMS IN OPEN SESSION, WE CAN AT THAT TIME. >> SO, I'M UNCLEAR ON THIS AS WELL, BECAUSE, TO ME, THERE'S A DEFINITE DIFFERENTIATION BETWEEN CEASE AND DESIST AND THE WELTLAND MITIGATION PLAN BECAUSE THERE WAS WHEN WE HIRED THE LAW FIRM AND I THINK I MADE THE MOTION THAT'S WHAT WE HIRED HIM TO DO WAS TO DO A MITIGATION PLAN. I DON'T KNOW WHERE THAT, NOT THE OTHER NOT THE OTHER STUFF. >> HOW ABOUT IF WE GO INTO EXECUTIVE SESSION, AND HE CAN EXPLAIN IT. >> WE'VE ALREADY GONE OVER THIS. >> NO, THIS IS JUST THE WETLAND MITIGATION. >> BUT THE WETLAND MITIGATION POLICY AS WAS EXPLAINED BY COUNSEL LAST TIME HAS POTENTIAL RAMIFICATIONS FOR THE MITIGATION THAT YOU HAVE A CONFLICT OF INTEREST IN. I THINK WE SHOULD PAUSE AND GO INTO THE EXPLANATION. >> I DON'T HAVE A CONFLICT OF INTEREST. >> IT WAS DONE BY IN 2020. I'M NOT ASKING FOR ANYTHING THAT HAPPENED IN 2022, I'M ASKING FOR THE THINGS THAT HE WAS SUPPOSED TO DO WHICH IS THE MITIGATION BANK AND THE POLICY FOR WETLAND MITIGATION. I HAVE NOT SEEN THOSE ITEM, THEY WERE PAID FOR IN 2020 AND I DON'T HAVE THEM. >> HE DID PROVIDE US WITH A PLAN THAT HE HAD. >> FIRST OF ALL, FOR THE RECORD, JUDGE, I DON'T HAVE A CONFLICT OF INTEREST, I'M VOLUNTEERING TO RECUSE MYSELF. SECOND, I DON'T WANT TO HAVE ANY DISCUSSION OUT HERE ABOUT THE CEASE AND DESIST LETTER, BUT, I DON'T THINK IT'S ATTORNEY/CLIENT PRIVILEGE TO BRING FORWARD A MITIGATION PLAN. >> WE'RE HAPPY TO DISCUSS THIS IN OPEN SESSION, BUT WE HAVE OR COUNSEL HERE AND HE CAN ADDRESS WETHER OR NOT TO TAKE THIS UP IN EXECUTIVE SESSION AND WHY. BUT YOU HAVE TO GO TO THE MICROPHONE AND WE CAN DO THAT. >> I JUST DON'T KNOW WHY WE CAN'T HAVE THAT DISCUSSION PUBLICLY ON THE MITIGATION PLAN. >> THIS IS ALMOST LIKE A RERUN. WE LITERALLY HAD THE SAME DISCUSSION. >> NO, IT'S NOT A RERUN, JUDGE, GO AHEAD. >> WHY CAN'T WE HAVE THE DISCUSSION ABOUT THE MITIGATION PLAN, NOT THE CEASE AND DESIST LETTER, BUT THE MITIGATION PLAN. WHY IS THAT SOMETHING THAT WE SHOULD BE CONCERNED ABOUT IN ATTORNEY/CLIENT PRIVILEGE. >> THAT'S A QUESTION THAT I WOULD LIKE TO ANSWER IN EXECUTIVE SESSION AND I WOULD LIKE TO REPORT ON THE OTHER MATTER IN THE EXECUTIVE SESSION BECAUSE THERE HAVE BEEN RECENT THINGS THAT HAPPENED THAT WOULD INFORM US ON THIS SITUATION. >> SO, THERE'S NOTHING THAT WE CAN DISCUSS ABOUT THE MITIGATION PLAN? JUST THE MITIGATION PLAN? >> WE MAY BE ABLE TO DISCUSS THINGS ABOUT THE MITIGATION PLAN IN OPEN SESSION, MITIGATION PLAN, I WOULD LIKE TO ADVISE THE COMMISSIONERS IN CLOSED SESSION ABOUT THE RAMIFICATIONS ABOUT THEIR DISCUSSING THESE ISSUES IN OPEN SESSION. IN OTHER WORDS, I NEED TO ADVISE THE COMMISSIONERS' COURT ABOUT WHAT I SEE AS THE ISSUES OF BRINGING THE MITIGATION PLAN UP IN THOSE OPEN SESSION... >> AND THEN THE COMMISSION CAN MAKE AN INFORMED DECISION ON THAT VARIATION. >> I'M SORRY, IS THAT THE SAME FOR THE POLICY THAT WAS SUPPOSED TO HAVE BEEN CREATED BACK THEN? WE WERE SUPPOSED TO HAVE DEVELOPED A MITIGATION POLICY FOR THE COUNTY. I NEVER SAW THAT. >> WELL, HE GAVE IT TO US A MONTH AGO. >> THAT WAS DATED MARCH 2022, I WANT TO SEE THE COPY HE DID IN 2020. WE PAID YOU IN 2020. >> IF THE COMMISSION IS TELLING ME THAT I NEED TO ANSWER QUESTIONS IN OPEN SESSION WITHOUT HEARING. >> IS IT YOUR ADVICE? >> CAN I FINISH? >> SURE. >> WILL YOU BE ABLE IN EXECUTIVE SESSION TO DISTINGUISH SO THAT I CAN LISTEN IN PART AND NOT BE INVOLVED IN PART. BECAUSE I DO NEED TO UNDERSTAND THE MITIGATION PLAN WHICH IS WHERE WE ALL STARTED ON THIS. SO, WOULD YOU BE ABLE TO SEPARATE THAT OUT, BECAUSE I WOULD LIKE TO KNOW ABOUT THAT [02:40:01] PART OF IT? >> I DO BELIEVE I CAN PARSE IT. AND YES, IT IS MY RECOMMENDATION TO THE COMMISSIONERS' COURT THAT BOTH ISSUES BE TAKEN UP IN EXECUTIVE SESSION CERTAINLY TO HEAR ABOUT MY REPORT ON THE OTHER MATTER. >> I CAN LIVE WITH THAT. >> AND WHAT YOU'RE ANSWERING RIGHT NOW, WHAT YOU ARE ADVISING US OR DIRECTING US, IS THAT ANY DIFFERENT THAN WHAT YOU ALREADY TOLD US? >> THERE'S BEEN A RECENT DEVELOPMENT. >> BUT YOUR RECOMMENDATION TO HOLD OFF ALL DISCUSSIONS, ISN'T THAT THE RECOMMENDATION TO KEEP IT IN EXECUTIVE SESSION FIRST, NOT TO HOLD BACK BUT FIRST TO ADVICE AND ALLOW PUBLIC DISCUSSION AS ALL EXECUTIVE SESSIONS ARE HANDLED. >> THAT IS CORRECT. >> WE'RE NOT FOLLOWING ANYTHING DIFFERENT. >> WITH REGARD TO THIS MATTER. >> WITH REGARD TO THIS MATTER. THANK YOU. >> ALL RIGHT. SO, WE'LL MOVE ON FOR RIGHT NOW, AND GO INTO ITEM 8 WHICH IS THE PREMIUM PAY. THIS IS A RATIFICATION OF WHAT WE ALREADY HAVE DONE. IT'S FOR THE LAW ENFORCEMENT, AND IT DOES INCLUDE THE CONSTABLES AND SHERIFFS IN NUECES COUNTY UNDER THE COLLCOLLECTIVE BARGAINING AGREEMENT THIS IS THE RATIFICATION OF THE PREMIUM PAY UNDER ARPA. >> THAT WAS A CLARIFICATION, I DON'T THINK WHEN WE DID IT BEFORE THE LAST MOTION IT WAS POINTED OUT THAT ALL THE MOTION THAT WAS MADE WAS FOR LAW ENFORCEMENT THAT WERE INCLUDED IN THE COLLECTIVE BARGAINING, AND THE INTENT WAS TO INCLUDE, MY INTENT WAS TO INCLUDE THE CONSTABLES AND THE SHERIFF IN THAT AS WELL. AND SO, THAT WOULD JUST BE MY MOTION WAS TO INCLUDE THE CONSTABLES AND SHERIFFS. >> SO, THE ELECTED OFFICERS, THE PROBLEM WITH THAT IS I THINK THERE WAS DISCUSSION AS TO WHETHER, I DON'T KNOW IF TREASURY GIVEN ADVICE BUT THEY EXCLUDED ELECTIVES FROM ARPA. >> THEY'VE BEEN GETTING PAID. >> WELL, I JUST KNOW THAT WE WERE WAITING ON THAT, WE HAD MADE A REQUEST SO THAT THE TREASURY WOULD UNDERSTAND IT. AND I THOUGHT THE SHERIFF ASKED TO BE EXCLUDED. IS HE ASKING TO BE INCLUDED? >> WHEN WE FIRST STARTED THE PREMIUM PAY, ALL AGREED TO BE PAID AND WE MADE THE PAYMENTS FOR PREMIUM PAY FOR THOSE PREMIUM PAY FOR INDIVIDUALS. I KNOW THAT WE'RE WORKING WITH THE TREASURY IF THAT IS AN ALLOWABLE EXPENSE. THE AMOUNT OF FUNDS ARE MINIMAL. >> RIGHT. I JUST WANT TO POINT OUT THAT HAGGERTY ADVISED US. >> I THOUGHT SOMEBODY. >> Y'ALL MADE SURE LAW ENFORCEMENT DIDN'T MEET THAT REQUIREMENT. >> I'M TALKING ABOUT THE SHERIFF. >> HE'S LAW ENFORCEMENT. >> I KNOW BUT DOESN'T BE MAKE THE $78,000. >> WE'RE NOT COUNTING LAW ENFORCEMENT FOR THE 150. >> THAT WAS THE COURT. >> WE DID THAT PIECE CORRECTLY, I WAS JUST WORRIED ABOUT WHERE WE ARE ON THE FINAL DETERMINATION. WE COULD ALWAYS COME BACK, I SUPPOSE, AND JUST PROVIDE THAT. BUT I JUST WANTED YOU TO KNOW THAT WAS A CONCERN. >> AND HAGGERTY GAVE US THE OKAY TO DO THIS INITIALLY. I'M HAPPY TO MAKE THIS MOTION SUBJECT TO. >> IF YOU DON'T MIND. >> SUBJECT TO THE AUDITOR AND THE COUNTY ATTORNEY THAT THIS IS LEGAL FOR US TO DO. I JUST WANTED TO INCLUDE THEM IN IT IF THEY COULD BE INCLUDED AND IF THEY CAN'T, SOMEBODY NEEDS TO EXPLAIN TO THEM WHY THEY CAN'T. >> WHAT HAGERTY HELPS US DO WAS OVERCOME THE 150 AND THE 78. >> LAST COURT WE HAD, WE MOVED THE COLLECTIVE BARGAINING FOR THE CADETS TO RETENTION PAY INSTEAD OF PREMIUM PAY. >> THAT'S CORRECT, THAT'S THE DISTINCTION. >> AND THAT WAS A NEW DISTINCTION MADE THE LAST TIME THAT WE DID IT BECAUSE PRIOR TO WHEN WE DID THIS FOUR OR FIVE MONTHS AGO, HAGERTY SAID WE COULD DO IT THE WAY WE COULD AND IT CHANGED. >> WELL, THE FINAL RULES CHANGED IN JANUARY. >> WE DID IT BASED ON HAGERTY'S ORIGINAL, I'M JUST SAYING, WHATEVER WE CAN DO, MY MOTION IS TO INCLUDE THEM IN IT, SUBJECT TO IT BEING OKAY TO DO. >> I THINK THAT'S FINE. WE'LL GET BACK TO YOU ON IT. >> ALL RIGHT. THAT WAY THEY KNOW THAT THE INTENTION IS THERE. >> RIGHT. >> ALL RIGHT. ALL THOSE IN FAVOR, SIGNIFY BY SAYING AYE. [9. Discuss and consider funding of repairs to office infrastructure at the Medical Examiner’s Office to provide a safe and efficient working environment, after the elevated use during the COVID-19 Pandemic, and other related matters.] >> (CHORUS OF AYES) >> THE NEXT IS THE FUNDING OF REPAIRS TORT OFFICE [02:45:02] INFRASTRUCTURE IN THE MEDICAL EXAMINERS OFFICE TO PROVIDE A SAFE AND WORKING ENVIRONMENT, AFTER THE ELEVATED USE DURING THE COVID-19 PANDEMIC. THIS WAS PART OF OUR DISCUSSION FROM LAST TIME. COMMISSIONER GONZALEZ IN >> WE VOTED ON THAT ONE. >> I AGREE, I THOUGHT WE DID THE $50,000 FOR THE CARPET AND PAINT AND SUCH. >> I THINK WHAT I MEANT ON THIS HERE WAS TO THE BACK THAT WE PROVIDED LAST WEEK, FOR THE (INDISCERNIBLE) I HAD GIVEN EVERYBODY A COPY OF IT, IT WOULD COST $5 MILLION TO ADD ANOTHER TEXT TO THE MEDICAL EXAMINER. AND DEMO THE MAIN BUILDING AND CREATE THE OFFICES THERE. SO, THAT WOULD REALLY UPGRADE THE MEDICAL EXAMINER'S BUILDING AND TO BE ABLE TO FUNCTION AND IF WE GET A NEW MEDICAL EXAMINER, THIS IS PROBABLY THE TIME TO DO IT. >> SO, ARE YOU INTERESTED IN SHOWCASING WHAT YOU HAVE RIGHT NOW? I HAVE MULTIPLE THOUGHTS HERE ON THIS, AND I WOULD LIKE TO SEE WHAT YOU HAVE AND... >> I GAVE IT TO YOU. >> NO, I'M TALKING JUANS GOING TO COME UP AND TALK ABOUT IT. THE ISSUE HERE, THAT'S WHAT'S GOING TO BE BETTER, HE'S GOT IT ON A THUMBDRIVE. THE ISSUE IS THAT THE MEDICAL EXAMINER'S OFFICE IS A MEDICAL FACILITY. AND WE HAVE A NEW MEDICAL EXAMINER COMING IN IN JULY AND IT SEEMS TO ME BEFORE WE DO ANYTHING HE SHOULD BE THE ONE WHO ASSIST US IN FORMULATING WHAT THIS OFFICE NEEDS FROM AN INFRASTRUCTURE POINT OF VIEW. IN ADDITION, WE ALREADY HAVE THE SMITH GROUP RETAINED. WE LITERALLY HAVE A CONTRACT WITH THEM, AND THEY'RE EXPERTS IN THE FIELD OF FORENSIC MEDICAL EXAMINER'S OFFICES. AND I DON'T UNDERSTAND HOW THIS HAPPENED, BECAUSE AGAIN, THERE WAS WITH NO CONSULTATION OF A MEDICAL PROFESSIONAL OR ANYBODY WHO HAS MEDICAL EXPERTISE, THIS IS PREMATURE BUT WELCOMED. IT'S WELCOME TO DO IT BUT IT'S PREMATURE. SO, WE ALREADY HAVE THE SMITH GROUP. AND I BELIEVE THAT THE HIRING OF CLK WAS VERY PREMATURE AND QUITE FRANKLY NOT DONE IN THE SPIRIT. >> (INDISCERNIBLE) >> WE DIDN'T SAY WE HIRED THEM. THEY'RE NOT HIRED, THIS IS WHY WE'RE PRESENTING THIS TO TALK ABOUT IT AND SEE WHAT WE'RE GOING TO DO. MAY BE WE NEED TO GO TO THE NEXT LEVEL AND GET. >> LET ME JUST SUGGEST THAT IF YOU'RE GOING TO USE FEDERAL FUNDS YOU HAVE TO FOLLOW THE FEDERAL RULES WHICH IS TO SEE IF OUR 200 WOULD REQUIRE THIS TO BE RFQ THE WAY WE DID IT WITH THE SMITH GROUP, WHICH IS THE COUNTY'S GO-TO ARCHITECTS ON THE MEDICAL EXAMINER'S OFFICE. THEY'RE THE ONES WITH THE EXPERTISE, I'M HAPPY TO SEE IT AND DISCUSS IT, BUT I'LL ASK THAT THIS BE TABLED BECAUSE IT DOESN'T EVEN HAVE THE BLESSING OF OUR CURRENT CHIEF MEDICAL EXAMINER WHO HAS BEEN HIRED TO COME IN IN JULY. AND WE HAVE NOT MADE AN ANALYSIS OF WHETHER THIS WOULD BE CHASING, YOU KNOW, PUTTING GOOD MONEY IN A BAD BUILDING. SO, I THINK... >> IT'S NOT A BAD BUILDING. >> I THINK IT'S BEEN ANALYZED BY ENGINEERS TO BE A BAD BUILDING, IT'S BEEN RANKED AS A HIGH PRIORITY. IT'S BEEN RANKED AS A BUILDING THAT NEEDS TO BE REPLACED AND SO I HAVE CONCERNS ABOUT PUTTING IN THAT AMOUNT OF MONEY TO THIS PLAYING AND NOT A NEW BUILDING. BUT, I AGREE IF THERE'S INFRASTRUCTURE PROBLEMS WE WOULD WANT TO CORRECT THOSE. BUT, AGAIN, WE WENT THROUGH THE TIME, TROUBLE, AND EXPENSE OF HIRING THE SMITH GROUP AND I DON'T UNDERSTAND HOW CLK GOT BROUGHT ON BECAUSE IT DOESN'T MEET THE FEDERAL REQUIREMENTS. AND IT DOESN'T IT'S NOT IN THE SPIRIT OF WORKING THIS NEW CHIEF WHO WANTS TO WHETHER A NEW OFFICE. I WOULD ASK THAT WE LIST TO JUAN, BECAUSE HE'S GONE THROUGH THE TROUBLE BUT THAT YOU TAKE ALL OF THESE GREAT PLANS AND ON JULY 18TH YOU WORK WITH OUR NEW CHIEF MEDICAL EXAMINER IF HE THINKS THIS IS GREAT. WHY WOULD HE PRESUME, WE'RE NOT DOCTORS, WE HAVE NOT RUN A MEDICAL FACILITY, YOU EITHER NEED TO FIND SOMEBODY WHOSE DONE THAT KIND OF WORK, WHICH, GUESS WHAT, WE ALREADY DID AND HIRED [02:50:01] THEM. OR HAVE THEM WORK WITH THIS GROUP IN CONJUNCTION WITH THE MEDICAL PROFESSIONALS. AGAIN, JUAN, GO AHEAD. >> JUDGE AND COMMISSIONERS, THIS IS SOME EXHIBITS THAT CLK PUT TOGETHER. THE FIRST EXHIBIT IS THE EXISTING CONDITIONS OF THE FACILITY. WHERE YOU HAVE THE AUTOPSY AND THE ADMINISTRATION, WHERE YOU COULD SEE THE BLUES IS WHERE THEY TO THE AUTOPSY AND THE ORANGE ON THE BOTTOM PART IS MORE THE ADMINISTRATION OFFICES WHERE THEY HAVE THE CONFERENCE ROOM AND MAIN ENTRANCE. THE SECOND EXHIBIT IS JUST A BLOW UP OF THE EXISTING FACILITY, AND IT'S APPROXIMATELY 5,000 SQUARE FEET TOTAL. AND THE NEXT EXHIBIT, PLEASE, IS IN TALKING WITH CLK, THIS IS THE PROPOSED, ON THE LEFT-HAND SIDE WOULD BE THE PROPOSED FACILITY WHICH IS A LITTLE OVER 5,000 SQUARE FEET, BUT THIS WOULD BE WHERE ALL THE AUTOPSIES, NEW REFRIGERATION, AND IT ARE WE WOULD BE ABLE TO TIE IN THE NEW FACILITY WITH THE EXISTING FACILITY AND COME BACK AND PHASE OUT THE EXISTING FACILITY TO CREATE OFFICE SPACES. AND YOU COULD LOOK AT THE BOTTOM PART WHERE THE SQUARE FOOTAGE ON THE TABLES, THE ADMINISTRATION BUILDING WOULD BE 5,000 SQUARE FEET BASED ON PHASE ONE AND PHASE 2. AND THEN THE AUTOPSY WOULD BE 6600 SQUARE FEET. THIS SHOWS A SEQUENCE OF CONSTRUCTION IF THE BOARD WOULD GO THIS ROUTE IN OTHER WORDS, YOU WOULD DO THE AUTOPSY OF THE NEW BUILDING AND TIE IT INTO THE EXISTING BUILDING AND RECOMMEND TO PHASE IT OUT WITH THE RED AND START TO DEMO THAT PORTION OF THE EXISTING FACILITY. I'M SORRY, THE BLUE PORTION AND THEN COME BACK AND DO THE RED PORTION OF THE EXISTING FACILITY TO CREATE A NEW OFFICE SPACE. AND THIS IS THE LAYOUT WHERE YOU DO THE TOP PART OF THE EXISTING FACILITY, YOU COULD COME BACK AND RENOVATE THE BOTTOM TO CREATE OFFICE SPACES AND A CONFERENCE ROOM. ON THE FIRST PART, THEY WOULD CREATE A BREAK ROOM SOME ADMINISTRATION OFFICES. AND THIS WOULD BE THE WHOLE NEW FACILITY TOGETHER IN OTHER WORDS YOU WOULD HAVE A NEW BUILDING TIDE WITH THE EXISTING FACILITY TO THE ADMINISTRATION OFFICES. AND THIS THIS IS A RECOMMENDATION OF THE PARKING LOT. YOU WOULD CREATE NEW PARKING LOTS IN FRONT OF THE EXISTING FACILITY AND ALSO THE NEW FACILITY AND REPAVE THE SURROUNDING OF THE FACILITY ITSELF, IN OTHER WORDS, CLEAN UP THE PAVEMENT. AND THE COST ESTIMATE OPINION OF PROBABLY COST BASED ON CLK TO RENOVATE AND TO DO A BRAND NEW BUILDING, YOU'RE LOOKING AT ABOUT $5 MILLION. AND BY THE TIME YOU PUT IN ALL THE NEW EQUIPMENT, AND NEW OFFICE DESK, AND FURNITURE, AND DO SOME TESTING FOR ENGINEERING AND ALSO FOR THE ARCHITECT, YOU'RE LOOKING AT A TOTAL OF $7 MILLION. >> 7? >> YES, SIR. >> JUAN. >> AND REAL QUICK, I KNOW WE TALKED ABOUT THE PREVIOUS WORK, OR THE WORK THAT WE'RE GOING DOING RIGHT NOW IS PART OF THE SEMI-RENOVATIONS OF THE FACILITY WHERE WE'RE GOING IN AND DOING THE GRIDS, NEW PAINTING, FLOORING, LIGHTING, I THINK RIGHT NOW, WE'RE TOTALLING UP TO ABOUT $46,000 AND KIND OF. >> YES, SIR? >> AND I THINK THAT WE'RE LOOKING AT THE EXISTING FACILITIES AND REPLACING AWNINGS, SOME ADDITIONAL COST. WE'RE LOOKING AT ALSO DOING PAVING WORK, WE'RE ON THE BACK [02:55:02] END OF THE BUILDING, SO THAT WAY WHEN THEY'RE DRIVING UP WE DON'T HAVE THE POT HOLES AND CLEAN IT UP AND ALSO DO PARKING IN THE FRONT, MAKE IT ADA AND MAKE SURE THAT WE'RE MEETING THOSE REQUIREMENTS. AND THAT'S NOT INCLUDING THE 46 THAT YOU HAD, AND WE'RE CLEANING UP THE FENCE AND THE GATE OPERATOR. COMMISSIONER, I KNOW THAT WASN'T PART OF THE ITEMS DISCUSSED LAST TIME, BUT WE'RE ALSO GOING IN THERE AND REPLACING THE SWIPE CARDS. AND ALSO THE FENCING IN THE BACK THAT'S LEANING. WE'RE GOING TO LEAN IN THERE AND START TO FIX THAT UP AND RESTRETCH THE WIRE. AND THEN, ALSO, THE LANDSCAPING. WE'RE GOING TO GO BACK THERE AND TAKE OUT OF ROCK THAT'S AROUND THE BUILDING. PUT IN SOME IRRIGATION, AND PUT IN NEW GRASS AND SOME LANDSCAPING TO KIND OF CLEAN IT UP A BIT. YOU LOOK AT THE TOTAL COST, YOU'RE LOOKING UNDER $100 TOTAL. >> SO, THE FIRST $46,000 WE'VE APPROVED? >> YES, MA'AM. >> AND SO YOUR ASKING FOR THE ADDITIONAL $46,000 TODAY? I MEAN, NOT $46,000, BUT WHATEVER IT IS, THE DELTA OF ALL OF THE OTHER ITEMS. >> I WOULD SAY TOTAL ABOUT $100,000. >> TOTAL. YOU LESS. >> AND HAVE YOU HAD THE OPPORTUNITY TO CHECK WITH DALE OR TERESA WHERE THAT $50,000 MAY COME FROM? >> NOT JUST YET. WE DETERMINED WHAT WE CAN DO IN ORDER TO GET IT. >> SO, DALE DO YOU HAVE A SOURCE, BASICALLY, WE HAVE APPROVED $50,000, IS THERE ANOTHER OPPORTUNITY HERE FOR THIS 50 THAT JUAN IS MENTIONING FOR INFRASTRUCTURE IMPROVEMENTS. >> NORMALLY, IT WOULD COME OUT OF BUILDING FUNDS FOR MAINTENANCE AND REPAIR SERVICES. THE LAST TIME I LOOKED. THAT ONE'S GETTING SHORT OF FUNDS. SO, THE FUNDS WE WOULD HAVE TO FIND THEM AND (INDISCERNIBLE) >> WOULD YOU BE WILLING TO, YOU KNOW, WE CAN, AGAIN, LOOK, AT LEAST GIVE US THE OPPORTUNITY SINCE WE DIDN'T KNOW WHAT THE DOLLAR AMOUNT WAS UNTIL RIGHT NOW, GIVE US A CHANCE TO FIND THOSE EXTRA $50,000 TO PUT ON AN AGENDA ITEM NEXT COURT FOR APPROVAL. >> JUDGE, IF I CAN RECOMMEND, I KNOW WE'RE GETTING LOW ON BUILDING FUNDS, BUT, IF I COULD USE OUR BUILDING FUNDS, WE'LL TAKE CARE OF THE ADDITIONAL $50,000. >> OKAY. THAT SEEMS FAIR. I'LL MAKE THE MOTION TOO... >> JUST TO KEEP THE PROCESS GOING. >> RIGHT. MY ONLY CONCERN HERE IS THAT I DIDN'T GET TO HEAR -- YOU'RE GOING TO DO MOST OF THE WORK INHOUSE? >> WE'RE GOING SOME INHOUSE AND SOME DONE BY CONTRACTORS, THAT WAY WE CAN GET THE PROJECT, OUR GUYS ARE BUSY RIGHT NOW, SO, WE'RE GOING TO TRY AND GET THIS DONE BY CONTRACTORS. >> BY CONTRACTORS? >> YES, MA'AM. >> THERE MAY BE A SPLIT BECAUSE I WAS HEARING THERE'S REPAIR OF THE ROADS AND STUFF. AND THAT'S A DIFFERENT FUND. THE OTHER ONE IS EQUIPMENT, AND THEN BUILDING AND GROUNDS. >> AND I DON'T THINK THIS IS A PROBLEM, BUT ONE OF MY QUESTIONS IS, SO WE OWN THE BUILDING BUT WE DON'T OWN THE LAND. >> RIGHT. >> SO, THINK THAT I'M CERTAIN THEY WOULD BE HAPPY FOR THE UPGRADE, BUT, WOULD YOU ALSO PLEASE COORDINATE WITH THE HOSPITAL DISTRICT, BECAUSE THEY OWN THE LAND. AND, THEY WOULD NEED TO BE CONSULTED IN ALL OF THIS EFFORTS. BUT, AS FAR AS THE TOTAL $100,000, WHICH IS REALLY JUST $50,000, BECAUSE THE COURT ALREADY APPROPRIATED THE $50,000 LAST COURT, HOW ABOUT IF WE MAKE THE MOTION THAT WE APPROVE OF THE WORK SUBJECT TO A LITTLE BIT OF REFINEMENT OF HOW THESE DOLLARS WILL COME AND YOU CAN REPORT ON THAT NEXT TIME. >> YES, MA'AM. I'LL COORDINATE WITH DALE AND THE HOSPITAL DISTRICT. THAT'S MY MOTION, IS THERE A SECOND? >> SECOND. >> AND ALSO THE HOSPITAL DISTRICT KNOWS. I ALREADY MET WITH THEM. HE'S GOT EVERYTHING THAT WE HAVE. THEY'RE GOING TO LOOK AT IT. >> OKAY. WELL, AT ANY RATE, JOHNNY'S NOT THE BOARD. THE BOARD NEEDS TO BE AN AGENDA ITEM. (OVER (OVERLAPPING SPEAK) >> ALL THOSE IN FAVOR, SIGNIFY BY SAYING AYE. >> THE MOTION, COMMISSIONER, IS LAST COURT WE APPROVED $50,000 [03:00:03] FOR WHAT I CALL, THE PAINT AND CARPET, THE CEILING TILES AND FLOORING, NOW, THIS MOTION IS TO DO THE ADDITIONAL INFRASTRUCTURE PIECES THAT WOULD INCLUDE IRRIGATION, PAVING, AWNINGS, LANDSCAPING, CLEANING OF THE FENCE, JUAN, WHAT ELSE DID I MISS? >> THE CARD READERS. >> AND THE FUNDING SOURCE WAS? >> JUAN IS GOING TO WORK ON HIS, HE'S GOING TO DO A PARSELING OF THE ROAD FUND FOR THE PAVEMENT AND THE BUILDING MAINTENANCE FOR THE BUILDING. >> I'M GOOD. THANK YOU. >> AND I HAVE THE MOTION AND GONZALEZ HAS THE SECOND. >> ALL THOSE IN FAVOR SIGNIFY BY SAYING AYE. (CHORUS OF AYES) >> THANK YOU. >> ALL RIGHT. AND THEN THE NEXT I'M ACTUALLY GOING TO ASK THE COURT TO RECOGNIZE THAT AT 1:00 WE HAVE A SCHEDULED INTERVIEW AND THIS IS A GOOD TIME TO TAKE A BATHROOM BREAK FOR EVERYBODY. IT IS 12:57 BY THE WAY, THAT PARTICULAR ITEM IS NOTICED. GIVE ME A SECOND TO FIND IT. >> IN EXECUTIVE ONLY. >> OKAY. >> SO, I'M GOING TO HAVE TO GO INTO EXECUTIVE SESSION. SO, LET ME DO ALL OF THAT RIGHT NOW. IT'S 12:57 P.M., FOR THE RECORD, AND I'M GIVING NOTICE THAT COMMISSIONERS' COURT'S GOING INTO EXECUTIVE SESSION TO DISCUSS MATTERS LISTED ON THE AGENDA. WHEN AUTHORIZED BY PROVISIONS TEXAS MEETING ACTS OF 551. >> SO, JUDGE ARE WE DOING ALL THE EXECUTIVE SESSION ITEMS? >> I'M GOING TO DO THE POO. I'M OPEN TO BOTH, I JUST WANT TO BE SURE TO GIVE THE MAGIC WORDS AND WE CAN HAVE OUR PICK. >> JUST SO THAT EVERYBODY KNOWS WHAT TO EXPECT. I'M FINE WITH DOING THE PIO AND COMING BACK OUT. I WANT TO LET THE AUDIENCE AND PEOPLE KNOW HOW LONG WE'RE GOING TO BE IN THERE. >> HOW MANY PIOS ARE WE ENTER VIEWING? >> JUST ONE. >> BUT IF WE'RE ALL TOGETHER, WE SHOULD DO EXECUTIVE SESSION. >> I THINK WE SHOULD. [4. EXECUTIVE SESSION: PUBLIC NOTICE is given that the Commissioners Court may elect to go into an Executive Session anytime during the meeting to discuss matters listed anywhere on the Agenda, when authorized by the provisions of the Open Meetings Act, Chapter 551 of the Texas Government Code. UPON COMPLETION WE CAN TAKE ANY ITEM UP IN OPEN SESSION THAT IS DEEMED PROPERTY ON ITEMS DISCUSSED IN EXECUTIVE SESSION. AND AGAIN, I THINK THAT I MENTIONED IT, IT'S WAR ON BACK ON THE RECORD CARE IF THAT'S OKAY FOR .40 7 PM. WORK COMING OUT OF EXECUTIVE SESSION. I'M GOING TO CALL, ALL TRIED TO DO IT IN SOME SEMBLANCE OF ORDER. ALTHOUGH THERE ARE SOME TABLES AS WELL.THERE'S A MOTION TO TABLE ITEM C AND D AT THIS TIME. [11. Discuss the removal of courtroom chairs from the Nueces County Courthouse and related matters.] AS HER SECOND? >> I'M SORRY TRAGICALLY HEAR YOU. >> ITEM C AND D ON EXECUTIVE SESSION AND THEY CORRESPOND CARA WITH AGENDA ITEMS, AGENDA ITEMS 11 AND 12. SO THE MOTION IS TO TABLE AT THIS TIME. >> PROBABLY 13 ALSO. >> AND 13. >> ARE ALL KIND OF RELATED. >> SO WE WILL TABLE THOSE. >> JUST FOR THE RECORD THERE'S NO AVAILABILITY OF THE PERSON RELATED TO THAT ITEM TO BE HERE. >> THAT IS CORRECT. UNTIL THE 25TH. DUE TO THAT, YEAH. CORRECT. IS THERE A SECOND? I DON'T KNOW IF I HEARD IT. >> THERE WAS, ALL THOSE IN FAVOR SIGNIFY BY SAYING I APPEARED OKAY, THERE IS AN ACTION ON CASE NUMBER 221 CB 210, GEORGE MARTINEZ VERSUS NUECES COUNTY. IS THERE A MOTION REGARDING THE SETTLEMENT DEMAND? >> MOTION TO REJECT. >> ALL RIGHT, I WILL SECOND. [03:05:03] AND TO ALLOW THE COUNTY ATTORNEY TO CONTINUE, CORRECT? >> YES. >> OKAY. ALL THOSE IN FAVOR SIGNIFY BY SAYING I APPEAR. >> OR YOU GO TO TABLE 14 ALSO? >> YES A GOOD TABLE ITEM NUMBER 14 WHICH WAS ALSO BROUGHT INTO SECOND EXECUTIVE SESSION CARA. >> MOTION. >> I WILL SECOND. ALL SIGNIFY PRICING G I. >> SO BACK ON REGULAR AGENDA CARA I WILL COME BACK OVER THERE. ON REGULAR AGENDA THAT TAKES CARE OF 10, 11, 12, 13, 1415 AND 16. 16 WAS A GEORGE MARTINEZ OKAY JUST FOR CLARITY. ARE YOU WITH ME? THAT CLEAR CERVICAL AGENDA. NONE WOULD GO BACK TO EXECUTIVE SESSION AND TELL YOU THAT THERE IS ALSO WELL, HOLD ON. IT'S THE NEXT ONE. WE CAN TAKE IT UP WHEN WE GET TO HUMAN RESOURCES OR WE CAN DO IT NOW. ON THE PIO. THAT'S A HUMAN RESOURCES. YOU WANT TO WAIT UNTIL WE GET THERE? >> WE DID DECIDE WHAT TO VOTE. >> THERE'S AN AGENDA ITEM F1. DO YOU WANT TO DO IT WILL BE GET TO F1? >> SURE. >> THAT'S MOVED TO GRANTS. THERE'S NO WITH HER ACTION BY THE WAY THAT I SEE. >> YOU CAN BRING BACK 7 OR NO? >> HOLD ON. I FORGOT 7. 7 IS THAT, WELL WE SAID THE DIRECTIVE IS TO BRING BACK ON THE 25TH OR AS SOON AS POSSIBLE. SORT OF THE PROS AND CONS IF YOU WILL OF A MITIGATION POLICY FOR NUECES COUNTY OUTLINING ? WORKS ALSO ITTEN, SHOOT. ARE YOU GONNA PUT IT IN WRITING? THE LITIGATION? >> RIGHT. HIS CLOSE BUT THAT TO THE COUNTY ATTORNEY. OKAY. IT'S NOT REALLY, HE IS GOING TO BRING IT BACK TO US ON THE 25TH. OR WHENEVER THE COUNTY ATTORNEY IS READY TO NOTICE IT AGAIN. I THINK I PREFER THAT. >> THANK YOU. [1. Discuss and consider approval of Amendment No. 1 with the Texas Water Development Board related to Master Plan Drainage Study.] >> THEN WITH THAT WE ARE GOING TO MOVE TO GRANTS. THERE IS AN APPROVAL OF AMENDMENT NUMBER ONE WITH THE TEXAS WATER DEVELOPMENT BOARD RELATING TO THE MASTER-PLANNED DRAINAGE STUDY. THIS IS A REQUEST FROM TEXAS WATER DEVELOPMENT BOARD TO AMEND BY THIS AMENDMENT TO CLEAN UP SOMETHING IN THE ORIGINAL CONTRACT DOCUMENT WHICH WAS THE LANGUAGE ON GEOGRAPHIC IDENTITY FOR D, D2. THEY CONSIDERED THE CITY OF DRISCOLL IN D, D2. THAT'S NOT CORRECT. >> WAS CORRECT. THAT'S WHAT IT WAS SUPPOSED TO BE. WE TOOK HIM OUT, SOMEONE TOOK AMOUNT. THE ORIGINAL ONE WAS AS INCLUDED. >> THIS IS A REQUEST BY THE WATER DEVELOPMENT BOARD AND IN ORDER FOR THE CONTRACTORS TO GET GOING AND GET PAID OVER DOING IS THE MINISTERIAL ACT. WHAT HAPPENS IS ALL STATE AGENCIES USE DOC YOU SIGN SO IN ORDER TO CREATE THE AMENDMENT. >> ARE YOU GONNA ELIMINATE TO SCHOOL? >> THERE'S NO ELIMINATION. IT'S JUST MAKING CERTAIN THE GEOGRAPHICAL RESTRICTION IS INCLUDED INSIDE THE AMENDMENT. IT'S TO HELP AND IT'S THE REQUEST OF WATER DEVELOPMENT BOARD. THEY PROVIDED THE INFORMATION TO PUBLIC WORKS. AND, TO US. AGAIN, IT'S VERY IMPORTANT THAT WE CLEANED IT UP SO THE PEOPLE CAN GET STARTED ON THEIR CONTRACTS. I MEAN IT'S A MINISTERIAL AT BEST. IT'S JUST ASKING US TO CORRECT IT. >> THERE THE ONE THAT REQUESTED IT? >> ABSOLUTELY. THEY ARE REQUESTING IT. THEY SAID THEY MADE AN ERROR IN THE DOC YOU SIGNED VERSION AND THEREFORE IN ORDER TO SEND US A NEW DONKEY SIGN A NEED TO ACKNOWLEDGE THEY WILL SEND THE CITY DOC YOU SIGN THAT'S WITH THIS AMENDMENT NUMBER ONE DOES. IT'S OUT LONG AND THE BACKUP TION TO MAKE THE MOTION TO GET THIS TO WATER DEVELOPMENT BOARD [03:10:07] AND OF COURSE ONCE WE SIGN IT YOU WILL GET ANOTHER COPY OF IT. IT'LL BE AGENDA ITEM AS FINAL EXECUTION. IS THERE A SECOND? [1. Discuss and consider adopting a resolution approving entering into an advance funding agreement with the Texas Department of Transportation (TxDOT) for the 2020 Highway Safety Improvement Program (HSIP) projects awarded to Nueces County; authorize the recommendation of bidding Nueces County HSIP Projects.] >> SECOND. >> ALL THOSE IN FAVOR SIGNIFY BY SAYING I APPEARED OKAY, ON PUBLIC WORKS. YOU ARE UP ONE WITH T. REGARDING RESOLUTION TO APPROVE ADVANCE FUNDING FOR THE HSF PROGRAM AND THE PROJECTS WE ARE AWARDED TO NUECES COUNTY. >> THAT'S CORRECT JUDGE. THIS IS AN AGREEMENT BETWEEN THE COUNTY AND TEXT ON. THESE ARE FOR PROJECTS TO PUT SOME ADVANCE WARNING SIGNS ON SOME OF OUR COUNTY ROADS. THIS IS A GRANT HONEY THAT WAS LAST YEAR THAT WAS PROVIDED TO THE COUNTY FOR THIS PURPOSE. OR RECOMMENDING THE ADVANCED FUNDING TO AGREEMENT. >> ALSO IT'S A SECOND PART AND YOU'RE ALSO ASKING US TO RECOMMEND, TO AUTHORIZE THE RECOMMENDATION OF BIDDING OF THESE PROJECTS. >> THAT'S CORRECT JUDGE. RECOMMENDING THEM FOR BIDDING THE PROJECT. THE BIDDING PROCESS IS HEADED BY TECH STOCK. >> CORRECT. IT'S A 2-FACED MOTION AND I WILL MAKE THE MOTION TO DO BOLD TO ENTER INTO THE ADVANCED FUNDING AGREEMENT WITH TEXT ON AND AUTHORIZE THE RECOMMENDATION OF THE BIDDING PROCESS. THERE IS A MOTION AND A SECOND. ALL THOSE IN FAVOR SIGNIFY BY SAYING I APPEARED OKAY IF YOU WILL RECALL EARLIER T-1 WAS PLACED INTO CONSENT. IF RTE TERMINATED THAT ITEM. THE FEMA ALLOWS FOR AND FEMA 100 PERCENT PROVIDED FOR IT. THAT TRANSACTION YOU'VE REGISTERED YOUR VOTE. THIS IS THAT FINANCIAL REPORT THAT ACCURATELY REFLECTS WHAT HAPPENED IN THE MONTH OF SEPTEMBER. UPSTATE IF YOU DON'T WANT TO APPROVE THE MONTHLY FINANCIAL. I AGREE THAT IT'S SILLY TO NOT APPROVE THAT WHICH IS REAL. THIS IS THE ACTUAL REPORT OUR AUDITOR IS PRESENTING TO US. >> THAT'S FINE I WILL ABSTAINING. >> OKAY. SORRY I THINK HE HAD IT TABLED SO I'VE GOT TO GO BACK. A MOTION AND A SECOND. SOME HAS BEEN REIMBURSED AT SOME HAS NOT BECAUSE IT'S IN THE PORTAL. >> SO NOT ALL OF IT HAS BEEN REEFED REIMBURSED? >> AGAIN, THERE'S CONFUSION. THIS IS A REPORT RATELY REFLECTS WHAT OUR EXPENDITURES ARE. THAT'S ALL THIS REPORT IS. IF YOU WANT MORE E AND THAT'S THE TABLE. THAT'S A MOTION. >> LET ME ASK FOR LEGAL CLARIFICATION WHAT IF WE DO NOT ACCEPT THIS REPORT? WHAT DOES THAT MEAN? IN OUR NEXT MEETING WE FINALLY GET TO VOTE ON IT AND SAY MAJORITY VOTES AGAINST IT.
