WE ARE IN THE THIRD FLOOR OF COMMISSIONERS COURT ROOM, NUECES COUNTY COURTHOUSE 901 LEOPARD. I DO SEE WE HAVE COMMISSIONER HERNANDEZ, MAREZ AND MYSELF PRESENT IN COURT, VIRTUALLY HAVE COMMISSIONER CHESNEY AND COMMISSIONER GONZALES.

AT THIS TIME, I WOULD ASK THAT, JUST FOR THE RECORD I DO CERTIFY THEN A QUORUM IS PRESENT WITH THE THREE OF US HERE UNDER THE NEW RULES. I WOULD LIKE TO SEE IF THERE'S ANY PUBLIC COMMENT AT THIS TIME. HAVING NO PUBLIC COMMENT, IN THE COURTROOM, OR NONE VISIBLE ONLINE OKAY. WE WILL MOVE TO EXECUTIVE

EXECUTIVE SESSION: PUBLIC NOTICE is given that the Commissioners Court may elect to go into an Executive Session anytime during the meeting to discuss matters listed anywhere on the Agenda, when authorized by the provisions of the Open Meetings Act, Chapter 551 of the Texas Government Code. To the extent there has been a past practice of distinguishing items for public deliberation and those for executive session, the public is advised that the Court is departing from that practice, and reserves the right to discuss any listed agenda items in executive session when authorized by law to do so. In the event the Commissioners Court elects to go into Executive Session regarding an agenda item, the section or sections of the Open Meetings Act authorizing the Executive Session will be publicly announced by the presiding officer. In accordance with the authority of the Government Code, Vernon’s Texas Codes, Sections 551.071, 551.072, 551.073, 551.074, 551.0745, 551.076, 551.086, 551.087, the Commissioners Court will hold an Executive Session to consult with attorney(s) including matters related to litigation; deliberate regarding real property, prospective gift(s), personnel matters, including termination, county advisory bodies, security devices, and/or economic development negotiations and other matters that may be discussed in an Executive Session. Upon completion of the Executive Session, the Commissioners Court may in an open session take such action as appropriate on items discussed in an Executive Session.]

SESSION. AND THEY DO GIVE NOTICE AT THIS TIME THAT WE WILL GO INTO EXECUTIVE SESSION FOR THE PURPOSES OF DISCUSSING MATTERS LISTED ON THE AGENDA AND IS AUTHORIZED BY CHAPTER 505 ONE, THE OPEN MEETINGS ACT. WE ALSO DO SO TO CONSULT WITH OUR ATTORNEY. THE SECTIONS OF THE OPEN MEETINGS ACT THAT AUTHORIZED EXECUTIVE SESSION ARE PUBLICLY ACKNOWLEDGED BY THE PRESIDING OFFICER, MYSELF.

THAT IS SUBJECT TO THE AUTHORITY OF GOVERNMENT CODE SECTION 551, 071, 7273, 74, 76, 86, 87. WE WILL CONSULT WITH LAWYERS INCLUDING MATTERS RELATING TO LITIGATION, REAL PROPERTY, GIFTS, PERSONNEL, TERMINATION, COUNTY ADVISORY BODIES, ALL OUR PERMISSIBLE NEGOTIATIONS AND OTHER MATTERS THAT MAY BE DISCUSSED IN EXECUTIVE SESSION.

UPON COMPLETION OF THE EXECUTIVE SESSION, THE COMMISSIONERS COURT WILL COME BACK INTO OPEN SESSION AND TAKE ANY APPROPRIATE ACTION AS DEEMED NECESSARY.

I BELIEVE TODAY IS CONSULT, WITH COUNTY ATTORNEY AND LAW OFFICE OF STEVE ARAGON. RIGHT NOW IT IS 8:11 AM, I ASKED THAT WE GO INTO EXECUTIVE SESSION

IT WAS A CONSULT ONLY OPPORTUNITY WITH OUR ATTORNEYS AND SO AT THIS TIME I AM ANNOUNCING THERE IS NO ACTION THAT WE WILL BE TAKING OUTSIDE OF EXECUTIVE SESSION.

HOWEVER, I WOULD LIKE TO ASK FOR ADJOURNMENTS IN MEMORY AND I HAVE ONE.

ALTHOUGH I JUST WANT TO MAKE THE ANNOUNCEMENT AND THEN WE WILL PROPERLY HAVE ALL OF THE I WOULD SAY, THE PROPER ADJOURNMENT IN MEMORY IN THE NEXT COURT NOVEMBER 30.

JUST EXPRESS ON BEHALF OF NUECES COUNTY COMMISSIONERS COURT AND NUECES COUNTY EXTENDED FAMILY MOST ESPECIALLY THE BAR ASSOCIATION, OF WHICH I'M A MEMBER IN THE JUDICIARY, OUR EXTREME SADNESS AND DEEPEST CONDOLENCES TO THE BLACKMAN FAMILY.

WE MISS ALREADY, JUDGE ROBERT BLACKMAN, AND WE WILL APPROPRIATELY HONOR HIM IN RECOGNITION WITH OUR REQUEST AT THE GOVERNORS OFFICE TO FLY THE FLAG AT HALF STAFF.

ON THE DAY OF HIS BURIAL, IN ADDITION ON NOVEMBER 30, I HOPE TO HAVE A PROPER ADJOURNMENT THAT WOULD HONOR SUCH A FINE, FINE NAVY MAN SUCH A FINE MARINER, A FINE JURIST, SUCH A FINE QUALITY HUMAN BEING. THANK YOU AND THIS CONCLUDES OUR COURT.
