IT HAS BEEN MY PRIVILEGE TO HELP THE COURT GET THROUGH THIS PROCESS OF REDISTRICTING. WE TALKED LAST TIME THE CURRENT PLAN IS CONSTITUTIONAL. IT HAS WHAT THEY CALL A TOP TO BOTTOM DEVIATION OF 37% THAT MAKES IT UNCONSTITUTIONAL.

THE LAW REQUIRES, GIVES SOME LEEWAY TO 10% AND OBVIOUSLY THAT'S NOT WHERE WE ARE WITH THE PLAN.

SO WE HAVE TO REVIEW THE LINES.

LAST TIME I WAS HERE I INTRODUCED FOUR PLANS AND WE GOT PUBLIC COMMENT AND A REACTION FROM THE MEMBERS THE COMMISSIONERS COURT. SO WE REVISED AND UPDATED THE MAPS. WE HAVE NOW SUBMITTED TO THE COURT FOR ITS CONSIDERATION THREE PLANS.

WE TRIED TO TAKE INTO CONTRACT THE COMMENTS WE RECEIVED FROM THE PUBLIC, THE DISCUSSIONS I'VE HAD WITH THE MEMBERS OF THE COMMISSIONERS COURT AND WE'RE SUBMITTING NOW, OUR FIRM IS SUBMITTING THREE PLANS DOUBLE A.

DOUBLE B AND DOUBLE C. SO IF WE CAN START WITH THE POWERPOINT AND GO TO THE FIRST MAP.

THE FIRST MAP AA CONTINUES WITH THE -- HAS THE TWO PRIMARY GOALS OF THE PLAN TO BALANCE OUT POPULATION BETWEEN THE FOUR COMMISSIONER PRECINCTS. AND TO PROTECT THE MINORITY VOTING STRENGTH IN THE DISTRICTS AS THEY EXIST TODAY SO THEY ARE REFLECTED IN THE PLAN AS WELL.

WE ALSO TRY TO MAINTAIN THE SAME THEME WE PRESENTED LAST TIME AND THAT IS TO TRY TO MAKE THE DISTRICTS MORE COMPACT.

AND TO COMBINE SOME OF THE RURAL AREA INTO A PREDINT AND

TO INCLUDE AN AREA AND ANOTHER SPOT FOR PLAN A.

I THINK VOTING PREDINT 27. AND, AGAIN.

IN THE PLAN WE TRIED TO JOIN THE AREAS AROUND VOTING PRECINCT 50 SO. THAT WAS A NEIGHBORHOOD THAT WAS SPLIT THAT WAS POINTED OUT TO US THAT WAS SPLIT.

WE TRIED TO INCLUDE THE PRECINCTS AROUND THAT PRECINCT TO JOIN THAT -- THAT NEIGHBORHOOD TOGETHER.

AND SO IF YOU TURN TO THE NEXT PAGE, THAT SHOWS HOW FAR WE HAVE COME IN TERMS OF BALANCING OUT THE POPULATION.

THIS PLAN HAS WHAT THEY CALL A TOP TO BOTTOM DEVIATION OF 5.73 AND AS WE DISCUSSED LAST TIME, JUDGE, THIS IS TALKING ABOUT THE DIFFERENCE BETWEEN THE MOST POPULATED AND THE LEAST POPULATED DISTRICT. WHAT THE COURTS LOOK TO DEFINE THE TOP TO BOTTOM DEVIATION. SO THAT DIFFERENTIAL IS 5.73.

AND COMMISSIONER PRECINCT 4 IS THE MOST POPULATED.

THAT'S ONE OF THE THINGS THAT COMMISSIONER BRENT CHESNEY INSISTED LOSE AS LITTLE POPULATION AS POSSIBLE.

HE IS FOND OF HIS VOTERS AND KEEP AS MANY AS HE CAN IN HIS COMMISSIONER PREDINT T IS THE LARGEST AT 91,000.

AND THE SMALLEST IS 86400. I THINK THAT'S JUSTIFIED TILT PICKS UP MUCH OF THE RURAL AREA.

AREAS THAT HAVE BEEN IDENTIFIED BY A NUMBER OF GROUPS AS BEING THE AREAS WHERE MOST OF THE UNDER COUNT OCCURS WHERE WE HAVE SMALL RURAL COMMUNITIES THAT ARE HARD TO COUNT.

HIS IS THE MOST UNDER POPULATED OF THE DISTRICTS.

EACH OF THE MINORITY DISTRICTS IS MAINTAINED WITH ALL OF THE THREE MINORITY DISTRICTS BEING OVER 70% MINORITY AND THE DISTRICT FOUR BEING 43%. AGAIN.

FAIR EQUAL TO WHERE WE ARE AND WITH THE GROWTH WE HAD.

SO THIS POWERPOINT AND CONTRIBUTED TO THE PUBLIC AND ONE OF THE FACT SHEETS WE HAVE IS TO SHOW SOME OF THOSE RURAL AREAS AND WHAT PERCENTAGE OF THOSE ARE INCLUDED IN WILL ON THE FAR LEFT SIDE WE HAVE THE COMMISSIONER PRECINCT.

ON THE RIGHT SIDE IT HAS A PERCENTAGE THAT THOSE ARE EITHER LOCATED OR SPLIT BETWEEN DIFFERENT COMMISSIONER PRECINCTS. WE, AGAIN, TRIED TO KEEP AS MANY OF THE AREAS INTACT AS WE COULD.

SO THAT DOES IT FOR PLAN AA. THE NEXT ONE IS BB.

AND IF WE CAN GO TO THE NEXT SLIDE AND ON WE DOUBLED ONE ON COMBINING THE RURAL AREAS THAT WE FEEL ARE A COMMUNITY OF INTEREST ON THE WEST END OF THE COUNTY.

AGAIN THOSE GET PUT INTO PRECINCT 1.

THE OTHER THREE DISTRICTS0 ARE COMMISSIONER PREDC DISTRICTS OR COMMISSIONER PRESENTS ARE URBAN.

1 IS MORE RURAL. IT BLUES MANY OF THE AREAS IN THAT ONE PRECINCT AND DRISCOLL AS WELL.

THIS PLAN IS THE MOST COMPACT AND THE ONE THAT COMPLIES THE BEST WITH THE 1 PERSON, ONE VOTE RULE.

THE TOP TO BOTTOM DEVIATION AND THIS PLAN IS 2.61.

AS YOU CAN SEE, EACH OF THE COMMISSIONER PRECINCTS IS UNDER 2% IN DIFFERENTIAL FROM THE IDEAL.

ALMOST PERFECT IN PRECINCT 1 IS UNDER POPULATED BY LESS THAN 1

HALF OF 1%. 2, 1.4% UNDER POPULATED.

PRECINCT 3, ALMOST -- ALMOST PERFECT AT .77 OF A PERCENT ABOVE THE IDEAL AND THEN PRECINCT 4, AGAIN, THE MOST OVERPOPULATED BUT ONLY AT 1.13%.

AGAIN, THE MINORITY NUMBERS, THE 3 MINORITY OPPORTUNITY DISTRICTS ALL OVER 70% AND THE FOURTH DISTRICT AT 43.58.

SO, AGAIN. THE PLAN COMPLIES AND IS CONSTITUTIONAL AND AS I MENTIONED.

IN PLAN CC WE TRY TO HAVE THE LEAST CHANGE PLAN.

VERY FEW VOTING PRECINCTS ARE MOVED FROM ONE DISTRICT TO THE OTHER. IT DOES NOT HAVE ANY CHANGE IN ITS PRECINCTS. THE OTHER HAVE SOME BUT THEY ARE VERY LIMITED IN THE CHANGE IN THEIR VOTING PRECINCTS.

IF WE GO TO THE NEXT PAGE. THAT'S THE RESULT OF DOING THAT IT IS CONSTITUTIONAL BUT THE TOP TO BOTTOM DEVIATION FOR THAT IS OVER 9% THE MAXIMUM ALLOWED BY THE LAW.

OBVIOUSLY WE HAVE NOT HAD TIME TO LOOK AT CC YET.

BUT I DID SUPPORT MAP BB BASED ON THE FACT IT HAS THE SMALLEST POPULATION DEVIATION. THROUGH NO FAULT OF THE COMMISSIONERS COURT THIS A RUSHED TIME LINE SINCE THERE IS NOT ENOUGH TO ANALYZE AND THE IMPACT ON THEM.

MY REQUEST THAT YOU LISTEN TO THE INDIVIDUALS AND THE AGENCIES AND LEADERS THAT YOU WILL HEAR FROM THIS WEEK AND TO TAKE AND INCORPORATE THE SUGGESTIONS, IF THEY ARE FAIR AND BELIEVE. AND USE THOSE AS YOU RECREW THE LINES. AND KEEP IT TRANSPARENT.

I APPRECIATE MR. THE HISTORIC AFRICAN-AMERICAN COMMUNITIES ARE STILL RAVAGED BY AIR POLLUTION. HAZARDOUS WASTE, LACK OF PUBLIC SERVICES AND FALLOUT FROM THE CONSTRUCTION OF THE BRIDGE AND THE UPCOMING DEMOLITION OF THE OLD BRIDGE.

I KNOW THAT YOU HAVE WORKED HARD AND RETOURSS AND TRANSFORMED THE AREAS ADD MADE IT POSSIBLE FOR MANY OF THESE CITIZENS OF NUECES COUNTY TO MAKE BETTER LIVES FOR THEMSELVES BUT WE STILL HAVE THOSE LEFT BEHIND AND SO, EVEN THOUGH THE POSITIVE STEPS HAVE BEEN TAKEN.

I WOULD ASK THAT WE REMAIN MINDFUL OF THE THAT ARE SUFFERING THOSE OUTSIDE OF THEIR CONTROL BUT T THEY ARE UNACCEPTABLE AND SO AS WE AND VARIOUS AREAS, YOU KNOW, THEY MAY CHANGE INTO DIFFERENT PRECINCTS.

I ASK YOU TO CONTINUE TO WORK TOGETHER AND TO STAY FOCUSED ON THE NEEDS OF THE UNDER SERVED COMMUNITIES.

I WAS EXCITED ABOUT THE INFRASTRUCTURE BILL.
