CHILDREN ABOUT THE IMPORTANCE OF WEARING THEIR MASKS, WASHING THEIR HANDS AND WATCHING THEIR SOCIAL DISTANCING.

WE HAVE CURRENT COVID CASES IN SOME CCISD SCHOOLS.

STAY ALERT. PARENTS AND CHILDREN ARE TRYING TO GET TO SCHOOL. THEY ARE ALL PREOCCUPIED WITH GETTING TO THEIR DESTINATIONS. RESPECT THE SAFETY CONCERNS OF THE SCHOOL. TALK WITH YOUR CHILD IF THEY DO NOT FEEL SAFE AT SCHOOL OR GUIDE THEM WHO TO TALK TO AT SCHOOL. ABOVE ALL, BE PATIENT AND BE SAFE AND THIS CONCLUDES OUR RISK MANAGEMENT SAFETY BRIEFING FOR TODAY. THANK YOU.

>>JUDGE CANALES: OKAY. THANK YOU SO MUCH, REBECCA, FOR THE SAFETY BRIEFING. ALSO AT THIS TIME, I AM GOING

[D. SAFETY BRIEFING]

TO NEED A LITTLE HELP WITH THE PUBLIC COMMENT IS NEXT.

[E. PUBLIC COMMENT: This section provides the public the opportunity to address the Commissioners Court on any issues within its jurisdiction. The Commissioners Court may not take formal action on any requests made during the Public Comment period which are not on the Agenda, but can refer such requests to County staff for review if appropriate.]

AND I AM ASKING TO ASK FOR TYNER TO ANNOUNCE PUBLIC COMMENT AS YOU SEE IT ON THE SIGN-UP SHEET.

>> JUDGE, WE HAVE THREE PEOPLE THAT SIGNED UP THIS MORNING.

THE FIRST PERSON LARRY FERK EN. IF I BELIEVE I PRONOUNCED THAT

CORRECT. >> IT'S CORRECT.

>>JUDGE CANALES: ALL RIGHT, TYNER.

IF YOU WILL ASK THEM TO PROCEED AND FOR MY BENEFIT AND COMMISSIONER CHESNEY'S BENEFIT TO MAKE CERTAIN THAT THEY GET

CLOSE TO THE MIKE. >>TYNER LITTLE: YES, LARRY.

IF YOU WILL GO TO THE PODIUM PLEASE.

>> I AM SECOND ON THE LIST AND STAND UP WITH HIM.

>>TYNER LITTLE: THE SECOND ON THE LIST IS TERRI BURGESS AND

SHE WILL STAND WITH HIM. >> I'M HERE TO DISCUSS THE

PROBLEM DITCHES THAT WE HAVE -- >> TOWARD THE MIC PLEASE.

>> SORRY SO THEY CAN HEAR YOU AT ZOOM.

>> IS THIS BETTER WITHOUT THE MASK MAYBE? HERE TO SPEAK OF THE PROBLEM DITCHES WE HAVE OVER IN -- ON 18 9, 52 B, 52, 69, 50, 48, 46, AND 44, AND THERE ON OUT TO -- CREEK -- OSO CREEK THAT WE HAVE BEEN TOLD ALL OUR DITCHES DRAIN TOO. AND I HAVE GIVEN CONNIE PIC PICTURES AND -- THE DITCHES SEEM TO BE PRETTY GOOD ON THE COUNTY SIDE AND THEY ARE TAKING THEM ON 52, BUT WHERE IT STARTS RIGHT THERE AS YOU SEE THAT PICTURE STARTS RIGHT THERE AT ROBS TOWN WHERE THE CITY LIMITS IS.

AND FROM THERE ON, YOU KEEP ON CLICKING.

SOME OF THE PICTURES ARE JUST REDUNDANT OF JUST SHOWING WHERE IT STARTS AT. AND IT CONTINUES ON TO WHERE IT -- IT GETS TO WHERE -- IT GETS DOWN ALMOST AT THE -- AT THE PALM TREE FOR US. I GUESS COULD YOU CALL IT, RIGHT BEFORE THERE THERE IS A CROSS OVER.

AND RIGHT THERE YOU SEE, THAT IS WHERE THE CROSSOVER IS.

AND THE DEBRIS THAT IS IN IS IT, AS WELL AS ALL UP AND DOWN THE DITCHES. AND FROM 1889, THE TREES AND THE DEBRIS AND THE -- THE SHRUBBERY IN THE DITCH THAT GOES FROM 18 89 TO 69 AND LS OVER TO COUNTY ROAD 44.

THAT DITCH HAS NOT BEEN CLEANED OUT IN THE 42 YEARS THAT I LIVED OVER AT 3600 COUNTY ROAD 50.

AND CONTINUED ON THESE PICTURES THAT WENT ACROSS 77 AND THE HIGHWAY 44 AND ENDED UP GETTING A FLAT TIRE AND COULDN'T GO ANY FURTHER. SO DON'T KNOW WHO WE CAN TALK TO OTHER THAN YOU GUYS TO HELP PUT SOME PRESSURE ON ROBS DOWN TO TAKE CARE OF THEIR DITCHES BECAUSE NUECES COUNTY IS TAKING CARE OF THEIRS AND ROBS TOWN TEAMS NEGLECT TAKING CARE OF FROM THERE ON THAT L PORTION THAT GOES FROM 189 ALL THE WAY TO 69 AND LS OVER TO COUNTY ROAD 44.

IF WE CAN ASK SOMEBODY THAT CAN PUT ON PRESSURE ON ROBS TOWN TO TAKE CARE OF THEIRS, THAT WILL BE OF GREAT HELP.

AND WHO IS -- WHO IS RESPONSIBLE AFTER THAT?

[00:10:03]

WHERE DOES ROBS TOWN STOP -- THAT IS IN FRONT OF MY HOUSE THAT AREA WHERE IT FLOODS ON COUNTY ROAD 50.

WHO IS RESPONSIBLE, YOU KNOW, ONCE IT HITS ROBS TOWN CITY LIMITS AND ALSO TO OSO CREEK. I WANT TO KNOW WHO IS

RESPONSIBLE. >> TYNER, LET HIM KNOW WE CAN'T COMMENT. THEY ARE ASKING.

>> THEY CAN'T RESPOND EITHER IN PUBLIC COMMENT.

>>JUDGE CANALES: THAT'S CORRECT.

SORRY. SORRY ABOUT THAT.

>> YOU ARE ON TWO DEVICES, JUDGE.

YOU NEED TO GET RID OF ONE. >>JUDGE CANALES: WE ARE HAVING A TECHNICAL PROBLEM TRYING TO GET BETTER VIDEO, BUT WE WILL HAVE TO -- WE WILL HAVE TO SEE WHAT WE CAN DO.

WE MAY NEED A TWO OR TH THREE-MINUTE RECESS TO GET US BACK ON. BUT IF YOU CAN HEAR ME, I JUST WANTED TO REMIND THE AUDIENCE UNFORTUNATELY WE CAN NOT RESPOND DURING PUBLIC COMMENT. THERE IS ACTUALLY SOME TECHNICAL RULES WHERE YOU CAN RESPOND, BUT BE AWARE THAT WE WILL RESPOND IN OTHER WAYS EITHER THROUGH WRITTEN COMMUNICATION, CONTACTING YOU AFTER THIS MEETING.

ALL OF YOUR COMMENTS ARE BEING WEIGHED VERY SERIOUSLY AND WE ARE ALL TAKING NOTES. IT IS JUST THAT THIS PARTICULAR PORTION OF THE -- OF THE AGENDA IS -- YOU GET A CHANCE TO TALK TO US AND WE WILL BE ABLE TO A DIFFERENT TIME ADDRESS THE SITUATION. I CAN TELL IF YOU STAY WITH US UNDER H 1 UNDER GENERAL INFORMATION REPORTS.

YOU WILL NOTICE ON THE AGENDA IT TALKS ABOUT FLOODING AND DRAINAGE. SO, AGAIN, IF THAT HELPS, COMMISSIONERS, THOSE ARE THE RULES THAT WE TYPICALLY OPERATE UNDER. BUT YOU MAY CONTINUE, SIR.

>> I HAVE GOT BESIDES WHAT I HAVE GIVEN CONNIE ON A THUMB DRIVE THAT SHE HAS DOWNLOADED, I AM ALSO WILLING TO GIVE THAT THUMB DRIVE FOR SOMEBODY ELSE TO DOWNLOAD IT IF THEY WANT TO.

I HAVE GOT PICTURES HERE AS WELL, THE SAME PICTURES.

BUT I THINK ALL THE PICTURES SHOW WHERE THE PROBLEM AREAS ARE AT. AND I THINK ON THE BACK OF THESE PICTURES, THEY ARE NOTED WHERE.

>> YES, MA'AM, I AM TERRY BURGESS AND I ALSO LIVE ON COUNTY ROAD 50 AND WHAT WE SEE A LOT OF -- THERE IS A LOT OF DUMPING THE AREA. A LOT OF DISRESPECTFUL PEOPLE.

THERE ARE CHAIRS. THERE ARE PLAYPENS.

THERE ARE BAGS OF TRASH AND TIRES.

IT IS UNFORTUNATE THAT PEOPLE DO THAT.

AND I FEEL FOR THE PEOPLE THAT HAVE TO CLEAN UP AFTER.

WE CLEAN UP AS MUCH AS WE CAN ALONG THE COUNTY ROAD.

WE EVEN MOW THE COUNTY ROAD. SO IF WE CAN GET HELP WITH THAT, WE WOULD GREATLY APPRECIATE IT.

THAT IS IT FOR US ROAR MA'AM. THANK YOU SO MUCH FOR YOUR T

TIME. >>TYNER LITTLE: NEXT, JUDGE,

SIGNED UP IS CHRIS GARCIA. >>JUDGE CANALES: AS SOON AS HE FINISHES CLEANING, YOU MAY PROCEED.

PLEASE REMEMBER TO REPEAT YOUR NAME AND ADDRESS FOR THE CLERK.

>> CHRIS GARCIA, 701 NORTH H HACKBURY, BISHOP, TEXAS.

>>JUDGE CANALES: YOU MAY PROCEED, SIR.

>> THANK YOU. JUDGE AND COMMISSIONERS, I APPRECIATE YOUR TIME SPECIFICALLY BECAUSE OF THE TIMES WE HAVE RECENTLY BEEN IN. I CAME BEFORE THIS COURT IN MAY ASKING IF NUECES COUNTY MENTAL HEALTH AND INTELLECTUAL DISABILITIES SERVICE LIKE MOBILE OUTREACH AND CRISIS RELIEF TEAMS ARE AVAILABLE FOR THOSE NEEDING HELP IN BISHOP.

I WAS HOPING THAT THIS WOULD BE ANSWERED -- THIS QUESTION WOULD BE ANSWERED IN FUTURE AGENDAS. SO FAR FROM WHAT I OBSERVE IT HAS NOT BEEN. IN THE MEANTIME I ASKED BISHOP POLICE DEPARTMENT HOW MANY TIMES HAVE THE DEPARTMENT REFERRED MENTAL HEALTH DISPATCHES TO NUECES COUNTY

[00:15:02]

INTELLECTUAL HEALTH AND DISABILITIES.

THEY APPLIED ZERO. TELLS ME THAT THE COUNTY RESOURCES FOR HOSE WHO NEED MENTAL HEALTH IS NOT BEING USED IN BISHOP. WHAT THE POLICE DEPARTMENT DOES DO IS GREAT AT ARRESTING OFFENDERS AND IN ADDITION TO THAT THEY POST THEIR PICTURES ON SOCIAL MEDIA.

IMAGINE THE STIGMA OF NOT HAVING YOUR ROOF OVER A HEAD IN A SMALL TOWN OF BISHOP, THEN ARRESTED FOR TRESPASSING BECAUSE YOU WANTED TO LAY YOUR HEAD DOWN AND REST SOMEWHERE.

WELL, THIS IS EXACTLY WHAT IS OCCURRING IN BISHOP.

THIS IS OCCURRING. AND I HAVE MY FRIEND'S PERMISSION TO TALK OF HIM. MY FRIEND DONNIE.

I AM NOT GOING TO USE HIS LAST NAME.

DONNIE DOES NOT HAVE A PLACE TO STAY LIKE WE DO.

HE SLEEPS IN AN INLET TO AN ABANDONED BUILDING IN HISTORIC BISHOP DOWNTOWN. YOU CAN FIND HIM AT THE BISHOP SQUARE BY THE LIGHT AT THE INTERSECTION OF BUSINESS 97 AND MAIN STREET. I HAD SEEN DONNIE BEFORE UNTIL I SEEN SOCIAL MEDIA POST IN A BISHOP COMMUNITY FACEBOOK GR GROUP. WHAT THIS IS WHAT THEY SAID OF DONNIE. ONE PERSON SAID I AM WONDERING ABOUT THE MAN SITTING AND LAYING ON THE GROUND IN FRONT OF THE BAKERY BUILDING. ANOTHER PERSON SAID, I HEAR HE WAS IN A DITCH ALL FOURS BARKING AT THE SUN THE LAST TIME I SAW HIM. ANOTHER PERSON SAID I BET THE SAME GUY I REPORTED SCREAMING TO HIMSELF IN THE PARKING LOT OF BISHOP PRIMARY SCHOOL. SOMEONE ELSE SAID HE IS MY COUSIN AND ON SYNTHETICS. I TRIED TO HELP HIM BUT HE KICKED MY CAR. ANOTHER PERSON PUT, DO THEY PICK HIM UP? HE SHOULD BE PUT IN JAIL AND SLEEP IT OFF. I CAN UNDERSTAND THE COMMENTS FROM THE COMMUNITY. THEY ARE INCENTIVE, BUT THEY DON'T UNDERSTAND HEALTH -- MENTAL HEALTH DISTRESS, BUT THIS COURT DOES. THIS COURT UNDERSTANDS THE NATURE OF THE MENTAL HEALTH DISTRESS AND I HEARD YOU TALK ABOUT IT. AND YOU TALK ABOUT THIS CONSTRUCTIVELY. I WONDER WHY NUECES COUNTY AND INTELLECTUAL DISABILITIES DO NOT GO TO WISH SHOP.

DONNIE HAS A ROUTINE OF WRITING THESE VERY WORDS ON A LARGE POSTER AND HE HANGS THEM AROUND TOWN DOWN MAIN STREET.

YOU CAN SEE THEM. I AM GOING TO READ WHAT YOU HE WRITES BECAUSE HE HAS GIVEN ME PERMISSION TO.

JESUS CHRIST, BABY CHILD, BOY AND GIRL LIVING THERE SLEEPWALKING. LEFT FOOT, LOOK UP THAT WAY EVERY TIME AND EVERY FIVE MINUTES.

DO CRY SPELL. UNDO THE PEOPLE'S LIVES AND EARTH AND MY INSIDES LIFE TO USE CHRIST SPELL AGAIN.

EVERYTHING OFF THE PEOPLE'S LIFE TO THE LEFT FOOT UNDER CONTROL. EVERYTHING OFF MY LIFE TO THE LEFT FOOD UNDER CONTROL. EARTH OFF TO THE LEFT FOOT UNDER CONTROL. JURISDICTION THE EARTH, THE W WAY. BISHOP, TEXAS, NUECES COUNTY.

LIVE HERE. IT IS MY HOMETOWN.

I AM THE OWNER. MAKE DUE CLEAN NUMBER TROUNCE BAG OF MONEY SLINGSHOT. JESUS CHRIST, BABY CHILD, DONNIE. HE TAKES PRIDE IN HIS HOMETOWN.

NOW WITH MY HELP, DONNIE WAS -- WITH SOME HELP -- DONNIE WAS ABLE TO SEE A DOCTOR AT THE INNOVATIVE READINESS CLINIC IN BISHOP COUPLE OF MONTHS -- FEW MONTHS AGO.

HE SAT WITH ME ON THE SPOT WHERE WE MADE AN APPOINTMENT WITH THAT WITH AMISTAD ROBS TOWN TO WORK ON HIS HEALTH AND WELLNESS. AS I PUT IT OUT BEFORE IN MAY, REGARDING THE IMPROVED MENTAL HEALTH SERVICES LIKE MOAT BILL CRISIS OUTREACH TEAMS, COMMUNITY INTERVENTION -- CRISIS INTERVENTION TEAMS THAT ARE AVAILABLE.

WE KNOW THEY ARE OUT THERE. AND I AM ASKING THIS COURT TO KEEP YOUR PROMISE TO BE ATTENTIVE TO THE MENTAL HEALTH NEEDS OF ALL NUECES COUNTY INCLUDING BISHOP AND INCLUDING DONNIE. I AM ASKING THE COURT FOR JUSTICE FOR DONNIE. THANK YOU.

>>JUDGE CANALES: THANK YOU, MR. GARCIA.

>> I WOULD LIKE TO SIGN IN, JUDGE?

>>JUDGE CANALES: YES. I JUST WANT TO MAKE SURE THAT TYNER READS THE NEXT PUBLIC COMMENT AND THEN WE WILL PUT YOU AT THE CONCLUSION. I DO WANT TO -- I DO WANT TO JUST AT LEAST REMARK THAT, AGAIN PUBLIC COMMENT IS NOT A TIME TO ANSWER, BUT THERE WILL BE AN OPPORTUNITY PERHAPS IN ANOTHER AGENDA ITEM TO ADDRESS THIS IMPORTANT ISSUE IF THAT IS WHAT YOU ARE GOING TO DO. I KNOW HOW TEMPTING IT IS.

I ALSO WANT TO REACH OUT AND SAY ALL THE THINGS THINK THAT

[00:20:01]

BET YOU WANT TO SAY, BUT, AG AGAIN, PUBLIC COMMENT IS NOT THE TIME. BUT WE WILL SIGN YOU UP.

>> THANK YOU. >>TYNER LITTLE: JUDGE, THE GENTLEMAN MAY WANT TO WAIT AROUND.

>>JUDGE CANALES: EXACTLY. I AM LOOKING IN THE COURT ROOM.

HE MAY HAVE WALKED OUT. >>TYNER LITTLE: THERE HE IS.

TELL HIM NOT TO LEAVE. >>JUDGE CANALES: HANG ON.

TYNER, WILL YOU PLEASE LET US KNOW IF THERE IS ANYBODY ELSE?

>>TYNER LITTLE: NO. THAT'S IT.

EXCEPT COMMISSIONER GONZALEZ ASKED ME TO SIGN HIS NAME.

>>JUDGE CANALES: NO PROBLEM. I SEE NO INDIVIDUAL ONLINE, BUT I WILL ASK AGAIN IF THERE ARE -- IF THERE IS ANYBODY WHO WISHES TO MAKE PUBLIC COMMENT, IF YOU WOULD DISPLAY YOUR HAND SIGNAL ON YOUR LAPTOP, THAT WOULD BE GREAT.

OKAY, SEEING NONE, I WILL ASK COMMISSIONER GONZALEZ, BUT AGAIN, IF IT IS IN RESPONSE. AS YOU KNOW WE CAN NOT DO THAT AT THIS TIME. GO AHEAD.

>>COMMISSIONER GONZALEZ: WHAT DO YOU MEAN I CAN'T RESPOND.

MY COMMENTS ARE MY COMMENTS. I UNDERSTAND THAT MR. GARCIA'S POINT. AND IT IS VERY WELL TAKEN.

I -- AS A COMMISSIONER OF THAT AREA, WHEN -- WE HAD AN OPEN DOOR POLICY TO ANYBODY WHO WANTED TO COME IN AND THERE WERE -- THEY WERE ALLOWED TO COME IN FOR THE MENTAL HEALTH.

AND ALSO, THE -- I KNOW THAT FOR A FACT THAT THEY SHOULD -- HAVE ASSIGNED TO SOME KIND OF REFERRAL.

AND THAT SHOULD HAVE CONTINUED ON, BUT IF THOSE REFERRALS ARE NOT BEING MET, THEN I -- I, AS A COMMISSIONER, NEED TO BE AWARE OF. BUT ANYBODY OUT THERE THAT IS HAVING ISSUES, I WILL BE GLAD TO MEET WITH THEM ON A ON ONE-ON-ONE BASIS. THANK YOU.

>>JUDGE CANALES: OKAY. I WILL MOVE ON AT THIS TIME.

SEEING NO FURTHER PUBLIC COMMENT.

[1. In support of the local Turtle Release Program.]

WE ARE GOING TO MOVE TO RESOLUTIONS, PROCLAMATIONS AND ORDERS. THE FIRST IS IN SUPPORT OF THE LOCAL TURTLE RELEASE PROGRAM AND I WILL DIRECTED YOUR ATTENTION TO TYNER AT THE PODIUM.

TYNER, I WAS REMINDED THAT TAX COLLECTOR HAD TO LEAVE WITH REGARD TO THE EMPLOYEE OF THE MONTH SO I AM PREPARED, DO WE HAVE SOMEBODY REPRESENTING THE OFFICE?

>>TYNER LITTLE: YES, RALPH IS HERE.

>>JUDGE CANALES: THANK YOU FOR THAT.

YOU MAY PROCEED. >>TYNER LITTLE: THIS IS IN SUPPORT OF THE DIVISION OF SEA TURTLE RESTORATION UNDER THE DIRECTION OF DR. DONNA SHAVER. WHEREAS NUECES COUNTY IS THE GATEWAY FOR THE PEDRO ISLAND NATIONAL SEASHORE AND GENERATIONS OF LOCAL RESIDENTS AND TOURISTS HAVE ENJOYED THE OPPORTUNITY TO RECREATE AND PARTICIPATE IN CONSERVATION EFFORTS OF PEDRO ISLAND NATIONAL SEASHORE.

WHEREAS THE KEMP RIDLEY IS THE MOST ENDANGERED OF SEA TURTLE SPECIES AND PEDRO ISLAND S SEASHORE IS THE MOST IMPORTANT NESTING BEACH IN THE UNITED STATES.

WHEREAS THE DIVISION OF SEA TURTLE RESTORATION OF THE NATIONAL PARK SERVICE IS LED BY DR. DONNA SHAVER, DEDICATED PUBLIC SERVANT WHO DEDICATED HER LIFE OF SAVING THE MOST ENDANGERED SEA TURTLES SERVING THE PUBLIC.

AND FURTHER ADMIRED AND SERVES AS A SUCCESSFUL ROLE MODEL TO YOUNG CHILDREN EN GIRLS WHO WISH TO BE LIKE HER.

WHEREAS, THE PEDRO ISLAND NATIONAL SEASHORE REMAIN HIGH ON THE PUBLIC'S BUCKET LIST OF THIS I THINK SO TO SEE PROVIDING A SIGNIFICANT AMOUNT OF ECOTOURISM DOLLARS AS PEOPLE TRAVEL TO THE PARK TO SEE PUBLIC RELEASES AS THOUSANDS OF TOURISTS AND LOCAL RESIDENTS FREQUENTLY LINE UP TO SEE A SINGLE TURTLE RELEASE. WHEREAS, THE NATIONAL PARK SERVICE IS CONSIDERING DISMANTLING THIS LEGACY SEA TURTLE CONSERVATION PROGRAM WITH THE INTENTION OF USING THE PROGRAM'S SPECIFIC FUNDS FOR OTHER PURPOSES WITHIN PADRE ISLAND NATIONAL SEASHORE AND SUCH AN ACTION IS A RESULT OF A FLAWED AND BIASED REPORT WHICH ATTEMPTS TO SAVE MONEY AND SEEK CONSISTENCY WITH SEA TURTLE PROGRAMS ON THE EAST COAST AND FLORIDA WHILE DIFFERENCES IN THE NESTING AND HATCHING HABITS OF THE KEMP'S RIDLEY MAKES THIS DISASTROUS FOR THE RECOVERY

[00:25:07]

EFFORTS OF THE MOST DANGEROUS SEA TURTLE IN THE WORLD.

BE IT RESOLVED THAT THE COMMISSIONERS COURT OF NUECES COUNTY, TEXAS HEREBY SUPPORT THE CONTINUATION OF THE DIVISION SEA TURTLE RESTORATION IN ITS CURRENT FORM UNDER THE DIRECTION OF DR. DONNA SHAVER AND FURTHER ASK THE UNITED STATES DEPARTMENT OF THE INTERIOR TO SUPPORT SUCH CONTINUATION OF THIS EDUCATIONAL AND ECONOMICALLY SUCCESSFUL CONSERVATION EFFORT FOR THE CRITICALLY INJURED K KEMP'S RIDLEY SEA TURTLE AND OTHER ENDANGERED PIECES CHEESE.

>> SO MOVED. >>JUDGE CANALES: HOW ABOUT A

SECOND AT THIS TIME. >> SECOND.

>>JUDGE CANALES: HAVING MOTION AND A SECOND, ANY DISCUSSION? SKILL COMMISSIONER -- WE HAVE GOT A VERY GOOD AND COMPREHENSIVE PUBLIC COMMENT ON THIS ISSUE LAST WEEK.

COMMISSIONER CHESNEY. >>COMMISSIONER CHESNEY: YES, I WOULD LIKE TO THANK MRS. KLEIN FOR -- I CAN'T SEE IF SHE IS THERE IN THE COURT ROOM TODAY. SHE WAS VERY HELP ENVELOPE GETTING THE WORDING FOR THIS RESOLUTION DONE AND I WANT TO SAY AGAIN AND I DON'T THINK WE CAN SEE ENOUGH HOW IMPORTANT DONNA SHAVER IS TO OUR COMMUNITY.

HOW IMPORTANT THE TURTLE RELEASE PROGRAM IS TO OUR COMMUNITY. NOT JUST TO THE COMMUNITY BUT TO THE COUNTRY. THIS IS VERY, VERY IMPORTANT STUFF. I DON'T KNOW IF THE PARKS DIRECTOR OF THE NATIONAL PARKS SEE THIS OR SEE THIS VIDEO, I WILL ASK TYNER ONCE THE COURT PASSES THIS, ASSUMING THAT HAPPENS, YOU WILL PROVIDE AND SEND A LETTER, COVER LETTER ON PWHOOV OF THE ENTIRE COURT AND SEND THAT TO THE PARKS DIRECTOR AT THE NATIONAL SEASHORE THAT HE KNOWS OF OUR OVERWHELMING SUPPORT AND SENT TO OUR CONGRESSMEN -- ANY CONGRESSMEN IN THE AREA. NOT JUST CLOUD AND QUAR AND ANYBODY WE HAVE RELATIONSHIPS WITH.

I WILL ASK -- I KNOW OUR STATE REPRESENTATIVES ARE AWARE OF THIS AND TO SEND IT TO OUR LEGISLATIVE DELEGATION.

I WANT THIS NOT JUST PASSED BUT SENT TO EVERYBODY THAT MATTERS.

AND OBVIOUSLY IN THIS PARTICULAR CASE, OUR FEDERAL REPRESENTATIVES ARE IMPORTANT. I WOULD LIKE TO SEND IT TO SENATOR CRUZ AND CORNYN AND A VERY, VERY BIG DEAL TO ME AND MY CONSTITUENTS AND ALL OF NUECES COUNTY WHO PARTICIPATED IN THIS. THE CHILDREN THAT HAVE GONE OUT THERE FOR YEARS AND YEARS AND WATCHED THIS AMAZING THING WHEN TURTLES WERE RELEASED BACK INTO THE OCEAN.

AND IT IS -- OR INTO THE OCEAN. IT IS AN INCREDIBLE PROGRAM.

IT IS INCREDIBLY IMPORTANT. AND WHAT'S GOING ON OUT THERE ALLEGEDLY THAT IS SEEMINGLY TO SHUT THIS DOWN IS BEYOND A TRAGEDY OF JUSTICE. SO I OVERWHELMINGLY SUPPORT THIS. I APPRECIATE MISS KLEIN -- MRS. KLEIN BRINGING THIS TO OUR ATTENTION TO ACT ON THIS AND SHE WILL NOTE THAT WE ACTED ON THIS VERY, VERY QUICKLY AS WE SAID WE WOULD AND I DIDN'T WANT THIS TO GO ON WITHOUT, AGAIN, ADDING MY STRONG SUPPORT AND WORDS TO THIS, BECAUSE THIS IS JUST -- IT'S NOT. IT'S NOT SAVING THE WORLD OR ANYTHING LIKE THAT. IT IS NOT BATTLING COVID OR ANYTHING LIKE THAT. BUT IT IS EXTREMELY IMPORTANT TO THIS AREA AND INTO OUR ENVIRONMENT AND WE NEED TO DO EVERYTHING WE CAN TO SAVE THIS PROGRAM AND SAVE DONNA SHAVER BECAUSE SHE IS TRULY AN ICON IN THIS AREA AND THIS COUNTRY AND HAS DONE SO, SO MUCH WAY BEYOND WHAT HER JOB DUTIES ARE WITH REGARD TO THIS AND OTHER PROGRAMS. THANK YOU FOR OPPORTUNITY TO SPEAK, JUDGE.

I APPRECIATE IT. >>JUDGE CANALES: VERY GOOD.

AND VERY GOOD COMMENTS AND OF ALL I ECHO, MRS. KLEIN SAID IF WE WERE TO PASS A RESOLUTION AND ALSO SUCK IS HE QUENLTLY WRITE A LETTER, SHE WOULD MAKE SURE THAT IT WAS ALSO ECHOED TO SECRETARY HOLLAND, DEB WHO WILL LAND, CIVIC THE INTERIOR AND WE THOUGHT THAT WAS APPROPRIATE. WE WILL MAKE CERTAIN THAT OUR ENTIRE FEDERAL AND LOCAL DELEGATION RECEIVE A COPY AND MORE IMPORTANTLY I NOTE -- WE DID SEND A NOTE TO TIM RIC RICHARDSON AND HE IS AWARE. PERHAPS A QUICK CALL FROM YOU COMMISSIONER CHESNEY TO TIM TO GIVE HIM A BRIEF BACKGROUND.

HE IS PART OF OUR TEAM AND HE CAN DELIVER THESE RESOLUTIONS AND LETTERS IN PERSON. HE HAS THOSE RELATIONSHIPS AND

[00:30:02]

I JUST THINK THAT WOULD BE A VERY GOOD USE OF TIME IF YOU WOULD -- IF YOU WOULD TAKE THAT ON OR AGREE TO TAKE THAT ON AT

THIS TIME. >>COMMISSIONER CHESNEY: I WILL BE HAPPY TO. I DON'T HAVE HIS NUMBER, BUT I WOULD BE HAPPY TO DO THAT AND WHAT IS EVEN BETTER TO PUT TIM -- GET TIME TALK TO TERESA ALSO BECAUSE SHE IS OBVIOUSLY TAKING A LEAD ON THIS GIVEN HER BACKGROUND BUT I WILL BE HAPPY

TO DO THAT, YES, MA'AM. >>JUDGE CANALES: ABSOLUTELY.

WE WILL MAKE ALL THOSE GOOD CONNECTIONS TODAY.

WE HAVE A MOTION AND A SECOND. THAT WAS EXCELLENT DISCUSSION.

ANYONE ELSE WHO WISHES TO COMMENT AT THIS TIME? OKAY. IN THAT CASE, ALL THOSE IN FAVOR OF THE RESOLUTION SUP SUPPORTING THE TURTLE RELEASE PROGRAM, PLEASE SIGNIFY BY SAYING AYE.

OPPOSED, SAME SIGN? OKAY, THANK YOU.

THE NEXT PART OF OUR AGENDA IS -- CAN BE FOUND UNDER G 1,

[1. Announcement of August 2021 Employee of the Month.]

THAT IS THE ANNOUNCEMENT OF THE AUGUST 2021 EMPLOYEE OF THE MONTH. TO DO SO APPROPRIATELY I WANT TO APOLOGIZE TO OUR TAX COLLECTOR AND TOLD HIM HE WOULD BE AT THE FRONT OF THE AGENDA AND HE HAD ANOTHER IMPORTANT MEETING TO ATTEND. I HOPE WE CAN HAVE HIM BACK NEXT TIME, BUT I THINK THE BEST WAY TO TALK ABOUT THIS OUTSTANDING NUECES COUNTY EMPLOYEE IS TO READ THE FOLLOWING LETTER THAT KEVIN PROVIDED TO ME.

I APOLOGIZE FOR NOT WRITING CLOSER TO THE DAY OF MY VISIT TO AUTOMOBILE REGISTRATION OFFICE.

SEE I WAS RAISED IN A FAMILY DEDICATED TO SERVICES TO OTHERS AND LAW ENFORCEMENT AND JUVENILE JUSTICE.

I HAVE SEEN, HEARD AND DEALT WITH THE GOOD, BAD, AND THE DOWNRIGHT CRIMINAL SINCE I WAS A CHILD.

MY WORK HISTORY IS THAT OF A POLICE OFFICER IN TULSA, OKLAHOMA FOR EIGHT YEARS, DEPUTY COUNTY SHERIFF AND WORKING WITH TWO HIGH-FROM FILE OIL EXPLORATION COMPANIES OF SECURITY IN OKLAHOMA. AND YOUR OFFICE WAS SO BUSY THAT DAY, BUT I COULD NOT HAVE BEEN RECEIVED. I COULD NOT HAVE RECEIVED A WARMER WILL TO YOUR OFFICE THAN HOW I WAS RECEIVED BY MISS HANNA'S WARM SMILE AND GRE GREETING.

OFF GEM OF AN EMPLOYEE IN MISS HANNA.

WELCOMED ME WITH WARM SMILES AND SAID NO WORRIES, SIR.

I CAN TAKE CARE OF ALL OF THESE.

CONSIDERING I WAS THROW SIX MONTHS LATE IN RENEWING THE REGISTRATION. I WAS SURPRISED BY HER REACTION. HER WILLINGNESS TO HELP ME AND GET EVERYTHING DONE THE VERY SAME DAY.

I DID HAVE TO OFFER TO COME BACK ON A DIFFERENT DAY TO DO THE DISABILITY PARKING APPLICATION.

AND SHE REPLIED, OH, NO, I GOT YOU.

WE WILL TAKE CARE OF THIS TODAY AND THANKED ME FOR MY SERVICE IN THE MILITARY. AND REMINDED ME SINCE I WAS LATE REGISTERING I WILL NEED TO REGISTER IN 2020 IN ORDER -- IN 2022 TO HAVE A FULL YEAR ON MY REGISTRATION.

I APPRECIATE THAT SOMEONE UNDERSTANDS WHEN YOU ARE NEW IN THE STATE, NEW IN THE COUNTY AND MANY STATE REQUIREMENTS ARE VERY DIFFERENT. I FIND THE E RESERVATION QUEUE PROGRAM AND INFORMATION IN THE LOBBY AND DOWNLOADED IT.

A VERY LONG LINE WAITING TO USE KIOSKS.

BOY, WAS I GLAD I DOWNLOADED THE QUEUE AND I WAS SEEN BY ANY OF THOSE WHO HAD NOT USED THE QUEUEING SYSTEM.

IT WAS SO EFFICIENT IN GETTING PEOPLE ORGANIZED.

MY COMPLIMENT. FIVE STARS OUT OF FIVE STARS.

MISS HANNA, SHE IS A KEEPER. PLEASE GIVE HER THE RECOGNITION PROVIDING GREAT SERVICE TO THE OFFICE AND CITIZENS OF NUECES COUNTY. THANKS AGAIN, WALTER DERIAN.

WE START THIS PROGRAM NUECES COUNTY NUECES EMPLOYEE OF THE MONTH OVER A YEARS AGO ALWAYS MAKES US FEEL SO GOOD HOW ONE PERSON CAN CHANGE THE WAY YOU FEEL ABOUT YOUR COUNTY, GOVERNMENT AND THE SERVICES WE PROVIDE.

WE ARE SO HAPPY THAT TAX ASSESSOR RECOMMENDED HER.

SHE LOVES HER JOB AT MOTOR VEHICLE.

HERE IS WHAT IS SO AMAZING. SHE HAS ONLY BEEN HERE EIGHT MONTHS. PERHAPS -- THIS IS THE THING THAT GAVE ME CHILLS. 19 YEARS OLD.

PRIOR MILL. SHE HAD TO LEAVE DUE TO COVID.

SHE IS A STUDENT HERE STUDYING TO BE A FORENSIC BIOLOGISTS IN CORPUS CHRISTI. SHE LOVES TO COOK.

SHE LOVES MUSIC. SHE LOVES TAKING CARE OF HER GRANDMOTHER. AND MOST OF ALL, SHE LOVES TO MAKE PEOPLE SMILE. HANNA, YOU MADE ME SMILE TODAY TO RECOGNIZE YOU AND SHOWCASES THAT YOU DON'T HAVE TO BE HERE

[00:35:03]

VERY LONG TO MAKE A GREAT IMPACT AND SHOWCASE YOU DON'T HAVE TO BE ALL THAT OLD OR ALL THIS EXPERIENCED TO TOUCH PEOPLE. YOU MAKE US SO PROUD AND FOR THAT, YOU ARE BEING RECOGNIZE THIS MONTH IN RECOGNITION OF YOUR OUTSTANDING SERVICE TO NUECES COUNTY AS EMPLOYEE OF THE MONTH. WELCOME HANNA SI S NEROS AND -- I DON'T HAVE THE EYES IN THE ROOM TO HELP RECOGNIZE AND

IDENTIFY HANNA. >>TYNER LITTLE: RALPH IS HERE,

JUDGE. >>JUDGE CANALES: WONDERFUL.

>> HELLO, JUDGE AND COMMISSIONERS COURT.

HANNA HAS BEEN WITH US FOR A SHORT WHILE, BUT SHOWED THE DEMONSTRATION OF EAGER TO LOAN AND GRASP OF KNOWLEDGE.

SHE IS OUTSTANDING AND ONE OF THE BEST EMPLOYEES IN THE OFFICE AND TRULY DESERVE THIS RECOGNITION TODAY.

THANK YOU. >>JUDGE CANALES: THANK YOU SO MUCH FOR BEING WITH US. THANK KEVIN.

AND HANNA, YOU ARE SITTING THERE SO CALMLY, BUT YOU ARE JUST -- OUR DELIGHT. I AM GLAD YOU ARE HAVING AN OPPORTUNITY TO COME TO COMMISSIONERS COURT.

I DON'T KNOW IF YOU HAD A CHANCE TO COME UP, BUT LET ME SAY THAT WHEN YOU THANKED A MILITARY VETERAN FOR YOUR SERVICE. DID YOU SOMETHING SO SPECIAL ON BEHALF OF OUR COUNTY. YOU MIGHT HAVE DONE IT OUT OF HABIT OR BECAUSE YOU, YOURSELF, UNDERSTAND WHAT SACRIFICE IS ALL ABOUT HAVING SERVED YOURSELF, BUT MORE IMPORTANTLY, YOU BECAME A AMBASSADOR AND I WANT TO SAY CONGRATULATIONS AND THANKS-TO-ON BEHALF OF ALL OF HOUSE WISH AND SEEK TO HONOR VETERANS. NUECES COUNTY HAS ITS OWN VETERANS SERVICES OFFICE. AND THE TRUTH IS WE NEED TO BE THANKING YOU TODAY FOR YOUR SERVICE.

>>JUDGE CANALES: COMMIS COMMISSIONERS, I HOPE THAT SETS THE TONE FOR YOUR DAY. AND HANNA, YOU ARE MORE THAN WELCOME TO TAKE A PICTURE WITH EVERYBODY AND IF YOU HAVE ANY COMMENTS -- YOU CERTAINLY DON'T HAVE TO, BUT WE ARE ALWAYS HAPPY TO HAVE YOU MAKE COMMENTS AS WELL.

BUT I BET THEY WANT TO HAVE A PICTURE FOR YOU.

>>COMMISSIONER GONZALEZ: YOU WANT TO SAY ANYTHING, HANNA? COUPLE OF WORDS. THERE YOU GO.

>> BUY IS JUST LIKE TO SAY JUDGE, THANK YOU FOR THIS OPPORTUNITY. TIME IN LOVE WITH MY JOB.

AND MAKES ME SO HAPPY TO COME TO WORK EVERY DAY AND TAKE CARE OF THE COMMUNITY AND WORK WITH AN AMAZING TEAM, SO THANK YOU ALL. THANK YOU.

>>JUDGE CANALES: THANK YOU. >> THANK YOU, HANNA.

CONGRATULATIONS. >>COMMISSIONER CHESNEY: CONGRATULATIONS. GOOD JOB.

>> TAKE PICTURE, TYNER. >>JUDGE CANALES: THAT WAS AN

ANNOUNCEMENT. >> WE WILL TAKE A PICTURE

JUDGE. >>JUDGE CANALES: YES, PROCEED.

AND I WILL TAKE -- SEE IF WE CAN MAKE THIS WORK.

>> BOTH OF US OUT HERE. THAT'S OKAY.

>> ONE, TWO, THREE. [APPLAUSE]

>>JUDGE CANALES: THANK YOU, TYNER.

THANK YOU SO MUCH. WE WILL PROCEED TO GENERAL INFORMATION REPORTS AND WE ARE SEATED AND CLEAN THE PODIUM.

WE ARE BEING EXTRA CAREFUL IN THE COURT ROOM AND WE APPRECIATE EVERYBODY KEEPING THEIR DISTANCE AND THE SANITIZATION PROCESS THAT IS GOING ON.

[1. Discuss disaster preparedness and response, including matters related to COVID-19, Emergency Orders, severe weather, flooding, drainage, economic recovery, state and federal assistance, and infrastructure status, and other related matters.]

WE WILL TURN TO H-1 WHICH IS MELISSA MONGIA.

I WANT TO MAKE SURE BEFORE I TURN TO HER SHE IS IN THE COURT ROOM OR ON THE PHONE IF NOT WE CAN SKIP AND COME BACK.

MELISSA, SETTLE IN AND GO TO YOU WHENEVER WE ARE READY.

>> THANK YOU. I AM ATTENDING VIRTUALLY, AFTER THE BRIEFING I WILL BE GOING OUT TO THE FAIRGROUNDS.

GOOD MORNING, JUDGE AND COMMISSIONERS.

CAN EVERYBODY HEAR ME OKAY? >> YES, MA'AM.

>> YES. >> OKAY, GREAT.

I JUST WANT TO SAY, YOU KNOW, THERE IS NO OTHER WAY TO START THIS BRIEFING THIS MORNING OTHER THAN BY SAYING THAT OUR COUNTY IS CURRENTLY IN A DIRE SITUATION.

I KNOW WORD ISN'T USED OR MAYBE OVERUSED, BUT WE REALLY, REALLY TRULY ARE. THE SURGE WE ARE EXPERIENCING WITH COVID-19 WE ARE ASSUMING THE REASON WHY WE ARE HAVING SUCH A POWERFUL SURGE IS THE DELTA VARIANT BEING HERE.

[00:40:04]

SO IT IS SAFE TO ASSUME A LOT OF CASES OF DELTA HERE.

IT IS EXTREMELY IMPORTANT RIGHT NOW FOR THE PUBLIC FOR THE PUBLIC TO BE AWARE OF THIS SITUATION AND BE AWARE OF NOT ONLY THE NUMBERS AND WHERE WE ARE AT THE NUMBERS BUT WHAT IS HAPPENING. WHAT IS HAPPENING IN THE HOSPITALS, WHAT IS HAPPENING WITH THE SCHOOLS.

WHAT IS HAPPENING WITH YOUR PARENT SENIOR CENTER.

WHAT IS HAPPENING RIGHT NOW? WHAT IS GOING ON? PUBLIC INFORMATION IS PROBABLY THE MOST CRITICAL COMPONENT OF MITIGATING THE SURGE. SO I STAND HERE TODAY TO TALK VERY OPENLY ABOUT OUR SITUATION, WHICH I ALWAYS DO BUT I WANT TO START WITH HOW URGENT THIS IS.

OUR CASES YESTERDAY. WE HAD 425 COVID-POSITIVE CASES YESTERDAY AND NINE DEATHS. OUR CURRENT SITUATION, OUR CURRENT EFFORTS, WE HAVE REQUESTED FROM THE STATE A TEAM -- I KNOW I MENTION THIS LAST TIME, BUT WE WEREN'T SURE WHERE WE WERE AT ON THAT, WHETHER IT WAS GOING TO BE GRANTED OR NOT, A TEAM TO COME DOWN AND RAN A RAPID INFUSION CENTER AT THE RICHARD M. BORCHARD FAIRG FAIRGROUNDS.

THAT REQUEST WAS APPROVED. THE BCFS TEAM BEGAN MOVING IN YESTERDAY LOADING ALL KINDS OF EQUIPMENTS, BEDS, AND OTHER EQUIPMENT NEEDED TO RUN AN INFUSION CENTER LIKE THAT, BUT IN THE MEANTIME, A VERY PASSIONATE AND NERVOUS GROUP OF LEADERS CAME TOGETHER TO SAY, WE HAVE TO DO SOMETHING UNTIL THEN, AND AT THAT TIME, WE ALSO DIDN'T KNOW IF THE STAR WAS GOING TO BE GRANTED AND IN AN EFFORT TO CLOSE THE GAP FROM WHERE WE WERE AT THAT DAY TO HAVING POTENTIALLY A FULL-BLOWN INFUSION SENT PROVIDED FOR US .

WE OPENED UP WHAT WE CALL A BRIDGE RIC.

RAPID INFUSION CENTER. A TEMPERATURE INFUSION CENTER SET UP AT THE MEMORIAL HOS HOSPITAL.

THAT SITE WAS CHOSEN BECAUSE OF HOW VETTED IT WAS.

AND HOW WE USE IT FOR TESTING AND VACCINATION.

AND CRITICAL TO USE A SITE WE COULD OPEN QUICKLY.

WE HAVE MEDICAL TENTS PROVIDED AND A GROUP OF FOLKS AGAIN AGENCIES THAT MAKE IT HAPPEN. WE HAVE NUECES COUNTY, KRISTA SPANN. AMISTAD, COASTAL BEND COUNCIL OF GOVERNMENT, ROBS TOWN. ALL CAME TOGETHER HOW CAN WE HAVE A INFUSION CENTER. RUNNING AT MEMORIAL HOSPITAL AND BEYOND THAT MAKE AN ASSESSMENT OF THE VOLUME WHEN THE OFFICIAL INFUSION CENTER SETS UP.

IN THE TIME THAT HAS BEEN OFFERING THE SOFT RUN WAS ON MONDAY AFTERNOON AND WE WENT LIVE OFFER TUESDAY, SO FROM TUESDAY MORNING, HOURS ARE FROM 8 A.M. TO 6 P.M. FROM OUR SOFT OPENING TO YESTERDAY EVENING AT CLOSURE, WE HAVE GIVEN 3 31 INTRUSIONS. A LARGE NUMBER.

IT DOESN'T SEEM THAT LARGE BUT A LARGE NUMBER INFUSIONS AND WE ARE ANTICIPATING A LARGER NUMBER OF INFUSIONS HAPPENING OUT AT THE FAIRGROUNDS. THIS IS OUR FIRST LINE OF DEFENSE -- WELL, OUR FIRST LINE OF DEFENSE, FOLKS, IS WEARING MASKS AND CHOOSING TO SOCIAL DISTANCING AND CHOOSING TO STAY AWAY FROM GROUPS AND OTHER PEOPLE.

THAT IS THE FIRST LINE OF DEFENSE.

VACCINATION. THAT IS PART OF THE FIRST LINE OF DEFENSE. BUT A SECOND LINE OF DEFENSE FOR US IS BEING ABLE TO GIVE THE ANTIBODY TREATMENTS IN THE EARLY STAGES OF COVID TO PREVENT THESE FOLKS NEEDING TO GO INTO THE HOSPITAL. HOSPITAL CAPACITIES ARE FULL.

THERE IS NOT ENOUGH -- THERE IS NOT ENOUGH STAFF.

THE STAFFING ISSUE IS CRITICAL HERE IN NUECES COUNTY AND ACROSS THE NATION REALLY. THE STATE OF TEXAS IS SUFFERING WITH THE SHORTAGE OF CLINICAL STAFF AND CLINICIANS AND RESPIRATORY THERAPISTS AS WELL AS THE SUPPLIES NEEDED FOR MANAGING INTRUSIONS OR -- INFUSIONS OR MANAGING COVID PATIENTS AND ICUS. THE NEED FOR ALTERNATIVE SITES.

AND OUR JOB TO LOOK BEYOND THAT OUR JOB IN MANAGE MANAGEMENT TO LOOK AHEAD AND I DON'T WANT TO BRING THIS INFORMATION FOR YOU, BUT WE HAVE TO THINK OF WHERE WE ARE AT.

REQUEST HAVE GONE OUT TO BRING -- WE DID THIS AT THE BEGINNING

[00:45:05]

OF THE PANDEMIC. TO BRING IN A MORGUE TRAILER FOR THE FAIRGROUNDS. WE ARE NOT ABLE TO HANDLE A LARGE CAPACITY OF DEATHS PER DAY AND HERE WE FIND OURSELVES.

ALL WE CAN DO IS STOP THE SPREAD OF THE VIRUS, TREATMENT PEOPLE EARLY, GET PEOPLE VACCINATED.

WE HAVE TO PREVENT THIS LAST PERSON HAPPENING.

TOO MANY DEATHS. THAT IS WHERE WE ARE AT AND THE WHOLE WORLD NEEDS TO BE WORRIED ABOUT IT RIGHT NOW.

THIS IS THE TIME WHERE PUBLIC MESSAGING AND SHARING INFORMATION IS SO INCREDIBLY CRITICAL.

WE ARE STILL RUNNING VACCINATION OPERATIONS.

TESTING HAS GOTTEN EVEN MORE LARGE OF OPERATIONS THAN IT WAS BEFORE. PUBLIC HEALTH IS TESTING ALSO AT THE MEMORIAL SITE. YESTERDAY WHEN I WENT OUT TO SITE TO CHECK ON THE INFUSION CENTER.

THE LINE FOR TESTING WAS AROUND THE BLOCK.

ALL AROUND THE HOSPITAL. SO PEOPLE ARE WORRIED.

PEOPLE ARE GETTING TESTED. I AM GLAD PEOPLE ARE GETTING TESTED BECAUSE YOU DON'T KNOW WHAT TO DO UNTIL YOU KNOW YOU HAVE COVID OR NOT. PLEASE GET TESTED.

PLEASE WEAR A MASK. PLEASE SOCIAL DISTANCE.

THE BIGGEST COMPONENT OR COMPLEXITY OF WHERE WE ARE AT IN THE RESPONSE RIGHT NOW TO COVID-19 IS THE FUNDING SIDE, IS THE REIMBURSEMENT SIDE, IS THE HOW DO WE CONTINUE TO DO THIS. I SAY FROM EMERGENCY MANAGEMENT FROM MELISSA THAT WE ARE AT ALL HANDS ON DECK, ALL FUNDS ON DECK POINT RIGHT NOW IN THE RESPONSE.

WE HAVE BEEN WORKING OUT HOW THIS IS GOING TO HAPPEN.

IT IS CHANGING EVERY DAY LIKE IT WAS IN THE BEGINNING OF THE PANDEMIC. THE RULES AND LIMITATION ON FUNDING HOW IT IS SPENT. WHAT IS SPENT ON WITH EVERY DAY THAT PASSES BY. THERE ARE CHANGES THAT COME DOWN FROM THE GOVERNOR'S OF OFFICE, GUIDANCE CHANGES ON SCHOOLS. AND SO EVERYBODY NEEDS TO BE HIGHLY AWARE AND ALERT RIGHT NOW, AND IT IS GOING TO -- GOING TO CHANGE OR REDIRECT WHAT WE ARE DOING HERE IN NUECES COUNTY TO COMBAT COVID-19.

BUT WE ARE READY. I NEED THE PUBLIC TO BE READY.

I WANT AS THE EMERGENCY COORDINATOR FOR THE COUNTY, I WANT PEOPLE TO WEAR MASKS. I WANT PEOPLE TO SOCIAL DISTANCE. I URGE THE LEADERSHIP IN THE AREA TO CONSIDER WHAT WE DID AT THE BEGINNING TO SAY EVERYBODY STAY HOME FOR TWO WEEKS. LET'S STOP THIS RISE, RIGHT.

THAT'S WHERE WE ARE AT AGAIN. AND THAT IS SOMETHING THAT I THINK IS VERY IMPORTANT. AS FAR AS FUTURE SUPPORT FOR THE STATE, THAT IS A BIG QUESTION IN CHANGING RIGHT NOW THAT WE ARE EXPERIENCING. WE HAVE AN URGENT NEED FOR STAFF. KRISTA SPANN, ADA, EVERYBODY IS SHORT ON CLINICAL STAFF. AT THIS POINT WE WERE TOLD ORIGINALLY THAT THOSE TYPE OF REQUESTS CAN BE SUBMITTED TO THE STATE. THAT COULD POTENTIALLY BE CHANGING OVER THE NEXT FEW DAYS AND WE MIGHT BE ABLE TO SEND IN A REQUEST. WE ARE ALREADY TALKING ABOUT HOW WE WANT TO HANDLE THOSE Q REQUESTS AS A COUNTY, AS A REGION USING THE COASTAL BEND REGIONAL ADVISORY COUNCIL TO LIAISON WITH THE HOSPITALS TO COMMUNICATE THE HOSPITAL NEEDS FOR US AND DEVELOP A FULL COMPREHENSIVE PLAN OR REQUEST PLAN. IN DOING THE REQUESTS TOGETHER, YOU KNOW, WHEN EVERYBODY SHOUTS AT THE SAME TIME, IT IS A LOT LOUDER. SO THIS IS GOING TO SHOW HOW DIRE AND URGENT THE NEED IN OUR REGION IS.

AND FURTHERMORE THE NEED AND URGENCY OF OUR SITUATION HERE IN NUECES COUNTY. THAT IS WHAT I HAVE AT THIS TIME. I AM GOING TO OPEN THE FLOOR TO QUESTIONS. I APOLOGIZE FOR HOW QUICKLY I AM GIVING THIS BRIEF, BUT, AGAIN, SEVERAL OPERATIONS THAT ARE GETTING UP AND STANDING AND ARE VERY CRITICAL FOR OUR

COUNTY. >>JUDGE CANALES: THANK YOU, MELISSA. WE WILL MOVE TONIGHT OTHER DISASTERS BRIEFLY SINCE WE DID HAVE FOLKS THAT STAYED IN THE ROOM TO DISCUSS FLOODING AND DRAINAGE, BUT AT THIS TIME, I WILL ASK IF THERE ARE ANY QUESTIONS FOR MELISSA.

IT'S A GOOD SUMMERY, BUT A LOT OF DISCUSSION WITH REGARDS TO ELIGIBILITY FOR THE INFUSION CENTER.

LET ME RUN OVER THREE IMPORTANT ASPECTS.

NUMBER ONE, IN ORDER TO USE THE INFUSION CENTER YOU MUST HAVE A REFERRAL FROM A DOCTOR. IF YOU DO NOT HAVE A DOCTOR, YOU NEED TO GO TO THE COVID CLINIC TO DETERMINE ELIGIBILITY AND THEY WILL GET YOU. THE THIRD ITEM I WANT TOO REITERATE THAT THE STATE IS PAYING FOR THE INFUSION CENTER IN EXHIBIT HALL A OPERATIONAL FRIDAY MORNING AT 0700.

THE CURRENT BRIDGE IS OPEN NOW. DOES NOT MEAN THAT INFUSIONS ARE NOT HAPPENING AT OUR THREE HOSPITALS.

THEY ARE. DR. HECTOR PETE WELLNESS HAVE

[00:50:04]

FIVE BEDS AND THEY ARE FULL. THE THERAPEUTIC IS MONOCHLONAL ANTIBODY. IT IS CALLED REGENERON.

IT IS FREE AND GRATEFUL TO THE MEDICAL SAFETY DR. WALKER AND MISS STIT FOR TAKING THE LEADERSHIP ROLE AND ALL THE PARTNERS. WE WOULDN'T HAVE BEEN DUE TO SOFT OPENING WHERE SEVEN PEOPLE NEEDED.

KRISTAS PAN GIVEN US THE REGENERON, THE SUPPLIES, WE ARE USING MEDICAL CORPS TENTSD. THOSE TENTS ARE BEING USED IN THE WAY THEY WERE MEANT FOR EMERGENCIES.

SO ARE THERE ANY QUESTIONS AT THIS THAT WE CAN ANSWER REGARDING THE RIC OR THE TEMPORARY RIC OR ANYTHING WITH REGARD TO COVID? I WILL ASK THAT YOU TUNE IN THIS AFTERNOON FOR THE PRESS CONFER REIGNS.

TEXAS A & M AND UNFORTUNATELY -- I HAVE ALREADY SEEN THE SLIDES. A GRIM PICTURE WHAT WILL HAPPEN IN 30 DAYS IF WE DO NOT DO EVERYTHING IN OUR POWER TO REVERSE THE TREND. THEY WILL SHOW YOU THE WORST THAT CAN HAPPEN AND THEY WILL ALSO LET YOU KNOW THAT IT DOESN'T HAVE TO HAPPEN LIKE THIS.

WE CAN CHANGE THE COURSE OF OUR DESTINY, BUT IT IS GOING TO TAKE ACTION. THANK YOU AND, AGAIN, THAT PUBLIC MESSAGE SOMETHING CRITICAL AND WE ARE MAKING EMERGENCY DECISIONS RIGHT NOW THAT YOU WILL SEE LATER.

AND I WOULD JUST ASK THAT YOU UNDERSTAND THAT THIS IS A DIRE SITUATION IN HOSPITALS THROUGHOUT THE STATE OF TEXAS AND PARTICULARLY IN SOUTH TEXAS WHERE WE ARE SPORTING A 50% HIGHER -- HIGHER AVERAGE THAN THE STATE OF TEXAS.

SO LATER, WHEN YOU SAY WHO TOLD YOU AND WHY DID YOU DO THAT, I AM LETTING YOU KNOW RIGHT NOW, WE ARE IMPLODING.

THIS IS ABSOLUTELY CRITICAL THAT WE ACT IN AN EMERGENCY.

AND EVEN THOUGH WE SIT HERE CALMLY IN COMMISSIONERS COURT, I PROMISE YOU, WE HAVE BEEN WORKING 24-7 OVER THE PAST TWO WEEKS TO NOT GET TO THE POINT THAT SO MANY OTHER COUNTIES FIND THEMSELF IN. WE AT LEAST FIND A BLUEPRINT FOR ACTION AND WE ARE READY TO -- TO SHOWCASE IT TO YOU.

IF YOU FEEL LIKE YOU NEED MORE INFORMATION ABOUT WHAT'S GOING ON, WHAT WE ARE DOING, WHAT WE ARE SPENDING ON, YOU WANT A WORKSHOP, YOU JUST LET ME KNOW, AND WE WILL GIVE IT TO YOU.

BUT WE ARE IN THE FULL THROES OF EMERGENCY ACTING UNDER THE DECLARATION AND DOING EVERYTHING TO SAVE LIFE.

AND I WOULD LIKE FOR YOU TO KNOW AND HEAR THAT FROM ME.

COMMISSIONERS, I YIELD TO YOU. >>COMMISSIONER HERNANDEZ: I DO HAVE A QUESTION. THIS IS COMMISSIONER HERNANDEZ.

DO YOU HEAR ME? >>JUDGE CANALES: GO AHEAD, S

SIR. >>COMMISSIONER HERNANDEZ:

MELISSA, DO YOU HEAR ME? >> YES, I HEAR YOU.

>>COMMISSIONER HERNANDEZ: THANK YOU FOR THE INFORMATION.

IT WAS GOOD. GOVERNMENT CODE 418 HAVE EMERGENCY MANAGEMENT TO HAVE A DISASTER PLAN.

DO WE HAVE ONE? >> YES, WE DO HAVE AN EMERGENCY MANAGEMENT PLAN. WE HAVE THE FULL EMERGENCY MANAGEMENT PLAN AND THEN WE HAVE OUR INDIVIDUAL ANNEXES THAT ADDRESS EACH DISASTER TYPE OF COMPONENT OF EMERGENCY MANAGEMENT. I HAVE STATE THIS BEFORE EARLIER THIS PANDEMIC. THOSE PLANS THAT WE DO HAVE, THEY SET A BACKBONE FOR OUR RESPONSE FOR DIFFERENT AREAS.

ANY KIND OF MASS MEDICAL OPERATIONS, PUBLIC HEALTH CRISIS. MASS SHELTERING AND OTHER THINGS LIKE THAT. BUT THIS PANDEMIC HAS BEEN

SOMETHING UNPRECEDENTED. >>COMMISSIONER HERNANDEZ: I

AGREE. >> AND SEVERAL DISASTERS WE EXPERIENCED ON TOP. BUT THIS PANDEMIC HAS REDEFINED HOW WE OPERATE. IT'S CHANGED BOUNDARIES.

IT HAS CHANGED THE WAY. IT HAS INTERRUPTED SUPPLY CHAINS WE DIDN'T THINK WOULD BE INTERRUPTED.

IT IS REALLY REDEFINE ALL OF OUR METHODS.

AND SO BEYOND THE PANDEMIC, ALL OF OUR PLANS WILL BE UPDATED TO REFLECT WHAT WAS LEARNED IN COVID-19.

THOSE PLANS ARE IN PLACE. OUR VOLUNTEER RECEPTION CORE THAT WE RAN FOR THE MASS VACCINATION SITES OUT AT THE FAIRGROUND. THAT VOLUNTEER MANAGEMENT SYSTEM WAS ALL WELL DESIGNED IN OUR VOLUNTEER MANAGEMENT PLAN AND MUCH THAT HAD TO BE ADOPTED AND ADAPTED BECAUSE OF THE THREAT THAT HE HAD. THE VIRUS.

THE FACT THAT IT COULD BE SOMETHING THAT COULD BE SPREAD.

THE FACT THAT WE DIDN'T KNOW CERTAIN THINGS ABOUT IT.

A LOT OF LIMITATIONS THAT WE HAD.

AND A LOT THAT OUR PLANS DIDN'T GIVE US THAT WE HAD TO FIGURE OUT SINCE THIS PANDEMIC HAD STARTED.

[00:55:01]

AGAIN, ALL THAT WILL BE APPLIED INTO OUR NEW PLANS, BUT AS OUR PLANS STOOD, NOTHING REALLY WOULD HAVE CLEARLY DEFINED OUT THESE DIFFERENT TYPES OF OPERATIONS WOULD HAVE OCCURRED.

>>COMMISSIONER HERNANDEZ: THANK YOU VERY MUCH.

I APPRECIATE YOUR BRIEFING AND I AGREE WITH YOU.

WE DON'T KNOW EVERYTHING ABOUT THIS VIRUS.

WE ARE STILL LEARNING AND APPRECIATE ALL THAT YOU DO.

THANK YOU VERY MUCH. >> THANK YOU, SIR.

>>JUDGE CANALES: THANK YOU.3 ANY OTHER QUESTIONS FOR MELISSA

OR COMMENT AT THIS TIME? >> JUDGE, I JUST WANT TO COMMENT ON THIS. THE INFUSION CENTERS EXIST TO SEE OUR COUNTY ON THE CUTTING EDGE OF RESPONSE IN DEALING WITH COVID EVER SINCE THE BEGINNING AND THIS IS JUST ONE OF AMERICAN ITEMS THAT WE HAVE TAKEN THE LEAD.

SO I AM THANKFUL THAT WE HAVE THOSE RESOURCES THAT HAVE COME TOGETHER THAT YOU, MELISSA AND OTHERS HAVE WORKED TO GET THIS TO HAPPEN AND I HOPE MORE OF OUR PARTNERS JOIN IN AND PARTICIPATE. I KNOW THERE WERE SOME KEY GROUPS THAT WERE NOT MENTIONED WHEN MELISSA LISTED ALL THE GROUPS AND HOPEFULLY PEOPLE SEE THE VALUE AND HOW IMPORTANT TO HELP REDUCE, MINIMIZE THE ACTUAL IMPACT ON COVID ON INDIVIDUALS. SO I AM WAITING AND WE WILL BE LOOKING TO SEE WHAT THE RESPONSES ARE AND HOW THE HEALING RATES AND RECOVERY RATES GO WITH THIS.

SO THANK YOU ALL FOR YOUR WORK. >> THANK YOU, COMMISSIONER.

>>JUDGE CANALES: COMMISSIONERS?

>>COMMISSIONER CHESNEY: JUDGE, I JUST WANT TO ADD REAL QUICK, I THINK YOU ALL SAID A LOT OF WHAT I WOULD HAVE SAID, AND I ECHO A LOT OF THE STATEMENTS MADE.

I THINK WITHOUT A DOUBT -- I WILL BE HONEST.

THAT IS THE REASON I AM ZOOMING THIS WEEK.

I AM A LITTLE, YOU KNOW, UPTIGHT WHAT IS GOING ON.

THIS DELTA VARIANT IS EXTREMELY SERIOUS.

I HAVE BEEN -- I HAVE PUT BACK INTO EFFECT IN MY BUSINESS THE MANDATORY WEARING OF MASKS WHEN THEY ARE AWAY FROM THEIR WORK STATIONS TO PROTECT PEOPLE. I CAN'T DO THAT EVERYWHERE, AND I AM NOT SURE THAT IS WITHIN THE RIGHTS OF ANY OF US TO DO, BUT AT THE SAME TIME, MY PRIVATE BUSINESS I DECIDED TO DO THAT FOR THE SAFETY AND WELFARE OF MY EMPLOYEES.

I THINK IT IS IMPORTANT TO NOTE THAT, YOU KNOW, WE NEED TO BE ENCOURAGING PEOPLE TO STAY DISTANCED AND WEAR MASKS AND DO THE THINGS THAT YOU NEED TO DO TO KEEP SAFE.

IT IS A VERY DIFFICULT TIME. THIS DELTA VARIANT IS REALLY, REALLY SCARY ESPECIALLY WITH THE EFFECT IT IS HAVING ON CHILDREN, UNLIKE THE LAST ONE. THAT IS VERY SCARY.

YOUNG PEOPLE, HEALTHY PEOPLE. I KNOW WE HAVE LOST, YOU KNOW, YOUNG PEOPLE DURING THIS TIME. PEOPLE WHO WE LOST HAVE BEEN YOUNG, HEALTHY AND OTHERS -- THE YOUNG MOTHER WE LOST HERE LOCALLY, JUDGE, IF I AM NOT MISTAKEN AND I DON'T WANT TO SAY SOMETHING THAT IS WRONG -- BUT YOU ARE NODDING YOUR HEAD AND THAT IS WHAT YOU ARE SAYING.

A DIFFICULT, DIFFICULT TIME AND SHAME BECAUSE WE WORKED SO HARD TO GET THE VACCINE. WE THOUGHT THE VACCINE WAS REALLY GOING TO HELP. A LOT OF PEOPLE HAVE CHOSEN NOT TO GET VACCINATED. THAT IS DIFFICULT.

THE DIFFICULTY OF THIS TOO WATCHING THESE STATISTICS THAT 95 -- AGAIN I DON'T WANT TO MISQUOTE, THE VAST MAJORITY -- THE VAST, VAST MAJORITY OF OUR HOSPITALIZATIONS ARE UNVACCINATED PEOPLE. WHEN I COULD -- WHAT I COULD READ AND AGAIN MY OPINION NOT A FACTUAL -- NOT A FACTUAL STATEMENT BUT WHAT I READ, THE VACCINE, IT HELPS MITIGATE THE SYMPTOMS BUT THE VACCINE IS HELPING MORE THAN ANYTHING E ELSE, BUT YET, YOU KNOW, I GOT PEOPLE THAT WORK FOR ME THAT I KNOW HAVE BEEN VACCINATED AND STILL HAVE GOTTEN COVID.

FORTUNATELY THEIR SYMPTOMS HAVE BEEN THE HIGHER AND NOT ONES IN THE HOSPITAL, THANK GOD, AT THIS POINT.

BUT IT IS A DIFFICULT TIME AND PEOPLE WILL CONSIDER MAKING IN NOT POLITICAL AND LET PEOPLE WHO THEY ARE AND IF THEY WANT TO WEAR A MASK, LET THEM AND DON'T HARANGUE AND SAY ANYTHING BAD WITH THEM AND VICE VERSA IS A.

AND TOUGH EVERYBODY IN LEADERSHIP POSITION -- LOCALLY -- FEDERAL AND STATE I DON'T KNOW THOSE PEOPLE -- ARE TRYING TO DO THIS NOT IN A POLITICAL FASHION BUT WHAT IS RIGHT.

SOMETIMES THE DECISIONS WILL BE QUESTIONED AND SOME PEOPLE WON'T THINK THEY ARE RIGHT BUT A DIFFICULT TIME AND, YOU KNOW, I CONTINUE TO PRAY FOR THOSE WHO ARE IN THE POSITION THEY ARE IN OF MAKING THESE DAY-TO-DAY DECISIONS AND I APPRECIATE WHAT YOU ARE DOING AND HAVING TO GO THROUGH.

>>JUDGE CANALES: THANK YOU, COMMISSIONER.

IS THERE ANYBODY ELSE? AGAIN, I AM GOING TO REITERATE

[01:00:02]

-- >>COMMISSIONER GONZALEZ: ALL I CAN TELL YOU, WE ENCOURAGE EVERYBODY TO WEAR A MASK

WHENEVER YOU CAN. >>JUDGE CANALES: SORRY, IT IS

VERY DIFFICULT TO HEAR YOU. >>COMMISSIONER GONZALEZ: WASN'T WEAR A MASK -- ENCOURAGE EVERYBODY TO WEAR A MASK WHENEVER YOU CAN. YOUR CALL, BUT BE COURTEOUS OF PEOPLE AROUND YOU. I JUST -- YOU KNOW, OUR PRAYERS ARE WITH THOSE FAMILIES THAT HAVE BEEN TOUCHED BY THIS VIRUS. AND WILL CONTINUE TO PRAY FOR

THEM. >>JUDGE CANALES: THANK YOU.

I ALSO -- AGAIN, I WAS JUST SAYING I WANT TO REITERATE, ALL YOU HAVE TO DO IS CALL MELISSA OR MY OFFICE, AND WE WILL GET YOU ANY INFORMATION THAT YOU NEED ON COVID, WHETHER IT IS STATISTICS THAT HELPS YOU ANSWER A CONSTITUENT'S QUESTION ANYTHING REGARDING OUR CENTERS. WE ARE COORDINATING WITH SO MANY ENTITIES AND USING OUR LEGISLATIVE DELEGATION TO GET ALL OF OUR MESSAGES BACK TO OUR LEGISLATIVE DELEGATION THAT WE KNOW, A, GRATEFUL FOR THE STATE OF TEXAS AND TO FUND THE RAPID INFUSION CENTER TO UNDER THE HOSPITALS AND STAFFS THAT -- THAT THEY ARE ABOUT TO MAKE WITH REGARD TO FUNDING.

WE WANT TO BE VERY ACTIVE IN THAT -- IN THAT VOICE.

AND LATER THIS AFTERNOON, WE WILL BE TALKING ABOUT LEGAL QUESTIONS AS IT APPLIES TO FUNDING AND USING OUR FUNDS FROM OUR PLACE. WE WILL HAVE THAT DISCUSSION LATER, BUT REALLY IMPORTANT FOR YOU TO KNOW THAT -- DO NOT MISTAKE US ACTING QUICKLY AND EXPEDITIOUSLY FOR NOT, YOU K KNOW, CHECKING WITH YOU OR GETTING YOU THE INFORMATION THAT YOU NEED. ANYTHING THAT YOU WANT TO KNOW OR YOU NEED TO KNOW, WE CAN GET IT FOR YOU VERY QUICKLY, BUT WE ARE WORKING LITERALLY AROUND THE CLOCK, YOU KNOW, THIS MORNING IT WAS ABOUT GETTING, YOU KNOW, A BETTER, BIGGER, BADDER GENERATOR SO THOSE TENTS CAN STAY COOLER BECAUSE THEY WERE UNHAPPY WITH THE TEMPERATURE IN THOSE TENTS YESTERDAY. IT WAS A LOGISTICS OPERATION THAT, QUITE FRANKLY, SHOULD TAKE ALL OF OUR TIMES IF JUST THAT ONE THING. AS MELISSA ALWAYS POINTS OUT NOT ONE THING BUT ABOUT 20 THINGS.

THE NEW THING IS WE KNOW OUR COVID CLINIC NEEDS NEW -- MORE STAFF REPORT. THE HEALTH DEPARTMENT NEEDS STAFF SUPPORT. AND WE ARE WORKING FURIOUSLY TO GET POSITIONS AT CITY-COUNTY PUBLIC HEALTH THAT ARE NOT CURRENTLY FILLED. AND SO, AGAIN, A LOT OF MOVING PARTS. IF YOU KNOW PEOPLE WHO HAVE A HEALTH BACK GROUND WHO MOISTURE IN RETIREMENT THAT WANT TO BE A PART OF THE SOLUTION AND JUST SAY, HEY, I AM GOING TO COME OUT OF RETIREMENT AND HELP. MELISSA HAS A VOLUNTEER ORGANIZATION THAT SHE MENTIONED SHE CAN GET YOU THE NUMBER TOO.

AND WE ARE BEING THE FACILITATORS AND THEY ARE REALLY DOING ALL OF THE -- THE SURVEY, IF YOU WILL, AND IN TAKING THE INFORMATION THAT GETS THOSE AMAZING PEOPLE TO THE RIGHT LOCATION. MELISSA, WE CAN QUICKLY MOVE AWAY FROM COVID AND ANSWER QUESTIONS WITH REGARD TO THE FLOODING AND DRAINAGE, YOU MAY NOT OR NOT HAVE BEEN ON AND THEY PROVIDED AMAZING PHOTOS. I LAKEFRONT SENT THEM TO YOUR OFFICE AND TO SUSAN ROTH, BUT THE QUESTIONS REALLY CAME OF THE DELINEATION OF WHOSE RESPONSIBILITY IS CERTAIN MAINTENANCE OF DRAINAGE DIT DITCHES.

AND I WAS GOING TO SUGGEST THAT -- THINK THAT WANTED THE FOLKS TO SEE YOU AND UNDERSTAND THAT OUR OFFICE CONSIDERS DRAINAGE AND FLOODING PARAMOUNT. AND WE ARE WORKING COMPREHENSIVELY BEFORE WE CAN BAND-AID FOR THE BIG PROJECTS AND THE BAND-AID FOR THE CLEANING OF THOSE DITCHES AND WE WILL IDENTIFY THE PICTURES TO THE MAPS BY GIS, FIGURE OUT, A, WHOSE RESPONSIBILITY, B, CAN WE HELP IN THAT RESPONSIBILITY, AND C, TRY TO FOLLOW UP WITH THESE CONSTITUENTS IN OUR AUDIENCE TODAY. I DON'T KNOW IF YOU WANTED TO MAKE A BLANKET STATEMENT ABOUT THAT SO THEY KNOW WHO YOU ARE AND THAT THEY CAN USE YOUR OFFICE AS A RESOURCE.

>> YES, ABSOLUTELY FOR MISSING THAT THIS MORNING BUT THANK Y YOU, JUDGE, FOR GIVING ME A QUICK SYNOPSIS.

SO I WILL BE HERE. FOLKS, YOU HAVE MY PHONE NU

[01:05:04]

NUMBER. YOU GAVE IT OUT LAST TIME.

361-533-2355 IS MY CELL PHONE AND E-MAIL ADDRESS IS MEL MELISSA.MUGIA@NUECESCO.COM. YOU CAN REACH ME EITHER WAY.

I WILL WORK -- WE HAVE BEEN COMPILING A LOT OF PHOTOGRAPHS OF DAMAGE THAT YOU IN COMMUNITIES SENT IN THAT IS GIVING US A VERY GREAT PICTURE. FOR THAT SPECIFIC DEBRIS, IF YOU WILL SEND THOSE PICTURES AND ANYTHING YOU HAVE TO ME, I WILL WORK WITH OUR PUBLIC WORKS DEPARTMENT AND WORK WITH GIS LIKE THE JUDGE SAID, WE CAN LAY OUT A MAP AND WE WILL MAKE A PLAN HOW WE CAN GO THROUGH -- AGAIN, WE HAVE TO ASSESS DEPENDING ON WHAT AREA -- WHOSE AREA OF RESPONSIBILITY IT IS, BUT WE WILL GET THOSE PLAYERS TO SIT DOWN TOGETHER IN A MEETING AND TALK OF CREATING ONE, TWO OR THREE STEPS THAT WE CAN FOLLOW TO GET THROUGH THIS PROCESS.

IF WE CAN CLEAN UP DEBRIS. OBVIOUSLY IT IS GOING TO HELP US HAVE LESS FLOODING THE NEXT TIME WE HAVE AN EVENT.

THE DRAIN DAMAGE IS THE PRIORITY.

I'M HERE TO BE THE COORDINATOR BETWEEN THE COMMUNITY AND PUBLIC WORKS AND THE DIFFERENT ORGANIZATIONS THAT MIGHT BE INVOLVED IF THIS IS A STATE ROAD.

IT DOESN'T MATTER. I WILL MAKE SURE THAT THE RIGHT PLAYERS ARE COMMUNICATING SO THAT WE CAN ADDRESS THOSE ISSUES. THOSE TEMPERATURE FIXES UNTIL WE REALLY GET THAT COMPREHENSIVE PLAN TOGETHER ON IMPROVING THE DRAINAGE AND THE FLOOD CONTROL HERE IN NUECES

COUNTY. >>JUDGE CANALES: MELISSA, THEY DON'T NEED TO SEND IT. I WILL PUT IT ON A THUMB DRIVE AND SEND IT TO YOU. I RECEIVED A QUICK MESSAGE THAT JUAN OUR COUNTY ENGINEER WILL BE PRESENTING A DRAINAGE REPORT ON AUGUST 16. SO THAT -- THAT IS JUST -- HE IS GOING TO CONFIRM THAT RIGHT NOW FOR US THAT YOU WILL GOING TO BE PRESENTING. GO AHEAD.

>> THAT'S RIGHT, JUDGE AND COMMISSIONERS.

WE WILL BE DOING A COMPLETE PRESENTATION ON MONDAY ON THE 16TH REGARDING DRAINAGE ISSUES FROM THE LAST TWO PREVIOUS RAIN EVENTS. WE HAVE TALKED TO THESE TWO CONSTITUENTS I DON'T WANT TO PRONOUNCE THESE -- FERGIN? YES, THEY BROUGHT OUR CONCERNS TO OUR OFFICE AND I APPRECIATE THAT AND RECEIVED -- AS YOU COMMISSIONERS AND JUDGE.

YOU RECEIVED NUMEROUS COMPLAINTS OF THE DRAINAGE WITHIN THE SUBDIVISION AND I KIND OF WANT TO BE REAL BRIEF, JUDGE, WHAT I AM GOING TO TALK ABOUT ON MONDAY.

WE ARE DOING SOME DITCH GRADING IN TWO OF THE SUBDIVISION IN THE NORTHWEST AREA OF OUR COUNTY.

ONE IS BROADWAY -- BROAD ACRES AND THE OTHER IS VALLEY VIEW.

WE ARE DOING DITCH MAINTENANCE IN THAT AREA.

REGARD TO THE MOWERS, WE HAVE -- I DO APPRECIATE YOU GOING OUT THERE AND DOING MOWING. I KNOW IT IS NOT YOUR RESPONSIBILITY, BUT I KNOW THAT RIGHT NOW WE HAVE AS CHERRY HAD DISCUSSED PREVIOUSLY IN OUR BUDGET MEETING, WE ONLY HAVE EIGHT MOWERS GOING ON NOW. IF WE DO MOW, MAYBE TWICE A YEAR, THAT IS A LOT WITHIN OUR RIGHT-OF-WAYS.

SO I KNOW IT COMES DOWN TO -- TO MAN POWER AND EQUIPMENT SO BASED ON THE MAN POWER AND EQUIPMENT TWO MOWS PER YEAR IS WHAT WE WILL BE DOING THROUGH OUR NUECES COUNTY BUT I THANK YOU FOR MOWING OUR RIGHT RIGHT-OF-WAY.

>>JUDGE CANALES: CAN YOU MOVE THE MIC BY ME.

>> CAN YOU HEAR ME NOW. >>JUDGE CANALES: CAN YOU TAKE THAT MIC WAY UP ON THE SOUND. WE CAN'T HEARING ANYTHING.

>> WITH THE LEGAL DUMPING. WE HAVE TWO ENVIRONMENTAL ENFORCEMENT OFFICERS I KNOW THEY ARE LIMITED LET'S SEE IF THEY CAN CORRECT THIS AND WE CAN NOT HEAR.

I'M PRETTY GOOD AT READING LIPS BUT NOT THROUGH THE TUBE.

>> HAD YOU ABOUT NOW. >> SWITCH WITH TYNER IF YOU C

CAN. >> JUST REAL BRIEF, JUDGE.

[01:10:08]

WE ARE CLEANING DITCHES IN BROAD ACRES AND VALLEY VIEW AND DOING DITCH CLEANING AND CULVERT CLEANING.

I KNOW THAT WE WERE RIGHT NOW -- I AM GOING TO BE REAL BRIEF BECAUSE I AM GOING TO DO A PRESENTATION.

>> REMEMBER THIS IS UNDER DISASTER.

THIS IS IN RELATIONSHIP TO THE FLOODING THAT OCCURRED AND I AM HELPING YOU HERE SO SAY THAT IS ACCURATE, RIGHT.

>> THAT'S CORRECT, JUDGE. WE HAVE TWO -- I KNOW COMMISSIONER HERNANDEZ RENTED OUT TWO ADDITIONAL FOR US TO KIND OF CAPTURE AND KEEP UP WITH OUR MAINTAINING.

ONLY SO MUCH MAN POWER TO PERFORM SOME OF THIS WORK.

SO COMMISSIONER THANK YOU. ON THE MOWERS MENTIONING EIGHT MOWER. WE ARE LUCKY WE DO MAINTENANCE THROUGHOUT THE WHOLE COUNTRY FOR TWO MOTION THROUGHOUT THE WHOLE YEAR SO I KNOW THAT JERRY HAD MENTIONED 20 SOMETHING MOWERS. 24 MOWERS AT ONE TIME.

SO WE KIND OF. WITH REGARDS TO ENFORCEMENT.

WE HAVE TWO ENVIRONMENTAL ENFORCEMENT AND I KNOW THEY ARE KIND OF SPREAD OUT THROUGHOUT THE WHOLE COUNTY, SO I WILL MAKE SURE THAT THEY GO OUT THERE AND I ALREADY TALKED TO OUR CODE ENFORCEMENT OFFICERS SINCE YESTERDAY AND TOLD THEM -- FOR THEM TO START DRIVING OUT THERE AND DOING SOME OF THE ROUNDS ON COUNTY ROAD 50 AND 69.

WITHIN OUR LIMITS. I WILL DO A PRESENTATION.

A VERY THOROUGH PRESENTATION ON MONDAY AND WITH REGARDS TO DRAINAGE AND WITH REGARDS TO ENVIRONMENTAL ENFORCEMENT AND TO KIND OF UPDATE COMMISSIONERS ON PUBLIC WORKS AND WHAT WE HAVE DONE HERE IN THE PAST YEAR OF PUBLIC WORKS.

>>JUDGE CANALES: WE APPRECIATE THAT.

ALL OF THAT HAS TO DO WITH THE DISASTERS.

ALL THIS WORK THAT YOU ARE GOING TO TALK ABOUT IS REALLY GERMAIN BECAUSE OF THE EXTREME WEATHER 'EENTS AND THE -- EVENTS. THESE FLOODS IN 2016 AND 2015 SHOULD HAVE PUT US ON NOTICE. BUT THE MAY AND JULY FLOODING HAVE SHOWCASED WHAT THE PROGRAMS ARE.

>> NORMALLY IN YEAR YOU DON'T HAVE OVER 100-YEAR INTENSITY.

BACK IN MARCH AND THEN HERE LAST MONTH.

THERE ARE 100 YEAR -- 12 INCHES AN HOUR.

WITHIN A DAY THAT IS A LOT OF RAIN.

SO IT IS NOT -- IT IS NOT NORMAL.

YOU GET THAT -- YOU GET THAT ONCE EVERY -- YOU GET THAT ONCE

EVERY 100 YEARS. >>.

>>I HAVE A COMMENT. >> EXCUSE ME ONE SECOND.

IT IS HARD FOR ME. I GOT TO LET THE CAMERA SWITCH.

LET ME CALL FOR ANY -- ANY COMMENTS OR QUESTIONS.

GIVE IT A SECOND. AND THEN IF YOU WILL SAY I HAVE -- WE ACTUALLY HAVE BUTTONS NOW AND WE ARE GOING TO START USING THEM SINCE WE DO A LOT OF VIRTUAL TECHNOLOGY.

HOPEFULLY YOU CAN LET US KNOW ONLINE -- OR LET US KNOW WITH THE BUTTON YOU WANT TO SPEAK WHEN WE ARE ON VIRTUAL.

GO AHEAD, COMMISSIONER. >> YES, I WANTED TO LET THE FOLKS AND JUAN KNOW I GOT AN E-MAIL YESTERDAY IN MY OFFICE ABOUT THE CONCERNS OF THE DI DITCH.

ON COUNTY ROAD 69. I DID GET IN CONTACT WITH

PEOPLE >>JUDGE CANALES: THE TEXAS.

IF WE CAN COMBINE THEM, ME MAY QUALIFY FOR FEMA PUBLIC ASSISTANCE SO WE ARE LOOKING FOR A DICK LA RATION AT THE

[01:15:03]

HIGHER LEVEL WITH REGARDS TO THOSE.

THE ONE THING THAT -- I JUST WANT TO END WITH IF THERE ARE NO OTHER COMMENTS HERE IS THAT I SHOULD HAVE REMARKED WE ARE -- THIS IS REALLY FOR DALE, BUT I AM GOING TO HOPEFULLY HAVE A LONGER CONVERSATION. BUT WE ARE GOING TO OPEN UP NEW FEMA PROJECT WORKSHEETS TO ASSIST US BECAUSE THE ORIGINAL ONES REALLY FOCUSED ON VACCINE. SO WE ARE GOING TO DO TWO THINGS. ONE IS WE WILL GET A SCOPE MODIFICATION NOT JUST THE FAIRGROUNDS THAT WE ARE WORKING IN. NOW THAT WE HAVE CLINICS ALL OVER. MOBILE OPPORTUNITIES, RAPID INFUSION CENTERS. WE NEED A SCOPE MODIFICATION AND WE ARE WORKING ON THAT TO GET THOSE -- THAT FUNDING EXPANDED AND THE SECOND THING IS THE COMPLETELY DIFFERENT FEMA PROJECT WORKSHEET RELATED TOENTIAL OTHER NEEDS THAT MIGHT BE YOU KNOW THAT MIGHT POP UP DUE TO HOSPITALS NOT HAVING APPROPRIATE CAPACITY TO HANDLE FOLKS.

I SHUTTER TO THINK WHAT HAPPENS IF WE HAVE 1600 PEOPLE IN THE HOSPITAL LIKE THE PROJECTIONS ARE GOING TO SAY.

WHERE WILL WE PUT THEM? WHAT OTHER VENUES AND CENTERS WOULD WE HAVE TO CREATE. WE NEED TO MAKE SURE WE HAVE ADVANCED FUNDING LIKE WE DID FOR VACCINES.

THAT MEANS MONEY SITTING IN OUR TREASURY.

NOT THAT WE ARE HAVING TO SPEND IT.

IT DOESN'T MEAN YOU DON'T HAVE TO GET THE PAPERWORK AND JUSTIFICATION BUT MEANS YOU ARE PREPARED AND YOUR COUNTY HAS FUNDS AND IT CAN SPEND. WE DID THAT FOR VACCINES.

IT WAS SMART. WE HAVE GOT THOSE MONIES THAT ARE BASICALLY DRAWING DOWN DONE AND WE NEED TO DO THE SAME FOR THESE NEW PROJECTS. I WANTED YOU GUYS TO HEAR THAT.

THAT IS SUPER IMPORTANT BECAUSE TRUST ME, WE WORRY ABOUT EVERY DOLLAR, BUT WE WORRY ABOUT LIFE FIRST AND FOREMOST AND TRYING TO DO BOTH AT THE SAME TIME BE FISCALLY SMART AND REACT QUICK NOW LIFE IS PROTECTED. WE WILL SHARE FEMA MODIFICATIONS AND NEW PROJECT WORKSHEETS WHENEVER YOU NEED IT OKAY. WE CAN MOVE ON THE DISASTERS THAT FLOODING HAVE CAUSED AND COVID-19.

[2. CONSENT AGENDA: The following Agenda Items are of a routine nature, and the Commissioners Court has received supporting materials for consideration. All of these Agenda Items will be passed with one vote without being discussed separately, unless a member of the Commissioners Court or the public requests that a particular Agenda Item be discussed. If so, that Agenda Item will be pulled from the Consent Agenda and discussed as part of the regular Agenda at the appropriate time. One vote will approve the remaining items on the Consent Agenda.]

CONSENT AGENDA AND REVIEW ITEMS A THROUGH I AND ANY THAT NEED SPECIAL CONSIDERATION OR HAVE QUESTIONS? I WOULD LIKE TO HEAR A MOTION TO APPROVE THE CONSENT AGENDA IF THERE ARE NONE -- NONE TO REMOVE.

NO EYE TOMBS BE MOVED. >>COMMISSIONER CHESNEY: SO

MOVED. >>JUDGE CANALES: I WILL SECOND. ALL IN FAVOR SIGNIFY BY SAYING AYE. OPPOSED SAME SIGN.

[1. Discuss and consider interlocal agreement with City of Corpus Christi, San Patricio County, Port of Corpus Christi Authority, and Port Industries of Corpus Christi regarding the Coastal Bend Bays & Estuaries Program.]

WE WILL MOVE INTO REGULAR AGENDA AND THE VERY FIRST ONE IS AN INTERLOCAL AGREEMENT BETWEEN THE SI OF CITY OF CORPUS CHRISTI, SAN PATRICIO, PORT OF CORPUS CHRISTI AUTHORITY, PORT INDUSTRIES OF CORPUS CHRISTI, COASTAL BEND BAYS ESTUARIES. I JUST ALWAYS ASK THIS.

RAY, BEFORE WE GET STARTED IF YOU CAN HELP INTRODUCE OR IF YOU ARE HERE FOR A RESOURCE, BUT OUR NUECES COUNTY ATTORNEY, IS EVERYTHING IN ORDER FOR THIS AGREEMENT TO BE -- TO PROCEED WITH THIS AGREEMENT AT THIS TIME?

>> YES. IT HAS BEEN REVIEWED BY OUR OFFICE AND APPROVED BY THE COURT.

>>JUDGE CANALES: GREAT. RAY, DO YOU WANT TO SET THE TONE FOR US? JUST NEED TO UNMUTE, RAY.

>> IT SAYS HE IS UNMUTED BUT WE CAN'T HEAR HIM.

>>JUDGE CANALES: WE SEE THAT YOU ARE UNMUTED RAY, BUT NO

AUDIO. >>JUDGE CANALES: OKAY.

GO AHEAD, DOCTOR. THIS IS WHY BACKUP IS GOOD.

>> I WAS NOT PREPARED TO SPEAK, SO, YOU KNOW, THE CBBEP IS L

[01:20:10]

LOOKING TO UPDATE OUR INTERLOCAL AGREEMENT THAT HAS BEEN IN PLACE FOR 20 YEARS NOW AND WE ARE UPDATING IT AFTER A RECENT UPDATE OF OUR BYLAWS. IT ALREADY HAS BEEN APPROVED BY THE PORT, THE PORT OF CORPUS CHRISTI COMMISSION AND LOOKING FOR THE OTHER LOCAL PARTIES ARE PART OF THE AGREEMENT TO SIGN AND SET OUR COURSE AGAIN FOR THE NEXT SEVERAL YEARS HERE.

OBVIOUSLY I THINK MOST OF THE COMMISSIONERS KNOW ALREADY, THAT THE COUNTY DOES HAVE A SEAT ON OUR BOARD OF DIRECTORS.

AND THE JUDGE FILLS THAT -- FILLS THAT ROLE OR HER PROXY IF SHE IS UNABLE TO ATTEND. SO -- AND THE COUNTY HAS BEEN ON THE BOARD FOR -- SINCE THE PROGRAM'S INCEPTION.

IT HAS BEEN AN INTEGRAL PART OF MOVING OUR ORGANIZATION FORWARD OVER THE YEARS AND WE JUST APPRECIATE THE CONTINUED SUPPORT AND, YOU KNOW, I DON'T KNOW WHAT ELSE TO SAY.

>>JUDGE CANALES: I THINK THAT IS GOOD.

I THINK THAT IS GOOD. I WILL CHECK WITH RAY ONE MORE TIME. RAY, DO YOU HAVE YOUR AUDIO? DON'T WORRY, RAY. LET ME MOVE TO COMMISSIONER CHESNEY TO GIVE A LITTLE BIT MORE TIME.

COMMISSIONER CHESNEY. >>COMMISSIONER CHESNEY: THANK YOU, JUDGE. I AM VERY MUCH IN SUPPORT OF THIS. I THINK THE COASTAL BEND BAYS AND ESTUARIES IS A PHENOMENAL ORGANIZATION IN NUECES COUNTY.

AND I KNOW THEY SERVE MORE THAN NUECES COUNTY, BUT THAT IS OUR FOCUS TODAY. I WILL ALSO OFFER JUDGE -- YOU SERVE AND TAKE THAT SERIOUSLY. IF THERE IS A TIME THAT YOU ARE NOT AVAILABLE, I WOULD LOVE TO BE THE ALTERNATE TO SIT THERE IN CASE YOU I NEED SOME BACKUP. I KNOW YOU ARE THERE MOST OF THE TIME BUT DON'T NEED TO, BUT SITUATIONS ARISE THAT YOU CAN'T, I WILL BE HAPPY TO SIT IN FOR YOU AND TAKE YOUR PROXY AS YOU WOULD LIKE, BECAUSE THAT IS OBVIOUSLY A VERY IMPORTANT ORGANIZATION. AND ESPECIALLY -- TO ALL OF NUECES COUNTY BUT MY PRECINCT AND I WILL BE HAPPY TO SERVE AS AN ATNALITY IF THE JUDGE CAN'T MAKE IT.

>>JUDGE CANALES: I WILL ACCEPT THAT.

THAT WILL BE GREAT. BELINDA HAS BEEN ATTENDING WHEN I CAN'T BE THERE, BUT AS YOU SAID NORMALLY I AM THERE.

I AM PROUD TO SAY I AM NOW THE VICE CHAIR OF THE ENTITY.

DR. BRIAN GULLE Y, OUR APPOINTEE FROM THE COUNTY, IS THE CHAIR. WATCH DR. STANCIL SMILE.

I HAVE BECAUSE OF COVID NOT BEEN AS ACTIVE AS I NEED TO BE BUT I CAN USE A PARTNER AND I THINK I JUST FOUND ONE.

I AM CHAIRING WITH DR. STANSIL THE DEVELOPMENT COMMITTEE.

AND DR. STANCIL, IF WE CAN HAVE -- YOU CAN EVEN HELP ME CO-CHAIR THAT WITH DR. STANCIL. WHAT WE NEED TO DO IS WIDEN OUR NET AND GIVE YOU BASICALLY ALL THE INFORMATION.

LIKE BEING ON THE BOARD BUT NOT VOTING.

>>COMMISSIONER CHESNEY: THAT WILL BE GREAT.

I WILL BE HAPPY TO. >>JUDGE CANALES: IF THAT CAN HAPPEN, DR. STANCIL. I HAVE IDEAS AND NOW I WILL SOMEBODY TO BOUNCE THOSE IDEAS OF.

BRENT, WE NEVER HAD THIS. WE NEED TO DO BIGGER DEVELOPMENT. WHAT IS HAPPENING ON THE COAST WITH THE DOLLAR AMOUNTS THAT ARE AVAILABLE WITH RESTORE AND NERDA AND GLO JUST REQUIRED THAT WE HAVE THE ADEQUATE STAFF TO HANDLE THE ADMIN OF THESE GRANTS.

EPA GIVES US THOSE DOLLARS TO WORK WITH.

TECQ MATCHES, BUT WE HAVE NOT HAD A RAISE IN 20 YEARS.

AND WE REALLY NEED THE COAST TO LEAD ON THIS LIKE WE LEAD ON TWYA. SENATOR TAYLOR FROM GALVESTON HAS THE OTHER NEP, BUT IF WE HAVE A BIGGER DEVELOPMENT COMMUNITY -- DEVELOPMENT ISN'T JUST MONEY, BUT DEVELOPMENT OF WHAT WE ARE ALREADY DOING. AND GETTING THE APPROPRIATE STATE FUNDING IS KEY. AND CHAIRMAN HUNTER HAS ALWAYS BEEN SUPPORTIVE AND WE HAVE NOT BEEN ABLE TO BRING IT HOME TWO SESSIONS IN A ROW BECAUSE WE HAVE GOT TO MAKE IT A HIGH PRIORITY AND USE SOME HELP. DR. STANCIL, DOES THAT

ADEQUATELY REPRESENT. >> I WELCOME THE SUPPORT AND I WILL BE REACHING OUT TO YOU FOR SURE.

>>COMMISSIONER CHESNEY: JUDGE, LET ME ASK YOU IN THE MODE OF DEVELOPMENT, I WOULD THINK OF ALL THE COASTAL RESTORATION THAT -- THAT THE ESTUARY GROUP DOES THAT SOME OF OUR FUNDS IF THEY ARE NOT ALREADY BEING APPROPRIATED THERE, ONE OF THOSE AREAS WE CAN LOOK AT FOR SPECIFIC PROJECTS AND THINGS OF

[01:25:01]

THAT NATURE BECAUSE I THINK THAT IS EXACTLY WHAT THE GO MESA FUNDS ARE FOR AND WE HAVE PROJECTS LINED -- IN LINE FOR SOME OF THOSE FUNDS, BUT THAT IS CERTAINLY ONE OF THE AREAS WE LOOK AT. KNOW, IN THAT VAIN.

BECAUSE WITHOUT A DOUBT, COASTAL BEND AND ESTUARIES DO A LOT OF COASTAL RESTORATION AND MAYBE THAT CAN LOOKED AT TOO.

SOMETIMES IF YOU ASK FOR A PARTNER YOU GET IT, AND I WILL FIGURE OUT A WAY TO SPEND THAT MONEY IN GOOD PROJECTS FOR COASTAL BEND BAYS AND ESTUARIES EVERY DAY.

>>JUDGE CANALES: WE ARE LUCKY WE HAVE A GREAT PARTNERSHIP WITH COASTAL BEND BAYS AND ESTUARIES AND THE BAYS COUNCIL.

DR. STANCID HAVE EDUCATED MYSELF AND THE STAKEHOLDERS AND BECAUSE OF THAT WE HAVE A NATURAL PLATFORM.

I WILL SAY I WOULD NOT BE A CHAIR OF THE CAUCUS ON A NATIONAL LEVEL WITH THE GULF COAST IF NOT FOR OUR EXPERIENCE. YOU ARE RIGHT.

WE HAVE A GREAT PARTNERSHIP. AND THIS INTERLOCAL AGREEMENT, TALL DOES IS UPDATE US AND GET MODERN.

I THINK IF RAY WAS ABLE TO VISIT, HE WOULD SAY THIS IS OVERDUE AND WE KIND OF NEED TO GET ALL THIS UPDATING AND THAT'S ALL THIS IS -- OH, WAIT. I THINK HE IS UNMUTED, RIGHT? NO? BUT YOU KIND OF LOOK LIKE -- LIKE ONE OF DAVID'S FAVORITE BIRDS WHERE YOU SEE THEM FOR A

DISTANCE AND WE ADMIRE IT. >> HIS PRESENCE IS SO BIG AND SO -- WE DON'T -- WE KNOW IT -- WHAT RAY IS.

SO HE IS GOOD. >>JUDGE CANALES: RAY, IT'S GREAT. YOU GET WHAT YOU NEED AND YOU DON'T HAVE TO SAY A WORD. LET ME ASK FOR THE MOTION,

COMMISSIONER CHESNEY. >>COMMISSIONER CHESNEY: I MAKE

MOTION TO PASS. >>JUDGE CANALES: I HAVE A MOTION TO APPROVE THIS INTERLOCAL AGREEMENT BETWEEN THE INCIDENT TEES THAT ARE LISTED BELOW, INCLUDING NUECES COUNTY REGARDING THE COASTAL GUANTANAMOS AND ESTUARIES.

I WILL SECOND THAT MOTION. HEARING NONE, ALL THOSE IN FAVOR SIGNIFY BY SAYING AYE. YOU EVEN GOT A VOLUNTEER OUT OF

IT. >> IF YOU WILL ALLOW ME FOR TWO SECONDS TO MAKE AN ANNOU ANNOUNCEMENT.

I WANT TO SAY I SAW THOSE PH PHOTOS ABOUT SOME OF THE -- I DON'T KNOW A LOT OF THAT -- THAT DEGREE WAS RESULT OF THE FLOODING OR SOUNDED LIKE MAYBE ILLEGAL DUMPING AS WELL.

I WAS JUST GOING TO SAY. WE DON'T KNOW IF WE HAVE A GRANT YET, BUT WE APPLIED FOR GRANT AND A LETTER OF SUPPORT TO ADDRESS SOME OF THE ILLEGAL DUMPING ISSUES GOING ON IN THE RURAL AREAS OF THE COASTAL BEND COUNTIES.

SO HOPEFULLY CROSSING OUR FINGERS THAT THAT GRANT WILL COME THROUGH, WE WILL HAVE OPPORTUNITIES FOR PEOPLE TO DISPOSE OF THINGS FREE OF CHARGE AND HOPEFULLY REMOVE SOME OF THE BARRIERS OF CAST AND ACCESSIBILITY WHICH LEAD TO THE ILLEGAL DUMPING AND DO SOME EDUCATION ABOUT IT AS WELL.

SO WE ARE HOPEFUL THAT WILL -- THAT WILL COME THROUGH AND EXPAND SOME OF THE LITTER PREVENTION STUFF THAT WE ARE ALREADY WORKING WITH THE CO COUNTY.

SO -- >>JUDGE CANALES: THAT IS WONDERFUL. WE WILL ASK YOU TO KEEP US INFORMED. YOU KNOW, WHEN YOU GET THAT AND WE WILL MAKE CERTAIN THAT THE COUNTY ENGINEER WHO WORKS WITH ENFORCEMENT CONTROL AND, OF COURSE, THE DRAINAGE DISTRICT.

SO MANY GOOD PARTNERS THERE. BUT, YES, KEEP US POSTED DO

DOCTOR. >> THANK YOU SO MUCH.

[1. Discuss and consider execution of a Donation Agreement with Cypress Point Capital, LLC to construct a portion of CR 43 from FM-2444 to 1700' South. CR 43 is in Commissioners Precinct No. 4.]

>>JUDGE CANALES: WE ARE GOING TO -- BEFORE WE GET TO THE TAX RATE, LET'S BY AHEAD AND TAKE UP -- I AM GOING TO COME OUT OF ORDER AND ASK JUAN TO PRESENT ITEMS 4 B 3 B, 1 AND 2.

>> ONE SIDE OF THE COURTROOM, JUDGE.

>>JUDGE CANALES: B 1 IS THE DONATION AGREEMENT WITH CYPRESS POINT CAPITAL TO CONSTRUCT A PORTION OF CR 43 IN PRECINCT NUMBER 4. OKAY.

SO WE WENT TO GET JUAN? OKAY.

COMMISSIONER CHESNEY, DO YOU WANT TO INTRODUCE OR WAIT FOR

JUAN? >>COMMISSIONER CHESNEY: I AM SORRY, JUDGE, CAN YOU REPEAT ANY DIDN'T HEAR THAT.

>>JUDGE CANALES: CYPRESS POINT CAPITAL.

ARE YOU BRIEFED ON THAT? B 1 ON PUBLIC WORKS.

SAYS CONSIDER EXECUTION OF A DONATION AGREEMENT WITH CYPRESS

POINT CAPITAL. >>COMMISSIONER CHESNEY: I JUST DIDN'T RECOGNIZE THE INCIDENT TEE.

>>JUDGE CANALES: GIVE US A LITTLE BACKGROUND.

>>COMMISSIONER CHESNEY: I WANT TO MAKE SURE AND I DID NOT GET -- I AM NOT AS FAMILIAR WITH THE WORRIES --

>>JUDGE CANALES: NO WORRIES, WE CAN WAIT.

>>COMMISSIONER CHESNEY: I KNOW WHAT WE ARE DOING BUT NOT FAMILIAR WITH THE CYPRESS POINT CAPITAL NAME.

[01:30:05]

AND HOPEFULLY JUAN CAN GET HERE AND VERIFY AND WE DON'T WASTE THE COURT'S TIME. BUT A JOINT AGREEMENT WHERE I HAVE GOTTEN THE -- THE DEVELOPER OF THIS PARTICULAR AREA TO SPLIT THE COST OF RE REHABBING A COUNTY ROAD WITH THE COUNTY. IT'S BEEN SOMETHING I HAVE BEEN KIND OF ADVOCATING AND TRYING TO DO TO GET THESE DEVELOPMENTS GOING SO WE CAN RAISE SOME -- SOME MONEY -- NEW TAX REVENUE FOR THE COUNTY AND IN THE COUNTY AND NOT THE CITY LIMITS AT THIS POINT IF THIS IS ONE I AM TALKING ABOUT.

THE DEVELOPER WILL HAVE TO -- WILL BE THERE FOR YOU AND DO IT WITH LEGAL. AND IF JENNY IS THERE SHE CAN CORRECT ME IF I AM TOTALLY OFF BASE WITH THIS, AND A DONATION AGREEMENT AND KENT BROWN DRAFT THIS AND I APPRECIATE THE WORK OF THE COUNTY ATTORNEY AND WE ARE ACCEPTING THAT MONEY FROM THE DEVELOPER FOR HIS PORTION OF THE COUNTY ROAD THAT WE ARE REHABBING. SO I SEE JUAN IS IN THE ROOM, IF I MISSPOKE, JUAN, TELL ME THIS IS WITH THEM.

>> THAT'S CORRECT, COMMISSIONER.

>>COMMISSIONER CHESNEY: I LAID OUT WHAT WE ARE DOING AND YOU

CAN JUMP IN AND HE RIGHT RATE. >> THIS IS SIMILAR TO COUNTY ROAD 33, COMMISSIONER. WHAT WE ARE DOING IS RECOMMENDING THE EXECUTION OF THE DONATION BETWEEN CYPRESS POINT CAPITAL LCC TO CONSTRUCT COUNTY ROAD 43 FROM FSHLINGZ M 2444 TO 1700 LINEAR FEET AND WE ARE RECOMMENDING IT.

>>COMMISSIONER CHESNEY: THIS IS PUBLIC WORKS I BELIEVE WILL

BE DOING THIS JOB THEMSELVES? >> YES, SIR.

YES, SIR, WE ARE LOOKING AT A COUPLE OF OPTIONS.

ONE WOULD BE PUBLIC WORKS AND POSSIBLY EITHER -- IF WE HAVE TO DEPENDING ON THE TIME FRAME, COMMISSIONER, MAYBE SOMEBODY ELSE TO ASSIST US ALSO ON IT. BUT AT THE SAME TIME --

>>COMMISSIONER CHESNEY: AS LONG AS IT STAYS WITHIN THE

BUDGET AMOUNT WE ARE GOOD. >>JUDGE CANALES: CAN YOU REPEAT -- WE HAVE A BUDGETED AMOUNT AND TALK ABOUT THAT AND WHAT THEY ARE DONATING JUST TO PUT IT ON THE RECORD.

>> THE TOTAL AMOUNT IS -- 14 145,478.50.

AND THEN THE OTHER -- CHEST KHAES THAT IS THEIR PORTION.

AND OUR PORTION MATCHES THEIR PORTION AND PORTION COMES FROM MY COS. ONE OF THOSE ONES THAT UNFORTUNATELY HAVEN'T MOVED AS FAST AS I WANTED NOT TO AN ANYONE'S FAULT AND SOME OF THE COS HAVE BEEN SITTING THERE FOR A WHILE AND SPENDING THE COS -- THIS PROJECT IS ON THE BOOKS

FOR THREE YEARS. >>JUDGE CANALES: SINCE 2016,

COMMISSIONER? >> A LONG TIME.

>> THE TOTAL. >>COMMISSIONER CHESNEY: ALLOCATED INTO -- ALLOCATED INTO AN AREA FOR QUITE SOME TIME. ALREADY SET UP AS A CODE.

THIS IS A DONATION 35R9 AND MOVE FORWARD WITH THE WORK.

>>JUDGE CANALES: WOULD YOU LIKE THAT MOTION?

>>COMMISSIONER CHESNEY: I WILL MAKE THAT MOTION, YES.

>> SECOND. >>JUDGE CANALES: A MOTION AND A SECOND. ALL THOSE IN FAVOR -- ANY DISCUSSION OR QUESTIONS FOR JUAN?

>> WOMAN, WE ARE GOOD. THANKS, JUDGE.

>>JUDGE CANALES: ALL THOSE IN FAVOR SIGNIFY BY SAYING AYE.

OPPOSED, SAME SIGN. THANK YOU FOR THAT CLARIFICATION. THE NEXT ONE IS A SUPPLEMENTAL

[2. Discuss and consider approval of a Supplemental Agreement No. 1 between Nueces County and Advanced Construction Management, LLC. for the Nueces County 2019 CIP Road Rehabilitation Project – County Road 22 and County Road 49 Project.]

AGREEMENT NUMBER 1 BETWEEN OURSELVES, THE COUNTY, AND ADVANCED CONSTRUCTION MANAGEMENT FOR COUNTY ROAD 22 AND 49. AND SO ADVANCE CONSTRUCTION MANAGEMENT HAS A SUPPLEMENTAL. TELL US ABOUT THIS.

>> JUDGE, COMMISSIONERS, THIS IS SUPPLEMENTAL FOR ADDITIONAL TIME FRAME. FOR ADDITIONAL TIME.

>>JUDGE CANALES: NO COST. >> MOTION TO APPROVE.

>> SECOND. >>JUDGE CANALES: OKAY.

I THINK I HEARD A SECOND FROM COMMISSIONER MAREZ.

AND THE ONLY DISCUSSION I HAVE IS SO -- THE TIME.

DOES THAT PUT US STILL ON TIME. IN OTHER WORDS, IS THIS TIME CURE A CONTRACT OR -- BECAUSE PEOPLE ALWAYS SAY WHAT TIME -- TAKING MORE TIME OR MORE OF A CONTRACTUAL ISSUE.

>> JUST A CONTRACTUAL -- >>COMMISSIONER CHESNEY: IT IS TAKING MORE TIME THAN WE OPENED BUT NOT TAKING MORE TIME THAN

THE CONTRACT ALLOWS FOR. >>JUDGE CANALES: GOT IT.

>>COMMISSIONER CHESNEY: THAT IS WHY WE ARE DOING THIS WITH

ACM. >>JUDGE CANALES: UNDERSTOOD.

>>COMMISSIONER CHESNEY: THE WEATHER HAS DERAILED THIS PROJECT THROUGH A GREAT PERIOD OF TIME.

>> THAT IS WHAT I WAS GOING TO SAY THAT THE RAIN EVENTS HAVE

PUSHED THE PROJECT BACK. >>JUDGE CANALES: DO YOU THINK WE WILL BE ABLE TO FINISH IT THIS YEAR?

>>COMMISSIONER CHESNEY: WE BETTER.

>> YES, I AM GOING TO SAY YES, WEATHER PERMITTING, JUDGE.

[01:35:04]

>> WEATHER PERMITTING. >>JUDGE CANALES: WEATHER PERMITTING. THAT IS A GOOD ANSWER.

THIS YEAR IS POSITIVE. HOW ABOUT A MOTION.

A MOTION AND A SECOND. I THINK WE DID ONE ALREADY.

I NEED TO CALL FOR THE VOLT. ALL THOSE IN FAVOR SIGNIFY BY SAYING AYE. OPPOSED, SAME SIGN.

OKAY. THANK YOU, JUAN, WITH THAT.

>> THANK YOU, JUDGE, COMMISSIONERS.

[2. Receive updated calculations of the no-new revenue tax rate, the voter-approval tax rate and the fund balances for Nueces County, Nueces County Farm to Market, and Nueces County Hospital District for 2021; Discuss and consider updated proposal for 2021-2022 tax rate for Nueces County, NC Farm to Market, and NC Hospital District based on the 2020/2021 supplement 1 certified totals received from the Appraisal District. Commissioners Court must take a record vote and authorize publishing appropriate notices. ]

>>JUDGE CANALES: ALL RIGHT. NOW WE WILL GO BACK UP TO 3-A-2 AND GET THE UPDATED CALCU CALCULATIONS AND DISCUSS THE UPDATED PROPOSAL TAX RATE. WHEN WE DO THESE TAX RATES, IT WILL BE FOR THE NC FARM TO MARKET OF NUECES COUNTY, THE NC HOSPITAL DISTRICT AND NUECES COUNTY.

THREE DIFFERENT RATES. AND IT IS BASED, OF COURSE, ON CERTIFIED TOTALS WE RECEIVED FROM THE APPRAISAL DISTRICT.

YESTERDAY YOU HAD THE OPPORTUNITY IN BUDGET WORKSHOP TO HAVE THAT DISCUSSION WITH OUR AUDITOR.

WE HAVE THE NEW NUMBERS. WE HAVE THE NEW RATES.

JUST WANTED YOU TO KNOW IN THIS CASE WE DO TAKE A RECORD VOTE TO AUTHORIZE AND PUBLISH THESE APPROPRIATE NOTICES.

AND SO, AGAIN, I AM GOING TO ASK DALE TO GO OVER THE OPTIONS AND REMIND THE COURT THAT THIS IS NOT SETTING ANYTHING WHAT WE SAUL THE "CEILING." WE PUBLISHED IT WOULD NOT EXCEED THIS AMOUNT. NOT THAT THIS WILL BE THE TAX RATE. WE DO THIS BECAUSE THERE IS STILL A LOT OF WORK TO BE DONE IN SETTING A BUDGET, BUT YOU WANT TO KNOW AND YOU WANT TO PUBLISH THAT IT WILL NOT GO ABOVE THIS PARTICULAR RATE. AND IN ORDER TO DO THAT YOU NEEDED TO KNOW BUDGET CHALLENGES FROM YESTERDAY AND DEFER NOW TO DALE TO GO OVER THEM.

I THINK IT IS IMPORTANT TO GO OVER THEM.

ITEM NUMBER 2. AND THEN WE WILL MOVE INTO ITEM 3 WHICH IS DISCUSS, CONSIDER AND SET THIS -- THIS TAX RATE

FOR THESE THREE ENTITIES. >> YES, YOUR HONOR.

I LIKE TO GO OVER THE TAX RATES BECAUSE WE PROVIDED THIS AUGUST 4 AND ERRORS IN THE NUMBERS WE RECEIVED FROM THE APPRAISAL DISTRICT AND I WOULD LIKE TO GO OVER THE TAX RATE NUMBERS AGAIN AND SO EVERYONE KNOWS WE PROVIDED THIS IN A WORKSHOP YESTERDAY BUT I THOUGHT IT WAS NECESSARY TO DISCUSS THIS IN COURT SO EVERYONE IS AWARE OF THE NUMBERS ARE AND WHERE WE ARE AT AND GO OVER THE NUMBERS AGAIN AND SEE THE TAX RATE ON THE ROMP THAT THE COUNTY HAS DISPLAYED.

YOU WILL SEE OUR LAST YEAR PRIOR YEAR PROPERTY --

>>COMMISSIONER CHESNEY: DALE, STAY ON THAT MIC.

WE ARE USING YOUR SOUND -- >> SOMEHOW IT GOT MUTED.

LET ME GO -- >>COMMISSIONER CHESNEY: THERE

YOU GO. >> LAST YEAR PROPERTY TAX RATE CURRENTLY PRESIDE ON THE COMBINED RATE OF THE DEBT SERVICE FUND AND OUR ROAD FUND .311483.

WE GOT OUR TAX CALCULATION, NO NEW REVENUE TAX.

OUR VOTER APPROVED TAX MAXIMUM OF 3.5%.

AND THE STATE LAW DID ALLOW US. THE COUNTY AND OTHER TO USE UNUSED INCREMENT IN TAXING WHICH MEANS ANY AMOUNT OF THE PRIOR YEAR WE DID NOT GO TO THE 3.5%.

WE CAN USE THOSE INCREMENTS TO BE ABLE TO INCREASE THE TAX SO GAVE YOU THESE PARTICULAR RA RATES.

FOR THE NO NEW REVENUE TAX RATE SECOND TO THE LEFT, .288982.

OUR MAXIMUM APPROVED 3.5% IS .314205.

AND OUR TOTAL TAX RATE THE MAXIMUM RATE WE CAN DO THIS YEAR WUTD VOTER REQUIREMENT IS .319058 AND USES UNUSED INCREMENT FROM PRIOR YEAR INCLUDING 3.A 5%.

HOSPITAL -- VERY BOTTOM LAST YEAR WAS .111824.

RATE WAS .106192. WITH THAT, THEY SON-IN-LAW HAVE 3.5%. AND VOTER IMPROVED WHICH IS THE MAXIMUM RATE THEY CAN CHARGE WHICH IS 8%, .115601.

NOW HOW THAT DIFFERS FROM THE INFORMATION WE PROVIDE TO YOU WAS -- WHEN -- WHEN THE TAX APPRAISAL DISTRICT RECEIVED THEIR RATES, THEY RECEIVED SEVERAL RATES FROM AN OUTSIDE VENDER FROM THE REFINERIES AND MECHANICAL STUFF ALONG THE P PORT, AND THEY WERE ABLE TO FIND THAT THERE WAS A -- -- I

WILL USE ONE. >>JUDGE CANALES: WHAT HAPPENED

[01:40:03]

WITH THE -- TALKING WITH THE DIFFERENCE OF WHAT SHE HAS AND WHAT I AM GOING THROUGH BUT -- A SMALL EXCHANGE FOR THAT AS WE TALKED ABOUT. THE VOTERS APPROVED IS -- THEY ARE THERE. THE -- ON THE CALCULATION ON THE RATE, THE MAIN PROBLEM WAS THE -- THE TAX OFFICE AND OF APPRAISAL USING $150 MILLION AS REGULAR PROPERTY.

IT SHOULD HAVE BEEN NEW PROPERTY.

SO WHEN WE GAVE YOU THE NUMBER ON THE 4TH.

WE MENTIONED THAT OUR NEW PROPERTY VALUATION WAS A MARKET OF $420 MILLION; HOWEVER, THE TRUE NUMBER IS $642 MILLION NEW PROPERTY SO THAT DEFINITELY CHANGED OUR VALUES.

THAT'S WHY I WANTED TO MAKE SURE WE ARE ALL AWARE OF THE RAISE IN -- RATES AND CALCULATIONS.

YOU SHOULD HAVE THESE VALUES CALCULATED AS PART OF THE PACKAGE THAT YOU HAVE. WE WILL GO OVER ANY BUT THE CURRENT TAX RATE VALUATIONS AS WAS PRESENTED AUGUST 4 WITH A

SLIGHT -- >>COMMISSIONER CHESNEY: SOMEBODY IS WHISPERING AND BLEEDING TO EVERY, DALE, FOR ME

AT LEAST. >> CONNIE.

WE ARE DISCUSSING THIS. SORRY.

THESE ARE JUST -- THE NEW RATES WITH THE NEW INFORMATION FROM THE TAX -- FROM THE APPRAISAL DISTRICT.

SO, AGAIN, THE NO NEW REVENUE .29882.

THE 3.5% IS .314205. IF WE USED UNUSED INCREMENT.

100% IS .130958. THOSE ARE THE RATES WE HAVE BASED ON THE CALCULATION OF WHAT THE APPRAISAL DISTRICT HAS PROVIDED TO YOU. THAT IS THE INFORMATION FOR A THE RATES FORCED FUND BALANCES WE NEED TO PROVIDE YOU FOR THE FUND BALANCES. CONNIE, CAN YOU PROVIDE THE

FUND BALANCES. >>COMMISSIONER CHESNEY: WAIT.

WHAT IS YOUR PROPOSED RATE FROM YESTERDAY, DALE?

>> WE ARE UPDATING THE CALCULATIONS.

ONCE WE GET TO THE PROPOSED WE WILL TALK OF THE PROPOSE.

RIGHT NOW HAD THE NEW RATES. ON THE LIST ON THE SCREEN WHICH IS THE ESTIMATED FUND BALANCES FOR THE YEAR, THESE RATES -- THESE COULD CHANGE THROUGHOUT THE -- ONCE WE GET OUR ACTUAL NUMBERS IN. OUR BEST ESTIMATES.

THAT WE HAD AT THE TIME. OUR FUND BALANCES FOR THE GENERAL FUND $27,459,463. ROAD AND BRIDGE 1,779,226.

OUR SPECIAL REVENUE FUND IS 20,525,085.

OUR STADIUM FAIRGROUNDS 2,158,1 06.

LAW LIBRARY 38,232. OUR AIRPORT FUND IS 147,216.

OUR PARKS IS 249,049. OUR COASTAL PARKS 1,099,210 AND DEBT SERVICE 3,547,20.7. TOTAL IS $56,996,92328.

A SUBMISSION OF OUR RATES AND UPDATED RATES.

NOW WE CAN CONTINUE ON FOR THE NEXT ITEM.

NUMBER 3 TO DISCUSS THE PROPOSAL WHERE WE EXPECT OUR RATES TO BE. IF WE ARE READY TO BEGIN.

>> THAT IS THE ONLY PAGE I H HAVE.

>> THE ONE THAT LISA GAVE YOU. HANG ON.

>> I HAVE MAILED IT TO THE JUDGE AND COMMISSIONERS.

TO COMMISSIONERS COURT. YOU SHOULD HAVE IT IN YOUR

E-MAIL. >> OUR CONVERSATION WE WENT THROUGH THE BUDGET HEARINGS YESTERDAY, THERE WAS -- THERE WAS A DISCUSSION ON OUR MILLION FIVE FOR PAYMENT TO BANK OF AMERICA. I DID SOME RESEARCH THROUGH OUR CONTRACT WITH BANK OF AMERICA, THERE IS A SMALL AMOUNT AS -- OF SAVINGS POSSIBLE. I WILL DEFER TO THE COUNTY ATTORNEY. 600,000 POSSIBLE SAVINGS THAT COULD BE THERE. THE FIRST YEAR, BUT THE FIRST YEAR OF CONSTRUCTION OR FIRST YEAR WHEN IT BEGINS.

NO. >> I ONLY HAVE TWO AND EACH ONE

HAS ONE SHEET. >> SORRY.

WE MIGHT BE ABLE TO LOWER THAT 1.5 MILLION DOWN FROM -- TO ABOUT 900,000. SO WE STILL NEED AROUND $2 MILLION OF FUNDS.

[01:47:26]

>>JUDGE CANALES: TO GIVE US MAXIMUM FLEXIBILITY.

>> YES THESE ARE THE PROPOSALS AND NOT ASKING TO ADOPT THE RATES TODAY. THESE ARE AS HIGH AS WE CAN GO WITHOUT HAVING MULTIPLE PUBLIC HEARINGS.

THESE ARE JUST THE CEILING OF THE RATES AT THIS TIME.

>>JUDGE CANALES: I HEAR YOU. SO JOHNNY IS ON.

I AM GOING TO ASK JOHNNY -- >> JUDGE, I THINK HE GOES -- I THINK HE IS -- I THINK DALE IS RECOMMENDING TODAY THE HIGHEST RATE HE CAN FOR THE HOSPITAL DISTRICTS.

IS THAT WHAT YOU SAID? >> THE HOSPITAL DISTRICT CAN GO A MAXIMUM OF 8% .11501. I TALKED TO JOHNNY AFTER HIS PROPOSAL AND HE SAID YOU CAN DEFINITELY WORK WITH THE SAME RATE, .11824. AND JOHNNY IS AVAILABLE ON LINE AT THIS TIME AND I WILL HAVE HIM GET INTO DISCUSSION.

>> GOOD MORNING, JUDGE. CAN I PROCEED?

>> YOU BET. >> GOOD MORNING, COMMISSIONERS.

>>COMMISSIONER CHESNEY: HANG ON ONE SECOND.

I AM CONFUSED, DALE. AND THE HOSPITAL DISTRICT FOR 2021 WAS .114241 AND YOU ARE PROPOSING.

NOT AN INCREASE OR DID I READ OR HEAR THAT WRONG.

>> .01962 FOR THE HOSPITAL DISTRICT.

NO NEW REVENUE TAX WHICH IS NO NEW TAXES.

THEY ARE PROPOSING .114824 SIMILAR TO THE RATE LAST YEAR 3.5% INCREASE ABOVE THAT REVENUE TAX RATE.

THEY ARE PROPOSING A RATE OF .11824.

THAT IS 5%. THEY CAN GO AS HIGH AS 8% .

.115601. >>COMMISSIONER CHESNEY: I AM SAYING ISN'T THEIR CURRENT RATE 1.112 -- WAIT, WHAT I DID HEAR

-- >> CURRENT RATE.

>>JUDGE CANALES: SCROLL DOWN -- CONNIE SCROLL DOWN SO YOU CAN SEE IT. .11824.

>>COMMISSIONER CHESNEY: I APOLOGIZE, JUDGE.

I MISSPOKE. I WROTE IT DOWN WRONG.

MY BAD. MY BAD.

>>JUDGE CANALES: YOU HAD THE 8 AND THE 1 REVERSED.

>>COMMISSIONER CHESNEY: I AM SORRY, GO AHEAD, JOHNNY.

>> GOOD MORNING, COMMISSIONERS. COMMISSIONER, IN LIGHT OF OUR CONVERSATION YESTERDAY AND TO BACKTRACK JUST A MOMENT FROM THAT TO TALK ABOUT THE DEVELOPMENTS WITH COVID IN THE COMMUNITIES. THERE -- ALL THE COMMENTS AND STUFF THAT HAVE BEEN MADE TODAY WARRANT THE CONSIDERATION OF

[01:50:03]

THE 8% RATE AT LEAST AT THIS MEETING FOR LEAVING NEWS A POSITION TO DEAL WITH THE UNKNOWNS THAT ARE PROBABLY GOING TO CROP UP IN THE NEXT TWO OR THREE WEEKS BEFORE YOU TAKE A FINAL VOTE ON THE DISTRICT'S TAX RATE.

IF THE DISTRICT DOESN'T HAVE ANY NEW EXPENDITURES AND STUFF, THE RATE THAT I HAVE TALKED ABOUT YESTERDAY THAT DALE DESCRIBED WOULD BE A RATE THAT WOULD BASICALLY GET THE DISTRICT TO A-- TO A POINT THAT THE BUDGET IS BALANCED FOR THE FIRST TIME IN MANY YEARS. AS YOU KNOW, WE HAVE -- WE HAVE HAD THE EFFECTIVE TAX RATE IN PLACE FOR A LONG TIME.

THE 3% INCREASE IN REVENUES THE COURT PROVIDED FOR LAST YEAR MOVED US A LOT FURTHER ALONG TOWARD BALANCES THE DISTRICT'S BUDGET. WE STILL CONTINUE FROM THE GRAPH I SHOWED YOU YESTERDAY TO OPERATE A SITUATION WHERE WE DROP DOWN THE FUNDS. TO SUMMARIZE TODAY'S VOTE, YOU WILL BE SETTING THE MAXIMUM AMOUNT, I WOULD RE-- RE-- RE-ESTABLISH MY REQUEST THEN TO DO IT AT THE 8% OR WHATEVER RATE FALLS JUST BELOW SOME TRIGGER MECHANISMS FOR TODAY AND THEN WHEN WE COME BACK AND DO THE DISTRICT'S TAX RATE LATER IN AUGUST AND SEPTEMBER -- EARLY SEPTEMBER, THAT WE WILL CONTINUE THAT RATE ARE SOME RATE BELOW THAT.

>>COMMISSIONER CHESNEY: JUDGE, I JUST HAVE A QUESTION FOR JOHNNY, RESPECTFULLY, IS THAT THE POSITION OF YOUR BOARD.

BECAUSE YOUR BOARD IS WHO WOULD MAKE THE DECISION FOR YOU TO REQUEST THAT. I WOULD LIKE TO KNOW IF THE BOARD HAS APPROVED THAT OR VOTED ON THAT OR IF YOU ARE MAKING THAT CHANGE -- I DON'T MEAN THAT RUDELY, ON THE FLY BASED ON WHAT YOU HEARD WAS LEGITIMATE INFORMATION, BUT BEFORE YOU MAKE THAT REQUEST, IS THAT YOUR BOARD'S POSITION?

>> COMMISSIONER, I DON'T KNOW IF WE ARE VOTING ON THE RATE GOING FORWARD FOR NEXT YEAR, BUT THE BOARD WILL HAVE A W WORKSHOP, IN ABOUT TWO WEEKS. WE CAME TO YOU QUICKLY BECAUSE YOU NEEDED TO TAKE THIS VOTE ON THE CEILING RATE.

AND SO WE PUT TOGETHER OUR BUDGET.

WE CERTAINLY WILL GO THROUGH A WORKSHOP WITH THEM AND IF THEY FEEL THAT THE RATE -- THEY WILL HAVE INPUT ON THE RATE.

THEY HAVE GIVEN ME COMMENTS ON THE PAST SEVERAL MONTHS REGARDING DISTRICT'S RATE. AND THEY WOULD CERTAINLY LIKE TO TRY TO ARIZONA MUCH MONEY AS WE CAN POSSIBLY COMING INTO THE DISTRICT SO WE CAN BALANCE THE DISTRICT'S OPERATIONS AND THAT IS WHY THE -- BALANCE OF WHAT WAS THERE AND CERTAINLY UNDERSTAND THE POLITICAL REALITIES OF THAT, BUT WHEN WE COME BACK TO COMMISSIONERS. WE WILL HAVE A RATE THAT THE BOARD IS COMFORTABLE WITH AND THE NUMBERS I GAVE YOU YESTERDAY AND TODAY ARE CONSISTENT TO INSTRUCTIONS TO ME OVER THE LAST TWO OR THREE MONTHS REGARDING OUR BUDGET.

>>COMMISSIONER CHESNEY: THE INSTRUCTIONS TO DALE YESTERDAY WAS 11284. THE INSTRUCTIONS, WAIT A MINUTE, NEVER MIND. I AM GOING TO GO UP.

MY QUESTION TO YOU -- AND I THINK YOU ANSWERED IT WITH A ROUNDABOUT NO BUT I DON'T WANT TO PUT WORDS IN YOUR MOUTH.

YOU DON'T KNOW WHAT YOUR BO BOARD'S POSITION IS ON YOUR REQUEST TODAY. IS THAT A FAIR STATEMENT?

>> YES, COMMISSIONER. OUR REQUEST TODAY IS I UNDERSTAND THE MEETING IS TO SET THE MAXIMUM RATE AND THE RATE THAT THE COURT WILL ADOPT LATER IN AUGUST AND SEPTEMBER COULD THAT RATED OR A LESSER RATE.

I DON'T WANT TO BOX THE POSITION -- BOX THE DISTRICT IN TO A POSITION OF HAVING A RATE SET AT THIS MEETING THAT CONSTRAINS THE ABILITY TO THE DISTRICT TO HAVE FUNDS SUFFICIENT TO DEAL WITH THE -- THE -- THE EMERGING NEEDS OF COVID. I MEAN THE COVID NEEDS -- I PROBABLY TO BRING THAT UP YESTERDAY, COMMISSIONER, THEY JUST DIDN'T POP UP THIS MORNING.

THEY HAVE BEEN OUT THERE NOW AND THE NUMBERS ARE GOING UP.

AND I THINK THE NEWS CONFERENCE AND THE INFORMATION WE ARE GOING TO RECEIVE LATER TODAY TELLS THAT STORY.

SO I AM -- I AM OKAY WITH ASKING YOU ALL TO CONSIDER THE CEILING AT THIS MEETING KNOWING THAT THERE IS A SUBSEQUENT MEETING WHERE THE FINAL RATE WILL BE -- WILL BE SET.

AND WE WILL ALL HAVE AN OPPORTUNITY TO HAVE ADDITIONAL INFORMATION IN HAND AT THAT POINT COMMISSIONER I AM NOT TRYING TO THROW A SLIDER OR CURVEBALL OR ANYTHING, BUT I DON'T WANT TO LEAVE THE DISTRICT IN A POSITION WHERE WE CAN'T GET ENOUGH REVENUE IN FROM THE NEW TAX RATE AT A LATER MEETING. THAT'S ALL.

>>COMMISSIONER CHESNEY: I UNDERSTAND THAT JOHNNY, BUT WHAT YOU ARE SAYING -- YOUR BOARD HAS NOT WEIGHED IN ON

[01:55:02]

THIS POSITION SO THIS IS NOT SOMETHING THAT YOU CAN SAY THAT THE BOARD DOES OR DOESN'T SUPPORT.

AND THEY MIGHT SUPPORT THIS, BUT YOU HAVEN'T PULLED YOUR BOARD WHETHER OR NOT THEY SUPPORT IT.

THIS IS YOU ACTING IN BEST INTEREST OF THE BOARD WHAT YOU BELIEVE BUT YOU DON'T KNOW THAT YOUR BOARD WILL.

SIMPLE QUESTION. >> NO.

THE REASON FOR THAT COMMISSIONER, I WANT TO UNDERLINE AGAIN THEIR INSTRUCTIONS TO ME IN THE LAST TWO FOR THREE MEETINGS REGARDING THE BUDGET TO DO WHATEVER WE CAN TO GET AS MUCH REVENUE AS THE COURT FEELS COMFORTABLE WITH COMING INTO THE DISTRICT.

THE BOARD WAS ESPECIALLY CONCERNED OF CONTINUING TO OPERATE THE DISTRICT AT A DEFICIT THAT CHART I SHOWED YOU WAS THE FUND BALANCE CONTINUING TO DECLINE.

>>COMMISSIONER CHESNEY: ARE THE SAYING THAT THE BOARD SUPPORT THIS RATE. IF THEY SUPPORT IT, THAT'S WHAT I NEED TO KNOW. IF THEY HAVEN'T TAKEN A FORMAL POSITION ON THIS PROPOSED RATE. THAT'S ALL I AM ASKING.

THAT'S ALL I AM ASKING. IF THEY -- IF YOU BELIEVE THEY SUPPORT IT, JUST SAY YES, THEY SUPPORT THIS RATE THAT YOU ARE PROPOSING TODAY. .

>> COMMISSIONER WHAT I CAN TELL THAT YOU THEY LIKELY WILL SUPPORT IT. THESE TAX RATES WERE NOT AVAILABLE TO THE BOARD IN THE PAST TWO OR THREE MONTHS TO TALK ABOUT. AS I 15EUD THEIR INSTRUCTIONS TO ME HAVE BEEN TO DO EVERYTHING I CAN TO IMPROVE THE DISTRICT'S LOW CASH FLOW FROM LOW TAX REVENUES AND CONSISTENT WITH THAT CONSENT, I BELIEVE THEY WILL BE SUPPORTIVE OF THAT RATE. BUT HAVE THEY SEEN THIS RATE, NO. THESE SCHEDULES WEREN'T AVAILABLE TO THEM, THEY WEREN'T AVAILABLE TO US AND THEY WEREN'T AVAILABLE TO YOU IN THE PAST TWO OR THREE MONTHS, BUT CONSISTENT WITH WHAT THEY INSTRUCTED ME TO WORK TOWARD, THIS 8% CEILING WOULD BE THAT KNOWING THAT IT IS ONLY A VOTE, A CEILING VOTE AND NOT THE FINAL VOTE ON WHAT THE NEEDS OF THE DISTRICT ARE GOING TO BE WHICH WILL TAKE IN A FEW WEEKS.

>>COMMISSIONER CHESNEY: S A VOTE.

TODAY'S VOTE IS A VOTE TO INDICATE WHETHER OR NOT THE COURT AND THE HOSPITAL DISTRICT BOARD ARE COMFORTABLE WITH TAX INCREASES BECAUSE IF WE VOTE FOR THIS RATE, IT WILL ASSURE THE PUBLIC THAT THERE IS PROBABLY -- PROBABLY, NOT FOR SURE, BUT PROBABLY A TAX INCREASE COMING AND I WANT TO MAKE SURE THAT WE ARE BEING TRANSPARENT ABOUT IT BECAUSE THAT IS WHAT IT IS TODAY. A CEILING AND AN INDICATION AND SIGNAL THAT POTENTIALLY A TAX INCREASE IS COMING TO NUECES COUNTY RESIDENTS FROM THE HOSPITAL DISTRICT AND THE COMMISSIONERS COURT. AS LONG AS YOU ARE COMFORTABLE MAKING THE REPRESENTATION THAT THE BOARD IS OKAY WITH THIS,

THAT'S ALL I AM ASKING. >> JUST RECALL THAT IF YOU WOULD THAT THE THAT THE HOSPITAL DISTRICT -- WE HAVE BEEN A GOOD CITIZEN WORK WITH THE COUNTY.

STEPPED UP FOR MENTAL HEALTH DEPARTMENT, STEPPED UP FOR COVID. EVERY TIME THAT THE COUNTY HAS COME TO US IN THE PAST YEAR, STUDIES WITH MEADOWS,

ACCENSURE. >>COMMISSIONER CHESNEY: I DON'T QUESTION IT. I APPLAUDED YOUR EFFORT ON SOME THINGS AND SOME THINGS THAT MAYBE I WOULD OR WOULDN'T DONE AND I DON'T MICROMANAGE YOUR BOARD AND THAT IS NOT WHAT THIS IS ABOUT, ALL I ASK IS YOUR BOARD COMFORTABLE FOR ADVOCATING FOR A POTENTIAL TAX INCREASE AND THIS RATE.

YOU ANSWERED IT. I AM GOOD.

THANK YOU. >>JUDGE CANALES: CAN WE GET THAT DOCUMENT UP ON THE SHARED SCREEN THE HOSPITAL DISTRICT SO I CAN GET ALL THE NUMBERS AG AGAIN, JUST ONE MORE TIME, CONNIE. THERE YOU GO.

THOSE -- I WANT TO MAKE SURE THAT I WROTE THEM DOWN.

LAST YEAR'S RATE WAS 111824. AND THE ONE THAT WE ARE LOOKING AT IS EXACTLY THE TAME, 11 111824.

REPRESENTS THE 5.3. SO WHAT WE ARE SAYING IS THAT IF THE CEILING IS SET AT 11 115601.

THE ONLY THING THAT WE ARE SIGNALING THAT THAT IS A CEILING. THAT IS ALL THAT COMMENTARY IS, BECAUSE THE RATE THAT WAS GIVEN AS THE RATED THAT WOULD BE SUITABLE BY THE BOARD AND BY JOHNNY IS THE EXACT SAME AS THIS YEAR. SO THE ONLY SIGNAL I SEE IS THE HOSPITAL DISTRICT IS AMAZING BECAUSE THEY HAVE COME TO US AND SAID, WE THINK WE CAN DO WITH THE EXACT SAME RATE AS WE HAVE LAST YEAR DESPITE THE FACT THAT WE HAD THE WORST HEALTH CRISIS KNOWN TO MANKIND IN OVER 100 YEARS.

THAT IS THE SIGNAL. THE ONLY REASON THE CEILING SHOULD BE GIVEN BECAUSE WHAT ARE YOU GOING TO DO IN THE NEXT

[02:00:03]

TWO OR THREE WEEKS IF YOU SEE THAT YOU HAVE 500 MORE PEOPLE IN THE HOSPITAL. AND ALL I AM SAYING IS THAT IT IS -- IT IS CALLED -- IT IS JUST A PROTECTION.

BUT WHAT I AM SEEING THE SIGNAL IS UNBELIEVABLE NEWS THAT THE BOARD THROUGH THEIR EXECUTIVE DIRECTOR FOUND THAT 5.3% ABOVE THE NO NEW REVENUE TAX RATE GIVES YOU EXACTLY WHAT THE CITIZENS GOT LAST YEAR AND THAT IS WHERE THEIR HEAD IT.

I AM JUST SAYING AS -- AS AN EMERGENCY MANAGER, THAT YOU SHOULD AT LEAST CONSIDER SINCE THE CEILING MEANS NOTHING ACCEPT THAT -- THIS IS A RATE THAT YOU CAN NOT GO ABOVE OR THAT EXISTS. AND THAT YOU GIVE YOURSELF THAT WIGGLE ROOM BECAUSE YOU KNOW THAT YOU -- I THINK IT IS ALMOST SCARY TO KNOW THAT YOU HAVE GOT THIS HORRIBLE WAVE OF DEATH COMING. AND, YOU KNOW, THAT WE ARE NOT -- WE ARE NOT THINKING ABOUT THAT.

AND THAT IS WHAT -- WHAT WE ARE WORRIED ABOUT IS THAT THERE IS A DESTRUCTION -- I BELIEVE WE CAN TURN THE TIDE, BY THE WAY.

I BELIEVE WE CAN, BUT IT WILL TAKE A HERCULEAN EFFORT.

AND THAT'S WHY I MENTIONED T THAT, COMMISSIONER CHESNEY, NOT BECAUSE I DON'T AGREE OR THINK THAT THE SAME RATE OF LAST YEAR IS NOT A GOOD RATE TO CONSIDER FOR THE COURT, BUT RATHER THAT THE CEILING IS JUST A PROTECTION AND THAT YOU DON'T GO OVER THIS RATE. BUT JUST THE VOTER APPROVED RATE. NOT LIKE SOME EXTRAORDINARY RATE. THE RATE THE LEGISLATURE GIVES US THAT SAYS THIS IS YOUR CEILING.

AND ALL I AM SAYING I THINK THAT IS SMART TO KEEP IT AND I DON'T THINK THE TAXPAYERS SHOULD EXPECT ANYTHING ACCEPT FOR WHAT THIS DOCUMENT SHOWS THAT THEY ARE COMING IN AND THE AUDITORS IS RECOMMENDING THE SAME EXACT RATE AS LAST YEAR.

JUST A THOUGHT. JUST A DIFFERENT THOUGHT.

>> I AM IN FAVOR OF -- >>JUDGE CANALES: WE WILL JUST GO ON AS THEY SAY. ENOUGH SAID.

>> JUDGE, WANT TO SHARE THAT I AM IN FAVOR OF --

>> GO AHEAD, JOHN. >> OF SETTING THE CEILING.

WE CAN EVEN STILL DECIDE -- YOU KNOW, NO NEW REVENUE.

AND SO I DON'T HAVE A PROBLEM SETTING THE CEILING SO THAT WE CAN WORK DOWN FROM THERE. I KNOW COMMISSIONER CHESNEY IS SHARING HIS CONCERNS. AND, YOU KNOW, WITH THE MESSAGE IT SENDS AND THE LEGISLATION WAS CHANGED AND CLEARED UP THE WAY THAT IT WAS THAT THE PUBLIC EXACTLY KNOWS WHAT -- WHAT THE POSSIBLE UP TENSIONS ARE. IT DOESN'T MEAN THAT IS WHERE WE ARE GOING TO GO, BUT WE DO NOT WANT THIS TO BE A SURPRISE OR FOR SOMEONE NOT TO UNDERSTAND THAT WITH ALL THE REQUESTS THAT WE HAVE, WE CANNOT CUT OURSELVES SHORT WITH REVENUE NEEDED TO ADDRESS ALL THESE NEEDS.

NOW WE ARE GOING TO -- I KNOW PUSH AND PULL AND HAGGLE ALL WE CAN AT THE VERY END TO SEE WHERE WE STAND, BUT I DO NOT HAVE A PROBLEM TODAY AT LEAST SETTING OUR CEILING AND THEN PUTTING OURSELVES AND STAFF TO TASK TO REALLY BRING THIS DOWN AS MUCH AS POSSIBLE TO HAVE AS LITTLE IMPACT ON THE TAXPAYERS

AS POSSIBLE. >>JUDGE CANALES: THANKS, COMMISSIONER MAREZ. ANYBODY ELSE? OKAY. IF THERE ARE -- IF THERE ARE IN OTHER COMMENTS OR QUESTIONS, WHAT WE ARE GOING TO DO IS -- I AM GOING TO ASK FOR A MOTION TO FIRST TACKLE THE -- THE NUECES COUNTY RATE. AND I DID WRITE EVERYTHING DOWN, BUT I DO LIKE THAT CHEAT SHEET UP.

IT DOES HELP, CONNIE. IF YOU WILL BRING IT BACK.

IT HAS ALL THOSE NUMBERS PERFECT.

>> SCROLL UP FOR THE COUNTY. >>JUDGE CANALES: THERE WE GO.

>> THERE IS THE COUNTY. >>JUDGE CANALES: SO THE RATE BEING SUGGESTED BY THE AUDITOR IS THE ONE I AM LOOKING TO HAVE A MOTION ON. AND THE AMOUNT IS -- DALE, WOULD YOU REPEAT IT? THE ONE YOU RECOMMENDED AGAIN.

>> THE TOTAL AMOUNT WE ARE PROPOSING AT THE TIME THE MAXIMUM CEILING WHICH IS 3.5% OF APPROVED RATE USING 100% OF THE UNUSED INCREMENT TOTAL . .316569 WITH THE GENERAL FUND 2.6872. DEBT SERVICE 0E7B9 44752 AND ROAD ONE.0375. 316569.

[02:05:04]

>>JUDGE CANALES: CEILING ONLY. THAT IS MY MOTION.

AND I WOULD ASK FOR A SECOND. >> SECOND.

>>JUDGE CANALES: OKAY. THE LAW REQUIRES ME TO TAKE A ROLE CALL VOTE. SO I WILL START WITH

COMMISSIONER HERNANDEZ. >>COMMISSIONER HERNANDEZ: NO

NEW TAX REVENUE, >>JUDGE CANALES: JUDGE SO SORRY. GET THAT MIC VERY CLOSE.

>>COMMISSIONER HERNANDEZ: THAT WAS A NO,

>>JUDGE CANALES: JUDGE WHAT DID HE SAY.

>>COMMISSIONER HERNANDEZ: NO. >>JUDGE CANALES: OKAY,

COMMISSIONER CHESNEY. >>COMMISSIONER CHESNEY: NO.

>>JUDGE CANALES: COMMISSIONER MAREZ.

>>COMMISSIONER MAREZ: AYE. >>JUDGE CANALES: COMMISSIONER

GONZALEZ. >>COMMISSIONER GONZALEZ: NO.

>>JUDGE CANALES: OKAY, NO. AND I AM AN AYE.

OKAY. SO WHAT IS THE AMOUNT THAT -- IS THERE A MOTION TO -- SINCE WE HAVE NOT -- THIS IS A CEILING. SO THE CEILING WOULD BE THE -- THE NEXT AMOUNT WOULD BE FOR ME NOT THE ENTIRE UNUSED INCREMENT -- AGAIN, THIS IS A CEILING. NOT WHERE WE ARE GOING TO SET THE RATE. WHAT IS A MOTION THEN -- I COULD -- I COULD GO TO .-- A TOTAL GENERAL FUND OF .268071.

JUST TAKE IT DOWN A NOTCH HERE. I AM JUST WONDERING WHAT THIS COURT IF THEY WANT TO ENTERTAIN A DISCUSSION AS TO WHAT CEILING YOU THINK YOU WOULD LIKE TO HAVE.

COMMISSIONER HERNANDEZ, WHAT CEILING ARE YOU CONSIDERING? THIS IS A CEILING, NOT THE R RATE.

THIS IS WHAT WE WILL NOT GO ABOVE.

>>COMMISSIONER HERNANDEZ: WELL, AT THIS POINT I AM NOT CONSIDERING ANYTHING AT RIGHT NOW.

AND KEEP IT AS IT IS. WE ARE GOING TO HAVE FURTHER

DISCUSSION ON THIS, AREN'T WE? >>JUDGE CANALES: NO, SIR.

TODAY WE HAVE TO SET THE PROPOSED RATE.

THAT IS THE PURPOSE OF TODAY'S MEETING.

WE NEED TO SET A PROPOSED RATE. THIS -- THAT WE WOULD NOT GO ABOVE. AND THEN WE WILL HAVE THE OPPORTUNITY TO FIGURE OUT WHAT OUR REAL RATE IS ONCE -- REMEMBER, WE JUST GOT THE NUMBERS YESTERDAY.

SO THE PURPOSE IS TO GIVE YOU MAXIMUM OPPORTUNITY TO WORK WITH THE NUMBERS AND SEE HOW YOU ARE GOING TO ACHIEVE YOUR BUDGET THAT YOU DESIRE WITH ALL OF THE THINGS THAT YOU NEED INSIDE OF IT. AND THE RATE GIVES YOU THAT MAXIMUM DOLLARS TO -- TO CONSIDER.

SO THAT IS ABSOLUTELY CRITICAL THAT WE DO SET THAT.

SO IF YOU DO NOT BELIEVE THAT THE AUDITORS RECOMMENDED RATE IS THE CORRECT ONE, WHAT RATE DO YOU RECOMMEND FOR US HERE TODAY? FOR THE CEILING?

>>COMMISSIONER HERNANDEZ: JUDGE, I HAVE TO APOLOGIZE BUT MY GLASSES DON'T HELP ME AT A ALL.

WHAT -- >>JUDGE CANALES: GET THAT MIC RIGHT -- YOU SAY I HAVE TO APOLOGIZE.

>>COMMISSIONER HERNANDEZ: MY GLASSES DON'T HELP ME AT ALL.

CAN YOU ENLARGE THE NUMBERS? >>JUDGE CANALES: DID YOU HEAR

HIM, COMMISSIONER? >>COMMISSIONER CHESNEY: I COULD NOT HEAR HIM. SORRY.

>>JUDGE CANALES: I COULDN'T -- GIVE HIM THE HAND-HELD.

>> THE HAND-HELD IS GOOD. DO YOU HAVE IT, CONNIE.

>>JUDGE CANALES: WHAT I AM LOOKING FOR COMMISSIONER AS THEY ARE PASSING YOU THE HAND-HELD MIC.

THE AMOUNT THAT YOU WILL RECOMMEND THAT THIS COURT RECEIVE A CEILING. IN OTHER WORDS, THE RATE HAS TO BE NOT OVER A CERTAIN AMOUNT. YOU HAVE BEEN GIVEN WHAT IT WAS LAST YEAR. YOU KNOW WHAT THAT KIND OF MONEY WILL BRING IN. YOU KNOW WHAT THE REVENUE WILL BRING IN. IT WILL NOT BRING IN ANY AMOUNT OF MONEY THAT WOULD EVEN COVER OUR BUDGET CHALLENGES.

YOU HAVE BEEN GIVEN THE 3.5%, WHICH DOES NOT COVER OUR BUDGET CHALLENGES. AND YOU HAVE BEEN GIVEN THE VOTER APPROVED THAT DOES COVER ALL OUR BUDGET CHALLENGES.

SO I AM WONDERING WHERE, AT LEAST, YOU ARE IN BETWEEN SO WE CAN HAVE A GOOD DISCUSSION ABOUT IT.

>>COMMISSIONER HERNANDEZ: I WANT TO --

>>JUDGE CANALES: WHERE IS YOUR STARTING POINT.

>>COMMISSIONER HERNANDEZ: I WANT TO START WHAT WE HAD LAST

YEAR. >>JUDGE CANALES: WHERE WE HAD LAST YEAR WOULD BRING IN 3.7 MILLION.

AND I WANT TO MAKE SURE YOU UNDERSTAND THAT WILL NOT MEET

OUR BUDGET CHALLENGES. >>COMMISSIONER HERNANDEZ: I

UNDERSTAND, JUDGE. >>JUDGE CANALES: ALL THOSE SALARY INCREASES THAT YOU WANT WILL NOT BE INCLUDED.

NEITHER WILL THE LIMITED RECLASSES NOR WOULD THE NEW POSITIONS. ARE YOU AWARE OF THAT.

[02:10:01]

>>COMMISSIONER HERNANDEZ: JUDGE, OTHER COMMISSIONERS THAT ARE GOING TO SPEAK OUT I AM SURE THOUGH.

>>JUDGE CANALES: I KNOW. I AM WANTING TO MAKE SURE THAT

YOU ARE AWARE -- >>COMMISSIONER HERNANDEZ: I AM

AWARE, JUDGE. >>JUDGE CANALES: I CAN MOVE ON

IF YOU UNDERSTAND THAT. >>COMMISSIONER HERNANDEZ: I

DO. >>JUDGE CANALES: IN CONFLICTED WHAT YOU SAID BEFORE. WE WILL MOVE ON.

COMMISSIONER GONZALEZ. >>COMMISSIONER GONZALEZ: GUILT

WITH A NO REVENUE TAX. >>JUDGE CANALES: NO NEW

REVENUE TAX OF $1 MILLION. >>COMMISSIONER GONZALEZ: YES,

MA'AM. >>JUDGE CANALES: HOW WILL YOU

ACHIEVE. >>COMMISSIONER GONZALEZ: I AM LOOKING AT A PLAN. AND THERE ARE WAYS TO DO IT.

>>JUDGE CANALES: YOU WOULD PUT THE CEILING AT THE NO NEW REVENUE, THEREFORE, NO WAY TO -- TO ADDRESS THE BUDGET

CHALLENGES? >>COMMISSIONER GONZALEZ: THERE ARE WAYS. I AM WORKING ON THOSE NOW.

I THINK -- I THINK WE CAN FIND THOSE MONIES.

AND TALKING -- >>JUDGE CANALES: I CANNOT UNDERSTAND WHAT HE IS SAYING. SOMEBODY PASS THAT MIC TO HIM.

>>COMMISSIONER GONZALEZ: I THINK IT IS YOUR MIC.

NOT MY MIC, I THINK IT IS YOUR MIC.

>>JUDGE CANALES: THE MIC INSIDE THE COURT ROOM.

>>COMMISSIONER GONZALEZ: I AM STATE NOTHING NEW TAX.

>>JUDGE CANALES: WE CAN HEAR YOU PERFECTLY.

>>COMMISSIONER GONZALEZ: THERE ARE WAYS TO FIND THE MONIES THAT WE NEED IF WE START CUTTING BACK ON SOME AREAS AND I AM WORKING ON THAT FOR RECOMMENDATION FOR THE NEXT

TIME. >>JUDGE CANALES: WE WELCOME

THAT BUT SETTING A CEILING. >>COMMISSIONER GONZALEZ: THAT

IS MY CEILING RIGHT NOW, JUDGE. >>JUDGE CANALES: NOW CEILING IS THE NO NEW REVENUE TAX RATE? WHAT ABOUT -- COMMISSIONER MAREZ, WHAT IS YOUR OPINION ON SETTING THE CEILING HERE TODAY?

>>COMMISSIONER MAREZ: WELL, I ALWAYS WANT TO OPERATE WITH A HIGH CEILING. LIKE I SAID WORK IT DOWN.

I DON'T KNOW IF THERE IS CONSENSUS.

I MEAN, IF THERE IS CONSENSUS, THERE IS NO -- I AM NOT GOING TO FIGHT CONSENSUS ON THIS ITEM IF THE COMMISSIONERS OR MAJORITY FEEL THAT THERE IS A BUDGET THAT THEY ARE GOING TO WORK THROUGH, THEN THAT IS WHAT WE ARE GOING TO HAVE TO WORK THROUGH. I -- I FEEL THAT WE NEED TO GIVE OURSELVES EVERY OPPORTUNITY TO -- TO LOOK AT ALL THE FUNDING AND LIKE I S SAID, WE CAN ALWAYS DECIDE NO NEW AT THE VERY END. IS THAT RIGHT, DALE?

>> THAT'S CORRECT. >>COMMISSIONER MAREZ: SO THAT IS JUST MY CONCERN. IS THAT -- IF WE CAN GET TO THAT POINT, WHY DO WE SET THAT TODAY.

I JUST WORRY ABOUT THAT. AND IF WE NEED TO CHANGE IT, WE GO THROUGH A LOT MORE MEETINGS BECAUSE WE WOULD HAVE TO REPOST THESE MEETINGS AND GO THROUGH SIMILAR TIME FRAME THAT WE ALREADY HAVE. IS THAT CORRECT?

>> YES, YOUR HONOR -- YES, COMMISSIONER.

IF WE SET A RATE, CEILING RATE, WILL REQUIRE MULTIPLE PUBLIC HEARINGS AND MULTIPLE AND PUSH OUR PROPOSAL AND ADOPTION PAST

SEPTEMBER 8. >>COMMISSIONER MAREZ: THAT IS MY ONLY CONCERN. I HEAR WHAT THE COURT -- OR WHAT THE MAJORITY OF THE COURT HAVE ALREADY INDICATED, I WOULD JUST ASK TODAY IF YOU SET THE CEILING.

AND THEN IF WE STILL -- IF THE MAJORITY STILL FEEL AT THE END WE WANT TO TACKLE THAT NO NEW REVENUE RATE, THEN WE CAN WALK IT DOWN, BUT I THINK TODAY IF WE CAN ALLOW -- NOW I AM SURE -- AND I AM THANKFUL TO HEAR THAT THERE ARE PLANS IN PLACE TO TRY TO WORK THROUGH THIS. WE ARE GOING TO HAVE TO REALLY HAVE TO MAKE TOUGH CHOICES IN THE PRLTION THAT WE HAVE ARE NOT GOING TO ALL BE -- BE FUNDED, BUT THAT WOULD BE MY ASK, JUDGE, IS I AM GOING TO SUPPORT WHAT THE CONSENSUS SAYS BECAUSE IF I VOTE AGAINST IT, IT DOESN'T MATTER.

STILL THREE VOTES IN FAVOR OF THE NO NEW RATE, BUT THAT'S WHY I SAY TODAY, THAT -- THAT IS WHY TODAY IS SET.

THAT IS WHY THE LEGISLATION WAS CHANGED.

THE WORDING IN THE DESCRIPTION OF THESE ITEMS USED TO BE EFFECTIVE ARE NOW, YOU KNOW, VOTER APPROVED, NO NEW REVENUE RATES. I WOULD JUST HOPE THAT WE WILL SET THE CEILING TODAY AND THEN -- -- IF -- YOU KNOW, IF -- IF WE HAVE AN IDEA THIS IS WHERE WE ARE GOING TO AND WE CAN WORK TOWARD THAT. I JUST DON'T WANT TO START OFF WHERE WE ARE AT THAT RATE. BUT LIKE I SAID, I AM GOING TO YIELD WITH WHAT THE MAJORITY OF THE THIS COURT SAYS AND GOES TOWARD AND I HAVE TO WORK FROM THERE.

SO I KIND OF ALREADY INDICATED WHERE I WAS AT ON THIS VOTE, ON THE LOSING END, BECAUSE I FELT THAT SETTING A CEILING IS -- IS

[02:15:03]

APPROPRIATE AND WHAT MOST TAXING ENTITIES DO.

YOU DON'T FIND THIS HAPPENING IN OTHER COUNTIES BUT THAT HAVE EXTREMELY HUGE GROWTH. THAT IS WHEN YOU ARE REALLY KIND OF ABLE TO WORK THROUGH THIS.

AND WE -- BECAUSE OF COVID AND JUST OUR NATURAL HISTORY, WE ALWAYS KIND OF CHUG ALONG AT A DECENT RATE OF GROWTH.

THAT IS MY CONCERN WITH THE NO NEW REVENUE RATE THAT THERE IS A LOT THAT IS GOING TO BE CUT AND LEFT BEHIND.

LIKE I SAID -- >>JUDGE CANALES: I WOULD LOVE TO DO THE NO NEW REVENUE TAX RATE WHEN WE HAVE A ROBUST DISCUSSION OF WHAT PEOPLE'S PLANS ARE AND THAT WILL TAKE PLACE AFTER WE HAVE DISCUSSIONS ABOUT OUR AMERICAN RELIEF PLAN ACT FUNDS INSIDE EXECUTIVE SESSION, BUT THE PURPOSE OF TODAY WAS TO MAKE CERTAIN TO PROTECT THIS COUNTY AND NOT DRAIN ITS CASH RESERVES, WHICH WE WORKED SO HARD TO BUILD UP.

AND WHEN YOU SEE Y AUDITOR SHOWCASES 2.7 MILLION AND YOU ARE SAYING THAT THE NO NEW REVENUE RATE WILL BRING IN $1 MILLION. YOU ARE GOING TO BE FIRING ALL THE WHOSE POSITIONS YOU CHANGED THIS YEAR, BECAUSE THERE IS NO OTHER WAY. AND THERE ARE -- AT MINIMUM -- AT MINIMUM, IF YOU GIVE NOBODY ANY OF THE NEW LIMITED NEW POSITIONS, NOBODY GETS ANY RECLASSES.

NOBODY GETS -- THERE ARE NO VETERAN TREATMENT COORDINATOR.

THERE IS NO -- ANY OF THE SERVICES THAT WE HAVE TO PROVIDE BY LAW AND BY CONTRACT, AND I AM JUST WONDERING WHAT YOUR SOLUTION IS AND YOU ARE GOING TO HAMSTRING THE COURT TO A REVENUE THAT YOU CAN STILL GET TO IF YOU ACTUALLY PROPOSE A PLAN. BUT TO SAY TO THE CITIZENS TODAY, I HAVE NO PLAN AND I AM GOING TO MAKE CERTAIN THAT WE LOSE OUR CASH RESERVES IS -- IS NOT CONSENSUS.

THAT IS JUST -- THAT IS JUST SOMETHING THAT YOU -- SOMEONE HAS TO ARTICULATE WHY YOU WOULD NOT AT LEAST GO TO THE SAME RATE THAT WE HAD BEFORE OR THE 3.5% AS THE CEILING.

BUT TO SAY I HAVE NO PLAN, BUT I AM GOING TO THINK ABOUT IT AND THE AUDITORS TOLD YOU $2.7 MILLION BARE BONES MINIMUM AND YOU ARE NOT GOING TO ACCOUNT FOR THAT THAT? THAT SEEMS SOMETHING THAT SHOULD BE ANSWERED BY THIS COMMISSIONERS COURT TODAY 37. AND I WOULD LIKE --

>> LET ME TRY TO ANSWER THAT, JUDGE.

>>JUDGE CANALES: WHAT IS THE ANSWER?

>> THE THING IS I WAS -- TO ME, WE TALKED ABOUT IT EARLIER, BRINGING IN ART FUNDS AND ALL THAT.

BUT THE PEOPLE -- THE PEOPLE ARE HURTING ALREADY.

PEOPLE THAT ARE -- THE SMALL BUSINESS.

YOU KNOW, RENTERS. YOU KNOW THE PEOPLE -- THE RESTAURANTS. THEY ARE REALLY HURTING.

PEOPLE HAVE CALLED AND SAID I CAN'T AFFORD ANY MORE TAXES.

CAN'T AFFORD ANYMORE. NOT JUST ABOUT US, BUT ABOUT THE PEOPLE WHO HAVE TO TAKE CARE OF TO AND REALLY BE CAUTIOUS WHAT THEY ARE GOING THROUGH.

IF ALL GOES DOWN AND WE ARE STILL ABLE TO FUNCTION, THAT IS FINE, BUT THEY ARE NOT GOING TO BE ABLE TO FUNCTION IF THEIRS GOES DOWNS. IF YOU WANTED SOMETHING TO TALK ABOUT THEN I WILL DO THE PRIOR YEAR ADOPTION RATE JUST FOR NOW TO TALK ABOUT IT, BUT, YOU KNOW, -- WHERE I STAND ON THIS RIGHT NOW. BUT I WILL GO BACK JUST TO PUT A CEILING AND THE PRIOR YEAR ADOPTION RATE.

>>JUDGE CANALES: OKAY. SO IS -- IF THAT IS A MOTION, THAT PRIOR ADOPTED RATED IS .311483.

AND IT WOULD BRING IN, DALE, $3.7 MILLION.

>> I BELIEVE THAT'S CORRECT. >>JUDGE CANALES: JUST SO WE KNOW, THE VOTER APPROVED RATE WOULD HAVE BROUGHT IN $2.8

MILLION, THAT'S CORRECT? >> I BELIEVE YOU ARE RIGHT.

>>JUDGE CANALES: YES? >> YES, I BELIEVE YOU ARE

CORRECT. >>JUDGE CANALES: 3.8.

IS THAT YOUR CEILING YOU ARE INTERESTED IN MAKING A MOTION

TOWARD? >> YES, MA'AM.

>> I SECOND THAT, JUDGE. >>JUDGE CANALES: ALL RIGHT, I WILL HAVE A MOTION AND A SE SECOND.

AND I WILL TAKE THAT RECORD VOTE.

SINCE YOU MADE THE MOTION. I WILL START CAN YOU

COMMISSIONER GONZALEZ. >>COMMISSIONER GONZALEZ: PRIOR

YEAR ADOPTED PRIOR YEAR RATE. >>JUDGE CANALES: SORRY.

>>COMMISSIONER GONZALEZ: ADOPTED PRIOR YEAR RATE.

>>JUDGE CANALES: BUT -- DO YOU VOTE IN FAVOR?

>> YES, IT WAS MY MOTION, YES. >>JUDGE CANALES: IF SOMEONE

COULD HELP ME. >>COMMISSIONER GONZALEZ: YES,

[02:20:01]

IT WAS MY MOTION. >>JUDGE CANALES: THANK YOU.

COMMISSIONER MAREZ. >>COMMISSIONER MAREZ: AYE.

>>COMMISSIONER HERNANDEZ: AYE. >>COMMISSIONER CHESNEY: NO.

>>JUDGE CANALES: MYSELF AYE. WE HAVE SET A PRIOR -- I AM SORRY -- PRIOR -- THE PROPOSED RATE AS THE PRIOR ADOPTED RA RATED. AND -- AND THAT, DALE, IS A TOTAL OF .311483. SO THAT IS GOING TO BE AS HIGH AS WE GO. AND THAT MONEY IS NOW -- THAT MONEY IS SET IN STONE AND WE CAN GO TO WORK ON THE BUDGET PLAN. AND HOPEFULLY WE WILL HAVE A TIME TO GATHER VERY SOON SO WE CAN SEE HOW WE ARE GOING TO ADDRESS A LOT MORE NEEDS THAN WE WILL HAVE DOLLARS FOR.

AT THIS TIME, I WILL -- >>COMMISSIONER GONZALEZ: EXCUSE ME JUDGE. DALE, WAS 3.7.

>> WHAT WAS THE QUESTION? >>COMMISSIONER GONZALEZ: THE FUNDS -- THE REVENUES 3.7? YES?

>> THE REVENUE FOR THE GENERAL FUND USING THE PRIVR YEAR RATE WILL BE 3,725,861 FOR GENERAL FUND, THE DEBT SERVICE WILL BE THE PRIOR YEAR'S RATE, WHICH WILL BE USING 700 -- I DON'T HAVE THAT NUMBER. USING APPROXIMATELY $700,000 WORTH OF DEBT SERVICE FUND BALANCE.

AND THEN THE -- THE ROAD FUND PRIOR YEAR RATE ACTUALLY EXCEEDS THE VOTER APPROVED R RATE.

AND THE PRIOR YEAR IS .003769 FOR A TOTAL TAX RATE OF .31 .311483. WE COULD -- SO YOU DO NOT EXCITE THE VOTER APPROVED RATE AND REQUIRE AN ELECTION.

MOVE THAT VARIANCE OF THE INCREASE UP TO THE GENERAL FUND. SO YOU HAVE THE SAME TOTAL RATE WITHOUT REQUIRING AN ELECTION. IF YOU ALL WOULD APPROVE TO DO SO, BUT THAT WOULD REQUIRE A VOTE.

>>JUDGE CANALES: SAY THAT AGAIN, LISA?

SAY THAT AGAIN. >> THE VOTER APPROVED TAX RATE -- HOLD ON. JUST A SECOND.

LET ME GO GRAB MY OTHER. >> BUT WE DIDN'T APPROVE THAT.

>>JUDGE CANALES: WE DIDN'T DO THAT.

>> COMBINED THE TOTAL -- .3 .311483.

IF YOU LOOK AT THE THIRD ROW FROM -- FROM THE LEFT, YOU WILL SEE THE MAXIMUM RATE FOR THE ROAD FUND A .03765.

WE CAN NOT EXCEED THE RATE TO GO TO THE PRIOR YEAR -- IF YOU WANT TO USE THE PRIOR YEAR RATES FOR THE GENERAL FUND AND DEBT SERVICE FUND AND ADDING THE ROAD FUND .31189.

A SLIGHT DECREASE. OTHER WAY -- THE COURT'S

INTENTION. >>JUDGE CANALES: YOU CAN KEEP THE TOTAL TAX RATE .311483 AND MOVE THE VARIANCE UP TO THE GENERAL FUND AND GIVE YOU A LITTLE BIT MORE ROOM IN THE GENERAL FUND AND YOUR TOTAL TAX RATE DON'T CHANGE.

IF YOU ADOPT THE TAX RATE EXACTLY AS IT WAS LAST YEAR, YOU WOULD BE REQUIRING AN ELECTION.

>> WE CAN NOT EXCEED THE AMOUNT FOR ROAD FUND.

>>COMMISSIONER CHESNEY: I UNDERSTAND THAT.

IF WHAT YOU ARE SAYING IS, L LISA, I DON'T THINK ANYBODY -- AND I WAS ON THE LOSING SIDE, BUT I DON'T THINK ANYONE WANTS TO HAVE AN ELECTION. WHAT YOU ARE SAYING IS -- YOU ARE SAYING COMMISSIONER GONZALEZ WANTS TO KEEP THE OVERALL RATE WHAT IT WAS LAST YEAR 31143 AS THE MAJORITY OF THE COURT, YOU ARE SAYING MOVE A LITTLE BIT OF ROAD FUND UP TO THE GENERAL FUND TO AVOID AN ELECTION --

>> TO CHANGE IT. >> FIVE DIFFERENT RATES.

>>COMMISSIONER CHESNEY: DOESN'T CHANGE THE -- WHATEVER

WE CAN TO DO AVOID AN ELECTION. >>COMMISSIONER GONZALEZ: THEN

THAT IS WHAT WE DO. >>JUDGE CANALES: ALL WE HAVE TO DO IS DO WHAT LISA IS SAYING AND SHAVE OFF THE ROAD FUND.

>> IT WILL BE A DECREASE TO THE ROAD FUND.

IT WILL BE A DECREASE TO THE ROAD FUND OF .000024 AND INCREASE BY THE SAME TO THE GENERAL FUND SO THAT THE GENERAL FUND RATE WOULD BE . .262986 INSTEAD OF .262962.

>>COMMISSIONER CHESNEY: I THINK THE BEST WAY WOULD BE TO

[02:25:01]

WITHDRAW THE PRIOR MOTION. LET COMMISSIONER GONZALEZ AMEND IT AND REVOTE IT TO MAKE SURE IT IS CLEAR FOR THE RECORD

WOULD BE MY SUGGESTION. >>COMMISSIONER GONZALEZ: WITH THE NUMBERS. I WILL -- I WILL WITHDRAW MY

MOTION TO -- >> THE MOTION WILL STILL TO BE MAINTAIN THE PROPOSED RATED. THE DEBT SERVICE .04752 AND GENERAL RATE WHICH THE BALANCE TO MAKE THE DIFFERENCE.

>>COMMISSIONER GONZALEZ: DO I HEAR A SECOND TO WITHDRAW THE SECOND. THEN I WILL MAKE A MOTION TO

SHOW THE ACTUAL NUMBERS. >> THOSE VERY NUMBERS TO SHOW THAT WILL PROVIDE THAT TO THE TACK OFFICE.

>> A MOTION AND SECOND. >>JUDGE CANALES: LET ME MAKE THE MOTION SO I CAN SEE IF I CAN GET IT CLEAR HERE.

THE -- JUST SO EVERYBODY KNOW, THE RATE DOESN'T CHANGE.

OUR MOTION IS VALID, OKAY. THAT THING THERE THING IS THAT WHAT YOU ARE SAYING IS THAT YOU ARE NEEDING TO SPECIFICALLY DESCRIBE THE GENERAL FUND, DEBT SERVICE FUND AND ROAD FUND.

THE TOTAL TAX RATE IS THE SAME AS LAST YEAR AS THE CEILING.

OPINIONED YOU A NOER GOING TO DESCRIBE WITH SPECIFICITY THE MAKE-UP OF THE 311483. AND I AM GOING TO LET.

>> JUDGE, HOLD ON REAL QUICK. I THINK TECHNICALLY THE MOTION IS INCORRECTED BECAUSE HIS MOTION WAS TO ADOPT THE PRIOR RATE WHICH INCLUDED THAT ROAD FUND AS IN THE PRIOR RATE AS CALCULATED. SO YOU COULD BE RIGHT AND I THINK TECHNICALLY IT COULD BE WRONG.

SO I WOULD JUST ASK THAT MAYBE YOU WITHDRAW IT AND REDO IT.

IT IS YOUR CALL. >> LET ME ASK THE COUNTY ATTORNEY. LET ME ASK THE COUNTY ATT ATTORNEY.A GOOD POINT. I WILL DEFER TO HER.

>> SINCE IT WAS SPECIFIED WE CAN'T DO THE ROAD RATE AS DONE EXACTLY AS LAST YEAR, IT WOULD BE A GOOD IDEA OR BETTER PRACTICE TO GO AHEAD AND RESPECIFY.

>> I HAVE THE RATE NUMBERS IF WE HAVE -- FOR CONSIDERATION.

TOTAL RATE .311483. THE GENERAL FUND .262986.

THE DEBT SERVICE .044752. ROAD FUND MAXIMUM 00.37045.

WHICH IS THE PRIOR YEAR RATE. THE RATE WE ARE NOW FROM

POSING. >>COMMISSIONER GONZALEZ: MY MOTION TO APPROVE THOSE NUM NUMBERS.

>> SECOND. CHEST WOULD WE NEED TO WITHDRAW

THE ENTIRE MOTION. >>COMMISSIONER GONZALEZ: WE

DID. >>JUDGE CANALES: CAN WE JUST

AMEND, JENNY. >> WITHDRAWAL.

>>COMMISSIONER CHESNEY: WE WOULD WITHDRAW THE PRIOR ONE.

>>COMMISSIONER GONZALEZ: WE ALREADY DID.

>> BUT YOU DIDN'T VOTE ON WITHDRAWING IT JUDGE JUDGE HE IS GOING TO WITHDRAWAL THE MOTION.

A SECOND FOR THE WITHDRAWALS. ALL THOSE IN FAVOR SIGNIFY BY SAYING AYE. OPPOSED SAME SIGN.

NOW YOUR NEW MOTION AND I HEARD COMMISSIONER MAREZ WITH A SECOND. IS THAT A SECOND THAT'S COR

CORRECT? >> HERNANDEZ, WHOEVER.

>>COMMISSIONER GONZALEZ: COMMISSIONER GONZALEZ WITH A

SECOND. >>JUDGE CANALES: VOTE,

COMMISSIONER GONZALEZ. >>COMMISSIONER GONZALEZ: YES.

>>COMMISSIONER MAREZ: AYE. >>COMMISSIONER HERNANDEZ: AYE.

>>COMMISSIONER CHESNEY: NO. >>JUDGE CANALES: MYSELF, AYE.

OKAY. AS THEY SAY THE AYES HAVE IT.

SO WE HAVE THE RATES CORRECT AS WERE ARTICULATED ON THE RECORD.

THEY TOTAL .311483 THAT WILL BE OUR CEILING.

AND THEY ALSO ARE REFLECTED INDIVIDUALLY AS DALE READ THEM

AND THE MOTION REFLECTS. >> NOW WE MUST PROCEED TO THE

HOSPITAL DISTRICT. >>JUDGE CANALES: WE WILL MOVE ON TO THE HOSPITAL DISTRICT. AND SO IS THERE -- A MOTION TO APPROVE THE CEILING RATE FOR THE HOSPITAL DISTRICT AT -- AT THIS TIME? OKAY.

WELL, I WILL MAKE THE MOTION TO GO TO THE VOTER APPROVED TAX RATE AS A CEILING ONLY. AND THAT IS .15 -- SORRY 11 11560137 AND WOULD LOOK FOR A SECOND.

>> SECOND. JUDGE SEEING NO SECOND --

[02:30:04]

>> COMMISSIONER, THERE WAS A SECOND.

>> COMMISSIONER MAREZ SECONDED. >>JUDGE CANALES: SORRY, IT'S THESE -- TERRIBLE AUDIO FOR ME AND I APOLOGIZE THIS MORNING.

>>COMMISSIONER CHESNEY: I DON'T HEAR.

>>JUDGE CANALES: SORRY, BRENT, GUILT BORROW SOME HEARING AIDS.

ALL THOSE IN FAVOR SIGNIFY BY SAYING AYE.

>> THIS MUST BE A RECORD VOTE AS WELL.

>>JUDGE CANALES: A RECORD V VOTE.

COMMISSIONER HERNANDEZ. .

>>COMMISSIONER HERNANDEZ: NO. >>COMMISSIONER MAREZ: AYE.

>>COMMISSIONER GONZALEZ: AYE. >>COMMISSIONER CHESNEY: NO.

>>JUDGE CANALES: BARBARA CANALES, AYE.

WHAT WAS THE VOTE ON THAT BECAUSE HARD TO HEAR.

>> 3-2 VOTE FOR YES, YOUR HO HONOR.

>> WE CAN MOVE ON TO EXECUTIVE SESSION AT THIS TIME.

>>COMMISSIONER CHESNEY: SORRY, WHAT WAS THE RATE THAT ENDED UP

BEING THE HOSPITAL DISTRICT. >> 115601 AS A CEILING.

OKAY. >>COMMISSIONER CHESNEY: THAT WAS THE ONE THAT WENT UP 5%? SORRY --

>>JUDGE CANALES: THAT IS 8% FOR HOSPITAL DISTRICT VOTER APPROVES 8. WHAT THEY WANT US TO CONSIDER

IS THE 5. >>COMMISSIONER CHESNEY: THE CEILING WE APPROVED AN 8% INCREASED CEILING?

>> THE VOTER APPROVED TAX RATE FOR ANY HOSPITAL DISTRICT IS 8% 37 OURS IS 3.5%. FOR HOSPITAL DISTRICTS 8%.

13 WE APPROVED A 8% CEILING TRACKS RATE FOR THE HOSPITAL DISTRICT NOT THE PROPOSED ONE. I AM JUST WANTING TO MAKE SURE

THAT -- >>JUDGE CANALES: THAT'S THAT'S CORRECT. THAT'S CORRECT.

AND WE WILL COME BACK AT BUDGET TIME AND KNOW THAT SOMEWHERE AT THAT RATE OR BELOW IS WHAT THIS COURT COULD APPROVE.

WE CAN NOT GO HIGHER THAN THAT. THAT IS THE CEILING.

>>COMMISSIONER CHESNEY: THANK YOU.

>>JUDGE CANALES: OKAY. ALL RIGHT, NOW -- NOW WE HAVE
