TOO. >> GOOD MORNING, MY NAME IS
NAME ] >> THIS IS SPECIFICALLY FOR COMMISSIONER MAREZ . WE LIVE IN THE AMISTAD AREA WE DO NOT HAVE PUBLIC WATER AVAILABLE. I KNOW YOU ARE SIGNED UP AS WELL SO I WAS GOING TO GIVE ADDITIONAL TIME. IF YOU'RE DONE, THAT IS GOOD.
>> YES OF COURSE, LIKE MY WIFE WAS SAYING WE RESIDE THERE IN A SMALL COMMUNITY. WE HAVE ELDERLY PEOPLE, WE HAVE CHILDREN WHO GO TO SCHOOL THAT THE BUS CANNOT GO IN BECAUSE THERE IS NO ROAD. SOME OF THEM HAVE TO WALK HALF A BLOCK TO GET TO THE MAIN ROAD TO GET PICKED UP TO GO TO SCHOOL.
ACTUALLY GETS KICKED UP WITH MUD WHEN IT RAINS. PEOPLE WORK OUT THERE LATE. THEY HAD TO GIVE RIGHTS TO MAKE SURE THEY GO TO SCHOOL, GIVE MY NEIGHBORS A RIDE SOMETIMES WHEN I GO LATE TO WORK. IF I HAVE A CHANCE, I HELP OUT IN THAT WAY, BUT EVERY HELPING OUT IN THE COMMUNITY. IT'S KIND OF HARD, ESPECIALLY THE ELDERLY AND THE KIDS. THEY WANT TO GO TO SCHOOL AND THEY HAVE NEW TENNIS SHOES AND THEY ARE CAKED UP WITH MUD AND WHO WANTS TO GO TO SCHOOL WITH MUDDY SHOES? IT IS HARD WE ARE TRYING TO MAKE A BETTER COMMUNITY AND HELP EACH OTHER OUT. THAT'S WHY WE'RE HERE TODAY TO SEE IF THE COUNTY COMMISSIONERS COURT AND YOUR HONOR, HEAR US OUT AND SEE WHERE WE CAN START TO MAKE IT BETTER COMMUNITY OUT THERE AND LIVABLE FOR EVERYBODY. THAT'S ALL I'VE GOT.
>> THANK YOU. >> FOR CLARIFICATION, THE LINES WERE REDRAWN SO MY AREA DOES NOT REPRESENT THAT ANYMORE. I HAVE TAKEN CALLS ON THAT AND WE WILL WORK ON THE COURT TO FIND A RESOLUTION.
I AM JUST CLARIFYING. I CAN'T GET INTO A DISCUSSION. I'M JUST TRY TO CLARIFY THAT'S NOT AN AREA I REPRESENT.
>> I COME TO THE COURTHOUSE AND I DON'T KNOW WHO CAN HELP US.
IF IT'S NOT YOU I DON'T KNOW. >> IT IS NOT IN MY PRECINCT
ANYMORE. >> IF THERE IS GUIDANCE YOU CAN GIVE US IN THE APPOINTMENT THAT WOULD BE GREAT.
>> OKAY THANK YOU. >> THE NEXT PERSON TO SPEAK,

MORRIS ABOUT. ALL I CAN DO, I WON'T SAY ANYTHING BAD, JUST LETTING YOU KNOW THEY ARE WOLF IN SHEEP'S CLOTHING AND YOU NEED TO BE AWARE OF THAT AND WHO YOU ARE HELPING. SO THAT'S BASICALLY ALL I HAVE TO SAY. WE JUST WANTED TO ACT AS A REMINDER. WE HAVE NOT BEEN HERE FOR YOU WHILE. THE OTHER, EVENTS , SINCE , I FELT LIKE YOU ALL NEEDED TO BE AWARE AND HAVE A WARNING. I THINK YOU KNOW WHAT I'M TALKING ABOUT. THERE WAS SOME STUFF, SO THANK YOU VERY
MUCH. >> THANK YOU, MA'AM. ANYONE ELSE WHO WISHES TO SPEAK ON PUBLIC COMMENT DID NOT HAVE THE OPPORTUNITY TO SIGN IN? THAT CONCLUDES OUR PUBLIC COMMENT SECTION. THERE IS NOBODY ONLINE? THAT CONCLUDES . NOW
[1. Nueces County Coastal Parks Board]
MOVING ON ITEM H. BOARD APPOINTMENTS, THE FIRST OF IS[00:30:04]
THE NUECES COUNTY COASTAL PARKS BOARD. WE HAD A TEMPORARY RESIGNATION FROM MISS WALLING AND SHE RESCINDED THAT RESIGNATION AND PLANS TO STAY IN THE MEANTIME WE DID GET ONE APPLICATION. BUT, I WOULD MAKE THE MOTION TO ACCEPT HER LETTER , RESCINDING HER RESIGNATION AND KEEP MK WALLING ON THE BOARD. A MOTION AND A SECOND ALL THOSE IN FAVOR OR ANY OTHER DISCUSSION? ALL OF THOSE IN FAVOR ANY OPPOSED, SAME SIGN.>> RELATED ITEM TO THAT CAN WE GET SOMETHING FROM THE COUNTY ATTORNEY'S OFFICE OR I DON'T KNOW WHO IN THE STAFF OR ELECTED OFFICIAL CAN HELP US WITH VERIFICATION ON THE ISSUES. I KNOW THERE WAS CONCERNS BROUGHT UP IN THAT AREA AND THEY WERE KIND OF BROUGHT UP TO ME. I KNOW THERE ARE SOME CHALLENGES AS FAR AS THE BOARD AND THE MAKE UP OF THE BOARD. LIKE TO HEAR THERE IS NOT ANYONE RESIGNING. MAYBE WE CAN CONNECT OFF-LINE AFTER THE MEETING.
>> ABSOLUTELY. I AM NOT FILLED IN ON THIS. I WILL MEET WITH
YOU ANYTIME. >> HER RESIGNATION WAS MOVED TO TAKE CARE OF HER MOTHER AND THEY WORKED IT OUT WITH HER SISTER OR SOMETHING SO SHE IS STAYING IN TOWN. SHE WOULD HAVE STILL YES. OKAY. ITEM NUMBER TWO. NUECES COUNTY EMERGENCY

CONSENT AGENDA. DOES ANY COMMISSIONER HAVE ANY CONSENT ITEM THAT THEY WISH TO PULL FOR FURTHER DISCUSSION? IF YOU DO, PLEASE LET ME KNOW.ARE THERE ANY OTHERS? ANYONE? I WOULD MAKE A MOTION TO PASS THE CONSENT AGENDA WITH THE EXCLUSION OF ITEM HI FOR FURTHER DISCUSSION.
>> SECOND. WE HAVE A MOTION AND A SECOND. ALL THOSE IN FAVOR SAY AYE. I PULLED ITEM HI TO GIVE RECOGNITION TO SOME PEOPLE, THESE PEOPLE TO GET A VEHICLE FOR THE JJ, A THING HE HAS NEEDED FOR A WHILE. SHE WENT ON HER OWN. SHE TALKED TO THE COURT OF CORPUS CHRISTI. WE WOULD LIKE TO THANK THEM AND THE FOUNDATION. MIKE SHAW TOYOTA AND BETTY JEAN HERSELF FOR THE WORK AND EFFORTS IN GETTING THIS VEHICLE DONATED IN FULL TO NUECES COUNTY FOR JJS USE AND THE GREAT WORK HE DOES FOR OUR VETERANS. ONE TO PULL IT OUT TO MAKE THOSE COMMENTS AND BE ABLE TO GIVE CREDIT WHERE CREDIT IS DUE. SHE WORKS VERY HARD OUT AT THE VETERANS CEMETERY, AS WELL. JJ WORKS VERY HARD AND THESE PEOPLE WANTED TO BE PART OF THAT. IN CLARIFICATION I WANT TO MAKE SURE EVERY COMMISSIONER KNOWS
[00:35:02]
THERE WASN'T A COMMISSIONER WHO WENT OUT TO SOLICIT THESE FUNDS FROM ANY ONE OF THESE. WE HAVE A POLICY AND RULE, THIS WAS BETTY JEAN ON HER OWN WHO WENT WITH THESE PEOPLE AND MET WITH THEM. WANT TO SAY THANK YOU, THANK YOU TO EACH OF THEM, TO BETTY JEAN AND JJ FOR THEIR WORK. I MAKE THE MOTION TO PASS. WE HAVE A MOTION AND A SECOND. ANY OTHER DISCUSSION? ALL THOSE IN FAVOR, SAY AYE. ANY OPPOSED, SAME SIGN. THE MOTION PASSES. MOVING ON. OUR REGULAR AGENDA. I AM GOING TO[13. Discuss and consider to take action on Nueces County collecting plat application fees within the County's jurisdiction and related matters.]
PULL UP ITEM 3 A 13 I WAS ASKED TO ADDRESS THAT ONE FIRST BECAUSE OF TIME CONSTRAINTS ON PEOPLE. NUMBER 13 IS DISCUSS AND CONSIDER TO TAKE ACTION ON THE NUECES COUNTY COLLECTING PLAT APPLICATION FEES WITHIN THE COUNTY JURISDICTION ANDRELATED MATTERS. >> JUDGE I MAKE A MOTION TO
>> WE HAVE A MOTION AND A SECOND, DO WE HAVE ANY OTHER
DISCUSSION? >> YES, WE HAVE PEOPLE HERE WHO WOULD LIKE TO SPEAK ON THE MATTER. I WOULD LIKE TO ALLOW THEM THE OPPORTUNITY TO SPEAK. THEY HAVE SOME POTENTIAL OTHER SUGGESTIONS THAT MIGHT BE GOOD.
>> PERFECT. >> GOOD MORNING MINIMUS ] EXECUTIVE OFFICER OF THE COASTAL BEND HOME BUILDERS ASSOCIATION. ON BEHALF OF THE ASSOCIATION WE ARE IN OPPOSITION TO ANY FORM OF PLANNING FEES FROM NUECES COUNTY WITHIN THE CITY OF CORPUS CHRISTI . AS THE DEVELOPMENT COMMUNITY DEALS WITH THE CITY OF CORPUS CHRISTI WHEN SUBMITTING PLATS AND APPROVING MEMBERSHIP IS NOT IN OPPOSITION TO THE POOREST 'S FEE STRUCTURE FOR THE MAINTAINED AREA OUTSIDE OF ET J BARRING REVIEW AND EXPEDITION OF SERVICES EACH ALLOCATION. IN MY DISCUSSION WITH OTHER BUILDER ASSOCIATIONS IN TEXAS THE COMMON PROCEDURE IS COUNTY OF THE CITY THAT DIRECTLY OVERSEES THE DEVELOPMENT PROCESS VARIES. INTERLOCAL AGREEMENT IS UNIQUE IN A WAY THAT DEVELOPERS SUBMIT TO THE CITY AND THE CITY HANDLES THE PROCESS OF SENDING TO INDIVIDUAL DEPARTMENTS INCLUDING THE COUNTY. THE CONSENSUS IS FEASIBLE TO PAY TO THE MUNICIPALITY IN WHICH DEVELOPER REQUIRED TO SUBMIT PAPERWORK DIRECTLY. INSTANCE OF DEVELOPING IN THE INSTANCE OF DEVELOPMENT GOING INSIDE OF ET J COUNTY FEES ARE REDUCED IF PAID TO THE COUNTY AND THE CITY BECAUSE THE DEVELOPER MUST SUBMIT TO COUNTY AND CITY IN OUR AREA THE DEVELOPER ONLY SUBMITS TO THE CITY WHEN DEVELOPMENT FALLS WITHIN ETJ RECOMMENDS INTO THE COUNTY WOULD BE TO WORK WITH THE CITY ON AMENDING THE AGREEMENT TO PROCURE THE PORTION OF FEES THEY ARE SEEKING TO COLLECT WITHIN ETJ DIRECTLY WITH THE
CITY. >> LOTS. I AM A LAND DEVELOPER IN CORPUS CHRISTI AND NUECES COUNTY. TO ADD ON TO WHAT WE WERE TALKING ABOUT ULTIMATELY THE COUNTY HAS A INTERLOCAL AGREEMENT THAT THEY HAVE FROM 2003 WHICH HAS A LOT OF FAILING PARTS ON BOTH SIDES. I HAVE BEEN RECOMMENDING FOR A FEW YEARS NOW THAT THE COUNTY OPEN DISCUSSIONS WITH THE CITY BECAUSE ULTIMATELY, THE CITY IS THE ONE WHO TAKES THE PLAT IF YOU ARE INSIDE IN THE COUNTY ETJ AND THAT'S KIND OF THE MAIN ARGUMENT HERE. IF THE CITY TAKES OVER OR HAS THE PLAT YOUR INTERLOCAL AGREEMENT IS REQUESTING THAT YOU THE COUNTY BEING THE REVIEW PROCESS WHEN THE CITY HAS A REVIEW PROCESS THEMSELVES, THE CITY IN THE REVIEW PROCESS THEIR PUBLIC WORKS OR WATER DEPARTMENT OR OTHER DEPARTMENTS THAT THEY HAVE AT THE CITY, THEY SHARE THESE FEES FOR THE REVIEW PROCESS AND YOU GUYS CAN ALL BE PART OF THAT RATHER THAN CREATE YOUR OWN FEE FOR THE PLATS IN THE ETJ. WHEN YOU HAVE NEIGHBORS OUTSIDE THE ETJ WE FULLY SUPPORT YOU BEING ABLE TO COLLECT A FEE , BUT WE ALSO WANT A SERVICE FOR THE FEE AND RIGHT NOW THE COUNTY NEEDS TO PROVIDE BETTER SERVICE AND BETTER COMMUNICATION. SO IF I COME BRING A PLAT IN THE COUNTY NOT IN THE ETJ, THEN I KNOW WHO TO TALK TO, HOW LONG IT WILL TAKE TO GET COMMENTS BACK, RULES AND GUIDELINES AND PROCEDURES THAT ONLY BENEFIT YOUR STAFF AND THE DEVELOPER TO COME OUT WITH A BETTER PROJECT.
WEATHER WITH THE STREETS, DRAINAGE AND PORTIONS WE CAN DO IN THE COUNTY. RIGHT NOW YOU'RE ASKING TO DO AS A WHOLE AND ULTIMATELY YOU ARE DOUBLE TAXING YOUR CITIZENS BECAUSE ULTIMATELY THE COST GOES DOWN TO THEM. IF YOU LOOK AT THE INTERLOCAL AGREEMENT THERE IS A LOT OF THINGS YOU CAN COME AND FIX AND I RECOMMEND YOU ENGAGE WITH DEVELOPMENT SERVICES BECAUSE IT IS STANDARD PROCESS AND PROCEDURE. AT THE END OF
[00:40:06]
THE DAY THEY SHARE FEES AND FUNDS FOR THE PLAT REVIEW AND PI REVIEW AND RIGHT NOW I HAVE DONE A NEIGHBORHOOD IN THE COUNTY, BUT IN THE ETJ. IT TOOK SOMEWHERE OF NINE MONTHS TO GET BACK COMMENTS AND PLAT COMMENTS FROM THE COUNTY BECAUSE YOU HAVE A 30 DAY GUIDELINE. WHEN THE CITY SENDS INFORMATION I CAN'T TALK TO YOU I HAVE TO TALK TO THE CITY, THE CITY HAS TO TALK TO YOU AND THEN YOU HAVE UP TO 30 DAYS TO RESPOND AND THEN SEND BACK TO THEM. AND ANOTHER 30 DAYS FOR ANY PARTICULAR COMMENT. GENERALLY YOU TAKE ALL 30 DAYS WHICH SLOWS DOWN DEVELOPMENT, SLOWS DOWN TAXES FOR THE CITY AND THE COUNTY AND SLOWS DOWN DEVELOPMENT AS A WHOLE.THERE'S A LOT OF THINGS THE COUNTY CAN DO BUT I RECOMMEND YOU START WITH LOOKING AT THE INTERLOCAL AGREEMENT AND FIXING THAT AND UPDATING IT MAINLY. IT IS FROM 2003 AND THE WORLD HAS CHANGED. ULTIMATELY WE CANNOT BRING OUR PLATS AND PI PLAN TO THE COUNTY SO HOW WOULD WE PAY YOU A FEE BECAUSE THE CITY IS DEVELOPMENT SERVICES THAT DOES THE INTAKE AND THEY CAN EASILY PORTION OUT A PORTION OF THEIR FEES TO PAY FOR THE PORTION OF REVIEW OR PROCESS YOU REQUIRE IN THAT BECAUSE AT THE END OF THE DAY THEY DO THAT FOR OTHER DEPARTMENTS THAT THEY HAVE AND THAT THEY WORK WITH IN THEIR OWN CITY.
>> MAKES SENSE, GOOD POINT. >> JUDGE, COMMISSIONERS, ] THANK YOU FOR HAVING US HERE TODAY. THANK YOU FOR THE OPPORTUNITY TO SPEAK WITH YOU AND WE APPRECIATE THE OPPORTUNITY TO VISIT WITH YOU ON THE ISSUE. ONE OF THE KEY THINGS WE ARE AGAINST IS DOUBLE FEES AND THAT'S ESSENTIALLY WHERE THIS GOES. I WANTED TO ADDRESS THE ISSUE OF THE CORPUS CHRISTI WATER AREA. AS LONG AS WE FALL WITHIN THAT, THERE IS ADDITIONAL PROBLEMS THAT ARE CREATED IF THE INTERLOCAL AGREEMENT IS NOT UPDATED AND FOLLOWED. IT SEEMS PRETTY CLEAR THAT THE AGREEMENT IS IN PLACE. WE HAVE BEEN USING IT FOR YEARS. INSIDE THE ETJ AND INSIDE THE CCN THIS WILL CREATE CHALLENGES AND DOUBLE FEES SO WE APPRECIATE YOUR
CONSIDERATION OF OUR REQUEST. >> THANK YOU.
>> JUDGE, SOME DISCUSSION. I HAVE ALWAYS SAID THAT I SUPPORT THE IDEA OF THESE FEES TO COLLECT WHAT THE COUNTY SHOULD.
I HAVE ALWAYS BEEN ON RECORD I DO NOT BELIEVE IN PLACING AN ADDITIONAL FEE ON OUR DEVELOPERS WHEN IT'S ALREADY BEING TAKEN. I THINK THAT'S THE ISSUE WE HAVE TO WORK THROUGH AND I TOTALLY AGREE WITH THAT. COMMISSIONER, I KNOW THIS HAS BEEN AN ISSUE AND I THINK IF YOU CHANGE THE MOTION OR RETRACT YOUR MOTION AND ALLOW TO ADOPT THE PLAT FEES PROPOSED OUTSIDE THE ETJ OF CORPUS CHRISTI I THINK, FOR ONE I WOULD BE ACCEPTING OF THAT. AND THEN I CAN MAKE ANOTHER MOTION THAT WE COULD DIRECT TO STAFF OR THE JUDGE OR SOMEONE ELSE TO GO WORK WITH THE CITY OF CORPUS CHRISTI ON THIS. THAT ISSUE , AS SAID IT'S NOT GOING AWAY, IT'S BEEN THERE. THERE HAS BEEN NO REAL COMMUNICATION IN 20 OR 21 YEARS SINCE THE CREATION OF THIS INTERLOCAL , TO ADJUST FOR THE CHANGES, THE CCN, WHEN YOU TALK ABOUT THE BOUNDARIES OF THE WATER SYSTEM FOR THE CITY OF CORPUS CHRISTI. IF WE CHANGE, COMMISSIONER, BECAUSE IF YOU KEEP THE MOTION I WON'T SUPPORT IT FOR THE ENTIRE COUNTY. BUT, WE SUPPORT EVERYTHING OUTSIDE THE ETJ OF CORPUS CHRISTI AND THEN WE COME BACK TO WORK ON THE REST TO CORRECT IT. I THINK THAT'S THE ONLY ISSUE YOU HAVE, WORK OUT
THAT PART ALONG THE ETJ. >> THAT WOULD BE WORKING OUT THE MOU TO CORPUS CHRISTI TO WHERE WE GET FEES FOR WHAT WE DO AND CLARIFYING THE TIME WHERE WE RESPOND SEE YOU ARE NOT WAITING. THAT WAS A BIG ISSUE BROUGHT TO MY ATTENTION.
SO I CAN AGREE TO THAT. >> THE COUNTY NOT THE CITY. IT IS THE COUNTY JURISDICTION. TO ME
>> DIDN'T WE TALK ABOUT THIS YESTERDAY?
>> INTO THE MICROPHONE. SORRY.
[00:45:02]
>> IT WILL BE. I THINK. OUTSIDE OF THE ETJ.
>> THE OTHER WOULD BE WORKING ON A MOU WITH THE CITY.
>> THAT'S CORRECT. >> CLARIFY ITS OUTSIDE THE ETJ BECAUSE THE COUNTY JURISDICTION IS INSIDE AND OUTSIDE.
>> IF YOU CAN REWORD YOUR MOTION.
>> ANYTHING OUTSIDE. >> MAKE SURE YOUR MOTION SAYS ANYTHING OUTSIDE AND WE ARE READY TO MOVE FORWARD AND VOTE.
IT WILL CLARIFY THE MOTION. >> YES I WANT TO CLARIFY. MY MOTION AND KEEP OUTSIDE THE ETJ.
>> TO ONLY BE, THIS MOTION ONLY AFFECTS OUTSIDE OF THE ETJ.
>> I SECOND IT, BUT I THINK I'M GLAD THIS WAS UP BECAUSE THERE'S FAULT IN EVERYBODY HERE. THE COUNTY, THE DEVELOPERS. EVERYBODY HAS A LITTLE FAULT IN THE PROCESS.
WHEN WE GO AND HAVE PROBLEMS SOMETIMES WE NEED TO RESTRICT.
WE ARE HAVING ISSUES THERE, NOT THE COUNTY ISSUE. THE DEVELOPER ISSUE. SO WE WANT TO CORRECT SOME THINGS AND THE DEVELOPER NEEDS TO GET TOGETHER AND CORRECT SOME OF THE ISSUES WE HAVE TWO SURE THINGS ARE CLARIFIED. TO MAKE SURE EVERYTHING IS PERMITTED AND WHAT GOES IN THE RIGHT DIRECTION AND EVERYTHING ELSE. I THINK IT'S TIME FOR US TO GET MORE INVOLVED TO MAKE SURE EVERYTHING IS GOING IN THE RIGHT DIRECTION. I GUESS CHECK AND BALANCE FOR BOTH OF US. SO I THINK IT'S ABOUT TIME AND I SECOND THE MOTION.
>> WE HAVE A MOTION AND A SECOND. ANY OTHER DISCUSSION?
>> THE MOTION IS CLEAR? OUTSIDE THE ETJ.
>> YES, WE HAVE A MOTION AND A SECOND. ALL THOSE IN FAVOR, SAY
AYE. ANY OPPOSED, SAME SIGN. >> JUDGE I WANT TO MAKE ANOTHER MOTION TO DIRECT STAFF AND COUNTY JUDGE OR DESIGNEE TO MEET WITH THE CITY OF CORPUS CHRISTI TO WORK ON THE INTERLOCAL AGREEMENT BETWEEN THE CITY AND NUECES COUNTY. TO ADDRESS COUNTY COLLECTING PORTION WHICH THE COMMISSION MENTIONED EARLIER. PLANNING FEES AND ANY OTHER ISSUES TO BE ADDRESSED, TO UPDATE THE INTERLOCAL. THAT WOULD BE MY
MOTION. >> YOU ARE DOING THAT ALREADY?
>> DIRECTING HIM TO DO IT NOW.
>> I KNOW EXACTLY WHAT HE SAID. WE ARE DOING IT NOW, THE CITY
BRINGS THE PLANS TO REVIEW? >> THE PROCESS IS ANYTHING WITHIN THE ETJ , THE CITY SUBMITS THE PLAT FOR US TO REVIEW. AND OUR STAFF REVIEWS OF THE PLAT. SO USUALLY ANYWHERE FROM 14 TO 30 DAY TURNAROUND. WE TRY TO EXPEDITE THE PROCESS BECAUSE YOU KNOW WE TRY TO ASSIST. WE DO REVIEW IT AND WE SUBMIT BACK TO THE CITY AND THE CITY CITY SUBMITS COMMENTS BACK TO THE DEVELOPER.
>> IS THAT LIKE A MOU HAVE WITH THE CITY? DO WE NEED A NEW ONE?
>> YES OR AND I DO AGREE WE NEED TO UPDATE THE AGREEMENT. I THINK THERE NEEDS TO BE SOME TYPE OF DOCUMENTATION THAT SAYS THAT THE CITY CAN'T ACCEPT THE SUBDIVISION WITHOUT ONE FROM THE COUNTY AND ONE FROM THE CITY. WITH SOME TYPE OF LETTERHEAD THAT SAYS WE BOTH AGREE THE DEVELOPMENT IS AND WAS CONSTRUCTED BY THE WAY THE ENGINEER DESIGNED IT.
>> YEAH. YOU ARE RIGHT COMMISSIONER. THERE'S A LOT OF PROBLEMS THIS INTERLOCAL NEEDS TO BE UPDATED BECAUSE WHAT HAPPENS A LOT OF TIMES, THERE IS A SUBDIVISION NOW THAT WE WOULD NOT APPROVE AND DID NOT APPROVE AND THEN THE CITY ANNEXED IT AND APPROVED IT AND IT'S CAUSING ALL KINDS OF PROBLEMS IN THE COUNTY BECAUSE THE INTERLOCAL IS NOT IN GOOD SHAPE. I REALLY APPRECIATE THE SUGGESTION MADE ON THAT BECAUSE THAT INTERLOCAL HAD NOT BEEN LOOKED AT IN 21 YEARS, THAT'S ABSURD AND THE WORLD HAS CHANGED. I TOTALLY SUPPORT THAT MOTION, I APPRECIATE YOU TAKING THE LEAD. THANK YOU TO COMMISSIONER HERNANDEZ FOR PUTTING IT ON THE AGENDA WITH THE FEES. THIS IS A GOOD POSITIVE DISCUSSION. WE CAN MAKE A LOT OF PROGRESS. WENT TO GET THE CITY TO AGREE TO SIT DOWN WITH US AND TALK ABOUT IT. HOPEFULLY THEY WILL COMPLY.
[00:50:02]
>> WE NEED TO HAVE A MEETING BEFORE I GO TALK TO THE CITY SO LET'S HAVE A MEETING. YES, OKAY.
>> THE REASON I BROUGHT THIS UP WAS BECAUSE , HOMEOWNERS WERE CALLING US OR CALLING ME, THAT THEY WANTED THE STREETS OR THE ROADS FIXED. THE CITY HAD ALREADY APPROVED , THAT'S WHY THEY BUILT IT. BUT THE ROADS WERE NOT CONSTRUCTED TO THE COUNTY'S STANDARDS. AND THEN WE HAD TO GO BACK IN AND REDO IT SO IT WAS COSTING THE COUNTY MONEY THAT WE REALLY CANNOT AFFORD. WE NEED TO GET SOME OF OUR MONEY BACK.
>> WE HAVE A MOTION AND A SECOND. ALL THOSE IN FAVOR, SAY AYE. ANY OPPOSED, SAME SIGN. THE MOTION PASSES AND THANK YOU ALL FOR BEING HERE THIS MORNING. YES. MOVING BACK IN

ITEM NUMBER THREE, DISCUSS AND CONSIDER UPDATING THE CURRENT FEES CHARGED TO APPLICANTS FOR THE DUNE PREDICTION PERMIT FEES AND RELATED MATTERS. I THOUGHT THEY WERE HERE.>> THERE THEY ARE. HELLO. WE ARE ON UPDATING THE CURRENT FEES TO APPLICANTS FOR THE DUNE PROTECTION .
>> YES MA'AM JUDGE COMMISSIONERS COURT. THE LAST TIME THESE FEES WERE EVALUATED AND LOOKED AT WAS 14 YEARS AGO.
SO WHAT WE'RE TRYING TO DO IS COME TO YOU AND ASK YOU IF YOU LOOK AT THE PROPOSED FEE STRUCTURE VERSUS WHAT IT WAS BEFORE, WE HAVE TWO NEW FEE STRUCTURES WE WANT TO BE CONSIDERED. THAT IS NO DUNE PERMIT WHICH TAKES AS MUCH TIME AS OREGANO PERMIT, NEVER A FEE STRUCTURE FOR THAT AND VIOLATIONS WE ARE DEALING WITH THREE DUNE VIOLATIONS WHERE PEOPLE STARTED WORK WITHOUT ANY KIND OF PERMIT AT ALL AND THOSE TAKE INCREDIBLE WORK. THERE IS NO FEE STRUCTURE FOR THAT KIND OF WORK. SO IT'S JUST FEES WE NEED TO RECOVER THE COST OF PROCESSING THESE PERMITS AND NOTHING MORE. NOT TRYING TO MAKE ANY PROFIT. IF YOU NEED TIME TO DIGEST THIS WEEKEND TABLE AND BRING IT BACK BUT IT IS PRETTY STRAIGHTFORWARD.
>> I AM GOOD IF EVERYBODY ELSE IS. IF ANYONE NEEDS TIME THAT'S OKAY. I WOULD MAKE A MOTION TO PASS UNLESS EVERYBODY
NEEDS TIME. >> A MOTION AND A SECOND TO

BASICALLY NO DENTAL THIS TIME AROUND BECAUSE WE DID NOT HAVE ENOUGH FOR DENTAL. WE DO HAVE THE ICE, THE GLASSES , TO DO THE EXAMS AND FREE GLASSES AND THEN ANYTHING ELSE WILL BE MEDICAL, AND ALSO FOR THE ANIMALS , WE ARE DOING THE VACCINATIONS AND THE TAGS AND HOPEFULLY THE CHIPS FOR THE ANIMALS. AS WELL AS THE RABIES SHOTS. EVERYTHING IS FREE. SO, JUST COME IN, WALKING AND GET IT DONE. WE ARE DOING HUMANS AND ANIMALS.

THIS YEAR. STILL A GREAT DEAL FOR THE COMMUNITY. ITEM NUMBER 10. DISCUSS AND CONSIDER DISTRIBUTING THE REMAINING COUNTYWIDE AVAILABLE BALANCE OF $3,961,483 AND THE REMAINING COURT INDIVIDUAL BALANCES THAT TOTAL 416,000 OF THE AMERICAN RESCUE PLAN ACT ARPA FUNDS. WE HAVE A LIST IN YOUR BACKUP, TERESA DID A GREAT JOB OF POINTING OUT AVAILABLE FUNDS AND COMING TO THAT. TERESA AND GRANT WHO WORKS IN GRANTS OR WHOEVER HELPED ON THE PROJECT, THANK YOU VERY MUCH. WE ARE GETTING DOWN TO THE WIRE. IT IS COMING TO THE END AND WE WANT TO MAKE SURE WE UTILIZE THESE FUNDS.>> JUDGE COULD I JUMP IN A QUICK BEFORE WE START THE DISCUSSION? I WANT TO MAKE A MOTION TO ALLOCATE MY REMAINING PRECINCT 4 FUNDS TO THREE PROJECTS AS CONTINGENCY FUNDS.
LONDON DRAINAGE, PARKER POOLE AND BOB HALL PIER. I FEEL CERTAIN ONE OR ALL OF THOSE MIGHT NOT HAVE ENOUGH SO I WOULD LIKE TO ALLOCATE THAT TO 10 TO BE USED FOR ANY OF THOSE
PROJECTS AS CONTINGENCY. >> DO YOU WANT TO TALK, I THINK WE HAD A PLAN THAT BY NOVEMBER, THIS IS GREAT BUT BY NOVEMBER 13 OUR NEXT MEETING, THESE HAVE TO BE SET AND DEDICATED. I DON'T KNOW IF WE CAN LEAVE IT OPEN-ENDED.
>> IS NOT OPEN-ENDED I AM LEAVING IT TO THOSE THREE
HOWEVER NEEDED. >> IT HAS TO BE AN AMOUNT.
>> AMANDA IS ON THE LINE FROM GRAND FORKS AND JESSICA AND IT HAS TO BE COMPLETELY CONTRACTED.
>> I AM ALLOCATING TO THESE THREE PROJECTS THAT ARE GOING OUT FOR THE BID UNDER CONTRACT AND IT IS ALLOCATED TOWARD THOSE THREE PROJECTS. I DON'T KNOW HOW MUCH IS GOING TO BE NEEDED FOR EACH PROJECT, THAT IT WILL BE USED BECAUSE I KNOW ONE IS ALREADY OVER BUDGET. I KNOW THE OTHER TWO WE HAVE NO CONTINGENCY. FOR BOB HALL SO THAT IS ALLOCATING TO THREE SPECIFIC PROJECTS. I WAS IN UNDER THE UNDERSTANDING AS LONG AS YOU ALLOCATE TO SPECIFIC PROJECTS THAT TOOK CARE OF THE REQUIREMENT, THAT'S WHAT I'M DOING. ALLOCATING TO THOSE
PROJECTS. >> YES. I BELIEVE , WE ARE IN THE BUDGETING PROCESS HERE SO YOU ARE ALLOCATING FUNDS TO A SPECIFIC PROJECT YES. THE COMMITMENT FROM GRANT WORKS AND THE GRANTS DEPARTMENT FRIENDS IS WE DO CONTRACT WITH SOMEBODY BEFORE THE END OF THE YEAR AND THAT'S THE COMMITMENT OF
FUNDS. >> PARKER POOLE HAS ALREADY BEEN BID TO, THE DRAINAGE WILL BE DONE, BOB HALL HAS BEEN
SIGNED. >> THESE ARE JUST FOR EXISTING
PROJECTS. >> DO WE HAVE A CONTRACT ON
THOSE? >> BOB HALL SIGN, PARKER POOLE
AT THE NEXT MEETING. >> INTO THE MICROPHONE.
>> AS AN EXAMPLE WE ARE NEGOTIATING FOR THE PARKER POOLE PROJECT. WE HAVE COME DOWN ON THE AMOUNT BUT WE ARE
[01:05:01]
TRYING TO REDUCE MORE . THAT'S WHY COMMISSIONERS ARE UNSURE TO THE FINAL AMOUNT . WILL HAVE A COMPLETED PROJECT BUT THIS EXTRA FUNDING HELPS PUSH IT FURTHER.>> THE LONDON DRAINAGE , THE ENGINEERS ARE WORKING ON THAT AND THEY HAVE 60 OR 90 DAYS WHATEVER FROM THE TIME IN WHICH WE MADE THE AWARD TO BRING BACK ENGINEERING DESIGN TO GO OUT FOR BID. THESE ARE EXISTING PROJECTS ALREADY ALLOCATED. ONE OF WHICH CONTRACT SIGNED, ONE OF WHICH COMING SOON AND THE OTHER WILL BE DONE WELL BEFORE THE END OF THE YEAR.
>> DO YOU NEED TO ALLOCATE THIS WAY YET OR WAIT UNTIL THE BID COMES IN AND WHEN YOU AWARD PUT IT ON.
>> I WAS SUPPOSED ALLOCATE BY THE END OF MAY WHICH WAS WITH WE PASSED AS A COURT AND I'M ALREADY BEHIND ON THAT. THIS GETS MY ALLOCATED SO I CAN QUIT LOOKING AT THE FACT THAT I DID NOT DO WHAT I WAS SUPPOSED TO DO BECAUSE I THOUGHT I WOULD HAVE OVERAGES BY THEN AND I STILL DON'T AND IT MIGHT BE AUGUST OR SEPTEMBER BEFORE THE END OF THE YEAR BUT I WANT TO ALLOCATE SO WE KNOW WE HAVE THE MONIES AVAILABLE. SO WHEN WE COME BACK I HAVE ALREADY ALLOCATED AND I DON'T NEED TO DO IT AGAIN. I'M GETTING THIS TO THREE SPECIFIC PROJECTS
UNDER CONTRACT. >> FIRST COME FIRST SERVE.
WHOEVER COMES FIRST GETS IT. OKAY.
>> WOULD THIS BE, I DON'T WANT TO OVERSTEP BUT WOULD THIS BE INTENT TO ALLOCATE WHEN THE FIGURES ARE KNOWN?
>> I AM ALLOCATING THIS MONEY TO THOSE PROJECTS.
>> YOU ALREADY HAVE THE MONEY TO ALLOCATE?
>> AFTER HUNDRED 10,000 LEFT SUPPOSED TO BE ALLOCATED BY THE END OF MAY BUT I DID NOT HAVE NUMBERS TO DO IT. I STILL DON'T HAVE NUMBERS FROM WHICH TO DO IT BUT I NEED TO DO THIS BECAUSE I WAS SUPPOSED TO HAVE ALREADY SO I'M ALLOCATING IT TO THREE SPECIFIC PROJECTS THAT I KNOW WILL BE SIGNED UP BEFORE
THE END OF THE YEAR. >> OKAY VERY GOOD.
>> TAKE THAT OFF THE LIST TERESA. THAT'S WHAT I'M DOING
THIS FOR. >> THAT IS A MOTION?
>> FOR LONDON DRAINAGE, PARKER POOLE, BOB HALL PIER.
>> I WILL SECOND THAT MOTION, ALL THOSE IN FAVOR, SAY AYE.
>> I WILL HAVE TO MANAGE THAT. I DON'T KNOW UNTIL.
>> THAT KIND OF THE PLANT AND WHAT I WAS GETTING TO. I WAS HOPING TO DO THE FIRST PART FIRST AND THEN PERSONALS, BUT AT THE END OF THE NOVEMBER MEETING , ANY PROJECTS THAT ARE NOT FUNDED , ARE NOT CONTRACTED OR COMING FORWARD AND THE LIKELIHOOD WE HAVE TO MAKE SOME DECISIONS MOVING FORWARD ON THAT UNALLOCATED MONEY. ANYTHING LEFT OVER IN THE BALANCES. WE WANTED TO HAVE THESE DONE BY MAY AND NOW WE ARE IN JULY AND WE NEED TO BE MOVING THESE PROJECTS FORWARD , WE DON'T WANT TO LOSE THAT. MY QUESTION TO MANY OF THEM AND WHY WE DID THE FIRST PART OF THE PAGE IN ALLOCATING THEM TO NUECES COUNTY OBLIGATIONS, NUECES COUNTY THINKS THIS WILL HELP IN THE BUDGET IN THE NEXT YEAR. THINGS THAT WERE TAKEN CARE OF ARE EASY NOT DEALING WITH OUTSIDE PEOPLE ATTORNEYS NOT DEALING WITH OUTSIDE ENTITIES THESE ARE BASICALLY NUECES COUNTY COUNTY PROPERTIES AND RESPONSIBLE IS. THAT AND MOVING FORWARD INTO THIS WAS THE REASON FOR THE LIST OF PROJECTS AND WE SEND EMAILS TO EVERYONE TO TURN IN THE PROJECT. YOU WANTED TO DO THE PROJECT WAS ON OASIS COUNTY PROPERTIES. THIS IS THE LIST WE GOT AND IF WE GO DOWN THE LIST FROM THE WALKING TRAIL I MEAN THE, WE ARE ON THE WRONG PAGE.
IF YOU GO DOWN THE MEDICAL EXAMINER THE GEL ROOF THE AUDIO AND VIDEO UPDATE AND COURTROOM FINALLY, THE COURTHOUSE SECURITY FOR UPSTAIRS , THE EMERGENCY OPERATIONS CENTER UPGRADE PARKS CAPITAL EQUIPMENT, FOUND OUT WE NEEDED SOME EQUIPMENT THAT WE DO NOT HAVE AVAILABLE IT WAS A GREAT USAGE. CALL THEIR OWN BUILDING RISK, SUNRISE POND GAZEBO AND PLAYED ON, AMISTAD PARK, BISHOP COMMUNITY CENTER ROOF REPLACEMENT, BISHOP COMMUNITY CENTER, ADA RAMPS HILLTOP COMMUNITY CENTER, ROOF UPGRADE INTERIORS CEILING, HAZEL BAZEMORE PARK EQUIPMENT DRISCOLL COMMUNITY CENTER
[01:10:02]
EXTERIOR SITE AND PREVENTS DRISCOLL COMMUNITY CENTER PLAYGROUND EQUIPMENT. THESE ALL PROJECTS THAT WERE TURNED IN BY EACH OF YOU AND US LISTING ESPECIALLY THE EQUIPMENT AND THE THINGS WE NEED HERE LOCALLY TOTALING TO THE 3,000,659. SO WE WERE WANTING TO GET A MOTION TO IMPROVE THESE THINGS WITH OUR MONEY AND THEN COME BACK IN NOVEMBER AND ANYTHING THAT HAS NOT MOVED FORWARD DOES NOT HAVE A CONTRACT IS NOT WORKING TOWARD WHERE WE SO WE HAVE A SIGNED CONTRACT BEFORE DECEMBER, THEN WE HAVE TO REPURCHASE CLICK ITEMS, PURCHASE EQUIPMENT, SOMETHING FOR THE COURTHOUSE, SOMETHING WE CAN DO BEFORE WE LET THE MONEY GO BECAUSE IT HAS TO BEDONE BY DECEMBER 26. >> JUDGE, THIS WAS A GREAT WAY OF DOING THIS. I APPRECIATE YOU TAKING THE LEAD ON THIS. 302 REMAINING, MAYBE ALLOCATE THAT AS CONTINGENCY FOR ALL THE PROJECTS TO BE DONE BECAUSE I'M AFRAID LIKE EVERYTHING
ELSE. >> WE PLANNED ON LEAVING IT UNTIL THE NOVEMBER MEETING ANYWAY TO SEE WHAT IS NECESSARY. AND ANY OTHER PROJECTS THAT FALL DURING THAT
TIME. >> IF YOU WANT TO MAKE THE
MOTION. >> I WOULD MAKE THE MOTION TO PASS WITH ALL OF THESE. WE SENT IT TO GRANT WORKS AS WELL.
>> WE DID A FULL VOTE. >> WE VOTED.
>> EVERYBODY VOTED. IT WAS UNANIMOUS. NOW YOU ASKED AFTER
WE VOTED. YES. >> I'M PRETTY SURE WE DID.
>> MY QUESTION. WE HAVE MONIES FOR SOME AREAS THAT MIGHT HELP THE COUNTY INSTEAD OF CERTAIN POSITIONS WITH SOME OF THE ARPA
>> ELIMINATING PAYROLL . >> KEEPING CERTAIN POSITIONS.
>> WE COULD LOOK AT IT IN NOVEMBER.
>> IN NOVEMBER . >> I THINK WE WILL END UP USING
IT ALL. >> TRUTHFULLY WITH 300 AND EVERYTHING COMING OVER I WOULD BE SURPRISED. THAT IS SOMETHING
WE CAN DISCUSS. >> I AM USING MY OWN FUNDS FOR
SOME PROJECTS. >> I MEAN, YEAH. SHE IS SAYING WAIT UNTIL NOVEMBER TO SEE WHERE WE ARE.
>> YES, RIGHT NOW YOUR FUNDS ARE 55,000 AND THAT WON'T FUND
MANY POSITIONS. >> SO. 55,000 IS ON THE LIST.
>> REMEMBER WE MET. >> WE DID NOT TAKE IT BACK. WE LEFT IT INSTEAD OF TRANSFERRING WHICH IS WHY WE DID THE LIST OF PRIORITIES AND THE LIST OF WHAT WE WANTED TO DO. WHAT HE IS TALKING ABOUT TO CLARIFY IS WHEN WE WERE WORRIED ABOUT THE JAIL ROOF, COMMISSIONER GONZALEZ MYSELF AND COMMISSIONER MAREZ TRANSFERRED SOME TO MAKE OF THE DIFFERENT TO GET ALL THE ROOF INTO ONE FUNDING SOURCE WITH THIS. AND, WE TRADED , EDWARD , FOR HIM TO USE ON PARKS . I DON'T HAVE THE AMOUNT IN FRONT OF ME, BUT THERE WAS 800 SOMETHING THOUSAND MINE, 300,000 FROM COMMISSIONER GONZALEZ AND 150 ALMOST 200 OF COMMISSIONER MAREZ FUNDS. THAT BEING SAID, THAT'S WHY IN THE LIST OF THINGS WHEN I TOOK IT INTO CONSIDERATION, OUR PROJECTS, I ASKED THESE GUYS FIRST BECAUSE IT INSTEAD OF MOVING MONEY BACK AND GIVING 300 AND ME MY 800,000, THESE ARE COUNTYWIDE PROJECTS AND BENEFITS. SO WE DID EVERYTHING FOR THE MEDICAL EXAMINER'S OFFICE THAT THEY ASKED FOR WHICH WAS IN HIS. WE DID ALL THE ROOFS AND THE PARKS, THE THINGS YOU ASKED FOR THAT WERE A PRIORITY ON THE LIST. WE LISTED THEM IN ORDER.
>> THAT IS THE LIST YOU HAVE RIGHT?
>> IT IS ON THE BIG LIST. INSTEAD OF GETTING MONEY BACK
YOU GOT THIS. >> IF I USE MY OWN MONEY I CAN HAVE THAT MONEY OR SOMETHING ELSE? THE ONE I WAS GOING TO USE ON THE ROOF. I KNOW WHERE IT SAT. IF I USE SOME OF THE
[01:15:07]
FUNDS I HAVE FROM MY CO FUNDS FOR THE ROOF AND ALL THAT BECAUSE I WANT TO USE MY FUNDS. I STILL HAVE THE ARPA FUNDS SO INSTEAD OF PUTTING THEM ON THE ROOF.>> EDWARD HAS ALREADY SPENT THAT MONEY AND HAS PROJECTS
DEDICATED. >> I BELIEVE WHAT COMMISSIONER IS ASKING, HE HAS HIS OWN REVENUE FUNDS RECEIVED THROUGH THE COUNTY. SO HE IS USING THAT FUNDING TO PAY FOR SOME OF THE OTHER ITEMS. SO WITH FUNDING FOR OPERA DOES NOT COME THROUGH FOR EXAMPLE, WE'RE TRYING TO DO A JOB ORDER CONTRACT WE FOUND THAT WE CAN'T DO THAT HE WILL USE HIS FUNDS THAT HE RECEIVED NOT ARPA TO DO THOSE PROJECTS AND THEN SHIFT THESE FUNDS ALLOCATED TO ANOTHER PROJECT.
>> IF YOU DO, THE PROBLEM WITH THIS IS MOVING FORWARD THIS LATE IN THE GAME. THESE PROJECTS LISTED HAVE TO GO OUT FOR THE BID, THEY HAVE TO BE SENT. WHAT IS THE TIMEFRAME MICHAEL? WE ARE LOOKING AT A MONTH AT THE EARLIEST IF THESE WERE READY TO GO WITH WORK ORDERS TOMORROW.
>> I'VE BEEN TELLING THE COURT FOR SOME MONTHS AUGUST WAS FAST APPROACHING AND I NEED SPECS AND PLANS FOR THESE ITEMS AND PERMISSION TO BID BY AROUND MID AUGUST SO I HAD 60 TO 90 DAYS TO COMPLETE THOSE AND GET THEM CONTRACTED BY NOVEMBER 20. AND I HAVE A CUSHION OF DECEMBER 11. SO, IF YOUR TURN TO START NEW PRODUCTS NOW THAT'S FINE AS LONG AS WE GET THE DRAWINGS
INTO MY OFFICE BY AUGUST. >> I THINK YOU ARE ASKING MORE ABOUT EMPLOYEES. I DON'T THINK THAT'S NOT UNDER CONTRACT.
EVERYTHING IS TO BE UNDER CONTRACT BY THE END OF 24. WE DO HAVE A CONTRACT WITH EMPLOYEES SO I DON'T KNOW THAT WOULD QUALIFY. I DON'T THINK WE CAN DO ANYMORE SALARIES.
>> TO CLARIFY. THESE PROJECTS ARE EXISTING PROJECTS AND THAT SOME IS LIKE $1 MILLION WE WERE ALLOCATED FROM ARPA USING THE CEOS THAT WE TOOK FROM THE PARKS DEPARTMENT, THEY GET IT BACK IN ADDITIONAL PROJECTS, BUT THEY STILL HAVE THE CO FUNDS WE ALLOCATED TO THEM FOR THE SAME PROJECT. SO THERE IS NOT ANY ADDITIONAL FUNDS THAT YOU HAVE REMAINING IN YOUR OWN SPECIFIC PRECINCT BECAUSE EVERYBODY HAD 4 MILLION AND THE BALANCE IS REMAINING ARE THE BALANCES WE SHOW ON HERE. YOURS IS 55,000 AND THEN WE DID THE GRANTS WORK AMENDMENT. SO IT IS
DECREASING. >> WHEN I GAVE THE MONEY IT WAS CO MONEY NOT ARPA FUNDS. I EXPECTED TO GET MY MONEY BACK.
I DON'T CARE ABOUT THE ARPA FUNDS. WE DID NOT USE IT I WANTED MY MONEY BACK TO USE IT BECAUSE IT WAS MINE TO BEGIN WITH. WE WERE KIND ENOUGH TO USE IT FOR SOMEBODY ELSE.
>> IN ORDER TO NOT DO THAT EDWARD HAS CONTRACTS AND WE HAVE PURCHASE ORDERS USING THE CEOS.
>> HE HAS ALREADY ALLOCATED IT , THAT'S THE REASON WE HAD TO
DO IT THIS WAY. >> NOT MY PARK.
>> WE GIVE HIM THE TWO. HE SPENT OURS FIRST. REMEMBER WHEN WE CAME TO COURT AND I ASKED HIM TO STOP AND SPEND THE OTHER FIRST? THAT'S WHAT I WAS TALKING ABOUT, WHAT IT WAS ALREADY SPENT SO I DID 800,000 AND I DON'T GET MINE BACK EITHER. IT'S DONE, BUT IT'S ON COUNTY PROJECTS AT LEAST. ON COUNTY AND THE OTHER ONE HERE IN PRECINCT 2, THE 340 STILL YOU GET ADDITIONAL MONEY ON TOP OF YOUR 4 MILLION THAT YOU HAD.
>> I'M NOT GETTING MORE MONEY. I'M GETTING WHATEVER I USED
FOR MY CEOS. >> YOU'RE GETTING ADDITIONAL
PROJECTS IN YOUR AREA. >> USING MY MONEY JUDGE.
>> AND I AM TOO YES. >> WE DID IT AGAIN TO OPERATE TO COOPERATE , WHEN THIS STARTS MOVING AROUND NOW SHOULD HAVE
[01:20:05]
GONE BACK WHERE WE CAME FROM RIGHT? WHEN I TALK ABOUT THE OTHER I THOUGHT THAT WAS THE DEAL THAT IT WOULD COME BACK TO BE ABLE TO USE IT. WHEN I MET WITH TERESA, WHEN YOU SEE IT AS PART OF MAJOR SPENDING WE THOUGHT IT WOULD BE SEPARATE.EVERYTHING IS HERE IT COMES TO THE BOTTOM SO YOU WILL BE ABLE TO TAKE YOURS FROM WHAT WAS LEFT OVER. THOSE WERE NOT ON THE MAIN SPENDINGS TO BEGIN WITH.
>> EVEN IF YOU TAKE THESE PROJECTS OFF WITH 240,000, IF YOU WANT TO CANCEL THOSE PROJECTS AND TAKE HUNDRED 40,000 IN ARPA MONEY I AM NOT SURE WITH THE EMPLOYEES, CAN WE GET IT DONE IF HE WANTS TO USE IT ON SEVEN DIFFERENT?
>> HOLD ON. YOU NEED TO ANSWER WHAT HE WAS ASKING YOU. I THOUGHT THIS MONEY WAS SPENT. ON EDWARDS PROJECTS.
>> THE PARKS DEPARTMENT HAD 6 MILLION TO SPEND FOR THE PARKS.
WHAT WE DID, WE REMOVED $2 MILLION AND SUBSTITUTED CO FUNDS TO KEEP THE GEL PROJECT WITHIN THE ARPA ALLOCATION. SO THE GEL PROJECT CAME IN UNDERFUNDED AT 4.2 . SO THE BALANCE , SO THERE IS 2.3 MILLION REMAINING FROM THAT PROJECT. IT IS PART OF THE TOTAL ALLOCATION AVAILABLE COUNTYWIDE FUNDS. COMMISSIONER, WHAT YOU ARE SAYING IS YOURSELF, THE JUDGE AND COMMISSIONER MAREZ USED CO FUNDS TO MAKE UP THE DIFFERENCE. SO IF YOU ARE SAYING YOU WANT YOUR ARPA FUNDS BACK, THAT WAS THE ORIGINAL THOUGHT TO DO IT, BUT BECAUSE YOU HAVE ALL THE FUNDS AVAILABLE YOU'RE JUST REPLACING THE FUNDS FOR THE PARKS OUT OF YOUR ARPA MONIES. THESE ARE ADDITIONAL.
>> MY CO FUNDS ARE MORE FLEXIBLE THAN ARPA FUNDS.
>> THAT'S CORRECT, BUT THERE ALLOCATED TO WHATEVER PROJECT
EDWARD HAS GOING ON. >> THEY WERE MY PROJECTS.
>> THERE WERE PROJECTS ALLOCATED TO THE PARKS . THERE WERE STILL ARPA, BUT USING CO FUNDS BECAUSE WE MOVED THE
FUNDS AROUND. >> ANYTHING TAKEN AWAY BRING IT
BACK THAT WAS MY THING. >> IN THAT CASE.
>> EXCEPT FOR US. MY CO FUNDS NOT THE ARPA FUNDS.
>> ASK EDWARD, HE IS SAYING YES.
>> WE TOOK THE $2 MILLION AND PURCHASED LIGHTING FOR
>> IN THE MICROPHONE PLEASE. >> PULL IT UP.
>> THE CURRENT PROJECTS, THE BIG PROJECTS WE HAVE THE BIG LIGHTING PROJECTS APPROVED BY THE COURT WHERE WE ARE PUSHING LIGHTS, THEY DELIVERED THE LIGHTS WE SHOULD HAVE THE STANDS UP BY THE END OF AUGUST IN STANDS IN BY THE END OF SEPTEMBER. THOSE PROJECTS ARE THE ONES WE ARE FUNDING WITH THE $2 MILLION. PART OF THE $2 MILLION, IF YOU REMEMBER, WE LOST 700,000 + ANOTHER 200,000 OF THOSE CO
MONIES THAT I ORIGINALLY HAD. >> WHEN THE JUDGE TOLD ME TO MILLION THERE WAS NOT TO MILLION BECAUSE YOU ALREADY
SPENT IT? >> RECENTLY BECAUSE I'M WORKING ON THE PROJECTS AT THE SAME TIME.
>> YOU KNEW YOU SHOULD HAVE HELD OFF ON IT.
>> THIS WAS DONE BEFORE THE DEAL.
>> THAT'S WHAT I TRIED TO STOP AND YOU LET THEM GO FORWARD NEXT TIME. A COUPLE OF MEETINGS AGO WHEN I SAID TO STOP ANNUAL
SAID WE GAVE IT. >> TO ME I WAS KIND ENOUGH TO SAY YOU CAN HAVE SOME OF MY MONEY FOR ONE THING. YOU DO NOT USE IT FOR THE ONE THING THAT MONEY SHOULD COME BACK TO ME.
THAT'S THE BOTTOM LINE. IF IT WAS ARPA FUNDS I DON'T CARE, YOU CAN HAVE THE ARPA FUNDS. BUT THE CO MONEY BELONGS TO ME AND I WANT TO USE IT FOR ONE PURPOSE. SOMEONE SHOULD'VE COME TO ME AFTER THAT AND SAID WE HAVE THIS MONEY LEFT OVER BUT NOBODY DID. SO I NEED THE FUNDS BACK BECAUSE I WANT TO
[01:25:06]
USE THEM. >> THE THING WE FOCUSED ON.
YOUR PRIORITY. >> COMMISSIONER HOLD ON. WE BROUGHT THIS UP A MEETING OR TWO AGO THE JUDGE TRIED TO STOP THIS, YOU SAID NO GO BACK AND LOOK AT THE TAPE. YOU ABSOLUTELY DID AND HE EXPLAINED EVERYTHING.
>> EXPLAINED EVERYTHING. HOLD ON HE SAID WE CAN'T STOP IT, WE SAID OKAY. IF THIS IS WHAT YOU WANT TO DO AND YOU LEAD THE CHARGE ON THAT MEETING EVEN THOUGH THE JUDGE TO TRY TO STOP AND WE WENT ALONG WITH IT BECAUSE YOU WANTED TO DO IT SO GO BACK AND WATCH THE VIDEO, EDWARD CAME AND EXPLAINED EXACTLY WHERE YOUR MONEY WAS. HE Tâ– OLD US.
>> THE JUDGE HAD COME TO ME AND TOLD ME YOU HAD MONEY COMING
BACK FROM ARPA. >> I SAID WE DID NOT USE THAT, THAT'S THE REASON I WENT TO YOU ON THE PRIORITY LIST BECAUSE YOU CONTRIBUTED. YOU GOT TWO THINGS. YOUR MAIN THING WAS THE GEL ROOF AND YOUR LIST OF 340. SO YOU HAD 940 ON HERE
THAT WAS YOUR PRIORITY. >> THAT IS A COUNTYWIDE
PROJECT. >> YES BUT THIS IS ALL THE
MONEY WE HAVE. >> I COULD HAVE USED IT FOR SOMETHING ELSE. YOU KNOW THIS IS REALLY AND I HATE THIS WITH ARPA FUNDS, IT'S JUST GOT TO BE A REAL MESS AND WE MOVE AROUND TOO MANY MONIES WITHOUT CLARIFYING THINGS FIRST. WE MOVE AROUND AND THEN TALK ABOUT IT. WHEN YOU STOP MOVING AROUND
AND TALK ABOUT IT FIRST. >> WE HAVE TO DO A LOT OF THESE THINGS IN A HURRY. YOU WANTED TO MENTION SOMETHING ABOUT THE
PAYMENTS TO EMPLOYEES? >> YES. WE CAN GET A POSITION AND FILL IT IN AND 2026, BUT IT HAS TO BE FILLED BY 2024.
DECEMBER. YOU CANNOT JUST HAVE THE POSITION THIS IS HOW MUCH MONEY. IT HAS TO BE FILLED, SOMEBODY HAS TO BE IN THE
POSITION. >> SO WHATEVER IS EARMARKED IN MY FUNDS RIGHT NOW ACCORDING TO THAT LIST THAT YOU SAY I SPEND
ON SHOULD I PUT A HOLD ON THEM? >> YOU WANT TO HOLD YOUR COMMISSIONER PRECINCT 2 DO NOT MOVE FORWARD FOR ARPA MONEY.
YES. >> THE AMENDMENT WOULD BE
EVERYTHING BUT? >> SO WITH THE FUNDS GO BACK TO COMMISSIONER GONZALEZ ARPA OKAY.
>> OKAY THEN YOU MADE THE MOTION JUDGE?
>> I MADE THE MOTION TO PASS. >> TO COMMENT I AGREE WITH WHAT COMMISSIONER GONZALEZ IS SAYING. I KNOW WE MADE EVERY EFFORT WE CAN TO SUPPORT THE COUNTY. MY FRUSTRATION IS CO'S ARE A LOT EASIER. I KIND OF HAD THAT CONVERSATION ALL BY MYSELF FOR THE LAST FEW DAYS COMING TO THE TERMS. IT DID GOOD WE NEEDED TO DO IT. IN RETROSPECT SHOULD HAVE NEVER DONE IT BECAUSE WE NEED FLEXIBILITY IN SOME PROJECTS AND NOW WE ARE HANDCUFFED ARPA AND A TIMEFRAME AND THAT KILLS ME BECAUSE THERE ARE OTHER PROJECTS I WOULD LOVE TO FUND WITH THE MONEY KNOWING , I AM FRUSTRATED BY THE PROCESS. LIKE I SAID, I HAVE
COME TO TERMS WITH IT. >> IF YOU LOOK BACK IN THE VIDEO WHEN WE TRANSFERRED MONEY TO THE ROOF PROJECT. SORRY EDWARD I WILL TELL YOU UNDER THE BUS ON THIS ONE. WE INSTRUCTED EDWARD TO USE ARPA MONEY FIRST AND WE WERE HOPING TO GET THE ROOF PROJECT IN. WE THOUGHT IT WOULD BE MORE COSTLY BUT I SAID WITH ARPA MONEY AND CONSTRAINTS AND CONTRACTS TO SCHEDULE ALL OF THAT FIRST YOU WILL HAVE A LOT OF PROJECTS I KNOW HE OVERSEES A LOT OF COMMISSIONERS PROJECTS , AS WELL. I THOUGHT THE FOCUS WAS ON THAT NOT THE CO'S BECAUSE OF ITS ABILITY THERE WAS NO TIME CONSTRAINT ON THE CEOS.
ONCE WE LEARNED OF THIS AND THE BID CAME IN THE PROJECTS HAD ALREADY BEEN BROUGHT TO COURT AND APPROVED, ALREADY DESIGNATED SO THAT WAS THE REASON A COUPLE OF MEETINGS AGO WHEN I ASKED TO STOP THAT ONE AND WE MOVED AHEAD. THERE HAS BEEN A LOT OF MISSED MEDICATION AND MISUNDERSTANDING IN THIS.
THESE ARE ALL GOOD THINGS FOR THE COUNTY. THESE ARE COUNTYWIDE BENEFITS. I THINK AT THE END OF THE DAY IT'S GOOD
[01:30:04]
FOR THE COUNTY, AT THE END OF THE DAY WITH THE TIME CONSTRAINTS WE HAVE MOVING FORWARD, WE CUT OUR LOSSES AND SAY WE WISH WE WOULD'VE KNOWN BETTER, THE COMMUNICATION WOULD HAVE BEEN BETTER MAYBE MORE PEOPLE WERE INVOLVED, BUT WHAT'S DONE IS DONE AND CANNOT BE UNDONE. IF YOU WANT TO OMIT YOURS AND I WILL AMEND MY MOTION TO PASS ALL OF THE LISTED ADDITIONAL COUNTY PROJECTS EXCLUDING THE ITEMS THE 340,000 ON COMMISSIONER PRECINCT 2.>> DO YOU WANT TO DO OPPOSITE WHERE WE MAKE A MOTION TO REMOVE THE 340 AND REALLOCATE TO PRECINCT 2 FIRST?

WE HAD BROUGHT THIS TO THE COURT BEFORE AND SAID WE WOULD BRING IT BACK TO THE FIRST WE WOULD BRING IT BACK TO 1 AUGUST BUDGET MEETING. I AM REMINDED WE TABLED THIS TO COME BACK IT SHOULD NOT HAVE BEEN ON THE AGENDA. NUMBER 14. DISCUSS AND CONSIDER UPDATING THE INVESTMENT COMMITTEE POLICY TO REMOVE THE FORMER EMPLOYEE HERNANDEZ AND REPLACE WITH COMMISSIONERS COURT REPRESENTATIVE AS A VOTING MEMBER OF THE COMMITTEE. AND ONE OF THE OTHER THINGS TO BE WITH THIS IS CONSIDER HAVING THE COUNTY JUDGE AND[01:35:01]
COMMISSIONERS COURT STAFF ALTERNATE . WE HAVE NOT HAD MEETINGS AND IT WAS OUR UNDERSTANDING WE DON'T HAVE ANYONE TAKING MINUTES OR ANYTHING. WE THOUGHT IT WOULD BE PRUDENT FOR THE COMMISSIONERS COURT STAFF AND COUNTY JUDGE OFFICE STAFF TO ALTERNATE TAKING MEETINGS FORTHIS MEETINGS. >> YOU HAVE NINE MEMBERS.
CAN'T SOMEBODY TAKE MINUTES? >> CAN WE MAKE IT A DESIGNATED POSITION SO WE DON'T NAME A PERSON ALL THE TIME?
>> ON THE COMMISSIONERS COURT REPRESENTATIVE ABSOLUTELY. YES, YES. SO I WOULD MAKE THE MOTION TO APPROVE THE COMMISSIONERS COURT REPRESENTATIVE AS A VOTING MEMBER OF THE INVESTMENT

PULL FROM THE MEMBERS, WHOEVER WE CAN TO TAKE THE MINUTES.ITEM NUMBER 15. DISCUSS AND CONSIDER UPDATING AND ADOPTING COMMISSIONERS COURT POLICIES AND ALL RELATED MATTERS. I HAD TWO POINTS OF CLARIFICATION BEFORE WE DO THAT. ON PAGE 11, COMMISSIONERS COURT POLICY. THIS HAS, I THINK IT WAS A TYPO. IT SAYS THE BOARD APPOINTEES THERE SHALL BE NO BORDER COMMISSION APPOINTMENT MADE BY THE COMMISSIONERS COURT 60 DAYS PRIOR TO ELECTION BUT THE LAST SENTENCE SAYS THAT THEY COME UP IN SEPTEMBER. I THINK THAT SHOULD'VE BEEN AUGUST INSTEAD OF SEPTEMBER SO I WOULD LIKE TO CORRECT , A CORRECTION MADE TO THE POLICY 60 DAYS PRIOR FROM ELECTION IS AUGUST, NOT SEPTEMBER. I WILL MAKE THE MOTION TO DO THAT.
>> SECOND. >> MOTION AND SECOND FOR CLARIFICATION ON THE DATE ALL OF THOSE IN FAVOR SAY AYE. ANY OPPOSED, SAME SIGN. THE MOTION PASSES. AND THEN ON PAGE 10 DID IT GET CORRECTED? I WAS TOLD IT MAY BE GOT CORRECTED, THE WORDING. 10 C YOUR PROPOSED PROJECT IS PRECINCT AND ANOTHER COMMISSIONER ASSIGNED TO OVERSEE THE PROJECT IT SHOULD BE IF THE PROPOSED PROJECT IS .
>> I THINK IT SAID COUNTY BEFORE.
>> THE WORDING GOT CORRECTED. >> THAT'S HOW YOU WANT IT?
>> YES. IT WAS ALREADY CORRECTED. MY FIRST DRAFT DID NOT HAVE CORRECTED. PAGE 10 , C. SECTION C AND YOU MAY HAVE THE CORRECTED WORDING ALREADY. IF THE PROPOSED PROJECT IS A PRECINCT PROJECT AND ANOTHER COMMISSIONER IS ASSIGNED TO OVERSEE BY THE COMMISSIONERS COURT EXPENSES SHOULD BE COVERED THE COUNTY FUNDS AND/OR ANOTHER FUNDING SOURCE BECAUSE WE DON'T DECIDE IF ANYTHING COMES OUT OF THE GENERAL FUND WITHOUT BEING APPROVED BY ALL OF US. THOSE WERE MY TWO CORRECTIONS OR CLARIFICATIONS. DOES ANYONE HAVE ANY OTHERS? IT WAS ALREADY FIXED. I DO NOT REALIZE THEY CORRECTED THAT ONE. ARE THERE ANY OTHER CORRECTIONS OR CLARIFICATIONS? OTHERWISE I WILL MAKE THE MOTION TO PASS THE , WE ALREADY DID. WE PASSED THE CLARIFICATION ALREADY NUECES COUNTY POLICY SO I DO WE NEED TO DO ANYTHING ELSE?
>> AS LONG AS THE COURT IS HAPPY WITH THAT, THEN, AND YOU VOTED ON PAGE 11 ALREADY. SO WE ARE GOOD? WE WILL CIRCULATE THE
CORRECTIONS. >> I REMEMBER THIS WAY BACK THEN WHEN WE DISCUSSED THIS MESS. I KNOW IT WENT AWAY AND JUDGE YOU SAID WE WILL TRY ONE TIME AND IF IT DON'T WORK WE WILL LOOK AT IT AGAIN, IT DID NOT WORK GOOD. I DON'T FEEL LIKE SOMEBODY IS TELLING ME HOW TO VOTE. THE PROCESS. THAT'S
THE SAME PAGE. >> IN THE POLICY IT'S ANOTHER
[01:40:01]
QUESTION, A QUESTION HE HAS, NOT THE DATES. WHAT PAGE IS ITON? YOU'RE TALKING ABOUT? >> PAGE 11. PAGE 12.
>> WANT ME TO BRING IT BACK WHEN HE COMES BACK SINCE HE IS THE ONE WHO STARTED THAT OR DO YOU WANT ME TO TALK MORE? I KNOW IT WAS VOTED ON AND APPROVED AND WE TALKED ABOUT WE CAN SEE HOW IT GOES AND WE CAN BRING IT BACK. IF YOU ARE ASKING TO BRING IT BACK AND NOT APPROVE THE PROCESS, IS THAT
YOUR MOTION? TO CHANGE BACK? >> EVEN AT ONE TIME ON 1115 COMMISSIONER HERNANDEZ SUBMITTED DISCUSS AND CONSIDER PREVIOUS COMMISSIONERS COURT NOMINATION TO THE VOTING PROCESS , THE WAY WE HAD BEFORE. AND WE SAID LET'S TRY ONE TIME AND SEE WHAT HAPPENS.
>> UNDERSTAND WE SAID WE WOULD TRY AND SAVE IT COMES BACK, BUT I ALSO UNDERSTAND WITH THE PROCESS IT GIVE US ALL, TO ME IT GAVE US MORE OF A VOTE THAN JUST A COUPLE PEOPLE DECIDING.
IT GIVE US ALL A VOICE. >> WE WILL DECIDE ANYWAY, BUT I'M SAYING IT IS SIMPLE. I STILL DON'T LIKE THE PROCESS OF WHERE WE SAY, WELL, YOU KNOW THERE ARE THREE PEOPLE ON THE BOARD, BUT ONE OF THOSE THREE PEOPLE YOU CAN VOTE FOR SOME DETAILS WHY SHOULD I VOTE FOR SOMEBODY ELSE SO NOW I'M TOLD HOW TO VOTE. AND IF I WANT TO VOTE FOR ONE OF THOSE THREE MINUTES AGO NEXT TO ONE OF THOSE THREE. WEATHER GIVES THEM TO OR NOT IT IS NOT MAKE ANY DIFFERENCE. WHY HAVE FIVE WHEN WE DON'T NEED FIVE? I THINK THE PROCESS , THREE VOTES IS THREE VOTES. NO DOUBT ABOUT IT. PEOPLE KNOW THE PROCESS IS THREE VOTES. THEY COME HERE AND THEY CAN TALK. AS FAR AS , I GOT A LOT OF FEEDBACK WITH A LOT OF NEGATIVE WITH THIS GAME WE ARE PLAYING AND A LOT OF OTHER STUFF. I THINK IT'S TIME, I THINK WE SHOULD GO BACK TO THE NORMAL , YOU HAVE FOUR APPLICANTS THEN LOOK AT ALL FOUR , LET THEM SPEAK AND THEN YOU DECIDE LIKE WE HAVE THE LAST 16 YEARS. NEVER CREATED A PROBLEM. BUT YOU KNOW THAT'S MY OPINION ON THAT. WHEN PEOPLE APPLY THEY KNOW THAT TO CONVINCE THREE PEOPLE. THAT'S WHAT IT'S ALL ABOUT. HOWEVER YOU LOOK AT IT.
>> IN THE REALLY HIGH-PROFILE ONES, I THINK HAVING A PROCESS
HELPS . >> THEY ARE ALL HIGH-PROFILE TO
ME. >> I ALSO THINK HAVING A PROCESS OUTLINED LIKE THIS, IT IS PUBLIC, PEOPLE CAN SEE IT.
IT GIVES MORE OPENNESS ABOUT IT INSTEAD OF DECISIONS BEING MADE IN BACK ROOMS. IT KEEPS THE PROCESS CLEAR.
>> WE ARE HERE IN THE FRONT IN OPEN COURT.
>> WE WORKED ON THIS THING FOR MONTHS. YOU DID TOO. I TALKED TO YOU ABOUT IT. YOU VOTED FOR IT WITH ALL DUE RESPECT. OKAY BRING ANOTHER PROPOSAL OTHER THAN GOING BACK TO WHERE WE WERE WHICH WAS WHO CAN MAKE THE FASTEST MOTION. NO INTERVIEWS.
I'M SEEING THE PROCESS WAS NOT OPEN. I GOT THE OPPOSITE FEEDBACK THAT IT WAS THE MOST OPEN PROCESS ANYBODY HAD SEEN.
IF IT NEEDS TO BE TWEAKED I AM OPEN FOR SUGGESTING. TO SAY LET'S GO BACK TO HOW IT WAS THAT IS TOTALLY BACKROOM PEOPLE MEET WITH PEOPLE. THAT HAPPENS ALL THE TIME. TO SAY THAT'S NOT GOING ON, YOU'RE NOT MEETING WITH PEOPLE BEHIND THE SCENES IS INACCURATE. I DON'T ME WITH THEM I DECIDED NOT GOING TO DO IT BUT THAT DOESN'T MEAN YOU CAN'T. JUST TO SAY LET'S GO BACK, WE DO NOT HAVE A PROCESS BEFORE. IT WAS LITERALLY WHO COULD MAKE THE FASTEST MOTION. WE DO NOT HAVE ANY INTERVIEWS, IT WAS ALL BACKROOM DEALS.
[01:45:02]
WE DID IT THIS TIME WITH THIS.>> WE DID IT WITH THE SHERIFF AND NOT ANY OTHER TIME. IT WAS
JUST NOMINATE AND GO. >> IT IS THE FASTEST PERSON THE OTHER WAY WHICH IS NOT FAIR. THIS COVERS EVERYBODY WHERE EVERYBODY GETS A NAME IN THE HAT. INSTEAD OF ONE PERSON MAKING NOMINATION SOMEBODY WITH A SECOND AND WE HAVE TO VOTE.
>> WHY DO I PUT IT IN A HAT? YOU WANT IT TO BE IN A HAT?
>> IF MY NUMBER IS UP THERE ALREADY GOING TO VOTE FOR NUMBER FIVE IF I DIDN'T WANT HIM OR FIVE.
>> WHY SHOULDN'T WE ALL HAVE THE OPPORTUNITY?
>> I DID NOT EVEN WANT NUMBER FIVE.
>> YOU COULD'VE SAID NOBODY. >> EVERY COMMISSIONER HAS THE OPPORTUNITY OR JUDGE HAS THE OPPORTUNITY TO NOMINATE SOMEONE
OR NOT. >> I WANT TO NOMINATE SOMEBODY.
>> SO YOU CAN. >> I DON'T WANT TO NOMINATE
SOMEBODY TELL ME TO NOMINATE. >> NOBODY TOLD YOU WHAT TO DO.
NOBODY TELLS JOE GONZALEZ WHAT TO DO COME ON.
>> IF SOMEONE ELSE ALREADY PUT YOUR NAME OF YOUR PERSON , YOU HAD TO PUT A DIFFERENT NAME BECAUSE ALL FIVE HAVE DIFFERENT
NAMES. >> CHANGE THAT PART. IF YOU WANT TO PUT THE SAME NAME UP TWICE.
>> I'M TELLING YOU WHAT I CAN DO THAT'S NOT RIGHT. I TELL YOU WHAT CAN WE DO IT. IF A NAME COMES IN I WANT TO VOTE FOR THE NAME AND YOU WANT TO THROW IT OUT THAT'S UP TO YOU.
I'M TELLING YOU I WANT TO VOTE THE WAY I WANT TO VOTE. I'M NOT GOING TO LET SOMEBODY TELL ME HOW TO VOTE.
>> I THINK WHAT COMMISSIONER IS SAYING IS YOU ALL WERE DELETING PEOPLE IN A GROUP WHEN IT CAME UP AND WE PUT THEIR NAMES DOWN
AND ONLY GOT ONE VOTE. >> YOU GOT TO VOTE FOR TWO.
>> YEAH. >> YOU CAN'T VOTE FOR THE SAME
PERSON TWICE. >> HE CAN VOTE FOR HIM AND I
CAN VOTE FOR HIM. >> AND YOU DID.
>> THE THING WAS THAT PERSON CANNOT TWO VOTES IN ONE ROUND
THE FIRST ROUND. >> NO, CAN'T BE NOMINATED.
>> YOU DID NOT HAVE TO VOTE FOR THE PERSON'S NAME ON THE LIST.
>> HE NOMINATED SOMEONE AND DID NOT VOTE. YOU WERE THE FIRST
VOTE. >> THEY TOLD HIM HE IS ALREADY ON THE BOARD. IF HE'S ALREADY ON THE BORDER WANT TO VOTE FOR
NOMINATE. >> YOU SAID THE PERSON WAS
ALREADY ON THE BOARD. >> YOU TRIED TO VOTE FOR SOMEONE WHO WASN'T ON THE BOARD. YOU NOMINATED CAN BURY AND TRY TO VOTE FOR JOHN WHO IS NOT ON THE BOARD. THAT'S WHAT
YOU DID. >> I LOST MY NOMINATION.
>> YOU DID NOT LOSE IT YOU DO NOT VOTE FOR HIM.
>> BECAUSE YOU ALL SET HE WAS OUT BECAUSE HE DID NOT GET
ENOUGH VOTES. >> HE DID NOT THE FIRST YOU
WERE STILL ON THE BOARD. >> YOU NOMINATED AND THEN
DIDN'T VOTE. >> THAT'S HOW CONFUSING THIS IS. JUST GO BACK AND WE VOTE UP OR DOWN. WHOEVER WE WANT?
>> PEOPLE ARE GROWN-UPS, THEY KNOW WHAT THEY COME HERE FOR.
IT'S NOT TRYING TO PLAY A GAME AND ELIMINATE AND SPIN THE
BOTTLE ELIMINATE. >> WHY WOULD , YOU THINK , I THINK EVERYBODY OUGHT TO HAVE THE OPPORTUNITY TO PUT A PERSON ON THE BOARD AND AT LEAST HAVE THEM CONSIDERED. THE OLD SYSTEM
DID NOT ALLOW THAT. >> IF I WANT SOMEBODY AND YOU
PUT THEM UP. >> MY CONCEPT IS THIS. WE CAN TWEAK THIS IF IT'S NOT GOOD. EVERYBODY OUGHT TO HAVE THE OPPORTUNITY. TO SAY I WANT TO PUT THIS PERSON ON THE BOARD AND WE VOTE FOR THEM UP OR DOWN NOT JUST OKAY RUBBER MAKES THE FASTEST MOTION I MAKE THE SECOND WE DON'T HAVE DISCUSSION OR INTERVIEWS. THAT'S WHAT I'M TRYING TO AVOID. THAT IS BACKROOM POLITICS. IF YOU WANT TO PUT SOMEONE UP AND WE'LL CONSIDER AND THERE'S A DIFFERENT WAY TO DO THIS BUT THAT'S WHAT I'M SAYING. I THINK ALL OF US OUGHT TO BE ABLE TO PUT A NAME ON THE BOARD AND HAVE THEM CONSIDERED.
[01:50:02]
OF COURSE YOU CAN. >> COMMISSIONER HERNANDEZ OR I WOULD COMMISSIONER MAREZ OR I OR YOU WANT THE SAME PERSON TO BE NUMBER ONE WAIT A MINUTE SAY WE WANT THE SAME PERSON SO WHO DO YOU NOMINATE, YOU COME BEFORE ME AND NOMINATE SO-AND-SO. I WANT TO NOMINATE THE SAME ONE YOU NOMINATED.
>> THEN YOU'RE GOING TO VOTE FOR HIM ANYWAY.
>> I KNOW WHY BUT I PUT SOMEONE SO UP THERE. HE DOESN'T EVEN HAVE A CHANCE. SO JUST TO PUT THEM ON THE BOARD?
>> YOU NOMINATED THE PERSON YOU WANTED TO NOMINATE.
>> NO YOU DID. >> I DON'T UNDERSTAND WHAT YOU'RE SAYING EVERYBODY CAN'T PUT A NAME ON THE BOARD.
>> YOUR MOTION RIGHT NOW IS TO DO AWAY WITH THE PROCESS? AND YOU HAVE A SECOND ON THE FLOOR OF YOUR MOTION.
>> A MOTION AND A SECOND. ALL THOSE IN FAVOR, SAY AYE. ANY
OPPOSED, SAME SIGN. >> IF YOU WANT TO PUSH IT OFF WAIT UNTIL HE COMES BACK. I CAN SUPPORT THIS NOW WITHOUT SOMETHING ELSE. IF YOU WANT TO BRING SOMETHING BACK THAT WORKS BETTER, BUT RIGHT NOW TO ME I DON'T HAVE A VOICE BECAUSE I AM ANNOUNCING. I TRY NOT TO BE THE ONE TO MAKE MOTION, BECAUSE I'M THE JUDGE CALLING OUT THE MOTION. I'M THE ONE THAT DOESN'T GET A VOICE SO I CAN'T SUPPORT THIS NOT HAVING
SOME TYPE OF PROCESS. >> YOU SUPPORTED WHEN YOU THE
PROCESS YOU SPOKE IN FAVOR. >> WE ALL DID.
>> COMMISSIONER MAREZ IS BACK, SO COMMISSIONER.
>> WHAT DO YOU WANT TO SUBSTITUTE IT FOR?
>> THE PROCESS WAS NOT BROKEN. MAYBE THERE'S ANOTHER WAY TO LOOK AT IT I DON'T KNOW MAYBE THERE IS. IF A PERSON IS NOMINATED AND THERE'S ANOTHER VOTE FROM ME PUT THEM ON I DON'T WANT TO VOTE FOR THE SAME PERSON YOU DID BECAUSE THAT'S MY NOMINATION. IN YOUR MIND YOU HAD THE SAME NOMINATION SO WHY PUT SOMEBODY I DID NOT THINK OF PUTTING IT
IN ON THE BOARD. >> IF YOU WANT TO TWEAK. THE PROCESS WAS , COME BACK WITH THE PROCESS NOT JUST ELIMINATE SOMETHING WE ALL WORKED ON FOR SEVERAL MONTHS OF WHICH YOU WERE INVOLVED IN. YOU WERE AGAINST IT WHEN YOU VOTED FOR
>> KNOW WE HAVE THE DISCUSSION.
>> FOR A LOT OF PEOPLE IT DID NOT WORK. A LOT OF PEOPLE
COMPLAINED. >> THAT'S WHY I CAN VOTE FOR DOING AWAY WITH IT BECAUSE I DON'T FEEL LIKE I HAD A VOICE EITHER. YOU BRING SOMETHING BACK AND THEN WE WILL REPLACE.
>> COME BACK WITH A PROPOSAL. LET US VOTE ON A PROPOSAL.
>> THERE IS NO WAY I CAN THINK OF COMMISSIONER OTHER THAN , BECAUSE YOU HAVE THREE PEOPLE HERE THAT ARE NOMINATED. TWO OF
THOSE YOU DON'T WANT. >> THE PEOPLE I VOTED FOR DID
NOT GET ON. >> MY PEOPLE DO NOT GET ON
EITHER. >> I'M NOT SAYING THEY GOT ON THERE BUT IT WAS THE LAST ONE VOTE ON. SAY FOR INSTANCE HERNANDEZ PUTS A VOTE UP AND COMMISSIONER MAREZ PUTS A VOTE
AND YOU, THAT'S THREE. >> THEN WE MIGHT NOT ASK YOU WHAT YOU WANT THAT'S WHAT WE WANT TO GET AWAY FROM.
>> WAIT A MINUTE MINUS PUT TOGETHER. SO I DON'T KNOW.
>> SO CHANGE IT THAT WAY SO YOU DON'T HAVE TO PUT SOMEBODY UP
IF YOU DON'T WANT TO. >> I WANT TO GIVE MY VOTE TO THE ONE HE HAS. NOW HAS TWO VOTES AND THERE IS ONE MORE LEFT. AND THEN COME BACK AND VOTE AGAIN.
>> I THINK THERE IS VERY LITTLE , AGREEMENT HERE. DOES IT NEED WORK DO WE NEED TO WORK ON SOMETHING ELSE, YES BUT I DON'T THINK WE HAVE A PLAN TO MOVE FORWARD TO AGREE OTHER THAN YOUR THE PLAN IS TO VOTE THIS DOWN AND YOU HAVE A MOTION FOR IT. A SECOND? I WOULD LIKE TO SEE SOMETHING COME BACK WITH A BETTER PLAN BEFORE WE DO AWAY WITH IT. I UNDERSTAND THERE ARE
>> IT IS THE PROCESS UNTIL WE FIND SOMETHING ELSE AND IT STAYS LIKE IT IS UNTIL WE HAVE A BETTER PLAN IN PLACE.
[01:55:03]
>> JUDGE REGARDLESS I'M TELLING YOU FOR THE RECORD. I WANT TO VOTE MY VOTE AND YOU GUYS WANT TO THROW IT OUT AND
THROW IT OUT OKAY? >> THAT IS AN EASY CHANGE. NOT
EVERYBODY HAS TO PUT ONE UP. >> MY GUY HAS ALREADY BEEN KNOWN , I WANT TO NOMINATE HIM TOO. WHY SHOULD I GET SOMEBODY
WHO HAS NOT BEEN NOMINATED? >> THAT CAN BE A CHANGE.
>> GOING BACK TO THE SAME ORIGINAL PLAN.
>> YOU DON'T HAVE TO PUT SOMEONE ON THE BOARD IF YOUR
NAME IS ALREADY UP THERE. >> BUT I HAVE TO VOTE. IF I VOTE THEY WILL HAVE TWO VOTES.
>> YES THAT'S ALL PEOPLE GOT IN LAST TIME.
>> TOTALLY DIFFERENT. >> WE ALL KNOW PEOPLE COMING AND THEY LOBBY US. HOW ARE YOU GOING TO FIX THAT?
>> THERE'S NOTHING WRONG WITH PEOPLE LOBBING. I HOPE NOBODY SAYS THAT, WE WANT TO KNOW WE ARE PUTTING.
>> ANYBODY CAN DO WHATEVER THEY WANT, BUT TO SAY THINGS DON'T GO ON BEHIND THE SCENES THAT IS INACCURATE. PEOPLE MEET WITH US ALL THE TIME ON DIFFERENT THINGS. AND THERE'S NOTHING WRONG WITH THAT. HOW WAS I GOING TO GET TO KNOW PEOPLE? I EITHER MEET WITH EVERYBODY OR NO ONE THAT IS HOW I DO IT. ON THE PORT DEAL I MET WITH ANYBODY WHO CALLED ME.
>> CONTINUING WITH THE MOTION OR WITHDRAWING UNTIL YOU CAN COME BACK WITH A BETTER PLAN OR IS THE MOTION STILL TO DO AWAY
WITH THIS? >> MY MOTION WOULD BE TO HOLD THIS UNTIL WE FIND A BETTER PLAN.
>> TO CONTINUE WE HAVE TO HAVE A PLAN. THIS WOULD STAY AS POLICY BECAUSE IT WAS VOTED IN.
>> LIKE COMMISSIONER SAYS WE VOTED IT IN WITH THE AGREEMENT AND IF WE DON'T LIKE IT WE CAN BRING IT BACK.
>> THAT'S THE MOTION NOW TO CANCEL. THAT'S THE MOTION ON THE FLOOR TO CANCEL AND YOUR SECOND. SO WE HAVE A MOTION AND A SECOND ON THE FLOOR TO CANCEL THIS PORTION OF THE APPOINTMENT PROCESS. ALL THOSE IN FAVOR, SAY AYE. ANY OPPOSED, SAME
SIGN. >> I'M SORRY REAL QUICK. I WANT TO COMMENT. IS IT THE BEST PROCESS I AGREE BUT I DON'T WANT TO NOT HAVE A PROCESS. AS IMPERFECT AS IT IS, WE UNDERSTAND AND I DON'T THINK IT'S GOOD POLICY TO CHANGE ANYTIME A VOTE COMES UP SO THE LONGER WE KNOW THIS IS THE PROCESS AND WE KNOW THE RULES TO GO BY RATHER THAN SOMETHING CREATED WEEKS OR MONTHS IN ADVANCE. AT LEAST WE KNOW HOW THE PROCESS WORKS. WHETHER WE LIKE THE OUTCOME OR NOT. I WOULD NOT WANT TO JUST ELIMINATE IT AND NOT HAVE A PROCESS. I AM IN FAVOR IF COMMISSIONER GONZALEZ OR COMMISSIONER HERNANDEZ HAVE A WAY TO PRESENT IT AND BRING IT TO US TO LOOK AT IT I AM IN FAVOR. I WON'T BE IN FAVOR OF ELIMINATING TODAY AND NOT HAVING ANYTHING.
>> YOU ALREADY SAID YOU WANT TO KEEP THE PROCESS AS IS.
>> I'M SAYING UNTIL WE GET OPTION B OPTION B PRESENTED SO WE CAN SAY HERE THEY ARE WHAT WE THINK? MAYBE WE COME UP WITH OPTION C OUT OF SOME COMBINATION OF THOSE. ALSO I MENTIONED BEFORE WHEN WE LAST LOOKED AT THE POLICY WHICH WAS , THERE ARE OTHER ENTITIES IN THE AREA , CITIES AND OTHER ELECTED BODIES WHO HAVE APPOINTMENT PROCESSES SO IF WE LOOK AT HOW THEY DO IT AND COME BACK MAYBE WE CAN HAVE SEVERAL OPTIONS TO LOOK AT AND SAY THIS IS HOW THEY DO IT WHICH ONE DO YOU WANT OR WHICH WORKS BEST? FOR ME, I WANT TO MAKE SURE THAT WE AND ANY APPLICANT UNDERSTAND WHAT THE PROCESS IS SO THERE'S NO CONFUSION BECAUSE I THINK THERE WAS CONFUSION DURING THE COURT APPOINTMENT. SO I DON'T WANT ANYONE TO DOUBT THE PROCESS IS NOT CLEAR AND UNDERSTAND SO THE PUBLIC AND COURT CAN UNDERSTAND. IF WE CAN TABLE THIS MAY BE TABLE AND NOT HAVE TO KILL IT AND ALLOW SOME TIME TO DO SOME RESEARCH AND THEN COME BACK AND COME UP WITH TWO OR THREE OTHER OPTIONS OR MORE. I WOULD BE MORE FAVORABLE TO
[02:00:01]
LOOK AT THAT RATHER THAN TO SAY LET'S KILL IT. I THINK THAT ISA BAD MESSAGE. >> I DON'T MIND TABLING IT.
>> WITHDRAW THE MOTION. UNTIL YOU BRING IT BACK AND WHEN YOU
COME UP WITH A BETTER PLAN. >> MAYBE SOMETHING THE FIRST
MEETING OF AUGUST. >> RIGHT NOW THIS IS THE PLAN
IN THE NUECES COUNTY POLICY. >> WE DON'T REALLY HAVE ANY
APPOINTMENTS COMING UP? >> NO. THERE IS TIME TO REVIEW AND WORK ON IT, BUT RIGHT NOW THE POLICY STANDS, BRING IT
BACK WITH OTHER OPTIONS. >> I DON'T KNOW IF NEXT WEEK IS TOO QUICK. MAYBE THE FIRST MEETING IN AUGUST. LIKE I SAID CITIES AND OTHER ELECTED BODIES TO LOOK AT WHAT THEY DO AND HOW THEY DO IT AND MAYBE IT'S AS SIMPLE AS WHAT YOU ARE SAYING, THROW OUT A NAME THE NAME IS ON AND ACCOUNTS AS A VOTE IN FAVOR OR WE DON'T ALL HAVE, WE DON'T FEEL FORCED TO PUT IN NAMES WE DON'T WANT TO PUT IN TWO NAMES WE ONLY WANT ONE.
THAT IS CLEARLY STATED. I WOULD RATHER THE PROCESS THE VERY CLEAR FOR EVERYONE. THAT'S WHAT I'M SHOOTING FOR.
>> TABLE 2 WHEN YOU ARE READY TO BRING IT BACK?
>> IT'S JUST CLARIFICATION. IF THERE IS NO MOTION , WHENEVER YOU GET IT READY TO PUT IT BACK YOU PUT IT ON THE AGENDA BECAUSE IT'S ALREADY IN THE POLICY AND VOTED ON IN THE POLICY SO YOU'RE JUST WITHDRAWING THE MOTION UNTIL YOU COME BACK WITH THE PLAN CORRECT? YES.
>> JUDGE WE VOTED ON TWO ORDINANCES? SO THEY GOT ON.
>> THE ONE BOARD APPOINTEE RESIGNED JUST GOT BACK ON.
