>> I PLEDGE ALLEGIANCE TO THE FLAG OF THE UNITED STATES OF AMERICA AND TO THE REPUBLIC FOR WHICH IT STANDS ONE NATION UNDER GOD INDIVISIBLE WITH LIBERTY AND JUSTICE FOR ALL.

>> YOU MAY BE SEATED. I JUST WANT TO MENTION THAT THE SHERIFF DID ASK FOR PERSONAL PRIVILEGE WITH ALL OF THE HAT AND WE LOVE SEEING ALL OF YOU AND OUR LAW ENFORCEMENT OFFICERS HERE IN YOUR HATS, SO THERE WAS NO PERSONAL PRIVILEGE NEEDED. IT IS 9:11 AND WE ARE CALLING THIS MEETING TO ORDER.

WE ARE AT 901 LEOPARD IN THE COMMISSIONERS COURTROOM. WE HAVE ALL COMMISSIONERS HERE EXCEPT FOR GONZALEZ WHO IS IN

[D. ANNOUNCEMENT ON DISCLOSURE OF CONFLICTS OF INTEREST: Any Conflicts of Interest or Appearance of a Conflict of Interest with items on this agenda shall be declared at this time. Members with conflicts will refrain from voting and are asked to refrain from discussion on such items. Conflicts discovered later in the meeting shall be disclosed at that time.]

THE BACK ROOM AND I'M CERTAIN HE WILL BE JOINING US ANY MOMENT. DO WE HAVE ANY CONFLICTS OF INTEREST? WOULD ANYBODY LIKE TO DISCLOSE THAT?

>> UNDER SECTION G FOR , ABSTAINING FROM. THAT IS ON

[1. In recognition of Arlis Young's 27 years of service to Nueces County.]

FILE. >> ABSOLUTELY. I HAD IT MARKED IN MY CALENDAR ON MY AGENDA ALREADY. ANY OTHERS? OTHERWISE, I WILL MOVE ON TO ITEM D . PRESENT THE FOLLOWING SIGNIFICANCE OF RECOGNITION. WE HAVE E 1 OF ARLIS YOUNG'S 27 YEARS OF SERVICE TO NUECES COUNTY AND I HAD IN MY NOTES THAT THE SHERIFF WAS GOING TO SPEAK ABOUT THIS.

>> THIS IS ARLIS YOUNG . STARTED HIS CAREER WITH THE NUECES COUNTY SHERIFF'S OFFICE IN 1995 AND HE WAS AN UNPAID DEPUTY. BACK THEN, THEY CALLED HIM RESERVES. BASICALLY, UNPAID DEPUTY RESERVE IS EVERY BIT AS QUALIFIED AND EVERY BIT TRAINED UP AS FULLY PAID DEPUTY SHERIFF. THAT IS THE WAY ARLIS YOUNG STARTED WITH US. HE SPENT A SIGNIFICANT TIME AS A CORRECTIONAL OFFICER IN THE NUECES COUNTY JAIL. AS A CORRECTIONAL OFFICER, HE WORKED HIS WAY INTO JAIL INDUSTRIES.

ONE THING IS THAT I REMEMBER WHEN I WAS A CORPUS CHRISTI POLICE OFFICER, IT'S FITTING THAT ARLIS YOUNG IS RETIRING ON THE DAY THAT WE ARE RECOGNIZING COWBOYS WHO HELPED US WITH AN A STRAY SITUATION, BECAUSE I BELIEVE IT WAS CLOSER TO THE YEAR 2000 OR 2002 SOMEWHERE IN THERE IS A CORPUS

[00:05:01]

CHRISTI POLICE OFFICER AND WE GOT A CALL NEAR YORKTOWN AND AIRLINE. IT WAS A HORSE. I CHASED THAT HORSE FOR 30 MINUTES. I JUST DID IN MY PATROL CAR. I CHASED IT ON FOOT AND I COULDN'T GET ANYWHERE NEAR THE HORSE. EVERY SHERIFF IN THE STATE OF TEXAS IS OBLIGATED TO DEAL WITH STRAYS EVEN INSIDE OF THE CITY LIMITS. IT'S THEIR RESPONSIBILITY. OF COURSE, THE DISPATCHER CALLED THE NUECES COUNTY SHERIFF'S OFFICE YEARS AGO AT THIS INCIDENT. ARLIS YOUNG IS THE ONE WHO SHOWED UP. HE PULLED UP IN HIS PICKUP TRUCK AND HORSE TRAILER AND HE SLOWLY GOT OUT OF THE TRUCK. HE WENT TO THE BACK OF THE TRAILER, OPENED THE GATE, WENT TO THE BACK OF THE TRUCK AND GOT A WHITE BUCKET AND STARTED CHECKING THE BUCKET . ONE WHO WALKED UP ON THE TRAILER, THE HORSE FOLLOWED HIM ONTO THE TRAILER. THANK YOU FOR THAT, MY FRIEND.

>> SERVICE AND WE WILL MISS ARLIS. THANK YOU, MY FRIEND. YOU KNOW WHAT? ONE OF HIS COWORKERS FOR ANY KIND OF STORIES, BUT NOT A LOT. COME ON UP HERE, CHIEF. STORIES THAT CAN BE

TOLD PUBLICLY. >> HE'S ALREADY TURNING RED.

HIM, I HAVE KNOWN HIM FOR MANY YEARS . HE HAS TOLD ME MANY STORIES, ARLITOS . HE HAS GIVEN ME A VAST EDUCATION ON STEERS, BOWLS, PIGS AND I HAD THE PLEASURE OF GETTING TO KNOW YOU. IT IS AN HONOR AND WE WILL DEFINITELY FEEL THE LOSS OF YOU NOT BEING HERE, BUT I KNOW THAT YOU ARE MOVING ON TO BETTER THINGS AND I WISH YOU ALL THE BEST.

>> HE IS THE ONE WHO TOLD ME ABOUT THE MEXICAN RESTAURANT

THIS MORNING. >> IT WAS VERY GOOD.

>> HE IS A CHARACTER, TEACHER AND MENTOR. WE ARE GOING TO MISS THAT VERY FIRST OCCASION WHEN I WAS A ROOKIE 20+ YEARS AGO AND I HAD THE PLEASURE OF RELIEVING HIM ON SHIFT . HE MADE SURE THAT HE LET US KNOW THE STANDARD WHEN WE CAME IN.

THEY RECIPROCATED IT, AS WELL . THEY SET A GOOD STANDARD FOR US OFFICERS. FAST FORWARD ANOTHER 12 YEARS AND I HAD THE PRIVILEGE OF WORKING WITH HIM WHEN HE WAS AN AIP. I RECALL PUTTING MY FOOT IN MY MOUTH BY TELLING HIM, LET'S GO AFTER THE LONGHORN, WROTE IT WROTE IT AND TIE IT TO THE TRUCK .

HE TOLD ME I WAS INSANE AND GAVE ME ANOTHER LESSON ON CATTLE STEERING. WE WILL MISS HIM. YOU WERE A GOOD TEACHER.

YOU STILL ARE A GOOD EXAMPLE, AS WELL. YOU ARE GOING TO BE MISSED. THANK YOU VERY MUCH, SIR. I WILL CALL YOU A DEPUTY OFFICER AND DEFINITELY A COWBOY. THANK YOU.

>>

WORDS, TOO? >> THANKS FOR 27 YEARS.

>> THANK YOU. >> IT'S OKAY.

>> THANK YOU. >>

>> , AND UP FRONT AND I WILL PRESENT YOU WITH THIS.

>> YOU NEED YOUR HORSE. >> IF WE WANT TO GET ANYBODY

ELSE APPEAR. >> WE GREATLY APPRECIATE

EVERYTHING. >> 27 YEARS IS A LIFETIME .

>> I KNOW YOU HAVE GOOD STORIES.

>> I'M SURE HE DOES.

[00:10:35]

TOO. I WAS IN CHARGE OF THE TRAIL RIDING IN SAN ANTONIO FOR ABOUT NINE YEARS. WE HAVE BEEN IN THE HORSE BUSINESS QUITE A WHILE. I DO THANK ALL OF MY COLLEAGUES OUT THERE .

>> TAKE CARE AND ENJOY LIFE.

[3. Recognizing 5 Cowboys who assisted Nueces County deputies with rounding up 5 wild, estray horses in the London/Chapman Ranch area.]

NEXT ONE FOR THE COWBOYS, WE WILL DO THAT ONE FIRST, SO YOU CAN BE PART OF THAT WITH YOUR FRIENDS. I WILL PULL UP F 3 , RECOGNIZING THE FIVE COWBOYS WHO ASSISTED NUECES COUNTY DEPUTIES WITH ROUNDING UP FIVE WILD ASTRAY HORSES AND SHERIFF ALLUDED TO THAT, BUT WE ARE GREATLY APPRECIATIVE OF ALL OF THE HELP THAT HE RECEIVED AND WE HAVE SOME ESTEEMED GUESTS, AS WELL AND I'M SURE THAT THEY WILL RECOGNIZE YOU AND WE ARE VERY HAPPY AND THANKFUL.

>> THAT A STRAY SITUATION, NO ONE KNOWS IT BETTER. THEY DO AN AWFUL LOT OF IT IN THE COUNTY AND WE FOUND IT OUT OVER THE EASTER HOLIDAY. SOMETIME SATURDAY BEFORE EASTER SUNDAY, A GROUP OF HORSES ESCAPED IN THE LONDON BRANCH AREA AND THEY WERE ABOUT AS WILD AS THEY COULD BE. THEY WERE DESCRIBED AS FERAL AND BELONGED TO A GENTLEMAN WHO BASICALLY KEPT THEM LOCKED UP AND NEVER SOCIALIZED THEM . WHEN THEY ESCAPED, THEY HAD NO INTENTION OF EVER GOING BACK TO THE PROPERTY. THEY HAD HUNDREDS OF ACRES OF TENDER PLANTS TO FEED ON AND THEY WERE LITERALLY IN HORSE HEAVEN .

THERE IS ALSO A LAKE. THEY HAD NO INTENTION THAT THERE WERE GOING TO BE NUECES COUNTY WILD HORSES ON THAT WILDHORSE DESERT OUT ON THE WEST SIDE OF NUECES COUNTY . ANYWAY, AS IS THE CASE WITH THE STRAYS, WE HAVE TO DEAL WITH THEM QUICKLY AND EFFECTIVELY , BECAUSE IF THEY END UP ON A COUNTY ROAD OR STATE HIGHWAY OR ANY ROAD, IT IS OFTEN TRAGIC WHAT HAPPENS WITH LARGE ANIMALS LIKE HORSES AND CATTLE , SO IS OUR RESPONSIBILITY TO QUICKLY GET THEM CONTAINED AND CAPTURED.

OUR CONTROL RESPONSE WAS THERE, BUT THE PATROL RESPONSE WAS DEFEATED AND THERE IS ONLY SO MUCH YOU CAN DO. YOU JUST CAN'T CHASE A WILDHORSE IN A PATROL CAR OR A TV. IT WILL NOT TURN OUT WELL BUT WE FOUND THAT OUT. ANYWAY, I HAVE HERE WITH ME ONE OF THE DEPUTIES WHO NAVIGATED THE ISSUE AND ULTIMATELY GOT US TO A SUCCESSFUL COMPLETION AND I WILL LET YOU TAKE IT FROM HERE.

>> I AM A PATROL SERGEANT. THESE FIVE GENTLEMEN ASSISTED FIVE WILD ASTRAY HORSES AND THESE ASSISTING GENTLEMEN ARE

[00:15:04]

THE TEAM LEADER WHO IS THE MANAGEMENT COORDINATOR AND IMPOUNDING LIVESTOCK. BUDDY OLSON, HELICOPTER PILOT WHO IS IN CHARGE OF ROUNDING UP CATTLE USING HIS HELICOPTER WHO I WILL MAKE A NOTE IS NOT HERE AT THE MOMENT. HE IS ON VACATION IN COSTA RICA. A VETERINARIAN FROM ALICE WHO IS THE EXTREMELY VALUABLE . MARK, PRIVATE RESIDENCE OF THE RANCH AREA AND FORMER COWBOY ASSISTED WITH ROPING AND DIRECTING THE MOVEMENT OF THE HORSES. MARTY ASSISTED IN THE ROUNDUP. IS OWNED BY THE COMMISSIONERS COURT OF NUECES COUNTY HEREBY RECOGNIZING THESE FIVE MEN FOR HELPING THE NUECES COUNTY SHERIFF'S OFFICE LIVESTOCK. I WOULD LIKE TO TALK ABOUT MY EXPERIENCE WITH LIVESTOCK. I HAVE BEEN IN THE SHERIFF'S OFFICE FOR 14 YEARS AND IN PATROL FOR 12 YEARS ON THE STREET. LIVESTOCK IS SOMETHING THAT IS ALMOST A DAILY OCCURRENCE WHEN YOU HAVE RANCHES, FARMS, PEOPLE ON HORSES AND CATTLE AND I RESPONDED TO HUNDREDS OF CALLS OVER MY YEARS OF SERVICE. THE SITUATION WAS DIFFERENT AND UNIQUE , BECAUSE THE AREA OF WHICH THE HORSES GOT OUT AND LIKE THE SHERIFF'S SAID, THEY DID NOT WANT TO BE ANY PART -- THEY DIDN'T WANT TO BE NEAR HUMANS AND WERE SCARED. AND ONE ON THE SOUTH SIDE OF CORPUS KNOWS HIGHWAY 286 , WHICH IS WAY OUT OF STAPLES. THEY KNOW HOW POPULAR THE ROAD IS THAT THESE HORSES WERE GOING BACK AND FORTH ACROSS THE ROADWAY NOT JUST EATING GRAIN AND THE FARM, BUT CAUSING A HAZARD AND DAMAGING PROPERTY, AS WELL. WE REACHED OUT TO LANCE BROWN AND THEY ASSISTED IN GOT THEIR TEAM TOGETHER AND PUT THE TEAM TOGETHER. IT WAS SOMETHING TO SEE IF YOU HAD BEEN THERE WITH THE HELICOPTER, ROPING AND DARTING THE HORSES FROM THE HELICOPTER. LIKE I SAID, LIVESTOCK IS SOMETHING WE DEAL WITH ON A DAILY BASIS. IF YOU HAVE FACEBOOK, YOU CAN GO BACK TO THE NUECES COUNTY FACEBOOK PAGE AND WATCH ME GET ATTACKED BY A GOAT , BECAUSE WE POSTED THAT REZONE THE A WHILE OF BACK. WE SUCCESSFULLY GOT THE GOAT AND I'M FINE. IT DIDN'T HURT. WE WERE SUCCESSFULLY ABLE TO GET THE GOAT. THAT IS JUST AN EXAMPLE OF SOMETHING THAT WE DEAL WITH ON A DAILY BASIS. I WANT TO THANK THE GENTLEMAN ON BEHALF OF OF THE SHERIFF'S OFFICE FOR YOUR ASSISTANCE ON THAT. THANK YOU

VERY MUCH. >> I WILL MAKE THE MOTION TO

PASS. >> WE ARE JOINED BY JIM WELLS COUNTY SHERIFF DANNY, THANK YOU FOR BEING HERE. JIM WELLS

COUNTY CHARGE, THANK YOU. >> WE HAVE A MOTION AND SECOND. ALL THOSE IN FAVOR? THE MOTION PASSES. IF YOU WANT

TO PLAY YOUR VIDEO? >>

THAT VIDEO. >> ANY OF YOU OR YOUR TEAM WANT TO SAY ANYTHING ABOUT THE COLLABORATION BETWEEN AGENCIES AND HOW IMPORTANT IT WAS THAT DAY?

>> THIS IS A GREAT DAY. WE APPRECIATE YOU DOING THAT.

>> MY NAME IS LANCE BROWN FROM THE EMERGENCY MANAGEMENT AND I WANT TO SAY THANK YOU TO OUR SHERIFF. HE PUT TOGETHER A GREAT PLAN FOR JIM WELLS COUNTY WITH THE LIVESTOCK AND WHAT WE DO WITH THE LIVESTOCK . I CAN'T THANK HIM ENOUGH WITH T DOES TO KEEP THE COUNTY SAFE. ARE SERGEANT 'S ANIMAL CONTROL AND HE HAS HIS HANDS FULL WITH THE HORSES, COWS, GOATS ON A DAILY BASIS, SO WE WORK REALLY HARD ON THAT. WITHOUT HIM, COUNTY JUDGE . THE RELATIONSHIP THAT ARE JUDGE AND

[00:20:08]

SHERIFFS HAVE AND THE UNITY THAT OUR COUNTY JUDGE HAS BROUGHT TO THE COUNTY IS UNBELIEVABLE. WE WERE GOING ASTRAY AND IN JUST A YEAR AND A HALF, COUNTY JUDGE BROUGHT US BACK TOGETHER TO UNIFY ALTOGETHER FROM OUR SHERIFF'S DEPARTMENT, EMS, JAILHOUSE, COMMISSIONERS AND WE HAVE A GOOD THING GOING ON OVER THERE. WHENEVER SERGEANT DAVID CALLED ME ON A MONDAY, HE SAID HE HAD A PROBLEM. IT WAS AT 3:00. I SAID, I CAN'T GO. ROPING A HORSE -- I AM 0 FOR 3 ON THAT AND IT'S NOT VERY FUN. I'M NOT SURE HOW THE INDIANS DID IT, BUT I KNOW THAT IT'S NOT VERY FUN. I KNEW THAT WITH THE TECHNOLOGY WE HAVE , WE WOULD BE ABLE TO COMPLETE THE TASK.

I GOT WITH DR. SAM OVER HERE AND SAID, THIS IS WHAT WE GOT.

WHAT DO YOU THINK LEXI MY IN-LAWS ARE COMING IN. DO YOU THINK WE WILL BE DONE? PLAYING AT REAL ESTATE , WE ARE LAYING THEM DOWN AND GET THEM AT 8:00. THEY HAVE TRAILERS AND WE HAVE TRUSTEES. THEY HAVE A LOT OF RESOURCES. WE WILL BE DONE BY 10:00. WE DIDN'T GET DONE UNTIL 10:00. I THINK IT WAS 3:30 WHERE WE ALL MISSED LUNCH AND WERE DYING FOR WATER. WE COVERED A LOT OF REAL ESTATE OVER ON THAT SOUTH END OF CORPUS . WE TOOK OFF AFTER THE VERY BEGINNING. SAM BUSTED THREE OF THEM AND WE HAVE TWO CONFIRMED HITS FOR SURE. I WASN'T QUITE SURE ABOUT THE THIRD ONE. THAT HEAVY TRAFFIC AREA THAT YOU ARE TALKING ABOUT. THERE WAS A LOT OF PEOPLE GOING THERE AND WE WERE HURTING THEM LIKE A BUNCH OF WORDS. KIND OF LIKE SPIRIT. COME BACK , SPIRIT. THEY WERE LONG GONE . WE GOT THEM PUSHED BACK TOWARDS A SAFE AREA AND I GOT WITH SERGEANT DAVID AND SAID, WHAT RESOURCES DO YOU HAVE THAT ARE AVAILABLE? HE SAYS, SHERIFF SAID THAT YOU HAVE TO DO WHATEVER YOU GOT TO DO. WE ARE GOING TO CATCH THESE HORSES AND WE ARE NOT LEAVING UNTIL ALL FIVE ARE CAUGHT. DO YOU HAVE A HELICOPTER? HE SAID, YES, WE DO. 30 MINUTES OUT, LET'S GET HIM HERE. WE GOT HIM PUSHED TO A SAFE AREA AND WITHOUT ANY PRESSURE, WE LOST HIM. THESE HORSES WERE RUNNING AND THEY WERE PROBABLY ABOUT ONE MILE AWAY WITH ZERO PRESSURE AND THREE OF THEM RAN THROUGH A FENCE IN THREE DIFFERENT SPOTS , SO WE BOTH AGREED THAT THIS WAS GOING TO BE TOUGH . HE SPOTTED ONE AND WE TRIED TO CATCH THE HORSE AND WE HAD HIM DARTED. HE WAS DROWSY . I TOLD SAM, WE WILL NEED SOMEONE WITH A HORSE TO GET UP THERE, SO WE CAN CATCH HIM AND LOGISTIC -WISE, I KNEW WHAT WE NEEDED TO DO AND HOW. WE JUST ALL CAME TOGETHER. IT WAS A HUGE CORROBORATION TOGETHER . I COULDN'T HAVE DONE IT BY MYSELF. I COULDN'T HAVE DONE IT WITHOUT OUR DR. AND OTHER GUY, SO FROM THE BOTTOM OF MY HEART , I'M GLAD WE GOT EVERYONE SAFE AND SOUND WITH NO ANIMALS INJURED OR PEOPLE INJURED. WE TOOK OUR TIME AND EVERYBODY WAS SAFE. I JUST WANT TO THANK SHERIFF FOR PUTTING TOGETHER WHAT WE HAVE ESTABLISHED IN JIM WELLS COUNTY. OUR COUNTY JUDGE FOR THE LEADERSHIP HE HAS. ARE SERGEANT AND YVETTE. I WANT TO THANK EVERYBODY. IT WAS A BLESSED DAY.

>> WE WANT TO THANK YOU GUYS. WE HAVE A RESOLUTION AND WOULD LOVE TO TAKE A PHOTO. I AM VERY PROUD OF THE RELATIONSHIP WE HAVE WITH OUR SHERIFF, BUT WE ARE MORE PROUD OF THE COLLABORATION BETWEEN COUNTIES AND WORKING TOGETHER TO SOLVE THINGS LIKE THIS AND KEEP THE COMMUNITY SAFE. THANK YOU VERY MUCH FROM THE BOTTOM OF OUR HEARTS FROM NUECES COUNTY FOR YOUR HELP IN THIS ISSUE. COME UP, PLEASE.

[00:27:28]

>> WE HAVE A MOTION AND SECOND. ALL THOSE IN FAVOR? ANY OPPOSED? THE MOTION PASSES. THANK YOU. COACH, WOULD YOU LIKE TO SAY A FEW WORDS? I'M SURE THE COMMISSIONERS WOULD LIKE TO SAY A FEW WORDS. WE ARE PROUD OF THE TEAM CONSISTENTLY GOING TO STAY AND IT'S PRETTY IMPRESSIVE.

>> FIRST, THANK YOU FOR BRINGING US OUT HERE TO RECOGNIZE THE LADIES AND THEIR ACCOMPLISHMENTS. IT'S NOT EASY TO DO IT ONCE, TWICE, BUT THREE TIMES IN A ROW. IT'S A BIG DEAL TO THE COMMUNITY FOR WHAT THEY REPRESENT IN ROBSTOWN. OUR PRACTICE IS AT 6:30 , SO IT'S HARD ENOUGH TO WAKE UP AND COME TO SCHOOL . WHEN WE WAKE UP, COME TO SCHOOL AND ARE LIFTING WEIGHTS THAT ARE VERY HEAVY, IT TAKES A LOT OF DEDICATION AND HARD WORK AND A DIFFERENT TYPE OF MIND-SET TO DO WITH THESE YOUNG LADIES DO. HATS OFF TO THEM. THEY ARE AMAZING ATHLETES. OBSESSION IS A THING YOU MADE WHEN YOU ARE IN THEIR RATE -- WEIGHT ROOM. THEY HAVE WHAT IT TAKES AND WE WILL MAKE ANOTHER RUN FOR A FOURTH. THANK YOU FOR HAVING

US. >>

>> I DID WANT ONE OF MY ATHLETES TO SPEAK. SHE IS A SENIOR AND HAS BEEN HERE THE ENTIRE RIDE FOR THE THREE YEARS

, SO I WILL INTRODUCE . >> GOOD MORNING. I AM A SENIOR AND ROBSTOWN EARLY COLLEGE HIGH SCHOOL AND I WOULD LIKE TO THANK THE COMMISSIONERS COURT FOR INVITING US TO CELEBRATE OUR THREE-TIME STATE CHAMPIONSHIP RUN . I HAVE HAD THE HONOR OF BEING ON THE ROBSTOWN POWERLIFTING TEAM AND I'M PROUD WHERE MY TEAM STANDS TODAY. POWERLIFTING IS SISTERHOOD. ME AND MY TEAM ARE NOTHING BUT FAMILY. AS A GRADUATING SENIOR, I PRAY THAT PEACE NEXT YEAR WOULD BE NOTHING BUT PURE STRENGTH AND PRIDE. SEEING THE POWERLIFTING GROW AND CREATE A CULTURE AND PROCESS HAS BEEN A MEMORABLE JOURNEY . AS MY SISTERS CONTINUE WITH POWERLIFTING, OUR PRAYER CONTINUES AND THEIR INDIVIDUAL STORIES ARE COMPLETE. ALL OF OUR ACCOMPANIMENTS COULD NOT HAVE BEEN POSSIBLE WITHOUT THE ROBSTOWN COMMUNITY. IT TAKES A VILLAGE AND I AM NOTHING BUT THANKFUL FOR THE SUPPORT THAT'S HELPED OUR POWERLIFTING TEAM TAKE THE STATE TITLE.

THANK YOU . >> CONGRATULATIONS.

>> DO YOU WANT TO SAY SOMETHING, COMMISSIONER?

>> LADIES, I JUST WANT TO CONGRATULATE YOU BEFORE THE START OF THE MEETING. I DON'T THINK WE COULD FIND ANOTHER TEAM IN THE STATE . MAYBE ONE OF THE BIGGER CITIES IN THE STATE, BUT IN OUR AREA OF THE STATE, THAT IS A THREE-TIME STATE CHAMPIONSHIP TEAM IN ANY SPORT -- THAT IS SO UNIQUE.

THE FIRST ONE WAS GREAT AND EXCITING. THE SECOND ONE, THEY DID IT AGAIN. THE THIRD TIME, WE ARE GETTING USED TO IT. WE HOPE AND EXPECT YOU TO BE HERE NEXT YEAR. CONGRATULATIONS TO THE SENIORS WHO HELPED THE ADULT -- BUILD UP THE PROGRAM.

I HAVE A SHIRT WHEN I THINK I'M EXERCISING, BUT YOU ARE

[00:35:03]

AT THESE REALLY EXERCISING. IT SAYS ROBSTOWN PROUD . WHEN WE THINK ABOUT THE GREAT THINGS THAT YOU AND YOUR CLASSMATES DO IN ROBSTOWN . WE NEED ONE THAT SAYS NUECES COUNTY PROUD, BECAUSE YOU REPRESENT THE ENTIRE COUNTY WHEN YOU GO TO THESE EVENTS. JUST KNOW THAT THE SMALL RECOGNITION IS OUR WAY OF PUTTING THE ENTIRE COUNTY ON NOTICE AND WE HAVE SOMETHING SPECIAL. IT'S NOT ONLY YOUR TEAM, BUT SO MUCH MORE GOING ON . THE FACT THAT YOU ARE ABLE TO COMMIT, I CAN'T IMAGINE. I FIGURED THAT YOUR TEACHERS WOULD GIVE YOU A PASS IF YOU ARE TIRED AFTER 6:30 PRACTICE AND LIFTED ALL OF THESE POUNDS OF WEIGHTS . I KNOW THAT MANY OF YOU ARE EXCELLING IN ACADEMICS, AS WELL. CONTINUE TO SUPPORT PROGRAMS AND TEAMMATES COULD CONTINUE TO MAKE THAT PROGRAM KNOWN STATEWIDE, AS YOU HAVE. ONCE AGAIN, CONGRATULATIONS. WE

ARE SO PROUD. >> WE ARE. THANK YOU. IF YOU WOULD LIKE TO COME UP HERE, WE WOULD LIKE TO TAKE A PHOTO WITH YOU, AS WELL.

[2. In recognition of Autism Awareness Month - April 2024.]

HAVE IN RECOGNITION OF AUTISM AWARENESS MONTH. FRANCIS WILL READ THAT RESOLUTION. IT'S GOOD TO SEE YOU HERE.

>> AUTISM AFFECTS AN ESTIMATED ONE IN 36 CHILDREN IN THE STATES AND IS A COMPLEX DISORDER THAT AFFECTS EACH PERSON DIFFERENTLY RESULTING IN UNIQUE STRENGTHS AND CHALLENGES . WHEREAS, AUTISM CAN CAUSE CHALLENGES WITH VERBAL AND NONVERBAL COMMUNICATION , SOCIAL INTERACTION AND REPETITIVE BEHAVIORS AND CAN AFFECT ANYONE REGARDLESS OF AGE, RACE, ETHNICITY, GENDER OR SOCIOECONOMIC BACKGROUND.

AUTISM ACCEPTANCE MEANS RESPECTING THE RIGHTS AND HUMANITY OF ALL AUTISTIC PEOPLE. IT MEANS CENTERING PERSPECTIVE AND NEEDS OF AUTISTIC PEOPLE WITH INTELLECTUAL DISABILITIES AND AUTISTIC PEOPLE WITH THE HIGHEST SUPPORT NEEDS. NOT BY SPEAKING OVER THEM, BUT BY

[00:40:05]

LISTENING AND LOOKING TO THEM AS LEADERS. FIGHTING TO ENSURE THAT THE UNIVERSAL HUMAN RIGHTS OF ALL AUTISTIC PEOPLE ARE RESPECT DID, INCLUDING THOSE PEOPLE WITH THE MOST SIGNIFICANT DISABILITIES. WHEREAS, IN THE MONTH OF APRIL, WE STRIVE TO PROMOTE AUTISM AWARENESS AMONG INCLUSION AND ACCEPTANCE . SUPPORTING SELF-DETERMINATION FOR ALL AUTISTIC INDIVIDUALS . NOW, THEREFORE, BE IT RESOLVED THAT THE COMMISSIONERS COURT OF NUECES COUNTY , THIS HEREBY PROCLAIMED THE MONTH OF APRIL, 2024 TO BE AUTISM AWARENESS

MONTH. >> SECOND THAT MOTION. ALL IN FAVOR? ANY OPPOSED? MOTION PASSES. DR. SCOTT AND DUSTIN, DO EITHER ONE OF YOU WANT TO SPEAK ON THIS ISSUE? COME ON

UP. >> SHE CAN DO IT, TOO. OKAY.

GOOD MORNING, JUDGE AND COUNTY COURT COMMISSIONERS. I AM DUSTIN , THE FOUNDER , PRESIDENT AND EXECUTIVE DIRECTOR OF THIS NEW NONPROFIT CREATING CONNECTIONS PIECE BY PIECE. I HAD BEEN A COMMUNITY ACTIVIST FOR AUTISM AWARENESS FOR ALMOST TWO YEARS AND WE HAVE OFFICIALLY BECOME A NONPROFIT BACK IN JULY OF 2023, SO THE NONPROFIT HAS BEEN A 501(C) FOR ABOUT NINE MONTHS NOW. I HAVE HAD THE HONOR AND PLEASURE TO SPEAK IN FRONT OF LAW ENFORCEMENT, SHERIFF'S AND SPEAK WITH COUNTY JUDGES AND EVEN AT BOARD OF JUDGES.

WE ALSO WANT TO CONTINUE OUR WORK WITH THE BOYS AND GIRLS CLUB, YMCA , SCHOOL DISTRICTS AND ALL OF THAT AND EVEN CHURCHES TO PROMOTE ALL OF THE ACCEPTANCE AND AWARENESS TO KNOW THAT WE ARE ALL EQUAL AND ALL THE SAME. WE ALL WANT UNDERSTANDING AND TO HELP PEOPLE WHO WERE HAVING TROUBLE COMMUNICATING THROUGH THE JUSTICE SYSTEM OR THROUGH THE SCHOOL DISTRICTS OR WE NEED ANY KIND OF HELP OR ANYTHING LIKE THAT. ALSO, TRY TO GROW THE NONPROFIT TO HELP US MOVE FORWARD AND DO WHAT WE NEED TO IN ORDER TO HELP IMPROVE LIVES AND UNDERSTAND AUTISM , AS WELL AS OTHER INTELLECTUAL DISABILITIES, AS WELL. THANK YOU FOR INVITING US HERE TO RECOGNIZE US AND EVERYTHING. THANK YOU SO MUCH. HAVE A GREAT DAY. I ALSO APOLOGIZE FOR THE DISTURBANCE OF MY SON A LITTLE

WHILE AGO. >> THAT'S A WELCOME DISTURBANCE. I JUST WANT TO SAY HOW IMPRESSED I AM WITH ALL OF THE GREAT WORK YOU DO. I SEE YOUR STUFF ON FACEBOOK ALL THE TIME . IT'S AMAZING THE WORK THAT YOU HAVE DONE. I WAS TALKING TO ONE OF YOUR BOARD MEMBERS THIS MORNING AND I DIDN'T REALIZE HE WAS ON YOUR BOARD. YOU MUST HAVE GOTTEN LESS FOR THE STRAWS TO GET HIM. I'M KIDDING. IT IS A GREAT THING WHAT YOU HAVE DONE PUTTING THIS 501(C) TOGETHER.

THAT'S NOT AN EASY TASK. KEEP DOING THE GREAT WORK YOU ARE DOING, BECAUSE YOU MADE A DIFFERENCE IN THE COMMUNITY AND YOU HAVE MADE A DIFFERENCE NOT ONLY IN WHAT YOU ARE LOOKING FOR, BUT TO BRING SUCH AWARENESS AND WHAT PEOPLE ARE CAPABLE OF AND WHAT WE ARE ALL CAPABLE OF. AS YOU SAID, WE ARE ALL EQUAL. THANK YOU FOR WHAT YOU DONE. YOU HAVE MADE A TRUE

DIFFERENCE. THANK YOU. >> THANK YOU SO MUCH. THANK EACH AND EVERYONE OF YOU ALL, INCLUDING YOU, JUDGE, FOR HELPING US PUT THIS TOGETHER. ALL OF THE COUNTY COURT COMMISSIONERS FOR ALSO MAKING THIS HAPPEN HERE AT NUECES COUNTY . WE ALSO HAVE A BOARD MEMBERS ON OUR BOARD, BUT THEY COULDN'T MAKE IT TODAY DUE TO OTHER JOBS. THANK YOU SO MUCH.

>> THANK YOU. >> WE HAVE A PROCLAMATION IF YOU WOULD LIKE TO GET A PHOTO, AS WELL. YOUR BOARD MEMBERS,

AS WELL. >> DR. SCOTT, DID YOU WANT TO

SAY ANYTHING? >> THANK YOU FOR RECOGNIZING THE MISSION THAT DUSTIN HAS PUT TOGETHER. IT TAKES A VILLAGE TO HELP OUR COMMUNITY AND PEOPLE LIVING WITH DISABILITIES. HE IS PART OF THAT VILLAGE. THANK YOU FOR DOING THIS TODAY.

[00:46:46]

ALL OF YOU. WE APPRECIATE ALL OF THE HARD WORK. WE WILL BE MOVING ON TO ITEM G ON OUR BOARD APPOINTMENTS. LET ME CLARIFY , I KNOW OUR RESOLUTIONS AND PROCLAMATIONS, SOMETIMES WE SPEAK MORE AND WE ARE ALSO HAPPY TO HAVE KIDS AND PEOPLE HERE, THAT WE ARE GETTING DOWN TO THE BUSINESS.

WE NEED THE AUDIENCE TO STAY QUIET. NO CLAPPING , AGREEING OR DISAGREEING WITH ANYTHING. PUBLIC COMMENT, WE HAVE TO

[1. Coastal Bend Council of Governments]

JUST LISTEN AND CAN'T COMMENT. WE ARE GETTING DOWN TO BUSINESS. ON ITEM G 1, COASTAL BEND COUNCIL OF GOVERNMENTS, WHICH WAS BASICALLY TO UPDATE WITH STAFF MEMBERS THAT HAD CHANGED AND I BELIEVE THERE IS ONE OPENING THAT COULD BE FILLED, AS WELL. IT ISN'T ON THERE, BUT WE WOULD LIKE TO MAKE A MOTION . WE HAVE A MOTION AND SECOND TO ACCEPT THE POSITIONS LISTED UPDATING OUR STAFF MEMBERS AND PEOPLE WHO HAVE CHANGED. ALL THOSE IN FAVOR? ANY OPPOSED? SINCE THIS IS EMPLOYEES AND STAFF MEMBERS, IF THERE ARE ANY SUGGESTIONS OR SOMEONE WHO WANTS TO SERVE ON THE BOARD,

[2. Nueces County Mental Health and Intellectual Disabilities]

WE MAY LOOK TO THAT IN THE FUTURE. MOVING TO ITEM TWO, NUECES COUNTY MENTAL HEALTH AND INTELLECTUAL DISABILITIES BOARD. WE HAVE FIVE OPEN POSITIONS. THERE WERE THREE LETTERS OF INTENT AND TWO NEW APPLICANTS. ERIN DIAZ AND

NANCY. >> REAPPOINTED THE THREE LETTER

OF INTENSE . >> MOTION AND SECOND TO REAPPOINT THOSE WITH THE LETTER OF INTENT? SORRY IF YOU DIDN'T SEE THAT. ALL THOSE IN FAVOR? ANY OPPOSED?

>> I HAVE A QUESTION ON THE NEW APPOINTMENTS. I THINK MR. DIAZ IS AN OUTSTANDING MAN AND APPLICANT, BUT I'M CONCERNED ABOUT THE FACT THAT THERE MIGHT BE CONFLICT BASED ON THE BOARD APPOINTMENT, SO I DON'T WANT TO PUT US IN A POSITION WHERE WE APPOINT THE STANDING APPLICANT TO SOMEONE WHO CAN'T

VOTE VERY MUCH. >> IF HE IS ON THAT BOARD AND WORKING FOR THE COUNTY, I BELIEVE HE'S WORKING WITH DR.

GONZALEZ . HE WOULD BE PRECLUDED FROM VOTING ON MATTERS THAT HAVE TO DO WITH NUECES COUNTY SPECIFICALLY WHEN HE IS SERVING ON THE BOARD. HE COULD SERVE ON THE BOARD , BUT NOT BE ABLE TO BOW ON MATTERS INVOLVING THE

COUNTY. >> HOW MANY MATTERS? IS A PREDOMINANTLY DEALING WITH NUECES COUNTY MATTERS?

>> I HAVE NEVER ATTENDED THE BOARD OR SEEN AN AGENDA OF

[00:50:03]

THEIRS, BUT I WOULD IMAGINE THAT WOULD CONSTITUTE A SIGNIFICANT PORTION OF THEIR BUSINESS , BUT MOSTLY WHAT IS RELATIVE TO THE COUNTY IS WHAT I WOULD BE CONCERNED WITH.

>> YOU SHOULD ABSTAIN THE BOAT AND IT MATTERS WHAT YOU WANT TO VOTE ON. WE HAVE OTHER JUDGES AND BOARDS, TOO. YOU ARE ON THE BOARD, SOMA -- CAN PUT ON CERTAIN THINGS. I DON'T SEE A DIFFERENCE. IF SOMEBODY WANTS TO SERVE, I'M SURE THAT SHE WOULD BE ABLE TO SERVE. IF THERE IS A CONFLICT, WE WILL KNOW ABOUT IT LATER AND CAN CROSS THAT ROAD WHEN WE COME TO IT. I DON'T SEE ANY CONFLICT AT THIS POINT. I THINK WE SHOULD GO WITH THE APPOINTMENTS.

>> THE PROBLEM THAT RISES IS THAT WE CAN'T DO ANYTHING ABOUT IT LATER. I WON'T MENTION NAMES, BUT THEY WILL HAVE TO RECUSE THEMSELVES ON 75% OF WHAT THEY ARE ON THE BOARD FOR AND OUT OF THE IT'S A GOOD SITUATION TO SET UP , BECAUSE THERE IS NOTHING WE CAN DO ONCE WE APPOINT SOMEONE.

THERE IS ABSOLUTELY NOTHING WE CAN DO AND YOU CAN'T REMOVE THEM. THAT IS REALLY HARD. I DON'T THINK WE SHOULD PUT BOARD MEMBERS ON THAT WILL HAVE SIGNIFICANT CONFLICT. THAT IS WHY I'M ASKING IF SOMEONE COULD TELL ME IF WE CAN TABLE THAT AND BRING THEM BACK LATER IN THE MEETING? I WOULD LIKE TO KNOW HOW MUCH -- I PUT IT ON ANY OF THE BOARD IN THE COUNTY, BECAUSE HE'S A GREAT GUY, BUT I'M CONCERNED ABOUT PUTTING HIM ON A BOARD THAT HE MIGHT CONFLICT HIMSELF OUT OF

60% OR 80%. >> BUT I WOULD SECOND THE MOTION AND THEN ASK IF SOMEBODY CAN GET THEM OVER HERE TO GET SOME ANSWERS ON THAT .

>> EMOTION AND A SECOND, ALL THOSE IN FAVOR SAY AYE. IF YOU CAN LET ME KNOW AS SOON AS POSSIBLE WE WILL BRING THE OTHER ONE BACK AND THANK YOU FOR BEING HERE.

>> I AM TOTALLY GOOD WITH HIM HE IS A GREAT GUY. I JUST WANT

[3. Nueces County Library Advisory Board]

TO SEE WHAT THE CONFLICT ISSUE IS.

>> MOVING ON NUMBER THREE, NUECES COUNTY ADVISORY LIBRARY ABOARD TWO LETTERS OF INTENT AND ONE NEW APPLICANT AND THREE OPEN POSITIONS. DEPUTY IS THE NEW APPLICANT.

>> I WOULD MOVE APPOINTMENT. ALL THREE.

>> TWO OR THREE LETTERS? >> WE CAN DO REAPPOINTMENT.

>> MOTION TO REAPPOINT TWO EXISTING MEMBERS.

>> ALL THOSE IN FAVOR, SAY AYE. ALL THOSE OPPOSED, SAME SIGN. THE MOTION PASSES AND WE HAD ONE NEW APPLICATION AND ONE OPENING FROM STEPHANIE WITH A MOTION AND A SECOND. ALL THOSE IN FAVOR, SAY AYE. ANY THOSE OPPOSED, SAME SIGN. THE

[4. South Texas Water Authority]

MOTION PASSES. MOVING ON ITEM 4 S. TEXAS WATER AUTHORITY TWO OPEN POSITIONS AND TWO LETTERS OF INTENT AND THIS ONE

COMMISSIONER IS ABSTAINING. >> I WOULD LIKE TO REAPPOINT

MOVING ON TO PUBLIC COMMENT. WE HAVE LIZ MILLER. AND ONE

MORE ON ZOOM. >>

[00:55:07]

ON I JUST WANT TO TALK ABOUT THE ONE ABOUT THE ANIMAL FACILITY. THAT'S JUST REQUEST FOR BID. THE REASON WHY DOES NOT HAVE ANYTHING TO DO WITH IT. LAST NIGHT I WAS JUST RESEARCHING SOMETHING ELSE AND I RUN ACROSS SMITH COUNTY TEXAS JUST APPROVED TEMPORARY ARPA FUNDED SPAIN NEUTER PROGRAM FOR THE COUNTY AND I THOUGHT THAT WAS COOL AND WORTH MENTIONING. DID NOT KNOW THAT WAS A THING YOU COULD DO AND THEY SAID COVID KIND OF BACKLOGGED THEM AND THEY THOUGHT IT WAS GREAT, THOUGHT THEY WOULD BRING IT HERE AND THEN I FORGOT THERE WAS SOMETHING ELSE ON HERE, HILLTOP AND THAT FIRST ONE WAS AMAZING. THE 25,000 THE 25,001 , THE FIRST ONE . I REMEMBER THE JUDGE SAID JUST LET US STREAM AND IT WAS PERFECT AND WONDERFUL AND IT WAS EXPENSIVE.

THIS NEW ONE EVERYBODY HAS NOSTALGIA ON HILLTOP AND IT DOES NOT GIVE ENOUGH TO THE NEW GENERATION FOR THEM. I THINK THOSE ONES CAME LAST TIME AND MENTIONED THAT AND THAT'S IT.

>> VICTORIA HOLLAND. >> THANK YOU SO MUCH. I AM ALSO HERE TO TALK ABOUT THE PROPOSED RENOVATION OF THE HILLTOP FACILITY. LOOKING AT THE PLANS IT MIGHT BE ABOUT 1/3 OF IT THAT GETS RENOVATED AND IN ADDITION WHICH DEFINITELY IS NEEDED, BUT THEN IT LOOKS LIKE WE ARE LEFT WITH A LOT OF SPRAWLING SPACE , THE SAME PROBLEMS. AND THEN TO THE OTHER SIDE IT IS WIPING OUT $10 MILLION. THAT SEEMS TO WIPE OUT ALL OF THE ARPA FUNDS THAT ARE LEFT FOR DISTRICT 1, I COULD BE WRONG BUT THAT'S WHAT IT LOOKS LIKE. I LIVE IN DISTRICT 1 AND WE LOVE OUR PARKS. WE HAVE MAJOR DRAINAGE ISSUES. THERE ARE A LOT OF NEEDS WE HAVE AND I'M NOT SAYING THIS HILLTOP PROJECT CANNOT BE A GREAT PROJECT, BUT AT NO POINT WERE THERE ANY INFO SESSIONS. I DON'T THINK THERE IS COMMUNITY INVOLVEMENT. WE WANT TO BE INVOLVED, WE CARE ABOUT OUR COMMUNITY AND LOOKING AT THIS I FEEL LIKE IT DOES NOT SEEM COMMUNITY INTEREST OR INPUT WAS TAKEN INTO CONSIDERATION. CERTAINLY NOT OUR OTHER NEEDS. I DO KNOW THE PREVIOUS COUNTY JUDGE HAD A GRAND VISION AND I UNDERSTAND, IF THERE IS A SENSE OF DEEP LOYALTY TO THE PREVIOUS COUNTY JUDGE WANTING TO TRY TO BRING YOUR VISION TO PASS AND I'M CERTAINLY NOT GOING TO PUT DOWN THE INTENT OF ANYONE INVOLVED IN THIS, BUT WIPING OUT $10 MILLION POTENTIALLY ADDING ON MORE CERTIFICATES OF PUBLICATION FOR A PROJECT WHEN WE HAD MAJOR NEEDS IN DISTRICT 1, I JUST REALLY WISH WE WOULD HAVE MORE TRANSPARENCY AND MORE COMMUNITY INVOLVEMENT IN THIS AND I WISH THAT I UNDERSTOOD BETTER BY THIS PROJECT IS SO MUCH MORE IMPORTANT THAN OUR PARKS AND DRAINAGE ISSUES, THEN OTHER MAJOR OR SMALLER RENOVATIONS THAT COULD HAPPEN THAT COULD BE MORE COST-EFFECTIVE. YOU KNOW, AT THE END OF THE DAY, I THINK COMMISSIONER HERNANDEZ, I KNOW HE'S TRYING HIS BEST, ALL COMMISSIONERS HERE YOU ARE IN YOUR SEATS BECAUSE YOU CARE DEEPLY ABOUT YOUR COMMUNITIES AND TO WANT TO MAKE THIS WELCOMING AND WONDERFUL FOR EVERYONE WHO LIVES HERE. PUTTING ALL OF YOUR FUNDS INTO ONE BASKET THAT BENEFITS ONLY A VERY VERY SMALL PERCENTAGE OF YOUR DISTRICT AND LEAVES THE REST OUT TO DRY DOES NOT SEEM LIKE THE BEST SOLUTION AND I COULD BE WRONG BUT I WOULD LIKE TO BE PROVEN WRONG WITH MORE INFORMATION AND A CHANCE FOR THE COMMUNITY TO GET INVOLVED, THAT'S ALL I HAVE TO SAY,

THANK YOU SO MUCH. >>

>> HILLTOP PROJECT THE MEDIA COMMISSIONER HERNANDEZ SAID IF I CAN BE TRUTHFUL IT IS POLITICAL SEASON YOU HAD TWO FORMER COMMISSIONERS SITTING IN THE OFFICE WHO NEVER DID

[01:00:01]

ANYTHING FOR HILLTOP. FIRST OFF I'M NOT POLITICAL. MY BEING HERE IS NOT LYRICAL I'M NOT RUNNING AGAINST YOU. I AM HERE BECAUSE I TRULY CARE ABOUT THE PROJECT AND I AM A CITIZEN AND A VOTER. YOU WORK FOR US AND WE HAVE A RIGHT TO VOICE AN OPINION. IN THIS DAY AND TIME PEOPLE WANT TO BELIEVE A POLITICIAN REPRESENTING THEM, THEY WANT TO TRUST THE MEDIA BUT SO MANY DO NOT TELL THE TRUTH THAT'S ONE OF MY PET PEEVES, DISHONESTY. WHEN I HEAR SOMETHING THAT IS UNTRUE AND MISLEADING FROM A POLITICIAN I WANT TO SET THE RECORD STRAIGHT. WHEN IT CAME INTO OFFICE THE PREVIOUS COMMISSIONER HAD A COUPLE PROJECTS THAT WERE NOT COMPLETED AND THEY WERE GOOD PROJECTS ONE OF THEM WAS THE BOAT RAMP AT HAZEL BASE. THE OTHER ONE WAS AT THE FAIRGROUNDS. WE ALSO ADDED THINGS AT THE OFFICE MEMORIAL OUTSIDE OF THE COURTHOUSE THAT ENHANCED WHAT HAD BEEN DONE WITH THE PREVIOUS COURT THEY DID THAT AND WE NEEDED TO BECAUSE MONEY HAD BEEN SPENT THAT'S JUST A COURTESY. 70 COMMISSIONERS BEFORE HAVE DONE THE SAME THING BECAUSE GOVERNMENT TAXES TAKE TWICE AS LONG TO COMPLETE ANYTHING OUT OF COURTESY YOU DO IT. WHEN I LEFT, SEVERAL PROJECTS WERE COMPLETED BUT NOT ALL OF THEM AND ONE WAS HAZEL BAZEMORE , WE TOURED ON THE BATHROOM BUILT NEW ONES WITH NEW PLAYGROUND EQUIPMENT. MOORE WAS LEFT TO DO, THE DOG ARC AND SPLASH PAD. SO MANY OTHER THINGS AND HERNANDEZ, YOU COMPLETED THAT.

MOST OF IT HAS BEEN AND THAT'S WHAT YOU DO, THOSE PROJECTS WERE ALREADY ON THE TABLE. WHEN I GOT TO COMMISSIONERS COURT IT WAS MANDATED TO MAKE HILLTOP ADA COMPLIANT THE COURT DID THAT WITH NO CHOICE IT WAS RIDICULOUS MONEY SPENT WITH A BUILDING SOLD IT COST AND MORE AND WE TOURED ONE OF THE ROOMS AND FOUND ASBESTOS, RENOVATED AND IN THE PLANS THEY WERE PUT INTO PLACE TO EITHER RENOVATE OR BUILD A NEW BUILDING FOR HILLTOP THAT WAS A PROJECT ALREADY INTO PLACE WHEN YOU TOOK THAT SEAT. EVEN THE ARCHITECT WAS HIRED , HE UNDERSTOOD THAT THE BUILDING HAD SOME GOOD BONES AND WE COULD PROBABLY USE THE CONCRETE, BUT HE UNDERSTOOD THE BUILDING NEEDED TO BE TORN DOWN. IT WAS BASICALLY A PROJECT WITH A NEW BUILDING WITH PRESERVED INFRASTRUCTURE. COVID HIT WHEN WE WERE IN THE PROCESS SO IT MOVED VERY SLOW AND PRETTY MUCH SHUT US DOWN.

IT IS A SHAME SO MUCH TIME HAS PASSED WITHOUT ACTION BECAUSE IT ONLY DRIVES UP THE PRICE OF THREE YEARS NOW. EVEN IF YOU WERE TO USE 9 MILLION TO REMODEL YOU CANNOT DO IT ALL AND YOU HAVE A REMITTING STRUCTURE SITTING THERE AND IT WILL TAKE DECADES BEFORE YOU GET MONEY AGAIN BECAUSE THE COUNTY DOES NOT HAVE MONEY AND HAVE SO MANY PROJECTS TO BE DONE. THERE IS NO TELLING WHAT YOU WILL RUN INTO, THE PROBLEMS IN THAT BUILDING. IT ALWAYS TAKES MORE MONEY TO REMODEL. I HOPE YOU WILL THINK ABOUT THIS, THE CITIZENS DESERVE A NEW BUILDING, THEY DO. MAKE IT SMALLER, EASIER TO MAINTAIN, IT WILL BE ENERGY EFFICIENT WITH NO ACOUSTIC PROBLEMS, THE CEILINGS ARE EXTREMELY LOW. IT IS AN UGLY BUILDING I'M SORRY IT IS, YOU DON'T CONTINUE TO KEEP MONEY POURING MONEY INTO SOMETHING THAT DOES NOT WORK, YOU HAVE A VEHICLE THAT'S BROKE HEY, WE HAVE PROJECTS AT THE COUNTY TO BE DONE THAT WE THROW MONEY INTO , WE SHOULD'VE REPLACED BEFORE. THIS IS A DECISION FOR THE COURT THESE DO NOT BE STUCK IN THE PAST, IT'S A NEW GENERATION WHICH GIVES US MODERN OPTIONS, BE A FORWARD THINKER. I BELIEVE THERE ARE AT LEAST THREE OF YOU THAT REALIZE THAT AND YOU'LL MAKE THE RIGHT DECISION AND HOPEFULLY COMMISSIONER HERNANDEZ WITH THE TIME YOU HAVE LEFT YOU CAN GET NEW PROJECTS OF YOUR OWN TO DO AND EITHER YOU WILL COMPLETE THE MORE THE NEXT COUNTY

COMMISSIONER WILL. THANK YOU. >> THANK YOU. TRUDY MURPHY.

>> GOOD MORNING AND THANK YOU FOR INVITING ME COMMISSIONER GONZALEZ. I SAW ON THE NEWS THAT NUECES COUNTY SOCIAL SERVICES WILL BE CLOSED DUE TO MISUSE OF COVERT FUNDING AND I FELT I NEEDED TO SPEAK OUT I APPLIED TO SOCIAL SERVICE TWICE AND WAS DENIED BECAUSE I DO NOT QUALIFY THE FIRST TIME WAS 2021 BECAUSE MY SON WAS LIVING WITH ME AND DID NOT WANT TO CONTRIBUTE TO THE HOUSEHOLD EXPENSES SO I DID NOT QUALIFY.

THE WORKER AT SOCIAL SERVICES GAVE ME THE FLYER TO APPLY AND THIS IS THE ONE YOU CAN SEE I TOOK NOTES WHEN I WAS TALKING TO HIM. THIS WAS NOT OUR MONEY THE SECOND TIME WAS BECAUSE I RECEIVED ASSISTANCE DURING THE YEAR AND DID NOT QUALIFY, SOCIAL SERVICES DOES NOT HAND OUT MONEY TO ANYBODY , THEY ARE VERY STRICT. THEY ASK FOR A LOT OF DOCUMENTS TO MAKE

[01:05:01]

SURE YOU QUALIFY. I DON'T KNOW ANYBODY ELSE THAT HELPS WITH MORTGAGE ELECTRIC OR WATER LIKE THEY DO I BELIEVE SOCIAL SERVICES IS GETTING SET UP AND BECAUSE SOMEONE ELSE MESSED UP SOCIAL SERVICES WILL BE BLAMED AND THAT'S A JOKE. I SAW AN ARTICLE FROM 2021 SAYING THE CITY GOT 18 MILLION IN GRANTS TO HELP WITH RENT, ANYBODY WHO DEALT WITH SOCIAL SERVICES KNOWS IT IS NOT TRUE AND ANYBODY THAT NEEDS THE HELP SUCH AS US ELDERLY PEOPLE WILL HAVE NOWHERE TO GO TO TO GET ASSISTANCE LIKE IT IS PROVIDED AT SOCIAL SERVICES. OTHER AGENCIES IN TOWN OCCASIONALLY HAVE MONEY TO HELP BUT THEY RUN OUT OF FUNDS QUICKLY. SOCIAL SERVICES NOT INVOLVED THE PEOPLE ARE AWARE THEY ARE NOT INVOLVED. SHOULD NOT WORRY ABOUT SAVING FACE AND SHOULD MAKE IT PUBLIC AND NO THEY WERE NOT RESPONSIBLE FOR WHAT THE NEWS SAID. THE WHOLE SCENARIO IS AN OUTRAGE. RECONSIDER YOUR DECISION AND TAKE INTO CONSIDERATION ALL THE PEOPLE LOSING THEIR JOBS AND TO HELP YOUR TAKING AWAY FROM THE COMMUNITY. THANK YOU.

>> THANK YOU, I BELIEVE ONLINE WE HAVE BETTY CRANFORD.

>> YES MA'AM BETTY CRANFORD.

MIND HILLTOP COMMUNITY CENTER WE DO NOT NEED A TAJ MAHAL NOR DO WE NEED ANOTHER BUILDING SUCH AS THE FAIRGROUNDS OR COMMUNITY CENTER. THE EVENT CENTER NEEDS HAVE BEEN MET WITH FAIRGROUNDS , THE AMERICAN BANK CENTER. REFERENCING TEARING DOWN THE BUILDING HOWEVER THE STRUCTURE WAS CERTIFIED AS BEING STRUCTURALLY SOUND. I KNOW THAT $2 MILLION WAS PREVIOUS, $2 MILLION WAS PREVIOUSLY SPENT ON UPDATING FOR WHAT THE ADA , THE RAMP YOU HAD TO HAVE FOR COMPLIANCE, BATHROOMS AND A WALKING NATURE TRAIL THAT YOU USED WHILE CONSTRUCTED , THE TRAIL WAS AND IS A WASTE OF FUNDING AS IT IS NOT UTILIZED TO ITS POTENTIAL. YOU WILL HAVE TO ADDRESS THE DISPOSAL OF ASBESTOS WHEN IT IS RENOVATED WHY NOT KEEP THE CERTIFIED STRUCTURE NOT GOT IT AND TURN IT INTO A MODERN FACILITY. I WILL TELL YOU EXCELLENT TASTE BUT I KNOW HIM WELL AND HIS TASTES ARE EXQUISITE. HE WOULD TEAR DOWN, BUILD A SMALLER EXQUISITE BUILDING. IT WOULD BE BEAUTIFUL BUT NOT PRACTICAL TO MEET THE NEEDS AND USE OF CITIZENS. ONE ADDITION THAT'S LACKING WOULD BE A SPACE LARGE ENOUGH TO HOST A LARGE GROUP FOR MEETINGS, WEDDING RECEPTIONS, COMMUNITY AWARD CEREMONIES ET CETERA THIS IS WHAT I HOPE THAT COMMISSIONER CHESNEY WILL BE OUR CHEERLEADER AND WILL SUPPORT THE NEEDS OF CITIZENS AND BELIEVE ME I HAVE SPOKEN WITH MANY. IT IS MY HOPE YOU WILL BE ACTIVE BY SUPPORTING THE COMMUNITY CENTER WITH A CERTIFIED STRUCTURE OVER DEMOLITION. THE BUILDING HAS A HISTORY OF THE ENTIRE COMMUNITY COMING TOGETHER TO HELP STOCK THE HOSPITAL WITH EQUIPMENT AND SUPPLIES. LET'S NOT CHANGE THE PURPOSE OF THE BUILDING. IT IS A COMMUNITY CENTER. LET'S KEEP IT AS ONE AVAILABLE TO THE COMMUNITY AND AT AFFORDABLE COST, THANK YOU.

[1. Receive presentation on the role of Coastal Bend Disaster Recovery Group as it pertains to Nueces County.]

THE TIME TO DO THAT. I APPRECIATE IT.

>> NOW MOVING ON TO THE REGULAR AGENDA. WE HAVE A PRESENTATION ON THE ROLE OF COASTAL BEND DISASTER RECOVERY GROUP AS IT PERTAINS TO NUECES COUNTY. THIS WAS PERTINENT COMING INTO HURRICANE SEASON WE FELT IT WAS A GOOD TIME TO BRING THIS PRESENTATION. WE APPRECIATE ALL COMMUNITY PARTNERS AND THE HELP

THEY GIVE US AT THIS TIME. >> THANK YOU JUDGE AND COMMISSIONERS. WE ARE GETTING CLOSE TO HURRICANE SEASON AND WE ARE TOLD THIS WILL BE A VERY SERIOUS SEASON THIS YEAR.

I WANTED TO GET AROUND TO THE COUNTIES AND REMIND THEM WE HAVE A MOU WITH THE COUNTY, NUECES COUNTY AND WHAT WE DO .

MICROPHONE. >> AS YOU KNOW, COASTAL BEND COVERS 11 COUNTIES OF THE COASTAL BEND REGION AND THAT'S BECAUSE DISASTER DOES NOT STOP AT COUNTY LINES, TYPICALLY THE DISASTER WILL END UP COVERING MULTIPLE COUNTIES. NEXT SLIDE.

WHAT IS LONG-TERM RECOVERY? WE START AFTER FEMA CLOSES. IT CAN LAST 5 TO 10 YEARS, WE FOCUS ON LONG-TERM SOLUTIONS TO THE UNMET NEEDS OF SURVIVORS. IT REQUIRES THOUGHTFUL AND STRATEGIC PLANNING AND ACTIONS TO ADDRESS MORE SERIOUS AND PERMANENT IMPACTS OF THE DISASTER. IT IS INTENDED TO INCREASE RESILIENCY WITH THE COMMUNITY WHEN POSSIBLE SO AS YOU CAN SEE IN THIS DRAFT WHERE AT THE END OF THE CYCLE. NEXT SLIDE PLEASE. WHAT IS A UNMET NEED? A BASIC SAFE SANITARY AND SECURE NEED THAT IS DISASTER RELATED AND SURVIVOR IS UNABLE TO OBTAIN BECAUSE THEY LACK EITHER PART OR ALL THE RESOURCES TO OBTAIN THAT NEED. WHERE WE COMING IS AFTER YOU HAVE EXHAUSTED YOUR FEMA, INSURANCE, ALL OF THAT TYPE OF STUFF ALL OF THOSE THINGS YOU HAVE, WE ARE HERE TO HELP PEOPLE THAT LACK THOSE RESOURCES AND WOULD NOT RECOVER WITHOUT OUR HELP. THAT PICTURE I LIKE TO SHOW IS NOT DISASTER RELATED THAT'S WHAT WE CALL DIFFERENT MAINTENANCE. SO IN THAT PICTURE. SO WE WOULD NOT BE HELPING WITH DIFFERENT MAINTENANCE LIKE THIS. NEXT SLIDE PLEASE. WHO RECEIVES ASSISTANCE? CLIENTS INCLUDE HOMEOWNERS WHO ARE CONSIDERED LOW INCOME OR SOCIALLY VULNERABLE, THE ELDERLY, SINGLE HEAD OF HOUSEHOLD WITH MINOR CHILDREN, SOMEBODY DISABLED OR ON DISCHARGED VETERANS. WHERE DO WE RESPOND, THE RECOVERY GROUP ACTIVATES WHEN THERE IS A FEDERALLY DECLARED DISASTER AND INDIVIDUAL ASSISTANCE HAS BEEN APPROVED. SINCE 2015 WHEN WE STARTED WE RESPONDED TO THE FLOOD IN NUECES COUNTY COUNTY. HURRICANE HARVEY AND THE WINTER STORM FROM 2021.

NEXT SLIDE. JUST TO REMIND YOU OF THE IMPACT WITH HURRICANE HARVEY. WE WERE ABLE TO OBTAIN $54.7 MILLION IN TOTAL RESOURCES FOR OUR CLIENTS. 424 CLIENTS RECEIVED NEW HOMES AND THIS IS THE BREAKDOWN, 147 WERE CLIENTS THAT RECEIVED GEN. LAND OFFICE HOMES BUT WE BUILT ANYONE HOMES AND REPLACE 79 MANUFACTURED HOMES. ALL RIGHT NEXT SLIDE. SO WE JUST RECENTLY MOVED, WE WERE ON THE SHORELINE IN CORPUS CHRISTI JUST MOVED FROM THE OFFICE AND WE ARE IN WHAT WE CALL BLUE SKIES MODE WHICH MEANS THAT WE ARE WAITING FOR THE NEXT DISASTER. WE ARE A NONPROFIT, WE DON'T RECEIVE ANY GOVERNMENT FUNDING AND WE RELY ON GRANTS AND DONATIONS. SO I WOULD LIKE TO INTRODUCE ALEX GARCIA OUR BOARD PRESIDENT.

[01:25:09]

>> THANK YOU FOR ALLOWING TO BE ABLE TO SPEAK YOUR TODAY AS EVERYBODY KNOWS EVERYTHING WE SEE TODAY FROM ALL THE REPORTS THAT ARE OUT THERE IS THAT WE WILL HAVE A VERY ACTIVE HURRICANE SEASON, PROBABLY, FROM EVERYTHING WE HEAR FROM THE EXPERTS AND EVERYTHING WE ARE HERE TODAY WE ANTICIPATE PROBABLY 27 NAMED STORMS OF SOME SORT AND WHEN YOU BREAK IT DOWN THEY SAY YOU WILL PROBABLY HAVE EIGHT MAJOR STORMS. AS WE KNOW WE ARE IN THE CONE. THE REASON COASTAL BEND LONG-TERM RECOVERY AND WHAT WE HAVE DONE, WE HAVE A NONPROFIT ORGANIZATION WHEN YOU STEP UP TO THE PLATE AND SAY MY COMMUNITY HAS A DISASTER AT HAND WHERE CAN WE GO ON WHO MANAGES THOSE DOLLARS? WE HAVE BEEN ABLE TO SHOW YOU NOT ONLY TO THE EXISTENCE OF THE COASTAL BEND LONG-TERM RECOVERY THROUGH 501(C)(3) WE ARE ABLE TO RECEIVE DONATIONS, TAKE THOSE DOLLARS, WORK WITH OTHER ORGANIZATIONS WHO ARE PARTNERS IN THE ONE THING WE HAVE DONE IS COLLABORATE WITH THEM, THE MENNONITES HAVE BEEN PHENOMENAL. YOU SAW EARLIER HOW MANY HOMES WE HAVE BUILT AND HOW MANY FAMILIES ARE IN MOBILE HOMES. IT IS ABOUT HELPING THEM GET BACK ON THEIR FEET BECAUSE WE SERVE SO MANY DIFFERENT COUNTIES AND WE WERE NOT ONLY THERE DURING HURRICANE HARVEY WE WERE THERE IN THE PRIOR WINTER STORM AND WE WERE THERE WHEN WE HAD , DURING THE FREEZE WHEN WE HAD SO MANY RESIDENTS THAT WERE AFFECTED WITH PIPES. WE GET CALLS TO SAY WE HAVE VOLUNTEERS WILLING TO HELP AND LOVELY WE SERVE AS A CONDUIT TO BE ABLE TO SERVE COUNTIES IN NEED AND HOMEOWNERS IN NEED BECAUSE AT THE END OF THE DAY THAT'S THE RESPONSIBILITY AND REFILL VULNERABLE AND THEY FEEL VULNERABLE . I AM FORTUNATE I AM ABLE TO SERVE AS PRESIDENT OF THE LONG-TERM RECOVERY GROUP. AND WE ARE OUT TALKING TO ALL THE EMERGENCY MANAGERS AS YOU KNOW WE HAVE HURRICANE CONFERENCE COMING UP AND WE ARE PARTICIPATING IN THAT BECAUSE AT THE END OF THE DAY IT'S ABOUT PREPARATION AND MAKING SURE CONSTITUENTS UNDERSTAND THERE IS AN ORGANIZATION OUT THERE. I HAVE A COUPLE OF FLYERS I WILL HAVE DISTRIBUTED, IT SHOWS YOU YOUR DONATION IS AN INVESTMENT TO OUR RESILIENCY AND WE CANNOT THANK YOU ENOUGH FOR LISTENING TO US AND WE WILL BE BACK TO TELL EVERYBODY HOW TO PREPARE. MAKE SURE YOU HAVE THE ESSENTIALS AND WE CANNOT THANK YOU ENOUGH. ALWAYS LOOKING FOR SUPPORT, WE KNOW WHEN IT'S BLUE SKIES IS THE HARDEST TIME TO RAISE FUNDING, BUT WE ALSO UNDERSTAND THE IMPORTANCE OF EXISTENCE SO WE RECOUNT ALL REGIONAL COUNTIES.

>> JUST TO CLARIFY FOR LISTENERS OR ANYONE ELSE I KNOW THOSE DONATIONS ARE CRITICAL FOR US TO ENABLE US TO HELP OUR CITIZENS. THE MONEY THAT COMES IN FOR NUECES COUNTY WHEN YOU SAY YOU SUPPORT ALL SURROUNDING THAT MONEY STAYS IN NUECES COUNTY ?

>> YES MA'AM. WE EARMARKED IT SO WE UNDERSTAND THE DONOR DOLLARS GO TO WHERE THEY ARE INTENDED.

>> JUST WANTED TO BE CLEAR FOR DONORS, IN THE FUTURE IF YOU

THINK OF DOING SOMETHING. >> ABSOLUTELY. IF ANYBODY WANTS TO VOLUNTEER. WE HAD OVER $4 MILLION WORTH WHEN YOU DO LABOR AND VOLUNTEER HOURS AND THAT'S HOW MANY HOURS WE WERE ABLE TO MANAGE TO GET THESE BUILT AS AN ORGANIZATION.

THEY REACHED OUT TO US AND WORK IN COLLABORATION WITH THEM WE ARE ABLE TO MAKE THOSE THINGS HAPPEN. IF YOU HAVE NOT SEEN ONE OF OUR HOMES YOU'RE MISSING OUT. WE WILL GIVE YOU INVITES SO YOU CAN SEE THE WORK WE HAVE DONE AND WHEN WE ARE OUT THERE, WHEN YOU'RE LOST EVERYTHING IN YOUR DEVASTATED WITH NOWHERE TO TURN IT'S IMPORTANT TO HAVE AN ORGANIZATION THAT CONTINUES TO EXIST TO BE ABLE TO KNOW THAT WE ARE HOPE FOR YOU. SO AT THE END OF THE DAY WE CANNOT THANK YOU FOR YOUR SUPPORT ENOUGH, LIKE I INDICATED THERE IS A SCAN CODE ON HERE IF YOU WANT TO DONATE OR MAKE ANY CONTRIBUTIONS , THE GOAL IS TO CONTINUE TO EXIST AND BE THERE THE NEXT DISASTER WHICH WE KNOW WILL HAPPEN SOONER OR

LATER. >> IT IS NOT IF IT IS WHEN.

THANK YOU VERY MUCH WE APPRECIATE THE COLLABORATION BETWEEN EMERGENCY MANAGEMENT, THE HURRICANE CONFERENCE AND ALL THE WORK YOU DO FOR THIS COUNTY MUCH LESS THE SURROUNDING COUNTIES AS WELL, THANK YOU VERY MUCH.

>> THANK YOU. >> I WOULD LIKE TO REMIND YOU THE DBDRG WAS STARTED THROUGH JUDGE NEIL AND DANIELLE HALE WHEN SHE WAS EMERGENCY MANAGER. IT IS VERY DIFFICULT WHEN YOU HAVE A DISASTER WHEN YOU OF ALL THE PEOPLE WHO WANT TO DONATE AND HELP OUT TO HAVE AN ORGANIZATION LIKE THIS TO WHERE THEY CAN HANDLE IT FOR US. WE HAVE A MOU WITH THEM SO WHEN WE HAVE THE DISASTER WE HAVE EVERYTHING IN PLACE. ONE OF THE NICE THINGS IS THROUGH THAT MOU IT GIVES US

[01:30:01]

PERMISSION TO GIVE THEM NAMES OF THE FEMALE PEOPLE IN NUECES COUNTY SO THEY CAN CONTACT THEM AND HELP THEM OUT THROUGH THE MONIES THAT WE RAISE THROUGH THE CBDRG NONPROFITS. VERY IMPORTANT ORGANIZATION FOR THE COUNTY.

>> THANK YOU AND THANK YOU FOR SERVING. APPRECIATE THE

[2. Discuss and consider approval of an interlocal agreement between Nueces County, Nueces County Drainage District #2 and the City of Robstown on Precinct 3 American Rescue Plan act (ARPA) project for improvements to the Bridge at County Road 44 and all related matters. ]

UPDATE. MOVING ON ITEM NUMBER TWO. DISCUSS AND CONSIDER APPROVAL OF INTERLOCAL AGREEMENT BETWEEN NUECES COUNTY, NUECES COUNTY DRAINAGE DISTRICT AND THE CITY OF ROB'S TOWN. COMMISSIONER MAREZ THIS IS YOUR PROJECT .

>> YES JUDGE. A LITTLE BIT OF BACKGROUND. HARD TO IMAGINE WE HAD ANY RAIN EVENTS WITHIN THE LAST YEAR OR SO THAT WERE STRONG ENOUGH TO WASH OUT A COUNTY ROAD BRIDGE. ONE WAS COUNTY ROAD 44 JUST WEST OF BUSINESS 77 AND THAT IS LOCATED JUST INSIDE MY PRECINCT. BUT, THE PROBLEM CAME OUT THAT THIS BRIDGE WHICH IS A SMALL SPAN BRIDGE TYPICALLY THE WOODEN OR SMALL CONCRETE BRIDGES, NOTHING LIKE THE HARBOR BRIDGE . THIS BRIDGE WAS WASHED AWAY. IT IS A DUAL OWNED BRIDGE BETWEEN NUECES COUNTY DRAINAGE DISTRICT 2 AND THE CITY OF ROB'S TOWN. EVERYONE IS STRAPPED FOR CASH AND IT'S DIFFICULT TO BE ABLE TO FUND EVEN WHAT YOU THINK IS THE MOST BASIC OF PROBLEMS. THEY HAD THE ISSUES WE HAD THE FUNDING THROUGH ARPA SO THIS IS JUST REALLY MOVING FORWARD ON THIS ITEM . AND SO I ASKED FOR THE COURT'S SUPPORT TODAY TO PROVE THIS INTERLOCAL AGREEMENT BETWEEN THE COUNTY DRAINAGE DISTRICT 2 AND CITY OF ROB'S TOWN USING ARPA FUNDING ALLOCATED TO MY PRECINCT FOR IMPROVEMENTS TO THE BRIDGE ON COUNTY ROAD 44 AND THAT IS MY MOTION.

>> SECOND. >> EMOTION AND A SECOND AND A THIRD. ALL THOSE IN FAVOR SAY AYE. ANY OPPOSED TO SAME SIGN.

>> WE AGREE SHE IS ESSENTIAL.

>> NO COMPLAINTS FROM ANY OF US. ITEM NUMBER FOUR, COMMISSIONER MAREZ AMERICAN RESCUE PLAN ACT FUNDS FOR THE BOYS AND GIRLS CLUB IS AN UPDATE WITH NO ACTION ON HERE.

PLANNED TO GET ALL THE ARPA PROJECTS LINED UP IN THIS MEETING AND SOME HAVE BEEN DELAYED SLIGHTLY. WANTED TO GET A FURTHER BUY-IN FROM THE CITY OF ROB'S TOWN. THIS IS A ROB'S TOWN BUILDING ONCE AGAIN A NEED FOR FUNDING. THERE IS PROGRAMMING INCLUDED THAT BENEFITS THE COMMUNITY AND I KNOW LOOKING AT ST. EDWARD WE HAVE THE ASKED WHICH IS

EMERGENCY SERVICES. >> WE USED THAT TO GIVE VACCINATIONS AND TESTING AND USED IT FOR COOLING WARMING IN CONJUNCTION WITH THE CITY AND PARTNERS IN THE CITY.

>> THAT WOULD HELP ALLEVIATE USING THE FACILITY AT THE ORTIZ PARK. OR THE FAIRGROUNDS.

>> THERE IS NO ACTION. >> JUST AN UPDATE WE ARE WAITING FOR COUNCIL TO KIND OF FINALIZE AND I WAS TOLD EARLIER TODAY THEY ARE MOVING FORWARD WITH SUPPORT OF THIS SO I THINK WE WILL HAVE IT BY THE NEXT WEEK EVERYTHING WILL BE SUPPORTED BY THEIR COMMUNITY AND WE HAVE THE FUNDING SOURCE TO HELP REHABILITATE THE BUILDING AND PROGRAMMING

[5. Receive update on American Rescue Plan Act (ARPA) fund balances for individual precinct and county wide projects through March 31, 2024 from Grants Administration.]

HOPEFULLY WITHIN THE YEAR. >> ITEM NUMBER FIVE RECEIVE UPDATE ON THE AMERICAN RESCUE PLAN ACT ARPA FUND BALANCES FOR THE INDIVIDUAL PRECINCTS COUNTY JUDGE AND COUNTYWIDE PROJECTS. AND THIS IS JUST AN UPDATE WITH NO ACTION ON THIS

SO THANK YOU FOR BEING HERE. >> OF COURSE, HAPPY TO BE HERE.

GOOD MORNING. FIRST I WAS GOING TO COVER SOME

[01:35:02]

INFORMATION THAT WE HAVE LEARNED FROM THE TREASURY. AND THEN WE WILL GO OVER SOME BALANCES FOR THE PROJECT THAT GRANT WORKS IS HELPING TO MANAGE. AND THEN LULU HAS SOME THINGS TO GO OVER, AS WELL. SO, FIRST OFF TREASURY HAS RELEASED SOME NEW INFORMATION. THAT IS REALLY HELPFUL. SO, AFTER THE DECEMBER 31 AFTER THE DECEMBER 31, 2024 OBLIGATION DEADLINE , COUNTIES HAVE THE OPTION TO RECLASSIFY EXCESS FUNDS FROM ONE ELIGIBLE PROJECT TO ANOTHER. SO A GOOD EXAMPLE IN THIS CASE WOULD BE IN THE NATIONAL ASSOCIATION OF COUNTIES THEY HAVE SHARED THESE EXAMPLES IN A PRESENTATION. SO I AM JUST HIGHLIGHTING THEM.

ONE OF THE EXAMPLES WAS A COUNTY ALLOCATED FUNDS TO SURFACE TRANSPORTATION PROJECT THAT WAS UNDER BUDGET , THEREBY FREEING UP PREVIOUSLY OBLIGATED FUNDS. SO IF WE HAVE A PROJECT THAT COMES IN UNDER BUDGET AND WE HAVE MORE MONEY LEFT OVER, WE CAN THEN PUT FUNDS OVER TO AN ONGOING PROJECT AFTER THE

OBLIGATION DEADLINE. >> THE PROJECT HAS TO BE COMPLETED SO WE MAKE SURE THEY ARE EXCESS OR JUST AFTER IT GOES OUT TO BID AND WE HAVE EXCESS FUNDS?

>> THERE ARE SOME EXCEPTIONS. SO, IT WOULD BE , I DON'T THINK THAT THE PROJECT WOULD HAVE TO BE ABSOLUTELY COMPLETED. BUT, IF, SO FOR ALL THE PROJECTS WE HAVE TO HAVE THAT CONSTRUCTION CONTRACT. SO, IF THERE IS MAYBE A CONTINGENCY THAT DOES NOT GET USED UP, ANY SORT OF FUNDS THAT ARE LEFT OVER, THEN AT THAT POINT YOU CAN MOVE OVER TO ANOTHER ELIGIBLE PROJECT. ANOTHER EXAMPLE THAT THEY ALSO HIGHLIGHTED WHICH WAS USEFUL. AN AUDITOR AND COUNTY 2024 SINGLE AUDIT IDENTIFIES A PROJECT IS NOT ELIGIBLE. THE COUNTY MAY WITHDRAW FUNDS FROM THE PROJECT AND RECLASSIFY THE FUNDS TO WORKFORCE TRAINING THAT THE COUNTY INITIALLY HAD BEEN FINANCING WITH LOCAL FUNDS. BUT IT IS ELIGIBLE UNDER SLFRF. THE CITY CAN USE EXCESS FUNDS TO FINANCE THE PROGRAM SO LONG AS THEY INCUR OBLIGATION BY ENTERING INTO A CONTRACT BY THE DEADLINE DECEMBER 31, 2024. SO THERE ARE SOME FLEXIBILITIES HERE WITH THIS CLARIFICATION.

>> CAN ASK JUDGE? SO I NEED TO DIG INTO THAT A LITTLE BIT MORE. FOR THE MAJORITY OF THE TIME WE HAVE ARPA FUNDS FOR THIS YEAR THIS COURT WAS TOLD AS LONG AS IT SPENT BY 26 WE ARE GOOD. AND THEN LO AND BEHOLD SHORTLY AFTER THE FIRST OF THE YEAR WE WERE TOLD EVERYTHING HAS TO BE UNDER CONTRACT BY THE END OF 2024. I KNOW YOU'RE DOING CLARIFICATION. SO THAT DOES NOT REALLY MAKE AND I'M NOT SAYING THERE'S LOGIC IN EVERYTHING THAT'S DONE IN LIFE BUT THAT DOES NOT REALLY MAKE SENSE BECAUSE, THAT IS A TWO-YEAR DIFFERENCE. SO, I COULD SEE IF THEY SAID YOU HAVE TO HAVE UNDER CONTRACT BY THE END OF 25 AND SPEND BY 26 MAY BE, BUT TO HAVE A TWO-YEAR GAP , HOW DO WE GET SOME EQUIVOCAL SOMETHING LIKE HAS A COUNTY ATTORNEY REVIEWED THIS? BECAUSE IT HAS REALLY MADE US ALL SCRAMBLE IN A MODE WE DID NOT ANTICIPATE. I'M NOT TRYING TO SPEAK FOR EVERYBODY ELSE BUT I HAVE HEARD RUMBLINGS. WE ARE ALL SITTING THINKING WE HAVE THE END OF 2026 TO GET IT DONE AND ALL OF A SUDDEN THE END OF 24 AND I HAVE THREE PROJECTS I AM SWEATING BECAUSE OF THE DEADLINE AND I WANT TO MAKE SURE THE DEADLINE IS HARD BECAUSE I'M NOT GOING TO LET UP ON MY PROJECTS, BUT IT IS JUST HARD FOR ME TO UNDERSTAND WHY THEY WOULD SAY IT HAS TO BE IN CONTRACT 2024 AND NOT HAVE TO BE SPENT UNTIL THE END OF 26 BECAUSE A LOT OF PROJECTS CAN BE DONE IN SIX MONTHS. SOME OF THE ONES I'M WORKING ON AND THE OTHER COMMISSIONERS AND JUDGE. SO HOW DO WE GET A LEGAL OPINION OR SOMETHING THAT SAYS ABSOLUTELY YOU KNOW WHAT DO WE DO HERE? BECAUSE IT'S HARD

FOR ME TO BUY THIS. >> THE GUIDANCE, I THINK THEY WOULD AGREE IS NOT CLEAR THAT MAYBE BY DESIGN OR MAYBE THEY

[01:40:07]

ARE DEALING WITH , YOU KNOW VARIOUS STATES WITH VARIOUS LAWS SO THEY ARE INTENTIONALLY NOT CLEAR, I DON'T KNOW. BUT WE HAVE SEEN THE SAME UPDATE , WE ARE IN THE SAME SPOT. WE ARE CONSTANTLY TALKING WITH BOAT DEALING WITH THAT VAGUE GUIDANCE.

>> READ THE RULE AGAIN THAT SAYS WE HAVE TO HAVE A CONTRACT OR READ THE GUIDANCE OR CLARIFICATION OR WHATEVER

PLEASE. >> THE CLARIFICATION IS THAT COUNTIES HAVE THE OPTION TO RECLASSIFY EXCESS FUNDS FROM ONE ELIGIBLE PROJECT TO ANOTHER ONE.

>> WEARS THE THING THAT SAYS WE HAVE TO HAVE IT UNDER CONTRACT BY THE END OF 24. THAT'S WHAT I WANT TO SEE.

>> I CAN GET YOU A SCREENSHOT OR SHOW YOU IN THE FINAL RULE WHERE IT SAYS THAT. THERE ARE A FEW THINGS THAT ARE VERY DIRECT IN THE FINAL RULE AND THAT'S ONE OF THEM. THIS DEADLINE OF HAVING IT UNDER CONTRACT. I WOULD BE HAPPY TO

GET IT TO YOU. >> IF YOU COULD AND THE WHOLE COURT THAT HAS PUT US IN A BIND AND , YES AND IF YOU COULD SNAG NOT BEFORE THE END OF THE MEETING BECAUSE I WOULD LIKE TO SEE IT WHILE WE ARE SITTING HERE AND I'M SURE EVERYBODY WOULD. I'M NOT GOING TO PUT WORK INTO THAT PREMISE, BUT.

>> PREVIOUSLY TOLD IT WAS UNDER OBLIGATION IF WE OBLIGATED BY COURT AUTHORITY NOW WE SAY WE HAVE TO SIGN A CONTRACT. SO IS THAT DEFINITIVE IS WHERE THE QUESTION IS.

>> WHEN DID THAT CLARIFICATION, WAS THAT A ROW THAT WAS OUT FOREVER IN THIS AND WE WERE NOT TOLD THE RIGHT

INFORMATION? >> SINCE 2022 IS ON THE FINAL

RULE WAS PUT OUT. >> THAT WAS PUT OUT AS FINAL RULE IN 2022. AND WE JUST GOT NOTIFIED AND I KNOW WE CHANGED CONTRACTORS FOR REASONS AND THAT MIGHT BE ONE REASON. OKAY, YEAH. IF YOU COULD GIVE ME THAT, THAT WOULD BE GREAT.

>> OF COURSE, JESSICA JOHNSTONE IS ON ZOOM. JESSICA, CAN YOU SCREENSHOT AND PULL THAT FROM THE FINAL RULE?

>> YES, ABSOLUTELY. IF YOU CAN HEAR ME OKAY. I DON'T KNOW THE RULES IF I CAN JUMP IN, I WILL. I AM AT MY DESK. I WILL SEND YOU AN EMAIL OR PUT IT IN THE CHAT. IT'S GOING TO BE A LOT OF INFORMATION BUT I CAN TRY TO TAKE SOME EXCERPTS.

SOMETHING DEFINITIVELY THAT SAYS THAT AND IF YOU CAN SEND THAT TO EVERYBODY ON THE COURT THAT WOULD BE GREAT.

>> YEAH, ABSOLUTELY. I'M GOING TO INCLUDE FAQS AND WORTH NOTING THIS IS A LARGE DOCUMENT THEY HAVE BEEN UPDATING SINCE 2021 PERIODICALLY.

>> YEAH, DON'T SEND ME THE WHOLE UPDATE, JUST THE HIGHLIGHTED VERSION. I DON'T WANT TO 100 PAGES. JUST WHATEVER IT IS THAT SAYS WE HAVE TO BE UNDER CONTRACT TO

THE END OF 24. THANK YOU. >> OKAY THAT WILL BE EASY. CAN I SEND IT TO EVERYONE ON THE COURT SINCE WE ARE ALL?

>> MAY BE BLIND COPY EVERYONE SO THERE'S NO PROBLEM WITH

REPLY ALL. >> OKAY YOU GOT IT, THANK YOU.

>> SPEAK INTO THE MICROPHONE.

>> THE QUESTION WAS DOES IT HAVE TO BE AN EXISTING PROJECT OR CAN IT BE A NEW PROJECT? IT WOULD HAVE TO BE EXISTING, IT WOULD HAVE TO BE AN EXISTING OBLIGATION AS OF

DECEMBER 31, 2024. >> SO, WE HAVE GOT , SO WHAT WE WILL APPROVE TODAY IS THE JUDGE PROJECT OVER THERE AT HILLTOP, THE PARK PROJECTS. SO WE HAVE $3 MILLION WORTH OF WHAT WE'RE GOING TO COVER. WE HAVE ANOTHER $400,000 WORTH OF ASK. WITH ANOTHER PROJECT FAILS TO MAKE IN 25 TO GIVE US

THE MONEY. WE CAN TAKE THAT. >> IF THE COURT , THEY WOULD HAVE TO VOTE ON THOSE, YES. THAT'S JUST AN EXAMPLE. WE

ARE NOT ASKING FOR THAT NOW. >> OKAY.

[01:45:02]

>> OKAY GREAT. OKAY SO I WAS GOING TO TALK QUICKLY ABOUT THE PROJECTS THAT GRANT WORKS IS HELPING TO MANAGE AND SOME OF THE UNALLOCATED FUNDS CURRENTLY. JESSICA AND I HAVE BEEN WORKING CLOSELY WITH LULU AND ANNA WHO ARE FANTASTIC AND WE LOVED WORKING WITH THEM. WE HAVE DECIDED IT MAY BE BEST IF WE SET A DEADLINE TO ALLOCATE FUNDS TO CERTAIN PROJECTS. 'S WE HOPING TO SET THE DEADLINE MAY 8 FOR THE COURT. SO IF JUDGE AND COMMISSIONERS, IF YOU COULD GET ALL LOCATIONS OR UNALLOCATED FUNDS ALLOCATED FOR THE MAY 8 COURT THAT WOULD BE HELPFUL SO WE CAN THEN MOVE FORWARD AND GET THESE PROJECTS ROLLING BEFORE THE DEADLINE. IF WE COULD MOVE FORWARD WITH THAT, THEN AFTER MAY 8, ANY UNALLOCATED FUNDS WOULD BE BEST TO BE PUT INTO ONGOING PROJECTS AT THAT POINT.

>> DIDN'T WE HAVE JUNE , DID WE TALK ABOUT JUNE BEFORE? BECAUSE WE HAD OR MAY EIGHT IS FINE BECAUSE I KNOW THE PROCUREMENT PROCESS AND MICHAEL TOLD US THAT WOULD BE

CUTTING CLOSE. >> WANTED IT BY AUGUST, OR.

WITH THE DESIGN AND EVERYTHING BECAUSE OF THE CONTRACTING.

>> TO CLARIFY, MY REQUEST WAS THAT I HAVE APPROVED PLANS AND SPECS AND PERMISSION TO BID BY THE BEGINNING OF AUGUST SOAKING OF THE BIDS OUT ON THE STREET AROUND THREE WEEKS TO ONE MONTH IF NECESSARY AND THEN COME BACK FOR CONDITION SELECTION AND SELECT AND EXECUTE THE CONTRACT BEFORE

THANKSGIVING. >> SO THIS WOULD HELP IF WE HAVE IT DONE BY MAY 8 TO HELP GET US TO THE DEADLINE ON YOUR

BEHALF AS WELL. >> AS LONG AS I GET PLANS AND APPROVAL TO BID I WILL GO WITH THAT.

>> OKAY WE CAN SHOOT FOR THAT DATE. NO PROMISES.

>> ARE YOU JUST REFERRING TO THE BALANCES FOR EACH QUART

MEMBER ALLOCATED? >> YES.

>> SO THAT MAY EIGHT DATE WOULD HELP , IN THAT ASPECT WITH BIDDING BECAUSE SOME OF THE PROJECTS, WE STILL NEED WORK AUTHORIZATION FOR ENGINEERS AND ENGINEERS NEED TIME TO WORK ON DESIGN AND MICHAEL NEEDS ALL OF THAT IN ORDER TO COMPLETE HIS BID PACKET. SO, HOPEFULLY IF WE CAN SHOOT FOR MAY 8 THAT WOULD BE AMAZING, BUT IF WE SPILL INTO JUNE AS LONG AS WE HAVE THE DEADLINE IN MIND THAT WOULD

BE GREAT. >> WE NEED TO MAKE EMOTION AND PASS SOMETHING WE CAN LIVE WITH.

>> THERE IS NO ACTION ON THIS. CAN WE MAKE EMOTION ON DOING

THAT? >> OR WE COULD GO BACK TO A RELATED ITEM THAT DOES HAVE ACTION . JUST A MATTER OF GETTING DEADLINES IN PLACE THAT WE CAN ALL AGREE TO SO WE CAN

DO IT. >> IF WE CAN DO IT I'M GOOD.

>> I THINK THE COURT CAN CERTAINLY DISCUSS PUTTING SOME DATES TOGETHER, BUT THIS PARTICULAR ITEM IS NOT AN ACTION ITEM. THE PREVIOUS ITEM.

>> WE HAVE MORE COMING UP ON ARPA FUNDS SO WE CAN DO WHEN

ONE OF THOSE COME UP. >> I WILL WAIT AND SEE IF SOMETHING THAT IS GERMANE COMES UP.

>> I HAVE ONE. >> ARE YOU USING THE NEXT WITH

ARPA FUNDS? >> GO AHEAD, SORRY.

>> NO PROBLEM AT ALL. SO I'M JUST GOING TO TALK THROUGH THE

UNALLOCATED. >> COUNTYWIDE NOT THE INDIVIDUAL? YOU HAD MEETINGS WITH US INDIVIDUALLY SO IS THIS

COUNTYWIDE? >> I CAN GO THROUGH ALL OF THEM IF YOU WOULD LIKE OR THE COUNTYWIDE. WE TRY TO HAVE MONTHLY MEETINGS WITH EACH TO TALK TO PROJECTS WHICH HAVE BEEN SO HELPFUL, SO THANK YOU FOR MAKING TIME FOR THAT. SO, COUNTYWIDE ACTUALLY AS FAR AS GRANT WORKS MANAGING PROJECTS WE HAVE THE THREE PARKS. ORTIZ, ARMISTEAD VETERANS, HAZEL BAZEMORE . NATURE STORYTIME WALKING TRAIL WHICH PUT IN SOME MONEY FOR THAT. THE MENTAL HEALTH RESTORATION , THE MEDICAL EXAMINER OFFICE RENOVATIONS. JAIL AND COURT

[01:50:04]

SEWER AND ROOF. ALTHOUGH THOSE PROJECTS, WE HAD NO MORE UNALLOCATED. SO THOSE PROJECTS TOOK ALL THAT MONEY. BUT, WE DO HAVE SOME FOR EACH COMMISSIONER AND THE JUDGE IF YOU GUYS WOULD LIKE FOR ME TO GO THROUGH THAT. SO, PRECINCT 1 WE HAVE $22,423 UNALLOCATED. I WANT TO PREFACE. I KNOW THERE HAS BEEN SOME CONVERSATION AND YOU KNOW WE WILL PUT MONEY HERE, WE'RE GOING TO PUT MONEY THERE. UNTIL IT GOES TO COURT, I'M NOT UPDATING THE SPREADSHEET AND LULU DOES NOT UPDATE THE DATABASE THAT LOOKS LIKE THIS.

I THINK YOU HAVE THAT. SO KEEP THAT IN MIND. KEEP THAT IN MIND. WE DO KEEP NOTE OF WHEN WE HEAR IF THINGS WILL BE MOVING AROUND. OKAY, SO PRECINCT 2. WE HAVE THE UNALLOCATED AMOUNT AS $396,594. AND WE DO HAVE AN ITEM IN THE COURT TODAY FOR ALLOCATION TO THE COMMUNITY CENTER. AND THEN PRECINCT 3, WE HAVE 1,000,997 138 .

>> WHAT IS IT? >> 2.172 UNALLOCATED.

>> SO I THINK WE ARE NOT MANAGING SOMETHING BECAUSE

THIS ONE DID NOT. >> HE'S WORKING ON SOME PROJECTS THAT HAVE NOT COME TO COURT BUT HE HAS SEVERAL THINGS

MOVING. >> YES YOU DO, YES.

>> WE HAVE SOME TOO, BUT THAT'S FOR LATER.

>> OKAY AND THEN PRECINCT 4. COMMISSIONER CHESNEY, WE HAVE $210,000 . JUDGE SCOTT, WE HAVE 47,628 $47,628 AND YEAH.

ANY QUESTIONS? ABOUT ANY OF THAT? DID YOU WANT TO TALK ABOUT, THERE WERE SOME OF THE PROJECTS THAT NEED TO BE MOVED. THAT WE ARE NOT MANAGING. DO YOU WANT TO TALK

ABOUT THESE? >> GOOD MORNING.

>> I PROVIDED A LIST OF PROJECTS CURRENTLY THAT MIGHT BE HAVING A REMAINING BALANCE THAT ARE UNDER COUNTYWIDE

CORRECT. >> ADDITIONAL FUNDS POSSIBLY TO

ADD. >> CORRECT.

>> THIS IS 982,927? >> CORRECT.

>> THERE MIGHT BE SOME TINY LINGERING AMOUNTS, I THINK THERE IS 3000 OR $6000 REIMBURSEMENT THAT WE RECEIVED FROM THE CITY OF CORPUS CHRISTI. I BELIEVE YOU HAVE

MORE INFORMATION ON THAT? >> WE GOT REINVESTMENT FROM THE CITY OF CORPUS CHRISTI FOR THE HEALTH DEPARTMENT PREMIUM PAY.

THERE ARE TINY AMOUNTS THAT CAN BE REALLOCATED.

>> IT CAN BE HANDY COME AUGUST AND POSSIBLY AFTER CONTRACTS COME IN, IF THERE IS A DISCREPANCY WITH THE BIDS COMING OVER THAT COULD BE SOMETHING WE UTILIZE AND I KNOW WE HAVE ONE PROJECT WAITING THAT WE WANT TO DO COUNTYWIDE AND ANOTHER THAT POSSIBLY THE OTHER JAIL ROOF WE TALKED

ABOUT HERE. THOSE THINGS. >> I DO WANT TO PUT IT OUT IN CASE WE COME TO THE WIRE AS FAR AS CONSTRUCTION IS CONCERNED.

WE CAN USE COOPERATIVE AGREEMENTS AND PROGRAMS TO DO CONSTRUCTION, BUT THEY HAVE TO MEET FEDERAL REQUIREMENTS

AS WELL. >> IS THAT LIKE MASTER SERVICE OR DIFFERENT COOPERATIVE AGREEMENTS? THAT DOESN'T REQUIRE ? INTO THE MICROPHONE PLEASE. EVERYBODY ELSE CAN I

[01:55:01]

HEAR YOUR. >> THE ONES THEY RECOMMEND ARE TIPS FOR THE HOUSTON AREA SO THOSE ARE PROCUREMENT BOARDS.

THOSE ARE THE ONES THEY RECOMMEND. BECAUSE OF TRANSPARENCY WITH ARPA SO THEY HAVE A LOT OF ARPA LANGUAGE IN

THAT BIDDING. >> CAN I ASK SINCE WE'RE TALKING ABOUT THESE I DON'T WANT TO GET OFF THAT TOPIC IS GOING TO SWITCH TO ANOTHER. OKAY CAN YOU TELL ME REAL QUICK WHERE WE ARE SINCE WE'RE TALKING ABOUT ARPA FUNDS ON

THE POOL REBID. >> WE SHOULD BE REBIDDING

MONDAY. >> IT IS OPEN FOR 30 DAYS?

>> IN THIS CASE 30 DAYS SO WE HAVE MORE TIME, LAST YEAR WE WENT TWO WEEKS NOW WE ARE GOING 30 DAYS.

>> BUT THAT IS READY TO GO? >> READY TO GO. WE HAVE INTERESTED PEOPLE THAT ARE ASKING ABOUT IT.

>> I WOULD HOPE SO. THAT'S A GOOD PROJECT. OKAY. YEAH, THAT'S ONE OF THOSE I AM KIND OF SWEATING, TIMEWISE LIKE

EVERYBODY ELSE. >> OKAY, THANK YOU. IS THAT ALL YOU HAVE FOR US ON THE UPDATE? THANK YOU.

>> WE WERE LOOKING TO SEE IF YOU HAVE QUESTIONS , WE HAVE BEEN WORKING DILIGENTLY ALTOGETHER. IT HAS BEEN A PLEASURE TO WORK WITH EVERYBODY. THANK YOU FOR HAVING US. IF YOU HAVE ANY QUESTIONS, MY CELL PHONE NUMBER IS ON MY EMAIL, FEEL FREE TO CALL ME. AND YES IT HAS BEEN

GREAT TO WORK WITH YOU GUYS. >> THANK YOU. WE HAVE MET WITH

[6. Discuss and consider amending the Work Authorization No. 1 from $67,232.00 to $105,492.00 for the New Driscoll Community Center project.]

YOU AND I'M CERTAIN WE WILL HAVE ANY MORE MEETINGS. THANK

YOU VERY MUCH. >> THANK YOU. MOVING ON, ITEM NUMBER SIX DISCUSS AND CONSIDER AMENDING WORK AUTHORIZATION NUMBER ONE FROM 67,232, 210 5492. FOR THE NEW DRISCOLL COMMUNITY CENTER. THIS IS PRECINCT 1,

COMMISSIONER HERNANDEZ. >> COMMISSIONER GONZALEZ

PRECINCT 2. >> I CANNOT HEAR YOUR.

>> CAN YOU SPEAK INTO THE MICROPHONE, I'M SORRY.

>> YES. AGREED TO PUT IN EXTRA FUNDING FOR DRISCOLL BUILDING OUT THERE FOR THE SENIOR CITIZENS.

>> NUMBER SIX AND SEVEN ARE BASICALLY ON THE NEW DRISCOLL COMMUNITY CENTER PROJECT TOGETHER.

>> COMMISSIONER GONZALEZ DOES NOT HAVE TO HELP WITH ADDITIONAL ON THIS BECAUSE IT'S IN THE 500 ADDITIONAL ON THIS BECAUSE IT'S IN THE 500,000 BUDGETED IT'S THE NEXT, THE CONSTRUCTION PART. YOU HAVE FUNDS FOR THIS

INCREASE ALREADY. >> MOTION.

>> SECOND. >> WE HAVE A MOTION AND A SECOND MIAMI QUESTION, THIS IS THE ONE CONTINGENT UPON THE DEED AND THE MOU WITH THEM? IS THIS MOVING FORWARD?

>> WE MET AND WE HAVE A MEETING THIS FRIDAY TO WE WILL WORK OUT THE DETAILS, THEY ARE FLEXIBLE.

>> THIS MOTION WOULD BE CONTINGENT UPON THAT APPROVAL,

YES. >> CONTINGENT ON WHAT APPROVAL? PROPERTY. WE STILL DO NOT HAVE THAT . YES. YES. EVERYTHING IS CONTINGENT UPON RECEIVING PROPER DOCUMENTATION, THE DEED AND THE MOU. WE HAVE A MOTION AND SECOND ALL THOSE IN FAVOR

[7. Discuss and consider transferring $286,087.00 to the New Driscoll Community Center Project.]

SAY AYE. ANY OPPOSED SAME SIGN. THE MOTION PASSES AND THEN NUMBER SEVEN IS WHEN COMMISSIONER GONZALEZ WILL TRANSFER 286,000 WILL TRANSFER $286,087 TO THE DRISCOLL

COMMUNITY CENTER PROJECT. >> WHAT A NICE GUY.

>> I KNOW. >> APPARENTLY THEY INCREASED A LITTLE BIT OF THE SIZE OF THE COMMUNITY CENTER AND SOME OUTSIDE PARKING LOT FENCING AND THINGS LIKE THAT.

>> AND A GAZEBO FOR THE SENIORS.

>> A GAZEBO, YES. >> GOING FROM A MODULAR DESIGN

TO A STANDING BUILDING. >> MAKE A MOTION.

>> WE HAVE A MOTION AND A SECOND? MOTION AND A SECOND.

[8. Discuss and consider adopting additional economic policy guidelines related to Precinct 2 American Rescue Plan Act (ARPA) Project community and economic development programs within Nueces County pursuant to Local Government Code 381.004, and all related matters.]

ALL THOSE IN FAVOR, SAY AYE. ANY THOSE OPPOSED, SAME SIGN.

THE MOTION PASSES. ITEM NUMBER EIGHT. DISCUSS AND CONSIDER ADOPTING ADDITIONAL ECONOMIC POLICY GUIDELINES RELATED TO PRECINCT 2 AMERICAN RESCUE PLAN PROJECT COMMUNITY AND ECONOMIC DEVELOPMENT GRANTS BETWEEN NUECES COUNTY AND THIS IS YOURS , THE COUNTY ATTORNEY HAS BEEN WORKING ON THIS. DID YOU

[02:00:01]

WANT TO EXPLAIN SOME OF THIS?

>> MEMBERS OF THE COURT I HAVE PLACED THE MOST CURRENT REDLINE ON THE DAYS FOR YOU. THERE ARE SOME INCLUSIONS THAT THE COMMISSIONER GAVE TO US YESTERDAY THAT I TRIED TO INCLUDE. TO THE COURT SATISFACTION THIS IS AN IMPORTANT STEP IN DISTINGUISHING THIS PROGRAM FROM OTHER LESS FAVORED PROGRAMS IN THE STATE AND IF THE COURT HAS QUESTIONS, IF THEY ARE TOO INTRICATE WE WILL PULL IT INTO EXECUTIVE, BUT ANY SERVICE-LEVEL OR LOGISTICAL THINGS I CAN PROBABLY ANSWER HERE.

>> WEIGHT, SAY THAT. SORRY. HOLD ON.

>> THIS IS DIRECTED AT COMMISSIONER GONZALEZ DISTRICT.

COULD BE UTILIZED WITH CHANGING OF THE WORDING FOR

ANY OTHER PERSON. >> TO ANY PRECINCT, YES.

>> IS THERE ANYTHING HOLDING US FROM DOING THAT?

>> NO. >> WHILE WE ARE HERE IF IT COMES UP JUST GET IT DONE ONCE IF THIS IS THE PROPER WORDING JUST IMPLEMENT COUNTYWIDE. THE ARPA FUNDING IS LIMITED THAT'S WHAT IT'S BASED ON OR?

>> THE ECONOMIC DEVELOPMENT POLICY NEEDS TO BE IN LIMITED PRECINCT BY PRECINCT OR TRACKED PRECINCT BY PRECINCT SO WE NEED TO BE AWARE OF THAT DIFFERENCE. I THINK ONE OF THE IMPORTANT FACTORS IS THAT THE FUNDS ARE FROM COMMISSIONERS DISTRICT AND HE WANTS THOSE FUNDS FROM HIS DISTRICT TO BE SPENT IN HIS DISTRICT. SO IF WE IMPLEMENT ONE FOR ANOTHER DISTRICT , IT WOULD BE FROM FUNDS FOR THE DISTRICT UNLESS THE COURT AS A WHOLE SOUGHT DONATIONS THAT WOULD BE USED

FOR THE ENTIRE COUNTY. >> REALLY A TEMPLATE WE COULD USE IF SOMEBODY WANTS TO DO IT IN ANOTHER PRECINCT YOU JUST HAVE TO FILL IN THE BLANKS. ALL IT IS, THE POLICY SHOULD BE

THE SAME. >> AT THE GIVE A GREAT SHADOW TO THE ATTORNEYS IN MY OFFICE WHO HAVE SPENT HOURS AND HOURS ON THIS IN A VERY SPED UP CAPACITY TO TRY TO PROVIDE THIS AND HELP GET THIS GREAT PROJECT UNDERWAY.

>> OKAY PRECINCT 2 ARPA FUNDS WHICH ARE WHAT ARPA FUNDS? WHAT

PROJECT? >> THIS IS FOR THE SEPTIC TANK

REPLACEMENTS. >> OKAY, DISCUSS AND CONSIDER ADOPTING POLICIES RELATED TO PRECINCT 2 ARPA PROJECT COMMUNITY FUNDS , BUT THIS IS A COUNTYWIDE , I'M TRYING TO

FIGURE OUT WHY. >> THE WHEN YOU BEEN PROVIDED IS WHEN WE WORKED ON SPECIFICALLY WITH COMMISSIONER GONZALEZ AND AS A WHOLE, THE COUNTY SHOULD HAVE A VERY CLEAR ECONOMIC DEVELOPMENT POLICY AND WE ARE ADDRESSING THAT, BUT THIS ONE IS TO FURTHER ARTICULATE THE ONE WE ALREADY DO HAVE WITH REGARD TO THIS SPECIFIC PROJECT IN THIS SPECIFIC PRECINCT. WE CAN GO AHEAD, IF YOU HAVE AREAS IN YOUR PRECINCT AND FUNDS TO PUT TOWARD THIS AND DO IT FOR ALL

PRECINCTS. >> I GUESS THAT KIND OF GOES BACK TO WHAT I WAS ASKING. THIS APPLIES ONLY SEPTIC BECAUSE IT IS A SPECIFIC PROJECT. GOOD THIS GO TO WATER? I DON'T WATER IS AN ISSUE.

>> IF YOU HAVE A PROJECT, COMMISSIONER, WE ARE HAPPY, THIS WILL BE A USEFUL TEMPLATE IF YOU HAVE A PROJECT. WE CAN RUN IT THROUGH THE ANALYSIS. THE IMPORTANT THING IS WE ARE TRYING TO ANSWER AND DEAL WITH CONSTITUTIONAL TEXAS CONSTITUTIONAL ISSUES ALONG WITH FEDERAL LAW AND ARPA AND WE THINK THIS IS A WONDERFUL WAY TO SERVE BOTH PURPOSES.

>> CAN YOU SHOW THIS WORDING WHERE IT SAYS SPECIFICALLY? IT LOOKS MORE COUNTYWIDE AND NOT SPECIFIC.

>> THE ONE IN YOUR PACKET, WE HAVE BEEN MAKING EDITS ON THIS EVEN UP UNTIL LAST NIGHT. SO IF YOU LOOK AT THE ONE THAT WAS ON YOUR DESK THIS MORNING. LET ME SEE IF I CAN FIND IT.

TWO PAGE FRONT AND BACK DOCUMENT.

[02:05:04]

>> THIS SPECIFIC , I WAS WANTING TO SEE.

>> THIS DOCUMENT, YOU MAY SEE CHANGES YOU WANT TO AND NOT PASS THIS SPECIFIC DOCUMENT ON THE BACK OF PAGE 1 IF YOU LOOK AT C THIS PROJECT LIMITED TO PRECINCT THIS PROJECT LIMITED TO PRECINCT 2 SHOULD COMMISSIONERS COURT EXPAND FIRST SUPPLEMENT TERMS AND POLICY WITH ADDITIONAL PRECINCTS ALONG WITH A NEW NOT TO EXCEED AMOUNT AND PRECINCT WILL FOLLOW THE POLICY CONTAINED.

>> OKAY. USPS TO PASS THIS? >> I THINK I AM SAYING WE BELIEVE WE HAVE FOUND A LEGALLY SUFFICIENT SOLUTION TO

COMPASS THE TASK. >> OKAY SOUNDS LIKE THAT'S WHAT YOU DID SO I WILL MOVE PASSAGE.

>> WE HAVE A MOTION AND A SECOND. COMMISSIONER GONZALEZ

ALL THOSE IN FAVOR SAY AYE. >> I WANT TO SAY THANK YOU TO YOU AND YOUR STAFF. I KNOW YOU ALL WORKED VERY HARD AND YOU ARE OVERLOADED WITH WORK. THANK YOU.

>> THANK YOU COMMISSIONER. >> OKAY. OLYMPIC

>> STAFF DID A WONDERFUL JOB AND JENNY HERSELF.

>> OVER AND ABOVE. >> ALL RIGHT, ALL RIGHT LET'S

GO, COME ON. >> I AM ESPECIALLY GRATEFUL TO EDWARD FOR SHOWING ME BECAUSE WHEN WE DO THINGS IN THEORY AND TRY TO IMAGINE ALL THE NEGATIVE THINGS WE SHOULD BE ADDRESSING, GOING ON THE TOUR SAVES US TIME.

>> WE SHOULD TAKE NOTE OF THIS MOMENT.

[9. Discuss and consider adopting criteria and application for recipients under the Precinct 2 American Rescue Plan Act (ARPA) Project, Colonias Septic System Improvements project; and all related matters.]

>> OKAY MOVING ON. NUMBER NINE. DISCUSS AND CONSIDER ADOPTING CRITERIA AND APPLICATIONS RECIPIENTS UNDER PRECINCT DISCUSS AND CONSIDER ADOPTING CRITERIA AND APPLICATIONS RECIPIENTS UNDER PRECINCT 2 AMERICAN RESCUE PLAN ACT SEPTIC SYSTEM IMPROVEMENTS PROJECT. SWEAT AGAIN THIS MEETS ALL LEGAL MUSTER ALL GOOD TO GO.

>> THIS MEETS ALL LEGAL MUSTER AVAILABLE UNDER FINAL RULE THAT'S AVAILABLE WHICH WE SAID WAS VAGUE. LIMITED CHANGES TO DISTINGUISH FROM OTHER UNFAVORED PROGRAMS AND WE BELIEVE THIS SHOULD BE LEGALLY SUFFICIENT. NOW THE APPLICATION THAT WAS INCLUDED IN YOUR PACKET IS ALSO NOT THE MOST UPDATED APPLICATION. THERE ARE SOME CHOICE POINTS ON THE APPLICATION THAT COMMISSIONER GONZALEZ MAY HAVE. WHETHER THE COURT WANTS TO USE LMI FOR A HIGHER STANDARD FOR WHAT FAMILIES WILL QUALIFY SO THERE ARE SOME DECISIONS ON THE APPLICATION WE WOULD ASK FOR GUIDANCE FROM THE COURT.

>> TODAY GUIDANCE FOR THAT STUFF? MY ONE QUESTION I HAD WHICH I CALLED YOU ON WAS TO MAKE SURE THEY HAD TO OWN THE PROPERTY AND YOU SAID THE APPLICATION HERE SAYS IF YOU ANSWERED NO TO THE PREVIOUS, THEN DO NOT CONTINUE TO FILL OUT SO THAT TOOK CARE OF MY QUESTION.

>> THAT'S HOW YOU ALL AGREE IT SHOULD STAY? OKAY.

>> MY OTHER SUGGESTION WOULD BE LMI.

>> THE LMI IF YOU TALK ABOUT STUFF IF THAT BE ONE OF THE

CRITERIA. >> NO BECAUSE WE DO LMI'S

WITH CD BG. >> SO WHO IS ELIGIBLE IN THIS

ONE? >> IT IS ON THE APPLICATION CRITERIA BEING ELIGIBLE. IT IS ABOUT HOW MANY MEMBERS ARE IN THE HOUSEHOLD AND WHEN DO YOU SUBMIT THE APPLICATION.

>> THE ONE THING WE WERE ASKING, BECAUSE THERE IS A PORTION THAT TALKS ABOUT INCOME. WE WERE ASKING FOR CLEAR CRITERIA WHETHER THAT BE LMI OR TOTAL FAMILY INCOME OF X AMOUNT. SO THE COURT TALKED ABOUT LMI, BUT ALSO WE TALKED ABOUT A DIFFERENT AMOUNT SOMETHING ABOVE LMI BUT NOT

OPEN TO ALL. >> WHAT IS , WHAT IS LEGALLY? IS NO REQUIREMENT. SO IT COULD BE ANYONE. IT COULD BE SOMEONE

[02:10:03]

WITH ACREAGE AND A NICER HOME THAN ANYBODY IN THE COURTROOM WOULD QUALIFY TO APPLY. THAT'S THE DECISION POINT.

YOU WANT IT TO BE OPEN OR AT ANOTHER LEVEL.

>> I THINK AT A INCOME LEVEL. SET THE CAP AT ABOUT $70,000.

>> TOTAL HOUSEHOLD INCOME OF $70,000 PER

>> THE ISSUE IS THAT LMI IS A SKILL WHICH SLIDES DEPENDING ON HOW MUCH MONEY YOU MAKE IN THE POPULATION SO YOU COULD BE MAKING 70,000 AND STILL BE UNDER DEPENDING ON HOW MANY

PEOPLE YOU HAVE. >> SO DO WE SAY A LEVEL OR JUST LMI? BECAUSE WE DON'T NEED.

>> PEOPLE WHO OWN ACREAGE. >> THEY COULD BE , BECAUSE IT IS A DESIGNATED AREA YOU CAN LIVE BUT NOT BE POLONIUS?

>> THE RANGE OF HOMES . >> THERE ARE SOME HOMES WITH SWIMMING POOLS THAT HAVE REALLY NICE BUT THAT'S ONE

HOUSE OR TWO HOUSES. >> IF WE LEFT THIS AND THOSE PEOPLE WOULD BE ABLE TO RECEIVE THIS BECAUSE ARPA HAS NO GUIDELINES. THAT'S WHERE WE GET INTO THE PROBLEM.

>> COMMISSIONER WAS TALKING ABOUT 75 , SOMEWHERE AROUND

THERE. 75 PER HOUSEHOLD. >> THAT'S NOT LMI FOR ONE

PERSON. >> YOU HAVE TO COMPARED TO THE COST OF THE SYSTEM ARRANGING 15 TO 20,000 TO INSTALL.

>> I DON'T KNOW. 75,000. IF YOU'RE SINGLE HOMEOWNER THAT'S A GOOD LIVING. SO DO YOU WANT TO SAY 75,000 WITH FOUR IN THE HOUSEHOLD? IT'S SUPPOSED TO BE PEOPLE THAT TRULY CANNOT AFFORD IT. ONE PERSON THAT MAKES 75,000 A YEAR CAN AFFORD A SEPTIC SYSTEM BUT IF IT IS SIX PEOPLE THAT'S A

DIFFERENT STORY. >> THIS IS WHERE THE NUMBER COMES INTO EFFECT ON MANY MEMBERS.

>> THAT'S WHAT I'M ASKING. >> RIGHT NOW PRIOR TO THIS DISCUSSION WE JUST LEFT IT AS LMI SO WE NEED GUIDANCE IS

THAT 75 TOTAL FAMILY >> FAMILY OF FOUR WHERE YOU DO

75 FAMILY OF FOUR. >> WE CAN MAKE THOSE EDITS OR SAY LMI PLUS A CERTAIN PERCENTAGE ABOVE LMI

>> IT IS YOUR CALL. WHAT DO YOU WANT TO DO?

>> I WOULD STAY WITH 75,000. WITH HOW MANY MEMBERS OF THE

HOUSEHOLD. >> FOUR OR MORE 75,000?

>> AT LEAST FOUR. >> COULD STILL BE THREE.

>> THAT'S WHAT WE ARE SAYING, GIVE THE GUIDELINES YOU WANT.

>> DO THEY TAKE THINGS LIKE INFLATION INTO CONSIDERATION?

75,000 DOES NOT GO VERY FAR. >> WHAT WE ARE ASKING IS THAT THE CRITERIA BE CLEAR AND OPEN SO APPLICANTS UNDERSTAND WHAT THEY ARE APPLYING FOR. I WILL MAKE THAT EDIT TO SAY INSTEAD OF ELIGIBLE PROPERTY SHOULD BE CLASSIFIED AS LMI I WILL CHANGE TO ELIGIBLE PROPERTIES WILL HAVE NO MORE THAN A COMBINED TOTAL HOUSEHOLD INCOME OF $75,000 FOR A FAMILY OF FOUR AND AS IT COMES IN THEY CAN BE COMPARED.

>> ONCE THIS IS RELATED MATTERS WE CAN MAKE A MOTION TO DO THE ALLOCATION BY A DATE CERTAIN SINCE IT'S RELATED MATTERS AND

ARPA? >> I BELIEVE SO.

>> WE NEED TO VOTE ON THIS. WHATEVER EVERYBODY WANTS TO DO.

HAVE A MOTION WITH ADDITIONAL CRITERIA?

>> WHAT IS THE MOTION EXACTLY SO WE CAN GET IT.

[02:15:01]

>> THEY HAVE TO OWN THE PROPERTY AND THE 75,000 HOUSEHOLD INCOME WITH FOUR MEMBERS DID WE SAY FOUR OR

THREE? >> THREE MEMBERS AT LEAST IN THE HOUSEHOLD. THAT IS MY MOTION COMMISSIONER A SECOND? MOTION AND SECOND ALL THOSE IN FAVOR SAY AYE. ANY OPPOSED SAME SIGN. NOW, COMMISSIONER CHESNEY YOU HAVE A MOTION ON

THE ARPA PROJECT DEADLINE. >> I WILL SAY THE END OF MAY.

IS THAT OKAY WITH EVERYBODY? >> YES, HAVE FUNDS DEDICATED.

AND IF THERE IS COUNTY LEFT IT HAS TO BE ALLOCATED BY MAY 31,

2024 AND A MOTION. >> I WILL SECOND. DID SOMEBODY ALREADY SECOND? ALL THOSE IN FAVOR SAY AYE. ANY OPPOSED

SAME SIGN. MOTION PASSES. >> I AM READING QUICKLY WHAT WAS SAID TO ME AND EVERYBODY I'M ASSUMING FROM JESSICA JOHNSTONE ON WHAT WE ASKED FOR, FOR THE OBLIGATION.

READING THIS TO ME IT SAYS UNDER THE REVISED DEFINITION OBLIGATION THE TERM CONTINUES TO MEAN BLESS YOU, IN ORDER PROPERTY SERVICES ENTRY IN THE CONTRACT SUB AWARDED SIMILAR TRANSACTION REQUIRE PAYMENT. SO TO ME IF WE HIRED ENGINEERS AND IT HAD NOT GONE TO BID THAT WOULD MEET OBLIGATION. THAT IS TO ME SO THERE IS , THIS IS NOT AS CLEAR AS ARTICULATED.

>> I DON'T KNOW IF I RECEIVED WHAT YOU HAVE.

>> PROBABLY NOT. I WILL FORWARD THIS TO YOU.

BASICALLY, I THINK WE NEED TO GET THAT CLARIFIED BECAUSE THAT'S A BIG DIFFERENCE. MANY OF US HAVE HIRED ENGINEERS AND ARCHITECTS ON OUR PROJECTS. SO THAT MIGHT MEET OBLIGATION BECAUSE WE HAVE TO PAY IT. IT SAYS AND I WILL READ IT UNDER REVISED DEFINITION OF OBLIGATION TERM MEANS ORDER PLACED FOR PROPERTY AND SERVICES AND ENTRY INTO CONTRACT SUB AWARDS AND SIMILAR TRANSACTIONS REQUIRING PAYMENT. SO IF WE HIRED ENGINEERS AND ARCHITECTS AND THEIR WORKING ON THEM TO ME THAT'S OBLIGATED. THAT'S WHAT YOU HAVE TO DO LEGAL DIGGING AND IT WILL FORWARD TO YOU IF ANYBODY SEES THIS DIFFERENTLY I WELCOME THAT.

>> WE NEED CLARIFICATION FROM YOU ALL.

>> THAT INCLUDES CONSTRUCTION?

>> I DON'T KNOW. TO ME THIS SAYS ENTRY, YES CONTRACT FOR CONSTRUCTION BUT THIS IS CONTRACT SUB AWARD SIMILAR TRANSACTION REQUIRING PAYMENT. IF WE HIRE ENGINEERS AND CONTRACTS ARCHITECTS THOSE ARE CONTRACTORS AND IT MAY TAKE LIKE THE ONE I'VE GOT, I DON'T KNOW I WILL BE UNDER CONTRACT FOR CONSTRUCTION, BUT WE HAVE HIRED THE ARCHITECTS AND ENGINEERS. TO ME THAT IS OBLIGATED.

>> LET'S GET THEIR OPINION. I KNOW WHEN HE WAS IN TOWN THAT SOMETHING HE MENTIONED ALSO. IF WE CAN GET AN UPDATE SENT AROUND TO ALL OF US ONCE WE HAVE A CLEAR OPINION WHOEVER WE NEED TO TALK TO YOU CAN BRING IT BACK WE WOULD

APPRECIATE IT. >> OKAY THANK YOU. THAT IS VERY HELPFUL AND THAT'S WHAT I NEEDED TO READ. SOMETIMES I WILL SEE THINGS DIFFERENTLY. TO ME IT SOUNDS LIKE IF WE HIRED ENGINEERS AND ARCHITECTS THAT SHOULD COUNT. THAT SHOWS

WE ARE SPENDING MONEY. >> I SEE WHAT YOU ARE SAYING.

THE ISSUE IS THE CONTRACT FOR THE ENGINEER IT DOES NOT ALSO INCLUDE THE AMOUNT THAT WILL BE NEEDED FOR CONSTRUCTION.

>> WHAT SHE SENT ME SAYS IT DOES NOT TO BE THAT THAT'S WHY I'M SAYING NOW SHE SENT ME THE SHORT VERSION TO BE PERFECTLY FAIR SO I HAVE READ EVERYTHING SHE SENT ME AND EVERYTHING HIGHLIGHTED. AND IT DOES NOT SAY WHAT YOU SAID. IT JUST SAYS. I AM READING WHAT OBLIGATION MEANS.

>> SHE'S GOING TO ENTER YOUR. >> I CAN CLEAR THIS UP. SO I THINK THIS THAT I HAVE SENT TO OBLIGATE $30,000 TO ENGINEERING THE ONLY OTHER GET A $300,000 IF IT'S A MILLION-DOLLAR PROJECT IS SOFT OBLIGATE REMAINING

FUNDS VIA CONSTRUCTION. >> YOU ARE SPECULATING UNLESS YOU'VE GOT SOMETHING US IN WRITING, NEEDED IN WRITING IN OTHER WORDS IT DOES NOT SAY ALL OF WHAT YOU'RE SAYING. IF

[02:20:03]

THERE'S MORE THAN OKAY SEND MORE AND HIGHLIGHT BUT WHAT YOU HAVE SENT HIGHLIGHTED DOES NOT SAY , IT SAYS THE TERM CONTINUES TO MEAN ORDER PLACED FOR PROPERTY SERVICES AND ENTRY INTO CONTRACT, SO BOARDS AND SIMILAR TRANSACTIONS REQUIRING PAYMENT. THAT'S IT. IT DOES NOT SAY.

>> I BELIEVE WE HAVE TO COME BACK TO THIS. THEY WANT TO CHECK FURTHER AND WE NEED CLARIFICATION FROM ALL

[10. Discuss and consider application process for Colonias residents to apply for assistance under the Colonias Septic System Improvements Precinct 2 American Rescue Plan Act (ARPA) Project; and all related matters.]

ENTITIES. >> OKAY WE CAN DO THAT.

>> THANK YOU. MOVING ON ITEM 10 DISCUSS AND CONSIDER

APPLICATION PROCESS. SORRY. >> WE VOTED ON EIGHT AND NINE?

OKAY SORRY. >> DISCUSS AND CONSIDER APPLICATION PROCESS FOR RESIDENTS TO APPLY AND THAT LOOKS SIMILAR , WHAT'S THE DIFFERENCE IN THIS ONE FROM THE

PREVIOUS? >> THIS IS JUST AN ACTION ITEM ASKING FOR THE COURT TO GO AHEAD AND GIVE US THE GUIDANCE OR NOT US IN PARTICULAR, BUT TO SAY THAT YES THE APPLICATIONS WILL OPEN ON THIS CERTAIN DATE AND THE COURT IS

THE MOTION PASSES SORRY. ITEM NUMBER 12. DISCUSS AND CONSIDER ALLOWING COMMISSIONER JOE GONZALEZ TO MAKE A REQUEST TO OUTSIDE ENTITIES FOR ADDITIONAL FUNDING FOR THE COLONIAS SEPTIC SYSTEM IMPROVEMENT AND THIS WOULD BE ON TOP OF HIS 500,000 PRECINCT 2 ARPA MONIES TO GO OUTSIDE TO SOLICIT FUNDS ONLY FOR PRECINCT 2 FOR HIS PROJECTS.

>> SO MOVED. >> SECOND.

>> MOTION AND SECOND. >> WHAT ARE WE DOING?

>> HE WANTS TO ASK FOR ADDITIONAL FUNDS BUT ONLY FOR HIS PRECINCT COLONIAS PROJECT.

>> SO I CAN FINISH THE PROJECT.

>> WHAT THE TOTAL GOING TO BE? >> PROBABLY ANOTHER MILLION.

IF I CAN MATCH THE 500. I CAN DO AT LEAST 100 MORE.

>> THAT'S ON TOP OF THE PROJECT.

>> NOTHING TO DO WITH THIS. YOU KEEP SAYING THAT.

>> IT IS COLONIAS TOO . SO YOU'RE DOING 2.9 ON THAT AND

THEN. >>

TO WORK WITH. >> THAT'S NOT RIGHT. I WAS TOLD CBDG HAS NOTHING TO DO WITH LMI. THEY TOLD ME , GRANT WORKS, THE CBDG STUFF SOMEBODY BETTER CLARIFY THIS.

>> IN THIS CASE IT FITS ON A PERSON'S PROPERTY IT HAS TO MEET LMI. YOUR PROJECT CAN BE QUALIFIED WITHOUT MEETING LMI BUT BECAUSE WE ARE WORKING ON PROPERTY , ALL OF THESE HAVE

TO BE. >> WHY WOULDN'T WE JUST ?

>> SO JUST TO BE CLEAR COMMISSIONER WE ARE LOOKING AT 567 HOMES IN THE COMMISSIONER PRECINCT ALONE. OF THOSE 567 HOMES ONLY 9% ARE PERMITTED TO THE HEALTH DEPARTMENT WE ARE UNABLE TO LOCATE 9% OF THOSE. SO, WE WILL TRY TO ADDRESS THE REMAINDER SO THE COMMISSIONER IS GOING TO USE ARPA FUNDING TO COLONIAS. SO THOSE WILLFULLY KNOCK IT OUT, THE REMAINDER OF THAT SOME OF THAT MONEY WILL BE LEFT AGAIN RIGHT

[02:25:02]

BACK ONE YEAR FROM NOW AND IT WILL DO ALL THE LMI IN THE SAME PRECINCTS. SO THAT LEAVES US WITH ADDITIONAL HOMES WE ARE TRYING TO ADDRESS THAT ARE LEFT OUT.

>> THE APPLICATION STATES THE FACT , THERE IS A DEAL IF THEY ARE UNDER THE LMI SELECTION THAT THEY WOULD COME

LATER. >> WE PUT A NOTE THAT IF THE HOME HAS PREVIOUSLY BEEN AWARDED SOME HELP UNDER CBDG THAN THEY WOULD NOT BE INCLUDED IN THIS APPLICATION.

>> NOTHING HAS BEEN AWARDED YET.

>> HOLD ON I HAVE TO GO BACK TO THE CBDG. WHERE DID THAT COME FROM BECAUSE THAT MONEY WAS THE MONEY WE WERE GIVEN BY THE STATE ON THE MONEY THAT WAS AWARDED IN NUECES COUNTY 'S OVER TO THIS EXTRA LMI REQUIREMENT COMING THAT HAVE NEVER HEARD ABOUT BEFORE ? IS THAT RIGHT? IN MY PROJECT, THERE IS NO LMI REQUIREMENT.

>> YOUR PROJECT IS FINE, IT'S THE NATURE OF THE WORK WE ARE

DOING. >> THE RULE. I HAVE BEEN TOLD

ALL ALONG. >> WE ARE GETTING FAR OFF.

>> I'M TRYING TO FIGURE OUT WHY WE'RE DOING TWO THINGS IF THERE IS ALL OF THIS CBDG MONEY , TRYING TO DETERMINE THIS I WAS TOLD THERE IS NO LMI RELATED TO TRAINING.

>> THERE IS LMI. >> GRANT WORKS TOLD ME THERE

WAS NO LMI. >> THE THING IS THAT THERE IS BUT IT IS ALSO GO IN COMMISSIONER MAREZ PRECINCT AS PART OF THE APPLICATION WE PROVIDE ITS 47% LMI TO THE TOTAL COUNTY THAT'S WHERE YOUR PRECINCT IS LEFT OUT BECAUSE DURING THE SURVEYS THAT WERE DONE FOR THESE PROJECTS ALL THE LMI REQUIREMENTS WERE MET BY COMMISSIONER MAREZ, COMMISSIONER HERNANDEZ AND THAT LEFT YOUR AREA DOES NOT NEED TO BE LMI. SOME AREAS DID NOT REQUIRE LMI, BUT BECAUSE THE NATURE OF THE WORK WE ARE DOING ON THEIR PROPERTY IT REQUIRES FEDERAL FUNDING REQUIRES THAT WE GIVE LMI.

>> OKAY. SO I GET THIS IS I GUESS THIS IS ARPA , THEN YOU JUST WANT TO DO SOME WITH ARPA AND SOME WITH CBDG?

>> THIS ITEM IS IN REGARDS TO HIM GETTING ADDITIONAL FUNDING BECAUSE WE HAVE OUR GROUP WITH THE LMI FOR A YEAR OR A YEAR AND A HALF FOR NOW. THEY WILL DO THIS GROUP WITH ARPA MONEY NOW. THAT LEAVES THIS GROUP IN THE CENTER THAT MEET THE CRITERIA , WE WILL NOT BE ABLE TO DO THAT. SO, WHEN HE COLLECTS ADDITIONAL FUNDING THAT WOULD ALLOW US TO DO THOSE

THAT ARE LEFT OUT. >> OKAY. WHAT IF AND WHAT IF SO YOU'RE GOING TO SPEND THE 500,000 NO MATTER WHAT AND IF YOU GET SOME YOU WILL ADD TO IT OR YOU JUST DO WHAT YOU CAN? OKAY. ALL RIGHT. THAT SORT OF CLEARS IT UP, THANK YOU.

>> THE ASK WILL ONLY BE FOR YOU. SO THE COURT IS GIVING YOU PERMISSION TO ASK ON YOUR BEHALF THAT'S WHAT YOU ARE ASKING. SO IT IS NOT NECESSARILY A COURT ASK THIS IS YOUR ASK SINCE IT DOES NOT PERTAIN TO ANYBODY BUT YOU.

NEXT TWO ITEMS, ITEM NUMBER 16 AND 17 , I PUT TOGETHER BECAUSE THEY BOTH GO TOGETHER. IF YOU WILL ALLOW ME, LAST TIME WE DID NOT HEAR RICHTER'S PLANS. I KNOW HE IS HERE IF WE CAN GO THROUGH THE PLANS FIRST BEFORE DISCUSSION IF YOU ARE OKAY WITH THAT I THINK WE NEED TO HEAR CLEARLY WHAT IT IS AND WHAT THE PLAN IS. MR. RICHTER I CALL YOU UP, THANK YOU.

>> THANK YOU, JUDGE. WE HAVE A GRAPHIC THAT SHOULD BE READY TO GO ON THE SCREEN TO CLARIFY MAYBE SOME OF THE QUESTIONS ABOUT THE VALUE ENGINEERING THE PROJECT . OKAY THERE WE GO.

VIEW. OKAY NOW, SO FOR CLARIFICATION. I THINK THERE WAS A LITTLE CONFUSION ABOUT WHAT WAS IN THE BID, IN THE ALTERNATE AND WHAT IS IN THE VALUE ENGINEERING EFFORTS THAT HAVE GONE ON SINCE I WAS LAST IN FRONT OF YOU. SHOWN IN THE BLUE IS EVERYTHING IT WAS BID IN THE BASE BID THAT WENT OUT RECENTLY. IN THE GREEN WHICH IS WING B WAS A BIT ALTERNATE.

WE HAD A HARD BID ON EVERYTHING AND BLUE AND A HARD BID ON THE GREEN. BECAUSE THE PROJECT WAS OVER BUDGET, IT WAS CONSIDERED IN ORDER TO MAKE THE BUDGET THAT WE WOULD NOT ACCEPT THE BID ALTERNATE. SO THAT WAS NOT NEGOTIATED OUT IT WAS NOT ACCEPTED IT WAS NOT PART OF THE BASE BID. SO THE BID ALTERNATE WAS ROUGHLY $1 MILLION. THAT WAS NOT ACCEPTED. NOT ACCEPT

[02:35:06]

UNTIL YOU ACCEPT ANYWAY, FOR THE PURPOSES OF US TRYING TO GET IN THE BUDGET THAT WAS DISALLOWED. THE ONLY THING IN THE ORIGINAL BID SCOPE THAT WAS DELETED IN THE VALUE ENGINEERING WAS THE BLUE SQUARE WITH THE RED AROUND IT ON THE FAR LEFT WHICH IS BASICALLY PUBLIC RESTROOMS AND A TOOL AND MECHANICAL STORAGE BUILDING. THAT WAS DELETED FROM THE BASE BID. IN ADDITION THE BALANCE OF THE BUILDING THE MAJORITY OF THE BUILDING IN THE WING A AND C SHOWN TO BE RENOVATED AND THE NEW CONSTRUCTION THAT IS SHOWN TO THE RIGHT BETWEEN ANC AND JUST SOUTH OF C. ALL OF THAT IS STILL IN THE SCOPE OF THE PROJECT FOR THE VALUE ENGINEERING. SOME CHANGES WERE MADE TO THE BASE BID PRIMARILY IN SIMPLE FLYING THE AIR CONDITIONING CONTROL SYSTEMS AND ALSO IN SOME OF THE FINISHES. AND SOME WINDOWS.

WE HAD ALMOST ALL GLASS ON THE BUILDINGS, NOW WE HAVE 80% GLASS AND WE REDUCED SOME OF THE SCOPE OF THE WINDOWS AND DELETED THE OPERABLE WINDOWS AND MADE THEM FIXED. SOME OF THE GREEN ASPECTS IN THE ORIGINAL PLAN WERE CONVERTED TO MORE CONVENTIONAL CONSTRUCTION TO BRING THE PROJECT INTO BUDGET BUT THE SCOPE OF THE PROJECT, THE FOOTPRINT WITH THE EXCEPTION OF THE ONE SMALL BUILDING TO THE LEFT WAS NOT REDUCED. BUT WE WERE ABLE TO GET BETTER THAN $1 MILLION OR ROUGHLY 1 MILLION OUT OF THE BASE BID TO BRING IT DOWN TO 9.4 MILLION. THE THREE WINGS SHOWN, D, EAST AND F WERE NOT IN THE SCOPE OF THE ORIGINAL BID AND THEY'RE NOT IN THE SCOPE OF THE VALUE ENGINEERING EITHER. THERE BASICALLY LEFT FOR CURRENT USE FOR POTENTIAL FUTURE BENEFIT

TO THE COUNTY. >> B, D, E AND F ARE ALL GOING TO STAY THERE WHERE THEY WERE?

>> YES MEN. >> WHY WAS B IN GREEN?

>> BECAUSE THE RENOVATION OF IT WAS BID AS THE ALTERNATE.

IN THE SCOPE OF THE BID BUT BECAUSE IT WAS A ALTERNATE OVER BUDGET WE BASICALLY ELECTED NOT TO CONSIDER THAT AS PART OF THE VALUE ENGINEER AND SCOPE. ESSENTIALLY IT REVERTS TO THE SAME STATUS AS D, E AND F WHICH IS EXISTING USE.

>> SO TAKING OUT THE NEW SPACE LEAVE THAT ASIDE SO BASICALLY NOT TOUCHING THOSE , WHAT IS THAT REPRESENTING IN SQUARE FOOTAGE? IF ANYONE KNOWS THAT.

>>

OF THIS UNDONE. >> ABOUT 20,000.

>> 20,000? SO, B, D, E, F AND THE RENOVATED SPACE IS IS

HOW MANY SQUARE FEET? >> IS AND C WHICH IS ABOUT 15.

AND THE NEW CONSTRUCTION IS ABOUT EIGHT.

>> YOU ANSWERED MY EMAILS ABOUT THIS. BUT I DO WANT TO TALK ABOUT THAT IN GENERAL. YOU MADE COMMENT IN THE LAST MEETING AND WE KIND OF STOPPED TALKING ABOUT IT BECAUSE WE WERE WAITING TO THIS CAME BACK. THERE WAS NEVER INTENDED FOR THE WHOLE BUILDING AND AS I DISAGREED IN MY EMAIL MY INTENT WAS IT WAS ALWAYS TO RENOVATE THE WHOLE BUILDING SO MY CONCERN IS THAT'S WHY I CHANGED MY POSITION BECAUSE THE SCOPE OF THIS HAS DRAMATICALLY CHANGED. WE CAN DISAGREE THAT'S OKAY REASONABLE PEOPLE CAN DISAGREE. IT DOES NOT MAKE SENSE TO ME TO NOT RENOVATE B, D, E, AND F, ADD THE NEW SPACE EVEN THOUGH IT IS GREAT DESIGN AND YOU EXPLAIN WHY BECAUSE IT WAS DESIGN AND FUNCTIONALITY SITUATION. TO ME IT WOULD HAVE BEEN EASIER FOR ME TO SWALLOW EVEN THOUGH I DO STILL STAND WITH THE POSITION THAT WE OUGHT TO TEAR IT DOWN

[02:40:01]

AND BUILD A NEW ONE BUT THAT MIGHT NOT BE WHERE WE ARE TODAY OR CAN GET TO TODAY. AT THE VERY LEAST IT WOULD SEEM WE SHOULD RENOVATE AND TOUCH EVERY PART OF THIS OTHERWISE I'M AFRAID WILL NEVER COME BACK TO B, D, E, AND F BECAUSE THIS IS ONCE-IN-A-LIFETIME TYPE MONEY. COMMISSIONER HERNANDEZ COMMITTED HIS ARPA FUNDS WHICH IS GREATLY APPRECIATED AND THEN THE COURT COMMITTED ANOTHER SIX OR 7 MILLION OF SETTLEMENT MONEY AND DIFFERENT CEOS AND STUFF LIKE THAT TO MAKE UP THIS BUDGET WHICH WAS APPRECIATED AND I VOTED FOR THAT AND SUPPORTED IT. I THINK EVERY PENNY AND DIME SHOULD STAY IN PRECINCT ONE BUT I HAVE CONCERNS OVER HER GETTING BACK TO B, D, E, AND F. SO I DON'T KNOW WHY WHEN THE VALUE ENGINEERING WAS GOING ON WHY WE DID NOT ELIMINATE THE NEW AND KEEP ANOTHER WING IN IT AND LOOK AT HOW WE TOUCH ALL OF IT I GET THE FUNCTIONALITY AND DESIGN, BUT WE ARE LEAVING 20,000 FT.÷ OF THE PROJECT UNTOUCHED AND PROBABLY WON'T BE TOUCHED AGAIN FOR MANY MANY MANY YEARS BECAUSE WE WILL NOT HAVE NINE OR 10 MORE MILLION FALL IN OUR LAP LIKE WE DID ON THIS TO DO IT. I'M TRYING TO FIGURE OUT WHY , WHY WE DO NOT TRY TO REDESIGN AND TOUCH ALL OF IT. I KNOW WE COULD NOT HAVE DONE AS MUCH ON SOME OF IT BUT WE COULD'VE DONE A LOT ON ALL OF IT. WE HAVE ONE WING WITH $1 MILLION PLUS OF ELECTION EQUIPMENT SITTING IN AND WE'RE NOT TOUCHING THAT.

>> MILLIONS OF DOLLARS OF ELECTION EQUIPMENT SITTING IN ONE OF THESE THAT WE ARE NOT EVEN TOUCHING. THAT'S CONCERNING TO ME. I DON'T KNOW WHERE TO GO ON THIS BECAUSE THIS SCOPE HAS CHANGED AND I HAVE A QUESTION FOR PURCHASING. CAN WE DO IT THIS WAY? I THINK THE PROJECT ON THE SCOPE CHANGED. CAN SUMMON A PURCHASE HERE? I WOULD LIKE TO KNOW THE OPINION ON THAT. CAN WE DO IT THIS WAY?

>> DO YOU WANT TO BRING THE PICTURE BACK UP PLEASE? SO, IN REVIEWING THE CHANGES PROPOSED BY RICHTER I SEE NO COMPELLING REASON WHY THE REENGINEERING EFFORTS WOULD CAUSE THE COURT TO BE REQUIRED TO REBID, THE ONLY PIECE OF THE PROJECT THAT IS BEING TAKEN AWAY IS THAT SMALL BLUE BOX ON THE LEFT SIDE WHICH I UNDERSTAND IS LESS THAN 10% OF THE PROJECT. A GREAT DEAL. ALL THE CHANGES PROPOSED ARE WITHIN , IF YOU WILL, IN THE BOX OF CHANGES THAT WERE IDENTIFIED AND THOSE ARE HVAC CHANGES AND OTHER MATERIALS CHANGES. ONLY IN THE VALUE ENGINEERING PROJECT. I SEE NO REASON WHY WE WERE NOT BE REQUIRED TO BID THIS WITH NO LEGAL REASON, COMPELLED IN COURT TO BE MADE INTO THAT CHOICE SO THE COURT REMAINS AVAILABLE TO PROCEED IN YOUR NORMAL FASHION OF EVALUATING THIS PROJECT AND DETERMINING IF YOU WANT TO MOVE FORWARD OR NOT IN EITHER DIRECTION IT'S FINE WITH WHATEVER THE COURT DECIDES.

>> I APPRECIATE THAT ANSWER. WHY WOULDN'T YOU HAVE THOUGHT WHEN YOU WERE DESIGNING THE BUILDING YOU HAVE TO KNOW THE STATE OF WHAT IT TOOK TO GET THIS MONEY THAT'S A LOT OF MONEY. WHY WOULDN'T WE TRY TO TOUCH THE WHOLE BUILDING AND DO SOMETHING WITH THE WHOLE BUILDING INSTEAD OF JUST PART OF IT AND THEN ADDING NEW SPACE. WE COULD HAVE SPENT THAT MONEY ON A COUPLE OF WINGS AND MADE A DIFFERENCE AND LIKE I SAID WE HAVE MILLIONS OF DOLLARS OF EQUIPMENT SITTING IN THE SPACE WE ARE NOT EVEN TOUCHING THAT.

>> I WILL ANSWER THAT IN TWO PARTS IF I MAY. TECHNICALLY WHEN YOU SAID IT WAS YOUR UNDERSTANDING THAT THE ENTIRE PROJECT WAS BEING TOUCHED, AND THE VERY EARLY STAGES MORE THAN A YEAR AGO WHEN WE FIRST POSED THIS PROJECT WE DID PRICE THE RENOVATION OF THE ENTIRE FACILITY AND THE PRICE WAS NORTH OF $15 MILLION AND THAT'S IN NON-INFLATED DOLLARS FROM PROBABLY TWO YEARS AGO. RIGHT AWAY IT WAS DETERMINED THAT WOULD NOT BE IN THE BUDGET, SO IT WAS MUCH LARGER THAN THE PROGRAM NEEDED FOR THE COMMUNITY CENTER. SO OBVIOUSLY WE CAN DEMOLISH WINGS THAT ARE NOT BEING USED, BUT THEY ARE AND BENEFICIAL USE NOW WITH STRUCTURE, SOUND, THE ROOF IS GOOD WE HAVE LIFE LEFT IN HIM THEY ARE OLD AND

[02:45:03]

NOT AS ATTRACTIVE AS THEY ONCE WERE, BUT THEY ARE FUNCTIONAL SO IT WAS DECIDED TO LEAVE THEM ALONE AND SHRINK THE FOOTPRINT OF THE COMMUNITY CENTER TO BE THE FOOTPRINT THAT WAS AFFORDABLE AT THE TIME. SO THAT'S WHEN THE THREE WINGS THAT WERE SORT OF TAKEN OFF THE TABLE WERE TAKEN OFF AND THIS HAPPENED MORE THAN A YEAR AGO AS THE PROJECT DEVELOPED. THE SECOND PART OF THE QUESTION IS WHEN WE ARE FACED WITH VALUE ENGINEERING BASED ON THE SCOPE, WHY WOULDN'T WE DELETE THE NEW CONSTRUCTION AND RENOVATE ANOTHER WING INSTEAD OF HAVING A PORTION OF IT BEING A NEW PORTION NOT BEING MADE. WE OPTED TO NOT DO THAT FOR TWO REASONS. ONE IS BECAUSE THE DELTA BETWEEN NEW CONSTRUCTION AND RENOVATION IS NOT AS BIG AS YOU MIGHT THINK IT WOULD BE BECAUSE THESE BUILDINGS ARE GOING TO BE COMPLETELY GUTTED BACK TO THE BARE STRUCTURE. SO ALL OF THE BUILDING THE ENVELOPE, THE WINDOWS, THE ELECTRICAL AND MECHANICAL, ALL OF IT IS NEW EVEN IN THE RENOVATED PORTION. THE AMOUNT OF SAVINGS GENERATED IS NOT AS GREAT AS YOU MIGHT THINK YET IT COMPROMISES THE FUNCTIONALITY AND THE PLAN IT WOULD SIGNIFICANTLY SET US BACK SCHEDULE LIES BECAUSE IT WOULD NOT REQUIRE COMPLETE REDESIGN WHEREAS THIS IS SORT OF IMPLEMENTING THE PLAN. SO IT IS CONSIDERED NOT REALLY TO BE A VIABLE STRATEGY FOR VALUE ENGINEERING. THIS GOT US IN THE BUDGET, RESPECTING THE CURRENT DESIGN AND IT PUTS YOU IN A POSITION TO ADD TO THE DESIGN AS YOU MAY NEED. THE FUTURE OF THOSE THREE WINGS THAT ARE NOT TOUCHED IS UP FOR CONSIDERATION. I'M SURE YOU HAVE A MUCH BETTER SENSE OF THE LIKELIHOOD OF THAT THAN I DO.

WE LOOKED AT IT AS BASICALLY VIABLE USEFUL SPACE FOR THE COUNTY . IS IT MORE VIABLE THE COUNTY IN ITS CURRENT STATE OR MORE VIABLE GONE AND THAT'S A JUDGMENT THAT THE COURT LOVE TO MAKE. FROM OUR VANTAGE IT APPEARED FROM US THAT IT IS USEFUL IN ITS CURRENT STATE AND IT COULD BE EXCEEDINGLY USEFUL IN THE FUTURE THE COUNTY DECIDED TO EXPAND THE COMMUNITY CENTER. SO THAT'S WHAT YOU SEE HERE.

>> SO BASICALLY YOU ARE SAYING RENOVATING IS MORE EXPENSIVE THAN THE NEW SPACE BECAUSE THE DELTA.

>> NOT MORE EXPENSIVE BUT PROBABLY 80% OF THE COST OF NEW SPACE , BUT KEEP IN MIND IF WE WERE TO BUILD THE NEW ALL-CASH AND CONCRETE TO THE QUALITY THE NEW COST WOULD BE EVEN HIGHER. I'M JUST SAYING THAT THE QUALITY OF THE BASIC STRUCTURE OF THE EXISTING BUILDING IS QUITE HIGH SO IT IS A VALUE PROPOSITION. THE NEW COST MORE THAN RENOVATION, NOT NECESSARILY. IF YOU STRIP BACK TO THE CONCRETE STRUCTURE AND YOU SPEND THE MAJORITY FOR THE NEW COST.

>> HOW MUCH IS THE NEW SPACE COSTING TO BUILD? WHAT DOES

THAT COST CURRENTLY? >> UNFORTUNATELY THEY DON'T TAKE IT OUT THAT WAY SO WE CANNOT GIVE A HARD NUMBER ON

THAT. >> YOU MUST OF BEEN ABLE TO WHEN YOU ELIMINATED THE B YOU ELIMINATED AN AMOUNT OF MONEY SO THEY MUST HAVE WOKEN IT DOWN SOMEHOW.

>> THE BID WAS SEPARATE AND THE B WAS VERY COMPETITIVE .

UNDER $1 MILLION WHICH WOULD EQUATE TO ROUGHLY $164 A SQUARE FOOT SO THE PRICE THAT WAS BID IS A BARGAIN-BASEMENT

PRICE. VERY ECONOMICAL. >> WOULDN'T YOU MAKE THE ARGUMENT? THE ARGUMENT THAT THE NEW SPACE HAS GOT TO BE MORE? WHAT YOU TOLD ME OR WHAT YOU TOLD THE COURT WAS IN THIS PLAN THAT ALL NEW CONSTRUCTION IS 425 A FOOT THAT'S WHAT YOU ESTIMATED IF WE DID ALL NEW CONSTRUCTION.

SO HOW MANY SQUARE FEET IS THE NEW SPACE THAT'S THERE NOW?

>> THE NEW SPACE WE HAVE IS , IS ABOUT 8000.

>> 425 SQUARE 8000. >> 425 FT.÷ , THAT'S ABOUT

[02:50:08]

8000. HOW MUCH? >> MENTAL MATH, 3.5 OR SO.

>> 3.4. >> THE NEW SPACE IS 3.4 MILLION OF THE EXISTING? OF THE 9 MILLION? WHAT I AM SEEING IS THE NEW SPACE ACCORDING TO YOU IS 425 PER FOOT.

>> WILL BECOME OF THE NEW SPACE FOR THIS DESIGN BUILT IN BETWEEN THE BUILDINGS AND AROUND THE BUILDINGS MIGHT BE A

LITTLE HIGHER. >> MY POINT OF THIS IS THAT B WAS 1 MILLION UNDER 1 MILLION , THE NEW SPACE ALONE IS 3.4 MILLION UNDER 425 A FOOT, YOU COULD TAKE AWAY THE NEW SPACE AND RENOVATE THE OTHER THREE WITH THAT SAME AMOUNT OF MONEY AND RENOVATE THE ENTIRE PROJECT AND TAKE OFF , THAT'S WHAT I'M TRYING TO GET TO. THE NEW SPACE IS WAY MORE THAN RENOVATED ACCORDING TO YOUR ESTIMATES YOU HAVE GIVEN THE COURT OF WHAT NEW CONSTRUCTION WILL COST IF WE TORE IT DOWN AND REBUILT. I'M USING YOUR NUMBERS.

>> YOU ARE USING MY NUMBERS, BUT THAT'S APPLES AND ORANGES.

HAS TO BE MORE THAN THE RENOVATION. DOUBLE PROBABLY.

>> I DON'T THINK SO. I THINK THE RENOVATED PORTION , I THINK THE VALUE THAT WE GOT FOR THE BID ALTERNATE IS PROBABLY AT OR NEAR CONTRACT COST OR MAYBE EVEN UNDER, SOMETIMES THE BIDDERS WILL BID STRATEGICALLY. SO A BIT ALTERNATE MIGHT BE PRICED VERY LOW IN ORDER TO SHIFT A LITTLE

BIT OF MONEY INTO THE BASE. >> AT THE END OF THE DAY ALL WE HAVE , THAT IS SPECULATION. SO YES, BUT THE NUMBERS ARE NOT.

THE TOTAL PROJECT WAS BID AT BASICALLY $10 MILLION.

>> WHAT I'M SAYING IS WHEN WE ELIMINATED B WE ELIMINATED $1 MILLION. WE KNOW 8000 SQUARE-FEET WILL COST WAY MORE THAN $1 MILLION OF NEW SPACE. I WILL EVEN REDUCE YOUR NUMBERS.

NEW CONSTRUCTION TODAY , YOUR NUMBERS 425 AT 3.4 MILLION LET'S SAY IT'S ONLY 2.7 MILLION FOR SAKE OF ARGUMENT BECAUSE THEY GIVE US A REALLY GOOD DEAL, YOU COULD STILL ALMOST RENOVATE TO HAVE MORE WINGS AND TAKE OUT THE SPACE.

MY POINT TO ALL THIS IS I THINK WE OUGHT TO TEAR DOWN AND START OVER, AND BUILD SOMETHING REALLY NICE AND REALLY SPECIAL AND REALLY COOL AND SPEND ALL THE MONEY IN THE PRECINCT. IF WE WOULD'VE DONE AWAY WITH A NEW PORTION OF THIS BUILDING WE COULD HAVE RENOVATED A LOT MORE OF THE EXISTING BUILDING INCLUDING A WINGED THAT HAS MILLIONS OF DOLLARS OF COUNTY EQUIPMENT AND WE'RE NOT EVEN TOUCHING THESE WINGS. SO AT THE VERY LEAST WE COULD'VE PROBABLY TOUCHED MAYBE NOT AS NICE AND SPECIAL AND BEAUTIFUL AS ALL THE OTHERS, BUT IF WE WOULD'VE USED THE MONEY BUT WE COULD HAVE RENOVATED THE WHOLE BUILDING IN SOME WAY BECAUSE D, E AND F HAVE TO BE RENOVATED IF WE KEEP THEM. BECAUSE I DON'T KNOW HOW ELSE TO SAY IT IT IS CRAPPY SPACE, OLD SPACE, IT IS SOLID, THE BONES ARE GOOD AND YOU ARE RIGHT SOLID CONSTRUCTION, THIS IS NOT BUILT TO BE A COMMUNITY CENTER. IT WAS BUILT TO BE HOSPITAL SO WE ARE REFURBISHING BUT IT MAKES NO SENSE TO ME NOT TO BE TOUCHING B, D, E, AND F AND BUILDING $3 MILLION POTENTIALLY WORTH OF NEW SPACE WHEN WE COULD'VE DONE RENOVATION SO THAT'S WHERE STRUGGLING. I THINK THE SCOPE HAS CHANGED AND I MISSED IT FROM THE DESIGN STANDPOINT I WILL TAKE MY HIT ON THAT BUT I DON'T KNOW GOOD ABOUT THROWING MORE GOOD MONEY AFTER BAD BECAUSE I DID NOT CATCH IT EARLIER BECAUSE I THINK WE COULD EASILY SHIFT GEARS. AND STILL RENOVATE THIS WHOLE PROJECT WITH THE MONEY WE HAVE.

I DON'T KNOW. I DON'T UNDERSTAND WHY WE DIDN'T GET

RID OF THE NEW SPACE. >> I HAVE ANOTHER QUESTION ABOUT THE , WE SPENT, THEY COMMENTED WE SPEND A LOT OF MONEY ON THE ADA IMPROVEMENT. IS THIS PLAN GOING TO IMPACT ANY OF THAT? ARE YOU GOING TO UTILIZE WHAT WE HAVE? ARE WE GOING TO HAVE TO TEAROUT STUFF? THAT'S WHAT DRIVES ME CRAZY WE DO THIS STUFF AND THEN TEAR IT OUT.

[02:55:01]

>> ANYTHING IN THE WINGS WE ARE NOT TOUCHING WILL STAY.

THERE WAS STILL BE THERE WITH THE BENEFIT ACCRUED. IN THE BLUE SECTION OF RENOVATION IT WILL BE WHATEVER WAS DONE IT WILL BE GUTTED BECAUSE THIS IS A COMPLETE REDO OF THE BLUE SECTION. SO IT IS A NEW DESIGN.

>> A NEW DESIGN ON THE INSIDE, BUT WE HAVE RAMPS IN CONCRETE AND ALL THAT STUFF DOES THAT STAY?

>> IF IT IS A PORTION OF THE ENTRANCE THAT'S NOT AFFECTED THEN IT STAYS, BUT A NEW ENTRANCE, WHERE THE ENTRANCE TO THE FACILITY TO A NEW PORTION INSTEAD OF RENOVATING SO THERE IS SOME SITE WORK ASSOCIATED WITH THAT. SO THERE IS SOME REDO OF RAMPS. BASICALLY IN THE AREA WHERE IT'S SHOWN IN BLUE IS PRETTY MUCH NEW IN TERMS OF SITE WORK.

>> OKAY. I WANT TO THANK YOU FOR PUTTING THIS IN COLOR AND SHOWING IT TO US. B WAS NEVER PART OF THE BASE BID , IT WAS ADDITIVE. SO REALLY YOU ARE NOT TAKING AWAY ANYTHING. P WAS NEVER INTENDED TO BE PART OF THE BASE BID. ALTHOUGH WE COULD HAVE USED IT AND WE STILL CAN BECAUSE IT IS STILL ADDITIVE.

>> IF YOU HAVE 900 SOMETHING THOUSAND YOU COULD EXECUTE

THAT. >> I REMEMBER WHEN YOU CAME BEFORE US SEVERAL TIMES AND TALKED ABOUT 15 MILLION, 18 MILLION, 15 MILLION AND I'M SURE A LOT OF US WERE AGAINST IT. WE ARE ADAMANT WE WILL NOT SPEND THAT MUCH MONEY. NOW WE ARE GOING TO SPEND MORE MONEY AND DO THE REST OF THE BUILDING BECAUSE D , ELECTIONS, THAT CAN BE RENOVATED. THAT CAN BE DONE INTERNALLY. RIGHT? I DO NOT GO IN THERE IT WAS LOCKED AND YOU HAVE THE KEY PROBABLY. I CANNOT GO IN THERE.

>> I HAVE INVITED EVERYONE TO COME TAKE A LOOK.

>> I'M JUST SAYING. I'M NOT HERE TO ARGUE OR WHATEVER. AND THAT'S FINE. DOES NOT MEAN WE WON'T TAKE CARE OF IT. WE ARE GOING TO TAKE CARE OF IT AND WE SHOULD BE TAKING CARE OF IT.

JUST WONDERING WHAT IT WOULD TAKE TO UPGRADE THE BUILDING IT DOES NOT TAKE MUCH. YOU KNOW, SO TO MAKE AN ISSUE WE ARE NOT GOING TO USE THE BUILDING E AND F AND WHATEVER IT IS, YOU KNOW MAYBE THOSE ARE GOOD AND WE CAN FIND MORE MONEY TO BUY LITTLE RENOVATE AS WE GO , YOU NEVER KNOW. FOR SOMEBODY MAKING COMMENT THAT NOBODY USES THE BUILDING, NOT ENOUGH PEOPLE USE IT, I DON'T THINK THEY HAVE BEEN HERE LONG ENOUGH TO KNOW THAT THE BUILDING WHEN STRUCTURED AND OPENED USED BY THOUSANDS OF PEOPLE, NOT HUNDREDS, THOUSANDS OF PEOPLE. THAT WAS THE MAIN BUILDING JUST LIKE ON THE WEST SIDE LIKE WE HAVE THE MAIN BUILDING ON THE SOUTH SIDE. IS AT THE SAME THING? IT IS A CORNERSTONE ON THE WEST SIDE THAT PEOPLE USED FOR MEETINGS AND EXERCISES AND ALL THIS OTHER STUFF, BOY SCOUTS AND GIRL SCOUTS. BUT THOSE BUILDINGS WERE ALWAYS USED. NOT ONLY THE DAYTIME, BUT EVENING TOO. THAT BUILDING WAS USED. BY THOUSANDS OF PEOPLE.

I THINK BY RENOVATING AND DOING A NEW PORTION I THINK WE'RE GOING DOWN FROM 15 MILLION WHATEVER IT WAS , I THINK TOLMAN, NOW 10 MILLION, NOW NINE SOMETHING. NOT GOING TO BUILD IT FOR FREE. I THINK WHAT WE HAVE TO ME IT IS A GOOD BUILDING WITH A GOOD BASE . WE TAKE CARE OF ELECTIONS

AND THAT BUILDING. >> THAT IS ADDITIONAL COST.

>> BUT YOU'RE NOT GOING TO FIX IT AT NO COST.

>> I DON'T KNOW MUCH TROUBLE IT WOULD BE, BUT LIKE COMMISSIONER CHESNEY'S COMMENTS, THESE LITTLE SQUARES IF YOU TOOK THOSE TWO YOU CAN DO THE REPAIRS TO ALL OF THOSE TO ALL THE WINGS. IT MIGHT BE LIMITED, PAINT, FLOOR,

[03:00:02]

CEILINGS, BUT IT WOULD BE RENOVATED WHERE THEY COULD

UTILIZE. >> AGAIN , IF IT'S NOT THAT MUCH WE HAVE DONE BUILDINGS OURSELVES INTERNALLY.

INAUDIBLE ] >> YOU NEED ONE OF THE BUILDINGS AND THERE'S OUR MONEY THAN WE CAN USE IT.

>> MY QUESTION WOULD BE MORE WHAT IS THE COST ALREADY SPENT ON ARCHITECTURE AND ENGINEERING, HOW MUCH WOULD IT COST TO CHANGE THESE ITEMS OUT AND WOULD THAT GIVE THE MONEY?

NEW AREAS. >> ONE IS EXCLUDED IN THE RED.

>> I WOULD HAVE TO GET BACK TO THE COURT ON THAT AFTER TALKING

WITH CONSULTANTS. >> I HAD NOT THOUGHT ABOUT THAT, BUT IF WE COULD KEEP THE NEW RENOVATED THE OTHER WINGS AND CAPTIVITY GOES IF YOU DO NOT DO THESE PORTIONS. I KNOW THIS IS SET UP AT THE BOTTOM. IF YOU REDO BACK BEHIND IF YOU OPEN IT UP THERE IS PLENTY OF ROOM WITH ALL OF THESE TO EXTEND. THEY HAVE A GREAT PROGRAM AND WE NEED TO ACCOMMODATE THEM BY ALL MEANS, BUT DO WE HAVE TO HAVE THE NEW PORTION? I'M TRYING TO THINK OUT-OF-THE-BOX. SO COMING FORWARD WE WANT TO DO THE BEST WE CAN WITH LIMITED AMOUNT OF DOLLARS BECAUSE IT ALL SOUNDS GOOD AND WE WOULD LIKE TO COME BACK AND DO MORE BUT WE MAY NOT HAVE AN OPPORTUNITY LIKE THIS

FOR A LONG TIME. >> I WOULD SAY IT IS A SIGNIFICANT, BASICALLY THE VALUE ENGINEERING THAT WE DID IS WITHIN THE SPIRIT AND COME OF THE DESIGN, IT MAINTAINS.

>> IT'S NO OFFENSE TO YOU WHATSOEVER.

>> I UNDERSTAND, IT IS KIND OF LOW HANGING FRUIT. YOU HAVE THE ABILITY TO ADAPT THE PLAN, KEEP FUNCTIONALITY AND IT'S NOT QUITE LIKE STARTING OVER. IF WE PULL OUT THE NEW SECTIONS, THAT CHANGES THE WHOLE OPERATION OF THE BUILDING , THE ADMINISTRATION WOULD HAVE TO BE COMPLETELY RECONFIGURED AND THEY WOULD HAVE TO FIND A NEW PLACE AND THE CONNECTIVITY BETWEEN THOSE THREE WINGS THE TWO IN PARTICULAR AND EVEN THE FUTURE , PRIMARILY BETWEEN A AND C WOULD BE LOST AND WE WOULD HAVE TO DETERMINE HOW THE ADMINISTRATION WILL WORK EFFECTIVELY WITHOUT THAT CONNECTION. ALL OF THAT IS POSSIBLE, IS JUST A COMPLETELY NEW DESIGN.

>> IT HAS WORKED FOREVER. YOU'RE ADDING AN ELEMENT WE NEVER HAD TO MAKE IT MORE FUNCTIONAL, BUT THOUSANDS OF PEOPLE WHICH I AGREE 100% THE BUILDING IS USED OVER AND OVER AND WE WANT IT TO BE USED AND I WITH THE WHOLE BUILDING TO BE USED OVER AND OVER. WILL NEVER GET TO B, D, E, AND F THAT'S $4 MILLION IN TODAY'S MONEY ON THE CHEAP SIDE AND WE WILL NEVER GET TO IT. IF WE GO FORWARD WITH THIS PLAN THIS COURT NEEDS TO UNDERSTAND WE WILL NOT GET TO B, D, E, AND F AND WE WILL LEAVE THIS HAVE DONE. WHERE DO YOU GET THE

MONEY? >> COMMISSIONER MAREZ WOULD

LIKE TO MAKE A COMMENT. >> WE CAN DO D. D IS NOT THE ISSUE. YOU WANT SOME OF MY MONEY I WILL GIVE YOU MONEY.

>> GO AHEAD. >> I'M TRYING TO KIND OF , I KNOW THE ISSUE THAT HAS BEEN BROUGHT UP YOU KNOW WHERE WE ARE ALL CHARGED WITH HAVING BEING SUBJECTIVE IN PROJECTS THAT WE TRY TO SUPPORT IN OUR PRECINCT. WE WILL NOT HOLD A STRAW POLL OR ANYTHING LIKE THAT SO THE MOST FAVORITE FAVORED PROJECT WINS. WE ARE ELECTED BECAUSE WE WORK WITH STAKEHOLDERS AND PRECINCTS ENTER THE COUNTY TO PURSUE THE BEST PROJECT AND WE HAVE HEARD FROM PREVIOUS COMMISSIONERS AND OF COURSE CURRENT COMMISSIONER THAT THIS IS AN ISSUE FOR MANY YEARS NOW. I WANT TO SUPPORT THE COMMISSIONER ON THIS, BUT I DO HEAR THOSE CONCERNS ON THE PRICE. I WANT TO GO BACK FOR SOME CLARITY , I MAY BE TOTALLY OFF. THE SCOPE AND WORK THAT YOU HAVE MR. RICHTER IS, YOU CREATED A DESIGN FOR THIS IS BASICALLY RENOVATION AND SOME NEW CONSTRUCTION AND THE AREAS THAT ARE SHADED AND I'M

[03:05:04]

COLORBLIND SO FORGIVE ME. IT LOOKS PURPLE OR BLUE TO ME I DON'T KNOW WHAT THAT IS WHERE THE CURSOR IS THAT IS ADDED

HOW MUCH SQUARE FOOTAGE? >> 23,000.

>> 23. LOOKING AT THIS AGENDA ITEM FROM MARCH LOOKING AT THIS AGENDA ITEM FROM MARCH 2021 I THINK THAT'S WHEN WE FIRST EXECUTED ARCHITECTURAL SERVICE CONTRACT WITH YOU. SO ON THERE IT SAID THE DISCUSSION WILL BE TWO CONCEPTS, CONCEPTUAL DESIGNS. ONE FOR THE NEW CONSTRUCTION AND ONE FOR THE RENOVATION. IS THIS A MARRIAGE OR SHOULD THERE HAVE ALWAYS BEEN TWO SEPARATE ITEMS? THAT'S WHAT I WOULD LIKE TO FIND OUT. WE MIGHT BE PAST THAT POINT AND IF WE ARE I CAN

LIVE WITH THAT. >> MY RECOLLECTION AND I'M GLAD YOU PULLED IT UP THAT PROMPTS DISCUSSION. WHEN WE WERE FIRST HIRED IT WAS ALREADY AT THAT TIME BEING CONSIDERED TO MOVE THE BUILDING AND BUILD NEW. WE WERE ASKING TO EVALUATE PROS AND CONS OF NEW RENOVATIONS. WE WERE NOT ASKED TO DO TWO COMPETING DESIGNS TO DO WONDERFUL DESIGN NEW AND WE DID EVALUATE AND WE LOOKED AT MUCH OF THE SAME WAY THAT WE PRESENTED AS THE SUMMARY OF VALUE ENGINEERING WHERE WE TALK ABOUT THE NEW AND RENOVATION AND THE TOTAL SQUARE FOOTAGE. WE WERE AND ARE OF THE OPINION THAT THE CORE STRUCTURES OF THE SIX WINGS THAT YOU HAVE NOW ARE VALUABLE. FIRST OF ALL IT WILL COST SOMETHING CLOSE TO $1 MILLION BY THE TIME YOU DEAL WITH ASBESTOS AND EVOLUTION AND EVERYTHING TO REMOVE THEM. THE VALUE PROPOSITION IS BENEFICIAL REUSE AND REHABILITATION NOT IN REMOVAL AND REPLACEMENT, WHERE PEOPLE CAN MAKE A VERY PERSUASIVE CASE THAT IT WOULD BE NICE TO HAVE A BRAND-NEW BUILDING WITH ALL THE BENEFITS OF THE BUILDING AND OF COURSE WE SEE THAT HAPPENING ALL THE TIME. PEOPLE TEAR OUTBUILDINGS ALL THE TIME BECAUSE THEY FAVOR NEW BUILDINGS. MANY TIMES THE OLD BUILDING THAT'S REMOVED IS VERY VERY SUBSTANTIAL AND VIABLE AND HAS INTRINSIC QUALITIES THAT MAY NOT BE READILY APPARENT. THAT WAS OUR CASE TO THE COURT AT THE BEGINNING. WE FELT THERE WAS SUFFICIENT VALUE IN THE BUILDINGS TO SAVE THEM AND THAT WE WOULD HAVE A BETTER BUILDING AND A BIGGER BUILDING FOR THE SAME DOLLAR IF WE SAVED BUILDINGS THAN IF WE TORE THEM DOWN AND WE STILL THINK THAT'S TRUE. IF WE WERE TO TEAR THEM DOWN AND BUILD BACK FOR THE SAME AMOUNT OF MONEY YOU ARE LOOKING AT RIGHT HERE, WE WOULD HAVE A NEW BUILDING A SLIGHTLY SMALLER THAN THE BLUE AREA.

ALL NEW AND NOTHING ELSE, NONE OF THE EXISTING BUILDINGS.

WHEREAS WITH THIS PRICE YOU HAVE A SIGNIFICANTLY RENOVATED TWO WINGS PLUS THE NEW. EQUIVALENT OF NEW CONSTRUCTION 23,000 SQUARE-FEET PLUS THE VALUE OF EXISTING BUILDINGS. MY FIRM 'S OPINION IS THE HIGHEST VALUE TO THE COUNTY IN THE LONG-TERM IS TO HOLD THE BUILDINGS FOR BENEFICIAL REHABILITATION AT SOME POINT IN THE FUTURE. COMMISSIONER CHESNEY IS MAKING A CASE WE SHOULD RESHUFFLE THE ASSETS AND TRY TO DO MORE ON THE REHABILITATION SOONER AND LESS NEW. AND THAT IS A REASONABLE THING TO CONSIDER, BUT IT WAS NOT CONSIDERED THE HIGHEST AND THE BEST USE WHEN WE FIRST DEVELOPED THE PLAN BECAUSE WE FELT TYING THEM TOGETHER IN THIS MANNER WOULD MAKE A MORE FUNCTIONAL AND BETTER PROJECT.

SO WE THOUGHT AND STILL THINK THIS IS A GOOD PLAN FOR A COMMUNITY CENTER, BUT IT DOES LEAVE MORE OF THE BUILDING IN ITS CURRENT STATE THAN WHAT YOU MIGHT BE ABLE TO DO IF YOU TAKE THOSE NEW STRUCTURES , REMOVE THEM AND TAKE MONEY TO RENOVATE. THAT IS AN INTERESTING PROPOSITION, BUT WE DID NOT VIEW THAT AS HIGHEST AND BEST USE AND THEREFORE IT'S NOT IN THE DESIGN. IF WE WERE TO UNDERTAKE THAT NOW I SHOULD TELL THE COURT IF I DIDN'T FOR THE PURCHASING AGENT WOULD. IF WE REMOVE THE NEW CONSTRUCTION AND REDO AS PART OF VALUE ENGINEERING THE OTHER WINGS WE WOULD BE FORCED TO REBID WERE IN A INFLATIONARY

[03:10:02]

PERIOD. IF YOU LOOK AT THE PROFILE OF THE BIDS WE'VE GOT THIS TIME AND PROJECT FORWARD, WE MIGHT NOT BE PHASED IN A FAVORABLE CONDITION WHEN WE TRY TO REBID THE PROJECT

>> WHAT I'M SAYING THERE ARE A LOT OF VARIABLES.

>> THERE'S A LOT OF INFORMATION AND A LOT OF DETAILS. I DON'T KNOW IF YOU FULLY EXPLAIN WHETHER OR NOT THERE SHOULD'VE BEEN TWO CONCEPTUAL DESIGNS BECAUSE THAT WAS DISCUSSION AND ACTION THAT THE COURT TOOK IN 21 NEW CONSTRUCTION AND RENOVATION WORK IF YOU SAID THEY TOLD ME IT WAS JUST IN ONE THAT'S A GOOD ENOUGH ANSWER. DOLL WE HAVE TO BEAR DOWN ON AN ISSUE THAT I KIND OF STUMBLED OVER.

MY QUESTION WAS SIMPLY THE PROPOSAL WE HAVE WITH THE NEW HOLDINGS AND RENOVATION COMBINED INTO ONE. THAT WAS THE ANSWER AND KEPT WITH THE SPIRIT AND THE ACTION BY THE COURT, IF IT DIDN'T SOMEBODY SHOULD HAVE CAUGHT IT , ANYONE OF THE STAFF SHOULD HAVE CAUGHT IT A LONG TIME AGO THAT WAS NOT DONE. I'M NOT GOING TO CRY OVER SPILLED MILK BUT I FEEL IT'S WORTH BRINGING UP. I'M NOT READY TO TAKE ACTION ON THIS ITEM TODAY, THERE'S A LOT MORE QUESTIONS. I DO APPRECIATE WHAT COMMISSIONER CHESNEY SET IN KEEPING MONEY INCREASING FOR USE THERE WITH THE COMMISSIONER AND AS LONG AS WE KEEP THAT SPIRIT I'M IN FAVOR OF THAT. I UNDERSTAND THE MARKET AND WHEN YOU GO ASK FOR ADDITIONAL SERVICES YOU'RE NOT ONLY ADDING MORE TIME, YOU ARE ADDING MORE MONEY. THOSE OF US CONCERNED ABOUT HOW MUCH WE SPEND BY TRYING TO SAY WE ARE SPENDING, WE ARE SPENDING MORE. MY QUESTIONS AND MY CONCERN WOULD BE IF WE FOLLOW UP MORE I DON'T KNOW, IF YOU GAVE US A SIMPLE DESIGN THAT COMBINES NEW CONSTRUCTION AND RENOVATION IT SAYS TWO CONCEPTUAL DESIGNS AND I DON'T WANT TO KEEP BELABORING THE ISSUE FROM THREE YEARS AGO, BUT IT IS SPECIFIC ON THE ITEM SUBMITTED TO THE COURT FOR ACTION. SO, ONE IS FOR NEW AND ONE IS RENOVATION. IF THIS WAS COMBINED THEN YOU THOUGHT OUTSIDE THE BOX AND YOU MADE IT HAPPEN BY HAVING BOTH PARTS COMBINED INTO ONE. I CAN LIVE WITH THAT. I WANT TO MAKE SURE THAT'S NOT WHAT WE HAD TO PAY AND THEN SOMEBODY IN OUR CHECKS AND BALANCES DO NOT KEEP ON TOP OF THAT, THAT'S MY CONCERN. I UNDERSTAND WHAT YOU'RE SAYING AND THE COST OF DESIGN, SOMEBODY STAYING ON TOP OF IT TO MAKE SURE THAT HAPPENS BUT THAT'S A BIG CONCERN FOR ME.

SO I KNOW WE'VE HAD A LOT OF DISCUSSION. WHEN I WAS SEARCHING TRYING TO REMIND MYSELF OF THE DISCUSSIONS YOU ARE REFERENCING EARLIER THAT'S WHERE THIS ONE POPPED UP MARCH 24 MARCH 24, 2021. SO I WOULD LIKE TO BRING THIS BACK SO WE CAN WORK THIS WITH STAFF AND GET MORE BACKGROUND ON THIS. IN THE SPIRIT OF SAYING I DO AGREE WITH KEEPING THE SAME AMOUNT OF MONEY HERE, I DON'T WANT TO WASTE MORE TIME AND I DON'T WANT TO SPEND MORE TIME ON THIS ISSUE, BUT I THINK WE OWE IT TO THE PEOPLE IN PRECINCT 1 AND PEOPLE IN THE COUNTY TO GET THIS RIGHT. SO I RESPECTFULLY ASK THAT WE TABLE THIS ITEM FOR THE NEXT MEETING WITH FURTHER DELAYS TO ALLOW PURCHASING AND/OR PUBLIC WORKS AND/OR LEGAL TO LOOK AT THE ITEM REFERENCED MARCH 24, 2021. HILLTOP COMMUNITY CENTER CONCEPTUAL DESIGN. THERE IS DISCUSSION LANGUAGE IN THERE THAT THE COURT ACTED ON SO WE'VE GOT TO SEE. IF IT GOT

DROPPED A CONTRACT. >> I DON'T UNDERSTAND.

SOMEBODY DROPPED THE BALL I GUESS YOU DROPPED THE BALL OR I DROPPED THE BALL? IT IS A DONE DEAL WE HAVE VOTED AND TO ME IT WAS A DONE DEAL. I NEVER KNEW ABOUT THE DIFFERENT

DESIGNS. >> WE ARE SUPPOSED TO.

>> IF THIS HAS BEEN INCLUDED ALREADY IN THE DESIGN THEN PROPS TO THE TEAM FOR MAKING IT ALL IN ONE. I CAN LIVE WITH THE SPIRIT OF THAT EVEN THOUGH PROBABLY SHOULD'VE BEEN SEPARATE. IT SEEMS LIKE YOU CAPTURED THE SPIRIT OF BOTH RENOVATION AND THE NEW. I'M OKAY WITH THAT SO CAN YOU VERIFY THAT AND DEAL WITH PUBLIC WORKS.

[03:15:04]

>> A LOT OF DISCUSSION TO GO THROUGH.

>> I THINK I'M WITH YOU COMMISSIONER. AND WHAT YOU'RE PUSHING FOR, BUT I WANT TO MAKE SURE THAT WE CHECK THE BOX OFF BECAUSE THIS WAS NOT A CAN OF WORMS I WAS EXPECTING TO OPEN BUT THIS CAME UP SO I FELT WE HAD TO BRING IT UP . THERE WAS ONLY ONE DESIGN EVER THAT'S NOT WHAT WAS VOTED ON. I EMBRACE IT I SHOULD HAVE CAUGHT IT. AND IT DID NOT HAPPEN. I WILL BE READY TO ACT UPON THIS ITEM THE NEXT BOARD MEETING SORRY NEXT COMMISSIONER COURT MEETING. WE'VE ALREADY HEARD THE PROS AND CONS OF THE REASONS FOR THIS. I WILL BE

READY TO TAKE ACTION. >> I WANT TO MAKE A MOTION WE

MOVE FORWARD. >> JUDGE I WOULD LIKE TO SPEAK.

>> I WOULD LIKE TO SPEAK JUDGE. I APPRECIATE ALL OF YOU HAVING SO MUCH INTEREST IN PRECINCT 1 TODAY. MAYBE THE REASON YOU DO NOT CATCH IT IS BECAUSE HE DID NOT CARE THE TIME HOW THINGS WENT. AND COMMISSIONER CHESNEY YOU COME HERE AND TALK ABOUT PRECINCT 1 LIKE YOU LIVED THERE, BUT TAKE A LOOK BACK AT YOUR PRECINCT. HOW MUCH MONEY HAVE YOU SPENT NEEDLESSLY? I

NEVER INTERRUPTED YOU. >> YOU ARE ASKING ME A QUESTION. IF YOU ASK ME A QUESTION I WILL ANSWER. IF YOU WANT TO MAKE A STATEMENT. HE IS ASKING ME A QUESTION. IF YOU WANT TO MAKE IT AS A STATEMENT THAN I CAN REBUT WHEN YOU ARE DONE THAT WOULD BE PROPER BUT I'M NOT GOING TO LET YOU ASK A QUESTION AND NOT ANSWER. TRY ANOTHER WAY GO FOR

IT. >> YOU KNOW, THE CEREMONY YOU HAD A FEW WEEKS AGO. I WASN'T HERE, BUT WHAT I UNDERSTAND THAT WAS SUPPOSED TO BE A TWO-YEAR PROJECT. AND IT TURNED INTO A SIX-YEAR PROJECT. MUST HAVE TAKEN A LOT MORE MONEY THAN WHAT YOU ANTICIPATED. THE PIER THE BOB HALL PIER. IT HAS BEEN BILLED LONGER THAN WHAT IT WAS. YOU PUT THINGS BACK THE WAY THEY WERE. NOW, TALKING ABOUT IT IT'S GOING TO BE A LONGER PERIOD THAN WHEN IT WAS. I DON'T KNOW HOW YOU GET THINGS THROUGH AND THEN, YOU KNOW WE DECIDED THE RESTAURANT TO BEGIN WITH WAS ILLEGALLY BUILT.

THEY BUILT IT AND YOU WERE HERE AT THE TIME.

>> NO IT WASN'T. YOU KEEP SAYING THAT. THAT'S WRONG

TOO. >> $800,000 GRANT MONEY SUPPOSED TO HAVE BEEN GONE TO INSPECT THE PILINGS ON THE PIER TO SEE IF THEY WERE CORRODED.

>> EXCUSE ME. >> WE ARE NOT EVEN ON THE

SUBJECT. >> I CALL A POINT OF ORDER.

YOU WANT TO TALK ABOUT BOB HALL PIER.

>> BOTH OF YOU THAT'S ENOUGH I WILL TABLE THIS, NOT RELEVANT

TO THE DISCUSSION GOING ON. >> JUDGE, ONE LESS THING. YOU

ARE INVESTING $4 MILLION . >> THAT'S NOT CORRECT EITHER .

LET'S TABLE THIS. >> WAIT A MINUTE.

>> YOU STARTED OUT WITH $4 MILLION AND YOU SAID YOU CANNOT GET THE ELECTRICAL BURIED UNDERGROUND I DID NOT SEE YOU COMING BACK TO THE COURT AND TELLING US WE WILL

DELETE THIS. >> NONE OF THAT IS FACTUAL. WE ARE GOING TO END DISCUSSION. WE HAVE A MOTION AND A SECOND TO BRING IT BACK TO THE NEXT MEETING MAY 8. ALL THOSE IN FAVOR SAY AYE. ANY OPPOSED SAME SIGN.

MORNING COMMISSIONERS. I HAVE PROVIDED YOU ALL WITH SIGNIFICANT IMPACTS AFFECTING THE BUDGET YEAR END REPORT.

>> DO YOU HAVE ANY MORE OF THOSE?

>> AT THE TOP YOU WILL SEE GENERAL ADMINISTRATION, THERE WAS THE HEALTH INSURANCE OVERRUN COST THAT THE COURT APPROVED IN SEPTEMBER OF $4 MILLION. THE EXPENSIVE SETTLEMENT AND JUDGMENT EVERY TIME COMMISSIONERS COURT APPROVED SETTLEMENT THAT DOES NOT HAVE ANOTHER FUNDING SOURCE IT GETS PAID FROM THE SELF-INSURANCE FUND AND THEN AT THE END OF THE YEAR WE HAVE TO REIMBURSE SELF-INSURANCE FUND AND APPROVE FOR EXPECTED FUTURE SETTLEMENTS. WE ACCRUED 2,600,000 THIS YEAR. SORRY I'M A LITTLE OUT OF BREATH.

2.3, YES. 2.3 MILLION. FOR THE INSURANCE FUND, THAT IS

[03:30:10]

01-02 THE POLICY AS YOU MAY REMEMBER WHENEVER WE APPROVED IN MAY 2023 THERE WAS A HUGE INCREASE IN THOSE POLICIES.

AGAIN, EVERYTHING IN THE SELF-INSURANCE FUND THAT GOES OUT HAS TO BE REIMBURSED BY THE COUNTY. SO THE $260,000 SHORTAGE WAS THEN ALLOCATED OUT TO ALL THE FUNDS AS YOU CAN SEE BELOW THAT. 87 AND 96 BOTH HAVE , FINANCIAL REPORTING REQUIREMENTS THAT WE HAVE, THEY BOTH HAVE A FISCAL IMPACT. HOWEVER, A SIGNIFICANT PORTION OF THAT, THERE IS OFFSETTING REVENUE THAT YOU DO NOT SEE WHENEVER YOU'RE JUST DOING A CHANGE ORDER TO COVER EXPENSES THAT OFFSET THOSE SO THE NET IS ZERO. SO AGAIN, IT IS, IF YOU TOTAL AND I DID A SUBTOTAL AT THE BOTTOM. ALL OF THE INCREASED EXPENSES FOR 87 AND 96 TOTAL 11,000,350 OR $15,511. THE ACTUAL INCREASE THAT, IN EXPENSE TO BOTTOM-LINE IS $272,933. AGAIN, THIS IS A REQUIREMENT THAT WE RECEIVED THIS YEAR THAT WE HAD TO IMPLEMENT.

>> CAN I ASK REAL QUICK. IS THIS PERTAINING TO CHANGE

ORDER ONE? >> BUDGET CHANGE ORDER 23.

BUDGET CHANGE ORDER 23 FISCAL YEAR .

>> AGENDA NUMBER ONE. I WANT TO ASK THAT THIS KID TABLED BECAUSE THIS WAS JUST HANDED TO ME.

>> NO NO NO NO NO, THE BUDGET CHANGE ORDER WAS ATTACHED TO THE AGENDA. I WAS ASKED TO EXPLAIN WHY WE NEEDED TO INCREASE EXPENSES IN CERTAIN DEPARTMENTS.

>> WE GOT IT HANDED. >> WE HAVE AT THE BUDGET CHANGE

ORDER FISCAL YEAR END. >> THIS IS BACK UP FOR FURTHER EXPLANATION PER BUDGET CHANGE ORDER NUMBER ONE WHICH I JUST GOT HANDED AND I HAVE TO VOTE ON SOMETHING YOU JUST HANDED ME RIGHT? THIS IS RELATED TO BUDGET CHANGE NUMBER ONE NUMBER 23 RELATED TO THAT SO THIS IS BACK UP JUST HANDED

TO ME I'M NOT GOING TO VOTE. >> MORE INFORMATION WAS

REQUESTED. YES. >> I WOULD MAKE A MOTION TO TABLE THIS. AFTER SHE PRESENTS IT.

>> WE HAVE TO HAVE IT PHYSICAL YEAR END AT 9:30.

>> THAT'S NOT MY FAULT YOU JUST WALKED IN AND HANDED ME THIS AND EXPECT ME TO UNDERSTAND THIS. I GET IT.

>> I ASKED. >> RIGHT, AND SHE SHOULD HAVE.

I AGREE. WE SHOULD HAVE GOTTEN THIS BEFORE NOW AND I AGREE YOU DID THE RIGHT THING, I'M EITHER GOING TO VOTE NO OR TO TABLE BECAUSE I JUST GOT IT HANDED TO ME. I'M TRYING TO THINK ABOUT OTHER THINGS AND READ THIS AND LISTEN TO THIS AND I'M NOT GOING TO DIGEST THIS IN THREE MINUTES. I'M JUST SAYING WHAT I'LL DO, IF YOU ARE ALL OKAY VOTING.

>> THIS HAS TO DO WITH 3.5 MILLION INCREASE OF WHAT? I UNDERSTAND THERE WAS 3.5 MILLION EVERY YEAR WE HAVE 1.2 OR 1.3 EXPENSE NOW THIS YEAR 3.5 MILLION EXPENSES INCREASING 360% WHY? THAT'S WHAT I WAS ASKING EARLIER. WHAT

EXPENSES DID WE ADD? >> THESE EXPENSES ARE ALL IN OUR BOOKS AGAIN, WE'RE DOING A FINANCIAL REPORT 9/30/23.

THESE ARE ALL ITEMS EXCEPT FOR THE 86 OR 96 AND 87 . ALL OF THESE ITEMS HAVE COME BEFORE COMMISSIONERS COURT, ALL OF THE EXPENSES WERE APPROVED, THE BUDGET THAT I WAS ASKED TO PROVIDE AN EXPLANATION OF WHAT THE LARGE EXPENSES THAT HAPPENED AT YEAR END THAT REQUIRED SUCH A BIG BUDGET CHANGE ORDER AT 9:30, 23. SO YES, 1285 AND THAT'S THE 3.5 THAT WE NEEDED AND THE ADDITIONAL BUDGET . AGAIN JUST A PRESENTATION FOR THE YEAR END. BECAUSE AFTER WE POSTED

[03:35:01]

OUR LAST BUDGET CHANGE ORDER APPROVE BY COMMISSIONERS COURT ON SEPTEMBER 13, THE SAME COURT YOU APPROVED THE HEALTH INSURANCE OVERRUN OF $4 MILLION SO WE DID NOT HAVE A CHANCE TO

DO THAT. >> IT WAS SEPTEMBER OF LAST

YEAR. >> YES AND THIS IS A BUDGET CHANGE ORDER FOR SEPTEMBER OF LAST YEAR. WE HAVE TO WAIT FOR ALL THE EXPENSES TO COME IN. ALL OF THOSE EXPENSES .

>> A QUESTION ON AN ITEM SHE IS REFERENCED ON. INTO THE

MICROPHONE PLEASE. >> COUNTY CLERK RECORDS MANAGEMENT YES. THERE IS OFFSETTING REVENUE. SO IF YOU HAVE A REVENUE COMING IN AND EXPENSE GOING OUT THE TWO WILL NET ZERO SO THERE'S NO BOTTOM LINE IMPACT. IT IS THE

SOFTWARE. >> THAT'S PAID OUT OF SO I'M NOT SURE WHY IT'S REFERENCED. WHY IS IT TAKEN OUT FOR THE

GENERAL FUND? >> IT IS NOT IN THE GENERAL FUND, IT IS 1315. THERE'S REVENUE AND 1315 THAT WILL

OFFSET ALSO. >> WHY IS IT INCLUDED?

>> THE BUDGET CHANGE ORDER IS FOR EXPENSES INCREASED. IT WAS A CHANGE ORDER THAT WAS NEEDED AT YEAR END TO COVER THOSE, WE DON'T DO BUDGET CHANGE ORDER FOR REVENUE ONLY EXPENSES.

HAD THE SOFTWARE THAT MET THE REQUIREMENTS OF 96.

>> EXPLANATION IT WAS NOT NEEDED WE DO NOT GO OVER

BUDGET. >> I UNDERSTAND.

>> OKAY SO DO YOU WANT TO MOVE THIS COMMISSIONER CHESNEY?

>> I DON'T CARE, WHATEVER EVERYBODY ELSE WANTS TO DO.

>> COMMISSIONER GONZALEZ , YOU HAVE YOUR QUESTIONS? YOU ARE NOT READY TO MOVE FORWARD EITHER? DO YOU ALL WANT TO

BRING IT BACK? >> MOTION TO TABLE TO THE NEXT

MEETING. >> SECOND.

>> MOTION AND SECOND TO TABLE TO THE NEXT MEETING. I HAVE ONE QUESTION I WAS TOLD THIS IS CLOSING OUT THE YEAR END BEFORE WE GET PACKETS FOR NEXT YEAR DOES THIS HAVE ANY EFFECT

ON THAT? >> YES.

>> WE HAVE A MOTION TO TABLE SO WE ARE GOOD. TO THE NEXT MEETING. ALL THOSE IN FAVOR SAY AYE. ANY OPPOSED SAME SIGN.

SO, I BELIEVE UNLESS WE GO BACK I DON'T THINK THERE'S

I WOULD LIKE TO SAY THAT RIGHT NOW. THERE IS ONE OTHER QUESTION THAT I HAVE BEFORE WE MOVE FORWARD ON RECONSIDERATION . I HAVE A QUESTION FROM THE AUDITOR ON THE BUDGET CHANGE ORDER NUMBER 23. I AM TOLD IF WE DID NOT ADDRESS THIS, IS THERE ANY PROBLEM OTHER THAN IT'S GOING TO SHOW NEGATIVE AMOUNTS AT THE END OF THE YEAR IN THOSE ACCOUNTS?

>> EITHER WENT OVER. LET ME BE CLEAR FROM WHAT IT LOOKS LIKE THE VAST MAJORITY OF THE COURT VOTES WERE FOR THE COURT APPOINTED ATTORNEYS THAT THEY CANNOT ESTIMATE THIS IS NOT ANY DETRIMENT AWAY GOING OVER THE BUDGET.
