H. PUBLIC COMMENT: This section provides the public the opportunity to address the Commissioners Court on any issues within its jurisdiction. The Commissioners Court may not take formal action on any requests made during the Public Comment period which are not on the Agenda, but can refer such requests to County staff for review if appropriate.
1. Nueces County Library Advisory Board - Recommend reopening for letters of intent/applications April 10, 2024 to April 17, 2024 at 5:00 p.m.
2. South Texas Water Authority - Recommend reopening for letters of intent/applications April 10, 2024 to April 17, 2024 at 5:00 p.m.
2. CONSENT AGENDA: The following Agenda Items are of a routine nature, and the Commissioners Court has received supporting materials for consideration. All of these Agenda Items will be passed with one vote without being discussed separately, unless a member of the Commissioners Court or the public requests that a particular Agenda Item be discussed. If so, that Agenda Item will be pulled from the Consent Agenda and discussed as part of the regular Agenda at the appropriate time. One vote will approve the remaining items on the Consent Agenda.
M. Approve Amendment No. 3 for extension of the contract expiration date to September 30, 2024, with the Texas Water Development Board related to the Tri-County Drainage Study.
N. Approve award and execution of Contractor Agreements for Job Order Contracting Services for General Construction and Multi-Trades (RFP No. 3256-23).
1. Discuss, consider and take action on Nueces County Game Room Regulations and all related matters.
2. Discuss and consider adopting 1st Amendment to the Amended Cooperative Agreement for City Operated Corpus Christi-Nueces County Public Health District and related matters.
3. Discuss and consider granting a Potable Waterline Easement and Right of Way to the University of Texas at Austin, Marine Science Center related to UTMSI’s construction of student housing on property adjoining County-owned property near the IB Magee Beach Park, and related matters.
4. Discuss and consider Coastal Parks seeking grant funding from the Texas General Land Office's Coastal Management Program to assist with costs to update the County's Beach Management Plan (BMP) and the Joint County/City Erosion Response Plan (ERP).
5. Discuss and consider executing a one-year GSA contract #47QTCA20D002T for $35,084.05 with Projectmates for construction project management software to be integrated into Workday financial software and all related matters.
6. Discuss and consider authorizing execution of Interlocal Agreement between the Regional Transportation Authority (RTA) and Nueces County providing for (2024) Street Improvement Program funding in an amount of $111,108.00.
7. Discuss and consider the selection of International Consulting Engineers for Engineering Services under Master Service Contract No. #20230259-4/26 (RFQ No. 3232-23) for the Hazel Bazemore Park Improvement Project, Precinct 1.
8. Discuss and consider authorizing and approving the selection of Levy Dykema for Oscar Ortiz Park Additions & Renovations.
9. Discuss and consider authorizing and approving execution of an agreement with Musco Lighting, under BuyBoard Cooperative Contract No. 677-22, for the purchase of Lighting Structures at Banquete Park in the total amount of $395,460.00.
10. Discuss and consider the creation of a County Assistance District or any other appropriate legal entity that allows the County to do this; and all related matters (551.071). Discuss and consider the possibility of Nueces County using the expiring 1/8 cents sales tax in conjunction with the creation of a County Assistance District, which would provide county wide drainage assistance, assistance and support of law enforcement, inland parks and pools, coastal parks, beaches and piers, tuition assistance for Nueces County residents, assistance for road improvements, and assistance for animals; and all related matters.
11. Discuss and consider moving forward with the ARPA approved engineer, Freese and Nichols, Inc., for the widening of the bridge on County Road 47 and all related matters.
12. Discuss and consider approving the ARPA beneficiary agreements for the Rescue House of South Texas dba Hope Unlimited ($49,500) and the Veterans Band of Corpus Christi Texas ($49,500).

4. EXECUTIVE SESSION: PUBLIC NOTICE is given that the Commissioners Court may elect to go into an Executive Session anytime during the meeting to discuss matters listed anywhere on the Agenda, when authorized by the provisions of the Open Meetings Act, Chapter 551 of the Texas Government Code. To the extent there has been a past practice of distinguishing items for public deliberation and those for executive session, the public is advised that the Court is departing from that practice, and reserves the right to discuss any listed agenda items in executive session when authorized by law to do so. In the event the Commissioners Court elects to go into Executive Session regarding an agenda item, the section or sections of the Open Meetings Act authorizing the Executive Session will be publicly announced by the presiding officer. In accordance with the authority of the Government Code, Vernon’s Texas Codes, Sections 551.071, 551.072, 551.073, 551.074, 551.0745, 551.076, 551.086, 551.087, the Commissioners Court will hold an Executive Session to consult with attorney(s) including matters related to litigation; deliberate regarding real property, prospective gift(s), personnel matters, including termination, county advisory bodies, security devices, and/or economic development negotiations and other matters that may be discussed in an Executive Session. Upon completion of the Executive Session, the Commissioners Court may in an open session take such action as appropriate on items discussed in an Executive Session.
B. Consult with the County Attorney on Cause No. 2023CCV-60026-2; Robert Novotny v. Nueces County, Texas, in the County Court at Law #2, Nueces County, Texas (Tex. Gov’t Code § 551.071); discuss, consider, and take action to approve related settlement documents, authorize County Judge to execute related Release, Waiver and Settlement documents, authorize the issuance and release of an expedited check; and related matters.
D. Consult with County Attorney regarding legal matters related to the reorganization of county departments, and reduction in force generally pursuant to the Nueces County Personnel Policy Manual; and all related matters. (551.071) Discuss and consider taking action related to Social Services Department in the 2024-2025 fiscal year in regular session if appropriate.
F. Deliberate business and financial issues related to a contract being negotiated: Interlocal Agreement Between the City of Corpus Christi and Nueces County Tax Increment Reinvestment Zone Number Six (TIRZ No. 6, Barisi Village); and related matters (Tex. Gov’t Code § 551.0725); discuss, consider, and take action in regular session if needed.
