G. PUBLIC COMMENT: This section provides the public the opportunity to address the Commissioners Court on any issues within its jurisdiction. The Commissioners Court may not take formal action on any requests made during the Public Comment period which are not on the Agenda, but can refer such requests to County staff for review if appropriate.

1. SPECIALLY SET ITEM FOR 1:00 P.M. Discuss possible projects for submission under the CDBG-MIT grant, including drainage projects.
2. CONSENT AGENDA: The following Agenda Items are of a routine nature, and the Commissioners Court has received supporting materials for consideration. All of these Agenda Items will be passed with one vote without being discussed separately, unless a member of the Commissioners Court or the public requests that a particular Agenda Item be discussed. If so, that Agenda Item will be pulled from the Consent Agenda and discussed as part of the regular Agenda at the appropriate time. One vote will approve the remaining items on the Consent Agenda.
I. Approve Listing of Grants to be included in the Vendor Payments Exception List not requiring Commissioners Court pre-approval.
1. Discuss and consider approving a budget amendment for Nueces County Hospital District fiscal year 2022/2023 budget allocation to the Nueces County Juvenile Justice Center from $407,000.00 to $474,000.00.
2. Receive an update on the status of the Bob Hall Pier design, chloride testing, permitting, schedule and budget. Discuss and consider the results of the chloride testing and possible solutions within the already approved budget.
3. Discuss and consider approval of a Professional Services and License Agreement between Nueces County Coastal Parks and the Gordian Group to provide a customized Job Order Contract (JOC) Complete Solutions.
4. Discuss and consider approval of a Dune Protection Permit for large scale construction of a single-family residence (DPP-202209-01) located at Lot 5, Mustang Island Estates, Corpus Christi TX.
5. Discuss and consider approval of a Dune Protection Permit for large scale construction of a single-family residence (DPP-202209-02) located at 113 Backside Drive in Lot 11, Blk 3 of Island Park Estates, Corpus Christi TX.
6. Receive briefing from Nueces County Office of Emergency Management on 2022 Winter Storm Elliott.
7. Discuss and consider approval of Agreement Supplement No. 2 to the Agreement with Lockwood, Andrews, & Newnam, Inc. for Consulting Services for Hazard Mitigation Action Plan (HMAP) under RFP No. 3189-22 Agreement and Amendment Supplement No. 1 to reflect correction of agreed upon reimbursements and total reimbursements.
8. Discuss and consider the elimination of the NCDC to coordinate our efforts with existing economic development organizations to better optimize economic development throughout Nueces County and all related matters.
9. Discuss and consider the ratification of previously passed updated Nueces County Commissioners' Court Policy and Procedure Guidelines.
10. Discuss and consider that all non-consent agenda items have an accompanying written staff recommendation in the Commissioners Court packet provided prior to the Commissioners Court meeting.
11. Discuss and consider funding sources for furniture needs for the county outreach medical clinic located at the Calderon building.
12. Discuss and consider an Order of Commissioners Court to procure construction services for the proposed Animal Care Center through a Request for Competitive Sealed Proposals as authorized under Section 2269.151 of the Texas Government Code.
13. Discuss and consider whether, pursuant to Texas Government Code, 551.0725, deliberation in an open meeting would have a detrimental effect on the position of the Commissioners Court with Banquete ISD in negotiating the terms of the Memorandum of Understanding between Banquete ISD and Nueces County to supply temporary school resource officer from American Rescue Plan Act (ARPA) funding; and related matters.

15. Discuss and consider whether, pursuant to Texas Government Code, 551.0725, deliberation in an open meeting would have a detrimental effect on the position of the Commissioners Court with Banquete ISD, Bishop ISD, Driscoll ISD, and West Oso ISD in negotiating the terms of the AT&T Agreements related to School Safety Technology from American Rescue Plan Act (ARPA) funding; and related matters.

17. Discuss and consider ratification of agreement between U.S. Immigration and Customs, Enforcement and Local, County and State Law Enforcement Agency and Nueces County Sheriff's Department for reimbursement of costs incurred by the Sheriff's Department in their participation in the program with Homeland Security Investigations (HSI); and related matters.
18. Discuss and consider acceptance and approval of Progressive Insurance’s offer of settlement for Nueces County's "total loss" property damage claim associated with an October 17, 2022 incident involving a Nueces County Constable Precinct 4 vehicle; authorize the County Judge and/or other appropriate County official to execute all documents as necessary in order to complete this settlement transaction; and related matters.
19. Discuss and consider approval of the supplemental engagement letter dated December 29, 2022 with Doug Chaves of Chaves, Obregon, & Perales LLC to represent Nueces County as co-counsel in providing legal services related to San Patricio/Nueces County boundary dispute and tax legislation.
20. Discuss and consider approval of the fifth supplemental engagement letter dated December 28, 2022 with Craig Enoch and his firm Enoch Kever PLLC to provide legal services related to San Patricio/Nueces County boundary dispute and tax legislation.

1. Approve the Criminal Justice Information System (CJIS) Addendum to the Master Odyssey Agreement.
2. Discuss and consider authorizing two temporary employees at 29 hours per week for 90 days to assist with ongoing intercom replacements at the county jail.
4. EXECUTIVE SESSION: PUBLIC NOTICE is given that the Commissioners Court may elect to go into an Executive Session anytime during the meeting to discuss matters listed anywhere on the Agenda, when authorized by the provisions of the Open Meetings Act, Chapter 551 of the Texas Government Code. To the extent there has been a past practice of distinguishing items for public deliberation and those for executive session, the public is advised that the Court is departing from that practice, and reserves the right to discuss any listed agenda items in executive session when authorized by law to do so. In the event the Commissioners Court elects to go into Executive Session regarding an agenda item, the section or sections of the Open Meetings Act authorizing the Executive Session will be publicly announced by the presiding officer. In accordance with the authority of the Government Code, Vernon’s Texas Codes, Sections 551.071, 551.072, 551.073, 551.074, 551.0745, 551.076, 551.086, 551.087, the Commissioners Court will hold an Executive Session to consult with attorney(s) including matters related to litigation; deliberate regarding real property, prospective gift(s), personnel matters, including termination, county advisory bodies, security devices, and/or economic development negotiations and other matters that may be discussed in an Executive Session. Upon completion of the Executive Session, the Commissioners Court may in an open session take such action as appropriate on items discussed in an Executive Session.
B. Consult with County Attorney regarding legal matters related to acceptance and approval of Progressive Insurance's offer of settlement for Nueces County's Total loss" property damage claim associated with an October 17, 2022 incident involving a Nueces County Constable Precinct 4 vehicle; authorize the County Judge and/or other appropriate County official to execute all documents as necessary in order to complete this settlement transaction; and related matters.
