The Nueces County Commissioners Court will meet on the above date at 9:15 a.m. in the Commissioners Courtroom, 3rd floor, Nueces County Courthouse, 901 Leopard, Corpus Christi, Texas. SAMUEL L. GONZALEZ COMMISSIONER, PRECINCT NO. 2 JOHN MAREZ COMMISSIONER, PRECINCT NO. 3 BRENT CHESNEY COMMISSIONER, PRECINCT NO. 4 KARA SANDS, CLERK OF THE COURT INFORMATION ON THE COMMISSIONERS COURT AGENDA CONSENT AGENDA: At most meetings, the Commissioners Court establishes a Consent Agenda. It consists of those Agenda Items which are routine or non-controversial, and which neither a member of the Commissioners Court nor the public has asked to be pulled for discussion. Once the Commissioners Court has established the Consent Agenda, Agenda Items included on it will be voted upon in one vote, and will not be discussed separately unless requested by the County Judge, Commissioner, or a citizen. EXECUTIVE SESSION: The Commissioners Court may go into Executive Session to discuss those matters listed anywhere on the Agenda or as otherwise permitted by law. PUBLIC COMMENT: Members of the public will have the opportunity to address the Commissioners Court during this section on any Agenda Item or any subject within its jurisdiction except a matter related to pending litigation. Each speaker should sign in on the Public Comment Sheet available at the rear of the Courtroom at least five (5) minutes before commencement of the Commissioners Court meeting. Speakers should limit their comments to two (2) minutes. The County Judge may, if he deems it necessary, limit both the number of speakers and the time allotted to each speaker. Under the law, the Commissioners Court may only take action on items specifically listed on the Agenda. Subject matter presented which is not part of the Agenda will be referred to the appropriate department for review and subsequent action. Materials submitted during public hearings will not be returned unless prior arrangements have been made through the County Clerk, with the approval of the County Judge. At least ten (10) copies of any document to be used by any speaker should be available for distribution. The speaker’s name and, if applicable, Agenda Item number should be clearly marked on such documents. Public Comment for items not on the Agenda will normally be held at the end of the meeting. ADJOURNMENTS IN MEMORY: The Commissioners Court may adjourn the meeting in memory of deceased community leaders, County employees, and other distinguished persons. Requests for Adjournment in Memory may be made through any County Commissioner or the County Judge. AUXILIARY AIDS OR SERVICES: Persons with disabilities who plan to attend this meeting of the Commissioners Court, and who may need special assistance, services or auxiliary aids, should contact the Office of the Nueces County Judge (361-888-0444) at least forty-eight (48) hours ahead of the meeting so that appropriate arrangements can be made.
A. Authorize payment of bills - manual check registers dated December 23, 2016 - January 10, 2017.
B. Authorize payment of bills - regular bill summaries dated December 30, 2016, January 6, 2017, January 9, 2017 and January 13, 2017.
C. Authorize payment of bills - special motions list dated January 18, 2017.
D. Authorize payment of bills - group health insurance claims and fees dated December 1, 2016 - December 31, 2016, January 5, 2017.
E. Approve personnel actions of a budgeted nature: 1. Temp List No. 409 2. Unfreeze List No. 748 3. Personnel Changes Report dated December 23, 2016, December 30, 2016 and January 6, 2017.
G. Accept filing of annual continuing education transcript for Kevin Kieschnick, Tax Assessor-Collector.
H. Authorize the purchase with Miller Environmental Services, LLC for storm sewer cleanout for the Blue Bonnet and San Pedro Subdivisions.
I. Authorize the purchase with Luchazie Construction to paint the interior and exterior of the Robstown Community Center.
K. Rescind a BuyBoard purchase from Romco Equipment Co. for an Asphalt Distributor Tank authorized on December 1, 2016; authorized a TASB BuyBoard State Contract No. 515-16 purchase from Romco Equipment Co. for an asphalt distributor tank to be installed on a cab and chassis from ATC Freightliner Group.
L. Authorize a TxSmartBuy Contract No. 071-072-A1 purchase with ATC Freightliner Group for cab and chassis to install an asphalt distributor tank.
M. Approve a finding for the method of procurement (request of competitive bids) for the surface waterlines and connections in the Ranch Colonia project; and authorize the purchasing agent to publish a notice.
N. Ratify the execution of a grant agreement accepting an award from the Texas Department of Agriculture Home-Delivered Meal Grant Program.
P. Accept for record purposes, executed lease agreements for FY 2016-2017 at the Nueces County Airport. 1. T-1 and T-10 Hangar - Donald Bayne Horne 2. T-16 and T-17 Hangar - Guillermo A. Pliego
Q. Ratify approval of Amendment No. 1 to Texas Department of Transportation Airport Project Participation Agreement.
A. Discuss and consider property damage claim submitted by Grace Gonzalez.
B. Ratify the hiring of Jo Ellen Hewins, Attorney At Law, to provide Legal Representation of Laura Garza Jimenez, County Attorney, in her capacity as Nueces County Attorney in Cause No. 2016DCV-6110-F, Warren Alkek d/b/a A&A Bail Bonds v. State of Texas, Mark Skurka, in his capacity as Nueces County District Attorney, and Laura Garza Jimenez, in her capacity as Nueces County Attorney, in the 214th District Court of Nueces County, Texas; ratify approval of the legal representation agreement, authorize the County Judge to sign the agreement and related matters.
C. Discuss and consider settlement of Civil Action No. 2:15-CV-00302; Elizabeth M. Leal v. Corpus Christi-Nueces County Public Health District, and Annette Rodriguez, In The United States District Court for the Southern District of Texas, Corpus Christi Division; authorize the County Judge to sign the settlement agreement, and related matters.
D. Consult with County Attorney regarding the status of Civl Action No. 2:16-CV-153, Danny Gonzales v. Nueces County, Texas; Justin Noland, Individually; Deputy Perales, Individually; S. Charleton, Individually; J. Medina, Individually; J. Villanueva, Individually; and A. Munoz, Individually, In The United States District Court for the Southern District of Texas, Corpus Christi Division and related matters.
E. Consult with the County Attorney to discuss and consider the status of Cause No. 2016DCV-5228-H, Joshua Sorensen v. Nueces County Civil Service Commission, Nueces County, Texas, and James "Jim" Kaelin, In The 347th Judicial District Court, Nueces County, Texas; and related matters.
