The Nueces County Commissioners Court will meet on the above date at 9:15 a.m. in the Commissioners Courtroom, 3rd floor, Nueces County Courthouse, 901 Leopard, Corpus Christi, Texas. SAMUEL L. ORTIZ COMMISSIONER, PRECINCT NO. 3 BRENT CHESNEY COMMISSIONER, PRECINCT NO. 4 KARA SANDS, CLERK OF THE COURT INFORMATION ON THE COMMISSIONERS COURT AGENDA CONSENT AGENDA: At most meetings, the Commissioners Court establishes a Consent Agenda. It consists of those Agenda Items which are routine or non-controversial, and which neither a member of the Commissioners Court nor the public has asked to be pulled for discussion. Once the Commissioners Court has established the Consent Agenda, Agenda Items included on it will be voted upon in one vote, and will not be discussed separately unless requested by the County Judge, Commissioner, or a citizen. EXECUTIVE SESSION: The Commissioners Court may go into Executive Session to discuss those matters listed anywhere on the Agenda or as otherwise permitted by law. PUBLIC COMMENT: Members of the public will have the opportunity to address the Commissioners Court during this section on any Agenda Item or any subject within its jurisdiction except a matter related to pending litigation. Each speaker should sign in on the Public Comment Sheet available at the rear of the Courtroom at least five (5) minutes before commencement of the Commissioners Court meeting. Speakers should limit their comments to two (2) minutes. The County Judge may, if he deems it necessary, limit both the number of speakers and the time allotted to each speaker. Under the law, the Commissioners Court may only take action on items specifically listed on the Agenda. Subject matter presented which is not part of the Agenda will be referred to the appropriate department for review and subsequent action. Materials submitted during public hearings will not be returned unless prior arrangements have been made through the County Clerk, with the approval of the County Judge. At least ten (10) copies of any document to be used by any speaker should be available for distribution. The speaker’s name and, if applicable, Agenda Item number should be clearly marked on such documents. Public Comment for items not on the Agenda will normally be held at the end of the meeting. ADJOURNMENTS IN MEMORY: The Commissioners Court may adjourn the meeting in memory of deceased community leaders, County employees, and other distinguished persons. Requests for Adjournment in Memory may be made through any County Commissioner or the County Judge. AUXILIARY AIDS OR SERVICES: Persons with disabilities who plan to attend this meeting of the Commissioners Court, and who may need special assistance, services or auxiliary aids, should contact the Office of the Nueces County Judge (361-888-0444) at least forty-eight (48) hours ahead of the meeting so that appropriate arrangements can be made.
A. Authorize payment of bills - manual check registers dated July 6, 2016 - July 26, 2016.
B. Authorize payment of bills - regular bill summaries dated July 8, 2016, July 15, 2016, July 18, 2016, July 22, 2016 and July 29, 2016.
C. Authorize payment of bills - special motions list dated August 3, 2016.
D. Authorize payment of bills - group health insurance claims and fees dated: Monthly - June 2016 and Weekly - July 7, 14 and 21, 2016.
E. Authorize payment of Pcard purchases for the month of June 2016.
F. Approve personnel actions of a budgeted nature: 1. Temp List #401 2. Unfreeze List #737 3. Personnel Changes Report dated July 8, 2016, July 15, 2016 and July 22, 2016
G. Approve appointment of Juan Ramirez, Animal Control Manager, as Local Rabies Control Authority pursuant to Chapter 826 of the Texas Health and Safety Code.
H. Approve Drug Forfeiture expenditures from the District Attorney's Office, pursuant to Chapter 59 of the Texas Code of Criminal Procedure for $1,149 reimbursement for State Bar dues.
I. Ratify agreement with Microsoft acknowledging participation of Nueces County in the Software Asset Management (SAM) engagement.
J. Ratify the submission of a grant application to the Texas Department of Emergency Management for the Hazard Mitigation Grant Program (HMGP) for FEMA-4245-DR and FEMA-4255-DR.
K. Approve an agreement with The Gordian Group to develop, implement, and support a Job Order Contract program per Buyboard Contract No. 334-10.
L. Approve a purchase with Evergreen Landscape Services for the mowing of right of ways in Commissioner’s Pct. 2 area.
M. Approve a purchase with Alvarado Electric Services Group for the replacement of an electrical panel at the Hilltop Community Center.
N. Approve a DIR Contract No. DIR-TEX-AN-NG-CTSA-005 purchase for cell phone equipment and service from AT&T.
O. Approve a TASB BuyBoard State Contract No. 461-14 purchase with ProTech Mechanical, Inc. to replace 12.5 condenser, re-route line set and electrical, and install a new concrete pad.
Q. Authorize Sole Source purchase from Hart InterCivic for software license and support annual renewal for the County Clerk?s Office.
R. Approve execution of Agreement Amendment No. 4 with Wage Works, Inc. and Aflac for RFP No. 2912-12 Cafeteria Administration, including Premium Only Plan (POP) & Enrollment/Billing Services.
S. Approve an agreement with Grace Paving and Construction, Inc. for IFB 3014-16 Nueces County Westhaven Park Improvements Project.
T. Authorize Sole Source purchase to move location of where services terminate, upgrade modem and router, and add TV service from Time Warner Cable Business Class for the Bishop Library.
U. Accept County Judge's appointment of Kelly Harlan as Chair of the Nueces County Airport Advisory Board.
V. Approve the application procedure for the Nueces County Special Task Unit of Adult Protective Services.
W. Approve a finding for the method of procurement (request of competitive bids) for renovations to the former Social Services Office space for the IT Department; and authorize the purchasing agent to publish a notice.
X. Approve an agreement with JE Construction Services for IFB 3016-16 Terry Shamsie Boulevard Reconstruction.
A. Discuss and consider the status of Cause No. 2016-DCV-0112-C, B&T Towing, LLC v. Constable Robert W. Sherwood, Individually and in his Official Capacity; Mrs. Woody Jr's, Inc.; Erika's Wrecker Service; and E&J Auto Truck & Rv, in the 94th Judicial District Court of Nueces County, Texas, and related matters.
B. Discuss and consider the status of Cause No. 2014-DCV-5145-D, Mateo Garcia v. Nueces County, Texas, in the 105th Judicial District Court of Nueces County, Texas, and related matters.
C. Consult with County Attorney to seek legal advice as to the County's legal remedies regarding Fred Burkhardt's demand letter to cease the CR61 Nueces County drainage project and related matters.
