The Nueces County Commissioners Court will meet on the above date at 9:15 a.m. in the Commissioners Courtroom, 3rd floor, Nueces County Courthouse, 901 Leopard, Corpus Christi, Texas. SAMUEL L. ORTIZ COMMISSIONER, PRECINCT NO. 3 BRENT CHESNEY COMMISSIONER, PRECINCT NO. 4 KARA SANDS, CLERK OF THE COURT INFORMATION ON THE COMMISSIONERS COURT AGENDA CONSENT AGENDA: At most meetings, the Commissioners Court establishes a Consent Agenda. It consists of those Agenda Items which are routine or non-controversial, and which neither a member of the Commissioners Court nor the public has asked to be pulled for discussion. Once the Commissioners Court has established the Consent Agenda, Agenda Items included on it will be voted upon in one vote, and will not be discussed separately unless requested by the County Judge, Commissioner, or a citizen. EXECUTIVE SESSION: The Commissioners Court may go into Executive Session to discuss those matters listed anywhere on the Agenda or as otherwise permitted by law. PUBLIC COMMENT: Members of the public will have the opportunity to address the Commissioners Court during this section on any Agenda Item or any subject within its jurisdiction except a matter related to pending litigation. Each speaker should sign in on the Public Comment Sheet available at the rear of the Courtroom at least five (5) minutes before commencement of the Commissioners Court meeting. Speakers should limit their comments to two (2) minutes. The County Judge may, if he deems it necessary, limit both the number of speakers and the time allotted to each speaker. Under the law, the Commissioners Court may only take action on items specifically listed on the Agenda. Subject matter presented which is not part of the Agenda will be referred to the appropriate department for review and subsequent action. Materials submitted during public hearings will not be returned unless prior arrangements have been made through the County Clerk, with the approval of the County Judge. At least ten (10) copies of any document to be used by any speaker should be available for distribution. The speaker’s name and, if applicable, Agenda Item number should be clearly marked on such documents. Public Comment for items not on the Agenda will normally be held at the end of the meeting. ADJOURNMENTS IN MEMORY: The Commissioners Court may adjourn the meeting in memory of deceased community leaders, County employees, and other distinguished persons. Requests for Adjournment in Memory may be made through any County Commissioner or the County Judge. AUXILIARY AIDS OR SERVICES: Persons with disabilities who plan to attend this meeting of the Commissioners Court, and who may need special assistance, services or auxiliary aids, should contact the Office of the Nueces County Judge (361-888-0444) at least forty-eight (48) hours ahead of the meeting so that appropriate arrangements can be made.
A. Authorize payment of bills - manual check register dated August 11 - 24, 2015.
B. Authorize payment of bills - regular bill summaries dated August 14, 2015, August 18, 2015, August 21, 2015 and August 28, 2015.
D. Approve personnel actions of a budgeted nature: 1. Application Temporary List No. 382 2. Unfreeze List No. 716 3. Personnel Changes report dated August 14, 2015 and August 21, 2015
E. Authorize payment of bills - group health insurance claims and fees for the week of August 13 and 20, 2015.
F. Authorize payment of Pcard purchases for the month of July, 2015.
G. Approve and accept donations (list attached) to the county in accordance with LGC 81.032.
H. Approval of amendment to the 2014-2015 Outside Agency Contract by and between Nueces County and the Corpus Christi Regional Economic Development Corporation previously approved on June 3, 2015. An additional $3,200 from Commissioner Pct. 4 will increase the total contract to $12,000 for FY 2014/2015.
I. Approve diabetes contract with American Diabetes Association for FY2014/2015.
J. Appoint Ramon Herrera, Animal Control Manager, as Local Rabies Control Authority pursuant to Chapter 826 of the Texas Health and Safety Code.
K. Authorize/Execute hangar lease agreements for the following at the Nueces County Airport: 1. Dana Gunter 2. F.A. Sternberg 3. Gregory P. Gideon 4. Guillermo Pliego 5. L. Ratify the execution of a grant contract with the Texas State Library and Archives Commission for the FY 2016 Special Projects Grant Program.
M. Authorize execution of Supplemental Agreement No. 1 between Nueces County and LNV, Inc. for engineering services for RFQ No. 2977-14 surface water lines and connections in Cindy Park.
O. Authorize a DIR Contract No. DIR-SDD-1951 purchase for 20 computers and monitors from Dell for the Keach Family Library.
P. Approve execution of an agreement with Maldonado Nursery & Landscaping, Inc. for IFB No. 2980-15 Packery Channel Nature Preserve Park Habitat Restoration Enhancement Project.
Q. Authorize/execute Amendment No. 2 to agreement with The Doctor’s Center for RFP No. 2884-11 Alcohol, Controlled Substances & Blood Specimen Testing Program.
R. Accept the following "Diabetes" Reports for FY 2013-2014: 1. Calallen ISD 2. Tuloso-Midway ISD

A. Consult with outside counsel to receive legal advice and discuss status of Civil Action No. 2:12-CV-131, Nueces County, Texas v. MERSCORP Holdings, Inc. Mortgage Electronic Registration Systems, Inc., and Bank of America, N.A., In the United States District Court for the Southern District of Texas, Corpus Christi Division and related matters.
B. Consult with outside attorney to provide legal advice relating to Commissioners Court's legal rights, duties, privileges, and obligations under the American with Disabilities Settlement Agreement with the Department of Justice and related matters.
C. Consult with outside attorney pursuant to Section 551.071(2), Texas Gov’t. Code to receive legal advice and counsel relating to the County’s legal rights, privileges, duties, and obligations in connection with the pending collective bargaining process and specifically with respect to the possible impasse status of the negotiations and related matters.
