I WANTED TO MAKE A COUPLE OF COMMENTS. AND CORRESPONDENT WAS SENT TO THE COURT AFTER THE RECOMMENDATION OF CSP 3187.21 FOR THE PIER DEMO WHERE IT WAS RECOMMENDED THAT JM DAVIDSON GET THE AWARD. OUR CORRESPONDENCE PROTESTED THAT RECOMMENDATION. I WANTED TO FILL IN A COUPLE OF THINGS ABOUT WHO WE ARE AND WHAT WE DO IN THE AREA. WE FEEL THE RECOMMENDATION OF THE COURT WAS NOT MADE IN THE CONFINES OF THE BID DOCUMENTS. WE FEEL PREFERENTIAL BIAS WAS GIVE TO THEM BECAUSE OF THEIR LOCATION TO THE HOME OFFICE. WITH THAT SAID, WE WERE $100,000 LOW ON THE BID, WHICH WAS A CSP, WE UNDERSTAND, AND BUT THE PROGRAM MANAGER RECOMMENDED US AS THE AWARD AND BEHIND CLOSED DOORS THE COURT CAME BACK THEY RECOMMEND THE DAVIDSON.

WITH THAT BEING SAID, PRIOR TO THE AWARD OF THE PROJECT, WE WANT TO YOU KNOW WE FULFILLED ALL THE REQUIREMENTS IN THE BID DOCUMENTS TO BE AWARDED THE PROJECT.

FOR TWO YEARS THE DISTRICT ATTORNEY NAMELY THE INVESTIGATORS HAVE PETITIONED FOR VEHICLES TO PERFORM THE JOB. THE VEHICLES WERE HAND ME DOWNS. WHAT I MEAN THEY WERE OLD PATROL VEHICLES WITH 60, 70,000 MILES. I TRIED ADDRESSING THIS AS PROFESSIONALLY AS POSSIBLE.

NOTHING WORKS. I HAVE TAKEN THE ISSUE UP WITH THE DISTRICT ATTORNEY AND THE FIRST ASSISTANT DISTRICT ATTORNEY WHO BROUGHT IT UP BEFORE.

NOTHING SEEMS TO BE DONE ABOUT THIS. I UNDERSTAND THE COUNTY IS TRYING TO REPLACE AND UPDATE THE FLEET. I WOULD LIKE TO STATE OUR OFFICE IS PASSED OVER FOR REASONS I DO NOT UNDERSTAND AND THE PROBLEM WITH THE VEHICLES ONLY CONTINUE TO GROW AND COST MORE EACH YEAR. WE ARE COLD NEW VEHICLES WERE COMING TO THE OFFICE. THIS IS TWO YEARS AGO. THEN THE VEHICLES WERE COMING.

NOTHING WAS DONE. WE ARE COLD THEY WOULD BE HERE AND NOTHING WAS DONE.

I SUBMITTED REPORTS TO MIKE ROBINSON TO REPAIR MY VEHICLE WAS GOING TO BE $6000.

THE VEHICLE ALONE IS WORTH ABOUT 4000 MAYBE AT BEST. WE HAD ANOTHER THAT WAS GIVEN TO US THAT WAS A HAND ME DOWN AND SPEND ANOTHER 4000 TO FIX THAT UP.

THERE ARE REPAIRS THAT NEED TO BE DONE. THE COST WE ESTIMATED I JUST, WITH THE MECHANIC RUN IT THROUGH, PROBABLY $25,000 FOR THE VEHICLES.

AND THIS IS NOT GOOD USE OF MONEY AND WE CANNOT PICK UP WITNESSES OR VICTIMS FOR TRIALS OR ANYTHING ELSE BECAUSE WE'RE AFRAID THEY WILL NOT MAKE IT. AND WHEN ARE WE GETTING THEM AND WHY IS THERE A DELAY? I UNDERSTAND THE COUNTY HAS ISSUES AND ISSUES WITH THE VEHICLES BUT THE PROBLEM IS WHEN ARE YOU SPENDING MORE MONEY THAN A VEHICLE IS WORTH THAT'S NOT RESPONSIBLE SPENDING AND NOT VERY SMART ESPECIALLY IF WE HAVE TO TRANSPORT SOMEONE AND SOMETHING HAPPENS TO THE VICTORY THE LIABILITY FALLS ON THE COUNT.

WHAT I MEAN BY LIABILITY I WAS SUED BEFORE WHEN I WAS WITH THE POLICE DEPARTMENT FOR A VEHICLE ACCIDENT. THEY VEENED ALL THE MAINTENANCE RECORDS.

THERE ARE TWO OPTIONS FOR THE COURT TO CONSIDER, BOTH OPTIONS HAVE THE SAME BASE MANAGEMENT FEES, THE DIFFERENCES ARE PRIMARILY IN THE LENGTH OF THE TERM, OPTION ONE HAS A FIVE-YEAR INITIAL PERIOD WITH TWO ONE-YEAR RENEWALS AND OPTION 2 HAS A THREE-YEAR CONTRACT WITH TWO ONE-YEAR RENEWALS. UNDER OPTION ONE, THERE IS A CAPITAL INVESTMENT PROPOSED OF $100,000 IN YEAR ONE AND $75,000 IN YEAR TWO AND THEN UNDER OPTION 2.

THERE IS A ONE-TIME CAPITAL INVESTMENT AMOUNT OF $110,000.

AND THEN WITH REGARD TO THE INCENTIVE FEE.

WE WORKED WITH CHARLES TO STRUCTURE AN INCENTIVE BASED PROGRAM WHERE SPECTRA WERE TO HIT SEVERAL ELEVATED MILESTONES THEY WOULD CAREFUL FOR AN INCREASED AMOUNT OF A FEES AND THAT AND OPTION ONE IS CAPPED AT 35% OF THE BASE MANAGEMENT FEE AND OVER THAT FIVE-YEAR PERIOD THEN THE FEE IS CAPPED AT 50% OF THE MANAGEMENT FEE. MY RECOMMENDATION TO THE COURT BASED ON THE FACT THE ITEM HAS GONE OUT SEVERAL TIMES OVER THE LAST DECADE AND IN EACH CASE SPECTRA HAS BEEN THE ONLY BIDDER AND IN THE MOST RECENT BID THEY WERE THE ONLY BIDDER.

AND IF THIS IS GOING TO BE THE CASE, OPTION ONE, ALTHOUGH IT HAS A LONG INITIAL TERM PERIOD OF FIVE YEARS, DOES PROVIDE THE COUNTY WITH THE BEST RATE ON THE BASE MANAGEMENT FEE AND INCENTIVE FEE CAP BEING 35% WHICH COULD SAVE US $108,750 OVER THE COURSE OF THE FIRES FIVE YEARS.

IN OPTION TWO THE THREE-YEAR WE DON'T HAVE THE CAP THAT IS UP
